Amparo proceeding in expediente number 26-026206-0007-CO, filed by Nombre01, identity card CED01, against the MUNICIPALITY OF PÉREZ ZELEDÓN.
Background:
“[M]y situation is as follows: for many years, I have owned 2 lots in Ciudadela Blanca, Sn. Isidro del General, P.Z., one for approximately more than 25 years and the other for 18 years. These 2 lots are side by side, that is, they are together.
Lot #1: Area 111.25 mt², No. Survey Plan: SJ 166405-94 Lot #2: Area 140 mt², No. Survey Plan SJ 144559-2010 The matter is that I went to the municipality to obtain the land-use certificate for the two lots, and the land-use certificates stated that no construction or anything else can be done, not even parking or a vegetable garden, because they are within 100 meters of a spring (naciente).
My concern is the following: I grew up in that area, in a house that was on the lot measuring 140 mt², which was together with the 111.5 lot, because at that time the lots had not been separated. Over time, the 111.5 lot was sold, and the person who bought it built a boarding house. Approximately 4 or 5 years ago, the two little rooms appeared because they were in very poor condition…
The houses were demolished, with the idea of later building new houses.
But now it turns out that nothing can be done there.
We want the Municipality to grant us the construction permit in the land-use certificate, since dozens of houses and apartments have been built there within that 100-meter range, including a Country Club with a swimming pool, water games, etc.; As a resident of the area, where I grew up, I remember that spring was a very small stream.
As I told you, many houses have been built in that area, and they are very beautiful and elegant, and my 2 little lots are being hemmed in by all those houses.
I want you to help me get the Municipality to grant me a residential-commercial construction permit in the land-use certificate. I do not think it is fair to have paid and to still be paying taxes for so many years, only to now be unable to do anything on these little lots.”

I.Subject of the application. The petitioner challenges the Municipality of Pérez Zeledón’s determination that no work may be carried out on two properties he owns because they are within the protection area of a spring. He complains that, despite the numerous buildings in the area, the municipal corporation refuses to authorize the residential and commercial land use he seeks.
II.Inadmissibility of the application. In this matter, the petitioner challenges the Municipality of Pérez Zeledón’s determination that, because his properties are located within the protection area of a spring, construction work and the other activities he seeks cannot be carried out there. He points out that there are numerous buildings in the same area and asks this Chamber to order the municipal corporation to authorize residential and commercial land use.
However, determining whether the restriction applied to the petitioner’s properties is legally justified would require verifying the spring’s existence, location, and characteristics; delineating the corresponding protection area; examining the land’s registration, cadastral, urban-planning, and environmental conditions; and reviewing the applicable infra-constitutional legislation. Likewise, assessing the argument concerning neighboring buildings would require determining whether they are in equivalent factual and legal circumstances, when they were built, and whether they have the respective administrative authorizations. These matters cannot be resolved through the summary procedure of an amparo proceeding.
Payment of municipal taxes and the existence of other buildings in the area do not, by themselves, confer a fundamental right to obtain the land use or construction permit sought. In reality, the petitioner seeks for this Chamber to review the legality of the restriction imposed by the Municipality and to substitute itself for the Administration in the exercise of its urban-planning and environmental powers, which exceeds the scope of this constitutional jurisdiction.
Accordingly, the application must be summarily dismissed, without prejudice to the petitioner bringing his claims before the Administration itself or through the competent ordinary procedure, where the justification for the restriction may be fully debated and the necessary technical evidence submitted.
III.Documents submitted to the expediente. The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within this period will be destroyed, as provided in the “Regulation on the Electronic Case File before the Judiciary,” approved by the Corte Plena at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The application is summarily dismissed.

Recurso de amparo que se tramita en el expediente número 26-026206-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE PÉREZ ZELEDÓN.
Resultando:
“[M]i asunto es el siguiente: desde hace muchos años, soy propietario de 2 lotes en Ciudadela Blanca, Sn. Isidro del General, P.Z, aproximadamente más de 25 años un lote y el otro hace 18 años. Estos 2 lotes, están uno al lado del otro, o sea, están juntos.
Lote #1: Área 111.25 mt², No. Plano: SJ 166405-94 Lote #2: Área 140 mt², No. Plano SJ 144559-2010 El asunto es que fui a la municipalidad a sacar el uso de suelo para los dos lotes, y salieron en el uso de Suelo, que no se puede construir, ni hacer nada, ni siquiera parqueo, ni una hortaliza, porque están en el rango de 100 mts de una naciente de agua.
Mi inquietud es la siguiente, yo crecí en esa área, en una casa que estaba en el lote que mide 140 mt², que estaba junto con el lote de 111.5, porque en ese tiempo no se habían separado los lotes. Con el tiempo, se vendió el lote de 111.5, y la persona que lo compró construyó una cuartería. Aproximadamente 4 o 5 años, aparecieron los 2 cuartitos porque estaban en muy malas condiciones…
Las casas se botaron, con la idea, de luego construir casas nuevas.
Pero ahora resulta que no se puede hacer nada ahí.
Queremos que la Municipalidad nos otorgue el permiso de construcción en el uso de Suelo ya que ahí, en ese rango de 100 mts, se han construido decenas de casas y apartamentos, incluso si no hay 1 Country Club con piscina juegos de agua, etc.; Como residente del área, que crecí ahí, me acuerdo que esa naciente era un chorro de agua muy pequeño.
Como les comenté, en esa área se han construido muchas casas, y muy lindas y elegantes, y mis 2 lotecitos están quedando encerrados en todas esas casas.
Quiero que me ayuden a que la Municipalidad me otorgue el permiso de construcción Residencial-Comercial en el Uso de Suelo, pienso que no es justo haber pagado y estar pagando impuestos por tantos años, para que ahora, yo no pueda hacer nada en estos lotecitos”.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso. El recurrente cuestiona que la Municipalidad de Pérez Zeledón haya determinado que no puede desarrollar ninguna obra en dos inmuebles de su propiedad, debido a que se encuentran dentro del área de protección de una naciente. Reclama que, pese a que existen numerosas construcciones en la zona, la corporación municipal se niega a autorizarle el uso de suelo residencial y comercial que pretende.
II.Inadmisibilidad del recurso. En el presente asunto, el recurrente cuestiona que la Municipalidad de Pérez Zeledón haya determinado que, debido a la ubicación de sus inmuebles dentro del área de protección de una naciente, no resulta posible desarrollar en ellos obras de construcción ni las demás actividades pretendidas. Señala que existen numerosas edificaciones en la misma zona y solicita que esta Sala ordene a la corporación municipal autorizarle un uso de suelo residencial y comercial.
Sin embargo, determinar si la restricción aplicada a los inmuebles del promovente resulta jurídicamente procedente exigiría verificar la existencia, ubicación y características de la naciente; delimitar el área de protección correspondiente; examinar las condiciones registrales, catastrales, urbanísticas y ambientales de los terrenos; y revisar la normativa infraconstitucional aplicable. Asimismo, valorar el alegato relacionado con las edificaciones vecinas requeriría establecer si estas se encuentran en condiciones fácticas y jurídicas equivalentes, cuándo fueron construidas y si cuentan con las autorizaciones administrativas respectivas. Tales aspectos no pueden dilucidarse mediante el procedimiento sumario del recurso de amparo.

En consecuencia, corresponde rechazar de plano el recurso, sin perjuicio de que el accionante plantee sus reclamos ante la propia Administración o en la vía ordinaria competente, donde podrá discutirse ampliamente la procedencia de la restricción y aportarse la prueba técnica necesaria.
III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
