Drafted by Justice Castillo Víquez; and, REASONS:
In judgment No. 202602965, issued at 09:25 on 4 August 2026, this Chamber declared inadmissible an amparo proceeding filed by the appellant, based on the following considerations:
“I.- SUBJECT OF THE AMPARO. The appellant challenges the actions of the Municipality of Goicoechea, because some trees were felled but not removed from the site. The appellant requests this Chamber’s intervention.
The purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a general instrument for guaranteeing the principle of constitutional supremacy or the principle of legality, through which it would be possible to bring an action against any other kind of constitutional or legal breach. Thus, the filing submitted by the appellant is a request for assistance, made in the hope that this Court will intervene or lend its good offices to the respondent municipality so that the felled trees may be removed. The appellant may, if they so wish, turn to the appropriate legal avenue to file there whatever matters they consider pertinent so that the matter may be resolved as the law requires. Accordingly, the application is inadmissible.
The appellant is advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic or new-technology device, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court in Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The application is dismissed summarily.” For the foregoing reasons, since the facts underlying this application have already been considered by this Chamber in the judgment partially transcribed above, it is inadmissible to address the same allegations, as they merely reiterate what was decided in the cited judgment. Accordingly, the appellant shall abide by what was decided in those judgments.

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra LA MUNICIPALIDAD DE GOICOECHEA
RESULTANDO:
Redacta el Magistrado Castillo Víquez; y,
CONSIDERANDO:
Esta Sala, en la sentencia No. 202602965 de las 09:25 horas del 4 de agosto de 2026, declaró inadmisible un recurso de amparo interpuesto por la parte recurrente, basado en las siguientes consideraciones:
“I.- OBJETO DEL AMPARO. La parte recurrente cuestiona las actuaciones de la Municipalidad de Goicoechea, por cuanto se talaron algunos árboles, pero no se retiraron del lugar. Solicita la intervención de esta Sala.
La finalidad del recurso de amparo, es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no la de servir como un instrumento genérico para garantizar el principio de supremacía constitucional o el principio de legalidad, por medio del cual sea posible accionar contra cualquier otra clase de quebrantos constitucionales o legales. Así, la gestión formulada por la parte recurrente es una petición de ayuda, presentada con el afán de que este Tribunal intervenga o interponga sus buenos oficios ante el municipio recurrido, para que se retiren los árboles que fueron talados. Por ello, podrá la parte recurrente, si a bien lo tiene, acudir ante la vía de legalidad respectiva, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se rechaza de plano el recurso”.
Por lo anterior, como los hechos que sirven de base a este recurso, ya fueron objeto de conocimiento por parte de esta Sala, en la Sentencia parcialmente transcrita, resulta improcedente manifestarse sobre los mismos alegatos, pues constituyen una mera reiteración de lo resuelto en la Sentencia de cita. Por lo expuesto, deberá la parte recurrente estarse a lo resuelto en dichas sentencias.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
