Amparo proceeding processed in expediente number 26-026223-0007-CO, filed by Nombre01, holder of identity card CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).

Background:

  1. 1In a brief received by the Chamber's Secretariat on 21 July 2026, the appellant files an amparo proceeding against ICAA. The appellant states verbatim as follows:

“First:

I am the owner and occupant of a 200 m² lot, duly registered in the National Registry, on which a dwelling has been built for the permanent residence of my family unit. The property is located on parcel recorded in the Real Folio Registry under number N.° PRN01, according to cadastral plan SJ-586846-1985, district of San Antonio, canton of Alajuelita, province of San José. The dwelling is currently occupied and constitutes my family's usual and permanent residence.

Second:

The community has a drinking water supply service administered by the Costa Rican Institute of Aqueducts and Sewers (AyA); however, supply is provided through a single meter shared among several property owners, a situation that results in an unequal, insufficient, and inadequate distribution of the water resource.

As a result, service is received irregularly, at low pressure, and with frequent interruptions, to the point that it is practically nonexistent during extensive periods of the day. This situation makes it difficult or impossible to meet basic needs such as drinking water for human consumption, personal hygiene, food preparation, and other activities essential to a dignified life.

Third:

On 25 May 2026, I formally requested availability of the drinking water service from AyA, for the purpose of regularizing my situation and obtaining an individual connection that would guarantee an adequate and continuous supply.

Nevertheless, by official letters SIGDD-2026-00012132-1-2-NN and N°SIGDD-2026-00012132-1-1-NRT, dated 11 June 2026, AyA denied the technical feasibility of the request, stating the following:

“For drinking water: Production and distribution infrastructure in the sector is insufficient for this type of development, which is included in AyA’s ME-A-19 Puente de Mulas system; that system covers areas where, because of their location and deficiencies in the water and hydraulic capacity of the supply systems, water is unavailable for more than one consumption unit per property.” Fourth:

The denial issued by AyA does not remedy the harm currently faced by the residents of the area, nor does it contemplate alternative measures that would ensure effective, continuous, sufficient, and safe access to drinking water.

The administration merely invokes technical limitations in infrastructure and operating capacity, without adequately assessing the actual circumstances of those of us who already live in the sector and depend daily on that service to meet essential needs. This situation directly affects our fundamental right of access to drinking water and to minimum conditions of health and well-being.

Fifth:

I am also responsible for the care of my daughter, Nombre02, holder of identity card N.° CED01, who has a disability recognized by the National Council of Persons with Disabilities (CONAPDIS). Her condition requires continuous care, adequate hygiene conditions, and constant access to the water resource.

The irregular drinking water supply resulting from the use of a single meter for several families particularly seriously affects her health, well-being, and quality of life, increasing the vulnerability of our family unit and compromising the care of her special needs.”

  1. 2Article 9 of the Law on Constitutional Jurisdiction authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any matter brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an earlier, identical or similar matter that was dismissed.

Prepared by Justice Castillo Víquez; and, Reasons:

I.Object of the application. The appellant claims that ICAA denied her request for drinking water availability and an individual connection for the dwelling she occupies with her family unit, on the grounds that production and distribution infrastructure in the sector is insufficient. She maintains that the shared supply she currently receives is irregular and insufficient, and is subject to frequent interruptions, affecting the fulfillment of her basic needs and, in particular, those of her daughter, who has a disability.

II.Inadmissibility of the application. In this matter, the appellant claims that ICAA denied her request for drinking water availability and an individual connection for the dwelling she occupies with her family unit. She states that she currently receives the service through a single meter shared among several property owners, which, according to her, causes low pressure and frequent supply interruptions. She notes that, by official letters numbered SIGDD-2026-00012132-1-2-NN and SIGDD-2026-00012132-1-1-NRT dated 11 June 2026, the respondent institution rejected her request because the production and distribution infrastructure of the ME-A-19 Puente de Mulas system is insufficient to supply more than one consumption unit per property. She adds that she is responsible for the care of her daughter, who has a disability and requires constant access to the water resource.

The appellant is advised that, although this Chamber has repeatedly recognized the existence of a fundamental right of access to drinking water, it has also held that the exercise of this right is not unrestricted and that service providers may deny service when technical or legal grounds justify doing so. In this regard, in judgment no. 2018-012838, issued at 9:30 on 10 August 2018, and reiterated in judgment no. 2020-014326, issued at 9:20 on 31 July 2020, this Court stated the following:

“IV.- The specific case. In the case at bar, the appellant considers her fundamental right of access to drinking water to have been violated. She states that she and her husband own the property recorded in the Real Folio Registry under number [ in San José, cadastral plan N° SJ-1843630-2015. She notes that, through a request made by her husband to the Costa Rican Institute of Aqueducts and Sewers, water availability was requested for the aforementioned land; however, by official letter N° UNDGAM-0583-2018-1803 dated 21 February 2018, the respondent Institute denied the request on the grounds that there is no availability (…) In the sector identified by the appellant, the existing drinking water infrastructure in front of the property does not have sufficient capacity to supply it. The drinking water production currently available to supply the infrastructure located in front of the property does not have sufficient capacity to supply the property.

The population in the area has grown, creating substantial demand that has made the system supplying the sector insufficient. The situation is aggravated by the area's elevation, the limited water sources in the sector, and the competent municipality's lack of cadastral control in the area. Accordingly, the amparo proceeding must be dismissed. This Constitutional Court has held in numerous judgments on this subject that drinking water supply is considered a public service under Costa Rican law and, as such, every public service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological changes (see Judgment N° 2001-09676 and N° 2004-08161). It is therefore clear that the Costa Rican Institute of Aqueducts and Sewers, as one of the state entities responsible for providing the public drinking water service, is likewise required to provide this service continuously, adaptably, and efficiently, and equally to all inhabitants.

However, this Court's case law has also held that, in the face of legal impossibility (that is, failure to meet requirements established in the applicable regulations) or formal impossibility (that is, the absence of a water distribution network), it is reasonable not to fulfill service requests or to require the interested party to bear installation costs when there is no drinking water distribution network and infrastructure must be built. Thus, in such cases, it has been clear that this is not a denial of access to drinking water service, but rather an inability to provide it or the interested party's necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, where the failure to provide drinking water service is not arbitrary, capricious, or without grounds, but is justified by legal or material impossibility, there is no violation of fundamental rights.

In this case, the respondent authority clearly states that the appellant must comply with the provisions of the Urban Planning Law and the Regulatory Plan. The person seeking amparo was also informed that there is no associated availability for subdivision of the parent property from which the property under review was created, and that the sector also lacks supply capacity. Finally, the respondent states that, in the sector identified by the appellant, the existing drinking water infrastructure in front of the property does not have sufficient capacity to supply it. Thus, there is both legal and formal or technical impossibility, since the land was subdivided without first obtaining availability and, in addition, because the sector where the property is located lacks sufficient capacity to provide the public service. In light of the foregoing, the Chamber considers that the amparo proceeding must be dismissed because, in accordance with the line of case law applied by this Court in similar cases, drinking water supply may be denied when legal and/or formal technical impossibility is found to exist, as in this case, such that the fundamental rights of the applicant would not be infringed.

If the appellant is in fact dissatisfied with the denial itself and the reasons supporting it, that is a matter of legality that cannot be litigated through this procedure. Moreover, the Chamber finds that the person seeking amparo was expressly informed of the reasons why authorization of the service was not appropriate, and therefore her fundamental rights were not violated in that respect either” (emphasis is not in the original).

In light of the foregoing, the appellant's complaint is not directed against an absolute, arbitrary, or baseless denial, since the dwelling receives drinking water through a shared meter. She challenges ICAA's refusal to authorize an additional individual connection because the production and distribution infrastructure of the system supplying the sector is insufficient.

Determining whether it is technically possible to add another consumption unit would require examining the water and hydraulic capacity of the ME-A-19 Puente de Mulas system, the characteristics of the property, and the feasibility of expanding or modifying the existing infrastructure. These matters require technical evidence and plenary proceedings that exceed the summary scope of an amparo proceeding. This jurisdiction cannot substitute its judgment for the specialized assessment of the competent institution or directly determine the technical feasibility of the requested service.

The disability of the appellant's daughter and the particular needs of her family unit have not gone unnoticed by this Court; however, those circumstances do not permit disregarding a duly communicated technical impossibility or require ICAA to authorize an additional connection when the system lacks capacity to supply it. Nor does the application indicate that the dwelling is completely without drinking water; rather, the supply is received through a shared connection that the appellant seeks to have individualized.

Accordingly, if the appellant considers that the denial lacks technical support or that the system does have sufficient capacity to authorize an individual connection, she must raise her objections through the corresponding ordinary channels, where the necessary evidence may be offered and taken to comprehensively review the challenged acts. Consequently, the application is inadmissible, and that is so declared.

III.Documents submitted to the expediente. The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not retrieved within that period will be destroyed, in accordance with the “Regulation on Electronic Expedientes before the Judiciary,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is summarily dismissed.

Recurso de amparo que se tramita en el expediente número 26-026223-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 21 de julio de 2026, la parte recurrente interpone recurso de amparo en contra del ICAA. Expone literalmente lo siguiente:

“Primero:

Soy propietaria y habitante de un derecho de 200 m², debidamente inscrito en el Registro Nacional, sobre el cual se encuentra construida una vivienda destinada a habitación permanente de mi núcleo familiar. El inmueble se ubica en la finca matrícula de Folio Real N.° PRN01, según plano catastrado SJ-586846-1985, distrito San Antonio, cantón de Alajuelita, provincia de San José. Actualmente, dicha vivienda se encuentra habitada y constituye mi residencia familiar habitual y permanente.

Segundo:

En la comunidad existe servicio de abastecimiento de agua potable administrado por el Instituto Costarricense de Acueductos y Alcantarillados (AyA); sin embargo, el suministro se realiza mediante un único medidor compartido entre varios propietarios, situación que genera una distribución desigual, insuficiente e inadecuada del recurso hídrico.

Como consecuencia de lo anterior, el servicio se recibe de forma irregular, con baja presión y frecuentes interrupciones, llegando incluso a ser prácticamente inexistente durante amplios períodos del día. Esta situación dificulta e impide la satisfacción de necesidades básicas como el consumo humano, la higiene personal, la preparación de alimentos y demás actividades indispensables para una vida digna.

Tercero:

El día 25 de mayo de 2026 presenté formal solicitud de disponibilidad del servicio de agua potable ante el AyA, con el propósito de regularizar mi situación y obtener una conexión individualizada que garantizara un suministro adecuado y permanente.

No obstante, mediante los oficios SIGDD-2026-00012132-1-2-NN y N°SIGDD-2026-00012132-1-1-NRT, de fecha 11 de junio de 2026, el AyA denegó la factibilidad técnica de la solicitud, indicando lo siguiente:

“Para agua potable: Infraestructura de producción y de distribución en el sector es insuficiente para este tipo de desarrollo, mismo que está incluido dentro del sistema ME-A-19 Puente de Mulas del AyA; el cual corresponde a las áreas en los que, por su ubicación y por deficiencias en la capacidad hídrica y capacidad hidráulica de los sistemas de abastecimiento, no se tiene disponibilidad de agua para más de una unidad de consumo por inmueble.” Cuarto:

La negativa emitida por el AyA no soluciona la afectación que actualmente enfrentamos las personas residentes de la zona, ni contempla medidas alternativas que permitan garantizar el acceso efectivo, continuo, suficiente y seguro al agua potable.

La administración se limita a invocar limitaciones técnicas de infraestructura y capacidad operativa, sin valorar adecuadamente las condiciones reales de quienes ya habitamos en el sector y dependemos diariamente de dicho servicio para satisfacer necesidades esenciales. Esta situación afecta de manera directa nuestro derecho fundamental de acceso al agua potable y a condiciones mínimas de salubridad y bienestar.

Quinto:

Adicionalmente, tengo a mi cargo a mi hija Nombre02, portadora de la cédula de identidad N.° CED01, quien cuenta con una condición de discapacidad declarada por el Consejo Nacional de Personas con Discapacidad (CONAPDIS), condición que requiere cuidados permanentes, condiciones adecuadas de higiene y un acceso constante al recurso hídrico.

La irregularidad en el suministro de agua potable derivada del uso de un único medidor para varias familias afecta de manera particularmente grave sus condiciones de salud, bienestar y calidad de vida, incrementando la vulnerabilidad de nuestro núcleo familiar y comprometiendo la atención de sus necesidades especiales”.

  1. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. La recurrente reclama que el ICAA denegó su solicitud de disponibilidad de agua potable y de una conexión individual para la vivienda que habita con su núcleo familiar, con fundamento en la insuficiencia de la infraestructura de producción y distribución del sector. Sostiene que el suministro compartido que recibe actualmente es irregular, insuficiente y presenta frecuentes interrupciones, situación que afecta la satisfacción de sus necesidades básicas y, particularmente, las de su hija, quien tiene una condición de discapacidad.

II.Inadmisibilidad del recurso. En el presente asunto, la recurrente reclama que el ICAA denegó su solicitud de disponibilidad de agua potable y de una conexión individual para la vivienda que habita con su núcleo familiar. Expone que actualmente recibe el servicio mediante un único medidor compartido entre varios propietarios, lo que, según manifiesta, provoca baja presión y frecuentes interrupciones en el suministro. Señala que, mediante los oficios nros. SIGDD-2026-00012132-1-2-NN y SIGDD-2026-00012132-1-1-NRT del 11 de junio de 2026, la institución recurrida rechazó su gestión, debido a que la infraestructura de producción y distribución del sistema ME-A-19 Puente de Mulas resulta insuficiente para abastecer más de una unidad de consumo por inmueble. Añade que tiene a su cargo a su hija, quien tiene una condición de discapacidad y requiere acceso constante al recurso hídrico.

Ahora bien, se le aclara a la accionante que, si bien esta Sala ha reconocido de manera reiterada la existencia de un derecho fundamental de acceso al agua potable, también ha señalado que su ejercicio no es irrestricto y que las entidades prestatarias pueden denegar el otorgamiento del servicio cuando existan razones técnicas o jurídicas que así lo justifiquen. En ese sentido, mediante la sentencia nro. 2018-012838 de las 9:30 horas del 10 de agosto de 2018, reiterada en la sentencia nro. 2020-014326 de las 9:20 horas del 31 de julio de 2020, este Tribunal indicó lo siguiente:

“IV.- Sobre el caso concreto. En el sub lite, la recurrente estima lesionado su derecho fundamental de acceso al agua potable. Indica que es propietaria, junto con su esposo, del inmueble matrícula folio real [ de San José, plano catastrado N° SJ-1843630-2015. Señala que mediante gestión realizada por su esposo ante el Instituto Costarricense de Acueductos y Alcantarillados, se solicitó la disponibilidad de agua para el terreno citado; empero, por medio del oficio N° UNDGAM-0583-2018-1803 del 21 de febrero de 2018, el instituto recurrido denegó la petición, bajo el argumento que no existe disponibilidad (…) En el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La producción de agua potable que existe actualmente y abastece la infraestructura que se ubica frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble.

La población en la zona ha ido aumentando y ello ha generado mucha demanda que ha provocado que, en la actualidad, el sistema que abastece el sector sea insuficiente. La situación se ve agravada por la elevación topográfica de la zona, las limitadas fuentes de captación en el sector y la falta de control catastral en la zona por parte de la municipalidad competente. Así las cosas, lo correspondiente es declarar sin lugar el recurso de amparo. Este Tribunal Constitucional ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase Sentencia N° 2001-09676 y N° 2004-08161).

Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura.

En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En la especie, la autoridad recurrida es clara en indicar que la recurrente debe cumplir con lo estipulado en la Ley de Planificación Urbana y Plan Regulador. Además, a la amparada se le explicó que no existe disponibilidad asociada para el fraccionamiento de la propiedad madre de la que se generó la propiedad en análisis ni tampoco existe capacidad de abastecimiento en el sector. Por último, el recurrido señala que en el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. De manera tal, que existe una imposibilidad tanto jurídica como formal o técnica, ya que el fraccionamiento del terreno se realizó sin que previamente se haya obtenido la disponibilidad y, además, porque en el sector donde se encuentra la propiedad no existe capacidad suficiente para brindar el servicio públicos.

Corolario de lo expuesto, la Sala considera que se debe desestimar el recurso de amparo, ya que de conformidad con la línea jurisprudencial esgrimida por este Tribunal en casos similares, es posible denegar el suministro de agua potable cuando se determina la existente de una imposibilidad jurídica y/o formal técnica, como ocurre en la especie, de modo que no se estarían infringiendo los derechos fundamentales de la parte promovente. Si la recurrente lo que se encuentra es disconforme con la negatoria en sí, y con los motivos que la sustentan, ello corresponde a un extremo de legalidad que no puede ser ventilado en esta vía . Además, la Sala constata que a la amparada sí se le indicaron expresamente los motivos por los cuales no procedía la autorización del servicio, de ahí que tampoco en ese aspecto se hayan conculcado sus derechos fundamentales” (el resaltado no es del original).

A partir de lo anterior, se observa que la inconformidad planteada por la recurrente no se dirige contra una negativa absoluta, arbitraria o carente de fundamento, pues la vivienda recibe agua potable mediante un medidor compartido. Lo que cuestiona es que el ICAA no autorice una conexión individual adicional, debido a la insuficiencia de la infraestructura de producción y distribución del sistema que abastece el sector.

Determinar si resulta técnicamente posible incorporar otra unidad de consumo exigiría examinar la capacidad hídrica e hidráulica del sistema ME-A-19 Puente de Mulas, las características del inmueble y la viabilidad de ampliar o modificar la infraestructura existente. Tales aspectos requieren prueba técnica y una discusión plenaria que exceden el ámbito sumario del recurso de amparo. Esta jurisdicción no puede sustituir el criterio especializado de la institución competente ni disponer directamente la factibilidad técnica del servicio solicitado.

La condición de discapacidad de la hija de la promovente y las necesidades particulares de su núcleo familiar no pasan inadvertidas para este Tribunal; sin embargo, esas circunstancias no permiten desconocer una imposibilidad técnica debidamente comunicada ni obligan al ICAA a autorizar una conexión adicional cuando el sistema carece de capacidad para abastecerla. Tampoco se desprende del escrito de interposición que la vivienda se encuentre absolutamente privada de agua potable, sino que el suministro se recibe mediante una conexión compartida cuya individualización pretende obtener la accionante.

Por consiguiente, si la recurrente estima que la denegatoria carece de sustento técnico o que el sistema sí posee capacidad suficiente para autorizar una conexión individual, deberá plantear sus inconformidades en las vías ordinarias correspondientes, donde podrá ofrecerse y evacuarse la prueba necesaria para revisar integralmente los actos cuestionados. En consecuencia, el recurso resulta inadmisible y así se declara.

III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
