Amparo proceeding filed in case no. 26-022989-0007-CO by Nombre01, identity card CED01, against the MINISTRY OF PUBLIC WORKS AND TRANSPORTATION (MOPT).

Background:

  1. 1In a written submission received by the Chamber on 25 June 2026, the amparo applicant files an amparo application. The applicant states that on 22 April 2026, they submitted a request to the office of the respondent minister seeking the following: “(…) In 2016, this Ministry, together with the Ministry of Environment and Health, published Decreto 39724-MOPT-MINAE-S, entitled ‘Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines.’ These regulations directed their control toward establishing new pollutant control levels verifiable during the technical vehicle inspection and new guidelines for vehicles entering the country for the first time, specifically in Articles 7 and 8 of the cited regulations. Article 7 of that body of regulations has been amended four times, postponing the requirement’s entry into force in order to carry out the actions necessary for its effective verification.Specifically, Article 8 establishes the actions this Ministry, the lead agency responsible for verifying compliance with vehicle requirements, is obligated to take, for both vehicles entering the country for the first time and vehicles already in circulation. (…) Based on this article, we make the following observations and inquiries: a. Competence: MOPT is the agency responsible for verifying the requirements established in Article 7 of the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines. Accordingly, it must coordinate with other institutions to ensure this takes place, for example, with the Ministry of Finance, specifically the General Directorate of Customs, and with RECOPE, which must ensure and certify that the current fuel meets the necessary parameters for vehicles entering with Euro IV and Tier II technologies (currently in force) to operate safely.On this point, we make the following specific inquiries: 1. As of today, what interinstitutional coordination has taken place to verify the requirements established in Article 7 of the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines, and with which specific institutions? What has been the scope and outcome of this coordination? 2. If the interinstitutional coordination mentioned in question 1 above has taken place, please provide copies of the minutes of meetings, emails, or existing records. 3. Has this Ministry coordinated directly with the General Directorate of Customs to issue the technical note referred to in the second paragraph of Article 8 of the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines? If so, please provide the documents and/or official correspondence exchanged.Likewise: b. New vehicles entering the country for the first time: The decree under discussion provides that these vehicles must be required to have a certificate of conformity with the emissions standards required by the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines, or, failing that, a measurement of pollutant emissions that makes it possible to determine whether they comply with those regulations. On this matter, we request the following information: 1. As of today, which institution is requesting these certificates, and who verifies and keeps them? 2. Who checks the authenticity of the certificates? 3. If those certificates are not submitted, what process is followed to address the requirement, such as a type-approval test available in Costa Rica or another procedure authorized by MOPT? 4. Given that compliance with the Euro IV and Tier II standards, which correspond to general pollutant-emission limits, and the inclusion of specific systems—OBD (on-board diagnostics system), EVAP, and ORVR (evaporative emissions control)—should currently be verified, please indicate the following: 4.1 Are the OBD (on-board diagnostics system), EVAP, and ORVR (evaporative emissions control) systems being checked for?If so, state the date from which these requirements took effect and please provide a certified copy of the amendment made to the Technical Vehicle Inspection Manual. 4.2 What changes have been made to the pollutant-emission values currently required in the country under the Euro IV and Tier II standards? c. Used vehicles entering the country for the first time: For this category, the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines establish two possible methods of verification: first, a certificate of conformity or a report measuring pollutant emissions for each vehicle; if that document is unavailable because the vehicle is used, the regulations establish a restriction on nationalization based on model year, specifically a maximum age of twelve years, which means that in 2026 only vehicles with model year 2014 or later may enter. In light of the foregoing, we ask: 1.Regarding certificates or measurement reports: 1.1 As of today, which institution is requesting these certificates and who keeps them? 1.2 Who checks the authenticity of the certificates? 1.3 Which entities are authorized to issue certificates and measurement reports? 1.4 Given that reports measuring pollutant-emission controls are permitted, which gas parameters resulting from vehicle combustion are currently measured and must be reported, and what are the concentration-limit percentages that must be met? Please state specifically whether they comply with the Euro IV and Tier II standards. 2. Regarding the restriction on entry based on model year: 2.1 As of today, which institution verifies compliance with the restriction on entry based on model year? 2.2 What currently happens to vehicles that do not meet the permitted age limit? 2.3 Which institution keeps statistics on the age of used vehicles entering the country for the first time?If this Ministry does, we request copies of those statistics from 2017 onward. d. Physical verification or inspection: The cited regulations provide that this Ministry will conduct dynamic tests during the vehicle inspection to verify that vehicles entering the country meet the standards established in Article 7 of the regulations. Given that the regulations will reach ten years since their issuance this year, specifically in two months, we respectfully ask: 1. Does the technical vehicle inspection currently have the equipment necessary to conduct dynamic tests? 2. Has this Ministry issued the technical procedures needed for the company that conducts the technical vehicle inspection to apply the test verifying the standards in Article 7 of the regulations in question? Please provide copies of all background documents and/or agreements of the Board of Directors on this matter, including any amendment to the Technical Vehicle Inspection Manual. 3.If the answer to question 1 in this subsection is no, please state when and under what legal mechanism this Ministry will make these dynamic tests available. These inquiries are made in accordance with my constitutional right to request information from public entities, the constitutional right to protection of a healthy and ecologically balanced environment, and the verification of this Ministry’s obligation to fully comply with and implement the cited regulations, which reach their first decade this year, as determined by the Constitutional Chamber in Voto 2025-041946 (…)”. The applicant claims that, as of the date this amparo application was filed, no response had been given to the request mentioned above, and therefore the requested information had not been made available. The applicant considers their fundamental rights to have been violated.
  2. 2By order issued at 14:23 on 30 June 2026, the amparo proceeding was admitted.
  3. 3Efraím Zeledón Leiva, in his capacity as Minister of Public Works and Transportation, reports under oath as follows: “FIRST: In response to Decreto Ejecutivo N°39724-MOPT-MINAE-S, ‘Regulations for the Control of Pollutant Emissions Produced by Motor Vehicles with Internal Combustion Engines,’ the Road Safety Council is preparing amendments that will subsequently be approved by the undersigned. SECOND: As of the date of this report, the necessary Board of Directors has not been established within the Road Safety Council; therefore, ministerial approval will be needed to expedite the process for the required amendments. REGARDING THE REQUEST BEFORE THIS MINISTERIAL OFFICE: Let the present and honorable Chamber note that, under the period granted, the deadline for the request expires today, 3 July 2026. Accordingly, the Administration, within its authority, is working on the initial development of the matter before us.Since the Road Safety Council does not have a duly constituted Board of Directors, technical matters must be submitted to that Entity’s full process for each specific case. To that end, a ministerial approval prepared by the undersigned is attached to continue the process concerning Decreto EjecutivoN°39724-MOPT-MINAE-S, ‘Regulations for the Control of Pollutant Emissions Produced by Motor Vehicles with Internal Combustion Engines,’ since this matter is also associated with the amparo proceeding filed by the same applicant in case No. 25-030815-0007-CO, and the inquiries arise from the same specific case. As indicated, the matter is being processed in accordance with the information available to the Administration and the principle of legality. In this particular case, having acted in accordance with the obligations imposed by law, this Office has not been able to violate any right of the complainant, since the relevant actions are being processed.Accordingly, this amparo application should be denied insofar as it concerns this ministerial office. Thus, since this Ministry has acted within the applicable legal framework and in keeping with the capacity conferred upon it, its obligations under the law, and its powers, this Office and none of its officials could have violated any right. Accordingly, this amparo application should be denied, and the State should be exempted from paying costs, damages, and losses.”
  4. 4Rafael Alonso Torres Loría, in his capacity as attorney of record, states: “The deadline for the Minister to submit a report has long passed, and two documents appear in the electronic case file which, in substance, have no connection whatsoever to this proceeding and do not show that the requested information was duly provided. Indeed, upon reviewing the referenced documents, it may be inferred that they are directly related to the subject matter of the amparo proceeding filed in case number 25-030815-0007-CO, and do not remotely correspond to the specific information requested. Note, moreover, that they are not even addressed to Asociación Preserve Planet. Accordingly, the report required by this High Court from the respondent was not submitted, and the requested information HAS NOT BEEN PROVIDED. Therefore, with due respect, I ask that the Minister of Public Works and Transportation be ordered to provide the requested information immediately and to pay the corresponding costs of the proceeding.”
  5. 5The legal requirements have been observed in these proceedings.

Justice Rueda Leal drafts the opinion; and, Reasons:

I.Preliminary matter. Although the amparo applicant claims to have come before this jurisdiction as general attorney-in-fact for Asociación Preserve Planet, the applicant has provided no evidence of that representation. Nevertheless, given the informal nature of the amparo proceeding and the broad standing to file one, the application will be processed.

II.Subject of the application. The amparo applicant states that they submitted an information request to MOPT. The applicant alleges that no response has been received.

III.Facts found. The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent failed to address them, as required in the initial order:

  • a)On 22 April 2026, the amparo applicant requested the following from the Minister of Public Works and Transportation: “(…) In 2016, this Ministry, together with the Ministry of Environment and Health, published Decreto 39724-MOPT-MINAE-S, entitled ‘Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines.’ These regulations directed their control toward establishing new pollutant control levels verifiable during the technical vehicle inspection and new guidelines for vehicles entering the country for the first time, specifically in Articles 7 and 8 of the cited regulations. Article 7 of that body of regulations has been amended four times, postponing the requirement’s entry into force in order to carry out the actions necessary for its effective verification. Specifically, Article 8 establishes the actions this Ministry, the lead agency responsible for verifying compliance with vehicle requirements, is obligated to take, for both vehicles entering the country for the first time and vehicles already in circulation. IV.The case at hand. In the present case, the amparo applicant states that they submitted an information request to MOPT. The applicant alleges that no response has been received.

Upon reviewing the case file, the Chamber found it proven that on 22 April 2026, the amparo applicant requested the following from the Minister of Public Works and Transportation: “(…) In 2016, this Ministry, together with the Ministry of Environment and Health, published Decreto 39724-MOPT-MINAE-S, entitled ‘Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines.’ These regulations directed their control toward establishing new pollutant control levels verifiable during the technical vehicle inspection and new guidelines for vehicles entering the country for the first time, specifically in Articles 7 and 8 of the cited regulations. Article 7 of that body of regulations has been amended four times, postponing the requirement’s entry into force in order to carry out the actions necessary for its effective verification. Used vehicles entering the country for the first time: For this category, the Regulations for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines establish two possible methods of verification: first, a certificate of conformity or a report measuring pollutant emissions for each vehicle; if that document is unavailable because the vehicle is used, the regulations establish a restriction on nationalization based on model year, specifically a maximum age of twelve years, which means that in 2026 only vehicles with model year 2014 or later may enter.

In light of the foregoing, we ask: 1. Regarding certificates or measurement reports: 1.1 As of today, which institution is requesting these certificates and who keeps them? 1.2 Who checks the authenticity of the certificates? 1.3 Which entities are authorized to issue certificates and measurement reports? 1.4 Given that reports measuring pollutant-emission controls are permitted, which gas parameters resulting from vehicle combustion are currently measured and must be reported, and what are the concentration-limit percentages that must be met? Please state specifically whether they comply with the Euro IV and Tier II standards. 2. Regarding the restriction on entry based on model year: 2.1 As of today, which institution verifies compliance with the restriction on entry based on model year? 2.2 What currently happens to vehicles that do not meet the permitted age limit? 2.3 Which institution keeps statistics on the age of used vehicles entering the country for the first time?

If this Ministry does, we request copies of those statistics from 2017 onward. d. Physical verification or inspection: The cited regulations provide that this Ministry will conduct dynamic tests during the vehicle inspection to verify that vehicles entering the country meet the standards established in Article 7 of the regulations. Given that the regulations will reach ten years since their issuance this year, specifically in two months, we respectfully ask: 1. Does the technical vehicle inspection currently have the equipment necessary to conduct dynamic tests? 2. Has this Ministry issued the technical procedures needed for the company that conducts the technical vehicle inspection to apply the test verifying the standards in Article 7 of the regulations in question? Please provide copies of all background documents and/or agreements of the Board of Directors on this matter, including any amendment to the Technical Vehicle Inspection Manual. 3.

If the answer to question 1 in this subsection is no, please state when and under what legal mechanism this Ministry will make these dynamic tests available. These inquiries are made in accordance with my constitutional right to request information from public entities, the constitutional right to protection of a healthy and ecologically balanced environment, and the verification of this Ministry’s obligation to fully comply with and implement the cited regulations, which reach their first decade this year, as determined by the Constitutional Chamber in Voto 2025-041946 (…)”.

It was also established that the request has still not been addressed. Consequently, the Chamber finds a violation of the fundamental rights of the person whose rights are protected, since the legal deadline for addressing information requests has passed (Article 32 of the Ley de la Jurisdicción Constitucional). In light of the foregoing, the amparo application is granted.

V.Documents submitted to the case file. The parties are advised that if they have submitted any paper document or object, or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve it within a maximum period of 30 business days, counted from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Boletín Judicial no. 19 on 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary, held on 3 May 2012.

Therefore:

The amparo application is granted. Efraím Zeledón Leiva, in his capacity as Minister of Public Works and Transportation, or whoever holds that office, is ordered to coordinate as appropriate and take the necessary measures within the scope of his authority so that, within a maximum period of TEN DAYS from notification of this judgment, the request made by the person whose rights are protected is addressed as required by law and the response is communicated to that person. The respondent authorities are advised that, in accordance with Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, will be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the events on which this declaration is based, to be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Notify the parties.

Recurso de amparo que se tramita en el expediente nro. 26-022989-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES (MOPT).

Resultando:

  1. 1Por escrito recibido en la Sala el 25 de junio de 2026, la persona accionante interpone un recurso de amparo. Manifiesta que el 22 de abril de 2026 planteó ante el despacho del ministro recurrido una gestión solicitando lo siguiente: “(…) Para el año 2016, este Ministerio, en conjunto con el Ministerio de Ambiente y Salud, publicaron el Decreto 39724-MOPT-MINAE-S, denominado "Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna". Esta reglamentación direcciono su control a emitir nuevos niveles de control de contaminantes verificables en la inspección técnica vehicular y nuevos lineamientos para los vehículos de primer ingreso, específicamente en los artículos 7 y 8 de citado reglamento. Et artículo 7 de dicho cuerpo normativo ha sido cuatro veces modificado, retrasando la entrada en vigor del requisito con la finalidad de realizar las actuaciones necesarias para su efectiva verificación.Específicamente, el artículo 8 determina cuales son las acciones a las que se encuentra obligado este Ministerio, ente rector en materia de verificación de cumplimiento de requisitos en vehículos, tanto de primer ingreso como en circulación. (…) De acuerdo con este artículo realizamos las siguientes consideraciones y consultas: a. Competencia: El MOPT es el ente encargado de verificar los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna. De conformidad con ello debe realizar las coordinaciones interinstitucionales para que así suceda, por ejemplo, con el Ministerio de Hacienda, específicamente con la Dirección General de Aduanas y con RECOPE, entidad que debe asegurar y certificar que el actual combustible cumple con los parámetros necesarios para que los vehículos que ingresan con tecnologías Euro IV y Tier Il (actualmente en vigencia) puedan funcionar de forma segura.Sobre este punto realizamos las siguientes consultas especificas: 1. A la fecha cuales coordinaciones interinstitucionales se han realizado para la verificación de los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, ¿con cuales instituciones específicas? ¿cuáles han sido los alcances y resultados de estas coordinaciones? 2. En caso de existir coordinaciones interinstitucionales indicadas en la pregunta 1 anterior, remitir copia de las minutas de reunión, correos electrónicos o actas existentes. 3. ¿Ha coordinado este Ministerio de forma directa con la Dirección General de Aduanas para la emisión de la nota técnica indicada en el párrafo segundo del artículo 8 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna?En caso de ser afirmativa su respuesta, favor aportar los documentos y/o oficios cursados. En igual sentido: b. Vehículos nuevos de primer ingreso: El decreto en comentario determina que se les debe exigir un certificado de conformidad sobre el cumplimiento de estándares de emisiones exigidos en el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, o en su defecto una medición de las emisiones contaminantes que permita determinar su cumplimiento de dicho reglamento. Sobre el particular solicitamos la siguiente información: 1. ¿A la fecha que institución está solicitando estos certificados, quien los verifica y los resguarda? 2. ¿Quién revisa la autenticidad de tos certificados? 3. ¿En caso de que no se presenten dichos certificados, cual es el proceso para atender el requerimiento, como por ejemplo una prueba de homologación a la que se pueda acceder en Costa Rica u otro trámite autorizado por el MOPT? 4.Siendo que se debe estar verificando en este momento la conformidad con los estándares Euro IV y Tier Il, que corresponden a límites generales de emisiones de contaminantes, así como la inclusión de sistemas específicos, OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas), le solicito por favor se sirva indicar lo siguiente: 4.1 ¿Se está verificando la existencia de los sistemas OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas)? De ser así, indicar a partir de que fecha entraron a regir estos requerimientos y favor proveer copia certificada de la modificación realizada a Manual de Inspección Técnica vehicular. 4.2 ¿Cuáles han sido los cambios en los valores de emisiones contaminantes que se requieren actualmente en el país de conformidad con las normas Euro IV y Tier II? c. Vehículos usados de primer ingreso: Para este sector el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, determina dos posibilidades de verificación, la primera de ellas es un certificado de conformidad o bien un informe de medición de las emisiones contaminantes por cada vehículo y en caso de no contar con este documento, debido a su naturaleza como un bien usado, se determina una limitación de nacionalización por año modelo, específicamente con doce años como máximo de antigüedad, que para el año 2026, solo se permite el ingreso de vehículos año modelo 2014 o mayor.De conformidad con lo anterior, nos permitimos consultar: 1. En el caso de los certificados o informes de medición: 1.1 ¿A la fecha que institución está solicitando estos certificados y quien los resguarda? 1.2 ¿Quién revisa la autenticidad de los certificados? 1.3 ¿Cuáles entidades son las autorizadas para emitir los certificados y los informes de medición? 1.4 Siendo que se permiten informes de medición de control de emisiones de contaminantes, cuáles son los parámetros de gases que se miden actualmente, resultado de la combustión de los vehículos, que deben indicarse y cuales los porcentajes de concentración límite que se deben cumplir. Favor indicar puntualmente si los mismos se ajustan o no a las normas Euro IV y Tier II. 2. En relación con la limitación de ingreso por año modelo 2.1 ¿Que institución a la fecha verifica si se cumple o no con la limitación de ingreso por año modelo? 2.2 ¿Que pasa actualmente con los vehículos que no cumplen con la antigüedad permitida? 2.3 ¿Que institución lleva las estadísticas respecto a la antigüedad de los vehículos usados de primer ingreso? en caso de que sea este Ministerio solicitamos copia de dichas estadísticas a partir del año 2017. d. Verificación física o inspección: Et citado reglamento supra dispone que este Ministerio ejecutará pruebas dinámicas, realizadas en la inspección vehicular a fin de verificar que los vehículos que ingresen cumplan con los estándares establecidos en el artículo 7º del reglamento.Considerando que el reglamento indicado cumple 10 años desde su emisión este año, específicamente en dos meses, respetuosamente consultamos: 1. ¿Actualmente la inspección técnica vehicular cuenta con los equipos necesarios para realizar las pruebas dinámicas? 2. ¿Este Ministerio ha emitido los procedimientos técnicos para que la prueba de verificación de estándares del artículo 7 del reglamento en cuestión se pueda aplicar por parte de la empresa que realiza la inspección técnica vehicular? Favor aportar copia de todos los antecedentes y/o acuerdos de la Junta Directiva en esta línea incluyendo cualquier modificación al Manual de Inspección Técnica Vehicular. 3. En caso de que la pregunta 1 de este acápite sea negativa, favor indicar en qué plazo y bajo qué figura legal, este Ministerio dispondrá de estas pruebas dinámicas? Las anteriores consultas se realizan en apego a mi derecho constitucional de requerir información a las entidades públicas, al derecho constitucional a la protección de un ambiente sano y ecológicamente equilibrado, y a la verificación de la obligación de este Ministerio de dar cabal cumplimiento e implementación del citado reglamento que cumple su primer decenio, según lo ha determinado la Sala Constitucional mediante su voto 2025-041946 (…)”. Reclama que a la fecha de interposición de este recurso no se le ha dado respuesta a la gestión señalada, y por ello no ha tenido acceso a lo solicitado. Estima lesionados sus derechos fundamentales
  2. 2Por resolución de las 14:23 horas del 30 de junio de 2026 se dio curso al amparo.
  3. 3Informa bajo juramento Efraím Zeledón Leiva, en su condición de ministro de Obras Públicas y Transportes, lo siguiente: “PRIMERO: Que en atención al Decreto Ejecutivo N°39724-MOPT-MINAE-S, "Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna” El Consejo de Seguridad Vial está planteando las reformas que posteriormente serán avaladas por el suscrito. SEGUNDO: Que a la fecha de la presente emisión no se ha conformado la Junta Directiva necesaria en el Consejo se Seguridad Vial, por lo que se deberá contar con un aval ministerial para la agilización del proceso de las reformas requeridas. DE LA GESTIÓN DE ESTE DESPACHO MINISTERIAL Note la presente y honorable Sala que la gestión promovida según el plazo otorgado, vence el día de hoy 3 de julio de 2026, por lo que la Administración conforme a las competencias está trabajando en la génesis del asunto que nos ocupa, donde al no existir una Junta Directiva debidamente conformada en el Consejo de Seguridad Vial, existen aspectos de nivel técnico que deben someterse al proceso integral de cada caso en concreto con dicha Entidad.Para ello se adjunta un aval ministerial, elaborado por el suscrito a fin de darle continuidad a lo que implica Decreto EjecutivoN°39724-MOPT-MINAE-S, "Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna”, toda vez que lo presente también se asocia al recurso del mismo recurrente visto en expediente N° 25-030815- 0007-CO y las consultas emanan del mismo caso en concreto, bajo lo cual como se indica , se esta dando trámite conforme a los insumos que posee la administración bajo el principio de legalidad. Del caso en particular y al haber actuado según las obligaciones de Ley, se hace ver que este Despacho no ha podido lesionar derecho alguno al reclamante, ya que se están gestionando las acciones pertinentes, por lo que lo propio, es que se declare sin lugar el presente recurso de amparo en lo que a este despacho ministerial se refiere.Así las cosas, siendo que este Ministerio ha actuado dentro del marco legal normal correspondiente de acuerdo a las capacidades que se nos confiere, según las obligaciones de Ley y las potestades de estes Ministerio, en consecuencia, se considera que este Despacho y ningún funcionario del mismo, no ha podido lesionar derecho alguno, por lo que lo propio es que se declare sin lugar el presente recurso de amparo, y se exima al Estado del pago de costas, daños y perjuicios”.
  4. 4Manifiesta Rafael Alonso Torres Loría, en su condición de abogado director: “Habiendo transcurrido sobradamente el plazo para rendir informe por parte del señor Ministro, se evidencian 2 documentos en la carpeta electrónica que, en el fondo, no guardan relación alguna con el presente proceso y tampoco evidencian el cumplimiento debido de la entrega de la información solicitada. En efecto, al revisar los documentos referenciados es posible inferir que los mismos se encuentran relacionados directamente con el objeto procesal del recurso de amparo tramitado en el expediente número 25- 030815-0007-CO, más ni por asomo corresponde a los extremos de información peticionados, inclusive nótese que ni siquiera se encuentran dirigidos a la Asociación Preserve Planet. Así las cosas es de indicar que el informe requerido por este alto Tribunal al recurrido no fue rendido, de la misma forma que la información solicitada NO HA SIDO ENTREGADA, de tal manera que, con el debido respeto, solicito se condene al señor Ministro de Obras Públicas y Transportes a entregar la información solicitada de manera inmediata, así como al pago de las respectivas costas del proceso”.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.De previo. Si bien el recurrente alega que acude a esta jurisdicción en su condición de apoderado general de la Asociación Preserve Planet, no menos cierto es que no aporta elemento probatorio donde conste tal representación. Sin embargo, vista la informalidad del recurso de amparo y la amplia legitimación para su interposición, se procede con el trámite del recurso.

II.Objeto del recurso. La parte recurrente indica que presentó una gestión de información ante el MOPT. Acusa que no ha recibido respuesta.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)El 22 de abril de 2026, el recurrente solicitó al ministro de Obras Públicas y Transportes lo siguiente: “(…) Para el año 2016, este Ministerio, en conjunto con el Ministerio de Ambiente y Salud, publicaron el Decreto 39724-MOPT-MINAE-S, denominado "Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna". Esta reglamentación direcciono su control a emitir nuevos niveles de control de contaminantes verificables en la inspección técnica vehicular y nuevos lineamientos para los vehículos de primer ingreso, específicamente en los artículos 7 y 8 de citado reglamento. Et artículo 7 de dicho cuerpo normativo ha sido cuatro veces modificado, retrasando la entrada en vigor del requisito con la finalidad de realizar las actuaciones necesarias para su efectiva verificación. Específicamente, el artículo 8 determina cuales son las acciones a las que se encuentra obligado este Ministerio, ente rector en materia de verificación de cumplimiento de requisitos en vehículos, tanto de primer ingreso como en circulación. (…) De acuerdo con este artículo realizamos las siguientes consideraciones y consultas: a. Competencia: El MOPT es el ente encargado de verificar los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna. De conformidad con ello debe realizar las coordinaciones interinstitucionales para que así suceda, por ejemplo, con el Ministerio de Hacienda, específicamente con la Dirección General de Aduanas y con RECOPE, entidad que debe asegurar y certificar que el actual combustible cumple con los parámetros necesarios para que los vehículos que ingresan con tecnologías Euro IV y Tier Il (actualmente en vigencia) puedan funcionar de forma segura. Sobre este punto realizamos las siguientes consultas especificas: 1. A la fecha cuales coordinaciones interinstitucionales se han realizado para la verificación de los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, ¿con cuales instituciones específicas? ¿cuáles han sido los alcances y resultados de estas coordinaciones? 2. En caso de existir coordinaciones interinstitucionales indicadas en la pregunta 1 anterior, remitir copia de las minutas de reunión, correos electrónicos o actas existentes. 3. ¿Ha coordinado este Ministerio de forma directa con la Dirección General de Aduanas para la emisión de la nota técnica indicada en el párrafo segundo del artículo 8 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna? En caso de ser afirmativa su respuesta, favor aportar los documentos y/o oficios cursados. En igual sentido: b. Vehículos nuevos de primer ingreso: El decreto en comentario determina que se les debe exigir un certificado de conformidad sobre el cumplimiento de estándares de emisiones exigidos en el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, o en su defecto una medición de las emisiones contaminantes que permita determinar su cumplimiento de dicho reglamento. Sobre el particular solicitamos la siguiente información: 1. ¿A la fecha que institución está solicitando estos certificados, quien los verifica y los resguarda? 2. ¿Quién revisa la autenticidad de tos certificados? 3. ¿En caso de que no se presenten dichos certificados, cual es el proceso para atender el requerimiento, como por ejemplo una prueba de homologación a la que se pueda acceder en Costa Rica u otro trámite autorizado por el MOPT? 4. Siendo que se debe estar verificando en este momento la conformidad con los estándares Euro IV y Tier Il, que corresponden a límites generales de emisiones de contaminantes, así como la inclusión de sistemas específicos, OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas), le solicito por favor se sirva indicar lo siguiente: 4.1 ¿Se está verificando la existencia de los sistemas OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas)? De ser así, indicar a partir de que fecha entraron a regir estos requerimientos y favor proveer copia certificada de la modificación realizada a Manual de Inspección Técnica vehicular. 4.2 ¿Cuáles han sido los cambios en los valores de emisiones contaminantes que se requieren actualmente en el país de conformidad con las normas Euro IV y Tier II? c. Vehículos usados de primer ingreso: Para este sector el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, determina dos posibilidades de verificación, la primera de ellas es un certificado de conformidad o bien un informe de medición de las emisiones contaminantes por cada vehículo y en caso de no contar con este documento, debido a su naturaleza como un bien usado, se determina una limitación de nacionalización por año modelo, específicamente con doce años como máximo de antigüedad, que para el año 2026, solo se permite el ingreso de vehículos año modelo 2014 o mayor. De conformidad con lo anterior, nos permitimos consultar: 1. En el caso de los certificados o informes de medición: 1.1 ¿A la fecha que institución está solicitando estos certificados y quien los resguarda? 1.2 ¿Quién revisa la autenticidad de los certificados? 1.3 ¿Cuáles entidades son las autorizadas para emitir los certificados y los informes de medición? 1.4 Siendo que se permiten informes de medición de control de emisiones de contaminantes, cuáles son los parámetros de gases que se miden actualmente, resultado de la combustión de los vehículos, que deben indicarse y cuales los porcentajes de concentración límite que se deben cumplir. Favor indicar puntualmente si los mismos se ajustan o no a las normas Euro IV y Tier II. 2. En relación con la limitación de ingreso por año modelo 2.1 ¿Que institución a la fecha verifica si se cumple o no con la limitación de ingreso por año modelo? 2.2 ¿Que pasa actualmente con los vehículos que no cumplen con la antigüedad permitida? 2.3 ¿Que institución lleva las estadísticas respecto a la antigüedad de los vehículos usados de primer ingreso? en caso de que sea este Ministerio solicitamos copia de dichas estadísticas a partir del año 2017. d. Verificación física o inspección: Et citado reglamento supra dispone que este Ministerio ejecutará pruebas dinámicas, realizadas en la inspección vehicular a fin de verificar que los vehículos que ingresen cumplan con los estándares establecidos en el artículo 7º del reglamento. Considerando que el reglamento indicado cumple 10 años desde su emisión este año, específicamente en dos meses, respetuosamente consultamos: 1. ¿Actualmente la inspección técnica vehicular cuenta con los equipos necesarios para realizar las pruebas dinámicas? 2. ¿Este Ministerio ha emitido los procedimientos técnicos para que la prueba de verificación de estándares del artículo 7 del reglamento en cuestión se pueda aplicar por parte de la empresa que realiza la inspección técnica vehicular? Favor aportar copia de todos los antecedentes y/o acuerdos de la Junta Directiva en esta línea incluyendo cualquier modificación al Manual de Inspección Técnica Vehicular. 3. En caso de que la pregunta 1 de este acápite sea negativa, favor indicar en qué plazo y bajo qué figura legal, este Ministerio dispondrá de estas pruebas dinámicas? Las anteriores consultas se realizan en apego a mi derecho constitucional de requerir información a las entidades públicas, al derecho constitucional a la protección de un ambiente sano y ecológicamente equilibrado, y a la verificación de la obligación de este Ministerio de dar cabal cumplimiento e implementación del citado reglamento que cumple su primer decenio, según lo ha determinado la Sala Constitucional mediante su voto 2025-041946 (…)”. (Hecho incontrovertido).
  • b)La gestión anterior no ha sido atendida. (Hecho incontrovertido).

IV.Sobre el caso concreto. En el sub examine, la parte recurrente indica que presentó una gestión de información ante el MOPT. Acusa que no ha recibido respuesta.

Analizados los autos, la Sala tuvo por probado que, el 22 de abril de 2026, el recurrente solicitó al ministro de Obras Públicas y Transportes lo siguiente: “(…) Para el año 2016, este Ministerio, en conjunto con el Ministerio de Ambiente y Salud, publicaron el Decreto 39724-MOPT-MINAE-S, denominado "Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna". Esta reglamentación direcciono su control a emitir nuevos niveles de control de contaminantes verificables en la inspección técnica vehicular y nuevos lineamientos para los vehículos de primer ingreso, específicamente en los artículos 7 y 8 de citado reglamento. Et artículo 7 de dicho cuerpo normativo ha sido cuatro veces modificado, retrasando la entrada en vigor del requisito con la finalidad de realizar las actuaciones necesarias para su efectiva verificación. Específicamente, el artículo 8 determina cuales son las acciones a las que se encuentra obligado este Ministerio, ente rector en materia de verificación de cumplimiento de requisitos en vehículos, tanto de primer ingreso como en circulación.

(…) De acuerdo con este artículo realizamos las siguientes consideraciones y consultas: a. Competencia: El MOPT es el ente encargado de verificar los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna. De conformidad con ello debe realizar las coordinaciones interinstitucionales para que así suceda, por ejemplo, con el Ministerio de Hacienda, específicamente con la Dirección General de Aduanas y con RECOPE, entidad que debe asegurar y certificar que el actual combustible cumple con los parámetros necesarios para que los vehículos que ingresan con tecnologías Euro IV y Tier Il (actualmente en vigencia) puedan funcionar de forma segura. Sobre este punto realizamos las siguientes consultas especificas: 1. A la fecha cuales coordinaciones interinstitucionales se han realizado para la verificación de los requisitos determinados en el artículo 7 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, ¿con cuales instituciones específicas?

¿cuáles han sido los alcances y resultados de estas coordinaciones? 2. En caso de existir coordinaciones interinstitucionales indicadas en la pregunta 1 anterior, remitir copia de las minutas de reunión, correos electrónicos o actas existentes. 3. ¿Ha coordinado este Ministerio de forma directa con la Dirección General de Aduanas para la emisión de la nota técnica indicada en el párrafo segundo del artículo 8 del Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna? En caso de ser afirmativa su respuesta, favor aportar los documentos y/o oficios cursados. En igual sentido: b. Vehículos nuevos de primer ingreso: El decreto en comentario determina que se les debe exigir un certificado de conformidad sobre el cumplimiento de estándares de emisiones exigidos en el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, o en su defecto una medición de las emisiones contaminantes que permita determinar su cumplimiento de dicho reglamento.

Sobre el particular solicitamos la siguiente información: 1. ¿A la fecha que institución está solicitando estos certificados, quien los verifica y los resguarda? 2. ¿Quién revisa la autenticidad de tos certificados? 3. ¿En caso de que no se presenten dichos certificados, cual es el proceso para atender el requerimiento, como por ejemplo una prueba de homologación a la que se pueda acceder en Costa Rica u otro trámite autorizado por el MOPT? 4. Siendo que se debe estar verificando en este momento la conformidad con los estándares Euro IV y Tier Il, que corresponden a límites generales de emisiones de contaminantes, así como la inclusión de sistemas específicos, OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas), le solicito por favor se sirva indicar lo siguiente: 4.1 ¿Se está verificando la existencia de los sistemas OBD (sistema de diagnóstico a bordo), EVAP y ORVR (Control de Emisiones Evaporativas)?

De ser así, indicar a partir de que fecha entraron a regir estos requerimientos y favor proveer copia certificada de la modificación realizada a Manual de Inspección Técnica vehicular. 4.2 ¿Cuáles han sido los cambios en los valores de emisiones contaminantes que se requieren actualmente en el país de conformidad con las normas Euro IV y Tier II? c. Vehículos usados de primer ingreso: Para este sector el Reglamento para el control de emisiones contaminantes producidas por los vehículos con motor de combustión interna, determina dos posibilidades de verificación, la primera de ellas es un certificado de conformidad o bien un informe de medición de las emisiones contaminantes por cada vehículo y en caso de no contar con este documento, debido a su naturaleza como un bien usado, se determina una limitación de nacionalización por año modelo, específicamente con doce años como máximo de antigüedad, que para el año 2026, solo se permite el ingreso de vehículos año modelo 2014 o mayor.

De conformidad con lo anterior, nos permitimos consultar: 1. En el caso de los certificados o informes de medición: 1.1 ¿A la fecha que institución está solicitando estos certificados y quien los resguarda? 1.2 ¿Quién revisa la autenticidad de los certificados? 1.3 ¿Cuáles entidades son las autorizadas para emitir los certificados y los informes de medición? 1.4 Siendo que se permiten informes de medición de control de emisiones de contaminantes, cuáles son los parámetros de gases que se miden actualmente, resultado de la combustión de los vehículos, que deben indicarse y cuales los porcentajes de concentración límite que se deben cumplir. Favor indicar puntualmente si los mismos se ajustan o no a las normas Euro IV y Tier II. 2. En relación con la limitación de ingreso por año modelo 2.1 ¿Que institución a la fecha verifica si se cumple o no con la limitación de ingreso por año modelo? 2.2 ¿Que pasa actualmente con los vehículos que no cumplen con la antigüedad permitida? 2.3 ¿Que institución lleva las estadísticas respecto a la antigüedad de los vehículos usados de primer ingreso? en caso de que sea este Ministerio solicitamos copia de dichas estadísticas a partir del año 2017. d. Verificación física o inspección: Et citado reglamento supra dispone que este Ministerio ejecutará pruebas dinámicas, realizadas en la inspección vehicular a fin de verificar que los vehículos que ingresen cumplan con los estándares establecidos en el artículo 7º del reglamento.

Considerando que el reglamento indicado cumple 10 años desde su emisión este año, específicamente en dos meses, respetuosamente consultamos: 1. ¿Actualmente la inspección técnica vehicular cuenta con los equipos necesarios para realizar las pruebas dinámicas? 2. ¿Este Ministerio ha emitido los procedimientos técnicos para que la prueba de verificación de estándares del artículo 7 del reglamento en cuestión se pueda aplicar por parte de la empresa que realiza la inspección técnica vehicular? Favor aportar copia de todos los antecedentes y/o acuerdos de la Junta Directiva en esta línea incluyendo cualquier modificación al Manual de Inspección Técnica Vehicular. 3. En caso de que la pregunta 1 de este acápite sea negativa, favor indicar en qué plazo y bajo qué figura legal, este Ministerio dispondrá de estas pruebas dinámicas? Las anteriores consultas se realizan en apego a mi derecho constitucional de requerir información a las entidades públicas, al derecho constitucional a la protección de un ambiente sano y ecológicamente equilibrado, y a la verificación de la obligación de este Ministerio de dar cabal cumplimiento e implementación del citado reglamento que cumple su primer decenio, según lo ha determinado la Sala Constitucional mediante su voto 2025-041946 (…)”.

Asimismo, se constató que esa gestión todavía no ha sido atendida. En consecuencia, la Sala verifica una lesión a los derechos fundamentales del tutelado, toda vez que se excedió el plazo legal para la atención de gestiones de información (artículo 32 de la Ley de la Jurisdicción Constitucional). En virtud de lo expuesto, se declara con lugar el recurso.

V.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara con lugar el recurso. Se ordena a Efraím Zeledón Leiva, en su condición de ministro de Obras Públicas y Transportes, o a quien ejerza ese cargo, que coordine lo pertinente y disponga lo correspondiente dentro del ámbito de sus competencias para que, en el plazo máximo de DIEZ DÍAS, contado a partir de la notificación de esta sentencia, se atienda la gestión del tutelado como en Derecho corresponde y se le comunique la respuesta. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso-administrativo.
