Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on 6 August 2026.
Amparo proceeding filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
Background:
“[S]he is a resident of Florida de Cóbano. She indicates that, for more than six months, a technical report and administrative opinion requested from the Costa Rican Institute of Aqueducts and Sewers have been awaiting resolution, concerning the problem of access to drinking water in the communities of La Abuela and Florida, in Cóbano de Puntarenas. She claims that the respondent institution has not issued a definitive response or conclusive technical opinion, thereby engaging in a prolonged and unjustified omission contrary to the principles of efficiency, promptness, and sound public administration. She indicates that the situation directly affects more than one hundred people residing in the community, including vulnerable populations such as older adults, minors, people with disabilities, and pregnant women. She states that the lack of adequate access to drinking water also affects public educational centers in the area, compromising basic conditions of sanitation, hygiene, and operation of the educational service.
She alleges that the respondent’s administrative omission infringes the right of access to drinking water and leaves the population in a condition of social, health-related, and human vulnerability, without an effective technical or administrative solution. She reports that the absence of an ASADA or formal water supply system worsens the situation, preventing regular, continuous, and safe access to this resource, which is essential to life and the exercise of other fundamental rights. She mentions that students at Escuela la Florida de Cóbano and Escuela de la Abuela must attend classes without drinking water. She asserts that more than 100 people living in hamlets in La Abuela de Cóbano obtain water from artisanal wells, and that the water is not potable. She requests the intervention of this Chamber.”
“[T]his refers to the amparo proceeding filed by Ms. Nombre01, who, in summary, alleges:
‘That there is an institutional omission in responding to the problem of drinking water supply in the communities of La Abuela and Florida de Cóbano, Puntarenas.’
Based on memorandum PRE-UTSAPS-2026-00207, signed by Lic. Zaida Díaz González, Coordinator of the Technical Unit for Drinking Water Supply and Sanitation Services (UTSAPS), as well as on the technical reports entitled ‘Technical and commercial assessment of an unauthorized operator. La Abuela Aqueduct, Cóbano’ and ‘Technical and commercial report on an unauthorized operator. La Florida Aqueduct, Cóbano,’ which are attached as evidence and form an integral part of the administrative file, it is established that:
The communities of La Abuela and La Florida de Cóbano currently receive water supply service through systems operated by third parties that are not part of the systems formally administered by the Costa Rican Institute of Aqueducts and Sewers. This situation was identified institutionally under the procedure entitled ‘Provision of services to communities where there is an unauthorized operator.’ For that reason, starting in 2025, the Institution initiated a series of technical and administrative actions to assess service provision conditions in both communities, including field inspections, collection of technical information, characterization of the existing systems, infrastructure analysis, the legal status of the land, and various alternatives for possible formal provision of drinking water supply service by AyA, assessing service alternatives and specialized studies aimed at determining the most appropriate solution to ensure formal and sustainable service provision. (See PRE-UTSAPS-2026-00207, Technical Assessment of La Abuela and La Florida.)
As part of that process, it was determined that the existing systems have technical and operational limitations that prevent them from being considered sustainable, independent long-term solutions. For that reason, the Administration has been analyzing different service alternatives for the area, including comprehensive solutions that would jointly address the needs of the communities concerned. The administrative file also shows that the situation raised by the applicant has been subject to ongoing institutional monitoring: technical reports have been issued, requests have been made for expansions and adjustments to those studies, and the analysis of technically viable alternatives for a definitive response to the identified problem is continuing. This was notified by email, with information sent through memorandum SG-GSP2025-00857 dated 10 September 2025 and the corresponding communications, notified on 14 August 2025. (See PRE-UTSAPS-2026-00207.)
Accordingly, it is not reasonable to claim that the Institute has engaged in an absolute omission or administrative inactivity, since technical, administrative, and planning actions have been underway since 2025 to identify and define a technically viable solution for the communities concerned. In addition, it must be emphasized that the Institute has not authorized these water supply systems, they are not within AyA’s coverage area, and their supply has operated irregularly.
In support of the foregoing, it is necessary to indicate what the General Law of Public Administration provides in Articles 11 and 13, paragraph 1, which, in observance of the principle of legality, state, respectively:
‘1. The Public Administration shall act subject to the legal system and may perform only those acts or provide only those public services authorized by that legal system, according to the hierarchical order of its sources.
‘1. In general, the Administration shall be subject to all written and unwritten rules of the administrative legal system and to the supplementary private law applicable to it, and may neither repeal nor decline to apply them in specific cases.’
In this case, it is established that no constitutional right has been violated, since, as shown in memorandum PRE-UTSAPS-2026-00207 and in the technical reports entitled ‘Technical and commercial assessment of an unauthorized operator. La Abuela Aqueduct, Cóbano’ and ‘Technical and commercial report on an unauthorized operator. La Florida Aqueduct, Cóbano,’ which form an integral part of the pleading submitted herein, the communities that are the subject of the proceeding receive water through systems operated by third parties identified institutionally as unauthorized operators, which are not part of the systems formally administered by the Costa Rican Institute of Aqueducts and Sewers. The Institute has also carried out continuous and sustained actions to address the situation in the communities of La Abuela and La Florida de Cóbano, diligently and promptly activating procedure EST-04-03-P, under which it conducted field inspections, prepared technical forms, issued specialized reports, assessed different solution alternatives, and continues to carry out the actions needed to determine the definitive response for those communities.
Consequently, the actions taken by the Costa Rican Institute of Aqueducts and Sewers have complied with the principle of legality and the powers conferred on it by the legal system. Therefore, no constitutional injury attributable to this Institution has occurred, nor has it abandoned the matters raised; rather, a complex technical procedure is underway that seeks to ensure a comprehensive, sustainable solution in accordance with the legal system in force. Accordingly, the ICAA has not violated any of the applicant’s fundamental rights.
For the foregoing reasons concerning the facts alleged in this amparo proceeding, it has been established that our actions were correct under the regulations governing us. We request that this proceeding be DECLARED WITHOUT MERIT, that the case file be ordered closed, and that the Costa Rican Institute of Aqueducts and Sewers be exempted from all liability.”

“I. STATEMENT REGARDING THE REPORT SUBMITTED BY THE RESPONDING AUTHORITY AND EXPANSION OF ARGUMENTS After reviewing the report submitted by the Costa Rican Institute of Aqueducts and Sewers (AyA), as well as the technical documentation provided by that institution, this party considers it necessary to make the following observations.
First, I must point out that AyA’s response confirms that the problem raised in this proceeding not only exists, but has been fully known to the respondent institution for several years. The technical reports entered into the case file show that AyA itself has conducted field inspections, collected information, and carried out studies of water capacity, which have shown that, despite the administrative activity undertaken, the underlying problem remains unresolved and the affected communities still lack an effective, permanent, and safe solution for drinking water supply.
The evidence provided by the respondent Administration itself establishes that the existing systems operate through unauthorized arrangements, have significant technical limitations, lack adequate infrastructure, do not have sufficient capacity to properly supply the current and future population, and continue to depend on precarious solutions that fail to meet the minimum standards required to guarantee the human right to drinking water.
It is particularly serious that AyA itself expressly acknowledges that the community of La Abuela has no chlorination system and that water is distributed directly from the well, even concluding in its technical report that the water is consumed raw, without an integrated water treatment process.
Consequently, the constitutional issue now before this Chamber goes beyond the mere existence of administrative actions or formal responses. The underlying question is whether the Costa Rican State is effectively guaranteeing the human right to drinking water in the communities of La Florida and La Abuela.
As this Honorable Court is well aware, the Costa Rican legal system had already assigned the Costa Rican Institute of Aqueducts and Sewers direct responsibility for guaranteeing the population’s drinking water supply.
Indeed, Article 2 of the Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers establishes that this institution is responsible for ‘directing and supervising everything concerning the provision of drinking water service to the inhabitants of the Republic’ and, in addition, for ‘constructing, expanding, and renovating aqueduct and sewer systems in cases where necessary and where the best fulfillment of national needs so advises.’ This is therefore an express statutory power that imposes on AyA not only authority to study or supervise, but also the effective duty to adopt the actions necessary to guarantee the population access to adequate drinking water service.
For precisely that reason, when the institution itself acknowledges communities supplied by unauthorized operators, technically insufficient systems, lack of water treatment, and a water deficit, the legal-administrative duty arises to promote and carry out the works, procedures, and actions needed to definitively overcome that situation, in fulfillment of the powers entrusted to it by the legislature.
Along these same lines, let us recall that Law N.°9849 of 5 June 2020 amended Article 50 of the Political Constitution to expressly recognize that:
‘Every person has the basic and inalienable human right of access to drinking water, as an essential good for life. Water is a good of the nation, indispensable to protecting this human right. (...) Priority shall be given to the supply of drinking water for consumption by individuals and populations.’ This constitutional provision elevated to the highest legal rank a guarantee that constitutional case law had repeatedly recognized as a direct manifestation of the fundamental rights to life, health, human dignity, and a healthy environment.
In judgment number 2013-7302, issued at 9:05 on 31 May 2013, this Chamber reiterated that access to drinking water constitutes a fundamental human right and recalled that the State is obligated to guarantee everyone access to sufficient, physically accessible, safe water fit for human consumption. It also expressly indicated that economic, administrative, or budgetary constraints do not constitute a valid justification for failing to fulfill the State’s duties relating to provision of this essential public service.
Specifically, in that constitutional judgment, Dr. Jinesta Lobo stated:
‘IV.- FUNDAMENTAL RIGHT TO THE PROPER FUNCTIONING OF PUBLIC SERVICES. Our Political Constitution implicitly recognizes the fundamental right of those subject to the Administration to the proper and efficient functioning of public services—that is, for those services to be provided to high quality standards. The necessary corollary is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently. This latter obligation follows from the systematic relationship among several constitutional provisions, such as Article 140, paragraph 8), which imposes on the Executive Branch the duty to supervise the proper functioning of services and administrative departments; Article 139, paragraph 4), insofar as it incorporates the concept of the proper conduct of Government; and Article 191, insofar as it incorporates the principle of administrative efficiency.
This atypical or unnamed individual guarantee is accentuated in the case of essential public services such as drinking water supply.’ In this matter, the evidence provided by the respondent authority itself shows that, despite the institution’s knowledge of the problem and the completion of various technical studies, the communities of La Florida and La Abuela continue to lack guaranteed access to a drinking water supply system that meets the conditions of continuity, safety, quality, and sustainability required by the Political Constitution and this Chamber’s case law. The alleged constitutional injury therefore remains ongoing.
Precisely in light of that case law, the situation established in this case file shows a current and continuing constitutional injury. Beyond the technical reports, memoranda, studies, and assessments in the file, this Chamber cannot lose sight of the human reality underlying this proceeding.
Behind every technical chart and administrative analysis are families, older adults, children, women, and people with health conditions who depend daily on precarious supply systems to meet an elementary need: having safe water to drink, cook, bathe, and preserve their health.
These are communities that, despite the institutions’ full knowledge of the problem and the numerous studies conducted over the years, remain exposed to consuming water without adequate treatment processes and to living with constant uncertainty about a resource essential to life. That reality is difficult to reconcile with the constitutional mandate recognizing access to drinking water as a basic and inalienable human right and with the State’s duty to ensure the effective provision of essential public services.
Under a preventive interpretation of fundamental rights and in accordance with the pro homine principle, the solution that affords the greatest possible protection to the human right at issue must be preferred.
This requires timely measures to be adopted before irreparable harm to health occurs, especially where vulnerable populations are involved, including older adults, children, pregnant women, and people with health conditions, as is the case in the communities involved in this proceeding.
Effective constitutional protection cannot be exhausted by establishing that studies are underway or alternatives are being analyzed. The human right to drinking water requires concrete results that allow people to access safe, sufficient, continuous, and quality water.
RELIEF REQUESTED Based on the foregoing, I again respectfully request that this Honorable Chamber:
1. Declare this amparo proceeding WITH MERIT for violation of the fundamental human right of access to drinking water enshrined in Article 50 of the Political Constitution.
2. Order the Costa Rican Institute of Aqueducts and Sewers, within a strict period of no more than 6 MONTHS, to formulate, approve, and implement a definitive solution to guarantee drinking water supply to those communities.
3. Order the Costa Rican Institute of Aqueducts and Sewers to report to this Constitutional Court once a month on all administrative, technical, financial, budgetary, registry, expropriation, property acquisition, easement establishment, administrative contracting, infrastructure construction, interinstitutional coordination, and any other actions necessary to permanently and definitively guarantee effective access to drinking water for the entire affected population.”
“1. APPEARANCE Pursuant to Article 34 of the Law on Constitutional Jurisdiction, I appear in this amparo proceeding as an ACTIVE INTERVENOR IN SUPPORT of the applicant, because I have a legitimate, current, and direct interest in the outcome of this constitutional proceeding, both as a resident of the community and as a representative of the older adults of the Community of La Abuela de Cóbano, who are a population especially vulnerable to the consequences of lack of access to drinking water.
For years, the older adults of the Community of La Abuela de Cóbano have faced a situation of profound vulnerability as a result of lacking permanent access to a sufficient and safe supply of drinking water.
For those of us who have dedicated our lives to the development of this community, access to water is not simply the provision of a public service. It is essential to preserving life, health, hygiene, and human dignity. The inability to have a continuous supply of water directly affects basic daily activities such as preparing food, drinking water each day, personal hygiene, washing clothes, and cleaning homes.
At present, much of the population depends on an insufficient supply system that cannot meet the needs of all residents, causing frequent interruptions in supply, particularly during the dry season. This situation forces many older adults to store water in precarious conditions, depend on relatives or neighbors to obtain it, or even limit their consumption in order to cope with periods of water shortage.
The problem is even more serious for older adults, many of whom suffer from chronic illnesses, require ongoing medication, or have physical and mobility limitations. Lack of water makes it difficult to maintain the minimum hygiene conditions necessary to prevent disease, limits proper food preparation, compromises the proper administration of medication, and increases the risk of gastrointestinal illnesses, infections, and other health complications.
Likewise, many older adults live alone or depend on others to carry out daily activities. The need to travel to obtain water, carry containers, or rely on alternative sources of supply imposes a physical and emotional burden that significantly affects their well-being and quality of life, impairing their autonomy and their right to a dignified old age.
The situation is made worse because many families have been forced to rely on artisanal wells to obtain water. During the rainy season, those wells are susceptible to contamination through infiltration of surface water, which may contain fecal matter and other contaminants. This creates uncertainty about the quality of the water we consume and a well-founded fear about the consequences for our health, particularly for older people, whose physical condition makes them especially vulnerable to illness and infection.
As the representative of the older adults of the Community of La Abuela de Cóbano, I know that the lack of access to drinking water is not a mere inconvenience or minor adverse impact. On the contrary, it directly affects our health, autonomy, living conditions, and dignity as people.
In addition to the foregoing, I have personally suffered the consequences of this problem. As an older adult, I was a beneficiary of a housing grant awarded by the National Institute of Housing and Urbanism (INVU), which represented an opportunity to obtain decent housing and significantly improve my living conditions.
However, because the community lacks an adequate drinking water supply, the Municipality did not approve the corresponding construction permit, which ultimately resulted in the loss of that housing grant.
This situation shows that lack of access to drinking water goes beyond the mere absence of a public service, since it ends up affecting other fundamental rights closely linked to human dignity, such as the right to adequate housing and the right of older adults to special protection by the State.
For an older adult, losing an opportunity to obtain decent housing is not a mere economic loss. It represents the frustration of a legitimate expectation of improving living conditions and having an adequate home during a stage of life when people need greater safety, stability, and protection.
My particular case concretely and palpably demonstrates the serious consequences that the absence of a sufficient and safe drinking water service has for the population of the Community of La Abuela de Cóbano and, especially, for the older adults among us who are in a condition of particular vulnerability.
After contributing to the development of this community throughout our lives, it is contrary to human dignity that, at our most vulnerable stage of life, we must face the uncertainty of not having enough safe water to meet our most basic needs.
For these reasons, I consider that guaranteeing effective access to drinking water is essential to the exercise of our fundamental rights and to ensuring a dignified life for the older adults of our community.
Article 34 of the Law on Constitutional Jurisdiction expressly provides:
‘In addition, anyone with a legitimate interest in the outcome of the proceeding may appear and participate in it as an intervenor in support of the applicant or the respondent.’ In this case, the outcome of this proceeding directly affects the fundamental rights of the older adults who live in the Community of La Abuela de Cóbano, particularly the rights of access to drinking water, health, life, human dignity, and special protection because of our vulnerable condition.
For that reason, a legitimate, current, and direct interest fully justifies my intervention in support of the applicant.

APPEARANCE Pursuant to Article 34 of the Law on Constitutional Jurisdiction, I appear in this amparo proceeding as an ACTIVE INTERVENOR IN SUPPORT of the applicant, because I have a legitimate, current, and direct interest in the outcome of this constitutional proceeding, both as a resident of the community and as a representative of the older adults of the Community of La Abuela de Cóbano, who are a population especially vulnerable to the consequences of lack of access to drinking water.
The Community of La Abuela de Cóbano is seriously affected by the lack of access to a sufficient, continuous, and safe supply of drinking water. At present, a significant part of the population depends on an unauthorized operator whose capacity is insufficient to adequately supply the residents of the area.
During the dry season, numerous families face a severe water shortage that prevents them from meeting basic and essential needs, such as human consumption, food preparation, personal hygiene, washing clothes, and the proper operation of sanitary facilities. This situation forces many people to change their daily routines, store water in precarious conditions, or travel elsewhere to obtain the water resources necessary for their subsistence.
In response to this situation, many neighbors have been forced to rely on artisanal wells to obtain water. However, during the rainy season those wells are particularly vulnerable to contamination through infiltration of surface water, which may contain fecal matter and other contaminants, causing the water to become cloudy and creating serious concern about the risks this poses to the population’s health.
As President of the Community Committee of La Abuela de Cóbano, I know that this problem particularly and seriously affects the older adults in our community. Many live alone, suffer from chronic illnesses, or have physical limitations that make it difficult for them to travel to obtain water, carry containers, or implement alternative supply measures.
The lack of drinking water directly affects their nutrition, personal hygiene, and cleaning of their homes and, in many cases, the proper administration of medication and medical treatments, increasing the risk of illness and significantly worsening their quality of life.
The situation also severely affects children and families in vulnerable circumstances, who need permanent access to safe drinking water to protect their health, development, and right to a dignified life. The lack of an adequate water supply goes beyond a mere daily inconvenience; it directly affects fundamental rights closely linked to life, health, human dignity, and the well-being of the entire community.
For these reasons, this amparo proceeding is particularly important to the residents of the Community of La Abuela de Cóbano, since any protection this Honorable Chamber may grant will directly affect the living conditions, health, and development of hundreds of people who have faced vulnerability for years as a result of lacking effective access to drinking water.

“[I]n my capacity as principal of Escuela La Abuela de Cóbano, we respectfully appear before this Honorable Constitutional Chamber to express our support for this amparo proceeding and, at the same time, to describe the difficult situation faced by our students, teachers, and the entire educational community because of the lack of permanent access to safe, sufficient, and quality drinking water.
Pursuant to Article 34 of the Ley de la Jurisdicción Constitucional, we appear in this amparo proceeding as active intervenors supporting the applicant, since we have a legitimate, current, and direct interest in the outcome of this constitutional proceeding, in my capacity as representative of Escuela La Abuela de Cóbano, an institution responsible for ensuring the conditions necessary for the proper operation of the educational center and the comprehensive protection of the minors who attend it daily.
Escuela La Abuela de Cóbano serves a student population of 58 students who depend on the existence of adequate basic services to effectively exercise their rights to education, health, food, and human dignity. Consequently, the lack of permanent access to sufficient, safe, and high-quality drinking water directly and immediately affects the operation of the educational institution and, in particular, the well-being and comprehensive development of our students.
Because this is an educational community made up mainly of children, the situation reported in this amparo is especially serious: minors are a particularly vulnerable group deserving of enhanced protection by the State, pursuant to Article 51 of the Constitución Política, the Convención sobre los Derechos del Niño, and the repeated jurisprudence of this Constitutional Chamber (Sala Constitucional).
The situation our school faces goes beyond the mere absence of a public service. The lack of water affects daily the health, education, dignity, and well-being of dozens of children who have the right to receive their lessons in adequate and safe conditions. Water is indispensable to the development of any educational center, and its absence has consequences that directly affect the learning process and the exercise of multiple fundamental rights of minors.
Our educational community has had to live for years with an irregular and insufficient service subject to constant interruptions. On various occasions, we have faced damage to pipes, considerable reductions in supply, and circumstances that prevent us from knowing with certainty whether the water reaching our facilities receives the treatment needed to ensure it is potable.
This situation causes deep concern among teachers, since children are entrusted to our care every day and, by virtue of being minors, require special protection by the State.
The lack of water directly affects students’ health. Children need to hydrate adequately during the school day, especially in a high-temperature area like ours. Many of them spend several hours at school and engage in physical and recreational activities that make the constant consumption of drinking water essential. Being unable to guarantee them permanent access to safe water poses an evident risk to their well-being and health.
Likewise, the absence of a reliable water service prevents the maintenance of adequate hygienic conditions. Students must be able to wash their hands before eating, after using the restrooms, and after recreational activities. These practices, which may seem routine to many people, are among the main ways to prevent gastrointestinal diseases, infections, and other conditions that particularly affect children.
The lack of water also makes it difficult to clean classrooms, dining halls, and restrooms. An educational center without enough water cannot guarantee minimum sanitary conditions. The bathrooms cannot be kept adequately clean, common areas cannot be cleaned as often as necessary, and the risk of disease spreading increases considerably.
We must also point out that uncertainty about water quality causes constant fear in the educational community. Although, fortunately, no cases of serious illness associated with water consumption have arisen to date, that does not mean there is no risk. On the contrary, we remain constantly concerned because we cannot be sure that our children are drinking water that has been properly treated and is fit for human consumption.
The harm to our students’ education is also evident. Service interruptions have on various occasions forced us to change schedules, reorganize activities, and even consider suspending certain tasks in order to protect students and ensure their safety.
Whenever the water supply fails, the school’s normal operation is disrupted. Lessons are interrupted, teachers must spend time resolving emergencies, and students lose valuable learning hours. At times, attention focuses more on how to deal with the water shortage than on the educational process itself.
The situation is particularly serious during the summer season. In those months, the availability of water resources decreases considerably, and the community lives with the uncertainty of not knowing when another supply interruption will occur. The shortage forces us to take extraordinary measures to continue operating and places the school in a state of constant vulnerability.
The harm suffered by our students goes far beyond the mere inconvenience caused by an interruption to a public service. The lack of water directly affects everyday activities essential to the comprehensive development of minors. When water is scarce or its quality is uncertain, children cannot hydrate adequately, handwashing becomes difficult, restroom cleanliness is compromised, and families become concerned about the conditions in which their children remain during the school day.
Likewise, the lack of a stable and safe supply affects the provision of the student meal service. Food preparation, washing utensils, and maintaining proper hygiene in dining areas all depend on the permanent availability of drinking water. The inability to guarantee these conditions directly affects minors’ right to receive food in sanitary and safe conditions.
No child should have to attend classes uncertain whether they will be able to drink water safely, use a restroom in hygienic conditions, or receive food under minimum sanitary conditions. Allowing this situation to continue over time disregards the special protection afforded to minors by our legal system and seriously compromises the exercise of their fundamental rights.
We must remember that access to drinking water is a fundamental human right, closely linked to the rights to life, health, education, human dignity, and the best interests of the minor. State institutions have an unavoidable duty to ensure that children receive their education in adequate conditions and have permanent access to a resource so indispensable to their comprehensive development.
It is incompatible with the constitutional order that, in the twenty-first century, an educational community must face daily the uncertainty of not having sufficient, safe, and continuous drinking water to meet its students’ basic needs.
For these reasons, we come before this Honorable Constitutional Chamber to request that the special vulnerability of the student population of Escuela La Abuela de Cóbano be taken into consideration and that the necessary measures be ordered so that the Instituto Costarricense de Acueductos y Alcantarillados adopts urgent and definitive actions to guarantee a permanent, sufficient, and safe supply of drinking water to our school and the entire community.
The protection of our children can no longer be postponed. Each day that passes without a definitive solution harms their health, education, and dignity, and violates the fundamental rights that our Constitution and international instruments recognize and specially protect.
Therefore, we respectfully join this amparo in all its aspects and request that it be granted, with the authorities named as respondents ordered to adopt the necessary measures to guarantee immediate and definitive access to drinking water for the educational community of Escuela La Abuela de Cóbano.

For that reason, there is a legitimate, current, and direct interest that fully justifies my participation as an active intervenor supporting the applicant.
The situation facing Escuela La Abuela de Cóbano is particularly serious because the principal persons affected are children, who constitute a particularly vulnerable group deserving of enhanced protection by the State.
In Article 51, our Constitución Política establishes special protection for minors. Likewise, the Convención sobre los Derechos del Niño recognizes every minor’s right to enjoy the highest attainable standard of health and requires States to adopt all measures necessary to guarantee their well-being and comprehensive development.
On this very subject, the Constitutional Chamber has stated:
“Minors are a particularly vulnerable group, entitled to special protection by the State, which requires a prompt institutional response for each minor, in their own environment and circumstances, as well as, specifically, particular promptness in the provision of health services.” (Resolution No. 05560-2019 of 09:15 on 29 March 2019).
The Constitutional Chamber also recalled in that same judgment that the Corte Interamericana de Derechos Humanos has stated:
“Children have the rights that belong to all human beings—minors and adults—and they also have special rights arising from their condition, to which correspond specific duties of the family, society, and the State.” It further added:
“Protecting children’s health requires various protective measures and is one of the fundamental pillars for guaranteeing that children enjoy a dignified life.” Constitutional jurisprudence is clear that, where minors are concerned, public institutions are required to act with enhanced diligence and particular promptness to guarantee the effective enjoyment of their fundamental rights. Accordingly, the persistence of a situation that prevents an educational center from having permanent access to sufficient, safe, and high-quality drinking water is a particularly serious omission, because it affects a group entitled to special constitutional protection and directly compromises its health, education, dignity, and comprehensive development.
These considerations are especially relevant in this case. The lack of permanent access to safe drinking water directly affects the minimum conditions for the health, hygiene, and development of our school’s students. The inability to ensure that children can hydrate adequately, wash their hands, use restrooms in sanitary conditions, or consume water whose potability is fully assured constitutes a real threat to their fundamental rights.
It is particularly troubling that students must attend an educational center every day without certainty that they will have a stable and safe supply of drinking water, exposing them to risks that no child should face in an environment intended precisely for their protection and comprehensive development.
Because minors are involved, State institutions are called upon to act with enhanced diligence and with the greatest possible speed, adopting the measures necessary to guarantee immediate and definitive access to drinking water for the educational community of Escuela La Abuela de Cóbano.
REQUEST FOR RELIEF For the reasons stated, I respectfully request that this Honorable Chamber:
1. Deem us to have appeared in this case file as ACTIVE INTERVENORS supporting the applicant.
2. In due course, grant the amparo and adopt the measures necessary to effectively guarantee sufficient, continuous, and safe access to drinking water for the inhabitants of the Comunidad de La Abuela de Cóbano.”
Drafted by Justice Garro Vargas; and, Reasons:
I.Subject of the amparo. The applicant alleges that she lives in Florida de Cóbano and that, for more than six months, a technical report and administrative opinion she requested from the Instituto Costarricense de Acueductos y Alcantarillados have been pending resolution. They relate to the problem of access to drinking water in the communities of La Abuela and Florida, in Cóbano de Puntarenas. She claims that the respondent institution has not issued a definitive response or conclusive technical opinion, thereby committing a prolonged and unjustified omission contrary to the principles of efficiency, promptness, and sound public administration. She states that the situation directly affects more than one hundred people living in the community, including vulnerable populations such as older adults, minors, persons with disabilities, and pregnant women. She maintains that the lack of adequate access to drinking water also affects public educational centers in the area, compromising basic sanitary and hygienic conditions and the operation of educational services.
She alleges that the respondent’s administrative omission violates the right of access to drinking water and leaves the population socially, medically, and humanly vulnerable, without an effective technical or administrative solution. She states that the absence of an ASADA or formal water supply system aggravates the situation, preventing regular, continuous, and safe access to that resource, which is indispensable to life and the exercise of other fundamental rights. She mentions that students at Escuela la Florida de Cóbano and Escuela de la Abuela must attend classes without drinking water. She alleges that more than 100 inhabitants of hamlets in la abuela de Cóbano obtain water from hand-dug wells, which is not potable. She requests the intervention of this Chamber.
II.Active interventions submitted. Intervention is a form of accessory participation that occurs when a person joins a proceeding in support of the claims of one of the principal parties. Accordingly, anyone with a direct interest in the outcome of the amparo has standing to participate as an intervenor. However, because the intervenor is not a principal applicant, the intervenor will not be directly affected by the judgment; that is, its effects cannot reach the intervenor directly and immediately, nor does the ruling’s res judicata effect apply to the intervenor. Nevertheless, in amparo matters the intervenor may benefit from the effects of the ruling because the jurisprudence and precedents of the constitutional jurisdiction have “erga omnes” effect (Article 13 of the Ley de la Jurisdicción Constitucional).
In this case, by submissions added to the digital case file on 22 June and 03 July 2026, Berta Fernández Cordero, Nombre02, and Nombre03—the latter in her capacity as director of Escuela La Abuela de Cóbano—asked to be recognized as active intervenors supporting the applicant. The Chamber admits the interventions submitted, pursuant to Article 34 of the Ley de la Jurisdicción Constitucional, because they claim to have a legitimate and direct interest in the outcome of this proceeding, as inhabitants of the community whose situation is reported in the amparo and, in the case of the last appearing party, also by virtue of her representation of an educational center located in that community. Their participation, however, is accessory to the principal claim and therefore does not alter the subject of this constitutional proceeding or broaden the scope of the analysis to be carried out by this Chamber.
III.Facts established. The following facts are deemed duly established and relevant to the decision in this matter:

Dear Madam:
In response to your request, we inform you that it is currently being processed. The corresponding technical report is being prepared by the Región Pacífico Central.
Once this stage is complete, the corresponding procedure will continue through to the final step, which consists of approval by this Institution’s Board of Directors.
We will notify you in due course of the progress and outcome of the procedure” (see documentary evidence submitted by the applicant).

Please remember the importance of responding within ten business days, pursuant to Article 32 of the Ley de la Jurisdicción Constitucional and Articles 27 and 30 of the Constitución Política, in order to prevent the possible filing of an amparo by third parties.
If the matter falls within the remit of another technical area, the General Management must assign it to the competent area for handling. However, any subsequent inquiry from the interested party must be handled directly by the General Management, in its capacity as the office responsible for the procedure and for managing any extensions that may be required” (see documentary evidence submitted by the applicant).
IV.The specific case. After analyzing the evidence submitted and the reports provided under oath by the respondent authorities, following due notice of the consequences set out in Article 44 of the Ley de la Jurisdicción Constitucional, the Chamber finds that the amparo should be denied for the following reasons.
First, the applicant maintains that the respondent authority failed to resolve the technical report and issue the administrative opinion she requested, thereby violating her right to petition and receive a prompt response. Although the case file contains official letters by which the Instituto Costarricense de Acueductos y Alcantarillados referred for handling the requests identified as SN-PE-2025-0305 and SN-PE-2025-0469, as well as the response issued by the Subgerencia de Gestión de Sistemas Periféricos, the applicant did not submit copies of the requests she says she filed. It is therefore impossible to know their precise content and scope or to verify whether the response provided by the Administration corresponded to what was requested.
Even so, the application itself shows that the applicant sought completion of the technical report and issuance of the corresponding administrative opinion. On that basis, no violation of the fundamental rights invoked is apparent. By official letter No. SG-GSP-2025-00857 of 10 September 2025, the respondent authority expressly stated that the matter was being processed, that the technical report was being prepared by the Región Pacífico Central, and that, once this stage was complete, the procedure would continue until it was eventually considered by the institution’s Board of Directors. It follows that what was requested was a technical or legal opinion. With respect to such requests, this Tribunal has held that, in these cases, the Administration’s failure to respond does not violate the rights protected by Articles 27 and 30 of the Constitución Política, since the request does not fall within the scope of a simple request for information or access to administrative information.
Second, the applicant alleges that the respondent institution violates the fundamental right of access to drinking water by failing to adopt a definitive solution for the communities of La Abuela and La Florida. However, the established facts show that the actual object of her claim is neither to report the suspension, denial, or deficient provision of an existing public service, nor a delay in deciding a specific application to access an already available formal supply system. Rather, in connection with the alleged failure to resolve the technical report and issue the administrative opinion, she seeks an order from this Chamber requiring the Instituto Costarricense de Acueductos y Alcantarillados to adopt a definitive solution to provide those communities with a formal drinking water supply system.
However, the sworn reports and evidence added to the case file show that the situation extends beyond issuing a simple administrative opinion. The Instituto Costarricense de Acueductos y Alcantarillados established that the communities of La Abuela and La Florida are supplied by unauthorized operators, and that it therefore began the relevant institutional procedure in 2025 to assess possible formal provision of the service. As part of that process, it conducted field inspections, collected technical information, characterized existing systems, assessed water sources, analyzed available infrastructure and the legal status of the land, and considered the various technically feasible alternatives for addressing the problem. The technical reports added to the case file also show that a definitive solution requires development of an integrated infrastructure project requiring an investment of several hundred million colones. This demonstrates that the matter does not involve a simple administrative action capable of immediate execution, but rather a process of planning, design, and construction of public works requiring specialized studies, selection of the most suitable technical alternative, budget availability, and institutional scheduling.
Although access to drinking water is a fundamental human right, that does not, in principle, mean that the summary procedure of amparo may be used to order the Administration to create infrastructure or immediately implement a service where none exists, thereby substituting the competent authority in decisions involving technical assessments, available resources, institutional planning, and public works. Constitutional protection is intended to restore the effective enjoyment of fundamental rights in the face of arbitrary or illegitimate acts or omissions by the Administration. In principle, however, it is not the mechanism for requiring expansion of public service coverage in places where those services have not yet been implemented.
This does not disregard the constitutional significance of the human right to drinking water or relieve the Administration of its obligations to work toward its realization. It means only that, in the circumstances established in this matter, no illegitimate act or omission has been shown that would authorize this Chamber to order, through amparo, the execution of an infrastructure project intended to create a formal supply system, particularly when the respondent authority has established that technical and administrative measures to determine the appropriate solution are ongoing.
In these circumstances, the amparo must be denied, as is hereby ordered.
V.Note of Justice Cruz Castro. Article 21 of the Constitución Política protects human life, and this Tribunal has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution requires the State to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the Pacto Internacional de Derechos Económicos, Sociales y Culturales—interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures for its full realization. A social and democratic state governed by the rule of law is subject to an enhanced obligation; for this reason, the supply of water is a priority obligation of public authorities.
From this perspective, invoking technical limitations cannot serve as an absolute justification for neglecting a basic need for subsistence. The Administration cannot merely note the system’s insufficiency; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to the water service, particularly when the water is for human consumption.
The majority approach normalizes a structural omission: it accepts that the lack of infrastructure releases the State from its obligation, when that very lack demonstrates a failure to meet its duty of foresight. This is not a matter of requiring the impossible, but of requiring the Administration to adopt reasonable, alternative, or progressive measures so as not to leave people unprotected.
Water is not just any service; it is an essential human right. Therefore, the respondent authority cannot shirk its duty to guarantee it by sheltering behind technical limitations without offering effective solutions.
VI.Documents submitted to the case file. The parties are advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the court office within a maximum of thirty business days from notification of this judgment. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .
Recurso de amparo promovido por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
“[Q]ue es vecina de la Florida de Cóbano. Indica que, desde hace más de seis meses, se encuentra pendiente de resolución un informe técnico y criterio administrativo solicitado ante el Instituto Costarricense de Acueductos y Alcantarillados, relacionado con la problemática de acceso a agua potable en la comunidad de La Abuela y Florida, en Cóbano de Puntarenas. Reclama que la institución recurrida no ha emitido una respuesta definitiva ni criterio técnico concluyente, incurriendo en una omisión prolongada e injustificada contraria a los principios de eficiencia, celeridad y buena administración pública. Señala que la situación afecta directamente a más de cien personas residentes de la comunidad, incluyendo poblaciones vulnerables como personas adultas mayores, menores de edad, personas con discapacidad y mujeres embarazadas. Manifiesta que la falta de acceso adecuado al agua potable incide además en centros educativos públicos de la zona, comprometiendo condiciones básicas de salubridad, higiene y funcionamiento del servicio educativo.
Alega que la omisión administrativa de la accionada lesiona el derecho al acceso al agua potable y mantiene a la población en una condición de vulnerabilidad social, sanitaria y humana, sin que exista una solución técnica o administrativa efectiva. Refiere que la inexistencia de una ASADA o sistema formal de abastecimiento de agua agrava la situación, impidiendo el acceso regular, continuo y seguro a dicho recurso, indispensable para la vida y el ejercicio de otros derechos fundamentales. Menciona que los estudiantes de la Escuela la Florida de Cóbano y de la Escuela de la Abuela, deben asistir a clases sin agua potable. Aduce que más de 100 personas habitantes en caseríos en la abuela de Cóbano se abastecen de agua a través de pozos artesanales, la cual no es potable. Solicita la intervención de esta Sala”.
“[R]efiere al recurso de amparo interpuesto por la señora Nombre01, quien en resumen alega; “Que existe omisión Institucional en brindar respuesta a la problemática de abastecimiento de agua potable, en las comunidades de La Abuela y la Florida de Cóbano Puntarenas.”
Con fundamento en el oficio PRE-UTSAPS-2026-00207, suscrito por la Licda. Zaida Díaz González, Coordinadora de la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y Saneamiento (UTSAPS), así como en los informes técnicos denominados "Valoración técnica y comercial de operador no autorizado. Acueducto de La Abuela, Cóbano" e "Informe técnico y comercial de operador no autorizado. Acueducto de La Florida, Cóbano", los cuales se adjuntan como prueba y forman parte integral del expediente administrativo, queda demostrado que:
Las comunidades de La Abuela y La Florida de Cóbano reciben actualmente el servicio de abastecimiento de agua mediante sistemas operados por terceros que no forman parte de los sistemas formalmente administrados por el Instituto Costarricense de Acueductos y Alcantarillados, situación que fue identificada Institucionalmente dentro del procedimiento denominado "Prestación de los servicios a comunidades donde existe un operador no autorizado", razón por la cual la Institución inició desde el año 2025 una serie de actuaciones técnicas y administrativas dirigidas a valorar las condiciones de prestación del servicio en ambas comunidades, incluyendo inspecciones de campo, levantamiento de información técnica, caracterización de los sistemas existentes, análisis de infraestructura, situación legal de los terrenos y diversas alternativas para una eventual prestación formal del servicio de abastecimiento de agua potable por parte del AyA, valorando de alternativas de atención y estudios especializados orientados a determinar la solución más adecuada para garantizar una prestación formal y sostenible del servicio.
(ver PRE-UTSAPS-2026-00207 Valoración técnica La Abuela y la Florida) Como parte de ese proceso, se determinó que los sistemas actualmente existentes presentan limitaciones técnicas y operativas que impiden considerarlos como soluciones sostenibles e independientes a largo plazo, razón por la cual la Administración ha venido analizando distintas alternativas de atención para la zona, incluyendo soluciones de carácter integral que permitan atender conjuntamente las necesidades de las comunidades involucradas. Asimismo, consta en el expediente administrativo que la situación planteada por la recurrente ha sido objeto de seguimiento Institucional permanente, habiéndose emitido informes técnicos, solicitado ampliaciones y ajustes a dichos estudios y continuando actualmente el análisis de las alternativas técnicamente viables para la atención definitiva de la problemática identificada, lo anterior ha sido notificado vía correo electrónico, remitiéndose información mediante oficio SG-GSP2025-00857 de fecha 10 de setiembre del 2025 y comunicaciones correspondientes, notificadas en fecha 14 de agosto del 2025.
(ver PRE-UTSAPS-2026-00207) Por consiguiente, no es de recibo afirmar la existencia de una omisión absoluta o una inactividad administrativa por parte del Instituto, toda vez que desde el año 2025 se han venido desarrollando actuaciones técnicas, administrativas y de planificación orientadas a identificar y definir una solución técnicamente viable para las comunidades involucradas; adicionalmente, es menester recalcar que, dichos sistemas de abastecimiento no son autorizados por el Instituto, no pertenecen a la zona de cobertura del AyA, sino que su abastecimiento a operado de manera irregular.
En respaldo de lo anteriormente señalado, es menester indicar lo que al respecto establece la Ley General de la Administración Pública, artículos 11 y 13 incisos 1, que en observancia al principio de legalidad disponen respectivamente:
“1. La Administración Pública actuará sometida al ordenamiento jurídico y sólo podrá realizar aquellos actos o prestar aquellos servicios públicos que autorice dicho ordenamiento, según la escala jerárquica de sus fuentes.
“1. La Administración estará sujeta, en general, a todas las normas escritas y no escritas del ordenamiento administrativo, y al derecho privado supletorio del mismo, sin poder derogarlos ni desaplicarlos para casos concretos.
En el presente caso, se constata que no se ha violentado ningún derecho Constitucional, ya que como ha quedado evidenciado en el oficio PRE-UTSAPS-2026-00207, así como en los informes técnicos denominados "Valoración técnica y comercial de operador no autorizado. Acueducto de La Abuela, Cóbano" e "Informe técnico y comercial de operador no autorizado. Acueducto de La Florida, Cóbano", los cuales forman parte integral del libelo que se presenta en este acto, ha quedado demostrado que las comunidades objeto del recurso son abastecidas mediante sistemas operados por terceros identificados Institucionalmente como operadores no autorizados, los cuales no forman parte de los sistemas formalmente administrados por el Instituto Costarricense de Acueductos y Alcantarillados. Asimismo, el Instituto ha desarrollado actuaciones continuas y sostenidas para atender la situación existente en las comunidades de La Abuela y La Florida de Cóbano activando de manera diligente y oportuna el procedimiento EST-04-03-P, donde realizó inspecciones de campo, elaboró fichas técnicas, emitió informes especializados, valoró distintas alternativas de solución y continúa desarrollando las actuaciones necesarias para determinar la alternativa definitiva de atención para dichas comunidades.
En consecuencia, las actuaciones desplegadas por el Instituto Costarricense de Acueductos y Alcantarillados se han ajustado al principio de legalidad y a las competencias que le han sido conferidas por el ordenamiento jurídico, razón por la cual no se configura lesión constitucional alguna atribuible a esta Institución, ni abandono de las gestiones planteadas, sino un procedimiento técnico complejo que se encuentra en desarrollo y que busca garantizar una solución integral, sostenible y conforme al ordenamiento jurídico vigente. Por ende, por parte del ICAA no se ha violentado ninguno de los derechos fundamentales de la recurrente.
IV PETITORIA Por lo antes expuesto sobre los hechos alegados mediante este Recurso de Amparo, queda demostrado que nuestras actuaciones han sido las correctas de conformidad con la normativa que nos rige, solicitamos se DECLARE SIN LUGAR el presente Recurso, se ordene archivar el expediente y se exima de toda responsabilidad al Instituto Costarricense de Acueductos y Alcantarillados”.
“I. EN CUANTO A LOS HECHOS ALEGADOS POR LA RECURRENTE Con fundamento en el oficio PRE-UTSAPS-2026-00207, suscrito por la Licda. Zaida Díaz González, Coordinadora de la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y Saneamiento (UTSAPS), así como en los informes técnicos denominados "Valoración técnica y comercial de operador no autorizado. Acueducto de La Abuela, Cóbano" e "Informe técnico y comercial de operador no autorizado. Acueducto de La Florida, Cóbano", los cuales se adjuntan como prueba y forman parte integral del expediente administrativo, queda demostrado que:

(ver PRE-UTSAPS-2026-00207 Valoración técnica La Abuela y la Florida) Como parte de ese proceso, se determinó que los sistemas actualmente existentes presentan limitaciones técnicas y operativas que impiden considerarlos como soluciones sostenibles e independientes a largo plazo, razón por la cual la Administración ha venido analizando distintas alternativas de atención para la zona, incluyendo soluciones de carácter integral que permitan atender conjuntamente las necesidades de las comunidades involucradas. Asimismo, consta en el expediente administrativo que la situación planteada por la recurrente ha sido objeto de seguimiento Institucional permanente, habiéndose emitido informes técnicos, solicitado ampliaciones y ajustes a dichos estudios y continuando actualmente el análisis de las alternativas técnicamente viables para la atención definitiva de la problemática identificada, lo anterior ha sido notificado vía correo electrónico, remitiéndose información mediante oficio SG-GSP2025-00857 de fecha 10 de setiembre del 2025 y comunicaciones correspondientes, notificadas en fecha 14 de agosto del 2025.

Acueducto de La Florida, Cóbano", los cuales forman parte integral del libelo que se presenta en este acto, ha quedado demostrado que las comunidades objeto del recurso son abastecidas mediante sistemas operados por terceros identificados Institucionalmente como operadores no autorizados, los cuales no forman parte de los sistemas formalmente administrados por el Instituto Costarricense de Acueductos y Alcantarillados. Asimismo, el Instituto ha desarrollado actuaciones continuas y sostenidas para atender la situación existente en las comunidades de La Abuela y La Florida de Cóbano activando de manera diligente y oportuna el procedimiento EST-04-03-P, donde realizó inspecciones de campo, elaboró fichas técnicas, emitió informes especializados, valoró distintas alternativas de solución y continúa desarrollando las actuaciones necesarias para determinar la alternativa definitiva de atención para dichas comunidades.
En consecuencia, las actuaciones desplegadas por el Instituto Costarricense de Acueductos y Alcantarillados se han ajustado al principio de legalidad y a las competencias que le han sido conferidas por el ordenamiento jurídico, razón por la cual no se configura lesión constitucional alguna atribuible a esta Institución, ni abandono de las gestiones planteadas, sino un procedimiento técnico complejo que se encuentra en desarrollo y que busca garantizar una solución integral, sostenible y conforme al ordenamiento jurídico vigente. Por ende, por parte del ICAA no se ha violentado ninguno de los derechos fundamentales de la recurrente.
Por lo antes expuesto sobre los hechos alegados mediante este Recurso de Amparo, queda demostrado que nuestras actuaciones han sido las correctas de conformidad con la normativa que nos rige, solicitamos se DECLARE SIN LUGAR el presente Recurso, se ordene archivar el expediente y se exima de toda responsabilidad al Instituto Costarricense de Acueductos y Alcantarillados”.
“I. MANIFESTACIÓN SOBRE EL INFORME RENDIDO POR LA AUTORIDAD RECURRIDA Y AMPLIACIÓN DE ALEGATOS Luego de conocer el informe rendido por el Instituto Costarricense de Acueductos y Alcantarillados (AyA), así como la documentación técnica aportada por dicha institución, esta parte considera necesario formular las siguientes observaciones.
En primer término, debo indicar que la respuesta brindada por el AyA confirma que la problemática denunciada en este recurso no solamente existe, sino que es plenamente conocida por la institución recurrida desde hace varios años. Los informes técnicos incorporados al expediente demuestran que el propio AyA ha realizado inspecciones de campo, levantamientos de información, estudios de capacidad hídrica, donde se ha evidenciado que, a pesar de la actividad administrativa desplegada, el problema de fondo continúa sin resolverse y que las comunidades afectadas siguen careciendo de una solución efectiva, permanente y segura para el abastecimiento de agua potable.
La prueba aportada por la propia administración recurrida acredita que los sistemas actualmente existentes operan mediante figuras no autorizadas, presentan importantes limitaciones técnicas, carecen de infraestructura adecuada, no poseen la estructura suficiente para abastecer adecuadamente a la población actual y futura, y continúan dependiendo de soluciones precarias que no satisfacen los estándares mínimos exigidos para garantizar el derecho humano al agua potable.
Particularmente grave resulta que el propio AyA reconoce expresamente que en la comunidad de La Abuela no existe un sistema de cloración y que el agua se distribuye directamente desde el pozo, llegando incluso a concluir en su informe técnico que el agua es consumida de forma cruda, sin un proceso integral de potabilización.
Por consiguiente, el debate constitucional que hoy se presenta ante esta Sala trasciende la simple existencia de gestiones administrativas o respuestas formales. La cuestión de fondo consiste en determinar si el Estado costarricense está garantizando efectivamente el derecho humano al agua potable de las comunidades de La Florida y La Abuela.
Como bien conoce ese Honorable Tribunal, el ordenamiento jurídico costarricense ya había atribuido al Instituto Costarricense de Acueductos y Alcantarillados una responsabilidad directa en la garantía del abastecimiento de agua potable a la población.
En efecto, el artículo 2 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados establece que corresponde a dicha institución "dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de agua potable" y, además, "construir, ampliar y reformar los sistemas de acueductos y alcantarillados en aquellos casos en que sea necesario y así lo aconseje la mejor satisfacción de las necesidades nacionales". Se trata, por tanto, de una competencia legal expresa que impone al AyA no solo facultades de estudio o supervisión, sino el deber efectivo de adoptar las acciones necesarias para garantizar el acceso de la población a un servicio adecuado de agua potable.
Precisamente por ello, cuando la propia institución reconoce la existencia de comunidades abastecidas mediante operadores no autorizados, sistemas técnicamente insuficientes, ausencia de potabilización y déficit hídrico, surge el deber jurídico-administrativo de impulsar y ejecutar las obras, procedimientos y actuaciones necesarias para superar definitivamente esa situación, en cumplimiento de las competencias que el legislador le ha confiado.
En esta misma línea, recordemos que mediante Ley N.°9849 del 5 de junio de 2020 se reformó el artículo 50 de la Constitución Política para reconocer expresamente que:
“ Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. (...) tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones.” Esta disposición constitucional elevó a rango supremo una garantía que ya había sido reconocida reiteradamente por la jurisprudencia constitucional como una manifestación directa de los derechos fundamentales a la vida, la salud, la dignidad humana y el ambiente sano.
En la sentencia número 2013-7302 de las 9:05 horas del 31 de mayo de 2013, esa Sala reiteró que el acceso al agua potable constituye un derecho humano fundamental y recordó que El Estado tiene la obligación de garantizar a todas las personas el acceso a agua suficiente, físicamente accesible, segura y apta para el consumo humano. Asimismo, indicó expresamente que las limitaciones económicas, administrativas o presupuestarias no constituyen una justificación válida para incumplir los deberes estatales relacionados con la prestación de este servicio público esencial.
Expresamente, en dicha sentencia constitucional el Dr. Jinesta Lobo señaló:
“IV.- DERECHO FUNDAMENTAL AL BUEN FUNCIONAMIENTO DE LOS SERVICIOS PÚBLICOS. Nuestra Constitución Política recoge implícitamente el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Esta última obligación se desprende de la relación sistemática de varios preceptos constitucionales, tales como el artículo 140, inciso 8), el cual le impone al Poder Ejecutivo el deber de vigilar el buen funcionamiento de los servicios y dependencias administrativas; el artículo 139, inciso 4), en cuanto incorpora el concepto de la buena marcha del Gobierno; y el artículo 191, en la medida que incorpora el principio de eficiencia de la administración.
Esa garantía individual atípica o innominada se acentúa tratándose de servicios públicos esenciales como el abastecimiento de agua potable." En el presente asunto, la propia prueba aportada por la autoridad recurrida evidencia que, pese al conocimiento institucional de la problemática y a la realización de diversos estudios técnicos, las comunidades de La Florida y La Abuela continúan sin acceso garantizado a un sistema de abastecimiento de agua potable que reúna las condiciones de continuidad, seguridad, calidad y sostenibilidad exigidas por la Constitución Política y la jurisprudencia de esta Sala. Por ello, la lesión constitucional denunciada permanece vigente.
Precisamente a la luz de dicha jurisprudencia, la situación acreditada en el presente expediente evidencia una lesión constitucional actual y continua. Más allá de los informes técnicos, memorandos, estudios y valoraciones que constan en el expediente, esta Sala no puede perder de vista la realidad humana que subyace detrás del presente recurso.
Detrás de cada cuadro técnico y cada análisis administrativo existen familias, personas adultas mayores, niños, mujeres y personas con padecimientos de salud que diariamente dependen de sistemas precarios de abastecimiento para satisfacer una necesidad tan elemental como disponer de agua segura para beber, cocinar, asearse y preservar su salud.
Se trata de comunidades que, pese al pleno conocimiento institucional de la problemática y a los múltiples estudios realizados durante años, continúan expuestas a consumir agua sin adecuados procesos de potabilización y a vivir bajo una incertidumbre permanente respecto de un recurso indispensable para la vida. Esa realidad resulta difícilmente conciliable con el mandato constitucional que reconoce el acceso al agua potable como un derecho humano básico e irrenunciable y con el deber estatal de garantizar una prestación efectiva de los servicios públicos esenciales.
Desde una interpretación preventiva de los derechos fundamentales y conforme al principio pro homine, debe preferirse la solución que otorgue la mayor protección posible al derecho humano comprometido.
Ello obliga a adoptar medidas oportunas antes de que se materialicen daños irreparables a la salud, especialmente cuando se trata de poblaciones vulnerables integradas por personas adultas mayores, niños, mujeres embarazadas y personas con padecimientos de salud, como ocurre en las comunidades involucradas en este proceso.
La tutela constitucional efectiva no puede agotarse en la constatación de que existen estudios en trámite o alternativas en análisis. El derecho humano al agua potable exige resultados materiales concretos que permitan a las personas acceder a agua segura, suficiente, continua y de calidad.
PETITORIA Con fundamento en lo expuesto, nuevamente solicito a esta Honorable Sala:
1. Declarar CON LUGAR el presente recurso de amparo por violación al derecho humano fundamental de acceso al agua potable consagrado en el artículo 50 de la Constitución Política.
2. Ordenar al Instituto Costarricense de Acueductos y Alcantarillados que, dentro de un plazo perentorio no mayor a 6 MESES, formule, apruebe y ejecute una solución definitiva para garantizar el abastecimiento de agua potable de dichas comunidades.
3. Ordenar al Instituto Costarricense de Acueductos y Alcantarillados informar una vez al mes a este Tribunal Constitucional de todas las actuaciones administrativas, técnicas, financieras, presupuestarias, registrales, expropiatorias, de adquisición de bienes, constitución de servidumbres, contratación administrativa, construcción de infraestructura, coordinación interinstitucional y cualquier otra gestión necesaria para garantizar de manera permanente y definitiva el acceso efectivo al agua potable para la totalidad de la población afectada”.
“1. APERSONAMIENTO Con fundamento en el artículo 34 de la Ley de la Jurisdicción Constitucional, me apersono al presente recurso de amparo en calidad de COADYUVANTE ACTIVA de la parte recurrente, por ostentar un interés legítimo, actual y directo en el resultado de este proceso constitucional, tanto en mi condición de habitante de la comunidad como en representación de las personas adultas mayores de la Comunidad de La Abuela de Cóbano, quienes constituyen una población especialmente vulnerable frente a las consecuencias derivadas de la falta de acceso al agua potable.
Las personas adultas mayores de la Comunidad de La Abuela de Cóbano enfrentamos desde hace años una situación de profunda vulnerabilidad como consecuencia de la falta de acceso permanente a un suministro suficiente y seguro de agua potable.
Para quienes hemos dedicado nuestra vida al desarrollo de esta comunidad, el acceso al agua no constituye simplemente la prestación de un servicio público. Se trata de un elemento indispensable para la preservación de la vida, la salud, la higiene y la dignidad humana. La imposibilidad de contar con agua de forma continua afecta directamente actividades básicas y cotidianas, tales como la preparación de alimentos, el consumo diario de agua, el aseo personal, el lavado de ropa y la limpieza de las viviendas.
Actualmente, gran parte de la población depende de un sistema de abastecimiento insuficiente que no logra cubrir las necesidades de todos los habitantes, provocando interrupciones frecuentes en el suministro, particularmente durante la época seca. Esta situación obliga a muchas personas adultas mayores a almacenar agua en condiciones precarias, depender de familiares o vecinos para obtenerla o, incluso, limitar su consumo para poder sobrellevar los periodos de desabastecimiento.
La problemática adquiere una dimensión aún más grave tratándose de personas adultas mayores, muchas de las cuales padecen enfermedades crónicas, requieren la ingesta permanente de medicamentos o presentan limitaciones físicas y de movilidad. La falta de agua dificulta mantener las condiciones mínimas de higiene necesarias para prevenir enfermedades, limita la adecuada preparación de alimentos, compromete la correcta administración de medicamentos y aumenta el riesgo de padecimientos gastrointestinales, infecciones y otras complicaciones de salud.
Asimismo, muchas personas adultas mayores viven solas o dependen de terceros para realizar actividades cotidianas. La necesidad de trasladarse para conseguir agua, cargar recipientes o recurrir a fuentes alternativas de abastecimiento representa una carga física y emocional que afecta significativamente su bienestar y su calidad de vida, lesionando su autonomía y su derecho a una vejez digna.
La situación se agrava debido a que numerosas familias se han visto obligadas a depender de pozos artesanales para obtener agua. Durante la época lluviosa, dichos pozos son susceptibles de contaminación por infiltración de aguas superficiales, las cuales pueden contener materia fecal y otros agentes contaminantes, generando incertidumbre sobre la calidad del agua que consumimos y un fundado temor respecto de las consecuencias que ello puede tener sobre nuestra salud, especialmente tratándose de personas de edad avanzada, cuya condición física las hace particularmente vulnerables a enfermedades e infecciones.
Como representante de las personas adultas mayores de la Comunidad de La Abuela de Cóbano, me consta que la falta de acceso a agua potable no constituye una simple incomodidad o una afectación menor. Por el contrario, se trata de una situación que incide directamente sobre nuestra salud, nuestra autonomía, nuestras condiciones de vida y nuestra dignidad como personas.
Aunado a lo anterior, en lo personal he sufrido las consecuencias de esta problemática. En mi condición de adulta mayor, fui beneficiaria de un bono de vivienda otorgado por el Instituto Nacional de Vivienda y Urbanismo (INVU), el cual representaba la oportunidad de acceder a una vivienda digna y mejorar significativamente mis condiciones de vida.
Sin embargo, debido a la inexistencia de un abastecimiento adecuado de agua potable en la comunidad, la Municipalidad no aprobó el correspondiente permiso de construcción, circunstancia que finalmente provocó la pérdida del referido bono de vivienda.
Esta situación evidencia que la falta de acceso al agua potable trasciende la mera carencia de un servicio público, pues termina afectando otros derechos fundamentales estrechamente vinculados con la dignidad humana, tales como el derecho a una vivienda adecuada y el derecho de las personas adultas mayores a recibir una protección especial del Estado.
Para una persona adulta mayor, la pérdida de una oportunidad de acceder a una vivienda digna no constituye un simple perjuicio económico. Representa la frustración de una expectativa legítima de mejorar sus condiciones de vida y de contar con un hogar adecuado durante una etapa de la vida en la que las personas requieren mayores condiciones de seguridad, estabilidad y protección.
Mi caso particular demuestra de manera concreta y palpable las graves consecuencias que la ausencia de un servicio de agua potable suficiente y seguro genera en la población de la Comunidad de La Abuela de Cóbano y, especialmente, en las personas adultas mayores que nos encontramos en una condición de especial vulnerabilidad.
Después de haber contribuido durante toda nuestra vida al desarrollo de esta comunidad, resulta contrario a la dignidad humana que, en nuestra etapa de mayor vulnerabilidad, debamos enfrentar la incertidumbre de no contar con agua suficiente y segura para satisfacer nuestras necesidades más básicas.
Por ello, considero que la garantía del acceso efectivo al agua potable constituye una condición indispensable para el ejercicio de nuestros derechos fundamentales y para asegurar una vida digna a las personas adultas mayores de nuestra comunidad.
El articulo 34 de la Ley de la Jurisdicción Constitucional dispone expresamente:
"Además, quien tuviere un interés legítimo en el resultado del recurso podrá apersonarse e intervenir en él como coadyuvante del actor o del demandado." En el presente caso, el resultado de este recurso incide directamente sobre los derechos fundamentales de las personas adultas mayores que habitan en la Comunidad de La Abuela de Cóbano, particularmente el derecho al acceso al agua potable, a la salud, a la vida, a la dignidad humana y a una protección especial en razón de nuestra condición de vulnerabilidad.
Por tal motivo, existe un interés legítimo, actual y directo que justifica plenamente mi intervención como coadyuvante activa de la parte recurrente.
PETITORIA Por las razones expuestas, respetuosamente solicito a esta Honorable Sala:
1. Que se me tenga por apersonada dentro del presente expediente en condición de COADYUVANTE ACTIVA de la parte recurrente.
2. Que oportunamente se declare con lugar el recurso de amparo y se adopten las medidas necesarias para garantizar de manera efectiva el acceso suficiente, continuo y seguro al agua potable para las personas habitantes de la Comunidad de La Abuela de Cóbano”
“1. APERSONAMIENTO Con fundamento en el artículo 34 de la Ley de la Jurisdicción Constitucional, me apersono al presente recurso de amparo en calidad de COADYUVANTE ACTIVA de la parte recurrente, por ostentar un interés legítimo, actual y directo en el resultado de este proceso constitucional, tanto en mi condición de habitante de la comunidad como en representación de las personas adultas mayores de la Comunidad de La Abuela de Cóbano, quienes constituyen una población especialmente vulnerable frente a las consecuencias derivadas de la falta de acceso al agua potable.
La Comunidad de La Abuela de Cóbano se encuentra seriamente afectada por la falta de acceso a un suministro suficiente, continuo y seguro de agua potable. Actualmente, una parte importante de la población depende de un operador no autorizado, cuya capacidad resulta insuficiente para abastecer adecuadamente a los habitantes de la zona.
Durante la época seca, numerosas familias enfrentan una grave escasez de agua que les impide satisfacer necesidades básicas y esenciales, tales como el consumo humano, la preparación de alimentos, la higiene personal, el lavado de ropa y el adecuado funcionamiento de los servicios sanitarios. Esta situación obliga a muchas personas a modificar sus rutinas diarias, almacenar agua en condiciones precarias o desplazarse a otros lugares para obtener el recurso hídrico necesario para su subsistencia.
Ante esta situación, muchos vecinos se han visto obligados a depender de pozos artesanales para obtener agua. No obstante, durante la época lluviosa dichos pozos son particularmente vulnerables a la contaminación por infiltración de aguas superficiales, las cuales pueden contener materia fecal y otros agentes contaminantes, provocando que el agua se enturbie y generando una seria preocupación por los riesgos que ello representa para la salud de la población.
Como Presidenta del Comité de la Comunidad de La Abuela de Cóbano, me consta que esta problemática afecta de manera particularmente grave a las personas adultas mayores de nuestra comunidad. Muchas de ellas viven solas, padecen enfermedades crónicas o tienen limitaciones físicas que les dificultan trasladarse para conseguir agua, cargar recipientes o implementar medidas alternativas de abastecimiento.
La falta de agua potable repercute directamente en su alimentación, en su higiene personal, en la limpieza de sus viviendas y, en muchos casos, en la adecuada administración de medicamentos y tratamientos médicos, incrementando el riesgo de enfermedades y deteriorando significativamente su calidad de vida.
Asimismo, la situación impacta severamente a niños, niñas y familias en condición de vulnerabilidad, quienes requieren un acceso permanente a agua potable segura para garantizar su salud, su desarrollo y una vida digna. La carencia de un suministro adecuado de agua trasciende una mera incomodidad cotidiana; constituye una afectación directa a derechos fundamentales estrechamente vinculados con la vida, la salud, la dignidad humana y el bienestar de toda la comunidad.
Por ello, el presente recurso de amparo reviste una especial importancia para los habitantes de la Comunidad de La Abuela de Cóbano, pues la tutela que eventualmente otorgue esta Honorable Sala incidirá directamente en las condiciones de vida, salud y desarrollo de cientos de personas que, desde hace años, enfrentan una situación de vulnerabilidad derivada de la falta de acceso efectivo al agua potable.
El artículo 34 de la Ley de la Jurisdicción Constitucional dispone expresamente:
“Además, quien tuviere un interés legítimo en el resultado del recurso podrá apersonarse e intervenir en él como coadyuvante del actor o del demandado.” En el presente caso, el resultado de este recurso incide directamente sobre los derechos fundamentales de las personas que habitan en la Comunidad de La Abuela de Cóbano, particularmente el derecho de acceso al agua potable, a la salud, a la vida y a un ambiente sano y ecológicamente equilibrado.
Por tal motivo, existe un interés legítimo, actual y directo que justifica plenamente mi intervención como coadyuvante activa de la parte recurrente, con el propósito de aportar a esta Sala la realidad que enfrenta nuestra comunidad y la urgente necesidad de que se adopten medidas efectivas para garantizar el acceso al agua potable.
PETITORIA Por las razones expuestas, respetuosamente solicito a esta Honorable Sala:
1. Que se me tenga por apersonada dentro del presente expediente en condición de COADYUVANTE ACTIVA de la parte recurrente.
2. Que oportunamente se declare con lugar el recurso de amparo y se adopten las medidas necesarias para garantizar de manera efectiva el acceso suficiente, continuo y seguro al agua potable para las personas habitantes de la Comunidad de La Abuela de Cóbano”.
“[E]n mi condición de directora de la Escuela La Abuela de Cóbano, comparecemos respetuosamente ante esta Honorable Sala Constitucional para manifestar nuestro apoyo al presente recurso de amparo y, al mismo tiempo, exponer la delicada situación que enfrentan nuestros estudiantes, docentes y toda la comunidad educativa debido a la falta de acceso permanente a agua potable segura, suficiente y de calidad.
Con fundamento en el artículo 34 de la Ley de la Jurisdicción Constitucional, nos apersonamos al presente recurso de amparo en calidad de coadyuvantes activos de la parte recurrente, por ostentar un interés legítimo, actual y directo en el resultado de este proceso constitucional, en mi condición de representante de la Escuela La Abuela de Cóbano, institución encargada de velar por las condiciones necesarias para garantizar el adecuado funcionamiento del centro educativo y la protección integral de las personas menores de edad que diariamente asisten a dicho centro de enseñanza.
La Escuela La Abuela de Cóbano atiende a una población estudiantil de 58 estudiantes que depende de la existencia de servicios básicos adecuados para poder ejercer efectivamente sus derechos a la educación, la salud, la alimentación y la dignidad humana. En consecuencia, la falta de acceso permanente a agua potable suficiente, segura y de calidad afecta de manera directa e inmediata el funcionamiento de la institución educativa y, particularmente, el bienestar y desarrollo integral de nuestros estudiantes.
Por tratarse de una comunidad educativa integrada principalmente por niños y niñas, la situación denunciada en este recurso reviste una especial gravedad, pues las personas menores de edad constituyen un grupo especialmente vulnerable y merecedor de una protección reforzada por parte del Estado, conforme a lo dispuesto en el artículo 51 de la Constitución Política, la Convención sobre los Derechos del Niño y la reiterada jurisprudencia de esta Sala Constitucional.
La situación que vive nuestra escuela trasciende la simple ausencia de un servicio público. La falta de agua afecta diariamente la salud, la educación, la dignidad y el bienestar de decenas de niños y niñas que tienen derecho a recibir sus lecciones en condiciones adecuadas y seguras. El agua es un elemento indispensable para el desarrollo de cualquier centro educativo y su ausencia genera consecuencias que repercuten directamente en el proceso de aprendizaje y en el ejercicio de múltiples derechos fundamentales de las personas menores de edad.
Nuestra comunidad educativa ha tenido que convivir durante años con un servicio irregular, insuficiente y con constantes interrupciones. En diversas ocasiones hemos enfrentado daños en las tuberías, disminuciones considerables en el abastecimiento y situaciones que impiden tener certeza de que el agua que llega a nuestras instalaciones recibe el tratamiento necesario para garantizar su potabilidad.
Esta situación genera una profunda preocupación, de los docentes, pues diariamente se nos confía el cuidado de niños y niñas que, por su propia condición de personas menores de edad, requieren una especial protección por parte del Estado.
La falta de agua afecta de manera directa la salud de los estudiantes. Los niños necesitan hidratarse adecuadamente durante la jornada escolar, especialmente en una zona de altas temperaturas como la nuestra. Muchos de ellos permanecen varias horas en la escuela y realizan actividades físicas y recreativas que hacen indispensable el consumo constante de agua potable. No poder garantizarles un acceso permanente a agua segura representa un riesgo evidente para su bienestar y su salud.
Asimismo, la ausencia de un servicio de agua confiable impide mantener adecuadas condiciones de higiene. Los estudiantes deben poder lavarse las manos antes de consumir alimentos, después de utilizar los servicios sanitarios y luego de realizar actividades recreativas. Estas prácticas, que para muchas personas pueden parecer cotidianas, constituyen una de las principales herramientas de prevención de enfermedades gastrointestinales, infecciones y otras afecciones que afectan especialmente a la población infantil.
La falta de agua también dificulta la limpieza de las aulas, de los comedores y de los servicios sanitarios. Un centro educativo sin agua suficiente no puede garantizar condiciones mínimas de salubridad. Los baños no pueden mantenerse adecuadamente aseados, las áreas comunes no pueden ser limpiadas con la frecuencia necesaria y el riesgo de propagación de enfermedades aumenta considerablemente.
Debemos señalar además que la incertidumbre sobre la calidad del agua genera un temor permanente entre la comunidad educativa. Aunque, afortunadamente, hasta este momento no se han presentado casos de enfermedades graves asociadas al consumo del agua, ello no significa que el riesgo no exista. Por el contrario, nos encontramos en una situación de constante preocupación, pues no tenemos la tranquilidad de saber que nuestros niños y niñas consumen agua debidamente tratada y apta para el consumo humano.
La afectación a la educación de nuestros estudiantes también es evidente. Las interrupciones en el servicio de agua han obligado en diversas ocasiones a modificar horarios, reorganizar actividades e incluso valorar la necesidad de suspender determinadas labores para proteger a los estudiantes y garantizar su seguridad.
Cada vez que falta el agua se altera el normal funcionamiento de la escuela. Las lecciones se ven interrumpidas, los docentes deben dedicar tiempo a resolver situaciones de emergencia y los estudiantes pierden horas valiosas de aprendizaje. En ocasiones, la atención se centra más en cómo enfrentar la escasez de agua que en el propio proceso educativo.
Particularmente grave resulta la situación durante la época de verano. En esos meses la disponibilidad del recurso hídrico disminuye considerablemente y la comunidad vive con la incertidumbre de no saber cuándo volverá a presentarse una interrupción en el suministro. La escasez obliga a adoptar medidas extraordinarias para continuar operando y coloca a la escuela en una situación de permanente vulnerabilidad.
La afectación que sufren nuestros estudiantes va mucho más allá de la simple incomodidad que genera la interrupción de un servicio público. La falta de agua incide directamente en actividades cotidianas indispensables para el desarrollo integral de las personas menores de edad. Cuando el agua escasea o existe incertidumbre sobre su calidad, los niños no pueden hidratarse adecuadamente, se dificulta el lavado de manos, se compromete la limpieza de los servicios sanitarios y se genera preocupación en las familias respecto de las condiciones en las que sus hijos permanecen durante la jornada escolar.
Asimismo, la falta de un abastecimiento estable y seguro afecta la prestación del servicio de comedor estudiantil. La preparación de alimentos, el lavado de utensilios y la adecuada higiene de las áreas de alimentación dependen de la disponibilidad permanente de agua potable. La imposibilidad de garantizar estas condiciones repercute directamente en el derecho de los menores a recibir su alimentación en condiciones de salubridad y seguridad.
Ningún niño o niña debería tener que asistir a clases con la incertidumbre de si podrá beber agua de manera segura, utilizar un servicio sanitario en condiciones adecuadas de higiene o recibir sus alimentos bajo condiciones mínimas de salubridad. Permitir que esta situación se prolongue en el tiempo implica desconocer la especial protección que nuestro ordenamiento jurídico reconoce a las personas menores de edad y compromete seriamente el ejercicio de sus derechos fundamentales.
Debemos recordar que el acceso al agua potable constituye un derecho humano fundamental, estrechamente vinculado con los derechos a la vida, a la salud, a la educación, a la dignidad humana y al interés superior de la persona menor de edad. Las instituciones del Estado tienen el deber ineludible de garantizar que los niños y niñas reciban su educación en condiciones adecuadas y cuenten con acceso permanente a un recurso tan indispensable para su desarrollo integral.
Resulta incompatible con el orden constitucional que, en pleno siglo XXI, una comunidad educativa deba enfrentar diariamente la incertidumbre de no contar con agua potable suficiente, segura y continua para atender las necesidades básicas de sus estudiantes.
Por ello, acudimos ante esta Honorable Sala Constitucional para solicitar que se tomen en consideración las especiales condiciones de vulnerabilidad de la población estudiantil de la Escuela La Abuela de Cóbano y se ordenen las medidas necesarias para que el Instituto Costarricense de Acueductos y Alcantarillados adopte las acciones urgentes y definitivas que permitan garantizar un abastecimiento permanente, suficiente y seguro de agua potable para nuestra escuela y para toda la comunidad.
La protección de nuestros niños y niñas no puede seguir postergándose. Cada día que transcurre sin una solución definitiva implica una afectación a su salud, a su educación y a su dignidad, así como una vulneración de los derechos fundamentales que nuestra Constitución y los instrumentos internacionales reconocen y protegen de manera especial.
Por tanto, respetuosamente nos adherimos en todos sus extremos al presente recurso de amparo y solicitamos que el mismo sea declarado con lugar, ordenándose a las autoridades recurridas adoptar las medidas necesarias para garantizar de forma inmediata y definitiva el acceso al agua potable de la comunidad educativa de la Escuela La Abuela de Cóbano.
El artículo 34 de la Ley de la Jurisdicción Constitucional dispone expresamente:
“Además, quien tuviere un interés legítimo en el resultado del recurso podrá apersonarse e intervenir en él como coadyuvante del actor o del demandado.” En el presente caso, el resultado de este recurso incide directamente sobre los derechos fundamentales de los menores de edad que habitan en la Comunidad de La Abuela de Cóbano, particularmente el derecho al acceso al agua potable, a la salud, a la vida, a la dignidad humana y a una protección especial en razón de nuestra condición de vulnerabilidad.
Por tal motivo, existe un interés legítimo, actual y directo que justifica plenamente mi intervención como coadyuvante activa de la parte recurrente.
La situación que enfrenta la Escuela La Abuela de Cóbano reviste una gravedad particular porque las principales personas afectadas son niños y niñas, quienes constituyen un grupo especialmente vulnerable y merecedor de una protección reforzada por parte del Estado.
Nuestra Constitución Política, en su artículo 51, establece una tutela especial en favor de las personas menores de edad. Asimismo, la Convención sobre los Derechos del Niño reconoce el derecho de toda persona menor de edad al disfrute del más alto nivel posible de salud y obliga a los Estados a adoptar todas las medidas necesarias para garantizar su bienestar y desarrollo integral.
Precisamente sobre este tema, la Sala Constitucional ha señalado:
“Las personas menores de edad son un grupo especialmente vulnerable, que ostenta una especial protección del Estado, lo cual requiere una ágil respuesta institucional para cada menor, en su entorno y circunstancias, así como, específicamente, la particular presteza de los servicios de salud.” (Resolución N.° 05560-2019 de las 09:15 horas del 29 de marzo de 2019).
Asimismo, la Sala recordó en esa misma sentencia que la Corte Interamericana de Derechos Humanos ha indicado que:
“Los niños poseen los derechos que corresponden a todos los seres humanos –menores y adultos– y tienen además derechos especiales derivados de su condición, a los que corresponden deberes específicos de la familia, la sociedad y el Estado.” Y agregó que:
“El cuidado de la salud de los niños supone diversas medidas de protección y constituye uno de los pilares fundamentales para garantizar el disfrute de una vida digna por parte de los niños.” La jurisprudencia constitucional es clara en cuanto a que, tratándose de personas menores de edad, las instituciones públicas se encuentran obligadas a actuar con una diligencia reforzada y con una especial presteza para garantizar el disfrute efectivo de sus derechos fundamentales. En consecuencia, la persistencia de una situación que impide a un centro educativo contar con acceso permanente a agua potable suficiente, segura y de calidad constituye una omisión particularmente grave, pues afecta a un grupo de especial protección constitucional y compromete directamente su salud, su educación, su dignidad y su desarrollo integral.
Estas consideraciones adquieren una relevancia especial en el presente caso. La falta de acceso permanente a agua potable segura afecta directamente las condiciones mínimas de salud, higiene y desarrollo de los estudiantes de nuestra escuela. La imposibilidad de garantizar que los niños puedan hidratarse adecuadamente, lavarse las manos, utilizar servicios sanitarios en condiciones de salubridad o consumir agua cuya potabilidad esté plenamente asegurada, constituye una amenaza real a sus derechos fundamentales.
Resulta particularmente preocupante que los estudiantes deban asistir diariamente a un centro educativo sin la certeza de contar con un suministro estable y seguro de agua potable, pues ello los expone a riesgos que ningún niño o niña debería enfrentar en un entorno destinado precisamente a su protección y desarrollo integral.
Por tratarse de personas menores de edad, las instituciones del Estado están llamadas a actuar con una diligencia reforzada y con la mayor celeridad posible, de manera que se adopten las medidas necesarias para garantizar, de forma inmediata y definitiva, el acceso al agua potable de la comunidad educativa de la Escuela La Abuela de Cóbano.
PETITORIA Por las razones expuestas, respetuosamente solicito a esta Honorable Sala:
1. Que se nos tenga por apersonados dentro del presente expediente en condición de COADYUVANTES ACTIVOS de la parte recurrente.
2. Que oportunamente se declare con lugar el recurso de amparo y se adopten las medidas necesarias para garantizar de manera efectiva el acceso suficiente, continuo y seguro al agua potable para las personas habitantes de la Comunidad de La Abuela de Cóbano”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. La recurrente alega que es vecina de la Florida de Cóbano y desde hace más de seis meses se encuentra pendiente de resolución un informe técnico y criterio administrativo solicitado ante el Instituto Costarricense de Acueductos y Alcantarillados, relacionado con la problemática de acceso a agua potable en la comunidad de La Abuela y Florida, en Cóbano de Puntarenas. Reclama que la institución recurrida no ha emitido una respuesta definitiva ni criterio técnico concluyente, incurriendo en una omisión prolongada e injustificada contraria a los principios de eficiencia, celeridad y buena administración pública. Señala que la situación afecta directamente a más de cien personas residentes de la comunidad, incluyendo poblaciones vulnerables como personas adultas mayores, menores de edad, personas con discapacidad y mujeres embarazadas. Manifiesta que la falta de acceso adecuado al agua potable incide además en centros educativos públicos de la zona, comprometiendo condiciones básicas de salubridad, higiene y funcionamiento del servicio educativo.
Alega que la omisión administrativa de la accionada lesiona el derecho al acceso al agua potable y mantiene a la población en una condición de vulnerabilidad social, sanitaria y humana, sin que exista una solución técnica o administrativa efectiva. Refiere que la inexistencia de una ASADA o sistema formal de abastecimiento de agua agrava la situación, impidiendo el acceso regular, continuo y seguro a dicho recurso, indispensable para la vida y el ejercicio de otros derechos fundamentales. Menciona que los estudiantes de la Escuela la Florida de Cóbano y de la Escuela de la Abuela, deben asistir a clases sin agua potable. Aduce que más de 100 personas habitantes en caseríos en la abuela de Cóbano se abastecen de agua a través de pozos artesanales, la cual no es potable. Solicita la intervención de esta Sala.
II.Sobre las coadyuvancias activas presentadas. La coadyuvancia es una forma de intervención adhesiva que se da cuando una persona actúa en un proceso adhiriéndose a las pretensiones de alguna de las partes principales, como consecuencia está legitimado para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso, pero al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de ésta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto, debido al carácter de "erga omnes" que tiene la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional).
En el presente caso, mediante escritos incorporados al expediente digital los días 22 de junio y 03 de julio de 2026, Berta Fernández Cordero, Nombre02 y Nombre03, esta última en su condición de directora de la Escuela La Abuela de Cóbano, solicitaron que se les tuviera como coadyuvantes activas de la parte recurrente. Al respecto, la Sala procede a admitir las coadyuvancias presentadas, en los términos del artículo 34 de la Ley de la Jurisdicción Constitucional, por cuanto aducen ostentar un interés legítimo y directo en el resultado de este proceso, al ser habitantes de la comunidad cuya situación se denuncia en el recurso y, en el caso de la última compareciente, además, por la representación que ejerce de un centro educativo ubicado en dicha comunidad. No obstante, su intervención tiene carácter accesorio respecto de la pretensión principal, por lo que no modifica el objeto del presente proceso constitucional ni amplía el ámbito del análisis que corresponde efectuar a esta Sala.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

Recordar la importancia de brindar una respuesta dentro del plazo de diez días hábiles, conforme a lo establecido en el artículo 32 de la Ley de la Jurisdicción Constitucional y en los artículos 27 y 30 de la Constitución Política, con el propósito de prevenir la eventual interposición de un recurso de amparo por parte de terceros” (véase prueba documental aportada por la parte recurrente).
“Asunto: Respuesta a documento SN-PE-2025-0305: Solicitud de continuidad y agilización del procedimiento EST-04-03-P y aplicación del procedimiento GNU-43-01, Comunidad La Abuela, Cóbano, Puntarenas.
Estimada señora:
En atención a su gestión, le informamos que el trámite se encuentra actualmente en proceso. El informe técnico respectivo está siendo elaborado por la Región Pacífico Central.
Una vez finalizada esta etapa, se continuará con el procedimiento correspondiente para llegar al paso final, que consiste en la aprobación por parte de la Junta Directiva de esta Institución.
Le estaremos comunicando oportunamente sobre el avance y resultado del trámite” (véase prueba documental aportada por la parte recurrente).
“ASUNTO: TRASLADO OFICIO SN-PE-2025-0469 Con instrucciones de la presidenta ejecutiva, Lourdes Sáurez Barboza y en atención al oficio No., SN-PE-2025-0469 suscrito por Nombre01 se traslada para la debida y oportuna atención. Se solicita a la Gerencia General dar respuesta directa al interesado a la dirección de correo ...01 En caso de requerir información adicional del tema comunicarse con el con el asesor de presidencia Henry/Adriana Cordero.
Recordar la importancia de brindar una respuesta dentro del plazo de diez días hábiles, conforme a lo establecido en el artículo 32 de la Ley de la Jurisdicción Constitucional y en los artículos 27 y 30 de la Constitución Política, con el propósito de prevenir la eventual interposición de un recurso de amparo por parte de terceros.
En caso de que el tema corresponda a otra área técnica, la Gerencia General deberá asignarlo al área competente para su atención; no obstante, cualquier consulta posterior del interesado deberá ser atendida directamente por la Gerencia, en su calidad de instancia responsable del trámite y de la gestión de las prórrogas que se requieran” (véase prueba documental aportada por la parte recurrente).
IV.Sobre el caso concreto. Después de analizar los elementos probatorios aportados y los informes rendidos bajo juramento por las autoridades recurridas, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, se estima que lo procedente es la desestimatoria del recurso por los siguientes motivos.
En primer término, la recurrente sostiene que la autoridad recurrida ha omitido resolver el informe técnico y emitir el criterio administrativo solicitado por ella, con lo cual estima lesionado su derecho de petición y pronta respuesta. Al respecto, si bien en el expediente constan los oficios mediante los cuales el Instituto Costarricense de Acueductos y Alcantarillados trasladó para su atención las gestiones identificadas con los números SN-PE-2025-0305 y SN-PE-2025-0469, así como la respuesta emitida por la Subgerencia de Gestión de Sistemas Periféricos, la recurrente no aportó copia de las solicitudes que afirma haber presentado, de modo que no es posible conocer con precisión su contenido y alcance, ni verificar la correspondencia entre lo peticionado y la respuesta brindada por la Administración.
Aun así, del propio escrito de interposición del recurso se desprende que la pretensión de la amparada consistía en obtener la conclusión del informe técnico y la emisión del criterio administrativo correspondiente. Bajo esa premisa, no se advierte una lesión a los derechos fundamentales invocados. En efecto, mediante oficio No. SG-GSP-2025-00857 del 10 de setiembre de 2025, la autoridad recurrida informó expresamente que el trámite se encontraba en proceso, que el informe técnico estaba siendo elaborado por la Región Pacífico Central y que, una vez concluida esa etapa, el procedimiento continuaría hasta su eventual conocimiento por la Junta Directiva de la institución. De esta forma, se desprende que lo solicitado es un criterio técnico o jurídico y tratándose de este tipo de solicitudes, este Tribunal ha indicado que, en estos casos la falta de respuesta de la administración no vulnera los derechos tutelados en los ordinales 27 y 30 de la Constitución Política, ya que lo requerido no puede encuadrarse en los supuestos de peticiones puras y simples de información o del acceso a la información administrativa.
En segundo lugar, la recurrente alega que la institución recurrida vulnera el derecho fundamental de acceso al agua potable al no haber adoptado una solución definitiva para las comunidades de La Abuela y La Florida. Sin embargo, el análisis de los hechos acreditados permite concluir que el objeto real de su pretensión no consiste en denunciar la suspensión, denegación o prestación deficiente de un servicio público existente, ni tampoco el retardo en resolver una solicitud concreta para acceder a un sistema formal de abastecimiento ya disponible. Lo que pretende es que, con ocasión de la supuesta omisión de resolver el informe técnico y emitir el criterio administrativo, esta Sala ordene al Instituto Costarricense de Acueductos y Alcantarillados adoptar una solución definitiva para dotar de un sistema formal de abastecimiento de agua potable a dichas comunidades.
No obstante, de los informes rendidos bajo juramento y de la prueba incorporada al expediente se desprende que la situación planteada trasciende la emisión de un simple criterio administrativo. En efecto, el Instituto Costarricense de Acueductos y Alcantarillados acreditó que las comunidades de La Abuela y La Florida son abastecidas mediante operadores no autorizados, razón por la cual en el 2025 inició el procedimiento institucional correspondiente para valorar la eventual prestación formal del servicio. Como parte de ese proceso se realizaron inspecciones de campo, levantamiento de información técnica, caracterización de los sistemas existentes, evaluación de las fuentes de abastecimiento, análisis de la infraestructura disponible, de la situación jurídica de los terrenos y de las distintas alternativas técnicamente viables para atender la problemática. Asimismo, los informes técnicos incorporados al expediente evidencian que la solución definitiva requiere el desarrollo de un proyecto integral de infraestructura, cuya inversión asciende a varios cientos de millones de colones, circunstancia que pone de manifiesto que no se está ante una actuación administrativa simple o de ejecución inmediata, sino frente a un proceso de planificación, diseño y ejecución de obra pública que demanda estudios especializados, definición de la alternativa técnicamente más adecuada, disponibilidad presupuestaria y programación institucional.
Si bien el acceso al agua potable constituye un derecho humano fundamental, ello no implica en principio que, mediante la vía sumaria del recurso de amparo se ordene a la Administración a la creación de infraestructura o la implementación inmediata de un servicio donde este no existe, sustituyendo a la autoridad competente en decisiones que involucran valoraciones técnicas, disponibilidad de recursos, planificación institucional y ejecución de obras públicas. La tutela constitucional está llamada a restablecer el goce efectivo de derechos fundamentales frente a actuaciones u omisiones arbitrarias o ilegítimas de la Administración, pero no constituye en principio el mecanismo para imponer la expansión de la cobertura de los servicios públicos en aquellos lugares donde aún no han sido implementados.
Lo anterior no supone desconocer la trascendencia constitucional del derecho humano al agua potable ni relevar a la Administración de las obligaciones que le corresponden para procurar su realización. Significa, únicamente, que en las circunstancias acreditadas en este asunto no se demuestra una actuación u omisión ilegítima que habilite a esta Sala para ordenar, por la vía del amparo, la ejecución de un proyecto de infraestructura destinado a crear un sistema formal de abastecimiento, máxime cuando la autoridad recurrida ha acreditado que mantiene en curso las actuaciones técnicas y administrativas dirigidas a determinar la solución que resulte procedente.
Bajo tal estado de las cosas, lo procedente es la desestimatoria del recurso como en efecto se dispone.
V.Nota del magistrado Cruz Castro. El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.
Desde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.
El enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.
El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.
VI.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. El magistrado Cruz Castro consigna nota.
