Background:

I.Object of the amparo. The applicants state that the respondent municipality suspends the drinking-water service for prolonged periods. At their residence, water is supplied for only one hour in the morning and one hour at night.
II.Facts found. The following facts are deemed duly established as relevant to deciding this matter, either because they have been proven or because the respondent failed to address them, as required by the initial order:
III.The specific case. In this case, the applicants state that the respondent municipality suspends the drinking-water service for prolonged periods. At their residence, water is supplied for only one hour in the morning and one hour at night.
Having examined the case file, the Chamber found that the amparo beneficiary resides in Aserrí, whose water system is administered by the respondent municipality. On 27 May 2026, the National Emergency Commission declared a green alert in several cantons, including Aserrí, due to the consolidation of the El Niño phenomenon. Due to drought and water-supply problems, the respondent Municipality established water supply and rationing schedules, which have been published on social media and the institutional website. The respondent municipality distributes water by hired tanker trucks or municipal vehicles in the sectors affected by rationing. In addition, the respondent municipality assists subscribers, through chats, telephone calls, or in-person visits, when they have water-supply problems that do not conform to the supply and rationing schedule. The purpose is to add them to the tanker-truck route list or to make a home visit to assess why they are not receiving water during the established schedule.
The Court recently heard a similar case against the Municipality of Aserrí, in which it ruled:
“I.- Object of the amparo. The applicant states that she is a resident of Aserrí, Dirección01, and that she has not received drinking-water service at her home for twenty-two days. She considers her fundamental rights to have been violated.
II.Facts found. The following facts are deemed duly established as relevant to deciding this matter, either because they have been proven or because the respondent failed to address them, as required by the initial order:
III.Facts not proven. The following facts relevant to this decision are not deemed established:
SOLE FACT. That the beneficiary went without drinking-water service at her home for twenty-two days and that this situation was brought to the attention of the respondent authorities.
IV.Drinking-water service. The relationship between Articles 21 and 50 of the Political Constitution gives rise to the rights to life, health, and a healthy and ecologically balanced environment. These rights are closely connected, since life, as the Constitution’s supreme value, calls for special protection: without life, protecting the other fundamental rights would have little value. Accordingly, life must be protected in all its dimensions—physical, mental, and environmental—and this is precisely why protecting the environment and natural resources is important, in order to promote people’s well-being. Among other things, that well-being is achieved by protecting and preserving the quality and quantity of water resources so that the water is potable for human consumption and thereby protects people’s health. Because water is necessary for hygiene, food, and drinking, its contamination can seriously harm public health.
In this regard, the State must provide the referenced protection and conservation through the bodies it designates for that purpose. Those bodies must adopt the measures necessary to guarantee everyone access to this resource and ensure those measures are followed. In this context, the right to water arises, and this Constitutional Court may protect it through an amparo proceeding (Judgment No. 2007-005482, issued at 14:39 on 24 April 2007, reiterated on numerous occasions, including No. 2007-005482, issued at 09:20 on 31 January 2025).
V.Merits. Based on the explanation given by the Mayor of Aserrí and confirmed by the report submitted by the authorities of the Costa Rican Institute of Aqueducts and Sewers, this Chamber rules out a violation of the beneficiary’s fundamental rights. The evidence shows that the water deficit in the Aserrí community results from reduced water-tank volume and the canton’s topography, and is unrelated to infrastructure problems. The water-system authorities have therefore had to implement consumption-regulation measures in multiple sectors within the area served by the system, with the aim of ensuring continuity of service.
In similar cases, the Chamber has found it appropriate to adopt measures to distribute the available supply and thereby ensure the greatest possible supply to existing users, since the situation is not attributable to the respondent institution (see, in this regard, Judgments No. 2016-14465, issued at 9:05 on 7 October 2016; No. 2014-9134, issued at 14:05 on 19 June 2014; and No. 2016-7240, issued at 09:20 on 27 May 2017, among others).
Accordingly, the reported situation is caused by natural problems affecting the availability of water resources and by low flow pressure during the dry season. These circumstances constitute force majeure not attributable to the Municipal Corporation. In response to this problem, the respondent Municipality has taken the necessary steps to minimize its effects and ensure drinking water for everyone in the area, through rationing or service suspensions for some hours during the day and water deliveries by tanker trucks making rounds in the affected areas. In addition, the rationing schedules and tanker-truck schedules have been communicated to residents of the affected sectors through posts on the Municipality’s website and social media. This enables affected residents to take appropriate measures and store water for basic needs.
Note that the respondent Municipality has not made prolonged or severe service interruptions. Rather, the interruptions have been scheduled to ensure that the entire community has water at different times and can collect and store water in tanks, etc.
Furthermore, there is no evidence that the applicant reported having gone several days without drinking-water service. The respondent authorities learned of the situation only through this amparo proceeding and will visit her home to determine the cause of the problem. This is the first step before a tanker truck is sent.
Moreover, given these circumstances, if the applicant considers that the community where she resides has not been duly informed of service suspensions, that complaint must be submitted to the authorities of the respondent Municipality.
As for the Costa Rican Institute of Aqueducts and Sewers, there is no evidence that it violated any fundamental right of the applicant, since it does not supply drinking water to the canton of Aserrí and was not responsible for the supply shortages scheduled by the Municipality of Aserrí.
VI.Conclusion. From the foregoing, it is established that, due to problems of natural origin, the Municipal Corporation has had to impose temporary rationing of drinking-water service in the area where the user lives. The Chamber has upheld rationing as a measure in response to water-resource scarcity, provided that it does not leave the population’s basic needs unmet, is temporary and lasts only some hours, is communicated to residents, and, where appropriate, tanker trucks are sent.
Therefore, no violation of the applicant’s fundamental rights is established, and the amparo proceeding must be dismissed.” (Judgment no. 2026-22360, issued at 9:30 on 19 June 2026).
Now, as in the quoted precedent, the Court finds that the situation is caused by a natural phenomenon affecting the drinking-water supply and requiring measures to distribute the resource appropriately, such as rationing and service suspensions. The Court has also verified that the respondent municipality has sought to mitigate the effects of the drought by delivering water through tanker trucks. Subscribers may also raise their concerns so that their homes may be added to the list for home delivery or so that an on-site visit may be made to inspect and address the problem. In light of the foregoing, the amparo proceeding is dismissed.
IV.Documents submitted to the case file. The parties are advised that, if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect them within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.
Therefore:

Recurso de amparo que se tramita en el expediente nro. 26-017838-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, a favor de Nombre02, cédula de identidad CED02, contra la MUNICIPALIDAD DE ASERRÍ.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. La parte recurrente manifiesta que la municipalidad accionada suspende el servicio de agua potable de manera prolongada. En su lugar de residencia, el suministro se da solo una hora en la mañana y una en la noche.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
III.Sobre el caso concreto. En el sub examine, la parte recurrente manifiesta que la municipalidad accionada suspende el servicio de agua potable de manera prolongada. En su lugar de residencia, el suministro se da solo una hora en la mañana y una en la noche.
Analizados los autos, la Sala tuvo por probado que la parte tutelada habita en Aserrí, cuyo acueducto es administrado por la municipalidad accionada. El 27 de mayo de 2026, la Comisión Nacional de Emergencias declaró alerta verde en varios cantones, incluido Aserrí, por la consolidación de el fenómeno de El Niño. Debido al problema de sequía y desabastecimiento de agua, la Municipalidad recurrida estableció horarios de suministro y racionamiento del agua que han sido publicados en redes sociales y la página web institucional. La municipalidad accionada distribuye agua mediante camiones cisterna contratados o vehículos municipales en los sectores afectados por el racionamiento. Además, la municipalidad recurrida atiende, mediante chats, llamadas telefónicas o visita presencial, a los abonados que presentan problemas de suministro de agua y que no se ajustan al horario de suministro y racionamiento con el propósito de incluirlos en la lista de recorrido de camiones cisterna o para realizar una visita domiciliar y valorar el motivo de que no reciban agua durante el horario establecido.
Ahora bien, este Tribunal conoció recientemente un caso análogo en contra de la Municipalidad de Aserrí, en el que dispuso:
“I.- Objeto del recurso. La recurrente manifiesta que, es vecina de Aserrí, Dirección01, y desde hace veintidós días no le llega el servicio de agua potable a su casa. Considera lesionado sus derechos fundamentales.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución
ÚNICO. Que durante veintidós días, la tutelada no haya tenido suministro de agua potable en su vivienda y que dicha situación haya sido puesta en conocimiento a las autoridades recurridas.
IV.Sobre el servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.
En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).
V.Sobre el fondo. En este caso, de lo explicado por el Alcalde de Aserrí y lo confirmado por el informe rendido por las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, esta Sala descarta que, se hayan quebrantado los derechos fundamentales de la amparada. Al respecto, se acredita, que el déficit de agua que presenta la comunidad de Aserrí es producto de la disminución en el volumen de los tanques de agua y de la topografía del cantón, y no relacionada con problemas en la infraestructura. De manera, que las autoridades del acueducto se han visto obligadas a implementar medidas de regulación del consumo en múltiples sectores dentro del área de cobertura del acueducto, con el fin de garantizar la continuidad del servicio.
En casos similares, la Sala ha estimado procedente adoptar determinadas medidas para distribuir lo obtenido, y así garantizar el suministro posible a los usuarios ya existentes, pues dicha situación no resulta imputable a la institución recurrida (ver en este sentido las Sentencias N° 2016-14465 de las 9:05 horas del 7 de octubre de 2016, N° 2014-9134 de las 14:05 horas del 19 de junio de 2014 y N° 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras).
Así las cosas, la situación denunciada es provocada por inconvenientes de origen natural vinculados a la disponibilidad del recurso hídrico, y con la baja presión del caudal por la época seca, lo cual constituye circunstancias de fuerza mayor no atribuibles a la Corporación Municipal. Ante esta problemática, la Municipalidad recurrida ha tomado las acciones necesarias para minimizar la situación y garantizar el agua potable a todas las personas que habitan en la zona mediante de racionamiento o suspensiones del servicio, por algunas horas durante el día, y mediante el suministro de agua a través de camiones cisterna que hacen los recorridos por las zonas afectadas. Aunado a ello, los horarios de dichos racionamientos han sido comunicado a los vecinos de los sectores afectados mediante publicaciones en la página de la Municipalidad y en redes sociales, lo mismo que el horario de los camiones cisterna. De esta forma, los vecinos perjudicados pueden tomar las medidas pertinentes y almacenar el agua para las necesidades básicas.
Nótese que, la Municipalidad recurrida no ha efectuado interrupciones prolongadas o severas del servicio, sino que las mismas han sido programadas con el fin de garantizar que toda la comunidad tenga agua a diferentes horas y que aprovechen para recoger agua y almacenarla en tanques, etc.
Además, no consta que la recurrente haya denunciado que ha permanecido durante varios días sin la dotación del servicio de agua potable, siendo que fue con ocasión del presente recurso, que las autoridades recurridas tuvieron conocimiento de la situación y procederán a realizar una visita en su vivienda para determinar la causa del problema, esto como primer paso previo al envió de un camión cisterna.
Por otra parte, dadas esas particularidades, si la recurrente estima que la comunidad donde reside no ha sido debidamente informada de las suspensiones del servicio, ello constituye una queja que debe ser presentada, ante las autoridades de la Municipalidad accionada.
En cuanto al Instituto Costarricense de Acueductos y Alcantarillados, no se verifica que haya lesionado derecho fundamental alguno a la recurrente, toda vez que no abastece de agua potable al cantón de Aserrí ni ha sido responsable de los desabastecimientos programados por la Municipalidad de Aserrí.
VI.Conclusión. De lo expuesto, se verifica que debido a los inconvenientes de origen natural, la Corporación Municipal ha tenido la obligación de aplicar racionamientos temporales del servicio de agua potable en la zona donde vive la usuaria siendo que la Sala ha avalado como medida, el racionamiento debido a la escasez del recurso hídrico, siempre que con ello, no se desatienda las necesidades básicas de la población, que sea de carácter temporal y por algunas horas, lo cual debe ser informado a los pobladores, y si es el caso, y enviar camiones cisternas.
Por ende, no se constata lesión alguna a los derechos fundamentales del recurrente y lo procedente es declarar sin lugar el recurso”. (Sentencia nro. 2026-22360 de las 9:30 horas del 19 de junio de 2026).
Ahora bien, al igual que en el precedente transcrito, se determina que la situación es causada por un fenómeno natural que afecta el suministro de agua potable y que obliga tomar acciones para distribuir adecuadamente el recurso, tales como su racionamiento y suspensiones de servicio. Este Tribunal ha verificado, además, que la municipalidad recurrida ha procurado mitigar la afectación de la sequía mediante el suministro a través de camiones cisterna. Incluso, los abonados tienen la posibilidad de plantear su disconformidad, a los efectos de que se incluya su vivienda en la lista de distribución a domicilio o que efectúe una visita in situ para inspeccionar y atender el problema. En virtud de lo expuesto, se declara sin lugar el recurso.
IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso.
