Motion alleging disobedience filed by Nombre01, identity card CED01, against the MUNICIPALITY OF SANTO DOMINGO DE HEREDIA AND THE NATIONAL ROAD COUNCIL.
Background:
Justice Hess Herrera drafted the opinion; and, Reasons:
By judgment No. 2025033778, at 09:20 on 17 October 2026, this Chamber granted the amparo application filed by the applicant against the Costa Rican Social Security Fund, in the following terms: “… “… The amparo application is partially granted, solely with respect to the National Road Council and the Municipality of Santo Domingo. Mauricio Sojo Quesada, in his capacity as acting executive director of the National Road Council, or whoever holds that position in his place, is ordered, within a period of SIX MONTHS counted from notification of this judgment, to adopt and implement the technical measures recommended by the National Emergency Commission to ensure correction of the stormwater and surface runoff management system in the affected area along Dirección01. Likewise, Jorge Fonseca Fonseca and Jéssica Cano Chaves, respectively the mayor and head of the Municipal Road Management Technical Unit, both of the Municipality of Santo Domingo de Heredia, or whoever holds those positions, are ordered, within a period of SIX MONTHS counted from notification of this judgment, to adopt and implement all technical measures necessary to comply with the recommendations set out in technical report CNE-UIAR-INF-1342-2023, including drainage works, runoff control, and reinforcement of the discharge headwalls in the affected municipal area.
Both respondent institutions must inform the amparo applicant and this Chamber of concrete progress and the estimated schedule for compliance with the order issued. The respondent authority is advised that, pursuant to Article 71 of the Constitutional Jurisdiction Law, a person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a greater penalty. The Municipality of Santo Domingo and the National Road Council are ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, which shall be assessed in enforcement of the judgment within the administrative-litigation jurisdiction. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note.
Justice Garro Vargas dissents regarding enforcement of this judgment and, pursuant to Article 56 of the Constitutional Jurisdiction Law, provides that it should take place before the Enforcement Division of the Administrative Litigation and Civil Treasury Court, under the enforcement rules established in Articles 155 et seq. of the Administrative Litigation Procedural Code. She also orders that a copy of the judgment be sent to her so that enforcement proceedings for this ruling may be initiated. As to the Ministry of Public Works and Transportation and the National Commission for Risk Prevention and Emergency Response (CNE), the amparo application is denied. Notify the parties.”
The amparo applicant alleges noncompliance with what this Chamber ordered in judgment No. 2025033778, at 09:20 on 17 October 2025, by which the amparo application was partially granted solely with respect to the National Road Council and the Municipality of Santo Domingo de Heredia. Specifically, the applicant states that, despite the time elapsed since that ruling and the six-month period established for compliance, the problem that gave rise to the constitutional proceeding persists because, she asserts, the pipes continue to direct water toward her property, part of her property remains affected, and no definitive solution has been implemented. She adds that she has not been informed of the actions the respondent institutions intend to take to resolve the situation, despite the judgment expressly imposing on them the duty to inform her of concrete progress and the estimated schedule for compliance. She therefore considers that there has been disobedience of what this jurisdiction decided and asks that compliance with the ruling be ordered again and, if deemed appropriate, that referral of the relevant record to the Public Prosecutor’s Office be considered.
To resolve this motion, the precise terms of the operative section of the ruling whose noncompliance is alleged must first be considered. On that occasion, this Chamber ordered the executive director of the National Road Council, or whoever held that position, to adopt and implement, within a period of six months counted from notification of the judgment, the technical measures recommended by the National Emergency Commission to ensure correction of the stormwater and surface runoff management system in the affected area along Dirección01. Likewise, the mayor and the head of the Municipal Road Management Technical Unit of the Municipality of Santo Domingo de Heredia, or whoever held those positions, were ordered to adopt and implement, within the same period, all technical measures necessary to comply with the recommendations set out in technical report CNE-UIAR-INF-1342-2023, including drainage works, runoff control, and reinforcement of the discharge headwalls in the affected municipal area. Finally, both institutions were required to inform the amparo applicant and this Chamber of concrete progress and the estimated schedule for compliance.
That clarification is essential to resolve this matter. The order issued by this Court did not merely impose on the respondent authorities a duty to coordinate, study, plan, or formulate projects. On the contrary, it expressly provided that, within the period granted, they had to “adopt and implement” the technical measures necessary to address the situation established in the amparo proceeding. There is, therefore, a substantial difference between carrying out administrative actions aimed at preparing to comply with a judgment and actually satisfying the order it contains. Technical studies, designs, budget procedures, procurement mechanisms, and interinstitutional coordination may constitute necessary stages in achieving the ordered result; however, on their own they do not amount to compliance when the operative section also requires the physical implementation of specific measures within a defined period.
That interpretation is especially relevant here because the judgment was issued precisely after a risk situation that had already persisted for some time was established. As to the Municipality of Santo Domingo de Heredia, a prolonged failure to address risks associated with stormwater and surface runoff management was established. It was also emphasized that technical report CNE-UIAR-INF-1342-2023 had identified highly vulnerable geotechnical conditions, steep slopes, unstable embankments, and shortcomings in runoff management; accordingly, the local government was expressly advised to improve the stormwater system on the municipal road, monitor risk areas, and adopt the other corresponding preventive measures.
As for CONAVI, the judgment likewise determined that, despite having known of the CNE recommendations since 2023, it had not carried out the interventions needed to correct inadequate stormwater management along Dirección01. The Chamber found it established that the absence of a uniform stormwater system, visible erosion, and shortcomings in the discharge system maintained a definite risk to people and neighboring properties. Thus, the purpose of the order was not simply for the institutions to continue analyzing a situation that had already been diagnosed, but for them to advance, within the established period, to implementing the necessary corrective measures.
Now, in response to the hearing granted regarding this motion, the respondent authorities submitted evidence showing that various actions to address the problem have indeed been carried out since the judgment was issued. That circumstance must be acknowledged, because the documents in the record do not show total inactivity or an express refusal by the authorities to observe what this Chamber decided. However, the issue to be resolved at this procedural stage is not merely whether the institutions have taken some administrative action, but whether those actions substantially satisfy what they were actually ordered to do.
As to the National Road Council, it reports that after the judgment was served, it took the necessary steps to prepare the “Hydrological and Hydraulic Study and Design of the Stormwater Collector and Discharge System for National Route No. 308,” prepared by the consulting firm DLZ-Carbon Ingeniería and completed in February 2026. The study included a topographic survey, delineation of contributing areas, hydrological analysis, hydraulic modeling of the system, assessment of the capacity of existing infrastructure, and design of a new stormwater collection, conveyance, and discharge system.
The evidence submitted allows the technical importance of those actions to be recognized. In fact, the study concluded that the existing stormwater system on the analyzed stretch of Dirección01 was partial and discontinuous, and determined that a new stormwater collector with sufficient capacity was needed to capture runoff and convey it to an adequate discharge structure that would reduce erosion. It also designed pipes, inlets, a discharge structure, energy-dissipating steps, a dissipation box, and protective works using riprap, precisely to control flow energy and minimize erosion affecting neighboring properties.
However, the information provided by CONAVI itself makes it possible to establish that, when this motion is being decided, the physical works that are the central object of the judgment have not yet been carried out. The study and corresponding plans were not sent to the Directorate of Road and Bridge Design for technical review and issuance of a specialized opinion until 29 July 2026; the proposed solution was therefore still at the final stage of institutional validation, before physical implementation could begin.
Moreover, the schedule submitted by the National Road Council itself confirms that physical implementation was planned for a later date. According to that schedule, the design review would take place during July and August 2026; commencement of the road maintenance contract and the corresponding budget allocation were planned for September 2026; coordination with the contractor and field layout would take place during September and October; and the stormwater drainage works themselves would be carried out between October and December 2026. Monitoring would then take place between January and March 2027, with final technical acceptance scheduled for March of that same year.
That schedule is a particularly relevant element in deciding this motion, because it shows that, although there is a specific administrative activity aimed at achieving the result ordered by this Chamber, execution of the works remains pending. In other words, the authority itself acknowledges that the material actions indispensable to correcting the stormwater and surface runoff management system that led to the amparo application being granted are still outstanding.
It is not legally admissible to equate completion of the studies and designs with full execution of the constitutional mandate. It is understandable that public works of this nature require hydrological studies, topographic surveys, designs, technical validations, budget availability, and procurement mechanisms. However, these circumstances form part of the administrative activity that the competent institution must organize to comply with a judicial ruling; they cannot, by themselves, result in a unilateral extension of the period set in a final constitutional judgment. To accept otherwise would make the effectiveness of the rulings of this jurisdiction dependent on the internal timelines each Administration sets for carrying out its procedures, even where the Chamber had already weighed the circumstances of the case and expressly set a deadline for ending the established violation.
It should also be added that the specialized study had been completed since February 2026, yet it was not formally submitted for institutional technical validation until 29 July of that year. That is, several months after the necessary technical document was available and, moreover, after the amparo applicant filed the motion alleging noncompliance. Without other evidence, this circumstance does not allow the conclusion that CONAVI’s actions were taken exclusively as a result of this motion. It does, however, show that when the interested party again came before this Chamber, the solution had not yet reached the material execution phase expressly required by the judgment.
Accordingly, CONAVI’s argument that there is “progressive, documented, and verifiable” compliance is insufficient. The documentation does indeed establish a progressive process of preparation for carrying out the works and, at least on the evidence currently available, rules out absolute institutional indifference to the judgment. But the existence of a compliance process is not equivalent to effective compliance with a judicial order whose terms required the technical measures to be adopted and carried out within the specified period. The institution itself acknowledges that material execution remained pending and that final acceptance of the project was projected for as late as March 2027.
A similar situation, though with its own particular features, arises with respect to the Municipality of Santo Domingo de Heredia. The local government states that it has carried out maintenance and improvements to the stormwater drainage systems on the cantonal road network near the area, including the installation and replacement of pipes, the construction and improvement of inspection chambers, and the cleaning and restoration of drainage structures. It also states that it has maintained ongoing coordination with CONAVI regarding the studies, design, and scheduling of the works to be carried out on Dirección01.
These actions are positive elements that must be considered and likewise establish that there has been no absolute municipal inactivity. However, they are also insufficient to establish full compliance with the order. First, the information provided describes various works carried out on the cantonal road network in general terms, but does not sufficiently specify when they were carried out, their precise locations, their technical scope, or how each corresponds to the recommendations in report CNE-UIAR-INF-1342-2023. It is therefore not possible to conclude from these statements alone that all measures imposed in the judgment have been physically carried out.
It should also be recalled that the obligations imposed on the Municipality were not limited to installing pipes or cleaning structures. The CNE report considered by this Chamber when issuing its judgment also included other measures concerning the monitoring of risk areas and the prevention of new impacts. The report submitted at this stage does not specifically demonstrate compliance with all of those requirements.
In addition, the Municipality expressly acknowledges that, despite the actions it says it has taken within its area of competence, directly resolving the stated problem still depends on construction of the new collector system, the outfall works, and the energy dissipation structures planned for Dirección01. Those works fall under CONAVI’s responsibility and remain pending. This acknowledgment confirms that the situation that gave rise to constitutional protection has not yet been physically resolved.
There is also another aspect of the judgment for which compliance has not been sufficiently established. As noted, the operative part expressly ordered both CONAVI and the Municipality to inform the amparo applicant and this Chamber of concrete progress and the estimated compliance schedule. One of Nombre01’s central allegations is precisely that, as of the date she filed this motion, she had not been informed of what would be done to resolve the situation affecting her property.
Although the evidence submitted establishes communications and coordination among the public authorities involved, particularly between the local government and CONAVI, no sufficient documentation was submitted to show that, before this motion was filed, the amparo applicant had been directly informed, in compliance with the judgment, of the concrete progress made and the schedule for carrying out the ordered measures. Accordingly, compliance with this specific obligation has also not been established.
In these circumstances, comparing the judgment’s terms with the reports submitted at this stage leads to the conclusion that the respondent authorities have taken steps toward compliance but have not established that they fully satisfied the order issued. This distinction is fundamental. The existence of administrative activity aimed at compliance is one thing; effective execution of the judgment on the terms set by this jurisdiction is another.
In CONAVI’s case, noncompliance is particularly clear because its own schedule shows that the main works remain pending and have been scheduled for later dates. As for the Municipality of Santo Domingo de Heredia, although certain actions on the cantonal road network have been established, the evidence does not sufficiently show that all the technical measures for which it was responsible under the CNE report and the judgment have been carried out, or that the duty to inform the amparo applicant was fulfilled in a timely manner.
It should be clarified that, even recognizing the studies, designs, municipal works, and interinstitutional coordination carried out after the judgment was issued, the fact remains that, when the motion alleging noncompliance was filed, the situation that led to the amparo application being granted had not been resolved, and the main works required to correct it remained pending. That circumstance explains and justifies why the amparo applicant again came before this constitutional jurisdiction: she was not raising a new dispute or challenging mere administrative details arising from execution, but alleging that the material result expressly ordered by this Chamber had still not been achieved.
For all the foregoing reasons, the motion alleging noncompliance filed by Nombre01 should be granted, because the evidence in the case file establishes that judgment No. 2025033778, issued at 09:20 on 17 October 2025, has not been fully complied with on the terms ordered.
Consequently, the motion alleging non-execution should be granted, and MAURICIO SOJO QUESADA, in his capacity as ACTING EXECUTIVE DIRECTOR OF THE NATIONAL ROAD COUNCIL (CONAVI), as well as JORGE FONSECA FONSECA and JÉSSICA CANO CHAVES, respectively MAYOR and HEAD OF THE MUNICIPAL ROAD MANAGEMENT TECHNICAL UNIT, both of the MUNICIPALITY OF SANTO DOMINGO, or whoever may hold those positions in their place, should be ordered to comply with what this Chamber ordered in judgment No. 2025033778, issued at 09:20 on 17 October 2025. This is subject to the warning that, if disobedience is established, proceedings may be opened against them in accordance with articles 53 and 71 of the Ley de la Jurisdicción Constitucional.
The parties are advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at Session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 on 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
MAURICIO SOJO QUESADA, in his capacity as ACTING EXECUTIVE DIRECTOR OF THE NATIONAL ROAD COUNCIL (CONAVI), as well as JORGE FONSECA FONSECA and JÉSSICA CANO CHAVES, respectively MAYOR and HEAD OF THE MUNICIPAL ROAD MANAGEMENT TECHNICAL UNIT, both of the MUNICIPALITY OF SANTO DOMINGO, or whoever may hold those positions in their place, are again instructed to comply with what this Chamber ordered in judgment No. 2025033778, issued at 09:20 on 17 October 2025. This is subject to the warning that, if the alleged disobedience is established, proceedings may be opened against them (article 53 of the Ley de la Jurisdicción Constitucional). Gestión de desobediencia presentada por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE SANTO DOMINGO DE HEREDIA Y CONSEJO NACIONAL DE VIALIDAD.
Resultando:
Redacta la Magistrada Hess Herrera; y,
Considerando:
Mediante la sentencia No. 2025033778 de las 09:20 horas del 17 de octubre de 2026 esta Sala declaró con lugar el recurso de amparo promovido por la parte recurrente contra la Caja Costarricense de Seguro Social, en los siguientes términos: “… “… Se declara parcialmente con lugar el recurso, únicamente respecto al Consejo Nacional de Vialidad y la Municipalidad de Santo Domingo. Se ordena a Mauricio Sojo Quesada, en su condición de director ejecutivo a.i. del Consejo Nacional de Vialidad, o a quien en su lugar ocupe ese cargo, para que dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, adopten y ejecuten las medidas técnicas recomendadas por la Comisión Nacional de Emergencias para garantizar la corrección del sistema de manejo de aguas pluviales y escorrentía superficial en la zona afectada sobre la Dirección01. Asimismo, se ordena a Jorge Fonseca Fonseca y Jéssica Cano Chaves, por su orden alcalde y encargada de Unidad Técnica de Gestión Vial Municipal, ambos de la Municipalidad de Santo Domingo de Heredia, o quienes ocupen dichos cargos, para que dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, adopten y ejecuten todas las medidas técnicas necesarias para dar cumplimiento a las recomendaciones establecidas en el informe técnico CNE-UIAR-INF-1342-2023, incluyendo las obras de drenaje, control de escorrentía y reforzamiento de los cabezales de desfogue en la zona cantonal afectada.
Ambas instituciones recurridas deberán informar a la recurrente y a esta Sala sobre los avances concretos y cronograma estimado de cumplimiento de la orden impartida. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Santo Domingo y al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. El Magistrado Salazar Alvarado pone nota.
La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. En cuanto al Ministerio de Obras Públicas y Transporte y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), se declara sin lugar el recurso. Notifíquese.”.
La recurrente acusa el incumplimiento de lo ordenado por esta Sala en la sentencia No. 2025033778 de las 09:20 horas del 17 de octubre de 2025, mediante la cual se declaró parcialmente con lugar el recurso de amparo, únicamente respecto del Consejo Nacional de Vialidad y de la Municipalidad de Santo Domingo de Heredia. En concreto, la gestionante señala que, pese al tiempo transcurrido desde el dictado de esa resolución y al plazo de seis meses establecido para su cumplimiento, la problemática que motivó la interposición del proceso constitucional persiste, pues, según afirma, las tuberías continúan dirigiendo aguas hacia su propiedad, parte de su inmueble permanece afectada y no se ha ejecutado una solución definitiva. Añade que tampoco ha sido informada acerca de las actuaciones que las instituciones recurridas pretenden realizar para solventar la situación, pese a que la sentencia expresamente les impuso el deber de comunicarle los avances concretos y el cronograma estimado de cumplimiento. Por ello, estima que existe una desobediencia a lo resuelto por esta jurisdicción y solicita que se ordene nuevamente el cumplimiento del fallo y, de estimarse procedente, se valore la remisión de los antecedentes correspondientes al Ministerio Público.
A efectos de resolver esta gestión, debe partirse del contenido preciso de la parte dispositiva del fallo cuyo incumplimiento se reclama. En aquella oportunidad, esta Sala ordenó al director ejecutivo del Consejo Nacional de Vialidad, o a quien ocupara ese cargo, que dentro del plazo de seis meses contado a partir de la notificación de la sentencia adoptara y ejecutara las medidas técnicas recomendadas por la Comisión Nacional de Emergencias para garantizar la corrección del sistema de manejo de aguas pluviales y escorrentía superficial en la zona afectada sobre la Dirección01. De igual manera, se ordenó al alcalde y a la encargada de la Unidad Técnica de Gestión Vial Municipal de la Municipalidad de Santo Domingo de Heredia, o a quienes ocuparan tales cargos, que dentro del mismo plazo adoptaran y ejecutaran todas las medidas técnicas necesarias para dar cumplimiento a las recomendaciones establecidas en el informe técnico CNE-UIAR-INF-1342-2023, incluyendo las obras de drenaje, control de escorrentía y reforzamiento de los cabezales de desfogue en la zona cantonal afectada. Finalmente, ambas instituciones quedaron obligadas a informar tanto a la recurrente como a esta Sala acerca de los avances concretos y el cronograma estimado de cumplimiento.
La precisión anterior resulta esencial para resolver este asunto. El mandato emitido por este Tribunal no se limitó a imponer a las autoridades recurridas un deber de coordinación, estudio, planificación o formulación de proyectos. Por el contrario, expresamente se dispuso que, dentro del plazo otorgado, debían “adoptar y ejecutar” las medidas técnicas necesarias para atender la situación acreditada en el proceso de amparo. Existe, por consiguiente, una diferencia sustancial entre realizar actuaciones administrativas orientadas a preparar el cumplimiento de una sentencia y satisfacer efectivamente el mandato contenido en ella. Los estudios técnicos, diseños, trámites presupuestarios, mecanismos de contratación y coordinaciones interinstitucionales pueden constituir etapas necesarias para alcanzar el resultado ordenado; sin embargo, por sí solos no equivalen al cumplimiento cuando la parte dispositiva exige, además, la ejecución material de determinadas medidas dentro de un plazo concreto.
Tal interpretación resulta particularmente relevante en este asunto, pues la sentencia se dictó precisamente después de constatar una situación de riesgo que ya se prolongaba en el tiempo. En efecto, respecto de la Municipalidad de Santo Domingo de Heredia se tuvo por acreditada una omisión prolongada en la atención de los riesgos vinculados con el manejo de aguas pluviales y de escorrentía superficial. Asimismo, se destacó que el informe técnico CNE-UIAR-INF-1342-2023 había identificado condiciones geotécnicas de alta vulnerabilidad, pendientes pronunciadas, taludes inestables y deficiencias en la gestión de las aguas de escorrentía; de ahí que se hubiera recomendado expresamente al gobierno local mejorar el sistema pluvial de la ruta cantonal, vigilar las zonas de riesgo y adoptar las demás medidas preventivas correspondientes.
En cuanto al CONAVI, la sentencia igualmente determinó que, pese a tener conocimiento de las recomendaciones formuladas por la CNE desde el año 2023, no había ejecutado las intervenciones necesarias para corregir el manejo inadecuado de las aguas pluviales en la Dirección01. La Sala tuvo por demostrado que la ausencia de un sistema pluvial uniforme, la existencia de erosión visible y las deficiencias del sistema de desfogue mantenían una situación de riesgo cierta para las personas y propiedades colindantes. Así, el objeto de la orden impartida no era simplemente que las instituciones continuaran analizando una situación ya diagnosticada, sino que, dentro del plazo establecido, avanzaran hasta la materialización de las medidas correctivas necesarias.
Ahora bien, con ocasión de la audiencia conferida respecto de la presente gestión, las autoridades recurridas aportaron elementos que permiten acreditar que, con posterioridad al dictado de la sentencia, sí se han realizado diversas actuaciones encaminadas a atender la problemática. Esa circunstancia debe ser reconocida, pues de la documentación incorporada no se desprende una inactividad absoluta o una negativa expresa de las autoridades a observar lo resuelto por esta Sala. No obstante, el punto que debe dilucidarse en esta fase procesal no consiste únicamente en determinar si las instituciones han efectuado alguna actuación administrativa, sino en establecer si aquellas actuaciones satisfacen, en sus términos sustanciales, lo que efectivamente les fue ordenado.
En lo que corresponde al Consejo Nacional de Vialidad, se informa que una vez notificada la sentencia, se promovieron las gestiones necesarias para elaborar el denominado “Estudio Hidrológico, Hidráulico y Diseño del Sistema Colector Pluvial y Desfogue de la Ruta Nacional No. 308”, desarrollado por la empresa consultora DLZ-Carbon Ingeniería y concluido en febrero de 2026. Dicho estudio comprendió el levantamiento topográfico, la delimitación de áreas tributarias, el análisis hidrológico, la modelación hidráulica del sistema, la evaluación de la capacidad de la infraestructura existente y el diseño del nuevo sistema de captación, conducción y desfogue de aguas pluviales.
La prueba aportada permite reconocer la importancia técnica de esas actuaciones. De hecho, el estudio concluyó que el sistema pluvial existente en el tramo analizado de la Dirección01 era parcial y discontinuo y determinó la necesidad de establecer un nuevo colector pluvial con capacidad suficiente para captar la escorrentía y conducirla hacia una estructura de desfogue adecuada que redujera los procesos erosivos. Asimismo, se diseñaron tuberías, tragantes, una estructura de desfogue, gradas disipadoras, una caja disipadora y obras de protección mediante enrocado, precisamente con el propósito de controlar la energía del flujo y minimizar la erosión que afecta los terrenos vecinos.
Sin embargo, precisamente la información suministrada por el propio CONAVI permite comprobar que, al momento de resolver esta gestión, las obras materiales que constituyen el objeto central de la sentencia aún no habían sido ejecutadas. En efecto, el estudio y los planos correspondientes fueron remitidos hasta el 29 de julio de 2026 a la Dirección de Diseño de Vías y Puentes para su revisión técnica y emisión del criterio especializado, encontrándose entonces la solución apenas en una etapa final de validación institucional, previa al inicio de la ejecución material.
Más aún, el cronograma aportado por el propio Consejo Nacional de Vialidad confirma que la ejecución material fue proyectada para un momento posterior. Según dicho cronograma, la revisión del diseño se desarrollaría durante julio y agosto de 2026; el inicio del contrato de conservación vial y la correspondiente incorporación presupuestaria estaban previstos para setiembre de 2026; la coordinación con el contratista y el replanteo de campo se realizarían durante setiembre y octubre y las obras de drenaje pluvial propiamente dichas se ejecutarían entre octubre y diciembre de 2026. Posteriormente, se efectuarían labores de seguimiento entre enero y marzo de 2027 y la recepción técnica definitiva estaba prevista para marzo de ese mismo año.
Ese cronograma constituye un elemento especialmente relevante para la resolución de esta gestión, pues demuestra que, aun cuando existe una actividad administrativa concreta encaminada a alcanzar el resultado dispuesto por esta Sala, la ejecución de las obras continúa pendiente. Es decir, la propia autoridad reconoce que aún restan precisamente las actuaciones materiales indispensables para corregir el sistema de manejo de aguas pluviales y escorrentía superficial que motivó la estimatoria del recurso.
No resulta jurídicamente admisible equiparar la realización de los estudios y diseños con la ejecución integral del mandato constitucional. Es comprensible que una obra pública de esta naturaleza requiera estudios hidrológicos, levantamientos topográficos, diseños, validaciones técnicas, disponibilidad presupuestaria y mecanismos de contratación. Sin embargo, esas circunstancias forman parte de la actividad administrativa que la institución competente debe organizar para cumplir una resolución judicial y no pueden traducirse, por sí mismas, en una modificación unilateral del plazo fijado en una sentencia constitucional firme. De aceptarse lo contrario, la eficacia de los pronunciamientos de esta jurisdicción quedaría subordinada a los tiempos internos que cada Administración establezca para desarrollar sus procedimientos, aun cuando la propia Sala hubiera ponderado previamente las circunstancias del caso y fijado expresamente un término para hacer cesar la lesión comprobada.
Debe añadirse que el estudio especializado se encontraba concluido desde febrero de 2026 y no obstante, la remisión formal para su validación técnica institucional se efectuó hasta el 29 de julio siguiente. Esto es, varios meses después de contar con el documento técnico necesario y, además, con posterioridad a la presentación de la gestión de incumplimiento por parte de la recurrente. Tal circunstancia no permite concluir, sin otros elementos, que las actuaciones del CONAVI hayan sido realizadas exclusivamente como consecuencia de esta gestión; sin embargo, sí evidencia que, al momento en que la interesada acudió nuevamente ante esta Sala, la solución todavía no había alcanzado la fase de ejecución material que expresamente exigía el fallo.
Por consiguiente, no resulta suficiente el argumento del CONAVI en cuanto sostiene que existe un cumplimiento “progresivo, documentado y verificable”. Ciertamente, la documentación acredita un proceso progresivo de preparación para ejecutar las obras y permite descartar, al menos con los elementos actualmente disponibles, una absoluta indiferencia institucional frente a la sentencia. Pero la existencia de un proceso de cumplimiento no equivale al cumplimiento efectivo de una orden judicial cuyo contenido exigía adoptar y ejecutar las medidas técnicas dentro del término establecido. La propia institución admite que permanecía pendiente la ejecución material y que la recepción final del proyecto se proyectaba incluso para marzo de 2027.
Una situación semejante, aunque con particularidades propias, se presenta respecto de la Municipalidad de Santo Domingo de Heredia. El gobierno local manifiesta que ha realizado trabajos de mantenimiento y mejoramiento de los sistemas de drenaje pluvial en la red vial cantonal cercana al sector, entre ellos la colocación y sustitución de tuberías, la construcción y mejoramiento de cajas de registro y la limpieza y recuperación de estructuras de drenaje. Asimismo, afirma haber mantenido coordinación constante con el CONAVI respecto de los estudios, diseño y programación de las obras que deben realizarse sobre la Dirección01.
Tales actuaciones constituyen elementos positivos que deben ser considerados y permiten establecer, de igual forma, que no existe una inactividad municipal absoluta. Sin embargo, tampoco permiten tener por acreditado el cumplimiento integral de la orden. En primer término, la información suministrada describe de manera general diversos trabajos efectuados en la red vial cantonal, pero no individualiza suficientemente su fecha de ejecución, ubicación específica, alcance técnico ni correspondencia concreta con cada una de las recomendaciones contenidas en el informe CNE-UIAR-INF-1342-2023. De esta manera, no resulta posible concluir, únicamente a partir de tales manifestaciones, que la totalidad de las medidas impuestas en la sentencia hayan sido materialmente ejecutadas.
Debe recordarse, además, que las obligaciones impuestas a la Municipalidad no se reducían exclusivamente a la colocación de tuberías o limpieza de estructuras. El informe de la CNE considerado por esta Sala al dictar sentencia contemplaba también otras medidas relacionadas con la vigilancia de las zonas de riesgo y la prevención de nuevas afectaciones. El informe rendido en esta fase no demuestra de manera concreta el cumplimiento de todos esos extremos.
Aunado a ello, la propia Municipalidad reconoce expresamente que, pese a las actuaciones que afirma haber efectuado dentro de su ámbito competencial, la solución directa de la problemática planteada depende todavía de la ejecución del nuevo sistema colector, de las obras de desfogue y de las estructuras de disipación proyectadas en la Dirección01, cuya ejecución corresponde al CONAVI y continúa pendiente. Tal reconocimiento confirma que la situación que dio origen a la tutela constitucional no se encuentra aun materialmente solucionada.
Existe, adicionalmente, otro extremo de la sentencia cuyo cumplimiento no aparece suficientemente acreditado. Como se indicó, la parte dispositiva dispuso expresamente que tanto el CONAVI como la Municipalidad debían informar a la recurrente y a esta Sala acerca de los avances concretos y del cronograma estimado de cumplimiento. Precisamente, uno de los alegatos centrales de Nombre01 consiste en que, a la fecha de formular esta gestión, no había sido informada sobre lo que se realizaría para solucionar la situación que afecta su propiedad.
Si bien la prueba aportada acredita comunicaciones y coordinaciones entre las autoridades públicas involucradas, particularmente entre el gobierno local y el CONAVI, no se aportó documentación suficiente que demuestre que, con anterioridad a la presentación de esta gestión, se hubiese comunicado directamente a la recurrente, en cumplimiento de la sentencia, cuáles habían sido los avances concretos obtenidos y cuál era el cronograma previsto para ejecutar las medidas ordenadas. Por consiguiente, tampoco puede tenerse por demostrado el cumplimiento de esa obligación específica.
Así las cosas, del contraste entre el contenido de la sentencia y los informes rendidos en esta fase se concluye que las autoridades recurridas han desplegado actuaciones dirigidas al cumplimiento, pero no han acreditado haber satisfecho integralmente la orden impartida. Esta distinción resulta fundamental. Una cosa es que exista actividad administrativa encaminada a cumplir y otra diferente es que el fallo haya sido efectivamente ejecutado en los términos dispuestos por esta jurisdicción.
En el caso del CONAVI, el incumplimiento resulta particularmente evidente porque su propio cronograma demuestra que las obras principales se encuentran pendientes y han sido programadas para fechas posteriores. En cuanto a la Municipalidad de Santo Domingo de Heredia, aunque se acreditan determinadas actuaciones en la red vial cantonal, no se demuestra de manera suficiente que se hayan ejecutado todas las medidas técnicas que le correspondían conforme al informe de la CNE y a la sentencia, ni que se haya satisfecho oportunamente el deber de información impuesto a favor de la recurrente.
Debe aclararse que aun reconociendo los estudios, diseños, trabajos municipales y coordinaciones interinstitucionales realizadas después del dictado del fallo, lo cierto es que a la fecha de presentación de la gestión de incumplimiento la situación que motivó la estimatoria del amparo no había sido solucionada y las principales obras necesarias para corregirla continuaban pendientes de ejecución. Precisamente esa circunstancia explica y justifica que la recurrente acudiera nuevamente ante esta jurisdicción constitucional: no se trató de plantear una nueva controversia ni de cuestionar simples aspectos administrativos derivados de la ejecución, sino de denunciar que el resultado material expresamente ordenado por esta Sala todavía no se había producido.
Por todo lo expuesto, procede acoger la gestión de incumplimiento planteada por Nombre01, pues los elementos incorporados al expediente permiten determinar que la sentencia No. 2025033778 de las 09:20 horas del 17 de octubre de 2025 no ha sido cumplida integralmente en los términos ordenados.
En consecuencia, lo que corresponde es acoger la gestión de inejecución interpuesta y ordenar a MAURICIO SOJO QUESADA, en su condición de DIRECTOR EJECUTIVO A.I. DEL CONSEJO NACIONAL DE VIALIDAD (CONAVI); así como a JORGE FONSECA FONSECA y JÉSSICA CANO CHAVES, por su orden ALCALDE y ENCARGADA DE LA UNIDAD TÉCNICA DE GESTIÓN VIAL MUNICIPAL, ambos de la MUNICIPALIDAD DE SANTO DOMINGO, o a quienes en su lugar ejerzan dichos cargos, que cumplan con lo ordenado por esta Sala en la sentencia No. 2025033778 de las 09:20 horas del 17 de octubre de 2025. Lo anterior, bajo la advertencia de que, de acreditarse la desobediencia, se podrá ordenar la apertura de un procedimiento en su contra, de conformidad con los artículos 53 y 71 de la Ley de la Jurisdicción Constitucional.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se le reitera a MAURICIO SOJO QUESADA, en su condición de DIRECTOR EJECUTIVO A.I. DEL CONSEJO NACIONAL DE VIALIDAD (CONAVI); así como a JORGE FONSECA FONSECA y JÉSSICA CANO CHAVES, por su orden ALCALDE y ENCARGADA DE LA UNIDAD TÉCNICA DE GESTIÓN VIAL MUNICIPAL, ambos de la MUNICIPALIDAD DE SANTO DOMINGO, o a quienes en su lugar ejerzan dichos cargos, que cumplan con lo ordenado por esta Sala en la sentencia No. 2025033778 de las 09:20 horas del 17 de octubre de 2025. Lo anterior, bajo la advertencia que de acreditarse la desobediencia alegada, se podrá ordenar la apertura de un procedimiento en su contra (artículo 53 de la Ley de la Jurisdicción Constitucional). Notifíquese este pronunciamiento a MAURICIO SOJO QUESADA, en su condición de DIRECTOR EJECUTIVO A.I. DEL CONSEJO NACIONAL DE VIALIDAD (CONAVI); así como a JORGE FONSECA FONSECA y JÉSSICA CANO CHAVES, por su orden ALCALDE y ENCARGADA DE LA UNIDAD TÉCNICA DE GESTIÓN VIAL MUNICIPAL, ambos de la MUNICIPALIDAD DE SANTO DOMINGO, o quienes en su lugar ejerzan dichos cargos, en forma personal. - Fernando Castillo V.
