Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 4 August 2026.
Amparo proceeding filed under expediente number 26-026674-0007-CO by Nombre01, identity card number CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
Background 1. By a brief entered into the electronic expediente on 24 July 2026, the claimant filed an amparo proceeding against the Costa Rican Institute of Aqueducts and Sewers. The claimant states that, since November 2025, the respondent authority has charged an excessive amount for drinking water service, prompting the claimant to file the corresponding complaint; however, that complaint has not been resolved. The claimant alleges that on 23 July 2026, the respondent authority suspended the drinking water service for nonpayment, even though the claimant and her children are experiencing vomiting and diarrhea. The claimant further alleges that the omission is due to the disputed charges. The claimant seeks the Chamber’s intervention so that a payment arrangement may be allowed. For these reasons, the claimant considers her fundamental rights to have been violated.
2. Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily dismiss, on procedural or substantive grounds, at any time, including upon filing, any matter brought before it that is manifestly inadmissible, when it considers that there is sufficient evidence to dismiss it, or when it is simply a repetition or reproduction of an identical or similar prior matter that was dismissed.
Justice Castillo Víquez drafts the opinion; and, Reasons:
The claimant states that, since November 2025, the respondent authority has charged an excessive amount for drinking water service, prompting the claimant to file the corresponding complaint; however, that complaint has not been resolved. The claimant alleges that on 23 July 2026, the respondent authority suspended the drinking water service for nonpayment, even though the claimant and her children are experiencing vomiting and diarrhea. The claimant further alleges that the omission is due to the disputed charges. The claimant seeks the Chamber’s intervention so that a payment arrangement may be allowed. For these reasons, the claimant considers her fundamental rights to have been violated.
Having reviewed the claimant’s arguments, the Court points out that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a means of reviewing the legality of acts of the Public Administration or as a generic channel for other types of requests. For this reason, the claimant should bear in mind that this Chamber has held that the amount of a bill for drinking water service is not disputed in this forum. This is a matter of legality that must be raised before the same administrative authority and, eventually, in the ordinary courts. Among other rulings, in judgment No. 2018017559, issued at 10:10 a.m. on 23 October 2018, it stated:
“…The claimant complains about the high charges on her water service bills. She states that she is a single woman with limited resources and has observed that the amount payable shown on the water bill varies excessively, since the supply serves only a few people and the amount charged is unjustified. She explains that staff of the respondent administration have already come to inspect, but have offered no solutions. However, this Chamber is not a body that reviews the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, in accordance with the applicable law, whether there is a leak on the property, to determine the source of the charge, or to establish the correct amount payable for the service received, since that is a matter for the ordinary administrative and judicial avenues. Accordingly, if the claimant considers it appropriate, she may raise her objection or complaint with the same respondent authority or before the competent court, where she may fully discuss the merits of the matter and assert her claims. In view of the foregoing, this amparo proceeding is inadmissible, and so it is declared…”. (emphasis added) These considerations apply to the case under review, since this Court finds no reason to depart from the position stated in those judgments, nor any grounds to assess the situation presented differently.
Accordingly, it is not for this jurisdiction to intervene on behalf of the amparo claimant before the respondent authorities in order to determine, under the infra-constitutional regulations governing the matter, whether the bill in question was properly charged. That situation concerns a dispute involving legality alone, the resolution of which falls outside this Court’s jurisdiction. Therefore, the claimant may, if she so wishes, raise her objections through the administrative process itself or before the competent court, where she may fully discuss the merits of the matter and assert her claims.
III.On suspension of drinking water supply for delinquency. Regarding this issue, this Chamber has ruled on numerous occasions. In judgment No. 2020-003446, issued at 9:30 a.m. on 21 February 2020, it stated:
“This Constitutional Court has consistently held, in amparo proceedings challenging suspension of the drinking water supply, that public aqueduct administrators may suspend service to their subscribers when users are delinquent in paying the established rates, since reasonable legal and regulatory requirements that a prospective consumer must meet cannot be disregarded. Despite the foregoing, this Court has established that, if the regular supply is to be cut off, the A y A or the Administrative Association must make a public water source available to the interested person nearby, where they can obtain this vital liquid; because, given that the right to health under Article 21 of the Political Constitution is at stake, drinking water service must be accessible to everyone” (emphasis does not appear in the original).
Accordingly, disconnection of the service was carried out pursuant to the powers held by the respondent municipality, at the time, on account of delinquency. Although there is a fundamental right of access to drinking water, it is not free of charge; therefore, the respondent authority has the power to suspend service if those subject to its authority do not pay the amounts owed for that service. Note that the claimant does not allege that she paid the most recent overdue bill and that restoration of service was denied.
Consequently, the amparo proceeding is inadmissible.
This Chamber must advise the parties that if they have submitted any paper documents, objects, or evidence stored on any additional device or in electronic, computing, magnetic, optical, telematic, or new-technology format, they must be collected from the Court’s offices within 30 business days after receiving notice of this judgment. Otherwise, all such material will be destroyed in accordance with the “Regulation on the Electronic Expediente before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is summarily dismissed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del cuatro de agosto de dos mil veintiseis .
Recurso de amparo que se tramita en el expediente número 26-026674-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando
1. Por escrito incorporado al expediente electrónico el 24 de julio de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que, desde noviembre de 2025, la autoridad accionada realizó un cobro excesivo por el servicio de agua potable, por lo que presentó el reclamo respectivo; sin embargo, el mismo no ha sido resuelto. Reclama que el 23 de julio de 2026, la autoridad accionada le suspendió el servicio de agua potable por la falta de pago, pese que ella y sus hijos presentan un cuadro de vómito y diarrea. Sin embargo, reclama que tal omisión se debe por los cobros reclamados. Solicita la intervención de la Sala a fin de que se permita un arreglo de pago. Por lo expuesto, estima lesionados sus derechos fundamentales.

El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
La parte recurrente expresa que, desde noviembre de 2025, la autoridad accionada realizó un cobro excesivo por el servicio de agua potable, por lo que presentó el reclamo respectivo; sin embargo, el mismo no ha sido resuelto. Reclama que el 23 de julio de 2026, la autoridad accionada le suspendió el servicio de agua potable por la falta de pago, pese que ella y sus hijos presentan un cuadro de vómito y diarrea. Sin embargo, reclama que tal omisión se debe por los cobros reclamados. Solicita la intervención de la Sala a fin de que se permita un arreglo de pago. Por lo expuesto, estima lesionados sus derechos fundamentales.
Vistos los alegatos de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, debe tener en cuenta la parte recurrente que esta Sala ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la sentencia nro. 2018017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:
“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
Así las cosas, este recurso es inadmisible y así se declara…”. (énfasis agregado) Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en tales sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada.
De esta manera, no le corresponde a esta jurisdicción interceder a favor de la parte amparada ante las autoridades recurridas a fin de determinar, según la normativa infraconstitucional que rige la materia, la procedencia del cobro de la factura de marras. Tal situación hace referencia a un conflicto de mera legalidad, cuya resolución es ajena al ámbito de competencia de este Tribunal. Por ello, la parte recurrente podrá plantear, si a bien lo tiene, sus reparos en la propia vía administrativa o en la sede jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
III.Sobre la suspensión del suministro de agua potable por morosidad. Respecto tema enunciado esta Sala se ha pronunciado en reiteradas oportunidades y en sentencia No. 2020-003446 de las 09:30 horas del 21 de febrero del 2020, indicó lo siguiente:
“La posición de este Tribunal Constitucional en cuanto a recursos de amparo en los que se cuestiona la suspensión del suministro de agua potable, ha sido reiterada en el sentido de admitir que las instituciones administradoras de los acueductos públicos pueden suspender el servicio a sus abonados, siempre y cuando los usuarios se encuentren en mora en el pago de las tarifas establecidas, pues los requisitos legales y reglamentarios que debe reunir el posible consumidor no pueden soslayarse si son razonables. A pesar de lo anterior, este Tribunal ha establecido la necesidad de que, si va a proceder a cortar el suministro regular, el A y A o la Asociación Administradora deje a disposición del interesado una fuente pública a corta distancia, donde pueda abastecerse del vital líquido, pues al estar de por medio el derecho a la salud, derivado del artículo 21 de la Constitución Política, el servicio de agua potable debe de estar al alcance de toda persona” (el énfasis no corresponde al original).
Así las cosas, la desconexión del servicio se hizo basado en las potestades que tiene el municipio recurrido, en su momento por morosidad. Si bien existe un derecho fundamental de acceso al agua potable, este no es gratuito, por lo que la autoridad recurrida cuenta con la potestad de suspender el servicio, en caso de que los administrados no cancelen los montos que se adeuden por este concepto. Nótese que la recurrente no aduce haber cancelado el último recibo vencido y se le denegara el restablecimiento del servicio.
En consecuencia, el recurso es inadmisible.
Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
