Amparo proceeding filed in case No. 26-024483-0007-CO by Nombre01, identity card No. CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AYA).
BACKGROUND:
“I.- REGARDING THE FACTS ALLEGED BY THE APPLICANT In response to the matter underlying the amparo application filed by Ms. Nombre01 against the Costa Rican Institute of Aqueducts and Sewers, based on the technical reports prepared by Engineer David Gamboa Mora, an employee of the UEN Customer Service Metering GAM – New Services Feasibility Inspection Area Zone 2, in memorandum No. UEN-SCMED-GAM-2026-01519 dated 29 July 2026 and its annex, and by Licentiate Javier Jiménez Rivas, Commercial Coordinator for GAM Zones 1 and 2, in memorandum No. UEN-SCC-GAM-2026-03166 dated 30 July 2026, both attached as evidence to this report, and considering the scope of the rule set out in the Regulations for the Provision of AyA Services, it is established that:
1. The New Service application was received at the Desamparados Service Center, which entered the application into the system on 13 November 2025 under number B12112025110006, in the name of Nombre01, for the individualization of a drinking water service associated with the property located in San José, Desamparados, San Miguel, 250 meters south of Maxi Palí, former Verdulería (see reports Nos. UEN-SCMED-GAM-2026-01519 and UEN-SCC-GAM-2026-03166).
2. The application in question was received by the Zone 2 Feasibility Inspection Area on 20 November 2025. Verification of compliance with the requirements established in Articles 67 and 68 of the Regulations for the Provision of AyA Services, published in official gazette La Gaceta No. 27, Supplement No. 29 of 9 February 2021, Board of Directors Agreement 2020-0442 and its amendments, began immediately. On 21 November 2025, the file was scheduled for the corresponding feasibility inspection by inspector Olmán Solís Hidalgo of AyA’s UEN Customer Service Metering GAM, New Services and Availability, who stated: ‘Approval is granted for 1 individualization of NIS 3309957 for a residence, at the RESIDENTIAL-HOME tariff, asphalt, with sewerage.’ On 24 November 2025, the Zone 2 Feasibility Inspection Area transferred approved file No. B12112025110006 to the Cadastral Area so it could assess and confirm the corresponding property coding. That same day, the latter unit sent the file, with the corresponding codes, to the Analysis and Review Area. On 27 November 2025 at 10:03, the user was notified by the email ...01 that the requested service had been approved. The service was scheduled and installed on 24 July 2026, and NIS CED01 was assigned to it by service order No. 53213574 (see report No. UEN-SCMED-GAM-2026-01519). In light of the foregoing, it must be clear that AyA’s actions are subject to the Principle of Legality enshrined in Article 11 of our Constitution and the General Law of Public Administration. This principle requires the entire Public Administration to act in accordance with the legal order, as well as the unequivocal rules of science and technology supported by Article 16 of the General Law of Public Administration and the provisions regulated in Articles 7, 8, 9, 67, 68, and 77 of the Regulations for the Provision of AyA Services.
Accordingly, it is important to conclude that the amparo applicant’s request has been duly addressed, and the institution has therefore not violated her fundamental rights. As stated above, the drinking water service was installed on 24 July 2026, even before the institution was notified that this amparo proceeding had been referred to it, and none of this Institute’s actions were capricious, arbitrary, or unfounded.”

In light of the foregoing, and since it has been shown that the facts alleged in this amparo application are not attributable to us and that our actions were correct under the rules governing us, we request that this application be denied, that the case file be ordered archived, and that the Costa Rican Institute of Aqueducts and Sewers be exempted from all liability and from any award of costs, damages, or losses.”

Justice Salazar Alvarado drafts this opinion; and, REASONS:
Before addressing the merits, it should be clarified that, beginning with Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the Public Administration has complied with the time limits set by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, whether to resolve a proceeding by final act—instituted on its own initiative or at a party’s request—or to hear the available administrative remedies. The present case falls within an exception, since it concerns a request for access to drinking water service, protected under Article 50 of the Constitution. Accordingly, given the subject matter, the Chamber reviews possible delays in resolving this type of request. That point having been clarified, the matter will now be resolved.
The applicant states that she owns property No. PRN01 in Desamparados. She explains that she submitted a request to the Costa Rican Institute of Aqueducts and Sewers for a drinking water service connection, but the service has not been activated. She considers that the situation described violates her fundamental rights.
The following relevant facts are considered duly established for purposes of resolving this application:
1. On 13 November 2025, the applicant requested the individualization of a drinking water service from the Costa Rican Institute of Aqueducts and Sewers, and the request was processed under No. B12112025110006, associated with the property located in San José, Desamparados, San Miguel (see the evidence submitted in the record).
2. On 27 November 2025 at 10:03, the user was notified by the email established for that purpose that the requested service had been approved (see the reports submitted by the respondent authorities).
3. The service was scheduled and installed on 24 July 2026, and NIS CED01 was assigned to it by service order No. 53213574 (see the reports submitted by the respondent authorities).
4. On 27 July 2026, notice of the order admitting this proceeding was served on the executive president and the Deputy Manager of Management of the Costa Rican Institute of Aqueducts and Sewers, and on 29 July 2026 on the head of the Desamparados cantonal office (see the proof-of-service records added to the case file).
In light of Article 41 of the Constitution, the Administration is required to guarantee people prompt and effective justice. In the field of administrative justice, this means that it must decide claims brought by members of the public diligently and expeditiously, ensure that its resolution addresses the points alleged, and notify interested parties of its decision, all within a reasonable time. The “reasonableness” of the duration of administrative activity is determined case by case, based on various factors, such as the technical complexity of the administrative matter, the breadth of the evidence to be taken, or the degree to which the challenged act affects a person or the environment. It follows that there is no strict right to constitutional enforcement of time limits; rather, there is a right to constitutional review of administrative actions when there are insufficient grounds to justify the time taken to resolve a particular administrative request.
In this case, it was established that on 13 November 2025, the applicant requested the individualization of a drinking water service from the Costa Rican Institute of Aqueducts and Sewers, and the request was processed under No. B12112025110006, associated with the property located in San José, Desamparados, San Miguel. It was also established that on 27 November 2025 at 10:03, the user was notified by the email established for that purpose that the requested service had been approved. It was further established that the service was scheduled and installed on 24 July 2026, and NIS CED01 was assigned to it by service order No. 53213574. However, since the respondent authorities were notified of the order admitting this proceeding on 27 July 2026, it is clear that the situation described by the applicant was resolved before the intervention of this Constitutional Chamber. Accordingly, the alleged violation of the right to prompt administrative justice is not established, and the application must be dismissed, as is hereby ordered.
I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum, the legal dispute must be heard by the Administrative Litigation Courts, not by this Chamber. However, with the recent enactment of Law No. 9097, Law Regulating the Right to Petition, it has been established that this right is subject to judicial protection through the amparo application established by Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of precedent, since under section 7 of its Act, this Court is exclusively responsible for defining its own jurisdiction.
Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo remedy, in all other cases the competent courts are the judges of the administrative-litigation jurisdiction, for the reasons given by this Court (Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008). This is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the relevant statutory provisions, based on a logical, systematic, and teleological interpretation of the legal order.
The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum of thirty working days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on Electronic Case Files in the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Judiciary’s Superior Council at Session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .
Recurso de amparo que se tramita en expediente N° 26-024483-0007-CO, interpuesto por Nombre01, cédula de identidad N° CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).
RESULTANDO:
“I.- EN CUANTO A LOS HECHOS ALEGADOS POR LA RECURRENTE En atención a la situación objeto del amparo planteado por la señora Nombre01 contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en los informes técnicos elaborados por el Ingeniero David Gamboa Mora, funcionario de la UEN Servicio al Cliente Medición GAM - Área de Inspección de Factibilidad de Nuevos Servicios Zona 2, mediante memorando N°UEN-SCMED-GAM-2026-01519 de fecha 29 de julio del 2026 y su anexo, y el Licenciado Javier Jiménez Rivas, Coordinador Comercial de la Zona 1 y 2 GAM, mediante memorando N°UEN-SCC-GAM-2026-03166 de fecha 30 de julio del 2026, los cuales se adjuntan como prueba de este informe, y el alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda demostrado que:
1. La solicitud de Nuevo Servicio fue recibida en la Plataforma de servicios de Desamparados, la cual ingresa la respectiva solicitud al sistema el 13 de noviembre del 2025 con el número B12112025110006, a nombre de Nombre01 para la individualización de un servicio de Agua Potable, asociado a la propiedad ubicada en San José, Desamparados, San Miguel, 250 metros al sur del Maxi Palí, antigua Verdulería (Ver informes N°UEN-SCMED-GAM-2026-01519 y N°UEN-SCC-GAM-2026-03166).
2. La solicitud en cuestión se recibió en el Área de Inspección de Factibilidad Zona 2, el día 20 de noviembre del 2025; se procedió de inmediato con la verificación de cumplimiento de los requisitos establecidos en los Artículos 67 y 68 del Reglamento de Prestación de los Servicios de AyA, Publicado en el Diario Oficial La Gaceta No. 27, Alcance No. 29 del 9 de febrero de 2021, Acuerdo de la Junta Directiva 2020-0442 y sus modificaciones. El día 21 de noviembre del 2025 se programó el expediente para la inspección de Factibilidad correspondiente a cargo de inspector Olmán Solís Hidalgo de la UEN Servicio al Cliente Medición GAM, Nuevos Servicios y Disponibilidades de AyA, quién indicó: “Se aprueba 1 individualización del NIS 3309957 para vivienda, en tarifa DOMICILIAR-RESIDENCIAL, asfalto, con alcantarillado”. El día 24 de noviembre del 2025, el Área de Inspección de Factibilidad Zona 2 trasladó el expediente aprobado NºB12112025110006, al Área de Catastro, con el fin de que valorara y confirmara la codificación respectiva de la propiedad y en esa misma fecha, esa dependencia remitió el expediente con los códigos correspondientes, al Área de Análisis y Depuración.
En fecha 27 de noviembre del 2025 a las 10:03 horas, se le notificó al usuario la aprobación del servicio solicitado mediante el correo ...01. La programación e instalación del servicio fue ejecutada el 24 de julio del 2026, asignándosele el NIS CED01 mediante orden de servicio N°53213574 (Ver informe N°UEN-SCMED-GAM-2026-01519). Lo anterior se evidencia con las siguientes imágenes:

Artículos 7, 8, 9, 67, 68 y 77 del Reglamento para la prestación de los servicios de AyA, publicado en el Diario Oficial La Gaceta Digital N°27, Alcance N°29, martes 09 de febrero, 2021.
En virtud de lo expuesto, debe tenerse claro que las actuaciones de AyA están sometidas al Principio de Legalidad consagrado en el artículo 11 de nuestra Carta Magna y la Ley General de la Administración Pública; principio que somete a toda la Administración Pública a actuar conforme al ordenamiento jurídico, así como a las reglas unívocas de la ciencia y técnica que respalda el artículo 16 de la Ley General de la Administración Pública y alcances regulados en los artículos 7, 8, 9, 67, 68 y 77 del Reglamento para la Prestación de los Servicios de AyA.
En tal sentido, es importante concluir que la gestión de la amparada ha sido debidamente atendida, por lo que no se han lesionado los derechos fundamentales de la recurrente por parte de la institución, como se indicó supra el servicio de agua potable fue instalado el 24 de julio del 2026, previo incluso, a la fecha en fuera notificada la institución del traslado de este recurso de amparo y ninguna de las actuaciones de este Instituto han sido antojadizas, arbitrarias o infundadas”.
“I.- EN CUANTO A LOS HECHOS ALEGADOS POR LA RECURRENTE En atención a la situación objeto del amparo planteado por la señora Nombre01 contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en los informes técnicos elaborados por el Ingeniero David Gamboa Mora, funcionario de la UEN Servicio al Cliente Medición GAM - Área de Inspección de Factibilidad de Nuevos Servicios Zona 2, mediante memorando N°UEN-SCMED-GAM-2026-01519 de fecha 29 de julio del 2026 y su anexo, y el Licenciado Javier Jiménez Rivas, Coordinador Comercial de la Zona 1 y 2 GAM, mediante memorando N°UEN-SCC-GAM-2026-03166 de fecha 30 de julio del 2026, los cuales se adjuntan como prueba de este informe, y el alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda demostrado que:
1. La solicitud de Nuevo Servicio fue recibida en la Plataforma de servicios de Desamparados, la cual ingresa la respectiva solicitud al sistema el 13 de noviembre del 2025 con el número B12112025110006, a nombre de Nombre01 para la individualización de un servicio de Agua Potable, asociado a la propiedad ubicada en San José, Desamparados, San Miguel, 250 metros al sur del Maxi Palí, antigua Verdulería (Ver informes N°UEN-SCMED-GAM-2026-01519 y N°UEN-SCC-GAM-2026-03166).
2. La solicitud en cuestión se recibió en el Área de Inspección de Factibilidad Zona 2, el día 20 de noviembre del 2025; se procedió de inmediato con la verificación de cumplimiento de los requisitos establecidos en los Artículos 67 y 68 del Reglamento de Prestación de los Servicios de AyA, Publicado en el Diario Oficial La Gaceta No. 27, Alcance No. 29 del 9 de febrero de 2021, Acuerdo de la Junta Directiva 2020-0442 y sus modificaciones. El día 21 de noviembre del 2025 se programó el expediente para la inspección de Factibilidad correspondiente a cargo de inspector Olmán Solís Hidalgo de la UEN Servicio al Cliente Medición GAM, Nuevos Servicios y Disponibilidades de AyA, quién indicó: “Se aprueba 1 individualización del NIS 3309957 para vivienda, en tarifa DOMICILIAR-RESIDENCIAL, asfalto, con alcantarillado”. El día 24 de noviembre del 2025, el Área de Inspección de Factibilidad Zona 2 trasladó el expediente aprobado NºB12112025110006, al Área de Catastro, con el fin de que valorara y confirmara la codificación respectiva de la propiedad y en esa misma fecha, esa dependencia remitió el expediente con los códigos correspondientes, al Área de Análisis y Depuración.
En fecha 27 de noviembre del 2025 a las 10:03 horas, se le notificó al usuario la aprobación del servicio solicitado mediante el correo ...01. La programación e instalación del servicio fue ejecutada el 24 de julio del 2026, asignándosele el NIS CED01 mediante orden de servicio N°53213574 (Ver informe N°UEN-SCMED-GAM-2026-01519). Lo anterior se evidencia con las siguientes imágenes:

Artículos 7, 8, 9, 67, 68 y 77 del Reglamento para la prestación de los servicios de AyA, publicado en el Diario Oficial La Gaceta Digital N°27, Alcance N°29, martes 09 de febrero, 2021.
En virtud de lo expuesto, debe tenerse claro que las actuaciones de AyA están sometidas al Principio de Legalidad consagrado en el artículo 11 de nuestra Carta Magna y la Ley General de la Administración Pública; principio que somete a toda la Administración Pública a actuar conforme al ordenamiento jurídico, así como a las reglas unívocas de la ciencia y técnica que respalda el artículo 16 de la Ley General de la Administración Pública y alcances regulados en los artículos 7, 8, 9, 67, 68 y 77 del Reglamento para la Prestación de los Servicios de AyA.
En tal sentido, es importante concluir que la gestión de la amparada ha sido debidamente atendida, por lo que no se han lesionado los derechos fundamentales de la recurrente por parte de la institución, como se indicó supra el servicio de agua potable fue instalado el 24 de julio del 2026, previo incluso, a la fecha en fuera notificada la institución del traslado de este recurso de amparo y ninguna de las actuaciones de este Instituto han sido antojadizas, arbitrarias o infundadas.
La misma se adjunta en informe separado presentado por la Presidenta Ejecutiva de este Instituto Ingeniera Lourdes Sáurez Barboza.
Por lo antes expuesto y debido a demostrarse que los hechos alegados, mediante este Recurso de Amparo, no son imputables a nuestra responsabilidad y que nuestras actuaciones han sido las correctas, de conformidad con la normativa que nos rige, solicitamos se declare sin lugar el presente recurso, se ordene archivar el expediente y se exima de toda responsabilidad, así como de toda condenatoria en costas, daños y perjuicios al Instituto Costarricense de Acueductos y Alcantarillados”.

Por lo antes expuesto y debido a demostrarse que los hechos alegados, mediante este Recurso de Amparo, no son imputables a nuestra responsabilidad y que nuestras actuaciones han sido las correctas, de conformidad con la normativa que nos rige, solicitamos se declare sin lugar el presente recurso, se ordene archivar el expediente y se exima de toda responsabilidad, así como de toda condenatoria en costas, daños y perjuicios al Instituto Costarricense de Acueductos y Alcantarillados”.
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
Antes de analizar el fondo del asunto debe aclararse que, a partir de la Sentencia N° 2008-02545, de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el caso concreto se plantea un supuesto de excepción, pues se está ante una solicitud de acceso al servicio de agua potable, resguardado por el artículo 50, de la Constitución Política por lo que, atendiendo a esta materia, la Sala valora las posibles dilaciones en la resolución de este tipo de solicitudes. Aclarado el punto, se entra a resolver la situación.
La recurrente asegura que es propietaria del inmueble N° PRN01 ubicado en Desamparados. Explica, que presentó una solicitud para la conexión de un servicio de agua potable ante el Instituto Costarricense de Acueductos y Alcantarillados; pero no se le ha habilitado el servicio. Considera que la situación descrita vulnera sus derechos fundamentales.
De importancia para la resolución del presente recurso, se estiman como debidamente demostrados los siguientes hechos de relevancia:
1. El 13 de noviembre de 2025, la recurrente solicitó la individualización de un servicio de agua potable ante el Instituto Costarricense de Acueductos y Alcantarillados y se tramitó bajo el B12112025110006, asociado a la propiedad ubicada en San José, Desamparados, San Miguel (véase al respecto la prueba aportada en autos).
2. El 27 de noviembre del 2025 a las 10:03 horas, se le notificó a la usuaria la aprobación del servicio solicitado mediante el correo establecido para tales fines (véanse al respecto los informes rendidos por las autoridades recurridas).
3. La programación e instalación del servicio fue ejecutada el 24 de julio del 2026, asignándosele el NIS CED01 mediante orden de servicio N°53213574 (véanse al respecto los informes rendidos por las autoridades recurridas).
4. El 27 de julio de 2026, se le notificó la resolución de curso de este proceso al presidente ejecutivo y al subgerente de Gestión del del Instituto Costarricense de Acueductos y Alcantarillados y, a la jefa de la oficina cantonal de Desamparados el 29 de julio de 2026 (véanse al respecto las actas de notificación agregadas en autos).
La Administración, a la luz del artículo 41, de la Constitución Política, tiene la obligación de garantizar a las personas el cumplimiento de la justicia pronta y cumplida, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicar a los interesados lo dispuesto, todo ello dentro de un plazo razonable. En este sentido, el carácter "razonable" de la duración de la actividad administrativa se determina, casuísticamente, con base en diversos elementos, tales como: la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino, más bien, un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.
En este caso, se acreditó que el 13 de noviembre de 2025, la recurrente solicitó la individualización de un servicio de agua potable ante el Instituto Costarricense de Acueductos y Alcantarillados y se tramitó bajo el B12112025110006, asociado a la propiedad ubicada en San José, Desamparados, San Miguel. Además, que el 27 de noviembre del 2025 a las 10:03 horas, se le notificó a la usuaria la aprobación del servicio solicitado mediante el correo establecido para tales. También, que la programación e instalación del servicio fue ejecutada el 24 de julio del 2026, asignándosele el NIS CED01 mediante orden de servicio N°53213574. Ahora bien, en vista de que la resolución de curso de este proceso se les notificó a las autoridades recurridas el 27 de julio de 2026, es claro que la situación expuesta por la recurrente se solucionó antes de la intervención de esta Sala Constitucional. En consecuencia, se descarta la acusada violación del derecho a una justicia administrativa pronta y corresponde desestimar el recurso, como en efecto se dispone.
vI.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
