Amparo application filed by Nombre01, identity card CED01, against THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.

BACKGROUND:

  1. 1In a brief added to the Chamber’s digital case file at 14:36 on 29 July 2026, the applicant files an amparo application against the Costa Rican Institute of Aqueducts and Sewers and states that

the applicant is a user of the drinking water service associated with NIS No. 333-1253. The applicant states that over approximately the past year, they have faced bills they consider excessive and disproportionate in relation to their household’s ordinary consumption, with bills exceeding one hundred and twenty-five thousand colones per month. The applicant indicates that, before living in the current residence, the household lived in a house in Desamparados, where, under comparable occupancy and use conditions, the monthly water payment was around thirty thousand colones. The applicant states that the same number of people reside in both homes, all adults, and that general conditions are similar, including a comparable number of bathrooms and ordinary consumption habits. The applicant reports that the current residence remains unoccupied for much of the day and therefore considers it necessary for the respondent institution to explain technically and objectively the reason for the consumption and amounts billed.

The applicant adds that the bill for the July 2026 billing period shows consumption of twenty-two cubic meters and a total due of seventy-eight thousand one hundred and seventy-five colones, an amount considered high given the actual occupancy and use conditions of the property. The applicant maintains that this situation causes significant financial harm, as well as ongoing uncertainty about the proper measurement, reading, and billing of the service, and about the possible existence of leaks or inconsistencies that the Costa Rican Institute of Aqueducts and Sewers should review. The applicant argues that, given the essential nature of the drinking water service, it is indispensable for the respondent institution to conduct a comprehensive review and provide a sufficient, clear, and documented technical response regarding the charges made.

  1. 2Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss, or dismiss on the merits, at any time, including upon filing, any matter brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a repetition or reproduction of an earlier identical or similar matter that was dismissed.

Justice Castillo Víquez drafts this opinion; and, REASONS:

I. OBJECT OF THE AMPARO

The applicant is dissatisfied with the amounts charged by the Costa Rican Institute of Aqueducts and Sewers for the drinking water service.

II. REGARDING THE PROPRIETY OF THE CHARGES MADE

The purpose of an amparo proceeding is to provide timely protection, with restitutive effect, against violations or threats to fundamental rights and freedoms. Accordingly, its admissibility is generally contingent not only on establishing the existence of a disturbance—or threat thereof—to one or more of the rights or guarantees set out in the Political Charter, or those of a fundamental nature established in international human rights instruments that have been signed and duly incorporated into the legal system, but also on the alleged harm constituting a direct and gross threat to or breach of those rights. Accordingly, the amparo applicant must be advised that it is not for this Court to determine whether the charges made by the respondent institution are proper under the rules governing the matter. Therefore, if the applicant disagrees with the charges made by the Costa Rican Institute of Aqueducts and Sewers, the applicant may, if they so wish, submit their arguments to the respondent institution itself, so that it may resolve the matter as the law requires. In light of the foregoing, the amparo application is inadmissible as to this point.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the clerk’s office within a maximum period of thirty business days, counted from notification of this judgment. Otherwise, all such material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at Session No. 27-11, on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19, on 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.

THEREFORE:

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

RESULTANDO:

  1. 1Por escrito agregado al expediente digital de la Sala a las 14:36 horas del 29 de julio de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados, y manifiesta

es usuario del servicio de agua potable asociado al NIS No. 333-1253. Señala que durante aproximadamente el último año, ha enfrentado facturaciones que considera excesivas y desproporcionadas en relación con el consumo ordinario de su núcleo familiar, registrándose recibos que han superado los ciento veinticinco mil colones mensuales. Indica que, antes de residir en la vivienda actual, su núcleo familiar habitaba una casa en Desamparados, donde, bajo condiciones comparables de ocupación y uso, el pago mensual por concepto de agua rondaba los treinta mil colones. Indica que en ambas viviendas se mantiene la misma cantidad de personas residentes, todas adultas, así como condiciones generales similares, incluyendo una cantidad semejante de baños y hábitos ordinarios de consumo. Refiere que la vivienda actual permanece desocupada durante buena parte del día, por lo que considera necesario que la institución recurrida explique técnica y objetivamente la razón de los consumos y montos facturados.

Agrega que la factura correspondiente al período de cobro del mes de julio de 2026 refleja un consumo de veintidós metros cúbicos y un total a pagar de setenta y ocho mil ciento setenta y cinco colones, suma que estima elevada en atención a las condiciones reales de ocupación y uso del inmueble. Sostiene que dicha situación le genera una afectación económica relevante, así como una incertidumbre permanente respecto de la correcta medición, lectura y facturación del servicio, y sobre la eventual existencia de fugas o inconsistencias que deban ser revisadas por el Instituto Costarricense de Acueductos y Alcantarillados. Aduce que, dada la naturaleza esencial del servicio de agua potable, resulta indispensable que la institución recurrida realice una verificación integral y brinde una respuesta técnica suficiente, clara y documentada en relación con los cobros efectuados.

  1. 2El artículo 9, de la Ley de la Jurisdicción Constitucional, faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

CONSIDERANDO:

I. OBJETO DEL AMPARO

La parte recurrente se encuentra inconforme con los montos cobros por el Instituto Costarricense de Acueductos y Alcantarillados, por el servicio de agua potable.

II. SOBRE LA PROCEDENCIA DE LOS COBROS REALIZADOS

La finalidad del recurso de amparo es brindar tutela oportuna, con efectos restitutivos, contra infracciones o amenazas a los derechos y libertades fundamentales, por lo que su procedencia, en general, está condicionada, no sólo a que se acredite la existencia de una turbación —o amenaza de ésta— a uno o más de los derechos o garantías contemplados en la Carta Política, o los de carácter fundamental establecidos en los instrumentos internacionales de derechos humanos suscritos y debidamente incorporados al ordenamiento jurídico, sino también a que el agravio alegado comporte una amenaza o quebranto directo y grosero de aquellos derechos. Por lo anterior, es menester indicar al amparado que no le corresponde a este Tribunal determinar la procedencia de los cobros realizados por la institución recurrida, de conformidad a la normativa que rige la materia. Por ello, si el amparado se encuentra disconforme con los cobros realizados por el Instituto Costarricense de Acueductos y Alcantarillados, podrá, si a bien lo tiene, presentar sus alegatos ante la propia recurrida, para que se resuelva lo que en derecho corresponda. Dicho lo anterior, el recurso resulta inadmisible en cuanto a este extremo.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:
