Amparo application filed by Nombre02, identity card CED01, against the MUNICIPALITY OF PARAÍSO.
Background:
“[O]n 3 March 2026, he filed a formal request addressed to the Municipal Council, by which he requested the following: ‘I. ADMINISTRATIVE FILE IN SICOP 1. Number of the file processed in SICOP. 2. Terms of reference. 3. Costs of the commissioned study. 4. Commissioned technical studies. 5. Structural and hydraulic calculation records. 6. Risk analyses. 7. Technical opinions. 8. Recommendations from external advisers. The foregoing is intended to analyze the technical completeness of the project’s supporting basis. II. KNOWLEDGE AND ASSESSMENT OF PRE-EXISTING TECHNICAL INFORMATION I request that the Council expressly state: 1. Whether it knew of the existence of construction plans and as-built plans for the channel, corresponding to works carried out under the community bond program managed by the Costa Rica–Canada Foundation. 2. Whether it knew of prior technical studies conducted with the participation of the University of Costa Rica and the Costa Rica Institute of Technology. 3. Whether those materials were formally considered as the baseline for the current design. If not, what technical criterion justified omitting that information. III. HEALTH ASSESSMENT AND INTERINSTITUTIONAL CONSULTATION I request an indication as to whether the Council verified that the project had: 1. A formal consultation with, or technical opinion from, the Ministry of Health. 2. An assessment of the health impact resulting from the change from an open to a closed hydraulic condition. 3. An assessment of risks from gas accumulation. 4. Modeling of forced or passive ventilation. 5. Also, whether those assessments were presented to the public before the closure was publicized as a solution. IV. SIGNIFICANT TECHNICAL RISKS ASSOCIATED WITH THE CLOSURE I request confirmation that the following aspects were technically evaluated: A) Gas generation and public health In systems receiving organic loads, the transition from an open channel to a closed conduit favors anaerobic conditions, generating: o Hydrogen sulfide (H₂S). o Methane. o Ammonia. o Please indicate: o Whether concentration modeling was performed. o Whether the location and capacity of vents were determined. o Whether population exposure was assessed. o Whether chronic risks from intermittent emissions were assessed. B) Chemical attack and microbiologically induced corrosion (MIC) In the presence of oxygen, H₂S generates sulfuric acid, which causes: o Progressive loss of the concrete cross-section. o Surface spalling. o Exposure of reinforcing steel. o Reduction of structural service life. Please indicate: o Whether the specified concrete is sulfate-resistant. o Whether a special coating was considered. o Whether the projected deterioration rate was estimated. o Whether there is service-life modeling under actual organic-load conditions. C) Maintenance costs and sustainability Please indicate whether the Council was aware of: o A detailed maintenance plan. o The frequency of sediment cleaning. o Periodic gas monitoring. o Budget projections for 10–20 years. o A closed conduit carrying organic loads is not a passive system. o Its sustainability depends on ongoing maintenance. V. CRITERION OF THE COLLEGIAL BODY I request that the Council expressly state: 1. What technical criterion formed the basis of its endorsement. 2. What specific documents it reviewed. 3. Whether it conducted independent technical consultations. 4. Whether it considered less invasive alternatives. VI. PRESENTATION TO THE PUBLIC Please indicate why the public presentation did not disclose: 1. The associated health risks. 2. Future maintenance costs. 3. Possible structural damage from chemical corrosion. 4. The existence of prior technical studies. 5. And whether the Council considers that the information provided was complete and sufficient for the public to understand all the technical implications. (…)’ Thus, at Ordinary Session No. 119-2026 of 10 March 2026, the Municipal Council considered his request and resolved as follows: ‘(…) AGREEMENT 17: IT IS AGREED unanimously to dispense with the reading procedure and the committee procedure for the aforementioned note. AGREEMENT FINAL AND DEFINITIVELY APPROVED UNANIMOUSLY. (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza). AGREEMENT 18: IT IS AGREED unanimously (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza) to inform Mr. Nombre02 that the Municipal Council has had no involvement in the processing or execution of the aforementioned project; the Council’s only participation in this matter was authorizing an extraordinary budget that included funds for conducting preliminary studies on the channel, but the Municipal Mayor’s Office has issued no communication concerning the commencement and execution of the project itself. The information requested is technical in nature and, therefore, the Municipal Administration is the body that can address each and every matter raised. Accordingly, the request for information is forwarded to the Municipal Mayor for timely action, bearing in mind that this is public information that must be provided within the applicable time limit. The Municipal Mayor is asked to provide the Municipal Council with a copy of the report given to the requester. AGREEMENT FINAL AND DEFINITIVELY APPROVED UNANIMOUSLY. (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza (…)’. Despite the foregoing, he alleges that, as of the date this application was filed, he had received no response to his request” (Sic).
“FIRST: It is true that Mr. Nombre02 submitted a formal request on 3 March 2026 seeking technical and administrative information about the channel construction project. SECOND: It is true that, at Ordinary Session No. 119-2026 of 10 March 2026, the Municipal Council considered the request. By Agreement 18, the Council determined that the information requested was technical in nature and therefore forwarded the request to this Municipal Mayor’s Office for timely action. THIRD: The applicant’s request was not a simple inquiry, but an extremely complex technical specification requiring the compilation, review, and consolidation of SICOP files, terms of reference, technical studies, structural and hydraulic calculation records, health impact analyses, gas modeling, and other elements specific to civil and sanitary engineering. FOURTH: It is absolutely false that, as of that date, the Municipality of Paraíso had failed to respond.
On 26 May 2026, letter MUPA-ALC-CAEN-492-2026 was issued, by which this Mayor’s Office provided a full and substantive response to the request concerning the ‘Paseo Mediterráneo’ Project. FIFTH: On that same date, 26 May 2026, the letter and its technical annexes, prepared by Eng. Óscar Fernández Rodríguez, Acting Head of the UTGV, were duly notified to the applicant. Because of the large size and volume of the requested technical files, a secure WeTransfer link was enabled and sent so that the requester could download the entire file and the commissioned technical studies. II. ON THE MERITS A. The technical complexity of the information and the reasonableness of the response time: Article 27 of the Political Constitution guarantees the right to petition and a prompt response. However, this Honorable Chamber’s abundant case law has repeatedly held that the time limit in Article 32 of the Constitutional Jurisdiction Act is not a fatal and absolute arithmetic deadline; rather, it must be assessed in light of the principles of reasonableness and proportionality, depending on the nature, volume, and complexity of the request.
In this case, the applicant requested an exhaustive engineering compendium that included calculation records, risk assessments for gas accumulation, ventilation modeling, and maintenance projections for 10–20 years. In strict compliance with the principles of objectivity and good faith, the Administration could not issue a terse or improvised response. The Technical Road Management Unit had to consolidate the external advisory studies, opinions, and structural calculations in order to provide an accurate, technical, and complete response. This technical consolidation effort justifies the time elapsed until the documents were effectively delivered through letter MUPA-ALC-CAEN-492-2026. B. Mootness due to satisfaction of the claim outside the proceeding: This amparo application has become moot. Under Article 52 of the Constitutional Jurisdiction Act, the application should be dismissed, or granted solely as to costs, when the facts prompting the amparo have ceased or have been remedied by the respondent authority itself before judgment is issued.
As shown by the evidence attached to this report, the Municipality of Paraíso has fully restored Mr. Nombre02’s right to petition and access information. Letter MUPA-ALC-CAEN-492-2026 has been formally notified, and all technical annexes, studies, costs, and calculation records have been made fully available through a file-transfer platform (WeTransfer), thereby guaranteeing unrestricted access to the public documents generated by the ‘Paseo Mediterráneo’ project. Once the information was delivered, the alleged constitutional injury disappeared entirely.”
“FIRST: After this amparo application was filed, on 26 May 2026 the Municipal Mayor’s Office sent an email: Notice of letter MUPA-ALC-CAEN-492-2026 / Response to information request concerning the ‘Paseo Mediterráneo’ Project: Good afternoon. Following instructions from Eng. Michaell Álvarez Quirós, letter MUPA-ALC-CAEN-492-2026 and its annexes are hereby notified. You may download them using the following WeTransfer link: https://we.tl/t-bzCMxqidx6K0gwsF. The link will be available for three days to complete the download. From my review, I can reliably state that the Municipality of Paraíso sent partial documentation concerning the procurement titled ‘UTGV-006-2025 – Structural and hydraulic engineering services for on-demand road projects.’ That procurement has been used as a preliminary technical basis for the project publicly called ‘Paseo Mediterráneo Comprehensive Project – Closure of the Llanos de Santa Lucía Channel,’ a project institutionally promoted through official publications, social media, and public presentations as a solution to the existing problem in the channel.
SECOND: The documentation provided is partial, fragmented, and insufficient to satisfy the constitutional right of access to public information and effective public oversight of a public intervention with significant urban, health, environmental, and budgetary impact. The information provided is limited primarily to preliminary aspects of structural, hydraulic, and road engineering, omitting precisely the essential technical elements concerning the actual source of the problem historically reported by the community: health and environmental contamination of the channel and the Púcares River. THIRD: The technical study provided by the Municipality itself expressly acknowledges: 1. The existence of wastewater discharges. 2. Improper connections to the sanitary sewer system. 3. Active contamination of the channel. 4. Sedimentation of organic matter. 5. Urban drainage deficiencies. 6. Waste accumulation. 7.
The need for frequent cleaning. 8. Persistent foul odors associated with contamination. The study also acknowledges that the problem is not limited to the channel, but also includes discharges from homes, businesses, and other sources that reach the Púcares River and the stormwater infrastructure. FOURTH: Despite the foregoing, the Municipality continues to promote the project publicly as an urban and landscape intervention, without technically demonstrating how the health and environmental impacts resulting from the progressive closure of a channel originally built to redirect stormwater and convey runoff will be addressed comprehensively. FIFTH: The documentation provided DOES NOT include: 1. Comprehensive health studies. 2. Microbiological characterization of water. 3. Water quality analyses. 4. Sanitary modeling. 5. Studies on gas generation and management. 6. Analysis of anaerobic behavior. 7.
Occupational safety studies. 8. Operational sustainability analysis. 9. Assessment of actual maintenance costs. 10. Scenarios for future urban and industrial growth. 11. Analysis of impacts from increased runoff. 12. Comprehensive environmental assessment. 13. Studies on structural damage from chemical attack on concrete. 14. Comprehensive technical opinions from the Ministry of Health. 15. Assessment of cumulative public health risks. SIXTH: It is particularly concerning that an intervention approximately 990 linear meters long, on an existing channel approximately 4 meters wide and up to 5 meters deep, whose surrounding area continues to face active health problems, is being advanced without sufficient public evidence of comprehensive studies commensurate with the work’s scale and technical complexity. SEVENTH: The information provided by the Municipality itself shows that the procurement used was an ‘on-demand’ procedure for general road and hydraulic engineering services, titled ‘UTGV-006-2025 – Structural and hydraulic engineering services for on-demand road projects.’ However, that procurement was ultimately used for the preliminary development of a highly specific, unique project with significant urban and health impacts, publicly estimated at approximately ₡450 million.
EIGHTH: The information provided raises more reasonable questions than it answers concerning: 1. The project’s true technical scope. 2. Its future sanitary sustainability. 3. The legality and appropriateness of the funding sources. 4. Operational risks. 5. Future institutional responsibilities. 6. The intervention’s overall compatibility with the constitutional principles of environmental protection and public health. NINTH: The community of Llanos de Santa Lucía has lived for years with contamination, foul odors, and diminished quality of life associated with the poor management of wastewater and stormwater systems. Despite numerous past complaints, institutional meetings, and community reports, there continues to be a lack of comprehensive technical information that would clearly establish: 1. The actual state of contamination. 2. Changes in water quality. 3. Cumulative health impacts. 4.
The actual effectiveness of the institutional actions taken. TENTH: This amparo application seeks not only access to documents, but effective protection of fundamental rights relating to: 1. The right to health. 2. The right to a healthy and ecologically balanced environment. 3. The right of access to public information. 4. The right to informed public participation in matters with environmental and health impacts.”
“In this amparo application, the applicant, Nombre02, states with complete clarity that on 03 March 2026 he submitted to the Municipal Council a formal request for information concerning the handling of the Llanos de Santa Lucía channel; this technical information can only be provided by the relevant technical unit of the Municipal Administration, as was made clear in the agreement communicated to him by letter MUPA-CONMU-CAEN-458-2026 of 10 April 2026, both to the Municipal Mayor’s Office and to the applicant, according to an email of that same date. The following was expressly resolved: ‘AGREEMENT 18: IT IS AGREED unanimously (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza) to inform Mr. Nombre02 that the Municipal Council has had no involvement in the processing or execution of the aforementioned project; the Council’s only participation in this matter was authorizing an extraordinary budget that included funds for conducting preliminary studies on the channel, but there has been no communication from the Municipal Mayor’s Office concerning the commencement or execution of the project itself.
The information requested is technical in nature and, therefore, the Municipal Administration is the body that can address each and every matter raised. Accordingly, the request for information is forwarded to the Municipal Mayor for timely action, bearing in mind that this is public information that must be provided within the applicable time limit. (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza).’ Notwithstanding the foregoing, as of this date the Municipal Council has not learned that the Municipal Mayor has acted on the information request forwarded by Agreement No. 18 transcribed above, nor has he sent any communication, even as a copy, that could be brought to the applicant’s attention in response to his request.
It must be emphasized that, when dealing with technical information, the Municipal Council does everything within its power to obtain the materials necessary to address residents’ requests, whether by forwarding them to the Mayor and stressing the importance of addressing them in a timely and proper manner or by requesting technical reports to provide answers to those seeking information. In either case, however, the Municipal Council remains dependent on the Administration’s delayed response.”
“FIRST: It is true that on 26 May 2026 an email was sent to the applicant notifying him of letter MUPA-ALCCAEN-492-2026 with a download link for the requested documents. This information consists of the studies and technical products developed under the procurement ‘UTGV-006-2025 Structural and Hydraulic Engineering Services for On-Demand Road Projects.’ SECOND: It is categorically denied that the documentation provided was partial or fragmented, or that this Administration concealed essential information, as the applicant alleges without basis. The Municipality of Paraíso has acted in strict compliance with the principles of transparency and access to public information, providing all documentation in the administrative file at the time of the request. THIRD: Regarding the alleged absence of comprehensive health studies, environmental modeling, microbiological analyses, gas studies, and future operational assessments, it is clarified that the intervention being considered in the Llanos de Santa Lucía channel is currently at a preliminary stage.
The purpose of this phase is solely to assess structural, hydraulic, road, and topographic technical feasibility. The fact that the health and environmental documents requested by the applicant do not exist is not due to a refusal to provide them or an omission, but to the material and objective fact that those instruments have not yet been generated in the assessment process. FOURTH: Regarding the contamination and health problems identified in the area, this Municipality acknowledges the complexity of the problem. However, for precisely that reason, any final decision requires the participation of the competent institutions. Various health matters are currently being addressed in coordination with the Ministry of Health. As of this date, the Municipality has adopted no final decision that disregards or supersedes the legal powers of those specialized bodies. FIFTH: It is absolutely false that there has been a violation of the right to a healthy environment or the right to health.
The actions taken consist of preliminary studies to assess technical alternatives, which do not constitute final approval of the project or authorization to carry out works. No physical work related to the possible closure of the channel is currently being carried out, nor are there specific actions that entail an immediate injury to the fundamental rights invoked.”
“By letter MUPA-ALC-CAEN-492-2026, sent to me on 26 May 2026, the Municipality provided documentation concerning the procurement titled UTGV-006-2025. Review of that documentation shows that the studies provided relate primarily to structural, hydraulic, topographic, and road matters. The respondent authorities also expressly acknowledge in the constitutional proceeding that the following do not currently exist: 1. Comprehensive health studies. 2. Microbiological characterization of water. 3. Comprehensive public health assessments. 4. Studies on gas generation and management. 5. Comprehensive environmental assessments. 6. Sanitary modeling. 7. Assessments of cumulative risks associated with the proposed intervention. THIRD. Express acknowledgment of the project’s preliminary status. Before this Chamber, the respondent authorities have maintained that the project is at a preliminary stage and that various studies requested by this applicant have not yet been generated in the relevant administrative file.
II. OBJECTIVE CONTRADICTION THAT REMAINS In this applicant’s view, there is an objective contradiction that warrants particular constitutional scrutiny. On the one hand, the Municipality publicly informs the public that it has designs, plans, and technical studies that allow the channel to be closed, and even announces the approval of public funds for a first construction phase. On the other hand, in this constitutional proceeding it acknowledges that health, environmental, and public health studies concerning fundamental aspects of the project do not yet exist. This situation raises reasonable doubt as to the true technical scope of the information used to promote the execution of a public works project of significant economic, urban, health, and environmental magnitude. III. CONSTITUTIONAL SIGNIFICANCE OF THE INFORMATION GAP The long-standing problems involving the Llanos de Santa Lucía channel and the Púcares River have been associated, including in technical documentation added to the file, with: 1.
Wastewater discharges. 2. Improper connections to the sanitary sewer system. 3. Accumulation of organic matter. 4. Persistent foul odors. 5. Pollutant discharges from homes and businesses. 6. Harm to the environmental quality of the surrounding area. Therefore, the absence of health and environmental studies is not an incidental aspect of the project. On the contrary, these are precisely the technical elements essential for the public to understand the risks, scope, impacts, and future sustainability of the proposed intervention. The information provided still does not answer fundamental questions concerning: 1. Changes in existing contamination. 2. Risks to public health. 3. The system’s future behavior once the work is completed. 4. Impacts on water quality. 5. Health mitigation measures. 6. The project’s environmental and operational sustainability.”
Justice Garro Vargas drafted this opinion; and, Reasons:
I.Subject of the application. The applicant states that on 3 March 2026 he submitted a request for public information to the Municipality of Paraíso; however, he alleges that no response had been provided as of the date this amparo application was filed.
II.Facts found. The following facts, relevant to deciding this matter, are deemed duly established:
a. On 3 March 2026, the applicant submitted a request for public information to the Municipality of Paraíso, by which he requested:
“Council members: In exercise of the right of access to public information and as a citizen directly affected by the health problem in the community of Llanos de Santa Lucía, I request that the Municipal Council formally report on the following technical matters: I. ADMINISTRATIVE FILE IN SICOP 1. Number of the file processed in SICOP. 2. Terms of reference. 3. Costs of the commissioned study. 4. Commissioned technical studies. 5. Structural and hydraulic calculation records. 6. Risk analyses. 7. Technical opinions. 8. Recommendations from external advisers. The foregoing is intended to analyze the technical completeness of the project’s supporting basis. II. KNOWLEDGE AND ASSESSMENT OF PRE-EXISTING TECHNICAL INFORMATION I request that the Council expressly state: 1. Whether it knew of the existence of construction plans and as-built plans for the channel, corresponding to works carried out under the community bond program managed by the Costa Rica–Canada Foundation. 2.
Whether it knew of prior technical studies conducted with the participation of the University of Costa Rica and the Costa Rica Institute of Technology. 3. Whether those materials were formally considered as the baseline for the current design. If not, what technical criterion justified omitting that information. III. HEALTH ASSESSMENT AND INTERINSTITUTIONAL CONSULTATION Please indicate whether the Council verified that the project had: 1. A formal consultation with, or technical opinion from, the Ministry of Health. 2. An assessment of the health impact resulting from the change from an open to a closed hydraulic condition. 3. An assessment of risks from gas accumulation. 4. Modeling of forced or passive ventilation. 5. Also, whether those assessments were presented to the public before the closure was publicized as a solution. IV. SIGNIFICANT TECHNICAL RISKS ASSOCIATED WITH THE CLOSURE I request confirmation that the following aspects were technically evaluated: A) Gas generation and public health In systems receiving organic loads, the transition from an open channel to a closed conduit favors anaerobic conditions, generating: • Hydrogen sulfide (H₂S). • Methane. • Ammonia. • Please indicate: • Whether concentration modeling was performed. • Whether the location and capacity of vents were determined. • Whether population exposure was assessed. • Whether chronic risks from intermittent emissions were assessed.
What technical criterion formed the basis of its endorsement. 2. What specific documents it reviewed. 3. Whether it conducted independent technical consultations. 4. Whether it considered less invasive alternatives. VI. PRESENTATION TO THE PUBLIC Please indicate why the public presentation did not disclose: 1. The associated health risks. 2. Future maintenance costs. 3. Possible structural damage from chemical corrosion. 4. The existence of prior technical studies. 5. And whether the Council considers that the information provided was complete and sufficient for the public to understand all the technical implications” (see evidence submitted).
b. At Ordinary Session No. 119-2026 of 10 March 2026, the Council of the Municipality of Paraíso resolved:
“AGREEMENT 18: IT IS AGREED unanimously (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza) to inform Mr. Nombre02 that the Municipal Council has had no involvement in the processing or execution of the aforementioned project; the Council’s only participation in this matter was authorizing an extraordinary budget that included funds for conducting preliminary studies on the channel, but the Municipal Mayor’s Office has issued no communication concerning the commencement and execution of the project itself. The information requested is technical in nature and, therefore, the Municipal Administration is the body that can address each and every matter raised. Accordingly, the request for information is forwarded to the Municipal Mayor for timely action, bearing in mind that this is public information that must be provided within the applicable time limit. The Municipal Mayor is asked to provide the Municipal Council with a copy of the report given to the requester. AGREEMENT FINAL AND DEFINITIVELY APPROVED UNANIMOUSLY. (Council members Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza)” (see evidence submitted).
c. On 21 May 2026, the authorities of the Municipality of Paraíso were notified of the resolution admitting this proceeding (see service records).
d. By letter No. MUPA-ALC-CAEN-492-2026 of 26 May 2026, the mayor of the Municipality of Paraíso addressed the applicant’s request as follows:
“In response to the note dated 03 March 2026 concerning the request for information about the ‘Paseo Mediterráneo’ Project, I am forwarding letter MUPA-UTGVCAEN-167-2026, prepared by Eng. Óscar Fernández Rodríguez, Acting Head of the UTGV, together with its annexes: ▪ Number of the file processed in SICOP ▪ Terms of reference ▪ Costs of the commissioned study ▪ Commissioned technical studies ▪ Structural and hydraulic calculation records ▪ Risk analyses ▪ Technical opinions ▪ Recommendations from external advisers” (see report submitted under oath and evidence provided).
e. On 26 May 2026, the Secretariat of the Municipality of Paraíso sent the applicant an email stating:
“Good afternoon. Following instructions from Eng. Michaell Álvarez Quirós, letter MUPA-ALC-CAEN-492- 2026 and its annexes are hereby notified. You may download them using the following WeTransfer link: https://we.tl/t-bzCMxqidx6K0gwsF. The link will be available for three days to complete the download” (see report submitted under oath and evidence provided).
f. The authorities of the Municipality of Paraíso reported:
“Regarding the alleged absence of comprehensive health studies, environmental modeling, microbiological analyses, gas studies, and future operational assessments, it is clarified that the intervention being considered in the Llanos de Santa Lucía channel is currently at a preliminary stage. The purpose of this phase is solely to assess structural, hydraulic, road, and topographic technical feasibility. The fact that the health and environmental documents requested by the applicant do not exist is not due to a refusal to provide them or an omission, but to the material and objective fact that those instruments have not yet been generated in the assessment process” (see report submitted under oath).
III.Fact not proven. The following fact is not deemed duly established: Sole fact. That letter No. MUPA-UTGV-CAEN-167-2026 was notified to the applicant (the record).
IV.The specific case. From a review of the record, it is established that on 3 March 2026 the applicant did in fact submit a request for public information to the Council of the Municipality of Paraíso, seeking the matters transcribed in proven fact a). However, it had not been answered by the date this application was filed, even though the ten business days referred to in Article 32 of the Constitutional Jurisdiction Act had elapsed.
The reports submitted under oath show that the applicant’s request was forwarded to the Mayor’s Office for review and proper handling. Nevertheless, the president of the respondent municipality’s Council acknowledged that the mayor had not addressed the relevant information request. Accordingly, it was in response to notification of this proceeding that letter No. MUPA-ALC-CAEN-492-2026 of 26 May 2026 was issued, addressing the applicant’s request.
Based on the foregoing, after analyzing what was requested and what was answered, the following is concluded:
First, it has not been established that letter No. MUPA-UTGV-CAEN-167-2026 was notified to the applicant, since, although the email sent to him on 26 May 2026 stated that it was included, that document does not appear among the attachments.
Second, it is determined that only item I was duly addressed by the respondent authority, since items II, III, IV, V, and VI were not addressed: the record does not establish that the respondents expressed themselves on the questions raised by the applicant. Although the mayor of the respondent municipality stated the following:
“Regarding the alleged absence of comprehensive health studies, environmental modeling, microbiological analyses, gas studies, and future operational assessments, it is clarified that the intervention being considered in the Llanos de Santa Lucía channel is currently at a preliminary stage. The purpose of this phase is solely to assess structural, hydraulic, road, and topographic technical feasibility. The fact that the health and environmental documents requested by the applicant do not exist is not due to a refusal to provide them or an omission, but to the material and objective fact that those instruments have not yet been generated in the assessment process.” The fact is that the record does not show that these technical and legal impossibilities were brought to the applicant’s attention. In this Court’s view, this fails to comply with Article 6 of the Framework Act on Access to Public Information:
“ARTICLE 6—Limits on the right of access to public information The general rule is to guarantee the right of access to public information. The exception consists of limits established in the Political Constitution of the Republic of Costa Rica, in international instruments approved by the Legislative Assembly, and in laws, in accordance with the principle that restrictions must be prescribed by law.
When an obligated entity wholly or partially denies a request for information made by an applicant, it must give reasons for the decision and specify the limit and legal provision on which the denial is based.
Rules concerning limits on the right of access to public information must be interpreted restrictively, since access is the general rule.” The provision quoted above establishes that the general rule is to guarantee the right of access to information, with restrictions as the exception. For that reason, it requires the obligated entity to give reasons for every denial, expressly identifying the applicable limit and the legal provision supporting it. Thus, although the respondent stated why it could not provide the comprehensive health studies, environmental modeling, microbiological analyses, gas studies, and future operational assessments, the record does not show that those reasons were communicated to the applicant. The respondent Municipality therefore failed to fulfill its legal duty to give reasons for the denial in the manner required by law.
Accordingly, this Court finds that the request submitted by the applicant has not been answered expressly and completely, even though the information sought by the person seeking protection falls within the protection afforded by Articles 27 and 30 of the Political Constitution, since it is public information directly related to the public’s right to know how public services and resources are managed. Consequently, because the ten-business-day period set out in Article 32 of the Ley de la Jurisdicción Constitucional has been substantially exceeded, those constitutional provisions are deemed to have been violated.
In these circumstances, the amparo application must be granted, with the consequences specified in the operative part of this judgment.
V.Documents submitted to the case file. The applicant is advised that, if any paper documents, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, were submitted, they must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within this period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo application is granted. Michel Álvarez Quirós, in his capacity as mayor, and Luis Diego Calderón Sánchez, in his capacity as president of the council, both of the Municipalidad de Paraíso, or whoever holds those offices in their stead, are ordered to issue the appropriate instructions and carry out all actions within their powers so that, within TEN DAYS from notification of this judgment, the applicant is answered expressly and completely regarding the information requested in points II, III, IV, V, and VI of the request submitted on 3 March 2026, as required by law, and is notified of the response. They must also, where applicable, provide reasons for refusing to supply any documents or data in the terms established by law, and send the applicant oficio nro. MUPA-UTGV-CAEN-167-2026 through the means indicated for receiving notices. The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order that must be complied with or enforced, issued in an amparo proceeding, and fails to comply with it or enforce it, will be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty.
The Municipalidad de Paraíso is ordered to pay the costs, damages, and losses caused by the events underlying this declaration, which will be quantified in enforcement proceedings before the administrative-litigation jurisdiction. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre02, cédula de identidad CED01, contra la MUNICIPALIDAD DE PARAÍSO.
Resultando:
“[E]l 3 de marzo de 2026 planteó solicitud formal dirigida al Concejo Municipal, mediante la cual requirió lo siguiente: “I. EXPEDIENTE ADMINISTRATIVO EN SICOP 1. Número de expediente tramitado en SICOP. 2. Pliego de condiciones. 3. Costos del estudio contratado. 4. Estudios técnicos contratados. 5. Memorias de cálculo estructural e hidráulico. 6. Análisis de riesgos. 7. Dictámenes técnicos. 8. Recomendaciones de asesoría externa. Lo anterior con el fin de analizar la integralidad técnica del sustento del proyecto. II. CONOCIMIENTO Y VALORACIÓN DE INFORMACIÓN TÉCNICA PREEXISTENTE Solicito que el Concejo indique expresamente: 1. Si tenía conocimiento de la existencia de planos constructivos y planos as-built del canal, correspondientes a las obras ejecutadas bajo el programa de bono comunal gestionado por la Fundación Costa Rica-Canadá. 2. Si tuvo conocimiento de estudios técnicos previos realizados con participación de la Universidad de Costa Rica y el Instituto Tecnológico de Costa Rica 3. Si dichos insumos fueron formalmente considerados como línea base para el diseño actual. En caso negativo, cuál fue el criterio técnico que justificó la omisión de esa información. III. VALORACIÓN SANITARIA Y CONSULTA INTERINSTITUCIONAL Solicito indicar si el Concejo verificó que el proyecto contara con: 1. Consulta formal o criterio técnico del Ministerio de Salud. 2. Análisis de impacto sanitario derivado del cambio de condición hidráulica abierta a cerrada. 3. Evaluación de riesgos por acumulación de gases. 4. Modelación de ventilación forzada o pasiva. 5. Asimismo, si dichas valoraciones fueron presentadas a la ciudadanía antes de divulgar el cierre como una solución. IV. RIESGOS TÉCNICOS NO MENORES ASOCIADOS AL CIERRE Solicito constancia de que fueron evaluados técnicamente los siguientes aspectos: A) Generación de gases y salud pública En sistemas que reciben carga orgánica, la transición de canal abierto a conducto cerrado favorece condiciones anaeróbicas, generando: o Sulfuro de hidrógeno (H?S). o Metano. o Amoníaco. o Se solicita indicar: o Si se realizó modelación de concentración. o Si se determinó ubicación y capacidad de ventilas. o Si se evaluó exposición poblacional. o Si se valoraron riesgos crónicos por emanaciones intermitentes. B) Ataque químico y corrosión microbiológica inducida (MIC) El H?S, en presencia de oxígeno, genera ácido sulfúrico que produce: o Pérdida progresiva de sección del concreto. o Desprendimiento superficial. o Exposición de acero de refuerzo. o Reducción de vida útil estructural. Solicito indicar: o Si el concreto especificado es resistente a sulfatos. o Si se contempló recubrimiento especial. o Si se estimó la tasa de deterioro proyectada. o Si existe modelación de vida útil bajo condiciones reales de carga orgánica. C). Costos de mantenimiento y sostenibilidad Solicito indicar si el Concejo conoció: o Plan detallado de mantenimiento. o Frecuencia de limpieza de sedimentos. o Monitoreo periódico de gases. o Proyección presupuestaria a 10-20 años. o Un conducto cerrado con carga orgánica no es un sistema pasivo. o Su sostenibilidad depende de mantenimiento constante. V. CRITERIO DEL ÓRGANO COLEGIADO Solicito que el Concejo indique expresamente: 1. Cuál fue el criterio técnico que fundamentó su aval. 2. Qué documentación específica revisó. 3. Si realizó consultas técnicas independientes. 4. Si consideró escenarios alternativos menos invasivos. VI. SOBRE LA PRESENTACIÓN A LA CIUDADANÍA Solicito indicar por qué, en la presentación pública, no se expusieron: 1. Los riesgos sanitarios asociados. 2. Los costos futuros de mantenimiento. 3. Las posibles afectaciones estructurales por corrosión química. 4. La existencia de estudios técnicos previos. 5. Y si el Concejo considera que la información suministrada fue integral y suficiente para que la ciudadanía comprendiera la totalidad de implicaciones técnicas. (…)". Así en Sesión Ordinaria N°119-2026 del 10 de marzo de 2026, el Concejo Municipal conoció su gestión y dispuso lo siguiente "(…) ACUERDO 17: Se ACUERDA por Unanimidad Dispensar del Trámite de Lectura y del Trámite de Comisión la nota señala. ACUERDO EN FIRME Y DEFINTIVAMENTE APROBADO POR UNANIMIDAD. (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza). ACUERDO 18: Se ACUERDA por Unanimidad (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza)., indicarle al señor Nombre02 que el Concejo Municipal no ha tenido ninguna injerencia en el trámite y ejecución del proyecto mencionado; la única participación que ha tenido este Concejo en relación con este tema es la autorización de un presupuesto extraordinario en el que se dispuso incluir recursos para llevar a cabo estudios preliminares sobre el tema del canal, pero no ha existido ningún comunicado de la Alcaldía Municipal sobre el inicio y ejecución del proyecto como tal. La información que solicita es de orden técnico y por ende, es la Administración Municipal la que puede atender todos y cada uno de los aspectos consultados. Por lo anterior, se traslada la solicitud de información al señor Alcalde Municipal para su atención oportuna, debiendo tenerse en cuenta que se trata de información pública que debe facilitarse en el plazo correspondiente. Se solicita al señor Alcalde Municipal adjuntar al Concejo Municipal copia del informe que se brinde al administrado. ACUERDO EN FIRME Y DEFINTIVAMENTE APROBADO POR UNANIMIDAD. (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza (…)". Pese a lo anterior, reclama que a la fecha de interposición de este recurso no ha recibido respuesta alguna a su gestión” (Sic).
“PRIMERO: Es cierto que el señor Nombre02 presentó una solicitud formal el 3 de marzo de 2026 requiriendo información técnica y administrativa sobre el proyecto constructivo referente al canal. SEGUNDO: Es cierto que en Sesión Ordinaria N° 119-2026 del 10 de marzo de 2026, el Concejo Municipal conoció la gestión. Mediante el Acuerdo 18, el Concejo determinó que la información solicitada era de orden técnico, por lo que trasladó la solicitud a esta Alcaldía Municipal para su atención oportuna. TERCERO: La solicitud del recurrente no consistía en una petición simple, sino en un pliego técnico sumamente complejo que requería la recopilación, revisión y consolidación de expedientes en SICOP, pliegos de condiciones, estudios técnicos, memorias de cálculo estructural e hidráulico , análisis de impacto sanitario y modelación de gases, entre otros elementos propios de la ingeniería civil y sanitaria.
CUARTO: Es absolutamente falso que a la fecha la Municipalidad de Paraíso mantenga una omisión de respuesta. Con fecha 26 de mayo del 2026, se emitió el oficio MUPA-ALC-CAEN-492-2026 , mediante el cual esta Alcaldía dio respuesta íntegra y de fondo a la solicitud del Proyecto "Paseo Mediterráneo". QUINTO: El mismo 26 de mayo de 2026, el oficio y sus respectivos anexos técnicos elaborados por el Ing. Óscar Fernández Rodríguez, Encargado a.i. de la UTGV, fueron debidamente notificados al recurrente. Debido al alto peso y volumen de los archivos técnicos requeridos, se habilitó y notificó un enlace seguro de WeTransfer para que el administrado pudiera descargar la totalidad del expediente y los estudios técnicos contratados. II. SOBRE EL FONDO A. Sobre la complejidad técnica de la información y la razonabilidad del plazo de respuesta: El artículo 27 de la Constitución Política garantiza el derecho de petición y pronta respuesta.
No obstante, la abundante jurisprudencia de esta Honorable Sala ha reiterado que el plazo del artículo 32 de la Ley de la Jurisdicción Constitucional no es un término aritmético fatal y absoluto, sino que debe valorarse a la luz del principio de razonabilidad y proporcionalidad, dependiendo de la naturaleza, el volumen y la complejidad de lo peticionado. En el caso que nos ocupa, el recurrente solicitó un compendio exhaustivo de ingeniería que incluía memorias de cálculo, evaluaciones de riesgos por acumulación de gases, modelaciones de ventilación y proyecciones de mantenimiento a 10-20 años. La Administración, en estricto apego al principio de objetividad y buena fe, no podía emitir una respuesta escueta o improvisada. Fue necesario que la Unidad Técnica de Gestión Vial consolidara los estudios de asesoría externa, dictámenes y memorias estructurales para brindar una respuesta veraz, técnica y completa.
Este esfuerzo de consolidación técnica justifica el lapso transcurrido hasta la entrega efectiva de los documentos mediante el oficio MUPA-ALC-CAEN-492-2026. B. Sobre la Carencia Actual de Interés por satisfacción extraprocesal de la pretensión: El presente recurso de amparo ha perdido su objeto. De conformidad con el artículo 52 de la Ley de la Jurisdicción Constitucional, procede declarar sin lugar el recurso, o bien con lugar únicamente para efectos de costas, cuando los hechos que motivan la interposición del amparo han cesado o han sido reparados por la propia autoridad recurrida antes del dictado de la sentencia. Tal y como se demuestra con el acervo probatorio adjunto a este informe, la Municipalidad de Paraíso ha restituido plenamente el derecho de petición y de acceso a la información del señor Nombre02. Se ha notificado formalmente el oficio MUPA-ALC-CAEN-492-2026 y se han puesto a su total disposición todos los anexos técnicos, estudios, costos y memorias de cálculo mediante una plataforma de transferencia de archivos (WeTransfer), garantizando así el acceso irrestricto a la documentación pública generada por el proyecto "Paseo Mediterráneo". Al haberse materializado la entrega de la información, el agravio constitucional aducido se ha desvanecido en su totalidad”.
“PRIMERO: Con posterioridad a la interposición del presente recurso, se recibe el día 26 de mayo del 2026, por parte de la Alcaldia Municipal, un correo eléctronico: Notificación del oficio MUPA-ALC-CAEN-492-2026 / Respuesta a solicitud de información del Proyecto "Paseo Mediterráneo: Buenas tardes, Siguiendo instrucción del Ing. Michaell Álvarez Quirós, se notifica el oficio MUPA-ALC-CAEN-492- 2026 y sus anexos, los cuales podrá descargar mediante el enlace de WeTransfer: https://we.tl/t-bzCMxqidx6K0gwsF Se informa que el enlace estará disponible por un plazo de tres días para realizar la descarga correspondiente. Del análisis realizado, puedo afirmar fidedignamente que la Municipalidad de Paraíso remitió parcialmente documentación relacionada con la contratación denominada: “UTGV-006-2025 – Servicios de ingeniería estructural e hidráulica para proyectos viales por demanda”. Dicha contratación ha sido utilizada como base técnica preliminar para el denominado públicamente “Proyecto Integral Paseo Mediterráneo – Cierre del Canal de Llanos de Santa Lucía”, proyecto promovido institucionalmente mediante publicaciones oficiales, redes sociales y exposiciones públicas como una solución a la problemática existente en el canal.
SEGUNDO: La documentación suministrada resulta parcial, fragmentada e insuficiente para satisfacer el derecho constitucional de acceso a información pública y control ciudadano efectivo sobre una intervención pública de alto impacto urbano, sanitario, ambiental y presupuestario. La información entregada se limita principalmente a aspectos preliminares de ingeniería estructural, hidráulica y vial, omitiendo precisamente los elementos técnicos esenciales relacionados con el origen real de la problemática denunciada históricamente por la comunidad: la contaminación sanitaria y ambiental del canal y del río Púcares. TERCERO: El propio estudio técnico aportado por la Municipalidad reconoce expresamente: 1. Existencia de descargas de aguas residuales. 2. Conexiones incorrectas al sistema sanitario. 3. Contaminación activa del canal. 4. Sedimentación de materia orgánica. 5. Deficiencias de drenaje urbano. 6.
Acumulación de residuos. 7. Necesidad de limpieza frecuente. 8. Persistencia de malos olores asociados a contaminación. Asimismo, el estudio reconoce que la problemática no se limita únicamente al canal, sino también a descargas provenientes de viviendas, comercios y otros aportes que alcanzan el río Púcares y la infraestructura pluvial. CUARTO: Pese a lo anterior, la Municipalidad continúa promoviendo públicamente el proyecto como una intervención urbana y paisajística, sin demostrar técnicamente cómo serán abordados integralmente los impactos sanitarios y ambientales, derivados del cierre progresivo de un canal originalmente construido para reencauzamiento pluvial y evacuación de aguas de escorrentía. QUINTO: La documentación suministrada NO incorpora: 1. Estudios sanitarios integrales. 2. Caracterización microbiológica de aguas. 3. Análisis de calidad de agua. 4. Modelación sanitaria. 5.
Estudios de generación y manejo de gases. 6. Análisis de comportamiento anaeróbico. 7. Estudios de seguridad ocupacional. 8. Análisis de sostenibilidad operativa. 9. Evaluación de costos reales de mantenimiento. 10. Escenarios de crecimiento urbano e industrial futuro. 11. Análisis de impactos por aumento de escorrentía. 12. Evaluación integral ambiental. 13. Estudios sobre afectación estructural por ataque químico al concreto. 14. Criterios técnicos integrales del ministerio de salud. 15. Evaluación de riesgos acumulativos para la salud pública. SEXTO: Resulta particularmente preocupante que una intervención de aproximadamente 990 metros lineales de longitud, sobre un canal existente de aproximadamente 4 metros de ancho y hasta 5 metros de profundidad, cuyo entorno mantiene problemática sanitaria activa, esté siendo impulsada sin evidencia pública suficiente de estudios integrales acordes a la magnitud y complejidad técnica de la obra.
SÉTIMO: La propia información suministrada por la Municipalidad evidencia que la contratación utilizada corresponde a un procedimiento “por demanda” orientado a servicios generales de ingeniería vial e hidráulica, denominado: “UTGV-006-2025 – Servicios de ingeniería estructural e hidráulica para proyectos viales por demanda”. Sin embargo, dicha contratación terminó siendo utilizada para el desarrollo preliminar de un proyecto altamente específico, singular y de gran impacto urbano y sanitario, públicamente estimado en aproximadamente ₡450 millones. OCTAVO: La información remitida genera más dudas razonables que respuestas claras respecto a: 1. El verdadero alcance técnico del proyecto. 2. Su sostenibilidad sanitaria futura. 3. La legalidad y pertinencia de las fuentes de financiamiento. 4. Los riesgos operativos. 5. Las responsabilidades institucionales futuras. 6. Y la compatibilidad integral de la intervención con los principios constitucionales de protección ambiental y salud pública.
NOVENO: La comunidad de Llanos de Santa Lucía ha convivido durante años con contaminación, malos olores y afectación a la calidad de vida asociados al manejo deficiente de aguas residuales y sistemas pluviales. Pese a múltiples denuncias históricas, reuniones institucionales y reportes comunitarios, persiste ausencia de información técnica integral que permita determinar con claridad: 1. El estado real de contaminación. 2. La evolución de la calidad del agua. 3. El impacto sanitario acumulativo. 4. Y la efectividad real de las acciones institucionales ejecutadas. DÉCIMO: El presente recurso no persigue únicamente acceso documental, sino la tutela efectiva de derechos fundamentales relacionados con: 1. Derecho a la salud. 2. Derecho a un ambiente sano y ecológicamente equilibrado. 3. Derecho de acceso a información pública. 4. Derecho a participación ciudadana informada en asuntos de impacto ambiental y sanitario”.
“En el presente amparo, el aquí recurrente Nombre02 expone con meridiana claridad que el 03 de marzo del 2026 presentó ante el Concejo Municipal una solicitud formal de información referida a la atención del canal de Llanos de Santa Lucía; información de orden técnico que sólo puede ser facilitada por la dependencia técnica respectiva de la Administración Municipal, tal cual se hizo ver en el acuerdo que se le comunicó mediante Oficio MUPA-CONMU-CAEN-458-2026 del 10 de abril del 2026, tanto a la Alcaldía Municipal como al aquí recurrente según correo electrónico de esa misma fecha disponiéndose expresamente lo siguiente: “ACUERDO 18: Se ACUERDA por Unanimidad (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza), indicarle al señor Nombre02 que el Concejo Municipal no ha tenido ninguna injerencia en el trámite y ejecución del proyecto mencionado; la única participación que ha tenido este Concejo en relación con este tema es la autorización de un presupuesto extraordinario en el que se dispuso incluir No obstante lo anterior, a la fecha no el Concejo Municipal no ha tenido conocimiento de que la Alcaldía Municipal recursos para llevar a cabo estudios preliminares sobre el tema del canal, pero no ha existido ningún comunicado de la Alcaldía Municipal sobre el inicio y ejecución del proyecto como tal.
La información que solicita es de orden técnico y por ende, es la Administración Municipal la que puede atender todos y cada uno de los aspectos consultados. Por lo anterior, se traslada la solicitud de información al señor Alcalde Municipal para su atención oportuna, debiendo tenerse en cuenta que se trata de información pública que debe facilitarse en el plazo correspondiente. Se solicita al señor Alcalde Municipal adjuntar al Concejo Municipal copia del informe que se brinde al administrado. ACUERDO EN FIRME Y DEFINTIVAMENTE APROBADO POR UNANIMIDAD. (Regidores, Mata Coghi, Arce Araya, Siles Solano, Hernández Castillo, Alfaro Sáenz, Obando Mora, Coto Espinoza).” A pesar de lo anterior, el Concejo Municipal no ha tenido conocimiento de que el Alcalde Municipal haya atendido la solicitud de información que le fuera trasladada mediante el acuerdo Número 18 transcrito supra ni tampoco ha remitido ninguna gestión ni siquiera en calidad de copia que le pueda ser puesta en conocimiento al recurrente para atender su solicitud.
Es necesario recalcar que, en tratándose de información técnica el Concejo Municipal hace todo lo que se encuentre a su alcance para procurarse los insumos necesarios para atender las gestiones de los munícipes, sea trasladando las gestiones al Alcalde señalándole la importancia de atenderlas en tiempo y forma o bien, requiriendo informes técnicos para proporcionar respuestas a quienes solicitan la información, sin embargo, en cualquier caso queda el Concejo Municipal sujeto a la reacción tardía de la Administración”.
“PRIMERO: Es cierto que el día 26 de mayo de 2026 se remitió al recurrente un correo electrónico notificando el oficio MUPA-ALCCAEN-492-2026 con un enlace de descarga para la documentación solicitada. Dicha información corresponde a los estudios y productos técnicos desarrollados dentro de la contratación "UTGV-006-2025 Servicios de Ingeniería Estructural e Hidráulica para Proyectos Viales por Demanda". SEGUNDO: Se rechaza categóricamente que la documentación suministrada sea parcial, fragmentada o que exista un ocultamiento de información esencial por parte de esta Administración, como infundadamente alega el recurrente. La Municipalidad de Paraíso ha actuado en estricto apego a los principios de transparencia y acceso a la información pública, entregando la totalidad de la documentación que conforma el expediente administrativo al momento de la solicitud. TERCERO: Sobre la alegada ausencia de estudios sanitarios integrales, modelaciones ambientales, análisis microbiológicos, estudios de gases y evaluaciones operativas futuras, se aclara que la intervención analizada en el canal de Llanos de Santa Lucía se encuentra actualmente en una etapa preliminar.
El objetivo de esta fase es evaluar únicamente la factibilidad técnica estructural, hidráulica, vial y topográfica. La inexistencia de los documentos sanitarios y ambientales exigidos por el recurrente no obedece a una negativa de entrega u omisión, sino al hecho material y objetivo de que dichos instrumentos aún no han sido generados dentro del proceso de evaluación. CUARTO: En relación con la contaminación y los problemas sanitarios señalados en el sector , esta Municipalidad reconoce la complejidad de la problemática. Sin embargo, precisamente por esta razón, cualquier decisión definitiva requiere la participación de las instituciones competentes. Actualmente se están trabajando diversos aspectos sanitarios en coordinación con el Ministerio de Salud. A la fecha, no existe ninguna decisión definitiva adoptada por la Municipalidad que desconozca o sustituya las competencias legales de estos órganos especializados.
QUINTO: Es absolutamente falso que exista una vulneración al derecho a un ambiente sano o a la salud. Las actuaciones desplegadas corresponden a estudios preliminares para valorar alternativas técnicas, lo cual no constituye una aprobación definitiva del proyecto ni una autorización para ejecutar obras. No existe actualmente ninguna ejecución material de obras relacionadas con el eventual cierre del canal, ni actuaciones concretas que impliquen una lesión inmediata a los derechos fundamentales invocados”.
“Mediante oficio MUPA-ALC-CAEN-492-2026, remitido al suscrito el 26 de mayo de 2026, la Municipalidad suministró documentación relacionada con la contratación denominada UTGV-006-2025. Del análisis de dicha documentación se desprende que los estudios aportados corresponden fundamentalmente a aspectos estructurales, hidráulicos, topográficos y viales. Asimismo, las propias autoridades recurridas reconocen expresamente dentro del expediente constitucional que actualmente no existen: 1. Estudios sanitarios integrales. 2. Caracterización microbiológica de aguas. 3. Evaluaciones integrales de salud pública. 4. Estudios de generación y manejo de gases. 5. Evaluaciones ambientales integrales. 6. Modelaciones sanitarias. 7. Estudios de riesgos acumulativos asociados a la intervención propuesta. TERCERO. Reconocimiento expreso del carácter preliminar del proyecto. Las autoridades recurridas han sostenido ante esta Sala que el proyecto se encuentra en una fase preliminar y que diversos estudios solicitados por este recurrente aún no han sido generados dentro del expediente administrativo correspondiente.
II. CONTRADICCIÓN OBJETIVA QUE SUBSISTE A criterio de este recurrente, existe una contradicción objetiva que merece especial valoración constitucional. Por una parte, la Municipalidad comunica públicamente a la ciudadanía que dispone de diseños, planos y estudios técnicos que permiten ejecutar el cierre del canal, e incluso anuncia la aprobación de recursos públicos para una primera etapa constructiva. Por otra parte, dentro de este proceso constitucional se reconoce que no existen aún estudios sanitarios, ambientales y de salud pública relacionados con aspectos fundamentales del proyecto. Esta situación genera una duda razonable sobre el verdadero alcance técnico de la información utilizada para promover la ejecución de una obra pública de significativa magnitud económica, urbana, sanitaria y ambiental. III. RELEVANCIA CONSTITUCIONAL DEL VACÍO DE INFORMACIÓN La problemática histórica del canal de Llanos de Santa Lucía y del río Púcares ha sido asociada, incluso por documentación técnica incorporada al expediente, a: 1.
Descargas de aguas residuales. 2. Conexiones incorrectas al sistema sanitario. 3. Acumulación de materia orgánica. 4. Malos olores persistentes. 5. Aportes contaminantes provenientes de viviendas y comercios. 6. Afectaciones a la calidad ambiental del entorno. Por ello, la ausencia de estudios sanitarios y ambientales no constituye un aspecto accesorio del proyecto. Por el contrario, corresponde precisamente a los elementos técnicos indispensables para que la ciudadanía pueda comprender los riesgos, alcances, impactos y sostenibilidad futura de la intervención propuesta La información entregada continúa sin responder interrogantes fundamentales relacionadas con: 1. La evolución de la contaminación existente. 2. Los riesgos para la salud pública. 3. El comportamiento futuro del sistema una vez ejecutada la obra. 4. Los impactos sobre la calidad del agua. 5. Los mecanismos de mitigación sanitaria. 6. La sostenibilidad ambiental y operativa del proyecto”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. El recurrente manifiesta que el 3 de marzo de 2026 presentó una solicitud de información pública ante la Municipalidad de Paraíso; sin embargo, reclama que a la fecha de interposición de este recurso no se le ha brindado una respuesta.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. El 3 de marzo de 2026, el recurrente presentó una solicitud de información pública ante la Municipalidad de Paraíso, por medio de la cual solicitó:
“Señores Regidores: En ejercicio del derecho de acceso a la información pública y en condición de ciudadano directamente afectado por la problemática sanitaria en la comunidad de Llanos de Santa Lucia, solicito que el Concejo Municipal informe formalmente sobre los siguientes extremos técnicos: I. EXPEDIENTE ADMINISTRATIVO EN SICOP 1. Número de expediente tramitado en SICOP. 2. Pliego de condiciones. 3. Costos del estudio contratado. 4. Estudios técnicos contratados. 5. Memorias de cálculo estructural e hidráulico. 6. Análisis de riesgos. 7. Dictámenes técnicos. 8. Recomendaciones de asesoría externa. Lo anterior con el fin de analizar la integralidad técnica del sustento del proyecto. II. CONOCIMIENTO Y VALORACIÓN DE INFORMACIÓN TÉCNICA PREEXISTENTE Solicito que el Concejo indique expresamente: 1. Si tenía conocimiento de la existencia de planos constructivos y planos as-built del canal, correspondientes a las obras ejecutadas bajo el programa de bono comunal gestionado por la Fundación Costa Rica–Canadá. 2.
Si tuvo conocimiento de estudios técnicos previos realizados con participación de la Universidad de Costa Rica y el Instituto Tecnológico de Costa Rica 3. Si dichos insumos fueron formalmente considerados como línea base para el diseño actual. En caso negativo, cuál fue el criterio técnico que justificó la omisión de esa información. III. VALORACIÓN SANITARIA Y CONSULTA INTERINSTITUCIONAL Solicito indicar si el Concejo verificó que el proyecto contara con: 1. Consulta formal o criterio técnico del Ministerio de Salud. 2. Análisis de impacto sanitario derivado del cambio de condición hidráulica abierta a cerrada. 3. Evaluación de riesgos por acumulación de gases. 4. Modelación de ventilación forzada o pasiva. 5. Asimismo, si dichas valoraciones fueron presentadas a la ciudadanía antes de divulgar el cierre como una solución. IV. RIESGOS TÉCNICOS NO MENORES ASOCIADOS AL CIERRE Solicito constancia de que fueron evaluados técnicamente los siguientes aspectos: A) Generación de gases y salud pública En sistemas que reciben carga orgánica, la transición de canal abierto a conducto cerrado favorece condiciones anaeróbicas, generando: • Sulfuro de hidrógeno (H₂S). • Metano. • Amoníaco. • Se solicita indicar: • Si se realizó modelación de concentración. • Si se determinó ubicación y capacidad de ventilas. • Si se evaluó exposición poblacional. • Si se valoraron riesgos crónicos por emanaciones intermitentes.
Cuál fue el criterio técnico que fundamentó su aval. 2. Qué documentación específica revisó. 3. Si realizó consultas técnicas independientes. 4. Si consideró escenarios alternativos menos invasivos. VI. SOBRE LA PRESENTACIÓN A LA CIUDADANÍA Solicito indicar por qué, en la presentación pública, no se expusieron: 1. Los riesgos sanitarios asociados. 2. Los costos futuros de mantenimiento. 3. Las posibles afectaciones estructurales por corrosión química. 4. La existencia de estudios técnicos previos. 5. Y si el Concejo considera que la información suministrada fue integral y suficiente para que la ciudadanía comprendiera la totalidad de implicaciones técnicas” (ver prueba aportada).
b. Por medio de la sesión ordinaria nro. 119-2026 del 10 de marzo de 2026, el Concejo de la Municipalidad de Paraíso acordó:
“ACUERDO 18: Se ACUERDA por Unanimidad (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza)., indicarle al señor Nombre02 que el Concejo Municipal no ha tenido ninguna injerencia en el trámite y ejecución del proyecto mencionado; la única participación que ha tenido este Concejo en relación con este tema es la autorización de un presupuesto extraordinario en el que se dispuso incluir recursos para llevar a cabo estudios preliminares sobre el tema del canal, pero no ha existido ningún comunicado de la Alcaldía Municipal sobre el inicio y ejecución del proyecto como tal. La información que solicita es de orden técnico y por ende, es la Administración Municipal la que puede atender todos y cada uno de los aspectos consultados. Por lo anterior, se traslada la solicitud de información al señor Alcalde Municipal para su atención oportuna, debiendo tenerse en cuenta que se trata de información pública que debe facilitarse en el plazo correspondiente. Se solicita al señor Alcalde Municipal adjuntar al Concejo Municipal copia del informe que se brinde al administrado. ACUERDO EN FIRME Y DEFINTIVAMENTE APROBADO POR UNANIMIDAD. (Regidores, Mata Coghi, Arce Araya, Siles Solano, Nombre01, Alfaro Sáenz, Obando Mora, Coto Espinoza)” (ver prueba aportada).
c. El 21 de mayo de 2026, las autoridades de la Municipalidad de Paraíso fueron notificadas de la resolución que dio curso a este proceso (ver actas de notificación).
d. Por medio del oficio nro. MUPA-ALC-CAEN-492-2026 del 26 de mayo de 2026, el alcalde de la Municipalidad de Paraíso atendió la gestión del recurrente de la siguiente manera:
“En atención y respuesta a Nota de fecha 03 de marzo de 2026, referente a la solicitud de información del Proyecto "Paseo Mediterráneo", me permito remitir el oficio MUPA-UTGVCAEN-167-2026, elaborado por el Ing. Óscar Fernández Rodríguez, Encargado a.i. de la UTGV, así como sus anexos: ▪ Número de expediente tramitado en SICOP ▪ Pliego de condiciones ▪ Costos del estudio contratado ▪ Estudios técnicos contratados ▪ Memorias de cálculo estructural e hidráulico ▪ Análisis de riesgos ▪ Dictámenes técnicos ▪ Recomendaciones de asesoría externa” (ver informe rendido bajo juramento y prueba aportada).
e. El 26 de mayo de 2026, la Secretaría de la Municipalidad de Paraíso le remitió un correo electrónico al recurrente, por medio del cual se le indicó:
“Buenas tardes, Siguiendo instrucción del Ing. Michaell Álvarez Quirós, se notifica el oficio MUPA-ALC-CAEN-492- 2026 y sus anexos, los cuales podrá descargar mediante el enlace de WeTransfer: https://we.tl/t-bzCMxqidx6K0gwsF Se informa que el enlace estará disponible por un plazo de tres días para realizar la descarga correspondiente” (ver informe rendido bajo juramento y prueba aportada).
f. Las autoridades de la Municipalidad de Paraíso informaron:
“Sobre la alegada ausencia de estudios sanitarios integrales, modelaciones ambientales, análisis microbiológicos, estudios de gases y evaluaciones operativas futuras, se aclara que la intervención analizada en el canal de Llanos de Santa Lucía se encuentra actualmente en una etapa preliminar. El objetivo de esta fase es evaluar únicamente la factibilidad técnica estructural, hidráulica, vial y topográfica. La inexistencia de los documentos sanitarios y ambientales exigidos por el recurrente no obedece a una negativa de entrega u omisión, sino al hecho material y objetivo de que dichos instrumentos aún no han sido generados dentro del proceso de evaluación” (ver informe rendido bajo juramento).
III.Hecho no probado. No se estima como debidamente demostrado el siguiente hecho probado: Único. Que el oficio nro. MUPA-UTGV-CAEN-167-2026 haya sido notificado al recurrente (los autos)
IV.Sobre el caso concreto. Del estudio de los autos, se tiene por demostrado que efectivamente el 3 de marzo de 2026, el recurrente presentó solicitud una de información pública ante el Concejo de la Municipalidad de Paraíso —mediante la cual requirió lo transcrito en el hecho probado a)—. Sin embargo, no había sido contestada a la fecha de interpuesto este recurso, pese a que había transcurrido los diez días hábiles a los que hace referencia el artículo 32 de la Ley de la Jurisdicción Constitucional.
Ahora bien, del análisis de los informes rendidos bajo juramento por parte los recurridos consta que la gestión del recurrente fue remitida ante la Alcaldía para su respectivo análisis y debida atención; no obstante, el presidente del Concejo del municipio accionado reconoció el alcalde no había atendido la solicitud de información respectiva. En esa línea, se tiene que fue a raíz de la notificación de este proceso que se emitió el oficio nro. MUPA-ALC-CAEN-492-2026 del 26 de mayo de 2026 a través del cual se atendió la gestión presentada por el recurrente.
A partir de lo expuesto, una vez analizado lo peticionado y lo respondido se concluye lo siguiente:
En primer lugar, no se tiene por demostrado que el oficio nro. MUPA-UTGV-CAEN-167-2026 haya sido notificado al recurrente, toda vez que pese a que así se le indicó en el correo electrónico que se le remitió desde el 26 de mayo de 2026, dentro de los adjuntos no se observa dicho documento.
En segundo lugar, se determina que solamente el punto I fue debidamente atendido por parte de la autoridad recurrida, toda vez que los punto II, III, IV, V y VI no han sido atendidos, pues de los elementos que constan en los autos no se tiene por demostrado que los recurridos se hayan expresado sobre las consultas formuladas por el recurrente. Si bien el alcalde del municipio accionado indicó lo siguiente:
“Sobre la alegada ausencia de estudios sanitarios integrales, modelaciones ambientales, análisis microbiológicos, estudios de gases y evaluaciones operativas futuras, se aclara que la intervención analizada en el canal de Llanos de Santa Lucía se encuentra actualmente en una etapa preliminar. El objetivo de esta fase es evaluar únicamente la factibilidad técnica estructural, hidráulica, vial y topográfica. La inexistencia de los documentos sanitarios y ambientales exigidos por el recurrente no obedece a una negativa de entrega u omisión, sino al hecho material y objetivo de que dichos instrumentos aún no han sido generados dentro del proceso de evaluación”.
Lo cierto del caso es que no consta que tales imposibilidades técnicas y legales hayan sido puestas en conocimiento del recurrente. Lo anterior, a criterio de este Tribunal incumple lo dispuesto en el artículo 6 de la Ley Marco Acceso a la Información Pública:
“ARTÍCULO 6- Límites del derecho de acceso a la información pública La regla general es garantizar el derecho de acceso a la información pública y su excepción los límites que son aquellos que están establecidos en la Constitución Política de la República de Costa Rica, en la normativa internacional aprobada por la Asamblea Legislativa y en las leyes, conforme al principio de reserva de ley.
Cuando un sujeto obligado deniegue, de manera total o parcial, una solicitud de información realizada por la persona solicitante, este deberá motivar el acto y especificar con base en cuál límite y normativa sustenta su resolución negativa.
La materia referida a los límites al derecho de acceso a la información pública debe ser interpretada en forma restrictiva, pues la regla general será su acceso”.
Nótese que la norma transcrita establece que la regla general es garantizar el derecho de acceso a la información, siendo las restricciones la excepción. Por tal razón, la norma impone al sujeto obligado la carga de motivar toda denegatoria, indicando expresamente el límite aplicado y la disposición normativa que lo respalda. De ese modo, pese a que el recurrido indicó los motivos por los cuales no pueden remitir los estudios sanitarios integrales, modelaciones ambientales, análisis microbiológicos, estudios de gases y evaluaciones operativas futuras no se desprende que tales motivos hayan sido informados al recurrente, por tal razón se advierte que la Municipalidad accionada incumplió con el deber de motivar la negativa en los términos exigidos por la ley.
Así las cosas, este Tribunal determina que la solicitud planteada por el recurrente no ha sido respondida de forma expresa y completa a pesar de que lo requerido por el tutelado se encuentra amparable en los artículos 27 y 30 de la Constitución Política, pues se trata de información pública que se relaciona directamente con el derecho de la ciudadanía a conocer cómo gestiona los servicios y recursos públicos. En consecuencia, como el plazo de diez días hábiles contemplado en el artículo 32 de la Ley de la Jurisdicción Constitucional ha sido ampliamente sobrepasado, se tiene por transgredidos tales numerales constitucionales.
Bajo este orden de circunstancias se impone declarar con lugar el recurso, con las consecuencias que se especifican en la parte dispositiva de esta sentencia.
V.Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Michel Álvarez Quirós, en su condición de alcalde, y Luis Diego Calderón Sánchez, en su condición de presidente del Concejo, ambos de la Municipalidad de Paraíso, o a quienes en sus lugares ejerzan esos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que dentro del plazo de DIEZ DÍAS, contados a partir de la notificación de esta sentencia, se le conteste de forma expresa y completa al recurrente la información requerida en los puntos II, III, IV, V y VI de la gestión remitida desde el 3 de marzo de 2026, según en derecho corresponda y se le notifique. Asimismo, deberán en los casos en que proceda motivarle la negativa de suministrar aquellos documentos o datos en los términos que establece la ley y remitirle al recurrente el oficio nro. MUPA-UTGV-CAEN-167-2026 al medio que señaló para atender notificaciones.
Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Paraíso al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
