BACKGROUND:

I. PURPOSE OF THE AMPARO

The applicant challenges the actions of the Municipality of Goicoechea, because some trees were felled but not removed from the site. The applicant requests the intervention of this Chamber.

II. THE SPECIFIC CASE

The purpose of the amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a generic instrument for guaranteeing the principle of constitutional supremacy or the principle of legality, by means of which it would be possible to bring an action against any other kind of constitutional or legal breach. Thus, the application submitted by the applicant is a request for assistance, made in the hope that this Court will intervene or use its good offices with the respondent municipality so that the felled trees are removed. Accordingly, the applicant may, if so desired, pursue the appropriate legality procedure in order to submit there the applications the applicant deems pertinent so that the matter may be resolved as the law requires. Consequently, the application is inadmissible.

III. DOCUMENTATION SUBMITTED TO THE FILE

The applicant is advised that if any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, has been submitted, it must be retrieved from the court office within a maximum period of thirty business days counted from notification of this judgment. Otherwise, any such material not retrieved within this period will be destroyed, in accordance with the “Regulation on Electronic Files before the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.

Recurso de amparo que se tramita bajo el expediente N° 26-026409-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra LA MUNICIPALIDAD DE GOICOECHEA.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala al ser las 14:57 horas del 22 de julio de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de Goicoechea y manifiesta que ese municipio realizó la tala de diversos árboles; sin embargo, no los ha retirado. Indica que el municipio cuenta con una máquina para la trituración de estos. Solicita la intervención de la Sala
  2. 2El artículo 9, de la Ley de la Jurisdicción Constitucional, faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

CONSIDERANDO:

I. OBJETO DEL AMPARO

La parte recurrente cuestiona las actuaciones de la Municipalidad de Goicoechea, por cuanto se talaron algunos árboles, pero no se retiraron del lugar. Solicita la intervención de esta Sala.

II. SOBRE EL CASO CONCRETO

La finalidad del recurso de amparo, es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no la de servir como un instrumento genérico para garantizar el principio de supremacía constitucional o el principio de legalidad, por medio del cual sea posible accionar contra cualquier otra clase de quebrantos constitucionales o legales. Así, la gestión formulada por la parte recurrente es una petición de ayuda, presentada con el afán de que este Tribunal intervenga o interponga sus buenos oficios ante el municipio recurrido, para que se retiren los árboles que fueron talados. Por ello, podrá la parte recurrente, si a bien lo tiene, acudir ante la vía de legalidad respectiva, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:
