Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the sixth of August, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by [Nombre 001], [Nombre 002], [Nombre 003], [Nombre 004], [Nombre 005], [Nombre 006], [Nombre 007], [Nombre 008], [Nombre 009], [Nombre 010], [Nombre 011], and [Nombre 012], against the Municipalidad de Pococí and the Ministerio de Salud.
Background:
She added that complaint N° 289-2026 was filed on the twelfth of June, two thousand twenty-six, and addressed through an inspection on the thirtieth of that same month. During that inspection, the presence of standing wastewater, grease residue on the public road, flies, foul odors, and scattered waste was confirmed, with the apparent source being the property where the establishment "Ventanita Mi Sabor" and a dwelling operate. For that reason, sanitary orders Nos. MS-DRRSHC-ARSP-3426-2026 and MS-DRRSHC-ARSP-3427-2026 were issued, with a deadline of the twenty-second of July, two thousand twenty-six.
She stated that on the fifteenth of July, two thousand twenty-six, fluorescein tests (pruebas con fluoresceína) were conducted at two properties, and the results showed that one dwelling and one apartment were improperly discharging their wastewater onto the road. With respect to the dwelling of Lauren Díaz Navarro, sanitary order N° MS-DRRSHC-ARSP-3388-2026 was issued, with a deadline of the fifteenth of August, two thousand twenty-six. Regarding the apartment occupied by [Nombre 002], she stated that it was pending to locate the owner, [Nombre 009], in order to serve him the corresponding sanitary order. She also stated that the Programa de Manejo Integrado de Vectores conducted interventions over six days, consisting of household inspections, removal of containers capable of accumulating water, and targeted application of products for larval control (control larvario). She clarified that aerial spraying (fumigación espacial) was not the most technically appropriate measure to address the root cause of the problem. She requested that the writ be denied.

Whereas:
I.Subject matter of the writ. The petitioners allege that the Municipalidad de Pococí and the Ministerio de Salud violated their fundamental rights to health and to enjoy a healthy and ecologically balanced environment by allegedly failing to take timely, coordinated, and effective measures to resolve the persistent accumulation of stormwater and wastewater in barrio Coopevigua 2 of Guápiles, particularly in the vicinity of the establishment "Ventanita Mi Sabor," a situation which, they allege, causes foul odors, proliferation of mosquitoes, flies, and other insects, and exposes community residents to the risk of contracting diseases, despite repeated complaints filed with the respondent authorities; they also question the lack of adequate infrastructure to drain the water and request that the necessary works and sanitary measures be carried out to definitively correct the reported problem.
II.Proven facts. For the purposes of this decision, the following facts are deemed duly established, either because they have been proven in the record or because the respondents failed to address them as required by the initial order:
IV.On the right to health and to a healthy and ecologically balanced environment. Article 21 of the Constitución Política recognizes the inviolability of human life, a provision from which this Chamber has derived the fundamental right to health. For its part, Article 50 of the Constitución Política recognizes every person's right to enjoy a healthy and ecologically balanced environment and imposes on the State the duty to guarantee, defend, and preserve it. Constitutional protection of the environment encompasses not only the conservation of natural resources, but also the right of individuals to develop their lives under conditions of health, free from contamination, foul odors, accumulations of wastewater, and other sources of risk that may affect their physical integrity or their health.
In this area, public authorities must act in accordance with the precautionary and preventive principles. It is not necessary to wait for a disease or irreversible harm to occur before intervening, as the existence of a demonstrable risk to health or the environment is sufficient to give rise to the duty to adopt timely and effective measures.
This Chamber has consistently held that municipalities and health governing authorities must exercise, within their respective jurisdictions, the powers of inspection, maintenance of public infrastructure, issuance and enforcement of sanitary orders, and inter-institutional coordination necessary to resolve problems arising from the improper disposal of wastewater. This follows, among others, from the jurisprudential precedents Nos. 2019-011274, 2019-022487, 2024-002523, and 2025-006950. This last ruling reiterated that the improper management of wastewater that affects bodies of water or a community may constitute a violation of the right to a healthy and ecologically balanced environment. On that occasion, the following was expressly stated:
"…VII.- ON THE MERITS. In the present case, the Chamber finds that there is sufficient evidence to grant this writ of amparo. As can be seen from the list of proven facts, the respondent authorities have indeed taken some actions aimed at resolving the problem raised by the petitioners regarding the improper disposal of wastewater and sewage (aguas negras) into a body of water running through barrio Veinte de Noviembre, in Puntarenas. It is also noted that the respondents acknowledge that there are persistent behaviors by residents who bring solid waste to the airstrip of Chacarita, causing serious contamination in that area. According to the sworn statement of the Mayor of Puntarenas, during a recent inspection on January 29, 2025, it was confirmed that the problem of solid waste contamination persists in this area, for which reason the Municipalidad de Puntarenas began cleaning and collecting the solid waste accumulated in the airstrip area and areas adjacent to the stormwater canal as of January 30, 2025.
He clarifies that periodic cleanups will be coordinated using municipal machinery starting in 2025. He further adds that the vast majority of the structures located south of the stormwater canal constitute unlawful encroachments on land owned by the Dirección General de Aviación Civil. There is a future project (2025-2030) for the construction of the sanitary sewer system (alcantarillado sanitario) in the Gran Puntarenas area, the initial design phase of which was awarded by AyA to the consortium IDOM-INNCIVE, with the primary objective of resolving problems related to the management and disposal of wastewater from the population. However, it cannot be verified that, to date, provisional measures have been taken to prevent the contamination situation in the community of Veinte de Noviembre from continuing. The Chamber notes, from the photographic evidence included in the case file, that in fact many of the dwellings in that community have pipes that discharge into the estuary or wetland running through it.
That is to say, there is indeed a serious contamination situation, as wastewater and sewage are being discharged into that body of water without adequate treatment or a planned final disposal method. The residents have created a very serious environmental problem that has not been addressed in a diligent or responsible manner by the respondent authorities, particularly the Municipalidad de Puntarenas. It must be recalled that the respondent municipality is responsible for safeguarding local interests, and it is of course its duty to maintain constant vigilance in situations where high-impact environmental contamination is occurring, such as that reported here. It is clear that these rivers, wetlands, estuaries, and other bodies of water running through the canton of Puntarenas ultimately discharge into the Pacific Ocean, where they significantly affect the ecosystems in that area, generating environmental imbalance, impacts on tourism, fishing problems, and, in global terms, a troubling pattern of inaction that seriously violates Article 50 of the Constitución Política.
This is why this Tribunal is called upon to intervene in this new case, as it has done in several prior rulings, so that the Municipalidad de Puntarenas will be responsible for sanctioning and correcting the conduct that directly causes contamination of the bodies of water in that canton, as is the case here…" (Judgment N° 2025-006950 of nine hours twenty minutes on the seventh of March, two thousand twenty-five).
The jurisdiction of one authority does not exclude that of the other. The municipality is responsible for public infrastructure, stormwater drainage, roadside ditches, and road conditions within its legal mandate; while the Ministerio de Salud must exercise health governance, inspect properties, identify sources of contamination, issue the pertinent sanitary orders, and verify their compliance. When the problem involves simultaneously public infrastructure and private wastewater discharges, both authorities are obligated to coordinate their actions, and it is not constitutionally permissible for them to mutually shift responsibility to one another.
V.On the specific case. The list of proven facts shows that the problem reported by the petitioners is not merely hypothetical nor is it based solely on subjective assessments. On the contrary, it was confirmed by the respondent authorities themselves.
The Municipalidad de Pococí confirmed on the seventh of July, two thousand twenty-six, that the drainage system was obstructed and that this condition prevented the proper flow of stormwater, causing it to pond in the roadside ditch and on the public road. The Ministerio de Salud, for its part, verified the existence of standing wastewater, grease residue, foul odors, flies, and inadequate used-water (aguas servidas) disposal systems.
It is also established that the authorities were aware of the situation before this proceeding was filed. The Concejo Municipal had been receiving petitions concerning drainage problems since the year two thousand twenty-one, and the Proceso de Control Ambiental Municipal had referred the case to the Ministerio de Salud since February of two thousand twenty-five. In turn, the Área Rectora de Salud received a complaint in December of two thousand twenty-five, and in January of two thousand twenty-six confirmed that the commercial establishment's wastewater treatment system had collapsed.
Despite this, the Municipalidad conducted the new inspection and cleaning of the drainage system only after this writ had been admitted. While such actions are positive and aimed at remedying part of the problem, they do not negate the prior omission nor do they establish a definitive solution, particularly because the water accumulation was also attributable to wastewater discharges from private properties.
As for the Ministerio de Salud, although it issued sanitary order N° MS-DRRSHC-ARSP-05-2026 in January of two thousand twenty-six, its compliance was not verified until the fifteenth of July, by which time the granted deadline had long since expired and the writ was already pending. That inspection confirmed that, despite the work carried out, the seepage of wastewater continued. Furthermore, the tests aimed at identifying other sources of irregular discharge were also conducted after the writ was admitted, and at the time the report was submitted, a sanitary order with respect to one of the properties had yet to be issued or served.
Thus, the administrative actions themselves confirm that the intervention prior to this proceeding was insufficient to effectively protect the rights of the community's residents. It is not enough to receive complaints, conduct inspections, or issue sanitary orders; it is essential to verify their compliance in a timely manner and, should the irregularities persist, to enforce the measures provided under the applicable legal framework to bring them to an end.
On the other hand, it is not within the jurisdiction of this court to substitute its judgment for that of the sanitary authorities on technical matters, nor to specifically order the constant fumigation sought by the petitioners, as the technical report explains that such a measure does not necessarily constitute the most effective alternative for addressing the root cause of vector proliferation. It is for the Ministerio de Salud to determine, in accordance with science and technical criteria, which control actions are appropriate. Nor does it fall to this Chamber to automatically order the paving of the road or the construction of a public work with specific characteristics. What is constitutionally required is that the Municipalidad adopt, within a reasonable period, the technical measures necessary to ensure adequate drainage of water and prevent its accumulation on the public road.
Consequently, a violation of the rights protected under Articles 21 and 50 of the Constitución Política is established, as at the time the writ was filed, a sanitary and environmental problem known to the authorities persisted without a comprehensive, timely, and effective response having been provided.
VI.On the actions taken during the processing of the writ. This Tribunal does not overlook that, after the writ was filed, the Municipalidad cleaned the drainage system and the Ministerio de Salud conducted new inspections, fluorescein tests, vector control work, and issued several sanitary orders.
However, such actions are insufficient to provide an effective and comprehensive solution to the problem at hand. In the specific case, moreover, there is no certainty that the problem has completely ceased, as at the time the reports were submitted, verification of several sanitary orders, service of another administrative act, and the adoption of a comprehensive solution for the management of stormwater and wastewater remained pending. Therefore, the writ must be granted against both respondent authorities, on the terms set forth in the operative clause (parte dispositiva) of this judgment.
In environmental matters, it is the view of the undersigned that, where the Public Administration has already intervened, the matter should be heard and resolved by the administrative contentious jurisdiction (jurisdicción contenciosa administrativa). However, I do proceed to examine the merits of the case when other rights of persons affected by the source of contamination are at stake, including the right to health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as is the case here, in which the petitioners allege that the Municipalidad de Pococí and the Ministerio de Salud have not effectively addressed repeated complaints regarding the persistent accumulation of stormwater and wastewater in barrio Coopevigua 2 of Guápiles, a situation which, they allege, causes foul odors, proliferation of mosquitoes, flies, and other insects, and exposes community residents to the risk of contracting diseases, posing a risk to public health, which is the reason they have come before this Chamber. The situation described constitutes an exception to my general position on this matter, which is why I considered it necessary for this Constitutional Tribunal to examine the merits of the case in order to verify or rule out the claims of the petitioners.
The parties are hereby notified that if any paper documents have been submitted, along with objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court within a maximum period of thirty business days counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session N° 43-12 held on May 3, 2012, Article LXXXI.
Therefore:
The writ is declared GRANTED. MANUEL HERNÁNDEZ RIVERA, in his capacity as Mayor of the Municipalidad de Pococí; JUAN MAURICIO MORA CRUZ, in his capacity as President of the Concejo Municipal de Pococí; and KAREN TATIANA MAYORGA QUIRÓS, in her capacity as Director of the Área Rectora de Salud de Pococí, or whoever holds those positions, are hereby ORDERED to immediately issue the corresponding directives and coordinate all actions within the scope of their respective jurisdictions so that, within a period of TWO MONTHS counted from notification of this judgment, the necessary measures are adopted and implemented to comprehensively resolve the accumulation of stormwater and wastewater in barrio Coopevigua 2 of Guápiles, in the vicinity of the establishment "Ventanita Mi Sabor," in order to prevent such water from continuing to discharge onto or pond on the public road. Additionally, the Director of the Área Rectora de Salud de Pococí is ordered to immediately verify compliance with sanitary orders Nos.
MS-DRRSHC-ARSP-3426-2026 and MS-DRRSHC-ARSP-3427-2026 and, once the corresponding deadline has expired, to verify compliance with sanitary order N° MS-DRRSHC-ARSP-3388-2026; she must also locate the owner of the property for which issuance or service of a sanitary order remains pending and, in the event of non-compliance, adopt the administrative and sanitary measures provided under the applicable legal framework. The foregoing shall be carried out without prejudice to any provisional measures that may be necessary to protect the health of community residents while a definitive solution is reached. Finally, the Mayor of the Municipalidad de Pococí is ordered to maintain the drainage system located on road C.7-0-110 in adequate operating condition and to conduct the technical studies necessary to determine and implement, within the scope of the Municipalidad's legal competences and possibilities, the works or measures required to ensure the proper evacuation of stormwater.
The respondent authorities are hereby warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, a prison term of three months to two years or a fine of twenty to sixty days shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in the course of a writ of amparo, and fails to comply with it or cause it to be complied with, provided the offense is not subject to a more severe penalty. The State and the Municipalidad de Pococí are ordered to pay court costs (costas), damages, and losses caused by the facts underlying this ruling, which shall be assessed in enforcement proceedings before the administrative contentious jurisdiction. Recurso de amparo interpuesto por [Nombre 001], [Nombre 002], [Nombre 003], [Nombre 004], [Nombre 005], [Nombre 006], [Nombre 007], [Nombre 008], [Nombre 009], [Nombre 010], [Nombre 011] y [Nombre 012], contra la MUNICIPALIDAD DE POCOCÍ y el MINISTERIO DE SALUD.
Resultando:
Añadió que la denuncia N° 289-2026 fue presentada el doce de junio de dos mil veintiséis y atendida mediante inspección el treinta de junio siguiente. En esa diligencia se constató la presencia de aguas residuales estancadas, restos de grasa en la vía pública, moscas, malos olores y residuos dispersos, cuyo origen aparente se ubicaba en la propiedad donde funcionan el establecimiento “Ventanita Mi Sabor” y una vivienda. Por ese motivo se emitieron las órdenes sanitarias números MS-DRRSHC-ARSP-3426-2026 y MS-DRRSHC-ARSP-3427-2026, con vencimiento el veintidós de julio de dos mil veintiséis.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. Los recurrentes alegan que la Municipalidad de Pococí y el Ministerio de Salud vulneraron sus derechos fundamentales a la salud y a disfrutar de un ambiente sano y ecológicamente equilibrado, al presuntamente omitir la adopción oportuna, coordinada y efectiva de las medidas necesarias para solucionar la persistente acumulación de aguas pluviales y residuales en barrio Coopevigua 2 de Guápiles, particularmente en las inmediaciones del establecimiento “Ventanita Mi Sabor”, situación que, según alegan, provoca malos olores, proliferación de zancudos, moscas y otros insectos, y expone a los habitantes de la comunidad al riesgo de contraer enfermedades, pese a las reiteradas denuncias formuladas ante las autoridades recurridas; asimismo, cuestionan la falta de infraestructura adecuada para evacuar las aguas y solicitan que se ejecuten las obras y medidas sanitarias necesarias para corregir definitivamente la afectación denunciada.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre el derecho a la salud y a un ambiente sano y ecológicamente equilibrado. El artículo 21, de la Constitución Política, reconoce la inviolabilidad de la vida humana, disposición de la cual esta Sala ha derivado el derecho fundamental a la salud. Por su parte, el artículo 50, Constitucional, reconoce el derecho de toda persona a disfrutar de un ambiente sano y ecológicamente equilibrado e impone al Estado el deber de garantizarlo, defenderlo y preservarlo. La protección constitucional del ambiente comprende no solo la conservación de los recursos naturales, sino también el derecho de las personas a desarrollar su vida en condiciones de salubridad, libres de contaminación, malos olores, acumulaciones de aguas residuales y otras fuentes de riesgo que puedan afectar su integridad o su salud.
En esta materia, las autoridades públicas deben actuar conforme a los principios preventivo y precautorio. No es indispensable esperar que se produzca una enfermedad o un daño irreversible para intervenir, pues basta la existencia de un riesgo comprobable para la salud o el ambiente para que surja el deber de adoptar medidas oportunas y eficaces.
La Sala ha reiterado que las municipalidades y las autoridades rectoras en salud deben ejercer, dentro de sus respectivas competencias, las potestades de inspección, mantenimiento de la infraestructura pública, emisión y ejecución de órdenes sanitarias y coordinación interinstitucional necesarias para resolver los problemas derivados de la disposición inadecuada de aguas residuales. Así se desprende, entre otros, de los antecedentes jurisprudenciales N° 2019-011274, N° 2019-022487, N° 2024-002523 y N° 2025-006950. Esta última resolución reiteró que el manejo inadecuado de aguas residuales que afecta los cuerpos de agua o una comunidad puede constituir una lesión del derecho a un ambiente sano y ecológicamente equilibrado. En esa oportunidad, textualmente se indicó lo siguiente:
“…VII.- SOBRE EL FONDO. En el sub lite, la Sala estima que existen suficientes elementos de convicción para acoger el presente recurso de amparo. Como puede apreciarse del elenco de hechos probados, ciertamente las autoridades accionadas han realizado algunas acciones tendentes a solucionar la problemática aludida por la parte recurrente, en torno a la inadecuada disposición de aguas residuales y negras en un cuerpo de agua que recorre el barrio Veinte de Noviembre, en Puntarenas. Asimismo, se observa que los recurridos aceptan que existen constantes conductas de los vecinos, quienes llevan residuos sólidos a la pista de aterrizaje de Chacarita, provocando una grave contaminación en dicho lugar. Según lo indicado bajo juramento por el Alcalde de Puntarenas, en inspección realizada recientemente, el día 29 de enero de 2025, se comprobó que el problema de contaminación por residuos sólidos persiste en esta zona, por lo cual la Municipalidad de Puntarenas inició con la limpieza y recolección de los residuos sólidos acumulados en la zona de la pista de aterrizaje y áreas aledañas al canal pluvial a partir del 30 de enero de 2025.
Aclara que se coordinarán limpiezas periódicas con la maquinaria municipal a partir del presente año 2025. Además, agrega que una gran mayoría de las construcciones ubicadas al sur del canal pluvial constituyen invasiones del terreno propiedad de la Dirección General de Aviación Civil. Existe un proyecto a futuro (2025-2030) para la construcción del alcantarillado sanitario en la Gran Puntarenas, cuya fase inicial de diseño fue adjudicada por parte del AyA al consorcio IDOM-INNCIVE, el cual tiene como objetivo principal resolver los problemas relacionados con el manejo y la disposición de las aguas residuales de la población. Sin embargo, no se logra verificar que, a la fecha, se hayan tomado medidas provisionales para evitar que se continúe dando una situación de contaminación en la comunidad Veinte de Noviembre. La Sala aprecia, de la prueba fotográfica aportada al expediente, que en efecto muchas de las viviendas que están en esa localidad tienen tuberías que descargan en el estero o humedal que recorre dicha comunidad.
Es decir, sí hay una situación de contaminación grave pues se vierten aguas residuales y negras en dicho cuerpo de agua, sin un adecuado tratamiento ni una disposición final planificada. Los vecinos han generado un problema ambiental muy grave que no ha sido atendido de manera diligente ni responsable por parte de las autoridades accionadas, especialmente la Municipalidad de Puntarenas. Debe recordarse que el municipio accionado es el encargado de velar por la protección de los intereses locales, siendo por supuesto su deber desplegar una conducta de vigilancia constante en escenarios donde se esté provocando contaminación ambiental de alto impacto, como la que se denuncia aquí. Es claro que estos ríos, humedales, esteros y demás cuerpos de agua que recorren el cantón de Puntarenas, desembocan finalmente en el océano Pacífico, donde afectan de manera importante los ecosistemas existentes en esa zona, generando desequilibrio ambiental, afectación turística, problemas pesqueros, y en términos globales, una preocupante conducta pasiva que lesiona gravemente el ordinal 50 de la Constitución Política.
De ahí que este Tribunal esté llamado a intervenir en este nuevo caso, como lo ha hecho en varios pronunciamientos anteriores, con el objeto que la Municipalidad de Puntarenas se encargue de sancionar y corregir las conductas que producen contaminación directa en los cuerpos de agua de ese cantón, como lo es el presente caso…” (Sentencia N° 2025-006950 de las nueve horas veinte minutos del siete de marzo de dos mil veinticinco).
La competencia de una autoridad no excluye la de la otra. A la municipalidad le corresponde atender la infraestructura pública, el drenaje pluvial, las cunetas y las condiciones de la vía dentro de sus atribuciones legales; mientras que el Ministerio de Salud debe ejercer la rectoría sanitaria, inspeccionar los inmuebles, identificar las fuentes de contaminación, dictar las órdenes sanitarias pertinentes y verificar su cumplimiento. Cuando el problema involucra simultáneamente infraestructura pública y descargas privadas de aguas residuales, ambas autoridades se encuentran obligadas a coordinar sus actuaciones, sin que resulte constitucionalmente admisible trasladarse recíprocamente la responsabilidad.
V.Sobre el caso concreto. Del elenco de hechos probados se desprende que la problemática denunciada por los recurrentes no es meramente hipotética ni se encuentra sustentada únicamente en apreciaciones subjetivas. Por el contrario, fue comprobada por las propias autoridades recurridas.
La Municipalidad de Pococí constató el siete de julio de dos mil veintiséis que el sistema de drenaje se encontraba obstruido y que esa condición impedía el adecuado discurrir de las aguas pluviales, lo cual ocasionaba su estancamiento en la cuneta y en la vía pública. El Ministerio de Salud, por su parte, verificó la existencia de aguas residuales estancadas, restos de grasa, malos olores, moscas y sistemas inadecuados de disposición de aguas servidas.
También se encuentra demostrado que las autoridades conocían la situación desde antes de interponerse este proceso. El Concejo Municipal había conocido gestiones relacionadas con los problemas de drenaje desde el año dos mil veintiuno y el Proceso de Control Ambiental Municipal había remitido el caso al Ministerio de Salud desde febrero de dos mil veinticinco. A su vez, el Área Rectora de Salud recibió una denuncia en diciembre de dos mil veinticinco y, en enero de dos mil veintiséis, comprobó que el sistema de tratamiento de aguas residuales del establecimiento comercial se encontraba colapsado.
Pese a ello, la Municipalidad efectuó la nueva inspección y la limpieza del sistema de drenaje únicamente después de cursado este recurso. Si bien tales actuaciones son positivas y se encuentran dirigidas a remediar parte de la problemática, no desvirtúan la omisión precedente ni acreditan una solución definitiva, particularmente porque la acumulación de aguas obedecía también a descargas residuales procedentes de inmuebles privados.
En cuanto al Ministerio de Salud, aunque emitió la orden sanitaria N° MS-DRRSHC-ARSP-05-2026 en enero de dos mil veintiséis, su cumplimiento fue verificado hasta el quince de julio siguiente, cuando ya había transcurrido ampliamente el plazo concedido y el recurso se encontraba en trámite. Esa inspección permitió comprobar que, pese a las labores ejecutadas, el afloramiento de aguas residuales continuaba. Además, las pruebas dirigidas a identificar otras fuentes de descarga irregular se practicaron igualmente después de cursado el amparo y, al momento de rendirse el informe, todavía se encontraba pendiente emitir o notificar una orden sanitaria respecto de uno de los inmuebles.
De ese modo, las propias actuaciones administrativas acreditan que la intervención anterior a este proceso fue insuficiente para proteger de manera efectiva los derechos de los habitantes de la comunidad. No basta con recibir denuncias, efectuar inspecciones o dictar órdenes sanitarias; es indispensable verificar oportunamente su cumplimiento y, de persistir las irregularidades, ejecutar las medidas previstas en el ordenamiento jurídico para hacerlas cesar.
Por otra parte, no corresponde a esta jurisdicción sustituir el criterio técnico de las autoridades sanitarias ni ordenar específicamente la fumigación constante pretendida por los recurrentes, pues el informe técnico explica que esa medida no constituye necesariamente la alternativa más eficaz para tratar el origen de la proliferación de vectores. Corresponde al Ministerio de Salud determinar, conforme a la ciencia y la técnica, cuáles acciones de control resultan adecuadas. Tampoco compete a esta Sala ordenar, de manera automática, el asfaltado de la calle o la construcción de una obra pública con características determinadas. Lo constitucionalmente exigible es que la Municipalidad adopte, dentro de un plazo razonable, las medidas técnicas necesarias para asegurar el adecuado drenaje de las aguas y evitar su acumulación en la vía pública.
En consecuencia, se acredita una lesión de los derechos protegidos en los artículos 21 y 50, de la Constitución Política, pues al momento de interponerse el recurso persistía una problemática sanitaria y ambiental conocida por las autoridades, sin que se hubiera brindado una respuesta integral, oportuna y efectiva.
VI.Sobre las actuaciones realizadas durante la tramitación del recurso. No desconoce este Tribunal que, después de interpuesto el amparo, la Municipalidad limpió el sistema de drenaje y el Ministerio de Salud realizó nuevas inspecciones, pruebas con fluoresceína, labores de control vectorial y emitió varias órdenes sanitarias.
Sin embargo, tales actuaciones no resultan suficientes para ofrecer una solución efectiva e integral al problema planteado. En el caso concreto, además, no existe certeza de que la afectación haya cesado completamente, pues al rendirse los informes continuaban pendientes la verificación de varias órdenes sanitarias, la notificación de otro acto administrativo y la adopción de una solución integral para el manejo de las aguas pluviales y residuales. Por ello, el recurso debe declararse con lugar contra ambas autoridades recurridas, en los términos que se indican en la parte dispositiva de esta sentencia.
En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente alega que la Municipalidad de Pococí y el Ministerio de Salud no han atendido eficazmente reiteradas denuncias presentadas por la persistente acumulación de aguas pluviales y residuales en barrio Coopevigua 2 de Guápiles, situación que, según alegan, provoca malos olores, proliferación de zancudos, moscas y otros insectos, y expone a los habitantes de la comunidad al riesgo de contraer enfermedades, con riesgo a la salud pública, motivo por el cual acuden ante esta Sala. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara CON LUGAR el recurso. Se ordena a MANUEL HERNÁNDEZ RIVERA, en su condición de alcalde de la Municipalidad de Pococí, a JUAN MAURICIO MORA CRUZ, en su condición de presidente del Concejo Municipal de Pococí; y a KAREN TATIANA MAYORGA QUIRÓS, en su condición de directora del Área Rectora de Salud de Pococí, o a quienes ocupen esos cargos, que giren de inmediato las órdenes correspondientes y coordinen todas las actuaciones que se encuentren dentro del ámbito de sus respectivas competencias para que, dentro del plazo de DOS MESES, contado a partir de la notificación de esta sentencia, se adopten y ejecuten las medidas necesarias para solucionar integralmente la acumulación de aguas pluviales y residuales en barrio Coopevigua 2 de Guápiles, en las inmediaciones del establecimiento “Ventanita Mi Sabor”, con el fin de evitar que esas aguas continúen descargándose o estancándose en la vía pública.
Adicionalmente, se ordena a la directora del Área Rectora de Salud de Pococí, verificar de inmediato el cumplimiento de las órdenes sanitarias números MS-DRRSHC-ARSP-3426-2026 y MS-DRRSHC-ARSP-3427-2026 y, una vez vencido el plazo correspondiente, verificar el cumplimiento de la orden sanitaria N° MS-DRRSHC-ARSP-3388-2026; asimismo, deberá localizarse al propietario del inmueble respecto del cual se encuentra pendiente la emisión o notificación de la orden sanitaria y adoptar, en caso de incumplimiento, las medidas administrativas y sanitarias previstas en el ordenamiento jurídico. Lo anterior deberá realizarse sin perjuicio de las medidas provisionales que resulten necesarias para proteger la salud de los habitantes de la comunidad mientras se alcanza una solución definitiva. Por último, se ordena al alcalde de la Municipalidad de Pococí, mantener en condiciones adecuadas de funcionamiento el sistema de drenaje ubicado en el camino C.7-0-110 y efectuar los estudios técnicos necesarios para determinar y ejecutar, dentro del ámbito de las competencias y posibilidades legales de la Municipalidad, las obras o medidas requeridas para asegurar la correcta evacuación de las aguas pluviales.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Pococí al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso-administrativo.
