CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 11 August 2026.

Amparo proceeding registered under expediente number 26-025320-0007-CO, filed by Nombre01, identity card CED02, against the MINISTERIO DE AMBIENTE Y ENERGÍA.

Background:

  1. 1By written submission filed with the Chamber’s Secretariat on 15 July 2026, the applicant brings an amparo proceeding against the MINISTERIO DE AMBIENTE Y ENERGÍA. The applicant states that they are the registered owner of the property recorded under real-property folio matrícula No. PRN01, covered by cadastral plan SJ-38407-2025 and located in Barrio Morazán, Pérez Zeledón. They acquired it in good faith in 2024 for the sole purpose of building a 42 m² single-family social-interest home, financed through the Bono Familiar de Vivienda. For that purpose, they obtained the Declaration of Social Interest for Individual Cases No. 2260-2025; the construction project registered with CFIA under code CED01; the respective certificates of potable-water availability issued by AyA and electrical availability granted by ICE; municipal right of way; plan approval; and Land-Use Certificate No. CRT-5654-2025-ACO, which classified residential use as compliant.The applicant indicates that, despite meeting all technical and urban-planning requirements, on 2 February 2026 the Municipality of Pérez Zeledón denied the construction-permit application, stating that the property lies within an area of forest cover according to the official SINAC map, leaving the project subject to the environmental authority’s opinion. The applicant explains that a subsequent technical report, SINAC-ACLA-P-DR-GMRN-SRPZ-INF-0054-2026, based on an inspection conducted on 6 March 2026, expressly acknowledged that the property has no forest cover, but is instead an area covered by grasses and ornamental plants. Nevertheless, in letter CARTA-SINAC-ACLA-P-DR-GMRN-SRPZ-0310-2026, dated 28 April 2026, SINAC maintained the restriction, asserting that the land had historically formed part of a forest area. The applicant considers this position inconsistent with FONAFIFO’s official forest-cover maps for 2000 and 2005, which place the property outside forest cover.The applicant adds that the respondent authority treated them unequally by continuing to block the project while permitting nearby construction, and also refused to explain the difference in its approach. The applicant alleges that they are being made to bear the consequences of alleged forest-cover removal in 2019, before they acquired the property, despite the absence of any criminal or administrative proceeding or final decision establishing their responsibility. They consider this an infringement of their rights to decent housing of social interest, private property, due process, the presumption of innocence, the principle that sanctions are personal, and equality, as well as the principles of reasonableness, proportionality, and environmental reality. The applicant adds that maintaining the restriction puts the validity of the Bono Familiar de Vivienda and the possibility of carrying out the housing project at risk. The applicant requests the Chamber’s intervention.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily dismiss or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is simply a reiteration or reproduction of an earlier identical or similar application that was rejected.

Drafted by Justice Castillo Víquez; and, Reasons:

I. SUBJECT OF THE AMPARO

The applicant complains that the respondent authorities denied and continue to block the construction-permit application for a social-interest housing project, despite the applicant’s having a Declaration of Social Interest, compliant land use, and the corresponding technical approvals, on the ground that the property lies within an area of forest cover, even though a SINAC technical report found that it has no forest cover. The applicant also alleges that they are being made to bear the consequences of alleged deforestation that occurred before they acquired the property and that they were treated unequally compared with neighboring properties. The applicant considers the fundamental rights to decent housing of social interest, private property, equality, due process, and the presumption of innocence, as well as the principle that sanctions are personal, to have been infringed. The applicant seeks to have the restrictions imposed set aside and to be allowed to continue the construction-permit process so the housing project can be carried out.

II. INADMISSIBILITY OF THE AMPARO

Having considered the applicant’s arguments, the Chamber observes that the applicant is challenging the decisions of the respondent authorities concerning the construction-permit application for a social-interest housing project and the determination that the property is subject to restrictions due to forest cover. In this regard, the applicant is advised that this Chamber is not a reviewer of the legality of the actions or decisions issued by the Municipality of Pérez Zeledón or the Sistema Nacional de Áreas de Conservación (SINAC). Accordingly, it does not act as an appellate court in this matter and cannot review whether the respondent authorities’ decisions concerning the denial of the construction application and the technical criteria supporting it conform to the facts and applicable law, nor assess the merits of the reasons for those decisions or the authority of the bodies that issued them.

These are matters of ordinary legality, to be contested through the ordinary channels and not before this specialized jurisdiction. Nor may the Chamber usurp the powers legally assigned to the respondent authorities to determine, under the applicable regulations, whether the property has forest cover, whether the restriction imposed is warranted, how to assess the technical reports, official maps, and other environmental studies, or whether a construction permit should be granted. Those tasks belong to the respondent authorities, and any disputes must be resolved through the ordinary administrative or judicial channels. In light of the foregoing, if the applicant disagrees with the decisions, they may, if they so wish, pursue any claims they consider appropriate through the corresponding administrative or judicial channel. Accordingly, the amparo is inadmissible, and so it is declared.

III. DOCUMENTATION SUBMITTED TO THE EXPEDIENTE

The applicant is advised that if they submitted any paper documents, or objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo is summarily dismissed.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .

Recurso de amparo que se tramita bajo el número de expediente 26-025320-0007-CO, interpuesto por Nombre01, cédula de identidad CED02; contra el MINISTERIO DE AMBIENTE Y ENERGÍA.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala el 15 de julio de 2026, la parte recurrente interpone recurso de amparo contra el MINISTERIO DE AMBIENTE Y ENERGÍA. Manifiesta que es propietario registral del inmueble matrícula de folio real N.° PRN01, amparado al plano catastrado SJ-38407-2025, ubicado en Barrio Morazán de Pérez Zeledón, adquirido de buena fe en el año 2024 con el propósito exclusivo de construir una vivienda unifamiliar de interés social de 42 m², financiada mediante el Bono Familiar de Vivienda, para lo cual obtuvo la Declaratoria de Interés Social para Casos Individuales N.° 2260-2025, el proyecto constructivo inscrito ante el CFIA bajo el código CED01 las respectivas constancias de disponibilidad de agua potable emitida por el AyA, disponibilidad eléctrica otorgada por el ICE, derecho de vía municipal, visado del plano y Certificado de Uso de Suelo N.° CRT-5654-2025-ACO, que calificó el uso residencial como conforme.Indica que, pese a cumplir con todos los requisitos técnicos y urbanísticos, la Municipalidad de Pérez Zeledón rechazó el 2 de febrero de 2026 el trámite de licencia de construcción al señalar que el inmueble se ubica dentro de un área de cobertura boscosa según el mapa oficial del SINAC, quedando el proyecto sujeto al criterio de dicha autoridad ambiental. Expone que posteriormente el informe técnico SINAC-ACLA-P-DR-GMRN-SRPZ-INF-0054-2026, producto de la inspección realizada el 6 de marzo de 2026, reconoció expresamente que el inmueble no presenta cobertura forestal, sino un área cubierta por gramíneas y plantas ornamentales; sin embargo, mediante el oficio CARTA-SINAC-ACLA-P-DR-GMRN-SRPZ-0310-2026, de 28 de abril de 2026, el SINAC mantuvo la restricción al afirmar que históricamente el terreno formó parte de un área de bosque, criterio que el recurrente considera contradictorio con los mapas oficiales de cobertura forestal de FONAFIFO de los años 2000 y 2005, los cuales ubican la propiedad fuera de cobertura forestal.Agrega que la autoridad recurrida incurrió en un trato desigual al mantener el bloqueo de su proyecto mientras existen construcciones cercanas autorizadas, negándose además a brindar explicaciones sobre esa diferencia de criterio. Alega que se le atribuyen las consecuencias de una supuesta eliminación de cobertura forestal ocurrida en 2019, antes de que adquiriera el inmueble, sin existir proceso penal, administrativo ni resolución firme que determine su responsabilidad, lo que estima lesiona su derecho a una vivienda digna y de interés social, a la propiedad privada, al debido proceso, a la presunción de inocencia, al principio de personalidad de las sanciones, a la igualdad y a los principios de razonabilidad, proporcionalidad y realidad ambiental. Añade que el mantenimiento de la restricción pone en riesgo la vigencia del Bono Familiar de Vivienda y la posibilidad de ejecutar el proyecto habitacional. Solicita la intervención de la Sala.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La persona recurrente reclama que las autoridades recurridas rechazaron y mantienen bloqueado el trámite de licencia de construcción de un proyecto de vivienda de interés social, pese a contar con la Declaratoria de Interés Social, uso de suelo conforme y las autorizaciones técnicas correspondientes, al considerar que el inmueble se ubica dentro de un área de cobertura boscosa, aun cuando un informe técnico del SINAC constató que no presenta cobertura forestal; además, acusa que se le atribuyen las consecuencias de una supuesta deforestación ocurrida antes de adquirir el inmueble y que recibió un trato desigual respecto de propiedades vecinas. Estima lesionados los derechos fundamentales a la vivienda digna y de interés social, a la propiedad privada, a la igualdad, al debido proceso, a la presunción de inocencia y al principio de personalidad de las sanciones. Pretende que se dejen sin efecto las restricciones impuestas y se permita la continuación del trámite de la licencia de construcción para ejecutar el proyecto habitacional.

II. INADMISIBILIDAD DEL AMPARO

Vistos los alegatos del recurrente, se observa que lo que plantea es su inconformidad con lo resuelto por las autoridades recurridas respecto del trámite de licencia de construcción de un proyecto de vivienda de interés social y la determinación de que el inmueble se encuentra sujeto a restricciones por cobertura boscosa. Al respecto, se le hace saber que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones que emitan la Municipalidad de Pérez Zeledón o el Sistema Nacional de Áreas de Conservación (SINAC), por lo que no le corresponde actuar como tribunal de alzada en la materia y revisar si lo resuelto por las autoridades recurridas, en relación con el rechazo del trámite constructivo y los criterios técnicos que lo sustentan, se ajusta a los hechos y la normativa vigente, ni el mérito de las razones que justificaron tales decisiones o la competencia de los órganos que resolvieron, por cuanto se trata de cuestionamientos de mera legalidad, propios de discutirse en la vía ordinaria y no en esta jurisdicción especializada.

Tampoco le corresponde usurpar las competencias legalmente asignadas a las autoridades recurridas a fin de determinar, conforme a la normativa aplicable en la materia, si el inmueble presenta o no cobertura forestal, si resulta procedente la restricción impuesta, la valoración de los informes técnicos, mapas oficiales y demás estudios ambientales, o si procede o no el otorgamiento de la licencia de construcción, lo anterior por ser una labor propia de las autoridades recurridas, cuyos diferendos deben dirimirse en la vía ordinaria, administrativa o jurisdiccional. En virtud de lo expuesto, si el recurrente se encuentra inconforme con lo resuelto deberá, si a bien lo tiene, plantear los reclamos que estime pertinentes en la vía administrativa o judicial correspondiente. En consecuencia, el recurso es inadmisible y así se declara.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
