Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on 11 August 2026.

Amparo proceeding processed under expediente number 26-027846-0007-CO, filed by Nombre01, identity card CED01, on behalf of CONDO SOLUTIONS SOCIEDAD ANONIMA Y OTROS; against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Background:

  1. 1By written submission filed with the Chamber’s Secretariat on 3 August 2026, the applicant files an amparo proceeding against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. The applicant states that the condominium it represents consists of 160 residential units and that the drinking water service, identified by NIS 548-4074, is used exclusively for residential consumption; however, AyA maintains the commercial-service tariff classification, which, in the applicant’s view, results in overbilling and the improper collection of Value Added Tax on a service the applicant considers exempt. The applicant reports that Resolution RE-0008-IA-2025 of ARESEP took effect on 1 March 2025, establishing the Large Residential Consumer Tariff (T-GCR), which, according to the applicant, AyA itself acknowledges in the notes on the bills issued to the condominium. The applicant states that, in response to this situation, on 15 June 2026 it filed a formal claim with AyA’s Large Clients Service Platform, requesting an end to the alleged overbilling, reclassification of the service under the T-GCR tariff, and reimbursement of amounts charged improperly.The applicant indicates that this request was denied by official letter UEN-SCMED-GAM-2026-01410, dated 16 July 2026, in which AyA based its denial on the infrastructure works not having been formally accepted. The applicant considers that this criterion adds a requirement not provided for in the tariff regime approved by ARESEP, disregards the residential nature of the service, replaces the applicable regulatory parameters with internal technical-operational provisions, and causes ongoing harm to property through the collection of a tariff the applicant considers improper. For these reasons, the applicant alleges that the respondent institution’s continuing administrative conduct violates the fundamental rights to drinking water on affordable and equitable terms, equality, property, the rights of consumers and users of public services, substantive due process, effective judicial protection, and the principle of legality.The applicant therefore requests that the amparo be granted, that application of the tariff corresponding to residential service be ordered, that the overbilling cease, and that the fundamental rights it considers violated be restored.
  2. 2By written submission added to the electronic expediente on 6 August 2026, the applicant states that, after the amparo proceeding was filed, the Comptroller General of the Republic’s Special Audit Report No. DFOE-SOS-IAD-00003-2026 was published. In the applicant’s view, the report establishes deficiencies in the tariff administration of the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and confirms improper charges affecting the 160 families that make up Sub-Condominio Jacaranda of Condominio Horizontal Residencial Lagos del Sol. The applicant adds that the report shows systematic financial harm resulting from application of a commercial tariff to the NIS 5484074 master meter, even though the applicant considers the Large Residential Consumer Tariff (T-GCR) applicable. The applicant considers this to violate the principle that services be provided at cost, the human right to water, and other fundamental rights of users.The applicant indicates that AyA continues to justify the charge on the basis of an internal requirement for formal delivery of the works, a criterion the applicant considers contrary to the body of applicable law and the conclusions of the oversight body, thereby causing continuing property damage to the affected families. In support of these allegations, the applicant submits the Special Audit Report No. DFOE-SOS-IAD-00003-2026 and requests that it be added as evidence to aid the Court’s decision. Based on the foregoing, the applicant asks that the expansion of the facts and the evidence submitted be admitted and that, as an extremely provisional interim measure, application of the commercial tariff and collection of 13% VAT on the NIS 5484074 master meter be suspended. The applicant requests that the amparo be granted.

  5. 5Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to reject summarily or on the merits, at any time, including upon filing, any submission brought before it that proves manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when it is simply a reiteration or reproduction of an identical or similar prior submission that was rejected.

Drafted by Justice Castillo Víquez; and, Reasons:

I. SUBJECT OF THE AMPARO

The applicant challenges the conduct of the Instituto Costarricense de Acueductos y Alcantarillados in maintaining the commercial-service tariff classification for a drinking water service intended exclusively for the residential consumption of 160 residential units, despite the entry into force of the Large Residential Consumer Tariff (T-GCR) and the denial of the reclassification request made by official letter UEN-SCMED-GAM-2026-01410, based on the infrastructure works not having been formally accepted. The applicant considers that this conduct violates the fundamental rights to drinking water on affordable and equitable terms, equality, property, the rights of consumers and users of public services, substantive due process, effective judicial protection, and the principle of legality. As an extremely provisional interim measure, the applicant requests suspension of application of the commercial tariff and collection of 13% VAT on the NIS 5484074 master meter while the merits of the amparo are resolved. The applicant seeks an order granting the amparo, requiring application of the tariff corresponding to residential service, ending the overbilling, and restoring the fundamental rights it considers violated.

II. INADMISSIBILITY OF THE AMPARO

Having considered the applicant’s allegations, the Chamber points out that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms. It is not a means of reviewing the legality of acts of the Public Administration or a general instrument for channeling other types of requests. For this reason, the Chamber cannot act as an appellate body on the matters presented and review whether the tariff classification assigned by the Instituto Costarricense de Acueductos y Alcantarillados to the drinking water service of the applicant condominium, application of the commercial-service tariff, denial of the request for reclassification under the Large Residential Consumer Tariff (T-GCR), collection of Value Added Tax, or reimbursement of amounts allegedly overcharged comply with the regulations in force and applicable regulatory provisions.

This is an ordinary legality dispute that must be resolved through the corresponding administrative or judicial procedure. Nor is it for this Chamber to assume powers legally assigned to the respondent institute, the Public Services Regulatory Authority, or the competent authorities in the matter in order to determine whether the requested tariff reclassification is technically and legally warranted, verify the correct application of the tariff regime, establish whether collection of Value Added Tax is proper, or decide whether the claimed sums should be reimbursed. Those are functions of the Administration, and disputes of that kind must be heard through the ordinary legality process, not the constitutional process. In this regard, it should be emphasized that an amparo proceeding cannot be used to turn the Constitutional Chamber into a mere forum for processing complaints concerning the billing and tariff classification of public services.

Doing so would not only require technical and legal evidentiary proceedings incompatible with the summary nature of this forum, but would also directly replace administrative discretion and displace public offices in handling matters within their competence. Accordingly, the applicant must pursue the ordinary legality process, administrative or judicial, and submit in writing any claims it considers appropriate so that they may be resolved as the law requires. Consequently, the amparo is inadmissible, and so it is declared.

III. DOCUMENTATION ADDED TO THE EXPEDIENTE

The applicant is advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be retrieved from the Chamber within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, pursuant to the “Regulation on the Electronic Expediente before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Judicial Council at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo is summarily rejected.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .

Recurso de amparo que se tramita bajo el número de expediente 26-027846-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, en presentación de CONDO SOLUTIONS SOCIEDAD ANONIMA Y OTROS; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala el 3 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta que el condominio que representa está conformado por 160 unidades habitacionales y que el servicio de agua potable, identificado con el NIS 548-4074, se destina exclusivamente al consumo residencial; sin embargo, el AyA mantiene la clasificación tarifaria de comercio-servicio, lo que, a su juicio, genera una sobrefacturación y el cobro improcedente del Impuesto al Valor Agregado sobre un servicio que estima exento. Refiere que el 1 de marzo de 2025 entró en vigor la Resolución RE-0008-IA-2025 de la ARESEP, mediante la cual se creó la Tarifa Grandes Consumidores Residenciales (T-GCR), normativa que, según afirma, el propio AyA reconoce en las observaciones consignadas en las facturas emitidas al condominio.Señala que, ante esa situación, el 15 de junio de 2026 presentó un reclamo formal ante la Plataforma de Servicios de Grandes Clientes del AyA, solicitando el cese de la presunta sobrefacturación, la reclasificación del servicio a la tarifa T-GCR y la devolución de los montos cobrados indebidamente. Indica que dicha gestión fue rechazada mediante el oficio UEN-SCMED-GAM-2026-01410, de 16 de julio de 2026, en el cual el AyA fundamentó la negativa en la falta de recepción formal de las obras de infraestructura. Considera que ese criterio incorpora un requisito no previsto en el régimen tarifario aprobado por la ARESEP, desconoce la naturaleza residencial del servicio, sustituye los parámetros regulatorios aplicables por disposiciones técnico-operativas internas y mantiene una afectación patrimonial continua derivada del cobro de una tarifa que estima improcedente. Por lo anterior, aduce que la institución recurrida mantiene una actuación administrativa continuada que lesiona los derechos fundamentales al agua potable en condiciones de asequibilidad y equidad, a la igualdad, a la propiedad, a los derechos de los consumidores y usuarios de servicios públicos, al debido proceso sustantivo, a la tutela judicial efectiva y al principio de legalidad.Por ello solicita que se declare con lugar el recurso, se ordene la aplicación de la tarifa correspondiente al servicio residencial, cese la sobrefacturación y se restituyan los derechos fundamentales que estima lesionados.
  2. 2Por escrito incorporado al expediente electrónico, el 6 de agosto de 2026, el manifiesta que, con posterioridad a la interposición del recurso de amparo, se publicó el Informe de Auditoría de Carácter Especial n.° DFOE-SOS-IAD-00003-2026 de la Contraloría General de la República, el cual, a su juicio, acredita deficiencias en la gestión tarifaria del Instituto Costarricense de Acueductos y Alcantarillados (AyA) y confirma la existencia de cobros improcedentes que afectan a las 160 familias que integran el Sub-Condominio Jacaranda del Condominio Horizontal Residencial Lagos del Sol. Agrega que dicho informe evidencia un perjuicio financiero sistemático derivado de la aplicación de una tarifa comercial al macro medidor NIS 5484074, pese a que considera procedente la Tarifa Grandes Consumidores Residenciales (T-GCR), lo que estima vulnera el principio de servicio al costo, el derecho humano al agua y otros derechos fundamentales de los usuarios.Indica que el AyA continúa justificando ese cobro con fundamento en un requisito interno de entrega formal de obras, criterio que considera contrario al bloque de legalidad y a las conclusiones del órgano contralor, lo que mantiene un daño patrimonial continuo para las familias afectadas. Como respaldo de sus alegatos, aporta el Informe de Auditoría de Carácter Especial n.° DFOE-SOS-IAD-00003-2026 y solicita su incorporación como prueba para mejor proveer. Con base en lo dicho, pide que se admita la ampliación de hechos y la prueba aportada y que, como medida cautelar provisionalísima, se suspenda la aplicación de la tarifa comercial y el cobro del 13% del IVA sobre el macro medidor NIS 5484074. Solicita se declare con lugar el recurso.
  3. 3Por escrito incorporado al expediente electrónico el 10 de agosto de 2026, el recurrente reitera sus alegatos y aporta prueba.
  4. 4Por escrito incorporado al expediente electrónico el 10 de agosto de 2026, Luis Gustavo Ascanio Flores, en representación de Condo Solutions S.A. presenta solicitud de coadyuvancia.
  5. 5El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente cuestiona la actuación del Instituto Costarricense de Acueductos y Alcantarillados al mantener la clasificación tarifaria de comercio-servicio para un servicio de agua potable destinado exclusivamente al consumo residencial de 160 unidades habitacionales, pese a la entrada en vigor de la Tarifa Grandes Consumidores Residenciales (T-GCR) y al rechazo de la solicitud de reclasificación formulada mediante el oficio UEN-SCMED-GAM-2026-01410, con fundamento en la falta de recepción formal de las obras de infraestructura. Considera que esa actuación lesiona los derechos fundamentales al agua potable en condiciones de asequibilidad y equidad, a la igualdad, a la propiedad, a los derechos de los consumidores y usuarios de servicios públicos, al debido proceso sustantivo, a la tutela judicial efectiva y al principio de legalidad. Solicita como medida cautelar provisionalísima, que se suspenda la aplicación de la tarifa comercial y el cobro del 13% del IVA al macro medidor NIS 5484074, mientras se resuelve el fondo del recurso. Pretende que se declare con lugar el recurso, se ordene la aplicación de la tarifa correspondiente al servicio residencial, cese la sobrefacturación y se restituyan los derechos fundamentales que estima lesionados.

II. INADMISIBILIDAD DEL AMPARO

Vistos los alegatos de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si la clasificación tarifaria asignada por el Instituto Costarricense de Acueductos y Alcantarillados al servicio de agua potable del condominio recurrente, la aplicación de la tarifa de comercio-servicio, el rechazo de la solicitud de reclasificación a la Tarifa Grandes Consumidores Residenciales (T-GCR), el cobro del Impuesto al Valor Agregado o la devolución de los montos presuntamente cobrados en exceso, se ajustan o no a la normativa vigente y a las disposiciones regulatorias aplicables, por cuanto constituye un diferendo de legalidad ordinaria que debe ser dirimido en la vía administrativa o judicial correspondiente.

Tampoco corresponde a esta Sala sustituir las competencias legalmente asignadas al instituto recurrido, a la Autoridad Reguladora de los Servicios Públicos o a las autoridades competentes en la materia, a efecto de determinar si técnica y jurídicamente procede o no la reclasificación tarifaria solicitada, verificar la correcta aplicación del régimen tarifario, establecer la procedencia del cobro del Impuesto al Valor Agregado o definir si corresponde la devolución de las sumas reclamadas, por cuanto ello constituye una labor propia de la Administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad. Al respecto, cabe destacar que no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de denuncias en materia de facturación y clasificación tarifaria de servicios públicos, puesto que ello no solamente haría necesario efectuar probanzas técnicas y jurídicas incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia.

Así las cosas, deberá la parte recurrente acudir ante la vía de legalidad ordinaria, administrativa o judicial, a fin de plantear allí, por escrito, los reclamos que estime pertinentes, para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
