CED04), against the MINISTRY OF PUBLIC EDUCATION and the INTEGRAL CARE CENTER FOR ADULTS WITH DISABILITIES OF ACOSTA (CAIPAD).

“FACTS:
1. On Tuesday, 03 October 2023, by email with the subject line: Noncompliance with Article 6 of the REGULATION FOR THE CONTROL OF NOISE POLLUTION, OF THE MINISTRY OF HEALTH, our family formally submitted a written complaint to Ms. Marisel Mora, director of the Integral Care Center for Adults with Disabilities of Acosta (CAIPAD), with copies to Ms. Anna Katharina Müller Castro, Minister of Education; Cristina Corrales Escoto, director of the Acosta Health Area; Mary Denisse Munive Angemüller, Minister of Health of Costa Rica; Ms. Margarita Marchena, president of the Costa Rican Association of Public Health; and other government bodies. In it, we respectfully described, among other things, the situation our family has experienced as a result of noncompliance with the provisions of the REGULATION FOR THE CONTROL OF NOISE POLLUTION, OF THE MINISTRY OF HEALTH. For years, CAIPAD has held morning activities during which the maximum decibel levels used for its aerobic activities exceed the permitted limits established in item 3, specifically Article 6 of the REGULATION FOR THE CONTROL OF NOISE POLLUTION, published on the platform of the Costa Rican Legal Information System (2000, p. 1), which provides as follows:
"Article 6: Sounds are considered disturbing when they are perceived in neighboring rooms at an intensity greater than 80 decibels from 6:00 to 18:00, or at an intensity greater than 60 decibels between 18:00 on one day and 6:00 on the following day. Between 6:00 and 18:00, noise produced by the sound source or sources may not exceed ambient noise by more than 30 decibels. Between 18:00 on one day and 6:00 on the following day, noise produced by the sound source or sources may not exceed "ambient noise" by more than 25 decibels." (Annex

On 15/07/2019, my mother, Nombre04, holder of identity card number CED04, representing the entire Robles Barboza family, filed complaint D143-2019 with the Ministry of Health of San Ignacio de Acosta for noncompliance with Article 06 of the National Regulation for the Control of Noise Pollution by the Integral Care Center for Adults with Disabilities of Acosta. (Annex 4, Case File 26-008759-0007-CO, granted) 17. On 25/11/2019, Mr. Luis Álvaro Rojas Calderón and Ms. Nombre06 inspected the site. Since the noise complained of—arising from the Integral Care Center for Adults with Disabilities of Acosta’s noncompliance with Article 06 of the National Regulation for the Control of Noise Pollution—was not occurring at that time, neither official carried out a measurement protocol. (Annex 4, Case File 26-008759-0007-CO, granted) 18. On 30/03/2023, my mother emailed complaint D-05OA-2023 to the Acosta Ministry of Health, stating that the impact continued as a result of the Integral Care Center for Adults with Disabilities of Acosta’s noncompliance with Article 06 of the National Regulation for the Control of Noise Pollution.
She also explained that activities were held at this institution every day from 7:00am to 8:00 am. It is worth noting that after 2023, the days on which the activities take place changed, but the times remain the same and the permitted decibel levels are exceeded. On 12/07/2023, the Acosta Ministry of Health called my mother to arrange an inspection visit, and she told them that the Center was on vacation, so the reported noise would not occur. (Annex 4, Case File 26-008759-0007-CO, granted) 20. On 14/11/2023, the Acosta Ministry of Health called my mother to arrange an inspection visit, and she told them that the Center was still on vacation, so the reported noise would not occur. The visit was rescheduled. (Annex 4, Case File 26-008759-0007-CO, granted) 21. On 22/11/2023, officials Luis Álvaro Rojas Calderón and Ms. Nombre01 inspected the site.
Since there was no noise from the Center, neither official carried out a measurement protocol. (Annex 4, Case File 26-008759-0007-CO, granted) 22. On 19/03/2024, I emailed the Acosta Ministry of Health document (Official Letter MS-DRRSCS-0673-2024), in which I stated, detailed, and reported the Integral Care Center for Adults with Disabilities of Acosta’s noncompliance with Article 06 of the National Regulation for the Control of Noise Pollution. (Annex 4, Case File 26-008759-0007-CO, granted) 23. On 21/03/2024, officials Luis Álvaro Rojas Calderón and Ms. Nombre01 inspected the site. Since there was no noise from the Center, neither official carried out a measurement protocol. (Annex 4, Case File 26-008759-0007-CO, granted) 24. On 30/04/2024, Mr. Luis Álvaro Rojas Calderón met with me to tell me that updates or reports would be sent to my mother because she filed the complaint. In addition, my mother told the official that, due to mourning (the deaths of two nephews in succession), she preferred to reschedule the visit set for 02/05/2024.

On 20/06/2024, the Ministry of Health called to arrange an inspection visit, but we pointed out that there was no noise impact on Fridays and that an inspection on 21/06/2024 was not considered advisable because no measurement protocol would be carried out, as clearly described in the preceding points. Mr. Álvaro explained that the complaint stated that the impact occurred every day, and that for this reason an inspection visit had been scheduled according to the availability of the Acosta Health Governing Area. However, due to MEP or national calendar events, this Educational Center, like most public educational centers in the country, has vacation periods, public holidays, training sessions, union assemblies, and other events. Accordingly, at that time, the days on which exercise activities were held—and during which the Integral Care Center for Adults with Disabilities of Acosta failed to comply with Article 06 of the National Regulation for the Control of Noise Pollution—were constantly changing.

On 21/06/2024, my mother, Nombre04, was given written submission MS-DRRSSCS-CD-060-2024, entitled "Subject: Decision to close complaints D-143-2019 and D-050A-2023," signed by Dr. Cristina Corrales Escoto, director of the Acosta Health Governing Area. In addition to several of the points described above, she was informed that by Official Letter MS-DRRSSCS-ARSAC-320-2024, CAIPAD had been warned about the prohibitions established in Art. 12 of Decree N° 39428-S, the "Regulation for the Control of Noise Pollution," which prohibits the installation and use of:
37. For many years, our family has tried to communicate peacefully and assertively with CAIPAD and the relevant authorities. We have repeatedly told them that we fully respect the population they serve and the reason for their work: people with conditions or disabilities in the canton and throughout the world. We have always supported the mission and vision that led to the establishment of this institution, which serves and supports adults with disabilities in Acosta. We applaud the work of its teachers and administrative staff as participants in Costa Rican society, because we know and understand the tools and support they provide to students.
However, we are fully aware that, through this written communication, which has been entirely peaceful and assertive, we have tolerated the indifference and inaction of government authorities. In this case, the Ministry of Public Education, through its various ministries and departments, has known about this situation for years. These authorities must ensure that existing regulations are duly complied with; instead, the complaints seem simply to have been read, forwarded, and filed by MEP. As a result, all those involved know that this ongoing situation has caused our family actual and irreversible harm to our physical, mental, and emotional health, as well as to our assets. This includes medical expenses due to the worsening symptoms of chronic illnesses and the deterioration of physical and mental health, purchases of medication, installing even more resistant structures in our home, rearranging bedrooms and other rooms into positions unsuited or not designed for people’s natural activities such as resting, sleeping, or working, and buying technological devices to continue carrying out work related to our professions, among many other expenditures we have had to make to try to maintain our daily routines as human beings and citizens.
Although our routine is not the same as that of most people in society, it exists and is a fact. Examples include security guards, health workers, staff who repair breakdowns, and—clearly in this digital age—those of us who do fieldwork as well as remote work, or work that means our working hours do not match the start and end times of the country’s public employees, to mention just one example.
In light of the foregoing, honorable justices of the Constitutional Chamber of Costa Rica, we understand the gravity of the systematic violation of Article 21 of the Political Constitution, from which the fundamental right to health and physical and psychological integrity derives. Likewise, Article 50 of the Constitution has been violated. It enshrines everyone’s right to a healthy and ecologically balanced environment and imposes on the State the corresponding duty to guarantee, defend, and preserve that right.
We also understand that constitutional jurisdiction was not designed to allow the health of persons subject to the administration, especially older adults with chronic conditions, to depend on the stratagems of those who cause noise pollution.
RELIEF SOUGHT:
1. I ask the Constitutional Chamber of Costa Rica to order the Ministry of Public Education (MEP) to guarantee my family and me the fundamental, interdependent rights to health and to a healthy environment. The right to a healthy environment is based on Article 50 of the Political Constitution, while the right to health derives from Article 21 (the right to life). Bearing in mind that the Constitutional Chamber has said that "the right to health derives from the right to life enshrined in the Constitution," which provides that "human life is inviolable" (Article 21), and that "this constitutional principle is the source from which the right to health and to physical, mental, and social well-being undeniably derives, a human right inextricably linked to the right to health and to the State’s obligation to protect human life." 2. I ask the Constitutional Chamber of Costa Rica to take into consideration the "INCIDENT FOR FAILURE TO ENFORCE JUDGMENT AND DISOBEDIENCE OF AUTHORITY (ARTICLES 53 AND 71 OF THE CONSTITUTIONAL JURISDICTION ACT) AND REQUEST FOR THE REFERRAL OF A CERTIFIED COPY OF THE RECORD TO THE PUBLIC PROSECUTOR'S OFFICE," filed on 17 July 2026 in Case File 26-008759-0007-CO, which the honorable justices of the Constitutional Chamber of Costa Rica granted on 22 May 2026 under Decision Number 2026018071.
3. I ask the Constitutional Chamber of Costa Rica to order the Ministry of Public Education (MEP) to pay the damages, losses, and costs caused by the facts on which this declaration is based."
Drafted by Justice Castillo Víquez; and, Reasons:
The applicant alleges that "for years, CAIPAD has held morning activities during which the maximum decibel levels used for its aerobic activities exceed the permitted limits established in item 3, specifically Article 6 of the REGULATION FOR THE CONTROL OF NOISE POLLUTION." This situation has continued over time, despite the various complaints submitted to CAIPAD itself and to the different authorities of the Ministry of Public Education. He alleges an "evasive pattern of conduct" on the part of the "source of the noise pollution (the Integral Care Center for Adults with Disabilities of Acosta, CAIPAD APRIOPEDA), which continues deliberately to refrain from using sound amplification equipment (loudspeakers) and emitting noise" when the relevant sound measurements have been attempted. He also alleges "indifference and inaction by government authorities, in this case the Ministry of Public Education, which through its various ministries and departments has known about this situation for years; authorities that must ensure proper compliance with existing regulations...."
This Chamber has clarified on various occasions that the amparo application has:
"the exclusive purpose of providing timely, restitutive protection against violations or imminent threats to fundamental rights and freedoms. Its nature is summary, and its processing is incompatible with extensive and technically complicated debates, the taking of slow and complex evidence, or the need first to examine, by way of a declaratory determination, whether the rights of a rank below the Constitution that the parties cite as part of the factual account in the amparo application or the statutory report, as the case may be, actually exist." (see, among others, vote no. 2022020000, at 9:15 a.m. on 26 August 2022).
Along the same lines, this Court has explained that the "essentially summary nature of the amparo application" means that:
"it is neither materially nor reasonably possible to undertake a complicated evidentiary process or take slow and complex evidence. For this reason, this Court has repeatedly held that it is impossible in this forum to analyze disagreements concerning technical criteria or parameters." (see, among others, vote no. 2011-009067, at 10:13 a.m. on 8 July 2011)
Prima facie, determining whether conduct causing noise pollution has in fact occurred and, in particular, whether the activities carried out at CAIPAD exceed the noise levels permitted by the legal system falls outside this Chamber’s jurisdiction, since doing so requires investigating and analyzing the reported facts and correctly applying and interpreting the infra-constitutional rules governing the matter and the relevant technical criteria. All of this exceeds the summary nature of amparo.
The application itself shows that a complaint concerning these facts has already been filed with the Ministry of Health, the competent authority to investigate and determine whether the alleged noise pollution has occurred. The applicant must therefore submit his arguments and objections to that same authority.
It should also be noted that the applicant previously filed an amparo application against the Ministry of Health (case file no. 26-008759-0007-CO) concerning these same facts. That application was decided by vote no. 2026-018071, at 9:30 a.m. on 22 May 2026. The ruling provided, in relevant part:
“I.- OBJECT. The applicant explained that physical exercise activities are held every day from 7:00 am to 8:00 am at the Integral Care Center for Adults with Disabilities of Acosta (CAIPAD), located in San Ignacio de Acosta, using loudspeakers outside the building, in the corridor or paved area at the front. He alleges that the music and the shouts of the person leading the activity generate excessive noise that can be heard in his home and exceeds the limits permitted by regulation. Complaints have been filed with the Acosta Health Governing Area of the Ministry of Health, but the problem has not been resolved.
The allegations could amount to a violation of the right to timely and effective administrative justice. In this regard, it must be clarified that, beginning with vote number 2008-02545, at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction, subject to certain exceptions, matters in which it is disputed whether the public administration has complied with the time limits established by the General Public Administration Act (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, for issuing a final decision in an administrative proceeding (initiated on the administration’s own initiative or at the request of a party) or deciding admissible administrative appeals. This application presents an exception, since it concerns complaints about alleged noise pollution.

IV.Specific case. In accordance with the reports submitted under oath, with the legal consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction, it is established that on 15 July 2019, complaint D-143-2019 was filed with the Acosta Health Area Office by Ms. Nombre02 (mother of Mr. Nombre01), alleging harm caused by noise from activities at the Comprehensive Care Center for Adults with Disabilities of Acosta (CAIPAD) (between 6:50 a.m. and 8:00 a.m.), without specifying the days. On 25 November 2019, an inspection was conducted at the site; the noise conditions were not present, and the noise measurement procedure was not carried out. On 30 March 2023, complaint 50A-2023 was filed by Ms. Nombre02, alleging harm caused by noise every day from 7:00 a.m. to 8:00 a.m. from activities at the Comprehensive Care Center for Adults with Disabilities of Acosta (CAIPAD).
On 12 July 2023, 14 November 2023, and 22 November 2023, the noise conditions were not present, and the noise measurement procedure was not carried out. On 19 March 2024, the Health Area Office received letter MS-DRRSCS-0673-2024, Forwarding of Routing Sheet MS-DGS-HT-366-2024, informing it of a note from Mr. Nombre01 addressed to the Comprehensive Care Center for Adults with Disabilities of Acosta (CAIPAD), in which he expressed his distress over noise caused by recreational activities conducted with the CAIPAD population. On 21 March 2024, a temporary change of schedule was arranged for environmental officers Nombre01 and Luis Álvaro Rojas Calderón to conduct an inspection to verify what the complainant had reported. The inspection record No. R-001-21-03-2024 states that they arrived at Ms. Nombre02’s home at 7:16 a.m. and left at 7:48 a.m. because the reported noise conditions were not present.
On 30 April 2024, Mr. Nombre01 (Ms. Nombre02’s son) appeared at the Health Area Office and requested information about the progress in addressing the complaint. He was asked about the possibility of scheduling an inspection visit for 2 May 2024. During a telephone call, Ms. Nombre02 said that there had been no “classes all week” and also stated that she did not consider it a good time to conduct the inspection because she was grieving. On 20 June 2024, according to the record of a telephone call to coordinate an inspection for 21 June 2024, Mr. Nombre01 said that there was no harm on Fridays and that there had been no lessons that week, so he did not consider it advisable to schedule the inspection for that date. On 12 July 2024, notice was served of letter MS-DRRSCS-ARSAC-320-2024 on Mr. Rigoberto Nelson Hudson, president of APRIOPEDA and representative of CAIPAD, warning him about Decreto 39428-S, Regulations for the Control of Noise Pollution.
On 12 June 2024, notice was served of resolution MS-DRRSC-ARSAC-CD-060-2024, closing complaints D-143-129 and D-50 A-2023. The multiple inspection visits undertaken to address the complaint are described in detail, whether because the noise conditions were not present or because, when coordination calls were made, the complainant could not receive officials from the Health Area Office. Since there was no clarity as to the days and times when the noise-related harm occurred, it was concluded that the complaints should be closed. He was informed that, if he disagreed with the outcome reached by the Health Area Office, he should notify it and file a new complaint clearly indicating the schedule (days and times) when the harm occurred. On 14 May 2025, Mr. Nombre01 filed complaint D-69-2025 against the Comprehensive Care Center for Adults with Disabilities of Acosta (CAIPAD), alleging harm caused by noise from a sound tower used for physical exercise and from the loud shouting of CAIPAD staff.
He stated that the noise affected Ms. Nombre02’s home from 7:00 a.m. to 8:30 a.m., Monday through Friday. An inspection was scheduled for 14 August 2025. The inspection appointment slip was served on the complainant on 10 June 2025. On 10-06-2025, by letter CARTA-MS-DRRSCS-ARSAC-0262-2025, the history of actions taken by the Acosta Health Area Office before complaint 069-2025 was provided to Dr. Berny Villareal Cortés, in his capacity as Director General of Health. On 05-08-2025, at 3:10 p.m., the complainant, Nombre01, was called by telephone to coordinate the visit for the following day; however, he said that no one was at his home at that time who could receive the inspectors. The response to complaint 069-2025 was documented on 8-09-2025 in inspection record R-001-08-09-2025. At 6:45 a.m., Luis Álvaro Rojas Calderón and Nombre05, members of this authority who were duly identified, arrived at the Nombre01 family’s room to conduct the noise measurement in accordance with the procedures.
They were received and set up in the office room of Nombre01, with the consent of his father, Mr. Nombre02. Once the measuring equipment had been set up, they were told that the physical exercise activity began at 7:15 a.m. That time passed and the activity did not begin; rather, it appeared that it had been moved inside the building. Mr. Nombre02 (the complainant’s father) stated that they had suffered from the reported noise for 9 years and that they believed some official from the local level of the Ministry of Health warned CAIPAD when an inspection was going to take place. On this occasion, too, the noise that bothered the complainant and his family did not occur. Inspection record R-001-08-09-2025 was completed, read, and signed at 7:37 a.m. As a conclusion of technical report MS-DRRSCSARSAC-IT-406-2025 on this response to the complaint, and because it was once again impossible to carry out the sound measurement in accordance with the regulatory procedure for the reasons stated, and because the Acosta Health Area Office had lost the complainant’s trust to continue rescheduling complaint 069-2025, coordination with and referral to the Central South Region was recommended, to explore whether the matter could be addressed by personnel from outside this Health Area Office.
On 10-09-2025, by technical support request MS-DRRSCS-ARSAC442-2025, complaint 069-2025 was referred to the Central South Region of this Ministry so that technical personnel at that higher level could proceed using their material and human resources, with technical report MS-DRRSCSARSAC-IT-406-2025 attached. On 8-12-2025, reports CARTA-MS-DRRSCS-URS-1879-2025 AND CARTA-MS-DRRSCS-URS-IT-632-2025 were received. The latter, entitled noise measurement report, explains the steps taken by Central South Region personnel to establish the noise measurement. It describes coordination between the parties and states that on 5-11-2025, personnel from that region appeared at the physical address in San Ignacio and were received by Mr. Nombre02, who said there was no bothersome noise and that they had turned the speaker around. The personnel remained there for the appropriate length of time, but ultimately the noise measurement could not be carried out.
It was determined that the inspection should be rescheduled, at which point the Acosta Health Area Office would coordinate again with the Central South Regional Health Directorate so that, in a coordinated manner, the communication and coordination with the complainant could be arranged.
In relation to the foregoing, it must first be stated that this Chamber intervenes only if it is established that the Ministry of Health has failed to address a complaint that was filed. Conversely, if the Ministry of Health has addressed the complaint but it has not been possible to verify the reported situation, this Chamber cannot intervene. It is not for a Constitutional Court to tell the Health Area Office how or when it must conduct measurements to obtain the results the complainant seeks. In this specific case, the account of the facts found establishes that the Ministry of Health did appear on various occasions to conduct the measurements. However, owing to circumstances that, according to the documentation provided, cannot be attributed to the Ministry of Health itself, the reported matter has not been established.
However, after the most recent intervention, conducted in 2025, the Health Area Office reached the following conclusion (as stated in the report): “… the inspection should be rescheduled, at which point the Acosta Health Area Office will coordinate again with the Central South Regional Health Directorate so that, in a coordinated manner, the communication and coordination with the complainant can be arranged.” There is no record that the new inspection was conducted. Since more than the period this Chamber has considered reasonable for addressing a complaint such as the one filed has elapsed since then, the amparo must be denied and an attempt to conduct a new inspection must be ordered, and the Health Area Office must issue a resolution on the complaint. It is reiterated that it is not for this Chamber to verify directly whether noise is produced at the levels alleged by the applicant. The amparo is granted solely on account of the time elapsed since the Health Area Office itself determined that a new inspection should be conducted, which it has not conducted.
V.Note by Justice Castillo Víquez regarding prompt and proper administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and proper justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Law No. 9097, Law on the Regulation of the Right of Petition, it has been established that this right is subject to judicial protection through the amparo proceeding established by Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must change its line of precedent.
Under section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Accordingly, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may properly be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, and for the reasons given by this Court (judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008), the competent judges are those of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.

THEREFORE:
The amparo is granted. Accordingly, Eddy Marchena Vásquez, Director of the Acosta Health Area Office, or whoever holds that position, is ordered to take the necessary steps so that, within fifteen days from service of this judgment, a new inspection is conducted to address the complaint filed by the applicant and a resolution is issued. It is cautioned that, in accordance with Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with it or enforce it, shall be sentenced to imprisonment for three months to two years, or to a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts on which this declaration is based, which shall be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Justice Castillo Víquez records a note.” (emphasis not in the original) In that same case file, the applicant filed a “MOTION FOR NON-EXECUTION OF JUDGMENT AND DISOBEDIENCE OF AUTHORITY.” By resolution issued at 16:27 on 27 July 2026, the respondent authority has already been given a hearing regarding the alleged disobedience. The appropriate ruling concerning the Ministry of Health’s conduct will therefore be made in that case file.
As a result of the foregoing, the present amparo should be summarily dismissed, as is hereby ordered.
In the present case, the applicant essentially claims ongoing harm resulting from the alleged noise pollution generated by activities carried out at the Comprehensive Care Center for Adults with Disabilities of Acosta, a situation which, according to the applicant, has persisted for several years despite the various steps taken before the competent authorities, and without it having been possible to date to conduct a measurement that would establish the actual conditions of the reported noise.
On this matter, with the customary respect, we disagree with the majority’s position. We consider that, given the nature of the alleged facts and their potential effect on the fundamental right to a healthy and ecologically balanced environment, enshrined in Article 50 of the Political Constitution, the matter warrants being heard by this jurisdiction. In particular, we consider it necessary to verify whether, after the actions described by the applicant, the competent authorities have managed to conduct new sound measurements and objectively determine whether the claimed harm exists.
On the basis of the foregoing, we dissent and order that the amparo proceed so that further information may be obtained to establish or rule out a violation of constitutional rank.
The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days from service of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and order that the amparo proceed.

Revisión del Documento EXPEDIENTE N° 26-026453-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026030598 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre07, mayor, cédula de identidad nro. CED01, costarricense, vecino del cantón de Acosta, a su favor y de Nombre07, cédula de identidad nro. CED02, Nombre02, cédula de identidad nro. CED03 y Nombre04, cédula de identidad nro. CED04), contra el MINISTERIO DE EDUCACIÓN PÚBLICA y el CENTRO DE ATENCIÓN INTEGRAL PARA PERSONAS ADULTAS CON DISCAPACIDAD DE ACOSTA (CAIPAD).
Resultando:
“HECHOS:
1. El día martes 03 de octubre del 2023 a través de correo electrónico Asunto: Incumplimiento del Artículo 6 del REGLAMENTO PARA EL CONTROL DE LA CONTAMINACION POR RUIDO, DEL MINISTERIO DE SALUD, como familia le hacemos entrega del escrito formal a la Sra. Marisel Mora directora del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD); con copia del escrito a la Sras. Anna Katharina Müller Castro, ministra de educación; Cristina Corrales Escoto, directora del Área de Salud de Acosta; Mary Denisse Munive Angemüller, ministra de salud de Costa Rica, a doña Margarita Marchena, presidenta de la Asociación Costarricense de Salud Pública y a otros entes actores gubernamentales. En el cual se les comenta de la manera más respetuosa, entre otras cosas, la situación (comentada con respeto durante años y que ha sido omitida e ignorada por las autoridades correspondientes) vivida por nuestra familia a raíz del incumplimiento de lo establecido en el REGLAMENTO PARA EL CONTROL DE LA CONTAMINACION POR RUIDO, DEL MINISTERIO DE SALUD, en donde desde el CAIPAD durante años se realizan actividades matutinas donde el máximo de decibeles que utilizan en sus actividades aeróbicas, sobrepasan los límites permitidos de acuerdo a lo que se establece en el inciso número 3, específicamente en el artículo número 6 del REGLAMENTO PARA EL CONTROL DE LA CONTAMINACION POR RUIDO, publicado en la plataforma del Sistema Costarricense de Información Jurídica (2000, p.1), el cual hace referencia a lo siguiente:
"Artículo 6: Son incómodos por sonidos cuando éstos se perciban en las habitaciones vecinas con una intensidad mayor a los 80 decibeles de las 6:00 a las 18:00 horas , o con una intensidad mayor a los 60 decibeles entre las 18:00 horas de un día y las 6:00 horas del siguiente. Entre las 6:00 y las 18:00 horas, los ruidos producidos por la o las fuentes de sonido no podrán ser mayores a 30 decibeles sobre el ruido ambiente. Entre las 18:00 horas de un día y las 6:00 horas del día siguiente los ruidos producidos por la o las fuentes de sonido no podrán ser mayores a 25 decibeles sobre "el ruido ambiente". (Anexo
16. El día 15/07/2019, mi señora madre Nombre04, portadora de la cédula de identidad número CED04, en representación de toda la familia Robles Barboza, presenta ante el Ministerio de Salud de San Ignacio de Acosta, la denuncia D143-2019 por el incumplimiento del Artículo 06 del Reglamento Nacional para el Control de la Contaminación por Ruido, por parte del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 17. El día 25/11/2019, se realiza la inspección al sitio por parte del señor Luis Álvaro Rojas Calderón y por parte de la señora Nombre06 y como no existió en ese momento el ruido denunciado proveniente incumplimiento del Artículo 06 del Reglamento Nacional para el Control de la Contaminación por Ruido, por parte del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta, no se realizó protocolo de medición por parte de ambos señores.
(Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 18. El día 30/03/2023, se envía a través de correo electrónico al Ministerio de Salud de Acosta la denuncia D-05OA-2023, donde mi madre indica que sigue la afectación por incumplimiento del Artículo 06 del Reglamento Nacional para el Control de la Contaminación por Ruido, por parte del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta, detallando además que las actividades se realizan en esta institución todos los días de 7:00am a 8:00 am. Cabe destacar que después del año 2023 han cambiado los días de la actividad pero se mantienen las horas y se sobrepasan los decibeles permitidos. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 19. El día 12/07/2023, por parte del Ministerio de Salud de Acosta se realiza llamada a mi señora madre para coordinar visita de inspección; y la misma les indica que en el Centro están de vacaciones por lo tanto no habrá ruido denunciado.
(Anexo 4 Expediente 26008759-0007-CO dado Con lugar) 20. El día 14/11/2023, por parte del Ministerio de Salud de Acosta se realiza llamada a mi señora madre para coordinar visita de inspección; y la misma les indica que en el Centro siguen de vacaciones por lo tanto no habrá ruido denunciado. Y se reprograma visita. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 21. El día 22/11/2023, se realiza visita de inspección por parte de los funcionarios Luis Álvaro Rojas Calderón y por parte de la señora Nombre01 y como no hay ruido por parte del Centro, no se realizó protocolo de medición por parte de ambos señores. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 22. El día 19/03/2024, mi persona envía al Ministerio de Salud de Acosta a través del correo electrónico, el documento (Oficio MS-DRRSCS-0673-2024), en el cual indico, detallo y denuncio el incumplimiento del Artículo 06 del Reglamento Nacional para el Control de la Contaminación por Ruido, por parte del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta.
(Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 23. El día 21/03/2024, se realiza visita de inspección por parte de los funcionarios Luis Álvaro Rojas Calderón y por parte de la señora Nombre01 y como no hay ruido por parte del Centro, no se realizó protocolo de medición por parte de ambos señores. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 24. El día 30/04/2024, el señor Luis Álvaro Rojas Calderón mantiene reunión con mi persona para comentarme que las actualizaciones o reportes se le harán a mi señora madre porque ella puso la denuncia. Mi señora madre, aunado a lo anterior, le comenta al funcionario que por razones de luto (muerte seguida de dos sobrinos), prefiere se reprograme la visita del 02/05/2024. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 25. El día 20/06/2024, se recibe llamada telefónica por parte del Ministerio de Salud para coordinar visita de inspección, pero se les señala que ahora los días viernes no hay afectación por ruido y que no se considera conveniente realizar una visita del día 21/06/2024 porque no se realizará protocolo de medición, como claro está, se ha descrito en puntos anteriores.
El señor Álvaro me explica que es que en la denuncia se indica que la afectación era todos los días y que por ello se ha programado visita de inspección según disponibilidad del Área Rectora de Acosta. Sin embargo por actividades calendario MEP o país, este Centro Educativo al igual que la mayoría de centros educativos públicos del país, realiza goce de vacaciones, feriados, capacitaciones, asambleas de sindicatos y demás; por lo tanto, en ese momento cambiaban constantemente los días de actividad de ejercicio en la que realizan incumplimiento del Artículo 06 del Reglamento Nacional para el Control de la Contaminación por Ruido, por parte del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta. (Anexo 4 Expediente 26-008759-0007-CO dado Con lugar) 26. Con fecha de realización del 21/06/2024, se le hace entrega a mi señora madre Nombre04, del escrito MS-DRRSSCS-CD-060-2024 correspondiente al ¨Asunto: Resolución cierre de denuncia D-143-2019 y D-050A-2023.¨, firmado por la señora Dra. Cristina Corrales Escoto, Directora de Área Rectora de Salud de Acosta.
En el cual además de varios de los puntos descritos anteriormente, se le hace saber que mediante el oficio MS-DRRSSCS-ARSAC-320-2024 se le apercibe al establecimiento CAIPAD, sobre las prohibiciones establecidas en el Art. 12 del Derecreto N° 39428-S del ¨Reglamento para el Control de la Contaminación por Ruido¨ en donde se establece la prohibición de instalación y uso de:
37. Que se ha intentado una comunicación pacífica y asertiva desde hace muchos años atrás por parte de nuestro núcleo familiar ante el CAIPAD y las autoridades correspondientes; incluso, haciéndoles saber de manera repetitiva que respetamos cien por ciento a la población a la que se deben y es su razón de ser; a las personas con condiciones o discapacidades del cantón y del mundo, que siempre hemos estado a favor de la misión y la visión en las que se estableció esta institución que alberga y apoya a las personas adultas con discapacidad de Acosta, que aplaudimos la labor de los docentes y administrativos como entes actores de la sociedad costarricense, porque sabemos y conocemos las herramientas y apoyos que brindan al estudiantado.
Sin embargo, tenemos plena conciencia de que hemos tolerando con esta comunicación escrita que ha sido meramente pacífica y asertiva, la indiferencia y la omisión de las autoridades gubernamentales, en este caso el Ministerio de Educación Pública que desde sus distintos Ministerios y departamentos ha sido conocedor de esta situación desde hace años atrás; autoridades que deben velar por el debido cumplimiento de los reglamentos existentes y que al contrario, pareciera que las gestiones denunciadas han sido simplemente leídas, remitidas y archivadas por parte del MEP; lo que por ende es de conocimiento de todos los actores, que esta perpetuación ha ocasionado daños emergentes e irreversibles a la salud física, mental y emocional de nuestra familia, así como a su patrimonio (gastos médicos por exacerbación de sintomatologías de las enfermedades crónicas y por el deterioro de salud física y mental, compra de insumos farmacológicos, cambio de estructuras aún más resistentes para la vivienda, reacomodo de dormitorios y demás aposentos en posiciones no aptas ni diseñadas para estas funciones naturales del ser humano como descansar, dormir o trabajar, compra de aparatos tecnológicos para poder avanzar en la realización de trabajos propios de su profesión, entre muchas cosas más en las que se ha tenido que gastar para tratar de sobrellevar una rutina diaria como seres humanos y ciudadanos; rutina que si bien es cierto no es igual a la que se desenvuelve la mayoría de personas en la sociedad, sí existe y es un hecho, y podemos dar el ejemplo de guardas, trabajadores de la salud, funcionarios que reparan averías y el ejemplo más claro en esta era digital, quienes hacemos aparte de trabajo de campo, teletrabajo o trabajo que involucra que las horas de rendimiento no sean las horas de entrada y salida de los funcionarios públicos del país, por mencionar solo un ejemplo.
A la luz de lo anterior, honorables magistrados y magistradas de la Sala Constitucional de Costa Rica, entendemos la gravedad de la violación sistemática al artículo 21 de la Constitución Política, del cual dimana el derecho fundamental a la salud y a la integridad física y psicológica. Asimismo, se consolida la infracción al artículo 50 constitucional, que consagra el derecho de toda persona a un ambiente sano y ecológicamente equilibrado, imponiendo al Estado el deber correlativo de garantizar, defender y preservar dicho derecho.
Comprendemos además que la jurisdicción constitucional no ha sido diseñada para tolerar que la salud de los administrados, en especial de personas adultas mayores con padecimientos crónicos, quede supeditada a las argucias de quienes emiten la contaminación sónica.
PETITORIA:
1. Solicito a la Sala Constitucional de Costa Rica, ordenar al Ministerio de Educación Pública (MEP) garantizar a mi familia y a mi persona, el derecho a la salud y al ambiente sano como derechos fundamentales interdependientes. El ambiente sano se fundamenta en el Artículo 50 de la Constitución Política, mientras que la salud se deriva del Artículo 21 (derecho a la vida). Teniendo presente que La Sala Constitucional ha dicho que ¨el derecho a la salud deriva del derecho a la vida consagrado en la Carta Magna¨, la cual dispone que "la vida humana es inviolable." (Artículo 21) y que ¨Es de este principio constitucional de donde innegablemente se desprende el derecho a la salud, al bienestar físico, mental y social, derecho humano que se encuentra indisolublemente ligado al derecho de la salud y a la obligación del Estado de proteger la vida humana.¨ 2. Solicito a la Sala Constitucional de Costa Rica, tomar en consideración el ¨INCIDENTE DE INEJECUCIÓN DE SENTENCIA Y DESOBEDIENCIA A LA AUTORIDAD (ARTÍCULOS 53 Y 71 DE LA LEY DE LA JURISDICCIÓN CONSTITUCIONAL) E INSTA LA REMISIÓN DE TESTIMONIO DE PIEZAS AL MINISTERIO PÚBLICO.¨, que se adjunta el día 17 de julio del 2026 al Expediente 26-008759-0007-CO dado Con lugar por los honorables magistrados y magistradas de la Sala Constitucional de Costa Rica el día 22 de mayo del 2026 bajo la Resolución Número 2026018071.
3. Solicito a la Sala Constitucional de Costa Rica, condenar al Ministerio de Educación Pública (MEP) al pago de daños, perjuicios y costas causados con los hechos que sirven de fundamento a esta declaratoria.”
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente acusa que “desde el CAIPAD durante años se realizan actividades matutinas donde el máximo de decibeles que utilizan en sus actividades aeróbicas, sobrepasan los límites permitidos de acuerdo a lo que se establece en el inciso número 3, específicamente en el artículo número 6 del REGLAMENTO PARA EL CONTROL DE LA CONTAMINACION POR RUIDO”. Situación que se ha mantenido en el tiempo, pese a las distintas gestiones que se han remitido al propio CAIPAD, como a las distintas autoridades del Ministerio de Educación Pública. Alega un “patrón de conducta evasiva” de parte del “ente emisor de la contaminación sónica (Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta, CAIPAD APRIOPEDA) sigue omitiendo de forma deliberada el uso de los equipos de amplificación sonora (altoparlantes) y la emisión de ruido”, cuando se ha pretendido realizar las respectivas mediciones sónicas. También se aduce “la indiferencia y la omisión de las autoridades gubernamentales, en este caso el Ministerio de Educación Pública que desde sus distintos Ministerios y departamentos ha sido conocedor de esta situación desde hace años atrás; autoridades que deben velar por el debido cumplimiento de los reglamentos existentes...”.
Esta Sala ha aclarado, en diversas ocasiones, que el recurso de amparo tiene:
“como finalidad exclusiva brindar tutela oportuna, con carácter restitutivo, contra infracciones o amenazas inminentes a los derechos y libertades fundamentales, su naturaleza es sumaria y su tramitación no es compatible con la realización de debates extensos y técnicamente complicados, la práctica de diligencias probatorias lentas y complejas, o la necesidad de entrar previamente a examinar, con carácter declarativo, si los derechos de rango infra constitucional que las partes citan como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, existen en realidad.” (véase, por todas, el voto nro. 2022020000 de las 9:15 horas del 26 de agosto de 2022).
En esta misma línea, este Tribunal ha precisado que la “naturaleza eminentemente sumaria del recurso de amparo”, supone que:
“no es material ni razonablemente posible entrar a un complicado sistema probatorio o a la práctica de diligencias probatorias lentas y complejas, por lo que este Tribunal ha sostenido reiteradamente la imposibilidad de analizar en esta sede la discrepancia en cuanto criterios o parámetros técnicos.” (véase, por todos, el voto nro. 2011-009067 de las 10:13 horas del 8 de julio de 2011)
Prima facie, resulta ajeno al ámbito de competencia de esta Sala el determinar si, en efecto, se ha incurrido en una conducta que genere contaminación sónica y, en particular, si efectivamente las actividades realizadas en el CAIPAD sobrepasan los niveles de ruido permitidos por el ordenamiento jurídico, previa investigación y análisis de los hechos denunciados, y conforme a la correcta aplicación e interpretación de la normativa infraconstitucional que rige la materia y los criterios técnicos pertinentes, pues todo ello excede el carácter sumario del amparo.
Ahora, según se constata del propio escrito de interposición, ya se formuló una denuncia por estos hechos ante el Ministerio de Salud, como autoridad competente para investigar y dilucidar sobre la acusada contaminación sónica. Por lo que será ante esa misma autoridad que el recurrente deberá formular sus alegatos y reproches.
A lo que se añade que el recurrente interpuso un recurso de amparo anterior contra el Ministerio de Salud (expediente nro. 26-008759-0007-CO), en relación con estos mismos hechos. Ese recurso ya se resolvió, mediante voto nro. 2026-018071 de las 9:30 horas del 22 de mayo de 2026, en el que se dispuso –en lo que interesa- que:
“I.- OBJETO. El recurrente explicó que en el Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD), ubicado en San Ignacio de Acosta, se realizan todos los días de 7:00 am a 8:00 am actividades de ejercicio físico, para lo que se utilizan parlantes en el exterior de la estructura, en el corredor o planché del frente. Alega que la música y los gritos de quien dirige la actividad generan un ruido excesivo que se escucha en su casa de habitación y que sobrepasa los límites reglamentarios permitidos. Se han presentado denuncias ante el Área Rectora de Salud de Acosta del Ministerio de Salud, pero no se ha solucionado el problema.
II.De previo. Lo planteado podría configurar una lesión al derecho a una justicia administrativa pronta y cumplida. Al respecto, debe aclararse que, a partir del voto número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa (con algunas excepciones) aquellos asuntos en los que se discuta si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo (incoado de oficio o a instancia de parte) o conocer de los recursos administrativos procedentes. Precisamente, en este recurso, se plantea un supuesto de excepción pues se trata de gestiones planteadas por problemas, según se alega, de contaminación sónica.

IV.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias legales, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que el día 15 de julio de 2019, se presenta en el Área Rectora de Salud de Acosta denuncia D-143-2019, interpuesta por la Sra. Nombre02 (madre del Sr. Nombre01) por supuesta afectación por ruido por actividades del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD) (entre las 6:50 am hasta las 8:00 am) sin especificas días. El día 25 de noviembre de 2019, se realiza inspección en el sitio, no se presentaron las condiciones de ruido y no se ejecuta el procedimiento de medición de ruido. El 30 de marzo de 2023, se interpones la denuncia 50A-2023, interpuesta por la Sra. Nombre02 por supuesta afectación por ruido todos los días de 7:00 am a 8:00 am) por actividades del Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD).
Los días 12 de julio 2023, 14 de noviembre de 2023, 22 de noviembre de 2023, no se no se presentaron las condiciones de ruido y no se ejecuta el procedimiento de medición de ruido. El 19 de marzo de 2024, se presenta al Área Rectora oficio MS-DRRSCS-0673-2024, Traslado Hoja de Trámite MS-DGS-HT-366-2024 donde hace del conocimiento de la nota del Sr. Nombre01 dirigida al Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD), donde expone su malestar a razón de ruido ocasionado por las actividades lúdicas realizadas con la población del CAIPAD. El día 21 de marzo de 2024, se gestionó el cambio temporal de horario a los gestores ambientales Nombre01 y Luis Álvaro Rojas Calderón para ejecutar inspección para la verificación de lo manifestado por el denunciante. El acta de inspección N° R-001-21-03-2024, donde se refiere que se llega a la vivienda de la Sra. Nombre02 a las 7:16 am y se retiran a las 7:48 am debido a que no se presentaron las condiciones de ruido referidas.
El día 30 de abril de 2024, el Sr. Nombre01 (hijo de la Sra. Nombre02) se presenta al Área Rectora solicita conocer el avance en la atención de la denuncia, donde se consulta sobre la posibilidad de programar vista de inspección el 2 de mayo de 2024. Según llamada de telefónica a la Sra. Nombre02 refiere que no se ha habido “clases toda la semana” y además señala que considera no es un buen momento para realizar la inspección ya que está viviendo un duelo. El 20 de junio de 2024, según Acta de llamada telefónica para coordinación de inspección el día 21 de junio 2024, el Sr. Nombre01 refiere que los viernes no hay afectaciones y que durante esa semana no ha habido lecciones por lo que no considera conveniente la programación esa fecha. El 12 de julio de 2024, se notifica oficio MS-DRRSCS-ARSAC-320-2024, al Sr. Rigoberto Nelson Hudson, presidente de APRIOPEDA representante de CAIPAD donde se apercibe sobre Decreto 39428-S, Reglamento para el control de la contaminación por ruido.
El 12 de junio de 2024, se notifica la resolución MS-DRRSC-ARSAC-CD-060-2024 de cierre de las denuncias D-143-129 y D-50 A-2023. Se describen en detalle las múltiples ocasiones visitas de inspección con la finalidad de atender la denuncia, ya sea porque no se presentan las condiciones de ruido o que al realizar llamadas de coordinación la denunciante no puede recibir a las autoridades del Área Rectora de Salud. Al no haber claridad sobre los días y horas en que se presenta la afectación por ruido se concluye con el cierre de las denuncias. Se le indica que de no estar de acuerdo con lo resulto por el Área Rectora comunicarlo e interponer una nueva denuncia donde se indique con claridad el horario (días y horas) en que se presentan la afectación. El 14 de mayo de 2025, el Sr. Nombre01 interpone denuncia D-69-2025, contra el Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta (CAIPAD) por supuesta afectación por ruido por torre de sonido utilizada para hacer ejercicio físico y por bulla de los gritos de los colaboradores del CAIPAD.
Señala que la afectación en la casa de la Sra. Nombre02 de 7:00 am a 8:30 am de lunes a viernes. Se programa inspección el 14 de agosto de 2025. Se notifica boleta de cita de inspección a denunciante el día 10 de junio de 2025. El 10-06-2025, mediante el oficio CARTA-MS-DRRSCS-ARSAC-0262-2025, le brinda el historial al Dr. Berny Villareal Cortés, en su calidad de Director General de Salud, acciones realizadas por el Área Rectora de Salud de Acosta que antecedieron la denuncia 069-2025. El 05-08-2025, al ser las 3:10 pm, se llamó por teléfono al denunciante Nombre01, para coordinar la visita el día siguiente, sin embargo, indica que en ese momento no hay nadie en su casa que pueda atender. La atención de la denuncia 069-2025, se logra plasmar el 8-09-2025, acta de inspección R-001-08-09-2025, donde a las 6:45 am los señores Luis Álvaro Rojas Calderón y Nombre05, miembros de esta autoridad y debidamente identificados se presentan a la habitación de la familia Nombre01, con el objetivo de realizar la medición de ruido según procedimientos, fueron recibidos e instalados en el aposento oficina de Nombre01, según la anuencia del padre Sr. Nombre02.
Una vez armado el equipo de medición se nos indica que la actividad de ejercicios físicos arranca a las 7:15 am, pasó esa hora y no se inicia más bien como aparenta que se trasladaron hacia adentro del edificio. El señor Nombre02 (padre del Denunciante), manifiesta que tienen 9 años de sufrir con el ruido denunciado y que ellos creen que algún funcionario del Ministerio de Salud del nivel local les avisa al CAIPAD cuando se va a realizar la inspección. En esta ocasión tampoco se genera el ruido que al denunciante y su familia le incomoda. Se procedió a llenar el acta de Inspección R-001-08-09-2025, leerla y firmarla al ser las 7:37 am. Como conclusión del informe técnico MS-DRRSCSARSAC-IT-406-2025, de esta atención de la denuncia y al no poder una vez más realizar la medición sónica según procedimiento reglamentario por las razones mencionadas y al haber pérdida de confianza en el Área Rectora de Salud de Acosta para seguir reprogramando la denuncia 069-2025, se recomendó la articulación y el traslado a la Región Central Sur, para ver la posibilidad que se atienda con personal ajeno a esta Área Rectora de Salud.
El 10-09-2025, mediante la solicitud de apoyo técnico MS-DRRSCS-ARSAC442-2025, se traslada la denuncia 069-2025, a la Región Central Sur de este Ministerio, para que personal técnico de este nivel superior procediera conforme a sus recursos materiales y humanos, adjuntando el informe técnico MS-DRRSCSARSAC-IT-406-2025. El 8-12-2025 se reciben los informes CARTA-MS-DRRSCS-URS-1879-2025 Y CARTA-MS-DRRSCS-URS-IT-632-2025, denominado informe de medición de ruido, en este último se explica los pasos llevados por los personeros de la Región Central Sur para establecer la medición de ruido, se indica la coordinación entre partes y que el día 5-11-2025, personeros de la región de marras, se presentan en la dirección física en San Ignacio, los atiende el Sr. Nombre02 quien indica que no hay ruido molesto y que le dieron vuelta al parlante, personal permanece ahí el tiempo adecuado y no se logra definitivamente realizar la medición de ruido: se establece que se debe reprogramar la inspección, instancia en la que el Área Rectora de Salud de Acosta procederá a coordinar nuevamente con la Dirección Regional de Rectoría de la Salud Central Sur, para que, de manera articulada, se gestione la comunicación y coordinación correspondiente con la persona denunciante.
En relación con lo expuesto se debe indicar, en primer que esta Sala solamente interviene si se comprueba que el Ministerio de Salud no atiende una denuncia planteada. Por el contrario, si el Ministerio de Salud sí atiende la denuncia, pero no ha sido posible verificar la situación denunciada, esta Sala no puede intervenir. No le corresponde a un Tribunal Constitucional indicarle al Área de Salud cómo o cuándo debe realizar las mediciones para obtener los resultados que solicita el denunciante. En este caso, concreto, de la relación de hechos probados se concluye que el Ministerio de Salud sí se ha presentado en diversas ocasiones a realizar las mediciones. Sin embargo, por circunstancias que, conforme a la documentación que se aportó, no se pueden atribuir al propio Ministerio de Salud, no se ha comprobado lo que se denunció.
Sin embargo, después de última de las intervenciones, realizada en el año 2025, el Área de Salud concluyó lo siguiente (se indica en el informe): “… se debe reprogramar la inspección, instancia en la que el Área Rectora de Salud de Acosta procederá a coordinar nuevamente con la Dirección Regional de Rectoría de la Salud Central Sur, para que, de manera articulada, se gestione la comunicación y coordinación correspondiente con la persona denunciante”. No consta que se hubiera realizado la nueva inspección. Dado que desde entonces han transcurrido un plazo que supera el que esta Sala ha considerado razonable para atender una denuncia como la planteada. En consecuencia el recurso debe declararse sin lugar y ordenar que se intente realizar una nueva inspección y que el Área de Salud emita una resolución sobre la denuncia. Se reitera que no le corresponde a esta Sala verificar directamente si se produce o no el ruido en los niveles que alega el recurrente. El amparo se estima únicamente por el plazo transcurrido desde que la misma Área de Salud consideró que se debe realizar una nueva inspección y no la ha realizado.
V.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

POR TANTO:
Se declara con lugar el recurso. En consecuencia, se le ordena a Eddy Marchena Vásquez, Director del Área Rectora de Salud de Acosta, o a quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de quince días, contados a partir de la notificación de esta sentencia, se realice una nueva inspección para atender la denuncia planteada por el recurrente y se emita una resolución. Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
El Magistrado Castillo Víquez consigna nota.” (lo destacado no corresponde al original) En ese mismo expediente, el recurrente interpuso un “INCIDENTE DE INEJECUCION DE SENTENCIA Y DESOBEDIENCIA A LA AUTORIDAD”. Y, por resolución de las 16:27 horas del 27 de julio de 2026, ya se otorgó audiencia a la autoridad recurrida respecto de la acusada desobediencia. Por lo que será en tal expediente en que habrá de resolverse lo procedente, en cuanto a la actuación del Ministerio de Salud.
Como corolario de lo anterior, procede rechazar de plano el presente amparo, como así se dispone.
En el sub iudice, la parte recurrente reclama, en esencia, una afectación continuada producto de la presunta contaminación sónica generada por las actividades desarrolladas en el Centro de Atención Integral para Personas Adultas con Discapacidad de Acosta, situación que, según afirma, persiste desde hace varios años pese a las distintas gestiones formuladas ante las autoridades competentes y sin que, hasta el momento, haya sido posible efectuar una medición que permita determinar las condiciones reales del ruido denunciado.
Sobre el particular, con el respeto acostumbrado nos separamos del criterio de mayoría. Estimamos que, por la naturaleza de los hechos acusados y su eventual incidencia sobre el derecho fundamental a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 de la Constitución Política, el asunto amerita ser conocido por esta jurisdicción. En particular, consideramos necesario verificar si, con posterioridad a las actuaciones descritas por la parte recurrente, las autoridades competentes han logrado efectuar nuevas mediciones sónicas y determinar objetivamente la existencia o no de la afectación reclamada.
Con base en lo anterior, salvamos el voto y disponemos que se curse el amparo a los efectos de contar con más elementos de conocimiento que permitan acreditar o descartar una lesión de rango constitucional.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso. Los magistrados Cruz Castro y Rueda Leal salvan el voto y disponen cursar el amparo.
