CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (Sala Constitucional). San José, at nine thirty on 6 August 2026.

Amparo application filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS).

Background:

  1. 1By a written submission received by the Chamber Secretariat on 15 July 2026, the applicant files an amparo application and states that approximately 3 months ago she received an excessive water charge for NIS 5277408. She states that she began the procedures by visiting the Guadalupe office of the Costa Rican Institute of Aqueducts and Sewers (ICAA); however, she received no response. She indicates that officials of the respondent institute subsequently made a visit, but did not reduce the charge. She relates that on 18 June 2026 she submitted a new request to ICAA, in which she sought the following: "that I be informed whether the NIS CED02 3415384 were new modifications or underwent any change in the nature of the service.” She requested a report on NIS 5277408, which increased sharply, and has not received a response to her request.
  2. 2By resolution issued at 14:54 on 15 July 2026, the present application was admitted for processing.
  3. 3Under oath, JOSE DARÍO GUZMÁN ÁLVAREZ, GENERAL MANAGER with powers as GENERAL ATTORNEY-IN-FACT WITHOUT LIMIT AS TO AMOUNT, RANDALL CAMPOS ROJAS, GAM SYSTEMS MANAGEMENT DEPUTY MANAGER, and CYNTHIA ORDOÑEZ ARROYO, HEAD OF THE GUADALUPE COMMERCIAL OFFICE (UEN Customer Service Zone IV GAM), all of the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS, report that, based on technical report memorandum No. UEN-SCC-GAM-2026-02956, prepared by Javier Jiménez Rivas of UEN-GAM Commercial Customer Service on 16 July 2026, the following was indicated: FIRST: In accordance with the records in AyA's Integrated Commercial System (SCI-OPEN) database, a search was conducted using service number NIS 5277408, specified in the filing, and it was determined that this service is registered in the name of Centro Comercial Sabanilla, at Dirección02, with the address: San José, Montes de Oca, Dirección04. The service is registered under the Metropolitan Residential Large Consumers tariff and has a total outstanding balance of ¢ 186,291.70 (see evidence 1, Memorandum No. UEN-SCC-GAM-2026-02956). - A Technical-Commercial-Legal review was conducted for this service concerning the claim about high consumption recorded from January to July 2026.Accordingly, to verify the service's consumption pattern, field inspections were carried out on 16 May 2026 and 27 May 2025, which recorded no leaks in the water-meter connections. On 16 July 2026, the inspection found that, with water in the area and everything shut off, the water meter registered a reading and a leak. For billing based on meter readings, an adjustment may be made only if there is a reading error or a cause attributable to the Institution. However, it should be noted that in each billing cycle from January to July 2026, which were verified through field inspections, ascending and consecutive readings were recorded, and no damage to the connection affecting the recorded consumption or reading errors were found. A correction to the disputed bill for May 2026 is not appropriate, since the Institution charges based on what the water meter records; for bills based on meter readings, an adjustment may be made only if there is a reading error or a cause attributable to the Institution.In view of the article cited above, it is not appropriate to adjust the bills under review, because they do not meet the requirements established for this purpose, and particularly because the service currently has the large residential consumers tariff and, as may be inferred from the regulation, adjustments are not permitted for this tariff group. The increase in the bills was presumably due to internal leaks, since the water meter was inspected under service order 54935363 on 16 July 2026, in the presence of Nombre01, and this situation was found. It should be noted that it is important for the systems and installations within the property to be kept in good working order. No tariff modification has been made due to changes in the nature of the service's use. What the applicant may request is renewal of a payment arrangement for the outstanding bills. If the payment arrangement is current, it may be renewed to include new bills or vary the initial conditions, in accordance with the provisions of Article 118 of the Regulation for the Provision of AyA Services.For this purpose, she must apply through the channels currently available or at any of our service points. This is to avoid suspension of service or the initiation of judicial collection proceedings, as well as any inconvenience this could cause her. As for service NIS 3415384, specified in the filing, a search was conducted in the records contained in AyA's Integrated Commercial System (SCI-OPEN) database, and it is registered in the name of Nombre01, at PRN01, with the address: Dirección01. The service is registered under the Metropolitan Residential Large Consumers tariff and has a total outstanding balance of ¢ 28,788.00. A Technical-Commercial-Legal review was also conducted for NIS 3415384 concerning the claim about high consumption recorded from January to July 2026. This was done to verify the service's consumption pattern. In the inspection performed, no evidence of leaks was found in the water meter or the service connections, and it was confirmed that the reading had been taken correctly, demonstrating that each and every water-meter reading corresponded to the customer's actual consumption.However, based on Article 97 cited above and work instruction code COM-73-01-I2, a billing error resulting from replacement of the water meter in May 2026 was corrected; the bill was calculated based on actual consumption of 34 cubic meters, and that adjustment resulted in a credit note or reduction in the applicant's favor in the total amount of ¢21,973.92. This decision was notified on 15 June 2026 to email address ...01 and concerns the applicant's Claim CRM12429164. -
  4. 4The legal requirements have been observed in the proceedings conducted.

Drafted by Justice Cruz Castro; and, Reasons:

I. SUBJECT OF THE APPLICATION

The applicant states that approximately 3 months ago she received an excessive water charge for NIS 5277408. She states that she began the procedures by visiting the Guadalupe office of the Costa Rican Institute of Aqueducts and Sewers (ICAA); however, she received no response. She indicates that officials of the respondent institute subsequently made a visit, but did not reduce the charge. She relates that on 18 June 2026 she submitted a new request to ICAA, in which she sought the following: "that I be informed whether the NIS CED02 3415384 were new modifications or underwent any change in the nature of the service.” She requested a report on NIS 5277408, which increased sharply, and has not received a response to her request.

II. FACTS FOUND

The following facts, relevant to deciding this matter, are deemed duly established, either because they have been proven or because the respondent failed to address them, as required in the initial order:

1. On 18 June 2026, the applicant submitted a request to the respondent authority, seeking the following: "that I be informed whether the NIS CED02 3415384 were new modifications or underwent any change in the nature of the service.” (see electronic record).

2. In accordance with the records in AyA's Integrated Commercial System (SCI-OPEN) database, a search was conducted for service number NIS 5277408, and it was determined that it is registered in the name of Centro Comercial Sabanilla, at Dirección02, under the Metropolitan Residential Large Consumers tariff, with a total outstanding balance of ¢ 186,291.70 (see electronic record).

3. For the above service, the respondent authority conducted a Technical-Commercial-Legal review concerning the claim about high consumption recorded from January to July 2026. Field inspections were carried out on 16 May 2026 and 27 May 2025, which recorded no leaks in the water-meter connections. On 16 July 2026, the inspection found that, with water in the area and everything shut off, the water meter registered a reading and a leak (see electronic record).

4. Ascending and consecutive readings were recorded in the bills based on meter readings, and no damage to the connection affecting recorded consumption or reading errors were found. A correction to the disputed bill for May 2026 is not appropriate, since the Institution charges based on what the water meter records; for bills based on meter readings, an adjustment may be made only if there is a reading error or a cause attributable to the Institution (see electronic record).

5. The increase in the bills was presumably due to internal leaks, since the water meter was inspected under service order 54935363 on 16 July 2026, in the applicant's presence, and this situation was found (see electronic record).

6. Regarding service NIS 3415384, specified in the filing, a search was conducted in the records contained in AyA's Integrated Commercial System (SCI-OPEN) database, and it is registered in the applicant's name. The service is registered under the Metropolitan Residential Large Consumers tariff and has a total outstanding balance of ¢ 28,788.00. A Technical-Commercial-Legal review was also conducted for NIS 3415384 concerning the claim about high consumption recorded from January to July 2026. III. THE CASE AT HAND

It follows from the report submitted by the respondent authority under oath, with the legal consequences that this entails, that although the applicant submitted a request to the Costa Rican Institute of Aqueducts and Sewers on 18 June 2026 asking to be informed whether NIS No. CED02 3415384 had been subject to modifications or changes in the nature of the service, and also requesting a report regarding the increase in the NIS 5277408 bill, the respondent authority did not issue any response concerning the request in which she sought: "that I be informed whether the NIS CED02 3415384 were new modifications or underwent any change in the nature of the service.” The report submitted by the respondent authority shows that the request was indeed received on 18 June 2026 and was processed internally in relation to both service numbers. It is also on record that a technical-commercial review had been conducted concerning NIS 3415384 and that an adjustment to the bill had been made, a decision that was notified before the filing that gave rise to this application was submitted.

Likewise, as to NIS 5277408, various technical inspections and a review of the increase in recorded consumption were conducted. Although the respondent authority states that it took action concerning the services identified by the applicant, it has not shown that it expressly answered the specific request submitted on 18 June 2026 or communicated the information sought in that request. Accordingly, since it does not appear that the request submitted by the applicant on 18 June 2026 was answered in the manner required by law, this Chamber concludes that the applicant's fundamental right to petition and receive a prompt response was violated. Consequently, the application must be granted in this respect so that the respondent authority may issue and notify a response concerning the request as soon as possible. As for the dispute over the amounts billed for the public water service, the Chamber explains to the applicant that disputes over the amount of a drinking-water bill and other such bills must be raised through the ordinary administrative or judicial channels.

Accordingly, if she considers it appropriate, she may submit her objections or claims to the respondent institution, as she indicates she has done, or to the competent ordinary jurisdiction. In those forums she may fully argue the merits of the matter and assert her claims. Accordingly, the application is dismissed as to this issue.

IV. DOCUMENTS SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper documents, objects, or evidence contained in an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any such material not collected within this period will be destroyed, pursuant to the "Regulation on Electronic Case Files before the Judiciary," approved by the Full Court in Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is granted only with respect to the alleged violation of the right to petition. JOSE DARÍO GUZMÁN ÁLVAREZ, GENERAL MANAGER; RANDALL CAMPOS ROJAS, GAM SYSTEMS MANAGEMENT DEPUTY MANAGER; and CYNTHIA ORDOÑEZ ARROYO, HEAD OF THE GUADALUPE COMMERCIAL OFFICE (UEN Customer Service Zone IV GAM), all of the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS, or whoever holds those positions, are ordered to coordinate what is necessary, issue the pertinent orders, and carry out all actions within their authority so that, within a maximum period of TEN DAYS from notification of this ruling, a response is provided to the applicant concerning what she requested in the submission filed on 18 June 2026. This is ordered with the warning that, under Article 71 of the Law on Constitutional Jurisdiction, those who receive an order that they must comply with or enforce, issued in an amparo application, and who fail to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Costa Rican Institute of Aqueducts and Sewers is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in enforcement proceedings within the administrative-litigation jurisdiction. The application is dismissed in all other respects. Notify the parties.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 15 de julio de 2026, la recurrente interpone recurso de amparo y manifiesta que hace aproximadamente 3 meses le llegó un cobro excesivo de agua al NIS 5277408. Señala que inició los trámites visitando la oficina de Guadalupe del Instituto Costarricense de Acueductos y Alcantarillados (ICAA); sin embargo, no recibió respuesta. Indica que posteriormente funcionarios del instituto recurrido realizaron una visita, pero no le rebajaron el cobro. Relata que el 18 de junio de 2026 planteó una nueva gestión ante el ICAA, en la que solicitó lo siguiente: "se me informe, si los nises CED02 3415384, fueron modificaciones nuevas o sufrieron algún cambio en la naturaleza del servicio”. Solicitó un informe del NIS 5277408 qué subió fuertemente y no ha recibido respuesta a su gestión.
  2. 2Mediante resolución de las 14:54 horas del 15 de julio de 2026, se dio curso al presente recurso.
  3. 3Informa bajo juramento JOSE DARÍO GUZMÁN ÁLVAREZ, GERENTE GENERAL con facultades de APODERADO GENERALÍSIMO SIN LÍMITE DE SUMA, RANDALL CAMPOS ROJAS SUBGERENTE GESTIÓN SISTEMAS GAM y CYNTHIA ORDOÑEZ ARROYO, JEFE DE LA OFICINA COMERCIAL EN GUADALUPE (UEN Servicio al Cliente Zona IV GAM) todos del INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, que con fundamento en el informe técnico memorando No. UEN-SCC-GAM-2026-02956, del funcionario Javier Jiménez Rivas, de la UEN-Servicio al Cliente Comercial GAM, del 16 de julio del 2026, se indicó que: PRIMERO: De conformidad con los registros que constan en la base de datos del Sistema Comercial Integrado del AyA (SCI-OPEN), se realizó consulta por medio del número de servicio NIS 5277408, detallado en el escrito de interposición, y se determinó que este servicio se encuentra registrado a nombre de Centro Comercial Sabanilla, localización Dirección02, con dirección: San José, Montes de Oca, Dirección04.El servicio se encuentra registrado con tarifa Metropolitana Residencial Grandes Consumidores y tiene un pendiente total de ¢ 186,291.70 (Ver prueba 1 Memorando No. UEN-SCC-GAM-2026-02956). - Para ese servicio, se realizó estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de enero a julio 2026. Así las cosas, para verificar el patrón de consumo del servicio, se llevaron a cabo las revisiones de campo en fechas 16 de mayo de 2026, 27 de mayo de 2025, las cuales registraron que no hay fugas en las conexiones del hidrómetro. En fecha 16 de julio de 2026, la revisión dio como resultado: con agua en el sector y con todo cerrado el hidrómetro registra lectura y fuga. En la facturación leída, se puede aplicar modificación únicamente si existe error de lectura o causa atribuible a la Institución, No obstante, es necesario decir, que en cada ciclo de facturación de los periodos de enero a julio 2026, que fueron verificadas mediante inspecciones de campo, se registraron lecturas ascendentes y consecutivas y no se determinó que existieran daños en la conexión que afectara los consumos registrados, ni errores de lectura, no es procedente una rectificación a la facturación reclamada de mayo del 2026, ya que la forma de cobro que realizó la Institución es mediante lo que registre el hidrómetro, sobre facturación leída solamente se puede aplicar modificación únicamente si existiere un error de lectura o causa asignable a la institución.Tomando en cuenta el artículo supra citado, no es procedente aplicar ajuste a las facturas en estudio, debido a que las mismas no cumplen con los requerimientos establecidos para este fin y particularmente porque actualmente tiene tarifa grandes consumidores residenciales y como se infiere del reglamento, no se permite la aplicación de ajuste a este grupo tarifario. El motivo del incremento en las facturaciones sería presumiblemente de fugas internas, ya que se revisó el hidrómetro, según orden de servicio 54935363, del 16 de julio del 2026, en presencia de Nombre01 y se determinó esta situación. Cabe mencionar, la importancia que los sistemas e instalaciones dentro de la propiedad se mantengan en buenas condiciones de funcionamiento, actualmente no se ha presentado alguna modificación tarifaria por cambios en la naturaleza por el uso del servicio. Lo que sí puede solicitar la recurrente, es una renovación de arreglo de pago, sobre las facturas pendientes.Si el arreglo se encuentra al día en el pago de las cuotas, se podrá renovar incluyendo nuevas facturas o variando las condiciones iniciales, conforme a las disposiciones del Reglamento para la Prestación de los Servicios del AyA, artículo 118. Para estos efectos, deberá de solicitarlo por los medios actualmente habilitados o en cualquiera de nuestros puntos de atención. Esto para evitar el proceso de suspensión del servicio, o la apertura de un proceso de cobro judicial, así como los inconvenientes que esto le pudiera causar. Sobre el servicio NIS 3415384, detallado en el escrito de interposición, se procede a hacer estudio en los registros que constan en la base de datos del Sistema Comercial Integrado del AyA (SCI-OPEN) y el mismo se encuentra registrado a nombre Nombre01, localización PRN01, con dirección: Dirección01. El servicio se encuentra registrado con tarifa Metropolitana Residencial Grandes Consumidores y tiene un pendiente total de ¢ 28,788.00.Para el NIS 3415384, se realizó también un estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de enero a julio 2026. Lo anterior, para verificar el patrón de consumo del servicio En la revisión efectuada, no se encontraron evidencias de fugas en el hidrómetro, ni en las conexiones del servicio, y se comprobó que la lectura estaba bien tomada, demostrándose que todas y cada una de las lecturas del hidrómetro, corresponden a consumos reales del cliente. No obstante, con base en lo dispuesto en el artículo 97 supra citado y el instructivo de trabajo código COM-73-01-I2, se procedió a rectificar un error en la facturación, producto del cambio del hidrómetro, el mes de mayo del 2026, el cual se calculó a consumo real de 34 metros cúbicos y dicha modificación generó a favor de la recurrente una nota de crédito o rebaja por un monto total de ¢21,973.92. Esta decisión fue notificada el 15 de junio del 2026 al correo ...01 y responde al Reclamo CRM12429164, de la recurrente. -
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO DEL RECURSO

Señala la recurrente que hace aproximadamente 3 meses le llegó un cobro excesivo de agua al NIS 5277408. Señala que inició los trámites visitando la oficina de Guadalupe del Instituto Costarricense de Acueductos y Alcantarillados (ICAA); sin embargo, no recibió respuesta. Indica que posteriormente funcionarios del instituto recurrido realizaron una visita, pero no le rebajaron el cobro. Relata que el 18 de junio de 2026 planteó una nueva gestión ante el ICAA, en la que solicitó lo siguiente: "se me informe, si los NISES CED02 3415384, fueron modificaciones nuevas o sufrieron algún cambio en la naturaleza del servicio”. Solicitó un informe del NISE 5277408 qué subió fuertemente y no ha recibido respuesta a su gestión.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

1. En fecha 18 de junio de 2026 la recurrente presentó ante la autoridad recurrida planteó una gestión, en la que solicitó lo siguiente: "se me informe, si los NISES CED02 3415384, fueron modificaciones nuevas o sufrieron algún cambio en la naturaleza del servicio”. (ver registro electrónico).

2. De conformidad con los registros que constan en la base de datos del Sistema Comercial Integrado del AyA (SCI-OPEN), se realizó consulta al número de servicio NIS 5277408, y se determinó que se encuentra registrado a nombre de Centro Comercial Sabanilla, localización Dirección02, registrado con tarifa Metropolitana Residencial Grandes Consumidores y tiene un pendiente total de ¢ 186,291.70 (ver registro electrónico).

3. Para el anterior servicio, la autoridad recurrida realizó estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de enero a julio 2026, se llevaron a cabo las revisiones de campo en fechas 16 de mayo de 2026, 27 de mayo de 2025, las cuales registraron que no existen fugas en las conexiones del hidrómetro. En fecha 16 de julio de 2026, la revisión dio como resultado: con agua en el sector y con todo cerrado el hidrómetro registra lectura y fuga (ver registro electrónico).

4. En la facturación leída, se registraron lecturas ascendentes y consecutivas y no se determinó que existieran daños en la conexión que afectara los consumos registrados, ni errores de lectura, no es procedente una rectificación a la facturación reclamada de mayo del 2026, ya que la forma de cobro que realizó la Institución es mediante lo que registre el hidrómetro, sobre facturación leída solamente se puede aplicar modificación únicamente si existiere un error de lectura o causa asignable a la institución (ver registro electrónico).

5. El motivo del incremento en las facturaciones sería presumiblemente de fugas internas, ya que se revisó el hidrómetro, según orden de servicio 54935363, del 16 de julio del 2026, en presencia de la recurrente y se determinó la situación (ver registro electrónico).

6. Sobre el servicio NIS 3415384, detallado en el escrito de interposición, se procedió a hacer estudio en los registros que constan en la base de datos del Sistema Comercial Integrado del AyA (SCI-OPEN) y el mismo se encuentra registrado a nombre de la recurrente. El servicio se encuentra registrado con tarifa Metropolitana Residencial Grandes Consumidores y tiene un pendiente total de ¢ 28,788.00. Para el NIS 3415384, se realizó también un estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de enero a julio 2026. En la revisión efectuada, no se encontraron evidencias de fugas en el hidrómetro, ni en las conexiones del servicio, y se comprobó que la lectura estaba bien tomada. No obstante, con base en lo dispuesto en el artículo 97 supra citado y el instructivo de trabajo código COM-73-01-I2, se procedió a rectificar un error en la facturación, producto del cambio del hidrómetro, el mes de mayo del 2026, el cual se calculó a consumo real de 34 metros cúbicos y dicha modificación generó a favor de la recurrente una nota de crédito o rebaja por un monto total de ¢21,973.92. Esta decisión fue notificada el 15 de junio del 2026 al correo ...01 y responde al Reclamo CRM12429164, de la recurrente (ver registro electrónico).

III. CASO CONCRETO

Del informe rendido por la autoridad recurrida el cual es dado bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que, pese a haber presentado el 18 de junio de 2026 una gestión ante el Instituto Costarricense de Acueductos y Alcantarillados, mediante la cual solicitó que se le informara si los NISES No. CED02 3415384 habían sido objeto de modificaciones o cambios en la naturaleza del servicio, así como un informe respecto del incremento en la facturación del NIS 5277408, la autoridad recurrida no emitió respuesta alguna sobre la gestión presentada en la que solicitó: "se me informe, si los NISES CED02 3415384, fueron modificaciones nuevas o sufrieron algún cambio en la naturaleza del servicio”. Del informe rendido por la autoridad recurrida se desprende que, en efecto, la gestión fue recibida el 18 de junio de 2026 fue tramitada internamente en relación con ambos números de servicio.

Asimismo, consta que respecto del NIS 3415384 se había realizado un estudio técnico-comercial y se efectuó una rectificación en la facturación, decisión que fue notificada con anterioridad a la presentación del escrito que dio origen a este recurso. De igual forma, en cuanto al NIS 5277408, se realizaron diversas inspecciones técnicas y un estudio sobre el incremento en el consumo registrado. Si bien la autoridad recurrida afirma haber efectuado gestiones relacionadas con los servicios indicados por la recurrente, no acredita haber dado respuesta expresa a la solicitud concreta presentada el 18 de junio de 2026, ni haber comunicado lo requerido en esa gestión. Así las cosas, al no constar que la gestión presentada por la recurrente el 18 de junio de 2026 haya sido contestada en los términos exigidos por el ordenamiento jurídico, esta Sala concluye que se produjo una lesión al derecho fundamental de petición y pronta respuesta de la amparada.

En consecuencia, el recurso debe estimarse, en cuanto a este extremo se refiere, con el fin de que la autoridad recurrida emita y notifique, a la mayor brevedad, una respuesta sobre lo peticionado. Respecto a la discrepancia con los montos facturados por el servicio público de agua. Al respecto, la Sala explica a la accionante que las discrepancias con el monto de la factura de agua potable y otros, deben ser alegados en la vía común -administrativa o jurisdiccional. En consecuencia, de considerarlo pertinente, puede plantear sus inconformidades o reclamos ante la institución recurrida -como indica haber realizado-, o en la jurisdicción ordinaria competente, vías en las que podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, en cuanto a este extremo se refiere, se declara sin lugar el recurso.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso únicamente en cuanto a la alegada lesión al derecho de petición. Se ordena a JOSE DARÍO GUZMÁN ÁLVAREZ, GERENTE GENERAL a RANDALL CAMPOS ROJAS SUBGERENTE GESTIÓN SISTEMAS GAM y a CYNTHIA ORDOÑEZ ARROYO, JEFE DE LA OFICINA COMERCIAL EN GUADALUPE (UEN Servicio al Cliente Zona IV GAM) todos del INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS o a quienes ocupen dichos cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de su competencia para que, en el plazo máximo de DIEZ DÍAS, contado a partir de la notificación de este pronunciamiento, se brinde respuesta a la recurrente sobre lo solicitado en la gestión presentada el 18 de junio de 2026. Lo anterior se dicta con el apercibimiento de que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Instituto Costarricense de Acueductos y Alcantarillados, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás se declara sin lugar el recurso. Notifíquese.
