Amparo proceeding filed in expediente number 26-018878-0007-CO, brought by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).

Background:

  1. 1By a filing added to the digital expediente on 27 May 2026, the claimant brings an amparo proceeding. According to the order admitting the proceeding, the claimant states that:

“on 17 February 2026, she requested from the respondent authority the availability of drinking water for the property registered under real-property folio PRN01. That request was registered under consecutive number 2026-00003784-1. Because no response was given to her request, on 7 May 2026 she filed a second request, asking for the current status of the proceeding, a copy of the expediente, among other items, such as a list of availability certificates, negative certificates, water-capacity certificates, or equivalent documents issued in Jicaral in 2026. Despite the foregoing, she alleges that the respondent authority has not responded to her requests and therefore considers her fundamental rights to have been violated. She asks that the application be granted.”

  1. 2By order of the Presidency of the Chamber issued at 10:21 a.m. on 5 June 2026, the proceeding was admitted.
  2. 3By a filing added to the digital expediente on 14 July 2026, Kathia Villalobos de la O, in her capacity as cantonal head of Nicoya of the Costa Rican Institute of Aqueducts and Sewers, reports under oath. She explains:

“In response to the situation underlying the amparo brought by the applicant against the Costa Rican Institute of Aqueducts and Sewers, based on reports No.GSP-RCH-CN-2026-00528, GG-2026-01065, GSP-RCHO-2026-00805 and No. GSP-RCH-CN-2026-00532 and their annexes, which are added to this report for the Constitutional Chamber as evidence and an integral part of the administrative expediente, it is established that: 1. According to the water balance for System CH-A-18 Jicaral, it is in Category II, which indicates that the system has reached its maximum growth. It currently produces 14 l/s, while demand on the system is 16,43 l/s, creating a resource deficit. The system is therefore in a critical situation, with growth restricted. In order to provide continuous, quality service to existing users, the system was restricted and no new equivalent services or branch extensions were approved for projects of any nature.

(See reports No.GSP-RCHCN- 2026-00528, GG-2026-01065 and GSP-RCHO-2026-00805). 2. On 17 February 2026, Ms. Nombre01 did indeed submit a request for service availability for construction of an apartment for residential use on the property registered under folio PRN01, cadastral survey plan PRN02, located 200 meters west of Jicaral School in Lepanto. While the arguments made by the applicant in her amparo are true, it is important to indicate that the request involved several aspects that were not within the control of a single public servant. To exercise the competencies and responsibilities inherent in each public servant’s role and position, and given the nature of the request under review, it was necessary to obtain technical input that would allow a duly reasoned decision consistent with the regulations. Once the technical elements required for decision-making were available, the Administration issued the Certificate of Availability of Aqueduct and Sewer Services No. SIGDD-2026-00003784-1-2-NAP, in accordance with the opinion in memorandum GSP-RCHO-2026-02298 dated 13 July 2026.

Those documents were duly notified to the interested party at email address ...01 on 13 July 2026 and resent on 14 July 2026. (Notification emails and opinion GSP-RCHO-2026-02298 are attached.) 3. No request remains pending resolution, nor has this Administration refused to rule on what was requested, since the petition was addressed by an express act duly communicated to the applicant. It should also be noted that the actions taken were intended to ensure that the decision had sufficient technical support and was consistent with the operating conditions of the supply system, safeguarding the proper provision of the public service and the principles governing management of the water resource. It is stated that, because the ruling requested by the applicant has been issued and notified and the matter has been addressed, no omission by the Administration remains in relation to the request filed (see report GSP-RCH-CN-2026-00532).

II. APPLICABLE REGULATIONS Article 11 and 27 of the Political Constitution, Articles 11 and 16 of the General Law on Public Administration, and Articles 07, 08, 09 and 14 of the Regulations for the Provision of AyA Services. III. CONCLUSIONS The actions taken were intended to obtain a technical opinion accurately reflecting the operating conditions of the Jicaral community’s supply system, all in keeping with the provision of the public service and the principles governing management of the water resource. This Administration considers that there is currently no failure to resolve the request, since the applicant was duly notified of the availability certificates, thereby concluding the request filed (…) V. RELIEF SOUGHT: Our actions have been correct under the regulations governing us; likewise, there have been no arbitrary, capricious, or negligent actions, or deliberate failure to comply.

The applicant has been duly notified and the proceeding is about to conclude. For the foregoing reasons, we request that this Amparo proceeding be denied, that the expediente be ordered archived, and that the Costa Rican Institute of Aqueducts and Sewers be exempted from all liability.”

Justice Garro Vargas drafts this decision; and, Reasons:

I. PRELIMINARY ISSUE

Before considering the merits of the matter, it should be clarified that, beginning with judgment no. 2008002545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with certain exceptions—in cases where the issue is whether the public administration has or has not complied with the time limits established by the General Law on Public Administration (Articles 261 and 325) or by sectoral laws for special administrative proceedings, either to resolve an administrative proceeding by final act—initiated ex officio or at a party’s request—or to hear the applicable administrative appeals. This case falls within an exception, since it concerns a request for drinking-water availability that allegedly was not resolved within a reasonable period.

II. SUBJECT OF THE APPLICATION

The applicant states that, although she submitted a request for drinking water on 17 February 2026, she had received no response by the time this matter was filed. She alleges that on 7 May 2026 she filed a request with ICAA; however, that request also has not been addressed.

III. FACTS ESTABLISHED

The following facts are considered duly established and relevant to the decision in this matter:

  • a)On 17 February 2026, the applicant submitted a request for drinking-water availability in relation to the property with real-property folio no. PRN01. (See documentary evidence).
  • b)On 7 May 2026, the claimant filed a request with ICAA, asking it to:

“1. Report the current status of the request for drinking-water and/or sanitary-sewer availability registered under consecutive number 2026-00003784-1. 2. Indicate the exact stage of the proceeding at which the request stands, the public servant or department currently responsible, the date it entered that stage, and the action pending for resolution. 3. State whether the request was deemed complete as of 17 February 2026 or, if not, indicate the date, content, issuing official, and means of notification of any formal request for correction made to the applicant. 4. Indicate the technical, legal, operational, or administrative reasons explaining the delay in issuing a response, providing sufficient documentary support. 5. Explain the specific reason for failure to meet the time limit established in Article 36 of the Regulations for the Provision of AyA Services, or provide a legal justification for why the Administration considers that time limit inapplicable to this request. 6.

Indicate whether there is a prepared technical opinion, inspection report, water-capacity analysis, hydraulic-capacity analysis, network analysis, internal recommendation, or any other document related to the request; and, if so, provide copies of those documents. 7. Provide a complete, organized, and legible copy of the administrative expediente corresponding to request 2026-00003784-1, including forms, submitted requirements, internal communications, consultations, technical reports, system logs, requests for correction, assignments, and any related action. 8. Expressly resolve and notify the request for availability submitted, with reasons and technical grounds, whether positively, negatively, conditionally, or as otherwise legally appropriate. 9. Certify whether, during 2026, certificates of service availability, negative certificates, water-capacity certificates, or equivalent documents have been issued for properties located in the Jicaral area. 10.

Provide a list of availability certificates, denials, or equivalent certificates issued during 2026 in the Jicaral area, indicating at least: consecutive number, request date, issuance date, type of certificate, positive/negative/conditional result, general sector or location, number of services approved, assigned flow rate if any, issuing department, and the time elapsed between the request and resolution. If deemed necessary to protect personal data, I request that the list be provided in anonymized or redacted form, without omitting administrative and technical data of public interest. 11. Indicate whether an institutional policy, circular, order, directive, moratorium, restriction, regional opinion, or administrative decision is affecting the issuance of availability certificates in Jicaral during 2026; and, if so, provide a complete copy of that act or document. 12. Indicate the corrective measures adopted or to be adopted to prevent continued failure to meet the regulatory deadline and to ensure prompt resolution of this request (…) For purposes of receiving notifications, I designate the email address: ...01.” (See documentary evidence).

  • c)On 9 July 2026, the respondent authority was notified of the order admitting this proceeding. (See notification record).
  • d)On 13 July 2026, ICAA notified the protected party of the result of the request for water availability. (See documentary evidence).
  • e)ICAA has not addressed the request filed by the applicant on 7 May 2026. (Undisputed fact).

IV. THE SPECIFIC CASE

In this case, the Chamber finds that ICAA violated the fundamental rights of the amparo applicant.

First, although the applicant submitted a request for drinking-water availability in relation to the property with real-property folio no. PRN01 on 17 February 2026, it is nonetheless true that ICAA did not notify her of the result of the proceeding until 13 July 2026—that is, almost five months later and after the respondent authority had been notified of the order admitting this proceeding.

Second, in the case under review, ICAA did not specifically address the request filed by the applicant on 7 May 2026, through which she asked:

“1. Report the current status of the request for drinking-water and/or sanitary-sewer availability registered under consecutive number 2026-00003784-1. 2. Indicate the exact stage of the proceeding at which the request stands, the public servant or department currently responsible, the date it entered that stage, and the action pending for resolution. 3. State whether the request was deemed complete as of 17 February 2026 or, if not, indicate the date, content, issuing official, and means of notification of any formal request for correction made to the applicant. 4. Indicate the technical, legal, operational, or administrative reasons explaining the delay in issuing a response, providing sufficient documentary support. 5. Explain the specific reason for failure to meet the time limit established in Article 36 of the Regulations for the Provision of AyA Services, or provide a legal justification for why the Administration considers that time limit inapplicable to this request. 6.

Indicate whether there is a prepared technical opinion, inspection report, water-capacity analysis, hydraulic-capacity analysis, network analysis, internal recommendation, or any other document related to the request; and, if so, provide copies of those documents. 7. Provide a complete, organized, and legible copy of the administrative expediente corresponding to request 2026-00003784-1, including forms, submitted requirements, internal communications, consultations, technical reports, system logs, requests for correction, assignments, and any related action. 8. Expressly resolve and notify the request for availability submitted, with reasons and technical grounds, whether positively, negatively, conditionally, or as otherwise legally appropriate. 9. Certify whether, during 2026, certificates of service availability, negative certificates, water-capacity certificates, or equivalent documents have been issued for properties located in the Jicaral area. 10.

Provide a list of availability certificates, denials, or equivalent certificates issued during 2026 in the Jicaral area, indicating at least: consecutive number, request date, issuance date, type of certificate, positive/negative/conditional result, general sector or location, number of services approved, assigned flow rate if any, issuing department, and the time elapsed between the request and resolution. Indicate whether an institutional policy, circular, order, directive, moratorium, restriction, regional opinion, or administrative decision is affecting the issuance of availability certificates in Jicaral during 2026; and, if so, provide a complete copy of that act or document. 12. Indicate the corrective measures adopted or to be adopted to prevent continued failure to meet the regulatory deadline and to ensure prompt resolution of this request (…) For purposes of receiving notifications, I designate the email address: ...01.” Consequently, the application is granted in accordance with the operative part of this ruling.

V. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum, the legal controversy must be heard by the Administrative Litigation Courts, not by this Chamber. However, with the recent enactment of Law No. 9097, Law on the Regulation of the Right of Petition, it has been established that this right is subject to judicial protection through the amparo proceeding established by Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s acts in fact, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted regulations do not require this Court to change its line of precedent. Under Article 7 of its Law, this Court alone is responsible for defining its own jurisdiction.

Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases properly heard in this jurisdiction through the constitutional amparo proceeding, the competent judges in all other cases, for the reasons this Court has given (judgment No. 2008-02545 issued at 8:55 a.m. on 22 February 2008), are the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.

VI. DOCUMENTATION ADDED TO THE EXPEDIENTE

The parties are advised that, if they submitted any paper document, objects, or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected within a maximum period of 30 business days, counted from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulations on the Electronic Expediente before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.

Therefore:

The amparo proceeding is granted. Kathia Villalobos de la O, in her capacity as cantonal head of Nicoya of the Costa Rican Institute of Aqueducts and Sewers, or whoever holds that position, is ordered to take all necessary measures and coordinate as appropriate, within the scope of her authority, so that, within FIVE DAYS from notification of this judgment, the request filed on 7 May 2026 is addressed as required by law and the corresponding notification is sent to the applicant at the means designated for that purpose. This is ordered while safeguarding personal data subject to restricted access, confidential data, and sensitive data, in accordance with the regulations in force. Any costs arising from the requested copies shall be borne by the interested party. The respondent authority is advised that, under Article 71 of the Law on Constitutional Jurisdiction, imprisonment for three months to two years or a fine of twenty to sixty days will be imposed on anyone who receives an order that must be complied with or enforced, issued in an amparo proceeding, and fails to comply with or enforce it, provided the offense is not subject to a more severe penalty.

The Costa Rican Institute of Aqueducts and Sewers is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in execution of judgment before the administrative-litigation jurisdiction. Justice Castillo Víquez records a note. Notify the parties.

Recurso de amparo que se tramita en expediente número 26-018878-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito incorporado al expediente digital el 27 de mayo de 2026, la parte accionante interpone recurso de amparo. Expone, según la resolución de curso del proceso, que:

“el 17 de febrero de 2026, solicitó ante la autoridad recurrida la disponibilidad de agua potable para el inmueble con matrícula de folio real PRN01. Esa gestión se registró con el consecutivo 2026-00003784-1. Debido a que no se daba respuesta a su requerimiento, el 7 de mayo de 2026, planteó una segunda gestión, donde pidió el estado actual del trámite, copia del expediente, entre otros rubros, como listado de disponibilidades, constancias negativas, constancias de capacidad hídrica o documentos equivalentes emitidos en Jicaral en 2026. Pese a lo dicho, acusa que la autoridad recurrida no ha brindado respuesta a sus gestiones, por lo que, estima vulnerados sus derechos fundamentales. Pide se declare con lugar el recurso”.

  1. 2Mediante resolución de la Presidencia de la Sala de las 10:21 horas del 5 de junio de 2026, se dio curso al proceso.
  2. 3Por escrito incorporado al expediente digital el 14 de julio de 2026, informa bajo juramento Kathia Villalobos de la O, en su condición de jefa cantonal de Nicoya del Instituto Costarricense de Acueductos y Alcantarillados. Explica:

“En atención a la situación objeto del amparo planteado por el recurrente contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en los informes No.GSP-RCH-CN-2026-00528, GG-2026-01065, GSP-RCHO-2026-00805 y No. GSP-RCH-CN-2026-00532 y sus anexos, los cuales son agregados a este informe para la Sala Constitucional, como prueba y parte integral del expediente administrativo, queda demostrado que: 1. De acuerdo con el Balance Hídrico del Sistema CH-A-18 Jicaral, se encuentra en la categoría II lo que indica que el sistema alcanzó su crecimiento máximo. Actualmente se producen 14 l/s y el sistema demanda 16,43 l/s situación que genera un déficit del recurso, por lo que el sistema se encuentra en una situación crítica y restringida en cuanto a crecimiento se refiere y en aras de brindar un servicio continuo y de calidad a los servicios existentes, se procedió a restringir el sistema y a no aprobar nuevos servicios equivalentes ni extensiones de ramal para proyectos de cualquier naturaleza.

Que efectivamente en fecha del 17 febrero 2026, la señora Nombre01 presenta solicitud de Disponibilidad de Servicios para la construcción de un apartamento para fines residenciales en el inmueble en la finca con matrícula PRN01, plano catastro PRN02. ubicado 200 metros oeste de la Escuela de Jicaral en Lepanto, si bien es cierto lo argumentado por la recurrente en su amparo interpuesto es importante indicar que la gestión solicitada existen, varios aspectos que no están en poder de un solo servidor público, requiriendo para el ejercicio de las competencias y responsabilidades propias del rol y cargo que ostente cada persona servidora pública y para el caso bajo estudio dada la naturaleza de la gestión, resultaba necesario contar con los insumos técnicos que permitieran emitir un pronunciamiento debidamente fundamentado y conforme a la normativa, asimismo una vez disponibles los elementos técnicos requeridos para la toma de decisión, la Administración procedió a emitir la Constancia de Disponibilidad de Servicios de Acueducto y Alcantarillado N°SIGDD-2026-00003784-1-2-NAP, conforme al criterio con el memorando GSP-RCHO-2026-02298 de fecha 13 de julio de 2026, documentos que fueron debidamente notificado a la interesada al correo ...01 en fechas del 13 de julio 2026 y reenviado nuevamente en fecha del 14 de Julio 2026.

(Se adjunta correos de notificación y criterio GSP-RCHO-2026-02298). 3. Que no existe una gestión pendiente de resolución ni una negativa de esta Administración a pronunciarse sobre lo solicitado, toda vez que la petición fue atendida mediante acto expreso y debidamente comunicado a la recurrente. Asimismo, debe señalarse que las actuaciones realizadas tuvieron como finalidad garantizar que la decisión adoptada contara con sustento técnico suficiente y fuera consistente con las condiciones operativas del sistema de abastecimiento, resguardando la adecuada prestación del servicio público y los principios que regulan la gestión del recurso hídrico. Se indica que al haberse emitido y notificado el pronunciamiento requerido por la recurrente y la situación ha sido atendida, no subsiste una omisión por parte de la administración con la solicitud gestionada (Ver informe GSP-RCH-CN-2026-00532).

II. NORMATIVA APLICABLE Artículo 11, y 27 de la Constitución Política, artículos 11 y 16 de la Ley General de la Administración Pública, y artículos 07, 08, 09 y 14, del Reglamento para la Prestación de los Servicios de AyA. III. CONCLUSIONES Que, las actuaciones realizadas tuvieron como finalidad contar con un criterio técnico que plasmara de forma real las condiciones operativas del sistema de abastecimiento, de la comunidad de Jicaral todo conforme a la prestación del servicio público y los principios que regulan la gestión del recurso hídrico. Esta Administración considera que actualmente no existe incumplimiento en la resolución del trámite dado que la recurrente fue debidamente notificada con las certificaciones de disponibilidad, dando por concluido la solicitud gestionada (…) V. PETITORIA: Que nuestras actuaciones han sido las correctas de conformidad con la normativa que nos rige, asimismo, no existen actuaciones arbitrarias, antojadizas, negligentes o incumplimiento deliberado a fecha la recurrente está debidamente notificada y el trámite esta por concluido por lo antes expuesto, solicitamos, se declare sin lugar el presente Recurso de Amparo y se ordene archivar el expediente y se exima de toda responsabilidad al Instituto Costarricense de Acueductos y Alcantarillados”.

  1. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I. CUESTIÓN PREVIA

Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante una solicitud de disponibilidad de agua potable que presuntamente no ha sido resuelta dentro de un plazo razonable.

II. OBJETO DEL RECURSO

La recurrente señala que, pese a que desde el 17 de febrero de 2026 formuló una solicitud de agua potable, a la fecha de interposición de este asunto, no ha tenido respuesta. Acusa que el 7 de mayo de 2026 planteó una gestión ante el ICAA; empero, tampoco ha sido atendida.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 17 de febrero de 2026, la recurrente planteó una solicitud de disponibilidad de agua potable en relación con la propiedad con folio real nro. PRN01. (Ver prueba documental).
  • b)El 7 de mayo de 2026, la accionante formuló una gestión ante el ICAA, mediante la cual solicitó:

“1. Informe el estado actual de la solicitud de disponibilidad de agua potable y/o alcantarillado sanitario registrada bajo el consecutivo 2026-00003784-1. 2. Indique la etapa exacta del trámite en que se encuentra la solicitud, el funcionario o dependencia responsable actual, la fecha de ingreso a esa etapa y la actuación pendiente para resolver. 3. Señale si la solicitud fue calificada como completa desde el 17 de febrero de 2026 o, en caso contrario, indique la fecha, contenido, funcionario emisor y medio de notificación de cualquier prevención formal realizada a la solicitante. 4. Indique las razones técnicas, legales, operativas o administrativas que expliquen el atraso en la emisión de la respuesta, aportando respaldo documental suficiente. 5. Explique la razón concreta del incumplimiento del plazo previsto en el artículo 36 del Reglamento para la Prestación de los Servicios de AyA, o bien justifique jurídicamente por qué considera la Administración que dicho plazo no resulta aplicable al presente trámite. 6.

Indique si existe criterio técnico elaborado, informe de inspección, análisis de capacidad hídrica, análisis de capacidad hidráulica, análisis de red, recomendación interna o cualquier otro documento relacionado con la solicitud; y, de existir, remita copia de dichos documentos. 7. Remita copia integral, ordenada y legible del expediente administrativo correspondiente a la solicitud 2026-00003784-1, incluyendo formularios, requisitos aportados, comunicaciones internas, consultas, informes técnicos, bitácoras del sistema, prevenciones, asignaciones y cualquier actuación relacionada. 8. Resuelva y notifique, de manera expresa, motivada y técnicamente fundamentada, la solicitud de disponibilidad presentada, sea en sentido positivo, negativo, condicionado o conforme corresponda jurídicamente. 9. Certifique si durante el año 2026 se han emitido constancias de disponibilidad de servicios, constancias negativas, constancias de capacidad hídrica o documentos equivalentes respecto de inmuebles ubicados en la zona de Jicaral. 10.

Remita listado de las disponibilidades, negativas o constancias equivalentes emitidas durante el año 2026 en la zona de Jicaral, indicando al menos: consecutivo, fecha de solicitud, fecha de emisión, tipo de constancia, resultado positivo/negativo/condicionado, sector o ubicación general, cantidad de servicios aprobados, caudal asignado si lo hubiere, dependencia emisora y plazo transcurrido entre solicitud y resolución. En caso de estimarse necesario por protección de datos personales, solicito que el listado sea entregado en versión anonimizada o testada, sin omitir los datos administrativos y técnicos de interés público. 11. Indique si existe una política institucional, circular, orden, directriz, moratoria, restricción, criterio regional o decisión administrativa que esté afectando la emisión de disponibilidades en Jicaral durante el año 2026; y, de existir, remita copia integra de dicho acto o documento. 12.

Indique las medidas correctivas adoptadas o por adoptar para evitar que se mantenga el incumplimiento del plazo reglamentario y para garantizar la pronta resolución de la presente solicitud (…) Para recibir notificaciones señalo el correo electrónico: ...01”. (Ver prueba documental).

  • c)El 9 de julio de 2026, la autoridad recurrida fue notificada de la resolución de curso de este proceso. (Ver acta de notificación).
  • d)El 13 de julio de 2026, el ICAA notificó a la tutelada el resultado de la solicitud de disponibilidad de agua formulada. (Ver prueba documental).
  • e)El ICAA no ha atendido la gestión interpuesta por la recurrente el 7 de mayo de 2026. (Hecho incontrovertido).

IV. SOBRE EL CASO CONCRETO

En el sub lite, la Sala acredita la lesión a los derechos fundamentales de la amparada por parte del ICAA.

Primeramente, aun cuando, desde el 17 de febrero de 2026, la recurrente planteó una solicitud de disponibilidad de agua potable en relación con la propiedad con folio real nro. PRN01, no menos cierto es que no fue sino hasta el 13 de julio de 2026, a saber, casi cinco meses después y con posterioridad a que la autoridad recurrida fue notificada de la resolución de curso del proceso, cuando el ICAA notificó el resultado del trámite.

De segundo, en el caso bajo estudio se echa de menos que el ICAA haya atendido de manera específica la gestión formulada por la recurrente el 7 de mayo de 2026, por medio de la cual solicitó: “1. Informe el estado actual de la solicitud de disponibilidad de agua potable y/o alcantarillado sanitario registrada bajo el consecutivo 2026-00003784-1. 2. Indique la etapa exacta del trámite en que se encuentra la solicitud, el funcionario o dependencia responsable actual, la fecha de ingreso a esa etapa y la actuación pendiente para resolver. 3. Señale si la solicitud fue calificada como completa desde el 17 de febrero de 2026 o, en caso contrario, indique la fecha, contenido, funcionario emisor y medio de notificación de cualquier prevención formal realizada a la solicitante. 4. Indique las razones técnicas, legales, operativas o administrativas que expliquen el atraso en la emisión de la respuesta, aportando respaldo documental suficiente. 5.

Explique la razón concreta del incumplimiento del plazo previsto en el artículo 36 del Reglamento para la Prestación de los Servicios de AyA, o bien justifique jurídicamente por qué considera la Administración que dicho plazo no resulta aplicable al presente trámite. 6. Indique si existe criterio técnico elaborado, informe de inspección, análisis de capacidad hídrica, análisis de capacidad hidráulica, análisis de red, recomendación interna o cualquier otro documento relacionado con la solicitud; y, de existir, remita copia de dichos documentos. 7. Remita copia integral, ordenada y legible del expediente administrativo correspondiente a la solicitud 2026-00003784-1, incluyendo formularios, requisitos aportados, comunicaciones internas, consultas, informes técnicos, bitácoras del sistema, prevenciones, asignaciones y cualquier actuación relacionada. 8. Resuelva y notifique, de manera expresa, motivada y técnicamente fundamentada, la solicitud de disponibilidad presentada, sea en sentido positivo, negativo, condicionado o conforme corresponda jurídicamente. 9.

Certifique si durante el año 2026 se han emitido constancias de disponibilidad de servicios, constancias negativas, constancias de capacidad hídrica o documentos equivalentes respecto de inmuebles ubicados en la zona de Jicaral. 10. Remita listado de las disponibilidades, negativas o constancias equivalentes emitidas durante el año 2026 en la zona de Jicaral, indicando al menos: consecutivo, fecha de solicitud, fecha de emisión, tipo de constancia, resultado positivo/negativo/condicionado, sector o ubicación general, cantidad de servicios aprobados, caudal asignado si lo hubiere, dependencia emisora y plazo transcurrido entre solicitud y resolución. Indique las medidas correctivas adoptadas o por adoptar para evitar que se mantenga el incumplimiento del plazo reglamentario y para garantizar la pronta resolución de la presente solicitud (…) Para recibir notificaciones señalo el correo electrónico: ...01”.

En consecuencia, se acoge el recurso de acuerdo con lo establecido en la parte dispositiva de este pronunciamiento.

V. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara con lugar el recurso. Se le ordena a Kathia Villalobos de la O, en su condición de jefa cantonal de Nicoya del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe ese cargo, que disponga todas las medidas necesarias y coordine lo pertinente, dentro del ámbito de sus competencias, a fin de que, en el plazo de CINCO DÍAS, contado a partir de la notificación de esta sentencia, se atienda como en derecho corresponda la gestión del 7 de mayo de 2026 y se le notifique lo correspondiente a la parte recurrente al medio señalado para tales efectos. Lo anterior se dicta salvaguardando los datos personales de acceso restringido, confidenciales y sensibles, de acuerdo con la normativa vigente. En caso de incurrirse en algún costo producto de las copias requeridas, el mismo correrá a cargo de la parte interesada. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. Notifíquese.
