Review of the Document CASE FILE No. 26-025816-0007-CO PROCEEDING: AMPARO PROCEEDING RULING No. 2026030122 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on 6 August 2026.
Amparo proceeding filed by Nombre01, identity card CED01, against the MUNICIPALITY OF GOICOECHEA.
Background:
Justice Castillo Víquez drafts the ruling; and, Reasons:
The petitioner alleges that the Municipality has failed to approve a new regulatory plan, leaving it without updated zoning to protect aquifer recharge areas, waterways, and risk areas. The petitioner maintains that this prevents harmonious residential and commercial development and allows obsolete rules to be applied. The petitioner adds that on 15 July 2026, according to the evidence submitted, they filed a complaint to this effect, but the Municipality refused to receive it. The petitioner considers fundamental rights to have been violated and requests the Chamber’s intervention so that the regulatory plan is approved.
Upon reviewing the evidence submitted, the Chamber observes that, regarding the complaint sent by email on 15 July 2026 (concerning approval of the regulatory plan) mentioned in this amparo, the respondent replied as follows:
“in order to continue the corresponding administrative procedure, we respectfully request that the document be submitted duly signed by the person making the filing. The document may be submitted with a handwritten signature or a digital signature, and a legible copy of the signatory’s current identity document must be attached, ensuring that the image clearly shows the personal information, identification number, photograph, and expiration date of the document. Likewise, the copy must not have any cross-outs, alterations, amendments, or damage that would prevent its authenticity from being verified or make it difficult to identify the person signing it. The foregoing is intended to ensure proper identification of the signatory and provide legal certainty to the procedure, in accordance with the principles governing administrative action, the General Public Administration Act, and Law No. 8454, the Law on Certificates, Digital Signatures, and Electronic Documents, which recognizes the full legal validity of documents signed using a certified digital signature.” In other words, the matter alleged is not a refusal to receive the complaint at the outset, but a disagreement with the requirements imposed by the respondent for processing it.
This is a dispute concerning ordinary legality that does not directly involve any fundamental right. Furthermore, it is emphasized that this Court must not act as a mediator with a particular natural or legal person—whether under public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek. Those matters must be resolved by the Administration or, as the case may be, by the ordinary courts.
Likewise, regarding approval of the regulatory plan, the petitioner applies to the Constitutional Chamber in the abstract, without identifying specific grievances that concretely, directly, or individually (in terms of manner, time, and place) affect or have affected the petitioner’s fundamental rights or those of any particular other person as a result of the alleged omission. In other words, the petitioner presents a general statement of disagreement with the alleged omission. Accordingly, because this part of the claim is abstract, it is also inadmissible and must be summarily rejected pursuant to Article 9 of the Constitutional Jurisdiction Act.
In this case, the petitioner complains that a new regulatory plan has not been approved for the canton of Goicoechea, even though, according to the petitioner, the regulations in force are outdated and insufficient to protect the canton’s aquifer recharge areas, waterways, risk areas, and remaining forested areas. In the petitioner’s view, this omission encourages disordered urban growth and compromises the right to a healthy and ecologically balanced environment.
We respectfully consider that the claim should not be rejected, since the inactivity attributed to the local government could have environmental consequences and therefore involve the right protected by Article 50 of the Political Constitution. In particular, the allegations raise the need to determine whether the failure to update the territorial planning instrument has effectively left the canton’s natural resources and environmentally vulnerable areas unprotected. This issue requires the report of the respondent authority and the relevant technical evidence, without this assessment prejudging the merits or disregarding the Municipality’s own powers in territorial planning.
On the basis of the foregoing, and taking into consideration the circumstances alleged in this case, we dissent and order that the amparo proceeding be processed so that further information may be obtained to establish or rule out a violation of constitutional rank.
The parties are instructed that, if they have submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not collected within this period will be destroyed, in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is summarily rejected. Justices Cruz Castro and Rueda Leal dissent and order that the amparo proceeding be processed.

Revisión del Documento EXPEDIENTE N° 26-025816-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026030122 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE GOICOECHEA.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
La parte recurrente acusa que existe una omisión de la municipalidad en aprobar un nuevo plan regulador, al carecer de zonificación actualizada para proteger zonas de recarga acuífera, cauces y áreas de riesgo. Sostiene que esto impide el desarrollo habitacional y comercial armónico, y permite la aplicación de normas obsoletas. Adiciona que el 15 de julio de 2026 (según prueba aportada), interpuso una denuncia en este sentido, pero se negaron a recibirla. Estima lesionados los derechos fundamentales. Solicita que la Sala intervenga para que se apruebe tal plan regulador.
Vista la prueba aportada, se observa que, respecto de la denuncia enviada por correo electrónico el 15 de julio de 2026 (atinente a la aprobación del plan regulador), mencionada en este amparo, la parte recurrida contestó lo siguiente:
“con el propósito de dar continuidad al trámite administrativo correspondiente, se solicita respetuosamente que el documento sea remitido debidamente suscrito por la persona gestionante. El documento puede ser presentado con firma manuscrita o firma digital y deberá adjuntarse copia legible del documento de identidad vigente del firmante, procurando que la imagen permita verificar claramente los datos personales, el número de identificación, la fotografía y la fecha de vencimiento del documento. Asimismo, la copia no deberá presentar tachaduras, alteraciones, enmiendas o deterioros que impidan comprobar su autenticidad o dificulten la identificación de la persona suscribiente. Lo anterior, con el fin de garantizar la adecuada identificación del firmante y brindar seguridad jurídica al trámite, de conformidad con los principios que rigen la actuación administrativa, la Ley General de la Administración Pública, así como la Ley N.° 8454, Ley de Certificados, Firmas Digitales y Documentos Electrónicos, la cual reconoce la plena validez jurídica de los documentos suscritos mediante firma digital certificada.” Es decir, lo acusado no trata de una denegatoria ad portas de la recepción de la denuncia, sino de una disconformidad con los requisitos solicitados por el recurrido para su tramitación, lo cual corresponde a un conflicto de legalidad ordinaria, que no involucra, al menos en forma directa, derecho fundamental alguno.
Además, se destaca que este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende. Esos extremos deben ser resueltos por la Administración o, en su caso, la jurisdicción ordinaria.
Asimismo, respecto de la aprobación del plan regulador, la parte promovente acude en abstracto ante la Sala Constitucional, sin concretar agravios específicos que afecten o hayan afectado de manera concreta, directa o individualizada (en modo, tiempo y lugar), sus derechos fundamentales o de otra persona en específico con la omisión acusada. Es decir, acude en forma genérica a exponer su disconformidad con la omisión mencionada. Por ende, al ser este extremo abstracto, también deviene inadmisible y procede su rechazo de plano, de conformidad con lo dispuesto en el artículo 9 de la Ley de la Jurisdicción Constitucional.
En el sub lite, la recurrente reclama la falta de aprobación de un nuevo plan regulador para el cantón de Goicoechea, pese a que, según sostiene, la normativa vigente se encuentra desactualizada y resulta insuficiente para proteger las zonas de recarga acuífera, los cauces, las áreas de riesgo y los remanentes boscosos del cantón. A su juicio, esa omisión favorece un crecimiento urbano desordenado y compromete el derecho a un ambiente sano y ecológicamente equilibrado.
Respetuosamente, consideramos que el reclamo no debe ser rechazado, pues la inactividad atribuida al gobierno local podría tener incidencia ambiental y, por ende, involucrar el derecho tutelado en el artículo 50 de la Constitución Política. En particular, lo alegado plantea la necesidad de determinar si la falta de actualización del instrumento de planificación territorial ha generado una desprotección efectiva de los recursos naturales y las zonas ambientalmente vulnerables del cantón. Tal extremo requiere contar con el informe de la autoridad recurrida y los elementos técnicos pertinentes, sin que esta apreciación implique adelantar criterio sobre el fondo ni desconocer las competencias propias de la municipalidad en materia de ordenamiento territorial.
Con base en lo anterior, tomando en consideración las circunstancias alegadas en el sub examine, salvamos el voto y disponemos que se curse el amparo a los efectos de contar con más elementos de conocimiento que permitan acreditar o descartar una lesión de rango constitucional.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso. Los magistrados Cruz Castro y Rueda Leal salvan el voto y disponen cursar el amparo.
