CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 30 July 2026.

Amparo proceeding in case file No. 26-025269-0007-CO, filed by Nombre02, identity card CED01, and Nombre01, identity card CED02, BOTH COUNCILWOMEN, against the MUNICIPALITY OF SAN RAMÓN.

BACKGROUND:

  1. 1By a submission received by the Chamber’s Secretariat on 14 July 2026, the applicants file an amparo application and state: that, in their capacity as municipal councilwomen, on 07 May 2026 they sent official letter No. CMSR-PNR-PLN-001-2026 to the email address ...03, addressed to the director of the Department of Urban Development of the Municipality of San Ramón, requesting the following information: “(…) a detailed report on the technical and administrative status of the project ‘Condominio Horizontal Residencial Monte Sueños’ (…) Specifically, certification is requested of the following: 1. The proposal approved by the Municipality for the project’s stormwater discharge. 2. A commitment letter or document regarding ‘Water Availability and Supply’ for the project. Documentary evidence must be submitted, issued by the service provider in that sector, namely, AyA, ASADA, or a private well with a concession from MINAE’s Water Directorate. 3.Setbacks and building lines: Verification that the project complies with the legally required building lines and construction setbacks established in the INVU, MOPT, etc. Regulation on Subdivision and Urban Developments. 4. The project site plan showing the public and communal areas to be ceded to the cantonal Municipality, as provided for in the Urban Planning Law and the Regulation on Subdivisions and Urban Developments, with approval from INVU and the other institutions involved in this type of project. 5. Environmental viability and services: Proof of the viability granted by SETENA. 6. A copy of the ‘Construction Permit’ issued by the Municipality of San Ramón authorizing the works to be carried out. Free access to the complete administrative file is also requested to review the construction plans, service availability letters, and technical inspection records. (...)” (sic) (see evidence submitted to the case file).They state that the respondent municipal mayor’s office has maintained as an administrative practice that municipal councilwomen require a prior resolution of the Municipal Council to access administrative information. They allege that this requirement, when rigidly applied, becomes a mechanism for political obstruction because it makes the exercise of their oversight function subject to a decision by the majority of the collegial body. They indicate that, by official letter No. MSR-AM-0222-2025 of 21 February 2025, the municipal mayor’s office issued a mandatory directive to all municipal employees, expressly providing that “(...) the dispatch of any response to information requests will require the express authorization of the Mayor’s Office (...)”. They state that, as a result, on 11 May 2026 they submitted a second request with the same purpose, this time in their capacity as residents of San Ramón, invoking Articles 11, 27, and 30 of the Political Constitution.They note that, by official letter No. MSR-AM-GM-DDU-034-2026 of 15 May 2026, the respondent director of the Department of Urban Development replied that, although the applicants serve as municipal councilwomen, the request was being processed in their personal capacity as “residents of San Ramón” because they had not submitted a Municipal Council resolution supporting the request. They argue that the same letter stated that case law and municipal regulations provide that, as a general rule, any formal request for reports or institutional documents made by council members in the exercise of their office must be channeled institutionally through the respondent mayor, so as not to interfere with direct administrative functions. They allege that the response added that there is no obligation to provide “that specific request” and that, although Article 30 of the Constitution guarantees free access to administrative departments to obtain information on matters of public interest, the respondent Municipality must protect technical information of a particular, personal, private, or intellectual-property nature, such as the construction plans of a private entity.They state that, on the basis of that reasoning, the respondent department concluded that, since the undersigned are not owners of the property and do not hold legal representation or registry standing on behalf of the developer, it is not appropriate to provide a copy of or unrestricted review of the internal file. Nevertheless, they maintain that the response did provide the following general information: “(...) construction permit PC-125-2026; CFIA 1276143; project name; developer; representative; location; real property folio; approval of stormwater discharge by official letter MSR-AMDDU-PU-153-2024; water availability by means of a drilled well; land-use authorization CRT-1356-2025-AC; parameters for the road-prevention line, building line, maximum building footprint, and minimum lot area; and environmental viability by means of initial resolution 0735-2020-SETENA. (...)”. They argue that the information provided shows that the respondent Municipality possesses specific public documents and that the urban-development file exists.However, they complain that the administration failed to provide the requested documents, failed to certify in full the matters requested, and denied access to the complete administrative file without identifying which items were public, which were restricted, and which could be provided with partial redaction. They state that the response does not identify a formal statute declaring the complete urban-development file confidential, nor explain why the stormwater discharge proposal, water availability, building lines, environmental viability, construction permit, technical inspection records, or administrative approvals would be entirely inaccessible. They add that it also fails to balance the right of access to public information, the community interest in urban development, environmental matters, and land use, against the potential protection of strictly private data or intellectual property.They maintain that the response simply denies broad access to the file and substitutes a partial administrative summary for the documents. They consider that the situation described violates their fundamental rights. They request that the application be granted.
  2. 2By resolution issued at 2:00 p.m. on 16 July 2026, the amparo proceeding was admitted.
  3. 3Under oath, María Gabriela Jiménez Corrales, mayor; Carlos Greivin Rojas Salas, president of the Municipal Council of San Ramón; and Johnny Montoya Villalobos, director of Urban Development, all of the Municipality of San Ramón, report as follows: “Regarding the facts described by the applicants, it must be stated that: Regarding the First fact: It is true that, on 07 May 2026, the Applicants submitted a letter requesting that certified information be sent to them. Second: It is true that, by Official Letter CMSR-PNL-001-2026 of 07 May 2026, the applicants submitted this letter in their capacity as Municipal Councilwomen. Regarding the Third fact: It is partly true. It is true that, as the Applicants state, they requested specific documentary information. However, it is not true that they requested all the information they detail in this application; it must be borne in mind that the applicants requested the following information: Proposal approved by the Municipality for the project’s stormwater discharge. 2.A commitment letter or document regarding ‘Water Availability and Supply’ for the project. Documentary evidence must be submitted, issued by the service provider in that sector, namely, AyA, ASADA, or a private well with a concession from MINAE’s Water Directorate. 3. Setbacks and building lines: Verification that the project complies with the legally required building lines and construction setbacks established in the INVU, MOPT, etc. Regulation on Subdivision and Urban Developments. 4. The project site plan showing the public and communal areas to be ceded to the cantonal Municipality, as provided for in the Urban Planning Law and the Regulation on Subdivisions and Urban Developments, with approval from INVU and the other institutions involved in this type of project. 5. Environmental viability and services: Proof of the viability granted by SETENA. 6. A copy of the ‘Construction Permit’ issued by the Municipality of San Ramón authorizing the works to be carried out.” In addition to this information request, they were requesting free access to the Administrative File to REVIEW CONSTRUCTION PLANS, SERVICE AVAILABILITY LETTERS, AND TECHNICAL INSPECTION RECORDS.Regarding the Fourth fact: It is not true; this Administration does not know to which individuals or institutions the information request document was sent, and for this reason we cannot comment on this fact. Regarding the Fifth fact: It is not true; this Administration has not obstructed the councilwomen’s political work at any time, as they are attempting to make this Honorable Constitutional Chamber believe. On the contrary, this Municipal Mayor’s Office, in accordance with Article 17 of the Municipal Code, has at all times sought to fulfill its function as general administrator and head of the municipal departments, overseeing their organization, operation, coordination, and faithful compliance with municipal resolutions, laws, and regulations in general. Regarding the Sixth fact: It is partly true. It is true that the Municipal Mayor’s Office prepared Official Letter MSR-AM-0222-2025.However, it is not true that this Mayor’s Office sought to centralize all the issuance of information; the primary purpose of this document was to coordinate the operation of the Municipal Departments. Regarding the Seventh fact: It is partly true. It is not true that this Municipal Administration placed any barrier to consultation before them. However, it must be borne in mind that Article 27 of the Municipal Code does not authorize council members to demand accounts or information from Municipal Employees, because this conduct is regulated in Article 17 of the same legal body as a function of the Municipal Mayor. Article 26 of the Municipal Code does authorize them to attend municipal sessions, submit motions, and serve on Committees. It is true that, on 07 May 2026, the Applicants submitted another letter, which they indicate was personal in nature. That letter is very similar to the one submitted in their capacity as Councilwomen, by Official Letter CMSR-PNL-001-2026; indeed, both documents request certification of the same documents identified by the undersigned in the Third fact.Regarding the Eighth fact: It is true, AS THE APPLICANTS THEMSELVES ACKNOWLEDGE, THAT THE REQUESTED INFORMATION WAS ADDRESSED BY ENGINEER JOHNNY MONTOYA VILLALOBOS, WHO, BY OFFICIAL LETTER MSR-AM-GM-DDU-034-2026, RESPONDED TO THEIR REQUESTS. In 2026, the requests by Nombre02 and Nombre01, both in their capacity as Councilwomen and in their capacity as citizens, were addressed in the same Official Letter MSR-AM-GM-DDU-034-2026. Regarding the Ninth fact: It is partly true. In this Official Letter, they are told that, in their capacity as Councilwomen (as established in the case law of the Electoral Tribunal and as the Procuraduría General de la República has also stated), they have no authority to issue direct orders to Municipal operational or administrative employees to provide confidential information or to use their elected office to obtain personal benefits. Such conduct violates the principle of hierarchy and the principle of separation of functions established in the Municipal Code, which provides that this conduct falls within the function of the Municipal Mayor’s Office.However, they are told that, as interested citizens, they may be provided the requested information insofar as it does not affect the principle of confidentiality or intellectual property protected by the Political Constitution. Regarding the Tenth fact: It is partly true. The Applicants are correct in stating that Official Letter MSR-AM-GM-DDU-034-2026 clarified that Article 30 of the Political Constitution has limitations, meaning not all information held may be provided to the public, since confidentiality must be protected. An example of such information is the plans or design of the project, which have special protection established by Article 47 of the Political Constitution. Certified documents containing personal or sensitive information, or information protected by intellectual-property law, such as the construction plans and technical specifications of a private project (‘Condominio Monte Sueños’) deposited with the Municipality for licensing procedures, are protected by the Copyright and Related Rights Law and Article 47 of the Constitution.It must be understood that indiscriminate delivery of these documents to third parties (including council members acting in their personal capacity) may harm the developer’s commercial or industrial secrets or intellectual property rights. The Municipality acted in accordance with the principle of legality by denying or omitting items protected by confidentiality. On the other hand, they request certification of documents not prepared by this Municipality, such as resolution No. 0735-2020-SETENA, extended validity (see agreement ACP-031-2020-SETENA), Construction Permit No. PC-125-2026, CFIA 1276143, issued by the Federated College of Engineers and Architects, as well as Water Availability, issued by the competent authority. For this reason, these certifications could not be prepared; however, they were advised to make the request to the Correct Department. Regarding the Twelfth fact: It is true.As the Applicants state, the information was provided to them within the applicable time, which is why this Administration considers there is no reason to file this amparo application, since a response to the letters submitted was provided in due time and proper form, and this application therefore has no current interest. The Applicants themselves confirm in their submission that they received the important information through Official Letter MSR-AM-GM-DDU-034-2026. Regarding the Thirteenth fact: What the Applicants state is not true: that the Municipality refused to provide a certified file. It must be understood that, in their request, the Applicants did not request a certified file. Rather, as clarified in the Third and Eleventh facts of this response, the documents they requested are not documents belonging to this administration or are subject to copyright. For this reason, the employees of this Municipality cannot certify as its own documents documents that do not belong to us, or documents whose characteristics impose restrictions preventing them from being public.Regarding the Fourteenth fact: It is not true. It can be seen from Official Letter MSR-AM-GM-DDU-034-2026 that a response to the request submitted was indeed provided in due time and proper form. Regarding the Fifteenth fact: It is not true. It can be seen from Official Letter MSR-AM-GM-DDU-034-2026 that a response to the request submitted was indeed provided in due time and proper form. Regarding the Sixteenth fact: Throughout this report, the reasons why the information was not provided to them in their capacity as councilwomen have been explained. Their request for the information at a personal level only shows that they were using their status as Councilwomen to try to obtain confidential and protected information. Note that their request letter states, and I quote verbatim: ‘FREE ACCESS TO THE COMPLETE ADMINISTRATIVE FILE IS ALSO REQUESTED TO REVIEW CONSTRUCTION PLANS, SERVICE AVAILABILITY LETTERS, AND TECHNICAL INSPECTION RECORDS.’ It is important that the Chamber bear in mind that this action could be considered an offense established in the Law against Corruption and Illicit Enrichment in Public Service.Third: On 15 May 2025, Engineer Johnny Montoya Villalobos notified Official Letter MSR-AM-GM-DDU-034-2026, Subject: Response to Request for Information on ‘Proyecto Condominio Horizontal Residencial Monte Sueños’, to the email addresses ...01, ...04, ...06, ...02, and ...05. Law: This amparo application is based on the following: Everyone may apply to the Constitutional Chamber to protect their constitutional right of free petition, in accordance with Article 27 of the Political Constitution, which states: ‘ARTICLE 27.- Freedom of petition, individually or collectively, before any public official or official entity, and the right to receive a prompt resolution, are guaranteed.’ However, I consider it important to indicate that anyone who believes one of their rights has been violated is entitled to resort to the courts, in accordance with Article 48 of the Political Constitution, which states: ‘ARTICLE 48.- Everyone has the right to a habeas corpus remedy to guarantee their personal freedom and integrity, and to an amparo remedy to maintain or restore the enjoyment of the other rights enshrined in this Constitution, as well as fundamental rights established in international human rights instruments applicable to the Republic.Both remedies shall fall within the jurisdiction of the Chamber indicated in Article 10.’ As can be seen, the information requested by the Applicants was addressed on 15 May 2026, and since no harm was caused to the Applicants, and they did not express their disagreement in writing after that notification, we consider that this Amparo Application has no current interest in continuing. It is also important to clarify that the Applicants appear to be attempting to challenge the legality of the Directive issued by the Municipal Mayor’s Office through Official Letter MSR-AM-0222-2025. However, an amparo application is not the legally established avenue for doing so. Since, as shown, no fundamental right of the councilwomen is being affected and the information was provided to them, we respectfully request that this Honorable Court dismiss the application.”
  4. 4The legal requirements have been observed in the proceedings.

I. SUBJECT OF THE APPLICATION

The applicants allege that, in their capacity as municipal councilwomen, on 7 May 2026 they sent official letter No. CMSR-PNR-PLN-001-2026 to the email address ...03, addressed to the director of the Department of Urban Development of the Municipality of San Ramón, requesting information of public interest. They allege that, although a response was given, the requested information was not provided and the requested items were not certified. The same information was requested again on the 11th of that month.

II. FACTS PROVEN

The following facts are considered duly established and relevant to the decision in this matter:

  • a)On 07 May 2026, the applicants, who are councilwomen, sent official letter No. CMSR-PNR-PLN-001-2026 to the email address ...03, addressed to the director of the Department of Urban Development of the Municipality of San Ramón, requesting the following information: “(…) a detailed report on the technical and administrative status of the project ‘Condominio Horizontal Residencial Monte Sueños’ (…) Specifically, certification is requested of the following: 1. The proposal approved by the Municipality for the project’s stormwater discharge. 2. A commitment letter or document regarding ‘Water Availability and Supply’ for the project. Documentary evidence must be submitted, issued by the service provider in that sector, namely, AyA, ASADA, or a private well with a concession from MINAE’s Water Directorate. 3. Setbacks and building lines: Verification that the project complies with the legally required building lines and construction setbacks established in the INVU, MOPT, etc. Regulation on Subdivision and Urban Developments. 4.   • b)By official letter No. MSR-AM-GM-DDU-034-2026 of 15 May 2026, the respondent director of the Department of Urban Development replied to the applicants: “I. Regarding standing to access the complete file. It is important to clarify that, although you serve as municipal councilwomen, this request is being processed in your personal capacity as ‘residents of San Ramón’, since you have not submitted a Municipal Council resolution supporting the request. Case law and municipal regulations provide that, as a general rule, any formal request for reports or institutional documents made by council members in the exercise of their office must be channeled institutionally through the Municipal Mayor, so as not to interfere with direct administrative functions. In addition, regarding your request for free access to the complete administrative file and to the construction plans, I am obliged to deny that specific request. Although Article 30 of the Political Constitution guarantees free access to administrative departments to obtain information on matters of public interest, the Municipality is required to protect technical information that is of a particular, personal, private, or intellectual-property nature (such as the construction plans of a private entity). Since you are not the owners of the property and do not hold legal representation or registry standing on behalf of the developer, it is not legally appropriate to provide a copy of or unrestricted review of the internal file. II. Regarding general and public information about the project. Notwithstanding the foregoing, in strict respect for your constitutional right of petition and in the interest of administrative transparency regarding construction projects, based on the information I requested from the Department of Urban Planning, I provide you with the general and public information corresponding to the project in question: ● Construction Permit: PC-125-2026, CFIA 1276143 ● Project Name: Condominio Horizontal Residencial Monte Sueños ● Developer: Daromacar S.A. (Legal Entity ID: 3-101-737916) ● Representative: Daniel Cruz Porras ● Location: Province of Alajuela, Canton of San Ramón, District of Ángeles. Real Property Folio: PRN01. Details of building lines and approvals: 1. Stormwater Discharge: The corresponding approval for stormwater discharge on property PRN01 was issued by official letter MSR-AM-DDU-PU-153-2024 of 13 May 2024, by Eng. Andrés Zúñiga, Head of the Department of Urban Planning. 2. Water Availability: According to the review of the construction permit and the Environmental Viability, a drilled well is used for these purposes. 3. Building Lines and Land Use: By means of Land-Use Authorization CRT-1356-2025-AC, Location Approval was granted after determining that the project conforms to and is compatible with the area. The established parameters are: ○ Road Prevention Line: 10 meters ○ Building Line: 13 meters ○ Maximum Building Footprint: 75% ○ Minimum Lot Area: 120.00 m² 4. Environmental Viability (SETENA): ○ Initial Resolution: The project has Environmental Viability under resolution No. 0735-2020-SETENA, extended validity (see agreement ACP-031-2020-SETENA).” (See the report submitted and evidence in the case file).

III. THE SPECIFIC CASE

In the present case, it is alleged that the applicants, in their capacity as municipal councilwomen, on 07 May 2026 sent official letter No. CMSR-PNR-PLN-001-2026 to the email address ...03, addressed to the director of the Department of Urban Development of the Municipality of San Ramón, requesting information of public interest. They allege that, although a response was given, the requested information was not provided and the requested items were not certified. The same information was requested again on the 11th of that month.

In this regard, based on the report submitted under oath by the respondent authority, subject to the warnings, including criminal penalties, set out in section 44 of the Constitutional Jurisdiction Law, and the documents submitted to the case file, the Chamber will analyze each of the inquiries made by the protected parties and the response given by the respondent authority.

First. Proposal approved by the Municipality for the project’s stormwater discharge. Response: “Stormwater Discharge: The corresponding approval for stormwater discharge on property PRN01 was issued by official letter MSR-AM-DDU-PU-153-2024 of 13 May 2024, by Eng. Andrés Zúñiga, Head of the Department of Urban Planning.” Second. Commitment letter or document regarding “Water Availability and Supply” for the project. Documentary evidence must be submitted, issued by the service provider in that sector, namely, AyA, ASADA, or a private well with a concession from MINAE’s Water Directorate. Response: “Water Availability: According to the review of the construction permit and the Environmental Viability, a drilled well is used for these purposes.” Third. Setbacks and building lines: Verification that the project complies with the legally required building lines and construction setbacks established in the INVU, MOPT, etc. Regulation on Subdivision and Urban Developments. Response: “Building Lines and Land Use: By means of Land-Use Authorization CRT-1356-2025-AC, Location Approval was granted after determining that the project conforms to and is compatible with the area. The established parameters are: ○ Road Prevention Line: 10 meters ○ Building Line: 13 meters ○ Maximum Building Footprint: 75% ○ Minimum Lot Area: 120.00 m² 4”.

Fourth. The project site plan showing the public and communal areas to be ceded to the cantonal Municipality, as provided for in the Urban Planning Law and the Regulation on Subdivisions and Urban Developments, with approval from INVU and the other institutions involved in this type of project. Response: No response appears in the record.

Fifth. Environmental viability and services: Proof of the viability granted by SETENA. Response: “Environmental Viability (SETENA): ○ Initial Resolution: The project has Environmental Viability under resolution No. 0735-2020-SETENA, extended validity (see agreement ACP-031-2020-SETENA).” Sixth. A copy of the “Construction Permit” issued by the Municipality of San Ramón authorizing the works to be carried out. Response: No response appears in the record.

Seventh. Free access to the complete administrative file is also requested to review the construction plans, service availability letters, and technical inspection records. Response: “. Regarding standing to access the complete file. It is important to clarify that, although you serve as municipal councilwomen, this request is being processed in your personal capacity as ‘residents of San Ramón’, since you have not submitted a Municipal Council resolution supporting the request. Case law and municipal regulations provide that, as a general rule, any formal request for reports or institutional documents made by council members in the exercise of their office must be channeled institutionally through the Municipal Mayor, so as not to interfere with direct administrative functions. In addition, regarding your request for free access to the complete administrative file and to the construction plans, I am obliged to deny that specific request.

Although Article 30 of the Political Constitution guarantees free access to administrative departments to obtain information on matters of public interest, the Municipality is required to protect technical information that is of a particular, personal, private, or intellectual-property nature (such as the construction plans of a private entity). Since you are not the owners of the property and do not hold legal representation or registry standing on behalf of the developer, it is not legally appropriate to provide a copy of or unrestricted review of the internal file.” Accordingly, after analyzing each of the responses the respondent authority gave to the protected parties, the Chamber finds that their fundamental rights were affected. This is because official letter No. CMSR-PNR-PLN-001-2026, sent on 7 May 2026, is in the record; the applicants requested certification of documents, and the evidence submitted does not show that the requested items were sent to them.

Indeed, the response is generic and ambiguous, is neither clear nor precise, and does not address each point fully, item by item, regarding the information the protected parties requested. Although it is important to note that the administration is not required to provide information that is impossible to access, not in its possession, or nonexistent—because the right of petition is not unlimited and is subject to certain exceptions—the fact remains that a clear, timely, and consistent response must always be given to the petition and access-to-information rights protecting the applicant party.

On the other hand, regarding free access to the complete administrative file to review the construction plans, service availability letters, and technical inspection records, it is important to indicate that this Chamber has held that council members may consult information of public interest and the underlying documents for municipal permits by virtue of their duty of oversight and political control. However, they are subject to restrictions concerning intellectual property. Thus, if the file contains plans or works protected by copyright, visual consultation or review is permitted to serve the public interest, but total or partial reproduction or photocopying of those plans is prohibited, as this is not permitted for third parties unless they are authorized.

The foregoing shows that this Court has considered that documents embodying an intellectual creation must be protected. In the Chamber’s view, that protection does not prevent third parties from consulting construction plans, but they may not photocopy them. For example, Judgment No. 9115-2004, issued at 11:29 a.m. on 20 August 2004, held:

“(...) In this case, then, the applicants’ disagreement concerns the respondent authority’s decision to authorize only partial photocopying of that file. As recorded in administrative minutes 282-03-EXT at 3:00 p.m. on 16 October 2003, the respondent authority did not authorize copies of folios 1 to 84 and 206, 207, 208, 219, 210, 215, and 216 because they contained plans protected by copyright. In view of this, the Chamber finds no violation of the protected party’s fundamental rights, since the respondent authority reports under oath that those folios were made available for study but not photocopying because they contained strictly private information protected by intellectual-property laws. This is reasonable, since plans, as inventions of the engineer or architect who creates the work, must be protected from reproduction without authorization from the person legally entitled to grant it, in order to prevent reproduction or plagiarism of the project to be developed. The Chamber understands that the neighbors of the project in question may have an interest in learning about those plans, since in their view the project to be developed will harm their properties; they must therefore know the project’s technical specifications to assess its impact on their properties. However, the respondent authority states in its report under oath that, although copying the folios of the file containing the plans was not permitted, access to study and analyze them was provided to interested parties. They could therefore appear at the Municipality with a specialist to review the plans in question, without photocopying them, in order to assess the potential impact the work might have on their properties and make the corresponding challenges…”. (Emphasis in the original).

Accordingly, although the respondent authority informed the applicants about the restrictions on the file it invokes, the record does not show that it made the file available for their review or offered to certify only those parts not protected by intellectual property or sensitive data rules. Likewise, although there is a response to the request, it is incomplete and does not correspond to what was requested. Nor does it appear that they were given certified copies of any public-access documents, if such documents exist, relating to the request.

Consequently, the justification given by the respondent authority to the protected parties and to this Chamber cannot be considered valid. The appropriate course is therefore to grant the application and order that the applicants be given a clear and precise response to each of the points requested. They must also be given the certified documents requested in the submission of 07 May 2026 that are held by that Municipality; otherwise, the omission must be justified. They must also be given access to review the file and be allowed to photocopy or obtain certification of whatever is permitted, all subject to the reservation of sensitive and restricted-access data protected by the Law on the Protection of Individuals with Regard to the Processing of Their Personal Data and other applicable regulations, and to copyright under the current regulations on intellectual-property protection.

IV. DOCUMENTS SUBMITTED TO THE CASE FILE

The applicant party is advised that any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that it may have submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Higher Council of the Judiciary at session No. 43-12, held on 3 May 2012, Article LXXXI.

THEREFORE:

The application is granted. María Gabriela Jiménez Corrales, mayor; Carlos Greivin Rojas Salas, president of the Municipal Council of San Ramón; and Johnny Montoya Villalobos, director of Urban Development, all of the Municipality of San Ramón, or whoever holds those positions, are ordered, within their respective competencies, to coordinate and issue the necessary orders so that, within FIVE DAYS from notification of this judgment, the protected parties receive an appropriate response regarding each of the requests made on 07 May 2026, in the terms indicated at the end of Considering III of this judgment. This is ordered subject to the reservation of sensitive and restricted-access data protected by the Law on the Protection of Individuals with Regard to the Processing of Their Personal Data and other applicable regulations, and by intellectual-property law. The respondent authority is advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order to comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty.

The Municipality of San Ramón is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, to be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Notify the parties.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del treinta de julio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número No 26-025269-0007-CO, interpuesto por Nombre02, cédula de identidad CED01 y Nombre01, cédula de identidad CED02, AMBAS REGIDORAS, contra la MUNICIPALIDAD DE SAN RAMÓN.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala el 14 de julio de 2026, la parte recurrente interpone recurso de amparo y manifiesta: que en su condición de Regidoras Municipales, el 07 de mayo de 2026 remitieron el oficio nro. CMSR-PNR-PLN-001-2026 al correo electrónico: ...03, dirigido al director del Departamento de Desarrollo Urbano de la Municipalidad de San Ramón, en el que solicitaron la siguiente información: "(…) un informe detallado sobre la situación técnica y administrativa del proyecto "Condominio Horizontal Residencial Monte Sueños" (…) Específicamente, se requiere certificar lo siguiente: 1. Propuesta aprobada por la municipalidad del desfogue del proyecto. 2. Carta o documento de compromiso de "Disponibilidad y Abastecimiento de Aguas" para el proyecto. Presentar prueba documental de la misma emitida por el ente prestatario en ese sector, a saber, AyA, ASADA o algún pozo propio con concesión de la Dirección de Aguas del MINAE. 3.Alineamientos y Retiros: Verificación de que el proyecto cumple con los alineamientos de ley y los retiros de construcción establecidos en el Reglamento de Fraccionamiento y Urbanizaciones del INVU, el MOPT, etc. 4. Diseño de sitio del del proyecto, donde consten las áreas públicas y comunales a ceder a la municipalidad del cantón, conforme lo establece la Ley de Planificación Urbana y el Reglamento de Fraccionamientos y Urbanizaciones, con la aprobación del INVU y demás instituciones implicadas en este tipo de proyectos. 5. Viabilidad Ambiental y Servicios: Constancia de la viabilidad otorgada por SETENA 6. Copia del "Permiso de Construcción" emitido por la Municipalidad de San Ramón, que faculta que las obras se estén llevando a cabo. Se solicita además el libre acceso al expediente administrativo completo para la revisión de los planos constructivos, cartas de disponibilidad de servicios y actas de inspección técnica.(...)" (sic) (véase prueba aportada al expediente). Indican que la alcaldía municipal recurrida ha sostenido como práctica administrativa que las regidoras municipales requieren acuerdo previo del Concejo para acceder a información administrativa. Alegan que esa exigencia, aplicada de forma rígida, se convierte en un mecanismo de bloqueo político, pues subordina el ejercicio de la función fiscalizadora a una decisión de la mayoría del órgano colegiado. Señala que, por oficio nro. MSR-AM-0222-2025, de 21 de febrero de 2025, la alcaldía municipal emitió una directriz de acatamiento obligatorio dirigida a todos los funcionarios municipales, mediante la cual dispuso expresamente que "(...) el despacho de cualquier respuesta a solicitudes de información requerirá la autorización expresa de la Alcaldía (...)". Aducen que, en virtud de lo anterior, el 11 de mayo de 2026 remitieron una segunda solicitud con el mismo objeto, esa vez en condición de ciudadanas ramonenses, invocando los artículos 11, 27 y 30 de la Constitución Política.Acotan que, mediante oficio nro. MSR-AM-GM-DDU-034-2026, del 15 de mayo de 2026, el director del Departamento de Desarrollo Urbano recurrido respondió que, si bien las solicitantes fungen como regidoras municipales, la gestión se tramita a título personal como "ciudadanas ramonenses", porque no aportaron acuerdo del Concejo que respaldara la solicitud. Arguyen que, en ese mismo oficio, se afirmó que la jurisprudencia y la normativa municipal establecen que, como regla general, cualquier requerimiento formal de informes o documentación institucional solicitado por regidores en el ejercicio de su cargo debe canalizarse orgánicamente por medio del alcalde recurrido, para no intervenir en las funciones administrativas directas. Alegan que la respuesta agregó que no existe obligación de entregar "dicha solicitud específica" y que, aunque el artículo 30 constitucional garantiza el libre acceso a los departamentos administrativos para obtener información sobre asuntos de interés público, la municipalidad recurrida debe proteger información técnica de carácter particular, personal, privado o de propiedad intelectual, como los planos constructivos de un ente privado.Señalan que, con base en esa argumentación, la dirección recurrida concluyó que, dado que las suscritas no son propietarias del inmueble ni ostentan representación legal o legitimación registral de la empresa desarrolladora, no procede facilitar copia o revisión irrestricta del expediente interno. No obstante, sostienen que la respuesta sí suministró los siguientes datos generales: "(...) permiso de construcción PC-125-2026; CFIA 1276143; nombre del proyecto; desarrollador; representante; ubicación; folio real; aprobación de desfogue pluvial mediante oficio MSR-AMDDU-PU-153-2024; disponibilidad de agua mediante pozo perforado; uso de suelo CRT-1356-2025-AC; parámetros de línea de prevención vial, línea de construcción, huella constructiva máxima y superficie mínima de lote; y viabilidad ambiental mediante resolución inicial 0735-2020-SETENA. (...)". Esgrimen que la información suministrada demuestra que la municipalidad recurrida posee documentación pública concreta y que el expediente urbanístico existe.Sin embargo, reclaman que la administración omitió entregar la documentación requerida, omitió certificar íntegramente los extremos solicitados y negó el acceso al expediente administrativo completo sin individualizar cuáles piezas serían públicas, cuáles serían reservadas y cuáles podrían entregarse con testado parcial Afirman que la respuesta no identifica una ley formal que declare confidencial el expediente urbanístico completo, ni explica por qué la propuesta de desfogue, la disponibilidad de agua, los alineamientos, la viabilidad ambiental, el permiso de construcción, las actas de inspección técnica o las aprobaciones administrativas serían íntegramente inaccesibles. Añaden que tampoco realiza una ponderación entre el derecho de acceso a la información pública, el interés comunal en materia urbanística, ambiental y de uso de suelo, y la eventual protección de datos estrictamente privados o de propiedad intelectual.Sostienen que simplemente niega el acceso amplio al expediente y sustituye la entrega documental por un resumen administrativo parcial. Estiman que la situación expuesta lesiona sus derechos fundamentales. Solicitan que se declare con lugar el recurso.
  2. 2Mediante resolución de las 14:00 horas del 16 de julio de 2026, se le dio curso al amparo.
  3. 3Informa bajo juramento María Gabriela Jiménez Corrales, alcaldesa, Carlos Greivin Rojas Salas, presidente del Concejo Municipal de San Ramón, y Johnny Montoya Villalobos, director de Desarrollo Urbano, todos de la Municipalidad de San Ramón, en los siguientes términos: “Sobre los hechos descritos por la recurrente se debe indicar que: Sobre el hecho Primero: Es cierto, el día 07 de mayo del año 2026, las Recurrentes presentaron una nota solicitando se le remita información certificada. Segundo: Es cierto, mediante el Oficio CMSR-PNL-001-2026, del día 07 de mayo del año 2026, las recurrentes en su calidad de Regidoras Municipales presentaron este oficio. Sobre el hecho Tercero: Es cierto en parte, es cierto que efectivamente como lo indican las Recurrentes ellas solicitaron información específica y documental, sin embargo no es cierto que solicitaron toda la información que detallan en este recurso, debe tomarse en cuenta que las recurrentes solicitaron la siguiente información: Propuesta aprobada por la municipalidad del desfogue del proyecto. 2.Carta o documento de compromiso de "Disponibilidad y Abastecimiento de Aguas" para el proyecto. Presentar prueba documental de la misma emitida por el ente prestatario en ese sector, a saber, AyA, ASADA o algún pozo propio con concesión de la Dirección de Aguas del MINAE. 3. Alineamientos y Retiros: Verificación de que el proyecto cumple con los alineamientos de ley y los retiros de construcción establecidos en el Reglamento de Fraccionamiento y Urbanizaciones del INVU, el MOPT, etc. 4. Diseño de sitio del del proyecto, donde consten las áreas públicas y comunales a ceder a la municipalidad del cantón, conforme lo establece la Ley de Planificación Urbana y el Reglamento de Fraccionamientos y Urbanizaciones, con la aprobación del INVU y demás instituciones implicadas en este tipo de proyectos. 5. Viabilidad Ambiental y Servicios: Constancia de la viabilidad otorgada por SETENA 6. Copia del "Permiso de Construcción" emitido por la Municipalidad de San Ramón, que faculta que las obras se estén llevando a cabo”.Adicional a esta solicitud de información, estaban solicitando el libre acceso al Expediente Administrativo, para LA REVISIÓN DE PLANOS CONSTRUCTIVOS, CARTAS DE DISPONIBILIDAD DE SERVICIOS Y ACTAS DE INSPECCIÓN TÉCNICA. Sobre el hecho Cuarto: no es cierto, no conoce esta Administración a que sujetos o instituciones remitió el documento de solicitud de información, es por esta razón que no nos podemos manifestar sobre este hecho. Sobre el hecho Quinto: no es cierto, esta Administración no ha bloqueado el actuar político de las Regidoras en ningún momento, como lo están intentando hacer ver a esta honorable Sala Constitucional. Muy por el contrario esta Alcaldía Municipal, en apego con lo establecido en el artículo 17 del Código Municipal, ha procurado en todo momento cumplir con su función de administrador general y jefe de las dependencias municipales, vigilando la organización, el funcionamiento, la coordinación y el fiel cumplimiento de los acuerdos municipales, las leyes y los reglamentos en general.Sobre el hecho Sexto: es cierto en parte, es cierto que la Alcaldía Municipal, elaboró el Oficio MSR-AM-0222-2025, sin embargo, no es cierto que esta Alcaldía buscará Centralizar toda la emisión de información, el fin principal de este documento ha sido coordinar el funcionamiento de las Dependencias Municipales. Sobre el hecho Séptimo; es cierto en parte. No es cierto que esta Administración Municipal les presentara ninguna barrera de consulta, sin embargo, debe tomarse en cuenta que el artículo 27 del Código Municipal, no faculta a los regidores a solicitar cuentas o información a los Funcionarios Municipales, motivo de que este actuar está regulado en el artículo 17 del mismo cuerpo normativo como actuar del Alcalde Municipal. Lo que sí se autoriza por medio del artículo 26 del Código Municipal, es asistir a las sesiones municipales, realizar mociones y ser parte de las Comisiones. Es cierto que las Recurrentes presentaron en fecha 07 de mayo del año 2026, otra nota, la cual señalan, es de carácter personal, esta nota es muy similar a la presentada en su calidad de Regidoras, mediante el Oficio CMSR-PNL-001-2026, incluso en ambos documentos se solicita certificar los mismos documentos, indicados por los suscritos en el hecho tercero.Sobre el hecho Octavo: Es cierto, COMO LO ESTÁN ACEPTANDO LAS RECURRENTES, LA INFORMACIÓN SOLICITADA FUE ATENDIDA POR EL INGENIERO JOHNNY MONTOYA VILLALOBOS QUIEN MEDIANTE EL OFICIO MSR-AM-GM-DDU-034-2026, LES BRINDÓ RESPUESTA A SUS SOLICITUDES. del año 2026, por las señoras Nombre02 y Nombre01, tanto en su calidad de Regidoras, como en su calidad de Ciudadanas fueron atendidas dentro del mismo Oficio MSR-AM-GM-DDU-034-2026. Sobre el hecho Noveno: es cierto en parte, dentro de este Oficio, se les explica que en calidad de Regidoras, (de acuerdo a lo dictado en la jurisprudencia del Tribunal Electoral, así como la Procuraduría General de la República lo ha señalado) no poseen autoridad para dar órdenes directas a los empleados operativos o administrativos Municipales para que les brinden información confidencial o se aprovechen de su puesto de elección popular para obtener beneficios personales.Motivo que esto viola el principio de jerarquía y el principio de separación de funciones establecido en el Código Municipal, el cual señala que ese actuar es función de la Alcaldía Municipal. Sin embargo, se les explica que como ciudadanas interesadas si se les puede otorgar la información solicitada que no afecte el principio de Confidencialidad o de propiedad intelectual resguardado en la Constitución Política. Sobre el hecho Décimo: es cierto en parte, es cierto lo indicado por las Recurrentes al señalar que el Oficio MSR-AM-GM-DDU-034-2026, se le aclara que el artículo 30 de la Constitución Política posee limitaciones, motivo de que no toda la información que se posea, se puede suministrar al público, ya que, existe un tema de confidencialidad que se debe de resguardar, un ejemplo de esta información son los planos o el diseño del proyecto, que poseen un resguardo especial establecido por el artículo 47 de la Constitución Política. se brinden documentos certificados con información personal, sensible y que poseen información protegida por el Derecho de propiedad intelectual, como lo serían los planos constructivos y memorias técnicas de un proyecto privado ("Condominio Monte Sueños") depositados ante la Municipalidad para trámites de licencias están protegidos por la Ley de Derechos de Autor y Derechos Conexos, y el artículo 47 constitucional.Debe comprenderse que la entrega indiscriminada de estos documentos a terceros (incluso regidores en su carácter personal) puede lesionar secretos comerciales, industriales o derechos de propiedad intelectual del desarrollador. La Municipalidad actuó bajo el principio de legalidad al denegar u omitir piezas protegidas por confidencialidad. Por otro lado, solicitan se certifiquen documentos que no son elaborados por esta Municipalidad, como lo serían la resolución N° 0735-2020-SETENA, vigencia extendida (ver acuerdo ACP-031-2020-SETENA), el Permiso de Construcción número PC-125-2026, CFIA 1276143, emitido por el Colegio Federado de Ingenieros y Arquitectos, así como la Disponibilidad de Agua, emitida por la Autoridad competente, es por esta razón que estas certificaciones no se pudieron desarrollar, sin embargo se le brindó la solicitar ante la Dependencia Correcta. Sobre el hecho Décimo Segundo: Es cierto, Como lo indican las Recurrentes, la información sí les fue suministrada, dentro del tiempo correspondiente, es por ello que considera esta Administración no existe razón de que este recurso de amparo se presente, siendo que se les brindó respuesta a las notas presentadas en tiempo y forma, generando que este recurso no posea interés actual y las mismas recurrentes confirman dentro del escrito que recibieron la información importante, mediante el Oficio MSR-AM-GM-DDU-034-2026.Sobre el hecho Décimo Tercero: No es cierto, lo indicado por las Recurrentes, al establecer que la Municipalidad no quiso otorgar un expediente certificado, debe comprenderse que en el escrito de solicitud, las Recurrentes no solicitaron el expediente certificado, sino que como se aclaró en los hechos Tercero y Décimo Primero de esta contestación, la solicitud de documentos que realizaron no son propios de esta administración o poseen Derechos de autor, es por esta razón que los funcionarios de esta Municipalidad no pueden certificar como propios, Documentos los cuales no son nuestros o documentos los cuales por sus características cuentan con una limitación que por su tipo, se impide sean públicos. Sobre el hecho Décimo Cuarto: No es cierto, de la lectura del Oficio MSR-AM-GM-DDU-034-2026, se logra observar que sí se les brindó respuesta a la solicitud presentada en tiempo y forma. Sobre el hecho Décimo Quinto: No es cierto, de la lectura del Oficio MSR-AM-GM-DDU-034-2026, se logra observar que sí se les brindó respuesta a la solicitud presentada en tiempo y forma.Sobre el hecho Décimo Sexto: a lo largo de este informe se le ha explicado las razones por las cuales la información no se les brindó en su calidad de regidoras, y al solicitar la información a nivel personal, solamente demuestra que estaban utilizando su investidura como Regidoras para intentar obtener información Confidencial y protegida, nótese que su nota de solicitud señala, cito textualmente: “SE SOLICITA ADEMÁS LIBRE ACCESO AL EXPEDIENTE ADMINISTRATIVO COMPLETO PARA LA REVISIÓN DE LOS PLANOS CONSTRUCTIVOS, CARTAS DE DISPONIBILIDAD DE SERVICIOS Y ACTAS DE INSPECCIÓN TÉCNICA”, es importante que la sala tenga en cuenta que esta acción podría considerarse un delito establecido en la Ley contra la Corrupción y el Enriquecimiento Ilícito en la Función Pública. Tercero: Que en fecha 15 de mayo del 2025, el Ingeniero Johnny Montoya Villalobos, realiza la notificación del Oficio MSR-AM-GM-DDU-034-2026, Asunto: Respuesta a solicitud de información sobre "Proyecto Condominio Horizontal Residencial Monte Sueños". a los Correos electrónicos ...01, al correo electrónico ...04, al ...06, al correo electrónico ...02 y al correo electronico ...05.Derecho: el presente recurso de amparo se fundamenta de la siguiente manera: Toda persona puede acudir a la Sala Constitucional, siempre amparando a su derecho constitucional de libre petición, de acuerdo con el artículo 27 de la Constitución política, el cual cita: “ARTÍCULO 27.- Se garantiza la libertad de petición, en forma individual o colectiva, ante cualquier funcionario público o entidad oficial, y el derecho a obtener pronta resolución.” Sin embargo, considero importante indicar que cualquier persona que considere que uno de sus derechos fue vulnerado, tiene derecho de acudir a la vía judicial, de acuerdo al artículo 48 de la Constitución Política, el cual cita: “ARTÍCULO 48.- Toda persona tiene derecho al recurso de hábeas corpus para garantizar su libertad e integridad personales, y al recurso de amparo para mantener o restablecer el goce de los otros derechos consagrados en esta Constitución, así como de los de carácter fundamental establecidos en los instrumentos internacionales sobre derechos humanos, aplicables a la República.Ambos recursos serán de competencia de la Sala indicada en el artículo 10.” Como se puede observar la información solicitada por las Recurrentes han sido atendidas en fecha 15 de mayo del año 2026, y siendo que no se le causó ningún perjuicio las Recurrentes, y posterior a esta notificación no manifestaron por escrito su inconformidad, consideramos que el presente Recurso de Amparo no posee interés actual en continuar. Además es importante aclarar, que se observa que las recurrentes están intentando atacar la legalidad de la Directriz emanada por la Alcaldía Municipal, mediante el Oficio MSR-AM-0222-2025, sin embargo, el Recurso de amparo no es la vía legalmente establecida para realizar esta acción, y siendo que como se demostró, no se está afectando ningún Derecho fundamental a las regidoras y la información si se le fue otorgada, respetuosamente se le solicita a este honorable Tribunal, declarar sin lugar el recurso.
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

Las recurrentes alegan que, en su condición de regidoras municipales, el 7 de mayo de 2026 remitieron el oficio nro. CMSR-PNR-PLN-001-2026 al correo electrónico: ...03, dirigido al director del Departamento de Desarrollo Urbano de la Municipalidad de San Ramón, en el que solicitaron información de interés público. Alegan que, si bien se les dio respuesta, sin embargo, se omitió la entrega de lo solicitado, omitió certificar lo peticionado. Lo anterior fue solicitado nuevamente el 11 de ese mismo mes.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 07 de mayo de 2026, las recurrentes quienes son regidoras, remitieron el oficio nro. CMSR-PNR-PLN-001-2026 al correo electrónico: ...03, dirigido al director del Departamento de Desarrollo Urbano de la Municipalidad de San Ramón, en el que solicitaron la siguiente información: "(…) un informe detallado sobre la situación técnica y administrativa del proyecto "Condominio Horizontal Residencial Monte Sueños" (…) Específicamente, se requiere certificar lo siguiente: 1. Propuesta aprobada por la municipalidad del desfogue del proyecto. 2. Carta o documento de compromiso de "Disponibilidad y Abastecimiento de Aguas" para el proyecto. Presentar prueba documental de la misma emitida por el ente prestatario en ese sector, a saber, AyA, ASADA o algún pozo propio con concesión de la Dirección de Aguas del MINAE. 3. Alineamientos y Retiros: Verificación de que el proyecto cumple con los alineamientos de ley y los retiros de construcción establecidos en el Reglamento de Fraccionamiento y Urbanizaciones del INVU, el MOPT, etc. 4. Diseño de sitio del del proyecto, donde consten las áreas públicas y comunales a ceder a la municipalidad del cantón, conforme lo establece la Ley de Planificación Urbana y el Reglamento de Fraccionamientos y Urbanizaciones, con la aprobación del INVU y demás instituciones implicadas en este tipo de proyectos. 5. Viabilidad Ambiental y Servicios: Constancia de la viabilidad otorgada por SETENA 6. Copia del "Permiso de Construcción" emitido por la Municipalidad de San Ramón, que faculta que las obras se estén llevando a cabo. Se solicita además el libre acceso al expediente administrativo completo para la revisión de los planos constructivos, cartas de disponibilidad de servicios y actas de inspección técnica”. (Ver informe rendido y prueba aportada al expediente);
  • b)Mediante oficio nro. MSR-AM-GM-DDU-034-2026, del 15 de mayo de 2026, el director del Departamento de Desarrollo Urbano recurrido respondió a las recurrentes: “I. Sobre la legitimación para el acceso al expediente completo Es importante aclarar que, si bien ustedes fungen como regidoras municipales, la presente gestión se tramita a título personal en su condición de "ciudadanas ramonenses", toda vez que no aportan un acuerdo del Concejo Municipal que respalde la solicitud. La jurisprudencia y normativa municipal establecen que, como regla general, cualquier requerimiento formal de informes o documentación institucional solicitada por los regidores en el ejercicio de su cargo debe ser canalizada orgánicamente a través del Alcalde Municipal, a fin de no intervenir en las funciones administrativas directas. Adicionalmente, en cuanto a su petición de obtener libre acceso al expediente administrativo completo y a los planos constructivos, me veo en la obligación de denegar dicha solicitud específica. Si bien el artículo 30 de la Constitución Política garantiza el libre acceso a los departamentos administrativos para obtener información sobre asuntos de interés público, la Municipalidad está obligada a proteger aquella información técnica que revista un carácter particular, personal, privado o de propiedad intelectual (como los planos constructivos de un ente privado). Dado que ustedes no son las propietarias del inmueble ni ostentan representación legal o legitimación registral por parte de la empresa desarrolladora, no es jurídicamente procedente facilitar la copia o revisión irrestricta del expediente interno. II. Sobre la información general y pública del proyecto. No obstante lo anterior, en estricto respeto a su derecho constitucional de petición y en aras de la transparencia administrativa respecto a los proyectos constructivos, dada la información que solicitó el suscrito al Departamento de Planificación Urbana, se procede a brindarles la información general y de carácter público correspondiente al proyecto en consulta: ● Permiso de Construcción: PC-125-2026, CFIA 1276143 ● Nombre del Proyecto: Condominio Horizontal Residencial Monte Sueños ● Desarrollador: Daromacar S.A. (Cédula Jurídica: 3-101-737916) ● Representante: Daniel Cruz Porras ● Ubicación: Provincia de Alajuela, Cantón de San Ramón, Distrito de Ángeles. Finca Folio Real: PRN01. Detalle de lineamientos y aprobaciones: 1. Desfogue Pluvial: Se cuenta con la aprobación respectiva para el Desfogue Pluvial en la finca PRN01, emitida mediante el oficio MSR-AM-DDU-PU-153-2024 del 13 de mayo de 2024, por parte del Ing. Andrés Zúñiga, Jefe del Departamento de Planificación Urbana. 2. Disponibilidad de Agua: Según la revisión del permiso de construcción, así como de la Viabilidad Ambiental, se tiene para los efectos un pozo perforado. 3. Alineamientos y Uso de Suelo: Mediante el Uso de Suelo CRT-1356-2025-AC, se otorgó el Visto Bueno de Ubicación al determinarse que el proyecto es conforme y compatible con la zona. Los parámetros establecidos son: ○ Línea de Prevención Vial: 10 metros ○ Línea de Construcción: 13 metros ○ Huella Constructiva Máxima: 75% ○ Superficie Mínima de Lote: 120.00 m² 4. Viabilidad Ambiental (SETENA): ○ Resolución Inicial: El proyecto cuenta con Viabilidad Ambiental mediante resolución N° 0735-2020-SETENA, vigencia extendida (ver acuerdo ACP-031-2020-SETENA)”. (Ver informe rendido y prueba aportada).

III. SOBRE EL CASO CONCRETO

En el sub lite, se alega que las recurrentes, en su condición de regidoras municipales, el 07 de mayo de 2026 remitieron el oficio nro. CMSR-PNR-PLN-001-2026 al correo electrónico: ...03, dirigido al director del Departamento de Desarrollo Urbano de la Municipalidad de San Ramón, en el que solicitaron información de interés público. Alegan que, si bien se les dio respuesta, sin embargo, se omitió la entrega de lo solicitado, omitió certificar lo peticionado. Lo anterior fue solicitado nuevamente el 11 de ese mismo mes.

Al respecto, del informe rendido bajo fe de juramento por la autoridad recurrida, bajo los apercibimientos, incluso penales, señalados en el numeral 44 de la Ley de la Jurisdicción Constitucional, y la documentación aportada al expediente, se procede a analizar cada una de las consultas realizadas por las tuteladas y la respuesta que les fue dada por la autoridad accionada.

Primero. Propuesta aprobada por la municipalidad del desfogue del proyecto. Respuesta: “Desfogue Pluvial: Se cuenta con la aprobación respectiva para el Desfogue Pluvial en la finca PRN01, emitida mediante el oficio MSR-AM-DDU-PU-153-2024 del 13 de mayo de 2024, por parte del Ing. Andrés Zúñiga, Jefe del Departamento de Planificación Urbana”.

Segundo. Carta o documento de compromiso de "Disponibilidad y Abastecimiento de Aguas" para el proyecto. Presentar prueba documental de la misma emitida por el ente prestatario en ese sector, a saber, AyA, ASADA o algún pozo propio con concesión de la Dirección de Aguas del MINAE. Respuesta: “Disponibilidad de Agua: Según la revisión del permiso de construcción, así como de la Viabilidad Ambiental, se tiene para los efectos un pozo perforado”.

Tercero. Alineamientos y Retiros: Verificación de que el proyecto cumple con los alineamientos de ley y los retiros de construcción establecidos en el Reglamento de Fraccionamiento y Urbanizaciones del INVU, el MOPT, etc. Respuesta: “Alineamientos y Uso de Suelo: Mediante el Uso de Suelo CRT-1356-2025-AC, se otorgó el Visto Bueno de Ubicación al determinarse que el proyecto es conforme y compatible con la zona. Los parámetros establecidos son: ○ Línea de Prevención Vial: 10 metros ○ Línea de Construcción: 13 metros ○ Huella Constructiva Máxima: 75% ○ Superficie Mínima de Lote: 120.00 m² 4”.

Cuarto. Diseño de sitio del del proyecto, donde consten las áreas públicas y comunales a ceder a la municipalidad del cantón, conforme lo establece la Ley de Planificación Urbana y el Reglamento de Fraccionamientos y Urbanizaciones, con la aprobación del INVU y demás instituciones implicadas en este tipo de proyectos. Respuesta: No consta respuesta.

Quinto. Viabilidad Ambiental y Servicios: Constancia de la viabilidad otorgada por SETENA. Respuesta: “Viabilidad Ambiental (SETENA): ○ Resolución Inicial: El proyecto cuenta con Viabilidad Ambiental mediante resolución N° 0735-2020-SETENA, vigencia extendida (ver acuerdo ACP-031-2020-SETENA)”.

Sexto. Copia del "Permiso de Construcción" emitido por la Municipalidad de San Ramón, que faculta que las obras se estén llevando a cabo. Respuesta: No consta respuesta.

Séptimo. Se solicita además el libre acceso al expediente administrativo completo para la revisión de los planos constructivos, cartas de disponibilidad de servicios y actas de inspección técnica”. Respuesta: “. Sobre la legitimación para el acceso al expediente completo Es importante aclarar que, si bien ustedes fungen como regidoras municipales, la presente gestión se tramita a título personal en su condición de "ciudadanas ramonenses", toda vez que no aportan un acuerdo del Concejo Municipal que respalde la solicitud. La jurisprudencia y normativa municipal establecen que, como regla general, cualquier requerimiento formal de informes o documentación institucional solicitada por los regidores en el ejercicio de su cargo debe ser canalizada orgánicamente a través del Alcalde Municipal, a fin de no intervenir en las funciones administrativas directas. Adicionalmente, en cuanto a su petición de obtener libre acceso al expediente administrativo completo y a los planos constructivos, me veo en la obligación de denegar dicha solicitud específica.

Si bien el artículo 30 de la Constitución Política garantiza el libre acceso a los departamentos administrativos para obtener información sobre asuntos de interés público, la Municipalidad está obligada a proteger aquella información técnica que revista un carácter particular, personal, privado o de propiedad intelectual (como los planos constructivos de un ente privado). Dado que ustedes no son las propietarias del inmueble ni ostentan representación legal o legitimación registral por parte de la empresa desarrolladora, no es jurídicamente procedente facilitar la copia o revisión irrestricta del expediente interno”.

Así las cosas, luego de analizadas cada una de las respuestas que la autoridad accionada le brindó a las tuteladas, la Sala acredita la afectación a sus derechos fundamentales. Esto, porque consta el oficio nro. CMSR-PNR-PLN-001-2026, enviado 7 de mayo de 2026; las recurrentes solicitan la certificación de documentos, y de la prueba aportada no se evidencia que le hayan enviado lo peticionado. En efecto, se desprende que la respuesta dada es genérica, ambigua, no son claras ni precisas y no se detalla a cabalidad punto por punto a cada uno, sobre la información que han requerido las tuteladas; que si bien es importante indicar que la administración no está obligada a otorgar información de imposible acceso o porque no está en sus manos o bien porque no exista —esto porque el derecho de petición no es un derecho ilimitado, es un derecho limitado bajo ciertas excepciones—; sin embargo, lo cierto del caso es que siempre tiene que haber una respuesta clara y oportuna y congruente frente al derecho de petición y acceso a la información que tutela a la parte accionante.

Por otro lado, sobre el libre acceso al expediente administrativo completo para la revisión de los planos constructivos, cartas de disponibilidad de servicios y actas de inspección técnica. Sobre este punto, es importante indicar que esta Sala ha indicado que las personas regidoras pueden consultar la información de interés público y los documentos base de los permisos municipales, esto por el deber de fiscalización, control político; sin embargo, están sujetas a limitación en cuanto al tema de propiedad intelectual, por lo que si el expediente contiene planos u obras protegidas por derechos de autor, se permite la consulta visual o revisión para cumplir con el interés público, pero se prohíbe la reproducción o el fotocopiado total o parcial de dichos planos, pues esto no es permitido para terceros, salvo que estén autorizados.

De lo anterior, este Tribunal ha considerado que los documentos que implican una creación intelectual que debe ser protegida, una protección que, a criterio de la Sala, no impide que los planos constructivos puedan ser consultados por terceros, pero no fotocopiarlos. Ejemplo la Sentencia N° 9115-2004, de 11:29 horas de 20 de agosto de 2004, se dispuso:

" (...) Ahora bien, su disconformidad entonces se traduce en la decisión de la autoridad recurrida de autorizar solamente el fotocopiado parcial de dicho expediente, pues según consta en el acta administrativa 282-03-EXT de las quince horas del dieciséis de octubre de dos mil tres, la autoridad recurrida no autorizó la copia de los folios 1 al 84 y 206, 207, 208, 219, 210, 215 y 216 por tratarse de planos protegidos por los derechos del autor. Con lo anterior, no encuentra esta Sala que se haya producido violación alguna a los derechos fundamentales del amparado, toda vez que según informa la autoridad recurrida bajo fe de juramento sí se facilitó el estudio de dichos folios pero no su fotocopia, por tratarse de información eminentemente privada protegida por las leyes de propiedad intelectual. Lo anterior, resulta razonable pues es claro que los planos como invención del ingeniero o arquitecto que realiza la obra deben ser protegidos de su reproducción si no se cuenta con la autorización respectiva de quien está legalmente facultado para darla, para de esta forma evitar cualquier reproducción o plagio del proyecto a desarrollar. Ahora bien, entiende la Sala que los vecinos del proyecto en cuestión pueden tener interés en conocer dichos planos pues en su criterio el proyecto a desarrollarse les produce un daño en sus propiedades, por lo cual evidentemente deben conocer los planteamientos técnicos del proyecto para medir su impacto en sus propiedades. Sin embargo, la recurrida en su informe bajo juramento señala que a pesar que no se ha permitido la copia a los folios del expediente que contienen los planos, sí se ha facilitado su acceso para el estudio y análisis por parte de los interesados, por lo que bien podrían presentarse con un especialista ante la Municipalidad a revisar los planos en cuestión, sin necesidad de fotocopiarlos, para de esta forma medir el eventual impacto que ocasiona la obra en sus propiedades y realizar las impugnaciones respectivas…”. (Lo resaltado es propio).

Por lo anterior, si bien la autoridad accionada les informó a las recurrentes sobre las restricciones del expediente que alegan; sin embargo, no consta que les haya puesto a su disposición la revisión del mismo, así como de certificarles únicamente lo que no está protegido por propiedad intelectual o datos sensibles. De igual forma, si bien consta respuesta a la gestión, la misma no es completa y a fin con lo solicitado; tampoco se aprecia que les hayan dado los documentos que son de acceso público certificados –si los hay– sobre lo gestionado.

En consecuencia, no se puede tener como válida la justificación que la autoridad accionada le dio a las tuteladas y a esta Sala. Por lo que, lo procedente es declarar con lugar el recurso, con la orden para que a las recurrentes se les dé respuesta clara y precisa sobre cada uno de los puntos requeridos. Y se les entregue los documentos certificados que fueron solicitados en la gestión del 07 de mayo de 2026 -que se encuentren en esa municipalidad; de lo contrario, justificar su omisión-, así como dar acceso para la revisión del expediente y se pueda fotocopiar o certificar lo que sí esté permitido, todo esto bajo la advertencia de reservar los datos sensibles y de acceso restringido, protegidos por la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales y demás normativa atinente, y derechos de autor conforme a lo dispuesto por la normativa vigente en materia de protección de propiedad intelectual.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a María Gabriela Jiménez Corrales, alcaldesa, Carlos Greivin Rojas Salas, presidente del Concejo Municipal de San Ramón, y Johnny Montoya Villalobos, director de Desarrollo Urbano, todos de la Municipalidad de San Ramón, o a quienes ocupen esos cargos, para que dentro del ámbito de sus competencias coordinen y gire las órdenes necesarias, a fin de que dentro del plazo de CINCO DÍAS, contados a partir de la notificación de esta sentencia, se le dé respuesta como corresponda a las tuteladas sobre cada una de las gestiones realizadas el 07 de mayo de 2026, en los términos indicados en la parte final del Considerando III de esta sentencia. Lo anterior se dispone con la advertencia de reservar los datos sensibles y de acceso restringido, protegidos por la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales y demás normativa atinente, y Propiedad Intelectual.

Se le advierte a la autoridad recurrida que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Ramón al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. Notifíquese.
