Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the sixth of August of two thousand twenty-six.
Constitutional remedy (recurso de amparo) filed by [Nombre 001], national identity document (cédula de identidad) [Valor 001], against the MUNICIPALIDAD DE QUEPOS and the MINISTERIO DE SALUD.
Background:
Drafted by Justice Araya García; and,
Considering:
I.Subject of the writ. The petitioner claims violation of his fundamental rights, alleging that in the vicinity and surroundings of the Parque Nacional Manuel Antonio there is an urgent need for a treatment plant, as foul odors are perceived at several points on the beach and in the park, causing contamination. He states that this situation has been raised by council members (regidores), but that the respondent authorities have not sought a solution to the problem.
II.Proven facts. Of relevance to the decision of this matter, the following facts are considered duly established, either because they have been so demonstrated or because the respondent failed to address them as required in the initial order:
- Regarding the actions of the Ministry of Health:
In addition, pursuant to ex officio inspections conducted by this Ministry in the area, 3 additional sanitary orders were notified requiring two establishments in the area and the PNMA itself to correct the inadequate wastewater disposal that was occurring at that time. • For the year 2026: currently only one complaint related to the wastewater issue in the area has been recorded, which concerns the PNMA; however, it has already been addressed and what was reported was not confirmed." Furthermore, the Health Governing Area has conducted, to date, 3 inspections of a group of establishments located facing Playa Espadilla, in which inadequate wastewater disposal was found, and the corresponding sanitary order was accordingly notified so that the identified non-compliance could be remedied (see the reports submitted and the evidence provided).
Subsequently, on July 01, 2026, the Health Regulatory Area (Área Rectora de Salud) carried out the corresponding inspection, in which it verified that Hotel Milenium had been operating without a valid operating health permit (permiso sanitario de funcionamiento) since April 22, 2026. Consequently, the Health Regulatory Area issued and notified sanitary order N° MS-DRRSPC-DARSQ-OS-0151-2026, by which it ordered the immediate closure (clausura) of the establishment until it obtains the corresponding valid operating health permit; this order is currently in effect (see the reports submitted and the evidence provided).
In this manner, the procedures and timelines proposed for improvements and repairs to the wastewater treatment system (sistema de tratamiento de aguas residuales) of the staff quarters (casa de funcionarios) and the indicated restroom blocks of the national park were accepted, with February 13, 2026, set as the maximum compliance date. Subsequently, although implementation has experienced delays, the Administration of the Park continues working toward compliance with the sanitary order, and the construction project for the wastewater treatment system for the staff quarters and the indicated restroom blocks of the national park was reviewed on the APC platform, with the Ministerio de Salud recording the result as "subsanación aceptada." This indication is made strictly within the technical review scope corresponding to the Ministerio de Salud (see the reports submitted and the evidence provided).
- Regarding the actions of the Municipalidad de Quepos:
There is no certainty as to the location of a potential treatment plant specifically for this sector, since making that determination involves highly technical criteria. 6- Furthermore, the Municipalidad de Quepos is aware that AyA purchased a 1.8-hectare parcel of land (Finca No. 236382) for the installation of a treatment plant for the city of Quepos, and is aware that construction plans exist for the sanitary sewer network for the entire city of Quepos; however, it is unknown whether this already-designed system has the capacity to receive the wastewater from Manuel Antonio or whether AyA is considering another alternative to provide service to the sector of interest to the complainant. For this sewer project for the city of Quepos, together with projects in Jacó and Golfito, AyA had financing from a loan between Costa Rica and the Banco KFW Frankfurt am Main, approved by the Asamblea Legislativa in 2019.
However, on August 16, 2023, the Ministerio de Hacienda notified the Instituto Costarricense de Acueductos y Alcantarillados (AyA) of the cancellation of the program and the elimination of the budget and financing for the projects in those communities. It is clear that, given the very high cost of projects of this nature, it represents a financial challenge for the Municipalidad de Quepos to direct resources from its Municipal budget to single-handedly fund a project of this scale, and therefore it requires the participation of other institutions and the Central Government" (see the reports submitted and the evidence provided).
- Regarding the actions of SINAC:
- Regarding the actions of the Instituto Costarricense de Acueductos y Alcantarillados:
It was thus established that, in response to complaints from local residents, the Ministerio de Salud itself had to intervene to address situations evidencing deficiencies in wastewater management. Furthermore, according to inspection records N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026, and MS-DRRSPC-DARSQ-AI-086-202, on February 05, 2026, the Health Regulatory Area of Quepos conducted an inspection at the 3 sites indicated by the petitioner and did not confirm the foul odors described (see the reports submitted and the evidence provided).
Consequently, should it be determined that a project needs to be formulated for the Manuel Antonio, Quepos area, it must comply with all phases established in the technical standards, guidelines, and procedures set forth by the Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), given the magnitude of the economic investment involved, for which reason it would be envisioned as a long-term solution. Within the framework of the inter-institutional working group, the conclusion of a cooperation agreement (convenio de cooperación) between AyA, SINAC, the Municipalidad de Quepos, and INDER has been identified as an alternative to accelerate the execution of a potential project, whereby AyA would contribute the technical designs, INDER would assume responsibility for the public procurement (licitación) and execution of the works, and, once completed, the assets would be transferred to AyA for its operation.
In this regard, any intervention must incorporate high-technology solutions—particularly with respect to the PTAR—that allow for the comprehensive treatment of contaminants, given the environmental sensitivity of the coastal area and the protected area. Additionally, the formulation of an independent sanitation project for the Manuel Antonio area has been preliminarily recommended, without incorporating additional flow into the existing project for Quepos, in order to guarantee a technically adequate solution. Finally, there is a clear need to define the financing scheme for the project with precision, bearing in mind that the contribution announced by INDER may prove insufficient to cover the total cost of the required works, making it necessary to explore complementary alternatives and to consider the possibility of multi-year financing schemes, in accordance with applicable regulations (see the reports submitted and the evidence provided).
IV.On the conduct of the Ministry of Health. After analyzing the evidentiary elements submitted, this Tribunal finds that no violation of the petitioner's fundamental rights has occurred with respect to this Ministry. This is because the reports filed by representatives of the respondent authorities—which are deemed given under oath, with the consequences, including criminal consequences, set forth in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter have duly established that the locations described by the petitioner in this amparo petition concerning Playa Manuel Antonio correspond to: • From the main entrance of the PNMA (Parque Nacional Manuel Antonio) to the former park entrance, running alongside Hotel San Bada. • On the northwest side of Mar y Sombra. • In the artificial lagoon arm of a stream adjacent to Kachá. The records in the database of the Área Rectora de Salud de Quepos show that since 2020 the following complaints have been filed concerning improper disposal of wastewater (aguas residuales) at the three locations identified by the petitioner in Manuel Antonio.
Those complaints are set out below: "• For the year 2020: the receipt of 5 complaints is on record, of which in all 5 cases improper wastewater disposal at those sites could not be confirmed. • For the year 2021: there are no records of any complaints formally filed on the subject matter in question. • For the year 2022: the receipt of 3 complaints is on record; in one of those cases it was possible to establish that improper wastewater disposal was taking place, and accordingly the corresponding sanitary order (orden sanitaria) was issued and follow-up was subsequently carried out, confirming compliance. With respect to the other 2 complaints, it was not possible to substantiate what had been reported. • For the year 2023: there are no records of any complaints formally filed on the subject matter in question. • For the year 2024: there are no records of any complaints formally filed on the subject matter in question. • For the year 2025: the receipt of 2 complaints is on record; the problem was substantiated in those cases and the corresponding sanitary order was issued so that the identified nonconformity could be corrected as quickly as possible.
In addition, based on ex officio inspections conducted by this Ministry in the area, 3 additional sanitary orders were issued requiring two establishments in the area and the PNMA itself to correct the improper wastewater disposal that was occurring at that time. • For the year 2026: at present only one complaint regarding wastewater in the area is on record, which pertains to the PNMA; however, that complaint has already been addressed and what was reported could not be confirmed." Furthermore, the Área de Salud has thus far conducted 3 inspections of a group of establishments located in front of Playa Espadilla, in which improper wastewater disposal was evidenced, and the corresponding sanitary order was accordingly issued requiring the identified nonconformity to be remedied. Likewise, through sanitary order N° MS-DRRSPC-DARSQ-OS-260-2024, issued on October 25, 2024, to the establishment Las Delicias, for improper management of wastewater from the bar sink, which was being directed to the curb and drainage channel in front of the establishment.
Accordingly, inspection report N° MS-DRRSPC-DARSQ-AI-028-2025 was drawn up, in which it was recorded that the wastewater from the bar sink was being directed directly to the septic tank and that the establishment was complying with the provisions of sanitary order N° MS-DRRSPC-DARSQ-OS-260-2024. The case was therefore closed. Through sanitary order N° MS-DRRSPC-DARSQ-OS-079-2025, issued and notified on March 26, 2025, to the establishment Baldi's Fresh—an order that was issued following physical-sanitary inspections conducted on March 17, 18, and 20, 2025, in which improper wastewater management was confirmed pursuant to technical report N° MS-DRRSPC-DARSQ-IT-125-2025—said sanitary order required submission of a remedial plan to resolve the situation, as well as the identification of a technically admissible alternative for the disposal of the effluent from the treatment system. However, the establishment's legal representative subsequently surrendered the sanitary operating permit, a circumstance that rendered the previously notified sanitary order moot, since the operating premise under which the measure had been issued ceased to exist.
Through sanitary order N° MS-DRRSPC-DARSQ-OS-0197-2025, issued and notified on July 18, 2025, to the establishment Restaurante Donde Alex 2—an order that was issued following physical-sanitary inspections conducted on July 4, 2025—it was ordered that the establishment must dispose of the restaurant's wastewater in a sanitary manner, within its own property, by means of a treatment system approved by the Ministry of Health, in such a way as to prevent its discharge into the environment. Compliance with this order was verified through inspection report N° MS-DRRSPC-DARSQ-AI-0614-2025, in which it was recorded that the restaurant's wastewater was not being discharged into the environment, and the case was therefore closed. Through sanitary order N° MS-DRRSPC-DARSQ-OS-0250-2025, issued on August 26, 2025, to the establishment Hotel Milenium—an order that was issued following physical-sanitary inspections conducted on August 22, 2025, in which improper disposal of wastewater from the laundry, toilets, showers, and washbasins of rooms 101, 102, and 103 was found, along with deficiencies in the routing of stormwater and accumulation of water on rooftops—it was ordered that the use of those rooms be suspended until the problem was corrected and authorization was obtained from the Ministry of Health, that gutters and downspouts be installed, that improvements be made to prevent stormwater accumulation, that a remedial plan be submitted, and that a technically admissible alternative be identified for the final disposal of the effluent.
Subsequently, on July 1, 2026, the Área Rectora de Salud conducted the corresponding inspection, during which it verified that Hotel Milenium had been operating without a valid sanitary operating permit since April 22, 2026. Accordingly, the Área Rectora de Salud issued and notified sanitary order N° MS-DRRSPC-DARSQ-OS-0151-2026, ordering the immediate closure of the establishment until it holds the corresponding valid sanitary operating permit; that order is currently in force. Through sanitary order N° MS-DRRSPC-DARSQ-OS-0328-2025, issued on November 7, 2025, to the Parque Nacional Manuel Antonio—an order that was issued following physical-sanitary inspections conducted on November 6, 2025, in which deficiencies were confirmed relating to the disposal of wastewater from the park rangers' house, sanitary block N°4, and the showers located in sanitary block N°3—immediate closure of the facilities of the park rangers' house was ordered, along with immediate closure of sanitary block N°4, immediate suspension of the use of the showers in sanitary block N°3, submission of a remedial plan with a timetable, and immediate adjustment of visitor capacity to correspond to the installed sanitary capacity.
In this regard, SINAC submitted the corresponding remedial plan under reference number CARTA-SINAC-SE-SE-1628-2025, which was reviewed by the Área Rectora de Salud de Quepos and approved by means of CARTA-MS-DRRSPC-DARSQ-367-2025 of November 26, 2025. The procedures and timelines proposed for improvements and repairs to the wastewater treatment system for the staff house and the indicated sanitary blocks of the National Park were thereby accepted as satisfactory, with February 13, 2026, set as the maximum compliance date. Subsequently, although implementation has experienced delays, the Park Administration continues working toward compliance with the sanitary order, and the construction project for the wastewater treatment system for the staff house and the indicated sanitary blocks of the National Park was reviewed on the APC platform, with the Ministry of Health's records reflecting a result of "remediation accepted." This indication is made strictly within the technical review scope corresponding to the Ministry of Health.
Now, after the filing of the present petition, on January 13, 2026, the petitioner filed a complaint with the Ministry of Health and SINAC of MINAE concerning the situation described in this amparo petition. Thus, on January 14, 2026, in response to the complaint filed by the petitioner on January 13, 2026, before the Municipalidad de Quepos and the Área Rectora de Quepos, the respondent Municipality and the respondent Área Rectora de Salud conducted an on-site inspection to assess the prevailing sanitary conditions, addressing the situation.
Likewise, following notification of the procedural resolution, according to inspection reports N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026, and MS-DRRSPC-DARSQ-AI-086-2026, on February 5, 2026, the Área Rectora de Salud de Quepos conducted an inspection at the 3 locations identified by the petitioner and did not confirm the foul odors described. Finally, it was not established that, prior to the filing of the present petition, the petitioner had filed a complaint with the Área Rectora de Salud de Quepos concerning the situation set out in the filing brief.
In this regard, it is relevant to reiterate that, prior to the filing of the present petition, the petitioner had not filed a complaint with the Área Rectora de Salud de Quepos concerning the situation described in the amparo; accordingly, no omission can be attributed to that Ministry.
In this connection, through judgment no. 2023-29457 of 12:50 hours on November 10, 2023, issued in case no. 23-012835-0007-CO, this Tribunal established, with respect to the requirement to file a complaint in environmental matters, that "in order for an injury or threat to environmental rights to be heard, whether in general or in particular, we would have to be facing a scenario in which the affected person has filed a complaint, and in the course of its processing a threat has been found or it has been determined that the environment is in fact being harmed, and yet the respondent administrative authorities have taken no measures whatsoever in this regard, thereby violating the constitutional right enshrined in Article 50 of the Carta Magna." However, that same judgment also established that "the Constitutional Tribunal has in fact taken up petitions in which a violation of the right to a healthy and ecologically balanced environment was demonstrated without the need for a prior complaint; this, under two exceptional scenarios, namely: 1) when the case is of great magnitude; and 2) when it can be inferred from the record that the competent authorities have had knowledge of the alleged situation that is threatening or causing harm to the environment and have taken no measures whatsoever in response." On this point, as established above, it is necessary to reaffirm that it is evident that since 2020 multiple complaints have been filed (none by the petitioner) with the respondent Área de Salud concerning improper wastewater disposal at the three locations identified by the petitioner; however, it is established that those complaints have been addressed by the respondent Ministry, conducting the corresponding inspections, ruling out the alleged situation, and issuing sanitary orders when deemed appropriate, with appropriate follow-up in each case.
Accordingly, this Tribunal considers that the Área de Salud has given timely follow-up to the complaints filed by members of the public. Likewise, upon becoming aware of the situation alleged by the petitioner through the amparo proceeding, on January 14, 2026, the respondent Municipality and the respondent Área Rectora de Salud conducted an on-site inspection to assess the prevailing sanitary conditions. A new inspection was also carried out on February 5, 2026, at the reported location, to confirm that the alleged harm did not exist. In other words, the Ministry of Health has been diligent in response to knowledge of complaints at the location identified by the petitioner—complaints that were never filed by the petitioner himself, since it is reiterated that, prior to the filing of the present petition, the petitioner had not filed a complaint with the Área Rectora de Salud de Quepos concerning the situation described in the amparo.
Finally, with respect to the complaint filed by the petitioner on January 13, 2026, before the Ministry of Health, it is reaffirmed that said action was filed after the submission of the present amparo petition, and therefore any claim relating to that complaint is premature.
Accordingly, with respect to this Ministry, no violation of the petitioner's fundamental rights is found.
V.On the conduct of the Municipalidad de Quepos. With respect to this municipal corporation, it is established as proven that there is an initiative on the part of the Municipalidad de Quepos and SINAC to collaborate inter-institutionally toward the construction of a treatment plant in the indicated area; for this reason, the Instituto Costarricense de Acueductos y Alcantarillados was invited to participate, as the lead institution on this subject and the one with the capacity to conduct the technical feasibility studies for the construction of said plant and to determine the most suitable site for its location, taking into account that this is an environmentally fragile area with particular topographic and soil-composition characteristics that must be considered.
Now, after the filing of the present petition, on January 13, 2026, the petitioner filed a request with the Municipalidad de Quepos regarding wastewater management at Playa Espadilla. Thus, on January 14, 2026, in response to a verbal request, the Unidad de Gestión Ambiental of the Municipalidad de Quepos, together with the Unidad de Zona Marítimo Terrestre, the Municipal Police, the engineer from the Unidad de Desarrollo e Infraestructura, and an official from the Ministry of Health, conducted an on-site inspection. As a result of that inspection, the respondent Municipality took several actions upon detecting that apparently at least two businesses were discharging wastewater to the curb and drainage channel in the inspection area, and accordingly a formal complaint was filed that same day with the Ministry of Health so that the competent authority could determine whether the described situation existed.
However, that filing was rejected by the Ministry of Health on the grounds that the persons complained of had to be individually identified. Through official communication MQ-CM-PM-007-26-2025-2026 of January 19, 2026, the President of the Concejo forwarded the petitioner's request to the mayor's office, identified as Oficio: CPE-1060-2-2026. Through official communication MO-ALC-143-2026 of February 2, 2026, the mayor's office of the Municipalidad de Quepos, acting as part of the administrative board of the Parque Nacional Manuel Antonio, sent an official communication to the Instituto Costarricense de Acueductos y Alcantarillados for the purpose of convening an inter-institutional working group focused on addressing the issue as quickly as possible in search of permanent long-term solutions. On February 3, 2026, the general management of the Instituto Costarricense de Acueductos y Alcantarillados communicated the following to the Municipalidad de Quepos: "In response to what was submitted under the heading 'official communication MQ-ALC-143-2026,' I hereby formally acknowledge receipt of the same by this office on 03/02/2026.
This acknowledgment of receipt is issued in strict compliance with the provisions of Article 27 of the Constitución Política, which recognizes the right of petition and the prompt resolution of requests submitted to the Public Administration; as well as Ley N.° 9097 on the Regulation of the Right of Petition and Ley N° 8220 on the Protection of Citizens from Excessive Requirements and Administrative Procedures, which impose on public institutions the duty to provide timely, reasonable, and reasoned responses to requests from members of the public. The appropriate processing will proceed in accordance with current regulations, and you will be duly informed of the progress of the request. With no further matters to report, I thank you for your attention and reiterate our commitment to transparency, efficiency, and continuous improvement in service to users and the public." Likewise, following notification of the procedural resolution, through official communication MQ-UGA-023-2026 of February 6, 2026, biologist Warren Umaña Cascante of the Municipalidad de Quepos requested that the Ministry of Health consider adapting its complaint-handling methodology to the particularities of this case and expressed the Municipality's willingness to collaborate in addressing it.
Through official communication MO-ALC-142-2026 of February 6, 2026, the mayor's office of the Municipalidad de Quepos forwarded the petitioner's response to the Concejo for consideration at an ordinary session by that body, since the petitioner had addressed his request to that body. Through official communication no. MQ-UZMT-24-2026 of February 9, 2026, the head of the Unidad de Zona Marítimo Terrestre of the Municipalidad de Quepos communicated the following to the mayor: "4- Furthermore, as a result of meetings in which this Unit has participated with the Ministerio de Ambiente, inter-institutional coordination has been carried out to convene a working group among MINAE, AyA, and the Municipalidad de Quepos, to determine long-term measures such as the construction of a sewerage system and a treatment plant to provide service in Manuel Antonio. This alternative primarily requires the expertise of AyA; accordingly, through official communication MQ-ALC-143-2026 of February 2, 2026, your mayor's office, with the collaboration of this Unidad de Zona Marítimo Terrestre, requested that the Executive Presidency of AyA visit the Canton of Quepos in order to convene an inter-institutional working group. 5- Finally, with respect to financing for the construction of a sanitary sewerage project at Playa Espadilla, it is technically impossible to define amounts or financing channels for a project for which we have not yet defined construction plans, or even technical feasibility.
There is no certainty regarding the location of a possible treatment plant specifically for this sector, since determining this involves highly technical criteria. 6- The Municipalidad de Quepos is aware that AyA purchased a 1.8-hectare parcel (Finca No. 236382) for the installation of a treatment plant for the city of Quepos, and is aware that construction plans exist for the sanitary sewerage system for the entire city of Quepos; however, it is unknown whether this already-designed system is capable of receiving the wastewater from Manuel Antonio or whether AyA is considering another alternative to provide service in the sector of interest to the complainant. For this sewerage project for the city of Quepos, along with projects in Jacó and Golfito, AyA had secured financing through a loan between Costa Rica and Banco KFW Frankfurt am Main, approved by the Asamblea Legislativa in 2019. However, the Ministerio de Hacienda on August 16, 2023, notified the Instituto Costarricense de Acueductos y Alcantarillados (AyA) of the cancellation of the program and the elimination of the budget and financing for the projects in those communities.
It is clear that, given the very high cost of this type of project, directing resources from its Municipal budget to single-handedly cover a project of this magnitude poses a financial challenge for the Municipalidad de Quepos, which therefore requires the participation of other institutions and the Central Government." Finally, it was not established that, prior to the filing of the present petition, the petitioner had filed a complaint with the Municipalidad de Quepos concerning the situation set out in the filing brief.
Accordingly, as noted in the preceding considerando, it is relevant to reiterate that, prior to the filing of the present petition, the petitioner had not filed a complaint with the Municipalidad de Quepos concerning the situation described in the amparo; therefore, no omission can be attributed to that municipal corporation with respect to any complaint by the petitioner. Consequently, with respect to the complaint filed by the petitioner on January 13, 2026, before the respondent Municipality, it is reaffirmed that said action was filed after the submission of the present amparo petition, and therefore any claim relating to that complaint is premature. Accordingly, on this point the petition against the Municipalidad de Quepos is denied.
However, notwithstanding the actions taken by the respondent Municipality, this Tribunal does find an omission on the part of that municipal corporation with respect to its obligations. In this regard, it has been duly established that, even before the petitioner had filed any formal administrative request, the respondent Municipality had already activated inspection mechanisms, inter-institutional coordination, and complaints before the competent authorities; accordingly, there currently exists an initiative on the part of the Municipalidad de Quepos and SINAC to collaborate inter-institutionally toward the construction of a treatment plant in the indicated area, which is why the Instituto Costarricense de Acueductos y Alcantarillados was invited to participate, as the lead institution on this subject and the one with the capacity to conduct the technical feasibility studies for the construction of said plant and to determine the most suitable site for its location, taking into account that this is an environmentally fragile area with particular topographic and soil-composition characteristics that must be considered.
Thus, while it is true that, prior to the filing of the present petition, the corresponding complaint had not been filed, the fact remains that the Municipalidad de Quepos was aware, even before any complaint was filed, of the possible need to construct a treatment plant in the indicated area. In this regard, it is necessary to reiterate what was stated in the preceding considerando, to the effect that "the Constitutional Tribunal has in fact taken up petitions in which a violation of the right to a healthy and ecologically balanced environment was demonstrated without the need for a prior complaint; this, under two exceptional scenarios, namely: 1) when the case is of great magnitude; and 2) when it can be inferred from the record that the competent authorities have had knowledge of the alleged situation that is threatening or causing harm to the environment and have taken no measures whatsoever in response." It is thus evident that the Municipality did have knowledge, even before any complaint was filed, of the possible need to construct a treatment plant in the indicated area.
On this point, it should be noted that the petitioner alleges that "the urgent need for a treatment plant in full operation has become apparent, since at various points along, for example, Playa Espadilla and Parque Manuel Antonio, foul odors resembling septic-tank odors can be detected (…) environmental advocates in the area have raised the situation before the Concejo of Quepos; however, the administration has not addressed the environmental problem as a priority." In this regard, the respondent Municipality does not deny this situation or deny having knowledge of what is described, but in its sworn report it confines itself to stating that "(…) the petitioner is not being truthful in claiming that there are funds earmarked for the construction of a plant that have not been used due to a lack of interest on the part of the local government, or that the land is under municipal ownership; what is true is that there is an initiative on the part of the Municipality and SINAC to collaborate inter-institutionally toward the construction of a treatment plant; however, precisely for that reason the lead institution on the subject, AyA, has been invited to participate, since it has the capacity to conduct the technical feasibility studies for the construction of that plant and to determine the most suitable site for its location, taking into account that this is an environmentally fragile area with particular topographic and soil-composition characteristics that must be considered (…) In the present case, the petitioner has not established the existence of an unlawful, arbitrary, or negligent omission on the part of the Municipalidad de Quepos.
On the contrary, it has been duly established that, even before the petitioner had filed any formal administrative request, the Municipality had already activated inspection mechanisms, inter-institutional coordination, and complaints before the competent authorities. This representation respectfully considers that an amparo petition does not lie when the Administration is acting within a reasonable margin of diligence, even when the definitive solution to the reported problem is complex or requires progressive, long-term action (…) The municipality's own management demonstrates that the technical, environmental, and territorial feasibility of the project is still under analysis, which is entirely reasonable and constitutionally valid." In other words, the Municipality itself acknowledges that the reported problem requires a solution; however, there is no record of the Municipalidad de Quepos having resolved the question of whether or not a treatment plant needs to be built at Playa Manuel Antonio, revealing an omission on the Municipality's part with respect to its obligations.
Likewise, it should be noted that, upon becoming aware of the situation through the amparo proceeding, the respondent Municipality has taken the following actions: "conducted an on-site inspection on January 14, 2026 (…) • The inspection was coordinated with multiple municipal departments and with the Ministry of Health, the lead authority on environmental sanitation matters. • A formal complaint was filed with the Ministry of Health upon detection of apparent irregularities, demonstrating active willingness to address them. • Subsequent actions were taken to overcome the technical limitations identified by the Ministry of Health. • An inter-institutional working group was promoted with AyA, the institution competent to conduct technical studies, design, and the eventual construction of a treatment plant." In other words, despite confirming that the Municipality did have knowledge of the question of whether a treatment plant is needed at Playa Manuel Antonio, the fact remains that to date it has only promoted an institutional working group without resolving the underlying issue.
In this regard, it is important to cite what was stated in ruling no. 2026-026822, issued at 09:25 hours on July 17, 2026, which established, in the relevant part, the following: "It must not be overlooked that the Municipalidad de Limón, as administrator of local interests and services (Article 169 of the Constitución Política), and the body before which the complaint of July 17, 2025 was filed, cannot distance itself from the problems presented and must act as a coordinator of the concerted intervention of the Administration, since, as has been seen, the definitive solution requires the integration of efforts and the action of various departments. This Sala Constitucional, in ruling No. 2020-010630, issued at 09:15 hours on June 12, 2020, explained: '(…) MUNICIPAL COMPETENCE AND OBLIGATION OF INTERINSTITUTIONAL COORDINATION. Municipal competence and obligation of interinstitutional coordination.
Article 169 of the Constitución Política provides that "The administration of local interests and services in each canton shall be the responsibility of the Municipal Government (...)." This provision has been developed by the ordinary legislator; accordingly, Article 3 of the Código Municipal, Ley N° 7794 of April 30, 1998, provides that: "The government and administration of cantonal interests and services shall be the responsibility of the municipal government." The Sala Constitucional has expressed the same view in its case law. For instance, in Sentencia N° 5445-99, issued at 14:30 hours on July 14, 1999, the following was established: "VI.- ON THE POWERS OF MUNICIPALITIES BY SUBJECT MATTER (THE CONCEPT OF 'THE LOCAL'). By express constitutional mandate—Article 169—a specific assignment of functions or powers is made in favor of local governments by subject matter, referring to 'the local,' that is, 'the administration of the services and interests' of the locality to which each is circumscribed, for which purpose it is endowed with autonomy (...).
Therefore, its powers are general in nature, since there is no detailed enumeration of its specific duties but merely a general statement of the scope of its competence; yet this does not make those duties indeterminate, as this Tribunal addressed in ruling number 6469-97, issued at sixteen hours and twenty minutes on October 8, nineteen ninety-seven, in the following terms: '(...) the local character carries such significance that defining its scope—whether by the legislator or by a judge—must lead to the preservation of the integrity of local interests and services, in such a way that not even the legislator could enact rules tending to dismember the Municipality (its territorial element) without following the procedures previously established in the Constitución Política; nor could the legislator enact provisions that place its inhabitants (population) in conditions clearly inferior to those of the rest of the country; nor measures that affect the very essence of the local (government), converting the Corporation into a mere empty shell in which only the name subsists while the entire regime—as conceived by the National Constituent Assembly—is rendered ineffective.
In other words, there will be duties that are by their nature municipal—local—and cannot be removed from that sphere of competence to be converted into national or state services or interests, because doing so would disarticulate the Municipality, or more precisely, drain it of its constitutional substance; and therefore, it is not possible to establish in advance the impassable limits of the local, but rather, to determine what does or does not correspond to the communal government, it must be extracted from the examination of each specific case (...).' From the foregoing, it is clear that, by the express will of our Fundamental Charter, a specific competence is assigned to local governments—a competence that, moreover, is exclusive to them; that is, it is an original competence of the municipality, and it may be displaced, in whole or in part, only by a nationalization or regionalization law.' Consequently, if a group of municipal residents (munícipes), within their territorial jurisdiction, suffer flooding that endangers their lives and causes serious property, psychological, and quality-of-life harm and general loss of well-being, this falls within the concept of 'local interests and services' under Article 169 of the Constitution, problems whose causes must be precisely identified and, even more so, whose solutions must be found and implemented as swiftly as possible; to which end, it is the Municipality's responsibility to coordinate with nationally competent institutions capable of acting on the problem.
Indeed, the Sala has already developed the municipal obligation to coordinate with other state institutions in order to attend to 'interests' and duly provide 'local services.' In the aforementioned Sentencia N° 5445-99, the Sala stated: '(...) these provisions refer to the obligation of coordination that must exist between local governments, decentralized institutions, and the Executive Branch, in order to carry out the functions assigned to them, which must be analyzed from the standpoint of the very nature of municipal autonomy. It is by virtue of Article 170 of the Constitution that municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in the administration of local interests and services (Article 169 of the Constitución Política) (...). A conflict cannot, then, be created through antagonism or rivalry between the subject matter that constitutes the general aim of "local interests and services" and the "national" or "state" public interests and services—intrinsically distinct from one another, but in reality destined to coexist (...).
Once the material competence of the municipality within a given territorial jurisdiction is defined, it becomes clear that there will be duties that are by their nature exclusively municipal, alongside others that may be deemed national or state; it is therefore essential to define the form of co-participation in powers that inevitably results, since the public capacity of the municipalities is local and that of the State and other entities is national; it follows that municipal territory is simultaneously state and institutional territory, to the extent required by circumstances. That is, municipalities may share their competences with the Public Administration in general, a relationship that must develop in the terms defined by law (Article 5 of the former Código Municipal, Article 7 of the new Código Municipal), which establishes the obligation of "coordination" between municipalities and the public institutions that concurrently exercise their competences, in order to avoid duplication of efforts and contradictions—above all because only voluntary coordination is compatible with municipal autonomy, as its expression.
In other words, the municipality is called upon to enter into cooperative relations with other public entities, and vice versa, given the concurrent or coinciding—in many cases—interests around a specific matter. In legal doctrine, coordination is defined from the existence of several independent centers of action, each with its own duties and decision-making powers, and potentially divergent ones; nevertheless, there must exist a community of purpose by subject matter—though by concurrence—insofar as the entity receiving the final results of the activity and acts of each center is the same.' So coordination is the ordering of relations among these various independent activities, which accounts for their concurrence on the same object or entity, making it useful for a comprehensive public plan, without suppressing the mutual independence of the acting subjects. Since there is no hierarchical relationship between decentralized institutions or the State itself in relation to the municipalities, it is not possible to impose certain conduct upon them, which gives rise to the indispensable interinstitutional 'concert,' in the strict sense: autonomous and independent centers of action reach agreement on that preventive and comprehensive framework, in which each fulfills a role in view of a mission entrusted to the others.' It should be noted, furthermore, that Municipalities are required, by mandate of Article 50 of the Constitución Política, to devote themselves to the protection of the environment (Sentencia N° 2006-7994, issued at 8:57 hours on June 2, 2006) (...)" (sic) (reiterated in ruling No. 2026-05217, issued at 09:34 hours on February 13, 2026) (emphasis not in the original).
Accordingly, from what has been stated, it is the obligation of the respondent Municipality to coordinate in seeking a solution given the possible need—or lack thereof—to construct a wastewater treatment plant (planta de tratamiento). That being the case, it is reaffirmed that the Municipality was indeed aware of whether or not there was a need to build a treatment plant in Playa Manuel Antonio; however, as of this date it has only convened an institutional working committee (mesa de trabajo) without resolving the substantive issue. Therefore, given the absence of a solution to a problem that may affect the environment and the right of the residents of that canton to a healthy and balanced environment, an omission on the part of the Municipal Corporation is apparent, and consequently, a violation of fundamental rights. In this regard, the writ of amparo (recurso de amparo) is granted solely with respect to this point and against the Municipalidad de Quepos.
VI.On the conduct of the National System of Conservation Areas of MINAE. In this regard, it has been established as proven that in October 2025, an earthquake occurred that damaged the internal infrastructure of the wastewater treatment system of Parque Nacional Manuel Antonio, which prompted SINAC to activate institutional emergency mechanisms, including a declaration of national emergency. Coordination was also carried out with the Área Rectora de Salud de Quepos, leading to sanitary order (orden sanitaria) N° MS-DRRSPC-DARSQ-OS-0328-2025, issued on November 7, 2025. Accordingly, the Park Administration continues working to comply with the sanitary order, and the construction project for the wastewater treatment system serving the employees' housing and the restroom facilities identified at Parque Nacional Manuel Antonio was reviewed on the APC platform, with the Ministry of Health recording the result as "corrective submission accepted." However, this situation bears no causal relationship to the matter reported in the present writ of amparo by the petitioner.
This is because, from a technical and material standpoint, these internal facilities are located 1.2 kilometers from the main entrance and from the stream in question; therefore, contamination from these systems toward the reported area is unlikely. Moreover, both systems had independent drainage systems and no effluent directed toward those bodies of water.
Furthermore, subsequent to the filing of the present writ of amparo, on January 13, 2026, the petitioner filed a complaint with the National System of Conservation Areas of MINAE regarding the situation described in the present writ. That complaint was recorded in the SITADA system under number 59948-2026. On January 19, 2026, the National System of Conservation Areas of MINAE conducted a field inspection at the site reported by the petitioner. Thus, the technical evidence submitted by the Administration of Parque Nacional Manuel Antonio demonstrates that the reported facts did not originate within the protected area but in zones external to it, and that the streams mentioned enter the park only at their final stretch; therefore, any potential contamination is generated upstream, outside SINAC's jurisdiction. Likewise, in official record (acta) N° 3765, it is noted that "it was possible to observe stream La Camaronera emitting an unpleasant odor, though the source of the foul smell could not be identified; accordingly, while walking along the bank of the stream we reached a point where two culverts discharging wastewater (aguas residuales) into the stream were identified.
Photographs and GPS coordinates were taken, and the complaint was referred to the Ministry of Health, as this falls within their jurisdiction." Thus, the inspection revealed indications of impact without being able to establish its origin with certainty. Consequently, on January 21, 2026, the case was referred to the Ministry of Health for its attention in accordance with its competences. On June 22, 2026, prior to notification of the decision to extend the proceedings to that institution, through Official Communication CARTA-SINAC-ACOPAC-DR-DRFVS-OSRAP-0154-2026, SINAC proceeded to notify the petitioner of the actions taken regarding his complaint. Finally, the Área Rectora de Salud de Quepos, in coordination with the National System of Conservation Areas of MINAE, has conducted technical verifications at Playa Nacional Manuel Antonio through fluorescein (fluoresceína) tests and assessments, which have ruled out the park's treatment systems as a source of contamination, confirming that they are operating adequately.
Thus, the Park's treatment systems and the treatment plant located at the main entrance use drainage systems as their final disposal mechanism, and these have been shown to be fully functional and not affecting this waterway. The staff of Playa Nacional Manuel Antonio conduct ongoing routine patrols in the aforementioned areas. During these inspection rounds, it is confirmed that the waterway enters the Park, but no evidence of irregular discharges or tributaries originating from neighboring properties is found.
In this regard, it is established that the National System of Conservation Areas of MINAE proceeded to process the complaint filed by the petitioner—which, it is reiterated, was filed after the present writ of amparo was submitted—conducting the inspection, referring the complaint to the Ministry of Health, and notifying the petitioner accordingly. It has also coordinated with the Área Rectora de Salud de Quepos. Accordingly, it is reiterated that, jointly, technical verifications have been conducted at Playa Nacional Manuel Antonio through fluorescein tests and assessments, which have ruled out the park's treatment systems as a source of contamination, confirming that they are operating adequately. Thus, the Park's treatment systems and the treatment plant located at the main entrance use drainage systems as their final disposal mechanism, and these have been shown to be fully functional and not affecting this waterway. Finally, it is also reiterated that the staff of Playa Nacional Manuel Antonio conduct ongoing routine patrols in the aforementioned areas. During these inspection rounds, it is confirmed that the waterway enters the Park, but no evidence of irregular discharges or tributaries originating from neighboring properties is found.
Consequently, it is apparent that the National System of Conservation Areas has acted in accordance with its competences and has processed the petitioner's complaint. In any event, it is reaffirmed that said complaint was filed after the present writ of amparo was submitted; therefore, any claim regarding that complaint is premature.
Consequently, with respect to SINAC, no violation of the petitioner's fundamental rights is found.
VII.On the conduct of the Instituto Costarricense de Acueductos y Alcantarillados. In this regard, on January 14, 2026, following the complaint filed by the petitioner on January 13, 2026 with the Municipalidad de Quepos and the Área Rectora de Quepos, the respondent Municipality and the respondent Área Rectora de Salud conducted an on-site inspection to assess the prevailing sanitary conditions. Accordingly, given the absence of a collective sanitary sewer system (sistema colectivo de alcantarillado sanitario), the applicable regulations impose the obligation that wastewater be treated through adequate individual systems. In the case of dwellings, this entails the use of septic tanks, while commercial establishments—such as hotels, restaurants, and others that generate special-category wastewater—are required to have specific treatment systems—including treatment plants—duly approved, supervised, and monitored by the Ministry of Health and the relevant municipality.
It was thus confirmed on site that there were discharges of untreated wastewater into the beach and sea in the vicinity of Parque Nacional Manuel Antonio. Accordingly, it is established that, as a result of complaints from area residents, the Ministry of Health itself has had to intervene in response to situations that reveal deficiencies in wastewater management. Likewise, according to inspection records N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026, and MS-DRRSPC-DARSQ-AI-086-202, on February 5, 2026, the Área Rectora de Salud de Quepos conducted an inspection at the 3 sites identified by the petitioner and did not verify the foul odors described. Subsequently, the Municipalidad de Quepos promoted the formation of an interinstitutional working committee, with the participation of the Instituto Costarricense de Acueductos y Alcantarillados and other strategic stakeholders with the potential to contribute technically and financially to the resolution of the wastewater problem, such as the National System of Conservation Areas (SINAC) and the Instituto de Desarrollo Rural (INDER).
In March 2026, as a result of the aforementioned coordination, the institutions involved conducted a joint technical visit to the Manuel Antonio area with the aim of analyzing the feasibility of developing a comprehensive sanitation project. In that process, the Municipalidad de Quepos, SINAC, and INDER agreed on the need to promote the formulation and eventual construction of a sanitary sewer system (AS) and a wastewater treatment plant (PTAR), as a structural solution to the problem. Accordingly, INDER has expressed its willingness to contribute approximately three billion colones (US$ 6,2 millones), without prejudice to the fact that the Instituto Costarricense de Acueductos y Alcantarillados, as the specialized technical body, must conduct the relevant assessments to determine the most appropriate solution from technical, economic, and environmental standpoints. Consequently, should the need to formulate a project for the Manuel Antonio, Quepos area be determined, it must comply with all phases established by the technical standards, guidelines, and procedures set forth by the Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), given the project's substantial financial investment, which is why it would be viewed as a long-term solution.
Accordingly, within the framework of the interinstitutional committee, the execution of a possible cooperation agreement between AyA, SINAC, the Municipalidad de Quepos, and INDER has been identified as an alternative to accelerate the implementation of a potential project, whereby AyA would provide the technical designs, INDER would assume responsibility for the bidding and execution of the works, and, upon their completion, the assets would be transferred to AyA for operation. In this regard, any intervention must contemplate high-technology solutions—particularly with respect to the PTAR—that enable comprehensive treatment of contaminants, given the environmental sensitivity of the coastal zone and the protected area. Additionally, the preliminary recommendation has been made to formulate an independent sanitation project for the Manuel Antonio area, without incorporating additional flow volumes into the existing project for Quepos, in order to ensure a technically adequate solution.
Finally, the need arises to clearly define the financing structure for the project, with the understanding that the contribution announced by INDER could prove insufficient to cover the total cost of the required works, and that complementary alternatives must be explored, including the possibility of multi-year financing arrangements in accordance with applicable regulations. Finally, it was not established as proven that, as of this date, the petitioner has filed a complaint with the Instituto Costarricense de Acueductos y Alcantarillados regarding the situation described in the petition.
In this way, it is apparent that the Instituto Costarricense de Acueductos y Alcantarillados has not received any complaint from the petitioner regarding the situation described in the present writ of amparo; therefore, it is not possible to establish any omission on the part of that institution.
Furthermore, the Instituto Costarricense de Acueductos y Alcantarillados is currently engaged in a coordination process with the Municipalidad de Quepos, SINAC, and INDER to develop a comprehensive sanitation project. These institutions have agreed on the need to promote the formulation and eventual construction of a sanitary sewer system (AS) and a wastewater treatment plant (PTAR). Consequently, should the need to formulate a project for the Manuel Antonio Quepos area be determined, it must comply with all phases established by the technical standards, guidelines, and procedures set forth by MIDEPLAN, given the project's substantial financial investment, which is why it would be viewed as a long-term solution. Accordingly, within the framework of the interinstitutional committee, the execution of a possible cooperation agreement between AyA, SINAC, the Municipalidad de Quepos, and INDER has been identified as an alternative to accelerate the implementation of a potential project, whereby AyA would provide the technical designs, INDER would assume responsibility for the bidding and execution of the works, and, upon their completion, the assets would be transferred to AyA for operation.
Therefore, these institutions are currently carrying out the relevant coordination efforts, including the possible execution of a cooperation agreement between AyA, SINAC, the Municipalidad de Quepos, and INDER. Accordingly, while it is true that no collective sanitary sewer system exists in Playa Manuel Antonio, as stated under oath by the representative of the Instituto Costarricense de Acueductos y Alcantarillados, the applicable regulations impose the obligation that wastewater be treated through adequate individual systems—a situation that, as evidenced in the preceding recitals, has been addressed by the Área Rectora de Salud de Quepos through its intervention in response to situations that reveal deficiencies in wastewater management, by conducting the appropriate inspections, issuing the corresponding sanitary orders, and ensuring compliance therewith.
In any event, with respect to ICAA's conduct, it is reiterated that as of this date no sanitation project has been approved, nor has the construction of a sewer system and treatment plant been approved; rather, the matter is at a coordination stage, at which point it is technically impossible to define amounts or financing mechanisms for a project that has neither construction plans nor even established technical feasibility (viabilidad técnica). Therefore, as stated above, there is no certainty regarding the location of a possible treatment plant specifically for this area, since determining this involves highly technical criteria that are currently being addressed through coordination within the aforementioned institutional committee. It therefore exceeds this Tribunal's competences to order the possible construction of a project that has not been approved, that is in the process of defining technical criteria, that as of this date has not even established technical feasibility, and that is in its initial phases. It should also be noted that these coordination activities within the interinstitutional committee have been undertaken since this year, and thus no unjustified delay is apparent, nor has a disproportionate period of time elapsed with respect to ICAA; therefore, no violation of the petitioner's fundamental rights is found in this regard either.
Consequently, with respect to ICAA, no violation of the petitioner's fundamental rights is found.
VIII.Conclusion. As indicated in recital V, a violation of the petitioner's fundamental rights by the Municipalidad de Quepos is indeed apparent, stemming from the failure to resolve the question of whether or not a treatment plant in Playa Manuel Antonio is necessary. Consequently, it is established that the writ of amparo is partially granted solely with respect to what was set forth against the Municipalidad de Quepos.
As to all other matters, the writ must be dismissed in all its aspects. It is important to remind the respondent authorities that they must continue processing the complaints filed by the petitioner, which must be addressed and resolved within a reasonable period of time. Furthermore, with respect to the Ministry of Health, SINAC, and ICAA, they are reminded of their duty to continue coordinating with the Municipalidad de Quepos to develop, within a reasonable period of time, a comprehensive sanitation project or the construction of a sewer system and treatment plant at the reported location, in accordance with the applicable technical criteria.
The parties are hereby notified that if any document has been submitted in paper form, as well as any objects or evidence contained in additional electronic, computer-based, magnetic, optical, telematic, or new-technology devices, these must be retrieved from the office within a maximum period of 30 business days counted from notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, artículo XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, artículo LXXXI.
Por tanto:
The writ of amparo is partially granted solely against the Municipalidad de Quepos for failure to resolve the question of whether or not to build a treatment plant in Playa Manuel Antonio. Consequently, Patricia Bolaños Murillo, in her capacity as mayor (alcaldesa), and Marta Bosques Marchena, in her capacity as president of the Municipal Council (Concejo Municipal), both of the Municipalidad de Quepos, or whoever may hold those positions, are hereby ordered to, in coordination with the other relevant institutions, issue the appropriate orders and carry out all actions within the scope of their competences so that, within a period of SIX MONTHS counted from notification of this ruling, the question of whether or not to build a treatment plant in Playa Manuel Antonio is definitively resolved in accordance with the law. The Municipalidad de Quepos is hereby warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or enforce, issued in a writ of amparo, and fails to comply with it or fails to enforce it, provided the offense is not more severely penalized under another provision.
The Municipalidad de Quepos is ordered to pay the costs, damages, and losses occasioned by the facts giving rise to this declaration, which shall be assessed in enforcement proceedings before the administrative courts (contencioso administrativo). In all other respects, the writ is dismissed. The respondent authorities are hereby directed to take note of what is indicated in recital VIII of this ruling. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE QUEPOS, y el MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. El recurrente reclama violación a sus derechos fundamentales, pues en las cercanías y alrededores del Parque Nacional Manuel Antonio se requiere urgentemente de una planta de tratamiento, ya que en varios puntos de la playa y del parque se percibe malos olores, produciendo contaminación. Afirma que esa situación ha sido manifestada por regidores, pero las autoridades recurridas no han buscado una solución al problema.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
- Sobre la actuación del Ministerio de Salud:
Con respecto a las otras 2 denuncias, no fue posible evidenciar lo denunciado. • Para el año 2023: no se tienen registros que se hayan interpuesto formalmente denuncias relacionadas al tema en cuestión. • Para el año 2024: no se tienen registros que se hayan interpuesto formalmente denuncias relacionadas al tema en cuestión. • Para el año 2025: se tienen registradas la recepción de 2 denuncias, de las cuales fue evidenciada la problemática y se procedió a notificar la orden sanitaria correspondiente para que la no conformidad identificada fuese corregida a la brevedad posible. Además, según inspecciones de oficio realizadas por este ministerio en la zona, se realizó la notificación de 3 órdenes sanitarias adicionales para que dos establecimientos de la zona y el propio PNMA realizara la corrección de la disposición inadecuada de aguas residuales que se estaban presentando en su momento. • Para el año 2026: actualmente se tiene registrado únicamente una denuncia por el tema de aguas residuales en la zona, la cual corresponde al PNMA, sin embargo, la misma ya fue atendida y no se comprobó lo denunciado”.
Además, dicha Área de Salud ha realizado hasta el momento 3 inspecciones a un grupo de establecimientos ubicados frente a playa Espadilla, en los cuales se ha evidenciado una disposición inadecuada de aguas residuales y por ende se realizó la notificación de la orden sanitaria correspondiente para que sea subsanada la no conformidad identificada (ver los informes rendidos y la prueba aportada).
Por consiguiente, el Área Rectora de Salud dictó y notificó la orden sanitaria N° MS-DRRSPC-DARSQ-OS-0151-2026, mediante la cual ordenó la clausura inmediata del establecimiento hasta que cuente con el respectivo permiso sanitario de funcionamiento vigente, orden que actualmente está vigente (ver los informes rendidos y la prueba aportada).
De ese modo, se tuvo por conforme el proceder y los plazos propuestos para las mejoras y reparaciones del sistema de tratamiento de aguas residuales de la casa de funcionarios y de las baterías sanitarias indicadas del Parque Nacional, fijándose como fecha máxima de cumplimiento el 13 de febrero de 2026. Posteriormente, si bien la ejecución ha presentado retrasos, la Administración del Parque continúa trabajando en el cumplimiento de la orden sanitaria y el proyecto constructivo del sistema de tratamiento de aguas residuales de la casa de funcionarios y de las baterías sanitarias indicadas del Parque Nacional fue revisado en la plataforma APC, constando para el Ministerio de Salud el resultado de “subsanación aceptada”. Esta indicación se formula estrictamente dentro del ámbito técnico de revisión correspondiente al Ministerio de Salud (ver los informes rendidos y la prueba aportada).
- Sobre la actuación de la Municipalidad de Quepos:
No existe certeza de ubicación de una posible planta de tratamiento específicamente para este sector, ya que definir esto corresponde a criterios altamente técnicos. 6- Ahora bien, la Municipalidad de Quepos tiene conocimiento que el AyA compró un terreno de 1.8 hectáreas (Finca No. 236382) para la instalación de una planta de tratamiento para la ciudad de Quepos y tiene conocimiento que existen los planos constructivos para el alcantarillado sanitario de toda la ciudad de Quepos, sin embargo, se desconoce si este sistema ya diseñado es capaz de recibir las aguas servidas de Manuel Antonio o si el AyA considera otra alternativa para brindar el servicio en el sector de interés del denunciante. Para este proyecto de alcantarillado de la ciudad de Quepos junto a proyectos en Jacó y Golfito, el AyA contaba con financiamiento de un préstamo entre Costa Rica y el Banco KFW Frankfurt am Main, aprobado por la Asamblea Legislativa en 2019.
Sin embargo, el Ministerio de Hacienda el 16 de agosto de 2023 comunicó al Instituto Costarricense de Acueductos y Alcantarillados (AyA) la cancelación del programa y la eliminación del presupuesto y financiamiento de los proyectos a esas comunidades. Es claro que, por el costo tan elevado de este tipo de proyectos, a la Municipalidad de Quepos le representa una dificultad financiera dirigir recursos de su presupuesto Municipal para cubrir por sí sola una obra de esta envergadura, por lo cual requiere del concurso de otras instituciones y del Gobierno Central” (ver los informes rendidos y la prueba aportada).
- Sobre la actuación del Sistema Nacional de Áreas de Conservación (SINAC):
- Sobre la actuación del Instituto Costarricense de Acueductos y Alcantarillados:
Así, se constató en sitio la existencia de descargas de aguas residuales sin tratamiento hacia la playa y el mar en las inmediaciones del Parque Nacional Manuel Antonio. Por lo que, se comprueba que, a raíz de denuncias de vecinos de la zona, el propio Ministerio de Salud ha debido intervenir en atención de situaciones que evidencian deficiencias en el manejo de aguas residuales. Asimismo, según las actas de inspección N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026 y MS-DRRSPC-DARSQ-AI-086-202, el 05 de febrero de 2026 el Área Rectora de Salud de Quepos realizó una inspección en los 3 sitios indicados por el recurrente y no comprobó los malos olores descritos (ver los informes rendidos y la prueba aportada).
Por consiguiente, en caso de que se determine la necesidad de formular un proyecto para la zona de Manuel Antonio, Quepos, este deberá cumplir con todas las fases establecidas con las normas técnicas, lineamientos y procedimientos que ha establecido el Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), esto debido a su gran inversión económica, razón por la cual, se visualizaría como una solución a largo plazo. De ese modo, en el marco de la mesa interinstitucional, se ha identificado como alternativa para acelerar la ejecución de un eventual proyecto la suscripción de un convenio de cooperación entre el AyA, el SINAC, la Municipalidad de Quepos y el INDER, mediante el cual el AyA aportaría los diseños técnicos, el INDER asumiría la licitación y ejecución de las obras, y, una vez concluidas, los activos serían transferidos al AyA para su operación. Al respecto, cualquier intervención deberá contemplar soluciones de alta tecnología —particularmente en lo relativo a la PTAR—que permitan el tratamiento integral de contaminantes, considerando la sensibilidad ambiental de la zona costera y del área protegida.
Adicionalmente, se ha recomendado, de manera preliminar, la formulación de un proyecto de saneamiento independiente para la zona de Manuel Antonio, sin incorporar incrementos de caudal al proyecto existente para Quepos, en aras de garantizar una solución técnicamente adecuada. Finalmente, se impone la necesidad de definir con claridad el esquema de financiamiento del proyecto, en el entendido de que el aporte anunciado por el INDER podría resultar insuficiente para cubrir la totalidad de las obras requeridas, debiendo explorarse alternativas complementarias y considerar la posibilidad de esquemas de financiamiento plurianual, de conformidad con la normativa aplicable (ver los informes rendidos y la prueba aportada).
IV.Sobre la actuación del Ministerio de Salud. Después de analizar los elementos probatorios aportados, este Tribunal verifica que no ha existido violación a los derechos fundamentales del recurrente en cuanto a este Ministerio. Lo anterior, porque en los informes rendidos por los representantes de las autoridades recurridas -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que los puntos que describe el recurrente en el presente recurso de amparado referente a la playa Manuel Antonio corresponden a: • De la entrada principal del PNMA (Playa Nacional Manuel Antonio) a la antigua entrada del parque, bordeando contiguo al Hotel San Bada. • En el costado noroeste de Mar y Sombra. • En la laguna artificial brazo de quebrada contiguo a Kachá.
En los registros de la base de datos del Área Rectora de Salud de Quepos consta que desde el 2020 se han presentado las siguientes denuncias relacionadas a una disposición inadecuada de agua residuales en los tres puntos señalados por el recurrente en Manuel Antonio. Dichas denuncias se indican a continuación: “• Para el año 2020: se tienen registradas la recepción de 5 denuncias, de las cuales las 5 no fue comprobado la disposición inadecuada de aguas residuales en los sitios. • Para el año 2021: no se tienen registros que se hayan interpuesto formalmente denuncias relacionadas al tema en cuestión. • Para el año 2022: se tiene registrado la recepción de 3 denuncias, en donde se logra evidenciar que en uno de los casos existía una disposición inadecuada de aguas residuales, por lo que se notifica la orden sanitaria correspondiente y posteriormente realiza el seguimiento se da misma y se comprueba su cumplimiento.
Con respecto a las otras 2 denuncias, no fue posible evidenciar lo denunciado. • Para el año 2023: no se tienen registros que se hayan interpuesto formalmente denuncias relacionadas al tema en cuestión. • Para el año 2024: no se tienen registros que se hayan interpuesto formalmente denuncias relacionadas al tema en cuestión. • Para el año 2025: se tienen registradas la recepción de 2 denuncias, de las cuales fue evidenciada la problemática y se procedió a notificar la orden sanitaria correspondiente para que la no conformidad identificada fuese corregida a la brevedad posible. Además, según inspecciones de oficio realizadas por este ministerio en la zona, se realizó la notificación de 3 órdenes sanitarias adicionales para que dos establecimientos de la zona y el propio PNMA realizara la corrección de la disposición inadecuada de aguas residuales que se estaban presentando en su momento. • Para el año 2026: actualmente se tiene registrado únicamente una denuncia por el tema de aguas residuales en la zona, la cual corresponde al PNMA, sin embargo, la misma ya fue atendida y no se comprobó lo denunciado”.
Además, dicha Área de Salud ha realizado hasta el momento 3 inspecciones a un grupo de establecimientos ubicados frente a playa Espadilla, en los cuales se ha evidenciado una disposición inadecuada de aguas residuales y por ende se realizó la notificación de la orden sanitaria correspondiente para que sea subsanada la no conformidad identificada. Igualmente, mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-260-2024 emitida el 25 de octubre de 2024 al establecimiento Las Delicias, por manejo inadecuado de aguas residuales provenientes de la pila del bar, las cuales eran dirigidas al cordón y caño frente al establecimiento. Por ende, se realizó el acta de inspección N° MS-DRRSPC-DARSQ-AI-028-2025, en la cual se consignó que las aguas residuales provenientes de la pila del bar se dirigían directamente al tanque séptico y que el establecimiento cumplía con lo indicado en la orden sanitaria N° MS-DRRSPC-DARSQ-OS-260- 2024.
Por ello, se dispuso el cierre del caso. Mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-079-2025, emitida y notificada el 26 de marzo de 2025 al establecimiento Baldi’s Fresh, orden que fue dictada con ocasión de inspecciones físico-sanitarias realizadas el 17, 18 y 20 de marzo de 2025, en donde se comprobó un mal manejo de aguas residuales, según informe técnico N° MS-DRRSPC-DARSQ-IT-125-2025. Por ende, en dicha orden sanitaria se ordenó la presentación de un plan remedial para solucionar la situación, así como la definición de una alternativa técnicamente admisible para la disposición del efluente del sistema de tratamiento. Sin embargo, posteriormente el representante legal del establecimiento renunció al permiso sanitario de funcionamiento, circunstancia que dejó sin efecto la orden sanitaria previamente notificada, al desaparecer el supuesto de operación del establecimiento bajo el cual se había emitido la medida.
Mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-0197-2025, emitida y notificada el 18 de julio de 2025 al establecimiento Restaurante Donde Alex 2, orden que fue dictada con ocasión de inspecciones físico-sanitarias realizadas el 04 de julio de 2025. Así, se dispuso que el establecimiento debía disponer sanitariamente, dentro de su propiedad, las aguas residuales del restaurante, mediante un sistema de tratamiento aprobado por el Ministerio de Salud, de forma tal que se evitara su salida al ambiente. De ese modo, su cumplimiento fue verificado mediante acta de inspección N° MS-DRRSPC-DARSQ-AI-0614-2025, en la cual se dejó constancia de que las aguas residuales del restaurante no salían al ambiente, razón por la cual se dispuso el cierre del caso. Mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-0250-2025, emitida el 26 de agosto de 2025 al establecimiento Hotel Milenium, orden que fue dictada con ocasión de inspecciones físico-sanitarias realizadas el 22 de agosto de 2025, en la que se constató disposición inadecuada de aguas residuales provenientes de lavandería, servicios sanitarios, duchas y lavatorios de las habitaciones 101, 102 y 103, así como deficiencias en la conducción de aguas pluviales y acumulación de agua en techos.
Por ende, se ordenó suspender el uso de dichas habitaciones hasta corregir el problema y obtener autorización del Ministerio de Salud, colocar canoas y bajantes, realizar mejoras para evitar acumulación de aguas pluviales, presentar plan remedial y definir una alternativa técnicamente admisible para la disposición final del efluente. Así, el 01 de julio de 2026, el Área Rectora de Salud realizó la inspección respectiva, en la cual verificó que el Hotel Milenium se encontraba operando sin permiso sanitario de funcionamiento vigente desde el 22 de abril de 2026. Por consiguiente, el Área Rectora de Salud dictó y notificó la orden sanitaria N° MS-DRRSPC-DARSQ-OS-0151-2026, mediante la cual ordenó la clausura inmediata del establecimiento hasta que cuente con el respectivo permiso sanitario de funcionamiento vigente, orden que actualmente está vigente. Mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-0328-2025, emitida el 07 de noviembre de 2025 al Parque Nacional Manuel Antonio, orden que fue dictada con ocasión de inspecciones físico-sanitarias realizadas el 06 de noviembre de 2025, en la cual se comprobaron deficiencias asociadas con la disposición de aguas residuales provenientes de la casa de guardaparques, la batería sanitaria N°4 y las duchas ubicadas en la batería sanitaria N°3.
Por ende, se ordenó la clausura inmediata de las instalaciones de la casa de guardaparques, la clausura inmediata de la batería sanitaria N°4, la suspensión inmediata del uso de las duchas ubicadas en la batería sanitaria N°3, la presentación de un plan remedial con cronograma y la adecuación inmediata del aforo de visitantes según la capacidad sanitaria instalada. Al respecto, el Sistema Nacional de Áreas de Conservación presentó el plan remedial correspondiente, bajo consecutivo CARTA-SINAC-SE-SE-1628-2025, el cual fue revisado por el Área Rectora de Salud de Quepos y aprobado mediante CARTA-MS-DRRSPC-DARSQ-367-2025 del 26 de noviembre de 2025. De ese modo, se tuvo por conforme el proceder y los plazos propuestos para las mejoras y reparaciones del sistema de tratamiento de aguas residuales de la casa de funcionarios y de las baterías sanitarias indicadas del Parque Nacional, fijándose como fecha máxima de cumplimiento el 13 de febrero de 2026.
Posteriormente, si bien la ejecución ha presentado retrasos, la Administración del Parque continúa trabajando en el cumplimiento de la orden sanitaria y el proyecto constructivo del sistema de tratamiento de aguas residuales de la casa de funcionarios y de las baterías sanitarias indicadas del Parque Nacional fue revisado en la plataforma APC, constando para el Ministerio de Salud el resultado de “subsanación aceptada”. Esta indicación se formula estrictamente dentro del ámbito técnico de revisión correspondiente al Ministerio de Salud.
Ahora bien, posterior a la interposición del presente recurso, el 13 de enero de 2026, el recurrente interpuso una denuncia ante el Ministerio de Salud y el Sistema Nacional de Áreas de Conservación del MINAE respecto a la situación descrita en el presente recurso de amparo. Así, el 14 de enero de 2026, ante la denuncia presentada por el recurrente el 13 de enero de 2026 ante la Municipalidad de Quepos y el Área Rectora de Quepos, la Municipalidad recurrida y el Área Rectora de Salud recurrida llevaron a cabo una inspección en el lugar, a efectos de constatar las condiciones sanitarias imperantes, atendiendo la situación.
Asimismo, posterior a la notificación de la resolución de curso, según las actas de inspección N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026 y MS-DRRSPC-DARSQ-AI-086-202, el 05 de febrero de 2026 el Área Rectora de Salud de Quepos realizó una inspección en los 3 sitios indicados por el recurrente y no comprobó los malos olores descritos. Por último, no se tuvo por demostrado que, previo a la interposición del presente recurso, el recurrente haya interpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la situación indicada en escrito de interposición.
En este sentido, es relevante reiterar que, previo a la interposición del presente recurso, el recurrente no había interpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la situación indicada en el amparo, por lo que no es posible atribuirle alguna omisión a dicho Ministerio.
Al respecto, mediante sentencia no. 2023-29457 de las 12:50 horas del 10 de noviembre de 2023, dictada dentro del expediente no. 23-012835-0007-CO, este Tribunal estableció sobre la necesidad de interponer una denuncia en temas ambientales, al indicar “que, para que se pueda ventilar una lesión o amenaza a los derechos ambientales, en la generalidad o en lo particular, tendríamos que estar ante el escenario de que la persona afectada haya presentado una denuncia y que, durante su trámite, se haya determinado una amenaza o que efectivamente se esté dañando al medio ambiente, y aun así, las autoridades administrativas recurridas no hayan tomado ningún tipo de medida al respecto, lesionando así el derecho constitucional consagrado en el artículo 50 de la Carta Magna”. Ahora bien, en esa misma sentencia también se estableció que “el Tribunal Constitucional sí ha entrado a conocer recursos donde se demostró una violación a un ambiente sano y ecológicamente equilibrado sin la necesidad de la interposición de una denuncia previa; ello, bajo dos supuestos de excepción, a saber: 1) cuando se trate de un caso de gran envergadura y; 2) cuando de los autos se pueda derivar que las autoridades competentes han tenido conocimiento de la situación acusada, que está amenazando u ocasionando una daño al medio ambiente, no han tomado ningún tipo de medida al respecto”.
Sobre el particular, tal y como se estableció anteriormente, es menester reafirmar que se denota que desde el 2020 se han interpuesto múltiples denuncias (ninguna por parte del recurrente) ante el Área de Salud recurrido respecto a la disposición inadecuada de agua residuales en los tres puntos señalados por el recurrente, sin embargo, se comprueba que esas denuncias han sido atendidas por el Ministerio recurrido, realizando las inspecciones correspondientes, descartando la situación alegada y emitiendo las órdenes sanitarias cuando se ha considerado, a las cuales le ha dado el seguimiento respectivo. De ese modo, este Tribunal considera que dicha Área de Salud les ha dado el seguimiento oportuno a las denuncias planteadas por los administrados. Igualmente, al tener conocimiento de la situación alegado del recurrente por medio del amparo, el 14 de enero de 2026, la Municipalidad recurrida y el Área Rectora de Salud recurrida llevaron a cabo una inspección en el lugar, a efectos de constatar las condiciones sanitarias imperantes.
Asimismo, se realizó una nueva inspección el día 05 de febrero de 2026 en el sitio denunciado, para corroborar que no existe tal afectación denunciada. Es decir, el Ministerio de Salud ha sido diligente ante el conocimiento de denuncias en el lugar señalado por el recurrente, denuncias que en ningún momento han sido interpuestas por el recurrente, ya que, se reitera que, previo a la interposición del presente recurso, el recurrente no había interpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la situación indicada en el amparo.
Por último, respecto a la denuncia interpuesta por el recurrente el 13 de enero de 2026 ante el Ministerio de Salud, se reafirma que dicha gestión fue interpuesta posterior a la presentación del presente amparo, por lo que cualquier reclamo respecto a esa denuncia deviene prematuro.
Por consiguiente, respecto a este Ministerio, se descarta lesión a los derechos fundamentales del recurrente.
V.Sobre la actuación de la Municipalidad de Quepos. Respecto a este Corporación Municipalidad se tiene por demostrado que existe una iniciativa por parte de la Municipalidad de Quepos y el SINAC de colaborar interinstitucionalmente con la construcción de una planta de tratamiento en la zona indicada, razón por la que se invitó al Instituto Costarricense de Acueductos y Alcantarillados, institución rectora en el tema, quienes para tal labor tiene la capacidad de realizar los estudios técnicos de viabilidad de construcción de dicha planta y la determinación del sitio más idóneo para ubicarla, tomando en consideración que se trata de una zona ambientalmente frágil y con características topográficas y de constitución del suelo particulares que deben tomarse en consideración.
Ahora bien, posterior a la interposición del presente recurso, el 13 de enero de 2026, el recurrente interpone una gestión ante la Municipalidad de Quepos respecto al manejo de aguas residuales en Playa Espadilla. Así, el 14 de enero de 2026, ante una solicitud verbal, la Unidad de Gestión Ambiental de la Municipalidad de Quepos, en conjunto con la Unidad de Zona Marítimo Terrestre, la Policía Municipal, el ingeniero de la Unidad de Desarrollo e Infraestructura, y una funcionaria del Ministerio de Salud, realizaron una inspección en el sitio. Así, producto de dicha inspección, la Municipalidad recurrida realizó varias acciones al detectar que en apariencia al menos dos negocios que desfogaban aguas residuales al cordón y caño en el área de inspección, por lo que se procede a presentar formal denuncia ante el Ministerio de Salud ese mismo día con el fin de que se determine lo descrito por parte de la autoridad competente.
Sin embargo, dicha gestión fue rechazada por parte del Ministerio de Salud, indicando que los denunciados debían estar individualizados. Mediante oficio MQ-CM-PM-007-26-2025-2026 del 19 de enero de 2026, la presidente del Concejo trasladó la gestión del recurrente a la alcaldía, identificada como Oficio: CPE-1060-2-2026. Mediante oficio MO-ALC-143-2026 del 02 de febrero de 2026, la alcaldía de la Municipalidad de Quepos, como parte de la junta administradora del Parque Nacional Manuel Antonio, le envió un oficio al Instituto Costarricense de Acueductos y Alcantarillados con el fin de realizar mesa de trabajo interinstitucional enfocada en abordar el tema a la mayor brevedad en la búsqueda de soluciones permanentes a largo plazo. El 03 de febrero de 2026, la gerencia general del Instituto Costarricense de Acueductos y Alcantarillados le comunicó a la Municipalidad de Quepos lo siguiente: “En atención a lo remitido bajo el asunto " oficio MQ-ALC-143-2026", me permito dejar constancia formal de su recepción en esta dependencia el día 03/02/2026.
Este acuse se emite en estricto apego a lo dispuesto en el artículo 27 de la Constitución Política, que reconoce el derecho de petición y la pronta resolución de las gestiones planteadas ante la Administración Pública; así como a la Ley N.° 9097 de Regulación del Derecho de Petición y a la Ley N° 8220 de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, que imponen a las instituciones públicas el deber de dar respuesta oportuna, razonable y motivada a las solicitudes de los administrados. Se procederá a dar el trámite correspondiente conforme a la normativa vigente, comunicándole oportunamente el curso de la gestión. Sin otro particular, agradezco su atención y reitero nuestro compromiso con la transparencia, la eficiencia y la mejora continua en la atención a los usuarios y administrados”.
Asimismo, posterior a la notificación de la resolución de curso, mediante oficio MQ-UGA-023-2026 del 06 de febrero de 2026, el biólogo Warren Umaña Cascante de la Municipalidad de Quepos le solicitó al Ministerio de Salud que considere adaptar su metodología de atención de denuncias debido a las particularidades del caso y manifiesta la disponibilidad por parte de la Municipalidad de colaborar en la atención del presente caso. Mediante oficio MO-ALC-142-2026 del 06 de febrero de 2026, la alcaldía de la Municipalidad de Quepos remitió la respuesta del recurrente al Concejo para ser conocido en sesión ordinaria por parte dicho Concejo, ya que ahí realizó la gestión del recurrente. Mediante oficio no. MQ-UZMT-24-2026 del 09 de febrero de 2026, el jefe de la Unidad de Zona Marítimo Terrestre de la Municipalidad de Quepos le comunicó al alcalde lo siguiente: “4- Por otro lado, a raíz de reuniones de las que esta Unidad ha participado con el Ministerio de Ambiente, se ha coordinado interinstitucionalmente para llevar a cabo una mesa de trabajo entre el MINAE, AyA y Municipalidad de Quepos, para determinar medidas de largo plazo como la construcción de un sistema de alcantarillado y una planta de tratamiento para brindar el servicio en Manuel Antonio.
Esta alternativa requiere de la expertiz principalmente de AyA, por lo cual, mediante oficio MQ-ALC-143-2026 del 02 de febrero del 2026, desde su despacho de alcaldía y con la colaboración de esta Unidad de Zona Marítimo terrestre se ha solicitado a Presidencia Ejecutiva de AyA una visita al Cantón de Quepos para llevar a cabo una mesa de trabajo entre instituciones. 5- Finalmente, respecto al financiamiento para la construcción de un proyecto de alcantarillado sanitario en Playa Espadilla, es técnicamente imposible definir montos o vías de financiamiento a un proyecto sobre el cual no tenemos definidos planos constructivos, ni siquiera la viabilidad técnica. No existe certeza de ubicación de una posible planta de tratamiento específicamente para este sector, ya que definir esto corresponde a criterios altamente técnicos. 6- Ahora bien, la Municipalidad de Quepos tiene conocimiento que el AyA compró un terreno de 1.8 hectáreas (Finca No. 236382) para la instalación de una planta de tratamiento para la ciudad de Quepos y tiene conocimiento que existen los planos constructivos para el alcantarillado sanitario de toda la ciudad de Quepos, sin embargo, se desconoce si este sistema ya diseñado es capaz de recibir las aguas servidas de Manuel Antonio o si el AyA considera otra alternativa para brindar el servicio en el sector de interés del denunciante.
Para este proyecto de alcantarillado de la ciudad de Quepos junto a proyectos en Jacó y Golfito, el AyA contaba con financiamiento de un préstamo entre Costa Rica y el Banco KFW Frankfurt am Main, aprobado por la Asamblea Legislativa en 2019. Sin embargo, el Ministerio de Hacienda el 16 de agosto de 2023 comunicó al Instituto Costarricense de Acueductos y Alcantarillados (AyA) la cancelación del programa y la eliminación del presupuesto y financiamiento de los proyectos a esas comunidades. Es claro que, por el costo tan elevado de este tipo de proyectos, a la Municipalidad de Quepos le representa una dificultad financiera dirigir recursos de su presupuesto Municipal para cubrir por sí sola una obra de esta envergadura, por lo cual requiere del concurso de otras instituciones y del Gobierno Central”. Por último, no se tuvo por demostrado que, previo a la interposición del presente recurso, el recurrente haya interpuesto una denuncia ante la Municipalidad de Quepos respecto a la situación indicada en escrito de interposición.
De esa forma, al igual que se señaló en el considerando anterior, es relevante reiterar que, previo a la interposición del presente recurso, el recurrente no había interpuesto una denuncia ante la Municipalidad de Quepos respecto a la situación indicada en el amparo, por lo que no es posible atribuirle alguna omisión a dicha corporación municipal respecto a alguna denuncia del recurrente. Por consiguiente, respecto a la denuncia interpuesta por el recurrente el 13 de enero de 2026 ante la Municipalidad recurrida, se reafirma que dicha gestión fue interpuesta posterior a la presentación del presente amparo, por lo que cualquier reclamo respecto a esa denuncia deviene prematuro. Por ende, respecto a este punto se declara sin lugar el recurso en contra de la Municipalidad de Quepos.
Sin embargo, a pesar de las acciones de la Municipalidad recurrida, este Tribunal sí constata una omisión por parte de esa corporación municipal en cuanto a sus obligaciones Al respecto, ha quedado debidamente demostrado que, antes incluso de que el recurrente formulara gestión administrativa formal, la Municipalidad recurrida ya había activado mecanismos de inspección coordinación interinstitucional y denuncia ante las autoridades competentes, por lo que actualmente existe una iniciativa por parte de la Municipalidad de Quepos y el SINAC de colaborar interinstitucionalmente con la construcción de una planta de tratamiento en la zona indicada, razón por la que se invitó al Instituto Costarricense de Acueductos y Alcantarillados, institución rectora en el tema, quienes para tal labor tiene la capacidad de realizar los estudios técnicos de viabilidad de construcción de dicha planta y la determinación del sitio más idóneo para ubicarla, tomando en consideración que se trata de una zona ambientalmente frágil y con características topográficas y de constitución del suelo particulares que deben tomarse en consideración.
Así, si bien es cierto, previo a la interposición del presente recurso, no se había interpuesto la denuncia respectiva, lo cierto es que la Municipalidad de Quepos tenía conocimiento antes de cualquier denuncia sobre la posible necesidad de construcción de una planta de tratamiento en la zona indicada. En este sentido, es menester reiterar lo indicado en el considerando anterior, respecto a que “el Tribunal Constitucional sí ha entrado a conocer recursos donde se demostró una violación a un ambiente sano y ecológicamente equilibrado sin la necesidad de la interposición de una denuncia previa; ello, bajo dos supuestos de excepción, a saber: 1) cuando se trate de un caso de gran envergadura y; 2) cuando de los autos se pueda derivar que las autoridades competentes han tenido conocimiento de la situación acusada, que está amenazando u ocasionando una daño al medio ambiente, no han tomado ningún tipo de medida al respecto”.
Así, se denota que la Municipalidad sí tenía conocimiento antes de cualquier denuncia sobre la posible necesidad de construcción de una planta de tratamiento en la zona indicada. Sobre el particular, nótese que el recurrente alega que “se ha notado la urgente necesidad de una planta de tratamiento en todas sus funciones, ya que en varios puntos por ejemplo de playa Espadilla como Parque Manuel Antonio se percibe malos olores tipo sépticas (…) ambientalistas de la zona han comentado la situación en Concejo Quepos; sin embargo, la administración no ha abordado la problemática ambiental como algo prioritario”. Al respecto, la Municipalidad recurrida no niega dicha situación ni niega tener conocimiento de lo indicado, pero en el informe rendido bajo juramento únicamente se limita a informar que “(…) falta a la verdad el recurrente al indicar que existe un dinero destinado a la construcción de una planta y que no se ha podido ejecutar por falta de interés del gobierno local y que los terrenos son de dominio Municipal, lo que si es cierto es que existe una iniciativa por parte de la Municipalidad y el SINAC de colaborar interinstitucionalmente con la construcción de una planta de tratamiento, sin embargo precisamente por tal razón se ha invitado a la institución rectora en el tema que es AyA, quienes para tal labor tiene la capacidad de realizar los estudios técnicos de viabilidad de construcción de dicha plante y la determinación del sitio más idóneo para ubicarla, tomando en consideración que estamos en una zona ambientalmente frágil y con características topográficas y de constitución del suelo particulares que deben tomarse en consideración (…) En el presente caso, el recurrente no acredita la existencia de una omisión ilegitima, arbitraria. o negligente por parte de la Municipalidad de Quepos.
Por el contrario, ha quedado debidamente demostrado que antes incluso de que el recurrente formulara gestión administrativa formal, la Municipalidad ya había activado mecanismos de inspección coordinación interinstitucional y denuncia ante las autoridades competentes. Considera esta representación de manera respetuosa que no procede el amparo cuando la Administración se encuentra actuando dentro de un margen razonable de diligencia, aun cuando la solución definitiva a la problemática denunciada sea compleja o requiera actuaciones progresivas y de largo plazo (…) La propia gestión municipal demuestra que la viabilidad técnica, ambiental y territorial del proyecto aún se encuentra en análisis, lo cual es plenamente razonable y constitucionalmente válido”.
Es decir, la propia Municipalidad acepta que el problema denunciado requiere de una solución, no obstante, no consta que la Municipalidad de Quepos haya resuelto sobre la necesidad o no de construir una planta de tratamiento en Playa Manuel Antonio, denotándose una omisión por parte de la Municipalidad respecto a sus obligaciones. Asimismo, nótese que, con conocimiento de la situación por medio del amparo, la Municipalidad recurrida ha realizado las siguientes actuaciones: “realizó inspección en sitio el 14 de enero de 2026 (…) • Se coordinó la inspección con múltiples dependencias municipales y con el Ministerio de Salud, autoridad rectora en materia de saneamiento ambiental. • Se presentó denuncia formal ante el Ministerio de Salud al detectarse aparentes irregularidades, demostrando voluntad activa de corrección. • Se gestionaron acciones posteriores para superar las limitaciones técnicas señaladas por el Ministerio de Salud. • Se promovió una mesa de trabajo interinstitucional con AyA, institución competente para estudios técnicos, diseño y eventual ejecución de una planta de tratamiento”. Es decir, a pesar de confirmarse que la Municipalidad sí tenía conocimiento sobre la necesidad o no de una planta de tratamiento en Playa Manuel Antonio, lo cierto es que a la fecha únicamente ha promovido una mesa de trabajo institucional sin resolver la cuestión de fondo.
En este sentido, es importante traer a colación lo indicado en la sentencia no. 2026-026822 de las 09:25 horas del 17 de julio de 2026, en donde se estableció, en lo que interesa, lo siguiente: “No debe perderse de vista que la Municipalidad de Limón como administradora de los intereses y servicios locales (artículo 169 de la Constitución Política), e instancia ante la cual se planteó la denuncia de 17 de julio de 2025, no puede desentenderse de los problemas expuestos, y debe actuar como articulador de la intervención coordinada de la Administración, pues como se ha visto, la solución definitiva hace necesaria la integración de esfuerzos y la actuación de diversas dependencias. Esta Sala Constitucional, en la sentencia No. 2020-010630 de las 09:15 horas de 12 de junio de 2020, explicó: “(…) COMPETENCIA MUNICIPAL Y OBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL. Competencia municipal y obligación de coordinación interinstitucional.
El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente: "VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos: " (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente.
En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó: "(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal.
Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (...) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias.
Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente - en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno".
De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros". Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57 horas de 2 de junio de 2006) (…)” (sic) (reiterado en la sentencia No. 2026-05217 de las 09:34 horas de 13 de febrero de 2026) (el énfasis no pertenece al original).
De ese modo, de lo indicado, es obligación de la Municipalidad recurrida coordinar para buscar una solución ante la posible necesidad o no de la construcción de una planta de tratamiento. Así las cosas, se reafirma que la Municipalidad sí tenía conocimiento sobre la necesidad o no de construir una planta de tratamiento en Playa Manuel Antonio, lo cierto es que a la fecha únicamente ha promovido una mesa de trabajo institucional sin resolver la cuestión de fondo. Por ende, ante la falta de solución ante un problema que puede afectar al ambiente y al derecho a un ambiente sano y equilibrado los administrados de ese cantón, se denota una omisión por parte de la Corporación Municipal y, por lo tanto, una lesión a los derechos fundamentales. En este sentido, se declara con lugar el recurso únicamente en cuanto a este punto y en contra de la Municipalidad de Quepos.
VI.Sobre la actuación del Sistema Nacional de Áreas de Conservación del MINAE. Sobre el particular, se tiene por demostrado que, en octubre de 2025, ocurrió un sismo que afectó la infraestructura interna del sistema de tratamiento del Parque Nacional Manuel Antonio, lo cual generó, por parte del SINAC, mecanismos de emergencia institucional, como la declaratoria de emergencia nacional. Asimismo, se coordinó con el Área Rectora de Salud de Quepos, lo que conllevó a la orden sanitaria N° MS-DRRSPC-DARSQ-OS-0328-2025, emitida el 07 de noviembre de 2025. Así, la Administración del Parque continúa trabajando en el cumplimiento de la orden sanitaria y el proyecto constructivo del sistema de tratamiento de aguas residuales de la casa de funcionarios y de las baterías sanitarias indicadas del Parque Nacional fue revisado en la plataforma APC, constando para el Ministerio de Salud el resultado de “subsanación aceptada”.
Sin embargo, esta situación no relación causal alguna con el tema denunciado en el presente recurso de amparo por el recurrente. Lo anterior, pues, desde el punto de vista técnico y material, estas instalaciones internas se ubican a 1.2 kilómetros de distancia de la entrada principal y de la quebrada en mención, por lo tanto, es improbable la contaminación de estos sistemas hacia el sector denunciado. Además, ambos sistemas presentaban sistemas de drenajes independientes y no tenían efluentes dirigidos a esos cuerpos de agua.
Ahora bien, posterior a la interposición del presente recurso de amparo, el 13 de enero de 2026, el recurrente interpuso una denuncia ante el Sistema Nacional de Áreas de Conservación del MINAE respecto a la situación descrita en el presente recurso de amparo. Así, la gestión fue registrada en el sistema SITADA bajo el número 59948-2026. El 19 de enero de 2026, el Sistema Nacional de Áreas de Conservación del MINAE realizó la inspección de campo en el lugar denunciado por el recurrente. Así, de la prueba técnica aportada por la Administración del Parque Nacional Manuel Antonio, se demuestra que los hechos denunciados no se originan dentro del área protegida, sino en zonas externas a la misma, siendo que las corrientes mencionadas ingresan al parque únicamente en su tramo final, por lo que cualquier eventual contaminación se genera aguas arriba, fuera de la jurisdicción del SINAC. Igualmente, en el acta N° 3765, se indica que “se logra observar la quebrada La Camaronera, emanando un olor desagradable, más no se logra observar el motivo del mal olor; por lo que, caminando sobre el borde de la quebrada llegamos a un punto, donde se logra identificar dos alcantarillas que dan al borde de la quebrada, llevando aguas residuales a la quebrada.
Se toman fotos y puntos GPS y se remite la denuncia al Ministerio de Salud, ya que es a quien le corresponde estos temas”. De ese modo, en la inspección se detectaron indicios de afectación sin poder establecerse con certeza su origen. Por ende, el 21 de enero de 2026 se procedió a remitir el caso al Ministerio de Salud para su atención conforme a sus competencias. El 22 de junio de 2026, previo a la notificación de la resolución de ampliación de curso a esa institución, mediante el Oficio CARTA-SINAC-ACOPAC-DR-DRFVS-OSRAP-0154-2026, el SINAC procedió a noticiarle al recurrente las acciones realizadas respecto a su denuncia. Por último, el Área Rectora de Salud de Quepos, en coordinación con el Sistema Nacional de Áreas de Conservación del MINAE, ha realizado verificaciones técnicas en la Playa Nacional Manuel Antonio, mediante pruebas de fluoresceína y evaluaciones, que han descartan que los sistemas de tratamiento del Parque sean fuente de contaminación, confirmando que estos operan adecuadamente.
Así, los sistemas de tratamiento del Parque y la planta de tratamiento ubicada en la entrada principal tienen como disposición final sistemas de drenajes, los cuales han demostrado estar plenamente funcionales y que no están afectando este cauce. El personal de la Playa Nacional Manuel Antonio realiza patrullajes de rutina constantes en los sectores mencionados. Durante dichos recorridos de control, se constata que el cauce ingresa al Parque, pero no se evidencia la existencia de descargas o afluentes irregulares provenientes de otras propiedades colindantes.
Al respecto, se constata que el Sistema Nacional de Áreas de Conservación del MINAE procedió a tramitar la denuncia interpuesta por el recurrente, la cual, se reitera, se presentó posterior a la interposición del presente recurso, realizando la inspección, remitiendo la denuncia al Ministerio de Salud y notificar al recurrente lo referente al mismo. Asimismo, ha coordinado con el Área Rectora de Salud de Quepos. De ese modo, se reitera que, en forma conjunta, ha realizado verificaciones técnicas en la Playa Nacional Manuel Antonio, mediante pruebas de fluoresceína y evaluaciones, que han descartan que los sistemas de tratamiento del Parque sean fuente de contaminación, confirmando que estos operan adecuadamente. Así, los sistemas de tratamiento del Parque y la planta de tratamiento ubicada en la entrada principal tienen como disposición final sistemas de drenajes, los cuales han demostrado estar plenamente funcionales y que no están afectando este cauce. Por último, también se reitera que el personal de la Playa Nacional Manuel Antonio realiza patrullajes de rutina constantes en los sectores mencionados. Durante dichos recorridos de control, se constata que el cauce ingresa al Parque, pero no se evidencia la existencia de descargas o afluentes irregulares provenientes de otras propiedades colindantes.
Por consiguiente, se denota que el Sistema Nacional de Áreas de Conservación ha actuado conforme a sus competencias y ha tramitado la denuncia del recurrente. En todo caso, se reafirma que dicha denuncia fue interpuesta posterior a la presentación del presente amparo, por lo que cualquier reclamo respecto a esa denuncia deviene prematuro.
Por consiguiente, respecto al SINAC, se descarta lesión a los derechos fundamentales del recurrente.
VII.Sobre la actuación del Instituto Costarricense de Acueductos y Alcantarillados. Al respecto, el 14 de enero de 2026, ante la denuncia presentada por el recurrente el 13 de enero de 2026 ante la Municipalidad de Quepos y el Área Rectora de Quepos, la Municipalidad recurrida y el Área Rectora de Salud recurrida llevaron a cabo una inspección en el lugar, a efectos de constatar las condiciones sanitarias imperantes. Por consiguiente, ante la inexistencia de un sistema colectivo de alcantarillado sanitario, la normativa vigente impone la obligación de que las aguas residuales sean tratadas mediante sistemas individuales adecuados. En el caso de las viviendas, ello implica el uso de tanques sépticos, mientras que, para establecimientos comerciales, tales como hoteles, restaurantes y otros que generan aguas residuales de tipo especial, es obligatorio contar con sistemas de tratamiento específicos —incluidas plantas de tratamiento— debidamente aprobados, supervisados y fiscalizados por el Ministerio de Salud y la Municipalidad correspondiente.
Así, se constató en sitio la existencia de descargas de aguas residuales sin tratamiento hacia la playa y el mar en las inmediaciones del Parque Nacional Manuel Antonio. Por lo que, se comprueba que, a raíz de denuncias de vecinos de la zona, el propio Ministerio de Salud ha debido intervenir en atención de situaciones que evidencian deficiencias en el manejo de aguas residuales. Asimismo, según las actas de inspección N° MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026 y MS-DRRSPC-DARSQ-AI-086-202, el 05 de febrero de 2026 el Área Rectora de Salud de Quepos realizó una inspección en los 3 sitios indicados por el recurrente y no comprobó los malos olores descritos. Posteriormente, la Municipalidad de Quepos promovió la conformación de una mesa de trabajo interinstitucional, con la participación del Instituto Costarricense de Acueductos y Alcantarillados y de otros actores estratégicos con potencial de contribuir técnica y financieramente a la solución de la problemática de las aguas residuales, tales como el Sistema Nacional de Áreas de Conservación (SINAC) y el Instituto de Desarrollo Rural (INDER).
En marzo de 2026, como resultado de la coordinación anteriormente, las instituciones involucradas efectuaron una visita técnica conjunta en la zona de Manuel Antonio, con la finalidad de analizar la viabilidad de desarrollar un proyecto integral de saneamiento. Así, en dicho proceso, la Municipalidad de Quepos, el SINAC y el INDER han coincidido en la necesidad de promover la formulación y eventual construcción de un sistema de alcantarillado sanitario (AS) y una planta de tratamiento de aguas residuales (PTAR), como solución estructural a la problemática. Por ende, el INDER ha manifestado su disposición de aportar aproximadamente tres mil millones de colones (US$ 6,2 millones), sin perjuicio de que el Instituto Costarricense de Acueductos y Alcantarillados, como órgano técnico especializado, debe realizar las valoraciones correspondientes para determinar la solución más idónea desde el punto de vista técnico, económico y ambiental.
Por consiguiente, en caso de que se determine la necesidad de formular un proyecto para la zona de Manuel Antonio, Quepos, este deberá cumplir con todas las fases establecidas con las normas técnicas, lineamientos y procedimientos que ha establecido el Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), esto debido a su gran inversión económica, razón por la cual, se visualizaría como una solución a largo plazo. De ese modo, en el marco de la mesa interinstitucional, se ha identificado como alternativa para acelerar la ejecución de un eventual proyecto la suscripción de un convenio de cooperación entre el AyA, el SINAC, la Municipalidad de Quepos y el INDER, mediante el cual el AyA aportaría los diseños técnicos, el INDER asumiría la licitación y ejecución de las obras, y, una vez concluidas, los activos serían transferidos al AyA para su operación. Al respecto, cualquier intervención deberá contemplar soluciones de alta tecnología —particularmente en lo relativo a la PTAR—que permitan el tratamiento integral de contaminantes, considerando la sensibilidad ambiental de la zona costera y del área protegida.
Adicionalmente, se ha recomendado, de manera preliminar, la formulación de un proyecto de saneamiento independiente para la zona de Manuel Antonio, sin incorporar incrementos de caudal al proyecto existente para Quepos, en aras de garantizar una solución técnicamente adecuada. Finalmente, se impone la necesidad de definir con claridad el esquema de financiamiento del proyecto, en el entendido de que el aporte anunciado por el INDER podría resultar insuficiente para cubrir la totalidad de las obras requeridas, debiendo explorarse alternativas complementarias y considerar la posibilidad de esquemas de financiamiento plurianual, de conformidad con la normativa aplicable. Por último, no se tuvo por demostrado que a la fecha el recurrente haya interpuesto una denuncia ante el Instituto Costarricense de Acueductos y Alcantarillados respecto a la situación indicada en escrito de interposición.
De esta forma, se denota que el Instituto Costarricense de Acueductos y Alcantarillados no ha recibido denuncia alguna del recurrente respecto a la situación indicada en el presente recurso de amparo, por lo que no es posible establecer alguna omisión por parte de esa institución.
Ahora bien, el Instituto Costarricense de Acueductos y Alcantarillados se encuentra realizando un proceso de coordinación con la Municipalidad de Quepos, el SINAC y el INDER para desarrollar un proyecto integral de saneamiento. Así, esas instituciones han coincidido en la necesidad de promover la formulación y eventual construcción de un sistema de alcantarillado sanitario (AS) y una planta de tratamiento de aguas residuales (PTAR). Por consiguiente, en caso de que se determine la necesidad de formular un proyecto para la zona de Manuel Antonio Quepos, este deberá cumplir con todas las fases establecidas con las normas técnicas, lineamientos y procedimientos que ha establecido el Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), esto debido a su gran inversión económica, razón por la cual, se visualizaría como una solución a largo plazo. De ese modo, en el marco de la mesa interinstitucional, se ha identificado como alternativa para acelerar la ejecución de un eventual proyecto la suscripción de un convenio de cooperación entre el AyA, el SINAC, la Municipalidad de Quepos y el INDER, mediante el cual el AyA aportaría los diseños técnicos, el INDER asumiría la licitación y ejecución de las obras, y, una vez concluidas, los activos serían transferidos al AyA para su operación.
Por ende, actualmente dichas instituciones se encuentran realizando las coordinaciones respectivas, como sería un eventual proyecto la suscripción de un convenio de cooperación entre el AyA, el SINAC, la Municipalidad de Quepos y el INDER. De esa forma, aunque si bien es cierto en la Playa Manuel Antonio no existe un sistema colectivo de alcantarillado sanitario, según lo indicado bajo juramento por el representante del Instituto Costarricense de Acueductos y Alcantarillados, la normativa vigente impone la obligación de que las aguas residuales sean tratadas mediante sistemas individuales adecuados, situación que, como se evidencia en los considerandos anteriores, ha sido atendida por el Área Rectora de Salud de Quepos al intervenir en atención de situaciones que evidencian deficiencias en el manejo de aguas residuales, realizando las inspecciones debidas, emitiendo las órdenes sanitarias correspondientes y velando por su cumplimiento.
En todo caso, respecto a la actuación del ICAA, se reitera que actualmente no existe aprobado algún proyecto de saneamiento, ni aprobada la construcción de un sistema de alcantarillado y una planta de tratamiento, sino que se encuentra en etapa de coordinación, en donde actualmente es técnicamente imposible definir montos o vías de financiamiento a un proyecto sobre el cual no se tienen definidos planos constructivos, ni siquiera la viabilidad técnica. Por ende, tal y como se indicó anteriormente, no existe certeza respecto a la ubicación de una posible planta de tratamiento específicamente para este sector, ya que definir esto corresponde a criterios altamente técnicos, los cuales se encuentran en trámite de coordinación en la mesa institucional mencionada. Por ende, excedente las competencias de este Tribunal ordenar la eventual construcción de un proyecto que no ha sido aprobado, que se encuentra en proceso de definición de criterios técnicos, que a la fecha ni siquiera cuenta con viabilidad técnica y se encuentra en fases iniciales. Asimismo, nótese que estas actuaciones de coordinación en la mesa interinstitucional se han realizado desde este año, por lo que no se denota algún atraso injustificado ni ha transcurrido un plazo desproporcionado por parte del ICAA, por lo que también se descarta lesión alguna a los derechos fundamentales del recurrente en ese sentido.
Por consiguiente, respecto al ICAA, se descarta lesión a los derechos fundamentales del recurrente.
VIII.Conclusión. Según lo indicado en el considerando V, sí se denota una lesión a los derechos fundamentales del recurrente por parte de la Municipalidad de Quepos ante la falta de solución sobre la necesidad o no de la construcción de una planta de tratamiento en Playa Manuel Antonio. Por consiguiente, se establece que se declara parcialmente con lugar el recurso únicamente por lo señalado ante la Municipalidad de Quepos.
En cuanto a todo lo demás, lo que corresponde es declarar sin lugar el recurso en todos sus extremos. Ahora bien, es importante recordarles a las autoridades recurridas que deberán continuar tramitando las denuncias presentadas por el recurrente las cuales deberán ser atendidas y resueltas en un plazo razonable. Además, en cuanto al Ministerio de Salud, el SINAC y el ICAA se les recuerda su deber de continuar coordinando con la Municipalidad de Quepos para desarrollar en un plazo razonable un proyecto integral de saneamiento o la construcción de un sistema de alcantarillado y una planta de tratamiento en el lugar denunciado, según los criterios técnicos aplicables.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso únicamente en contra de la Municipalidad de Quepos por la falta de solución sobre la necesidad o no de construir una planta de tratamiento en Playa Manuel Antonio. En consecuencia, se le ordena a Patricia Bolaños Murillo, en su condición de alcaldesa, y Marta Bosques Marchena, en su condición de presidenta del Concejo Municipal, ambos de la Municipalidad de Quepos, o a quienes ocupen los cargos, que, en forma coordinada con las demás instituciones respectivas, proceda a girar las órdenes pertinentes y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, se resuelva en definitiva y conforme a Derecho corresponda respecto a la necesidad o no de construir una planta de tratamiento en Playa Manuel Antonio. Se advierte a la Municipalidad de Quepos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Quepos al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Tomen nota las autoridades recurridas de lo indicado en el considerando VIII de esta sentencia. Notifíquese.- Fernando Castillo V.
