Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 13 August 2026.

Amparo proceeding filed in case file No. 26-017071-0007-CO by [Nombre 001], identity card [Valor 001], against the MINISTRY OF ENVIRONMENT AND ENERGY.

Background:

  1. 1By a brief received by the Chamber’s Secretariat on 14 May 2026, the applicant files an amparo application. He alleges: “1. Regarding the affected property I own a farm located in Canalete de Upala, Alajuela, historically devoted to agricultural and livestock activities, on which my household’s economic and family stability directly depends. The property is located in an area influenced by the Zapote River, a river with a large flow and strong erosive force. 2. Works and interventions carried out In 2019, Coopeguanacaste carried out works and interventions intended to protect its own infrastructure associated with a surge tank near the Zapote River. As a result of those interventions, the following were carried out: • earthworks (movimientos de tierra), • tree felling, • access roads opened, • ditches built, • concrete placed, • levees built, • and changes made to the river’s natural behavior.Those interventions significantly altered the dynamics and direction of the Zapote River’s force. 3. Environmental complaint before MINAE Given the seriousness of the events, I filed a formal complaint with MINAE under administrative case file SITADA No. 16-362-2019 concerning the interventions carried out by Coopeguanacaste on the Zapote River, including earthworks, tree felling, construction of levees, and alterations to the river channel and its natural behavior. As a result of that complaint, the environmental authorities learned of the interventions carried out and the possible direct effects of those works on the environment. The complaint also enabled the environmental authorities to learn of interventions carried out within an environmentally sensitive area associated with the Zapote River channel. 4. Related agrarian case file The reported events are also being handled in agrarian case file No. 21- 000108-1520-AG-7, concerning the effects on my property caused by the works carried out by Coopeguanacaste and the river’s subsequent behavior. 5.Progressive development of the damage Initially, the direct effects on my property were concentrated at vertices 13, 14, and 15 of my cadastral plan, as a result of the work carried out to access the property, earthworks, tree felling, opening ditches, and other interventions performed during construction of the works associated with Coopeguanacaste’s infrastructure. Later, as a result of the levee built and the artificial alteration of the Zapote River’s channel and direction, the damage began to spread progressively toward vertices 15, 16, 17, and 18 of my property plan. In the years following those interventions, the redirection of the river’s force toward my land has caused: • ongoing erosion, • loss of soil, • land instability, • progressive deterioration of the farm, • ongoing alteration of the surroundings, • and increasing risk to the property. It should be clarified that these new progressive effects on vertices 15, 16, 17, and 18 were not fully incorporated into the initial assessments in agrarian case file No. 21-000108-1520-AG-7 because they concern later damage that has continued to advance over the years since construction of the levee and the other interventions.Accordingly, it is necessary for an updated technical assessment, an expansion, or a supplemental expert report to be completed in the agrarian proceedings so that the new current effects and the progressive advance of the damage to the property may be properly assessed. 6. Excessive judicial delay The agrarian proceedings have experienced excessive and unreasonable delays, mainly related to difficulties in appointing and securing acceptance from court-appointed experts. To date, several potential experts have been involved, and they have declined for reasons including: • geographical distance, • technical complexity of the case, • lack of specific expertise, • and additional technical requirements raised later in the proceedings. Among other entries in the case file: 10 April 2024: Didier Alexander Miguel García declines the appointment. 26 June 2024: Franklin Gerardo Arroyo Solano declines the appointment. 27 September 2024: Junior Noe Murillo Castro accepts the appointment. 23 February 2025: an expert report is submitted.Objections and new technical requirements later arose, causing further delays. Meanwhile, the damage to my property continues to advance. Prolonged delay in environmental matters involving progressive damage ultimately becomes a form of denial of justice. 7. Institutional omission and lack of an effective response Despite the years that have passed: • no effective urgent protective measures have been implemented, • the advance of the damage has not been stopped, • there has been no final response from the competent authorities, • and the effects continue to worsen with every rainy season. Institutional inaction has created a continuing situation of uncertainty, distress, and helplessness for my family. 8. Current human situation My family lives with constant concern about the river’s progressive advance and the property’s continuing deterioration. • Each winter brings fear: • fear of losing more land, • fear that the damage will continue to advance, • fear that the effects will reach other areas of the property, • and fear of remaining helpless in the face of a problem that continues to grow over time.It is deeply painful to watch the deterioration advance slowly while the responsible institutions provide no effective and timely solution. III. FUNDAMENTAL RIGHTS VIOLATED I consider the following fundamental rights to have been violated: 1. The right to a healthy and ecologically balanced environment (Article 50 of the Political Constitution). 2. The right to prompt and effective justice (Article 41 of the Constitution). 3. The right to property. 4. The right to effective judicial protection. 5. The principle of administrative legality. 6. The right to family security and protection. 7. The environmental precautionary principle. IV. LEGAL BASIS Article 50 of the Political Constitution recognizes everyone’s right to a healthy and ecologically balanced environment, as well as the State’s obligation to guarantee and protect that right. Article 41 of the Constitution guarantees everyone the right to obtain prompt and effective justice without denial.Costa Rican constitutional case law has repeatedly held that environmental protection is an immediate obligation of public institutions and that unjustified delay in proceedings related to environmental damage may constitute a violation of fundamental rights. The precautionary principle also requires authorities to act immediately when there is a risk of progressive or irreversible damage. In this case, the damage is not hypothetical: it is currently continuing to advance on my property. V. IMPUGNED ACTS AND OMISSIONS The following are challenged: 1. MINAE’s inaction and omission in response to the reported effects. 2. The excessive delay in agrarian case file No. 21-000108-1520-AG-7. 3. The absence of urgent and effective protective measures. 4. The failure to update the technical assessment of the new progressive effects. 5. Institutional tolerance of the continuing advance of environmental and property damage. 6.The prolonged violation of fundamental rights. VI. RELIEF SOUGHT For the foregoing reasons, I respectfully request that this honorable Constitutional Chamber: 1. Declare this amparo proceeding WELL-FOUNDED. 2. Order MINAE to act immediately and effectively regarding the reported environmental effects. 3. Order the Agrarian Court to handle case file No. 21-000108-1520-AG-7 urgently and without further unjustified delay. 4. Order updated technical assessments of the new progressive effects on the property. 5. Allow an updated technical assessment, an expansion, or a supplemental expert report concerning the new effects that arose after the initial assessments to be added to the agrarian case file. 6. Order urgent protective measures to prevent the continued advance of the damage. 7. Warn the respondent authorities of their constitutional duty to provide effective protection and protect the environment.”
  2. 2By a ruling issued at 7:42 a.m. on 8 June 2026, the President of the Chamber directed the applicant to appear before the Chamber’s Secretariat to sign the filing initiating the proceeding, as he had failed to do so, or alternatively to submit a duly signed brief ratifying the amparo application in all its terms. He was also asked to state the following: “• Which department of the Ministry of Environment and Energy (MINAE) is handling administrative case file ‘SITADA No. 16-362 2019’; and to provide a complete, legible copy of the complaint filed with the respondent authority, together with proof of receipt or of its submission by email.”
  3. 3By briefs entered into the electronic case file on 11 June 2026, the applicant complied with the directive.
  4. 4By ruling issued at 12:48 p.m. on 12 June 2026, the President of the Chamber admitted the amparo application for processing and requested a report from the Director of the Directorate of Waters and the President of the Administrative Environmental Tribunal, both of the Ministry of Environment and Energy.
  5. 5By a brief entered into the electronic case file on 17 June 2026, Adriana Bejarano Alfaro, in her capacity as presiding judge of the Administrative Environmental Tribunal, submits a sworn report. She states: “BACKGROUND: In accordance with the facts described in this amparo application, it was determined that they relate to administrative case file No. 253-14-01-TAA, from which it is important to extract the following background describing the actions of this Tribunal: FIRST: On 29 July 2014, officials of this Tribunal conducted an ex officio inspection of the area of the Bijagua Hydroelectric Project, developed by the Cooperativa de Electrificación Rural de Guanacaste R.L., known as COOPEGUANACASTE R.L. The inspection was conducted to verify whether significant environmental damage to natural resources existed. SECOND: As a result of the inspection, report TAA-DT-06914, dated 21 August 2014, was issued and signed by officials Biologist Rolando Manfredi Abarca, Engineer Alexis Madrigal Chaves, and Lic. Daniel Morera Blanco.On 1 September 2014, on the basis of that report, case file No. 253-1401-TAA was opened ex officio. (Folio 01 to 127) THIRD: Case file No. 253-14-01-TAA was opened to analyze and investigate the following facts: The project has a Declaration of National Convenience and Public Interest, as well as associated works in the construction, operation, and maintenance phases, under Decree No. 37732-MINAE. The project covers an area of 40 ha, according to company representatives. That decree allows them to fell, prune, or remove trees of any species, including protected species located in protection areas defined in accordance with Article 33 of the Ley Forestal. It also provides that SINAC shall give priority and expedited treatment to applications, provided they are not located on lands that are State Natural Heritage. A visual inspection was conducted in the area encompassing the construction phase of the Bijagua Hydroelectric Project to verify whether significant environmental damage existed.During the site inspection, it was observed that watercourses within the project area had been diverted to construct the water intake. This type of human intervention causes large quantities of stone of varying sizes, as well as smaller granular material such as sand, to be moved. This work was carried out in the Zapote River channel, where a levee was built. During the survey of the project area, several spoil areas were observed, of which those designated Nos. 4, 5, and 7 were visited. According to the project managers, during the survey of spoil area No. 4 it was observed that a perimeter channel and other secondary channels had been built, with several traps or sedimentation basins installed to stop the movement and deposition of this material; however, some of this sediment flows directly toward the forest ecosystem, thereby altering natural drainage. In spoil area No. 5, it was observed that there were no soil conservation works and that sediment was being carried away, creating gullies in the soil through water erosion.The sediment then collects in the ditches beside the road. There are no soil management and conservation works. Spoil area No. 7 is characterized by very steep slopes and quite loose material. Water erosion causes gullies in the soil through which sediment is carried away and deposited in the protection area of the Bijagua River. In some places, traps or sedimentation basins are installed to stop sediment deposition, but the volume of material is so great that they collapse. During the survey of the project, several bodies of water were observed to be silted up by sediment carried and deposited mainly by water erosion, for example in the protection area of Quebrada Agüero, as well as in several culverts located on the project’s internal roads. With heavy machinery traffic, sediment flows toward a possible body of water that empties into the Bijagua River and subsequently into the Zapote River.No measures had been taken to compact the material deposited in the spoil areas visited during the site inspection: a large amount of mud and standing water was evident. As a result, when a person walks across the surface, their weight and the pressure exerted cause them to sink into the mud. No evidence was observed that the visited spoil areas had been replanted with native trees; they therefore lack the plant cover that is very important in such cases for holding the material in place and preventing landslides. What could be observed, except at some locations, was the growth of grass which, because of its high germination rate, rapid growth, and dispersal, was developing in some parts of the visited spoil areas. The road leading to the Zapote River water intake was the only place where works to channel rainwater could be observed; these were properly lined and had drop structures to reduce the speed of the water.As part of the compensatory measures, Mr. Torres stated that about 12,000 native trees were being planted. It is important to use species that grow quickly and have multiple uses, to retain the soil and also benefit soil conservation, such as trees or shrubs in the Fabaceae (legume) family and other native plant families in the area. The visual inspection in the project area showed that very few mitigation and soil conservation works had been carried out, principally in the spoil areas. Sediment traps had been built, most of which had collapsed on the day of the visit. There were several artificial drains leading to the Bijagua River, but apparently they were not functional because their cover had been removed, possibly by water. Possibly because these works were unsuccessful or inadequate for the sediment load and the volume of runoff water in several sectors of the project, sediment flows along the topography of the ravines and the slopes of the embankments.This, together with its inertia, carries sediment toward the Zapote and Bijagua River channels and toward a forest ecosystem, altering natural drainage. Measures or alternatives must therefore be implemented to improve sediment retention in the spoil areas and prevent water contamination by particles that alter the physicochemical and biological characteristics of the water in the various channels within the Bijagua Hydroelectric Project area. Mr. Torres, the construction company’s environmental manager, states that officials from the Technical Environmental Secretariat (SETENA) have not inspected the works for approximately eight months. SETENA officials should conduct periodic inspections and prepare the respective reports to ensure that the company in charge of the project is complying with its environmental commitments. FOURTH: To establish the real truth of the reported facts, by ruling No. 1146-15-TAA, issued at 8:05 a.m. on 7 September 2015, this Tribunal resolved as follows: (Folio 128 to 132) ‘FIRST: In this matter, this Office considers it extremely important for establishing the real truth of the reported facts to request Engineer Freddy Bolaños Céspedes, or whoever holds his position as Secretary General of the National Environmental Technical Secretariat, to provide this Office, in accordance with the complaint filed by this Tribunal’s officials in memorandum No. TAA-DT-069-14 against the project known as the Bijagua Hydroelectric Project, developed by Coopeguanacaste R.L., with the relevant Environmental Audit and Monitoring reports, since the project has the corresponding environmental viability; to indicate the scope established in that viability; and to state whether the project has caused any type of significant adverse environmental damage and, if so, what mitigation measures were proposed and whether they have already been approved and implemented.SECOND: In this matter, this Office considers it extremely important for establishing the real truth of the reported facts to request Engineer Alexander León Campos, or whoever holds his position as Director of the Arenal Tempisque Conservation Area, to conduct an inspection of the site concerned by the complaint filed in memorandum No. TAA-DT-069-2014, which reports a series of environmental irregularities arising from construction of the Bijagua Hydroelectric Project by developer Coopeguanacaste R.L., and to report to this Tribunal on any resulting effects, including whether environmental damage is being caused and what type. If the inspection detects significant adverse environmental damage, the Director should, in accordance with his powers, conduct the corresponding economic assessment of the alleged damage. Another matter this Tribunal requires him to analyze is the spoil areas, specifically whether the company is carrying out mitigation work.THIRD: In this matter, this Office considers it extremely important for establishing the real truth of the reported facts to request Engineer José Miguel Zeledón Calderón, or whoever holds his position as Director of the Directorate of Waters, to conduct an inspection of the site concerned by the complaint filed in memorandum No. TAA-DT-069-2014, which reports a series of environmental irregularities arising from construction of the Bijagua Hydroelectric Project by developer Coopeguanacaste R.L., and to report to this Tribunal on any effects on water resources; if any are found, to conduct, in accordance with his powers, the corresponding economic assessment of the environmental damage caused to water resources.’ FIFTH: On 10 March 2017, memorandum No. SG-ASA-0166-2017, signed by Lic. Marco Arroyo Flores, was received. He states that the project does have the corresponding environmental viability, granted by Resolution No. 27452012-SETENA.The plant began operating in 2016 and takes water from the Bijagua and Zapote rivers through lateral diversion weirs. In January 2017, an inspection was conducted jointly with personnel of the Bijagua Hydroelectric Project because Hurricane Otto had caused extensive damage to intakes and various protection levees, as well as severe damage to transmission-line poles, several of which were at risk. A great deal of fiber optic cable had also been damaged. Along the rivers, extensive movement of stones, logs, trees, and sediment could be seen, including river diversions (...) (Folio 137 to 139) SIXTH: By ruling No. 1083-17-TAA, issued at 8:05 a.m. on 26 July 2017, this Tribunal again requested that Engineer Alexander León Campos, as Director of the Arenal Tempisque Conservation Area, and Engineer José Miguel Zeledón Calderón, as Director of the Directorate of Waters, comply with the requirements in ruling No. 1146-15-TAA.(Folio 201 to 205) SEVENTH: On 4 October 2017, memorandum No. ACAT-SCM-OC-27817, signed by Engineer Alexander León Campos as Director of the Tempisque Conservation Area, was received. He reported: 1- The area contains a series of infrastructure works intended to manage runoff erosion and flows from supplementary works. No tree felling or vegetation removal was evidenced in or along the river channel or within its protection area. There was an impact in that sector, but it resulted from Hurricane Otto and the number of uprooted trees. 2- The areas adjacent to that sector are well defined by the road embankments with plant cover, and the channel is fully conserved. 3- The remaining natural channel has a good flow and is free of erosion. The engineering works constructed allow for adequate control of runoff sediment; the road slopes and channels have plant cover, and there is no effect on the Ley Forestal. 4- Based on what was observed, the major impacts likely occurred during the construction phase of the most significant works (dam, gates, flow conveyance channels, water intakes, etc.); however, by the time of the inspection, those impacts had already been controlled, thereby minimizing erosion pollution.(See folios 211-217.) EIGHTH: On 24 October 2017, memorandum No. IN-UHSAN-0079-2017, signed by Engineer Andrés Phillips Ureña of the Directorate of Waters, was received. It reports: According to the 2014 inspection report, the problems were those presented by all hydroelectric projects during their construction phase, so we assume that the relevant issues identified in the 2014 inspection have since been corrected. The works currently in place are those normally necessary to use the water resource. As for the economic assessment of environmental damage to bodies of water, we consider it technically impossible to conduct one, since it is difficult to determine possible seasonal damage during the construction process. (See folio 218.) NINTH: Based on the facts and technical reports provided by the Tempisque Conservation Area, the Directorate of Waters, and SETENA, and after due analysis, this Administrative Environmental Tribunal concluded that the Bijagua Hydroelectric Project had not violated environmental regulations and that no effect on the environment or water resources had been demonstrated.Accordingly, in ruling No. 1404-18-TAA, issued at 11:53 a.m. on 18 December 2018, it proceeded to DISMISS the complaint filed ex officio by the Tribunal itself because environmental damage had not been established. The legal remedies were available against that ruling. (See folio 219 to 228.) TENTH: After the period for filing remedies expired without any being filed, this Tribunal, by ruling No. 1525-19-TAA issued at 9:45 a.m. on 9 September 2019, proceeded to definitively close case file No. 253-14-01-TAA. (See folio 231) ELEVENTH: After case file No. 253-14-01-TAA was closed, on 11 August 2020, memorandum No. DA-UHSAN-0541-2020 was received, through which the Directorate of Waters submitted a report on the Bijagua River and stated, as relevant: (See folio 234 to 240). Ruling 1083-17-TAA in case file 253-14-01-TAA mentions that, according to the inspection conducted on 29 July 2014 (during construction of the hydroelectric project), watercourses were observed to have been diverted for the water intake, and several bodies of water were silted up by sediment carried and deposited through water erosion, with artificial drains leading to the Bijagua River.According to the field inspection conducted by the undersigned at the study site on 27 August 2019, detailed above in this report, and within the Directorate of Waters’ remit, none of the matters stated in the cited ruling were identified, nor was any effect on water resources found.’ TWELFTH: On 11 August 2020, this Tribunal received memorandum No. DA-UHSAN-0539-2020, through which the Directorate of Waters, in response to SITADA 16362-2019 filed by Mr. [Nombre 001], identity card [Valor 002], against Coopeguanacaste for diverting the Zapote River, which caused water to strike the applicant’s property directly, informed Mr. [Nombre 001] as follows: (See folio 241 to 243). After consulting the National Register of water-use and watercourse concessions and the National Register of works in watercourses, no permit for a work in a watercourse issued by this Directorate was found for the inspected points.It is therefore determined that the work in the watercourse (the identified levee) does not have the required permit. During the field inspection, no machinery was identified carrying out work within the Zapote River channel. It should also be stated that the field inspection did not make it possible to identify any effect on third-party properties. Since it was determined that this Directorate had issued no permit for the identified work in the watercourse (the levee), the corresponding complaint will be filed with the Administrative Environmental Tribunal. A review of the background relating to the study site identified ruling 1083-17-TAA, concerning case file 253-14-01-TAA, in which the respondent was the Bijagua Hydroelectric Project developed by Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Because the facts identified during the undersigned’s field inspection are located within the Bijagua Hydroelectric Project area, the reports generated by this Directorate will be formally forwarded to the Administrative Environmental Tribunal so that they may be added as supporting material to the complaint in case file 253-14-01-TAA, for that Tribunal to proceed as appropriate.THIRTEENTH: Folios 244 to 247 of the administrative case file show that on 11 August 2020, the Directorate of Waters submitted memorandum No. DA-UHSAN-0540-2020, informing this Tribunal about complaint SITADA 16362-2019, filed by Mr. [Nombre 001], identity card [Valor 003], with that Directorate. REGARDING THE AMPARO APPLICATION: As is apparent from each of the facts described in the background of this response, the Bijagua Hydroelectric Project under the name of Coopeguanacaste R.L. was inspected ex officio by this Tribunal, and an investigation was opened into the facts found at the time of the inspection under case file No. 253-14-01-TAA. As part of the procedure, reports were requested from the competent agencies, including SINAC, the Directorate of Waters, and SETENA. Based on the reports received and the corresponding analysis, and on what the aforementioned agencies competent in this matter determined, this Tribunal concluded that the Bijagua Hydroelectric Project did not violate environmental regulations and caused no effect on the environment or water resources.It therefore dismissed the complaint filed ex officio by the Tribunal itself, as recorded in ruling No. 1404-18-TAA, issued at 11:53 a.m. on 18 December 2018. Once that ruling became final, case file No. 253-14-01-TAA was definitively closed by ruling No. 1525-19-TAA, issued at 9:45 a.m. on 9 September 2019. Regarding complaint SITADA 16362-2019, it should be clarified that it was filed with the Directorate of Waters by Mr. [Nombre 001], identity card [Valor 002], and although that Directorate forwarded it to this Tribunal, it did so after case file No. 253-14-01-TAA had been definitively closed. In view of the foregoing and of the facts described by Mr. [Nombre 001] in this amparo application, the appropriate course is to separate memoranda DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-UHSAN-0541-2020 from the prior case and open a new case file to investigate the facts alleged by the Directorate of Waters and their current status, within this Tribunal’s remit.This separation was carried out by ruling No. 629-2026-TAA, issued at 1:15 p.m. on 16 June 2026. LEGAL BASIS This report is based on Articles 1, 2, 3, 11, 59, 60, 103, and 108 of the Organic Environmental Act; Articles 214, 282, 297, 308, 311, and following of the General Law of Public Administration; Articles 11 and 45 of the Biodiversity Law; Decreto Ejecutivo 34136-MINAE, the Regulations on Proceedings of the Administrative Environmental Tribunal; and Articles 43 and following of the Constitutional Jurisdiction Act. RELIEF SOUGHT In light of the foregoing, I ask this Honorable Chamber to accept this report as submitted and to dismiss the amparo application insofar as it concerns the Administrative Environmental Tribunal.”
  6. 6By a brief entered into the electronic case file on 19 June 2026, José Miguel Zeledón Calderón, in his capacity as Director of Waters of the Ministry of Environment and Energy, submits a sworn report. He states: “In this regard, we report that on 27 August 2019, officials of the San Juan Hydrological Unit of the Directorate of Waters conducted an inspection at the site in response to the complaint filed by the applicant. Report DA-UHSAN-0539-2020 was therefore issued to Mr. [Nombre 001], stating: ‘No permit for a work in a watercourse issued by this Directorate was found for the inspected points. It is therefore determined that the work in the watercourse (the identified levee) does not have the required permit. During the field inspection, no machinery was identified carrying out work within the Zapote River channel. It was not possible to identify any effect on third-party properties. Since it was determined that this Directorate issued no permit for the identified work in the watercourse (the levee), the corresponding complaint will be filed with the Administrative Environmental Tribunal.’ Given that works in a watercourse without permits were found, the corresponding complaint regarding construction of the work without the required permits was forwarded to the Administrative Environmental Tribunal by memorandum DA-UHSAN-0540-2020.As reported in memorandum DA-UHSAN-0614-2026, dated 18 June 2026, ‘the possible determination of liability of the natural or legal person associated with the identified intervention, as well as the definition of any corrective, restorative, or removal measures appropriate to address the effects associated with that work, must be assessed and resolved within the established administrative proceeding. That proceeding must also determine the involvement of those concerned and the measures, if any, to be undertaken by those found responsible for the intervention or its effects on water resources.’ It is clear that the Directorate of Waters acted promptly in this specific case by addressing the complaint and visiting the site, and forwarding the corresponding complaint to the Administrative Environmental Tribunal so that it could consider the violation arising from construction of the work in the watercourse and order the corresponding corrective measures.It is important to note the following, according to the cited memorandum, regarding the applicant’s claim of alleged direct effects on the complainant’s property caused by the levee built on Coopeguanacaste’s property: ‘• The complainant provides no technical evidence to support the claim. • Geoprocessing using geographic information systems and the Quantum GIS (QGIS) tool made it possible to: o Identify the points under review in accordance with Table 1 of memorandum DA-UHSAN-0539-2020 (red points 20, 21, and 22 visible in Figure 1). A. DA-UHSAN-0539-2020 indicated that the levee was located at points 22 and 21. o Identify farm 360333 using the OGC services available in the National Territorial Information System (SNIT) of the National Register’s Real Estate Registry, which contains Costa Rica’s Cadastral Map, specifically Zone 2 (see Figure 1). o Identify aerial images of the study site that were available: A. 1:5,000 Orthophoto Mosaic 2014-2017: Available in SNIT.A raster layer showing a mosaic of orthophotos taken between 2014 and 2017 at a scale of 1:5,000, as part of the project titled “Contracting for the Capture of Images and Production of Orthoimages and Digital Cartography of the Entire National Territory” (Figure 2. Image A.) B. ESRI Satellite: Historical images from ESRI. Wayback Imagery captured on 27/3/2017. (Figure 2. Image B. and Figure 1 of the Annexes) C. Google Satellite: Historical images available in Google Earth Pro. Image date: 4/7/2025 (Figure 2. Image C and Figure 2 of the Annexes). The comparative analysis of the available historical orthophotographs (Figure 2. A, B, and C) shows: • Image A (2014-2017) shows that the study area had continuous tree cover across much of the sector analyzed. • Image B (27/3/2017) shows a significant reduction in that cover, accompanied by greater soil exposure and sediment deposited on the floodplain adjacent to the channel. o The possibility that the observed variation may be associated with extreme hydrometeorological events should be considered.In that regard, Hurricane Otto, which occurred in November 2016 and caused significant flooding, erosion, and sediment movement in different parts of the Northern Region, is noteworthy. • Image C (4/7/2025) shows natural regeneration of plant cover and an increase in vegetation density and extent compared with the previously recorded condition. The works reported by the applicant date to 2019. However, the photointerpretive analysis identified that the channel variations and areas without plant cover observed in the sector were already present in images captured before that intervention. Historical aerial images available for 2025 show plant cover in the sector where progressive and continuing damage to the identified land is alleged, without showing any progressive and continuing loss of forest cover directly attributable to the reported work. Consequently, the information analyzed does not technically establish that the effects alleged by the applicant correspond to a progressive process attributable to the reported work, nor does it establish a direct causal relationship between that intervention and the claimed property damage.Therefore, although the existence of unauthorized work prompted the corresponding administrative actions, this does not make it possible to conclude technically that the claimed effects resulted directly and exclusively from that intervention.’ RELIEF SOUGHT In light of the information provided and the technical analysis conducted in accordance with the attached memorandum DA-UHSAN-0614 2026, and given the applicant’s lack of evidence, we ask that this amparo application against this Directorate be dismissed, as the Directorate acted promptly and diligently, and that the case file be closed.”
  7. 7The legal requirements have been observed in the proceedings.

Drafted by Justice Rueda Leal; and, Reasons:

I.Preliminary issue. Before examining the merits, it must be clarified that, since judgment No. 2008002545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred cases to the administrative-litigation jurisdiction—with some exceptions—where the issue is whether the public administration has complied with the time limits established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws for special administrative procedures, either to resolve an administrative procedure by final act—whether initiated ex officio or at a party’s request—or to hear the available administrative remedies. This case presents an exception, because it concerns an environmental complaint alleged not to have been resolved within a reasonable period. That point clarified, the Chamber proceeds to resolve the specific situation raised in this amparo.

II.Subject of the amparo application. The applicant alleges that he owns property registered under matrícula No. 2-360333-000, located in Canalete de Upala, Alajuela, used for agricultural and livestock activities and situated in an area influenced by the Río Zapote. He states that in 2019 the company Coopeguanacaste carried out various works to protect its own infrastructure near the river, including earthworks (movimientos de tierra), tree felling, opening access routes, construction of drainage ditches, placement of concrete, and construction of dikes, which altered the riverbed and the river’s natural behavior. He states that these interventions substantially changed the dynamics of and the direction of the force of the Río Zapote. He says that, given the seriousness of the events, he filed a complaint with MINAE under case file SITADA No. 16-362-2019, which enabled the authorities to learn of the interventions and their possible environmental effects.

He notes that the complaint was forwarded from the Upala office of SINAC to the Water Directorate of the Ministry of Environment and Energy, where field inspections were carried out, reports were issued, and the matter was referred to the Environmental Administrative Tribunal. He maintains that, as of the date he brings this amparo proceeding, no effective measures have been adopted to stop the harm and no timely response has been provided, resulting in an ongoing impact on his property, as well as uncertainty and concern for his family. He requests the Chamber’s intervention.

III.Facts established. The following facts are deemed duly established and relevant to the decision in this matter:

  • a)On 6 August 2019, the applicant filed a complaint with the Upala-Guatuso subregion of SINAC concerning the following events: “According to the report, the company Coope Guanacaste diverts the Río Zapote and builds a dike with materials from the river itself (stones); by diverting the riverbed, it causes the water to have a direct impact on the applicant’s property” (see evidence submitted).
  • b)On 8 August 2019, the applicant’s complaint was forwarded to the Water Directorate of the Ministry of Environment and Energy (see evidence submitted).
  • c)In official letter DA-UHSAN-0539-2020 of 10 August 2020, issued by the MINAE Water Directorate and addressed to the complainant, it was stated: “(…) No authorization for work in the riverbed issued by this Directorate was found for the points inspected; it is therefore determined that the work in the riverbed (the identified dike) does not have the required authorization. — During the field inspection, no machinery of any kind was found carrying out work within the Río Zapote riverbed. —It was not possible to identify any impact on third-party properties. —Since it was determined that this Directorate had issued no authorization for the identified work in the riverbed (the dike), the corresponding complaint will be filed with the Environmental Administrative Tribunal.” (see report submitted under oath).
  • d)In official letter DA-UHSAN-0540-2020 of 10 August 2020, issued by the MINAE Water Directorate and addressed to the Environmental Administrative Tribunal, it was stated: “With regard to complaint SITADA 16362-2019, filed by Mr. [Nombre 001], identity card [Valor 003], identifying Coopeguanacaste as the respondent and concerning works in the Río Zapote riverbed, we inform you as follows: The undersigned conducted a field inspection on 27 August 2019. That inspection resulted in report DA-UHSAN-0539-2020, which is attached to this report. The presence of works in the riverbed within the public domain was established (the dike described in the above-mentioned official letter). No authorization for that work issued by this Directorate is on record; it is therefore determined that the water resource has been affected. Accordingly, this complaint is respectfully referred to you for whatever action may be appropriate. A review of records relating to the site under study identified resolution 1083-17-TAA, related to case file 253-14-01-TAA, in which the respondent was the Bijagua Hydroelectric Project, developed by Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Because the events identified during the field inspection conducted by the undersigned occurred in the area of the Bijagua Hydroelectric Project, the reports prepared by this Directorate are formally being referred to the Environmental Administrative Tribunal so that they may be added as supporting material to the complaint in case file 253-14-01-TAA, for that Tribunal to proceed as appropriate. In addition, the economic valuation of the environmental damage is presented below” (see report submitted under oath and evidence submitted).
  • e)The order initiating the amparo proceeding was served on the president of the Environmental Administrative Tribunal on 12 June 2026 and on the director of the MINAE Water Directorate on 16 June 2026 (see service records).
  • f)By resolution No. 629-2026-TAA, issued at 13:15 on 16 June 2026, the authorities of the Environmental Administrative Tribunal separated official letters DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-USHAN-0541-2020 from case file No. 253-14-01-TA in order to open a new case file and begin investigating the events alleged by the Water Directorate (see report submitted under oath).

IV.The specific case. In the matter at hand, the applicant alleges that he owns property registered under matrícula No. 2-360333-000, located in Canalete de Upala, Alajuela, used for agricultural and livestock activities and situated in an area influenced by the Río Zapote. He requests the Chamber’s intervention.

In this regard, the account of the established facts shows that on 6 August 2019, the applicant filed a complaint with the Upala-Guatuso subregion of SINAC concerning the following events: “According to the report, the company Coope Guanacaste diverts the Río Zapote and builds a dike with materials from the river itself (stones); by diverting the riverbed, it causes the water to have a direct impact on the applicant’s property.” On 8 August 2019, the applicant’s complaint was forwarded to the Water Directorate of the Ministry of Environment and Energy. In official letter DA-UHSAN-0539-2020 of 10 August 2020, issued by the MINAE Water Directorate and addressed to the complainant, it was stated: “(…) No authorization for work in the riverbed issued by this Directorate was found for the points inspected; it is therefore determined that the work in the riverbed (the identified dike) does not have the required authorization. — During the field inspection, no machinery of any kind was found carrying out work within the Río Zapote riverbed. —No impact on third-party properties could be identified. —Since it was determined that this Directorate had issued no authorization for the identified work in the riverbed (the dike), the corresponding complaint will be filed with the Environmental Administrative Tribunal.” In official letter DA-UHSAN-0540-2020 of 10 August 2020, issued by the MINAE Water Directorate and addressed to the Environmental Administrative Tribunal, it was stated: “With regard to complaint SITADA 16362-2019, filed by Mr. [Nombre 001], identity card [Valor 003], identifying Coopeguanacaste as the respondent and concerning works in the Río Zapote riverbed, we inform you as follows: The undersigned conducted a field inspection on 27 August 2019.

That inspection resulted in report DA-UHSAN-0539-2020, which is attached to this report. The presence of works in the riverbed within the public domain was established (the dike described in the above-mentioned official letter). No authorization for that work issued by this Directorate is on record; it is therefore determined that the water resource has been affected. Accordingly, this complaint is respectfully referred to you for whatever action may be appropriate. A review of records relating to the site under study identified resolution 1083-17-TAA, related to case file 253-14-01-TAA, in which the respondent was the Bijagua Hydroelectric Project, developed by Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Because the events identified during the field inspection conducted by the undersigned occurred in the area of the Bijagua Hydroelectric Project, the reports prepared by this Directorate are formally being referred to the Environmental Administrative Tribunal so that they may be added as supporting material to the complaint in case file 253-14-01-TAA, for that Tribunal to proceed as appropriate.

In addition, the economic valuation of the environmental damage is presented below.” The order initiating the amparo proceeding was served on the president of the Environmental Administrative Tribunal on 12 June 2026 and on the director of the MINAE Water Directorate on 16 June 2026. By resolution No. 629-2026-TAA, issued at 13:15 on 16 June 2026, the authorities of the Environmental Administrative Tribunal separated official letters DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-USHAN-0541-2020 from case file No. 253-14-01-TA in order to open a new case file and begin investigating the events alleged by the Water Directorate.

Accordingly, as to the MINAE Water Directorate, no action or omission that would harm the applicant’s fundamental rights is apparent, since it processed and responded to the complaint filed by the person seeking protection as of 2020, by means of official letter DA-UHSAN-0539-2020 of 10 August 2020. It also referred the applicant’s case to the Environmental Administrative Tribunal by means of official letter DA-UHSAN-0540-2020 of 10 August 2020 for the appropriate action.

As for the Environmental Administrative Tribunal, the record shows that the complaint filed by the person seeking protection was referred to it on 10 August 2020. However, as appears from the report submitted under oath, it was only by resolution No. 629-2026-TAA, issued at 13:15 on 16 June 2026—almost six years later and after service of the order initiating this amparo proceeding—that the authorities of the Environmental Administrative Tribunal separated official letters DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-USHAN-0541-2020 from case file No. 253-14-01-TA in order to open a new case file and begin investigating the events alleged by the Water Directorate in connection with the complaint filed by the person seeking protection.

In light of the foregoing, this Chamber considers that there has been undue delay and unjustified tardiness that violate the fundamental right of the amparo applicant to prompt and duly completed administrative proceedings, enshrined in Article 41 of the Political Constitution. Accordingly, because, as of the date this application was filed, the proceeding in question had still not been resolved by the respondent Environmental Administrative Tribunal, the application must be granted, with the consequences set out in the operative part of this judgment.

V.Justice Castillo Víquez files a separate note. I have supported this Tribunal’s position that when a litigant alleges a violation of the right to prompt and duly completed justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Law Regulating the Right of Petition, that right has been established as one that may be protected judicially through the amparo application provided for in Article 32 of the Constitutional Jurisdiction Law, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Tribunal to change its line of precedent.

Under Article 7 of its Law, this Tribunal alone is responsible for defining its own jurisdiction, since constitutional legal disputes concerning minors, the environment, payment of salary, payment of benefits upon retirement, pensions under the non-contributory regime, and cases involving profound cerebral palsy, persons with disabilities, foreigners outside the country, drinking water service, older adults where pension matters are not at issue, corruption complaints, Indigenous peoples’ rights, claims concerning lack of coverage by the Caja Costarricense de Seguro Social, and maternity leave are within this jurisdiction’s purview through the constitutional amparo proceeding. In all other cases, for the reasons set out in this judgment, the competent courts are those of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory rules, based on a logical, systemic, and teleological interpretation of the legal order.

VI.Documents submitted to the case file. The parties are advised that, if they submitted any paper document, objects, or evidence contained on an additional electronic, computing, magnetic, optical, telematic, or new-technology device, they must retrieve them within a maximum period of 30 business days, counted from service of this judgment. Any material not retrieved within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session No. 27-11 of 22 August 2011 and published in Judicial Bulletin No. 19 of 26 January 2012) and Article LXXXI of session No. 43-12 of the Judicial Council of 3 May 2012.

Therefore:

The amparo application is partially granted, solely with respect to the Environmental Administrative Tribunal. Adriana Bejarano Alfaro, in her capacity as presiding judge of the Environmental Administrative Tribunal, or whoever holds that office, is ordered to issue the necessary instructions and carry out all actions within the scope of the respective competencies so that, within a maximum period of THREE MONTHS counted from service of this judgment, a final decision is issued in the case referred by official letter No. DA-UHSAN-0540-2020 of 10 August 2020, concerning the environmental complaint filed by the person seeking protection, and that person is notified of the decision. The respondent authorities are advised that, pursuant to Article 71 of the Constitutional Jurisdiction Law, a person who receives an order that they must comply with or cause to be complied with, issued in an amparo proceeding, and fails to comply with it or cause it to be complied with, will be sentenced to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty.

The application is denied as to the MINAE Water Directorate. The State is ordered to pay the costs, damages, and losses caused by the events on which this declaration is based, which shall be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente nro. 26-017071-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE AMBIENTE Y ENERGÍA.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 14 de mayo de 2026, el recurrente interpone recurso de amparo. Alega: “1. Sobre la propiedad afectada Soy propietario de una finca ubicada en Canalete de Upala, Alajuela, dedicada históricamente a actividades agrícolas y pecuarias, de la cual depende directamente la estabilidad económica y familiar de mi hogar. La propiedad se ubica en una zona influenciada por el rio Zapote, rio de gran caudal y fuerza erosiva. 2. Obras e intervenciones realizadas En el año 2019, Coopeguanacaste ejecutó obras e intervenciones destinadas a proteger infraestructura propia relacionada con un tanque de oscilación cercano al rio Zapote. Producto de dichas intervenciones se realizaron: • movimientos de tierra, • tala de árboles, • apertura de accesos, • construcción de cunetas, • colocación de concreto, • construcción de diques, • y alteraciones sobre el comportamiento natural del rio.Dichas intervenciones provocaron modificaciones importantes sobre la dinámica y dirección de la fuerza del rio Zapote. 3. Denuncia ambiental ante MINAE Ante la gravedad de los hechos, interpuse formal denuncia ante el MINAE bajo el expediente administrative SITADA N.° 16-362-2019, relacionada con las intervenciones realizadas por Coopeguanacaste sobre el rio Zapote, incluyendo movimientos de tierra, tala de árboles, construcción de diques y alteraciones sobre el cauce y comportamiento natural del rio. Producto de dicha denuncia, las autoridades ambientales tuvieron conocimiento de las intervenciones efectuadas y de las posibles afectaciones directas al ambiente derivadas de dichas obras. Asimismo, dicha denuncia permitió que las autoridades ambientales conocieran sobre la existencia de intervenciones realizadas dentro de una zona ambientalmente sensible relacionada con el cauce del rio Zapote. 4.Expediente agrario relacionado Los hechos denunciados también se tramitan dentro del expediente agrario N.° 21- 000108-1520-AG-7, relacionado con las afectaciones ocasionadas sobre mi propiedad como consecuencia de las obras ejecutadas por Coopeguanacaste y el comportamiento posterior del rio. 5. Evolución progresiva del daño Inicialmente, las afectaciones directas sobre mi propiedad se concentraron en los vértices 13, 14 y 15 de mi piano catastrado, como consecuencia de los trabajos realizados para el ingreso a la propiedad, movimientos de tierra, tala de árboles, apertura de cunetas y demás intervenciones efectuadas durante la ejecución de las obras relacionadas con infraestructura de Coopeguanacaste. Posteriormente, y como consecuencia del dique construido y de la alteración artificial del cauce y dirección del rio Zapote, el daño comenzó a extenderse progresivamente hacia los vértices 15, 16, 17 y 18 del piano de mi propiedad.Durante los años posteriores a dichas intervenciones, el desvió de la fuerza del rio hacia mi terreno ha provocado: • erosión constante, • perdida de suelo, • inestabilidad del terreno, • deterioro progresivo de la finca, • alteración continua del entorno, • y riesgo creciente sobre la propiedad. Debe aclararse que estas nuevas afectaciones progresivas sobre los vértices 15, 16, 17 y 18 no se encontraban incorporadas integralmente dentro de las valoraciones iniciales del expediente agrario N.° 21-000108-1520-AG-7, debido a que corresponden a danos posteriores que han continuado avanzando con el paso de los años después de la construcción del dique y demás intervenciones realizadas. En consecuencia, resulta necesario que dentro del proceso agrario se realice una actualización técnica, ampliación o adendum pericial que permita valorar adecuadamente las nuevas afectaciones actuales y el avance progresivo del daño sobre la propiedad. 6.Dilación judicial excesiva El proceso agrario ha sufrido retrasos excesivos e irrazonables relacionados principalmente con dificultades para el nombramiento y aceptación de peritos judiciales. A la fecha han intervenido múltiples posibles peritos, presentándose negativas debido a: • lejanía geográfica, • complejidad técnica del case, • falta de especialización especifica, • y exigencias técnicas adicionales planteadas posteriormente dentro del proceso. Entre otros movimientos del expediente: 10 de abril de 2024: Didier Alexander Miguel García no acepta el cargo. 26 de junio de 2024: Franklin Gerardo Arroyo Solano no acepta el cargo. 27 de setiembre de 2024: Junior Noe Murillo Castro acepta el cargo. 23 de febrero de 2025: se rinde informe pericial. Posteriormente surgieron objeciones y nuevas exigencias técnicas que han provocado más retrasos y dilaciones. Mientras tanto, el daño continúa avanzando sobre mi propiedad.La demora prolongada en asuntos ambientales y de daño progresivo termina convirtiéndose en una forma de denegación de justicia. 7. Omisión institucional y ausencia de respuesta efectiva A pesar de los años transcurridos: • no se han ejecutado medidas urgentes efectivas de protección, • no se ha detenido el avance del daño, • no existe una respuesta definitiva por parte de las autoridades competentes, • y las afectaciones continúan agravándose con cada temporada lluviosa. La inacción institucional ha generado una situación constante de incertidumbre, angustia e indefensión para mi familia. 8. Situación humana actual Mi familia vive bajo preocupación permanente ante el avance progresivo del rio y el deterioro continuo de la propiedad. • Cada invierno representa temor: • temor de perder más terreno, • temor de que el daño continue avanzando, • temor de que las afectaciones alcancen otras áreas de la propiedad, • y temor de permanecer indefensos frente a un problema que continúa creciendo con el paso del tiempo.Resulta profundamente doloroso observar cómo el deterioro avanza lentamente mientras las instituciones responsables no brindan una solución efectiva y oportuna. III. DERECHOS FUNDAMENTALES VIOLADOS Considero vulnerados los siguientes derechos fundamentales: 1. Derecho a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política). 2. Derecho a justicia pronta y cumplida (artículo 41 constitucional). 3. Derecho de propiedad. 4. Derecho a tutela judicial efectiva. 5. Principio de legalidad administrativa. 6. Derecho a la seguridad y protección familiar. 7. Principio precautorio ambiental. IV. FUNDAMENTO JURIDICO El artículo 50 de la Constitución Política reconoce el derecho de toda persona a un ambiente sano y ecológicamente equilibrado, así como la obligación del Estado de garantizar y proteger dicho derecho. El artículo 41 constitucional garantiza el derecho de toda persona a obtener justicia pronta, cumplida y sin denegación.La jurisprudencia constitucional costarricense ha reiterado que la protección ambiental constituye una obligación inmediata de las instituciones públicas y que la dilación injustificada en procesos relacionados con daños ambientales puede constituir violación de derechos fundamentales. Asimismo, el principio precautorio obliga a las autoridades a actuar de manera inmediata cuando exista riesgo de daño progresivo o irreversible. En el presente caso, el daño no es hipotético: continúa avanzando actualmente sobre mi propiedad. V. ACTOS Y OMISIONES IMPUGNADOS Se impugnan: 1. La inacción y omisión del MINAE ante las afectaciones denunciadas. 2. La dilación excesiva del proceso agrario N.° 21-000108-1520-AG-7. 3. La ausencia de medidas urgentes y efectivas de protección. 4. La falta de actualización técnica de las nuevas afectaciones progresivas. 5. La permisividad institucional frente al avance continue del daño ambiental y patrimonial. 6.La vulneración prolongada de derechos fundamentales. VI. PETITORIA Por lo expuesto, solicito respetuosamente a esta honorable Sala Constitucional: 1. Que se declare CON LUGAR el presente recurso de amparo. 2. Que se ordene al MINAE actuar de manera inmediata y efectiva respecto de las afectaciones ambientales denunciadas. 3. Que se ordene al Juzgado Agrario tramitar el expediente N.° 21-000108-1520- AG-7 con carácter urgente y sin más dilaciones injustificadas. 4. Que se ordene la realización de valoraciones técnicas actualizadas sobre las nuevas afectaciones progresivas existentes sobre la propiedad. 5. Que se permita dentro del expediente agrario la incorporación de una actualización técnica, ampliación o adendum pericial respecto de las nuevas afectaciones surgidas con posterioridad a las valoraciones iniciales. 6. Que se dicten medidas urgentes de protección que permitan evitar el avance continue del daño. 7. Que se prevenga a las autoridades recurridas sobre su obligación constitucional de tutela efectiva y protección ambiental”.
  2. 2Por resolución dictada a las 7:42 horas del 8 de junio de 2026, la Presidencia de la Sala previno al recurrente que comparezca ante la Secretaría de esta Sala para firmar el escrito de interposición, por haber omitido hacerlo; o bien, aporte memorial debidamente firmado en el que ratifique el recurso en todos sus extremos. Asimismo, se le solicitó que indique lo siguiente: “• En qué dependencia del Ministerio de Ambiente y Energía (MINAE) se tramita el expediente administrativo “SITADA N.° 16-362 2019”; además, aporte copia completa, legible y con el respectivo comprobante de recibido o de remisión de correo electrónico de la denuncia que planteó ante la autoridad accionada”.
  3. 3Por escritos incorporados al expediente electrónico el 11 de junio de 2026, el recurrente cumplió la prevención.
  4. 4Por resolución de las 12:48 horas del 12 de junio de 2026, la Presidencia de la Sala dio curso al amparo y solicitó informe al director de la Dirección de Aguas y presidente del Tribunal Ambiental Administrativo, ambos del Ministerio de Ambiente y Energía.
  5. 5Por escrito incorporado al expediente electrónico el 17 de junio de 2026, informa bajo juramento Adriana Bejarano Alfaro en su condición de jueza presidenta del Tribunal Ambiental Administrativo. Expone: “ANTECEDENTES: Conforme a los hechos descritos en el presente Recurso de Amparo, se determinó que los mismos se relacionan con el expediente administrativo NO 253-14-01-TAA, del cual es importante extraer los siguientes antecedentes, que describen las actuaciones de este tribunal: PRIMERO: Que el día 29 de julio del 2014, funcionarios de este Tribunal realizaron inspección de oficio al área del Proyecto Hidroeléctrico Bijagua, desarrollado por la Cooperativa de Electrificación Rural de Guanacaste R.L., conocida como COOPEGUANACASTE. R.L. Dicha inspección fue con la finalidad de comprobar la existencia de daños ambientales significativos a los recursos naturales. SEGUNDO: Como resultado de la inspección realizada, se emitió el informe TAA-DT-06914 de fecha 21 de agosto del 2014, suscrito por los funcionarios Biól.Rolando Manfredi Abarca, Ing. Alexis Madrigal Chaves y el Lic. Daniel Morera Blanco, con base en el cual el día 01 de setiembre del año 2014 se procedió a abrir de oficio el expediente NO 253-1401-TAA. (Folio del 01 al 127) TERCERO: El expediente N° 253-14-01-TAA, se abrió con el objetivo de analizar e investigar los siguientes hechos: Que el proyecto cuenta con un Decreto de Conveniencia Nacional e Interés Público, as como obras asociadas en las fases de construcción, operación y mantenimiento, según Decreto No 37732-MINAE. El proyecto tiene un área de 40 ha, según indicaron representantes de la empresa. Dicho decreto les permite realizar la corta, poda o eliminación de árboles de cualquier especie y los vedados que se ubiquen en las áreas de protección, definidas de conformidad con el artículo 33 de la Ley Forestal. Asimismo, indica que el SINAC, dará un tratamiento prioritario y expedito a los trámites realizados, siempre que no se ubiquen en terrenos que sean Patrimonio Natural del Estado.Se realizó una inspección ocular en el área que comprende la etapa constructiva del Proyecto Hidroeléctrico Bijagua, con la finalidad de comprobar la existencia de daños ambientales significativos. En la inspección de campo se pudo observar que se desviaron cauces que se encuentran dentro del área del proyecto, con la finalidad de construir la tora de agua. Este tipo de acción antrópica ocasiona movimientos a grandes cantidades de piedra de diferentes tamaños, así como material granulométrico más pequeño como arena. Este tipo de trabajo se realizó en el cauce del Río Zapote, en donde se construyó un dique. En el recorrido realizado por el área del proyecto se observó que se encuentran varias escombreras, de las cuales se visitaron las denominadas N° 4. N°5. y N° 7 respectivamente. Según manifestaron los encargados de provecto, en el recorrido por la escombrera N° 4 se pudo observar que se realizó un canal perimetral y otros canales secundarios en donde se colocaron varias trampas o sedimentadores para detener el arrastre y la deposición de este material, pero resulta que parte de este sedimento se dirige directamente hacia el ecosistema boscoso, lo que implica que se altere el drenaje natural.En la escombrera N° 5, se pudo observar que no hay obras de conservación de suelos y hay arrastre de sedimentos lo que produce cárcavas en el suelo causadas por la erosión hídrica, luego éstos se depositan en las cunetas a un lado del camino, No se encuentran obras de manejo y conservación de suelos. En la escombrera N° 7, esta se caracteriza por que tiene taludes muy pronunciados y el material se encuentra bastante suelto, además la erosión hídrica provoca que en el suelo se produzcan cárcavas por donde se arrastran los sedimentos, los cuales se van a depositar en el área de protección del Río Bijagua. En algunas partes se colocan trampas c sedimentadores para detener la deposición de sedimentos pero la capacidad de carga de material es mucha por lo que estos se colapsan. En el recorrido realizado por el provecto fue observado la colmatación de varios cuerpos de agua por el arrastre y deposición de sedimentos provocados principalmente por la erosión hídrica, como por ejemplo en el área de protección de la Quebrada Agüero, como en varias alcantarillas que se encuentran en los caminos internos del proyecto que con el tráfico de la maquinaria pesada fluyen los sedimentos hacia un posible cuerpo de agua que va a desembocar al Río Bijagua y posteriormente este al Zapote.En las escombreras visitadas en la inspección de campo no se han tomado medidas en cuanto a la compactación del material depositado, ya que se evidencia una gran cantidad de lodos y el agua empozada, esto provoca que cuando la persona se desplaza por su superficie por el peso y la presión realizada al caminar hace que se hunda en el lodo. No se pudo observar que las escombreras visitadas se hayan reforestado con árboles nativos de la zona, por lo tanto carecen de la cobertura vegetal que en estos casos es muy importante para sostener el material y que este no provoque derrumbes. Lo que sí se pudo observar, con excepción de algunos sitios es el crecimiento de zacate, que por su alta incidencia de germinación, crecimiento rápido y transporte se estaba desarrollando en algunas partes de las escombreras visitadas. En el camino que conduce a la toma de agua del Río Zapote, fue este el único sitio en donde se pudo observar que se habían realizado obras para la conducción del agua pluvial, las cuales se encontraban debidamente impermeabilizadas y con quiebra gradientes para disminuir la velocidad del agua.Como parte de las medidas de compensación el Sr. Torres manifiesta que se están plantando cerca de 12.000 árboles de especies nativas. Es importante que se utilicen especies que sean de crecimiento rápido y de uso múltiple, con la finalidad de retención de la tierra y a la vez sean de beneficios para la conservación del suelo, como por ejemplo árboles o arbustos de la familia Fabaceae (leguminosas) entre otras familias de plantas nativas de la zona. En la inspección ocular realizada en el área del proyecto se pudo observar que son muy pocas las obras de mitigación y conservación de suelos que se han realizado en el área del provecto principalmente en las escombreras, se han construido trampas de sedimento las cuales el día de la visita estaban en su mayoría colapsadas, hay varios drenajes artificiales que van al Río Bijagua pero aparentemente no fueron funcionales pues la cobertura fue removida del sitio posiblemente por la acción del agua.Posiblemente por el poco éxito o no funcionales con la capacidad de carga de sedimentos y la cantidad de agua en escorrentía en varios sectores del proyecto, este sedimento se dirige por la tipógrafa quebrada y las pendientes de los taludes, además aunado a la inercia hacia el cauce de los ríos Zapote y Bijagua, como también hacia un ecosistema boscoso alterando el drenaje natural, por lo tanto se deben de implementar medidas o alternativas para mejorar la retención de sedimentos en las escombreras y evitar la contaminación del agua por partículas, alterando las características fisicoquímicas y biológicas del agua de los diferentes cauces que se encuentran dentro del área del Proyecto Hidroeléctrico Bijagua. El Sr. Torres Regente Ambiental de la empresa constructora menciona que los funcionarios de la Secretarla Técnica Ambiental (SETENA), no realizar inspecciones a las obras desde hace ocho meses aproximadamente, es importante que los funcionarios de la SETENA realicen inspecciones periódicas y realizar los informes respectivos con la finalidad de que la empresa encargada del proyecto esté cumpliendo con los compromisos ambientales adquiridos.CUARTO: Con el objetivo de determinar la verdad real de los hechos denunciados, mediante resolución N° 1146-15-TAA de las ocho horas cinco minutos del día siete de setiembre del dos mil quince, este tribunal resolvió: (Folio 128 al 132) "PRIMERO: Que en el caso que nos ocupa considera este _Despacho de suma importancia para el establecimiento de la verdad real de los hechos denunciados, solicitarle al Ing. Freddy Bolaños Céspedes, o a quien ocupe su cargo en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental, que de conformidad con la denuncia interpuesta mediante oficio No. TAA-DT-069-14, suscrito por los funcionarios de este Tribunal en contra del Proyecto denominado Hidroeléctrico Bijagua, desarrollado por la empresa Coopeguanacaste R.L., de conformidad con sus competencias enviar los correspondientes informes de Auditoria y Seguimiento Ambiental, ya que el proyecto cuenta con la respectiva viabilidad ambiental; proceda a indicar a este Despacho cuáles son los alcances establecidos en dicha viabilidad.Además de ello, indicar si el proyecto a cometido algún tipo de daño ambiental significativo negativo, y si fuese así cuál o cuáles han sido las medidas de mitigación propuestas y si las misma ya fueron aprobadas e implementadas. SEGUNDO: Que en el caso que nos ocupa considera este Despacho de suma importancia para el establecimiento de la verdad real de los hechos denunciados, solicitarle al Ing. Alexander León Campos, o a quien ocupe su cargo, en su condición de Director del Área de Conservación Arenal Tempisque, que de conformidad con la denuncia interpuesta mediante oficio No. TAA-DT-069-2014, en el cual denuncian una serie de irregularidades de carácter ambiental, que se están dando con la construcción del Proyecto Hidroeléctrico Bijagua, por parte de la empresa desarrolladora Coopeguanacaste R.L., que realice una inspección al sitio objeto de la denuncia e informe a este Tribunal, sobre las eventuales afectaciones, así como indicar si está generando daños al ambiente y de qué tipo, si de la inspección se logra detectar daños ambientales significativos negativo, proceder de conformidad a sus competencias a realizar la correspondiente valoración económica del supuesto daño.Otro aspecto que este Tribunal requiere de su análisis es lo correspondiente a las escombreras, si efectivamente la empresa está realizando trabajos de mitigación. TERCERO: Que en el caso que nos ocupa considera este Despacho de suma importancia para el establecimiento de la verdad real de los hechos denunciados, solicitarle al Ing. José Miguel Zeledón Calderón o a quien ocupe su cargo, en su condición de Director de la Dirección de Aguas, que de conformidad con la denuncia interpuesta mediante oficio No TAA-DT-069-2014, en el cual se denuncian una serie de irregularidades de carácter ambiental, que se están dando con la construcción del Proyecto Hidroeléctrico Bijagua, por parte de la empresa desarrolladora Coopeguanacaste R.L que realice una inspección al sitio objeto de la denuncia e informe a este Tribunal si existe algún afectación al recurso hídrico, y si existiera proceder de conformidad con sus competencias a realizar la correspondiente valoración económica del daño ambiental ocasionado al recurso hídrico”.QUINTO: En fecha 10 de marzo del año 2017 ingresó Oficio NO SG-ASA-0166-2017 suscrito por el Lic. Marco Arroyo Flores en el cual indica que efectivamente dicho proyecto cuenta con la respectiva Viabilidad Ambiental otorgada mediante la Resolución No. 27452012-SETENA. Que en el año 2016 inicia operaciones la Central, toma las aguas de los ríos Bijagua y Zapote mediante presas de derivación lateral. Que en enero del año 2017 realizaron una inspección en conjunto con los personeros del PH Bijagua, esto por cuanto a raíz del Huracán Otto dieron muchos daños en tomas, en los diferentes diques de protección así como daños severos en postes de la línea de transmisión por lo que hay varios postes en peligro, mucha fibra óptica dañada en el recorrido de los ríos se puede apreciar gran arrastre de piedras, troncos, árboles y sedimentos, inclusive desviación de los ríos (...) (Folio 137 al 139) SEXTO: Mediante resolución No. 1083-17-TAA de las ocho horas cinco minutos del día veintiséis de julio del dos mil diecisiete, este tribunal solicitó por segunda ocasión al Ing. Alexander León Campos, en su condición de Director del Área de Conservación Arenal Tempisque y al Ing. José Miguel Zeledón Calderón en su condición de Director de la Dirección de Aguas, el cumplimiento de lo requerido en la resolución N° 1146-15-TAA.(Folio 201 a 205) SÉPTIMO: El día 04 de octubre del año 2017, se recibió el oficio NO ACAT-SCM-OC-27817 suscrito por el Ing. Alexander León Campos, en su condición de Director del Área de Conservación Tempisque en el cual informó: 1- El área presenta una serie de obras de infraestructura tendientes al manejo de la erosión de escorrentía y caudales de obras complementarias. Sobre el cauce del río, o dentro de su área de protección, no se logró evidenciar corta de árboles o remoción de vegetación. En ese sector si hubo afectación pero fue a raíz del Huracán Otto dada la cantidad de árboles desraizados. 2- Las áreas aledañas a ese sector, están bien delimitadas con los taludes de los caminos con cobertura vegetal y el cauce totalmente conservado. 3- Se logra determinar que el remanente del cauce natural, muestra buen caudal y está libre de erosión. Las obras ingenieriles construidas, permiten un adecuado control de sedimentos por escorrentías, con taludes en los caminos y canales, muestra cobertura vegetal y no hay afectación a la Ley Forestal. 4- Por lo observado es muy probable que durante la fase constructiva de las obras más relevantes (represa, compuertas. canales para conducción de caudales, tomas de agua etc.) se dieron los impactos fuertes, sin embargo al momento de la inspección esos impactos ya habían sido controlados, minimizando de esta manera a la contaminación por erosión.(Ver folios 211-217). OCTAVO: En fecha 24 de octubre del año 2017, ingresó oficio IN-UHSAN-0079-2017 suscrito por el Ing. Andrés Phillips Ureña, de la Dirección de Agua en el cual informa que: Según se indica en el informe de inspección realizada en el año 2014, se dan los problemas que presentan todos los proyectos hidroeléctricos en su fase constructiva, por lo que suponemos que en la actualidad los aspectos relevantes de la inspección del año 2014, ya han sido corregidas. Las obras en este momento existentes son las que normalmente son necesarias para poder realizar el aprovechamiento del Recurso Hídrico. En cuanto a la valoración económica de daño ambiental en los cuerpos de agua se considera que no existe posibilidad técnica de realizarlos, ya que resulta difícil determinar el posible daño estacional durante el proceso constructivo. (Ver folio 218). NOVENO: Con fundamento en los hechos e informes técnicos brindados por el Área de Conservación Tempisque, la Dirección de Agua y la SETENA, este Tribunal Ambiental luego de un debido análisis, concluyó que el Proyecto Hidroeléctrico Bijagua no había incurrido en incumplimiento a la normativa ambiental y no se logró demostrar una afectación al ambiente, ni al recurso hídrico.Por lo anterior, en la resolución N° 1404-18-TAA de las once horas cincuenta y tres minutos del día dieciocho de diciembre del dos mil dieciocho, procedió a DESESTIMAR la denuncia interpuesta de oficio por este mismo Tribunal, por cuanto no se logró determinar daño ambiental. Contra dicha resolución se otorgaron los recursos de ley. (Ver folio 219 a 228). DÉCIMO: Transcurrido el plazo para la interposición de recursos, sin la presentación de los mismos, este Tribunal en resolución N° 1525-19-TAA de las nueve horas cuarenta y cinco minutos del nueve de setiembre del dos mil diecinueve, procedió al Archivo definitivo del expediente N° 253-14-01-TAA. (Ver folio 231 DÉCIMO PRIMERO: Posterior al archivo del expediente N° 253-14-01-TAA, el día 11 de agosto del 2020, ingresó el oficio DA-UHSAN-0541-2020, mediante el cual la Dirección de Agua presentó un dictamen de cuerpo de agua sobre el río Bijagua y en lo que interesa señaló: (Ver folio 234 a 240).En la resolución 1083-17-TAA del expediente 253-14-01-TAA se menciona que según inspección realizada el 29 de julio del 2014 (etapa de construcción del proyecto hidroeléctrico), se observó desvió de cauces para la toma de agua, colmatación de varios cuerpos de agua por el arrastre y deposición de sedimentos provocados por erosión hídrica, drenajes artificiales que van al Río Bijagua. Según la inspección de campo realizada por el suscrito el día 27 de agosto del 2019. al sitio de estudio la cual se detalló arriba en el presente informe. y según las competencias de la Dirección de Agua, no se identificó lo señalado en la resolución citada, y además no se determinó afectación al recurso hídrico. "DÉCIMO SEGUNDO: El día 11 de agosto del 2020, se presentó en este Tribunal oficio DA-UHSAN-0539-2020, mediante el cual la Dirección de Agua, en atención a la SITADA 16362-2019 presentada por el señor [Nombre 001] Cédula de identidad [Valor 002], contra Coopeguanacaste, por el desvío del rio Zapote, lo cual al desviar el cauce provoca impacto directo del agua en propiedad del recurrente, le informó al señor [Nombre 001] lo siguiente: (Ver folio 241 a 243).Una vez consultado el Registro Nacional de concesiones para el aprovechamiento de aguas y cauces, y el Registro Nacional de Obras en cauce, no se determinó permiso de obra en cauce otorgado por esta Dirección, para los puntos inspeccionados, por lo que se determina de esta forma que, la obra en cauce (dique identificado) no posee el respectivo permiso. En inspección de campo, no se identificó ningún tipo de maquinaria realizando trabajos dentro del cauce del Rio Zapote. No se omite manifestar que en inspección de campo realizada, no fue posible identificar afectación a propiedades de terceros. Ahora bien, al determinarse que no existe permiso otorgado por esta Dirección, para la obra en cauce identificada (dique), es que se procederá a presentar la respectiva denuncia ante el Tribunal Ambiental Administrativo. En revisión de antecedentes relacionados al sitio de estudio se identifica la resolución 1083-17-TAA relacionado al expediente 253-14-01-TAA con denunciado Provecto Hidroeléctrico Bijagua desarrollado por Cooperativa de Electrificación Rural de Guanacaste R.L.COOPEGUANACASTE R.L. Al ubicarse los hechos identificados en inspección de campo realizada por el suscrito. en el área del Proyecto Hidroeléctrico Bijagua. es que se procederá a trasladar de manera formal al Tribunal Ambiental Administrativo los respectivos informes generados por esta Dirección, para que se adjunten como insumo a la denuncia del expediente 253-14-01-TAA. para que dicho Tribunal proceda según corresponda. DÉCIMO TERCERO: A folio 244 a 247 del expediente administrativo, consta que el día 11 de agosto del 2020, la Dirección de Agua presentó el oficio DA-UHSAN-0540-2020, mediante el cual informó a este Tribunal sobre la denuncia SITADA 16362-2019 presentada por el señor [Nombre 001] cédula de identidad [Valor 003] ante esa Dirección de Agua. SOBRE EL RECURSO DE AMPARO: Tal y como se desprende de cada uno de los hechos descritos en los antecedentes del presente oficio de respuesta, el Proyecto Hidroeléctrico Bijagua a nombre de Coopeguanacaste R.L, fue inspeccionado de oficio por este Tribunal y sobre los hechos encontrados al momento de la inspección, se inició una investigación para lo cual se abrió el expediente N° 253-14-01 -TAA.Como parte del procedimiento, se solicitaron informes a las entidades competentes, como lo fue a SINAC, a la Dirección de Agua y a la SETENA. Producto de los informes recibidos y luego del análisis correspondiente, de lo dispuestos por las entidades antes citadas competentes en la materia de la presente denuncia este Tribunal determinó que el Proyecto Hidroeléctrico Bijagua no incumplía con la normativa ambiental, ni generaba afectación al ambiente y al recurso hídrico, por lo que procedió a desestimar la denuncia interpuesta de oficio por este mismo Tribunal, tal y como consta en la resolución N° 1404-18-TAA de las once horas cincuenta y tres minutos del día dieciocho de diciembre del dos mil dieciocho. Una vez firme dicha resolución, lo cual conllevo al archivo definitivo del expediente N° 253-14-01-TAA, mediante la resolución N° 1525-19-TAA de las nueve horas cuarenta y cinco minutos del nueve de setiembre del dos mil diecinueve.Respecto a la denuncia SITADA 16362-2019, cabe aclarar que la misma fue presentada ante la Dirección de Agua por el señor [Nombre 001] cédula de identidad [Valor 002] y si bien, fue remitida a este Tribunal por dicha Dirección, esto fue posterior al archivo definitivo del expediente N O 253-14-01-TAA. En razón de lo anterior, considerando los hechos descritos por el señor [Nombre 001], en el presente Recurso de Amparo, lo procedente es desacumular los oficios DA-UHSAN-0539-2020, DA-UHSAN-0540-2020 y DA-UHSAN-0541-2020 de la Dirección de Agua y abrir un nuevo expediente, con el objetivo de iniciar la investigación de los hechos alegados por la Dirección de Agua y su estado actual, según las competencias de este Tribunal. Dicha desacumulación fue realizada mediante resolución NO 629-2026-TAA de las trece horas quince minutos del día dieciséis de junio del año dos mil veintiséis. FUNDAMENTO DE DERECHO El presente informe se fundamenta en los artículos 1, 2, 3, 11, 59, 60, 103, 108 de la Ley Orgánica del Ambiente, artículos 214, 282, 297, 308, 311 y siguientes de la Ley General de la Administración Pública, artículos 11, 45 de la Ley de Biodiversidad, Decreto Ejecutivo 34136-MINAE Reglamento de Procedimientos del Tribunal Ambiental Administrativo, y los artículos 43 y siguientes de la Ley de la Jurisdicción Constitucional.PETITORIA Conforme a lo anterior, solicito a esta Honorable Sala, se tenga por rendido el informe solicitado, y se declare sin lugar el presente Recurso de Amparo en lo que respecta al Tribunal Ambiental Administrativo”.
  6. 6Por escrito incorporado al expediente electrónico el 19 de junio de 2026, informa bajo juramento José Miguel Zeledón Calderón en su condición de director de Agua del Ministerio de Ambiente y Energía. Expone: “Al respecto hemos de informar que con fecha 27 de agosto del 2019 se realizó inspección en el sitio por parte de funcionarios de la Unidad Hidrológica San Juan de la Dirección de Aguas, a raíz de la denuncia que fuera presentada por el recurrente, por lo que se emitió el informe DA-UHSAN-0539-2020 dirigido al señor [Nombre 001], en el que se informó: o “No se determinó permiso de obra en cauce otorgado por esta Dirección, para los puntos inspeccionados, por lo que se determina de esta forma que, la obra en cauce (dique identificado) no posee el respectivo permiso. o En inspección de campo, no se identificó ningún tipo de maquinaria realizando trabajos dentro del cauce del Río Zapote. o No fue posible identificar afectación a propiedades de terceros. o Al determinarse que no existe permiso otorgado por esta Dirección, para la obra en cauce identificada (dique), es que se procederá a presentar la respectiva denuncia ante el Tribunal Ambiental Administrativo” En vista de que se encontraron obras en cauce que no contaban con permiso, mediante el oficio DA-UHSAN-0540-2020 se remitió al Tribunal Ambiental Administrativo la denuncia correspondiente por la construcción de la obra sin contar con los permisos respectivos.Tal y como se informa en el oficio DA-UHSAN-0614-2026, del 18 de junio del 2026, “la eventual determinación de responsabilidades respecto de la persona física o jurídica vinculada a la intervención identificada, así como la definición de las medidas correctivas, restaurativas o de remoción que resulten procedentes para atender los efectos asociados a dicha obra, corresponde ser valorada y resuelta dentro del procedimiento administrativo establecido. Así mismo corresponde a dicho procedimiento determinar tanto la participación de los involucrados como las medidas que, en su caso, deban ser asumidas por quienes resulten responsables de la intervención o de sus efectos sobre el recurso hídrico.” Es claro que la actuación de la Dirección de Agua en el caso en concreto, de atención de denuncia y visita al sitio, se hizo de manera oportuna, remitiendo la denuncia correspondiente al Tribunal Ambiental Administrativo para que se conociera de la infracción por la construcción de la obra en cauce y se dictaran las medidas correctivas correspondientes.Importante señalar que para efectos de atender lo señalado por el recurrente, sobre supuestas afectaciones directas a la propiedad del denunciante por el dique construido en propiedad de Coopeguanacaste, se tiene lo siguiente según el oficio citado: “• El denunciante no aporta evidencia técnica de lo alegado. • Realizado geoprocesamiento mediate sistemas de información geográfico implementando la herramienta Quantum GIS (QGIS) fue posible: o Identificar los puntos en estudio conforme el cuadro 1 del oficio DA-UHSAN-0539-2020 (puntos rojos 20, 21 y 22 visibles en figura 1.). A. DA-UHSAN-0539-2020: indicó que el dique se ubicó en los puntos 22 y 21. o Identificar la finca 360333 conforme los servicios OGC disponibles en el Sistema Nacional de Información Territorial (SNIT) del Registro Nacional sobre el Registro Inmobiliario el cual contienen el Mapa Catastral de Costa Rica, específicamente la zona 2 (ver figura 1). o Identificar imágenes aéreas disponibles del sitio en estudio: A. Mosaico Ortofotos 1:5 mil 2014-2017: Disponible en el SNIT: Capa raster que muestra el mosaico de las ortofotos tomadas entre los años 2014 y 2017 a escala 1:5.000, en el marco del Proyecto denominado “Contratación para la toma de imágenes y producción de ortoimágenes y cartografía digital de todo el Territorio Nacional” (figura 2.Imagen A.) B. ESRI Satellite: Imágenes históricas de ESRI. Wayback Imagery capturada el 27/3/2017. (figura 2. Imagen B. y Figura 1 de Anexos) C. Google Satellite: Imágenes históricas disponibles en Google Earth Pro. Fecha de imagen: 4/7/2025 (figura 2. Imagen C y Figura 2 de Anexos). Del análisis comparativo de las ortofotografías históricas disponibles (Figura 2. A, B y C) se observa: • En la imagen A (2014-2017) el área de estudio presentaba una cobertura vegetal arbórea continua en gran parte del sector analizado. • En la imagen B (27/3/2017) se evidencia una reducción significativa de dicha cobertura, acompañada de una mayor exposición del suelo y de sedimentos depositados en la planicie adyacente al cauce. o Es importante considerar la hipótesis de que la variación observada podría estar asociada a la ocurrencia de eventos hidrometeorológicos extremos. En este sentido, destaca el huracán Otto, ocurrido en noviembre de 2016, el cual generó importantes procesos de inundación, erosión y movilización de sedimentos en distintos sectores de la Región Norte. • En la imagen C (4/7/2025) se aprecia un proceso de regeneración natural de la cobertura vegetal, incremento de la densidad y extensión de la vegetación respecto a la condición previa registrada.Las obras denunciadas por el recurrente corresponden al año 2019. Sin embargo, del análisis fotointerpretativo efectuado se identificó que las variaciones del cauce y las áreas desprovistas de cobertura vegetal observadas en el sector ya se encontraban presentes en imágenes captadas con anterioridad a dicha intervención. Las imágenes aéreas históricas disponibles para el año 2025 evidencian la presencia de cobertura vegetal en el sector donde se alega una afectación progresiva y continua del terreno señalado, sin que de ellas pueda evidenciarse una pérdida progresiva y continua de la superficie boscosa atribuible de manera directa a la obra denunciada En consecuencia, la información analizada no permite acreditar técnicamente que las afectaciones alegadas por el recurrente correspondan a un proceso progresivo atribuible a la obra denunciada, ni establecer una relación causal directa entre dicha intervención y los daños reclamados sobre la propiedad.Por lo anterior, aun cuando la existencia de una obra sin autorización motivó las actuaciones administrativas correspondientes, ello no permite concluir técnicamente que las afectaciones reclamadas sean consecuencia directa y exclusiva de dicha intervención”. PETITORIA Conforme lo informado, y análisis técnico realizado según oficio DA-UHSAN-0614 2026 adjunto y ante la falta de evidencia por parte del recurrente, solicitamos se declare sin lugar el presente recurso de amparo presentado contra esta Dirección, toda vez, que la actuación de la misma ha sido oportuna y diligente y se archive el expediente”.
  7. 7En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Cuestión previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia ambiental la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo.

II.Objeto del recurso. El recurrente alega que es propietario de la finca matricula nro. 2-360333-000, ubicada en Canalete de Upala, Alajuela, destinada a actividades agrícolas y pecuarias, localizada en una zona influenciada por el río Zapote. Indica que en el año 2019 la empresa Coopeguanacaste realizó diversas obras para proteger infraestructura propia cercana al río, incluyendo movimientos de tierra, tala de árboles, apertura de accesos, construcción de cunetas, colocación de concreto y construcción de diques, lo cual generó alteraciones en el cauce y comportamiento natural del río. Señala que dichas intervenciones provocaron modificaciones importantes sobre la dinámica y dirección de la fuerza del rio Zapote. Manifiesta que, ante la gravedad de los hechos interpuso denuncia ante el MINAE bajo el expediente SITADA N.º 16-362-2019, lo que permitió a las autoridades conocer las intervenciones y sus posibles efectos ambientales.

Menciona que esa denuncia fue remitida del SINAC de Upala a la dirección de Aguas del Ministerio de Ambiente y Energía, donde se realizaron inspecciones de campo, emitieron informes y trasladaron el caso al Tribunal Ambiental Administrativo. Sostiene que, a la fecha en la que acude en amparo, no se han adoptado medidas efectivas para detener el daño ni se ha brindado una respuesta oportuna, lo que ha generado una situación continua de afectación a su propiedad, así como incertidumbre y preocupación para su núcleo familiar. Solicita la intervención de la Sala.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 6 de agosto de 2019, el recurrente interpuso una denuncia ante la subregión Upala-Guatuso del SINAC, por los siguientes hechos: “Según indica el informe la empresa Coope Guanacaste desvía el río Zapote y construye un dique con materiales del mismo río (piedras) al desviar el cause provoca impacto directo del agua en propiedad del Recurrente” (véase prueba aportada).
  • b)El 8 de agosto de 2019, la denuncia del recurrente fue trasladada a la dirección de Aguas del Ministerio de Ambiente y Energía (véase prueba aportada).
  • c)Por oficio DA-UHSAN-0539-2020 del 10 de agosto de 2020, emitido por la dirección de Aguas del MINAE dirigido al denunciante, se indicó: “ (…) No se determinó permiso de obra en cauce otorgado por esta Dirección, para los puntos inspeccionados, por lo que se determina de esta forma que, la obra en cauce (dique identificado) no posee el respectivo permiso. - En inspección de campo, no se identificó ningún tipo de maquinaria realizando trabajos dentro del cauce del Río Zapote. -No fue posible identificar afectación a propiedades de terceros. -Al determinarse que no existe permiso otorgado por esta Dirección, para la obra en cauce identificada (dique), es que se procederá a presentar la respectiva denuncia ante el Tribunal Ambiental Administrativo”. (véase informe rendido bajo juramento).
  • d)Por oficio DA-UHSAN-0540-2020 del 10 de agosto de 2020 emitido por la dirección de Aguas del MINAE dirigido al Tribunal Ambiental Administrativo, se indicó: “En atención a denuncia SITADA 16362-2019, presentada por el señor [Nombre 001] cédula de identidad [Valor 003], donde indica como imputado a Coopeguanacaste, y denuncia sobre obras en cauce del río Zapote, es que se le indica: Se realizó inspección de campo por parte del suscrito el día 27 de agosto del 2019. Producto de dicha inspección se generó el informe DA-UHSAN-0539-2020, el cual se adjunta al presente informe. Se determina la presencia de obras en cauce de dominio público (dique descrito en oficio supra). Para dicha obra no se registra permiso otorgado por esta Dirección, por lo que se determina afectación al recurso hídrico. Debido a lo anterior, es que se le traslada respetuosamente la presente denuncia para lo que corresponda. En revisión de antecedentes relacionados al sitio de estudio, se identifica la resolución 1083-17-TAA relacionado al expediente 253-14-01-TAA con denunciado Proyecto Hidroeléctrico Bijagua desarrollado por Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Al ubicarse los hechos identificados en inspección de campo realizada por el suscrito, en el área del Proyecto Hidroeléctrico Bijagua, es que se procede a trasladar de manera formal al Tribunal Ambiental Administrativo los respectivos informes generados por esta Dirección, para que se adjunten como insumo a la denuncia del expediente 253-14-01-TAA, para que dicho Tribunal proceda según corresponda. Adicionalmente se presenta a continuación la valoración económica del daño ambiental” (véase informe rendido bajo juramento y prueba aportada).
  • e)La resolución de curso del amparo fue notificada al presidente del Tribunal Ambiental Administrativo el 12 de junio de 2026 y al director de la dirección de Aguas del MINAE el 16 de junio de 2026 (véanse actas de notificación).
  • f)Por resolución nro. 629-2026-TAA de las 13:15 horas del 16 de junio de 2026, las autoridades del Tribunal Ambiental Administrativo desacumularon los oficios DA-UHSAN-0539-2020, DA-UHSAN-0540-2020 y DA-USHAN-0541-2020 del expediente nro. 253-14-01-TA para abrir un nuevo expediente, con el objetivo de iniciar la investigación de los hechos alegados por la Dirección de Agua (véase informe rendido bajo juramento).

IV.Sobre el caso concreto. En el sub lite, el recurrente alega que es propietario de la finca matricula nro. 2-360333-000, ubicada en Canalete de Upala, Alajuela, destinada a actividades agrícolas y pecuarias, localizada en una zona influenciada por el río Zapote. Indica que en el año 2019 la empresa Coopeguanacaste realizó diversas obras para proteger infraestructura propia cercana al río, incluyendo movimientos de tierra, tala de árboles, apertura de accesos, construcción de cunetas, colocación de concreto y construcción de diques, lo cual generó alteraciones en el cauce y comportamiento natural del río. Señala que dichas intervenciones provocaron modificaciones importantes sobre la dinámica y dirección de la fuerza del rio Zapote. Manifiesta que, ante la gravedad de los hechos interpuso denuncia ante el MINAE bajo el expediente SITADA N.º 16-362-2019, lo que permitió a las autoridades conocer las intervenciones y sus posibles efectos ambientales.

Menciona que esa denuncia fue remitida del SINAC de Upala a la dirección de Aguas del Ministerio de Ambiente y Energía, donde se realizaron inspecciones de campo, emitieron informes y trasladaron el caso al Tribunal Ambiental Administrativo. Sostiene que, a la fecha en la que acude en amparo, no se han adoptado medidas efectivas para detener el daño ni se ha brindado una respuesta oportuna, lo que ha generado una situación continua de afectación a su propiedad, así como incertidumbre y preocupación para su núcleo familiar. Solicita la intervención de la Sala.

Al respecto, de la relación de hechos probados se desprende que el 6 de agosto de 2019, el recurrente interpuso una denuncia ante la subregión Upala-Guatuso del SINAC, por los siguientes hechos: “Según indica el informe la empresa Coope Guanacaste desvía el río Zapote y construye un dique con materiales del mismo río (piedras) al desviar el cause provoca impacto directo del agua en propiedad del Recurrente”. El 8 de agosto de 2019, la denuncia del recurrente fue trasladada a la dirección de Aguas del Ministerio de Ambiente y Energía. Por oficio DA-UHSAN-0539-2020 del 10 de agosto de 2020, emitido por la dirección de Aguas del MINAE dirigido al denunciante, se indicó: “ (…) No se determinó permiso de obra en cauce otorgado por esta Dirección, para los puntos inspeccionados, por lo que se determina de esta forma que, la obra en cauce (dique identificado) no posee el respectivo permiso. - En inspección de campo, no se identificó ningún tipo de maquinaria realizando trabajos dentro del cauce del Río Zapote. -No fue posible identificar afectación a propiedades de terceros. -Al determinarse que no existe permiso otorgado por esta Dirección, para la obra en cauce identificada (dique), es que se procederá a presentar la respectiva denuncia ante el Tribunal Ambiental Administrativo”.

Por oficio DA-UHSAN-0540-2020 del 10 de agosto de 2020, emitido por la dirección de Aguas del MINAE y dirigido al Tribunal Ambiental Administrativo, se indicó: “En atención a denuncia SITADA 16362-2019, presentada por el señor [Nombre 001] cédula de identidad [Valor 003], donde indica como imputado a Coopeguanacaste, y denuncia sobre obras en cauce del río Zapote, es que se le indica: Se realizó inspección de campo por parte del suscrito el día 27 de agosto del 2019. Producto de dicha inspección se generó el informe DA-UHSAN-0539-2020, el cual se adjunta al presente informe. Se determina la presencia de obras en cauce de dominio público (dique descrito en oficio supra). Para dicha obra no se registra permiso otorgado por esta Dirección, por lo que se determina afectación al recurso hídrico. Debido a lo anterior, es que se le traslada respetuosamente la presente denuncia para lo que corresponda.

En revisión de antecedentes relacionados al sitio de estudio, se identifica la resolución 1083-17-TAA relacionado al expediente 253-14-01-TAA con denunciado Proyecto Hidroeléctrico Bijagua desarrollado por Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Al ubicarse los hechos identificados en inspección de campo realizada por el suscrito, en el área del Proyecto Hidroeléctrico Bijagua, es que se procede a trasladar de manera formal al Tribunal Ambiental Administrativo los respectivos informes generados por esta Dirección, para que se adjunten como insumo a la denuncia del expediente 253-14-01-TAA, para que dicho Tribunal proceda según corresponda. Adicionalmente se presenta a continuación la valoración económica del daño ambiental”. La resolución de curso del amparo fue notificada al presidente del Tribunal Ambiental Administrativo el 12 de junio de 2026 y al director de la dirección de Aguas del MINAE el 16 de junio de 2026.

Por resolución nro. 629-2026-TAA de las 13:15 horas del 16 de junio de 2026, las autoridades del Tribunal Ambiental Administrativo desacumularon los oficios DA-UHSAN-0539-2020, DA-UHSAN-0540-2020 y DA-USHAN-0541-2020 del expediente nro. 253-14-01-TA para abrir un nuevo expediente, con el objetivo de iniciar la investigación de los hechos alegados por la Dirección de Agua.

Así las cosas, en cuanto a la dirección de Aguas del MINAE no se observa acción u omisión que resulte lesiva de los derechos fundamentales del recurrente, en tanto dieron trámite y respuesta a la denuncia del tutelado desde 2020, mediante oficio DA-UHSAN-0539-2020 del 10 de agosto de 2020. Además, trasladaron el caso del amparado al Tribunal Ambiental Administrativo mediante oficio DA-UHSAN-0540-2020 del 10 de agosto de 2020 para lo correspondiente.

Ahora bien, en cuanto al Tribunal Ambiental Administrativo, consta que desde el 10 de agosto de 2020 les fue trasladada la denuncia del tutelado; sin embargo, según se desprende del informe rendido bajo juramento, fue por resolución nro. 629-2026-TAA de las 13:15 horas del 16 de junio de 2026 -casi seis años después y con posterioridad a la notificación del curso de este amparo- que las autoridades del Tribunal Ambiental Administrativo desacumularon los oficios DA-UHSAN-0539-2020, DA-UHSAN-0540-2020 y DA-USHAN-0541-2020 del expediente nro. 253-14-01-TA para abrir un nuevo expediente, con el objetivo de iniciar la investigación de los hechos alegados por la Dirección de Agua en relación con la denuncia del tutelado.

En mérito de lo expuesto, estima esta Sala que se ha producido una dilación indebida y un retardo injustificado que vulnera el derecho fundamental a un procedimiento administrativo pronto y cumplido de la parte amparada, consagrado en el artículo 41 de la Constitución Política. Así las cosas, en virtud de que a la fecha de interposición del presente recurso, el proceso en cuestión todavía no ha sido resuelto por el Tribunal Ambiental Administrativo recurrido, lo procedente es acoger el recurso, con las consecuencias que se indican en la parte dispositiva de esta sentencia.

V.El magistrado Castillo Víquez pone nota. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia, pues las controversias jurídico-constitucionales que atañen a menores de edad, al ambiente, pago de salario, al pago de las prestaciones cuando la persona se jubila, a las pensiones del régimen no contributivo y los casos de parálisis cerebral profunda, discapacitados, extranjeros que se encuentran fuera del país, servicio de agua potable, adultos mayores cuando no se refiere a cuestiones de su pensión, denuncias de corrupción, derecho de los indígenas, reclamos por la falta de aseguramiento ante la Caja Costarricense de Seguro Social y de licencias de maternidad son de conocimiento de esta jurisdicción a través del proceso constitucional de garantía del amparo.

En los demás casos, y por las razones que se dan en esta sentencia, los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25 de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VI.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso, únicamente en cuanto al Tribunal Ambiental Administrativo. Se le ordena a Adriana Bejarano Alfaro en su condición de jueza presidenta del Tribunal Ambiental Administrativo, o a quien ocupe ese cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias respectivas, para que en el plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se resuelva de forma definitiva el caso que fue trasladado mediante oficio nro. DA-UHSAN-0540-2020 del 10 de agosto de 2020, en relación con la denuncia ambiental incoada por el tutelado, y se le notifique lo resuelto. Se advierte a las autoridades recurridas, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

En cuanto a la dirección de aguas del MINAE, se declara sin lugar el recurso. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. El magistrado Castillo Víquez consigna nota. Notifíquese.
