Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 13 August 2026.

Amparo proceeding filed by [Nombre 001], identity card [Valor 001], against LA MUNICIPALIDAD DE BELÉN and EL MINISTERIO DE SALUD.

BACKGROUND:

  1. 1By a written submission received by the Chamber on 14 July 2026, the amparo applicant files an amparo proceeding. She states that she comes before this Chamber because of an environmental and public-health problem involving the irregular discharge of wastewater into a body of water. She indicates that, at the beginning of 2026, she learned of an environmental problem at property No. 0047893, located in San Antonio de Belén, Heredia, consisting of the apparent irregular discharge of wastewater from that property into a nearby body of water, causing foul odors, environmental pollution, and a risk to public health. This wastewater includes water from the property's sanitary system. She states that, in response, on 5 March 2026 she filed a complaint with the Municipalidad de Belén (case No. 738-2026), reporting the aforementioned environmental harm (irregular discharge of wastewater and sewage into a nearby body of water).Following that complaint, municipal officials conducted an inspection on 6 March 2026 and performed tests to determine the source and path of the wastewater. The inspection found an irregular discharge of wastewater from the septic tank at the property complained of. She explains that, because the reported environmental problem remained unresolved, on 10 March 2026 she filed a further request (procedure No. 790-2026). In response to this complaint, a new inspection of the property complained of took place on 13 March 2026, with the participation of municipal officials and the environmental manager of the Área Rectora de Salud de Belén-Flores (Belén-Flores Health Area). The inspection found no progress in constructing the technical solution intended to prevent the irregular discharge of wastewater, and the environmental problem therefore persisted. She points out that, by resolution No. DSP-ALS.R-003-2020 of 23 March 2020, the Municipalidad de Belén expressly acknowledged an environmental problem associated with the irregular discharge of wastewater. In that resolution, the Administration stated that, during inspections, foul odors had been detected from the accumulation and degradation of wastewater near the river, a situation affecting both community life and public health. It also acknowledged that the property lacked an adequate connection carrying water from the septic tank to a secondary treatment system, which was needed to ensure environmentally safe disposal. She alleges that, although the aforementioned municipal and health authorities technically confirmed the reported environmental problem, it had not been definitively resolved by the time the amparo application was filed. She argues that, while inspections, administrative requests, and technical assessments took place, those actions alone do not establish that the irregular wastewater discharge has stopped or that the water resource concerned currently has effective protection.She states that an administrative proceeding was subsequently initiated concerning a proposed technical solution involving infiltration trenches and improvements to the existing wastewater treatment system. However, she indicates that, during that procedure, the Municipalidad de Belén itself made numerous technical observations regarding the proposal, requesting clarification about the volume of wastewater generated, the treatment system's dimensions and location, setbacks from adjoining properties and the river, and other matters needed to verify compliance with the applicable regulations. She maintains that the later approval of an infiltration-trench design amounts only to a documentary assessment of a proposed technical alternative; it does not establish that the solution was properly implemented or that the previously confirmed pollution has ceased. For that reason, an on-site physical inspection is essential to determine whether the reported environmental problem was actually corrected.She adds that, from the time of the initial complaint to the Municipalidad de Belén, the Administration was also informed of possible construction works within the property complained of, located near the Río Bermúdez, where environmental restrictions related to protection of the water resource might apply. The complaint also raised the need to verify whether the works, earthworks (movimientos de tierra), construction of wastewater treatment systems, and other interventions on the property complied with applicable setbacks and alignments under the current environmental regulations. She asserts that it is necessary to verify not only the proposed sanitary solution, but also that any work carried out does not encroach on a protection zone or cause further harm to the water resource. She states that, because the property has no registered cadastral survey plan, all works are being carried out without an INVU river alignment, thereby encroaching on the protection zone.She alleges that the respondent authorities' failure to take concrete action in response to the previously confirmed pollution violates the fundamental right established in Article 50 of the Constitution, since “when environmental harm has been confirmed, it is not enough to open administrative files or issue formal requests; there is a constitutional duty to adopt timely, effective, and proportionate measures to prevent, stop, and remedy environmental damage.” Accordingly, she states that she has come before the Chamber so that the competent authorities may be ordered to take the necessary actions to ensure effective protection of the environment, the water resource, and public health. She considers the rights to health and to a healthy environment (Articles 21 and 50 of the Constitution) to have been violated. She requests that the amparo proceeding be granted and, in essence, that the respondent authorities be ordered to address the aforementioned matters promptly.
  2. 2By resolution issued at 14:26 on 22 July 2026, the proceeding was admitted and reports were requested from the respondent authorities.
  3. 3By a written submission received by the Chamber on 29 July 2026, Zeneida Chaves Fernández, in her capacity as Mayor; José Pablo Suárez Sánchez, in his capacity as Director of Public Services; and Juan Pablo Artavia Jiménez, in his capacity as Coordinator of the Sanitary Sewer Unit, all of the Municipalidad de Belén, submit a report and expressly state the following: “(…) FIRST: On 5 March 2026, the Municipalidad received procedure No. 738-2026, which contained a complaint about construction taking place without the corresponding municipal permit. The procedure was referred to several technical units, including the Sanitary Sewer and PTARs units, for each to issue an individualized opinion on the situation. As to that Unit specifically, the matter to be addressed was stated literally as follows: ‘Another very serious situation occurring on that property is that they are discharging sewage, kitchen water, and other wastewater from the three or four houses located there directly into the river.’ SECOND: The following day (6 March 2026), the undersigned, Ing. José Pablo Suárez Sánchez and Juan Pablo Artavia Jiménez, attended the site in our previously stated institutional roles to gather information about the reported situation.During the inspection, dye tests were performed on the property to determine whether the water discharged into the river was wastewater. The tests confirmed that it was indeed wastewater, resulting from an overflow from the existing septic tank, and the residents present at the inspection were told what corrective action was required to address the problem. THIRD: The following week (10 March 2026), procedure No. 790-2026, in the amparo applicant's name, was formally received by the Sanitary Sewer Unit. In response, on 13 March 2026 Ing. Juan Carlos Chaves Artavia, in his capacity as Sanitary Sewer Analyst, conducted a new inspection together with Victoria Leiva Pereira, environmental manager for the Belén-Flores Health Area of the Ministerio de Salud. During the visit, it was found that no corrective measures had been implemented in the system. Consequently, the residents were informed of the harm this situation was causing to the environment and public health, since, in addition to contaminating the river channel, it encourages the proliferation of mosquitoes and other disease vectors.FOURTH: That same month, on 23 March 2026, the owner of the property where the sanitary violations were detected, Olga Marta del Socorro Chaves Zumbado, identity card 4-0131-0386, was notified of resolution DSP-ALS-R-003-2026, by which the Sanitary Sewer and PTARs units required improvements to the existing system, including modifications to the septic tank and construction of infiltration trenches, all under the responsibility of a professional qualified in the field. For this purpose, the owner appointed civil engineer Jeffrey Zumbado Vargas, a professional with the experience and knowledge needed to carry out the required modifications. The Sanitary Sewer and PTARs units also verified that Ing. Zumbado Vargas was duly registered and authorized to practice with the Colegio Federado de Ingenieros y de Arquitectos de Costa Rica (CFIA) (Federated College of Engineers and Architects of Costa Rica), and confirmed that he holds current professional authorization under license IC-11914.In this case, the Unit did not set a specific deadline for the solution, since Ms. [Nombre 001], the amparo applicant here, had already referred the matter to the Urban Development and Construction Control Unit, the administrative division competent to conduct inspections concerning construction. FIFTH: Also in March 2026, on the 23rd, the amparo applicant was sent response letter DSP-ALS-O-034-2026 concerning both procedure No. 738-2026 and procedure No. 790-2026. She was informed that the owner of the property complained of had already been notified by resolution DSP-ALSR-003-2026, and that, if the ordered measures were not complied with, the matter would be referred to the Ministerio de Salud, which already knew of the situation following the inspection conducted on 10 March 2026. SIXTH: In addition, Ing. Chaves Artavia, in the aforementioned capacity, informed the amparo applicant by telephone that she would be notified in due course once the design for the system improvements had been approved, as subsequently occurred.SEVENTH: On 8 April 2026, Ing. Jeffrey Zumbado, the person responsible for the work, submitted a proposed design for improvements to the wastewater treatment system. However, that design was not approved at that time because it required technical adjustments related to the design parameters used. In an exchange of emails with the professional responsible, the necessary observations and corrections for bringing it into compliance were provided. EIGHTH: The Sanitary Sewer and PTARs units are responsible for carefully verifying the technical information submitted by the professional, in order to ensure that the proposed treatment system has sufficient capacity to adequately handle the load generated by the population served, which, according to information provided by the professional responsible, consists of seven people. NINTH: Ing. Chaves Artavia informed the amparo applicant by telephone in due course that the Sanitary Sewer and PTARs units could not unilaterally modify the baseline data used by the professional in the design, since the accuracy of that information is the professional responsibility of the person preparing the design, who is technically accountable for the criteria and parameters used in preparing the proposal.TENTH: On 14 May 2026, after the technical observations had been addressed and the required corrections made, the design proposal was finally approved by letter DSP-ALS-O-055-2026, which was duly notified to the owner. ELEVENTH: During the last week of June 2026, a telephone conversation took place with the complainant, who expressed concern about the approval granted. It should be noted, however, that the design was approved after technical verification that the proposal met the requirements established by this Unit. Had those requirements not been met, the process would have required further review and corrections, which inevitably would have further delayed resolution of the reported problem. For that reason, the proposal underwent a thorough review and multiple requests for adjustments before the relevant approval was issued. TWELFTH: Ing. Zumbado was also informed that, for the construction phase of the works included in the approved design, he was required to coordinate as appropriate with the Municipalidad de Belén’s Urban Development and Construction Control Unit, the administrative division competent in the matter, which was included in the relevant communications.THIRTEENTH: On 3 July 2026, personnel from the Sanitary Sewer and PTARs units conducted a new inspection of the property complained of, together with Victoria Leiva Pereira, environmental manager for the Belén-Flores Health Area of the Ministerio de Salud. During the visit, it was found that the works required to remedy the identified sanitary problem had still not been carried out. Consequently, the aforementioned environmental manager issued three sanitary orders to the parties associated with the property, because it contains three separate homes, each with violations requiring attention. FOURTEENTH: After Construction Permit No. 60-2026, issued by the Municipalidad de Belén’s Urban Development and Construction Control Unit, was granted for the previously approved design, on 21 July 2026 Ing. Jeffrey Zumbado was asked, in the aforementioned capacity, to conduct a technical inspection to verify the works carried out, authorized under [sic].As a result, the visit was scheduled for 28 July 2026 at 11:00 a.m., with the participation of Ing. Juan Carlos Chaves, representing the Sanitary Sewer and PTARs units, and Concepción Fonseca Torruno, construction inspector representing the Urban Development and Construction Control Unit. During this inspection, tests using sodium fluorescein dye would be conducted to verify compliance with the requested sanitary corrective actions. FIFTEENTH: On 28 July 2026, at the previously agreed time, an inspection was conducted on the property complained of to perform dye tests in the homes concerned and verify whether the problem involving wastewater management (blackwater and greywater) had been corrected through the works carried out. Ing. Jeffrey Zumbado Vargas reported that construction of the infiltration trenches had been completed, so the effectiveness of the measures implemented was to be verified on site.The inspection by the Sanitary Sewer and PTARs units, conducted by Ing. Juan Carlos Chaves Artavia and Juan Pablo Artavia Jiménez, took place together with Concepción Fonseca Torruno, construction inspector for the Urban Development and Construction Control Unit, within the scope of his authority concerning Construction Permit No. 060-2026. Ing. Jeffrey Zumbado Vargas and Luis Humberto Guzmán Chaves, a resident of the property inspected, were also present. As evidence presented during the inspection, Mr. Luis Humberto Guzmán Chaves provided photographs showing construction of the infiltration trenches and removal of the pipe that had previously served as an overflow for wastewater from the septic tank into the Río Bermúdez; these matters were verified during the inspection. Dye tests were conducted on wastewater discharges (blackwater and greywater) from the first two homes inspected. The third home could not be inspected because no one was present to allow entry to the property.Accordingly, it was agreed that this home's inspection would take place jointly with the Ministerio de Salud after the deadline granted under the sanitary orders issued by that institution had expired, in order to verify compliance with the corresponding corrective measures. The dye tests showed that both greywater and blackwater from the two homes inspected were carried to the existing treatment system. Consequently, no wastewater discharges into the Río Bermúdez were found, and it is concluded that the previously identified discharge was eliminated through the corrective works carried out. In light of the course of events, we consider that this Administration has acted reasonably, promptly, and in compliance with the principle of legality, and especially expeditiously, and that as of today there is no violation of the fundamental right of the municipality resident [Nombre 001]. To date, her requests have been handled by the Directorate of Public Services and the Sanitary Sewer and PTARs units.We reiterate our commitment to protecting public health and the environment, and to finding an effective solution to the reported situation. We consider this amparo application premature, since the two-month period established in case law for determining whether there is administrative delay had not elapsed in this case; the matter was addressed promptly, and the amparo application should therefore be denied (…)”.
  4. 4By a written submission received by the Chamber on 29 July 2026, Gustavo Espinoza Chaves, in his capacity as Director of the Belén-Flores Health Area of the Ministerio de Salud, submits a report and expressly states the following: “(…) 1. On 25 June 2026, the Belén-Flores Health Area received a health complaint filed by Ms. [Nombre 001], recorded as procedure 081-2026, against a neighbor of her property in San Antonio de Belén, 150 meters east, adjoining Barbería Fran, in which she stated: ‘On 6 March I filed a complaint with the Municipalidad de Belén, specifically with the Sanitary Sewer Unit and other departments, because of a situation on the property adjoining mine. At that time, no action was taken, and I understand that the Ministerio de Salud conducted an inspection jointly with that unit. However, to this day I have received no response, and I therefore express my dissatisfaction with the situation.Unfortunately the problem has worsened, because they continue to discharge blackwater into the river and are also dumping it on the ground…’ She attached a letter sent to the Municipalidad on 6 March 2026. In addition, a review of the records and administrative file shows no formal inspections by the health authority concerning the reported events before the complaint filed on 25 June of this year. On 29 June 2026, Ms. [Nombre 001] sent information about the complaint filed with the Health Area to the Ministerio de Salud’s Service Inspectorate. It should be clarified that the request submitted on 6 March 2026 was addressed exclusively to the Municipalidad de Belén, whereas the first formal complaint submitted to the Ministerio de Salud was not received until 25 June 2026. (folios 1-29). 2. On 1 July 2026, the Municipalidad de Belén was asked for information about construction permits and the complaint Ms. [Nombre 001] had filed with that authority.As part of the follow-up, on 3 July 2026 Licda. Victoria Leiva Pereira of the Belén-Flores Health Area and Ing. Juan Carlos Chaves Artavia of the Municipalidad de Belén’s Sanitary Sewer Unit visited the property complained of. Ing. Chaves stated that the Sanitary Sewer Unit had approved the design of the wastewater treatment system and that the Urban Department had approved a remodeling permit. 3. During the inspection, the owner, Ms. Olga Marta Chaves Zumbado, and her son, Mr. Luis Humberto Guzmán, attended and allowed entry. There are three homes on the property. At the rear, a septic tank was observed, covered by sheets serving as a lid; elsewhere, there was a pipe in the yard where wastewater was observed. According to Technical Inspection Report MS-DRRSCN-DARSBF-1988-2026 on the sodium fluorescein dye test, at 9:26 a.m. dye tests were conducted on the septic tank and one of the laundry basins, with a positive result.During the inspection, the distance from the river to the yard where the septic tank and wastewater pipe are located was measured at approximately 15 meters. (folios 30 to 33). 4. By sanitary orders MS-DRRSCN-DARSBF-OS-041-2026 and MS-DRRSCN-DARSBF-OS-042-2026, dated 3 July 2026, Ms. Olga Marta Chaves Zumbado and Mr. Carlos Francisco Chaves Zumbado, owners of the homes, were notified that they had 22 working days to carry out the repairs and works required to prevent improper disposal of wastewater. The administrative orders identified are due to expire on 4 August 2026. The deadline was set in view of the nature of the corrective works, which involve construction interventions and work that cannot be performed immediately. Ms. [Nombre 001] was informed by email of the health authority's actions. (folios 34 to 39). 5. On 10 July 2026, an email was received from Ms. [Nombre 001], who stated that despite the time elapsed since the initial complaint and the actions taken by different authorities, the matter remained without a definitive and verifiable solution.She wished to know how they would verify that the protection zone was not being affected and that the drains were being built correctly, since there was great concern that the property had no registered cadastral survey plan linked to it, according to the National Registry, which is essential for calculations and designs. Nevertheless, the work continued as usual, with no responsible environmental measures being taken. She requested notification of the warning issued to the owners with a 22-day deadline. She attached a copy of the registry record for the property complained of. (folios 40 to 42). 6. On 10 July 2026, an email was received from Ing. David Umaña Corrales of the Municipalidad de Belén, who stated: ‘This Unit handled the complaint initially filed. According to the inspection conducted, no construction works were found at the reported site at the time of assessment; accordingly, the relevant follow-up work was to continue.The Municipal Inspector promptly communicated this to the interested person by email and, to date, no construction works have been found at the place identified in the complaint. Subsequently, through the CFIA's APC platform, Construction Permit # 0060-2026, dated 16 June 2026, was processed and issued for construction of drains and a septic tank at the reported site, following assessment by the Sanitary Sewer Unit. The permit also covers repair works to a home in a different area from the one identified in the complaint.’ In addition, that same day an email was received from Ing. Juan Carlos Chaves of the Municipalidad de Belén’s Sanitary Sewer Unit, who stated: ‘Regarding the visit conducted with Environmental Manager Victoria Leiva, I wish to add an observation. When the Sanitary Sewer Unit approved the design for the wastewater treatment system at the property complained of, the engineer Jeffrey Zumbado was asked about the land slope.He replied that it would be less than 20%, which falls within the regulations for subsurface disposal of treated ordinary wastewater, since the maximum permitted limit is 30%. However, at no time were we told that the intention was to place fill in the area designated for the infiltration trenches. This situation requires particular attention because placing fill in sloped areas can compromise the proper operation of the infiltration trenches. Accordingly, under the Sanitary Sewer Unit’s opinion, the ground must be properly stabilized before the trenches are built, either by compacting the fill or, if geotechnical conditions require it, by constructing a retaining wall or other support structure. If these measures are not implemented, there is a high probability of erosion-related landslides, which would put the infiltration system’s functionality at risk and could cause untreated wastewater to be discharged into the river again.’ (folios 43 to 46). 7.On 17 July 2026, an email was received from Ms. [Nombre 001], who stated that she needed the notice delivered to the property owners because she intended to take the matter to other authorities. She attached a letter with no reference number identifying irregularities in the procedure for granting the construction permits, stating that assessment of those permits falls within the health authority's remit, and requesting the construction plans and the file concerning the permits issued. (folios 47-58). 8. On Monday, 20 July 2026, Ms. [Nombre 001] was informed by email that, in response to her complaint under procedure 081-2026, received by the Health Area on 25 June 2026, an inspection and dye test had been conducted on 3 July 2026, and the relevant document was attached. Since the dye test was positive and the matter fell within the Ministerio de Salud’s authority, the corresponding administrative orders had been issued, and those documents were attached.She was also informed that the sanitary orders were still within their compliance period and that construction permits and the location of the systems in question fall within the Municipalidad’s authority, not that of the Ministerio de Salud. (folios 59-68). 9. On Thursday, 23 July 2026, an email was received from Ing. Juan Carlos Chaves Artavia of the Municipalidad de Belén’s Sanitary Sewer Unit, stating that, according to the professional in charge of work on the property complained of, the work had been completed, and an inspection had been arranged for 27 July at 11:00 a.m. On Monday, 27 July 2026 at 8:15 a.m., an email was received from Ing. Juan Carlos Chaves Artavia of the Municipalidad de Belén’s Sanitary Sewer Unit rescheduling the visit to Tuesday, 28 July 2026. In response, Ing. Chaves was informed that the Ministerio de Salud did not consider it appropriate to conduct a joint inspection before the deadline expired, because the administrative orders issued were still within their compliance period, which expired on 4 August 2026.(folios 69-77). In this regard, it is important to note that after learning of the complaint, which was filed with this Health Area on 25 June 2026, the health authority conducted an inspection and technical dye test, issued administrative orders (sanitary orders), and followed up on the case. The actions taken by the Municipalidad de Belén fall within the exercise of distinct and independent powers assigned by law to the Ministerio de Salud. In addition, when this honorable Court’s notice was received in the present case, the sanitary orders issued by the health authority were still within their compliance period, expiring on 4 August 2026; therefore, when this report was submitted, no established noncompliance justified the adoption of sanctions. The Ministerio de Salud’s authority in this matter is also limited to verifying the existence of health risks arising from wastewater disposal and ordering the appropriate corrective measures.Matters concerning the issuance of construction permits and approval of works fall within the Municipalidad de Belén’s authority, without prejudice to the Ministerio de Salud’s authority to monitor sanitary conditions and order the applicable corrective measures. Accordingly, the amparo applicant’s objections to the construction permits must be considered by the competent municipal authority. The chronology of events thus shows that the health authority took concrete and timely action within a reasonable period, and that there was no omission, inaction, or neglect that could constitute a violation of the amparo applicant’s fundamental rights. REQUEST FOR RELIEF On the basis of the facts set out, I ask this Honorable Authority to deny the amparo application as against the Ministerio de Salud, since there has been no omission, arbitrary conduct, or unreasonable conduct by this institution.On the contrary, the health authority promptly addressed the complaint, conducted inspections, verified the reported facts, and issued the corresponding sanitary orders within the scope of its authority. As for the plans and construction permits, the Municipalidad is responsible for issuing them in accordance with its requirements, including review of compliance with setbacks from protection zones and other matters (…)”.
  5. 5In the processing of this proceeding, the legal requirements have been observed.

Drafted by Justice Araya García; and, REASONS:

I. OBJECT OF THE AMPARO PROCEEDING

The amparo applicant alleges that the authorities of the Municipalidad de Belén and the Belén-Flores Health Area have not addressed and definitively and conclusively resolved—despite the complaints filed—a public-health and environmental problem involving the irregular discharge of wastewater and sewage from a property into a river. In essence, she alleges that, as of the filing of the amparo application, the respondents had not physically verified whether the measures ordered to address the situation had been effective.

She also alleges that the accompanying complaint concerning construction works on the property, which could compromise the protection zone and cause further harm to the water resource, has not been addressed.

II.Preliminary Matter. Before examining the merits—concerning the alleged violation of the right to a prompt and duly completed procedure—it must be clarified that, beginning with judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—cases in which the issue is whether the public administration has complied with the deadlines set by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws for special administrative procedures, whether to issue a final decision in a proceeding conducted on the merits, initiated either on the Administration’s own initiative or at a party’s request, or to hear the available administrative appeals. This case presents an exception, supported by the majority of this Constitutional Court, because it concerns environmental and health complaints that allegedly have not been resolved within a reasonable time. Having clarified this point, the Chamber proceeds to resolve the specific situation raised in this amparo proceeding.

III. FACTS FOUND

The following facts are considered established insofar as they are relevant to deciding this amparo proceeding:

Facts relating to the Municipalidad de Belén:

  • 1)On 5 March 2026, the amparo applicant filed a complaint with the Municipalidad de Belén (case No. 738-2026), reporting construction at property No. 0047893 in San Antonio de Belén, Heredia, next to Condominio Jireth, without the corresponding municipal permit and within a protection zone. The complaint also alleged the irregular discharge of wastewater and sewage from that property (specifically, from the three or four houses located there) into a nearby body of water (river) (see report).
  • 2)Following that complaint, municipal officials conducted an inspection on 6 March 2026 and performed dye tests on the property to determine whether the water discharged into the river was wastewater. The tests confirmed that it was indeed wastewater, resulting from an overflow from the existing septic tank, and the residents present at the inspection were told what corrective action was required to address the problem (see report).
  • 3)On 10 March 2026, another complaint (procedure No. 790-2026) in the amparo applicant’s name was formally received by the Sanitary Sewer Unit. In response, on 13 March 2026 the sanitary sewer engineer-analyst conducted a new inspection at the site together with the environmental manager of the Belén-Flores Health Area of the Ministerio de Salud. During the visit, it was found that no corrective measures had been implemented in the system. Consequently, the residents were informed of the harm this situation was causing to the environment and public health, since, in addition to contaminating the river channel, it encouraged the proliferation of mosquitoes and other disease vectors (see report).
  • 4)On 23 March 2026, the owner of the property where the sanitary violations were detected, Olga Marta del Socorro Chaves Zumbado, identity card 4-0131-0386, was notified of resolution No. DSP-ALS-R-003-2026, by which the Sanitary Sewer and PTARs units required improvements to the existing system, including modifications to the septic tank and construction of infiltration trenches, all under the responsibility of a professional qualified in the field. That resolution expressly stated as follows:

“WHEREAS: According to the results obtained during the inspections, the property discharges wastewater irregularly into the Pirro River. During the inspection, foul odors were detected from the accumulation and degradation of wastewater deposited on the banks of the Pirro River, affecting community life and public health. According to the inspections conducted, the property is not connected to a secondary treatment system, such as infiltration trenches, for wastewater from the septic tank. According to point 3 of the recitals of the Reglamento de Vertido y Reúso de Aguas Residuales N° 33601, which states verbatim: ‘Contamination of bodies of water promotes the spread of waterborne diseases, reduces the number of available sources, raises the cost of supplying water for human consumption, and endangers many species of our flora and fauna with extinction.’ The minimum setback required for construction of the infiltration trenches under Ley Forestal Nº 7575 must be taken into account.

The steep slope of the land must be considered in designing the infiltration trenches, in accordance with Annex 2 to Decreto Ejecutivo Nº 42075-S-MINAE, the regulation for subsurface disposal of ordinary wastewater, which establishes technical requirements for sloping land with a gradient between 1% and 30%, since the trenches must be laid out according to specific guidelines. Under Chapter III, Article 11, subsection “d,” of the Reglamento para la Operación y Administración del Alcantarillado Sanitario y Plantas de Tratamiento de Aguas Residuales del Cantón de Belén, which states verbatim: ‘No construction is permitted over the drainage area, nor may bedrooms, living rooms, dining rooms, laundry areas, or any other room that makes the soil impermeable be added over the area where the drains will be built.’ Therefore, the infiltration drain must be kept covered with grass, fine gravel, grass block, or permeable paving stones to facilitate evapotranspiration, infiltration of treated water into the subsurface, and maintenance, cleaning, and replacement of the filtering material.

Any work required within private property is the exclusive responsibility of the owner, not the Municipalidad de Belén. THEREFORE, THE SANITARY SEWER UNIT OF THE MUNICIPALIDAD DE BELÉN RESOLVES: For the factual reasons set out above: FIRST: To grant a period of ten (10) business days, counted from the day after this notice is received, to submit the calculation report supporting the technical solution for treating the wastewater produced on this property, to ensure that the solution complies with Decreto Ejecutivo Nº 42075-S-MINAE, the regulation for subsurface disposal of ordinary wastewater. SECOND: To refer the case to the Belén Flores Health Area of the Ministry of Health so that it may take the applicable health and legal measures if these requirements are not complied with in a timely and proper manner. THIRD: To inform Olga Marta del Socorro Chaves Zumbado, identity card number 4-0131-0386, of this resolution. SERVE NOTICE” (see report and evidence).

  • 5)To comply with the order, the property owner appointed civil engineer Jeffrey Zumbado Vargas, a professional with the experience and knowledge needed to carry out the required modifications. The Sanitary Sewer Unit and wastewater treatment plants verified that Engineer Zumbado Vargas was duly registered and authorized to practice before the Colegio Federado de Ingenieros y de Arquitectos de Costa Rica (CFIA), confirming that his professional authorization was current under license IC-11914. In this case, the Sanitary Sewer Unit and wastewater treatment plants did not set a specific deadline to implement the solution, since the amparo applicant had already referred the matter to the Urban Development and Construction Control Unit, which “is the administrative department competent to conduct inspections relating to construction matters” (see report).
  • 6)On 23 March 2026, the amparo applicant was given a response by official letter No. DSP-ALS-O-034-2026 concerning file No. 738-2026 and file No. 790-2026. She was informed that the owner of the reported property had already been notified of resolution No. DSP-ALS-R-003-2026 and that, if the ordered measures were not complied with, the matter would be referred to the Ministry of Health. Specifically, the following was recorded on this occasion:

“On 05 March of this year, we received file 738-2026, concerning a report of an alleged irregular discharge of wastewater into the Bermúdez River. The reported property is parcel 0047893, registered under microfilm folio 1482- 495-001, located in the district of San Antonio, canton of Belén, province of Heredia. The property currently has three dwellings, and ownership belongs to Olga Marta del Socorro Chaves Zumbado, identity card number 4-0131-0386. On 06 March of this year, engineers José Pablo Suárez Sánchez and Juan Pablo Artavia Jiménez visited the reported property and conducted tests using sodium fluorescein dye to determine whether the water being discharged into the Bermúdez River was the same water coming from the septic tank. The tests established that this wastewater from the septic tank does not have a secondary treatment system, such as infiltration trenches (…) On 10 March 2026, the report was received again, this time under file 790- 2026.

Consequently, a second inspection was conducted on 13 March of this year, with the participation of Engineer Juan Carlos Chaves Artavia, representing the Municipality, and Environmental Manager Victoria Leiva Pereira of the Belén-Flores Health Area. The inspection established that there had been no progress in constructing the infiltration trenches. In light of this situation, the property was notified by resolution DSP-ALS-R-003-2026, granting a period of ten business days, counted from the day after 23 March of this year, to submit the calculation report supporting the technical solution to the problem caused by the irregular discharge of wastewater. This is to ensure that the work to be carried out has the necessary technical support and complies with current regulations in Costa Rica, particularly Decreto Ejecutivo Nº 42075-S-MINAE, Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas (…) Once the deadline for submitting the requested calculation report has expired, this Sanitary Sewer Unit will review it and, if approved, grant a new deadline for construction of the proposed and approved work.

During that period, the relevant technical inspections will be conducted to verify that the solutions set out in the calculation report and approved by this Unit are faithfully implemented in the work. These inspections will seek to ensure that the construction measures conform to what was authorized, that the established technical parameters are met, and that current regulations on wastewater disposal are observed, particularly the provisions of Decreto Ejecutivo Nº 42075-S-MINAE. This will ensure that the infrastructure developed meets standards of safety, functionality, and sustainability, avoiding risks of environmental contamination and safeguarding water resources and community well-being. The following is noted: - The case will be referred to the Belén Flores Health Area of the Ministry of Health so that it may take the applicable health and legal measures if the reported property does not comply with these requirements in a timely and proper manner” (see report and evidence).

  • 7)In addition, the sanitary sewer analyst engineer informed the amparo applicant by telephone that she would be notified in due course once the design for improvements to the treatment system had been approved (see report).
  • 8)On 8 April 2026, Engineer Jeffrey Zumbado (the person responsible for the work) submitted a design proposal to the municipality for improvements to the wastewater treatment system. The design was not approved at that time because it required technical adjustments relating to the parameters used. In an exchange of emails with the professional responsible, the necessary comments and corrections for bringing it into compliance were provided (see report).
  • 9)On an unspecified date, the sanitary sewer analyst engineer informed the amparo applicant by telephone that the Sanitary Sewer Unit and wastewater treatment plants could not unilaterally modify the input data used by the professional in the design, since “the accuracy of that information is the professional responsibility of the professional who prepares the design, who is technically accountable for the criteria and parameters used in preparing the proposal” (see report).
  • 10)On 14 May 2026, after the technical comments had been addressed and the required corrections made, the proposal for infiltration trenches or drainage to be installed on the reported property was finally approved by official letter No. DSP-ALS-O-055-2026, which was duly served on the owner on 18 May 2026. The proposal underwent an exhaustive review and multiple requests for adjustments before the corresponding approval was issued (see report and evidence).
  • 11)During the last week of June 2026, municipal authorities spoke by telephone with the complainant, who expressed concern about the approval granted to the design for infiltration trenches or drainage. However, according to the report, “the design was approved after technical verification that the proposal met the requirements established by this Unit. Had those requirements not been met, the process would have required further reviews and corrections, which would inevitably have delayed resolution of the reported problem even further” (see report).
  • 12)On an unspecified date, Engineer Zumbado (hired by the reported party) was informed that, for the construction phase of the work included in the approved design, he had to coordinate as appropriate with the Urban Development and Construction Control Unit of the Municipalidad de Belén, the administrative department competent in the matter, which was also included in the relevant communications (see report).
  • 13)On 3 July 2026, staff of the Sanitary Sewer Unit and wastewater treatment plants conducted a new inspection of the reported property together with the Environmental Manager of the Belén-Flores Health Area of the Ministry of Health. During the visit, it was established that the work required to remedy the identified health issue had not yet been carried out. Consequently, the Environmental Manager of the respondent Ministry issued three health orders addressed to the parties associated with the property, because three separate dwellings were found, each with noncompliance requiring attention (see report).
  • 14)On 14 July 2026, the amparo applicant filed this amparo application (see filing).
  • 15)On 21 and 23 July 2026, the municipal sanitary sewer analyst engineer asked Engineer Jeffrey Zumbado to conduct a technical inspection to verify the work completed. Engineer Jeffrey Zumbado Vargas reported that the infiltration trench work had been completed, and that the effectiveness of the measures implemented should therefore be verified on site. The visit was initially scheduled for 27 July 2026 and was then rescheduled for 28 July 2026 (see report and evidence).
  • 16)The scheduling of this last inspection took place before 24 July 2026 (see evidence).
  • 17)On 24 July 2026, the respondent municipal authorities were notified that this amparo application had been filed (see notices of service).
  • 18)On 28 July 2026, an inspection was conducted at the reported property to carry out dye tests at the dwellings involved and to determine whether the problem with wastewater management (blackwater and greywater) had been remedied by the work completed (see report and evidence).
  • 19)This last inspection by the Sanitary Sewer Unit and wastewater treatment plants was conducted jointly with the construction inspector from the Urban Development and Construction Control Unit, within the scope of that Unit’s responsibilities concerning construction permit No. 060-2026. Engineer Jeffrey Zumbado Vargas and Mr. Luis Humberto Guzmán Chaves, a resident of the inspected property, were also present. As evidence submitted during the inspection, Mr. Luis Humberto Guzmán Chaves provided photographs of the construction of the infiltration trenches and removal of the pipe that had previously served as an overflow for discharging wastewater from the septic tank into the Bermúdez River. These matters were verified during the inspection. Dye tests were conducted on wastewater discharges (blackwater and greywater) from the first two dwellings inspected. It was not possible to inspect the third dwelling because no one was present to allow entry to the property. It was therefore agreed that the inspection of that dwelling would be conducted jointly with the Ministry of Health after the deadline granted in the health orders issued by that institution had expired, in order to verify compliance with the applicable corrective measures (see report and evidence).
  • 20)According to the report submitted, “the dye test results confirmed that both the greywater and blackwater generated in the two inspected dwellings are conveyed to the existing treatment system.” It was consequently stated that “no wastewater discharges into the Bermúdez River were detected; therefore, it is concluded that the previously identified discharge was eliminated by the corrective work carried out” (see report and evidence).

Facts relating to the Belén-Flores Health Area of the Ministry of Health:

  • 1)On 25 June 2026, the amparo applicant filed a health complaint with the Belén-Flores Health Area (file No. 081-2026). On this occasion, the person whose rights are protected stated expressly as follows: “On 06 March I filed a complaint with the Municipalidad de Belén, specifically with the Sanitary Sewer Unit and other departments, because of a situation at the property adjoining mine. At that time, no action was taken, and I understand that the Ministry of Health jointly conducted an inspection with that Unit. However, to this day I have received no response, and I wish to express my dissatisfaction with the situation. Unfortunately, the problem has worsened: they continue discharging blackwater into the river and are also discharging it onto the ground.” The amparo applicant attached the letter she had sent to the Municipality on 6 March 2026 and photographs of the reported site. She also provided the following address for service of notices: [email protected] (see report and evidence).
  • 2)On 1 July 2026, the Environmental Manager of the respondent Health Area requested information from the Municipalidad de Belén about construction permits and the complaint the amparo applicant had filed with that authority (see report and evidence).
  • 3)On 3 July 2026, an official from the Belén Flores Health Area and the engineer from the Sanitary Sewer Unit of the Municipalidad de Belén visited the reported property. On that occasion, the municipal official stated that the Municipality’s Sanitary Sewer Unit had approved the wastewater treatment system design and noted that the Urban Department had already approved a remodeling permit (see report).
  • 4)During the inspection conducted on 3 July 2026, the respondents were received by the owner, Olga Marta Chaves Zumbado, and her son, Mr. Luis Humberto Guzmán, who allowed them to enter. Three dwellings were found on the property. At the rear of the property, a septic tank covered with sheets was observed; a pipe with wastewater was also found elsewhere in the yard. According to Technical Report on Inspection and Dye Test with Sodium Fluorescein No. MS-DRRSCN-DARSBF-1988-2026, at 9:26 a.m. dye tests were conducted on the septic tank and one of the laundry sinks, with a positive result. During the inspection, the distance from the river to the yard where the septic tank and wastewater pipe were located was measured and recorded as approximately fifteen meters. It was also stated that the water flows toward the Río Pirro protection zone and into the river itself (see report and evidence).
  • 5)On 3 July 2026, the Ministry of Health issued health orders No. MS-DRRSCN-DARSBF-OS-041-2026 and No. MS-DRRSCN-DARSBF-OS-042-2026, which were served respectively on Olga Marta Chaves Zumbado and Carlos Francisco Chaves Zumbado (owners of the dwellings). They were instructed to make the repairs and carry out the work required to prevent the improper disposal of blackwater and wastewater and its discharge into the Río Pirro protection zone, within twenty-two business days. The administrative acts state an expiration date of 4 August 2026. Specifically, they were asked to install an adequate system for collecting, conveying, and treating wastewater. According to the report, “the deadline granted was set in consideration of the nature of the corrective work, which involves construction interventions and work that cannot be carried out immediately” (see report and evidence).
  • 6)On 6 July 2026, the amparo applicant was informed by email of the health authority’s actions. That day, she was expressly told by email: “Please be advised that complaint file 081-2026 is being addressed. A visit to the reported property was conducted and the corresponding administrative act was issued, with a deadline of 22 business days. The complaint is being addressed” (see report and evidence).
  • 7)On 10 July 2026, the amparo applicant sent an email to the respondent Health Area, stating that, despite the time elapsed since the initial complaint and the actions taken by various authorities, the matter remained pending a definitive and verifiable solution. She also said she wanted to know how compliance would be verified to ensure the protection zone was not being affected and that the drains were being built correctly. She further expressed concern that, according to the National Registry, the property did not have a cadastral plan associated with it, which was essential for performing calculations and preparing designs. She asserted that, despite this, the work was proceeding as usual without responsible measures being taken to protect the environment. She also requested a copy of the notice of the preventive order served on the owners, which gave them a twenty-two-day deadline, and attached a copy of the registry record for the reported property (see report and evidence).
  • 8)On 10 July 2026, the respondent Health Area received an email from Engineer David Umaña Corrales of the Municipalidad de Belén stating: “This Unit addressed the complaint initially filed. According to the inspection conducted, no construction work was observed at the reported site at the time of assessment; accordingly, it was decided to continue the relevant follow-up. The Municipal Inspector duly informed the interested person of this situation by email, and, as of this date, no construction work has been found at the location identified in the complaint. Subsequently, Construction Permit # 0060-2026, dated 16 June 2026, for the construction of drains and a septic tank at the reported site was processed and granted through the CFIA’s APC platform, following review by the Sanitary Sewer Unit. The permit also covers repair work to a dwelling in a different area from the one identified in the complaint.” That same day, an email was also received from Engineer Juan Carlos Chaves of the Municipalidad de Belén Sanitary Sewer Unit, stating: “Regarding the visit conducted with Environmental Manager Victoria Leiva, I would like to offer an observation. When the Sanitary Sewer Unit approved the design for the wastewater treatment system at the reported property, Engineer Jeffrey Zumbado was asked about the slope of the land. He replied that it would be less than 20%, which is within the range established by the regulation for subsurface disposal of treated ordinary wastewater, since the maximum permitted slope is 30%. However, at no time were we told that the intention was to place fill in the area designated for the infiltration trenches. This situation must be considered carefully, since placing fill on sloped areas may compromise the proper operation of the infiltration trenches. Therefore, according to the Sanitary Sewer Unit’s judgment, the ground should be properly stabilized before the trenches are built, either by compacting the fill or, if geotechnical conditions require it, by constructing a retaining wall or other support structure. If these measures are not implemented, there is a high probability of erosion-related landslides, which would jeopardize the functionality of the infiltration system and could cause wastewater to be discharged into the river again without adequate treatment” (see report and evidence).
  • 9)On 17 July 2026, the amparo applicant sent an email to the aforementioned Health Area, stating that she needed a copy of the notice delivered to the property owners, as she needed to approach other authorities. She attached a letter with no official letter number identifying irregularities in the procedure for granting construction permits and stating that the health authority was responsible for reviewing them. She also requested the construction plans and the file relating to the permits granted (see report and evidence).
  • 10)On 20 July 2026, the amparo applicant was informed by email, regarding her complaint (file 081-2026), that an inspection and dye test had been conducted on 3 July 2026. She was told that, because the dye test was positive, the corresponding administrative acts had been issued, and the documents were attached. She was also told that the health orders were still within their compliance period and that construction permits and the location of the systems in question fell within the Municipality’s jurisdiction, not that of the Ministry of Health (see report and evidence).
  • 11)On 23 July 2026, the Belén-Flores Health Area received an email from the engineer of the Municipalidad de Belén Sanitary Sewer Unit stating that, according to the professional responsible for the work at the reported property, it had been completed. An inspection had therefore been arranged for 27 July at 11:00 a.m., and the Health Area was asked whether it was available to accompany the inspection (see report and evidence).
  • 12)On 24 July 2026, the Director of the Belén-Flores Health Area was notified that this amparo application had been filed (see notices of service).
  • 13)On Monday, 27 July 2026, at 8:15 a.m., an email was received from the aforementioned municipal official stating that the inspection had been rescheduled for Tuesday, 28 July 2026. In response, the engineer was informed that the Ministry of Health did not consider a joint inspection before the deadline appropriate, because the administrative acts issued were still within their compliance period, which expired on 4 August 2026 (see report).

IV. FACT NOT PROVEN

The following relevant fact is considered unproven for purposes of deciding this amparo application: Sole fact.—That the respondent municipal authorities addressed the amparo applicant’s complaint concerning construction work and the alleged encroachment on the environmental protection zone (case file).

V. THE CASE

The amparo applicant comes before this Chamber and states that she reported an environmental and health problem to the Municipalidad de Belén and the Belén-Flores Health Area, which, she alleges, has not been definitively addressed as of this date.

First, she explains that parcel No. 0047893, located in San Antonio de Belén, is discharging wastewater and sewage irregularly into a nearby body of water (a river), thereby causing foul odors, environmental contamination, and a risk to public health.

She alleges that, although various actions have been taken, they do not by themselves establish that the irregular wastewater discharge has ceased or that the water resource in question is now effectively protected.

She maintains that the subsequent approval of a design for infiltration trenches constitutes only a documentary assessment of a proposed technical alternative. It does not amount to confirmation that the solution was properly implemented or that the previously established contamination has ceased. In her view, an on-site inspection is therefore essential to determine whether the reported environmental problem was actually remedied.

She also states that, from the time of her initial complaint, the administration was informed of possible construction work on the reported property, located near the Bermúdez River, where environmental restrictions related to protection of the water resource might apply. She also reported the need to verify whether the work, earthworks, construction of wastewater treatment systems, and other interventions on the property complied with the applicable setbacks and alignments under current environmental regulations.

She therefore asserts that it is necessary to verify not only the proposed health solution but also that any work carried out does not affect a protection zone or cause additional harm to the water resource.

She asks that the amparo application be granted and, in essence, that the respondent authorities be ordered to address the situations described above.

Having reviewed the arguments made by the applicant, the reports submitted by the respondent authorities—with due warning of the consequences provided for in Article 44 of the Ley de la Jurisdicción Constitucional—and all the evidence in the case file, this Constitutional Tribunal considers that this amparo proceeding must be partially granted, for the reasons set out below.

A. As to the Municipalidad de Belén and the complaint about the irregular discharge of wastewater and sewage into the river, the amparo application must be denied:

First, it has been shown that, from the time this matter was reported, the municipal authorities diligently addressed it. A thorough review of the proven facts set out in this judgment fully establishes this. The complaint in question was filed on 5 March 2026, and the next day the authorities of the Municipalidad de Belén inspected the property and conducted dye tests that confirmed the alleged facts and led to instructions being issued to the reported parties to remedy the problem. It is also established that, a few days later, on 13 March 2026, the respondents, together with the Environmental Manager of the Belén-Flores Health Area of the Ministry of Health, made another site visit, which established that the measures ordered to address and remedy the irregular discharge into the river had not been complied with. As a result, on 23 March 2026—that is, the same month the complaint was filed—the respondent municipal authorities notified the owner of the reported property of resolution No. DSP-ALS-R-003-2026, which required improvements to the existing system, including modifications to the septic tank and construction of infiltration trenches.

It is also verified that the respondent municipal authorities monitored the proposed work submitted in April 2026 by the engineer hired by the reported parties to comply with the order. Following several reviews and steps, that proposal was finally approved on 14 May 2026.

It is likewise established that on 3 July 2026 the respondent municipal corporation’s authorities conducted another inspection of the reported property, together with the Environmental Manager of the Belén-Flores Health Area of the Ministry of Health. The visit established that the required work had not yet been carried out, so the Ministry’s authorities issued three health orders relating to the property, with an expiration date of 4 August 2026.

It was shown that on 21 and 23 July 2026—before the respondents were notified of this amparo—the municipal sanitary sewer analyst engineer asked the private engineer hired by the complainant to conduct a technical inspection to verify the completed work. The evidence established that this inspection was ultimately scheduled for 28 July 2026, also before the Municipality was notified of this amparo.

It was established that, as agreed, the municipal authorities inspected the site on 28 July 2026 to determine whether the problem with wastewater management (blackwater and greywater) had been remedied by the work completed. Two of the three dwellings on the parcel were inspected because no one was present at the third dwelling to authorize entry. After testing, it was confirmed that “both the greywater and blackwater generated in the two inspected dwellings are conveyed to the existing treatment system.” Accordingly, the authorities reported under oath that “no wastewater discharges into the Bermúdez River were detected; therefore, it is concluded that the previously identified discharge was eliminated by the corrective work carried out.” As to the third dwelling, the municipal authorities decided to conduct an inspection jointly with the Ministry of Health once the period granted under the health orders issued by that institution had expired, to verify compliance with the applicable corrective measures.

These facts show that, from the time the complaint was filed, the authorities of the Municipalidad de Belén took multiple steps to address it and ultimately verified that the corrective measures ordered and implemented—at least as regards the discharge of wastewater and sewage into the river—had been effective and the reported problem eliminated. It is also important that this final verification took place days before the deadline set by the Ministry of Health in its health orders had expired. Thus, even though the third dwelling was not inspected on 28 July 2026, its residents still had time to carry out the corrections, at least those ordered by the Ministry of Health, in the event—purely hypothetically—that they had not yet done so.

Second, it is established that on 23 March 2026, weeks before this amparo application was filed, the municipal authorities notified the amparo applicant of official letter No. DSP-ALS-O-034-2026. The letter addressed the complaint, specifically the irregular discharge into the river, the inspections conducted and their results, and the measures ordered for the reported parties to remedy the problem. It was also shown that the municipal corporation’s authorities maintained regular telephone communication with the amparo applicant concerning the design for improvements ordered for the reported parties. Indeed, it is established that during the last week of June 2026, before this amparo was filed, she was told that the design submitted by the reported party for infiltration trenches or drainage had been approved because it met the requirements established for that purpose.

Additionally, although the record does not show that the amparo applicant was notified of the results of the 28 July 2026 inspection, given the circumstances described above, any such omission cannot be considered arbitrary. As reiterated, at that time the reported parties still had time to comply with the health orders issued by the Ministry of Health.

Accordingly, it has been shown that, to date, the person whose rights are protected has been kept fully informed of the processing and resolution of the complaint under review, and a violation of constitutional Article 41 is therefore ruled out.

B. As to the Municipalidad de Belén and the complaint about construction in a protection zone, the amparo application must be granted: In essence, after reviewing the case file, it has not been shown that the municipal authorities addressed or ruled on the amparo applicant’s separate complaint about construction allegedly carried out on the property in question within an environmental protection zone. By the time this amparo application was filed, on 14 July 2026, more than four months had elapsed since the amparo applicant reported this specific matter on 5 March of the current year. As stated, the record does not show that the municipal corporation addressed or acted on it, or that a response was given to the complainant. This omission does violate the fundamental rights of the person whose rights are protected. Accordingly, this part of the amparo application must be granted, with the consequences to be set out in the operative part of this judgment.

C. As to the Belén-Flores Health Area and the complaint about the irregular discharge of wastewater and sewage into the river, the amparo application must be denied:

First, when this amparo application was filed on 14 July 2026, the authorities in question had received the amparo applicant’s complaint about the matter under review—the irregular discharge into the river—less than a month earlier, on 25 June 2026. It therefore cannot be maintained that, by the time the matter was brought before the Chamber, an excessive and unreasonable period had elapsed for the Belén-Flores Health Area authorities to intervene formally and address the health problem reported.

Second, although the complaint was formally filed on 25 June 2026, the Ministry of Health authorities had already intervened in the case as of 13 March 2026, in response to a request for assistance from the Municipalidad de Belén. On that occasion, the relevant Environmental Manager inspected the reported property together with the Municipality.

Third, the evidence shows that the health authorities also acted promptly and diligently in response to the complaint, with no arbitrary omission on their part. In particular, before this amparo was filed, they inspected the reported property on 3 July 2026, conducted dye tests, and confirmed the reported facts. This led them to issue and serve three health orders that same day on the occupants of the three dwellings found on the property. By those administrative acts, the reported parties were given twenty-two business days to make the repairs and carry out the work required to prevent the improper disposal of blackwater and wastewater and its discharge into the river’s protection zone; the deadline expired on 4 August 2026.

Fourth, the person whose rights are protected came before this Chamber on 14 July 2026, when the reported parties still had time to comply with the health orders. Indeed, when the Director of the Belén-Flores Health Area submitted his report on 29 July 2026, that authority still had time to visit the reported property and verify that the orders had in fact been complied with.

Fifth, because it was demonstrated that, as of 6 July 2026 (days before this amparo application was filed), the authorities of the aforementioned health area informed the amparo applicant of the steps taken regarding her complaint. Specifically, she was informed of the visit carried out, the sanitary orders issued, and the twenty-two-day period granted for compliance. At the same time, it was verified that on 20 July 2026 (before this amparo application was notified to the aforementioned ministry), she was again informed of the inspection and the color test conducted on 3 July 2026. She was also advised that, because the color test was positive, the corresponding administrative acts had been issued (and were attached to the notice), and that the sanitary orders were still within the compliance period. Accordingly, no violation of Article 41 of the Constitution has been established in this case.

D. Regarding the Área Rectora de Salud Belén-Flores and the complaint concerning construction in a protected area, the amparo application must be denied:

This is essentially because it was shown that the amparo applicant filed this specific request with the Ministerio de Salud on 10 July 2026, that is, four days before this amparo application was filed. It therefore cannot be maintained that, when this amparo application was filed, an excessive and unreasonable period had elapsed without the matter being addressed. In any event, the record shows that on 20 July 2026 (before this amparo application was notified to the health area), the amparo applicant was informed that matters concerning the construction permit and the location of the identified systems fell within the Municipality’s jurisdiction, not that of the Ministerio de Salud.

VI. NOTE OF INTEREST

Finally, in light of the arguments set out in the preceding reason, the authorities of the Municipalidad de Belén must be advised that they have a duty to carry out, as soon as possible (if they have not already done so), an inspection of the third dwelling, which could not be assessed on 28 July 2026, and to determine whether the measures issued to its inhabitants have been complied with, in order to definitively resolve the reported health and environmental problem. The municipal authorities are also advised that they have a duty to promptly communicate to the amparo applicant the results of the inspections carried out at the three aforementioned dwellings (in particular, regarding the irregular discharge of water).

Additionally, the authorities of the Área Rectora de Salud de Belén-Flores are advised that they have a duty (if they have not already done so) to take the necessary steps and promptly visit the three aforementioned dwellings, verify compliance with the sanitary orders issued, and communicate the results to the amparo applicant. They are also advised that, if the requirements set out in those sanitary orders have not been met, they must immediately order and implement additional measures to prevent further harm to health and the environment.

VII. DISSENTING OPINION OF JUSTICE SALAZAR ALVARADO

With due respect, I dissent from the majority opinion declaring the amparo application partially granted, for the following reasons:

In the Costa Rican legal system, protection of the right to a healthy and ecologically balanced environment is provided not only by Article 50 of the Political Constitution, but also by a number of laws and executive decrees (regulations) in force, including the Ley Orgánica del Ambiente, Law No. 7554 of 4 October 1995; the Ley de Biodiversidad, Law No. 7788 of 30 April 1998; the Ley de Conservación de la Vida Silvestre, Law No. 7317 of 21 October 1992; and Executive Decree No. 31849 of 24 May 2004, the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) [General Regulations on Environmental Impact Assessment Procedures], to name just a few. This makes it necessary, in environmental matters, to distinguish constitutional review from review of legality. In this regard, it is my view that this Chamber should hear a matter by way of an amparo proceeding alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and the violation of that right is manifest and evident, readily ascertainable, of some importance or gravity, and directly affects a specific person or community.

Otherwise, the matter must be raised and debated through the legality process. Accordingly, mere noncompliance with obligations and duties imposed by law on the various public administrations in environmental matters is properly heard through the legality process—administrative or judicial—where the alleged noncompliance or omissions can be reviewed much more broadly. It must be borne in mind that an amparo proceeding is summary, informal, straightforward, and swift. Thus, once the Administration intervenes in an environmental matter in the exercise of its powers and conducts a procedure, issuing administrative acts, the matter falls outside the scope of this specialized jurisdiction. Accordingly, review of administrative actions taken in connection with an environmental matter that requires full proceedings on the merits for proper assessment is possible only in the ordinary jurisdiction, since the design of the amparo proceeding is incompatible with comparing or reviewing technical or legal assessments made under the applicable laws or regulations, or with taking additional and further evidence needed to compare or review the assessments already in the case’s administrative file.

The contrary would transform the amparo proceeding into ordinary proceedings on the merits, thereby distorting it and defeating the purposes for which it was designed, and depriving it of its character as an instrument for the effective protection of fundamental rights. Consequently, I consider that where a public entity or body has intervened in various ways or issued administrative acts concerning an environmental matter, review and oversight fall within the administrative-litigation jurisdiction. It is precisely the determination that such administrative intervention exists that establishes the matter as one for the legality process. Accordingly, this amparo application should have been summarily rejected, since its subject is a matter properly debated, analyzed, and resolved through the legality process. However, since that was not done, the proper course is to deny the application without ruling on the merits of the matter raised, because it is for the ordinary jurisdiction, specifically the administrative-litigation jurisdiction, to determine whether the challenged administrative actions and conduct substantively conform to the provisions of the legal order concerning the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment.

VIII. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the administrative-litigation courts, not this Chamber. However, with the recent enactment of Law No. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is amenable to judicial protection by means of the amparo application provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must change its line of case law; under Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction.

Accordingly, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, the competent courts in all other cases are those of the administrative-litigation jurisdiction, for the reasons this Court gave in judgment No. 2008-02545, at 8:55 a.m. on 22 February 2008. This is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the relevant legal provisions, based on a logical, systemic, and teleological interpretation of the legal order.

IX.Documents submitted to the case file. The parties are advised that if they submitted any paper document, as well as any object or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, it must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 May 2012, Article LXXXI.

THEREFORE:

The amparo application is declared partially granted (solely because of the Municipalidad de Belén’s failure to address and resolve the complaint concerning alleged construction in an environmental protection area). Accordingly, Zeneida Chaves Fernández, in her capacity as Mayor; José Pablo Suárez Sánchez, in his capacity as Director of Public Services; and Juan Pablo Artavia Jiménez, in his capacity as Coordinator of the Sanitary Sewer System, all of the Municipalidad de Belén, or whoever holds those positions in their place, are ordered to issue the necessary orders and take all actions within their powers so that, within a maximum period of ONE MONTH from notification of this judgment, they address the complaint filed by the amparo applicant on 5 March 2026 (specifically, regarding works allegedly carried out without municipal permits in an environmental protection area) and provide and formally notify her of a response.

The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with it or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Municipalidad de Belén is ordered to pay the costs, damages, and losses caused by the events underlying this declaration, to be assessed in enforcement proceedings before the administrative-litigation jurisdiction. The application is denied as to the remaining grievances. All respondent authorities shall take note of what is stated in reason VI of this judgment. Justice Salazar Alvarado dissents and would deny the application, because it is for the ordinary jurisdiction, specifically the administrative-litigation jurisdiction, to determine whether the challenged administrative actions and conduct substantively conform to the provisions of the legal order concerning the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment. Justice Castillo Víquez appends a note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra LA MUNICIPALIDAD DE BELÉN, y EL MINISTERIO DE SALUD.

RESULTANDO:

  1. 1Por escrito aportado a la Sala el 14 de julio de 2026, la recurrente interpone recurso de amparo. Expone que acude a esta Sala por la existencia de una problemática ambiental y sanitaria por descarga irregular de aguas residuales hacia un cuerpo de agua. Indica que a inicios del año 2026 tuvo conocimiento de una problemática ambiental generada en la finca No. 0047893 ubicada en San Antonio de Belén de Heredia, consistente en la aparente descarga irregular de aguas residuales provenientes de dicha propiedad hacia un cuerpo de agua cercano, generando con esto malos olores, contaminación ambiental y riesgo para la salud pública. Dentro de esas aguas se incluye las provenientes del sistema sanitario de la propiedad. Señala que, ante dicha situación, el 5 de marzo de 2026 presentó una denuncia ante la Municipalidad de Belén (caso No. 738-2026), mediante la cual expuso la referida afectación ambiental (descarga irregular de aguas residuales y sanitarias en cuerpo de agua cercano).Producto de esa denuncia, funcionarios municipales realizaron una inspección el 6 de marzo de 2026 y realizaron pruebas para determinar el origen y recorrido de tales aguas residuales. Resultado de esa inspección se determinó la existencia de la descarga irregular de aguas residuales provenientes del tanque séptico de la propiedad denuncia. Explica que, como la situación ambiental denunciada continuaba sin solventarse, el 10 de marzo de 2026 presentó una nueva gestión (trámite No. 790-2026). En virtud de esta denuncia, el 13 de marzo de 2026 se realizó nueva inspección en la propiedad denunciada (con la participación de funcionarios municipales y de la gestora ambiental del Área Rectora de Salud de Belén-Flores). En dicha inspección se constató que no existía un avance en la construcción de la solución técnica para evitar la descarga irregular de aguas residuales, permaneciendo, entonces, la problemática ambiental.Apunta que mediante resolución No. DSP-ALS. R-003-2020 del 23 de marzo de 2020, la Municipalidad de Belén reconoció expresamente la existencia de una problemática ambiental asociada a la descarga irregular de aguas residuales. En dicha resolución, la Administración indicó que durante las inspecciones se percibieron malos olores producto de la acumulación y degradación de aguas residuales ubicadas en las cercanías del río, situación que afecta la convivencia y la salud pública. Asimismo, reconoció que la propiedad no contaba con una conexión adecuada de las aguas provenientes del tanque séptico hacia un sistema secundario de tratamiento, necesario para garantizar una disposición ambientalmente segura. Acusa que, pese que las referidas autoridades municipales y sanitarias comprobaron técnicamente la existencia de la problemática ambiental denunciada, al día de formulado el amparo la situación no había sido solucionada de forma definitiva.Aduce que, si bien se realizaron inspecciones, requerimientos administrativos y valoraciones técnicas, dichas actuaciones no acreditan por sí mismas que la descarga irregular de aguas residuales haya cesado ni que el recurso hídrico involucrado cuente actualmente con una protección efectiva. Manifiesta que, posteriormente, se inició un proceso administrativo relacionado con la propuesta de una solución técnica mediante zanjas de infiltración y mejoras al sistema de tratamiento de aguas residuales existente. No obstante, indica que, durante dicho procedimiento, la propia Municipalidad de Belén realizó múltiples observaciones técnicas respecto de la propuesta presentada, requiriendo aclaraciones relacionadas con el volumen de aguas residuales generado, dimensiones y ubicación del sistema de tratamiento, retiros respecto de propiedades colindantes y del río, así como otros aspectos necesarios para verificar el cumplimiento de la normativa aplicable.Sostiene que la aprobación posterior de un diseño de zanjas de infiltración constituye únicamente una valoración documental de una alternativa técnica propuesta, pero no equivale a una constatación de que dicha solución haya sido ejecutada correctamente ni de que la contaminación previamente comprobada haya cesado. Por ello, resulta indispensable una verificación material en sitio que permita determinar que la problemática ambiental denunciada fue efectivamente corregida. Agrega que, desde la denuncia inicial presentada ante la Municipalidad de Belén, también se puso en conocimiento de la administración la existencia de posibles obras constructivas dentro de la propiedad denunciada, ubicada en una zona cercana al Río Bermúdez, respecto de la cual podían existir restricciones ambientales aplicables, relacionadas con la protección del recurso hídrico. Asimismo, se denunció la necesidad de verificar si las obras, movimientos de tierra, construcción de sistemas de tratamiento de aguas residuales y demás intervenciones realizadas en la propiedad respetaban los retiros y alineamientos aplicables conforme a la normativa ambiental vigente.Afirma que corresponde verificar no solamente la solución sanitaria propuesta, sino también que cualquier intervención realizada no comprometa una zona de protección ni genere afectaciones adicionales al recurso hídrico. Indica que, que dicha propiedad no cuenta con plano catastrado, todas las obras se están realizando si un alineamiento fluvial del INVU, generando con ello una invasión a la zona de protección. Acusa que la inactividad material de las autoridades recurridas frente a la contaminación previamente constatada vulnera el derecho fundamental consagrado en el ordinal 50 constitucional, pues “ante una afectación ambiental comprobada no basta con abrir expedientes administrativos o emitir requerimientos formales, sino que existe un deber constitucional de adoptar medidas oportunas, eficaces proporcionales dirigidas a prevenir, detener y corregir el daño ambiental”. En consecuencia, afirma que se acude ante la Sala con la finalidad de que se ordene a las autoridades competentes adoptar las acciones necesarias para garantizar la protección efectiva del ambiente, del recurso hídrico y de la salud pública.Estima lesionados los derechos a la salud y a un ambiente sano (artículos 21 y 50 constitucionales). Solicita que se declare con lugar el recurso y medularmente que se les ordene a las autoridades recurridas atender puntualmente las referidas situaciones expuestas.
  2. 2Por resolución de las 14:26 hrs. de 22 de julio de 2026, se le da curso al proceso y se requieren los informes a las autoridades recurridas.
  3. 3Mediante memorial aportado a la Sala el 29 de julio de 2026, Zeneida Chaves Fernández, en su condición de Alcaldesa, José Pablo Suárez Sánchez, en su condición de Director de Servicios Públicos y Juan Pablo Artavia Jiménez, en su condición de Coordinador del Alcantarillado Sanitario, todos de la Municipalidad de Belén, rinden informe y señalan expresamente lo siguiente: “(…) PRIMERO: El día 05 de marzo del 2026, a la Municipalidad ingresó el trámite N. 738-2026, donde se presenta una queja por el desarrollo de una construcción, sin el permiso municipal correspondiente. El trámite fue remitido a varias unidades técnicas, entre ellas Alcantarillado Sanitario y PTARs, para la emisión de un criterio individualizado con respecto a la situación. En el caso específico de tal Unidad, el problema por atender correspondió a lo indicado literalmente: “Otra situación muy delicada que está ocurriendo en dicha propiedad es que están vertiendo aguas sanitarias, aguas de cocina y demás aguas residuales provenientes de las tres o cuatro casas que se encuentran en el lugar, directamente al río.” SEGUNDO: Al día siguiente (6 de marzo del 2026), se hicieron presentes en el sitio los suscritos el Ing. José Pablo Suárez Sánchez y Juan Pablo Artavia Jiménez, en su nuestro rol institucional antes referido, con el propósito de recabar información sobre la situación reportada.Durante la inspección se realizaron pruebas de coloración en la propiedad para determinar si las aguas vertidas al río correspondían a aguas residuales. Como resultado de dichas pruebas, se confirmó que efectivamente se trataba de aguas residuales, provenientes de un rebalse desde el tanque séptico existente, por lo que se les indicó a los habitantes presentes en la diligencia sobre la corrección requerida para esta problemática. TERCERO: A la semana siguiente (10 de marzo del 2026), ingresó formalmente a la Unidad de Alcantarillado Sanitario el trámite N. 790-2026, a nombre de la recurrente. En atención a este, el 13 de marzo del 2026 el Ing. Juan Carlos Chaves Artavia en su condición de Analista de Alcantarillado Sanitario realizó una nueva inspección en conjunto con la gestora ambiental Victoria Leiva Pereira, del Área Rectora de Salud Belén-Flores, del Ministerio de Salud. Durante la visita se constató que no se habían implementado medidas correctivas en el sistema.En consecuencia, se indicó a los habitantes sobre la afectación que esta situación estaba ocasionando al ambiente y a la salud pública, ya que, además de contaminar el cauce del río, favorece la proliferación de mosquitos y otros vectores. CUARTO: En el mismo mes a saber el 23 de marzo del 2026, se notificó a la propietaria del inmueble donde se detectaron las infracciones sanitarias, señora Olga Marta del Socorro Chaves Zumbado, cédula de identidad 4-0131-0386, la resolución DSP-ALS-R-003-2026, mediante la cual la Unidad de Alcantarillado Sanitario y PTARs requirió la implementación de mejoras al sistema existente, incluyendo adecuaciones al tanque séptico y la construcción de zanjas de infiltración, todo ello bajo la responsabilidad de un profesional competente en la materia. Para tales efectos, la propietaria designó al ingeniero civil Jeffrey Zumbado Vargas, profesional que cuenta con la experiencia y los conocimientos necesarios para desarrollar las modificaciones requeridas.Asimismo, la Unidad de Alcantarillado Sanitario y PTARs verificó que el Ing. Zumbado Vargas se encontrara debidamente incorporado y habilitado ante el Colegio Federado de Ingenieros y de Arquitectos de Costa Rica (CFIA), comprobándose que efectivamente cuenta con habilitación profesional vigente bajo el carné IC-11914. En este caso, esta Unidad no estableció un plazo específico para la solución, dado que la señora [Nombre 001], aquí recurrente ya había remitido la situación a la Unidad de Desarrollo Urbano y Control Constructivo, el cual es el reparto administrativo competente para realizar las inspecciones relacionadas con materia constructiva. QUINTO: Siempre dentro del mes de marzo de 2026, el día 23, se dio respuesta a la recurrente mediante el oficio DSP-ALS-O-034-2026, lo relacionado tanto con el trámite N° 738-2026 como con el trámite N° 790-2026, indicándole que la propietaria del inmueble denunciada ya había sido notificada mediante la resolución DSP-ALSR-003-2026 y que, en caso de incumplimiento de las medidas ordenadas, el asunto sería remitido al Ministerio de Salud, institución que ya tenía conocimiento de la situación a raíz de la inspección realizada el 10 de marzo del 2026.SEXTO: Adicionalmente, vía telefónica el Ing. Chaves Artavia en la condición dicha le informó a la recurrente que una vez aprobado el diseño de las mejoras al sistema de tratamiento se le comunicaría oportunamente, tal como ocurrió posteriormente. SETIMO: El 8 de abril del 2026, el Ing. Jeffrey Zumbado responsable de la obra remitió una propuesta de diseño para las mejoras al sistema de tratamiento de aguas residuales. No obstante, dicho diseño no fue aprobado en esa oportunidad, debido a que requería ajustes técnicos relacionados con los parámetros de diseño utilizados. Mediante intercambio de correos electrónicos con el profesional responsable, se indicaron las observaciones y correcciones necesarias para su adecuación. OCTAVO: Que la Unidad de Alcantarillado Sanitario y PTARs tiene la responsabilidad de verificar detalladamente la información técnica aportada por el profesional, con el fin de garantizar que el sistema de tratamiento propuesto tenga la capacidad suficiente para atender adecuadamente la carga generada por la población servida, la cual, según la información suministrada por el profesional responsable, corresponde a siete personas.NOVENO: Oportunamente el Ing. Chaves Artavia, le informó vía telefónica a la recurrente que la Unidad de Alcantarillado Sanitario y PTARs no puede modificar unilateralmente los datos de partida utilizados en el diseño, por parte del profesional, ya que la exactitud de dicha información recae bajo la responsabilidad profesional del profesional que realiza el diseño, quien responde técnicamente por los criterios y parámetros empleados en la elaboración de la propuesta. DECIMO: El día 14 de mayo del 2026, una vez atendidas las observaciones técnicas planteadas y realizadas las correcciones requeridas, se aprobó finalmente la propuesta de diseño mediante el oficio DSP-ALS-O-055-2026, el cual fue debidamente notificado a la propietaria. DECIMO PRIMERO: Durante la última semana de junio del 2026, se tuvo una conversación telefónica con la denunciante donde manifestó su preocupación por la aprobación otorgada.No obstante, es importante señalar que la aprobación del diseño respondió a la verificación técnica de que la propuesta cumplía con los requerimientos establecidos por esta Unidad. De no haberse alcanzado dicho cumplimiento, el proceso habría requerido nuevas revisiones y correcciones, lo que inevitablemente habría prolongado aún más la solución de la problemática denunciada. Precisamente por esta razón, la propuesta fue objeto de una revisión exhaustiva y de múltiples solicitudes de ajuste antes de emitir la aprobación correspondiente. DECIMO SEGUNDO: Asimismo, se indicó al Ing. Zumbado antes mencionado que, para la etapa constructiva de las obras contempladas en el diseño aprobado, debía coordinar lo pertinente con la Unidad de Desarrollo Urbano y Control Constructivo, de la Municipalidad de Belén, reparto administrativo competente en la materia y que la misma fue incluida en las comunicaciones respectivas.DECIMO TERCERO: El 3 de julio del 2026, personal de la Unidad de Alcantarillado Sanitario y PTARs realizó una nueva inspección en la propiedad denunciada, en conjunto con la gestora ambiental Victoria Leiva Pereira, del Área Rectora de Salud Belén-Flores, del Ministerio de Salud. Durante la visita se constató que aún no se habían ejecutado las obras requeridas para subsanar la situación sanitaria identificada. En consecuencia, la indicara gestora ambiental emitió tres órdenes sanitarias dirigidas a las vinculadas con el inmueble, debido a que se ubican tres viviendas independientes, cada una con incumplimientos que requerían ser atendidos. DECIMO CUARTO: Una vez otorgado el Permiso de Construcción N 60-2026 emitido por la Unidad de Desarrollo Urbano y Control Constructivo, de la Municipalidad de Belén referido al diseño previamente aprobado el 21 de julio del 2026 se solicitó al Ing. Jeffrey Zumbado, en la condición dicha la realización de una inspección técnica con el propósito de verificar que las obras ejecutadas, autorizadas bajo.Como resultado de dicha gestión, la visita fue programada para el 28 de julio del 2026, a las 11:00 a. m., con la participación del Ing. Juan Carlos Chaves, en representación de la Unidad de Alcantarillado Sanitario y PTARs, y del señor Concepción Fonseca Torruno, inspector de Construcción en representación de la Unidad de Desarrollo Urbano y Control Constructivo. En esta inspección, se realizarán pruebas de coloración con fluoresceína sódica, para verificar el cumplimiento de las acciones correctivas sanitarias solicitadas. DECIMO QUINTO: El 28 de julio de 2026, a la hora previamente acordada, se realizó la inspección en la propiedad denunciada con el objetivo de efectuar pruebas de coloración en las viviendas involucradas, a fin de verificar si la problemática relacionada con la gestión de las aguas residuales (negras y grises) había sido corregida mediante las obras ejecutadas. El Ing. Jeffrey Zumbado Vargas, informó que las obras correspondientes a las zanjas de infiltración habían sido concluidas, por lo que procedía verificar en sitio la efectividad de las medidas implementadas.La inspección de la Unidad de Alcantarillado Sanitario y PTARs, efectuada por el Ing. Juan Carlos Chaves Artavia y Juan Pablo Artavia Jiménez, se realizó de manera conjunta con el señor Concepción Fonseca Torruno, inspector de construcción de la Unidad de Desarrollo Urbano y Control Constructivo, en el ámbito de sus competencias relacionadas con el permiso de construcción N. 060-2026. Asimismo, estuvieron presentes el Ing. Jeffrey Zumbado Vargas y el señor Luis Humberto Guzmán Chaves, en su condición de habitante de la propiedad inspeccionada. Como parte de la evidencia aportada durante la inspección, el señor Luis Humberto Guzmán Chaves presentó un registro fotográfico de la construcción de las zanjas de infiltración y de la eliminación de la tubería que anteriormente funcionaba como rebalse para la descarga de aguas residuales desde el tanque séptico hacia el río Bermúdez, aspectos que fueron objeto de verificación durante la inspección realizada.Se realizaron las pruebas de coloración en las descargas de aguas residuales (negras y grises) correspondientes a las dos primeras viviendas inspeccionadas. En cuanto a la tercera vivienda, no fue posible efectuar la inspección debido a la ausencia de personas que permitieran el ingreso al inmueble. Debido a lo anterior, se acordó que la inspección de dicha vivienda se realizará de manera conjunta con el Ministerio de Salud, una vez vencido el plazo otorgado mediante las Órdenes Sanitarias emitidas por esa institución, con el fin de verificar el cumplimiento de las medidas correctivas correspondientes. En cuanto a los resultados de las pruebas de coloración, se comprobó que tanto las aguas residuales grises como las aguas residuales negras, generadas en las dos viviendas inspeccionadas, son conducidas al sistema de tratamiento existente. En consecuencia, no se evidenció la existencia de descargas de aguas residuales hacia el río Bermúdez, por lo que se concluye que el vertido previamente identificado fue eliminado mediante las obras correctivas ejecutadas.Siendo el curso de las circunstancias consideramos que esta administración ha actuado con razonabilidad, oportunidad y apego al bloque de legalidad, sobre todo de manera célere y que a la fecha no existe vulneración, al derecho fundamental de la munícipe [Nombre 001]. A la fecha sus gestiones han sido atendidas por la Dirección de Servicios Públicos y la Unidad de Alcantarillado Sanitario y PTARs. Reiteramos nuestro compromiso con la protección de la salud pública y del ambiente, así como con la búsqueda de una solución efectiva a la situación denunciada. Consideramos que la presente gestión de amparo resulta prematura, toda vez que el plazo de dos meses establecido jurisprudencialmente para determinar la existencia de mora administrativa no transcurrió en el presente caso, dado que se atendió oportunamente, por lo que debería declararse sin lugar la gestión de amparo (…)”.
  4. 4Por escrito aportado a la Sala el 29 de julio de 2026, Gustavo Espinoza Chaves, en su condición de Director del Área Rectora de Salud de Belén-Flores del Ministerio de Salud, rinde informe y señala expresamente lo siguiente: “(…) 1. El día 25 de junio de 2026, ingresó al Área Rectora de Salud Belén-Flores denuncia sanitaria presentada por la Sra. [Nombre 001], consignada en el trámite 081-2026 contra un vecino de su propiedad en San Antonio de Belén, 150 metros este colindando con la Barbería Fran y en que expuso: “Desde el 06 de marzo presenté una denuncia ante la Municipalidad de Belén, específicamente ante la Unidad de Alcantarillado Sanitario y otros departamentos, debido a una situación que se presenta en la finca colindante con la mía. En ese momento, no se tomaron cartas en el asunto, y tengo conocimiento de que el Ministerio de Salud realizó, de forma conjunta, una inspección con dicha unidad.Sin embargo, hasta el día de hoy no he recibido respuesta alguna, por lo cual manifiesto mi disconformidad con la situación. Lamentablemente el problema se ha agravado, ya que no solo continúan arrojando aguas negras al río, sino que también las vierten sobre la tierra… adjunta nota enviada el 6 de marzo de 2026 a la Municipalidad”. Asimismo, revisados los archivos y el expediente administrativo, no consta que la autoridad de salud haya realizado inspecciones formales relacionadas con los hechos denunciados con anterioridad a la denuncia presentada el 25 de junio del presente año. El 29 de junio de 2026, la Sra [Nombre 001], envió información a la Contraloría de Servicios del Ministerio de Salud, sobre la denuncia interpuesta en el área rectora de salud. Debe precisarse que la gestión presentada el 06 de marzo de 2026 fue dirigida exclusivamente a la Municipalidad de Belén, mientras que la primera denuncia formal presentada ante el Ministerio de Salud ingresó hasta el 25 de junio de 2026.(folios 1-29). 2. El 01 de julio de 2026, se le solicitó a la Municipalidad de Belén información sobre los permisos de construcción y sobre la denuncia presentada por la Sra. [Nombre 001] ante esa instancia. En seguimiento al caso, el día 03 de julio del 2026, la Licda. Victoria Leiva Pereira del Área Rectora de Salud Belén Flores y el Ing. Juan Carlos Chaves Artavia de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén, realizaron visita a la propiedad denunciada y el Ing. Chaves indicó que la Unidad de Alcantarillado Sanitario de la Municipalidad había aprobado el diseño del sistema de tratamiento de aguas residuales por parte de la Unidad e indica que el Departamento Urbano ya aprobó un permiso para remodelación. 3. Durante la inspección atendió la Sra. Olga Marta Chaves Zumbado propietaria y su hijo el Sr. Luis Humberto Guzmán, quienes permitieron el ingreso, en la propiedad hay tres viviendas, en la parte posterior de la misma se observa un tanque séptico con unas láminas que sirven de tapa, además por otro lado hay una tubería en el patio donde se observaron aguas residuales.Según consta en el Informe Técnico de Inspección de Prueba de Coloración con fluoresceína sódica MS-DRRSCN-DARSBF-1988-2026 a las 9:26 a.m. se procedió a realizar pruebas de coloración en el tanque séptico y en una de las pilas de lavar dando como resultado positivo. Durante la inspección se midió la distancia desde el río hasta el patio donde se encuentra el tanque séptico y tubería de aguas servidas y se tiene una distancia de aproximadamente 15 metros. (folios 30 a 33). 4. Con órdenes sanitarias MS-DRRSCN-DARSBF-OS-041-2026, MS-DRRSCN-DARSBF-OS-042-2026 de fecha 03 de julio de 2026, se le notificó a la señora Olga Marta Chaves Zumbado y al señor Carlos Francisco Chaves Zumbado (propietarios de las viviendas) que en el plazo de 22 días hábiles debían realizar las reparaciones y obras requeridas para evitar la inadecuada disposición de aguas residuales. Los actos administrativos señalados tienen fecha de vencimiento al 04 de agosto de 2026.El plazo otorgado, fue fijado considerando la naturaleza de las obras correctivas, las cuales implican intervenciones constructivas y trabajos que no pueden ejecutarse de manera inmediata. De lo actuado por la autoridad sanitaria, se le informó a la señora [Nombre 001] vía correo electrónico. (folios 34 a 39). 5. El 10 de julio de 2026 se recibió un correo de la Sra. [Nombre 001], en que señaló que pese al tiempo transcurrido desde la denuncia inicial y las actuaciones realizadas por distintas autoridades, el asunto continua pendiente de una solución definitiva y verificable, que quisiera saber cómo van a verificar que no se está afectando la zona de protección y que los drenajes se estén construyendo de forma correcta, ya que existe una gran preocupación, ya la finca no cuenta con un plano catastrado ligado a ella, según el Registro Nacional, lo cual es un tema indispensable para realizar cálculos y diseños.Sin embargo, los trabajos continúan de forma normal, sin que se tomen medidas responsables con el medio ambiente. Solicita la notificación de prevención que se les otorgó a los propietarios con el plazo de 22 días. Adjunta copia del registro de la finca de la propiedad denunciada. (folios 40 a 42). 6. El 10 de julio de 2026 se recibió correo electrónico del Ing. David Umaña Corrales de la Municipalidad de Belén en que señaló: “La denuncia inicialmente presentada fue atendida por esta Unidad. De acuerdo con la inspección realizada, al momento de la valoración no se evidenció la ejecución de obras constructivas en el sitio denunciado; en consecuencia, se dispuso continuar con las labores de seguimiento correspondientes. Dicha situación fue comunicada oportunamente a la persona interesada por el Inspector Municipal mediante correo electrónico y, a la fecha, no se ha constatado la ejecución de obras constructivas en el lugar señalado en la denuncia.Posteriormente, mediante la plataforma APC del CFIA, se tramitó y otorgó el Permiso de Construcción # 0060-2026, de fecha 16 de junio de 2026, correspondiente a la construcción de drenajes y tanque séptico en el sitio denunciado, previa valoración de la Unidad de Alcantarillado Sanitario. Asimismo, el permiso contempla obras de reparación de una vivienda ubicada en un sector distinto al señalado en la denuncia”. Además, el mismo día ingresó un correo electrónico del del Ing. Juan Carlos Chaves de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén en que indicó: “Con respecto a la visita realizada junto con la Gestora Ambiental Victoria Leiva, me permito aportar una observación. En el momento en que la unidad de alcantarillado sanitario otorgó la aprobación para el diseño del sistema de tratamiento de aguas residuales de la propiedad denunciada, se efectuó la consulta al ingeniero Jeffrey Zumbado sobre la pendiente del terreno.Su respuesta fue que la misma sería inferior al 20%, lo cual se encuentra dentro de lo establecido por el reglamento para la disposición al subsuelo de aguas ordinarias tratadas, dado que el límite máximo permitido es del 30%. Sin embargo, en ningún momento se nos indicó que la intención era realizar un relleno en la zona destinada al desarrollo de las zanjas de infiltración. Esta situación debe ser considerada con especial atención, ya que la ejecución de rellenos en áreas de pendiente puede comprometer la correcta operación que tienen las zanjas de infiltración. Por lo anterior, de acuerdo con el criterio de la unidad de alcantarillado resulta importante realizar una adecuada estabilización del terreno antes de la construcción de las zanjas ya sea por medio de una compactación del relleno o la eventual construcción de un muro de contención u otra obra de soporte, en caso de que las condiciones geotécnicas lo requieran.De no implementarse estas medidas, existe una alta probabilidad de que se produzcan deslizamientos por erosión, lo cual pondría en riesgo la funcionalidad del sistema de infiltración y podría provocar de nuevo que se depositen las aguas residuales sin el adecuado tratamiento al río”. (folios 43 a 46). 7. El 17 de julio de 2026, se recibió un correo de la Sra. [Nombre 001] en el que indicó que necesita la notificación que le entregaron a los propietarios del inmueble, porque requiere llevar la situación a otras instancias y adjuntó una nota sin número de oficio donde señaló irregularidades en el procedimiento para otorgar los permisos constructivos, indicando que a la autoridad sanitaria le compete la valoración de tales permisos, solicitando los planos constructivos y el expediente de los permisos otorgados. (folios 47-58) 8. El lunes 20 de julio de 2026 vía correo electrónico se informó a la Sra. [Nombre 001], que en atención a su denuncia con trámite 081-2026, la cual ingresó al área rectora de salud el 25 de junio de 2026, se realizó visita de inspección y prueba de coloración el 3 de julio de 2026 (se le adjunta documento).Al tener la prueba de coloración positiva y dentro del ámbito de competencia del Ministerio de Salud se giraron los actos administrativos correspondientes (se le adjuntan los documentos). Además, se le indicó que las órdenes sanitarias aún se encuentran en plazo y se señaló que el permiso de construcción y su ubicación de los sistemas señalados es competencia de la Municipalidad y no del Ministerio de Salud. (folios 59-68) 9. El jueves 23 de julio de 2026 se recibió un correo del Ing. Juan Carlos Chaves Artavia, de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén indicando que, según lo manifestado por el profesional a cargo de los trabajos en la propiedad denunciada, estos ya se encuentran finalizados y se acordó realizar inspección el 27 de julio a las 11:00 a.m. El lunes 27 de julio de 2026 a las 8:15 a.m. se recibió correo del Ing. Juan Carlos Chaves Artavia, de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén, donde se reprogramó la visita para el martes 28 de julio de 2026.En respuesta se le informó al Ing. Chaves, que por parte del Ministerio de Salud no se consideró procedente realizar la inspección conjunta antes del vencimiento del plazo, debido a que los actos administrativos emitidos aún se encuentran dentro del plazo de cumplimiento que vence el 04 de agosto de 2026. (folios 69-77). En tal sentido, es importante reseñar que la autoridad sanitaria a partir del conocimiento de la denuncia (fue presentada a esta Área Rectora de Salud 25 de junio de 2026), realizó inspección, prueba técnica de coloración, emisión de los actos administrativos (órdenes sanitarias) y seguimiento del caso. Las actuaciones realizadas por la Municipalidad de Belén corresponden al ejercicio de competencias distintas y autónomas de las atribuidas legalmente al Ministerio de Salud. Por otra parte, en el presente caso las órdenes sanitarias giradas por la autoridad sanitaria al momento de recibir el emplazamiento de ese honorable tribunal, todavía se encuentran en plazo (vencen el 04 de agosto de 2026), por lo que al momento de rendir este informe no existe incumplimiento acreditado que justifique la adopción de medidas sancionatorias.Además, la competencia del Ministerio de Salud en este asunto se circunscribe a verificar la existencia de riesgos sanitarios derivados de la disposición de aguas residuales, así como ordenar las medidas correctivas que sean pertinentes. Asimismo, los aspectos relacionados con la emisión de permisos constructivos y aprobación de obras corresponden a la Municipalidad de Belén; sin perjuicio de las competencias del Ministerio de Salud para fiscalizar las condiciones sanitarias y ordenar las medidas correctivas que correspondan. Por ello, los cuestionamientos planteados por la amparada respecto de los permisos constructivos deben ser analizados por la autoridad municipal competente. Por lo que, de la relación cronológica de hechos se desprende que la autoridad sanitaria realizó actuaciones concretas y oportunas dentro de un plazo razonable, por lo que no existe omisión, inercia o desatención que pueda constituir lesión a derechos fundamentales de la amparada.PETITORIA Con base en los hechos expuestos, solicito a su Honorable Autoridad, se declare sin lugar el recurso de amparo respecto del Ministerio de Salud, al no existir una conducta omisiva o arbitraria o irrazonable a esta institución. Por el contrario, la autoridad sanitaria atendió oportunamente la denuncia, realizó las inspecciones, verificó los hechos denunciados y emitió las órdenes sanitarias correspondientes dentro del ámbito de sus competencias. En cuanto a los planos y permisos de construcción se indica que corresponde a la Municipalidad emitirlos, cumpliendo con los requisitos que ellos establezcan, lo cual conlleva la revisión de que se esté cumpliendo con los retiros a zonas de protección y otros aspectos (…)”.
  5. 5En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Araya García; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

La recurrente aduce que las autoridades de la Municipalidad de Belén y del Área Rectora de Salud Belén-Flores no han atendido y resuelto definitiva y contundentemente –pese a las denuncias formuladas al efecto–, una problemática ambiental y sanitaria por descarga irregular de aguas residuales y sanitarias desde una propiedad hacia un río. Medularmente acusa que los recurridos no han constatado materialmente si las medidas giradas para contrarrestar esa situación habían sido efectivas o no a la fecha de formulado el amparo.

Igualmente, acusa que no ha sido atendida la denuncia concomitantemente planteada por obras constructivas en el inmueble citado que podrían comprometer la zona de protección y generar afectaciones adicionales al recurso hídrico.

II.Cuestión Preliminar. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones–, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción –respaldado por la mayoría de este Tribunal Constitucional–, pues se está ante denuncias de carácter ambiental y sanitarias, las cuales presuntamente no ha sido resueltas dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

III. HECHOS PROBADOS

De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

Hechos relacionados con la Municipalidad de Belén:

  • 1)El 5 de marzo de 2026 la recurrente presentó una denuncia ante la Municipalidad de Belén (caso No. 738-2026), mediante la cual expuso el desarrollo de una construcción (en inmueble No. 0047893 ubicado en San Antonio de Belén de Heredia contiguo a condominio Jireth) sin el permiso municipal correspondiente y en zona de protección. Igualmente, se adujo la descarga irregular de aguas residuales y sanitarias desde esa propiedad finca (concretamente provenientes de tres o cuatro casas ubicadas en el sitio), hacia un cuerpo de agua cercano (río) (ver informe).
  • 2)Producto de esa denuncia, funcionarios municipales realizaron una inspección el 6 de marzo de 2026 y realizaron pruebas de coloración en la propiedad para determinar si las aguas vertidas al río correspondían a aguas residuales. Como resultado de dichas pruebas, se confirmó que efectivamente se trataba de aguas residuales, provenientes de un rebalse desde el tanque séptico existente, por lo que se les indicó a los habitantes presentes en la diligencia sobre la corrección requerida para esta problemática (ver informe).
  • 3)El 10 de marzo del 2026, ingresó formalmente a la Unidad de Alcantarillado Sanitario otra denuncia (trámite No. 790-2026) a nombre también de la recurrente. En atención a esta gestión, el 13 de marzo del 2026 el ingeniero analista de alcantarillado sanitario realizó una nueva inspección en el sitio en conjunto con la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud. Durante la visita se constató que no se habían implementado medidas correctivas en el sistema. En consecuencia, se indicó a los habitantes sobre la afectación que esta situación estaba ocasionando al ambiente y a la salud pública, ya que, además de contaminar el cauce del río, favorecía la proliferación de mosquitos y otros vectores (ver informe).
  • 4)El 23 de marzo del 2026, se notificó a la propietaria del inmueble donde se detectaron las infracciones sanitarias, señora Olga Marta del Socorro Chaves Zumbado, cédula de identidad 4-0131-0386, la resolución No. DSP-ALS-R-003-2026, mediante la cual la Unidad de Alcantarillado Sanitario y PTARs requirió la implementación de mejoras al sistema existente, incluyendo adecuaciones al tanque séptico y la construcción de zanjas de infiltración; todo esto bajo la responsabilidad de un profesional competente en la materia. Dicha resolución consignó expresamente lo siguiente:

“CONSIDERANDO: Que, según los resultados obtenidos en las inspecciones, la propiedad cuenta con la descarga irregular de aguas residuales al Rio Pirro. Que durante la inspección se perciben malos olores por la acumulación y degradación de las aguas residuales depositadas a la orilla del rio Pirro, que afecta la convivencia y salud pública. Que, de acuerdo con las inspecciones realizadas, la propiedad no cuenta con la conexión de las aguas residuales provenientes del tanque séptico a un sistema de tratamiento secundario como lo son zanjas de infiltración. Que, de acuerdo con el punto 3 de la consideración del Reglamento de Vertido y Reúso de Aguas Residuales N° 33601, que dice literalmente: Que la contaminación de los cuerpos de agua favorece la proliferación de enfermedades de transmisión hídrica, reduce el número de fuentes disponibles, eleva los costos para el abastecimiento de agua para consumo humano, y pone en peligro de extinción a muchas especies de nuestra flora y fauna.

Que se debe tomar en cuenta el retiro mínimo para la construcción de las zanjas de infiltración de acuerdo con la Ley Forestal Nº 7575. Que en el diseño de las zanjas de infiltración deberá considerarse la pendiente pronunciada existente en el terreno, de conformidad con el anexo 2 del Decreto Ejecutivo Nº 42075-S-MINAE, el reglamento para la disposición al subsuelo de aguas residuales ordinarias, ya que establece los requerimientos técnicos en terrenos inclinados, cuya pendiente esté entre el 1% y el 30%, ya que la distribución de zanjas debe hacerse de acuerdo lineamientos específicos. Que, de acuerdo con el Capítulo III, Artículo 11, inciso “d”, del Reglamento para la Operación y Administración del Alcantarillado Sanitario y Plantas de Tratamiento de Aguas Residuales del Cantón de Belén, el cual establece literalmente: “No se permitirá ninguna construcción sobre el área de drenaje ni ampliación de dormitorios, sala, comedor, pilas y cualquier otro aposento que impermeabilice el suelo sobre el cual se construirán los drenajes”; por lo tanto, el drenaje de infiltración debe mantenerse con una cobertura de césped, lastre fino, zacate block o adoquín permeable, para facilitar la evapotranspiración, la infiltración del agua tratada al subsuelo y el mantenimiento, limpieza y sustitución del material de filtrado.

Que, toda intervención requerida dentro de una propiedad privada le corresponde exclusivamente al propietario y no así a la Municipalidad de Belén. POR TANTO, LA UNIDAD DE ALCANTARILLADO SANITARIO DE LA MUNICIPALIDAD DE BELEN RESUELVE: Que con las razones de hecho expuestas: PRIMERO: Conceder un plazo de diez (10) días hábiles, contados a partir del día siguiente al que recibe la presente notificación, para presentar la memoria de cálculo que respalde la solución técnica del tratamiento de aguas residuales producidas por esta propiedad con el fin de asegurar que dicha solución sea acuerdo con El Decreto Ejecutivo Nº 42075-S-MINAE, el reglamento para la disposición al subsuelo de aguas residuales ordinarias. SEGUNDO: Trasladar el caso al Área Rectora de Salud Belén Flores del Ministerio de Salud para que tome las medidas sanitarias y legales que correspondan, en caso de no atender estas disposiciones en tiempo y forma. TERCERO: Informar a Olga Marta del Socorro Chaves Zumbado, cedula de identidad 4-0131-0386, de la resolución. NOTIFIQUESE” (ver informe y prueba).

  • 5)En aras de cumplir lo ordenado, la propietaria designó al ingeniero civil Jeffrey Zumbado Vargas, profesional que cuenta con la experiencia y los conocimientos necesarios para desarrollar las modificaciones requeridas. Asimismo, la Unidad de Alcantarillado Sanitario y PTARs verificó que el Ing. Zumbado Vargas se encontrara debidamente incorporado y habilitado ante el Colegio Federado de Ingenieros y de Arquitectos de Costa Rica (CFIA), comprobándose que efectivamente cuenta con habilitación profesional vigente bajo el carné IC-11914. En este caso, la Unidad de Alcantarillado Sanitario y PTARs no estableció un plazo específico para ejecutar la solución, dado que la recurrente ya había remitido la situación a la Unidad de Desarrollo Urbano y Control Constructivo, el cual “es el reparto administrativo competente para realizar las inspecciones relacionadas con materia constructiva” (ver informe).
  • 6)El 23 de marzo de 2026, se dio respuesta a la recurrente mediante el oficio No. DSP-ALS-O-034-2026, respecto al trámite No. 738-2026 y al trámite No. 790-2026, indicándosele que la propietaria del inmueble denunciada ya había sido notificada de la resolución No. DSP-ALS-R-003-2026 y que, en caso de incumplimiento de las medidas ordenadas, el asunto sería remitido al Ministerio de Salud. Específicamente, en esta ocasión se consignó lo siguiente:

“El día 05 de marzo del presente año Hemos recibido el trámite 738-2026, correspondiente a una denuncia por una presunta descarga irregular de aguas residuales al rio Bermúdez. La propiedad denunciada corresponde a la finca 0047893, inscrita bajo el folio microfilmado 1482- 495-001 ubicado en el distrito San Antonio, del cantón de Belén en la provincia de Heredia, dicha propiedad actualmente cuenta con tres viviendas y el derecho de esta le pertenece a Olga Marta del Socorro Chaves Zumbado, cédula de identidad 4-0131-0386. El día 06 de marzo del presente año se hicieron presentes a la propiedad denunciada los ingenieros José Pablo Suárez Sánchez y Juan Pablo Artavia Jiménez donde se hicieron pruebas de coloración con fluoresceína sódica para determinar si las aguas que estaban siendo depositadas al rio Bermúdez eran las mismas que venían del tanque séptico. Como resultado de las pruebas se determina que efectivamente estas aguas residuales provenientes del tanque séptico no cuentan con un sistema de tratamiento secundario como lo son las zanjas de infiltración (…) El día 10 de marzo del año 2026 se recibió nuevamente la denuncia, esta vez bajo el trámite 790- 2026.

En consecuencia, el 13 de marzo del presente año se efectuó una segunda inspección, con la participación del Ingeniero Juan Carlos Chaves Artavia, representante de la Municipalidad, y de la Gestora Ambiental Victoria Leiva Pereira, del Área Rectora de Salud Belén-Flores. En dicha inspección se constató que no existe ningún avance en la construcción de las zanjas de infiltración. Ante esta situación, se notificó a la propiedad mediante la resolución DSP-ALS-R-003-2026, otorgándose un plazo de diez días hábiles, contados a partir del día siguiente al 23 de marzo del presente año, para que se presente la memoria de cálculo que respalde la solución técnica a la problemática generada por el vertido irregular de aguas residuales. Lo anterior con el fin de garantizar que las obras a ejecutar cuenten con el debido respaldo técnico y se ajusten a la normativa vigente en Costa Rica, en particular al Decreto Ejecutivo Nº 42075-S-MINAE Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas (…) Una vez vencido el plazo otorgado para la entrega de la memoria de cálculo solicitada, esta Unidad de Alcantarillado procederá con la revisión del mismo y en caso de ser aprobado se concederá un nuevo plazo destinado a la construcción de la obra propuesta y aprobada.

Durante dicho período se llevarán a cabo las inspecciones técnicas pertinentes, con el objetivo de verificar que las soluciones planteadas en la memoria de cálculo y aprobadas por esta unidad se materialicen de manera fiel en la ejecución de la obra. Estas inspecciones tendrán como propósito garantizar que las medidas constructivas se ajusten a lo autorizado, que se cumplan los parámetros técnicos establecidos y que se respeten las disposiciones normativas vigentes en materia de disposición de aguas residuales, particularmente lo estipulado en el Decreto Ejecutivo Nº 42075-S-MINAE. De esta forma, se asegura que la infraestructura desarrollada responda a criterios de seguridad, funcionalidad y sostenibilidad, evitando riesgos de contaminación ambiental y asegurando la protección de los recursos hídricos y del bienestar de la comunidad. Se indica la siguiente consideración: - Se trasladará el caso al Área Rectora de Salud Belén Flores del Ministerio de Salud para que tome las medidas sanitarias y legales que correspondan, en caso de que la propiedad denunciada no atienda estas disposiciones en tiempo y forma” (ver informe y prueba).

  • 7)Adicionalmente, vía telefónica, el ingeniero analista de alcantarillado sanitario le informó a la recurrente que, una vez aprobado el diseño de las mejoras al sistema de tratamiento, se le comunicaría oportunamente (ver informe).
  • 8)El 8 de abril del 2026, el Ing. Jeffrey Zumbado (responsable de la obra) remitió una propuesta de diseño al municipio para las mejoras al sistema de tratamiento de aguas residuales. Dicho diseño no fue aprobado en esa oportunidad, debido a que requería ajustes técnicos relacionados con los parámetros utilizados. Mediante intercambio de correos electrónicos con el profesional responsable, se indicaron las observaciones y correcciones necesarias para su adecuación (ver informe).
  • 9)En fecha no precisa, el ingeniero analista de alcantarillado sanitario le informó vía telefónica a la recurrente que la Unidad de Alcantarillado Sanitario y PTARs no podía modificar unilateralmente los datos de partida utilizados en el diseño por parte del profesional, ya que “la exactitud de dicha información recae bajo la responsabilidad profesional del profesional que realiza el diseño, quien responde técnicamente por los criterios y parámetros empleados en la elaboración de la propuesta” (ver informe).
  • 10)El día 14 de mayo del 2026, una vez atendidas las observaciones técnicas planteadas y realizadas las correcciones requeridas, se aprobó finalmente la propuesta de diseño de zanjas de infiltración o drenaje a realizarse en el inmueble denunciado mediante el oficio No. DSP-ALS-O-055-2026, el cual fue debidamente notificado a la propietaria el 18 de mayo de 2026. Dicha propuesta fue objeto de una revisión exhaustiva y de múltiples solicitudes de ajuste antes de emitirse la aprobación correspondiente (ver informe y prueba).
  • 11)Durante la última semana de junio del 2026, las autoridades municipales tuvieron una conversación telefónica con la denunciante, quien manifestó su preocupación por la aprobación otorgada al diseño de zanjas de infiltración o drenaje. No obstante, según informe, “la aprobación del diseño respondió a la verificación técnica de que la propuesta cumplía con los requerimientos establecidos por esta Unidad. De no haberse alcanzado dicho cumplimiento, el proceso habría requerido nuevas revisiones y correcciones, lo que inevitablemente habría prolongado aún más la solución de la problemática denunciada” (ver informe).
  • 12)En fecha no precisa, se le indicó al Ing. Zumbado (contratado por la denunciada) que, para la etapa constructiva de las obras contempladas en el diseño aprobado, debía coordinar lo pertinente con la Unidad de Desarrollo Urbano y Control Constructivo de la Municipalidad de Belén; reparto administrativo competente en la materia, la que, además, fue incluida en las comunicaciones respectivas (ver informe).
  • 13)El 3 de julio del 2026, personal de la Unidad de Alcantarillado Sanitario y PTARs realizaron una nueva inspección en la propiedad denunciada, en conjunto con la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud. Durante la visita se constató que aún no se habían ejecutado las obras requeridas para subsanar la situación sanitaria identificada. En consecuencia, la indicada gestora ambiental del ministerio recurrido emitió tres órdenes sanitarias dirigidas a las vinculadas con el inmueble, debido a que se ubicaron tres viviendas independientes, cada una con incumplimientos que requerían ser atendidos (ver informe).
  • 14)El 14 de julio de 2026, la recurrente formuló el presente amparo (ver escrito de interposición).
  • 15)Los días 21 y 23 de julio del 2026 el ingeniero municipal analista de alcantarillado sanitario le solicitó al ingeniero Jeffrey Zumbado la realización de una inspección técnica con el propósito de verificar las obras ejecutadas. El Ing. Jeffrey Zumbado Vargas informó que las obras correspondientes a las zanjas de infiltración habían sido concluidas, por lo que procedía verificar en sitio la efectividad de las medidas implementadas. Dicha visita fue originalmente programada para el 27 de julio de 2026 y luego se reprogramó finalmente para el 28 de julio de 2026 (ver informe y prueba).
  • 16)La programación de esta última inspección se llevó a cabo antes de 24 de julio de 2026 (ver prueba).
  • 17)El 24 de julio de 2026, las autoridades municipales recurridas fueron notificadas de la interposición de este amparo (ver actas de notificación).
  • 18)El 28 de julio de 2026 se realizó la inspección en la propiedad denunciada con el objetivo de efectuar pruebas de coloración en las viviendas involucradas y a fin de verificar si la problemática relacionada con la gestión de las aguas residuales (negras y grises) había sido corregida mediante las obras ejecutadas (ver informe y prueba).
  • 19)Esta última inspección de la Unidad de Alcantarillado Sanitario y PTARs se realizó de manera conjunta con el inspector de construcción de la Unidad de Desarrollo Urbano y Control Constructivo, en el ámbito de sus competencias relacionadas con el permiso de construcción N. 060-2026. Asimismo, estuvieron presentes el Ing. Jeffrey Zumbado Vargas y el señor Luis Humberto Guzmán Chaves, en su condición de habitante de la propiedad inspeccionada. Como parte de la evidencia aportada durante la inspección, el señor Luis Humberto Guzmán Chaves presentó un registro fotográfico de la construcción de las zanjas de infiltración y de la eliminación de la tubería que anteriormente funcionaba como rebalse para la descarga de aguas residuales desde el tanque séptico hacia el río Bermúdez, aspectos que fueron objeto de verificación durante la inspección realizada. Se realizaron las pruebas de coloración en las descargas de aguas residuales (negras y grises) correspondientes a las dos primeras viviendas inspeccionadas. En cuanto a la tercera vivienda, no fue posible efectuar la inspección debido a la ausencia de personas que permitieran el ingreso al inmueble. Debido a lo anterior, se acordó que la inspección de dicha vivienda se realizará de manera conjunta con el Ministerio de Salud, una vez vencido el plazo otorgado mediante las órdenes sanitarias emitidas por esa institución, con el fin de verificar el cumplimiento de las medidas correctivas correspondientes (ver informe y prueba).
  • 20)Según informe rendido, “en cuanto a los resultados de las pruebas de coloración, se comprobó que tanto las aguas residuales grises como las aguas residuales negras, generadas en las dos viviendas inspeccionadas, son conducidas al sistema de tratamiento existente”. En consecuencia, se dijo que “no se evidenció la existencia de descargas de aguas residuales hacia el río Bermúdez, por lo que se concluye que el vertido previamente identificado fue eliminado mediante las obras correctivas ejecutadas” (ver informe y prueba).

Hechos relacionados con el Área Rectora de Salud Belén-Flores del Ministerio de Salud:

  • 1)El 25 de junio de 2026, la recurrente presentó ante el Área Rectora de Salud Belén-Flores denuncia sanitaria (trámite No. 081-2026). En esta ocasión la tutelada señaló expresamente lo siguiente: “Desde el 06 de marzo presenté una denuncia ante la Municipalidad de Belén, específicamente ante la Unidad de Alcantarillado Sanitario y otros departamentos, debido a una situación que se presenta en la finca colindante con la mía. En ese momento, no se tomaron cartas en el asunto, y tengo conocimiento de que el Ministerio de Salud realizó, de forma conjunta, una inspección con dicha unidad. Sin embargo, hasta el día de hoy no he recibido respuesta alguna, por lo cual manifiesto mi disconformidad con la situación. Lamentablemente el problema se ha agravado, ya que no solo continúan arrojando aguas negras al río, sino que también las vierten sobre la tierra”. Adjuntó la recurrente nota enviada el 6 de marzo de 2026 a la Municipalidad y fotografías del sitio denunciado. Adicionalmente, señaló el siguiente medio para recibir notificaciones: [email protected] (ver informe y prueba).
  • 2)El 1° de julio de 2026, la gestora ambiental del Área Rectora de Salud recurrida le solicitó a la Municipalidad de Belén información sobre los permisos de construcción y sobre la denuncia presentada por la recurrente ante esa instancia (ver informe y prueba).
  • 3)El 3 de julio del 2026, una funcionaria del Área Rectora de Salud Belén Flores y el ingeniero de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén, realizaron visita a la propiedad denunciada. En tal ocasión el referido funcionario municipal indicó que la Unidad de Alcantarillado Sanitario de la municipalidad había aprobado el diseño del sistema de tratamiento de aguas residuales y señaló que el Departamento Urbano ya había aprobado un permiso para remodelación (ver informe).
  • 4)Durante la inspección realizada el citado día 3 de julio de 2026, los recurridos fueron atendidos por la señora Olga Marta Chaves Zumbado propietaria y su hijo el Sr. Luis Humberto Guzmán, quienes permitieron el ingreso. En la propiedad se hallaron tres viviendas, en la parte posterior de la misma se observó un tanque séptico con unas láminas que sirven de tapa, además por otro lado se halló una tubería en el patio donde se observaron aguas residuales. Según consta en el Informe Técnico de Inspección de Prueba de Coloración con fluoresceína sódica No. MS-DRRSCN-DARSBF-1988-2026, a las 9:26 a.m. se procedió a realizar pruebas de coloración en el tanque séptico y en una de las pilas de lavar dando como resultado positivo. Durante la inspección se midió la distancia desde el río hasta el patio donde se encuentra el tanque séptico y tubería de aguas servidas y se consignó una distancia de aproximadamente quince metros. También se indicó que las aguas discurren hacia la zona de protección del Río Pirro y a su corriente propiamente (ver informe y prueba).
  • 5)El 3 de julio de 2026, el Ministerio de Salud emitió las órdenes sanitarias No. MS-DRRSCN-DARSBF-OS-041-2026 y No. MS-DRRSCN-DARSBF-OS-042-2026 y se le notificaron respectivamente a la señora Olga Marta Chaves Zumbado y al señor Carlos Francisco Chaves Zumbado (propietarios de las viviendas), indicándosele que, en el plazo de veintidós días hábiles, debían realizar las reparaciones y obras requeridas para evitar la inadecuada disposición de aguas negras y servidas y su vertido en la zona de protección del Río Pirro. Los actos administrativos señalados tienen fecha de vencimiento el 4 de agosto de 2026. Concretamente, se les solicitó instalar un sistema adecuado de recolección, conducción y tratamiento de las aguas residuales. Según informe, “el plazo otorgado, fue fijado considerando la naturaleza de las obras correctivas, las cuales implican intervenciones constructivas y trabajos que no pueden ejecutarse de manera inmediata”. (ver informe y prueba).
  • 6)De lo actuado por la autoridad sanitaria, se le informó a la recurrente vía correo electrónico el día 6 de julio de 2026. Este día, vía correo electrónico, se le indicó expresamente lo siguiente: “Se le informa que la denuncia con número de trámite 081-2026 se encuentra en atención, se realizó visita en la propiedad denunciada y se giró el acto administrativo correspondiente, con un plazo de 22 días hábiles. La denuncia se encuentra en atención” (ver informe y prueba).
  • 7)El 10 de julio de 2026 la recurrente remitió un correo al Área Rectora de Salud recurrida, mediante el cual señaló que, pese al tiempo transcurrido desde la denuncia inicial y las actuaciones realizadas por distintas autoridades, el asunto continuaba pendiente de una solución definitiva y verificable. Además, señaló que quería saber cómo se verificaría que no se estaba afectando la zona de protección y que los drenajes se estaban construyen de forma correcta. Igualmente, expresó preocupación, al indicar que la finca no cuenta con un plano catastrado ligado a esta, según el Registro Nacional, lo cual es un tema indispensable para realizar cálculos y diseños. Afirmó que, pese a esto, los trabajos continuaban de forma normal, sin que se tomaran medidas responsables con el medio ambiente. Solicitó también la notificación de prevención que se les otorgó a los propietarios con el plazo de veintidós días y adjuntó copia del registro de la finca de la propiedad denunciada (ver informe y prueba).
  • 8)El 10 de julio de 2026, el Área Rectora de Salud recurrida recibió correo electrónico del Ing. David Umaña Corrales de la Municipalidad de Belén en que señaló: “La denuncia inicialmente presentada fue atendida por esta Unidad. De acuerdo con la inspección realizada, al momento de la valoración no se evidenció la ejecución de obras constructivas en el sitio denunciado; en consecuencia, se dispuso continuar con las labores de seguimiento correspondientes. Dicha situación fue comunicada oportunamente a la persona interesada por el Inspector Municipal mediante correo electrónico y, a la fecha, no se ha constatado la ejecución de obras constructivas en el lugar señalado en la denuncia. Posteriormente, mediante la plataforma APC del CFIA, se tramitó y otorgó el Permiso de Construcción # 0060-2026, de fecha 16 de junio de 2026, correspondiente a la construcción de drenajes y tanque séptico en el sitio denunciado, previa valoración de la Unidad de Alcantarillado Sanitario. Asimismo, el permiso contempla obras de reparación de una vivienda ubicada en un sector distinto al señalado en la denuncia”. Además, el mismo día ingresó un correo electrónico del del Ing. Juan Carlos Chaves de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén, mediante al cual indicó: “Con respecto a la visita realizada junto con la Gestora Ambiental Victoria Leiva, me permito aportar una observación. En el momento en que la unidad de alcantarillado sanitario otorgó la aprobación para el diseño del sistema de tratamiento de aguas residuales de la propiedad denunciada, se efectuó la consulta al ingeniero Jeffrey Zumbado sobre la pendiente del terreno. Su respuesta fue que la misma sería inferior al 20%, lo cual se encuentra dentro de lo establecido por el reglamento para la disposición al subsuelo de aguas ordinarias tratadas, dado que el límite máximo permitido es del 30%. Sin embargo, en ningún momento se nos indicó que la intención era realizar un relleno en la zona destinada al desarrollo de las zanjas de infiltración. Esta situación debe ser considerada con especial atención, ya que la ejecución de rellenos en áreas de pendiente puede comprometer la correcta operación que tienen las zanjas de infiltración. Por lo anterior, de acuerdo con el criterio de la unidad de alcantarillado resulta importante realizar una adecuada estabilización del terreno antes de la construcción de las zanjas ya sea por medio de una compactación del relleno o la eventual construcción de un muro de contención u otra obra de soporte, en caso de que las condiciones geotécnicas lo requieran. De no implementarse estas medidas, existe una alta probabilidad de que se produzcan deslizamientos por erosión, lo cual pondría en riesgo la funcionalidad del sistema de infiltración y podría provocar de nuevo que se depositen las aguas residuales sin el adecuado tratamiento al río” (ver informe y prueba).
  • 9)El 17 de julio de 2026, la recurrente remitió a la citada instancia de salud un correo, mediante el cual indicó que necesitaba la notificación que le entregaron a los propietarios del inmueble (pues requería acudir a otras instancias) y adjuntó una nota sin número de oficio donde señaló irregularidades en el procedimiento para otorgar los permisos constructivos, indicando que a la autoridad sanitaria le competía la valoración de estos últimos. Además, solicitó los planos constructivos y el expediente de los permisos otorgados (ver informe y prueba).
  • 10)El 20 de julio de 2026, vía correo electrónico, se informó a la recurrente, respecto a su denuncia (trámite 081-2026), que se realizó visita de inspección y prueba de coloración el 3 de julio de 2026. Se le aclaró que, al tener la prueba de coloración positiva, se giraron los actos administrativos correspondientes (se le adjuntaron los documentos). Además, se le indicó que las órdenes sanitarias aún se encontraban en plazo y se señaló que el permiso de construcción y la ubicación de los sistemas señalados era competencia de la Municipalidad y no del Ministerio de Salud (ver informe y prueba).
  • 11)El 23 de julio de 2026 el Área Rectora de Salud Belén-Flores recibió un correo del Ingeniero de la Unidad de Alcantarillado Sanitario de la Municipalidad de Belén indicando que, según lo manifestado por el profesional a cargo de los trabajos en la propiedad denunciada, estos ya se encontraban finalizados, por lo que se había acordado realizar inspección el 27 de julio a las 11:00 a.m. y se consultó sobre disponibilidad para brindar acompañamiento (ver informe y prueba).
  • 12)El 24 de julio de 2026, el Director del Área Rectora de Salud Belén-Flores fue notificado de la interposición de este amparo (ver actas de notificación).
  • 13)El lunes 27 de julio de 2026 a las 8:15 a.m. se recibió correo del citado funcionario municipal indicando que la inspección se reprogramó para el martes 28 de julio de 2026. En respuesta se le informó al ingeniero que, por parte del Ministerio de Salud, no se consideraba procedente realizar la inspección conjunta antes del vencimiento del plazo, debido a que los actos administrativos emitidos aún se encontraban dentro del plazo de cumplimiento (cuyo vencimiento era el 4 de agosto de 2026) (ver informe).

IV. HECHO NO PROBADO

De relevancia para dirimir el presente recurso de amparo, se tiene por indemostrado el siguiente: Único.- Que las autoridades municipales recurridas hayan atendido la denuncia formulada por la recurrente relacionada con las obras constructivas y la presunta invasión a la zona de protección ambiental (los autos).

V. CASO CONCRETO

La recurrente acude a esta Sala y señala que denunció un problema ambiental y sanitario ante la Municipalidad de Belén y ante el Área Rectora de Salud Belén-Flores, el cual, a la fecha, según aduce, no ha sido atendido definitivamente.

Explica, en primer término, que en la finca No. 0047893 ubicada en San Antonio de Belén se produce una descarga irregular de aguas residuales y sanitarias en un cuerpo de agua cercano (río) generando con esto malos olores, contaminación ambiental y riesgo para la salud pública.

Alega que, si bien se han realizado diversas actuaciones, estas no acreditan por sí mismas que la descarga irregular de aguas residuales haya cesado ni que el recurso hídrico involucrado cuente actualmente con una protección efectiva.

Sostiene que la aprobación posterior de un diseño de zanjas de infiltración constituye únicamente una valoración documental de una alternativa técnica propuesta, pero no equivale a una constatación de que dicha solución haya sido ejecutada correctamente, ni de que la contaminación previamente comprobada haya cesado. Por ello, en su criterio, resulta indispensable una verificación material en sitio que permita determinar que la problemática ambiental denunciada fue efectivamente corregida.

De otra parte, menciona que, desde la denuncia inicial presentada, también se puso en conocimiento de la administración la existencia de posibles obras constructivas dentro de la propiedad denunciada, ubicada en una zona cercana al Río Bermúdez, respecto de la cual podían existir restricciones ambientales aplicables, relacionadas con la protección del recurso hídrico. Asimismo, se denunció la necesidad de verificar si las obras, movimientos de tierra, construcción de sistemas de tratamiento de aguas residuales y demás intervenciones realizadas en la propiedad respetaban los retiros y alineamientos aplicables conforme a la normativa ambiental vigente.

Afirma, entonces, que corresponde verificar no solamente la solución sanitaria propuesta, sino también que cualquier intervención realizada no comprometa una zona de protección ni genere afectaciones adicionales al recurso hídrico.

Solicita que se declare con lugar el recurso y medularmente que se les ordene a las autoridades recurridas atender puntualmente las referidas situaciones expuestas.

Ahora bien, revisados los argumentos expuestos por la parte accionante, los informes rendidos por las autoridades recurridas –con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional–, así como todas las pruebas aportadas a los autos, este Tribunal Constitucional considera que este proceso de amparo debe ser acogido parcialmente. Esto, por los motivos que se indicarán a continuación.

A. En cuanto a la Municipalidad de Belén y la denuncia por descarga irregular de aguas residuales y sanitarias al río, el amparo se debe desestimar:

Primero, por cuanto se ha demostrado que, desde el momento en que este aspecto fue denunciado, fue diligentemente abordado y atendido por las autoridades municipales. Una lectura exhaustiva realizada al elenco de hechos probados consignado en esta sentencia permite tener plenamente por acreditado dicha afirmación. Nótese que la denuncia en cuestión fue interpuesta el 5 de marzo de 2026 y el día siguiente las autoridades de la Municipalidad de Belén realizaron una inspección y pruebas de coloración en el inmueble en cuestión que confirmaron los hechos acusados y conllevaron al giro de instrucciones a los denunciados para corregir dicha problemática. También, consta que, pocos días después, sea, el 13 de marzo de 2026, los recurridos, en compañía de la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud, realizaron una nueva visita al sitio, mediante la cual se constató el incumplimiento de las medidas giradas de atención y corrección del vertido irregular de aguas al río.

Lo anterior conllevó a que el 23 de marzo de 2026 (sea, el mismo mes de interpuesta la denuncia), las autoridades del municipio recurrido le notificaron a la propietaria de la finca denunciada la resolución No. DSP-ALS-R-003-2026, mediante la cual se requirió la implementación de mejoras al sistema existente, incluyendo adecuaciones al tanque séptico y la construcción de zanjas de infiltración.

Paralelamente, se tiene por verificado que las autoridades municipales recurridas estuvieron al pendiente de la propuesta de obras planteada en abril de 2026 por el ingeniero contratado por los denunciados para atender la orden girada, siendo que, luego de varias revisiones y gestiones realizadas, esta última fue finalmente aprobada el 14 de mayo de 2026.

Igualmente, consta que el 3 de julio de 2026 las autoridades de la corporación municipal recurrida realizaron una nueva inspección en la propiedad denunciada, en conjunto con la gestora ambiental del Área Rectora de Salud Belén-Flores del Ministerio de Salud. Durante la visita se constató que aún no se habían ejecutado las obras requeridas, por lo cual las autoridades del citado ministerio giraron tres órdenes sanitarias vinculadas al citado inmueble con fecha de vencimiento el 4 de agosto de 2026.

Se demostró que, durante los días 21 y 23 de julio de 2026 (antes de notificado este amparo a los recurridos), el ingeniero municipal analista de alcantarillado sanitario le solicitó al ingeniero privado contratado por la parte denunciante la realización de una inspección técnica con el propósito de verificar las obras ejecutadas. Según se acreditó, dicha inspección fue programada finalmente para efectuarse el 28 de julio de 2026 (todo esto, antes también de que este amparo se le notificara a la municipalidad).

Se acreditó que el 28 de julio de 2026, tal y como fue acordado, las autoridades municipales realizaron inspección en el sitio a fin de verificar si la problemática relacionada con la gestión de las aguas residuales (negras y grises) había sido corregida mediante las obras ejecutadas. Consta que en tal ocasión se inspeccionaron dos de las tres viviendas ubicadas en la finca (pues en el tercer inmueble a no habían personas presentes que autorizaran el ingreso) y se comprobó, luego de las pruebas efectuadas, que “tanto las aguas residuales grises como las aguas residuales negras, generadas en las dos viviendas inspeccionadas, son conducidas al sistema de tratamiento existente”. En consecuencia, se informó bajo juramento que “no se evidenció la existencia de descargas de aguas residuales hacia el río Bermúdez, por lo que se concluye que el vertido previamente identificado fue eliminado mediante las obras correctivas ejecutadas”. Finalmente, en cuanto a la tercera vivienda, las autoridades municipales dispusieron realizar una inspección de forma conjunta con el Ministerio de Salud una vez vencido el plazo otorgado mediante las órdenes sanitarias emitidas por esa institución, con el fin de verificar el cumplimiento de las medidas correctivas correspondientes.

Dicho esto, se demuestra que las autoridades de la Municipalidad de Belén, desde el momento de presentada la denuncia, han realizado múltiples gestiones para atenderla, hasta finalmente verificar que las medidas de corrección giradas y adoptadas (al menos en lo tocante al vertido de aguas residuales y sanitarias en el río) han sido efectivas, eliminándose la problemática acusada. Además, es importante señalar que la verificación de este último estado de cosas se llevó a cabo días antes, incluso, de que venciera el plazo dispuesto al efecto por el Ministerio de Salud en las órdenes sanitarias giradas. De ahí que, aunque la tercera vivienda no hubiera sido inspeccionada el 28 de julio de 2026, lo cierto es que los habitantes de ese inmueble contaban aun con plazo para atender las correcciones (al menos las giradas por el ministerio de salud), en caso –solo eventualmente–, que no lo hubieran hecho para entonces.

Segundo, dado que, consta que el 23 de marzo de 2026 (semanas antes desde antes de formulado este amparo), las autoridades municipales le notificaron a la recurrente el oficio No. DSP-ALS-O-034-2026, a través del cual se hizo referencia a la denuncia planteada (concretamente en cuanto al vertido irregular de aguas en el río), a las inspecciones realizadas, a los resultados obtenidos y las medidas giradas a la parte denunciada para la corrección de la problemática. También, se demostró que las autoridades de la citada corporación municipal han mantenido constante comunicación con la recurrente vía telefónica, respecto al diseño de mejoras girado a la parte denunciada. Incluso, consta que en la última semana de junio de 2026 (antes también de formulado este amparo), se le explicó que la aprobación del diseño aportado por la denunciada de zanjas de infiltración o drenaje se había emitido por cumplirse los requerimientos establecidos al efecto.

Adicionalmente, cabe señalar que, si bien no consta que se le haya notificado a la recurrente una respuesta tocante a los resultados de la inspección efectuada el 28 de julio 2026, dicha eventual omisión, partiendo de las circunstancias supra descritas, no podría tenerse como arbitraria, en el tanto, se reitera, los denunciados, para entonces, aún contaban con plazo para cumplir las órdenes sanitarias también giradas por el Ministerio de Salud.

Bajo dicha inteligencia, se ha demostrado que la tutelada, en lo que corresponde hasta el momento, se ha mantenido plenamente informada del trámite y resolución de la denuncia bajo estudio, descartándose con esto una violación al numeral 41 constitucional.

B. En cuanto a la Municipalidad de Belén y la denuncia por construcciones realizadas en zona de protección, el amparo se debe acoger: Esto, medularmente, en el tanto, luego del estudio de los autos no se ha demostrado que las referidas autoridades municipales se hayan pronunciado y hayan atendido propiamente la denuncia también formulada por la recurrente relacionada con construcciones presuntamente realizadas en el inmueble en cuestión en zona de protección ambiental. Para la fecha de formulado este amparo, sea, el 14 de julio de 2026, había trascurrido un plazo excesivo de más de cuatro meses desde que este aspecto en concreto se denunció por la recurrente el 5 de marzo del año en curso y, como se dijo, no consta que haya sido abordado y atendido por la corporación municipal; tampoco, que una respuesta sobre el particular se le haya brindado a la denunciante. Dicha omisión sí representa una violación a los derechos fundamentales de la tutelada. Por ende, este este extremo del amparo se debe estimar, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia.

C. En cuanto al Área Rectora de Salud Belén-Flores y la denuncia por descarga irregular de aguas residuales y sanitarias al río, el amparo se debe desestimar:

Primero, habida cuenta que, cuando se interpuso este amparo (14 de julio de 2026), las referidas autoridades tenían poco menos de un mes de haber recibido formalmente (el 25 de junio de 2026) la denuncia planteada por la recurrente para atender la situación bajo estudio (vertido irregular de aguas en el río). De ahí que, no pueda sostenerse que, al momento en que se acudió a la Sala, había trascurrido un plazo excesivo e irrazonable a efecto que las autoridades del Área Rectora de Salud Belén-Flores, hubieran intervenido formalmente y atendido la problemática sanitaria expuesta.

Segundo, dado que, en todo caso, aun cuando formalmente la denuncia se planteó el 25 de junio de 2026, consta que las autoridades del Ministerio de Salud, de previo y, en atención a colaboración requerida por la Municipalidad de Belén, ya habían intervenido en el caso bajo estudio, específicamente, desde el 13 de marzo de 2026. Ocasión última en la que la respectiva gestora ambiental realizó una inspección en conjunto con el municipio en la finca denunciada.

Tercero, ya que, se demostró que, con motivo de dicha denuncia, igualmente, las autoridades en salud actuaron oportuna y diligentemente, sin que se advierta alguna arbitraria omisión de su parte. Particularmente, consta que, antes de formulado este amparo, realizaron una inspección el 3 de julio de 2026 en la propiedad denunciada; ocasión en la cual se ejecutaron pruebas de coloración y se comprobaron los hechos denunciados, lo cual, a su vez, motivó al dictado y notificación, ese mismo día, de tres órdenes sanitarias a los habitantes de las tres viviendas halladas en el inmueble. Actos administrativos mediante los cuales, a su vez, se les otorgó a los denunciados veintidós días hábiles para realizar las reparaciones y obras requeridas para evitar la inadecuada disposición de aguas negras y servidas y su vertido en la zona de protección del río (concretamente, con fecha de vencimiento el 4 de agosto de 2026).

Cuarto, en el tanto, la tutelada acudió a esta Sala el 14 de julio de 2026, cuando, para entonces, las personas denunciadas aún contaban con plazo para cumplir lo dispuesto en las referidas órdenes sanitarias giradas. Incluso, nótese que, al momento de rendido el informe por el Director del Área Rectora de Salud de Belén-Flores, sea, el 29 de julio de 2026, dicha instancia contaba con plazo para acudir al inmueble denunciado y verificar que lo ordenado hubiera sido efectivamente cumplido.

Quinto, por cuanto se demostró que, desde el 6 de julio de 2026 (días antes de formulado este amparo), las autoridades de la citada área rectora de salud le informaron a la recurrente el trámite llevado a cabo respecto a su denuncia. Específicamente, se le informó sobre la visita realizada, el de órdenes sanitarias y el plazo otorgado de veintidós días para su cumplimiento. Concomitantemente, se verificó que el 20 de julio de 2026 (antes de notificado este amparo al citado ministerio), se le informó a la recurrente nuevamente sobre la inspección y prueba de coloración el 3 de julio de 2026. Se le aclaró también que, al tener la prueba de coloración positiva, se giraron los actos administrativos correspondientes (los cuales se le adjuntaron) y se le indicó, además, que las órdenes sanitarias aún se encontraban en plazo. Por ende, una violación al artículo 41 constitucional no se tiene configurada en la especie.

D. En cuanto al Área Rectora de Salud Belén-Flores y la denuncia por construcciones realizadas en zona de protección, el amparo se debe desestimar:

Esto medularmente, en el tanto se ha demostrado que esta precisa gestión la formuló la recurrente ante el Ministerio de Salud el día 10 de julio de 2026, sea, cuatro días antes de formulado este amparo. De ahí que, no se podría sostener que, al momento de interpuesto este amparo, había trascurrido un plazo excesivo e irrazonable para su atención al momento. En todo caso, consta que el 20 de julio de 2026 (antes de notificado este amparo al área rectora), se le informó a la recurrente que lo tocante al permiso de construcción y la ubicación de los sistemas señalados era competencia de la Municipalidad y no del Ministerio de Salud.

VI. NOTA DE INTERÉS

Finalmente, en virtud de los argumentos expuestos en el considerando anterior, resulta menester señalares a las autoridades de la Municipalidad de Belén que es su deber realizar lo antes posible (en caso de no haberla realizado antes) una inspección en la tercera vivienda que no pudo ser valorada el pasado 28 de julio de 2026 y determinar si las medidas giradas a sus habitantes han sido o no cumplidas en aras de solventar de manera definitiva el problema sanitaria y ambiental denunciado. Igualmente, se les indica a las autoridades municipales que es su deber comunicar prontamente el resultado de las inspecciones realizadas a las referidas tres viviendas a la parte recurrente (en particular, lo tocante al tema del vertido irregular de aguas).

Adicionalmente, se les indica a las autoridades del Área Rectora de Salud de Belén-Flores que es su deber (en caso de no haberlo hecho antes), gestionar lo pertinente y, de forma pronta, acudir a las tres viviendas citadas, verificar el cumplimiento de las órdenes sanitarias giradas y comunicar su resultado a la recurrente. Asimismo, se les señala que, en caso que lo dispuesto en las referidas órdenes sanitarias no se haya cumplido, deberán disponer y ejecutar inmediatamente medidas adicionales para evitar que no se continúe dañando la salud y el ambiente.

VIi.- VOTO SALVADO DEL MAGISTRADO SALAZAR ALVARADO. Con el debido respeto, disiento del voto de mayoría que declara parcialmente con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

VIII. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

IX.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso (únicamente por la omisión incurrida por la Municipalidad de Belén de atender y resolver denuncia interpuesta por supuestas construcciones realizadas en zona de protección ambiental). En consecuencia, se le ordena a Zeneida Chaves Fernández, en su condición de Alcaldesa, a José Pablo Suárez Sánchez, en su condición de Director de Servicios Públicos y a Juan Pablo Artavia Jiménez, en su condición de Coordinador del Alcantarillado Sanitario, todos de la Municipalidad de Belén, o a quienes ocupen en su lugar tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de UN MES, contado a partir de la notificación de la presente sentencia, se aborde y atienda la denuncia formulada por la recurrente el 5 de marzo de 2026 (concretamente, respecto a las obras realizadas presuntamente sin permisos municipales en zona de protección ambiental) y, a su vez, se le brinde y notifique una respuesta formal.

Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Belén al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al resto de agravios, se declara sin lugar el recurso. Tomen nota todas las autoridades recurridas de lo dispuesto en el considerando VI de la presente sentencia. El magistrado Salazar Alvarado salva el voto y declara sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
