Background:
Drafted by Justice Castillo Víquez; and, Reasons:
The petitioner lives in Condominio Vía Heredia, directly adjacent to a unit whose occupants smoke tobacco constantly and unpredictably. Smoke and harmful gases emanating from that property continuously and without interruption enter the interior of his private home, contaminating the air he breathes and exposing him to forced secondhand smoke. He alleges that he filed a complaint with the Ministry of Health; however, it was denied and the case was closed, on the ground that Ley 9028 “does not prohibit smoking inside private homes,” completely disregarding the environmental pollution and harm to health that he suffers inside his own home. He considers his fundamental rights to have been violated. He asks that the challenged Ministry be ordered to reopen the proceedings concerning the complaint and to conduct technical inspections and air-quality measurements in his adjacent home, issuing the corresponding health orders and warnings to prevent tobacco smoke emissions from continuing to enter his residence.
Having considered the petitioner’s allegations and requests, it is established that the challenged authorities did resolve his health complaint; however, he disagrees with the decision. In this regard, he is advised that this Constitutional Chamber is not a reviewer of the legality of the actions or decisions adopted by the Ministry of Health in health matters, nor may it replace the active Administration in the exercise of its powers. Accordingly, it does not act as an appellate court in this area and cannot review whether the decision on his complaint complies with the law, or examine the merits of the reasons supporting that decision, much less usurp the powers of the respondent party by initiating extensive investigations and determining, in light of the facts and applicable law, whether the complaint is justified, whether his neighbor committed any infraction, and whether a sanction should be imposed.
These are matters of ordinary legality that must be resolved through the ordinary administrative or judicial channels. In addition, this Chamber cannot act merely as a forum for processing complaints, since doing so would not only require complicated evidentiary proceedings, incompatible with the summary nature of this forum, but would also directly substitute its will for that of the Administration and usurp the role of public offices in handling matters within their competence. Consequently, the petitioner must present his objections or claims to the challenged authorities or through the competent judicial channel, where he may fully contest the merits of the matter and pursue his claims. Accordingly, the amparo is inadmissible, and it is so declared.
The petitioner is advised that if he submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution adopted by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is summarily rejected.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .
Recurso de amparo interpuesto Nombre01, cédula de identidad número CED01; contra el MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente habita en el Condominio Vía Heredia, colindando de forma directa con una filial cuyos ocupantes consumen tabaco de forma constante e intempestiva. Las emanaciones de humo y gases nocivos provenientes de dicha propiedad invaden de forma continua e ininterrumpida el interior de su vivienda privada, contaminando el aire que respira y exponiéndome a tabaquismo pasivo forzado. Aduce que interpuso una denuncia ante el Ministerio de Salud, sin embargo, se declaró sin lugar y se cerró el caso, al considerar que la Ley 9028 "no prohíbe el fumado dentro de viviendas particulares", desentendiéndose por completo de la contaminación ambiental y la afectación a la salud que sufre dentro de su propia vivienda. Estima lesionados sus derechos fundamentales. Solicita que se ordene al ministerio recurrido la reapertura de las diligencias de la denuncia y se ordene realizar las inspecciones técnicas y mediciones de calidad de aire en su vivienda colindante, emitiendo las órdenes sanitarias y apercibimientos correspondientes para evitar que las emanaciones de humo de tabaco continúen invadiendo su residencia.
Vistos los alegatos y pretensiones del recurrente, se constata que las autoridades recurridas sí resolvieron su denuncia sanitaria, no obstante, se encuentra inconforme con lo resuelto. Al respecto, se le hace saber que, esta Sala Constitucional no es un contralor de la legalidad de las actuaciones o resoluciones que adopte el Ministerio de Salud en materia sanitaria y tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde actuar como tribunal de alzada en la materia y revisar si lo resuelto respecto de su denuncia, se ajusta a Derecho, ni analizar el mérito de las razones que justificaron la decisión, mucho menos usurpar las atribuciones de la parte recurrida, para iniciar amplias investigaciones y determinar conforme a la situación fáctica y la normativa aplicable si procede la denuncia, si su vecino ha incurrido en alguna falta y si se le debe imponer alguna sanción, pues se trata de extremos de legalidad ordinaria que deben ser dirimidos en la vía común, administrativa o jurisdiccional.
Adicionalmente, esta Sala no puede actuar como una mera instancia tramitadora de denuncias, por puesto que ello no solamente haría necesario efectuar probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. En consecuencia, deberá el recurrente plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
