Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on 6 August 2026.
Amparo proceeding filed in case number 26-004831-0007-CO by Nombre02, an older adult, identity card CED01, against the Municipalidad de Alajuelita, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados.
Background:
“FIRST: In response to the facts set out by the applicant, we respectfully report that the situation complained of has been analyzed by the technical bodies of the Municipalidad de Alajuelita, particularly the Technical Unit for Road Management, which conducted site inspections and issued the corresponding technical opinion. Those actions show that the matter has been addressed through the corresponding administrative steps and is currently undergoing technical assessment by the Junta Vial Cantonal, the body competent to consider and make decisions relating to the cantonal road network.
SECOND: In that regard, according to the technical report issued by Architect Michael Barboza Arroyo, attached to this pleading, the road where the area identified by the applicant is located is registered in the Cantonal Road Network Inventory with classification NCU (Not Classified as In Use). Under the applicable rules governing administration of the cantonal road network and use of public resources, this means that public funds may not lawfully be invested in work on that road while that classification remains in effect.
The Cantonal Road Network classification ‘Not Classified as In Use’ (NCU) applies to public roads, paths, walkways, or trails, often narrow and unsuitable for vehicular traffic, that serve few users. Their maintenance is the responsibility of direct beneficiaries, and they do not receive funds under Ley 8114.
It is important to mention some key points regarding NCU roads under Ley 8114: ‘They are public roads that do not fit into the main functional categories (primary, secondary, tertiary), and are used mainly by pedestrians, bicycles, beasts of burden, or as limited-access roads. They must be registered in the “Road Register” of MOPT’s Sectoral Planning Directorate. To change from NCU to another category, they must meet the regulatory road-width requirements of Ley 5060 and MOPT’s technical requirements.’ THIRD: In addition, the technical analysis conducted on site confirmed the presence of various factors affecting the problem described by the applicant. These include discharges of water that are not exclusively stormwater, but also wastewater from properties in the area, which appears to be entering the existing stormwater drainage system.
In this regard, it must be noted that control, inspection, and regulation of wastewater discharges are not within the competence of local governments. Rather, these matters fall within the remit of the Ministerio de Salud, as the competent health authority, under Ley General de Salud No. 5395, the Regulation on Wastewater Discharge and Reuse (Decreto Ejecutivo No. 33601), and other applicable health regulations. Those provisions expressly prohibit discharging wastewater into stormwater drainage systems and empower the health authority to order the corresponding corrective measures when such situations are detected.
FOURTH: It should be noted that the municipality recognizes that public health must be viewed as an integrated matter because it must cover all priority dimensions of every person’s life. However, in the case before us, we understand that this matter is not the municipality’s responsibility but that of the property owners, on the one hand, and the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados, on the other. Ley General de Salud places on the property owner the obligation to ensure the proper disposal of water in general, and also gives the Ministerio de Salud the corresponding authority to verify that this obligation is being fulfilled appropriately:
ARTICLE 285.- Excreta, sewage, wastewater, and stormwater must be disposed of properly and in a sanitary manner to prevent contamination of soil and natural water sources used for human consumption, the formation of vector breeding grounds and disease, and air pollution through conditions that compromise its purity or quality.
Ley General de Salud establishes the basic obligations of owners of properties, whether or not they have buildings, and identifies the bodies competent to oversee sewerage systems. In this regard, it provides that property owners must carry out the drainage works ordered by the health authorities, and that owners of buildings must equip them with systems for disposing of excreta, sewage, and wastewater, subject to approval by the Ministerio.
These requirements are set out in Articles 286 and 287 of that Law, which provide:
ARTICLE 286.- Every natural or legal person is required to carry out the drainage works ordered by the health authority to prevent the formation of unsanitary and infectious foci, or to remedy those already present on properties they own.
If the owner is unwilling to comply with such orders, the health authority may carry them out at the expense of the person who failed to comply.
Where the public interest and the nature and scale of the drainage works so warrant, every property owner is required to grant an easement in favor of the State so that the health authority may construct those works. The land may be expropriated when the easement is incompatible with its use.
The maintenance and operation of such works, where applicable, shall be the responsibility of their beneficiaries.
ARTICLE 287.- Every natural or legal person who owns homes, establishments, or buildings where people carry out their activities is responsible for ensuring that those properties have a system for disposing of excreta, sewage, and wastewater approved by the Ministerio. Users of homes, establishments, or buildings are required to keep that system in good working order.
Thus, Ley General de Salud requires owners to connect to the sewer system and further provides that technical oversight of such systems is exercised by the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados.
This is provided in Article 288 of Ley General de Salud, which states:
ARTICLE 288.- Every owner is required to connect the system for disposing of excreta, sewage, and wastewater from their property to the sanitary sewer where it is operational, except in cases recognized as appropriate exceptions under the applicable regulations.
The cited Law grants the Ministerio de Salud authority to order property owners to carry out the necessary works for these purposes and places technical oversight of sewerage systems under that Ministerio and the Instituto Costarricense de Acueductos y Alcantarillados.
Article 292 of Ley General de Salud No. 5395 of 1973 prohibits discharging sewage, wastewater, and industrial waste into storm sewers and states:
ARTICLE 292.- Discharge of sewage, wastewater, and industrial waste into storm sewers is prohibited in all cases. The Ministerio is empowered to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through systems for collecting excreta, sewage, and wastewater.
FIFTH: Accordingly, where there may have been an unlawful discharge of wastewater from private properties, it is for the Ministerio de Salud to conduct the investigations and inspections and issue any health orders that may be appropriate, in order to correct those discharges and prevent harm to public health and the environment.
Likewise, the municipal technical report states that, before the Technical Unit for Road Management can assess any work relating to road infrastructure or the existing drainage system, the problem of wastewater discharge must first be corrected by the competent authorities. The presence of sanitary discharges in a system designed for stormwater makes effective intervention by the municipal administration technically impossible.
REQUEST FOR RELIEF.
In view of the foregoing, this Municipality has taken the actions falling within its legal powers, referring the matter for technical analysis and keeping it under consideration by the corresponding bodies. However, it is important to clarify that resolving the problem described by the applicant in an integrated manner involves matters beyond municipal competence, particularly the sanitary control of wastewater discharges, which falls to the national health authority.
For the reasons stated, it is evident that the Municipalidad de Alajuelita has not failed to act within its sphere of competence. It addressed the situation through technical inspections and the corresponding administrative analysis, without prejudice to the intervention of other competent institutions within their respective legal powers. Consequently, because no violation of fundamental rights attributable to this municipality has been established, this Honorable Court is respectfully requested to dismiss in its entirety the Amparo application filed by the applicant Nombre02.”
“This response is based on the administrative and technical actions included in health case file D-012-2026, processed by this Health Area.
As shown in case file D-012-2026, on 21 January 2026 a complaint was received from Mr. Nombre02, who reported alleged seepage/discharges of dirty water from a neighboring property and associated the situation with bad odors, possible structural damage to his home, and a health risk.
In response to that filing, and in accordance with Article 32 of the Regulations to the Law on Protection of Citizens from Excessive Requirements and Procedures, which requires that filings of the same nature be handled in order of their date of submission, this Health Authority scheduled and conducted an inspection on 08 April 2026, as shown by the notice documentation and the corresponding inspection record, consecutively numbered A-117-2026, included in the case file.
During that on-site inspection on 08 April 2026, which took place before notification of the amparo proceeding at issue, we were received by the complainant himself and his daughter, Nombre01, who signed the inspection record A-117-2026. The record notes their statement that the reported problem had been resolved, and that the initially reported seepage was not observed.
The same finding appears at pages CED02 000011 of the administrative file, in Technical Report IT-MS-DRRSCS-ARSAL-0088-2026, which concludes that no seepage was found during the inspection and that the complainant reported that the originally reported problem had ceased.
On that basis, since there was no evidence warranting health measures or further follow-up, this Directorate ordered the closure and archiving of case file D-012-2026 by official letter MS-DRRSCS-ARSAL-CD-0040- 2026 dated 28 April 2026, and notified the complainant on 29 April 2026.
In addition, in connection with the amparo proceeding and in order not to disregard the constitutional rights of the amparo applicant, the file contains, at page 000016, a record of a telephone call made to Mr. Nombre02 on 28 April 2026 to explain and clarify the scope of the proceeding. During that call, the applicant expressly stated that complaint D-012-2026 and the amparo proceeding concerned different situations. He said the health complaint concerned seepage caused by a neighbor and that this had already been resolved. He also stated that the amparo proceeding concerned the lack of storm sewers in the area, which he characterized as a municipal matter because it involved infrastructure on a public road and because, according to him, the Municipality had not used the funds for its installation.
For the foregoing reasons, we respectfully report that, within the Ministerio de Salud’s remit, the formal filing processed by this Health Area at the applicant’s request is case file D-012-2026. It was addressed through an inspection and verification, which found no issue at the time of the visit, and the case was then administratively closed. As to the matter that the applicant himself identifies as the reason for the amparo application—the installation of storm sewers on a public road—this health authority does not carry out stormwater infrastructure works or administer municipal funds for those purposes, without prejudice to its health-inspection powers where unlawful discharges or actual risks to public health are duly established.
Attached to this report is a certified copy of the documentation in case file D-012-2026, duly identified, numbered from 00001 to 000017, and arranged in strict chronological order: the inspection notice/form, inspection record, technical report, closure letter, and telephone-call record.
Accordingly, we respectfully request that this Directorate be deemed to have complied with the hearing granted to it and that the submitted evidence be incorporated into the record. We also ask that the Court take into account that, within the Ministerio de Salud’s sphere of competence, the complaint that led to health-authority action (D-012-2026) has already been addressed and closed following an inspection that found no issues, and thus no failure to act is attributable to this Health Authority.
As to claims concerning storm sewer works or other infrastructure on a public road, we reiterate that, according to the applicant, this is a matter of municipal administration. We therefore request that this Chamber limit the Ministry’s responsibility to the actions actually taken and documented in the health case file.”
“RESPONSE OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS By technical study No. DRyT-DSRT-2026-00056 dated 05 May 2026, Engineer Juan Pablo Vargas Brenes, an employee of AyA’s GAM Collection and Treatment UEN, issued the technical opinion in this matter and reports as follows:
Having reviewed the brief initiating the proceeding, signed by the applicant and filed with the Municipalidad de Alajuelita, concerning the progressive sinking of her land (apparently caused by seepage of wastewater from homes located uphill on the street known as Dirección01), the situation described is considered to be mainly associated with the management of surface runoff along the stormwater collection system, rather than the apparent conveyance of wastewater through that system.
During the site inspection conducted by technical operations staff of AyA’s Development and Research Unit on 5 May of this year, no wastewater discharges into the stormwater channel (which is piped in many places) were observed. The channel was dry during the site visit. (Ref: Photographs No. 1 and No. 2) Based on what was observed at the site, a stormwater channel or ditch runs along the front of the applicant’s home. During rainfall, it carries water from street runoff. In that area, the channel consists only of a ditch dug along the side of the street, with no civil works to channel stormwater. (Ref: Photograph No. 3) Consistent with the foregoing, the problem described by the applicant concerning the apparent sinking of her property is mostly related to the erosive effect that rainfall may cause at the boundary between the applicant’s land and the ditch carrying rainwater. That water may have sufficient erosive force to cause some kind of damage to the property in question.
Although no wastewater flow into the stormwater channel was observed, even if such flow existed, its volume would be considerably less than the volumes generated by rainfall. It is therefore estimated that, even if such flows were to pass through the channel, their effect on the issue raised by the applicant would be minimal compared with the effect of stormwater runoff during heavy rainfall in the area.
In this regard, THE LOCAL GOVERNMENT HAS THE POWERS TO ADMINISTER, MAINTAIN, AND DEVELOP CIVIL WORKS SUPPLEMENTING THE STORM SEWER SYSTEM INTENDED TO CARRY AWAY RAINWATER, WHILE AYA HAS NO AUTHORITY OVER THIS TYPE OF STORMWATER INFRASTRUCTURE.
In addition to the foregoing, AyA has no civil infrastructure for collecting wastewater (wastewater and ‘sewage’) in the area where the situation described by the applicant is located. Therefore, each home built in the area must dispose of its domestic wastewater individually through a septic tank and drainage, rather than discharging it into stormwater systems that are not designed to carry water other than that generated during rainfall.
The foregoing is supported by Article 286 of Ley General de Salud, Ley No. 5395, which expressly provides that the Ministerio de Salud may order drainage works to prevent the formation of unsanitary and infectious foci; and by Articles 287 and 288 of that same Law, which state that each home or business owner is responsible for having a system to dispose of their own wastewater where there is no operational sanitary sewer system.
Art 286 ‘Every person, natural or legal, is required to carry out the drainage works ordered by the health authority to prevent the formation of unsanitary and infectious foci, or to remedy those already present on properties they own.’ Art. 287 and Art 288 ‘Every person, natural or legal, who owns homes, establishments, or buildings where people carry out their activities is responsible for ensuring that those properties have a system for disposing of excreta, sewage, and wastewater approved by the Ministerio. Users of homes, establishments, or buildings are required to keep that system in good working order.’ According to the definition of wastewater, any water that has been used by people and whose composition has therefore changed is considered wastewater. For this reason, both water containing organic fecal matter and inorganic soapy water must be disposed of through septic tanks and drainage in all areas without an operational sanitary sewer system (as applies in this case). Therefore, if this type of water were discharged into stormwater collection systems (storm sewers), that would be unlawful, AND MUST BE ADDRESSED AND CORRECTED BY THE MINISTERIO DE SALUD AND THE LOCAL GOVERNMENT. II.

ON THE MERITS The Municipalidad de Alajuelita MUST take the measures within its remit concerning the presence of wastewater originating from the stormwater network. This must be done in coordination with the Ministerio de Salud, as the institutions responsible for ensuring the proper discharge of wastewater, in light of both Decreto Ejecutivo No. 31545- S- MINAE and Ley General de Salud.
Responsibility in the case under review lies strictly with the Municipality. On this point, we do not omit to state that, in VOTO No. 2013-007598, this Honorable Constitutional Chamber clearly indicated the obligation of local governments to safeguard the interests of their residents.
They are responsible for actively planning with the other entities involved to protect the fundamental interests and rights of their communities and to do everything within their power to provide the services under their charge responsibly.
The risk to people’s health and life is a problem for which the Municipality is responsible and, therefore, it must seek an effective solution.
Moreover, the Ministerio de Salud’s duty to ensure the proper disposal of the pollutants mentioned is a matter of responsibility and legal certainty, and particularly of protecting public health. NO SUCH ACTIONS ARE BEING TAKEN IN ANY WAY, which gives rise to a violation of the right to health and to a healthy and ecologically balanced environment.
REQUEST FOR RELIEF On the basis of the factual and legal grounds stated, I submit the requested report. I expressly identify for the consideration of this Office the actions of the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS in fulfillment of its purposes. It has plainly not disobeyed or violated constitutional or environmental rules, guarantees, or principles, and has always acted responsibly to safeguard and protect the right to the environment, health, and life. The amparo application against my represented institution should therefore be dismissed in its entirety, as I respectfully request.
LAW This report is submitted in accordance with Articles 21 and 50 of the Political Constitution, Article 43 and related provisions of the Constitutional Jurisdiction Act, Articles 113 and related provisions of the General Public Administration Act, and Articles 1 and 2 of the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados (Ley No. 2726).”
Drafted by Justice Garro Vargas; and, Reasons:
I.On the Chamber’s consideration of this case for violation of Article 41 of the Political Constitution. Before examining the merits, it must be clarified that, beginning with judgment No. 2008-002545 issued at 08:55 on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits set by the General Public Administration Act (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, whether to issue a final decision in an administrative proceeding—initiated on the administration’s own initiative or at a party’s request—or to decide the available administrative appeals. In the case at hand, an exception applies,
because it is alleged that a reported situation persists and relates to environmental pollution that could affect the health of the applicant and her family. That clarification having been made, the specific situation raised in this amparo proceeding will now be resolved.
II.Subject of the amparo application. The applicant alleges that, for more than three years, wastewater from multiple homes located uphill from her property has flowed down and passed in front of her only residence, located in the Pueblo Escondido neighborhood in Los Filtros de Alajuelita. She indicates that this water seeps beneath the front of her property, causing the ground to sink progressively and affecting the structural stability of her home. She adds that wastewater is even penetrating beneath the house’s structures, posing a serious risk to the integrity of the property and to her personal safety and that of her family. She notes that the situation also constitutes an evident public health problem because of the constant exposure to contaminated water. She states that the situation was duly reported to the Municipalidad de Alajuelita, whose engineers therefore conducted several inspections and confirmed the following: -The existence of the problem. -The need to correct the handling of wastewater. -The existence of a health risk and -The local government’s commitment to intervene.
She even says she was informed that resources had already been approved and allocated to install new piping to solve the problem. However, she complains that, despite the time elapsed and multiple technical visits, the municipality has not carried out the promised works. She maintains that, on the contrary, the problem has worsened and that the authority has now taken no effective action, ignoring what had previously been agreed.
III.Proven facts. The following facts are considered duly established and relevant to deciding this matter, either because they have been proven or because the respondents failed to address them as required in the initial order:
IV.On the principle of prompt and complete justice. Under Article 41 of the Constitution, the Administration has an obligation to guarantee the public prompt and complete justice, without denial. In the sphere of administrative justice, this entails a duty to decide diligently and expeditiously on claims submitted by members of the public, to ensure that the decision addresses the matters alleged, and to notify interested parties of what has been decided, all within a reasonable time. In this regard, whether the duration of administrative activity is “reasonable” is determined case by case based on various factors, such as the technical complexity of the administrative matter, the extent of the evidence to be taken, or the degree of harm caused by the challenged act. It follows that there is no strict right to have the Administration’s time limits constitutionalized.
V.On the collection, treatment, and final disposal of sewage. To effectively protect a healthy and ecologically balanced environment, the State, understood broadly, has a duty to provide the necessary measures to ensure timely and effective treatment of sewage in the country’s communities. In this regard, this Constitutional Court has held that the Instituto Costarricense de Acueductos y Alcantarillados, Municipalities, and the Ministerio de Salud are responsible, within their respective spheres of competence, for ensuring the proper collection, treatment, and final disposal of such water. As for the Instituto Costarricense de Acueductos y Alcantarillados specifically, its Constitutive Law—Ley No. 2726 of 14 April 1961, as amended—provides as follows:
“Article 1.- For the purpose of directing and setting policy, establishing and applying rules, carrying out and promoting planning, financing, and development, and resolving all matters relating to the supply of drinking water and the collection and conveyance of sewage and liquid industrial waste, as well as regulatory matters concerning storm sewer systems in urban areas, throughout the national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby established as an autonomous State institution.” To the extent that it concerns that institution, pursuant to Article 2° of that same body of rules, (…) “To direct and oversee all matters related to providing the inhabitants of the Republic with drinking-water service, collection and conveyance of sewage and liquid industrial waste, and stormwater in urban areas (…)”. With regard to the Municipalities, Article 169 of the Political Constitution grants them authority to plan and oversee urban development in their locality, as an extension of their duty to administer local interests and services in each canton.
Accordingly, each municipality must establish an integrated urban-planning policy that ensures development is consistent with the efficient operation of a system for supplying drinking water and collecting, treating, and finally disposing of sewage. Likewise, the General Health Law—Law No. 5395 of 30 October 1973—provides in Article 2° that the Executive Branch, through the Ministry of Health, is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as carrying out the activities assigned to it by law. Article 341 of that law also includes among the Ministry of Health’s powers the authority to order and take the special measures authorized by that law to prevent risks to or harm to people’s health, or their spread or worsening, and to prevent individuals from continuing or repeating an infraction.
On the specific subject, Book 1, Title 3, Chapter 3 of the General Health Law, “On the obligations and restrictions governing the sanitary disposal of excreta and wastewater,” provides, to the relevant extent, as follows:
“Article 285.—Excreta, sewage, wastewater, and stormwater must be disposed of adequately and in a sanitary manner to prevent contamination of the soil and natural water sources used for human consumption, the formation of vector and disease breeding grounds, and air pollution through conditions that compromise its purity or quality.” (Emphasis not in the original.)
“Article 287.—Every natural or legal person who owns dwellings, establishments, or buildings where people carry out their activities shall be responsible for ensuring that such property has an excreta and sewage and wastewater disposal system approved by the Ministry. Users of dwellings, establishments, or buildings shall be required to keep that system in good working order.” “Article 288.—Every owner is required to connect the system for disposing of excreta, sewage, and wastewater on their property to the sanitary sewer system in places where it is operational, except in cases that the applicable regulations recognize as warranted exceptions.” It also follows from those rules that Ministry of Health authorities are required to ensure the application of and compliance with that law and its regulations, without prejudice to the powers and duties that special laws confer on or impose on other public bodies or entities within their respective areas of action (Article 337).
This confirms the distinct functions and duties imposed by the legal system on the Instituto Costarricense de Acueductos y Alcantarillados, the Ministry of Health, and the municipalities regarding the collection, treatment, and final disposal of sewage. Those functions and duties must also be carried out in a coordinated manner, as noted in the preceding reason, to ensure administrative effectiveness and efficiency (judgment No. 2020-002412, at 09:30 on 7 February 2020).
VI.The specific case. In the case under review, the applicant alleges that wastewater from other dwellings is affecting his property in the Pueblo Escondido neighborhood in Los Filtros, Alajuelita. He states that he timely reported the situation to the Municipalidad de Alajuelita, after which municipal engineers conducted several inspections and confirmed the following: the existence of the problem; the need to correct the wastewater management; the existence of a health risk; and the local government’s commitment to intervene. He further asserts that he was informed that funds had already been approved and allocated to install new piping to resolve the problem. He nevertheless complains that, despite the time elapsed and multiple technical visits, the municipality has not carried out the promised works. He asks that the Municipalidad de Alajuelita be ordered to take the necessary measures immediately to correct the wastewater problem.
Although the applicant’s complaint is against the aforementioned municipality, the record shows that he reported the wastewater problem to the Alajuelita Health Area of the Ministry of Health on 21 January 2026. Specifically, he alleged purported seepage/discharges of dirty water from a neighboring property, associating the situation with foul odors, possible structural damage to his home, and a health risk. Accordingly, staff of that health authority inspected the site on 08 April, where they were met by the applicant himself and his daughter, Nombre01. The report states that he told them the reported problem had been resolved, and no seepage of the kind initially alleged was observed. On that basis, since there was no evidence warranting the issuance of health measures or additional follow-up actions, the file was closed and archived. The absence of a problem was confirmed by technical operations staff of the ICAA Development and Research Unit, who inspected the site on 05 May 2026 and found no wastewater discharges into the stormwater drain (which is piped in many places); the drain itself was dry during the site visit.
It is therefore established that the problem affecting the applicant and underlying this amparo had been resolved before this application was served on the Ministry of Health. This means that the complaint was favorably resolved without the intervention of this Chamber.
It was also established that on 28 April 2026, in connection with the amparo application, staff of the Alajuelita Health Area spoke by telephone with the applicant to provide guidance and clarify the scope of this constitutional proceeding. During that call, he expressly stated that complaint D-012-2026 and the amparo application concerned different situations: the health complaint concerned seepage caused by a neighbor, which had already been resolved. He also stated that the amparo application concerned the lack of stormwater drainage in the area, a matter he characterized as municipal because it involved infrastructure on a public road and because, according to him, the municipality had not used the funds for its installation. That is an erroneous assessment, since the only issue complained of in this matter is the alleged continuing contamination by wastewater, as the foregoing makes clear.
In light of these considerations, the alleged inaction of the respondent authorities in response to the specific problem asserted by the applicant in this matter is not established.
VII.Conclusion. Consequently, since the alleged violation of the applicant’s fundamental rights by the respondent authorities was not proven—the Ministry of Health addressed the reported problem in a timely manner, while the ICAA and the respondent municipality bear no responsibility for the matter complained of—the appropriate course is to dismiss the application.
VIII.Note by Justice Castillo Víquez concerning prompt and duly administered justice in administrative proceedings. I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and duly administered justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts, not by this Chamber. However, with the recent enactment of Law No. 9097, Law Regulating the Right to Petition, that right has been made subject to judicial protection through the amparo proceeding established by Article 32 of the Constitutional Jurisdiction Law, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of case law, since under Article 7 of its Law, this Court alone is responsible for defining its own jurisdiction.
Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases properly heard in this jurisdiction through the constitutional amparo proceeding, the competent judges in other cases are the judges of the administrative-litigation jurisdiction, for the reasons given by this Court (judgment No. 2008-002545, at 08:55 on 22 February 2008). This is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal rules, based on a logical, systemic, and teleological interpretation of the legal system.
In environmental matters, it is my view that when the Public Administration has already intervened, the matter falls within the jurisdiction of the administrative-litigation courts. Nevertheless, I do address the merits when other rights of the people affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free of contamination (Article 50 of the Political Constitution), as in this case. The applicant states that for more than three years, wastewater from multiple dwellings located uphill from his property has flowed down and passed in front of his only home, located in the Pueblo Escondido neighborhood in Los Filtros, Alajuelita. He states that this water seeps beneath the front of his property, causing the ground to sink progressively and affecting the structural stability of his home. He adds that the wastewater is even penetrating beneath the house’s structures, posing a serious risk to the integrity of the property and to the personal safety of him and his family. He explains that he has filed the relevant complaints, but the situation has not been resolved.
X.Documents submitted to the case file. The parties are advised that if they submitted any paper document, or objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the office within a maximum period of thirty business days from service of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, as provided in the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.
Therefore:
The application is dismissed. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-004831-0007-CO, interpuesto por Nombre02, adulta mayor, cédula de identidad CED01, contra la Municipalidad de Alajuelita, el Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados.
Resultando:
“PRIMERO: En atención a los hechos expuestos por el recurrente, se informa respetuosamente que la situación denunciada ha sido objeto de análisis por parte de las instancias técnicas de la Municipalidad de Alajuelita, particularmente por la Unidad Técnica de Gestión Vial, la cual realizó visitas de inspección al sitio y emitió el correspondiente criterio técnico. De dichas actuaciones se desprende que el caso ha sido atendido mediante las gestiones administrativas correspondientes, encontrándose actualmente en proceso de valoración técnica por parte de la Junta Vial Cantonal, órgano competente para conocer y adoptar decisiones relacionadas con la red vial cantonal.
SEGUNDO: En ese sentido, según el informe técnico emitido por el Arq. Michael Barboza Arroyo, adjunto a este libelo, se determinó que la vía donde se ubica el sector señalado por el recurrente se encuentra registrada en el Inventario de la Red Vial Cantonal con la clasificación NCU (No Clasificada en Uso), circunstancia que implica, conforme a la normativa aplicable en materia de administración de la red vial cantonal y utilización de recursos públicos, que no resulta legalmente procedente realizar inversiones de fondos públicos para su intervención mientras dicha condición se mantenga.
La Red Vial Cantonal con clasificación "No Clasificada en Uso" (NCU)” corresponde a caminos públicos, senderos, veredas o trillos, frecuentemente angostos y no aptos para tránsito vehicular, que sirven a pocos usuarios. Su mantenimiento es responsabilidad de beneficiarios directos y no reciben fondos de la Ley 8114.
Es importante mencionar algunos aspectos claves según la Ley 8114 sobre los Caminos NCU: “Son vías públicas que no encajan en las categorías funcionales principales (primarias, secundarias, terciarias), cuyo uso es principalmente peatonal, bicicletas, bestias o caminos de acceso limitados. Deben estar registrados en el "Registro Vial" de la Dirección de Planificación Sectorial del MOPT y para cambiar de NCU a otra categoría, deben cumplir con los anchos de vía reglamentarios de la Ley 5060 y los requisitos técnicos del MOPT”.
TERCERO: Adicionalmente, del análisis técnico efectuado en sitio se constató la existencia de diversos factores que inciden en la problemática expuesta por el recurrente, entre ellos la presencia de descargas de aguas que no corresponden únicamente a aguas pluviales, sino también a aguas servidas provenientes de propiedades ubicadas en el sector, las cuales se estarían vertiendo al sistema de drenaje pluvial existente.
Sobre este particular, resulta necesario señalar que el control, fiscalización y regulación del vertido de aguas residuales o aguas servidas no constituye una competencia propia de los gobiernos locales, sino que corresponde al Ministerio de Salud, en su condición de autoridad sanitaria competente, conforme a lo establecido en la Ley General de Salud No. 5395, así como en el Reglamento de Vertido y Reúso de Aguas Residuales (Decreto Ejecutivo No. 33601) y demás normativa sanitaria aplicable. Dichas disposiciones establecen expresamente la prohibición de descargar aguas servidas en sistemas de drenaje pluvial, así como la facultad de la autoridad sanitaria para ordenar las medidas correctivas correspondientes cuando se detecten este tipo de situaciones.
CUARTO: Valga indicar que, el municipio reconoce que la salud pública se debe ver como un tema integral porque debe dar cobertura a todas las dimensiones prioritarias para la vida de toda persona. Sin embargo, en el caso que nos ocupa, nos damos cuenta que este asunto no es responsabilidad municipal sino de los dueños de las propiedades, por una parte, del Ministerio de Salud y del Instituto Costarricense de acueductos y alcantarillados por otro. Por su parte, la Ley General de Salud establece la obligación, al dueño de la propiedad, para lograr la adecuada disposición de las aguas en general, así como la correspondiente competencia del Ministerio de Salud para verificar la oportunidad de la forma en que se cumpla tal obligación:
ARTICULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.
La Ley General de Salud establece las obligaciones básicas de los propietarios de inmuebles, con edificaciones o sin ellas y los entes competentes para ejercer el control de los sistemas de alcantarillado. En tal sentido, señala la obligación que tienen los propietarios de predios de realizar las obras de drenaje que las autoridades de salud les indiquen, así como la obligación de los propietarios de edificaciones de dotar a sus edificios de sistemas de disposición de excretas y de aguas negras y servidas, cuya aprobación corresponde al Ministerio.
Lo dicho lo establecen los artículos 286 y 287 de la citada Ley, los cuales disponen:
ARTICULO 286.- Toda persona natural o jurídica está obligada a realizar las obras de drenaje que la autoridad de salud ordene a fin de precaver la formación de focos insalubres y de infección, o de sanear los que hubiere en predios de su propiedad.
Si el propietario fuere renuente en el cumplimiento de tales órdenes, la autoridad de salud podrá hacerlos a costa del omiso.
En los casos en que el interés público, la naturaleza y envergadura de las obras de drenaje lo justificare, todo propietario de inmueble está obligado a constituir servidumbre en favor del Estado para que la autoridad de salud construya, tales obras pudiendo decretarse la expropiación del terreno cuando la servidumbre fuere incompatible con su utilización.
El mantenimiento y operación, si procedieren, estará a cargo de los beneficiarios de tales obras.
ARTICULO 287.- Toda persona natural o jurídica propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.
Así, la Ley General de Salud impone a los propietarios la obligación de conectarse al mismo y establece, además, que el control técnico de tales sistemas lo ejerce el Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados.
Así lo establece el numeral 288 de la Ley General de Salud, el cual dispone:
ARTICULO 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.
La citada Ley otorga competencias al Ministerio de Salud, para ordenar a los propietarios la realización de las obras necesarias para tales efectos y sujeta el control técnico de los sistemas de alcantarillado a dicho Ministerio y al Instituto Costarricense de Acueductos y Alcantarillados.
Según el artículo 292 de la Ley General de Salud No. 5395 de 1973 prohíbe la descarga de las aguas negras, aguas servidas y residuos industriales al alcantarillado pluvial e indica:
ARTICULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio que da facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas.
QUINTO: En consecuencia, tratándose de un eventual vertido irregular de aguas residuales provenientes de propiedades privadas, corresponde al Ministerio de Salud realizar las investigaciones, fiscalizaciones y eventuales órdenes sanitarias que resulten procedentes, con el fin de corregir dichas descargas y evitar afectaciones a la salud pública y al ambiente.
De igual forma, el informe técnico municipal advierte que antes de que la Unidad Técnica de Gestión Vial pueda valorar cualquier tipo de intervención relacionada con la infraestructura vial o el sistema de drenaje existente, resulta indispensable que la problemática relativa al vertido de aguas servidas sea previamente corregida por las autoridades competentes, toda vez que la presencia de descargas sanitarias en un sistema diseñado para aguas pluviales impide técnicamente cualquier intervención efectiva por parte de la administración municipal.
PETITORIA.
En virtud de lo anterior, esta Municipalidad ha realizado las actuaciones que se encuentran dentro del ámbito de sus competencias legales, remitiendo el asunto para su análisis técnico y manteniendo el caso en conocimiento de las instancias correspondientes. No obstante, es importante precisar que la solución integral del problema descrito por el recurrente involucra materias que exceden las competencias municipales, particularmente en lo relativo al control sanitario del vertido de aguas residuales, aspecto que corresponde a la autoridad sanitaria nacional.
Por lo expuesto, se evidencia que la Municipalidad de Alajuelita no ha incurrido en omisión alguna dentro del ámbito de sus competencias, habiendo atendido la situación mediante inspecciones técnicas y el correspondiente análisis administrativo, sin perjuicio de que otras instituciones competentes deban intervenir en el marco de sus respectivas atribuciones legales. Consecuentemente, al no verificarse vulneración alguna a derechos fundamentales imputables a este municipio, respetuosamente se solicita a ese Honorable Tribunal que declare sin lugar en todos sus extremos el Recurso de Amparo interpuesto por el recurrente Nombre02”.
“La presente respuesta se fundamenta en las actuaciones administrativas y técnicas incorporadas al expediente sanitario D-012-2026 tramitado ante esta Área Rectora.
Conforme consta en el expediente D-012-2026, el día 21 de enero de 2026 se recibió denuncia del señor Nombre02, en la que indicó presuntas filtraciones/descargas de aguas sucias provenientes de una propiedad vecina, asociando dicha situación con malos olores, posible afectación estructural de su vivienda y riesgo sanitario.
En atención a esa gestión, y de conformidad con las disposiciones del numeral 32 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites que establece respeto a la orden de presentación de los trámites de la misma naturaleza de acuerdo con la fecha de ingreso, esta Autoridad Sanitaria programó y realizó inspección en fecha 08 de abril de 2026, tal como se desprende de la documentación de citación y del acta de inspección respectiva consecutivo A-117-2026, incorporada al expediente.
Durante dicha verificación in situ de fecha 08 de abril de 2026, efectuada previo a la notificación del recurso de amparo que nos ocupa, fuimos atendidos por el propio Sr. denunciante y su hija Nombre01, quien rubrica el acta de inspección A-117-2026, donde se deja constancia de la manifestación de que el problema denunciado se encontraba solucionado, no observándose la filtración inicialmente denunciada.
Ese mismo resultado consta a folios CED02 000011 del expediente administrativo, Informe Técnico IT-MS-DRRSCS-ARSAL-0088-2026, el cual concluye que en la inspección realizada no se constató filtración y que el denunciante indicó el cese de la problemática originalmente denunciada.
Con base en lo anterior, al no existir evidencia que ameritara la emisión de medidas sanitarias ni acciones adicionales de seguimiento, mediante oficio MS-DRRSCS-ARSAL-CD-0040- 2026 de fecha 28 de abril de 2026, esta Dirección dispuso el cierre y archivo del expediente D-012-2026, notificado al denunciante el día 29 de abril de 2026.
Adicionalmente, con ocasión del recurso de amparo y con el afán de no desatender los derechos constitucionales del amparado, consta en el expediente a folio 000016 acta de llamada telefónica realizada el 28 de abril de 2026 al señor Nombre02, con el propósito de orientar y precisar el alcance del recurso. En dicha comunicación, el recurrente indicó expresamente que la denuncia D-012-2026 y el recurso de amparo corresponden a situaciones distintas; señaló que la denuncia sanitaria se refería a filtraciones generadas por un vecino y que ello ya se encontraba solucionado. Asimismo, manifestó que el recurso de amparo obedece a la falta de alcantarillado pluvial en la zona, aspecto que calificó como de índole municipal por tratarse de infraestructura en vía pública y porque, según su dicho, la Municipalidad no ha ejecutado los recursos para su instalación.
Por lo expuesto, se informa respetuosamente que, en lo que compete al Ministerio de Salud, la gestión formal tramitada ante esta Área Rectora por el recurrente es el expediente D-012-2026, el cual fue atendido mediante inspección y verificación, determinándose la inexistencia del hallazgo al momento de la visita y procediéndose al cierre administrativo del caso. En cuanto al extremo que el propio recurrente identifica como motivo del amparo (instalación de alcantarillado pluvial en vía pública), esta autoridad sanitaria no ejecuta obras de infraestructura pluvial ni administra recursos municipales para tales fines, sin perjuicio de las competencias de fiscalización sanitaria cuando se acrediten vertidos irregulares o riesgos efectivos a la salud pública debidamente constatados.
Se adjunta a este informe, copia certificada, debidamente identificada, foliada con numeración del 00001 al 000017, y en estricto orden cronológico, de la documentación del expediente D-012-2026: citación/boleta de inspección, acta de inspección, informe técnico, oficio de cierre y acta de llamada telefónica.
Por lo anterior, se solicita respetuosamente que se tenga por cumplida la audiencia conferida a esta Dirección y por incorporada la prueba remitida. Se pide además que se valore que, en el marco de competencias del Ministerio de Salud, la denuncia que originó actuación sanitaria (D-012-2026) ya fue atendida y cerrada tras inspección sin hallazgos, por lo que no existe omisión atribuible a esta Autoridad Sanitaria.
En cuanto a los reclamos vinculados con obras de alcantarillado pluvial u otra infraestructura en vía pública, se reitera que se trata de un aspecto propio de la gestión municipal, según lo manifestado por el recurrente, por lo que se solicita que esta Sala delimite el ámbito de responsabilidad de este Ministerio a lo efectivamente actuado y acreditado en el expediente sanitario”.
“RESPUESTA DEL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Mediante estudio técnico No. DRyT-DSRT-2026-00056 de fecha 05 de mayo de 2026, el Ingeniero Juan Pablo Vargas Brenes, funcionario de la UEN Recolección y Tratamiento GAM del AyA, emitió el criterio técnico del caso e informa lo siguiente:
Que habiéndose dado lectura al escrito de interposición suscrito por el recurrente ante la Municipalidad de Alajuelita, con relación al hundimiento progresivo de su terreno (generado por la aparente infiltración de aguas residuales provenientes de viviendas ubicadas hacia la parte alta de la calle denominada como Dirección01) se considera que la situación expuesta se encuentra mayoritariamente asociada con un tema de manejo de las aguas pluviales de escorrentía superficial a lo largo del sistema de recolección pluvial y no tanto al aparente trasiego de aguas residuales sobre dicho sistema.
Que, en la inspección realizada al sitio por parte del personal técnico operativo de la Unidad de Desarrollo e Investigación de AyA, realizada el día 5 de mayo de los corrientes, no se evidenció descargas de aguas residuales hacia el caño pluvial (en muchas partes entubado), encontrándose este mismo en condición seca en el transcurso de la visita al sitio. (Ref: Fotografías N°1 y N°2) Que, de conformidad con lo observado en el sitio, a lo largo del frente de la vivienda del recurrente pasa un encauzamiento pluvial o caño a través del cual discurren en momentos de lluvia las aguas provenientes de la escorrentía superficial de la calle, siendo que, en ese sector, el encauzamiento pluvial esta únicamente conformado por una zanja hecha hacia el costado de la calle, sin que medie ningún tipo de obra civil de canalización pluvial. (Ref: Fotografía N°3) Que en apego al punto anterior, la problemática expuesta por el recurrente con respecto al aparente hundimiento de su propiedad se encuentra mayormente relacionado con la el efecto erosivo que en momentos de lluvia se puede llegar a generar justo en la colindancia del terreno del recurrente, con la zanja por la que discurren las aguas de lluvia, mismas que podrían tener el suficiente potencial erosivo como para que se pueda llegar a dar algún tipo de afectación sobre la propiedad en referencia.
Que pese a que no se evidenció flujo de aguas residuales hacia el encauzamiento pluvial, se considera que aun existiendo el mismo, el caudal asociado de éste sería considerablemente menor a los caudales generados por eventos de lluvia, con lo cual se estima que, aún bajo el escenario en que tales caudales discurrieran por el encauzamiento, su efecto sobre lo que el recurrente alega sería mínimo en comparación con el efecto causado por la escorrentía de aguas pluviales en momento de lluvias intensas en el sector.
Que, bajo este orden de ideas, EL GOBIERNO LOCAL TIENE DENTRO DE SUS POTESTADES LA ADMINISTRACIÓN, MANTENIMIENTO Y DESARROLLO DE OBRAS CIVILES COMPLEMENTARIAS AL SISTEMA DE ALCANTARILLADO PLUVIAL DESTINADO PARA LA EVACUACIÓN DE AGUAS DE LLUVIA, SIENDO QUE, EL AYA POR SU PARTE, NO TIENE INJERENCIA SOBRE ESTE TIPO DE INFRAESTRUCTURA DE ÍNDOLE PLUVIAL.
Que en complemento a lo señalado en los puntos anteriores, en el sector donde se ubica la situación descrita por el recurrente, el AyA no cuenta con ningún tipo de infraestructura civil para la recolección de aguas residuales (aguas servidas y aguas “negras”) por lo cual cada vivienda construida en el sector, está obligada a disponer sus aguas residuales domiciliares por medios individuales a través de tanque séptico y drenajes en lugar de disponerlas hacia sistemas pluviales que no están diseñados para transporte aguas que no sean las generadas durante eventos de lluvia.
Lo anterior se sustenta en el artículo 286 de la Ley General de Salud; Ley No. 5395, en el que se indica expresamente que el Ministerio de Salud tiene la potestad de ordenar la realización de las obras de drenaje mediante las cuales se evite la formación de focos insalubres y de infección; así como también en los artículos 287 y 288 de esta misma ley, en los cuales se señala la responsabilidad de cada propietario de vivienda o comercio a contar con un sistema de disposición para sus propias aguas residuales en aquellos lugares en donde no se cuente con el sistema de alcantarillado sanitario en funcionamiento.
Art 286 “Toda persona, natural o jurídica, está obligada a realizar las obras de drenaje que la autoridad de salud ordene a fin de precaver la formación de focos insalubres y de infección, o de sanear los que hubiere en predios de su propiedad.” Art. 287 y Art 288 “Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” Que de acuerdo a la definición de aguas residuales, toda agua que haya recibido un uso humano por el cual haya cambiado su composición, se considera agua residuales, siendo por ello que tanto las aguas con contenidos fecales orgánicos como las jabonosas inorgánicas deben de ser dispuestas por medio de tanques sépticos y drenajes en todos aquellos sectores en los que no se cuente con alcantarillado sanitario en operación (tal y como aplica para el caso en referencia) por lo que, en caso de que se dieran este tipo de vertidos hacia sistemas de recolección para aguas de lluvia (alcantarillado pluvial) esto correspondería a un acto contrario a la ley, EL CUAL DEBE DE SER GESTIONADO Y CORREGIDO POR EL MINISTERIO DE SALUD Y POR EL RESPECTIVO GOBIERNO LOCAL. II.

Descripción: Se observa un tragante pluvial frente a la propiedad del recurrente, sin presencia de aguas residuales al menos durante el tiempo en el que se realizó la inspección Fotografía N°3 (…)
Descripción: Se observa el frente de la propiedad del recurrente, el cual colinda con el encauzamiento pluvial carente de obras civiles apropiadas para el adecuado trasiego de las aguas pluviales o de Lluvia. I. SOBRE EL FONDO DEL ASUNTO La Municipalidad de Alajuelita DEBE tomar las medidas que le corresponden con respecto al tema de la presencia de aguas residuales provenientes de la red pluvial. Lo anterior, coordinación con el Ministerio de Salud, como instituciones encargadas de velar por el adecuado vertido de las aguas residuales, a la luz tanto del Decreto Ejecutivo No. 31545- S- MINAE como la Ley General de Salud.
La responsabilidad en el caso bajo estudio es estrictamente de la Municipalidad. Y en este punto, no omitimos manifestar que -mediante VOTO No. 2013-007598- esa Honorable Sala Constitucional ha señalado claramente la obligación de los gobiernos locales de velar por los intereses de sus munícipes.
Les corresponde una labor activa de planificación con los demás entes involucrados a fin de tutelar los intereses y derechos fundamentales de sus comunidades y realizar todo lo que esté a su alcance para brindar de manera responsable los servicios bajo su égida.
El riesgo a la salud y, a la vida de las personas es un problema del cual la Municipalidad es responsable y, por ende; debe buscar una solución eficaz.
Además, es deber del Ministerio de Salud de velar por el correcto desecho de los residuos contaminantes mencionados es un elemento de responsabilidad, seguridad jurídica y en especial sobre el cuidado de la salud pública, ACCIONES QUE NO SE ESTÁN REALIZANDO DE NINGUNA MANERA, lo cual, genera una violación al derecho de salud y de un ambiente sano y ecológicamente equilibrado.
PETITORIA Con fundamento en las razones de hecho y de derecho señaladas, dejo rendido el informe solicitado. Expresamente señalo, a efectos de que tome en cuenta ese Despacho, las actuaciones del INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS en cumplimiento de sus fines, siendo que de forma evidente no ha desobedecido, violentado normas, garantías o principios constitucionales, ni ambientales, sino que siempre ha tenido una conducta responsable en resguardo y protección al derecho al ambiente, a la salud y a la vida, por lo que debe declararse SIN LUGAR el recurso en todos sus extremos en contra de mi representada; y de esa forma lo solicito.
DERECHO Se rinde el presente informe de conformidad con los artículos 21 y 50 de la Constitución Política, el artículo 43 siguientes y concordantes de la Ley de la Jurisdicción Constitucional, artículos 113 siguientes y concordantes de la Ley General de la Administración Pública, y artículos 1 y 2 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados (Ley No. 2726)”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Sobre el conocimiento de este caso por lesión al artículo 41 de la Constitución Política. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia No. 2008-002545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción,
pues se acusa la persistencia de una situación denunciada que se relaciona con contaminación ambiental que podrían afectar la salud del recurrente y de su familia. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.
II.Objeto del recurso. El recurrente alega que, desde hace más de tres años, las aguas residuales provenientes de múltiples viviendas ubicadas en la parte superior de su propiedad descienden y pasan frente a su única casa de habitación ubicada en el barrio Pueblo Escondido en Los Filtros de Alajuelita. Indica que, esas aguas se filtran por debajo del frente de su propiedad, provocando el hundimiento progresivo del terreno y afectando la estabilidad estructural de su vivienda. Añade que el agua residual incluso está penetrando por debajo de las estructuras de la casa, lo que representa un grave riesgo para la integridad del inmueble y para su seguridad personal y de su familia. Señala que esa situación constituye, además, un evidente problema de salud pública, debido a la exposición constante a aguas contaminadas. Manifiesta que la situación fue denunciada oportunamente ante la Municipalidad de Alajuelita, por lo que ingenieros municipales realizaron varias inspecciones y confirmaron lo siguiente: -La existencia del problema. -La necesidad de corregir el manejo de las aguas residuales. -La existencia de un riesgo sanitario y -El compromiso de intervención por parte del gobierno local.
Incluso, asegura que se le informó que ya se habían aprobado y destinado recursos para la instalación de nueva tubería para solucionar el problema. Sin embargo, reclama que a pesar del tiempo transcurrido y de múltiples visitas técnicas, la municipalidad no ha ejecutado las obras prometidas. Sostiene que, por el contrario, el problema se ha agravado y actualmente ha omitido toda acción efectiva, ignorando lo previamente acordado.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre el principio de justicia pronta y cumplida. La Administración, a la luz del artículo 41 constitucional, tiene la obligación de garantizarle a la ciudadanía el cumplimiento de la justicia pronta y cumplida, sin denegación, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicarles a los interesados lo dispuesto, todo ello dentro de un plazo razonable. En este sentido, el carácter "razonable" de la duración de la actividad administrativa se determina casuísticamente con base en diversos elementos, tales como la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación producida por el acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos de la Administración.
V.Sobre la recolección, tratamiento y disposición final de las aguas negras. Para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado, entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas negras. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al Instituto Costarricense de Acueductos y Alcantarillados, como a las Municipalidades y al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Así, en el caso específico del Instituto Costarricense de Acueductos y Alcantarillados, su propia Ley Constitutiva -Ley No. 2726 de 14 de abril de 1961 y sus reformas-, dispone lo siguiente:
“Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que a dicha institución le corresponde, conforme a lo dispuesto en el artículo 2° de ese mismo cuerpo normativo (…) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas (…)”. En lo referente a las Municipalidades, debe indicarse que el artículo 169 de la Constitución Política le otorga a éstas la competencia para planificar y vigilar el desarrollo urbano de su localidad, como derivación de su deber de administrar los intereses y servicios locales en cada cantón.
En razón de lo anterior, corresponde a cada municipio establecer una política integral de planteamiento urbano, que garantice un desarrollo en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas negras. De igual forma, la Ley General de Salud -Ley No. 5395 de 30 de octubre de 1973-, dispone, en su artículo 2°, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley. Igualmente, el artículo 341 de la referida ley establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares.
En cuanto al tema específico, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, “ De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas”, dispone -en lo conducente-, lo siguiente:
“Artículo 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” (El destacado no forma parte del original).
“Artículo 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros órganos o entes públicos dentro de sus respectivos campos de acción (artículo 337).
Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al Instituto Costarricense de Acueductos y Alcantarillados, al Ministerio de Salud y a las municipalidades, en materia de recolección, tratamiento y disposición final de las aguas negras. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficacia y eficiencia administrativas (sentencia No. 2020-002412 de las 09:30 horas del 07 de febrero de 2020).
VI.Sobre el caso concreto. En el sub examine, el recurrente acusa que aguas residuales provenientes de otras viviendas afectan su propiedad en el barrio Pueblo Escondido en Los Filtros de Alajuelita. Indica que la situación fue denunciada oportunamente ante la Municipalidad de Alajuelita, por lo que ingenieros municipales realizaron varias inspecciones y confirmaron lo siguiente: -La existencia del problema. -La necesidad de corregir el manejo de las aguas residuales. -La existencia de un riesgo sanitario y -El compromiso de intervención por parte del gobierno local. Incluso, asegura que se le informó que ya se habían aprobado y destinado recursos para la instalación de nueva tubería para solucionar el problema. Sin embargo, reclama que a pesar del tiempo transcurrido y de múltiples visitas técnicas, la municipalidad no ha ejecutado las obras prometidas. Solicita que se ordene a la Municipalidad de Alajuelita adoptar de manera inmediata las medidas necesarias para corregir el problema de las aguas residuales.
Si bien el reclamo del recurrente es contra el citado ayuntamiento, se constata que esa problemática con las aguas residuales la denunció ante el Área Rectora de Salud de Alajuelita del Ministerio de Salud el 21 de enero de 2026. En concreto, acusó presuntas filtraciones/descargas de aguas sucias provenientes de una propiedad vecina, asociando dicha situación con malos olores, posible afectación estructural de su vivienda y riesgo sanitario. De ahí que personal de esa autoridad sanitaria realizó el pasado el 08 de abril una inspección en el lugar, donde fueron atendidos por el propio recurrente y su hija Nombre01. Se informa que les manifestó que el problema denunciado se encontraba solucionado, no observándose la filtración inicialmente acusada. Con base en lo anterior, al no existir evidencia que ameritara la emisión de medidas sanitarias ni acciones adicionales de seguimiento, se dispuso el cierre y archivo del expediente.
Esa inexistencia de problemática la corroboró el personal técnico operativo de la Unidad de Desarrollo e Investigación del ICAA, pues el 05 de mayo de 2026 realizó una inspección en el sitio y no evidenció descargas de aguas residuales hacia el caño pluvial (en muchas partes entubado), encontrándose este mismo en condición seca en el transcurso de la visita al sitio. Por consiguiente, se constata así que el problema que aquejaba al recurrente y que sustentó este amparo, fue resuelto desde antes que se le notificara de este recurso al Ministerio de Salud. Lo anterior significa que, sin la intervención de esta Sala, fue superado favorablemente lo acusado.
Igualmente quedó acreditado que el 28 de abril de 2026, con ocasión del recurso de amparo, personal del Área Rectora de Salud de Alajuelita habló telefónica con el recurrente con el propósito de orientar y precisar el alcance de este proceso constitucional. En dicha comunicación, indicó expresamente que la denuncia D-012-2026 y el recurso de amparo corresponden a situaciones distintas, señaló que la denuncia sanitaria se refería a filtraciones generadas por un vecino y que ello ya se encontraba solucionado. Asimismo, manifestó que el recurso de amparo obedece a la falta de alcantarillado pluvial en la zona, aspecto que calificó como de índole municipal por tratarse de infraestructura en vía pública y porque, según su dicho, el ayuntamiento no ha ejecutado los recursos para su instalación. Se advierte que ello corresponde a una apreciación errónea, pues lo único reclamado en este asunto es la persistencia de la presunta contaminación por aguas residuales, como se desprende de lo antes reseñado.
En virtud de las consideraciones expuestas, se descarta la alegada inercia de las autoridades accionadas ante la problemática concreta aducida por el recurrente en este asunto.
VII.Conclusión. En consecuencia, como no se comprobó la alegada violación a los derechos fundamentales del recurrente por parte de las autoridades recurridas, pues el Ministerio de Salud atendió oportunamente la problemática acusada, entretanto el ICCA y el ayuntamiento accionado no han tenido responsabilidad alguna en lo acusado, lo procedente es ordenar la desestimación del recurso.
VIII.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia No. 2008-002545 de las 08:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que desde hace más de tres años, las aguas residuales provenientes de múltiples viviendas ubicadas en la parte superior de su propiedad descienden y pasan frente a su única casa de habitación ubicada en el barrio Pueblo Escondido en Los Filtros de Alajuelita. Indica que, esas aguas se filtran por debajo del frente de su propiedad, provocando el hundimiento progresivo del terreno y afectando la estabilidad estructural de su vivienda. Añade que el agua residual incluso está penetrando por debajo de las estructuras de la casa, lo que representa un grave riesgo para la integridad del inmueble y para su seguridad personal y de su familia. Explica, que ha presentado las denuncias respectivas, sin que se solucione la situación.
X.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. El magistrado Castillo Víquez suscribe nota. El magistrado Salazar Alvarado pone nota. Notifíquese.
