Constitutional protection writ (recurso de amparo) processed under file number 26-006563-0007-CO, filed by [Nombre 001], national identity card (cédula de identidad) [Valor 001], against the INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA (INCOPESCA), the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES, AND THE SERVICIO NACIONAL DE GUARDACOSTAS.
Background:
The resolution AJDIP 162-2024 contradicts this progress with a weak and incomprehensible justification, given the magnitude of the constitutional environmental commitment, by treating the repeal of a regulation as an option rather than extending its application, stating the following in its text: "1- That by means of Resolution AJDIP/312-2023 of December 12, 2023, in its operative section, the Board of Directors (Junta Directiva) resolved: '1- To approve the recommended extension request and to amend Board of Directors Resolution AJDIP/076-2022, in its Transitory Provision II, so that it shall henceforth read as follows: Transitory Provision II: "For medium-scale Sport and Tourist Fishing vessels, this regulation shall apply as of July 1, 2024." 2- To repeal Board of Directors Resolution AJDIP/116-2023. 3- To request that the working committee established to follow up on the matter present an alternative text of regulations exclusively for sport and tourist fishing no later than March 2024.' 2- That to date it has not been possible to have a clear, effective, and participatory proposal that would define the conditions and scope of the text to be incorporated into Resolution AJDIP/077-2020, 'Regulation for the monitoring, control, and surveillance of fishing vessels of the national and foreign fleets'; or, alternatively, as proposed by the Office of Legal Counsel, the Directorate of Fisheries and Aquaculture Management, and in part by the sport and tourist fishing sector, the creation of new regulations exclusively for that activity that would include the obligation to have a location, tracking, and control system for medium-scale fishing vessels belonging to that sector. 3- That while it is true that ample time has elapsed and, for the reasons stated, it has not been feasible, from within the Administration, to independently develop a reasonable, balanced, and fair proposal consistent with the line of action that has prevailed in the conduct of the current Administration toward the various productive sectors. 4- That given the conditions and arguments set out above, and as this Board of Directors faces the dilemma between the entry into force of Transitory Provision II of Resolution AJDIP/312-2023 and the effective reality of not having sufficient elements to define an adequate text consistent with the reality of the medium-scale sport and tourist fishing sector; in order to safeguard the institutional interests of that national productive sector in particular, it is appropriate to repeal Transitory Provision II of Resolution AJDIP/076-2022 and its amendment contained in Resolution AJDIP/312-2023, as well as any other resolution that opposes it. 5- That having duly weighed the arguments cited in the preceding recitals, and after discussing and analyzing the proposal put forward, the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Por tanto; RESOLVES 1- To repeal Transitory Provision II of Resolution AJDIP/076-2022, along with its amendments contained in Resolution AJDIP/116-2023 and any other resolution that opposes it.
Similarly, Resolution AJDIP/312-2023 is repealed. 2- Final resolution. Takes effect upon adoption." 8- This decision clearly contradicts the non-regression principle (principio de no regresión) in environmental matters, which has been established in constitutional jurisprudence in several highly relevant decisions: "The fundamental right to a healthy and ecologically balanced environment, enshrined in Article 50 of the Political Constitution, prevents public authorities from adopting measures that imply a setback in the levels of environmental protection already achieved. The non-regression principle constitutes a parameter of constitutional review that ensures progressivity in environmental matters." (Ruling 016904-2025) Consistently, for many years, this principle has been established as an integral part of environmental law: thus Constitutional Ruling 013367-2012: "V. On the principles of progressivity and non-regression of environmental protection.
The progressivity principle (principio de progresividad) of human rights has been recognized by International Human Rights Law; among other international instruments, it is set forth in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the area of Economic, Social and Cultural Rights. Under these instruments, the State assumes the obligation to progressively increase, to the extent of its capacity and development, the levels of protection of human rights, with special consideration for those rights — such as the right to the environment (Art. 11 of the Protocol) — that require multiple positive actions by the State for their protection and full enjoyment by all rights-holders (…). Regarding the right to the environment it stated: 'The foregoing constitutes an evolutionary interpretation of environmental protection under Constitutional Law, which does not admit a regression to its detriment.' (Ruling of the Constitutional Chamber No. 18702-10)." (In the same vein, rulings 2014-012887, 2017-002375, 2017-005994, 2019-012745, and 2019-017397)"…
Thus, in accordance with the progressivity principle, the State assumes the obligation to increase, to the extent possible, the levels of protection of human rights, including the right to a healthy and ecologically balanced environment. For its part, the application of the non-regression principle consists of a guarantee that constrains the State from adopting measures, policies, or rules that worsen — without reasonable and proportionate justification — the degree of protection of fundamental rights already achieved, and that, when applicable, the corresponding compensatory measures must be weighed. (…)" (among many other rulings) 9- As a result of this regulatory situation, the satellite tracking device, duly installed, functional, and connected to the satellite monitoring system jointly managed by INCOPESCA and the Servicio Nacional de Guardacostas, is not a requirement demanded by the MOPT through its port captaincy (capitanía de puerto) section in order to issue the seaworthiness certificate (certificado de navegabilidad) to vessels, and therefore in order to issue departure clearances (zarpes) as an additional vessel control measure — even though it could serve, as stated, as an additional safety and control measure, not only in relation to natural resources but also as a safety device for locating vessels — a situation that also contravenes the State's obligation to establish procedures for the control of the national fishing fleet.
It is considered that the participation of both the MOPT and the Servicio Nacional de Guardacostas is derivative — that is, they do not incorporate control of the devices precisely because no mandatory regulation exists established under INCOPESCA's control powers; but if this writ of amparo is granted, they will necessarily have to make the necessary adjustments both to the regulations and to the exercise of satellite control. Clearly, compliance can be incorporated as a requirement for the issuance of the seaworthiness certificate, which is carried out by the MOPT port captaincy once a year. In the case of departure clearances, a streamlined regulatory framework can be established that allows notification by radio to the Port Captaincy of departures within a general compliance monitoring system (references: Decreto Ejecutivo N.° 28742-MOPT, Regulations for the Issuance of Departure Clearances for Vessels Flying the National Flag; Decreto Ejecutivo N.° 32468-MOPT (2005): Regulations for the Inspection and Certification of Vessels Flying the National Flag; Decreto Ejecutivo N.° 39442-MOPT (2015) (…) The petitioner requests the following: "(…) 1- To grant this writ of amparo. 2- To declare unconstitutional INCOPESCA's action of exempting the tourist and sport fishing fleets from satellite monitoring. 3- To order INCOPESCA to, within a reasonable period of 2 months, draft the regulation that establishes as a mandatory requirement the installation and maintenance of duly functional satellite tracking devices connected to the INCOPESCA-SNG institutional satellite monitoring system for the tourist and sport fishing fleets, both national and international, establishing the necessary mechanisms for their connection. 4- To order the MOPT through its port captaincy section to make the necessary regulatory amendments to incorporate a seaworthiness requirement for tourist fishing and sport fishing vessels, and to develop a streamlined methodology for granting departure clearances to vessels that meet the requirement. 5- To order the Servicio Nacional de Guardacostas to incorporate, within the joint monitoring and control systems with INCOPESCA, the tracking and data management of the satellite monitoring systems of the tourist and sport fishing fleets in accordance with the regulations to be established (…)."

I.
On the situation reported This writ of amparo was filed by [Nombre 001] against the Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), the Ministerio de Obras Públicas y Transportes (MOPT), and the Servicio Nacional de Guardacostas, alleging a purported state omission in the requirement of satellite tracking devices for tourist and sport fishing vessels, as well as the alleged violation of the right to a healthy and ecologically balanced environment and of the environmental non-regression principle.
With regard to the MOPT, the technical and administrative information supporting this report was provided by the Maritime and Port Division (División Marítimo-Portuaria), the body with jurisdiction over maritime authority, seaworthiness certification, and the administrative control of departure clearances, pursuant to the applicable legal framework.
In accordance with Law No. 3155, Decreto Ejecutivo N.° 45103-MOPT, Decreto Ejecutivo N.° 32468-MOPT (Regulations for the Inspection and Certification of Vessels Flying the National Flag), and Decreto Ejecutivo N.° 28742-MOPT (Regulations for the Issuance of Departure Clearances), the MOPT, through the Maritime and Port Division and the Port Captaincies (Capitanías de Puerto), is responsible for exercising powers related to:
The verification of the technical seaworthiness conditions of vessels.
• The administrative prior control through the granting of departure clearances.
These powers are limited exclusively to matters of navigation safety and the protection of human life at sea, and do not encompass the regulation, monitoring, or control of the fishery resource — matters that the legal framework expressly assigns to different sector-specific authorities, in particular to the Instituto Costarricense de Pesca y Acuicultura, pursuant to Law No. 8436.
The Maritime and Port Division reports that:
The applicable regulations do not provide for satellite tracking devices as a technical requirement for seaworthiness.
Likewise, the legal framework does not authorize the MOPT to require satellite tracking devices as a condition for granting departure clearances.
The certification of minimum maritime safety conditions.
The Maritime and Port Division does not administer or operate its own satellite monitoring systems for vessels, such as VMS, fisheries AIS, or other equivalent systems, as such platforms require specialized technological infrastructure and are linked to the control of specific economic activities.
The legal framework has assigned these functions to entities with express subject-matter jurisdiction, such as:
• INCOPESCA, for the monitoring and control of fishing activity.
• The Servicio Nacional de Guardacostas, for maritime surveillance and interdiction duties.
Notwithstanding, the MOPT actively participates in interinstitutional coordination frameworks, in adherence to the principles of administrative coordination, unity of the State, and efficiency and effectiveness of the public service, through information exchange, attention to technical requirements, and operational support when appropriate.
From the foregoing it is concluded that:
The MOPT has at all times acted in conformity with the principle of legality, within the scope of competence assigned to it by the legal framework.
The non-requirement of satellite tracking devices as a condition for seaworthiness or departure clearance does not constitute an administrative omission, but rather a direct consequence of the absence of an express enabling rule.
The regulation of satellite monitoring of fishing vessels falls under the Instituto Costarricense de Pesca y Acuicultura, pursuant to Law No. 8436.
No regressive action in environmental matters nor violation of fundamental rights attributable to this Administration is established…".
He requests that the appeal be dismissed.

ON THE INADMISSIBILITY OF THE ALLEGED FACTS From this point, the petitioner's claims are rejected in their entirety, as they rest on an erroneous premise consisting of the assertion of a purported unconstitutional omission in the exercise of the powers of control and surveillance of fishing activity.
Contrary to what is maintained, the Costa Rican State, through INCOPESCA and in coordination with other competent institutions, has developed a set of regulatory, technical, and operational mechanisms that allow for effective control of fishing activity, calibrated to criteria of reasonableness, proportionality, and differentiation according to the nature of each fleet.
ON INCOPESCA'S COMPETENCE AND THE EXERCISE OF TECHNICAL DISCRETION In accordance with Law No. 8436, INCOPESCA is responsible for regulating, ordering, and administering the fishery resource, as well as issuing the measures necessary for its control and surveillance.
However, these powers are not exercised automatically, but rather within the framework of technical-administrative discretion (discrecionalidad técnica-administrativa), which means that the Administration may define, on the basis of technical, scientific, and operational criteria, the most appropriate regulatory measures for each segment of the fishing activity.
Constitutional jurisprudence has repeatedly recognized that the Administration has a margin of technical appreciation that cannot be substituted, except in cases of manifest arbitrariness, which does not occur in the present case.
Consequently, the petitioner's claim — who lacks the experience necessary for the drafting of institutional regulations, in addition to lacking the required technical expertise — attempts to impose a single, uniform model of control that disregards the technical nature of fisheries management and seeks to improperly substitute the Administration in the definition of public policy.
ON THE REGULATORY DIFFERENTIATION OF FISHING FLEETS The applicable regulations establish a clear distinction among the various fleets (commercial, artisanal, tourist, and sport), which responds to objective criteria such as the intensity of resource exploitation, environmental impact, economic purpose, and operational capacity.
This differentiation is not only valid but necessary from a constitutional standpoint, given that the principle of equality does not imply identical treatment, but rather differential treatment when distinct conditions exist.
To seek to equate, without further technical analysis, all fleets under a single mandatory satellite monitoring regime — as the petitioner proposes — would mean disregarding these substantial differences and violating the principle of reasonableness in administrative regulation.
It is evident that the petitioner tends to confuse this distinguished Chamber for the following reasons:
Just as it is stated that artisanal vessels are excluded because they operate within less than 3 miles, INCOPESCA's decision in that regard is not challenged.
If the matter is challenged with respect to the sport and tourist fishing fleets, INCOPESCA has the technical capacity to decide how its licensees should be administered.
No scientific-technical evidence is provided regarding the timing, manner, or reasons why a specific obligation should be imposed on a licensee, given that INCOPESCA can decide, based on technical criteria, the modality of a possible implementation.
The tourist and sport fishing fleet also exhibits differences according to the purchasing power of vessel owners and the permits granted for their activities; therefore, actions must be taken to identify the best way to implement new technologies in accordance with the economic capacity of the vessel owners, which varies greatly.
ON THE ABSENCE OF OMISSION IN CONTROL AND SURVEILLANCE The petitioner (recurrente) bases his action on the alleged nonexistence of control mechanisms with respect to certain fleets (flotas), which not only does not conform to reality but is entirely false.
As reflected in the administrative record, the State has multiple control tools at its disposal, including the satellite monitoring (monitoreo satelital) system applied to higher-impact fleets, license controls, port and high-seas inspections, and interinstitutional coordination with the Servicio Nacional de Guardacostas and other competent authorities.
In this regard, there is no absence of control, but rather a differentiated and progressive model, designed according to technical and administrative efficiency criteria. Moreover, INCOPESCA has currently made investments to improve the satellite monitoring center, with better technologies and trained personnel, which demonstrates that the institution is committed, and which also serves as a reference point so that other institutions such as the Coast Guard and SINAC may have access to real-time satellite monitoring.
ON THE REASONABLENESS OF EXCLUDING CERTAIN FLEETS FROM THE SATELLITE TRACKING DEVICE.
The exclusion of the tourism and sport fishing fleet from the mandatory use of the satellite monitoring system is the result of a technically justified decision, based on the lower extractive intensity of these activities, their recreational or service-oriented nature, and the need to avoid disproportionate regulatory burdens. The foregoing does not preclude the possibility that, in the medium term and with the appropriate technical criteria and outreach to permit holders (permisionarios), the launch of a robust program that includes the aforementioned fleet can be managed.
In particular, it must be emphasized that these activities do not present the same level of impact on fishery resources as the commercial fleet, which is why imposing identical measures is neither necessary nor proportionate.
Constitutional review cannot become a mechanism for imposing the petitioner's criterion over the technical judgment of the Administration, unless a manifest irrationality is demonstrated, which has not been established.
ON THE PRINCIPLE OF ENVIRONMENTAL NON-REGRESSION The petitioner invokes the principle of environmental non-regression (principio de no regresión ambiental); however, its application in the present case is inadmissible.
Constitutional jurisprudence has established that said principle does not imply the absolute impossibility of modifying regulations, but rather the prohibition against unjustifiably reducing the level of environmental protection.
In the specific case at hand, there is no regression in the level of protection, because:
First, there was no consolidated obligation applicable to all fleets with respect to satellite monitoring.
Second, the regulatory modification responds to a process of technical review and regulatory adjustment.
Third, an effective system of control is maintained over the highest-impact sectors.
Therefore, what the petitioner alleges constitutes an extensive and incorrect interpretation of the principle of non-regression.
ON THE LIMITS OF THE WRIT OF AMPARO (RECURSO DE AMPARO) The petitioner's claim is not limited to the protection of a fundamental right, but seeks to have the Constitutional Chamber (Sala Constitucional) order the adoption of specific regulations, consisting of the mandatory implementation of a satellite monitoring system for all fleets.
The foregoing exceeds the scope of the writ of amparo, which does not constitute a vehicle for substituting the Administration in the definition of public policies or for imposing specific technical criteria.
ON THE PARTICIPATION OF OTHER INSTITUTIONS With regard to MOPT and the Servicio Nacional de Guardacostas, it must be noted that their competences are complementary and derivative, and are exercised in accordance with the applicable regulatory framework.
There is no legal provision establishing the mandatory use of satellite monitoring systems for all fleets, and therefore no omission may be attributed to said institutions.
ON THE EFFECTIVE CONTROL AND SURVEILLANCE ACTIONS EXERCISED BY INCOPESCA Contrary to what the petitioner asserts, the Instituto Costarricense de Pesca y Acuicultura has been actively, continuously, and progressively exercising its control and surveillance competences over fishing activity, through the implementation of various regulatory, operational, and interinstitutional coordination tools.
In that regard, it must be highlighted that INCOPESCA has developed and implemented the Satellite Monitoring System for those fleets with the greatest extractive impact, which constitutes a concrete and effective measure for real-time tracking and control of vessels (embarcaciones) subject to that obligation.
Likewise, control mechanisms have been strengthened through permanent coordination with the Servicio Nacional de Guardacostas, enabling the execution of high-seas surveillance activities, as well as joint operations aimed at preventing and sanctioning illegal activities.
In the same way, the Administration maintains administrative controls linked to the issuance of licenses, departure clearances (autorizaciones de zarpe), port inspections, and verification of compliance with current regulations, allowing for comprehensive oversight of fishing activity in its various forms.
It must also be emphasized that the regulatory model adopted responds to a progressive and differentiated approach, in which control measures are implemented gradually and in accordance with the level of risk and impact of each fleet, in adherence to technical criteria, administrative efficiency, and compliance with international regulations.
Consequently, not only is there no inaction on the part of the Administration, but an active exercise of its competences is evident, aimed at ensuring the sustainable use of marine resources and compliance with the applicable regulatory framework.
CONCLUSION
In accordance with all of the foregoing, it is fully established that INCOPESCA's actions not only comply with the legal framework (ordenamiento jurídico) but also reflect an effective, technical, and continuous exercise of its competences in the management, control, and surveillance of fishing activity.
The appeal filed rests on an incorrect premise, assuming the existence of a nonexistent omission, when what is actually evident is a disagreement with the regulatory model adopted by the Administration, which is duly grounded in criteria of reasonableness, proportionality, and technical differentiation.
Likewise, the existence of a real, current, and direct impact on the fundamental right to a healthy environment has not been demonstrated, nor has the configuration of an environmental regression in the terms defined by constitutional jurisprudence.
On the contrary, the actions carried out by INCOPESCA demonstrate a sustained commitment to the responsible management of fishery resources, through the implementation of control mechanisms appropriate to the nature of each activity, within a framework of progressive improvement and regulatory adaptation.
Accepting the petitioner's claim would imply transferring to the constitutional judge functions that properly belong to the active Administration, particularly in the definition of technical public policies, which is inadmissible within the framework of the writ of amparo…".
This report is submitted exclusively with respect to the Servicio Nacional de Guardacostas, an institution that forms part of the Ministerio de Seguridad Pública and exercises specialized police functions in the maritime domain, without prejudice to the competences of the other respondent entities.
It is hereby noted from the outset that the Servicio Nacional de Guardacostas fully recognizes the special constitutional relevance of the human right to a healthy and ecologically balanced environment, as well as the need to strengthen state mechanisms for protecting marine-coastal resources. Along the same lines, the importance of the principles of progressivity and non-regression in environmental matters is also recognized, as parameters of interpretation and administrative action compatible with Article 50 of the Constitución Política and with Costa Rican constitutional jurisprudence.
Nonetheless, it must also be clarified, with equal precision, that the issuance, modification, repeal, or replacement of specific regulations on satellite monitoring of fishing vessels falls within the competential sphere of INCOPESCA, pursuant to the applicable legal and regulatory framework, and therefore the Servicio Nacional de Guardacostas did not issue the challenged regulatory provision and does not exercise regulatory authority over that specific subject matter.
Ley N.° 8000, the Ley de Creación del Servicio Nacional de Guardacostas, clearly establishes the legal nature and institutional purpose of the Service. In its Article 1, it provides that the Servicio Nacional de Guardacostas is a police body belonging to the Fuerza Pública (national police force), specialized in guarding the territorial waters, continental shelf, insular shelf, and seas adjacent to the Costa Rican State, under the direct authority of the Minister of Public Security.
Based on that founding statute, the functional framework of the Servicio Nacional de Guardacostas must be understood in terms of surveillance, control, prevention, protection, and safeguarding of the maritime space under Costa Rican jurisdiction, which includes, of course, an active role in protecting marine-coastal resources, preventing unlawful activities, and collaborating interinstitutionally with other public entities with specific subject-matter competence.
In other words, the Servicio Nacional de Guardacostas has a legal and operational vocation for the protection of the maritime space, for supporting compliance with the legal order at sea, and for the safeguarding of public interests of special relevance, among them the safety of navigation, control of activities in jurisdictional waters, and the protection of legal interests associated with the lawful and sustainable use of the marine environment.
However, that institutional mission does not translate into an autonomous regulatory competence to govern the legal regime of fishing or aquaculture, nor to independently define the obligated parties, deadlines, technical conditions, or transitional regimes applicable to the satellite monitoring system for fishing vessels. That domain is, by legal design, within the orbit of INCOPESCA, as the competent sectoral authority for regulating the use of fishery resources and the technical instruments associated with their control.
Precisely for that reason, the fact that the Servicio Nacional de Guardacostas participates in maritime surveillance tasks, operational control, and consultation of information available in institutional systems does not imply that it is the issuing body of the challenged regulatory provision, nor that it is responsible, on its own, for defining the regulatory content of such obligations.
III.On the Constitutional Relevance of the Right to a Healthy and Ecologically Balanced Environment, and the Principles of Progressivity and Non-Regression. The Servicio Nacional de Guardacostas considers it essential to make clear that the protection of the marine-coastal environment does not constitute an accessory or marginal matter for this institution, but rather a substantive dimension of the public interest at stake in the exercise of its functions.
Article 50 of the Constitución Política recognizes every person's right to a healthy and ecologically balanced environment, and obliges the State to guarantee, defend, and preserve this legal interest. The Sala Constitucional has been consolidating a line of jurisprudence of reinforced environmental protection, under criteria such as prevention, objectification of environmental protection, precaution, and, with increasing intensity, environmental non-regression.
In this context, the principle of environmental non-regression has been developed in Costa Rican legal doctrine as a requirement pursuant to which the environmental legal framework and jurisprudence must not retreat from levels of protection already achieved, unless there is a legally sufficient justification that is reasonable and compatible with the centrality of the environmental public interest.
Complementarily, the principle of progressivity requires that state action tend toward the gradual and sustained strengthening of environmental protection mechanisms, especially when fragile ecosystems, strategic natural resources, or common-use assets whose degradation may prove difficult or impossible to reverse are at stake.
Both principles are articulated with particular intensity in the marine-coastal domain, for several reasons:
First, due to the ecological vulnerability of marine and coastal ecosystems.
Second, due to the need to ensure the sustainable use of hydrobiological resources (recursos hidrobiológicos) and to prevent phenomena of overexploitation, illegal fishing, or loss of traceability.
Third, because effective control of fishing activity responds not only to economic or administrative purposes, but also to an environmental and public governance function.
From this perspective, the Servicio Nacional de Guardacostas considers it legitimate and legally relevant to affirm that, from an operational standpoint, the existence of vessel monitoring and tracking systems constitutes a valuable tool both for the protection of marine resources and for navigational safety, the traceability of operations, and the improvement of institutional surveillance capacities.
Having said that, it must equally be clarified that the recognition of the institutional usefulness of such mechanisms does not imply assuming as its own the specific regulatory decision that the petitioner challenges in these constitutional proceedings. The Servicio Nacional de Guardacostas did not issue the challenged act, has no authority to reform or repeal it, and is not responsible for unilaterally defining the regulatory scope of the regime applicable to the medium-scale sport and tourism fishing fleet. That decision falls within the subject-matter competence of the corresponding sectoral authority.
Consequently, the institutional position of the Service may be summarized as follows: there is full institutional awareness of the duty to progressively protect the marine-coastal environment and to avoid unjustified setbacks in its protection; but there is no identity between that shared constitutional obligation of the State and the authorship of the challenged regulatory act, which did not originate from the Servicio Nacional de Guardacostas.
The subject matter of this appeal also reveals a fundamental aspect: the effective protection of the marine-coastal environment and the control of fishing activity necessarily require interinstitutional coordination.
In the case of the Servicio Nacional de Guardacostas, that coordination is concretely manifested in its working relationship with INCOPESCA, as the sectoral authority with regulatory and technical competence in fishery matters. As has been brought to the attention of this Chamber, the Servicio Nacional de Guardacostas has operational access to information from the monitoring system through a mirror user account (usuario espejo), which is consulted on a daily basis by the Operations Center and the Intelligence Section of the Servicio Nacional de Guardacostas, for strictly functional and operational purposes.
This coordination dynamic responds to an institutional logic of joining state efforts to improve surveillance, control, and protection of marine-coastal resources, without altering the legal distribution of competences. The interinstitutional agreement signed between INCOPESCA and the Ministerio de Seguridad Pública, through the Servicio Nacional de Guardacostas (a copy is attached), constitutes precisely a strategic expression of that collaboration, by facilitating access to the system, training processes, and functional support mechanisms to strengthen maritime oversight and surveillance.
Likewise, the regulatory regime of satellite monitoring itself places the system within the institutional orbit of INCOPESCA and provides for restricted access for other state authorities, which confirms that coordination exists, but does not equate to substitution of competence.
Therefore, the Servicio Nacional de Guardacostas may affirm, with full objectivity, the following:
1. that it maintains permanent surveillance of the fishing fleet within the scope of its operational functions, with or without the support of technological monitoring systems; 2. that the use of satellite tracking tools strengthens state control capacities, protects resources, and contributes to navigational safety; 3. that the coordination relationship with INCOPESCA has been maintained in terms of broad collaboration, constant communication, and effective interinstitutional coordination, which has contributed significantly to fulfilling the maritime-environmental public interest; and 4. that such coordination does not convert the Servicio Nacional de Guardacostas into the issuing or governing authority of the challenged regulation.
First: It is acknowledged that the first factual allegation is true insofar as the Servicio Nacional de Guardacostas is one of the respondent authorities in this appeal and forms part of the state apparatus with an operational presence in the maritime domain.
It is inaccurate, however, to the extent that it seeks to attribute to the Servicio Nacional de Guardacostas the issuance, approval, or repeal of the challenged regulatory provision, since that competence does not belong to this institution.
Second: It is acknowledged that the second factual allegation is partially true, in the sense that this institution recognizes the constitutional relevance of the right to a healthy and ecologically balanced environment and the need to strengthen the protection of marine-coastal resources. It is nonetheless clarified that the Servicio Nacional de Guardacostas did not issue the challenged administrative resolution nor does it have the competence to define, reform, or repeal on its own the legal regime of satellite monitoring for fishing.
Third: It is acknowledged that the third factual allegation is partially true, in that the Servicio Nacional de Guardacostas maintains operational coordination with INCOPESCA and consults monitoring system information through a mirror user account for institutional surveillance and control purposes. However, that circumstance does not modify the legal distribution of competences nor does it convert the Service into the governing body of the system or a normative authority on the matter.
Fourth: It is acknowledged that the fourth factual allegation is partially true, insofar as monitoring systems constitute a useful tool for strengthening oversight, protecting marine resources, and contributing to navigational safety.
It must nonetheless be clarified that any constitutional assessment of the sufficiency, scope, or regressiveness of the challenged regulation must be analyzed primarily with respect to the body with subject-matter competence to issue it.
Fifth: It is acknowledged that the fifth factual allegation is false if understood to mean that the Servicio Nacional de Guardacostas incurred a regulatory omission, regulatory dismantlement, or legal regression through its own act.
The Service did not issue an institutional opinion that gave rise to the challenged resolution, nor did it participate as a decision-making authority in its approval or repeal.
Sixth: It is acknowledged that the sixth factual allegation is true only insofar as the Servicio Nacional de Guardacostas maintains activities oriented toward permanent surveillance of the maritime space, vessel control, and collaboration with other competent authorities. Any inference attributing direct responsibility to it for the regulatory configuration of the challenged regulatory regime is rejected.
Seventh: It is acknowledged that the seventh factual allegation must be taken as denied insofar as it exceeds the legal competences of the Servicio Nacional de Guardacostas or attributes to it regulatory powers that the law does not confer upon it.
Eighth and following They are denied or clarified in the same terms as above, establishing that:
the Servicio Nacional de Guardacostas does maintain an institutional commitment to the protection of the marine-coastal environment; it does participate in interinstitutional coordination schemes for control and surveillance purposes; it does consider the strengthening of technological vessel tracking mechanisms useful and valuable; but it is not the issuing body of the challenged administrative-regulatory act nor the governing authority of that regulation.
As is apparent from the appeal and the documentation accompanying it, the petitioner's principal objection is directed against the decision contained in INCOPESCA resolution AJDIP/162-2024, whereby Transitorio II was repealed — the transitional provision that had established the applicability of the regulation to medium-scale sport and tourism fishing vessels, following the extension approved by INCOPESCA resolution AJDIP/312-2023.
With respect to that point, the Servicio Nacional de Guardacostas wishes to clarify that:
it did not approve said resolution; it did not promote it as a decision-making body; it is not legally responsible for its issuance; and it cannot, on its own, reverse, substitute, or redefine its content.
Consequently, even though this General Directorate understands the constitutional concern raised by the petitioner regarding the sufficiency of environmental control mechanisms, the direct imputation to the Servicio Nacional de Guardacostas lacks sufficient competential basis…".
It requests that the appeal be dismissed.

Furthermore, it is necessary to make a clarification regarding the resolution identified as AJDIP/312-2022, since that resolution contains a material error in the year shown in its numbering. Accordingly, the correct reading and understanding of said resolution is AJDIP/312-2023, a circumstance that was duly recorded in the minutes corresponding to Ordinary Session No. 61-2023 of the Board of Directors of INCOPESCA, which is brought to the attention of this honorable Chamber for the corresponding legal and administrative purposes.
Additionally, official memorandum INCOPESCA-PE-DOPA-126-2022 is submitted, a technical-administrative document related to the same matter and bearing close connection to the institutional actions developed in relation to the implementation, tracking, control, and surveillance of fishing vessels, constituting a relevant input for an adequate understanding of the administrative and regulatory context applicable to the case before this Constitutional Chamber.
It should be noted that the administrative and regulatory actions submitted herein respond to the legitimate exercise of the legal competences attributed to INCOPESCA as the governing body (ente rector) in fishery and aquaculture matters, particularly with regard to the management, tracking, control, and oversight of fishing activities carried out by both national and foreign vessels, seeking to ensure the sustainability and responsible use of hydrobiological resources.
In light of the foregoing, it is respectfully requested that compliance with the order issued in the aforementioned resolution be deemed fulfilled, and that the submitted documentation be incorporated into the judicial file for the corresponding assessment…".
"… I. On the Scope of the Court's Order The order issued by this Chamber has the purpose of having the respondent authorities document the technical grounds supporting the challenged administrative action, specifically in relation to the requirement of satellite location devices for tourism and sport fishing vessels.
In that regard, it is necessary to clarify that, with respect to MOPT, the situation presented does not derive from a discretionary technical decision adopted by this Administration, but from the strict application of the principle of legality (principio de legalidad) and the competence-distribution regime established in the applicable legal framework.
In accordance with the information provided by the División Marítimo-Portuaria (Maritime-Port Division), the competent body in this matter, MOPT:
• Has not adopted its own technical decision regarding the requirement of satellite location devices on fishing vessels.
• Has also not issued technical studies, diagnoses, or specialized analyses on the implementation of such systems, as that matter does not fall within its sphere of competence.
Indeed, MOPT's actions regarding:
• seaworthiness (navegabilidad) certification, and • issuance of departure clearances (zarpes) are limited to verifying technical maritime safety conditions, without encompassing the regulation or monitoring of fishing activities or the technological control of such activities.
As the technical-administrative basis for the Ministry's action, reference is made to the opinion issued by the División Marítimo-Portuaria through official memorandum CARTA-MOPT-DVMP-2026-366, which establishes that:
There is no express regulatory authorization (habilitación normativa) allowing the maritime authority to require satellite location devices as a condition for seaworthiness or the issuance of departure clearances.
Pursuant to Article 11 of the Ley General de la Administración Pública, the Administration may only impose obligations when there is a rule expressly authorizing it to do so, and therefore requiring such devices in the absence of regulation would constitute an excess in the exercise of administrative authority (potestad administrativa).
Satellite monitoring of vessels constitutes a specialized technical activity linked to the control of fishing activity, a competence that the legal framework has assigned to INCOPESCA and the Servicio Nacional de Guardacostas, not to MOPT.
Consequently, the technical basis for MOPT's action lies not in the adoption of its own technical policy on satellite monitoring, but in the correct interpretation and application of the applicable competential and regulatory framework.
In express response to the request made by this Chamber, it is hereby confirmed that:
This Ministry does not have technical studies, specialized reports, or additional sectoral analyses on the implementation of satellite location systems in tourism or sport fishing vessels.
This is due to the fact that the matter falls within the technical and regulatory purview of INCOPESCA, pursuant to Ley N.° 8436.
Therefore, the absence of such studies does not constitute an administrative omission, but a direct consequence of the current delimitation of competences.
Based on the foregoing, it is concluded that:
MOPT has not adopted its own technical decision regarding the requirement of satellite location devices, as it does not fall within its competence.
The challenged administrative action finds its basis in an institutional technical-legal opinion, grounded in the principle of legality (principio de legalidad) and the proper delimitation of competences.
No additional technical studies exist, as this matter falls outside the functional scope of this Administration…." It requests that the appeal be dismissed.
"… I. Preliminary consideration By way of preliminary matter, this Director General's Office deems it necessary to reiterate that the Servicio Nacional de Guardacostas forms part of the Ministerio de Seguridad Pública and exercises specialized police functions in the maritime domain, in accordance with Ley n.° 8000, Ley de Creación del Servicio Nacional de Guardacostas.
Within that framework, this institution carries out surveillance, control, prevention, security, and protection operations in Costa Rican jurisdictional waters, as well as interinstitutional coordination activities with other competent public entities, including the Instituto Costarricense de Pesca y Acuicultura.
Nevertheless, as stated in the initial report submitted to the Chamber, the Servicio Nacional de Guardacostas is not the issuing body, proponent, or decision-maker of the provision challenged by the petitioner. Nor does it hold rulemaking authority (potestad reglamentaria) to define, modify, repeal, or replace the legal regime applicable to the satellite monitoring system (sistema de monitoreo satelital) for fishing vessels (embarcaciones pesqueras).
The resolution being addressed requests the submission of the technical studies or criteria underpinning the decision challenged by the petitioner.
In response to that directive, this Director General's Office respectfully reports that, upon reviewing the scope of the Servicio Nacional de Guardacostas's participation in the events at issue in this proceeding, there is no record of this institution having issued any technical study, technical opinion, technical-regulatory criterion, formal recommendation, or equivalent document that served as a direct basis for the issuance, modification, or repeal of the challenged decision.
The foregoing is due to the fact that the challenged decision was not issued by the Servicio Nacional de Guardacostas, nor was it adopted within a decision-making administrative procedure under this institution's charge. The matter pertaining to the regulation of the system for tracking, locating, or satellite monitoring of fishing vessels falls within the area of competence of the sectoral fisheries authority, without prejudice to the police and operational functions that the Servicio Nacional de Guardacostas exercises within the national maritime domain.
III.On the absence of technical studies or criteria specific to the Servicio Nacional de Guardacostas that support the challenged decision
This Director General's Office expressly reports that the Servicio Nacional de Guardacostas does not possess its own technical studies that served as the basis for the decision challenged by the petitioner.
Likewise, it is clarified that this institution:
1. Did not issue the challenged provision.
2. Did not approve the contested regulatory modification.
3. Did not promote, as a decision-making body, the exclusion or inclusion of a particular fleet within the satellite monitoring regime.
4. Did not issue any technical-regulatory criterion that constituted a direct basis for the challenged decision.
5. Does not have legal authority to replace, amend, or repeal the decision adopted by the competent sectoral authority.
Consequently, within the Servicio Nacional de Guardacostas there is no internal technical file, institutional technical opinion, or specialized study that may be submitted as the basis for a decision that was not issued by this Director General's Office.
Notwithstanding the foregoing, this Director General's Office does consider it pertinent to reiterate that the Servicio Nacional de Guardacostas maintains a relationship of interinstitutional coordination with INCOPESCA for the purpose of carrying out surveillance, control, oversight, and protection of the marine-coastal resource (recurso marino-costero).
In that regard, as documentation related to the institutional activities of the Servicio Nacional de Guardacostas, reference is again made to the Framework Interinstitutional Cooperation Agreement (Convenio Marco de Cooperación Interinstitucional) between the Instituto Costarricense de Pesca y Acuicultura and the Ministerio de Seguridad Pública, through the Servicio Nacional de Guardacostas, already referenced in the initial report.
That instrument establishes the existence of a cooperation framework between both institutions, aimed at facilitating joint activities, operational coordination, functional support, and collaboration in matters of surveillance and control in Costa Rican jurisdictional waters.
Nevertheless, it must respectfully be clarified that said agreement does not constitute a technical study by the Servicio Nacional de Guardacostas that supported the challenged decision, but rather an interinstitutional coordination instrument that defines and facilitates collaboration between institutions with distinct competences.
As was duly reported to the Chamber, the Servicio Nacional de Guardacostas has operational access to information from the monitoring system through a mirror user account (usuario espejo), which is consulted by institutional operational units for strictly functional, law-enforcement, and maritime surveillance purposes.
Such access allows the strengthening of state control capabilities, supports surveillance operations, guides operational activities, and contributes to the protection of the marine-coastal resource. However, that operational access does not transform the Servicio Nacional de Guardacostas into the governing body of the system, nor into a technical regulatory authority over fisheries matters, nor into a decision-making body with respect to the challenged provision.
Consequently, the operational use of that tool must not be confused with the issuance of technical-regulatory criteria regarding the scope, mandatory nature, regulated parties, transitional regime, or legal conditions of the satellite monitoring system.
From the operational perspective of the Servicio Nacional de Guardacostas, monitoring, location, and tracking systems for vessels constitute useful tools for strengthening maritime surveillance, navigation safety, activity traceability, and the protection of the marine-coastal resource.
However, that general operational assessment does not amount to a technical-regulatory criterion regarding the challenged decision, nor does it replace the authority of the corresponding sectoral body to determine the regulatory scope of the system applicable to each fleet.
For this reason, this Director General's Office reiterates that the Servicio Nacional de Guardacostas maintains full readiness for interinstitutional coordination, operational collaboration, and functional support within the framework of its legal competences, but cannot attribute to itself the technical basis of a decision issued by another public authority.
Effective protection of the marine-coastal environment and control of fishing activity require interinstitutional coordination. However, such coordination does not alter the legal distribution of competences among the respondent institutions.
The Servicio Nacional de Guardacostas exercises police and operational functions within the maritime domain. INCOPESCA, for its part, exercises sectoral competences in matters of fisheries resource management, regulation, and administration. It therefore follows that the technical studies, regulatory criteria, or specialized assessments that may have supported the challenged decision must be provided by the authority that issued or promoted that decision, as applicable.
With regard to the Servicio Nacional de Guardacostas, it is reported under oath that there is no record of the issuance of its own technical studies or criteria that served as a direct basis for the decision challenged by the petitioner…."

Considering:
I.Subject matter of the appeal. The petitioner challenges administrative resolution AJDIP/162-2024 of INCOPESCA, by which Transitorio II of the Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras was repealed, exempting the medium-scale tourist and sport fishing fleet from the obligation to install satellite tracking devices (dispositivos de localización satelital). The petitioner alleges that this omission infringes the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado) (Article 50, Constitutional) and violates the principle of environmental non-regression (principio de no regresión ambiental), by weakening control mechanisms over the exploitation of marine resources. The petitioner likewise criticizes MOPT for failing to require these devices as a condition for granting seaworthiness certificates (certificados de navegabilidad) and departure clearances (zarpes).
II.Proven facts. Of relevance to the resolution of this matter, the following facts are deemed duly established, either because they have been so evidenced or because the respondent failed to address them as required by the initial order:
III.On the fundamental right to a healthy and ecologically balanced environment. Article 50 of the Constitution recognizes every person's right to enjoy a healthy and ecologically balanced environment and, correspondingly, imposes on the State the legal duty to guarantee, defend, and preserve that constitutional interest. For several decades, this Chamber has recognized that the environment constitutes a collective legal interest whose protection holds preferential status within the Social and Democratic State of Law, by virtue of its close connection to human dignity, public health, sustainable development, and the protection of present and future generations. Precisely for this reason, the constitutional protection of the environment is not exhausted by the prevention of harm already caused, but encompasses the permanent duty to organize State action through public policies, regulatory instruments, and administrative mechanisms that prevent risks, control potentially degrading activities, and ensure the rational use of natural resources.
Constitutional jurisprudence has highlighted that environmental protection constitutes a positive obligation of the State, meaning not only that it must refrain from authorizing activities harmful to ecosystems, but also that it must adopt effective measures progressively strengthening the mechanisms for oversight, control, and surveillance of natural resources. In that context, the use of technological tools designed to improve the administrative supervision of activities potentially generating environmental impact constitutes a manifestation of the State's duty to employ the suitable means available to give effect to the fundamental right recognized in Article 50, Constitutional.
IV.On the principles of prevention, precaution, progressivity, and environmental non-regression. The evolution of Environmental Law has led to recognition that effective protection of the environment requires anticipatory State action in the face of risks that could compromise ecosystem balance. For this reason, this Chamber has consistently incorporated the prevention principle (principio de prevención) and the precautionary principle (principio precautorio) as interpretive parameters of Article 50, Constitutional. The prevention principle obligates public authorities to adopt measures aimed at avoiding harm when sufficient knowledge exists regarding the risks associated with a given activity. The precautionary principle, for its part, authorizes and even requires State intervention when, despite scientific uncertainty, serious or irreversible harm to the environment may occur. To these principles are added the principle of progressivity (principio de progresividad) and environmental non-regression, both extensively developed under International Human Rights Law and Costa Rican constitutional jurisprudence.
This Chamber has stated that the principle of progressivity imposes on the State the duty to progressively strengthen the levels of environmental protection attained, through the constant improvement of the legal, administrative, and technical instruments designed to ensure the effective enjoyment of the fundamental right to the environment. As a complementary expression of that principle, the prohibition of environmental regression prevents public authorities from reducing, without objective, sufficient, and constitutionally reasonable justification, the degree of protection previously achieved.
Nevertheless, the Chamber has also recognized that the principle of non-regression does not have an absolute character. The Administration retains a margin of regulatory latitude to modify public policies, reorganize regulatory instruments, or replace administrative mechanisms, provided that such decisions are grounded in objective, technically demonstrable reasons compatible with the constitutional duty of environmental protection. Therefore, not every regulatory modification constitutes in itself a constitutionally prohibited regression. The determinative inquiry is whether the challenged measure effectively produces an unjustified reduction in the existing level of protection, or whether, on the contrary, it responds to a reasonable technical redefinition that maintains — or even strengthens — the effectiveness of the environmental protection system. Consequently, when a constitutional challenge is raised against an administrative decision that modifies a previously established environmental protection instrument, the review conducted by this jurisdiction must be directed toward determining whether the Administration demonstrated, through objective and verifiable grounds, that the modification is compatible with the reinforced duty of protection imposed by Article 50, Constitutional.
V.On the technical discretion (discrecionalidad técnica) of the Administration and the scope of constitutional review. The Instituto Costarricense de Pesca y Acuicultura maintains that the challenged decision constitutes an exercise of the technical discretion conferred by the Ley de Pesca y Acuicultura to regulate the sustainable use of hydrobiological resources (recursos hidrobiológicos). In this regard, this Chamber has recognized that certain matters of high scientific complexity fall primarily within the province of the active Administration, which enjoys a margin of technical appraisal in selecting the regulatory measures it deems most adequate for the fulfillment of the public interest. However, that discretion does not constitute an arbitrary power, nor does it exempt the Administration from the duty to provide sufficient reasoning (motivación) for its decisions. Particularly when an administrative act affects the protection of fundamental rights or modifies instruments previously established for environmental protection, the duty to provide reasoning acquires heightened intensity. This requires the Administration to set forth the technical, scientific, environmental, or specialized grounds justifying the decision adopted, in a manner that allows verification of its rationality, proportionality, and conformity with the constitutional order.
Consequently, the review that this Chamber must conduct does not consist in substituting the Administration's technical judgment with that of the Constitutional Court. Rather, the function of this jurisdiction is to verify that the administrative decision was adopted within the corresponding competential framework, that it is sufficiently reasoned, and that the technical assessment invoked is objectively verifiable, reasonable, and compatible with the essential content of the fundamental right whose protection is sought. It is precisely from this perspective that the evidence submitted pursuant to the evidentiary measure for better adjudication (prueba para mejor resolver) must be analyzed, in order to determine whether the challenged administrative resolution is supported by sufficient technical studies, or whether, on the contrary, the modification of the satellite monitoring regime responded to considerations extraneous to the reinforced protection required by Article 50, Constitutional.
VI.On the competences constitutionally and legally conferred upon the respondent authorities. As a preliminary matter, it is essential to define the scope of competences of each of the respondent authorities, since constitutional review can only extend to actions or omissions attributable to the competent body. The Ley de Pesca y Acuicultura, Ley N° 8436, as well as the Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, confer upon that entity technical authority over the management, administration, conservation, monitoring, control, and sustainable use of hydrobiological resources. Within those competences is the power to establish the technical mechanisms necessary for monitoring and surveillance of fishing vessels, including the use of technologies aimed at strengthening oversight of fishing activity. Accordingly, the decision regarding which vessels must be incorporated into the Satellite Monitoring System constitutes a competence belonging exclusively to INCOPESCA.
For its part, MOPT exercises competences related to maritime authority, seaworthiness certification, and departure clearance authorization, pursuant to the Ley General de Puertos, the vessel certification regulations, and other special regulations. The sworn reports submitted indicate that MOPT does not hold rulemaking authority to impose obligations related to satellite monitoring of fishing vessels and that its actions are constrained by the principle of legality set forth in Article 11 of the Ley General de la Administración Pública. Similarly, the Servicio Nacional de Guardacostas exercises predominantly police, preventive, and operational functions within the national maritime domain. Although it actively participates in fisheries oversight through interinstitutional coordination mechanisms with INCOPESCA and has operational access to the Satellite Monitoring System, this does not make it a regulatory authority for the legal regime applicable to the different categories of vessels.
Consequently, the challenged administrative decision is legally attributable solely to the Instituto Costarricense de Pesca y Acuicultura. The constitutional analysis must therefore focus primarily on the actions of that institution, without prejudice to subsequently examining whether any indirect consequences arise with respect to the other respondent authorities.
VII.On the evidentiary measure for better adjudication ordered by this Chamber. By resolution of 16:51 hours on May 25, 2026, this Chamber deemed it necessary to request, as an evidentiary measure for better adjudication, the technical studies or criteria underlying the challenged decision. The purpose of that measure was to determine whether the repeal of Transitorio II of Acuerdo AJDIP-076-2022 was the result of a specialized technical assessment capable of constitutionally justifying the modification of the satellite monitoring regime. It was not, therefore, a matter of verifying the formal existence of the administrative resolution — a circumstance that was never in dispute — but rather of ascertaining whether the exercise of rulemaking authority had been preceded by sufficient technical justification. The responses provided by the respondent authorities permit the following conclusions.
MOPT expressly stated that it had not prepared technical studies on the matter, as it falls outside its legal competences. The Servicio Nacional de Guardacostas likewise reported that it had not issued any technical criterion related to the exclusion of the tourist and sport fishing fleet from the mandatory satellite monitoring system. Both responses are consistent with the distribution of competences provided for in the legal framework and rule out any technical participation by those institutions in the adoption of the challenged decision. Consequently, the analysis of the evidence must focus exclusively on the documentation submitted by the Instituto Costarricense de Pesca y Acuicultura.
VIII.Assessment of the documentation submitted by INCOPESCA. In compliance with the directive issued by this Chamber, INCOPESCA submitted copies of various Board of Directors resolutions related to the regulatory evolution of the Satellite Monitoring System, as well as official memorandum INCOPESCA-PE-DOPA-126-2022. The Chamber observes that the submitted documentation allows for reconstruction of the administrative process through which the satellite tracking system was progressively implemented. It also demonstrates that, since 2020, institutional policy had been oriented toward a gradual expansion of the universe of vessels subject to technological monitoring. The documentation submitted by the Instituto Costarricense de Pesca y Acuicultura includes official memorandum INCOPESCA-PE-DOPA-126-2022, prepared by the Dirección de Ordenamiento Pesquero y Acuícola with the participation of the Legal Advisory Office (Asesoría Jurídica), which contains technical assessments regarding the utility of the satellite monitoring system for strengthening the monitoring, control, and surveillance of fishing activity, combating illegal, unreported, and unregulated fishing (pesca ilegal, no declarada y no reglamentada), and promoting the sustainable use of hydrobiological resources.
However, that criterion was issued within a clearly defined administrative context. Its purpose was to evaluate a request submitted by representatives of the tourist and sport fishing sector for an extension of the deadline for the mandatory implementation of the satellite monitoring system, and it concludes by recommending only that the deadline for the installation of satellite beacons (balizas satelitales) be extended. It does not contain a technical assessment aimed at justifying the subsequent repeal of Transitorio II agreed upon by means of AJDIP-162-2024, nor does it develop a scientific or specialized analysis explaining why the exclusion of the tourist and sport fishing fleet from the mandatory satellite monitoring regime is compatible with the level of environmental protection previously attained.
IX.Analysis of the technical documentation submitted by INCOPESCA. In compliance with the directive issued by this Chamber, the Instituto Costarricense de Pesca y Acuicultura submitted copies of various resolutions adopted by its Board of Directors in relation to the implementation of the Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras, as well as official memorandum INCOPESCA-PE-DOPA-126-2022, prepared by the Dirección de Ordenamiento Pesquero y Acuícola with the participation of the Legal Advisory Office. A comprehensive review of that documentation establishes that the Administration did incorporate into the administrative file a criterion of a technical-administrative nature related to the implementation of the satellite monitoring system. Indeed, the referenced memorandum develops various considerations regarding the utility of the Sistema de Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras as an instrument designed to strengthen fishing activity oversight, combat illegal, unreported, and unregulated fishing, improve interinstitutional coordination, and promote the sustainable use of hydrobiological resources.
It likewise acknowledges the importance of satellite monitoring as a technological mechanism for strengthening national fisheries management and aligning it with the regional commitments assumed by the Costa Rican State. However, the Chamber notes that this technical criterion was issued within a clearly delimited administrative context. Its purpose was to assess the request submitted by representatives of the tourist and sport fishing sector for an extension of the deadline prescribed for the mandatory implementation of the satellite monitoring system. As a result of that assessment, the technical criterion concluded by recommending the granting of a temporary extension, with the purpose of allowing for the proper operational implementation of the system and facilitating the progressive adaptation of the regulated sector.
Accordingly, the content of the memorandum demonstrates that INCOPESCA's own technical body considered it appropriate to maintain the implementation of the satellite monitoring system, recommending only that its entry into force with respect to a particular group of vessels be temporarily deferred. In that sense, the submitted documentation evidences the existence of a technical criterion favorable to the satellite monitoring system, but does not in itself constitute a technical basis justifying the decision subsequently adopted by means of Acuerdo AJDIP-162-2024.
X.On the correspondence between the technical criterion submitted and the challenged administrative decision. Precisely because official memorandum INCOPESCA-PE-DOPA-126-2022 contains relevant technical assessments, it is necessary to determine whether there exists a relationship of consistency between that specialized criterion and the administrative decision whose constitutionality is challenged in this proceeding. In this regard, the Chamber observes that the subject matter of this appeal does not consist in reviewing the legality of the extension recommended in 2022, but rather the decision subsequently adopted by INCOPESCA's Board of Directors through Acuerdo AJDIP-162-2024, by which Transitorio II of Acuerdo AJDIP-076-2022 was repealed and the entry into force of the regime that was to have mandatorily incorporated the medium-scale tourist and sport fishing fleet into the satellite monitoring system was eliminated.
From this perspective, the technical criterion submitted and the challenged administrative act do not share the same subject matter. Whereas official memorandum PE-DOPA-126-2022 proceeds from the premise that satellite monitoring constitutes an appropriate instrument for strengthening fisheries oversight and recommends only extending the deadline for its implementation, Acuerdo AJDIP-162-2024 adopts a different decision, consisting in repealing the transitional regime that had established that future mandatory incorporation. The Chamber does not deny that the Administration may modify decisions previously adopted, nor that rulemaking authority encompasses the power to review regulatory instruments when necessary for the adequate satisfaction of the public interest. However, when the Administration changes the direction of a public policy previously grounded in technical criteria, it must set forth the objective reasons justifying that change in course.
In the present matter, the documentation submitted does not allow for the identification of any study, technical report, scientific evaluation, or specialized opinion issued after official communication PE-DOPA-126-2022 that would explain what technical circumstances led to the substitution of the initial recommendation for phased implementation with the subsequent repeal of the transitional regime (régimen transitorio). There is, therefore, a break between the technical opinion incorporated into the administrative file (expediente administrativo) and the decision ultimately adopted by the Board of Directors, without that transition being supported by a sufficiently explicit technical statement of reasons (motivación técnica).
XI.On the reinforced technical statement of reasons for administrative acts with environmental impact. This Court has repeatedly recognized that the Administration enjoys a margin of technical discretion (discrecionalidad técnica) when regulating complex matters whose definition requires scientific or specialized knowledge. However, the existence of technical discretion does not exclude the constitutional duty to provide reasons. On the contrary, when the exercise of that power affects mechanisms designed to protect the environment, the requirement of a statement of reasons acquires a reinforced content, derived from Article 50 of the Constitución Política and from the principles of objectivization of environmental protection (tutela ambiental), prevention, and progressivity (progresividad). In such cases, the Administration is not required to indefinitely maintain a particular regulation, but it must demonstrate, through objective and verifiable grounds, that the modification introduced is compatible with the level of environmental protection that the constitutional framework requires to be preserved.
It is precisely for this reason that this Court ordered, as evidence for better resolution, the submission of the studies or technical opinions that served as the basis for the contested decision. The documentation submitted demonstrates that there were technical opinions in favor of the phased implementation of the satellite monitoring (monitoreo satelital) system; however, it does not establish that the subsequent decision to repeal the transitional regime had been preceded by a new technical evaluation analyzing the environmental, regulatory, or oversight consequences arising from that modification. The statement of reasons set out in Acuerdo AJDIP-162-2024 itself refers primarily to the absence of consensus with the regulated sector, to the advisability of continuing the regulatory drafting process, and to reasons of administrative expediency. Without dismissing the institutional relevance of such circumstances, this Court considers that they do not substitute the need to establish, through specialized technical elements, that the modification of the satellite monitoring regime maintains an equivalent level of protection of the fishery resource (recurso pesquero) and the environment.
XII.Application of the principles of progressivity and non-regression (no regresión) to the specific case. This Court considers that the present matter should not be resolved on the premise that every modification of the legal regime applicable to satellite monitoring constitutes, in itself, a constitutionally prohibited environmental regression. As indicated above, the principle of non-regression does not prevent the Administration from reviewing, modifying, or replacing regulatory instruments when doing so responds to objective, technically justified reasons that are compatible with the State's duty of environmental protection. The constitutional problem in the present case lies in a different aspect. The administrative file shows that the technical body of INCOPESCA itself had considered it appropriate to implement the satellite monitoring system progressively with respect to the tourist and sport fishing fleet (flota turística y deportiva), recommending only that the deadline for making that obligation effective be extended.
Subsequently, the Board of Directors adopted a different regulatory decision by repealing the corresponding transitional regime. However, the Administration did not establish that between one decision and the other there had been a new technical assessment explaining the scientific, environmental, fisheries-related, or regulatory reasons that justified abandoning the scheme initially recommended. Accordingly, this Court does not conclude that the repeal of Transitorio II is contrary to the Constitución Política merely because it modifies the existing regulatory regime, but rather because the Administration failed to demonstrate, through a sufficient technical statement of reasons, that said modification preserved the level of environmental protection required by Article 50 of the Constitución Política. That insufficiency of reasoning prevents this Court from verifying that the exercise of the rule-making power (potestad reglamentaria) was carried out within the parameters of objectivity, reasonableness, and reinforced protection that must govern every administrative action with a direct impact on the environment.
It is noted that compliance with this judgment does not imply that the Instituto must adopt a particular regulatory solution. It falls to the Instituto, in the exercise of the competencies that the legal framework confers upon it, to define the regime applicable to the tracking, control, and surveillance of medium-scale tourist and sport fishing vessels, provided that the decision it ultimately adopts is duly supported by objective, sufficient, and verifiable technical criteria, in accordance with the parameters developed in this judgment.
XIII.On the legal situation of the Ministerio de Obras Públicas y Transportes and the Servicio Nacional de Guardacostas. With respect to these authorities, the appeal cannot succeed. Both institutions established that the contested decision was not issued within the scope of their competencies. They also demonstrated that they lack the regulatory power to impose, modify, or repeal the legal regime for satellite monitoring of fishing vessels. The Ministerio de Obras Públicas y Transportes acts in accordance with the principle of legality by limiting the requirements for seaworthiness certification (certificación de navegabilidad) and the issuance of vessel departure clearances (zarpes) to those expressly provided for by the legal framework. Likewise, the Servicio Nacional de Guardacostas performs maritime surveillance functions and operational coordination with INCOPESCA, without holding the authority to define the content of the contested regulatory regime. Accordingly, no constitutional injury attributable to those authorities is established.
The parties are warned that if any document has been submitted on paper, as well as any objects or evidence contained in any additional device of an electronic, computer, magnetic, optical, telematic, or new-technology nature, these must be retrieved from the office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at session N° 27-11 of August 22, 2011, artículo XXVI, and published in Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, artículo LXXXI.
Por tanto:
The appeal is declared partially granted, solely with respect to the Instituto Costarricense de Pesca y Acuicultura, for having adopted Acuerdo AJDIP-162-2024 without establishing, through a sufficient technical statement of reasons, that the repeal of Transitorio II of Acuerdo AJDIP-076-2022 was compatible with the constitutional duty of environmental protection and with the principles of objectivization, prevention, progressivity, and environmental non-regression. Accordingly, Nelson Peña Navarro, in his capacity as Executive President of the Instituto Costarricense de Pesca y Acuicultura (INCOOPESCA), is ordered to, within six months counted from the notification of this judgment, complete the technical statement of reasons supporting Acuerdo AJDIP-162-2024 or, in the alternative, adopt a new duly reasoned resolution, for which purpose he must incorporate and assess the scientific, technical, environmental, and regulatory studies that are relevant, in a manner that allows for an objective verification that the regulation adopted satisfies the constitutional duty of environmental protection.
The appeal is declared without merit with respect to the Ministerio de Obras Públicas y Transportes and the Servicio Nacional de Guardacostas. The respondents are warned that, pursuant to the provisions of Article 71 of the Ley de la Jurisdicción Constitucional, a prison sentence of three months to two years or a fine of twenty to sixty days shall be imposed upon any person who receives an order that must be complied with or enforced, issued within an amparo appeal (recurso de amparo), and fails to comply with it or to enforce it, provided that the offense is not more severely punishable under another provision. The Instituto Costarricense de Pesca y Acuicultura is condemned to pay the costs, damages, and losses occasioned by the acts underlying this declaration, which shall be assessed in administrative-litigation enforcement proceedings (vía de ejecución de sentencia de lo contencioso administrativo), unless another remedy is appropriate.- Fernando Castillo V.

El acuerdo AJDIP 162-2024, viene a contradecir este avance con una fundamentación débil e incomprensible, dada la dimensión del compromiso ambiental constitucional, al considerar como opción la derogatoria de una norma en vez de dimensionar su aplicación, al indicar en su texto lo siguiente: “1-Que por medio del Acuerdo AJDIP/312-2023 del 12 de diciembre de 2023, en su parte dispositiva, la Junta Directiva acordó: “1- Aprobar la solicitud de prórroga recomendada y modificar el acuerdo de Junta Directiva AJDIP/076- 2022, en su Transitorio II, para que en lo sucesivo se lea de la siguiente manera: Transitorio II: “Para las embarcaciones de Pesca Deportiva y Turística de mediana escala, el presente reglamento será aplicable a partir del 01 de julio del año 2024”. 2-Dejar sin efecto el Acuerdo de Junta Directiva AJDIP/116-2023. 3-Solicitar a la Comisión de trabajo instaurada para el seguimiento del tema, la presentación del texto alternativo de reglamentación exclusiva para la pesca deportiva y turística a más tardar en el mes de marzo del año 2024”. 2-Que a la fecha no ha sido posible contar con una propuesta clara, efectiva y participativa que venga a definir las condiciones y alcances del texto que se quiere incorporar al Acuerdo AJDIP/077- 2020, “Reglamento para el seguimiento, control y vigilancia de embarcaciones pesqueras de las flotas nacional y extranjera”; o si en su defecto, tal y como lo han planteado desde la Asesoría Jurídica, la Dirección de Ordenamiento Pesquero y Acuícola y en parte el sector de pesca turística deportiva, la creación de una nueva reglamentación exclusiva para esa actividad que contemple la obligatoriedad de contar con un sistema de localización, seguimiento y control para las embarcaciones pesqueras de mediana escala pertenecientes a ese sector. 3-Que si bien es cierto, ha transcurrido de manera sobrada el tiempo, y por las razones señaladas no ha sido factible desde el seno de la Administración, desarrollar de manera unilateral una propuesta razonable, equilibrada y justa, en concordancia con la línea de acción que ha imperado en el actuar de la presente Administración, para con los diversos sectores productivos. 4-Que por las condiciones y argumentaciones supra indicadas y siendo que se encuentra esta Junta Directiva ante la dicotomía de la entrada en vigencia del transitorio II del Acuerdo AJDIP/312-2023 y la efectiva realidad de no contar con los elementos suficientes para delimitar un texto adecuado conforme a la realidad del sector pesquero turístico-deportivo de mediana escala; en aras de salvaguardar los intereses institucionales particularmente de ese sector productivo nacional, resulta pertinente derogar el Transitorio II del Acuerdo AJDIP/076-2022 y su reforma contenida en el Acuerdo AJDIP/312-2023; así como cualquier otro que se le oponga. 5-Que debidamente valoradas las argumentaciones citadas en los considerandos precedentes, una vez discutida y analizada la propuesta planteada, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, POR TANTO; ACUERDA 1-Derogar el Transitorio II del Acuerdo AJDIP/076-2022, así como sus reformas contenidas en el Acuerdo AJDIP/116-2023, y cualquier otro que se le oponga.
De igual manera se deroga el Acuerdo AJDIP/312-2023. 2- Acuerdo Firme. Rige a partir de su adopción.” 8- Esta decisión claramente contradice el principio de no regresión en materia ambiental el cual ha sido establecido en la jurisprudencia constitucional en varias piezas de suma relevancia: “El derecho fundamental a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 de la Constitución Política, impide que las autoridades públicas adopten medidas que impliquen un retroceso en los niveles de protección ambiental ya alcanzados. El principio de no regresión constituye un parámetro de control de constitucionalidad que asegura la progresividad en materia ambiental.” (sentencia 016904-2025) De manera consistente desde muchos años atrás este principio ha venido siendo establecido como parte integral del derecho ambiental: así la sentencia constitucional 013367- 2012 “V. Sobre los principios de progresividad y no regresión de la protección ambiental.
El principio de progresividad de los derechos humanos ha sido reconocido por el Derecho Internacional de los Derechos Humanos; entre otros instrumentos internacionales, se encuentra recogido en los artículos 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales, artículo 1 y 26 de la Convención Americana sobre Derechos Humanos y artículo 1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales. Al amparo de estas normas, el Estado asume la obligación de ir aumentando, en la medida de sus posibilidades y desarrollo, los niveles de protección de los derechos humanos, de especial consideración aquellos, que como el derecho al ambiente (art. 11 del Protocolo), requieren de múltiples acciones positivas del Estado para su protección y pleno goce por todos sus titulares (…). En relación con el derecho al ambiente dijo: “Lo anterior constituye una interpretación evolutiva en la tutela del ambiente conforme al Derecho de la Constitución, que no admite una regresión en su perjuicio.” (Sentencia de la Sala Constitucional Nº 18702-10)”.
(En el mismo sentido, las sentencias 2014-012887, 2017-002375, 2017-005994, 2019-012745 y 2019- 017397)”… De este modo, de acuerdo con el principio de progresividad, el Estado asume la obligación de aumentar, en la medida de lo posible, los niveles de protección de los derechos humanos, incluido el derecho al ambiente sano y ecológicamente equilibrado. Por su parte, la aplicación del principio de no regresión consiste en una garantía que constriñe al Estado a abstenerse de adoptar medidas, políticas o normas que empeoren, sin una justificación razonable y proporcionada, el grado de protección a los derechos fundamentales ya alcanzado, y que, dado el caso, se tienen que ponderar las medidas de compensación que correspondan. (…)” (entre muchos otros pronunciamientos) 9- A raíz de esta realidad reglamentaria, el dispositivo de control satelital debidamente instalado, funcional y conectado al sistema de monitoreo satelital que maneja en conjunto el Incopesca con el Servicio Nacional de Guardacostas, no es un requisito exigido por el Ministerio de Obras Públicas y Transportes en su sección de capitanía de puerto para otorgar el certificado de navegabilidad a las embarcaciones y por tanto para otorgar los zarpes como una medida adicional de control de las embarcaciones, pudiendo ser, como se ha dicho, una medida más de seguridad y control, ya no solo en relación a los recursos naturales, sino, como un dispositivo de seguridad para la ubicación de embarcaciones, situación que contraviene también la obligación del Estado de establecer procedimientos para el control de la flota pesquera nacional.
Se considera que la participación tanto del Ministerio de Obras Públicas y Transportes como del Servicio Nacional de Guardacostas es derivada, es decir, no incorporan el control de los dispositivos precisamente porque no existe una reglamentación obligatoria, establecida a partir de las competencias de control del INCOPESCA, pero si el presente amparo se declara con lugar, necesariamente tendrán que hacer los ajustes necesarios tanto en la reglamentación como en el ejercicio del control satelital. Claramente el cumplimiento puede ser incorporado dentro de los requisitos para la emisión del certificado de navegabilidad, que realiza el MOPT- capitanía de puerto una vez al año. En el caso de los zarpes, pueda establecerse una reglamentación ágil que permita avisar por Radio a la Capitanía de las salidas dentro de un control general del cumplimiento (referencias Decreto Ejecutivo Nº 28742- MOPT Reglamento a la Emisión de Zarpe a las Embarcaciones de Bandera Nacional, Decreto Ejecutivo Nº 32468-MOPT (2005): Reglamento para la Inspección y Certificación de Embarcaciones de Bandera Nacional Decreto Ejecutivo Nº 39442-MOPT (2015) (...) Solicita el recurrente lo siguiente: “(…) 1- Declarar con lugar el presente recurso de amparo 2- Declarar inconstitucional la actuación del Incopesca de eximir del control satelital a la flota turística y deportiva 3-Ordenar al Incopesca que, en un plazo prudencial de 2 meses, elabore el reglamento que establezca como obligación la instalación y mantenimiento de dispositivos de control satelital debidamente funcionales y conectados al sistema de monitoreo satelital institucional INCOPESCA- SNG para la flota turística y la flota deportiva tanto nacional como internacional, estableciendo los mecanismos necesarios para su conexión. 4- Ordenar al Ministerio de obras Públicas y Transportes en su sección de capitanía de puerto, realizar las modificaciones reglamentarias necesarias para la incorporación como requisito de navegabilidad para las embarcaciones de pesca turística y pesca deportiva, así como el desarrollo de una metodología ágil para el otorgamiento de zarpes para las embarcaciones que cumplan con el requisito. 5- Ordenar al Servicio Nacional de Guardacostas, incorporar dentro de los sistemas de monitoreo y control conjunto con el INCOPESCA los rastreos y manejo de dato de los sistemas de monitoreo satelital de la flota turística y deportiva conforme a los reglamentos que se establezcan (…)”.

I.
Sobre la situación denunciada El presente recurso de amparo fue interpuesto por el señor [Nombre 001] contra el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), el Ministerio de Obras Públicas y Transportes (MOPT) y el Servicio Nacional de Guardacostas, alegando una supuesta omisión estatal en la exigencia de dispositivos de localización satelital para embarcaciones de pesca turística y deportiva, así como la presunta vulneración del derecho a un ambiente sano y ecológicamente equilibrado y del principio de no regresión ambiental.
En lo que respecta al Ministerio de Obras Públicas y Transportes, la información técnica y administrativa que sustenta este informe ha sido suministrada por la División Marítimo‑Portuaria, órgano competente en materia de autoridad marítima, certificación de navegabilidad y control administrativo de zarpes, conforme al marco legal vigente.
De conformidad con la Ley N.° 3155, el Decreto Ejecutivo N.° 45103‑MOPT, el Decreto Ejecutivo N.° 32468‑MOPT (Reglamento para la Inspección y Certificación de Embarcaciones de Bandera Nacional) y el Decreto Ejecutivo N.° 28742‑MOPT (Reglamento a la Emisión de Zarpes), corresponde al MOPT, por medio de la División Marítimo‑Portuaria y las Capitanías de Puerto, ejercer competencias vinculadas a:
La verificación de las condiciones técnicas de navegabilidad de las embarcaciones.
• El control administrativo previo mediante el otorgamiento de zarpes.
Dichas competencias se circunscriben exclusivamente a aspectos de seguridad de la navegación y protección de la vida humana en el mar, no comprendiendo la regulación, monitoreo ni control del recurso pesquero, materias que el ordenamiento jurídico asigna expresamente a autoridades sectoriales distintas, en particular al Instituto Costarricense de Pesca y Acuicultura, conforme a la Ley N.° 8436.
La División Marítimo‑Portuaria informa que:
En la normativa aplicable no se contempla la exigencia de dispositivos de localización satelital como requisito técnico para la navegabilidad.
De igual forma, el ordenamiento jurídico no habilita al MOPT para exigir dispositivos de localización satelital como requisito para el otorgamiento de zarpes.
La certificación de condiciones mínimas de seguridad marítima.
La División Marítimo-Portuaria no administra ni opera sistemas propios de monitoreo satelital de embarcaciones, tales como VMS, AIS pesquero u otros sistemas equivalentes, por cuanto dichas plataformas requieren infraestructura tecnológica especializada y se vinculan con el control de actividades económicas específicas.
El ordenamiento jurídico ha asignado dichas funciones a entidades con competencia material expresa, tales como:
• INCOPESCA, para el monitoreo y control de la actividad pesquera.
• Servicio Nacional de Guardacostas, para labores de vigilancia e interdicción marítima.
No obstante, el MOPT participa activamente en esquemas de coordinación interinstitucional, en apego a los principios de coordinación administrativa, unidad del Estado, eficiencia y eficacia del servicio público, mediante el intercambio de información, atención de requerimientos técnicos y apoyo operativo cuando corresponde.
De lo expuesto se concluye que:
El Ministerio de Obras Públicas y Transportes ha actuado en todo momento conforme al principio de legalidad, dentro del ámbito competencial que le asigna el ordenamiento jurídico.
La no exigencia de dispositivos de localización satelital como requisito para la navegabilidad o el zarpe no constituye una omisión administrativa, sino una consecuencia directa de la inexistencia de habilitación normativa expresa.
La regulación del monitoreo satelital de embarcaciones pesqueras corresponde al Instituto Costarricense de Pesca y Acuicultura, conforme a la Ley N.° 8436.
No se configura actuación regresiva en materia ambiental ni violación a derechos fundamentales atribuible a esta Administración…”.
Solicita que se desestime el recurso planteado.

SOBRE LA IMPROCEDENCIA DE LOS HECHOS ALEGADOS Desde este acto se rechazan en todos sus extremos las afirmaciones del recurrente, por cuanto parten de una premisa errónea consistente en afirmar la existencia de una supuesta omisión inconstitucional en el ejercicio de las competencias de control y vigilancia de la actividad pesquera.
Contrario a lo sostenido, el Estado costarricense, por medio de INCOPESCA y en coordinación con otras instituciones competentes, ha desarrollado un conjunto de mecanismos regulatorios, técnicos y operativos que permiten el control efectivo de la actividad pesquera, ajustados a criterios de razonabilidad, proporcionalidad y diferenciación según la naturaleza de cada flota.
SOBRE LA COMPETENCIA DE INCOPESCA Y EL EJERCICIO DE LA DISCRECIONALIDAD TÉCNICA De conformidad con la Ley N.° 8436, corresponde a INCOPESCA regular, ordenar y administrar el recurso pesquero, así como dictar las medidas necesarias para su control y vigilancia.
No obstante, dichas competencias no se ejercen de forma automática, sino bajo el marco de la discrecionalidad técnica-administrativa, lo cual implica que la Administración puede definir, con base en criterios técnicos, científicos y operativos, las medidas regulatorias más idóneas para cada segmento de la actividad pesquera.
La jurisprudencia constitucional ha reconocido de forma reiterada que la Administración cuenta con un margen de apreciación técnica que no puede ser sustituido, salvo en supuestos de arbitrariedad manifiesta, lo cual no ocurre en el presente caso.
En consecuencia, la pretensión del recurrente, el cual carece de experiencia para la emisión de elaboración de reglamentación institucional, además de la falta de criterio técnico, trate de imponer un modelo único y uniforme de control desconoce la naturaleza técnica de la gestión pesquera y pretende sustituir indebidamente a la Administración en la definición de política pública.
SOBRE LA DIFERENCIACIÓN REGULATORIA DE LAS FLOTAS PESQUERAS La normativa vigente establece una diferenciación clara entre las distintas flotas (comercial, artesanal, turística y deportiva), lo cual responde a criterios objetivos tales como la intensidad de explotación del recurso, el impacto ambiental, la finalidad económica y la capacidad operativa.
Esta diferenciación no solo es válida, sino necesaria desde el punto de vista constitucional, toda vez que el principio de igualdad no implica un tratamiento idéntico, sino un trato diferenciado cuando existan condiciones distintas.
Pretender equiparar, sin mayor análisis técnico, a todas las flotas bajo un mismo régimen de control satelital obligatorio, como lo propone el recurrente, implicaría desconocer estas diferencias sustanciales y vulnerar el principio de razonabilidad en la regulación administrativa.
Es evidente que el recurrente tiende a confundir a tan distinguida Sala por lo siguiente:
Así como se indica que las artesanales se excluyen por estar a menos de 3 millas, no se cuestiona al INCOPESCA su decisión Si cuestiona el tema de la forma con los de pesca deportiva y turistica siendo que INCOPESCA tiene la capacidad técnica de decidir cómo debe administrarse al permisionario de la institución.
No se incluyen evidencias científicos-técnicas sobre el momento, la forma o las razones del porque debe imponerse una situación específica a un permisionario, siendo que el INCOPESCA puede decidir basado en criterios técnicos la modalidad de una posible implementación.
La flota turística y deportiva también tiene una diferenciación de acuerdo a su poder adquisitivo y a los permisos otorgados para realizar sus actividades, por lo que se debe realizar acciones que identifiquen la mejor manera de implementar la aplicación de las nuevas tecnologías de acuerdo a la capacidad económica de los dueños de las embarcaciones, la cual difiere en extremos.
SOBRE LA INEXISTENCIA DE OMISIÓN EN EL CONTROL Y VIGILANCIA El recurrente fundamenta su acción en la supuesta inexistencia de mecanismos de control respecto de determinadas flotas, lo cual no solo no se ajusta a la realidad sino es completamente falso.
Tal y como consta en la gestión administrativa, el Estado dispone de múltiples herramientas de control, incluyendo el sistema de monitoreo satelital aplicado a flotas de mayor impacto, controles de licencias, inspecciones en puerto y altamar, así como la coordinación interinstitucional con el Servicio Nacional de Guardacostas y otras autoridades competentes.
En este sentido, no existe ausencia de control, sino un modelo diferenciado y progresivo, diseñado conforme a criterios técnicos y de eficiencia administrativa, además actualmente INCOPESCA ha realizado inversiones para mejorar el centro de monitoreo satelital, con mejores tecnologías y personal capacitado lo que demuestra que la institución está comprometida, y que además, sirve de espejo para que otras instituciones como guardacostas y SINAC, tenga acceso al monitoreo satelital en tiempo real.
SOBRE LA RAZONABILIDAD DE LA EXCLUSIÓN DE CIERTAS FLOTAS DEL DISPOSITIVO DE SEGUIMIENTO SATELITAL.
La exclusión de la flota turística y deportiva del uso obligatorio del sistema de monitoreo satelital responde a una decisión técnica debidamente justificada, basada en la menor intensidad extractiva de estas actividades, su naturaleza recreativa o de servicios, y la necesidad de evitar cargas regulatorias desproporcionadas. Lo anterior si detrimento que ha mediano plazo y con los criterios técnicos y la socialización a los permisionarios, se pueda gestionar el inicio de un programa robusto que incluya la flotilla en mención.
En particular, debe destacarse que estas actividades no presentan el mismo nivel de impacto sobre el recurso pesquero que la flota comercial, razón por la cual la imposición de medidas idénticas no resulta ni necesaria ni proporcional.
El control constitucional no puede convertirse en un mecanismo para imponer el criterio del recurrente sobre el criterio técnico de la Administración, salvo que se demuestre una irracionalidad evidente, lo cual no ha sido acreditado.
SOBRE EL PRINCIPIO DE NO REGRESIÓN AMBIENTAL El recurrente invoca el principio de no regresión ambiental; sin embargo, su aplicación en el presente caso resulta improcedente.
La jurisprudencia constitucional ha establecido que dicho principio no implica la imposibilidad absoluta de modificar regulaciones, sino la prohibición de reducir injustificadamente el nivel de protección ambiental.
En el caso concreto, no existe una regresión en el nivel de protección, por cuanto:
Primero, no existía una obligación consolidada aplicable a todas las flotas en materia de monitoreo satelital.
Segundo, la modificación normativa responde a un proceso de revisión técnica y ajuste regulatorio.
Tercero, se mantiene un sistema de control efectivo sobre los sectores de mayor impacto.
Por tanto, lo alegado por el recurrente constituye una interpretación extensiva e incorrecta del principio de no regresión.
SOBRE LOS LÍMITES DEL RECURSO DE AMPARO La pretensión del recurrente no se limita a la tutela de un derecho fundamental, sino que busca que la Sala Constitucional ordene la adopción de una normativa específica, consistente en la implementación obligatoria de un sistema de monitoreo satelital para todas las flotas.
Lo anterior excede el ámbito del recurso de amparo, el cual no constituye una vía para sustituir a la Administración en la definición de políticas públicas ni para imponer criterios técnicos específicos.
SOBRE LA PARTICIPACIÓN DE OTRAS INSTITUCIONES En relación con el Ministerio de Obras Públicas y Transportes y el Servicio Nacional de Guardacostas, debe indicarse que sus competencias son complementarias y derivadas, y se ejercen conforme al marco normativo vigente.
No existe disposición legal que establezca la obligatoriedad del uso del sistema de monitoreo satelital para todas las flotas, por lo que no puede atribuirse omisión alguna a dichas instituciones.
SOBRE LAS ACCIONES EFECTIVAS DE CONTROL Y VIGILANCIA EJERCIDAS POR INCOPESCA Contrario a lo afirmado por el recurrente, el Instituto Costarricense de Pesca y Acuicultura ha venido ejerciendo de manera activa, continua y progresiva sus competencias de control y vigilancia sobre la actividad pesquera, mediante la implementación de diversas herramientas regulatorias, operativas y de coordinación interinstitucional.
En ese sentido, debe destacarse que INCOPESCA ha desarrollado e implementado el Sistema de Monitoreo Satelital, para aquellas flotas de mayor impacto extractivo, lo cual constituye una medida concreta y efectiva de seguimiento y control en tiempo real de las embarcaciones sujetas a dicha obligación.
Asimismo, se han fortalecido los mecanismos de control mediante la coordinación permanente con el Servicio Nacional de Guardacostas, permitiendo la ejecución de labores de vigilancia en altamar, así como operativos conjuntos orientados a la prevención y sanción de actividades ilícitas.
De igual forma, la Administración mantiene controles administrativos vinculados al otorgamiento de licencias, autorizaciones de zarpe, inspecciones en puerto y verificación del cumplimiento de la normativa vigente, lo que permite un seguimiento integral de la actividad pesquera en sus distintas modalidades.
Debe resaltarse además que el modelo de regulación adoptado responde a un enfoque progresivo y diferenciado, en el cual las medidas de control se implementan de forma gradual y conforme al nivel de riesgo e impacto de cada flota, en apego a criterios técnicos y de eficiencia administrativa y cumplimiento de normativa internacional.
En consecuencia, no solo no existe inacción por parte de la Administración, sino que se evidencia un ejercicio activo de sus competencias, orientado a garantizar el uso sostenible de los recursos marinos y el cumplimiento del marco normativo vigente.
CONCLUSIÓN
De conformidad con todo lo expuesto, queda plenamente acreditado que la actuación de INCOPESCA no solo se ajusta al ordenamiento jurídico, sino que responde a un ejercicio efectivo, técnico y continuo de sus competencias en materia de ordenamiento, control y vigilancia de la actividad pesquera.
El recurso interpuesto parte de una premisa incorrecta, al asumir la existencia de una omisión inexistente, cuando en realidad lo que se evidencia es una discrepancia con el modelo regulatorio adoptado por la Administración, el cual se encuentra debidamente fundamentado en criterios de razonabilidad, proporcionalidad y diferenciación técnica.
Asimismo, no se ha demostrado la existencia de una afectación real, actual y directa al derecho fundamental a un ambiente sano, ni tampoco la configuración de una regresión ambiental en los términos definidos por la jurisprudencia constitucional.
Por el contrario, las acciones desplegadas por INCOPESCA evidencian un compromiso sostenido con la gestión responsable del recurso pesquero, mediante la implementación de mecanismos de control acordes con la naturaleza de cada actividad, dentro de un esquema de mejora progresiva y adaptación regulatoria.
Aceptar la pretensión del recurrente implicaría trasladar al juez constitucional funciones propias de la Administración activa, particularmente en la definición de políticas públicas de carácter técnico, lo cual resulta improcedente dentro del marco del recurso de amparo…”.
Este informe se rinde exclusivamente en cuanto corresponde al Servicio Nacional de Guardacostas, institución que forma parte del Ministerio de Seguridad Pública y que ejerce funciones policiales especializadas en el ámbito marítimo, sin perjuicio de las competencias propias de otras entidades recurridas.
Desde ya se deja constancia de que el Servicio Nacional de Guardacostas reconoce plenamente la especial relevancia constitucional del derecho humano a un ambiente sano y ecológicamente equilibrado, así como la necesidad de fortalecer los mecanismos estatales de protección del recurso marino-costero. En esa misma línea, se reconoce también la importancia de los principios de progresividad y no regresión en materia ambiental, como parámetros de interpretación y actuación administrativa compatibles con el artículo 50 de la Constitución Política y con la jurisprudencia constitucional costarricense.
No obstante, también debe precisarse, con igual claridad, que la emisión, modificación, derogatoria o sustitución de la normativa específica sobre monitoreo satelital de embarcaciones pesqueras corresponde a la esfera competencial de INCOPESCA, conforme al marco legal y reglamentario aplicable, por lo que el Servicio Nacional de Guardacostas no dictó la disposición reglamentaria impugnada ni ejerce potestad reglamentaria sobre esa materia específica.
La Ley N.° 8000, Ley de Creación del Servicio Nacional de Guardacostas, establece con claridad la naturaleza jurídica y finalidad institucional del Servicio. En su artículo 1, dispone que el Servicio Nacional de Guardacostas es un cuerpo policial integrante de la Fuerza Pública, especializado en el resguardo de las aguas territoriales, la plataforma continental, el zócalo insular y los mares adyacentes al Estado costarricense, con dependencia directa del Ministro de Seguridad Pública.
A partir de dicha norma de creación, el marco funcional del Servicio Nacional de Guardacostas debe entenderse en clave de vigilancia, control, prevención, resguardo y protección del espacio marítimo bajo jurisdicción costarricense, lo cual incluye, desde luego, una participación activa en la protección del recurso marino-costero, la prevención de actividades ilícitas y la colaboración interinstitucional con otros entes públicos con competencia material específica.
En otras palabras, el Servicio Nacional de Guardacostas tiene una vocación legal y operativa de tutela del espacio marítimo, de apoyo al cumplimiento del ordenamiento jurídico en el mar y de resguardo de intereses públicos de especial relevancia, entre ellos la seguridad de la navegación, el control de actividades en aguas jurisdiccionales y la protección de bienes jurídicos asociados al aprovechamiento legítimo y sostenible del medio marino.
Sin embargo, esa misión institucional no se traduce en una competencia normativa autónoma para regular el régimen jurídico pesquero o acuícola, ni para definir por sí solo los sujetos obligados, plazos, condiciones técnicas o regímenes transitorios del sistema de monitoreo satelital pesquero. Ese ámbito se encuentra, por diseño legal, en la órbita de INCOPESCA, como autoridad sectorial competente para la regulación del aprovechamiento pesquero y los instrumentos técnicos asociados a su control.
Precisamente por ello, el hecho de que el Servicio Nacional de Guardacostas participe en tareas de vigilancia marítima, control operativo y consulta de información disponible en sistemas institucionales, no implica que sea el órgano autor de la disposición reglamentaria impugnada ni que le corresponda, por sí mismo, definir el contenido normativo de tales obligaciones.
III.Sobre la relevancia constitucional del derecho a un ambiente sano y ecológicamente equilibrado, y los principios de progresividad y no regresión. El Servicio Nacional de Guardacostas estima indispensable dejar claramente establecido que la protección del ambiente marino-costero no constituye para esta institución una materia accesoria o marginal, sino una dimensión sustantiva del interés público comprometido en el ejercicio de sus funciones.
El artículo 50 de la Constitución Política reconoce el derecho de toda persona a un ambiente sano y ecológicamente equilibrado, y obliga al Estado a garantizar, defender y preservar dicho bien jurídico. La Sala Constitucional ha venido consolidando una línea jurisprudencial de tutela reforzada del ambiente, bajo criterios como prevención, objetivación de la tutela ambiental, precaución y, cada vez con mayor intensidad, no regresión ambiental.
En ese contexto, el principio de no regresión ambiental ha sido desarrollado en la doctrina jurídica costarricense como una exigencia conforme a la cual el ordenamiento y la jurisprudencia ambientales no deben retroceder respecto de los niveles de protección ya alcanzados, salvo que exista una justificación jurídicamente suficiente, razonable y compatible con la centralidad del interés público ambiental.
De forma complementaria, el principio de progresividad exige que la actuación estatal tienda al fortalecimiento gradual y constante de los mecanismos de protección ambiental, especialmente cuando están en juego ecosistemas frágiles, recursos naturales estratégicos o bienes de uso común cuya degradación puede resultar de difícil o imposible reversión.
Ambos principios se articulan de manera especialmente intensa en el ámbito marino-costero, por varias razones:
Primero, por la vulnerabilidad ecológica de los ecosistemas marinos y costeros.
Segundo, por la necesidad de asegurar el aprovechamiento sostenible de los recursos hidrobiológicos y evitar fenómenos de sobreexplotación, pesca ilegal o pérdida de trazabilidad.
Tercero, porque el control efectivo de la actividad pesquera no solo responde a finalidades económicas o administrativas, sino también a una función ambiental y de gobernanza pública.
Desde esa óptica, el Servicio Nacional de Guardacostas considera legítimo y jurídicamente relevante afirmar que, desde una perspectiva operativa, la existencia de sistemas de monitoreo y seguimiento de embarcaciones constituye una herramienta valiosa tanto para la protección de los recursos marinos como para la seguridad de la navegación, la trazabilidad de operaciones y la mejora de capacidades de vigilancia institucional.
Dicho lo anterior, corresponde igualmente precisar que el reconocimiento de la utilidad institucional de tales mecanismos no implica asumir como propia la decisión reglamentaria específica que el recurrente cuestiona en esta vía constitucional. El Servicio Nacional de Guardacostas no emitió el acto impugnado, no tiene potestad para reformarlo o derogarlo, y no le corresponde definir unilateralmente el alcance normativo del régimen aplicable a la flota de pesca deportiva y turística de mediana escala. Esa decisión se ubica en la competencia material de la autoridad sectorial correspondiente.
En consecuencia, la posición institucional del Servicio puede resumirse así: sí existe plena conciencia institucional del deber de proteger progresivamente el ambiente marino-costero y evitar retrocesos injustificados en su tutela; pero no existe identidad entre esa obligación constitucional compartida por el Estado y la autoría del acto reglamentario impugnado, que no provino del Servicio Nacional de Guardacostas.
La materia objeto del recurso revela, además, un aspecto fundamental: la protección efectiva del ambiente marino-costero y el control de la actividad pesquera exigen necesariamente coordinación interinstitucional.
En el caso del Servicio Nacional de Guardacostas, esa coordinación se manifiesta de forma concreta en su relación de trabajo con INCOPESCA, en tanto autoridad sectorial con competencia regulatoria y técnica en materia pesquera. Según ha sido puesto en conocimiento de esta Sala, el Servicio Nacional de Guardacostas cuenta con acceso operativo a información del sistema de monitoreo mediante un usuario espejo, el cual es consultado de manera diaria por el Centro de Operaciones y por la Sección de Inteligencia del Servicio Nacional de Guardacostas, con fines estrictamente funcionales y operativos.
Esa dinámica de coordinación responde a una lógica institucional de unión de esfuerzos estatales para mejorar la vigilancia, el control y la protección del recurso marino-costero, sin alterar la distribución legal de competencias. El convenio interinstitucional suscrito entre INCOPESCA y el Ministerio de Seguridad Pública, por medio del Servicio Nacional de Guardacostas (se adjunta copia), constituye precisamente una expresión estratégica de esa colaboración, al facilitar acceso al sistema, procesos de capacitación y mecanismos de apoyo funcional para fortalecer la fiscalización y la vigilancia marítima.
Asimismo, el propio régimen reglamentario del monitoreo satelital ubica el sistema bajo la órbita institucional de INCOPESCA y prevé acceso restringido para otras autoridades estatales, lo que confirma que la coordinación existe, pero no equivale a sustitución competencial.
Por ello, el Servicio Nacional de Guardacostas sí puede afirmar, con plena objetividad, lo siguiente:
1. que mantiene una vigilancia permanente de la flota pesquera desde el ámbito de sus funciones operativas, con o sin apoyo de sistemas tecnológicos de monitoreo; 2. que el uso de herramientas de seguimiento satelital fortalece las capacidades de control estatal, la protección del recurso y la seguridad de la navegación; 3. que la relación de coordinación con INCOPESCA se ha mantenido en términos de amplia colaboración, comunicación constante y articulación interinstitucional efectiva, lo que ha contribuido de forma significativa al cumplimiento del interés público marítimo-ambiental; y 4. que dicha coordinación no convierte al Servicio Nacional de Guardacostas en órgano autor o rector de la regulación impugnada.
Primero: Se contesta que el hecho primero es cierto solo en cuanto el Servicio Nacional de Guardacostas es una de las autoridades recurridas en el presente recurso y forma parte del aparato estatal con presencia operativa en el ámbito marítimo.
Es inexacto, sin embargo, en caso de que se pretenda atribuir al Servicio Nacional de Guardacostas la emisión, aprobación o derogatoria de la normativa reglamentaria impugnada, por cuanto dicha competencia no corresponde a esta institución.
Segundo: Se contesta que el hecho segundo es cierto parcialmente, en el sentido de que esta institución reconoce la relevancia constitucional del derecho a un ambiente sano y ecológicamente equilibrado y la necesidad de fortalecer la protección del recurso marino-costero. No obstante, se aclara que el Servicio Nacional de Guardacostas no dictó el acuerdo administrativo cuestionado ni ostenta competencia para definir, reformar o derogar por sí mismo el régimen jurídico del monitoreo satelital pesquero.
Tercero: Se contesta que el hecho tercero es cierto en parte, en cuanto el Servicio Nacional de Guardacostas mantiene coordinación operativa con INCOPESCA y consulta información del sistema de monitoreo mediante usuario espejo para fines institucionales de vigilancia y control. Sin embargo, esa circunstancia no modifica la distribución legal de competencias ni convierte al Servicio en ente rector del sistema ni en autoridad normativa de la materia.
Cuarto: Se contesta que el hecho cuarto es cierto parcialmente, en el tanto los sistemas de monitoreo constituyen una herramienta útil para robustecer la fiscalización, proteger los recursos marinos y contribuir a la seguridad de la navegación.
No obstante, corresponde aclarar que la eventual valoración constitucional sobre la suficiencia, alcance o regresividad de la regulación impugnada debe analizarse primordialmente respecto del órgano con competencia material para emitirla.
Quinto: Se contesta que el hecho quinto es falso si se entiende que el Servicio Nacional de Guardacostas incurrió en omisión normativa, desmantelamiento regulatorio o regresión jurídica por acto propio.
El Servicio no emitió criterio institucional que diera origen al acuerdo impugnado, ni participó como autoridad decisora en su aprobación o derogatoria.
Sexto: Se contesta que el hecho sexto es cierto únicamente en cuanto el Servicio Nacional de Guardacostas mantiene una actuación orientada a la vigilancia permanente del espacio marítimo, el control de embarcaciones y la colaboración con otras autoridades competentes. Se rechaza cualquier inferencia que le adjudique responsabilidad directa por la configuración normativa del régimen reglamentario cuestionado.
Sétimo: Se contesta que el hecho sétimo debe tenerse por negado en lo que exceda las competencias legales del Servicio Nacional de Guardacostas o le atribuya potestades regulatorias que la ley no le confiere.
Octavo y siguientes Se niegan o aclaran en los mismos términos anteriores, dejando establecido que:
el Servicio Nacional de Guardacostas sí posee un compromiso institucional con la tutela del ambiente marino-costero; sí participa en esquemas de coordinación interinstitucional con fines de control y vigilancia; sí considera útil y valioso el fortalecimiento de mecanismos tecnológicos de seguimiento de embarcaciones; pero no es el órgano emisor del acto administrativo-reglamentario impugnado ni el ente rector de esa regulación.
Según se desprende del recurso y de la documentación que lo acompaña, la disconformidad principal del recurrente se dirige contra la decisión contenida en el acuerdo de INCOPESCA AJDIP/162-2024, mediante la cual se derogó el Transitorio II que había fijado la aplicabilidad del reglamento a embarcaciones de pesca deportiva y turística de mediana escala, luego de la prórroga aprobada por el acuerdo de INCOPESCA AJDIP/312-2023.
Respecto de ese punto, el Servicio Nacional de Guardacostas se permite aclarar que:
no aprobó dicho acuerdo; no lo promovió como órgano decisor; no le corresponde jurídicamente su emisión; y no puede, por sí mismo, revertir, sustituir o redefinir su contenido.
En consecuencia, aun cuando esta Dirección General comprende la preocupación constitucional planteada por el recurrente en torno a la suficiencia de los mecanismos de control ambiental, la imputación directa al Servicio Nacional de Guardacostas carece de sustento competencial suficiente…”.
Solicita que se desestime el recurso planteado.

5. Acuerdo AJDIP/030-2023.

Asimismo, resulta necesario realizar una aclaración respecto del acuerdo identificado como AJDIP/312-2022, toda vez que dicho acuerdo contiene un error material en cuanto al año consignado en su numeración. En consecuencia, lo correcto es leer y entender dicho acuerdo como AJDIP/312-2023, circunstancia que fue debidamente consignada dentro del acta correspondiente a la Sesión Ordinaria N.° 61-2023 de la Junta Directiva del INCOPESCA, razón por la cual se hace de conocimiento de esa honorable Sala para los efectos jurídicos y administrativos correspondientes.
Adicionalmente, se aporta el oficio INCOPESCA-PE-DOPA-126-2022, documento técnico-administrativo relacionado con el mismo particular y que guarda estrecha vinculación con las actuaciones institucionales desarrolladas en torno a la implementación, seguimiento, control y vigilancia de embarcaciones pesqueras, constituyendo un insumo relevante para una adecuada comprensión del contexto administrativo y regulatorio aplicable al caso en conocimiento de esa Sala Constitucional.
Debe señalarse que las actuaciones administrativas y regulatorias aquí aportadas responden al ejercicio legítimo de las competencias legales atribuidas al INCOPESCA como ente rector en materia pesquera y acuícola, particularmente en lo concerniente al ordenamiento, seguimiento, control y fiscalización de las actividades pesqueras desarrolladas tanto por embarcaciones nacionales como extranjeras, procurando garantizar la sostenibilidad y aprovechamiento responsable de los recursos hidrobiológicos.
En virtud de lo anterior, se solicita respetuosamente tener por cumplido lo ordenado mediante la resolución supra indicada, así como incorporar la documentación aportada al expediente judicial de referencia para su respectiva valoración…”.
“… I. Sobre el alcance de la prevención La prevención emitida por esa Sala tiene como finalidad que las autoridades recurridas acrediten los fundamentos técnicos que sustentan la actuación administrativa cuestionada, específicamente en relación con la exigencia de dispositivos de localización satelital para embarcaciones de pesca turística y deportiva.
En ese sentido, resulta necesario precisar que, en lo que respecta al Ministerio de Obras Públicas y Transportes, la situación planteada no deriva de una decisión técnica discrecional adoptada por esta Administración, sino de la aplicación estricta del principio de legalidad y del régimen de distribución de competencias establecido en el ordenamiento jurídico vigente.
De conformidad con la información suministrada por la División Marítimo-Portuaria, órgano competente en la materia, el Ministerio de Obras Públicas y Transportes:
• No ha adoptado una decisión técnica propia respecto de la exigencia de dispositivos de localización satelital en embarcaciones pesqueras.
• Tampoco ha emitido estudios técnicos, diagnósticos o análisis especializados sobre la implementación de dichos sistemas, por cuanto dicha materia no forma parte de su ámbito competencial.
En efecto, la actuación del MOPT en materia de:
• certificación de navegabilidad, y • otorgamiento de zarpes Se encuentra delimitada a la verificación de condiciones técnicas de seguridad marítima, sin que comprenda la regulación o monitoreo de actividades pesqueras o el control tecnológico de dichas actividades.
Como fundamento técnico-administrativo de la actuación del Ministerio, se cuenta con el criterio emitido por la División Marítimo-Portuaria mediante oficio CARTA-MOPT-DVMP-2026-366, en el cual se establece que:
No existe habilitación normativa expresa que permita a la autoridad marítima exigir dispositivos de localización satelital como requisito para la navegabilidad o el otorgamiento de zarpes.
Conforme al artículo 11 de la Ley General de la Administración Pública, la Administración únicamente puede imponer obligaciones cuando exista norma que la faculte expresamente, por lo que la exigencia de dichos dispositivos en ausencia de regulación constituiría un exceso en el ejercicio de la potestad administrativa.
El monitoreo satelital de embarcaciones constituye una actividad técnica especializada vinculada al control de la actividad pesquera, competencia que el ordenamiento jurídico ha asignado a INCOPESCA y al Servicio Nacional de Guardacostas, no al MOPT.
En consecuencia, el sustento técnico de la actuación del MOPT no radica en la adopción de una política técnica propia sobre monitoreo satelital, sino en la correcta interpretación y aplicación del marco competencial y normativo vigente.
En atención expresa a lo solicitado por esa Sala, se hace constar que:
Este Ministerio no dispone de estudios técnicos, informes especializados o análisis sectoriales adicionales sobre la implementación de sistemas de localización satelital en embarcaciones de pesca turística o deportiva.
Lo anterior obedece a que la materia corresponde a la órbita técnica y regulatoria de INCOPESCA, conforme a la Ley N.° 8436.
Por tanto, la inexistencia de dichos estudios no constituye una omisión administrativa, sino una consecuencia directa de la delimitación competencial vigente.
De lo expuesto se concluye que:
El Ministerio de Obras Públicas y Transportes no ha adoptado una decisión técnica propia en relación con la exigencia de dispositivos de localización satelital, por no formar parte de su competencia.
La actuación administrativa cuestionada encuentra su sustento en un criterio técnico‑jurídico institucional, basado en el principio de legalidad y en la correcta delimitación de competencias.
No existen estudios técnicos adicionales, por tratarse de una materia ajena al ámbito funcional de esta Administración...”.
Solicita que se desestime el recurso planteado.
“… I. Consideración preliminar De previo, esta Dirección General estima necesario reiterar que el Servicio Nacional de Guardacostas forma parte del Ministerio de Seguridad Pública y ejerce funciones policiales especializadas en el ámbito marítimo, conforme a la Ley n.° 8000, Ley de Creación del Servicio Nacional de Guardacostas.
En ese marco, esta institución desarrolla labores de vigilancia, control, prevención, resguardo y protección en aguas jurisdiccionales costarricenses, así como acciones de coordinación interinstitucional con otras entidades públicas competentes, entre ellas el Instituto Costarricense de Pesca y Acuicultura.
No obstante, como fue expuesto en el informe inicial rendido ante esa Sala, el Servicio Nacional de Guardacostas no es el órgano emisor, proponente ni decisor de la disposición cuestionada por el recurrente. Tampoco ostenta potestad reglamentaria para definir, modificar, derogar o sustituir el régimen jurídico aplicable al sistema de monitoreo satelital de embarcaciones pesqueras.
La resolución que se atiende solicita aportar los estudios o criterios técnicos que dan sustento a la decisión cuestionada por el recurrente.
En atención a dicha prevención, esta Dirección General informa respetuosamente que, revisado el ámbito de participación del Servicio Nacional de Guardacostas en los hechos objeto del presente proceso, no consta que esta institución haya emitido estudio técnico, dictamen técnico, criterio técnico-regulatorio, recomendación formal o documento equivalente que haya servido como fundamento directo para la emisión, modificación o derogatoria de la decisión cuestionada.
Lo anterior obedece a que la decisión impugnada no fue dictada por el Servicio Nacional de Guardacostas, ni fue adoptada dentro de un procedimiento administrativo decisorio a cargo de esta institución. La materia vinculada con la regulación del sistema de seguimiento, localización o monitoreo satelital de embarcaciones pesqueras corresponde al ámbito competencial de la autoridad sectorial pesquera, sin perjuicio de las funciones policiales y operativas que el Servicio Nacional de Guardacostas ejerce en el espacio marítimo nacional.
III.Sobre la inexistencia de estudios o criterios técnicos propios del Servicio Nacional de Guardacostas que sustenten la decisión cuestionada
Esta Dirección General informa de manera expresa que el Servicio Nacional de Guardacostas no cuenta con estudios técnicos propios que hayan servido de sustento a la decisión cuestionada por el recurrente.
Asimismo, se aclara que esta institución:
1. No dictó la disposición cuestionada.
2. No aprobó la modificación normativa impugnada.
3. No promovió, como órgano decisor, la exclusión o inclusión de determinada flota dentro del régimen de monitoreo satelital.
4. No emitió criterio técnico-regulatorio que constituyera fundamento directo de la decisión cuestionada.
5. No posee competencia legal para sustituir, reformar o derogar la decisión adoptada por la autoridad sectorial competente.
Por consiguiente, no existe dentro del Servicio Nacional de Guardacostas un expediente técnico propio, dictamen técnico institucional o estudio especializado que pueda ser aportado como sustento de una decisión que no fue emitida por esta Dirección General.
Sin perjuicio de lo anterior, esta Dirección General sí considera pertinente reiterar que el Servicio Nacional de Guardacostas mantiene una relación de coordinación interinstitucional con INCOPESCA para el cumplimiento de fines de vigilancia, control, fiscalización y protección del recurso marino-costero.
En ese sentido, como documentación relacionada con la actuación institucional del Servicio Nacional de Guardacostas, se reitera el Convenio Marco de Cooperación Interinstitucional entre el Instituto Costarricense de Pesca y Acuicultura y el Ministerio de Seguridad Pública, por medio del Servicio Nacional de Guardacostas, ya referido en el informe inicial.
Dicho instrumento acredita la existencia de un marco de cooperación entre ambas instituciones, orientado a facilitar acciones conjuntas, coordinación operativa, apoyo funcional y colaboración en materia de vigilancia y control en aguas jurisdiccionales costarricenses.
No obstante, debe aclararse respetuosamente que dicho convenio no constituye un estudio técnico del Servicio Nacional de Guardacostas que haya sustentado la decisión cuestionada, sino un instrumento de coordinación interinstitucional que delimita y facilita la colaboración entre instituciones con competencias distintas.
Tal como se informó oportunamente a esa Sala, el Servicio Nacional de Guardacostas cuenta con acceso operativo a información del sistema de monitoreo mediante un usuario espejo, el cual es consultado por dependencias operativas institucionales para fines estrictamente funcionales, policiales y de vigilancia marítima.
Ese acceso permite fortalecer las capacidades de control estatal, apoyar labores de vigilancia, orientar actuaciones operativas y coadyuvar en la protección del recurso marino-costero. Sin embargo, dicho acceso operativo no convierte al Servicio Nacional de Guardacostas en órgano rector del sistema, ni en autoridad técnica reguladora de la materia pesquera, ni en órgano decisor de la disposición impugnada.
En consecuencia, el uso operativo de dicha herramienta no debe confundirse con la emisión de criterios técnicos regulatorios sobre el alcance, obligatoriedad, sujetos obligados, régimen transitorio o condiciones jurídicas del sistema de monitoreo satelital
Desde la perspectiva operativa del Servicio Nacional de Guardacostas, los sistemas de monitoreo, localización y seguimiento de embarcaciones constituyen herramientas útiles para fortalecer la vigilancia marítima, la seguridad de la navegación, la trazabilidad de actividades y la protección del recurso marino-costero.
Sin embargo, esa valoración operativa general no equivale a un criterio técnico-regulatorio sobre la decisión cuestionada, ni sustituye la competencia de la autoridad sectorial correspondiente para determinar el alcance normativo del sistema aplicable a cada flota.
Por ello, esta Dirección General reitera que el Servicio Nacional de Guardacostas mantiene plena disposición de coordinación interinstitucional, colaboración operativa y apoyo funcional dentro del marco de sus competencias legales, pero no puede atribuirse como propio el fundamento técnico de una decisión emitida por otra autoridad pública.
La protección efectiva del ambiente marino-costero y el control de la actividad pesquera requieren coordinación interinstitucional. Sin embargo, dicha coordinación no altera la distribución legal de competencias entre las instituciones recurridas.
El Servicio Nacional de Guardacostas ejerce funciones policiales y operativas en el ámbito marítimo. INCOPESCA, por su parte, ejerce competencias sectoriales en materia de ordenamiento, regulación y administración del recurso pesquero. De ahí que los estudios técnicos, criterios regulatorios o valoraciones especializadas que hayan sustentado la decisión cuestionada deben ser aportados por la autoridad que emitió o promovió dicha decisión, según corresponda.
En lo que respecta al Servicio Nacional de Guardacostas, se informa bajo juramento que no consta la emisión de estudios o criterios técnicos propios que hayan servido como fundamento directo para la decisión cuestionada por el recurrente…”.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. El recurrente impugna el acuerdo AJDIP/162-2024 del INCOPESCA, mediante el cual se derogó el Transitorio II del Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras, eximiendo a la flota de pesca turística y deportiva de mediana escala de la obligatoriedad de instalar dispositivos de localización satelital. Alega que dicha omisión vulnera el derecho a un ambiente sano y ecológicamente equilibrado (artículo 50, Constitucional) y violenta el principio de no regresión ambiental, al debilitar los mecanismos de control sobre la explotación del recurso marino. Asimismo, reprocha al MOPT la falta de exigencia de estos dispositivos para el otorgamiento de certificados de navegabilidad y zarpes.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el derecho fundamental a un ambiente sano y ecológicamente equilibrado. El artículo 50, de la Constitución Política, reconoce el derecho de toda persona a disfrutar de un ambiente sano y ecológicamente equilibrado y, correlativamente, impone al Estado el deber jurídico de garantizar, defender y preservar dicho bien constitucional. Desde hace varias décadas, esta Sala ha reconocido que el ambiente constituye un bien jurídico de naturaleza colectiva cuya tutela posee un carácter preferente dentro del Estado Social y Democrático de Derecho, en razón de su estrecha vinculación con la dignidad humana, la salud pública, el desarrollo sostenible y la protección de las generaciones presentes y futuras. Precisamente por ello, la protección constitucional del ambiente no se agota en la prevención de daños ya consumados, sino que comprende el deber permanente de organizar la actuación estatal mediante políticas públicas, instrumentos regulatorios y mecanismos administrativos que permitan prevenir riesgos, controlar actividades potencialmente degradantes y asegurar el aprovechamiento racional de los recursos naturales.
La jurisprudencia constitucional ha destacado que la protección ambiental constituye una obligación positiva del Estado, lo que implica no solamente abstenerse de autorizar actividades lesivas para los ecosistemas, sino adoptar medidas efectivas dirigidas a fortalecer progresivamente los mecanismos de fiscalización, control y vigilancia de los recursos naturales. En ese contexto, la utilización de herramientas tecnológicas destinadas a mejorar la supervisión administrativa de actividades potencialmente generadoras de impacto ambiental constituye una manifestación del deber estatal de emplear los medios idóneos disponibles para hacer efectivo el derecho fundamental reconocido en el artículo 50, Constitucional.
IV.Sobre los principios de prevención, precaución, progresividad y no regresión ambiental. La evolución del Derecho Ambiental ha conducido a reconocer que la protección efectiva del ambiente exige una actuación anticipada del Estado frente a riesgos que podrían comprometer el equilibrio de los ecosistemas. Por ello, esta Sala ha incorporado de manera constante los principios de prevención y precaución como parámetros interpretativos del artículo 50 constitucional. El principio de prevención obliga a las autoridades públicas a adoptar medidas destinadas a evitar la producción de daños cuando existe suficiente conocimiento acerca de los riesgos asociados a determinada actividad. Por su parte, el principio precautorio autoriza e incluso exige la intervención estatal cuando, aun existiendo incertidumbre científica, puedan producirse daños graves o irreversibles al ambiente. A estos principios se suman los de progresividad y no regresión ambiental, ampliamente desarrollados tanto por el Derecho Internacional de los Derechos Humanos como por la jurisprudencia constitucional costarricense.
Esta Sala ha señalado que el principio de progresividad impone al Estado el deber de fortalecer gradualmente los niveles de protección ambiental alcanzados, mediante el perfeccionamiento constante de los instrumentos jurídicos, administrativos y técnicos destinados a garantizar el disfrute efectivo del derecho fundamental al ambiente. Como manifestación complementaria de dicho principio, la prohibición de regresión ambiental impide que las autoridades públicas reduzcan, sin una justificación objetiva, suficiente y constitucionalmente razonable, el grado de protección previamente alcanzado.
No obstante, la Sala también ha reconocido que el principio de no regresión no posee carácter absoluto. La Administración conserva un margen de configuración normativa para modificar políticas públicas, reorganizar instrumentos regulatorios o sustituir mecanismos administrativos, siempre que tales decisiones se encuentren sustentadas en razones objetivas, técnicamente demostrables y compatibles con el deber constitucional de protección ambiental. Por ello, no toda modificación normativa constituye por sí misma una regresión constitucionalmente prohibida. Lo determinante consiste en verificar si la medida cuestionada produce efectivamente una disminución injustificada del nivel de protección existente o si, por el contrario, responde a una redefinición técnica razonable que mantiene -o incluso fortalece- la eficacia del sistema de tutela ambiental. En consecuencia, cuando se cuestiona constitucionalmente una decisión administrativa que modifica un instrumento de protección ambiental previamente instaurado, el examen de esta jurisdicción debe orientarse a determinar si la Administración acreditó, mediante fundamentos objetivos y verificables, que la modificación resulta compatible con el deber de protección reforzada impuesto por el artículo 50 de la Constitución Política.
V.Sobre la discrecionalidad técnica de la Administración y el alcance del control constitucional. El Instituto Costarricense de Pesca y Acuicultura sostiene que la decisión impugnada constituye una manifestación de la discrecionalidad técnica atribuida por la Ley de Pesca y Acuicultura para regular el aprovechamiento sostenible de los recursos hidrobiológicos. Al respecto, esta Sala ha reconocido que determinadas materias de alta complejidad científica corresponden primariamente a la Administración activa, la cual dispone de un margen de apreciación técnica para seleccionar las medidas regulatorias que estime más adecuadas al cumplimiento del interés público. Sin embargo, esa discrecionalidad no constituye una potestad arbitraria ni exime a la Administración del deber de motivar suficientemente sus decisiones. Particularmente cuando el acto administrativo incide sobre la protección de derechos fundamentales o modifica instrumentos previamente establecidos para la tutela del ambiente, la motivación adquiere una intensidad reforzada. Ello supone que la Administración debe exteriorizar las razones técnicas, científicas, ambientales o especializadas que justifican la decisión adoptada, de manera que sea posible verificar su racionalidad, proporcionalidad y conformidad con el orden constitucional.
En consecuencia, el control que corresponde ejercer a esta Sala no consiste en sustituir el criterio técnico de la Administración por el propio del Tribunal Constitucional. La función de esta jurisdicción consiste, más bien, en verificar que la decisión administrativa haya sido adoptada dentro del marco competencial correspondiente, que se encuentre suficientemente motivada y que la valoración técnica invocada resulte objetivamente verificable, razonable y compatible con el contenido esencial del derecho fundamental cuya tutela se reclama. Precisamente desde esa perspectiva deberá analizarse la prueba incorporada mediante la resolución para mejor resolver, a efectos de determinar si el acuerdo administrativo impugnado encuentra sustento en estudios técnicos suficientes o si, por el contrario, la modificación del régimen de monitoreo satelital respondió a consideraciones ajenas a la protección reforzada que exige el artículo 50 de la Constitución Política.
VI.Sobre las competencias constitucional y legalmente atribuidas a las autoridades recurridas. Como cuestión previa, resulta indispensable delimitar el ámbito de competencias de cada una de las autoridades recurridas, pues el control constitucional únicamente puede recaer sobre actuaciones u omisiones atribuibles al órgano competente. La Ley de Pesca y Acuicultura, Ley N° 8436, así como la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, atribuyen a dicho ente la rectoría técnica en materia de ordenamiento, administración, conservación, seguimiento, control y aprovechamiento sostenible de los recursos hidrobiológicos. Dentro de esas competencias se encuentra la facultad de establecer los mecanismos técnicos necesarios para el seguimiento y vigilancia de las embarcaciones pesqueras, incluyendo la utilización de tecnologías destinadas a fortalecer la fiscalización de la actividad pesquera.
Consecuentemente, la decisión relativa a determinar cuáles embarcaciones deben incorporarse al Sistema de Monitoreo Satelital constituye una competencia propia del INCOPESCA. Por su parte, el Ministerio de Obras Públicas y Transportes ejerce competencias vinculadas con la autoridad marítima, la certificación de navegabilidad y la autorización de zarpes, conforme a la Ley General de Puertos, los Reglamentos sobre Certificación de Embarcaciones y demás normativa especial. De los informes rendidos bajo juramento se desprende que dicho Ministerio no posee potestad normativa para imponer obligaciones relacionadas con el monitoreo satelital de embarcaciones pesqueras y que su actuación se encuentra limitada por el principio de legalidad contenido en el artículo 11, de la Ley General de la Administración Pública. En igual sentido, el Servicio Nacional de Guardacostas ejerce funciones eminentemente policiales, preventivas y operativas dentro del espacio marítimo nacional.
Aunque participa activamente en la fiscalización pesquera mediante mecanismos de coordinación institucional con el INCOPESCA y posee acceso operativo al Sistema de Monitoreo Satelital, ello no lo convierte en autoridad reguladora del régimen jurídico aplicable a las distintas categorías de embarcaciones. En consecuencia, la decisión administrativa impugnada resulta jurídicamente atribuible únicamente al Instituto Costarricense de Pesca y Acuicultura. Por ello, el análisis constitucional deberá concentrarse fundamentalmente sobre la actuación desarrollada por esa institución, sin perjuicio de examinar posteriormente si existe alguna consecuencia indirecta respecto de las demás autoridades recurridas.
VII.Sobre la prueba para mejor resolver ordenada por esta Sala. Mediante resolución de las 16:51 horas del 25 de mayo de 2026, esta Sala estimó necesario solicitar, como prueba para mejor resolver, los estudios o criterios técnicos que sirvieron de fundamento a la decisión cuestionada. La finalidad de dicha diligencia probatoria era determinar si la derogatoria del Transitorio II del Acuerdo AJDIP-076-2022 obedeció a una valoración técnica especializada capaz de justificar constitucionalmente la modificación del régimen de monitoreo satelital. No se trataba, por consiguiente, de verificar la existencia formal del acuerdo administrativo, circunstancia que nunca estuvo en discusión, sino de constatar si el ejercicio de la potestad reglamentaria había estado precedido de una motivación técnica suficiente. La respuesta brindada por las autoridades recurridas permite arribar a las siguientes conclusiones.
El Ministerio de Obras Públicas y Transportes manifestó expresamente que no elaboró estudios técnicos sobre el particular, al tratarse de una materia ajena a sus competencias legales. El Servicio Nacional de Guardacostas informó igualmente que no emitió criterio técnico alguno relacionado con la exclusión de la flota turística y deportiva del sistema obligatorio de monitoreo satelital. Ambas respuestas resultan coherentes con la distribución de competencias prevista en el ordenamiento jurídico y descartan que dichas instituciones hubieran participado técnicamente en la adopción de la decisión cuestionada. En consecuencia, el análisis de la prueba debe concentrarse exclusivamente sobre la documentación aportada por el Instituto Costarricense de Pesca y Acuicultura.
VIII.Valoración de la documentación aportada por el INCOPESCA. En cumplimiento de la prevención formulada por esta Sala, el INCOPESCA remitió copia de diversos acuerdos de Junta Directiva relacionados con la evolución normativa del Sistema de Monitoreo Satelital, así como el oficio INCOPESCA-PE-DOPA-126-2022. La Sala observa que dicha documentación permite reconstruir el proceso administrativo mediante el cual fue implementándose progresivamente el sistema de seguimiento satelital. Asimismo evidencia que, desde el año 2020, la política institucional había estado orientada hacia una ampliación gradual del universo de embarcaciones sujetas al monitoreo tecnológico. La documentación remitida por el Instituto Costarricense de Pesca y Acuicultura incorpora el oficio INCOPESCA-PE-DOPA-126-2022, elaborado por la Dirección de Ordenamiento Pesquero y Acuícola con participación de la Asesoría Jurídica, el cual contiene apreciaciones técnicas relativas a la utilidad del sistema de monitoreo satelital para fortalecer el seguimiento, control y vigilancia de la actividad pesquera, combatir la pesca ilegal, no declarada y no reglamentada, y favorecer el aprovechamiento sostenible de los recursos hidrobiológicos.
Sin embargo, dicho criterio fue emitido con ocasión de una solicitud de prórroga para la implementación gradual del sistema y concluye recomendando únicamente la ampliación del plazo para la instalación de las balizas satelitales. No contiene una evaluación técnica dirigida a justificar la posterior derogatoria del Transitorio II acordada mediante el AJDIP-162-2024, ni desarrolla un análisis científico o especializado que explique por qué la exclusión de la flota turística y deportiva del régimen obligatorio de monitoreo satelital resulta compatible con el nivel de protección ambiental previamente alcanzado.
IX.Análisis de la documentación técnica aportada por el INCOPESCA. En cumplimiento de la prevención formulada por esta Sala, el Instituto Costarricense de Pesca y Acuicultura remitió copia de diversos acuerdos adoptados por su Junta Directiva en relación con la implementación del Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras, así como el oficio INCOPESCA-PE-DOPA-126-2022, elaborado por la Dirección de Ordenamiento Pesquero y Acuícola con participación de la Asesoría Jurídica. El examen integral de esa documentación permite establecer que la Administración sí incorporó dentro del expediente administrativo un criterio de carácter técnico-administrativo relacionado con la implementación del sistema de monitoreo satelital. En efecto, el citado oficio desarrolla diversas consideraciones acerca de la utilidad del Sistema de Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras como instrumento destinado a fortalecer las labores de fiscalización de la actividad pesquera, combatir la pesca ilegal, no declarada y no reglamentada, mejorar la coordinación interinstitucional y favorecer el aprovechamiento sostenible de los recursos hidrobiológicos.
Asimismo, reconoce la importancia del monitoreo satelital como mecanismo tecnológico para fortalecer la gestión pesquera nacional y armonizarla con los compromisos regionales asumidos por el Estado costarricense. No obstante, la Sala advierte que dicho criterio técnico fue emitido dentro de un contexto administrativo claramente delimitado. Su objeto consistía en valorar la solicitud formulada por representantes del sector de pesca turística y deportiva para ampliar el plazo previsto para la implementación obligatoria del sistema de monitoreo satelital. Como resultado de esa valoración, el criterio técnico concluyó recomendando la concesión de una prórroga temporal, con el propósito de permitir la adecuada implementación operativa del sistema y facilitar la adaptación progresiva del sector regulado.
Consecuentemente, el contenido del oficio evidencia que el órgano técnico del propio INCOPESCA consideró conveniente mantener la implementación del sistema de monitoreo satelital, recomendando únicamente diferir temporalmente su entrada en vigencia respecto de determinado grupo de embarcaciones. En ese sentido, la documentación remitida demuestra la existencia de un criterio técnico favorable al sistema de monitoreo satelital, pero no constituye, por sí misma, un fundamento técnico que justifique la decisión posteriormente adoptada mediante el Acuerdo AJDIP-162-2024.
X.Sobre la correspondencia entre el criterio técnico aportado y la decisión administrativa impugnada. Precisamente porque el oficio INCOPESCA-PE-DOPA-126-2022 contiene apreciaciones técnicas relevantes, corresponde determinar si existe una relación de congruencia entre ese criterio especializado y la decisión administrativa cuya constitucionalidad se cuestiona en este proceso. Al respecto, la Sala observa que el objeto del presente recurso no consiste en revisar la legalidad de la prórroga recomendada durante el año 2022, sino la decisión adoptada posteriormente por la Junta Directiva del INCOPESCA mediante el Acuerdo AJDIP-162-2024, mediante la cual se derogó el Transitorio II del Acuerdo AJDIP-076-2022 y se eliminó la entrada en vigencia del régimen que preveía incorporar obligatoriamente a la flota turística y deportiva de mediana escala al sistema de monitoreo satelital. Desde esa perspectiva, el criterio técnico aportado y el acto administrativo impugnado no poseen identidad material.
Mientras el oficio PE-DOPA-126-2022 parte de la premisa de que el monitoreo satelital constituye un instrumento adecuado para fortalecer la fiscalización pesquera y recomienda únicamente ampliar el plazo para su implementación, el Acuerdo AJDIP-162-2024 adopta una decisión distinta, consistente en derogar el régimen transitorio que establecía esa futura incorporación obligatoria. La Sala no desconoce que la Administración puede modificar las decisiones previamente adoptadas ni que la potestad reglamentaria comprende la facultad de revisar los instrumentos normativos cuando ello resulte necesario para la adecuada satisfacción del interés público. Sin embargo, cuando la Administración modifica el sentido de una política pública previamente sustentada en criterios técnicos, corresponde exteriorizar las razones objetivas que justifican ese cambio de orientación.
En el presente asunto, la documentación aportada no permite identificar un estudio, informe técnico, evaluación científica o criterio especializado posterior al oficio PE-DOPA-126-2022 que explique cuáles circunstancias técnicas llevaron a sustituir la recomendación inicial de implementación gradual por la posterior derogatoria del régimen transitorio. Existe, por consiguiente, una ruptura entre el criterio técnico incorporado al expediente y la decisión finalmente adoptada por la Junta Directiva, sin que esa transición aparezca respaldada mediante una motivación técnica suficientemente explicita.
XI.Sobre la motivación técnica reforzada de los actos administrativos con incidencia ambiental. Esta Sala ha reconocido reiteradamente que la Administración dispone de un margen de discrecionalidad técnica para regular materias complejas cuya definición requiere conocimientos científicos o especializados. Sin embargo, la existencia de discrecionalidad técnica no excluye el deber constitucional de motivación. Por el contrario, cuando el ejercicio de esa potestad incide sobre mecanismos diseñados para la protección del ambiente, la exigencia de motivación adquiere un contenido reforzado, derivado del artículo 50 de la Constitución Política y de los principios de objetivación de la tutela ambiental, prevención y progresividad. En tales supuestos, la Administración no está obligada a mantener indefinidamente una determinada regulación, pero sí debe demostrar, mediante fundamentos objetivos y verificables, que la modificación introducida resulta compatible con el nivel de protección ambiental que el ordenamiento constitucional exige preservar.
Precisamente por ello esta Sala dispuso, como prueba para mejor resolver, la remisión de los estudios o criterios técnicos que sirvieran de fundamento para la decisión cuestionada. La documentación aportada demuestra que existieron criterios técnicos favorables a la implementación gradual del sistema de monitoreo satelital; sin embargo, no acredita que la decisión posterior de derogar el régimen transitorio hubiera estado precedida por una nueva evaluación técnica que analizara las consecuencias ambientales, regulatorias o de fiscalización derivadas de esa modificación. La motivación consignada en el propio Acuerdo AJDIP-162-2024 se refiere principalmente a la inexistencia de consenso con el sector regulado, a la conveniencia de continuar el proceso de elaboración normativa y a razones de oportunidad administrativa. Sin desconocer la relevancia institucional de tales circunstancias, la Sala estima que ellas no sustituyen la necesidad de acreditar, mediante elementos técnicos especializados, que la modificación del régimen de monitoreo satelital mantiene un nivel equivalente de protección del recurso pesquero y del ambiente.
XII.Aplicación de los principios de progresividad y no regresión al caso concreto. La Sala estima que el presente asunto no debe resolverse a partir de la premisa de que toda modificación del régimen jurídico aplicable al monitoreo satelital constituye, por sí misma, una regresión ambiental constitucionalmente prohibida. Como se indicó anteriormente, el principio de no regresión no impide a la Administración revisar, modificar o sustituir instrumentos regulatorios cuando ello responda a razones objetivas, técnicamente justificadas y compatibles con el deber estatal de protección ambiental. El problema constitucional del presente caso radica en un aspecto distinto. El expediente administrativo evidencia que el propio órgano técnico del INCOPESCA había considerado conveniente la implementación progresiva del sistema de monitoreo satelital respecto de la flota turística y deportiva, recomendando únicamente ampliar el plazo para hacer efectiva esa obligación.
Posteriormente, la Junta Directiva adoptó una decisión regulatoria diferente al derogar el régimen transitorio correspondiente. No obstante, la Administración no acreditó que entre una y otra decisión hubiera mediado una nueva valoración técnica que explicara las razones científicas, ambientales, pesqueras o regulatorias que justificaban abandonar el esquema inicialmente recomendado. En consecuencia, esta Sala no concluye que la derogatoria del Transitorio II resulte contrario a la Constitución Política por el solo hecho de modificar el régimen reglamentario vigente, sino porque la Administración no logró demostrar, mediante una motivación técnica suficiente, que dicha modificación preservaba el nivel de protección ambiental exigido por el artículo 50 de la Constitución Política. Esa insuficiencia de motivación impide a esta jurisdicción verificar que el ejercicio de la potestad reglamentaria se desarrolló dentro de los parámetros de objetividad, razonabilidad y protección reforzada que deben regir toda actuación administrativa con incidencia directa sobre el ambiente.
Se advierte que el cumplimiento de esta sentencia no implica que el Instituto deba adoptar una determinada solución regulatoria, correspondiéndole, en el ejercicio de las competencias que el ordenamiento jurídico le atribuye, definir el régimen aplicable al seguimiento, control y vigilancia de las embarcaciones de pesca turística y deportiva de mediana escala, siempre que la decisión que finalmente adopte se encuentre debidamente sustentada en criterios técnicos objetivos, suficientes y verificables, conforme a los parámetros desarrollados en esta sentencia.
XIII.Sobre la situación jurídica del Ministerio de Obras Públicas y Transportes y del Servicio Nacional de Guardacostas. Respecto de estas autoridades, el recurso no puede prosperar. Ambas instituciones acreditaron que la decisión cuestionada no fue emitida dentro del ámbito de sus competencias. Asimismo demostraron que carecen de potestad normativa para imponer, modificar o derogar el régimen jurídico del monitoreo satelital de embarcaciones pesqueras. El Ministerio de Obras Públicas y Transportes actúa conforme al principio de legalidad al limitar los requisitos para la certificación de navegabilidad y el otorgamiento de zarpes a aquellos expresamente previstos por el ordenamiento jurídico. De igual manera, el Servicio Nacional de Guardacostas desarrolla funciones de vigilancia marítima y coordinación operativa con el INCOPESCA, sin ostentar competencia para definir el contenido del régimen reglamentario impugnado. En consecuencia, no se acredita lesión constitucional atribuible a dichas autoridades.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente respecto del Instituto Costarricense de Pesca y Acuicultura, al adoptar el Acuerdo AJDIP-162-2024 sin acreditar, mediante una motivación técnica suficiente que la derogatoria del Transitorio II del Acuerdo AJDIP-076-2022 resultaba compatible con el deber constitucional de protección del ambiente y con los principios de objetivación, prevención, progresividad y no regresión ambiental. En consecuencia, se ordena a Nelson Peña Navarro en su condición de Presidente Ejecutivo del Instituto Costarricense de Pesca y Acuicultura (INCOOPESCA), que, dentro del plazo de seis meses, contado a partir de la notificación de esta sentencia, complete la motivación técnica que sustente el Acuerdo AJDIP-162-2024 o, en su defecto, adopte un nuevo acuerdo debidamente motivado, para lo cual deberá incorporar y valorar los estudios científicos, técnicos, ambientales y regulatorios que resulten pertinentes, de forma que permita verificar objetivamente que la regulación adoptada satisface el deber constitucional de protección del ambiente.
Se declara sin lugar el recurso respecto del Ministerio de Obras Públicas y Transportes y del Servicio Nacional de Guardacostas. Se advierte a los recurridos que de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Pesca y Acuicultura al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de fundamento a esta declaratoria, los cuales se liquidarán en la vía de ejecución de sentencia de lo contencioso administrativo, si otra cosa no correspondiere.- Fernando Castillo V.
