Document Review CASE FILE No. 26-027852-0007-CO PROCEEDING: AMPARO PROCEEDING RULING No. 2026030781 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 11 August 2026.
Amparo proceeding brought by Nombre02, identity card CED01, against DESARROLLADORA JKL AND CONDOMINIO VISTA DEL CENTRO.
Background:
Drafted by Justice Castillo Víquez; and, Reasons:
The applicant states that she is a resident of Condominio Vista del Centro, located in San Sebastián. She alleges that the condominium administration uses the suspension of the drinking water supply as a means of pressure against some residents. In her case, the service was suspended on 31 July 2026 and, as of this date, she still has no access to it. She states that she lives with minors. She requests the Chamber’s intervention.
Regarding the grievances raised, it should be stated that this Chamber is not responsible for ruling on disputes arising from the application of contractual and civil rules governing the relationship between condominium owners and the administrative bodies of condominiums.
In this regard, in judgment No. 2016-04185, issued at 2:30 p.m. on 29 March 2016, this Court stated:
“(…) the applicant must take into account that the property regime chosen upon acquiring the property is governed by the provisions of the Condominium Property Regulatory Act -Law No. 7933-, which provides not only for the existence of a Condominium and Administration Regulation governing matters relating to the condominium owners’ interests, but also establishes bodies such as the Condominium Owners’ Assembly, to which the administrator whose conduct the applicant questions is subject, and the various means by which an owner may assert their rights and those held in common. Accordingly, the matter raised by the applicant is not to be resolved before this jurisdiction, but before the bodies established under that law or, where appropriate, through the relevant civil proceedings, since it is a matter of ordinary legality. Consequently, this amparo is inadmissible, and so it is declared. (…)” That precedent applies to the case under review, since the situation alleged by the applicant concerning the application of fines and condominium regulations arises from a dispute that must be resolved through the ordinary legal channels. Accordingly, the applicant may bring the matter before that forum to debate its merits and assert the claims. Consequently, the amparo is inadmissible, and so it is declared.
In the case at hand, the applicant complains that the administration of the condominium where she resides suspended the drinking water supply to her home and continues to maintain that measure as a means of pressure to obtain payment of other charges, a situation that, she claims, also affects her minor children.
In this regard, with the customary respect, we depart from the majority’s view. We consider that the alleged facts go beyond, in principle, a mere civil or condominium dispute, since suspending the drinking water supply could constitute a de facto measure intended to coerce the applicant into satisfying obligations of a different nature. This circumstance warrants examination by this jurisdiction, particularly because it involves access to drinking water as an element essential to a dignified life and protected by Article 50 of the Political Constitution, as a fundamental right of access to drinking water. On that basis, we dissent and order that the amparo proceed.
The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 working days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and order that the amparo proceed.

Revisión del Documento EXPEDIENTE N° 26-027852-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026030781 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre02, cédula de identidad CED01, contra DESARROLLADORA JKL Y CONDOMINIO VISTA DEL CENTRO.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
La recurrente manifiesta que es vecina del condominio Vista del Centro, ubicado en San Sebastián. Aduce que la administración del condominio utiliza la suspensión del suministro de agua potable como mecanismo de presión hacía algunos residentes. En su caso, el servicio fue suspendido el 31 de julio de 2026 y a la fecha continúa sin acceso. Comenta que reside con menores de edad. Solicita la intervención de la Sala.
Respecto a los agravios expuestos, es preciso indicar que a esta Sala no le corresponde pronunciarse sobre los conflictos surgidos con motivo de la aplicación de las pautas de carácter contractual y civil que regulan la relación de los condóminos con los órganos de administración de los condominios.
Sobre el particular, en sentencia n.° 2016-04185 de las 14:30 horas del 29 de marzo de 2016, esta Tribunal señaló:
“ (… ) debe tomar en cuenta el recurrente, que el régimen de propiedad por el que optó al adquirirla se rige por lo dispuesto en la Ley Reguladora de la Propiedad en Condominio -Ley No. 7933-, en la cual se dispone no solo la existencia de un Reglamento de Condominio y Administración que regula lo relativo a los intereses de los condóminos, sino que también establece órganos como la Asamblea de Condóminos, a la cual está sujeto el administrador cuya gestión cuestiona el recurrente y los diferentes medios por los cuales puede un propietario hacer valer sus derechos y los comunes. Así las cosas, lo planteado por el recurrente no corresponde ser dilucidado ante esta jurisdicción, sino ante los propios órganos dispuestos en dicha ley, o eventualmente en la vía civil respectiva, por tratarse de un asunto de mera legalidad. En consecuencia, este recurso es inadmisible y así se declara. (…)”.
Tal precedente resulta aplicable al caso en estudio, pues la situación que acusa la parte recurrente respecto a la aplicación de multas y reglamentos condominales, obedece a un diferendo que corresponde ser dilucidado ante las vías de legalidad ordinaria. De manera tal, que será en dicha sede donde el gestionante podrá acudir, a fin discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara
En el sub lite, la recurrente reclama que la administración del condominio en el que reside suspendió el suministro de agua potable de su vivienda y mantiene esa medida como mecanismo de presión para obtener el pago de otros rubros, situación que, según afirma, afecta además a sus hijos menores de edad.
Sobre el particular, con el respeto acostumbrado nos separamos del criterio de mayoría. Estimamos que los hechos alegados trascienden, en principio, un mero diferendo de naturaleza civil o condominal, pues la suspensión del suministro de agua potable podría constituir una vía de hecho dirigida a coaccionar a la recurrente para satisfacer obligaciones de distinta naturaleza. Tal circunstancia amerita ser examinada por esta jurisdicción, particularmente por involucrar el acceso al agua potable como elemento indispensable para una vida digna y tutelado por el artículo 50 de la Constitución Política, en su dimensión de derecho fundamental de acceso al agua potable. Con base en lo anterior, salvamos el voto y disponemos que se curse el amparo.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso. Los magistrados Cruz Castro y Rueda Leal salvan el voto y disponen cursar el amparo.
