Writ of amparo (recurso de amparo) filed under case number 26-011675-0007-CO, submitted by [Nombre 001], national identification number [Valor 001], against the MUNICIPALIDAD DE SAN JOSE, INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, and the MINISTERIO DE SALUD.
Recitals:
'Ley Constitutiva Instituto Costarricense de Acueductos y Alcantarillados ARTICULO 1º.- For the purpose of directing, setting policies, establishing and applying standards, carrying out and promoting planning, financing, and development, and of resolving all matters related to the supply of drinking water and the collection and discharge of sewage and liquid industrial waste, as well as the regulatory aspects of stormwater drainage systems in urban areas, throughout the national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous State institution. ARTICULO 2º.- The following falls within the competence of the Instituto Costarricense de Acueductos y Alcantarillados: a) To direct and oversee all matters necessary to provide the inhabitants of the Republic with potable water service, collection and discharge of sewage and liquid industrial waste, and stormwater management in urban areas; g) To directly administer and operate water supply and sewerage systems throughout the country, which shall be assumed taking into account convenience and availability of resources.
Systems currently administered and operated by municipal corporations may remain under their charge, provided they deliver efficient service.' Reglamento para la Prestación de los Servicios del Instituto Costarricense de Acueductos y Alcantarillados. Reglamento para la Prestación de los Servicios del Instituto Costarricense de Acueductos y Alcantarillados Artículo 6°— Services. AyA shall provide water supply services for residential use and wastewater sanitation within the coverage area, provided it has technical and legal feasibility (factibilidad técnica y legal). The internal systems and facilities required to enjoy the services are the responsibility of the user. Ley General de Salud ARTICULO 289.- All sewage systems shall be subject to the technical control of the Ministry and of the Servicio Nacional de Acueductos y Alcantarillado, and private or public legal entities that construct, administer, and operate them shall comply with the standards that the Executive Branch, in consultation with the Servicio Nacional de Acueductos y Alcantarillado, issues to govern their construction, operation, and the discharge and final treatment of effluent sources.' It follows from the aforementioned regulations that it is AyA that our legal system designates as the public entity responsible for administering and operating all matters related to water supply and sewerage systems throughout the country.
However, this municipality has this week dispatched crews to clean the obstructed areas using hydraulic equipment (a hydro-vacuum truck), to help mitigate surface water exposure, and is currently performing periodic cleanings within our area of competence. As set forth above, it is clear that the Municipalidad de San José has acted diligently with respect to what falls within our competence in response to the situation described by [Nombre 001]. EVIDENCE • Official communication SCMRP-185-2026 PRAYER For all of the foregoing reasons and arguments, we respectfully consider that there is no objective evidence giving rise to a presumption of any violation by the Municipalidad de San José of the fundamental right invoked by the petitioner; on the contrary, the explanation and report submitted by this Municipal Corporation, with its legal character and implications, demonstrates that the Municipality has acted in accordance with the law and within the powers granted by the legal system.
Therefore, the Honorable Sala Constitucional is respectfully requested to DISMISS THIS WRIT IN ALL ITS GROUNDS and not to order this Institution to pay costs in this matter. Resolution in accordance with the foregoing is respectfully requested."
RESPONSE OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS By Official Communication DRyT-OMSR-2026-00289, dated May 29, 2026, Engineer William Leininger Sancho, an official of AyA's UEN Recolección y Tratamiento GAM, reports the following:
Introduction The purpose of this document is to report on the conditions complained of by the petitioner, as well as on the state of the sanitary sewer network of the Urbanización Finca San Juan, and the role AyA has played, in its capacity as regulatory oversight authority (rectoría), in seeking a comprehensive solution to the problem of wastewater collection and treatment.
Background According to information held by AyA, the Urbanización Finca San Juan was built by IMAS, and in 1995 was transferred to the Instituto Nacional de Vivienda y Urbanismo (hereinafter INVU) for administration. In 2008, INVU transferred the streets, avenues, walkways, parks, and common areas to the Municipalidad de San José. With regard to the sanitary sewer network of Finca San Juan, it was never completed; as a result, the sanitary sewer network was never transferred to AyA for operation.
Reported Problem In Finca San Juan, the residents themselves have carried out work to discharge the wastewater from their homes into the municipal drainage channels (caños municipales) and, from there, into the municipal storm sewer system (alcantarillado pluvial municipal) or onto public roads (…) The drainage channel conduit was broken open so that the wastewater would flow into the channel and through the municipal storm drainage system (…) The drainage channel conduit was broken open so that the wastewater would flow into the channel and through the municipal storm sewer system (…) Wastewater overflows onto the sidewalk and falls into the drainage channel, and then into the municipal storm sewer system (…) Wastewater overflows onto the sidewalk and falls into the drainage channel, and then into the municipal storm sewer system (…) Wastewater originating from the properties flows through the channels of the municipal storm drainage system (…) Wastewater originating from the properties flows through the channels and then spreads along the street.
It is important to note that there is an incomplete sanitary sewer network at the site, which has no treatment capacity and is not an AyA "asset"; therefore, the Institution does not provide maintenance services for that network and does not charge for the sanitary sewer service. According to the available information, this network is the property of INVU. Since AyA does not provide sanitary sewer service at the site, it is considered that the residents of the Urbanización Finca San Juan must dispose of their wastewater through a method approved by the Ministerio de Salud (hereinafter MINSA). AyA has repeatedly informed MINSA of this situation (the following official communications are attached as examples: DRyT-OMSR-2019-00603, DRyTOMSR-2021-00431, DRyT-OMSR-2023-00092, and DRyT-OMSR-2024-00152), given that this Ministry bears the responsibility of overseeing the proper management and disposal of wastewater. The foregoing is in compliance with the Ley General de Salud, Ley N° 5395, which provides:
ARTICLE 275.- It is prohibited for any natural or legal person to contaminate surface, underground, or territorial marine waters, directly or indirectly, through drainage or the discharge or storage, whether voluntary or negligent, of liquid, solid, or gaseous waste or residues, whether radioactive or non-radioactive, sewage, or substances of any nature that, by altering the physical, chemical, and biological characteristics of water, render it dangerous to human health, to terrestrial or aquatic fauna, or unsuitable for domestic, agricultural, industrial, or recreational uses.
ARTICLE 276.- Only with a permit from the Ministry may natural or legal persons create drainage systems or proceed with the discharge of solid or liquid waste or residues, or other substances that could contaminate surface, underground, or marine water, strictly adhering to regulatory safety standards and conditions and to any special procedures the Ministry may impose in the particular case to render them harmless.
ARTICLE 285.- Excreta (excretas), sewage, used water (aguas servidas), and stormwater (aguas pluviales) must be disposed of adequately and in a sanitary manner so as to prevent soil contamination and contamination of natural water sources for human use and consumption, the breeding of disease vectors and illnesses, and air pollution under conditions that threaten its purity or quality.
ARTICLE 287.- Any natural or legal person who owns dwellings, establishments, or buildings in which people carry out their activities shall be responsible for ensuring that such property has a system for the disposal of excreta, sewage, and used water approved by the Ministry, and users of dwellings, establishments, or buildings shall be obligated to maintain said system in proper working condition.
ARTICLE 292.- The discharge of sewage, used water, and industrial waste into the storm sewer system is prohibited in all cases. The Ministry is authorized to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through excreta, sewage, and used-water collection systems.
ARTICLE 316.- When the health authority so orders, owners, administrators, or those in charge shall proceed with the disinfection (desinfección), pest extermination (desinsetización), rat eradication (desratización), or repair, as applicable, of buildings intended for permanent or temporary residential use, including annexes and interior patios, whose condition threatens the health or safety of their occupants. A property subject to any of these ordered sanitary measures may not be occupied until its deficiencies have been remedied or the health and safety risk to its occupants has disappeared, and it may be closed by the health authority if the danger is imminent.
ARTICLE 320.- Dwellings and buildings that, due to their dilapidated condition or the existence therein of a permanent source of infection, pose a danger to the health and safety of their occupants or neighbors shall be declared uninhabitable by the health authority. Likewise, those that do not meet the requirements set forth in the sanitary and construction regulations shall be declared unsanitary.
Condition of the Urbanización Finca San Juan As has been stated, the sanitary sewer network of the Urbanización Finca San Juan is the property of INVU, but it was never completed and therefore does not meet the conditions necessary to collect wastewater from the properties in the area. A series of branch lines (ramales) were laid along each of the streets of the Urbanización, but these branch lines were not connected to one another so as to enable the collection and transport of wastewater to a treatment plant (planta de tratamiento). It has been observed that local residents have connected their homes' drainage to this piping, which causes the wastewater to discharge directly onto the ground and subsequently flow into the bed of the Río Tiribí.
Actions Taken by AyA in Its Capacity as Regulatory Oversight Authority Between 2019 and 2021, AyA participated in a commission led by the Municipalidad de San José, in which other institutions also participated (MIVAH, INVU, etc.). As part of the work carried out by AyA, terms of reference for the procurement of preliminary studies, design, and construction of a wastewater treatment plant were delivered (Official Communication DRyT-2021-00147 is attached). Furthermore, AyA reported on the need to consider the construction of a new sanitary sewer system, as well as an interceptor sewer (interceptor) to collect and convey the wastewater from all the streets to the treatment plant. Additionally, the Commission was informed that the land on which the treatment plant was intended to be built did not have sufficient area, since the initial plan had contemplated locating the plant on land corresponding to a river protection zone (zona de protección del río).
To address this limitation, the preparation of a declaration of national interest (declaratoria de conveniencia nacional) was recommended in order to be able to build the treatment system within the river protection zone. It was also reported that said property would need to have road frontage so that it could be connected to potable water and three-phase electricity services. At present, given that conditions at the site do not permit the establishment of a treatment plant, both the Municipalidad and INVU are evaluating the possibility of building at least 2 pumping stations (estaciones de bombeo) that would operate in series and pump the wastewater to an AyA treatment plant (Los Tajos). It is important to note that, for the development of all these works, it is first necessary to relocate the residents who have encroached upon the forest reserve areas (zonas de reserva forestal) set aside by INVU, as well as upon public roads, streets, park areas, and the river protection zone. Without this prior step, it is impossible to develop the improvements needed to resolve the wastewater problem in the area.
Resolution of Expediente 23-008884-0007-CO In April 2023, the Sala Constitucional granted a writ of amparo (Recurso de Amparo) filed by a group of residents of Finca San Juan, who reported a problem related to wastewater discharges and the operation of the sanitary sewer network. The Sala Constitucional ordered: "María Gabriela Vallejo Astúa and Viviana Ramos Sánchez are hereby ordered, in their respective capacities as Deputy General Manager and Head of the Strategic Business Unit (UEN) of Environmental Management of Pavas, both of ICAA, or whoever holds those positions, to, within no more than THREE DAYS, forward the complaint filed by petitioner Hilda Catalina Zúñiga Peña on March 6, 2023 to the Instituto Nacional de Vivienda y Urbanismo and to the Municipalidad de San José, for whatever action may be appropriate." As a result of the foregoing, the General Management of AyA issued Official Communication GG-2023-01939, which is attached.
Resolution of Expediente N° 24-005606-0007-CO In February 2024, the Sala Constitucional granted a writ of amparo filed by a female resident of Finca San Juan, who reported a problem related to wastewater discharges and the operation of the sanitary sewer network. The Sala dismissed the case as premature and further noted: "Notwithstanding the foregoing, it is necessary to advise the respondent authorities of the Instituto Costarricense de Acueductos y Alcantarillados that, by virtue of what was set forth in the report submitted to the Sala, and should they determine that they are not competent to address the petitioner's complaint, they shall, in the interest of protecting her rights and in accordance with the principle of inter-institutional coordination, forward the complaint to the authorities they deem should intervene to provide a solution, expeditiously." In light of the foregoing, by Official Communication DRyT-OMSR-2024-00295 (attached), the complaint was forwarded to INVU.
Resolution of Expediente N° 26-002473-0007-CO In March 2026, the Sala Constitucional granted a writ of amparo in which a problem relating to wastewater discharges and the operation of the sanitary sewer network was reported. The Sala Constitucional ordered: "i) within FIVE DAYS, counted from notification of this ruling, an inter-institutional commission shall be created to specifically address the problem affecting the Finca San Juan settlement with respect to the collection and treatment of used water and sanitary wastewater; and ii) within ONE MONTH, counted from the creation of the aforementioned inter-institutional commission, a plan shall be designed to address the problem that is the subject of this writ, which shall be brought to the attention of this Chamber. The mayor of San José is advised to take note of what is stated in fine of Considerando IV of this ruling." In light of the foregoing, by Official Communication GG-2026-01164 (attached), the names of AyA officials to form part of said commission were provided.
Official Communications Forwarded to INVU In addition to Official Communications GG-2023-01939 and DRyT-OMSR-2024-00295, AyA, by Official Communication DRyT-OMSR-2024-00738 (attached), forwarded to INVU Official Communication CMPPSD-051-2024, in which it reported a problem occurring in Pavas, Finca San Juan, Calle 156C. Also, by Official Communication DRyT-OMSR-2025-00859 (attached), INVU was copied on a response addressed to Ms. Yessica Andrea Traña Arguello, so that said Institution could carry out the corresponding actions. Accordingly, it is considered that AyA has been keeping INVU informed of the complaints received concerning problems in Finca San Juan. The foregoing is in compliance with the resolution of Expediente 24-005606-0007-CO issued by the Sala.
Conclusions
In the Urbanización Finca San Juan, AyA does not have a sanitary sewer network under its administration; therefore, it does not charge for the sanitary sewer service or allocate resources for its maintenance. In the Urbanización Finca San Juan, there is a sanitary sewer network that is the property of INVU, but it is incomplete and therefore does not meet the conditions necessary to receive the community's wastewater. Some local residents discharge their wastewater into the storm sewer system or into the sanitary sewer system built by INVU, which causes the wastewater to discharge onto the ground and then flow untreated into the Río Tiribí. AyA has informed MINSA of this situation, given that this Institution holds the authority to require residents to properly manage their wastewater. In its capacity as regulatory oversight authority, AyA collaborated in a Commission to develop a comprehensive solution to the wastewater problem in Finca San Juan.
At present, there are conditions at the site that make it impossible to develop a comprehensive solution. The actions required to resolve these conditions fall outside the scope of AyA and must be addressed by other Institutions. By Official Communication GG-2023-01939, AyA forwarded the complaint filed by the petitioner in Expediente 23-008884-0007-CO to the Instituto Nacional de Vivienda y Urbanismo and to the Municipalidad de San José. By Official Communication DRyT-OMSR-2024-00295, AyA forwarded the complaint to the Instituto Nacional de Vivienda y Urbanismo, in compliance with the resolution of Expediente 24-005606-0007-CO issued by the Sala. Furthermore, following the Sala's mandate, AyA has been forwarding the complaints received so that INVU may carry out the appropriate steps to address the problem in Finca San Juan. AyA, in its capacity as regulatory oversight authority, is collaborating with the Municipalidad de San José and INVU to seek a comprehensive solution to the wastewater problem in Finca San Juan, and currently, in its capacity as the governing regulatory institution, is part of the commission led by the Municipalidad de San José to provide a comprehensive solution to the problem in Finca San Juan.
IMPORTANT NOTE As part of my client's response, it is important to mention that, by Official Communication PRE-2026-00798, dated May 29, 2026, this Executive Presidency responded to Official Communications SCMRP-204-2026 and PE-197-2026, signed by INVU and the Municipalidad de San José. The response states verbatim: "In response to the official communications in question, regarding the matter of Finca San Juan, we hereby report that, following the communication from the Municipalidad de San José received by email on April 15, stating 'I also take this opportunity to mention that the senior officials have had a recent meeting and will be holding a new meeting in the coming days to discuss the matter. For this reason, we consider it prudent to postpone the meeting scheduled for tomorrow until further notice,' a meeting between the senior officials of MIVAH and AyA has been scheduled for June 4, following which a new session of the Commission will be convened once the line of approach has been defined." PETITION Based on the factual and legal grounds set forth above, I hereby submit the requested report.
I expressly note, for the consideration of that office, the actions taken by the Instituto Costarricense de Acueductos y Alcantarillados in fulfillment of its responsibilities, it being evident that it has not disobeyed, nor violated any rules, guarantees, or constitutional or environmental principles, but has instead acted responsibly in safeguarding and protecting the right to a healthy environment, to health, and to life; THEREFORE, THE WRIT MUST BE DISMISSED IN ALL ITS COUNTS AS AGAINST AyA, AND I SO REQUEST.

Considering:
I.Preliminary matter. Before analyzing the merits of the case, it should be clarified that, since judgment No. 2008002545 of 8:55 a.m. on February 22, 2008, this Sala has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied or not with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, both for resolving an administrative proceeding by a final administrative act (acto final)—initiated ex officio or at the request of a party—and for addressing the applicable administrative appeals. Precisely, in the instant case, a situation of exception arises, since this involves an environmental complaint which it is alleged has not been resolved within a reasonable period. Having clarified this point, the Court proceeds to resolve the specific situation claimed in this amparo.
II.Object of the appeal. The appellant alleges that since March 2024, there has been an overflow of sewage at Finca San Juan, Pavas, which flows into the stormwater drainage system (sistema pluvial). He contends that this situation has generated wastewater on public thoroughfares, the entry of gases into dwellings, unbearable odors, and a massive presence of disease vectors (vectores), which he considers harmful to the health, safety, and dignity of the residents. He states that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Salud are aware of this situation; however, he has not obtained a solution. He requests the intervention of the Sala.
IV.On the specific case. In the instant case, the appellant alleges that since March 2024, there has been an overflow of sewage at Finca San Juan, Pavas, which flows into the stormwater drainage system. He contends that this situation has generated wastewater on public thoroughfares, the entry of gases into dwellings, unbearable odors, and a massive presence of vectors, which he considers harmful to the health, safety, and dignity of the residents. He states that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Salud are aware of this situation; however, he has not obtained a solution. He requests the intervention of the Sala.
In this regard, the record of proven facts shows that on April 11, 2024, the appellant filed the following complaint with the mayor's office of San José: "My name is [Nombre 001], ID # [Valor 002]. On behalf of the residents of Finca San Juan – [...], we have already filed the relevant complaints with the ministerio de salud under case D-0039-2024 relating to sewage, which indicates that the Municipalidad de San José must resolve this public health problem. A complaint was also filed with AYA, which responded by email IN.CS N° 0067 2024, where they refuse to take responsibility, alleging that no resources are allocated to this area, despite the existence of drainage networks and sewage pipes. We, the residents, acting within the law and fulfilling our responsibilities, request that the sewage problem be resolved as soon as possible, as very strong odors have begun to be noticed and people have started to fall ill, this being a public health problem that affects us all." By official communication MSJ-ALCALDIA-AI-782-2024 of April 26, 2024, the municipal authorities replied to the appellant: "In response to your request, regarding municipal cooperation and the sewage problem at Finca San Juan – Pavas, alameda 156, block 4, in front of the JYL store, I attach official communication No. SCMRP-168-2024, which was sent to Dr. Ana Isabel Rodríguez Sánchez, Director of the Área de Salud de Pavas, in which a response is provided regarding the existing problem at the site." On February 19, 2025, the Ministerio de Salud served Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 on the Municipalidad de San José, requiring that: "Within a period of no more than 08 calendar months from the date of this notification, carry out the repairs necessary to complete the corresponding sanitary sewer network in the area of (alamedas 14, 15, and 16) located in Pavas, Finca San Juan, 10 meters east and 5 meters south of Super Alfa on Calle 156 C, so that these areas have an adequate system for the disposal of sewage and used water and so that these do not block or overflow onto the public thoroughfare.
Legal Basis: Articles 1, 2, 4, 7, 147 subsection c), 275, 285, 288, 289 of Ley Nº 5395, Ley General de Salud. Article 6 subsection e) of the Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC." Now, the respondent authorities acknowledge that the wastewater situation at Finca San Juan has not been resolved. In these circumstances, it cannot be overlooked that the problem at issue has been the subject of judgments by this Court, yet has not been resolved to date. In this regard, through judgment No. 2026004335 of 9:20 a.m. on February 6, 2026, a writ of amparo was granted based on the following arguments.
"CONSIDERING:
I.Preliminary matter. Before analyzing the merits of the case—for the alleged violation of the right to prompt and complete proceedings—it should be clarified that, since judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Sala has referred to the administrative-law jurisdiction—with certain exceptions—those matters in which it is disputed whether the public administration has complied or not with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, both for resolving an administrative proceeding by a final administrative act—initiated ex officio or at the request of a party—and for addressing the applicable administrative appeals. Precisely, in this case, a situation of exception arises, since this involves a complaint filed concerning a water seepage problem that has allegedly not been addressed. Having clarified this point, the Court proceeds to resolve the specific situation raised in this amparo.
The appellant considers her fundamental rights to have been violated. She states that since 2024, there has been a continuous overflow of sewage in alamedas 14, 15, and 16 of Finca San Juan, Pavas, a situation that causes contamination, foul odors, risk of gastrointestinal and skin diseases, and significantly affects her family, minor children, and neighbors. She argues that despite having filed the respective complaints with the Ministerio de Salud, Instituto Costarricense de Acueductos y Alcantarillados, Instituto Nacional de Vivienda y Urbanismo, and Municipalidad de San José, the problem she faces has not been resolved.
Of relevance to the decision in this matter, the following facts are considered duly established:
Between 2019 and 2021, the Instituto Costarricense de Acueductos y Alcantarillados participated in a commission led by the Municipalidad de San José, in which other institutions also participated (MIVAH, INVU, etc.), to address the problem of wastewater overflow at Finca San Juan, Pavas. As part of the work carried out by AyA, terms of reference (términos de referencia) were provided for the contracting of preliminary studies, design, and construction of a wastewater treatment plant (planta de tratamiento de aguas residuales) (see official communication DRyT-2021-00147).
On June 6, 2024, the Área Rectora de Salud de Pavas received a complaint regarding the overflow of wastewater and a blocked sewer in alamedas 14, 15, and 16 of Finca San Juan, Pavas, filed against the Instituto Costarricense de Acueductos y Alcantarillados. The complaint alleged that the described situation was causing a continuous overflow of sewage and contamination. The respondent health governing area processed the matter, assigning it case number D 091-2024 (see sworn report submitted and documentation provided).
On June 18, 2024, the respondent health governing area conducted an on-site inspection, confirming that various sewers along the alameda were overflowing. On that occasion, local residents stated that the Municipalidad de San José and the Instituto Costarricense de Acueductos y Alcantarillados had made site visits; however, the reported problem had not been remedied (see sworn report submitted and documentation provided).
On June 21, 2024, the respondent health governing area prepared technical report N°MS-DRRSCS-DARS-P-IT-0156-2024-JLC, recommending that the case be referred to the Instituto Costarricense de Acueductos y Alcantarillados for the purpose of conducting a joint inspection visit (see sworn report submitted and documentation provided).
On June 21, 2024, the respondent health governing area referred case N° D-0091-2024 through official communication N° MS-DRRSCS-DARS-P-0269-2024 to the Instituto Costarricense de Acueductos y Alcantarillados (see sworn report submitted and documentation provided).
On July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados responded to official communication N° MS-DRRSCS-DARS-P-0269-2024, through official communication N° DRyT-OMSR-2024-00497, stating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo; however, the project was not completed, and as a result the sanitary sewer network had not been transferred to ICAA for proper operation (see sworn report submitted and documentation provided).
On July 16, 2024, the respondent health governing area replied to the Instituto Costarricense de Acueductos y Alcantarillados regarding official communication N° DRyT-OMSR-2024-00497 through official communication N° MS-DRRSCS-DARS-P-0302-2024, requesting the cleaning, maintenance, and unblocking of the sewer network (see sworn report submitted and documentation provided).
On August 19, 2024, the respondent health governing area received official communication N° DRyT-OMSR-2024-00603 from the Instituto Costarricense de Acueductos y Alcantarillados, indicating that, since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was not appropriate for that institution to allocate resources for its maintenance (see sworn report submitted and documentation provided).
On August 19, 2024, the respondent health governing area sent official communication N° MS-DRRSCS-DARS-P-0338-2024 to the Instituto Nacional de Vivienda y Urbanismo, requesting information related to the problem described (see sworn report submitted and documentation provided).
On September 4, 2024, the Instituto Nacional de Vivienda y Urbanismo responded to official communication N° MS-DRRSCS-DARS-P-0338-2024 through official communication N°DPH-UPH-247-2024, which stated verbatim: "The parcels generated by the IMAS, lots, public areas, and remainder of the property, according to the master plan (designed by IMAS), were transferred to INVU in November 1995, with the purpose of having INVU formalize the transfers of the lots to the prospective beneficiaries of the project and transfer the public areas to the Municipalidad de San José; therefore, the transfer from IMAS to INVU was intended to formalize the title deeds for the parcels—an administrative matter, not a construction one. As mentioned, the streets, alamedas, park zones, and urban infrastructure works were designed and built by the IMAS, as evidenced by the plans; therefore, the delivery of the plans and the infrastructure pipeline management to the Instituto Costarricense de Acueductos y Alcantarillados should have been carried out by the aforementioned entity.
INVU, in April 2008, transferred the streets, avenues, alamedas, parks, and communal areas to the Municipalidad de San José." (emphasis not in the original) On October 11, 2024, the respondent health governing area sent official communication N°MS-DRRSCS-DARS-P-0408-2024 requesting support, addressed by email to the mayor of San José, for the handling of the complaint according to his competencies (see sworn report submitted and documentation provided).
On September 30, 2024, the respondent health governing area received official communication N°CM-PPSD-051-2024 from Municipal Council Member Yorleny Córdoba Moya, requesting support from Ms. Kristel Ramírez Ballesteros of the Instituto Costarricense de Acueductos y Alcantarillados in addressing the complaint (see sworn report submitted and documentation provided).
On October 1, 2024, the Instituto Costarricense de Acueductos y Alcantarillados, through official communication N°DRyT-OMSR-2024-00738, in response to official communication N°CM-PPSD-051-2024, stated that the Finca San Juan network was not an asset of that institution, and therefore no resources could be allocated for its maintenance and operation (see sworn report submitted and documentation provided).
On October 23, 2024, a meeting was held between officials from the Municipalidad de San José and the Ministerio de Salud. Among the agreements reached, it was decided to resend to the respondent municipality the information contained in complaint N° D-091-2024 up to that point in time (see sworn report submitted and documentation provided).
On February 19, 2025, Sanitary Order (Orden Sanitaria) N°MS-DRRSCS-DARS-P-OS-006-2025 was served on the Municipality of San José, requiring that: "Within a period of no more than 8 calendar months from the date of this notification, carry out the repairs necessary to complete the corresponding sanitary sewer network (alcantarillado sanitario) in the area of (alamedas 14, 15, and 16) located in Pavas Finca San Juan, 10 meters east and 5 meters south of Super Alfa on Calle 156 C, so that these areas have an adequate system for the disposal of sewage and wastewater (aguas negras y servidas) and so that these do not obstruct or overflow (rebalsen) onto the public right-of-way. Legal Basis: Articles 1, 2, 4, 7, 147 paragraph c), 275, 285, 288, 289 of Ley Nº 5395 Ley General de Salud. Article 6 paragraph e) of the Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC." (see the report filed and documentation submitted).
On February 26, 2025, the mayor (alcalde) of San José filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025, stating: "Based on the factual and legal considerations set forth, as well as the legal norms and case law that protect the Municipality of San José, and given that what is requested in SANITARY ORDER MS-DRRSCS-DARS-P-OS-006-2025 issued by the ÁREA RECTORA DE SALUD DE PAVAS is not procedurally appropriate, it is respectfully requested that the motion for reconsideration be GRANTED, and, should that motion be denied, that the appeal be elevated on a subsidiary basis." (see the report filed and documentation submitted).
On April 1, 2025, through RESOLUCION-MS-DRRSCS-0662-2025, the motion for reconsideration filed by the Municipality of San José was resolved and dismissed (declarándolo sin lugar) (see the report filed and documentation submitted).
On May 20, 2025, the Minister of Health, through Resolution N°MS-DM-YA-2202-2025, dismissed the appeal filed by the mayor of San José (see the report filed and documentation submitted).
On October 22, 2025, the Ministry of Health sent official communication CARTA-MS-DRRSCS-DARS-P-0602-2025 to the mayor of San José, requesting a report on the status of compliance with Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 and the actions taken toward that end (see the report filed and documentation submitted).
On November 18, 2025, the Ministry of Health received official communications MSJ-ALCALDIA-4753-2025 and SCMRP-547-2025 from the Municipality of San José, which stated the following: "Through official communication No. SCMRP-278-2025, the Service Provision Department (Gerencia Provisión de Servicios) was advised that what the Ministry of Health is requesting is a matter of sanitary sewerage; consequently, handling sanitary sewerage does not fall within the competence or functions of this Section, which is why stormwater fee (tasa pluvial) funds cannot be invested for that purpose, since doing so would constitute a misappropriation of public funds and would violate the principle of tax legality, the equivalence principle, the transparency principle, and the principle of the specific purpose of fees. Likewise, the entity responsible for administering and operating the sanitary sewer system in the canton (Cantón) of San José is the Instituto Costarricense de Acueductos y Alcantarillados, the body responsible for developing and resolving everything related to the supply of drinking water as well as the collection and evacuation of sewage and wastewater.
Furthermore, it is important to note that this Section has not been assigned any works related to Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 in the sector known as Finca San Juan." (see the report filed and documentation submitted).
On December 4, 2025, the Ministry of Health served the mayor of San José with sanitary report (informe sanitario) N°MS-DRRSCS-DARS-0690-2025, which imposed a fine of one base salary (salario base) in the amount of ¢462,200.00 for non-compliance with Sanitary Order No. MS-DRRSCS-DARSP-OS-006-2025 (see the report filed and documentation submitted).
On December 9, 2025, the Ministry of Health received from the Municipality of San José an appeal against sanitary report N°MS-DRRSCS-DARS-0690-2025 (see the report filed and documentation submitted).
IV.On the right to a healthy and ecologically balanced environment. It must first be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73, and 89 of the Constitución Política), as well as through the applicable international norms in Costa Rica. In this regard, in Judgment No. 2006-005928 of 3:00 p.m. on May 2, 2006, this Tribunal held: "The right to life recognized in Article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the inhabitants of the republic rest. Likewise, the right to health also finds its basis in that provision of the Constitution, since life is inconceivable unless minimum conditions are guaranteed to the human person for an adequate and harmonious psychic, physical, and environmental balance. Now, public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73, and 89 of the Constitución Política.
Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Tribunal has employed the concept of 'environmental quality' as a parameter, precisely, of the quality of life of individuals, which is combined with other elements such as health, food, work, and housing, with reference to the fact that every person has the right to use the environment for their own development, but not in an unlimited manner, since there is also a duty of protection and preservation of the environment for present and future generations — the principle of sustainable development —." Likewise, from Article 50 of the Constitución Política there derives the State's obligation to protect the environment.
That provision establishes: "The State shall promote the greatest well-being of all inhabitants of the country, organizing and stimulating production and the most equitable distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. For this reason, they are entitled to denounce acts that infringe upon that right and to claim reparation for the damage caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding responsibilities and sanctions." This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person's fundamental right to health and to a healthy and ecologically balanced environment.
V.On the coordination of public institutions in the comprehensive protection of the environment. The State — as a whole — has an obligation to take the necessary measures to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that would endanger the health of those subject to its authority. In this task, the term "public institution" encompasses both the Central Administration — Ministries, such as the Ministry of Environment and Energy and the Ministry of Health — which, by reason of their subject matter, bear broad participation and responsibility with respect to the conservation and preservation of the environment and which, in most cases, act through their specialized subordinate bodies; as well as, in the same manner, municipalities, which bear significant responsibility within their respective territorial jurisdictions.
Given the diversity of actors that may be involved, one might think that this multiple responsibility would create chaos in administrative management. Therefore, in order to avoid the simultaneous coexistence of spheres of power of different origins and natures, the duplication of national and local efforts, and the confusion of rights and obligations among the various parties involved, it is necessary to establish a series of coordination relationships among the various agencies of the Executive Branch and the decentralized institutions, and between these and the municipalities, so that they may carry out the functions entrusted to them. This Constitutional Chamber (Sala Constitucional) has already addressed the principle of coordination among public agencies and municipalities in the pursuit of common goals, stating in Judgment No. 1999-005445 of 2:30 p.m. on July 14, 1999, that: "Coordination is the ordering of the relations among these various independent activities, which takes account of that concurrence on a single object or entity in order to make it useful to an overall public plan, without suppressing the mutual independence of the acting subjects.
Since there is no hierarchical relationship among the decentralized institutions, nor between the State and the municipalities, it is not possible to impose specific conduct upon the latter, which gives rise to the indispensable interinstitutional 'accord,' in the strict sense, whereby autonomous and independent centers of action agree on a preventive and global scheme in which each fulfills a role with a view to a mission entrusted to the others. Thus, the relations of municipalities with other public entities can only take place on a footing of equality, resulting in negotiated forms of coordination, to the exclusion of any coercive form that would undermine their autonomy and would allow corporate entities to be subjected to a coordination scheme without their consent or against their will; but which does admit the necessary subordination of these entities to the State and in the interest thereof (through the State's 'administrative supervision,' and specifically, in the function of legality oversight that is the State's responsibility, with general supervisory powers over the entire sector)."
After analyzing the evidentiary elements submitted, this Tribunal establishes that, between the years 2019 and 2021, the Instituto Costarricense de Acueductos y Alcantarillados participated in a commission led by the Municipality of San José, in which other institutions (MIVAH, INVU, etc.) also took part, to address the problems arising in the Finca San Juan sector of Pavas due to the overflow of wastewater (aguas residuales). As part of the work carried out by the AyA, terms of reference (términos de referencia) were delivered for the engagement of preliminary studies, design, and construction of a wastewater treatment plant (planta de tratamiento de aguas residuales). Furthermore, on June 6, 2024, the Área Rectora de Salud de Pavas received a complaint regarding wastewater overflow and a blocked sewer (alcantarilla obstruida) in alamedas 14, 15, and 16 of Finca San Juan, Pavas, directed against the Instituto Costarricense de Acueductos y Alcantarillados.
The complaint alleged that the situation described was causing a continuous overflow of sewage and contamination. The respondent regional health authority (área rectora de salud) processed the complaint and assigned it case number D 091-2024. On June 18, 2024, the respondent regional health authority conducted an on-site inspection, confirming that various sewers in the alameda were overflowing. On that occasion, local residents stated that the Municipality of San José and the Instituto Costarricense de Acueductos y Alcantarillados had visited the site; however, they had not resolved the problem complained of. On June 21, 2024, the respondent regional health authority prepared technical report N°MS-DRRSCS-DARS-P-IT-0156-2024-JLC, which recommended transferring the case to the Instituto Costarricense de Acueductos y Alcantarillados for the purpose of conducting a joint inspection visit. On June 21, 2024, the respondent regional health authority transferred case N° D-0091-2024, through official communication N° MS-DRRSCS-DARS-P-0269-2024, to the Instituto Costarricense de Acueductos y Alcantarillados.
On July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados responded to official communication N° MS-DRRSCS-DARS-P-0269-2024 through official communication N° DRyT-OMSR-2024-00497, stating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo; however, the project had not been completed, and as a result the sanitary sewer network had not been transferred to ICAA for proper operation. On July 16, 2024, the respondent regional health authority replied to ICAA's official communication Nº DRyT-OMSR-2024-00497 through official communication Nº MS-DRRSCS-DARS-P-0302-2024, requesting the cleaning, maintenance, and unclogging (destaqueo) of the sewer network. On August 19, 2024, the respondent regional health authority received official communication N° DRyT-OMSR-2024-00603 from the Instituto Costarricense de Acueductos y Alcantarillados, stating that, since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was not appropriate for that institution to allocate resources for its maintenance.
On August 19, 2024, the respondent regional health authority sent official communication N° MS-DRRSCS-DARS-P-0338-2024 to the Instituto Nacional de Vivienda y Urbanismo, requesting information related to the problem described. On September 4, 2024, the Instituto Nacional de Vivienda y Urbanismo responded to official communication N° MS-DRRSCS-DARS-P-0338-2024 through official communication N°DPH-UPH-247-2024, which stated verbatim: "The properties generated by IMAS, including lots, public areas, and the remainder of the estate, according to the site plan (designed by IMAS), were transferred to INVU in November 1995, with the purpose of having INVU formalize the transfers of the lots to the prospective beneficiaries of the project and transfer the public areas to the Municipality of San José; therefore, the transfer from IMAS to INVU was made with the intention of formalizing the property deeds — an administrative matter, not a construction one.
As mentioned, the streets, alamedas, park areas, and urban infrastructure works were designed and built by IMAS, as shown in the plans; therefore, the delivery of plans and the pipeline infrastructure arrangements to the Instituto Costarricense de Acueductos y Alcantarillados should have been carried out by that entity. In April 2008, INVU transferred the streets, avenues, alamedas, parks, and communal areas to the Municipality of San José." On October 11, 2024, the respondent regional health authority sent a support request, official communication N°MS-DRRSCS-DARS-P-0408-2024, by email to the mayor of San José, for attention to the complaint in accordance with the mayor's competencies. On September 30, 2024, the respondent regional health authority received official communication N°CM-PPSD-051-2024 from Municipal Councillor (regidora Municipal) Yorleny Córdoba Moya, requesting support from Ms.
Kristel Ramírez Ballesteros of the Instituto Costarricense de Acueductos y Alcantarillados in connection with the complaint. On October 1, 2024, the Instituto Costarricense de Acueductos y Alcantarillados, through official communication N°DRyT-OMSR-2024-00738 in response to official communication N°CM-PPSD-051-2024, stated that the Finca San Juan network was not an asset of that institution, and therefore resources could not be allocated for its maintenance and operation. On October 23, 2024, a meeting was held between officials of the Municipality of San José and the Ministry of Health. Among the agreements reached, it was determined that the information contained in complaint N° D-091-2024 up to that point would be resent to the respondent municipality. On February 19, 2025, Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 was served on the Municipality of San José, requiring that: "Within a period of no more than 8 calendar months from the date of this notification, carry out the repairs necessary to complete the corresponding sanitary sewer network in the area of (alamedas 14, 15, and 16) located in Pavas Finca San Juan, 10 meters east and 5 meters south of Super Alfa on Calle 156 C, so that these areas have an adequate system for the disposal of sewage and wastewater and so that these do not obstruct or overflow onto the public right-of-way.
Legal Basis: Articles 1, 2, 4, 7, 147 paragraph c), 275, 285, 288, 289 of Ley Nº 5395 Ley General de Salud. Article 6 paragraph e) of the Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC." On February 26, 2025, the mayor of San José filed a motion for reconsideration with a subsidiary appeal against Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025, stating: "Based on the factual and legal considerations set forth, as well as the legal norms and case law that protect the Municipality of San José, and given that what is requested in SANITARY ORDER MS-DRRSCS-DARS-P-OS-006-2025 issued by the ÁREA RECTORA DE SALUD DE PAVAS is not procedurally appropriate, it is respectfully requested that the motion for reconsideration be GRANTED, and, should that motion be denied, that the appeal be elevated on a subsidiary basis." On April 1, 2025, through RESOLUCION-MS-DRRSCS-0662-2025, the motion for reconsideration filed by the Municipality of San José was resolved and dismissed.
Likewise, on May 20, 2025, the Minister of Health, through Resolution N°MS-DM-YA-2202-2025, dismissed the appeal filed by the mayor of San José. It is also established that on October 22, 2025, the Ministry of Health sent official communication CARTA-MS-DRRSCS-DARS-P-0602-2025 to the mayor of San José, requesting a report on the status of compliance with Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 and the actions taken toward that end. On November 18, 2025, the Ministry of Health received official communications MSJ-ALCALDIA-4753-2025 and SCMRP-547-2025 from the Municipality of San José, which stated the following: "Through official communication No. SCMRP-278-2025, the Service Provision Department was advised that what the Ministry of Health is requesting is a matter of sanitary sewerage; consequently, handling sanitary sewerage does not fall within the competence or functions of this Section, which is why stormwater fee funds cannot be invested for that purpose, since doing so would constitute a misappropriation of public funds and would violate the principle of tax legality, the equivalence principle, the transparency principle, and the principle of the specific purpose of fees.
Likewise, the entity responsible for administering and operating the sanitary sewer system in the canton of San José is the Instituto Costarricense de Acueductos y Alcantarillados, the body responsible for developing and resolving everything related to the supply of drinking water as well as the collection and evacuation of sewage and wastewater. Furthermore, it is important to note that this Section has not been assigned any works related to Sanitary Order No. MS-DRRSCS-DARS-P-OS-006-2025 in the sector known as Finca San Juan." On December 4, 2025, the Ministry of Health served the mayor of San José with sanitary report N°MS-DRRSCS-DARS-0690-2025, which imposed a fine of one base salary in the amount of ¢462,200.00 for non-compliance with Sanitary Order No. MS-DRRSCS-DARSP-OS-006-2025. Finally, it is established that on December 9, 2025, the Ministry of Health received from the Municipality of San José an appeal against sanitary report N°MS-DRRSCS-DARS-0690-2025.
A. Regarding the Municipality of San José, it is established that these authorities have been aware of the problem under examination since 2021 and that, despite the several years that have elapsed to date, they have not taken clear and decisive action aimed at definitively resolving it. It should be noted that, according to the section on established facts in this writ of amparo (amparo), the municipal corporation has participated in commissions together with other institutions in order to find a solution to the problem affecting the Finca San Juan sector of Pavas; nevertheless, the problem of wastewater overflow continues without a real solution. In addition to the foregoing, it should be noted that the respondent municipal entity has been subject to a sanitary order since February 19, 2025, without having complied with the Ministry of Health's directives to this day; and the reports filed with that ministry to update it on the actions taken have simply alleged a lack of competence as justification for non-compliance.
In light of the foregoing, this Constitutional Chamber has no doubt that the authorities of the respondent municipality have incurred in serious omissions that have contributed to the sanitary and environmental problem under examination persisting to this day.
B. With respect to the Ministry of Health, it is established that these authorities have been aware of the problem under examination since 2024 and that, since that time, they have conducted on-site inspections and, upon confirming the facts complained of, have been managing its resolution with various institutions. In this regard, it should be noted that on June 21, 2024, the respondent regional health authority transferred case N° D-0091-2024, through official communication N° MS-DRRSCS-DARS-P-0269-2024, to the Instituto Costarricense de Acueductos y Alcantarillados; however, on July 9, 2024, the Instituto Costarricense de Acueductos y Alcantarillados responded to that communication stating that the Urbanización Finca San Juan had been built by the Instituto Nacional de Vivienda y Urbanismo, indicating that the project had not been transferred to that institution for proper operation. Moreover, although the regional health authority had requested the cleaning, maintenance, and unclogging of the sewer network, it received a refusal from ICAA, which stated that since the sewer network had not been completed by INVU and had not been transferred to ICAA, it was not appropriate for that institution to allocate resources for its maintenance.
It is evident that, in light of this situation, the authorities of the Ministry of Health turned to the Instituto Nacional de Vivienda y Urbanismo to obtain information about the situation in the sector known as Finca San Juan, Pavas, establishing that: "In April 2008, INVU transferred the streets, avenues, alamedas, parks, and communal areas to the Municipality of San José." (sic). It is for this reason that, following several approaches to the Municipality of San José in order to find a solution to the problem presented, the Ministry of Health ultimately served Sanitary Order N°MS-DRRSCS-DARS-P-OS-006-2025 on the respondent municipal corporation on February 19, 2025, which to date remains pending compliance.
At this point, it is important to remind the authorities of the Ministry of Health that having issued the aforementioned sanitary order and having requested reports to ascertain compliance — even imposing sanctions in that regard — does not relieve or exempt them from continuing to address the matter and providing the appropriate follow-up, through the issuance and enforcement of all relevant acts, in accordance with the provisions of the Ley General de Salud and its implementing regulations. In this connection, this court, in Voto No. 2016-6368 of 9:30 a.m. on May 13, 2016, stated the following:
"(…) V. ON THE AMPARO AGAINST THE MINISTRY OF HEALTH. ON THE MERITS: From the foregoing facts it is apparent that the Ministry of Health, although it acted in a timely manner, issued the sanitary orders, and even filed criminal complaints, the truth is that the sanitary problem persists, as its representative indicates in the sworn report. The Chamber does not observe that the Ministry has adopted extraordinary measures, such as the closure of the site, the collaboration of the Fuerza Pública for security at the site, or even the eventual eviction of the residential development, or any other effective measures. The provision of a public service such as that in the hands of the Ministry of Health demands an efficiency and diligence that is perhaps beyond what is required of other public bodies, given the fundamental rights to health and to a healthy environment, as they pertain to its competencies.
The Chamber considers that the actions taken by the Ministry of Health have been insufficient and violate the fundamental right to health and to a healthy environment of the protected party, and therefore the amparo must be granted against it and an order must be issued requiring it to adopt the necessary measures, including radical ones, and to make the pertinent decisions in order to eliminate the existing sanitary problem on the border between Condominio Camino de Luna, the Río Liberia, and the Residencial El Río, within a period of two months from notification of the judgment. (…)" (Emphasis not in the original.)
Likewise, in Judgment No. 2022-10613 of 9:40 a.m. on May 13, 2022, this Chamber stated:
"(…) IV.- ON THE SPECIFIC CASE.- After analyzing the evidentiary elements submitted, this Tribunal finds that the respondent authorities have violated the fundamental rights at issue. This is so because the sworn report filed by the representative of said authority — which is deemed given under oath, with the consequences, including criminal ones, provided for in Article 44 of the Law governing this Court — and the evidence submitted for resolution of the matter, have duly established that on August 16, 2021, the respondent received the complaint filed by the petitioner against his neighbors for the discharge of wastewater onto his property by the respondent neighbors. On August 27, 2021, the Environmental Manager of the Área Rectora de Salud Alajuela 1 conducted an on-site inspection visit, at which the health authority determined that stormwater and wastewater (blackwater and greywater) were being discharged onto the protected party's property, causing foul odors and a risk of insect and rodent proliferation that could affect the health of persons residing in the dwelling.
On September 3, 2021, the respondent issued and served Sanitary Order N° 0188, ordering José Arístides Morera Jiménez to correct the problem found and, within two months, to properly and hygienically dispose of the stormwater, wastewater, and sewage that were not being properly channeled in the dwelling on his property. On November 10, 2021, the respondent conducted a compliance verification visit for the said sanitary order, confirming that stormwater and wastewater were continuing to discharge onto the protected party's property, thereby establishing non-compliance with the order. Through official communication MS-DRRSCN-DARSA1-3001-2021, the respondent submitted a criminal complaint to the Fiscalía Adjunta de Alajuela against José Arístides Morera Jiménez for the crime of disobedience to authority, without any resolution having been issued to date. On December 9, 2021, the petitioner filed a complaint against Mr.
Aiut Avalos, indicating that the respondent was channeling stormwater and wastewater onto his property, and requesting that the neighbor be asked to channel those waters properly. On January 6, 2022, the respondent conducted an inspection visit and, despite no one being present at the respondent's property, confirmed that stormwater and wastewater were being directed onto the protected party's property, for which sanitary order 0030 was prepared ordering Mr. Aiut Avalos to properly and hygienically dispose of the stormwater that was not being channeled in his dwelling; however, it has not been possible to serve this order, as the persons have not been found at the location.
That being the case, this Chamber finds that while the respondent argues that it has taken actions aimed at resolving the situation affecting the protected party (tutelado), the fact remains that, despite those efforts, it has not succeeded in resolving the matter definitively. The mere filing of a criminal complaint for non-compliance with a health order, and the excuse that the other health order could not be served, do not suffice in this Chamber's view, particularly given that a serious, proven problem of stormwater (aguas llovidas) and wastewater (aguas residuales) being improperly managed has been established—all of it flowing toward the petitioner's property due to the neighbors' failure to construct drainage works (obras de drenaje), thereby causing serious flooding and contamination for a long time without resolution. It should be noted that the Ministry of Health holds broad powers to act in accordance with the Ley General de Salud and its corresponding Regulations, as the governing supervisory body (ente rector) responsible for health oversight and control, including: special sanitary measures for the evacuation of dwellings (article 1, paragraph c of the Regulations), declarations of uninhabitability (declaratoria de inhabitabilidad), demolition orders, and fines—since it is clear that, pursuant to articles 39 and 286 of the Ley General de Salud, it is the duty of every owner and manager of movable and immovable property to prevent nuisances and health hazards as well as sources of contamination or infection, and to carry out drainage works; and that, in the event of non-compliance, the administration may carry out such works at the defaulting party's expense, all while observing due process. Accordingly, the proper course of action is to grant the writ, with the consequences set out in the operative section (parte dispositiva) (…)" (Emphasis not in the original).
More recently, in Voto No. 2025-583 of 09:20 hrs. of January 10, 2025, this constitutional body stated:
"(…) Regarding the Ministry of Health. While the reports filed and the evidence in the record establish that the respondent authorities of the Ministry of Health—Área Rectora de Salud de Puntarenas – Chacarita—have undertaken steps to comply with the orders previously issued by this Court, as reflected in the proven facts of this judgment, and that, following non-compliance with health order 0112-REG-2024 by the Municipalidad de Puntarenas, on December 4, 2024, a criminal complaint was filed against the Municipalidad de Puntarenas for the alleged offense of Disobedience to Authority before the Deputy Prosecutor's Office of the Public Ministry in Puntarenas; the fact remains that, in the view of this Chamber, the Ministry's performance has been insufficient, since that ministry is required to observe, as well as to guarantee the protection of, the health of the population and of the environment (…)" (Emphasis not in the original).
Against this backdrop, it is clear that the respondent authorities of the Ministry of Health have likewise been remiss in addressing the serious environmental situation facing the community of Finca San Juan, Pavas.
C. Finally, with respect to the Instituto Costarricense de Acueductos y Alcantarillados, it has been reported and established from the evidence submitted that the Urbanización Finca San Juan was initially built by the Instituto Mixto de Ayuda Social and that, because that project was not properly completed, its transfer to ICAA was never successfully carried out. In the report submitted to this Chamber, ICAA stated clearly as follows:
"(…) It is important to note that there is an unfinished sanitary sewer network (red de alcantarillado sanitario) on the site, which has no treatment system and is not an AyA asset; accordingly, the Institution does not provide maintenance services for that network and does not charge for sanitary sewage service. According to the information available, this network is the property of INVU. (…)".
Now, while the objective reasons given by ICAA's authorities for not absorbing the problem through public funds are understandable, this state of affairs cannot and must not exempt ICAA from collaborating with the other respondent authorities in order to find a solution to the proven environmental and public health problem. In view of the gravity of the demonstrated facts, this Constitutional Court considers that ICAA must intervene (by virtue of the clear and broad expertise it possesses in this field) and pursue the relevant coordination channels with both the Municipalidad de San José and the Ministry of Health in order to achieve, jointly, a response and address the situation under review. Although, as stated, ICAA is not compelled to invest public funds in solving the problem, it can collaborate and coordinate with the other public bodies cited in the terms indicated above. However, this last effort has been conspicuously absent from the present case.
VII.Conclusion. In its consistent case law, this Chamber has held that it cannot be accepted that human beings are denied the right to a healthy environment or the right to health due to the inability of the competent authorities to effectively exercise their oversight powers and to resolve the problems entrusted to them by law. Indeed, this Court considers that state action must be coordinated and effective; it is not simply a matter of identifying the problem and assigning responsibility to others, as has occurred in this case, nor is it this Chamber's role to prescribe for each entity the specific solutions it must implement. Rather, once the matter has been assessed, a comprehensive solution must be provided—one in which, under the system of distribution of competences and functions of a State, all those involved must participate, each contributing what ultimately falls within its purview. Pursuant to the foregoing, this Chamber determines that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministry of Health must coordinate a definitive solution to the public health problem affecting the Finca San Juan, Pavas community. Accordingly, the proper course of action is to grant the writ.
I have supported this Court's position that when a litigant (justiciable) alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the competent bodies to adjudicate the legal dispute are the Administrative Courts (Tribunales de lo Contencioso-Administrativo), not this Chamber. That said, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection by means of the writ of amparo (recurso de amparo) established by article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with article 27 of the Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the administration's material actions, its administrative acts, or its response are affecting his or her fundamental rights. In my view, the recently enacted legislation does not imply that this Court should modify its jurisprudential line; this Court, pursuant to section 7 of its own Law, has exclusive authority to define its own jurisdiction.
Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional cases—which may properly be heard in this jurisdiction through the constitutional amparo proceeding—in all other cases, and for the reasons set forth by this Court (sentencia N° 2008-02545 of 8:55 hours of February 22, 2008), the competent judges are those of the administrative courts, all of which is consistent with article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.

Por tanto:
The writ is granted. Accordingly: a) Luis Diego Miranda Méndez, in his capacity as mayor of San José, as well as Adolfo Ortiz Barboza, in his capacity as acting director of the Área Rectora de Salud de Pavas, and Nelson Cordero Rodríguez, in his capacity as acting director of the Dirección Regional de Rectoría de la Salud Central Sur, both officials of the Ministry of Health, or whoever holds those positions, are ordered to issue the pertinent instructions and to carry out all measures necessary so that, immediately upon notification of this judgment, they jointly and in a coordinated manner take the steps needed to ensure that there are no further health impacts on the residents of the Sector Finca San Juan, Pavas; b) Luis Diego Miranda Méndez, in his capacity as mayor of San José, or whoever holds that position, is ordered to issue the pertinent instructions and to carry out all measures necessary so that, within a maximum period of TWELVE MONTHS counted from the date of notification of this judgment, all work required to comply with Health Order N°MS-DRRSCS-DARS-P-OS-006-2025 issued by the Ministry of Health is carried out and completed; c) Adolfo Ortiz Barboza, in his capacity as acting director of the Área Rectora de Salud de Pavas, and Nelson Cordero Rodríguez, in his capacity as acting director of the Dirección Regional de Rectoría de la Salud Central Sur, both officials of the Ministry of Health, or whoever holds those positions, are ordered to take the pertinent actions within the scope of their respective competences to ensure compliance with Health Order N°MS-DRRSCS-DARS-P-OS-006-2025 within the period prescribed above, so that the contamination problem in Finca San Juan, Pavas is definitively resolved; and d) Alejandro González Bogantes, in his capacity as director of the GAM Collection and Treatment Division of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to immediately carry out the coordination work necessary alongside the Ministry of Health and the Municipalidad de San José, in order to provide the support and technical advice needed to definitively resolve the wastewater overflow problem in the Finca San Juan, Pavas area, furnishing whatever accompaniment is necessary to achieve that end.
The respondent authorities are hereby warned that, in accordance with article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on any person who receives an order—which he or she is required to comply with or to enforce—issued within an amparo proceeding and fails to comply with it or to enforce it, provided the offense is not subject to a more severe penalty. The Municipalidad de San José, the State, and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the costs, damages, and losses occasioned by the facts underlying this ruling, which shall be assessed in enforcement-of-judgment proceedings before the administrative courts. Justice Castillo Víquez enters a note. Notification shall be given.
In view of the foregoing, since the period specified in that judgment has not yet expired, the proper course of action is to grant the writ and order that the problem be resolved within the time limit established therein.
V.Note of Justice Castillo Víquez, regarding prompt and effective administrative justice. I have supported this Court's position that when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the competent bodies to adjudicate the legal dispute are the Administrative Courts, not this Chamber. VI.Note of Justice Salazar Alvarado. In environmental matters, it is this Justice's view that if the Public Administration has already intervened, the knowledge and resolution of such matters falls within the jurisdiction of the administrative courts. Nevertheless, I do examine the merits of the case when other rights of persons affected by a pollution source are at stake, including the right to health, quality of life, and the right to enjoy a clean and pollution-free environment (article 50 of the Constitution), as occurs in this case, in which the petitioning party states that since March 2024 there has been a sewage overflow (desbordamiento de aguas negras) at Finca San Juan, Pavas, which flows into the stormwater drainage system (sistema pluvial). The petitioner argues that this situation has produced wastewater on public roads, the infiltration of gases into dwellings, unbearable odors, and a massive presence of disease vectors, which the petitioner considers harmful to the health, safety, and dignity of the residents. The petitioner notes that the Municipalidad de San José, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministry of Health are aware of this situation; however, no solution has been obtained.
VII.Partial dissenting vote of Justice Garro Vargas with respect to the operative section of this judgment. While I agree with the majority of the Chamber that the writ should be granted, I differ as to where the enforcement phase of the matter should be lodged, due to the lack of adequate mechanisms provided by the rules governing this constitutional jurisdiction for monitoring a judgment that involves aspects of a certain technical complexity—specifically, the requirement that the Instituto Costarricense de Acueductos y Alcantarillados, the Ministry of Health, and the Municipalidad de San José definitively resolve the wastewater overflow problem in the Finca San Juan de Pavas area within the remaining twelve-month period set in sentencia No. 2026-004335 of 9:20 hours of February 6, 2026. By contrast, the enforcement provisions of the Código Procesal Contencioso-Administrativo (article 155 et seq.) offer evident advantages, such as the ability to request timetables, impose fines, establish responsibilities, monitor stages of compliance, and so forth. For this reason, pursuant to article 56 of the Ley de Jurisdicción Constitucional, I am of the view that the enforcement phase should be conducted before the Enforcement Division (Área de Ejecución) of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement-of-judgment rules of that Code.
VIII.Documentation submitted to the case file. The parties are hereby notified that any paper documents, objects, or evidence contained in any additional electronic, computing, magnetic, optical, telematic, or new-technology device that may have been submitted must be retrieved within a maximum period of 30 business days counted from the date of notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (approved by Corte Plena in article XXVI of session no. 27-11 of August 22, 2011, and published in Boletín Judicial no. 19 of January 26, 2012) and article LXXXI of session no. 43-12 of May 3, 2012 of the Consejo Superior del Poder Judicial.
Por tanto:
The writ is granted. Lourdes María Saurez Barboza and Ana Isabel Rodríguez Sánchez, each in their respective capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados and director of the Área Rectora de Salud de Pavas, as well as Mariana de los Ángeles Zúñiga Pérez and Luis Diego Miranda Méndez, in that order, municipal council president and mayor, both of San José, or whoever holds those positions, are ordered to issue the pertinent instructions and to take all steps within their respective areas of competence so that, within the remaining period set in sentencia nro. 2026004335 of 9:20 hours of February 6, 2026, the wastewater overflow problem in the Finca San Juan, Pavas area is definitively resolved. The respondent authorities are hereby warned that, in accordance with article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on any person who receives an order—which he or she is required to comply with or to enforce—issued within an amparo proceeding and fails to comply with it or to enforce it, provided the offense is not subject to a more severe penalty.
The Caja Costarricense de Seguro Social, the Municipalidad de San José, and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in enforcement-of-judgment proceedings before the administrative courts. Justice Castillo Víquez enters a note. Justice Salazar Alvarado enters a note. Justice Garro Vargas files a partial dissenting vote with respect to the enforcement of this judgment and, pursuant to article 56 of the Ley de la Jurisdicción Constitucional, orders that enforcement be conducted before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be sent to that body so that enforcement proceedings may be initiated. Notification shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del treinta de julio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente nro. 26-011675-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE SAN JOSE, INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Cuestión previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia ambiental la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo.
II.Objeto del recurso. El recurrente alega que desde marzo de 2024 se presenta un desbordamiento de aguas negras en finca San Juan, Pavas, el cual fluye hacia el sistema pluvial. Aduce que esta situación ha generado aguas residuales en vía pública, ingreso de gases a viviendas, olores insoportables, presencia masiva de vectores, lo que estima lesivo de la salud, seguridad y dignidad de los vecinos. Menciona que la Municipalidad de San José, el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud tienen conocimiento de esta situación; sin embargo, no ha obtenido una solución. Solicita la intervención de la Sala.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
IV.Sobre el caso concreto. En el sub lite, el recurrente alega que desde marzo de 2024 se presenta un desbordamiento de aguas negras en finca San Juan, Pavas, el cual fluye hacia el sistema pluvial. Aduce que esta situación ha generado aguas residuales en vía pública, ingreso de gases a viviendas, olores insoportables, presencia masiva de vectores, lo que estima lesivo de la salud, seguridad y dignidad de los vecinos. Menciona que la Municipalidad de San José, el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud tienen conocimiento de esta situación; sin embargo, no ha obtenido una solución. Solicita la intervención de la Sala.
Al respecto, de la relación de hechos probados se desprende que el 11 de abril de 2024, el recurrente gestionó ante la alcaldía de San José la siguiente denuncia: “Mi nombre es [Nombre 001], cédula # [Valor 002]. En representación de los vecinos de finca San Juan – [...], ya hemos presentado las denuncias pertinentes al ministerio de salud con el asunto D-0039-2024 relacionado a aguas negras, el cual indica que sea la Municipalidad de San José quien solucione este problema de salud social, también se denunció ante el AYA , donde se nos indica vía correo electrónico IN.CS N° 0067 2024 donde no se quieren hacer responsables alegando que no se destinan recursos en esta zona, peri la se cuenta con red fluviales y tuberías de aguas negras, nosotros los vecinos estando a derecho en con nuestras responsabilidades hacemos solicitud de solucionar el problema de aguas negras lo antes posible ya que se empiezan a notar olores muy fuertes y las personas empezaron a enfermar, siendo este un problema de salud pública que nos afecta a todos”.
Por oficio MSJ-ALCALDIA-AI-782-2024 del 26 de abril de 2024, las autoridades municipales contestaron al recurrente: “En atención a su solicitud, en referencia con colaboración municipal y el problema de las aguas negras, en finca San Juan – Pavas, alameda 156 bloque 4, frente a la tienda JYL, le adjunto oficio No. SCMRP168-2024, el cual se envió a la Dra. Ana Isabel Rodríguez Sánchez, Directora del Área de Salud de Pavas, en dicho documento se da respuesta a la problemática existente en el sitio”. El 19 de febrero del 2025, el Ministerio de Salud notificó orden sanitaria nro. MS-DRRSCS-DARS-P-OS-006-2025 a la Municipalidad de San José para que: “En un plazo no mayor a 08 meses calendario a partir de la presente notificación, realizar las reparaciones que sean pertinentes para concluir la red de alcantarillado sanitario correspondiente en la zona de (alamedas 14, 15 y 16) ubicadas Pavas Finca San Juan del Super Alfa 10 metros este y 5 metros sur calle 156 C, para que estas cuenten con un adecuado sistema de disposición de aguas negras y servidas y que estas no obstruyan ni rebalsen en la vía pública.
Fundamento Legal: Artículos 1, 2, 4, 7, 147 inciso c), 275, 285, 288, 289 de la Ley Nº 5395 Ley General de Salud. Artículo 6 inciso e) del Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC”.
Ahora bien, las autoridades recurridas aceptan que no se ha solucionado la situación de aguas residuales en finca San Juan. Así las cosas, no se puede obviar que la problemática acusada ha sido objeto de sentencias por parte de este Tribunal, sin que a la fecha se haya solventado. En ese sentido, mediante sentencia nro. 2026004335 de las 9:20 horas del 6 de febrero de 2026, se declaró con lugar un recurso de amparo, con base en los siguientes argumentos.
“CONSIDERANDO:
I.De previo. De previo a analizar el fondo del asunto —por la presunta violación del derecho a un procedimiento pronto y cumplido— debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa —con algunas excepciones— aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante una denuncia interpuesta por un problema de filtración de aguas que presuntamente no ha sido atendida. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
La recurrente considera conculcados sus derechos fundamentales. Refiere que desde el año 2024, hay un rebalse continuo de aguas negras en las alamedas 14,15 y 16 de la Finca San Juan, Pavas, situación que provoca contaminación, malos olores, riesgo de enfermedades gastrointestinales y cutáneas y, afecta significativamente a su familia, niños menores de edad y, vecinos. Esgrime que a pesar de haber gestionado las respectivas denuncias antes el Ministerio de Salud, Instituto Costarricense de Acueductos y Alcantarillados, Instituto Nacional de Vivienda y Urbanismo y Municipalidad de San José, la problemática que aqueja no ha sido solucionada.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Entre los años 2019 al 2021, el Instituto Costarricense de Acueductos y Alcantarillados, participó en una comisión liderada por la Municipalidad de San José, en la cual participaron otras instituciones (MIVAH, INVU, etc.). Para abordar la problemática presentada en el sector de Finca San Juan, Pavas, por desbordamiento de aguas residuales. Como parte de las labores realizadas por el AyA, se entregaron lo términos de referencia para contratación de estudios preliminares, diseño y construcción de una planta de tratamiento de aguas residuales (se adjunta el Oficio DRyT-2021-00147).
El 6 de junio del 2024, el Área Rectora de Salud de Pavas, recibió una denuncia por desbordamiento de aguas residuales y alcantarilla obstruida, en las alamedas 14,15 y 16 de la Finca San Juan, Pavas, contra el Instituto Costarricense de Acueductos y Alcantarillados. En dicha denuncia se adujo que la situación señalada provocaba un rebalse continuo de aguas negras y contaminación. El área rectora de salud recurrida dio trámite a la gestión asignándole el número de caso D 091-2024 (véase informe rendido y documentación aportada).
El 18 de junio del 2024, el área rectora de salud accionada realizó una inspección en el sitio, logrando constatar que distintas alcantarillas de la alameda se encontraban rebalsadas. En aquella ocasión, vecinos del lugar manifestaron que la Municipalidad de San José y el Instituto Costarricense de Acueductos y Alcantarillados habían realizado visitas al sitio; sin embargo, no habían subsanado la problemática denunciada (véase informe rendido y documentación aportada).
El 21 de junio del 2024, el área rectora de salud recurrida elaboró el informe técnico N°MS-DRRSCS-DARS-P-IT-0156-2024-JLC, donde se recomendó el traslado del caso al Instituto Costarricense de Acueductos y Alcantarillados con el objetivo de realizar una visita de inspección en conjunto (véase informe rendido y documentación aportada).
El 21 de junio del 2024, el área rectora de salud accionada realizó traslado del caso N° D-0091-2024, a través del oficio N° MS-DRRSCS-DARS-P-0269-2024 al Instituto Costarricense de Acueductos y Alcantarillados (véase informe rendido y documentación aportada).
El 9 de julio del 2024, el Instituto Costarricense de Acueductos y Alcantarillados, respondió el oficio N° MS-DRRSCS-DARS-P-0269-2024, a través del oficio N° DRyT-OMSR-2024-00497, indicando que la Urbanización Finca San Juan había sido construida por el Instituto Nacional de Vivienda y Urbanismo; sin embargo, el proyecto no se concluyó y esto conllevó a que la red de alcantarillado sanitario no fuese trasladada al ICAA para su correcta operación (véase informe rendido y documentación aportada).
El 16 de julio del 2024, el área rectora de salud accionada respondió al Instituto Costarricense de Acueductos y Alcantarillados el oficio Nº DRyT-OMSR-2024-00497 a través del oficio Nº MS-DRRSCS-DARS-P-0302-2024, solicitando la limpieza, mantenimiento y destaqueo de la red de alcantarillado (véase informe rendido y documentación aportada).
El 19 de agosto del 2024, el área rectora de salud recurrida recibió el oficio N° DRyT-OMSR-2024-00603 por parte del Instituto Costarricense de Acueductos y Alcantarillados, donde se indicó que, dado que la red de alcantarillado no se había concluido por parte del INVU y no se había trasladado al ICAA, era improcedente que esa institución destinara recursos para su mantenimiento (véase informe rendido y documentación aportada).
El 19 de agosto del 2024, el área rectora de salud recurrida, envió el oficio N° MS-DRRSCS-DARS-P-0338-2024, al Instituto Nacional de Vivienda y Urbanismo, solicitando información relacionada a la problemática expuesta (véase informe rendido y documentación aportada).
El 4 de setiembre del 2024, el Instituto Nacional de Vivienda y Urbanismo brindó respuesta al oficio N° MS-DRRSCS-DARS-P-0338-2024, mediante el oficio N°DPH-UPH-247-2024, en el cual se indicó textualmente: “Las fincas generadas por el IMAS, lotes, áreas públicas y resto de finca, según el plano de conjunto (diseñado por IMAS), fueron traspasados al INVU en noviembre del 1995, con la finalidad de que el INVU formalizara los traspasos de los lotes a los potenciales beneficiarios del proyecto y traspasara las áreas públicas a la Municipalidad de San José, por lo tanto, el traspaso IMAS al INVU fue con la intención de que formalizara las escrituras de los terrenos, un tema administrativo, no constructivo. Como se menciona las calles, alamedas, zonas de parque y las obras de infraestructura urbanística fueron diseñadas y construidas por el IMAS, como consta en planos; por lo tanto, la gestión de entrega de los planos y gestiones de infraestructura de tuberías al Instituto Costarricense de Acueductos y Alcantarillados debió ser efectuada por la entidad mencionada.
El INVU en la fecha de abril del año 2008 traspasó las calles, avenidas, alamedas, parques y áreas comunales a la Municipalidad de San José.” (el resaltado no corresponde al original) El 11 de octubre del 2024, el área rectora de salud recurrida, envió el oficio de solicitud de apoyo N°MS-DRRSCS-DARS-P-0408-2024, al alcalde de San José a través de correo electrónico para la atención de la denuncia según sus competencias (véase informe rendido y documentación aportada).
El 30 de setiembre del 2024, el área rectora de salud accionada recibió el oficio N°CM-PPSD-051-2024 por parte de la regidora Municipal Yorleny Córdoba Moya, solicitando apoyo a la Sra. Kristel Ramírez Ballesteros del Instituto Costarricense de Acueductos y Alcantarillados en atención a la denuncia (véase informe rendido y documentación aportada).
El 1° de octubre del 2024, el Instituto Costarricense de Acueductos y Alcantarillados mediante oficio N°DRyT-OMSR-2024-00738 en respuesta al oficio N°CM-PPSD-051-2024 indicó que la red de finca San Juan no era activo de ese instituto, por lo que no se podían destinar recursos para su mantenimiento y operación (véase informe rendido y documentación aportada).
El día 23 de octubre del 2024, se llevó a cabo una reunión entre funcionarios de la Municipalidad de San José y el Ministerio de Salud. Entre los acuerdos tomados, se determinó el reenvió a la municipalidad recurrida, de la información contenida en la denuncia N° D-091-2024 hasta ese momento (véase informe rendido y documentación aportada).
El 19 de febrero del 2025, se notificó la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025 a la Municipalidad de San José, para que: “En un plazo no mayor a 8 meses calendario a partir de la presente notificación, realizar las reparaciones que sean pertinentes para concluir la red de alcantarillado sanitario correspondiente en la zona de (alamedas 14, 15 y 16) ubicadas Pavas Finca San Juan del Super Alfa 10 metros este y 5 metros sur calle 156 C, para que estas cuenten con un adecuado sistema de disposición de aguas negras y servidas y que estas no obstruyan ni rebalsen en la vía pública. Fundamento Legal: Artículos 1, 2, 4, 7, 147 inciso c), 275, 285, 288, 289 de la Ley Nº 5395 Ley General de Salud. Artículo 6 inciso e) del Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC.” (véase informe rendido y documentación aportada).
El 26 de febrero del 2025, el alcalde de San José presentó recurso de revocatoria con apelación en subsidio contra la orden sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025, indicando: “Con fundamento en las consideraciones de hecho y de derecho expuestas, así como las normas jurídicas y jurisprudencia que amparan a la Municipalidad de San José, y no resultando procedente lo solicitado en la ORDEN SANITARIA MS- DRRSCS-DARS-P-OS-006-2025 emitida por el ÁREA RECTORA DE SALUD DE PAVAS, se solicita respetuosamente ACOGER el recurso de revocatoria y en caso de ser rechazado dicho recurso se eleve el recurso de apelación de manera subsidiaria.” (véase informe rendido y documentación aportada).
El 1° de abril del 2025, mediante RESOLUCION-MS-DRRSCS-0662-2025 se resolvió el recurso de revocatoria interpuesto por la Municipalidad de San José, declarándolo sin lugar (véase informe rendido y documentación aportada).
El 20 de mayo del 2025, la ministra de salud mediante resolución N°MS-DM-YA-2202-2025, declaró sin lugar el recurso de apelación interpuesto por el alcalde de San José (véase informe rendido y documentación aportada).
El 22 de octubre del 2025, el Ministerio de Salud envió el oficio CARTA-MS-DRRSCS-DARS-P-0602- 2025 al alcalde de San José, solicitando informar el estado de cumplimiento de la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025 y las acciones realizadas para ello (véase informe rendido y documentación aportada).
El 18 de noviembre del 2025, el ministerio de salud recibió los oficios MSJ-ALCALDIA-4753-2025 y SCMRP-547-2025 por parte de la Municipalidad de San José, donde se indicó lo siguiente: “Mediante el oficio No. SCMRP-278-2025, se le indicó a la Gerencia Provisión de Servicios que lo solicitado por el Ministerio de Salud es un tema de alcantarillado sanitario, por consiguiente, no es competencia de esta Sección ni se encuentra dentro de sus funciones la atención de alcantarillado sanitario, razón por la cual, no se pueden invertir los recursos pertenecientes a tasa pluvial para tal fin, ya que esto resultaría en un desvío de fondos públicos y violenta el principio de legalidad tributaria, principio de equivalencia, principio de transparencia y finalidad específica de las tasas. Asimismo, la entidad encargada de administrar y operar el alcantarillado sanitario en el Cantón de San José es el Instituto Costarricense de Acueductos y Alcantarillados, ente responsable de desarrollar y resolver todo lo relacionado con el suministro de agua potable como también, la recolección y evacuación de aguas negras y residuales. Aunado a lo anterior, es importante indicar que, esta Sección no tiene asignado ningún tipo de obras relacionadas a la Orden Sanitaria Orden Sanitaria No. MS-DRRSCS-DARS-P-OS-006-2025 en el sector denominado Finca San Juan.” (véase informe rendido y documentación aportada).
El 4 de diciembre del 2025, el ministerio de salud notificó al alcalde de San José, el informe sanitario N°MS-DRRSCS-DARS-0690-2025, donde se impuso una multa de un salario base correspondiente a la suma de ¢462.200.00 por el incumplimiento de la Orden Sanitaria Orden Sanitaria No. MS-DRRSCS-DARSP-OS-006-2025 (véase informe rendido y documentación aportada).
El 9 de diciembre del 2025, el Ministerio de Salud recibió ante esta dependencia el recurso de apelación del informe sanitario N°MS-DRRSCS-DARS-0690-2025 por parte de la Municipalidad de San José (véase informe rendido y documentación aportada).
IV.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como, a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia No. 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental.
Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–”.
Asimismo, del artículo 50 de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.
V.Sobre la coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud-, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia. Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial.
Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia No. 1999-005445 de las 14:30 horas del 14 de julio de 1999, que: "La coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.
Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de este (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector".
Después de analizar los elementos probatorios aportados, este Tribunal acredita que, entre los años 2019 al 2021, el Instituto Costarricense de Acueductos y Alcantarillados, participó en una comisión liderada por la Municipalidad de San José, en la cual participaron otras instituciones (MIVAH, INVU, etc.), para abordar la problemática presentada en el sector de Finca San Juan, Pavas, por desbordamiento de aguas residuales. Como parte de las labores realizadas por el AyA, se entregaron los términos de referencia para contratación de estudios preliminares, diseño y construcción de una planta de tratamiento de aguas residuales. Además, que el 6 de junio del 2024, el Área Rectora de Salud de Pavas, recibió una denuncia por desbordamiento de aguas residuales y alcantarilla obstruida, en las alamedas 14,15 y 16 de la Finca San Juan, Pavas, contra el Instituto Costarricense de Acueductos y Alcantarillados.
En dicha denuncia se adujo que la situación señalada provocaba un rebalse continuo de aguas negras y contaminación. El área rectora de salud recurrida dio trámite a la gestión asignándole el número de caso D 091-2024. Que el 18 de junio del 2024, el área rectora de salud accionada realizó una inspección en el sitio, logrando constatar que distintas alcantarillas de la alameda se encontraban rebalsadas. En aquella ocasión, vecinos del lugar manifestaron que la Municipalidad de San José y el Instituto Costarricense de Acueductos y Alcantarillados habían realizado visitas al sitio; sin embargo, no habían subsanado la problemática denunciada. Que el 21 de junio del 2024, el área rectora de salud recurrida elaboró el informe técnico N°MS-DRRSCS-DARS-P-IT-0156-2024-JLC, donde se recomendó el traslado del caso al Instituto Costarricense de Acueductos y Alcantarillados con el objetivo de realizar una visita de inspección en conjunto.
Que el 21 de junio del 2024, el área rectora de salud accionada realizó traslado del caso N° D-0091-2024, a través del oficio N° MS-DRRSCS-DARS-P-0269-2024 al Instituto Costarricense de Acueductos y Alcantarillados. Que el 9 de julio del 2024, el Instituto Costarricense de Acueductos y Alcantarillados, respondió el oficio N° MS-DRRSCS-DARS-P-0269-2024, a través del oficio N° DRyT-OMSR-2024-00497, indicando que la Urbanización Finca San Juan había sido construida por el Instituto Nacional de Vivienda y Urbanismo; sin embargo, el proyecto no se concluyó y esto conllevó a que la red de alcantarillado sanitario no fuese trasladada al ICAA para su correcta operación. Que el 16 de julio del 2024, el área rectora de salud accionada respondió al Instituto Costarricense de Acueductos y Alcantarillados el oficio Nº DRyT-OMSR-2024-00497 a través del oficio Nº MS-DRRSCS-DARS-P-0302-2024, solicitando la limpieza, mantenimiento y destaqueo de la red de alcantarillado.
Que el 19 de agosto del 2024, el área rectora de salud recurrida recibió el oficio N° DRyT-OMSR-2024-00603 por parte del Instituto Costarricense de Acueductos y Alcantarillados, donde se indicó que, dado que la red de alcantarillado no se había concluido por parte del INVU y no se había trasladado al ICAA, era improcedente que esa institución destinara recursos para su mantenimiento. Que el 19 de agosto del 2024, el área rectora de salud recurrida, envió el oficio N° MS-DRRSCS-DARS-P-0338-2024, al Instituto Nacional de Vivienda y Urbanismo, solicitando información relacionada a la problemática expuesta. Que el 4 de setiembre del 2024, el Instituto Nacional de Vivienda y Urbanismo brindó respuesta al oficio N° MS-DRRSCS-DARS-P-0338-2024, mediante el oficio N°DPH-UPH-247-2024, en el cual se indicó textualmente: “Las fincas generadas por el IMAS, lotes, áreas públicas y resto de finca, según el plano de conjunto (diseñado por IMAS), fueron traspasados al INVU en noviembre del 1995, con la finalidad de que el INVU formalizara los traspasos de los lotes a los potenciales beneficiarios del proyecto y traspasara las áreas públicas a la Municipalidad de San José, por lo tanto, el traspaso IMAS al INVU fue con la intención de que formalizara las escrituras de los terrenos, un tema administrativo, no constructivo.
Como se menciona las calles, alamedas, zonas de parque y las obras de infraestructura urbanística fueron diseñadas y construidas por el IMAS, como consta en planos; por lo tanto, la gestión de entrega de los planos y gestiones de infraestructura de tuberías al Instituto Costarricense de Acueductos y Alcantarillados debió ser efectuada por la entidad mencionada. El INVU en la fecha de abril del año 2008 traspasó las calles, avenidas, alamedas, parques y áreas comunales a la Municipalidad de San José.”. Que el 11 de octubre del 2024, el área rectora de salud recurrida, envió el oficio de solicitud de apoyo N°MS-DRRSCS-DARS-P-0408-2024, al alcalde de San José a través de correo electrónico para la atención de la denuncia según sus competencias. Que el 30 de setiembre del 2024, el área rectora de salud accionada recibió el oficio N°CM-PPSD-051-2024 por parte de la regidora Municipal Yorleny Córdoba Moya, solicitando apoyo a la Sra. Kristel Ramírez Ballesteros del Instituto Costarricense de Acueductos y Alcantarillados en atención a la denuncia.
Que el 1° de octubre del 2024, el Instituto Costarricense de Acueductos y Alcantarillados mediante oficio N°DRyT-OMSR-2024-00738 en respuesta al oficio N°CM-PPSD-051-2024 indicó que la red de finca San Juan no era activo de ese instituto, por lo que no se podían destinar recursos para su mantenimiento y operación. Que el día 23 de octubre del 2024, se llevó a cabo una reunión entre funcionarios de la Municipalidad de San José y el Ministerio de Salud. Entre los acuerdos tomados, se determinó el reenvió a la municipalidad recurrida, de la información contenida en la denuncia N° D-091-2024 hasta ese momento. Que el 19 de febrero del 2025, se notificó la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025 a la Municipalidad de San José, para que: “En un plazo no mayor a 8 meses calendario a partir de la presente notificación, realizar las reparaciones que sean pertinentes para concluir la red de alcantarillado sanitario correspondiente en la zona de (alamedas 14, 15 y 16) ubicadas Pavas Finca San Juan del Super Alfa 10 metros este y 5 metros sur calle 156 C, para que estas cuenten con un adecuado sistema de disposición de aguas negras y servidas y que estas no obstruyan ni rebalsen en la vía pública.
Fundamento Legal: Artículos 1, 2, 4, 7, 147 inciso c), 275, 285, 288, 289 de la Ley Nº 5395 Ley General de Salud. Artículo 6 inciso e) del Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario No 30413-MP-MINAE-S-MEIC.”. Que el 26 de febrero del 2025, el alcalde de San José presentó recurso de revocatoria con apelación en subsidio contra la orden sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025, indicando: “Con fundamento en las consideraciones de hecho y de derecho expuestas, así como las normas jurídicas y jurisprudencia que amparan a la Municipalidad de San José, y no resultando procedente lo solicitado en la ORDEN SANITARIA MS- DRRSCS-DARS-P-OS-006-2025 emitida por el ÁREA RECTORA DE SALUD DE PAVAS, se solicita respetuosamente ACOGER el recurso de revocatoria y en caso de ser rechazado dicho recurso se eleve el recurso de apelación de manera subsidiaria.”.
Que el 1° de abril del 2025, mediante RESOLUCION-MS-DRRSCS-0662-2025 se resolvió el recurso de revocatoria interpuesto por la Municipalidad de San José, declarándolo sin lugar. A su vez, que el 20 de mayo del 2025, la ministra de salud mediante resolución N°MS-DM-YA-2202-2025, declaró sin lugar el recurso de apelación interpuesto por el alcalde de San José. De igual forma, se tiene que el 22 de octubre del 2025, el Ministerio de Salud envió el oficio CARTA-MS-DRRSCS-DARS-P-0602- 2025 al alcalde de San José, solicitando informar el estado de cumplimiento de la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025 y las acciones realizadas para ello. Que el 18 de noviembre del 2025, el ministerio de salud recibió los oficios MSJ-ALCALDIA-4753-2025 y SCMRP-547-2025 por parte de la Municipalidad de San José, donde se indicó lo siguiente: “Mediante el oficio No. SCMRP-278-2025, se le indicó a la Gerencia Provisión de Servicios que lo solicitado por el Ministerio de Salud es un tema de alcantarillado sanitario, por consiguiente, no es competencia de esta Sección ni se encuentra dentro de sus funciones la atención de alcantarillado sanitario, razón por la cual, no se pueden invertir los recursos pertenecientes a tasa pluvial para tal fin, ya que esto resultaría en un desvío de fondos públicos y violenta el principio de legalidad tributaria, principio de equivalencia, principio de transparencia y finalidad específica de las tasas.
Asimismo, la entidad encargada de administrar y operar el alcantarillado sanitario en el Cantón de San José es el Instituto Costarricense de Acueductos y Alcantarillados, ente responsable de desarrollar y resolver todo lo relacionado con el suministro de agua potable como también, la recolección y evacuación de aguas negras y residuales. Aunado a lo anterior, es importante indicar que, esta Sección no tiene asignado ningún tipo de obras relacionadas a la Orden Sanitaria Orden Sanitaria No. MS-DRRSCS-DARS-P-OS-006-2025 en el sector denominado Finca San Juan.”. Que el 4 de diciembre del 2025, el ministerio de salud notificó al alcalde de San José, el informe sanitario N°MS-DRRSCS-DARS-0690-2025, donde se impuso una multa de un salario base correspondiente a la suma de ¢462.200.00 por el incumplimiento de la Sanitaria No. MS-DRRSCS-DARSP-OS-006-2025. Finalmente, se colige que el 9 de diciembre del 2025, el Ministerio de Salud recibió ante esta dependencia el recurso de apelación del informe sanitario N°MS-DRRSCS-DARS-0690-2025 por parte de la Municipalidad de San José.
A. En cuanto a la Municipalidad de San José, se tiene que dichas autoridades conocen del problema bajo estudio desde el año 2021 y que, a pesar de los varios años trascurridos hasta la fecha, no han llevado a cabo acciones claras y contundentes tendentes a solventarlo de forma definitiva. Nótese que, según el apartado de hechos probados de este amparo, la corporación municipal ha participado en comisiones junto a otras institucional a fin de encontrar una solución al problema que aqueja al sector de Finca San Juan, Pavas; no obstante, el problema de desbordamiento de aguas residuales aún persiste, sin una solución real. Aunado a lo anterior, nótese que sobre el ente municipal accionado pesa una orden sanitaria desde el 19 de febrero de 2025, sin que a este momento se hubiere dado cumplimiento con lo dispuesto por parte del Ministerio de Salud, siendo que, en los informes rendidos a esa cartera ministerial a efecto de actualizar sobre las acciones tomadas al respecto, lo que se aduce es una incompetencia para proceder a su incumplimiento.
Así las cosas, para esta Sala Constitucional no cabe duda que las autoridades del municipio recurrido han incurrido en graves omisiones que han coadyuvado a que el problema sanitario y ambiental bajo estudio se mantenga a la fecha.
B. En lo que respecta al Ministerio de Salud, se tiene que estas autoridades, desde el año 2024, conocen del problema bajo estudio y que, desde entonces también, realizaron inspecciones en el sitio y, al constatar los hechos denunciados, han venido gestionando ante diferentes instituciones su atención. Es este sentido, cabe indicar que el 21 de junio del 2024, el área rectora de salud accionada realizó traslado del caso N° D-0091-2024, a través del oficio N° MS-DRRSCS-DARS-P-0269-2024 al Instituto Costarricense de Acueductos y Alcantarillados; no obstante, el 9 de julio del 2024, el Instituto Costarricense de Acueductos y Alcantarillados, respondió el oficio indicando que la Urbanización Finca San Juan había sido construida por el Instituto Nacional de Vivienda y Urbanismo; indicando que el proyecto no había sido trasladado a esa institución para su correcta operación. Ahora bien, a pesar de haberle solicitado dicha área rectora la limpieza, mantenimiento y destaqueo de la red de alcantarillado, recibió la negativa del ICAA, señalando que dado que la red de alcantarillado no se había concluido por parte del INVU y no se había trasladado al ICAA, era improcedente que esa institución destinara recursos para su mantenimiento.
Se evidencia que ante la situación expuesta, las autoridades del Ministerio de Salud, acudieron ante el Instituto Nacional de Vivienda y Urbanismo, para obtener información sobre la situación del sector conocido como Finca San Juan, Pavas, estableciéndose que: “El INVU en la fecha de abril del año 2008 traspasó las calles, avenidas, alamedas, parques y áreas comunales a la Municipalidad de San José.” (sic). En por esta razón, que posterior a varios acercamientos ante la Municipalidad de San José a fin de encontrar una solución a la problemática presentada, finalmente el 19 de febrero de 2025, el Ministerio de Salud, notificó la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025, a la corporación municipal recurrida, la cual a este momento se encuentra pendiente de cumplimiento.
En este punto, es importante recordarles a las autoridades del Ministerio de Salud, que el hecho de haber emitido la orden sanitaria antes mencionada y haber solicitado informes para conocer acerca de su cumplimiento, incluso estableciendo sanciones al respecto, no lo releva o exime de continuar atendiendo y darle el seguimiento que corresponda, a través del dictado y ejecución de todos aquellos actos que resulten pertinentes, conforme a lo estipulado en la Ley General de Salud y su reglamento. En ese particular, esta jurisdicción, en el Voto No. 2016-6368 de las 09:30 hrs. de 13 de mayo de 2016, señaló lo siguiente:
“(…) V. DEL AMPARO CONTRA EL MINISTERIO DE SALUD. SOBRE EL FONDO: De los hechos anteriores se desprende que el Ministerio de Salud, si bien actuó oportunamente, emitió las órdenes sanitarias e incluso presentó denuncias penales, lo cierto es que el problema sanitario subsiste, como lo indica su representante en el informe rendido bajo juramento. No observa la Sala que el Ministerio haya adoptado medidas extraordinarias, como la clausura del lugar, la colaboración de la Fuerza Pública para la seguridad del lugar, e incluso, el eventual desalojo del residencial o cualesquiera otras medidas efectivas. La prestación de un servicio público como el que está en manos del Ministerio de Salud exige una eficiencia y diligencias acaso más allá de la necesaria en por parte de otros órganos públicos, por causa de los derechos fundamentales a la salud y al ambiente sano, en lo que atañe a sus competencias.
La Sala considera que lo actuado por el Ministerio de Salud ha sido insuficiente y viola el derecho fundamental a la salud y a un ambiente sano de la amparada, por lo que procede estimar el recurso en su contra y ordenar que se disponga las medidas necesarias, incluso radicales, y adopte las decisiones pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Condominio Camino de Luna, el Río Liberia y el Residencial El Río, dentro de un término de dos meses, a partir de la notificación de la sentencia. (…)” (El destacado no forma parte del original).
Asimismo, en la Sentencia No. 2022-10613 de las 09:40 hrs. de 13 de mayo de 2022, esta Sala señaló:
“(…) IV.- SOBRE EL CASO EN CONCRETO.- Después de analizar los elementos probatorios aportados, este Tribunal verifica que ha existido la violación a los derechos fundamentales por parte de las autoridades recurridas. Lo anterior, porque en el informe rendido por parte del representante de dicha autoridad -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el 16 de agosto del 2021, el recurrido recibió la denuncia interpuesta por el recurrente, en contra de sus vecinos por la descarga de aguas servidas hacia su propiedad por parte de los vecinos denunciados. El 27 de agosto del 2021, la Gestora Ambiental del Área Rectora de Salud Alajuela 1, realizó visita de inspección al sitio, en que la autoridad sanitaria determinó la descarga de aguas pluviales y residuales (negras y servidas) hacia la propiedad del amparado, ocasionando malos olores, riesgo de proliferación de insectos y roedores que pueden afectar la salud las personas que habitan la vivienda.
El 03 de setiembre del 2021, el recurrido giró y notificó orden sanitaria N° 0188 en que se le ordenó a José Arístides Morera Jiménez, proceder a corregir la problemática encontrada, y en el plazo de dos meses disponer sanitaria y adecuadamente las aguas pluviales, residuales y negras que no están encausadas adecuadamente en la vivienda de su propiedad. El 10 de noviembre del 2021, el recurrido realizó una visita de verificación del cumplimiento de la orden sanitaria referida, comprobando que las aguas pluviales y residuales seguían descargando hacia la propiedad del tutelado, por lo que se constató el incumpliendo lo ordenado. Por oficio MS-DRRSCN-DARSA1-3001-2021, el recurrido remitió denuncia a la Fiscalía Adjunta de Alajuela, contra de José Arístides Morera Jiménez por el delito de desobediencia a la autoridad, sin que a la fecha se haya emitido resolución al respecto. El 09 de diciembre del 2021, el recurrente presentó denuncia contra el señor Aiut Avalos e indica que el denunciado conduce sus aguas pluviales y residuales (servidas) hacia su propiedad, por lo que pidió solicitar al vecino que encause esas aguas de forma adecuada.
El 06 de enero del 2022, el recurrido efectuó la visita de inspección y a pesar de que no había nadie en la propiedad del denunciado, se comprobó que las aguas pluviales y servidas son dirigidas a la propiedad del amparado, por lo que se confeccionó la orden sanitaria 0030 ordenando al señor Aiut Avalos, disponer sanitaria y adecuadamente las aguas pluviales que no están encausadas en su vivienda, empero, no se ha podido notificar, ya que no se encuentra a las personas en el lugar.
Así las cosas, esta Sala estima que si bien el recurrido argumenta que ha efectuado acciones tendientes a la resolución de la situación que aqueja al tutelado, lo cierto es que a pesar de ello, no ha logrado resolverlo de manera definitiva, pues la simple interposición de una denuncia penal por incumplimiento de una orden sanitaria y la excusa de que no han podido notificar la otra orden sanitaria, no resulta suficiente para esta Sala, tomando en cuenta que hay un problema serio comprobado de aguas llovidas y residuales incorrectamente manejadas, que discurren todas hacia la propiedad del recurrente, por falta de obras de drenaje por parte de los vecinos, lo que le ocasionan problemas serios de inundación y contaminación desde hace mucho tiempo y no se soluciona. Nótese que el Ministerio de Salud tiene amplias potestades para actuar de conformidad con la Ley General de Salud y el Reglamento correspondiente, como ente rector encargado de la vigilancia y control de la salud, tales como: las medidas sanitarias especiales de desalojo de vivienda (artículo 1 inciso c del Reglamento), declaratoria de inhabitabilidad, demolición, así como las multas, ya que es claro que de conformidad con la Ley General de Salud artículos 39 y 286 es deber de todo propietario y encargado de muebles e inmuebles evitar molestias y daños a la salud así como focos de contaminación o infección debiendo efectuar obras de drenaje e incluso en caso de renuencia hacerlas la administración a costa del omiso, todo resguardando el debido proceso. De modo que lo procedente es declarar con lugar el recurso, con las consecuencias, que se indicaran en la parte dispositiva (…)” (El destacado no forma parte del original).
Más recientemente, en el Voto No. 2025-583 de las 09:20 hrs. de 10 de enero de 2025, este órgano constitucional señaló:
“(…) Sobre el Ministerio de Salud. Si bien, de los informes rendidos y de la prueba que consta en autos, se acredita que las autoridades accionadas del Ministerio de Salud -Área Rectora de Salud de Puntarenas – Chacarita-, han realizado gestiones a fin de cumplir con las ordenes que en su momento dio este Tribunal, tal como se aprecian en los hechos probados de esta sentencia, y que, ante el incumplimiento de la orden sanitaria 0112-REG-2024 por parte de la Municipalidad de Puntarenas, el 4 de diciembre del 2024, se interpuso denuncia penal contra la Municipalidad de Puntarenas, por el presunto Delito de Desobediencia a la Autoridad ante la Fiscalía Adjunta del Ministerio Público en Puntarenas; sin embargo, lo cierto del caso es que, para esta Sala su deber ha sido insuficiente, pues dicho ministerio demanda la observancia, así como, el garantizar la protección de la salud de la población y del medioambiente (…)” (El destacado no forma parte del original).
Ante dicho panorama, resulta claro que las autoridades recurridas del Ministerio de Salud también han sido omisas en atender la grave situación ambiental que afronta la comunidad de Finca San Juan, Pavas.
C. Finalmente, en cuanto al Instituto Costarricense de Acueductos y Alcantarillados, se ha informado y se ha acreditado a partir de las pruebas allegadas, que la Urbanización Finca San Juan fue inicialmente construida por el Instituto Mixto de Ayuda Social y que dicho proyecto al no haberse concluido adecuadamente, dio al traste con la entrega al ICAA. En el informe rendido a esta Sala, el ICAA explicó claramente lo siguiente:
“(…) Se considera importante mencionar que en el sitio existe una red de alcantarillado sanitario inconclusa, la cual no tiene tratamiento y no es activo del AyA, por lo que la Institución no brinda el servicio de mantenimiento a dicha red y no cobra el servicio de alcantarillado sanitario. Según la información que se cuenta, esta red propiedad del INVU. (…)”.
Ahora, cabe señalar que si bien son comprensibles los motivos objetivos explicados por las autoridades del ICAA para no asumir con fondos públicos el problema; lo cierto es que, de otra parte, este estado de cosas no lo debe ni puede eximir de colaborar con el resto de autoridades recurridas en aras de hallar una solución al problema ambiental y de salubridad acreditado. Ante la gravedad de los hechos demostrados, este Tribunal Constitucional considera que el ICAA sí debe intervenir (en virtud del claro y amplio conocimiento que posee en la materia) y ejecutar las instancias de coordinación que sean pertinentes tanto con la Municipalidad de San José y como el Ministerio de Salud para lograr, en conjunto, una respuesta y hacer frente a la situación bajo estudio. Si bien, como se dijo, el ICAA no se encuentra compelido a invertir fondos públicos en la solución del problema, sí puede colaborar y coordinar con el resto de instancias públicas citadas en los términos señalados. Sin embargo, esta última labor se echa de menos en el presente asunto.
VII.Conclusión. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano ni el derecho a la salud debido a la incapacidad de las autoridades correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. En efecto, considera este Tribunal que la actividad estatal debe darse de manera coordinada y efectiva, pues no se trata simplemente de determinar el problema y endilgarle la responsabilidad a otros, como ha sucedido en este caso, ni tampoco corresponde que sea esta Sala quien asigne a cada entidad las soluciones que deben implementar; sino que, una vez valorado el asunto se debe dar una solución integral, para lo cual, bajo el sistema de distribución de competencias y funciones de un Estado, deben participar todos los involucrados, cada una aportando lo que en definitiva le corresponde. De conformidad con lo expuesto, esta Sala determina que tanto la Municipalidad de San José, el Instituto Costarricense de Acueductos y Alcantarillados, como el Ministerio de Salud deben coordinar una solución definitiva al problema sanitario que afecta a la comunidad Finca San Juan, Pavas. En consecuencia, lo procedente es declarar con lugar el recurso.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

Por tanto:
Se declara con lugar el recurso. En consecuencia: a) Se ordena a Luis Diego Miranda Méndez, en condición de alcalde de San José, así como a Adolfo Ortiz Barboza, en condición de director a.i. del Área Rectora de Salud de Pavas y a Nelson Cordero Rodríguez, en condición de director a.i. de la Dirección Regional de Rectoría de la Salud Central Sur, ambos funcionarios del Ministerio de Salud, o a quienes en sus lugares ocupen esos cargos, girar las órdenes pertinentes y llevar a cabo todas las actuaciones necesarias para que, de forma inmediata, a partir de la notificación de la presente sentencia, de manera conjunta y coordinada, dispongan lo necesario para asegurar que no hayan afectaciones a la salud de las personas que habitan en el Sector Finca San Juan, Pavas; b) Se ordena a Luis Diego Miranda Méndez, en condición de alcalde de San José, o a quien ocupe ese cargo, girar las órdenes pertinentes y llevar a cabo todas las actuaciones necesarias, para que, dentro del plazo máximo de DOCE MESES contado a partir de la notificación de esta sentencia, se lleven a cabo y finalicen los trabajos que se requieran para cumplir con la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025 emitida por parte del Ministerio de Salud; c) Se ordena a Adolfo Ortiz Barboza, en condición de director a.i. del Área Rectora de Salud de Pavas y a Nelson Cordero Rodríguez, en condición de director a.i. de la Dirección Regional de Rectoría de la Salud Central Sur, ambos funcionarios del Ministerio de Salud, o a quienes en sus lugares ocupen esos cargos, ejecutar las acciones pertinentes dentro del marco de sus competencias para velar por el cumplimiento de la Orden Sanitaria N°MS-DRRSCS-DARS-P-OS-006-2025, dentro del plazo anteriormente dispuesto, de forma que se resuelva en forma definitiva la problemática de contaminación existente en Finca San Juan, Pavas; y d) Se ordena a Alejandro González Bogantes, en condición de director de Recolección y Tratamiento GAM del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe ese cargo, que de manera inmediata ejecute las labores de coordinación que sean necesarias junto al Ministerio de Salud y la Municipalidad de San José, a fin de brindar el apoyo y la asesoría que sea necesaria para solucionar de manera definitiva el problema de desbordamiento de aguas residuales presente en el sector de Finca San Juan, Pavas, proporcionando el acompañamiento que sea necesario para cumplir con ese fin.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José, al Estado y al Instituto Costarricense de Acueductos y Alcantarillados, al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo Víquez consigna nota. Notifíquese”.
En consecuencia, visto que el plazo indicado en esa sentencia no ha vencido, lo procedente es acoger el recurso y ordenar que se solvente el problema dentro del término ahí establecido.
V.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento.
VI.Nota del magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que desde marzo de 2024 se presenta un desbordamiento de aguas negras en finca San Juan, Pavas, el cual fluye hacia el sistema pluvial. Aduce que esta situación ha generado aguas residuales en vía pública, ingreso de gases a viviendas, olores insoportables, presencia masiva de vectores, lo que estima lesivo de la salud, seguridad y dignidad de los vecinos. Menciona que la Municipalidad de San José, el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud tienen conocimiento de esta situación; sin embargo, no ha obtenido una solución.
VII.Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de cierta complejidad, como es en este caso que dentro del plazo pendiente de doce meses dispuesto en la sentencia No. 2026-004335 de las 9:20 horas del 06 de febrero de 2026, el Instituto Costarricense de Acueductos y Alcantarillados, el Ministerio de Salud y la Municipalidad de San José resuelvan de manera definitiva el problema de desbordamiento de aguas residuales en el sector de la Finca San Juan de Pavas. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara con lugar el recurso. Se les ordena a Lourdes María Saurez Barboza y Ana Isabel Rodríguez Sánchez, cada una en su respectiva condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados y directora del área rectora de salud de Pavas, así como a Mariana de los Ángeles Zúñiga Pérez y Luis Diego Miranda Méndez, por su orden, presidenta municipal y alcalde, ambos de San José, o a quienes ejerzan esos cargos, que giren las órdenes pertinentes y dispongan lo necesario dentro del ámbito de sus competencias respectivas, para que, dentro del plazo pendiente dispuesto en la sentencia nro. 2026004335 de las 9:20 horas del 6 de febrero de 2026 se resuelva de manera definitiva el problema de desbordamiento de aguas residuales en el sector de Finca San Juan, Pavas. Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Caja Costarricense de Seguro Social, a la Municipalidad de San José y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia ante la jurisdicción contencioso-administrativa. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
