CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the thirtieth of July two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case file nro. 26-015410-0007-CO, brought by [Nombre 001], national identity card (cédula de identidad) [Valor 001], against the MINISTERIO DE SALUD, the CONCEJO MUNICIPAL DE DISTRITO DE CERVANTES DE ALVARADO, and the MINISTERIO DE AGRICULTURA Y GANADERÍA (MAG).
Background:
As stated, once the customary inquiries in our municipal records were conducted, the dairy operation reported by Mr. [Nombre 001] does not hold operating or construction permits issued by this administration, and should the owner — namely Mr. [Nombre 006] with identification number [Valor 003] — initiate the relevant proceedings, the reported activity could at most be declared a tolerated nonconforming use (uso no conforme tolerado) in light of the Plan Regulador of the Canton of Alvarado, given that the structure used for said activity has been in existence for a very long time, in which case improvements would be required with respect to the proper management of sewage water (aguas servidas), stormwater, and solid and organic waste, since it is located in an agriculturally oriented zone accessed by a residential zone.
It is important to note that the properties involved in this neighborhood dispute were at some point subdivided from an agricultural parcel dedicated to cattle raising and related activities, and that even though the street and the adjacent properties were partially designated for residential use, the predominant use of the area is agricultural; therefore, in a district with an agricultural vocation, a degree of tolerance toward such activity must exist.
Notwithstanding the foregoing, since the control and keeping of animals — the primary cause of noise pollution, foul odors, and obstruction of roadways, as well as the consequent contamination of stormwater due to the lack of adequate systems pursuant to Ministry of Health standards — is not strictly a municipal matter, it is of crucial importance that the entities involved in the control of these public health and environmental impacts — namely the Ministry of Health, SENASA, and MINAE — notify the offender and proceed with the corresponding sanitary order so that the municipality, through the corresponding licenses, may require compliance with the Ley de Construcciones and its implementing regulations, as well as all binding standards in urban and environmental matters.
Recent inspections have determined that the problem is not directly related to the channeling of stormwater from the building to the public thoroughfare, since the shed (galerón) used as a dairy operation does not have a gutter (canoas) and drainage system discharging to the public thoroughfare; rather, roof runoff flows freely into the interior of the property and drains naturally in the pasture area, which is why the reported problem is not strictly a matter of stormwater discharge to the public thoroughfare.
In this regard, it appears more likely that the slope of the concrete apron (planché) providing access to the main gates of the reported dairy operation channels the sewage water from the dairy operation to the public thoroughfare, which gives rise to the need for a farm management plan (plan de manejo de finca) that would allow for adequate use of the property in connection with the livestock activity.
That being the case, upon closing this report, the owner of the dairy operation is being notified to initiate the operating license proceedings in order to normalize the activity; however, it is reiterated that without the corresponding sanitary order regarding the foul odors and contamination of soils and surface water from the Ministry of Health, and the sanitary order from SENASA regarding the keeping of animals without proper controls, these conditions will continue to affect the quality of life of the residents of Calle Ulloa. We will subsequently proceed to notify all residents of Calle Ulloa regarding the proper construction of sidewalks and the corresponding channeling of stormwater, in accordance with the Código Municipal and the mobility law. Therefore, the present writ of amparo should be declared without merit with respect to the District Municipal Council of Cervantes, until the relevant public institutions carry out the corresponding actions."
The evidence submitted demonstrates that the reported facts have not ceased and that the infringement upon my fundamental rights continues to occur in a repeated and permanent manner, despite the complaints previously filed with the Ministry of Health, the Servicio Nacional de Salud Animal (SENASA), and the Municipal Intendancy of the District Council of Cervantes. The foregoing evidences the need for prompt and effective action by the respondent authorities, in fulfillment of their constitutional and legal duties with respect to the protection of public health, environmental sanitation, and the safeguarding of the fundamental rights of inhabitants.
On the basis of the foregoing, I respectfully request of the Honorable Justices: 1. That the attached photographs, taken on June 17, 2026, be admitted into case file number 26-015410-0007-CO as additional evidence of the ongoing and current nature of the reported facts. 2. That said evidence be considered when adjudicating this writ of amparo, as it demonstrates that the reported infringement persists and continues to undermine my fundamental rights. 3. That, in protection of the rights enshrined in Articles 21, 50, and related provisions of the Constitución Política, the writ of amparo be declared with merit. 4. That the respondent authorities be ordered to adopt, within the scope of their respective competencies, the necessary and effective measures to guarantee the definitive cessation of the conditions generating the accumulation of cattle excrement on the public thoroughfare and in front of my property, thereby preventing further harm to public health, a healthy environment, and freedom of movement. 5. That the immediate implementation of whatever measures this High Court deems appropriate be ordered, in the interest of ensuring effective judicial protection and preventing the prolongation of a situation that continues to cause harm to myself and the community.
Given that these are current and ongoing facts, and since the photographs were taken today, I respectfully request that they be considered as evidence of the enduring nature of the reported injury."

Considering:
Prior to examining the merits of this petition, it must be clarified that, since ruling No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Constitutional Chamber (Sala) has referred — with certain exceptions — to the administrative contentious jurisdiction (jurisdicción contencioso administrativa) those matters in which it is disputed whether the public administration has complied or not with the deadlines established by the General Administrative Procedure Law (Ley General de Administración Pública) (Articles 261 and 325) or by sectoral laws for special administrative procedures, to resolve by final act an administrative procedure — conducted ex officio or at the request of a party — and to consider the applicable administrative remedies. This case, precisely, presents an exceptional circumstance, as it involves a complaint concerning alleged sanitary problems affecting the protected party.
The petitioner states that a dairy operation operates on a property adjacent to his home. He argues that since 2017 he has repeatedly requested the Ministry of Health to intervene, owing to the contamination produced by that industrial activity, which generates foul odors, accumulation of waste, and excessive noise; furthermore, excrement is not properly managed. He recounts that in 2024 the situation worsened, which is why he filed a formal complaint with the Health Regulatory Area of Paraíso; however, that authority has not taken the necessary measures to resolve the problem. He adds that the aforementioned agency also referred the case to the MAG and to the District Municipal Council of Cervantes; however, those authorities have likewise failed to resolve the situation.
Of relevance to the decision in this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent authority omitted any reference to them, as required by the initial order (auto inicial):
With respect to the authorities of the Ministry of Health:
With respect to the MAG:
Through visit record 36284, bovine traceability was performed on 9 animals on April 15. • On April 22 of the current year, a joint visit was conducted with ICE, visit sheet number 36286, during which efforts were made to equip the producer with an earthworm (lombrices) module for the treatment of excrement, and discussions took place regarding the installation of a module for composting and drying the same, with the objective of treating the remaining waste and using the rest of the effluent (efluente) on cut-grass; it is worth noting that the producer works in said areas, and the relevant land-use designation was also requested." (Report of the respondent authority.)
With respect to the District Municipal Council of Cervantes de Alvarado:
In the matter at hand, the petitioner states that a dairy operates on a property adjacent to his home. He alleges that since 2017 he has repeatedly requested that the Ministerio de Salud intervene, due to the contamination produced by that industrial activity, which generates foul odors, accumulation of waste, and excessive noise; moreover, manure is not properly managed. He recounts that in 2024 the situation worsened, prompting him to file a formal complaint with the Área Rectora de Salud de Paraíso; however, that authority has not taken the necessary measures to resolve the problem. He adds that the same office also referred the matter to MAG and to the Concejo Municipal de Distrito de Cervantes; however, those authorities have likewise failed to resolve the situation.
From the review of the record, it is established that in September 2017 the Área Rectora de Salud de Paraíso received a complaint from the petitioner against the dairy commercial operation being conducted adjacent to his property; however, following the inspections carried out, no irregular activity could be confirmed, and the complainant was so informed on 28 November 2017. On 10 July 2024, the petitioner filed a new complaint with the Área Rectora de Salud de Paraíso concerning livestock (actividades ganaderas) activity adjacent to his property. On 30 July 2024, the health authorities conducted an on-site inspection and identified problems with wastewater (aguas residuales), the electrical installation, and general sanitary conditions at the establishment. After several attempts, on 4 October 2024 the respondent party was served with sanitary order (orden sanitaria) no. MS-DRRSCE-DARSP-OS-0196-2024, granting a period of 40 days to carry out the following actions: "thorough cleaning and disinfection of the entire dairy; prohibition on discharging blackwater (aguas negras) and wastewater into the stormwater sewer; adequate and sanitary disposal of wastewater originating from the property so as to prevent contamination of the soil and natural water sources; submission of the certificate or verification report for the electrical installation of the premises, prepared by a duly registered professional in accordance with the provisions of the Reglamento de Oficialización del Código Eléctrico de Costa Rica." On 17 October 2024, the matter was also referred to Senasa and to the Concejo Municipal de Distrito de Cervantes de Alvarado.
On 22 May 2025, the health authority served the petitioner with an official letter explaining that "the reported establishment is in the process of managing compliance with the two outstanding points of the sanitary order, which are being addressed jointly with the Ministerio de Agricultura y Ganadería." On that same date, proceedings were transferred to MAG. Through technical reports nos. CARTA-MS-DRRSCE-DARSP-IT-0659-2025, CARTA-MS-DRRSCE-DARSP-1144-2025, and CARTA-MS-DRRSCE-DARSP-IT-0036-2026, dated August 2025, it was determined: "that the respondent party complied with only two of the four points of the said sanitary order, leaving outstanding the matters concerning the prohibition on discharging blackwater and wastewater into the stormwater sewer, as well as the adequate and sanitary disposal of wastewater originating from the property." On 13 April 2026, the respondent authority served the respondent party with an official letter regarding non-compliance with the sanitary order, as well as the imposition of a fine.
On 15 April 2026, the respondent party filed an appeal against the fine and the non-compliance report, which was elevated to the appellate body (órgano de alzada) on 23 April 2026. Regarding the noise complaint filed by the petitioner on 17 July 2025, the respondent authority notified him that the inspection would take place on 27 August of that year; however, it did not proceed because the complainant was not present at his property on that day. Consequently, on 24 November 2025 he was requested to provide three dates on which the proceeding could be carried out; however, he did not respond. On 23 October 2024, MAG authorities conducted an on-site inspection to begin providing guidance on improving the commercial operation's processes, at the request of the Área Rectora de Salud de Paraíso. The Agencia de Extensión Agropecuaria de Paraíso of MAG has carried out the following actions: "• In follow-up to the referral of the case through colleague Maritza Araya Mora, who informed us that the case fell within our agency's jurisdiction, a visit was conducted on 31 October 2024 under number 81737, during which a soil sampling was performed to develop a fertilization plan, instructions were given for sending samples to the laboratory, and a perimeter tour of the farm was conducted to assess the application of liquid manure (purines). • On 14 November 2024 the sample was received, and on 26 November 2024 the laboratory issued the results of the analysis, which were delivered to the producer.
As part of the complaint process, the producer sent the Ministerio de Salud, on 25 November 2024, an official letter from Mr. Carlos Francisco Araya Aguilar showing that the electrical system of the dairy had already been improved, demonstrating the producer's willingness to comply with the recommendations arising from the complaint. • On 14 February 2025, under official letter AEA-PAR-04-25 addressed to Dr. José Ignacio Ballestero Solano, at that time director of the Área Rectora de Paraíso, Ministerio de Salud, it was communicated that support, follow-up, and technical advisory services were being provided through a farm plan (plan de finca). • On 17 February 2025, as part of the follow-up with the producer through visit sheet 0148011, the bovine traceability system was implemented, 25 animals were tagged, training was provided on the Trazar Agro platform, and follow-up was given on manure management: at that time it was observed that on the road the producer was collecting cattle dung in compliance with the recommendations provided. • Follow-up with the producer was conducted on 22 April 2025, during which a fertilization plan was prepared and the producer was asked to provide the land-use permit (uso de suelo) for the farm; the producer indicated that he was suffering from a serious health condition, as documented in visit sheet 0148128. • On 21 July 2025, through visit sheet 0149913, a visit was made to the producer to collect data in order to support the calculations for the management plan; planting of cut grass (pasto de corta) was recommended in the area behind the dairy to make use of the farm's remaining capacity. • As part of the actions of the AEA de Paraíso, a query was submitted using the data to Engineer Rebeca Gutiérrez, who, through official letter SENASA-PAA-022-2025, provided certain recommendations in this regard; the letter is attached.
Through visit sheet 36284, bovine traceability of 9 animals was carried out on 15 April. • On 22 April of the current year, a joint visit with ICE was conducted, sheet number 36286, during which work was done to provide the producer with a vermiculture module (módulo de lombrices) for manure treatment, and discussions were held regarding the installation of a composting and drying module for the same purpose, with the aim of treating the remaining solids while using the rest of the effluent on cut grass; it is worth noting that the producer works in those areas, and he was likewise asked to provide the corresponding land-use permit." On 17 October 2024, the Área Rectora de Salud de Paraíso referred the matter of the reported property to the Concejo Municipal de Distrito de Cervantes de Alvarado. The reported dairy lacks a municipal operating license and has neither a stormwater drainage system nor sidewalks.
In the course of processing this writ, the respondent District Municipal Council notified the owner of the dairy that he was required to apply for an operating license; likewise, the respondent and other residents of the street were notified that they were required to construct sidewalks and the corresponding stormwater drainage system.
In the first place, with respect to MAG, any harmful omission affecting the fundamental rights of the petitioner is prima facie ruled out. In this regard, it is observed that the matter was referred to that office by the Ministerio de Salud for the corresponding assessment, given that the commercial activity involved animals. In this context, it is observed that MAG authorities have provided the appropriate guidance and advisory services for improving the productive process. Indeed, it is noted that the most recent visit took place on 22 April and that work was done on a "vermiculture module for manure treatment, and discussions were held regarding the installation of a composting and drying module for the same purpose, with the aim of treating the remaining solids while using the rest of the effluent on cut grass." Furthermore, in its report the respondent authority does not identify irregularities strictly related to matters falling within its own areas of competence, and it reaffirms that advisory and support services continue to be provided as appropriate.
On the other hand, with respect to the specific issue of noise that the petitioner alleges is produced by the reported farm, it is observed that the Área Rectora de Salud de Paraíso sought to address that problem; however, this was not possible due to circumstances attributable to the complainant himself. In this regard, it is established that on 17 July 2025 the respondent authority notified the petitioner that on 27 August of that year an inspection would be conducted to verify the alleged noise problem; however, it did not proceed because the complainant was not present at his property on that day. Consequently, on 24 November 2025 he was requested to provide three dates on which the proceeding could be carried out; however, he did not respond. Accordingly, no omission on the part of the respondent authority can be established with regard to this point.
Therefore, the writ is dismissed with respect to these two issues.
V.Now, with respect to the Concejo Municipal de Distrito de Cervantes de Alvarado and the proper follow-through by the respondent Área Rectora de Salud on the irregular situations set forth in sanitary order no. MS-DRRSCE-DARSP-OS-0196-2024, the intervention of this constitutional jurisdiction is indeed warranted.
In the first place, regarding the said sanitary order, it is established that, although it was served in October 2024 and the respondent party was given 40 days to comply with its provisions, as of April 2026 there were still outstanding points that had not been resolved. In this regard, the health authority itself notes that "the respondent party complied with only two of the four points of the said sanitary order, leaving outstanding the matters concerning the prohibition on discharging blackwater and wastewater into the stormwater sewer, as well as the adequate and sanitary disposal of wastewater originating from the property." In this context, the respondent authority reports that the respondent party was served notice of the imposition of a fine, which the latter appealed. However, while the appeal was elevated to the appellate body on 23 April 2026, the record does not show that any ruling had been issued at the time this writ was filed.
Accordingly, given the non-compliance with requirements ordered as far back as 2024, as confirmed by the respondent authority, the appropriate course of action is for the relevant measures to be executed promptly and in an effective and comprehensive manner to resolve the sanitary problems — and there is no indication on the record that this has been done.
Furthermore, this Court also finds no evidence that the respondent District Municipal Council acted with the requisite promptness to address the situation in question and remedy the irregularities identified, even though the matter was also referred to that body in October 2024.
In this respect, it is worth noting that it was only in the course of processing this amparo proceeding that the respondent authority notified the owner of the dairy that he was required to apply for an operating license; likewise, the respondent and other residents of the street were notified that they were required to construct sidewalks and the corresponding stormwater drainage system. However, there is no indication on the record that measures to bring the said irregular situations into legal compliance have ultimately been carried out.
Consequently, the writ is granted with respect to these issues, in the terms set out in the dispositif of this ruling.
In environmental matters, it is the view of the undersigned that where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative contentious (contencioso administrativo) courts. Nevertheless, I do enter into the merits of the case when other rights of persons affected by the source of contamination are at stake — including the right to health, to quality of life, and to enjoy a healthy, contamination-free environment (article 50 of the Constitución Política) — as is the case here, in which the petitioner states that a dairy operates on a property adjacent to his home. He alleges that since 2017 he has repeatedly requested that the Ministerio de Salud intervene, due to the contamination produced by that industrial activity, which generates foul odors, accumulation of waste, and excessive noise; moreover, manure is not properly managed. He recounts that in 2024 the situation worsened, prompting him to file a formal complaint with the Área Rectora de Salud de Paraíso; however, that authority has not taken the necessary measures to resolve the problem. He adds that the same office also referred the matter to MAG and to the Concejo Municipal de Distrito de Cervantes; however, those authorities have likewise failed to resolve the situation.
The parties are hereby advised that any documents submitted in paper form, as well as objects or evidence contained in any additional device of an electronic, computer, magnetic, optical, telematic, or new-technology nature, must be retrieved from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N°27-11 of 22 August 2011, article XXVI, and published in the Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N°43-12 held on 3 May 2012, article LXXXI.
Por tanto:
The writ is declared partially granted, solely with respect to the Ministerio de Salud and the Concejo Municipal de Distrito de Cervantes de Alvarado, in the terms set forth in Considerando V of this judgment. Alexander Sánchez Cabo and Carlos Alberto Granados Siles, each in their respective capacities as Minister of Health and Director of the Área Rectora de Salud de Paraíso, or whoever holds those positions, as well as Mariana Calvo Brenes, in her capacity as intendant (intendente) of the Concejo Municipal de Distrito de Cervantes de Alvarado, or whoever holds that position, are hereby ordered to issue the pertinent directives, coordinate what is necessary, and carry out all actions within the scope of their respective competences so that, within a maximum period of TWO MONTHS counted from notification of this judgment, the corresponding measures are executed to bring the duly established irregularities into legal compliance and to definitively resolve the problem that is the subject of this writ.
The respondent authority is hereby warned that, in accordance with article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued within an amparo proceeding, and who fails to comply with or cause compliance with that order, provided the offense is not more severely penalized under another provision. The State and the Concejo Municipal de Distrito de Cervantes de Alvarado are condemned to pay costs, damages, and losses caused by the acts that serve as the basis for this declaration, to be assessed in enforcement proceedings before the administrative contentious courts. In all other respects, the writ is declared without merit. Magistrate Salazar Alvarado appends a note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del treinta de julio de dos mil veintiseis .
Recurso de amparo que se tramita en el expediente nro. 26-015410-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SALUD, el CONCEJO MUNICIPAL DE DISTRITO DE CERVANTES DE ALVARADO y el MINISTERIO DE AGRICULTURA Y GANADERÍA (MAG).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
De previo a analizar el fondo del recurso, debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa – con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo – instruido de oficio o a instancia de parte– conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia relativa a presuntos problemas sanitarios que afectan a la parte tutelada.
El recurrente manifiesta que en una propiedad contigua a su vivienda opera una lechería. Aduce que desde 2017 ha solicitado reiteradamente al Ministerio de Salud que intervenga, debido a la contaminación que produce esa actividad industrial, pues se generan malos olores, acumulación de residuos y ruidos excesivos; además, no existe un buen manejo de los excrementos. Narra que en 2024 la situación se agravó, por lo que interpuso una denuncia formal ante el Área Rectora de Salud de Paraíso; sin embargo, esa autoridad no ha ejecutado las medidas necesarias para resolver el problema. Agrega que la dependencia referida también traslado el caso al MAG y al Concejo Municipal de Distrito de Cervantes; sin embargo, dichas autoridades tampoco han resuelto la situación.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Respecto de las autoridades del Ministerio de Salud:
Respecto del MAG:
Mediante la hoja de visita 36284 se realiza trazabilidad bovina de 9 animales, el 15 de abril. • El 22 de abril del presente año se realizó en conjunto con el ICE una visita, hoja número 36286, en donde se trabaja en dotar al productor de un módulo de lombrices para el tratamiento de las excretas y se conversa con el tema de colocar un módulo para compostear y secar la misma, con el objetivo de darle tratamiento a los remanentes y el resto del efluente usarlo en pasto de corta, cabe destacar que el productor trabaja en dichos espacios, de igual manera se le solicito el uso de suelos respectivo.”. (Informe de la autoridad recurrida).
Respecto del Concejo Municipal de Distrito de Cervantes de Alvarado:
En el sub lite, el recurrente manifiesta que en una propiedad contigua a su vivienda opera una lechería. Aduce que desde 2017 ha solicitado reiteradamente al Ministerio de Salud que intervenga, debido a la contaminación que produce esa actividad industrial, pues se generan malos olores, acumulación de residuos y ruidos excesivos; además, no existe un buen manejo de los excrementos. Narra que en 2024 la situación se agravó, por lo que interpuso una denuncia formal ante el Área Rectora de Salud de Paraíso; sin embargo, esa autoridad no ha ejecutado las medidas necesarias para resolver el problema. Agrega que la dependencia referida también traslado el caso al MAG y al Concejo Municipal de Distrito de Cervantes; sin embargo, dichas autoridades tampoco han resuelto la situación.
Del estudio de los autos se tiene por demostrado que, en septiembre de 2017, el Área Rectora de Salud de Paraíso recibió una denuncia del accionante en contra de la actividad comercial de lechería que se desarrollaba continuo a su propiedad; sin embargo, luego de las inspecciones efectuadas, no se logró comprobar actividad irregular alguna, lo cual se le comunicó al denunciante el 28 de noviembre de 2017. El 10 de julio de 2024, el tutelado interpuso una nueva denuncia ante el Área Rectora de Salud de Paraíso por el desarrollo de actividad ganaderas contiguo a su propiedad. El 30 de julio de 2024, las autoridades sanitarias realizaron una inspección en el sitio y determinaron problemas de aguas residuales, instalación eléctrica y condiciones sanitarias en general en el establecimiento. Luego de varios intentos, el 4 de octubre de 2024 se le notificó a la parte denunciada la orden sanitaria nro. MS-DRRSCE-DARSP-OS-0196-2024, en la que se le dio un plazo de 40 días para realizar las siguientes acciones: “limpieza y desinfección profunda de toda la lechería; prohibición de descarga de las aguas negras y residuales al alcantarillado pluvial; disponer adecuada y sanitariamente las aguas residuales provenientes de la propiedad a fin de evitar la contaminación del suelo y de las fuentes naturales; presentar el certificado o informe de verificación de la instalación eléctrica del local elaborado por un profesional debidamente colegiado en apego a lo establecido en el Reglamento de Oficialización del Código Eléctrico de Costa Rica.”.
El 17 de octubre de 2024, el caso fue también trasladado a Senasa y al Concejo Municipal de Distrito de Cervantes de Alvarado. El 22 de mayo de 2025, la autoridad sanitaria le notificó al recurrente un oficio, en el que le explicó que “el establecimiento denunciado está en proceso de gestión para el cumplimiento de los dos puntos pendientes de la orden sanitaria, los cuales están siendo abordados conjuntamente con el Ministerio de Agricultura y Ganadería.”. En esa misma fecha, se trasladan gestiones al MAG. Mediante los informes técnicos nros. CARTA-MS-DRRSCE-DARSP-IT-0659-2025, CARTA-MS-DRRSCE-DARSP-1144-2025 y CARTA-MS-DRRSCE-DARSP-IT-0036-2026, de agosto de 2025, se determinó: “que la parte denunciada solamente cumplió con dos de los cuatro puntos de la orden sanitaria de marras, quedando pendiente de cumplimiento los temas referentes a la prohibición de descarga de las aguas negras y residuales al alcantarillado pluvial así como a la disposición adecuada y sanitaria de las aguas residuales provenientes de la propiedad.”.
El 13 de abril de 2026, la autoridad recurrida le notificó al denunciando un oficio relativo al incumplimiento de la orden sanitaria, así como la imposición de una multa. El 15 de abril de 2026, el denunciado interpuso recurso de apelación en contra de la multa y el informe de incumplimiento referido, el cual fue elevado al órgano de alzada el 23 de abril de 2026. Respecto de la denuncia por ruido interpuesta por el tutelado el 17 de julio de 2025, la autoridad accionada le notificó a este que el 27 de agosto de ese año se llevaría a cabo la inspección, sin embargo, no se llevó a cabo porque el denunciante no se encontraba ese día en su propiedad. Debido a ello, el 24 de noviembre de 2025 se le solicitó que indicara tres fechas para realizar la diligencia; empero, no brindó respuesta. El 23 de octubre de 2024, autoridades del MAG realizaron una inspección en el sitio, para iniciar el acompañamiento en los procesos de mejora de la actividad comercial, a solicitud del Área Rectora de Salud de Paraíso.
La Agencia de Extensión Agropecuaria de Paraíso del MAG ha realizado las siguientes acciones: “• En seguimiento al traslado del caso por medio de la compañera Maritza Araya Mora, quien nos informó que el caso correspondía a nuestra agencia, es que se realizó una visita el 31 de octubre del 2024 bajo el número 81737, en donde se le realiza un muestreo de suelos para realizar un plan de fertilización, y se le hacen las indicaciones para poder enviar al laboratorio, se realiza un recorrido por el perímetro de la finca para analizar la aplicación de purines. • El 14 de noviembre 2024 se llevó a cabo la recepción de la muestra y el 26 de noviembre 2024 se emitió el resultado del análisis por parte del laboratorio, se le hizo llegar al productor. El productor como parte de la denuncia hizo llegar al Ministerio de Salud el pasado 25 de noviembre del 2024 un oficio de parte del señor Carlos Francisco Araya Aguilar en donde ya se mejoró el sistema eléctrico de la lechería donde se demuestra el interés del productor del acatamiento de las recomendaciones de la denuncia. • El 14 de febrero de 2025 bajo el oficio AEA-PAR-04-25 dirigido al Dr. José Ignacio Ballestero Solano, en ese momento director Área Rectora de Paraíso, Ministerio de Salud, en donde se le externa que se le está brindando apoyo, seguimiento y asesoría técnica al respecto por medio de un plan de finca. • El 17 de febrero del 2025 como parte del seguimiento al productor mediante la hoja de visita 0148011 se implementa el sistema de trazabilidad bovina, se realiza el areteo de 25 animales, se brinda capacitación en la plataforma trazar agro y se da seguimiento en el manejo de excretas: en donde se puede visualizar en ese momento que en la calle que el productor está recolectando la boñiga del ganado haciendo caso a las recomendaciones brindadas. • Se realiza seguimiento al productor el 22 de abril del 2025 en donde se realiza un plan de fertilización y se le solicita el uso de suelo de la finca, el productor indica que tiene un serio padecimiento de salud mediante la hoja de visita 0148128. • El 21 de julio del 2025 mediante la hoja de visita 0149913 se realizó una visita al productor para hacer captura de datos para poder apoyar con los cálculos del plan de manejo, se le recomendó la siembra de pasto de corta en la parte de atrás de la lechería para utilizar los remanentes de la finca. • Como parte de las acciones de la AEA de Paraíso con los datos se realizó una consulta a la Ingeniera Rebeca Gutiérrez y ella mediante el oficio SENASA- PAA-022-2025 es que indica algunas recomendaciones al respecto, se adjunta oficio.

El 17 de octubre de 2024, el Área Rectora de Salud de Paraíso trasladó el caso de la propiedad denunciada al Concejo Municipal de Distrito de Cervantes de Alvarado. La lechería denunciada carece de licencia de funcionamiento municipal y no tiene sistema de alcantarillado pluvial ni aceras. Con ocasión del trámite de este recurso, el Concejo Municipal de Distrito recurrido notificó al propietario de la lechería que debía proceder con el trámite de licencia de funcionamiento; asimismo, se notificó al denunciado y a otros vecinos de la calle que debían proceder con la construcción de aceras y con el respectivo sistema de canalización de aguas pluviales.
En primer lugar, respecto del MAG prima facie se descarta alguna omisión lesiva de los derechos fundamentales del tutelado. Al respecto, se observa que el caso fue trasladado a esa dependencia por el Ministerio de Salud para que la respectiva valoración, debido a la actividad comercial se desarrollaba con animales. En ese tanto, se observa que las autoridades del MAG han brindado el acompañamiento y asesoría respectiva para el mejoramiento del proceso productivo. Incluso, se observa que la última visita se realizó el 22 de abril y se trabajó un “módulo de lombrices para el tratamiento de las excretas y se conversa con el tema de colocar un módulo para compostar y secar la misma, con el objetivo de darle tratamiento a los remanentes y el resto del efluente usarlo en pasto de corta”. Además, en su informe la autoridad accionada no advierte irregularidades estrictamente relacionadas con los aspectos propios de sus competencias, y reiteran que se continúa brindando la asesoría y acompañamiento que corresponde.
Por otra, parte, respecto del tema específico del ruido que aduce el accionante que produce la finca denunciada, se observa que el Área Rectora de Salud de Paraíso procuró abordar tal problemática; sin embargo, no fue posible por situaciones atribuibles al propio denunciante. Al respecto, se constata que el 17 de julio de 2025, la autoridad accionada le notificó al amparado que 27 de agosto de ese año se llevaría a cabo la inspección para verificar el problema de ruido acusado, sin embargo, no se llevó a cabo porque el denunciante no se encontraba ese día en su propiedad. Debido a ello, el 24 de noviembre de 2025 se le solicitó que indicara tres fechas para realizar la diligencia; empero, no brindó respuesta. De tal manera, no es posible constatar una omisión de la autoridad recurrida en relación con este punto.
Ergo, se desestima el recurso en relación con estos dos extremos.
V.Ahora bien, en relación con el Concejo Municipal de Distrito de Cervantes de Alvarado y el debido seguimiento del Área Rectora de Salud accionada de las situaciones irregulares consignadas en la orden sanitaria nro. MS-DRRSCE-DARSP-OS-0196-2024, sí resulta necesaria la intervención de esta jurisdicción constitucional.
En primer lugar, respecto de la orden sanitaria referida, se constata que, pese a que se notificó desde octubre de 2024 y se le otorgó al denunciado 40 días para cumplir con lo dispuesto, a abril de 2026 aún había puntos que no se había resuelto. En ese tanto, la propia autoridad sanitaria destaca que “la parte denunciada solamente cumplió con dos de los cuatro puntos de la orden sanitaria de marras, quedando pendiente de cumplimiento los temas referentes a la prohibición de descarga de las aguas negras y residuales al alcantarillado pluvial así como a la disposición adecuada y sanitaria de las aguas residuales provenientes de la propiedad.”. En ese tanto, la autoridad accionada informa que se le notificó al denunciado la imposición de una multa, lo cual fue apelado por este. Sin embargo, si bien el recurso de apelación fue elevado al órgano de alzada el 23 de abril de 2026, no consta que al momento de interposición del recurso se haya emitido pronunciamiento alguno.
De tal manera, ante el incumplimiento constatado por la autoridad recurrida de aspectos que fueron ordenados desde 2024, lo procedente es que se ejecuten las acciones pertinentes para resolver los problemas sanitarios con celeridad y de manera efectiva e integral, lo cual no consta que se haya realizado.
Por su parte, tampoco verifica esta Sala que el Concejo Municipal de Distrito accionado haya diligenciado con celeridad lo pertinente para atender la situación de marras y solucionar las irregularidades constatadas, pese a que el caso también se le remitió a esa dependencia desde octubre de 2024.
En tal sentido, véase que no fue sino con ocasión del trámite de este proceso de amparo que la autoridad accionada notificó al propietario de la lechería que debía proceder con el trámite de licencia de funcionamiento; asimismo, se notificó al denunciado y a otros vecinos de la calle que debían proceder con la construcción de aceras y con el respectivo sistema de canalización de aguas pluviales. Sin embargo, no consta que finalmente se hayan materializado las acciones para ajustar a derecho las situaciones irregulares referidas.
En consecuencia, se declara con lugar el recurso en relación con estos extremos, en los términos que se indican en la parte dispositiva de este pronunciamiento.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que en una propiedad contigua a su vivienda opera una lechería. Aduce que desde 2017 ha solicitado reiteradamente al Ministerio de Salud que intervenga, debido a la contaminación que produce esa actividad industrial, pues se generan malos olores, acumulación de residuos y ruidos excesivos; además, no existe un buen manejo de los excrementos. Narra que en 2024 la situación se agravó, por lo que interpuso una denuncia formal ante el Área Rectora de Salud de Paraíso; sin embargo, esa autoridad no ha ejecutado las medidas necesarias para resolver el problema. Agrega que la dependencia referida también traslado el caso al MAG y al Concejo Municipal de Distrito de Cervantes; sin embargo, dichas autoridades tampoco han resuelto la situación.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, solo respecto del Ministerio de Salud y del Concejo Municipal de Distrito de Cervantes de Alvarado, en los términos indicados en el considerando V de esta sentencia. Se ordena a Alexander Sánchez Cabo y Carlos Alberto Granados Siles, cada uno en su condición de ministro de Salud y director del Área Rectora de Salud de Paraíso, o a quienes ocupen esos cargos, así como a Mariana Calvo Brenes, en su condición de intendente del Concejo Municipal de Distrito de Cervantes de Alvarado, o a quien ocupe ese cargo, que giren las órdenes pertinentes, coordinen lo correspondiente y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias respectivas para que, dentro del plazo máximo de DOS MESES, contado a partir de la notificación de esta sentencia, se ejecuten las acciones que correspondan para que se ajusten a derecho las irregularidades debidamente constatadas y se resuelva en definitiva la problemática objeto de este recurso.
Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Concejo Municipal de Distrito de Cervantes de Alvarado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Salazar Alvarado pone nota. Notifíquese.
