CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (Sala Constitucional). San José, at 9:25 a.m. on 11 August 2026.

Application to supplement and clarify judgment No. 2026028996, issued at 9:25 a.m. on 30 July 2026 in the amparo proceeding conducted under case file No. 26-022997-0007-CO, filed by Nombre01, identity card CED01, against the MINISTRY OF HEALTH and the MUNICIPALITY OF SAN RAMÓN.

Background:

  1. 1By a brief filed with this Constitutional Jurisdiction on 7 August 2026 at 15:16, within the third business day following service of the judgment—which was effected on 4 August 2026—the applicant, Nombre01, seeks to supplement and clarify judgment No. 2026028996. First, she states that she acknowledges that this Chamber’s intervention had a concrete effect on how the case was handled, since, following the request for a report made by the justices, the San Ramón Health Area resumed its handling of her complaint as of 3 July 2026 and conducted a dye test in the septic system of the adjoining property on 9 July 2026. She directly observed the result on her property on 16 July 2026. She contends, however, that this finding, far from demonstrating that the administrative measures were effective or that the investigation had concluded, shows the need to adopt urgent measures, particularly since another discharge of intensely foul-smelling water occurred between 26 and 27 July 2026, without first ensuring that septic seepage into her property had ceased.She notes that the judgment extensively reproduces the reports submitted by the Municipality of San Ramón and the Health Area, and concludes on that basis that the respondent authorities adopted effective measures. However, it does not expressly address the briefs she filed on 20, 22, and 29 July 2026, by which she submitted documentary and audiovisual evidence concerning the dye test of 9 July 2026, her observations on the respondent authorities’ reports, and the septic discharge of 26 and 27 July 2026. On that basis, she respectfully requests: first, clarification as to whether those briefs and evidence were incorporated into the record and considered when the judgment was issued, and what bearing they had on the conclusion regarding the effectiveness of the actions taken; second, supplementation of the decision with an express ruling on the observation made on 16 July 2026, the persistence of the discharges from 26 to 27 July 2026, and the bearing of her status as a 71-year-old older adult on the protection sought; third, clarification as to whether the Chamber considered that the Ministry of Health performed the dye test, which had been pending since late April 2026, at only two of the three dwellings on the adjoining property, and only after the Chamber’s request for a report; fourth, clarification as to how the conclusion regarding the effectiveness of the actions taken can be reconciled with the fact that the Ministry of Health again ceased its activity after submitting the requested report, despite the technical investigation remaining incomplete; and fifth, clarification as to whether it was considered that, after 10 July 2026, that Ministry did not follow up on the availability dates indicated by the applicant herself, namely, 20 and 27 July 2026.
  2. 2In the conduct of these proceedings, the legal requirements have been observed.

Justice Cruz Castro writes; and, Reasons:

I.The Constitutional Jurisdiction Act empowers this Chamber to supplement and clarify its judgments where appropriate, providing: “Article 12.- The Chamber’s judgments may be clarified or supplemented at a party’s request, if requested within three days, and on the Chamber’s own initiative at any time, including in enforcement proceedings, to the extent necessary to give full effect to the judgment.” Thus, a ruling may be supplemented when a point raised in the original application was not decided in the judgment, and clarified when the judgment was decided in unclear or ambiguous terms, making it difficult to understand. Supplementation and clarification are procedural instruments for completing a judgment or explaining the scope of the ruling; they are not a means of reopening the merits debate that has already been resolved.

II.A judgment may be supplemented or clarified only to complete it if one of the points debated was not decided, or to explain the scope of the ruling on an issue that may have been left unclear. In addition, the second paragraph of Article 11 of the Constitutional Jurisdiction Act clearly states: “No remedy shall lie against judgments, orders, or rulings of the Constitutional Jurisdiction.” Accordingly, this procedure cannot be used to seek a new assessment of the evidence or to have the Chamber supply or review technical criteria that fall within the Administration’s own authority.

III.In this matter, the applicant’s request cannot be granted on the terms sought, for the following reasons.

First, this Chamber ruled on all the matters within the scope of the amparo application. Judgment No. 2026028996 analyzed, with respect to both the Ministry of Health and the Municipality of San Ramón, all actions taken in connection with complaint D-SR-059-2026—inspections, dye tests, the technical report, the Sanitary Order, and follow-up—as set out in Proven Facts 1 through 14 and Reason IV of that decision. It also addressed the applicant’s status as an older adult, which was expressly noted in the Background and weighed as part of the factual context of the matter. There is therefore no matter from the original debate that was left undecided and warrants supplementation.

Second, this Chamber did not omit any evidence. The briefs filed by the applicant on 20, 22, and 29 July 2026 were added to the case file before judgment was issued and formed part of the body of evidence considered as a whole by this Court. The fact that the judgment does not identify each brief by its filing date does not mean they were omitted: their substantive contents—the persistence of seepage, the dye test performed on 9 July 2026, and its results—were expressly considered in Proven Facts 4, 6, 13, and 14, as well as in Reason IV, when assessing whether the respondent authorities had adopted effective measures in response to the complaint. Supplementation and clarification do not require the Chamber to cite each individual item in the case file by name; they require verification that its substantive content was taken into account, which is established in this case.

Third, the facts the applicant describes as new—the observation made on 16 July 2026 and the discharge of 26 and 27 July 2026—are not autonomous and independent facts outside the scope of what was already considered in these proceedings. Rather, they directly arise from the same factual situation that gave rise to complaint D-SR-059-2026 and that the respondent authorities were already addressing through Sanitary Order OS-MS-DRRSCO-DARS-SR-RS-OS-1484-2026 and the corresponding follow-up actions. They are therefore part of the ordinary course of an administrative proceeding that remains active and has not concluded, rather than novel circumstances warranting supplementation of a final judgment.

Fourth, it must be recalled that it is not this Chamber’s role to supply the technical criteria that fall within the respondent authorities’ remit. The third, fourth, and fifth parts of the request—concerning whether the dye test should have been conducted in all three dwellings on the adjoining property rather than only two, whether it should have been conducted as early as late April 2026, and whether the Ministry of Health should have promptly followed up on the dates when the applicant said she would be available—concern technical assessments and administrative timing within the ongoing health investigation under case file D-SR-059-2026. Those matters are for the Directorate of the San Ramón Health Area to determine, not this Constitutional Jurisdiction, and this does not entail replacing the Administration’s technical judgment with that of this Chamber.

Fifth, it must likewise be recalled that these proceedings were heard precisely because of the alleged failure or delay by the respondent authorities in addressing complaint D-SR-059-2026, as explained in Reason I of judgment No. 2026028996, since that claim fell within an exception to the ordinary referral of such matters to the administrative-litigation jurisdiction. The scope of this Chamber’s review was therefore limited to determining whether the alleged inactivity had constitutional significance as of the date of judgment, not to continuously monitoring each subsequent technical action or determining the exact source of the reported seepage.

Finally, it must be clarified—insofar as this affects the proper understanding of the judgment’s scope—that dismissal of the amparo application, because no delay of constitutional significance had been established as of the date of judgment, does not release the Ministry of Health or the Municipality of San Ramón from continuing, within their respective areas of authority, the administrative and technical actions needed to complete the pending investigation and verify compliance with Sanitary Order OS-MS-DRRSCO-DARS-SR-RS-OS-1484-2026, until the sanitary situation reported by the applicant is definitively resolved. Dismissal of the amparo does not in any way entail suspension or closure of that administrative proceeding.

Accordingly, since no omission requiring supplementation or ambiguity requiring clarification has been found beyond what is stated in the preceding paragraph, the proper course is to deny the requested supplementation.

IV. DOCUMENTS SUBMITTED TO THE CASE FILE

The parties are advised that any paper document, as well as any objects or evidence stored on an additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be retrieved from the Court office within a maximum of 30 business days from service of this judgment. Otherwise, all such material not retrieved within this period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 on 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

THEREFORE:

It is clarified that dismissal of the amparo application ordered in judgment No. 2026028996 does not exempt the Ministry of Health or the Municipality of San Ramón from continuing the necessary administrative and technical actions within case file D-SR-059-2026 until the sanitary situation reported is definitively resolved. In all other respects, the request for supplementation and clarification is denied. Notify the parties.- Fernando Castillo V.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .

Gestión de aclaración y adición de la sentencia N.° 2026028996 de las nueve horas veinticinco minutos del treinta de julio de dos mil veintiséis, dictada dentro del recurso de amparo que se tramita en el expediente número 26-022997-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE SAN RAMÓN.

Resultando:

  1. 1Mediante escrito presentado ante esta Jurisdicción Constitucional el 7 de agosto de 2026, a las 15:16 horas, dentro del tercer día hábil siguiente a la notificación de la sentencia -diligenciada el 4 de agosto de 2026-, la recurrente Nombre01 interpone gestión de adición y aclaración de la sentencia N.° 2026028996. Manifiesta, en primer término, que reconoce que la intervención de esta Sala produjo un efecto concreto en la atención del caso, pues a raíz del requerimiento de informe formulado por los señores Magistrados, el Área Rectora de Salud de San Ramón retomó su denuncia a partir del 3 de julio de 2026 y practicó, el 9 de julio de 2026, una prueba de coloración en el sistema séptico del inmueble colindante, cuyo resultado constató directamente en su propiedad el 16 de julio de 2026. Sostiene, sin embargo, que ese hallazgo, lejos de demostrar que las medidas administrativas fueron eficaces o que la investigación se encontraba concluida, evidencia la necesidad de adoptar medidas urgentes, máxime cuando entre el 26 y el 27 de julio de 2026 se produjo una nueva descarga de aguas de intensa fetidez, sin que se hubiera garantizado previamente el cese de las filtraciones de origen séptico hacia su propiedad.Señala que la sentencia reproduce ampliamente los informes rendidos por la Municipalidad de San Ramón y el Área Rectora de Salud, y concluye con base en ellos que las autoridades recurridas adoptaron medidas eficaces, pero no se refiere expresamente a los escritos que presentó los días 20, 22 y 29 de julio de 2026, mediante los cuales aportó prueba documental y audiovisual relacionada con la coloración del 9 de julio de 2026, sus observaciones a los informes de las autoridades recurridas, y la descarga séptica del 26 y 27 de julio de 2026. Con fundamento en lo anterior, solicita respetuosamente: primero, que se aclare si esos escritos y pruebas fueron incorporados y valorados al dictarse la sentencia y qué incidencia tuvieron en la conclusión sobre la eficacia de las actuaciones; segundo, que se adicione la resolución con un pronunciamiento expreso sobre la constatación del 16 de julio de 2026, la persistencia de las descargas del 26 al 27 de julio de 2026, y la incidencia de su condición de persona adulta mayor de 71 años en la tutela solicitada; tercero, que se aclare si se valoró que el Ministerio de Salud practicó la prueba de coloración pendiente desde finales de abril de 2026 únicamente a dos de las tres viviendas del inmueble colindante, y solo después del requerimiento de informe de esta Sala; cuarto, que se aclare cómo se concilia la conclusión sobre la eficacia de las actuaciones con el hecho de que el Ministerio de Salud cesó nuevamente su actividad una vez rendido el informe solicitado, pese a que la investigación técnica permanece inconclusa; y quinto, que se aclare si se consideró que, después del 10 de julio de 2026, dicho Ministerio no dio seguimiento a las fechas de disponibilidad que la propia recurrente había indicado, a saber, el 20 y el 27 de julio de 2026.
  2. 2En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I.La Ley de la Jurisdicción Constitucional faculta a esta Sala para adicionar y aclarar sus sentencias en aquellos casos en que resulte procedente, al disponer: "Artículo 12.- Las sentencias que dicte la Sala podrán ser aclaradas o adicionadas, a petición de parte, si se solicitare dentro de tercero día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo." Así, la adición de un pronunciamiento procede cuando un punto del planteamiento original del recurso no fue resuelto en el fallo, y la aclaración cuando dicho fallo fue resuelto en términos oscuros o ambiguos, implicando de esta forma una difícil comprensión de este. La adición y la aclaración constituyen un instrumento procesal para complementar una sentencia o explicar los alcances que tiene el fallo, y no una vía para reabrir el debate de fondo ya resuelto.

II.Las adiciones y aclaraciones de una sentencia proceden, únicamente, para completarla en caso de que alguno de los puntos debatidos no hubiere sido fallado, o para explicar los alcances del fallo en alguna cuestión que pudiera haber quedado confusa. Asimismo, el párrafo segundo del artículo 11 de la Ley de la Jurisdicción Constitucional es claro al indicar que "No habrá recurso contra las sentencias, autos o providencias de la jurisdicción constitucional." En consecuencia, esta vía no puede emplearse para plantear una nueva valoración de la prueba, ni para que la Sala supla o revise los criterios técnicos que corresponden a la propia Administración dentro de sus competencias.

III.En el presente asunto, la gestión formulada por la recurrente no resulta atendible en los términos solicitados, por las siguientes razones.

En primer lugar, esta Sala resolvió sobre todos los extremos que integraban el objeto del recurso. La sentencia N.° 2026028996 analizó, tanto respecto del Ministerio de Salud como de la Municipalidad de San Ramón, la totalidad de las actuaciones desplegadas dentro de la denuncia D-SR-059-2026 -inspecciones, pruebas de coloración, informe técnico, Orden Sanitaria y su seguimiento-, según consta en los Hechos Probados 1 a 14 y en el Considerando IV de dicha resolución, e igualmente se pronunció sobre la condición de persona adulta mayor de la recurrente, la cual fue expresamente recogida en el Resultando y ponderada como parte del contexto fáctico del asunto. No existe, por tanto, un extremo del debate original que haya quedado sin resolver ni que amerite ser adicionado.

En segundo lugar, esta Sala no pretirió ninguna prueba. Los escritos presentados por la recurrente los días 20, 22 y 29 de julio de 2026 fueron incorporados al expediente con anterioridad al dictado de la sentencia y formaron parte del acervo probatorio integralmente considerado por este Tribunal. Que la sentencia no individualice cada escrito por su fecha de presentación no significa que hayan sido omitidos: su contenido sustancial -la persistencia de filtraciones, la prueba de coloración practicada el 9 de julio de 2026 y sus resultados- fue expresamente valorado en los Hechos Probados 4, 6, 13 y 14, así como en el Considerando IV, al analizarse si las autoridades recurridas habían adoptado medidas eficaces frente a lo denunciado. No corresponde a la aclaración y adición imponer a la Sala el deber de citar nominalmente cada pieza del expediente, sino verificar que su contenido sustancial haya sido tomado en cuenta, lo que en este caso se encuentra acreditado.

En tercer lugar, los hechos que la recurrente califica como nuevos -la constatación del 16 de julio de 2026 y la descarga del 26 y 27 de julio de 2026- no constituyen hechos autónomos e independientes del objeto ya conocido en este proceso, sino consecuencia directa de la misma situación fáctica que dio origen a la denuncia D-SR-059-2026 y que ya venía siendo atendida por las autoridades accionadas mediante la Orden Sanitaria OS-MS-DRRSCO-DARS-SR-RS-OS-1484-2026 y las diligencias de seguimiento correspondientes. Se trata, en consecuencia, del desenvolvimiento ordinario de un procedimiento administrativo que continúa activo y no concluido, y no de circunstancias novedosas que ameriten una adición de lo resuelto en sentencia firme.

En cuarto lugar, debe recordarse que no es labor de esta Sala suplir los criterios técnicos que corresponden a las autoridades recurridas. Los extremos tercero, cuarto y quinto de la gestión formulada -relativos a si la prueba de coloración debió practicarse en las tres viviendas del inmueble colindante y no solo en dos, a si dicha prueba debió realizarse desde finales de abril de 2026, y a si el Ministerio de Salud debió dar seguimiento inmediato a las fechas de disponibilidad señaladas por la recurrente- constituyen valoraciones de orden técnico y de oportunidad administrativa propias de la investigación sanitaria en curso dentro del expediente D-SR-059-2026, cuya determinación compete a la Dirección del Área Rectora de Salud de San Ramón y no a esta Jurisdicción Constitucional, sin que ello implique sustituir el criterio técnico de la Administración por el de esta Sala.

En quinto lugar, de igual manera, debe recordarse que este proceso se conoció, precisamente, por la supuesta dilación o demora de las autoridades accionadas en atender la denuncia D-SR-059-2026, tal como se explicó en el Considerando I de la sentencia N.° 2026028996, al constituir dicho reclamo un supuesto de excepción a la remisión ordinaria de este tipo de asuntos a la jurisdicción contencioso-administrativa. El objeto de conocimiento de esta Sala se circunscribió, entonces, a determinar si la inactividad alegada resultaba constitucionalmente relevante a la fecha de la sentencia, y no a fiscalizar de manera continua cada diligencia técnica posterior ni a determinar el origen exacto de las filtraciones denunciadas.

Finalmente, debe aclararse -en tanto ello sí incide en la correcta comprensión del alcance del fallo- que la desestimatoria del recurso, por no haberse acreditado a la fecha de la sentencia una dilación con relevancia constitucional, no releva al Ministerio de Salud ni a la Municipalidad de San Ramón de continuar, dentro del ámbito de sus competencias, con las actuaciones administrativas y técnicas necesarias para concluir la investigación pendiente y verificar el cumplimiento de la Orden Sanitaria OS-MS-DRRSCO-DARS-SR-RS-OS-1484-2026, hasta la resolución definitiva de la situación sanitaria denunciada por la recurrente. La desestimación del amparo no implica, en modo alguno, la paralización o el cierre de dicho procedimiento administrativo.

En consecuencia, al no advertirse omisión alguna que deba ser suplida ni oscuridad que requiera ser aclarada más allá de lo indicado en el párrafo anterior, lo procedente es rechazar la adición solicitada.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se aclara que la desestimatoria del recurso de amparo dispuesta en la sentencia N.° 2026028996 no exime al Ministerio de Salud ni a la Municipalidad de San Ramón de continuar con las actuaciones administrativas y técnicas necesarias, dentro del expediente D-SR-059-2026, hasta la resolución definitiva de la situación sanitaria denunciada. En lo demás, no ha lugar a la gestión de adición y aclaración formulada. Notifíquese.- Fernando Castillo V.
