Res. 31317-2026 Sala Constitucional · Sala Constitucional · 13/08/2026
OutcomeResultado
The Chamber summarily rejected the amparo because enforcement of the agrarian judgment falls to the court that issued it.La Sala rechazó de plano el amparo porque la ejecución de la sentencia agraria corresponde al órgano jurisdiccional que la dictó.
SummaryResumen
The applicant alleged that the Municipality of Limón and the Costa Rican Electricity Institute had failed to comply with an agrarian judgment ordering the removal of dangerous trees, one of which fell onto the applicant’s home. The Constitutional Chamber (Sala Constitucional) determined that the amparo sought enforcement of a ruling issued by another court, a matter for the court that issued it. It therefore summarily rejected the application as inadmissible and stated that the applicant could ask the Agrarian Court to enforce its ruling. The tree-related risk and alleged noncompliance are presented as the applicant’s assertions; the Chamber did not determine whether they were true or order measures to enforce the agrarian judgment.

In this case, the relief sought in this amparo concerns the enforcement or compliance with judicial rulings issued by other Courts of Justice of the Republic—Article 153 of the Political Constitution—which is not a matter for this Chamber to hear, particularly since every judicial body has the authority to enforce its rulings and orders. The applicant may therefore, if they wish, apply to the judicial body that issued the ruling so that it may, in exercising its powers, take whatever action the law requires to enforce what was decided. Accordingly, this application is inadmissible, and so it is declared. Therefore: The application is summarily rejected.

CASE FILE No. 26-028156-0007-CO PROCEEDING: AMPARO APPLICATION RULING No. 2026031317 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 13 August 2026.
Amparo application filed by Nombre02, identity card CED01, against the INSTITUTO COSTARRICENSE DE ELECTIRICIDAD (ICE) and the MUNICIPALIDAD DE LIMÓN.
Background:
Drafted by Justice Castillo Víquez; and, Reasons:
The applicant alleges that, after 7 months, judgment 2025000674 issued by the Agrarian Court in case file 25-000274-0465-AG has still not been complied with. That judgment concerns the felling of trees that endanger the applicant’s home.
In this case, the relief sought in this amparo concerns the enforcement or compliance with judicial rulings issued by other Courts of Justice of the Republic—Article 153 of the Political Constitution—which is not a matter for this Chamber to hear, particularly since every judicial body has the authority to enforce its rulings and ensure compliance with its orders. The applicant must therefore, if they so wish, apply to the judicial body that issued the ruling so that it may, in exercise of its powers, order whatever is appropriate in law to enforce what was decided. Accordingly, this application is inadmissible, and that is hereby declared.
The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve those items from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judicial Branch,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judicial Branch at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The application is summarily dismissed.
