Amparo proceeding filed in case number 26-025459-0007-CO by [Nombre 001], identity card [Valor 001], against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA), THE MINISTRY OF HEALTH, AND THE MUNICIPALITY OF GOICOECHEA.
BACKGROUND:
“Regarding the requests made by the petitioner, this Directorate considers it important to point out that: 1- The schedule for constructing, enabling, and commissioning the sanitary sewer is determined exclusively by the Costa Rican Institute of Aqueducts and Sewers. 2- Decisions concerning health orders, risks to public health, and sanitation measures fall within the Ministry of Health’s authority. 3- The Municipality of Goicoechea lacks legal authority to authorize use of sanitary infrastructure administered by AYA when it has not been officially enabled to receive household connections.
“Likewise, regarding the facts alleged by the petitioner, official letter MG-AG-DGA-311-2026, dated 24 July 2026 and signed by Eng. Harry Ortega López, acting director of Environmental Management of the Municipality of Goicoechea, which forms part of our evidence, states: The Costa Rican Institute of Aqueducts and Sewers has sanitary sewer infrastructure at the site, which has NOT been commissioned for operation. Any current use of that infrastructure is illegal, with significant environmental repercussions because it is being used empirically and because of the type of waste people are attempting to dispose of. As set out in report MG-AG-DI-01879-2026, point 3, the illegal connections were made even to wells intended to receive stormwater, which clearly represents a significant negative environmental impact (odors, blockages, and possible harm to the health of local residents). By means of health orders, the Ministry of Health ordered the closure of the illegal connections to eliminate the risk, and that measure is currently being complied with.
Several properties were built with their respective permits and wastewater disposal methods before the construction of the AyA sewer infrastructure, so reusing those systems should not pose a risk if they were originally built according to the applicable technical guidelines.” The Municipality requests that the Chamber deny the amparo proceeding.
“The facts set out show that this Health Area Directorate, from the time it learned of the situation in January 2026, acted diligently and in coordination with the Costa Rican Institute of Aqueducts and Sewers and the Municipality of Goicoechea, within the scope of its health oversight and sanitary policing powers established in Articles 1, 2, 340, 341, and 344 of the General Health Law, No. 5395. It should be noted that construction, administration, operation, and commissioning of sanitary sewer infrastructure are legally the responsibility of the Costa Rican Institute of Aqueducts and Sewers, under its constitutive law; this is not the responsibility of the Ministry of Health, whose authority concerning wastewater disposal is limited to ensuring that it is carried out properly and in sanitary conditions, and to ordering the corrective measures necessary to prevent risks to public health, under Articles 285 through 293 of the General Health Law.
In that regard, the joint notice signed by the three institutions did not deny the existence of the sanitary sewer network. Rather, it responded to the technical finding of illegal connections to the stormwater system and to the non-operational sanitary sewer, with direct discharge into sanitary wells Nos. 160A-059, 160A-0152, and 1060A-051—a situation that caused concrete harm to residents downstream of the discharge point and a resulting risk to public health and the environment in the area. The measure closing those wells, notified with a period of three calendar months, was therefore not an arbitrary decision directed against the petitioner or the petitioner’s neighbors, but a general health measure, supported by technical reasons and adopted for the benefit of the community affected by the overflows and bad odors reported since January 2026, in the exercise of the powers conferred on this Directorate by Articles 340, 341, and 344 of the General Health Law.
The administrative file also establishes that, by the time the amparo proceeding was filed, the corrective measures notified in the notice had already been carried out: AyA sealed the inlets and outlets of the sanitary inspection wells involved between 3 and 11 July 2026 (folios 00031 through 00033), that is, before the Constitutional Chamber’s order of 22 July 2026. This shows that the situation reported was addressed in a timely manner by the competent institutions, through a duly documented process of interinstitutional coordination and in compliance with the time granted to property owners. In light of the foregoing, this Directorate considers that it committed no omission or arbitrary act violating the fundamental rights to health, a healthy environment, or a dignified life alleged by the petitioner, since the actions taken constituted a legitimate and coordinated exercise of health oversight and sanitary policing powers, aimed precisely at protecting public health and the environment of the Mata de Plátano community….”
CONCLUSION
In accordance with the foregoing, as set out in the aforementioned report No. CARTA-MS-DRRSCS-DARSG-1356-2026, the Ministry of Health acted within the scope of its legal and administrative powers and did not violate the fundamental rights invoked by the amparo applicant. From the time the reported problem came to its attention, the Goicoechea Health Area Directorate carried out its duties in a timely, diligent, and coordinated manner with the Costa Rican Institute of Aqueducts and Sewers and the Municipality of Goicoechea, within its legal health oversight and sanitary policing powers. The actions taken were intended to address a technically verified situation involving illegal wastewater connections to systems that were not operational or authorized, which caused overflows, bad odors, and a health risk to the community. Accordingly, the measures adopted—including notifying residents and AyA’s subsequent sealing of the wells involved—were reasonable, proportionate, and aimed at protecting public health, a healthy environment, and the quality of life of the affected population.
Consequently, since it has been established that the competent institutions followed up effectively on the matter and that the corrective measures were carried out even before this amparo proceeding was addressed, the Chamber is respectfully requested to deny the amparo proceeding insofar as it concerns this Ministry.” The Ministry requests that the Chamber deny the amparo proceeding.

He alleges that illegal wastewater connections exist and that the existing sanitary sewer in the area is not operating, causing environmental pollution. He claims that the respondent authorities have not adequately addressed the problem. He complains that the respondent institutions intend for residents of his community, including him, to build septic tanks in their homes, which is not an appropriate solution because it causes contamination of aquifers and environmental harm.

On numerous occasions, this Chamber’s case law has recognized that public health and the right to a healthy and ecologically balanced environment are protected both constitutionally and under international regulations. It has stated that the legitimate exercise of this right requires resources to be used rationally, and that the State is responsible for environmental protection under the precautionary principle governing environmental matters. This principle requires the State to do everything necessary within the limits permitted by law to prevent irreversible environmental harm. To that end, the State is responsible for creating favorable social conditions so that each person can enjoy health, understood as a state of physical, psychological (or mental), and social well-being (see Judgment No. 1998-180, issued at 16:24 on 13 January 1998). The State’s objective duty to protect the environment does not necessarily give individuals a subjective right to demand a specific measure through the courts, but they are entitled to have measures adopted that are suitable to protect that right where public authorities, individuals, or legal entities act with manifest negligence.
The State therefore has a duty to regulate areas of social life that may pose dangers to the physical existence of the inhabitants of its territory, as well as areas that may harm the environment. It may do so through laws, regulations, agreements, or other measures concerning administrative organization and procedures. Accordingly, the ability to demand through an amparo proceeding a specific form of performance by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is limited to cases where an imminent danger to those rights is clearly established. It follows that constitutional jurisdiction may intervene only when the State, through its competent bodies, is demonstrably inactive in responding to demands made by the country’s inhabitants in the exercise of their rights (see Judgment No. 2014-002127).
In the sub examine, the amparo applicant states that they reside in a home located in Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. They allege that there are illegal wastewater connections and that, in addition, the existing sanitary sewer system in the area is not operational, causing environmental contamination. They contend that the respondent authorities have not adequately addressed the problem. They complain that the respondent institutions expect residents of their community, including the applicant, to build septic tanks in their homes, which is not an appropriate solution because it causes contamination of aquifers and environmental harm.
Regarding the municipality named as respondent, the Chamber considers it proven that sanitary sewer infrastructure belonging to ICAA exists in the Las Brisas de Salitrillo area. It was built in anticipation of a future sanitary sewer system. Several property owners made direct, unauthorized connections to that sewer network. This caused operational problems, bad odors, and health-related effects. ICAA informed the property owners that they had to disconnect from the sewer network, which had not yet been commissioned. Those who had made irregular connections proceeded to disconnect them, complying with the directions issued by the authorities. The properties currently have individual wastewater treatment systems. Illegal connections were made even to wells intended to receive stormwater, causing a significant adverse environmental impact: odors, blockages, and possible harm to the health of local residents.
Regarding Ministerio de Salud, it is established that unlawful connections do exist and appear to be causing bad odors at the well and temporary overflows. On 14 January 2026, Ministerio de Salud reported that the situation was being addressed through interinstitutional coordination among ICAA, Municipalidad de Goicoechea, and Ministerio de Salud. On 14 January 2026, Ministerio de Salud and ICAA conducted a joint inspection, during which wastewater outflows in Barrio Las Brisas were confirmed. ICAA reported that cleaning of the affected well had been scheduled for 5 February 2026. On 17 March 2026, an official notice was ordered to be issued to the community of Mata de Plátano de Goicoechea, informing it that inspections had identified illegal wastewater connections to stormwater systems administered by the local government, as well as to the nonoperational sanitary sewer, with direct discharge into sanitary wells N°160A-059, 160A-0152 and 1060A-051.
The notice stated that, within a maximum period of THREE MONTHS, those wells would be closed in response to the harm the situation was causing residents located downstream. On 3 July 2026, the first closures of the inlets and outlets of the sanitary inspection wells were carried out. By the expiry of the period granted to the property owners in the notice, corrective measures had been implemented and the inlets and outlets of the sanitary inspection wells involved had been sealed. ICAA sealed the inlets and outlets of the sanitary inspection wells involved between 3 and 11 July 2026.
Finally, as to ICAA, this Chamber finds that no collective wastewater collection and treatment system is operational in the area where the person protected by the amparo lives. Wastewater from homes in Barrio Las Brisas must be treated using individual septic tank systems. In 2000, the developer of Urbanización Las Brisas submitted the sanitary design to the competent authorities, establishing the use of septic tanks and individual infiltration fields as the technical solution. As part of the usual permitting procedure to develop the property on which Urbanización Brisas de Salitrillos now stands, ICAA, by official letter N°152 dated 22 April 1998, approved the application for provision of potable water service and denied availability of sanitary sewer service. The development company conducted infiltration studies at several points on the property, which are consistent with the feasibility of using a septic tank and drains as an individual means of wastewater disposal from homes.
Not all areas of the GAM can connect to the storm sewer system. Technical factors, such as the topography of the land, may prevent connection to that network even when the area falls within its coverage. There is wastewater contamination in Urbanización Las Brisas de Salitrillos, where illegal interconnections have been identified to the planned sanitary system network, which is not in use. The GAM sanitary sewer project is called “Proyecto Mejoramiento del Ambiental del Área Metropolitana” and is being carried out by ICAA under the mandate of Ley Nº 8559, entitled “Aprobación del Contrato de Préstamo Externo N° CRP4, suscrito por el Gobierno de la República de Costa Rica y el Banco Japonés para la Cooperación Internacional (JBIC), para Financiar Proyecto Mejoramiento del Medio Ambiente del área Metropolitana.” Although several cantons in the GAM, including Goicoechea, are included, not all areas can be connected to the system. Therefore, many people and businesses with septic tank treatment systems must continue treating their wastewater in this way; these are valid treatment systems that work properly when correctly installed and maintained as required by the owner.
In light of this, the Chamber considers that the amparo should be dismissed. As can be seen from the proven facts, problems with contamination caused by the inadequate final disposal of wastewater from some homes in Urbanización Las Brisas, in Salitrillo de Goicoechea, have indeed been detected. However, the authorities involved in this amparo, especially Ministerio de Salud and ICAA, have addressed the situation satisfactorily. According to the reports issued by those public bodies, during 2026 the contamination caused by some residents’ illegal connection to the public sewer system, which ICAA has not yet put into operation, was addressed. The case file shows that illegal wastewater connections were identified to existing stormwater systems, both those administered by the local government and ICAA’s nonoperational sanitary sewer, with direct discharge into sanitary wells N°160A-059, 160A-0152 and 1060A-051.
Accordingly, the residents responsible were granted a maximum period of THREE MONTHS to correct the situation, failing which those wells would be closed, in response to the harm the situation was causing the environment. Indeed, on 3 July 2026, the first closures of the inlets and outlets of the sanitary inspection wells were carried out. Based on the information Ministerio de Salud provided in this amparo, by the expiry of the period granted to the property owners, corrective measures had been implemented and the inlets and outlets of the sanitary inspection wells involved had been sealed; ICAA sealed those inlets and outlets between 3 and 11 July 2026. This amparo application was filed on 15 July 2026. Accordingly, in this Court’s view, the reported environmental situation had been addressed before this proceeding was filed. Ergo, for the reasons stated, the amparo must be dismissed.
The Chamber considers it necessary to remind the respondent authorities, especially Ministerio de Salud and ICAA, of their responsibility to supervise and monitor the proper use residents of Urbanización Las Brisas make of the existing sanitary sewer system, as well as to periodically review environmental conditions in that area, given the irregular conduct identified in this amparo. In the Chamber’s view, it is reasonable to think that residents of that area might repeat such reprehensible conduct, thereby again causing serious harm to the environment and public infrastructure and, consequently, to the proper use of public funds. This is why the Court is concerned that the respondents maintain periodic monitoring of the facts reported in this amparo.
In environmental matters, it is also my view that, where the Public Administration has already intervened, the matter falls within the administrative-litigation jurisdiction for consideration and resolution. Nevertheless, I do consider the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free from contamination (Article 50 of the Political Constitution). That is the case here, where the amparo applicant states that they reside in a home located in Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. They allege that there are illegal wastewater connections and that, in addition, the existing sanitary sewer system in the area is not operational, causing environmental contamination. They contend that the respondent authorities have not adequately addressed the problem. They complain that the respondent institutions expect residents of their community, including the applicant, to build septic tanks in their homes, which is not an appropriate solution because it causes contamination of aquifers and environmental harm, to the detriment of a healthy and ecologically balanced environment and a decent quality of life.
This Chamber must notify the parties that any paper documents they may have submitted, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, telematic, or new-technology media, must be retrieved from the office within thirty business days after receiving notice of this judgment. Otherwise, all such material will be destroyed in accordance with the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by Corte Plena at session N°27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial N°19 on 26 January 2012, as well as the resolution approved by Consejo Superior del Poder Judicial at session N°43-12 held on 03 May 2012, Article LXXXI.

La parte recurrente indica que es residente de una vivienda ubicada en Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. Acusa que existen conexiones ilegales de aguas residuales y, además, el alcantarillado sanitario existente en el sector no se encuentra en operación, lo cual produce contaminación ambiental. Alega que las autoridades accionadas no han atendido adecuadamente la problemática. Reclama que las instituciones recurridas pretenden que los vecinos de su comunidad, incluyéndolo, construyan tanques sépticos en sus hogares, lo cual no es la solución adecuada, pues se produce contaminación de mantos acuíferos y afectaciones ambientales.

En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional. Se ha indicado que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase Sentencia Nº 1998-180 de las 16:24 horas del 13 de enero de 1998).
La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas.
De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver Sentencia N° 2014-002127).
En el sub examine, la parte recurrente aduce que es residente de una vivienda ubicada en Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. Acusa que existen conexiones ilegales de aguas residuales y, además, el alcantarillado sanitario existente en el sector no se encuentra en operación, lo cual produce contaminación ambiental. Alega que las autoridades accionadas no han atendido adecuadamente la problemática. Reclama que las instituciones recurridas pretenden que los vecinos de su comunidad, incluyéndolo, construyan tanques sépticos en sus hogares, lo cual no es la solución adecuada, pues se produce contaminación de mantos acuíferos y afectaciones ambientales. Al respecto, en relación con el municipio accionado, la Sala tiene por demostrado que en el sector de Las Brisas de Salitrillo, existe infraestructura de alcantarillado sanitario, perteneciente al ICAA, la cual fue construida como previsión para un futuro sistema de alcantarillado sanitario.
Varios propietarios realizaron conexiones directas y sin autorización a dicha red sanitaria. Lo anterior ocasionó problemas de funcionamiento, malos olores y afectaciones de carácter sanitario. El ICAA comunicó a los propietarios que debían desconectarse de la red sanitaria, que aún no se encontraba habilitada. Las personas que habían realizado conexiones irregulares procedieron a efectuar la desconexión correspondiente, dando cumplimiento a las disposiciones emitidas por las autoridades. Actualmente los inmuebles cuentan con sistemas individuales de tratamiento de aguas residuales. Las conexiones ilegales se dieron inclusive a pozos destinados para la recepción de aguas pluviales, lo que representa un impacto ambiental negativo importante: olores, taponamientos y posible afectación de la salud de los habitantes del lugar. Por otro lado, en relación en el Ministerio de Salud, se tiene por acreditado que, efectivamente, existen conexiones ilícitas que estarían generando malos olores en el pozo y rebalses temporales.
En fecha 14 de enero de 2026, el Ministerio de Salud comunicó que la situación estaba siendo atendida mediante coordinación interinstitucional entre el ICAA, la Municipalidad de Goicoechea y el Ministerio de Salud. En fecha 14 de enero de 2026, se realizó una inspección conjunta entre el Ministerio de Salud y el ICAA, en la cual se corroboraron los afloramientos de aguas residuales en Barrio Las Brisas. El ICAA informó que la limpieza del pozo afectado se había programado para el 5 de febrero de 2026. El 17 de marzo de 2026, se ordenó emitir un comunicado oficial dirigido a la comunidad de Mata de Plátano de Goicoechea, mediante el cual se informó que, durante las inspecciones realizadas, se identificaron conexiones ilegales de aguas residuales hacia sistemas pluviales administrados por el gobierno local, así como hacia el alcantarillado sanitario no operativo, con descarga directa en los pozos sanitarios N°160A-059, 160A-0152 y 1060A-051.
En dicho comunicado se informó que, en un plazo máximo de TRES MESES, se procedería con la clausura de esos pozos, en atención a la afectación que la situación generaba a los vecinos ubicados aguas abajo. En fecha 3 de julio de 2026, se realizaron los primeros cierres de las entradas y salidas de los pozos de registro sanitario. Al vencer el plazo otorgado a las personas propietarias mediante el comunicado, se habían ejecutado las medidas correctivas y se habían sellado las entradas y salidas de los pozos de registro sanitario involucrados. El ICAA selló las entradas y salidas de los pozos de registro sanitario involucrados entre el 3 y el 11 de julio de 2026. Finalmente, en cuanto al ICAA, esta Sala logra acreditar que en la zona donde habita el tutelado no se encuentra habilitado ningún sistema colectivo de recolección y tratamiento de las aguas residuales. Las aguas residuales de las viviendas en Barrio Las Brisas deben ser tratadas con sistemas individuales de tanques sépticos.
En el año 2000 se presentó el diseño sanitario por parte de la empresa desarrolladora de la Urbanización Las Brisas ante las autoridades competentes, estableciéndose como solución técnica la utilización de tanques sépticos y campos de infiltración individuales. Como parte del procedimiento habitual para los respectivos permisos para urbanizar la finca en la que se asienta actualmente la Urbanización Brisas de Salitrillos, el ICAA, a través del oficio N°152 del 22 de abril de 1998, aprobó la solicitud de dotación para el servicio de agua potable y denegó la disponibilidad en la disponibilidad del servicio de alcantarillado sanitario. El desarrollador de la urbanización llevó a cabo estudios de infiltración en varios puntos de la propiedad, los cuales son consistentes con el hecho de que el uso de tanque séptico y drenajes resultaba factible como medio de disposición individual para las aguas residuales domiciliares.
No todos los sectores de la GAM pueden conectarse al sistema de alcantarillado pluvial, pues existen razones técnicas como por ejemplo la topografía de los terrenos, que impiden que puedan ser conectados a dicha red, a pesar de estar dentro del área de cobertura. Existe contaminación de aguas residuales en la Urbanización Las Brisas de Salitrillos, donde se han identificado interconexiones ilícitas a la red prevista del sistema sanitario que no se encuentra en uso. El proyecto de alcantarillado sanitario de la GAM se denomina: “Proyecto Mejoramiento del Ambiental del Área Metropolitana” que está realizando el ICAA de acuerdo con el mandato dado por la Ley Nº 8559 denominada "Aprobación del Contrato de Préstamo Externo N° CRP4, suscrito por el Gobierno de la República de Costa Rica y el Banco Japonés para la Cooperación Internacional (JBIC), para Financiar Proyecto Mejoramiento del Medio Ambiente del área Metropolitana." A pesar de incluirse a varios cantones de la GAM, entre ellos Goicoechea, no todos los sectores podrán ser interconectados al sistema, por lo que muchas personas o empresas que tienen sistemas de tratamiento por medio de tanques sépticos, deben seguir tratando sus aguas por estos medios que son sistemas de tratamiento válidos y que funcionan adecuadamente si se ejecutan de manera correcta y se les da el mantenimiento requerido por parte del propietario.
Ante este panorama, estima la Sala que se debe declarar sin lugar el recurso. Como puede constatarse del elenco de hechos probados, ciertamente se han detectado problemas de contaminación por la inadecuada disposición final de aguas residuales de algunas viviendas de la Urbanización Las Brisas, en Salitrillo de Goicoechea. Sin embargo, la situación ha sido atendida de manera satisfactoria por las autoridades involucradas en este amparo, especialmente por el Ministerio de Salud y el ICAA. De conformidad con los informes emitidos por dichas instancias públicas, durante este año 2026 se atendió la situación de contaminación generada debido a la conexión ilegal de algunos vecinos al sistema de alcantarillado pública que todavía no está en operación por parte del ICAA. Se desprende de los autos que se identificaron conexiones ilegales de aguas residuales hacia sistemas pluviales existentes, tanto los administrados por el gobierno local, así como hacia el alcantarillado sanitario no operativo del ICAA, con descarga directa en los pozos sanitarios N°160A-059, 160A-0152 y 1060A-051.
En virtud de ello, se concedió un plazo máximo de TRES MESES a los vecinos responsables para corregir la situación, pues se procedería con la clausura de esos pozos, en atención a la afectación que la situación generaba al medio ambiente. Justamente el pasado 3 de julio de 2026, se realizaron los primeros cierres de las entradas y salidas de los pozos de registro sanitario. A partir de lo informado por el Ministerio de Salud en este amparo, al vencer el plazo otorgado a las personas propietarias, se habían ejecutado las medidas correctivas y se habían sellado las entradas y salidas de los pozos de registro sanitario involucrados, siendo que el ICAA selló las entradas y salidas de los pozos de registro sanitario involucrados entre el 3 y el 11 de julio de 2026. El presente recurso de amparo fue interpuesto el 15 de julio de 2026, de manera que, a criterio de este Tribunal, la situación ambiental denunciada fue atendida con anterioridad a la presentación del presente proceso. Ergo, por las razones expuestas, procede la desestimatoria del amparo.
Estima la Sala que es necesario recordarle a las autoridades accionadas, especialmente al Ministerio de Salud y al ICAA, su responsabilidad en la supervisión y vigilancia del adecuado uso que hacen los vecinos de la Urbanización Las Brisas al sistema de alcantarillado sanitario existente, así como la revisión periódica de las condiciones ambientales en dicho sector, debido a los antecedentes irregulares detectados en este amparo. En consideración de la Sala, es lógico pensar que dichas conductas tan reprochables podrían repetirse por parte de los vecinos de dicho sector, generando con ello nuevamente una afectación grave al medio ambiente, a la infraestructura pública y, por consiguiente, al adecuado uso de los fondos públicos. De ahí la preocupación de este Tribunal para que los accionados mantengan una vigilancia periódica de los hechos denunciados en este amparo.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que es residente de una vivienda ubicada en Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. Acusa que existen conexiones ilegales de aguas residuales y, además, el alcantarillado sanitario existente en el sector no se encuentra en operación, lo cual produce contaminación ambiental. Alega que las autoridades accionadas no han atendido adecuadamente la problemática. Reclama que las instituciones recurridas pretenden que los vecinos de su comunidad, incluyéndolo, construyan tanques sépticos en sus hogares, lo cual no es la solución adecuada, pues se produce contaminación de mantos acuíferos y afectaciones ambientales, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Tomen nota los recurridos de lo indicado por la Sala en el considerando VII de esta sentencia. El magistrado Salazar Alvarado consigna nota.- Fernando Castillo V.
