THE FELLING WAS BASED ON A PHYTOSANITARY AND RISK DIAGNOSIS THAT DETERMINED THAT THREE TREES HAD CONDITIONS MAKING PRUNING INSUFFICIENT AND RECOMMENDED THEIR FELLING; THEREFORE, NO VIOLATION OF THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT WAS ESTABLISHED. THE APPLICATION IS DECLARED WITHOUT MERIT. VCG09/2026 “(…) IV.- ON THE MERITS OF THE MATTER. After analyzing the evidence submitted, this Court rules out a violation of the constitutional right to a healthy and ecologically balanced environment. The report submitted by the representatives of the respondent authority and the evidence submitted for resolution of the matter duly establish that, on 7 December 2017, by means of letter No. MSA-GOT-PCA-02-104-2017, the Environmental Comptroller’s Office of the respondent Municipality informed the mayor that, due to the earthworks (movimientos de suelo) carried out in the central park of Santa Ana, the root system and anchoring of some trees had been affected; for that reason, it suggested obtaining felling permits from MINAE and replacing those specimens with smaller shrub species.
It is also established that, on 26 June 2025, through memorandum No. MSA-GOT-PCA-02-063-2025, the Environmental Comptroller’s Office of the respondent local entity recommended pruning a number of branches on four trees, taking care not to disturb branches where birds were nesting. It is then established that, on 11 November 2025, within the framework of the tender procedure “TREE MAINTENANCE SERVICE—UNDER THE ON-DEMAND MODALITY” No. 2022LA-000040-0002400001, the respondent local government issued an electronic invoice to Alto Voltaje y Telecomunicaciones S.A. for tree-felling and pruning services. It is further inferred that, on 11 November 2025, by means of document No. AV2025-1585-011, the representatives of Alto Voltaje y Telecomunicaciones S.A. recorded the tree pruning they carried out in the central park area of Santa Ana. Next, it is established that, on 24 June 2026, a tree located in the central park of Santa Ana fell.
Subsequently, it is deemed proven that, on 24 June 2026, by means of a report entitled “PHYTOSANITARY AND RISK DIAGNOSTIC STUDY THROUGH VISUAL ASSESSMENT, CENTRAL PARK OF SANTA ANA, SAN JOSÉ, COSTA RICA,” prepared by Eng. Minor Arce Solano, after assessing three trees located in the central park of Santa Ana that had management and size conditions similar to those of the tree that fell on that same date, the following conclusions were issued: “VI GENERAL CONCLUSIONS AND RECOMMENDATIONS. - Felling the trees assessed has been recommended, taking into account possible root damage, their growth, age, and the surroundings in which they are located. - Pruning has not been recommended, since it does not eliminate the risk of falling; moreover, the pruning would have to be very severe to reduce the risk, which is not appropriate.” Lastly, it is established that, on 30 June 2026, within the framework of the tender procedure “TREE MAINTENANCE SERVICE—UNDER THE ON-DEMAND MODALITY” No. 2022LA-000040-0002400001, the respondent Municipality issued an electronic invoice to Alto Voltaje y Telecomunicaciones S.A. for tree-felling and pruning services.
Accordingly, no violation of Article 50 of the Political Constitution or of the constitutional principles concerning the environment is established. Contrary to the applicant’s allegations, the felling of trees in the central park of Santa Ana, which took place after the tree fell on 24 June 2026, was not based on an arbitrary criterion of the respondent Municipality. In environmental matters, it is also my view that, where the Public Administration has already intervened, the matter falls within the administrative-litigation jurisdiction for its consideration and resolution. Nevertheless, I do consider the merits when other rights of the affected persons are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Political Constitution), as is the case here. It is alleged that, on 24 June 2026, a tree in the central park of the canton of Santa Ana fell due to adverse weather conditions. Amparo proceeding in case file number 26-023146-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPPALITY OF SANTA ANA.
BACKGROUND:
Justice Hess Herrera drafts the judgment; and, REASONS:
Supporting-party intervention is a form of ancillary intervention that occurs when a person participates in a proceeding by supporting the claims of one of the principal parties. Consequently, a person with a direct interest in the outcome of the application has standing to participate as a supporting party. However, because the supporting party is not a principal party, the judgment will not directly affect that person; that is, its effect cannot reach that person directly and immediately, nor is that person affected by the ruling’s status as res judicata. In amparo matters, however, the effect of the decision may benefit the supporting party because the case law and precedents of the constitutional jurisdiction have “erga omnes” effect (Article 13 of the Law on Constitutional Jurisdiction).
Having clarified the foregoing, in this case the Chamber proceeds to admit the active intervention filed by Shirley Jara Vásquez, since she has a clear interest in the outcome of these proceedings: a violation of the right to a healthy environment is conduct that harms the community.
The applicant states that on 24 June 2026, a tree in the central park of the canton of Santa Ana fell due to adverse weather conditions. She alleges that the mayor of the local government ordered the felling of the remaining trees despite having no technical opinion supporting it, causing serious and irreversible environmental consequences. She considers the following to have been violated: A) Article 50 of the Constitution and the principle of non-regression in environmental matters, since the destruction of tree heritage cannot be justified by a unilateral decision based on considerations of economic convenience, such as budgetary savings on tree maintenance; B) section 16 of the Ley General de la Administración Pública, because there was no technical or scientific basis and the action was disproportionate, as it did not consider mitigation measures that would allow the tree to be preserved; and C) the preventive and precautionary principles in environmental matters, as well as the duty to replace and maintain ecosystem services.
On that basis, she asks that the local government be ordered to: A) refrain from felling trees without the respective technical permits; B) implement an Urban Tree Management Plan in accordance with the requirements of Law No. 10.939; and C) guarantee that, in cases where a specific tree is shown to be unviable, it will be replaced immediately in the same location by planting trees and native species that are resistant to wind.
The following facts are considered duly established and relevant to deciding this matter, either because they have been proven or because the respondent failed to address them as required in the initial order:
After analyzing the evidence submitted, this Court finds no violation of the constitutional right to a healthy and ecologically balanced environment. The report submitted by the representatives of the respondent authority and the evidence submitted for resolution of the matter duly establish that on 7 December 2017, by means of official letter No. MSA-GOT-PCA-02-104-2017, the Environmental Comptroller’s Office of the respondent Municipality informed the mayor that earthworks carried out in Santa Ana central park had affected the root systems and anchoring of some trees. For that reason, it suggested applying to MINAE for felling permits and replacing those specimens with smaller shrub species. It is also established that on 26 June 2025, by means of memorandum No. MSA-GOT-PCA-02-063-2025, the Environmental Comptroller’s Office of the respondent local entity recommended pruning a number of branches on four trees, taking care around those branches where birds were nesting.
It is then established that on 11 November 2025, under the procurement procedure “TREE MAINTENANCE SERVICE—ON-DEMAND BASIS” No. 2022LA-000040-0002400001, the respondent local government issued an electronic invoice to Alto Voltaje y Telecomunicaciones S.A. for tree-felling and pruning services. It is subsequently inferred that on 11 November 2025, by means of document No. AV2025-1585-011, representatives of Alto Voltaje y Telecomunicaciones S.A. recorded the tree pruning they carried out in the area of Santa Ana central park. Next, it is established that on 24 June 2026, a tree located in Santa Ana central park fell. It is further found that on 24 June 2026, in a report titled “PHYTOSANITARY AND RISK DIAGNOSTIC STUDY THROUGH VISUAL ASSESSMENT OF SANTA ANA CENTRAL PARK, SAN JOSÉ, COSTA RICA,” prepared by Eng. Minor Arce Solano, the author evaluated three trees in Santa Ana central park that had management and size conditions similar to those of the tree that fell on the same date and reached the following conclusions: “VI GENERAL CONCLUSIONS AND RECOMMENDATIONS. - Felling the trees evaluated has been recommended, considering possible root damage, their development, age, and the surroundings in which they are located. - Pruning has not been recommended, since it does not eliminate the risk of falling; moreover, pruning would have to be very severe to reduce the risk, which is not appropriate.” Lastly, it is established that on 30 June 2026, under the procurement procedure “TREE MAINTENANCE SERVICE—ON-DEMAND BASIS” No. 2022LA-000040-0002400001, the respondent Municipality issued an electronic invoice to Alto Voltaje y Telecomunicaciones S.A. for tree-felling and pruning services.

Contrary to the applicant’s allegation, the felling of trees in Santa Ana central park after the tree fell on 24 June 2026 was not based on an arbitrary criterion of the respondent Municipality. In that regard, note that the technical and scientific basis available to the local government for taking this action is set out in the report “PHYTOSANITARY AND RISK DIAGNOSTIC STUDY THROUGH VISUAL ASSESSMENT OF SANTA ANA CENTRAL PARK, SAN JOSÉ, COSTA RICA,” dated 24 June 2026 and prepared by Eng. Minor Arce Solano. The report authorized the felling of three specific specimens that did not meet the safety conditions required to remain standing. Thus, it is clear that adopting this measure was not an arbitrary decision; in addition to being supported by a technical opinion establishing its viability, it responded to the need to protect the life and physical integrity of pedestrians passing through the area.
Along the same lines, any disagreement with that action, as well as the desire to implement an Urban Tree Management Plan or to replace the specimens by planting specific tree species, are matters that this jurisdiction cannot examine, since they exceed the summary nature of the amparo proceeding and this Court’s jurisdiction. Any dispute on these matters must instead be resolved before the Municipal Administration itself. Accordingly, the amparo application must be dismissed.
In environmental matters, it is also my view that when the Public Administration has already intervened, the administrative-litigation jurisdiction should hear and resolve the matter. Nevertheless, I do consider the merits when other rights of the affected persons are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Political Constitution), as in this case, where it is alleged that on 24 June 2026 a tree in the central park of the canton of Santa Ana fell due to adverse weather conditions. It is alleged that the mayor of the local government ordered the felling of the remaining trees despite having no technical opinion supporting it, causing serious and irreversible environmental consequences, thereby violating the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.
This Chamber must notify the applicant that any document submitted, whether on paper, as well as any objects or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, must be collected from the court office within 30 working days after receipt of notice of this judgment. Otherwise, all such material will be destroyed in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The amparo application is dismissed. Justice Salazar Alvarado files a note. Notify the parties.

Después de analizar los elementos probatorios aportados, este Tribunal descarta que se haya lesionado el derecho constitucional a un medio ambiente sano y ecológicamente equilibrado. Del informe rendido por los representantes de la autoridad recurrida y la prueba aportada para la resolución del asunto ha quedado debidamente acreditado que el 7 de diciembre de 2017, por medio del oficio No. MSA-GOT-PCA-02-104-2017, la Contraloría Ambiental de la Municipalidad recurrida informó al alcalde que, con motivo de los movimientos de suelo que se realizaron en el parque central de Santa Ana, se vieron afectados el sistema radical y el anclaje de algunos árboles, razón por la cual se sugiere tramitar los permisos de corta ante el MINAE y sustituir estos ejemplares por especies arbustivas más pequeñas.
Además, se constata que el 26 de junio de 2025, a través del memorial No. MSA-GOT-PCA-02-063-2025, la Contraloría Ambiental del ente local accionado recomendó realizar la poda de una serie de ramas de cuatro árboles, con precaución de aquellas en las que se encontraran aves en anidación. Luego, se comprueba que el 11 de noviembre de 2025, en el marco del procedimiento licitatorio “SERVICIO DE MANTENIMIENTO DE ÁRBOLES-BAJO LA MODALIDAD SEGÚN DEMANDA” No. 2022LA-000040-0002400001, el gobierno local recurrido emitió una factura electrónica a la empresa Alto Voltaje y Telecomunicaciones S.A. por concepto de servicios de corta y poda de árboles. Posteriormente, se deduce que el 11 de noviembre de 2025, mediante documento No. AV2025-1585-011, la representación de Alto Voltaje y Telecomunicaciones S.A. dejó constancia de las podas de árboles que realizaron en la zona del parque central de Santa Ana.
Acto seguido, se acredita que el 24 de junio de 2026, un árbol ubicado en el parque central de Santa Ana sufrió una caída. Ulteriormente, se tiene por comprobado que el 24 de junio de 2026, por medio de informe titulado “ESTUDIO DIAGNÓSTICO FITOSANITARIO Y DE RIESGO MEDIANTE EVALUACIÓN VISUAL PARQUE CENTRAL SANTA ANA, SAN JOSÉ COSTA RICA”, elaborado por el Ing. Minor Arce Solano, tras evaluar tres árboles ubicados en el parque central de Santa Ana y que cuentan con condiciones similares de manejo y tamaño a la planta arbórea que cayó en la misma fecha, emitió las siguientes conclusiones: “VI CONCLUSIONES Y RECOMENDACIONES GENERALES. - Se ha recomendado realizar la corta de los árboles evaluados, considerando posible afectación de raíces, desarrollo de los mismos, edad y el entorno donde se ubican. - No se han recomendado hacer podas, ya que esto no elimina el riesgo de caída, además la poda debería ser muy fuerte para reducir el riesgo, lo que no es correcto.”.
Por último, se tiene que el 30 de junio de 2026, en el marco del procedimiento licitatorio “SERVICIO DE MANTENIMIENTO DE ÁRBOLES-BAJO LA MODALIDAD SEGÚN DEMANDA” No. 2022LA-000040-0002400001, la Municipalidad recurrida emitió una factura electrónica a la empresa Alto Voltaje y Telecomunicaciones S.A. por concepto de servicios de corta y poda de árboles.
En consecuencia, no se constata la existencia de una transgresión al artículo 50 de la Constitución Política, ni a los principios constitucionales en materia ambiental. Contrario a lo que alega la parte recurrente, la corta de los árboles en el parque central de Santa Ana, que se realizó con posterioridad al evento de la caída del 24 de junio de 2026, no obedece a un criterio arbitrario de la Municipalidad recurrida. En ese sentido, nótese que el sustento técnico y científico con el que cuenta el gobierno local para llevar a cabo esta actuación, está contemplado en el informe “ESTUDIO DIAGNÓSTICO FITOSANITARIO Y DE RIESGO MEDIANTE EVALUACIÓN VISUAL PARQUE CENTRAL SANTA ANA, SAN JOSÉ COSTA RICA” de fecha 24 de junio de 2026, elaborado por el Ing. Minor Arce Solano, el cual autorizó la corta de tres ejemplares específicos que no reunían las condiciones de seguridad para permanecer en pie. Así las cosas, se evidencia que la adopción de esta medida no resulta una decisión antojadiza, sino que, además de contar con un criterio técnico para su viabilidad, responde a una necesidad de resguardar la vida y la integridad física de los transeúntes que atraviesan la zona.
En la misma línea, cualquier inconformidad que exista con dicha actuación, así como el deseo de implementar un Plan de Gestión de Arbolado Urbano o la sustitución de los ejemplares por la plantación de especies arbóreas específicas, son asuntos que no corresponden ser examinados por esta jurisdicción, pues ello excede la naturaleza sumaria del recurso de amparo y la competencia de este Tribunal. Por el contrario, cualquier discusión al respecto de esta temática, deberá ser dirimida ante la propia Administración Municipal. Así las cosas, corresponde desestimar el recurso. (…)” ... ARTÍCULO 34 DE LA LEY DE LA JURISDICCIÓN CONSTITUCIONAL “(…) I.- SOBRE LA COADYUVANCIA PLANTEADA. La coadyuvancia es una forma de intervención adhesiva que se da cuando una persona actúa en un proceso adhiriéndose a las pretensiones de alguna de las partes principales. Como consecuencia, está legitimada para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso, pero al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de esta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto, debido al carácter de "erga omnes " que tiene la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional).

En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que el 24 de junio de 2026, un árbol en el parque central del cantón de Santa Ana cayó con motivo de condiciones meteorológicas adversas. Acusa que el alcalde del gobierno local ordenó la tala del resto de las plantas arbóreas, a pesar de no contar con un criterio técnico para ello, lo cual produce consecuencias ambientales graves e irreversibles, lo que conlleva a la violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

Recurso de amparo que se tramita en expediente número 26-023146-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPPALIDAD DE SANTA ANA.
RESULTANDO:
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
La coadyuvancia es una forma de intervención adhesiva que se da cuando una persona actúa en un proceso adhiriéndose a las pretensiones de alguna de las partes principales. Como consecuencia, está legitimada para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso, pero al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de esta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto, debido al carácter de "erga omnes " que tiene la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional).
Aclarado lo anterior, en este caso, la Sala procede a admitir la coadyuvancia activa planteada por Shirley Jara Vásquez, pues tiene un claro interés en el resultado de este proceso, ya que la violación al derecho a un medio ambiente sano constituye una actuación que perjudica a la colectividad.
La recurrente manifiesta que el 24 de junio de 2026, un árbol en el parque central del cantón de Santa Ana cayó con motivo de condiciones meteorológicas adversas. Acusa que el alcalde del gobierno local ordenó la tala del resto de las plantas arbóreas, a pesar de no contar con un criterio técnico para ello, lo cual produce consecuencias ambientales graves e irreversibles. Estima como vulnerados: A) el artículo 50 constitucional y el principio de no regresión en materia ambiental -pues la destrucción de patrimonio arbóreo no puede ampararse en una decisión unilateral fundada en consideraciones de conveniencia económica-, como el ahorro presupuestario del mantenimiento de los árboles; B) el numeral 16 de la Ley General de la Administración Pública -por existir ausencia de sustento técnico y científico, así como una desproporcionalidad en la actuación, por no contemplar medidas de mitigación que permitan la conservación del árbol-; y C) los principios preventivo y precautorio en materia ambiental, además del deber de sustitución y mantenimiento de los servicios ecosistémicos.
Con motivo de lo anterior, solicita que se le ordene al gobierno local lo siguiente: A) abstenerse de ejecutar talas sin contar con los permisos técnicos respectivos; B) implementar un Plan de Gestión de Arbolado Urbano, conforme a las exigencias de la Ley No. 10.939; y C) garantizar que, en aquellos casos donde se acredite la inviabilidad de un árbol específico, se le dará una sustitución inmediata en el mismo sitio, mediante la plantación de árboles y especies nativas que tengan resistencia al viento.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados, o bien, porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Después de analizar los elementos probatorios aportados, este Tribunal descarta que se haya lesionado el derecho constitucional a un medio ambiente sano y ecológicamente equilibrado. Del informe rendido por los representantes de la autoridad recurrida y la prueba aportada para la resolución del asunto ha quedado debidamente acreditado que el 7 de diciembre de 2017, por medio del oficio No. MSA-GOT-PCA-02-104-2017, la Contraloría Ambiental de la Municipalidad recurrida informó al alcalde que, con motivo de los movimientos de suelo que se realizaron en el parque central de Santa Ana, se vieron afectados el sistema radical y el anclaje de algunos árboles, razón por la cual se sugiere tramitar los permisos de corta ante el MINAE y sustituir estos ejemplares por especies arbustivas más pequeñas. Además, se constata que el 26 de junio de 2025, a través del memorial No. MSA-GOT-PCA-02-063-2025, la Contraloría Ambiental del ente local accionado recomendó realizar la poda de una serie de ramas de cuatro árboles, con precaución de aquellas en las que se encontraran aves en anidación.

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
