Amparo proceeding filed by Nombre02, identity card CED02, on behalf of Nombre03, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
Background:
Justice Cruz Castro drafted the decision; and, Reasons:
The petitioner states that the beneficiary has always had access to drinking water without significant difficulty and has even been assigned NIS 5349625. The petitioner indicates that recently, due to the needs of his growing family, the beneficiary requires a new drinking-water connection, but the respondent authorities told him that water is currently unavailable in the area and that the amount of water is low. The petitioner states that on 05 May 2026, the beneficiary appeared to request a certificate of existing services to establish whether there is water capacity in that area. The petitioner recounts that he has received no response to his request. Nor does it appear that the respondent had any problem or difficulty processing it, since a message was sent to the notification email address ...01 stating: “AYA informs you that the Certificate of Existing Drinking-Water Service with inventoried flow and/or sanitary sewer service with inventoried flow and/or sanitary sewer service, NIS: 5349625, is being processed.” The petitioner complains that disproportionate amounts of time have elapsed and deadlines have passed before the beneficiary, who is an older adult, could obtain the document duly requested from the institution, thereby violating his fundamental rights.
The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent authority failed to address them, as provided in the initial order:
1. The beneficiary submitted a request for service availability to the Costa Rican Institute of Aqueducts and Sewers (AyA), entered into the Integrated System for Managing Availability and Developments (SIGDD) on 08 April 2026 under request number 2026-00008154-1, concerning property folio registration No. PRN01, located in San Pablo district, San Pablo canton, Heredia province, according to cadastral plan No. H-0113704-1993. 2. AyA denied the request for drinking-water service availability, having determined that the existing production and distribution infrastructure in the sector is insufficient to serve additional development, since the property is within system ME-A-15 San Pablo of the AyA Metropolitan Aqueduct, identified as a system with deficient water and hydraulic capacity. (See electronic record).
3. AyA reported that there is no technical feasibility for granting additional drinking-water availability to the property and that the sanitary sewer system is also unavailable for new connections in the area. (See electronic record).
4. The service-availability request was completed on 29 April 2026 and communicated to the applicant by email, informing him of the decision, the applicable remedies, and the statutory period for filing them. (See electronic record).
5. No remedy was filed within the period granted by the Administration to challenge AyA’s denial of availability. (See electronic record).
6. AyA based its denial on technical criteria concerning the current capacity of the supply system, stating that system ME-A-15 San Pablo went from having an approximate capacity of 3.1 liters per second to a deficient status of -1.4 liters per second, according to the institution’s technical information. 7. The property currently has drinking-water service registered with AyA under Service Identification Number (NIS) 5349625 in the name of Nombre03, corresponding to a metropolitan residential rate, without sanitary sewer service, and the account is current on its payment obligations. (See electronic record).
8. AyA issued a certificate of existing service under consecutive UEN-SCCAT-GAM-2026-01890, dated 29 May 2026, certifying the existence of drinking-water service associated with the property registered under folio registration No. PRN03, according to cadastral plan No. H-0113704-1993. (See electronic record).
9. The certificate of existing service issued by AyA was granted solely to certify the current conditions of the registered service. It does not constitute additional drinking-water availability, authorize flow increases or changes in use, or provide additional services to the property. (See electronic record).
10. The beneficiary submitted a request for a certificate of existing service at the San Pablo de Heredia Commercial Agency on 5 May 2026. It was processed using the institutional CRM tool and transferred to the Cadastral Survey area for handling. (See electronic record).
11. The requested certificate of existing service was resolved under consecutive UEN-SCCAT-GAM-2026-01890 and notified to the applicant on 2 June 2026 at the email address indicated in the request. (See electronic record).
12. AyA stated that the denial of additional drinking-water availability is based on technical and regulatory criteria concerning the supply system’s actual capacity, in accordance with the applicable Regulation on the Provision of Aqueduct, Sanitary Sewer, and Hydrant Services. In this matter, the petitioner alleges a violation of the beneficiary’s fundamental rights, particularly the right to petition and timely access to administrative information, because he claims that, despite having requested a certificate of existing drinking-water service from the Costa Rican Institute of Aqueducts and Sewers (AyA), he did not receive a response within a reasonable period. He also challenges the statement that drinking water is unavailable in the area, despite the property currently having an active service identified by NIS 5349625. In this specific case, the evidence incorporated into the file shows that the beneficiary submitted a request for a certificate of existing service to AyA on 5 May 2026, and that the request was received, registered, and transferred for the corresponding processing. The record also shows that the request was handled under consecutive UEN-SCCAT-GAM-2026-01890, dated 29 May 2026, and notified to the beneficiary on 2 June 2026 through the channel indicated for receiving communications.
Thus, contrary to the petitioner’s allegations, there is no evidence of an absolute omission by the respondent authority or an unjustified refusal to provide the requested information, since the institution issued the requested certificate and communicated its result to the interested party. Consequently, because the request for delivery of the document has been satisfied, there is no current violation of the fundamental right invoked.
As for the claim concerning the denial of additional drinking-water availability, the Constitutional Chamber has recognized that access to drinking water is a fundamental right. However, this does not mean that institutions responsible for providing the service must authorize additional connections without considering the technical conditions and actual capacity of the supply systems. The Administration must act in accordance with the principle of legality and ensure adequate service for the existing population, avoiding authorization of developments that could compromise the availability of the water resource. In this case, it has been established that AyA denied the beneficiary’s request for service availability because the production and distribution infrastructure of system ME-A-15 San Pablo is deficient and lacks sufficient water and hydraulic capacity to meet new demand. According to the respondent authority, that decision was based on technical criteria and regulations applicable to the public aqueduct service.
The record also shows that the property already has active drinking-water service identified by NIS 5349625, corresponding to a metropolitan residential rate, without sanitary sewer service. However, the existence of that service does not mean that availability exists for a new connection, increased flow, or modification of the authorized use, since the certificate issued by AyA only certifies the current conditions of the registered service. In that regard, the challenged decision was not arbitrary or without grounds, but resulted from a technical assessment of the supply system’s capacity, carried out within the respondent institution’s sphere of competence. The record also shows that the decision was communicated to the beneficiary and that no remedy was filed within the period granted to challenge it. Consequently, given that AyA handled the beneficiary’s request and that the denial of additional drinking-water availability is supported by technical and regulatory criteria, no violation of the alleged fundamental rights is evident. Accordingly, the amparo proceeding must be dismissed, as is hereby ordered.
The petitioner is advised that, if any paper document or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device were submitted, they must be collected from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is dismissed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .
Recurso de amparo interpuesto Nombre02, cédula de identidad CED02, a favor de Nombre03, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
Señala la parte recurrente que el amparado siempre ha tenido acceso al agua potable sin mayor inconveniente, incluso, tiene asignado el NIS 5349625. Indica que, recientemente, por necesidades de crecimiento familiar, requiere una nueva conexión de agua potable, pero, las autoridades recurridas, le exponen que en la actualidad no hay disponibilidad de agua en la zona y que la cantidad de agua es poca. Manifiesta que el amparado, el 05 de mayo de 2026, se apersonó a solicitar una constancia de servicios existentes para establecer que si hay capacidad hídrica en dicha zona. Narra que no ha obtenido respuesta a su solicitud. Incluso no se observa que el recurrido tuviera alguna clase de problema o inconveniente con la gestión pues enviaron al correo para notificaciones ...01, un mensaje que expresaba lo siguiente: “AYA le informa que la Constancia de Servicio existente de agua potable con caudal inventariado y/o de alcantarillado sanitario con caudal inventariado y/o de alcantarillado sanitario, NIS: 5349625, se encuentra en trámite”. Reclama que han transcurrido tiempo y plazos desproporcionados para que el amparado, que es un adulto mayor, pueda tener acceso al documento oportunamente gestionado ante la institución, violentando así sus derechos fundamentales.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
1. El amparado presentó una solicitud de disponibilidad de servicios ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA), ingresada al Sistema Integrado para Gestión de Disponibilidades y Desarrollos (SIGDD) el día 08 de abril de 2026, bajo el número de gestión 2026-00008154-1, respecto de la finca matrícula N.° PRN01, ubicada en el distrito San Pablo, cantón San Pablo, provincia de Heredia, según plano catastrado N.° H-0113704-1993. (Ver registro electrónico).
2. La solicitud de disponibilidad de servicio de agua potable fue resuelta de forma negativa por el AyA, al determinarse que la infraestructura de producción y distribución existente en el sector resulta insuficiente para atender un desarrollo adicional, al encontrarse la propiedad dentro del sistema ME-A-15 San Pablo del Acueducto Metropolitano AyA, identificado como un sistema con capacidad hídrica e hidráulica deficitaria. (Ver registro electrónico).
3. El AyA informó que no existe factibilidad técnica para otorgar disponibilidad adicional de agua potable para la propiedad y que tampoco existe disponibilidad del sistema de alcantarillado sanitario para nuevas conexiones en la zona. (Ver registro electrónico).
4. La gestión de disponibilidad de servicio fue finalizada el 29 de abril de 2026 y comunicada al gestionante mediante correo electrónico, indicándole la resolución adoptada, así como los recursos procedentes y el plazo legal para su interposición. (Ver registro electrónico).
5. Dentro del plazo otorgado por la Administración, no se presentó recurso alguno contra la denegatoria de disponibilidad emitida por el AyA. (Ver registro electrónico).
6. El AyA fundamentó la denegatoria en criterios técnicos relacionados con la capacidad actual del sistema de abastecimiento, indicando que el sistema ME-A-15 San Pablo pasó de contar con una capacidad aproximada de 3,1 litros por segundo a presentar una condición deficitaria de -1,4 litros por segundo, según la información técnica institucional. 7. El inmueble cuenta actualmente con un servicio de agua potable registrado ante el AyA bajo el Número de Identificación de Servicio (NIS) 5349625, a nombre de Nombre03, correspondiente a una tarifa residencial metropolitana, sin servicio de alcantarillado sanitario, encontrándose dicho servicio al día en sus obligaciones de pago. 8. El AyA emitió constancia de servicio existente mediante consecutivo UEN-SCCAT-GAM-2026-01890, de fecha 29 de mayo de 2026, en la cual se hizo constar la existencia del servicio de agua potable asociado al inmueble inscrito bajo la matrícula N.° PRN03, según plano catastrado N.° H-0113704-1993. (Ver registro electrónico).
9. La constancia de servicio existente emitida por el AyA fue otorgada únicamente para acreditar las condiciones actuales del servicio registrado y no constituye una disponibilidad de agua potable adicional, ni autoriza aumentos de caudal, cambios de uso o la prestación de servicios adicionales para el inmueble. (Ver registro electrónico).
10. El amparado presentó una solicitud de constancia de servicio existente ante la Agencia Comercial de San Pablo de Heredia el día 5 de mayo de 2026, la cual fue tramitada mediante la herramienta institucional CRM y trasladada al área de Levantamiento Catastral para su atención. (Ver registro electrónico).
11. La constancia de servicio existente solicitada fue resuelta mediante consecutivo UEN-SCCAT-GAM-2026-01890 y notificada al gestionante el 2 de junio de 2026 al correo electrónico señalado en la solicitud. (Ver registro electrónico).
12. El AyA indicó que la denegatoria de disponibilidad adicional de agua potable responde a criterios técnicos y normativos relacionados con la capacidad real del sistema de abastecimiento, de conformidad con el Reglamento para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes aplicable. En el presente asunto, la parte recurrente reclama la supuesta lesión a los derechos fundamentales del amparado, en particular, el derecho de petición y el acceso oportuno a la información administrativa, debido a que afirma que, pese a haber solicitado una constancia de servicio existente de agua potable ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA), no habría recibido respuesta dentro de un plazo razonable. Asimismo, cuestiona que se le haya indicado la inexistencia de disponibilidad de agua potable en la zona, pese a que el inmueble cuenta actualmente con un servicio activo identificado con el NIS 5349625. En el caso concreto, de los elementos probatorios incorporados al expediente se desprende que el amparado presentó ante el AyA una solicitud de constancia de servicio existente el 5 de mayo de 2026, gestión que fue recibida, registrada y trasladada para su trámite correspondiente.
Asimismo, consta que dicha solicitud fue atendida mediante el consecutivo UEN-SCCAT-GAM-2026-01890, de fecha 29 de mayo de 2026, y notificada al amparado el 2 de junio de 2026 al medio señalado para recibir comunicaciones. De esta forma, contrario a lo alegado por la parte recurrente, no se acredita una omisión absoluta por parte de la autoridad recurrida ni una negativa injustificada a brindar la información solicitada, toda vez que la institución emitió la constancia requerida y comunicó su resultado al interesado. En consecuencia, al haberse satisfecho la pretensión relacionada con la entrega del documento solicitado, no se observa una lesión actual al derecho fundamental invocado. Ahora bien, en cuanto al reclamo relacionado con la negativa de disponibilidad adicional de agua potable, debe indicarse que la Sala Constitucional ha reconocido que el acceso al agua potable constituye un derecho fundamental; sin embargo, ello no implica que las instituciones encargadas de la prestación del servicio deban autorizar conexiones adicionales sin considerar las condiciones técnicas y la capacidad real de los sistemas de abastecimiento.
La Administración debe actuar conforme al principio de legalidad y garantizar la adecuada prestación del servicio a la población existente, evitando autorizar desarrollos que puedan comprometer la disponibilidad del recurso hídrico. En este caso, se encuentra acreditado que el AyA resolvió negativamente la solicitud de disponibilidad de servicio presentada por el amparado, debido a que la infraestructura de producción y distribución del sistema ME-A-15 San Pablo presenta una condición deficitaria, al no contar con capacidad hídrica e hidráulica suficiente para atender nuevas demandas. Según lo informado por la autoridad recurrida, dicha decisión se fundamentó en criterios técnicos y en la normativa aplicable al servicio público de acueducto. Asimismo, consta que el inmueble ya cuenta con un servicio activo de agua potable identificado con el NIS 5349625, correspondiente a una tarifa residencial metropolitana, sin servicio de alcantarillado sanitario.
No obstante, la existencia de dicho servicio no implica que exista disponibilidad para una nueva conexión, aumento de caudal o modificación del uso autorizado, pues la constancia emitida por el AyA únicamente acredita las condiciones actuales del servicio registrado. En ese sentido, la decisión cuestionada no obedece a una actuación arbitraria o carente de fundamento, sino a una valoración técnica sobre la capacidad del sistema de abastecimiento, realizada dentro del ámbito de competencia de la institución recurrida. Además, consta que la resolución fue comunicada al amparado y que no se interpuso recurso alguno dentro del plazo conferido para cuestionar dicha decisión. En consecuencia, al haberse acreditado que el AyA atendió la gestión planteada por el amparado y que la denegatoria de disponibilidad adicional de agua potable encuentra sustento en criterios técnicos y normativos, no se observa vulneración alguna a los derechos fundamentales alegados. Por lo anterior, procede declarar sin lugar el recurso, como en efecto se dispone.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso.
