Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours thirty minutes on the sixth of August, two thousand twenty-six.

Amparo petition (recurso de amparo) processed under case file No. 26-023694-0007-CO, filed by [Nombre 001], national identity card number (cédula de identidad) [Valor 001], against the ASAMBLEA LEGISLATIVA.

Recitals:

  1. 1By written submission received at the Chamber's Secretariat on July 1, 2026, the petitioner files an amparo petition against the ASAMBLEA LEGISLATIVA. He states that on July 15, 2026, through the email address [email protected], he formally requested the following information from the respondent: "(…) 1 – With respect to compliance with Ley Forestal N.° 7575 and Ley de Aguas N.° 276: 1 - Does the infrastructure of the establishment [Nombre 002] comply with the setback distances of one hundred meters within the radius of permanent springs (nacientes permanentes) and fifteen meters along the riverbanks (riberas) of adjacent rivers and streams (Article 33 of Ley Forestal N.° 7575)? 2 – More specifically: Is the property or any part of its commercial infrastructure built within a radius of two hundred (200) meters of a freshwater spring (naciente) currently being captured by the local community water-system association (ASADA) or rural water system (acueducto rural) for human population consumption, as strictly and inviolably required by Ley de Aguas N.° 276 and public health regulations?Please certify the exact distance to the nearest community spring. 3 – Provide a digital copy of the topographic demarcations (delimitaciones topográficas) and official alignments (alineamientos oficiales) issued for said property by ICE and SINAC-MINAE. II. With respect to Groundwater Extraction and Wells (Aprovechamiento de Aguas Subterráneas y Pozos): 4. In the event that the hotel, restaurant, or its swimming pools are supplied by a water well located on the property, please indicate the drilling case-file number, the groundwater extraction concession (Concesión de Aprovechamiento de Aguas Subterráneas) number granted by the MINAE Water Directorate, and the maximum authorized flow rate (caudal máximo autorizado). If no such concession exists, detail the legal source of the water resource used in the commercial operation. III. With respect to Urban Planning Legality (Municipalidad de Tilarán): 5.Provide a complete copy of the land-use classification (Uso de Suelo) and final building permits (Permisos de Construcción) granted for this commercial complex. 6. Detail the numerical ratio of square meters actually constructed on the site versus the number of square meters that were approved and assessed by the municipal engineering department. (…)" (sic). In response to this request, the respondent Representative issued a manifestly poor, incomplete, evasive, and deficient reply, leaving the specific technical points requested without a precise answer, attempting to unlawfully shift the burden of proof to the citizen or evading the substance of what was requested, which constitutes a material denial of access to public information that remains ongoing as of the date of filing of this petition (see the evidence submitted to the case file).
  2. 2By order issued at 16:52 hours on July 22, 2026, the present petition was admitted for processing.
  3. 3CINDY MURILLO ARTAVIA, in her capacity as REPRESENTATIVE (DIPUTADA) OF THE REPUBLIC OF COSTA RICA, reports under oath as follows: "… ONE. The petitioner [Nombre 001] requests information directly related to the commercial establishment known as [Nombre 002]. Among the information requested are references to provisions of the Ley Forestal, the Ley de Aguas, ICE and SINAC–MINAE, as well as the local ASADA where said establishment is located, the MINAE Water Directorate, and the Municipalidad de Tilarán. In this regard, it must be noted that virtually all of the information requested by the petitioner should be contained in the case files processed or registered by the various institutions mentioned above, which hold the necessary competence to provide certified, reliable, and pertinent information. TWO. As set out above, it falls upon the mentioned administrative entities to respond to the different information requests submitted by the petitioner.In my capacity as a public official (funcionaria pública), Representative of the Republic, I do not possess the records, nor the authority or competence, required to provide the information or certify what may be appropriate. Accordingly, where relevant, the petitioner must direct his requests to the appropriate institutions. THREE. On another matter, I must note that the commercial establishment identified by the petitioner belongs to a corporation (sociedad anónima) of which I am not a member, whether as a shareholder, legal representative, or attorney-in-fact (apoderada), which I declare under oath and having been duly warned of the penalties that the law imposes for perjury. In this regard, I submit a certificate of legal standing (personería) to confirm my statement, which is why I am also unable to claim a legal representation that I do not hold, nor is it my place to address the information request made by the petitioner.FORMAL OBJECTIONS. From the foregoing it can be concluded with certainty that I am not the appropriate party to respond on matters related to the records of various administrative entities, and even less so to act on behalf of the corporate owner of the commercial establishment at issue in this matter. On the basis of the foregoing, I formally raise the objections of Lack of Legal Basis (Falta de Derecho) and Lack of Passive Standing (Falta de Legitimación Pasiva) against the petition filed against me."
  4. 4The required legal formalities have been observed throughout these proceedings.

Opinion drafted by Justice Hess Herrera; and,

Considering:

I. PRELIMINARY MATTER

Given that CINDY MURILLO ARTAVIA, in her capacity as REPRESENTATIVE OF THE REPUBLIC OF COSTA RICA, failed to indicate whether the email address used by the petitioner to request the information is officially authorized as a channel for submitting such requests, pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, that status of the email address is deemed established, and the constitutionality of the matter is analyzed on the basis of the elements submitted to the case file.

II. SUBJECT OF THE PETITION

The petitioner claims that the respondent Representative provided an incomplete, evasive, and deficient response to his request for information concerning compliance with environmental, water, and urban planning regulations by the establishment [Nombre 002], which he considers to be a violation of his right of access to public information.

III. ESTABLISHED FACTS

The following facts are considered duly established for the purposes of deciding this matter, either because they have been duly certified or because the respondent failed to address them, as required in the initial order (auto inicial):

  • a)On June 15, 2026, at 11:22 hours, [Nombre 001], from the email address [...], sent an email to [email protected], with the subject line "Diputada Cindy Murillo Artavia.pdf" and an attached file. On that occasion, the following was requested: "(…) 1 – With respect to compliance with Ley Forestal N.° 7575 and Ley de Aguas N.° 276: 1 - Does the infrastructure of the establishment [Nombre 002] comply with the setback distances of one hundred meters within the radius of permanent springs and fifteen meters along the riverbanks of adjacent rivers and streams (Article 33 of Ley Forestal N.° 7575)? 2 – More specifically: Is the property or any part of its commercial infrastructure built within a radius of two hundred (200) meters of a freshwater spring currently being captured by the local ASADA or rural water system for human population consumption, as strictly and inviolably required by Ley de Aguas N.° 276 and public health regulations?

  • b)On June 29, 2026, at 12:45 hours, CINDY MURILLO ARTAVIA, from the email address [email protected], sent a reply to [Nombre 001], at the address [...], in the following terms: "Dear Mr. [Nombre 001]. Resident (munícipe) of Grecia. With my highest regards: I greet you warmly and respond to your inquiry dated June 15, 2026, as set out below:

1- Regarding the information that has circulated publicly about my support and favorable vote on the bill recently approved and related to the Embalse Arenal area, Guanacaste; I inform you that these matters are currently the subject of an ongoing judicial investigation. 2- In strict adherence to Article 295 of the Code of Criminal Procedure (Código Procesal Penal), the proceedings at this preparatory stage are private in nature as regards third parties, and I am therefore legally precluded from providing public details in this regard. 3- I maintain full conviction that my actions have been in strict compliance with the law and the norms of this country, which will be duly established before the appropriate authorities …" (see attached evidence).

IV. ON THE RIGHT OF PETITION AND PROMPT RESPONSE

The right of petition and prompt response (derecho de petición y pronta respuesta), protected under Articles 27 of the Constitution (Constitución Política) and 32 of the Ley de la Jurisdicción Constitucional, obliges public officials to resolve requests submitted by citizens within ten business days from the date of submission of such requests, in the absence of any other prescribed time limit for a reply. However, the cited Article 32 also provides that, in deciding on the petition, the Chamber shall consider the reasons advanced to show that this period is insufficient, taking into account the circumstances and the nature of the matter, in which case the Administration is always obligated to inform the petitioner of the reasons for the delay in issuing a response. In any event, the duty to respond does not entail the receipt of a favorable outcome, but it does require necessary congruence between the subject matter of what was requested and what was answered.

V. ON THE SPECIFIC CASE

The petitioner alleges that the respondent Representative violated his fundamental rights of petition, prompt response, and access to public information, on the grounds that the reply provided to his request was incomplete, evasive, and deficient with respect to the specific technical points consulted. Specifically, he requested information concerning compliance with forest, water, and urban planning regulations by the establishment known as [Nombre 002], including certification of distances from springs and watercourses, topographic demarcations, official alignments, concessions for groundwater extraction, building permits, land-use classification, and the ratio between areas actually built and areas authorized.

Article 27 of the Constitution recognizes every person's right to address petitions to public authorities and to receive a prompt response. This guarantee imposes on the recipient authority the duty to consider the request and provide a response within a reasonable period; however, it does not mean that the response must necessarily be favorable or that the authority is obligated to grant what is requested. What the Constitution demands is that the request not be ignored and that the authority's position be communicated in a timely manner, regardless of whether it coincides with the petitioner's wishes. Constitutional jurisprudence has distinguished, in this respect, between the right to submit a petition and receive a response, on the one hand, and an alleged right to necessarily receive what was requested, on the other, since the latter is not encompassed within the constitutional guarantee.

In turn, the right enshrined in Article 30 of the Constitution guarantees access to information of public interest held by public bodies and entities. Its purpose is to enable individuals to know about and monitor administrative activity; nonetheless, its exercise presupposes that the information requested exists and is held, generated, received, or maintained by the entity to which the request is addressed.

In harmony with the foregoing, the Framework Law on Access to Public Information (Ley Marco de Acceso a la Información Pública) establishes that requests may be submitted by electronic means and that public information must generally be delivered within ten business days. It also classifies as pre-constituted public information (información pública preconstituida) that which already exists in the physical or digital records of the Administration and is readily accessible. It follows that the right of access applies to information that exists and is available in the archives of the obligated entity (sujeto obligado), but does not impose on the authority the duty to create non-existent documents, conduct special investigations, perform topographic measurements, produce technical studies, issue certifications on matters outside its competence, or compile information that is dispersed across the records of different institutions.

In the specific case, it is established that the request was submitted on June 15, 2026, at 11:22 hours, to the institutional email address of the respondent Representative. It is also on record that on June 29, 2026, at 12:45 hours, she sent a reply to the email address provided by the requester. Therefore, ten business days elapsed between the submission of the request and its response, meaning the request was attended to within the legally established time period and, moreover, prior to the filing and notification of this amparo petition. No situation of silence, abandonment, unjustified delay, or complete absence of response attributable to the respondent can therefore be found.

Nor is there any effective dispute regarding the receipt of the request via the email address used. Although the respondent failed to expressly state in her report whether that address was formally authorized as a channel for submitting information requests, the fact remains that she received the message, was aware of its contents, and replied from that same institutional address. Accordingly, any discussion regarding the formal authorization of the medium used has no material bearing on the resolution of this matter, since the message achieved its purpose and the petition was effectively processed.

It does not escape this Chamber's notice, however, that the reply of June 29, 2026, did not develop with sufficient clarity and precision the specific reasons why the Representative was unable to supply each of the documents and technical data requested. Indeed, that reply addressed mainly the existence of a judicial investigation related to her support and favorable vote on a bill concerning the Embalse Arenal area, as well as the private nature of preparatory proceedings. Those statements do not have a direct bearing on all of the environmental, water, and urban planning points raised by the requester.

Nevertheless, that argumentative insufficiency is not, under the particular circumstances of this case, sufficient to conclude that a material denial of the right of access to public information occurred. The sworn report establishes that the respondent Representative does not hold the records, case files, or technical background information requested, and lacks the legal authority to carry out the verifications or issue the certifications sought. She explained that such information should be found, depending on its nature, with the Instituto Costarricense de Electricidad, the Sistema Nacional de Áreas de Conservación, the Ministerio de Ambiente y Energía, the Water Directorate, the local water-system association, or the Municipalidad de Tilarán.

Likewise, the respondent declared under oath that she is not a member of the corporation that owns the commercial establishment, whether as a shareholder, legal representative, or attorney-in-fact, and submitted a certificate of legal standing to support that statement. There is no evidence on the record that permits the conclusion that Ms. Murillo Artavia personally holds the required administrative case files, that they form part of the archives of her legislative office (despacho legislativo), or that, by virtue of her position, she holds the competence to certify distances from springs, topographic alignments, water extraction concessions, municipal permits, or the number of square meters built.

The mere fact that the Representative had supported or voted in favor of a bill related to the Embalse Arenal area does not make her the custodian of all technical, environmental, urban planning, or registry case files relating to commercial establishments located in that region. The legislative function exercised with respect to a bill does not displace the competences legally assigned to environmental, municipal, water, or technical authorities, nor does it impose on each legislator the obligation to maintain and certify the administrative records produced by those bodies.

Thus, granting the petitioner's request would entail ordering the respondent to deliver or certify information that, according to the sworn report and the evidence incorporated into the case file, is not in her possession. Such an order would be materially and legally impermissible, given that the right of access to public information does not authorize demanding that an authority produce information that does not exist in its archives, substitute for technically competent bodies, or assume certifying powers that the legal system does not confer upon it.

It must be recalled that a negative response, grounded in the non-existence of the information in the authority's possession or in the lack of competence to produce it, does not in itself constitute a constitutional violation. A violation would arise if the authority failed to respond, unjustifiably delayed its reply, concealed information it actually holds, or denied delivery in whole or in part without providing justification. The Ley Marco de Acceso a la Información Pública expressly provides for constitutional protection against ambiguous or partial responses that, without justification, materially constitute a denial; however, in this matter, the sworn report establishes that there was no withholding or concealment of public documentation in the Representative's possession, but rather an inability to supply records belonging to other administrations.

Accordingly, the petitioner must direct his requests — should he choose to do so — to the institutions that, by virtue of their competences, produce, receive, and maintain the required information.

Therefore, given that the respondent Representative attended to the request within the legal time period, prior to the filing of this amparo petition, and that it has not been demonstrated that she retained the requested information in her possession or concealed public documentation under her custody, no violation of the fundamental rights of petition, prompt response, and access to public information is found. The failure to satisfy the petitioner's request is attributable to the fact that he directed his request to an authority that does not hold the relevant background information and lacks the technical competence required to produce or certify it, and not to any omissive or arbitrary conduct on the part of the respondent. On the merits of the foregoing, the petition must be dismissed.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioning party is hereby notified that, if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, they must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within this period will be destroyed, pursuant to the provisions of the Reglamento sobre Expediente Electrónico ante el Poder Judicial, approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial No. 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, Article LXXXI.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente No. 26-023694-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASAMBLEA LEGISLATIVA.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 01 de julio de 2026, el recurrente interpone recurso de amparo contra la ASAMBLEA LEGISLATIVA. Manifiesta que el 15 de julio de 2026, mediante la dirección electrónica [email protected], solicitó formalmente a la recurrida la siguiente información: “(…) 1 – Con respecto al cumplimiento de la Ley Forestal N.° 7575 y Ley de Aguas N.° 276: 1 - ¿Cumple la infraestructura del establecimiento [Nombre 002] con las distancias de retiro de cien metros en el radio de nacientes permanentes y quince metros en las riberas de ríos/quebradas adyacentes (Artículo 33 de la Ley Forestal N.° 7575)? 2 – De forma específica: ¿Se encuentra el inmueble o parte de su infraestructura comercial construido dentro del radio de doscientos (200) metros de alguna naciente de agua dulce que esté siendo captada por la ASADA local o acueducto rural para el Consumo Humano Poblacional, tal como lo exige de forma estricta e inviolable la Ley de Aguas N.° 276 y la normativa de salud pública?Sírvase certificar la distancia exacta a la naciente comunitaria más cercana. 3 – Aporte copia digital de las delimitaciones topográficas y alineamientos oficiales extendidos para dicho predio por el ICE y el SINAC-MINAE. II. Con respecto al Aprovechamiento de Aguas Subterráneas y Pozos: 4. En caso de que el hotel, restaurante o sus piscinas se abastezcan mediante un Pozo de Agua ubicado dentro de la propiedad, sírvase indicar el número de expediente de perforación, el número de Concesión de Aprovechamiento de Aguas Subterráneas otorgado por la Dirección de Agua del MINAE y el caudal máximo autorizado. De no contar con dicha concesión, detalle el origen legal del recurso hídrico utilizado en la operación comercial. III. Con respecto a la Legalidad Urbanística (Municipalidad de Tilarán): 5. Remita copia íntegra del Uso de Suelo y de los Permisos de Construcción definitivos otorgados para este complejo comercial.6.Detalle la relación numérica de metros cuadrados efectivamente construidos en el sitio versus la cantidad de metros cuadrados que fueron aprobados y tasados ante el departamento de ingeniería municipal. (…)” (sic). Ante tal solicitud, la Diputada recurrida emitió una respuesta manifiestamente pobre, incompleta, evasiva y omisa, dejando sin contestar de forma puntual los extremos técnicos requeridos, pretendiendo trasladar de forma ilegítima la carga de la prueba al ciudadano o eludiendo el fondo de lo peticionado, lo cual constituye una denegación material del acceso a la información pública que se mantiene vigente a la fecha de presentación de este recurso (véase la prueba aportada a los autos).
  2. 2Mediante resolución de las 16:52 horas del 22 de julio de 2026, se dio curso al presente recurso.
  3. 3Informa bajo juramento CINDY MURILLO ARTAVIA, en su condición de DIPUTADA DE LA REPÚLICA DE COSTA RICA, quien manifiesta lo siguiente: “… UNO. Solicita el recurrente [Nombre 001] información directamente relacionada con el establecimiento comercial denominado [Nombre 002]. Entre la información solicitada se refiere a disposiciones de la Ley Forestal, de la Ley de Aguas, del ICE y el SINAC – MINAE, así como de la ASADA de la localidad en que se ubica dicho establecimiento, de la Dirección de Aguas- MINAE y la Municipalidad de Tilarán. Al respecto, es preciso señalar que prácticamente la totalidad de la información solicitada por el recurrente debería estar constituida en los expedientes tramitados o registrados por las diversas instancias atrás mencionadas, que guardan la competencia necesaria para brindar la información certificada fidedigna y pertinente. DOS. De acuerdo con lo ya señalado, atañe a las entidades administrativas mencionadas, el dar respuesta a las diferentes solicitudes de información requeridas por el recurrente.En mi condición de funcionaria pública, Diputada de la República, no poseo los registros, ni las atribuciones y competencias necesarias para brindar la información o certificar lo que pudiera resultar procedente. En consecuencia, cuando resulte pertinente, deberá el recurrente dirigir sus solicitudes a las instancias que corresponda. TRES. En otro orden, debo señalar que el establecimiento comercial indicado por el recurrente pertenece a una sociedad anónima de la cual no formo parte, ni como accionista ni como representante legal o apoderada, lo cual declaro bajo juramento y apercibida de las penas con que la ley sanciona el perjurio. Sobre ese particular, aporto certificación de personería que permite constatar mi afirmación, razón por la cual tampoco me resulta posible arrogarme una representación jurídica que no ostento, ni me corresponde, referirme a la solicitud de información establecida por el recurrente.EXCEPCIONES FORMALES. De lo expuesto puede deducirse con certeza que no soy la persona legitimada para responder por asuntos relacionados con los registros de diferentes entidades administrativas y menos aún para actuar en nombre de la sociedad propietaria del establecimiento comercial de interés en este asunto. Con fundamento en lo ya expresado, establezco formalmente las excepciones de Falta de Derecho y de Falta de Legitimación Pasiva ante el recurso incoado en mi contra.”.
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. DE PREVIO

En vista de que CINDY MURILLO ARTAVIA, en su condición de DIPUTADA DE LA REPÚLICA DE COSTA RICA omitió indicar si el correo electrónico utilizado por la parte recurrente para solicitar la información se encuentra autorizado como canal oficial para realizar dicha gestión, de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional se tiene por cierta esa condición del correo electrónico y se procede a analizar la constitucionalidad del asunto con base en los elementos aportados a los autos.

II. OBJETO DEL RECURSO

El recurrente reclama que la diputada accionada brindó una respuesta incompleta, evasiva y omisa a su solicitud de información relacionada con el cumplimiento de la normativa ambiental, hídrica y urbanística del establecimiento [Nombre 002], lo que a su juicio, vulnera su derecho de acceso a la información pública.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)El 15 de junio de 2026, a las 11:22 horas, [Nombre 001], desde la dirección electrónica [...], remitió un correo electrónico a [email protected], con el asunto “Diputada Cindy Murillo Artavia.pdf” y un archivo adjunto. En esa oportunidad solicitó lo siguiente: “(…) 1 – Con respecto al cumplimiento de la Ley Forestal N.° 7575 y Ley de Aguas N.° 276: 1 - ¿Cumple la infraestructura del establecimiento [Nombre 002] con las distancias de retiro de cien metros en el radio de nacientes permanentes y quince metros en las riberas de ríos/quebradas adyacentes (Artículo 33 de la Ley Forestal N.° 7575)? 2 – De forma específica: ¿Se encuentra el inmueble o parte de su infraestructura comercial construido dentro del radio de doscientos (200) metros de alguna naciente de agua dulce que esté siendo captada por la ASADA local o acueducto rural para el Consumo Humano Poblacional, tal como lo exige de forma estricta e inviolable la Ley de Aguas N.° 276 y la normativa de salud pública?

Sírvase certificar la distancia exacta a la naciente comunitaria más cercana. 3 – Aporte copia digital de las delimitaciones topográficas y alineamientos oficiales extendidos para dicho predio por el ICE y el SINAC-MINAE. II. Con respecto al Aprovechamiento de Aguas Subterráneas y Pozos: 4. En caso de que el hotel, restaurante o sus piscinas se abastezcan mediante un Pozo de Agua ubicado dentro de la propiedad, sírvase indicar el número de expediente de perforación, el número de Concesión de Aprovechamiento de Aguas Subterráneas otorgado por la Dirección de Agua del MINAE y el caudal máximo autorizado. De no contar con dicha concesión, detalle el origen legal del recurso hídrico utilizado en la operación comercial. III. Con respecto a la Legalidad Urbanística (Municipalidad de Tilarán): 5. Remita copia íntegra del Uso de Suelo y de los Permisos de Construcción definitivos otorgados para este complejo comercial.6.

Detalle la relación numérica de metros cuadrados efectivamente construidos en el sitio versus la cantidad de metros cuadrados que fueron aprobados y tasados ante el departamento de ingeniería municipal. (…)” (sic) ver prueba adjunta).

  • b)El 29 de junio de 2026, a las 12:45 horas, CINDY MURILLO ARTAVIA, desde la dirección electrónica [email protected], remitió una respuesta a [Nombre 001], a la dirección [...] , en los siguientes términos: “Estimado señor [Nombre 001]. Munícipe de Grecia. De mi mayor consideración: Le saludo cordialmente y respondo a su consulta fechada 15 de junio de 2026, de la manera que expongo a continuación:

1- Respecto a la información que ha circulado públicamente, sobre mi apoyo y voto favorable al proyecto de ley recientemente aprobado y relacionado con la zona del Embalse Arenal, Guanacaste; le informo que dichos hechos son actualmente objeto de una investigación judicial en curso. 2- En estricto apego al artículo 295 del Código Procesal Penal las actuaciones en esta etapa preparatoria son de carácter privado para terceros, por lo que legalmente me encuentro impedida de brindar detalles públicos al respecto. 3- Que mantengo la total convicción de que mis actuaciones se han ajustado estrictamente al Derecho y a las normas de este país, lo cual quedará debidamente acreditado ante las instancias correspondientes …” (ver prueba adjunta).

IV. SOBRE EL DERECHO DE PETICIÓN Y PRONTA RESPUESTA

El derecho de petición y pronta respuesta, cobijado en los artículos 27, de la Constitución Política y 32, de la Ley de la Jurisdicción Constitucional, obliga a los funcionarios públicos a resolver las solicitudes de los administrados en el plazo de diez días hábiles a partir de la fecha de presentación de tales gestiones, a falta de que no se hubiere señalado otro plazo para contestar. Sin embargo, el artículo 32, citado dispone, además, que, en la decisión de la petición, la Sala apreciará las razones que se aduzcan para considerar insuficiente ese plazo, atendidas las circunstancias y la índole del asunto, en cuyo caso la Administración siempre está obligada a comunicarle al petente las causas de la demora en pronunciarse. En todo caso, el deber de resolver no implica la obtención de una respuesta favorable o no, pero sí la necesaria congruencia entre el objeto de lo pedido y el de lo contestado.

V. SOBRE EL CASO CONCRETO

El recurrente acusa que la diputada recurrida vulneró sus derechos fundamentales de petición, pronta respuesta y acceso a la información pública, por cuanto considera que la contestación brindada a su gestión fue incompleta, evasiva y omisa respecto de los extremos técnicos consultados. Concretamente, solicitó información relacionada con el cumplimiento de la normativa forestal, hídrica y urbanística por parte del establecimiento denominado [Nombre 002], incluyendo la certificación de distancias respecto de nacientes y cauces, delimitaciones topográficas, alineamientos oficiales, concesiones para el aprovechamiento de aguas subterráneas, permisos de construcción, uso de suelo y relación entre las áreas construidas y las autorizadas.

El artículo 27 de la Constitución Política reconoce el derecho de toda persona a dirigir peticiones ante las autoridades públicas y obtener pronta resolución. Tal garantía impone a la autoridad destinataria el deber de conocer la gestión y brindar una respuesta dentro de un plazo razonable; sin embargo, no supone que la contestación deba ser necesariamente favorable ni que la autoridad se encuentre obligada a conceder aquello que se le solicita. Lo constitucionalmente exigible es que la gestión no sea ignorada y que se comunique oportunamente la posición de la autoridad, con independencia de que esta coincida o no con las pretensiones del peticionario. La jurisprudencia constitucional ha distinguido, en ese sentido, entre el derecho a formular la petición y obtener respuesta, por una parte y un pretendido derecho a recibir necesariamente lo solicitado, por otra, pues este último no se encuentra comprendido en la garantía constitucional.

Por su parte, el derecho consagrado en el artículo 30 de la Constitución Política garantiza el acceso a la información de interés público que se encuentre en poder de los órganos y entes públicos. Su finalidad es permitir que las personas conozcan y fiscalicen la actividad administrativa; no obstante, su ejercicio presupone que la información solicitada exista y sea custodiada, generada, recibida o conservada por el sujeto al que se dirige la gestión.

En armonía con lo anterior, la Ley Marco de Acceso a la Información Pública establece que las solicitudes pueden formularse por medios electrónicos y que la información pública debe entregarse, por regla general, dentro del plazo de diez días hábiles. Asimismo, califica como información pública preconstituida aquella que ya se encuentra en los registros físicos o digitales de la Administración y es de fácil acceso. De ello se desprende que el derecho de acceso recae sobre información existente y disponible en los archivos del sujeto obligado, pero no impone a la autoridad el deber de crear documentos inexistentes, efectuar investigaciones especiales, realizar mediciones topográficas, elaborar estudios técnicos, emitir certificaciones sobre circunstancias ajenas a sus competencias o recopilar información que se encuentra dispersa en los registros de instituciones distintas.

En el caso concreto, se encuentra demostrado que la solicitud fue remitida el 15 de junio de 2026, a las 11:22 horas, a la dirección electrónica institucional de la diputada recurrida. También consta que el 29 de junio de 2026, a las 12:45 horas, esta remitió una contestación al correo señalado por el gestionante. Por consiguiente, entre la presentación de la solicitud y su respuesta transcurrieron diez días hábiles, de modo que la gestión fue atendida dentro del plazo legalmente establecido y además, con anterioridad a la interposición y notificación del presente recurso de amparo. No se configura, entonces, una situación de silencio, abandono, retardo injustificado o falta absoluta de respuesta atribuible a la recurrida.

Tampoco existe controversia efectiva respecto de la recepción de la gestión por medio del correo electrónico utilizado. Aunque la recurrida omitió indicar expresamente en su informe si esa dirección se encontraba formalmente autorizada como canal para presentar solicitudes de información, lo cierto es que recibió el mensaje, conoció su contenido y respondió desde esa misma dirección institucional. En consecuencia, cualquier discusión sobre la habilitación formal del medio empleado carece de incidencia material en la resolución del asunto, pues el mensaje cumplió su finalidad y la petición fue efectivamente tramitada.

Ahora bien, no pasa inadvertido para esta Sala que la respuesta del 29 de junio de 2026 no desarrolló con la claridad y precisión deseables la razón concreta por la que la diputada no podía suministrar cada uno de los documentos y datos técnicos requeridos. En efecto, esa contestación se refirió principalmente a la existencia de una investigación judicial vinculada con su apoyo y voto favorable a un proyecto de ley relacionado con la zona del embalse Arenal, así como al carácter privado de las actuaciones preparatorias. Tales manifestaciones no guardan una relación directa con todos los extremos ambientales, hídricos y urbanísticos planteados por el peticionario.

No obstante, esa insuficiencia argumentativa no resulta bastante, en las circunstancias particulares del caso, para concluir que se produjo una denegación material del derecho de acceso a la información pública. Del informe rendido bajo juramento se desprende que la diputada recurrida no posee los registros, expedientes ni antecedentes técnicos solicitados, ni cuenta con atribuciones legales para efectuar las verificaciones o expedir las certificaciones pretendidas. Explicó que esa información debería encontrarse, según su naturaleza, en poder del Instituto Costarricense de Electricidad, el Sistema Nacional de Áreas de Conservación, el Ministerio de Ambiente y Energía, la Dirección de Aguas, la asociación administradora del acueducto local o la Municipalidad de Tilarán.

Asimismo, la recurrida declaró bajo juramento que no forma parte de la sociedad anónima propietaria del establecimiento comercial, ni en calidad de accionista, representante legal o apoderada y aportó una certificación de personería para respaldar esa afirmación. No consta en autos prueba alguna que permita concluir que la señora Murillo Artavia custodie personalmente los expedientes administrativos requeridos, que estos formen parte de los archivos de su despacho legislativo o que, por razón de su cargo, posea competencia para certificar distancias respecto de nacientes, alineamientos topográficos, concesiones de aprovechamiento de aguas, permisos municipales o cantidades de metros cuadrados construidos.

El solo hecho de que la diputada hubiera apoyado o votado favorablemente un proyecto de ley relacionado con la zona del embalse Arenal no la convierte en depositaria de todos los expedientes técnicos, ambientales, urbanísticos o registrales relativos a los establecimientos comerciales ubicados en esa región. La función legislativa ejercida respecto de un proyecto de ley no desplaza las competencias legalmente atribuidas a las autoridades ambientales, municipales, hídricas o técnicas, ni impone a cada legislador la obligación de conservar y certificar los registros administrativos producidos por esas dependencias.

De esta manera, acceder a la pretensión del recurrente implicaría ordenar a la recurrida la entrega o certificación de información que, según el informe rendido bajo juramento y la prueba incorporada al expediente, no se encuentra en su poder. Tal mandato resultaría material y jurídicamente improcedente, dado que el derecho de acceso a la información pública no faculta para exigir a una autoridad que produzca información inexistente en sus archivos, sustituya a los órganos técnicamente competentes o se arrogue facultades certificadoras que el ordenamiento jurídico no le confiere.

Debe recordarse que una respuesta negativa, fundada en la inexistencia de la información en poder de la autoridad o en la falta de competencia para producirla, no constituye por sí misma una lesión constitucional. La vulneración se configuraría si la autoridad omitiera responder, retardara injustificadamente la contestación, ocultara información que efectivamente posee o denegara total o parcialmente su entrega sin brindar una justificación. La Ley Marco de Acceso a la Información Pública contempla expresamente la tutela constitucional frente a respuestas ambiguas o parciales que, sin justificación, constituyan materialmente una negativa; sin embargo, en este asunto, el informe rendido bajo juramento permite establecer que no hubo retención ni ocultamiento de documentación pública en poder de la diputada, sino imposibilidad de suministrar antecedentes pertenecientes a otras administraciones.

En consecuencia, el recurrente deberá dirigir sus solicitudes -si a bien lo tiene- a las instituciones que, en razón de sus competencias, elaboran, reciben y custodian la información requerida.

Por consiguiente, dado que la diputada recurrida atendió la gestión dentro del plazo legal, antes de la interposición de este amparo y que no se ha demostrado que mantuviera en su poder la información solicitada o que hubiera ocultado documentación pública bajo su custodia, no se aprecia una lesión de los derechos fundamentales de petición, pronta respuesta y acceso a la información pública. La falta de satisfacción de la pretensión del recurrente obedece a que dirigió la solicitud a una autoridad que no posee los antecedentes ni cuenta con las competencias técnicas necesarias para producirlos o certificarlos y no a una conducta omisiva o arbitraria de la recurrida. En mérito de lo expuesto, procede declarar sin lugar el recurso.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso. - Fernando Castillo V.
