Amparo application filed by Nombre01, identity card CED01, against THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.

BACKGROUND:

  1. 1In a submission added to the Chamber’s digital case file on 4 August 2026, the applicant files an amparo application against the Costa Rican Institute of Aqueducts and Sewers and states that she is a user of the drinking water service installed in her home located in Lomas de Ayarco Sur, Curridabat. She notes that only two people live in the home. She states that water consumption is concentrated in the morning and before lunch, while maintaining consistent water-saving habits. She indicates that laundry is done approximately every fifteen days and that no commercial or other activity that would justify extraordinarily high consumption takes place on the property. She adds that, since January 2026, significant differences have appeared in the consumption and amounts billed by the Costa Rican Institute of Aqueducts and Sewers, which do not correspond to the number of occupants in the home, the historical consumption pattern, or ordinary usage habits.She indicates that the bills show pronounced fluctuations in recorded consumption, from 54 m in March to 84 m in April, then decreasing to 43 m in May and rising again to 71 m in June and 78 m in July 2026. She mentions that the amounts billed varied significantly during that period. She maintains that some of the billed consumption did not arise from physical readings directly verified at the meter and that the Costa Rican Institute of Aqueducts and Sewers has not explained the method used to make those estimates or how they were later reconciled with an actual reading. She states that she has appeared repeatedly at the Costa Rican Institute of Aqueducts and Sewers branch in Guadalupe and has made numerous telephone inquiries to the customer service center, requesting a review of the bills, an inspection of the meter, and a technical explanation of the situation. She adds that the customer service agents have not provided her with a solution or a clear, written, complete, and duly reasoned response.She states that they have only told her that they cannot do anything, without informing her of a technical inspection, a meter accuracy test, or a formal decision. She complains that, as of the date this application was filed, she is still awaiting a report showing that the meter is working properly, that readings were taken correctly, or that the billed consumption actually occurred at the home; moreover, she has not been given a definite date for inspecting or replacing the meter. In light of the foregoing, she requests the intervention of this Chamber.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to reject outright or on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is simply a reiteration or reproduction of an earlier identical or similar application that was rejected.

Justice Castillo Víquez writes; and, REASONS:

I. SUBJECT OF THE AMPARO

The applicant is dissatisfied with the amounts charged by the Costa Rican Institute of Aqueducts and Sewers for drinking water service. She also requests an order directing the respondent authority to answer her inquiries and conduct the corresponding technical inspection.

II. INADMISSIBILITY OF THE APPLICATION

REGARDING THE APPLICANT’S DISAGREEMENT WITH THE AMOUNT CHARGED FOR CONSUMPTION OR THE BILLING FOR A PUBLIC SERVICE. This Court has ruled that a dispute over the amount of a bill for drinking water service is not heard in this forum. This is a matter of legality that must be raised before the same administrative body and, eventually, in the ordinary courts. Among other decisions, in Judgment No. 2018-017559, issued at 10:10 on 23 October 2018, it stated the following:

“…The applicant complains about the high charges on the water service bill she has received. She says she is a single woman of limited means and has observed that the amount payable shown on the water bill varies excessively, even though the supply serves only a few people and the amount charged is unjustified. She explains that staff of the respondent administration have already come to inspect, but have provided no solutions. However, this Chamber is not a reviewer of the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, under the applicable law, whether there is a leak on the property or to determine the source of the charge, nor to establish the correct amount payable for the service received, since that is a task for the ordinary administrative and judicial channels. Accordingly, if the applicant considers it appropriate, she may bring her disagreement or complaint before the same respondent authority or before the competent judicial forum, where she may fully debate the merits of the matter and assert her claims. Therefore, this application is inadmissible, and so it is declared…” These considerations apply to the case under review, since this Court finds no reason to depart from the criterion set out in those judgments, nor any grounds to assess the situation presented differently.

III. THE SPECIFIC CASE

The purpose of an amparo proceeding is to provide timely protection, with restitutive effects, against violations or threats to fundamental rights and freedoms. Its admissibility is therefore generally conditional not only on establishing the existence of a disturbance—or threat thereof—to one or more of the rights or guarantees set forth in the Constitution, or of a fundamental nature under international human rights instruments signed and duly incorporated into the legal system, but also on the alleged harm constituting a direct and gross threat to or breach of those rights. For the foregoing reasons, the applicant must be advised that it is not for this Court to determine whether the charges made by the respondent institution are proper under the regulations governing the matter. Accordingly, if the applicant disagrees with the charges made by the Costa Rican Institute of Aqueducts and Sewers, she may, if she so wishes, present her arguments to that authority for a decision as provided by law.

Nor is it for this Court to issue an order directing that authority to conduct a technical inspection or perform accuracy tests such as those requested by the applicant. Note that, in substance, the disagreement concerns the responses issued by the respondent authority. Furthermore, no violation of access to a public service is apparent, since the complaint concerns a discrepancy with the amount billed for drinking water service, while the fact remains that the applicant continues to receive that service at the property to which she refers. In light of the foregoing, the application is inadmissible.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that any paper documents they may have submitted, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be collected from the office within a maximum period of thirty business days, counted from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at Session No. 27-11, on 22 August 2011, Article XXVI, and published in the Boletín Judicial No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.

THEREFORE:

The amparo application is rejected outright.

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

RESULTANDO:

  1. 1Por escrito agregado al expediente digital de la Sala el 4 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados, y manifiesta que es usuaria del servicio de agua potable instalado en su vivienda ubicada en Lomas de Ayarco Sur, Curridabat. Señala que en la vivienda habitan únicamente dos personas. Afirma que el consumo de agua se concentra en horas de la mañana y antes del almuerzo, manteniendo hábitos constantes de ahorro. Indica que el lavado de ropa se realiza aproximadamente cada quince días y que en el inmueble no se desarrolla actividad comercial ni ninguna otra actividad que justifique consumos extraordinariamente elevados. Agrega que, desde enero de 2026, se han presentado diferencias significativas en los consumos y montos facturados por el Instituto Costarricense de Acueductos y Alcantarillados que no guardan relación con la cantidad de habitantes de la vivienda, el patrón histórico de consumo ni los hábitos ordinarios de uso.Indica que las facturas reflejan fluctuaciones pronunciadas en los consumos registrados, pasando de 54 m en marzo a 84 m en abril, disminuyendo posteriormente a 43 m en mayo y aumentando nuevamente a 71 m en junio y 78 m en julio de 2026. Menciona que los montos facturados experimentaron variaciones importantes durante ese período. Sostiene que parte de los consumos facturados no se originó en lecturas físicas verificadas directamente en el medidor y que el Instituto Costarricense de Acueductos y Alcantarillados no le ha explicado el método utilizado para realizar dichas estimaciones ni la forma en que estas fueron conciliadas posteriormente con una lectura real. Afirma que se ha presentado en reiteradas ocasiones ante la sucursal del Instituto Costarricense de Acueductos y Alcantarillados en Guadalupe y que ha realizado numerosas gestiones telefónicas ante el centro de atención al cliente, solicitando la revisión de las facturas, la inspección del medidor y una explicación técnica de la situación planteada.Agrega que que los agentes de servicio al cliente no le han brindado una solución ni una respuesta clara, escrita, completa y debidamente fundamentada. Afirma que únicamente le han indicado que no pueden hacer nada, sin informarle sobre una inspección técnica, una prueba de precisión del medidor o una resolución formal. Reclama que, a la fecha de interposición de este recurso, continúa a la espera de un informe que demuestre el correcto funcionamiento del medidor, que las lecturas fueron tomadas adecuadamente o que los consumos facturados efectivamente se produjeron en la vivienda, además o se le ha comunicado una fecha cierta para inspeccionar o sustituir el medidor. Por lo expuesto, solicita la intervención de esta Sala.
  2. 2El artículo 9, de la Ley de la Jurisdicción Constitucional, faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

CONSIDERANDO:

I. OBJETO DEL AMPARO

La parte recurrente se encuentra inconforme con los montos cobros por el Instituto Costarricense de Acueductos y Alcantarillados, por el servicio de agua potable. Además, solicita se le ordene a la autoridad recurrida brindarle respuesta a sus gestiones y realizar una inspección técnica correspondiente.

II. NADMISIBILIDAD DEL RECURSO

SOBRE LA DISCONFORMIDAD DE LA PARTE RECURRENTE CON EL MONTO POR CONSUMO O LA FACTURACIÓN DE UN SERVICIO PÚBLICO. Este Tribunal ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la Sentencia N° 2018-017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:

“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara…”.

Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dichas sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada.

III. SOBRE EL CASO CONCRETO

La finalidad del recurso de amparo es brindar tutela oportuna, con efectos restitutivos, contra infracciones o amenazas a los derechos y libertades fundamentales, por lo que su procedencia, en general, está condicionada, no sólo a que se acredite la existencia de una turbación —o amenaza de ésta— a uno o más de los derechos o garantías contemplados en la Carta Política, o los de carácter fundamental establecidos en los instrumentos internacionales de derechos humanos suscritos y debidamente incorporados al ordenamiento jurídico, sino también a que el agravio alegado comporte una amenaza o quebranto directo y grosero de aquellos derechos. Por lo anterior, es menester indicar a la amparada que no le corresponde a este Tribunal determinar la procedencia de los cobros realizados por la institución recurrida, de conformidad a la normativa que rige la materia. Por ello, si la amparada se encuentra disconforme con los cobros realizados por el Instituto Costarricense de Acueductos y Alcantarillados, podrá, si a bien lo tiene, presentar sus alegatos ante la propia recurrida, para que se resuelva lo que en derecho corresponda.

Tampoco le corresponde a este Tribunal emitir una orden para que dicha autoridad proceda a realizar una inspección técnica, o bien, que realicen pruebas de precisión tales como las solicitadas por la parte recurrente. Nótese que en el fondo existe una inconformidad con las respuestas emitidas por la autoridad recurrida. Por otra parte, no se desprende una lesión al acceso a un servicio público, pues lo que se acusa es la discrepancia con el monto facturado por el servicio de agua potable, pero lo cierto es que la parte accionante mantiene el suministro de ese servicio en el inmueble a que hace referencia. Dicho lo anterior, el recurso resulta inadmisible.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se rechaza de plano el recurso.
