PROCEEDING: WRIT OF AMPARO (RECURSO DE AMPARO) RESOLUCIÓN Nº 2026028443 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the twenty-eighth of July, two thousand twenty-six.

Writ of amparo (recurso de amparo) filed by Nombre01, national identification number (cédula de identidad) CED01, against the TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.

Whereas:

  1. 1By written submission entered into the Judicial Case Management System of this Chamber at 17:46 hours on July 7, 2026, the petitioner files a writ of amparo against the TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, and states: "I. FACTS. 1. In the full-trial proceeding under expediente 23-003998-1027-CA, pending before the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, Nombre02 requested intra-procedural precautionary measures (medidas cautelares) to suspend the effects of subsection b) of Article VII of Ordinary Session N° 185-2019 of the Municipal Council of the District of Cóbano (November 12, 2019), which ordered the demolition of structures and the cancellation of the maritime-terrestrial zone (Zona Marítimo Terrestre, ZMT) concession (concesión) granted in 2004 over a parcel at Playa Santa Teresa de Cóbano. 2.The plaintiff's requests for precautionary measures were limited, in essence, to suspending the demolition of structures, the cancellation of the concession, an administrative notice regarding gates, and—in a subsequent amendment—the de-registration from the public registry (desinscripción registral) and the engagement of a notary through SICOP. In none of the petitioner's submissions was it requested that the Municipal Council should provide cooperation to regularize business permits or licenses. 3. By ruling N° 2026002926 of May 11, 2026, the Tribunal partially granted the precautionary measure and, as a counter-security (contracautela), ordered Nombre02 to regularize "all permits and licenses" before the Municipal Council of the District of Cóbano within three months, expressly warning the respondent entity that it "must provide its cooperation and act in good faith for said regularization," under penalty of having the injunctive relief (tutela) lifted. 4.Nombre02 has never held a municipal business license (patente comercial) or tourism operating license to carry on the business of luxury house rentals on the parcel subject to the concession. The tourism activity has historically been conducted without the corresponding municipal permit, even while the concession was in force and all the more so after its administrative cancellation in 2019. 5. The cancellation of the concession agreed upon in Ordinary Session N° 185-2019 was based on the finding of serious violations of the applicable construction regulations within the maritime-terrestrial zone and encroachment upon protected areas. These violations were detected in administrative proceeding N° 002-ODPA-CMDC-IM-2019. These violations and infractions continue to this day, despite the administratively final cancellation of the concession and the subsequent de-registration from the public registry. 6.Precautionary measures regarding the same facts had previously been denied. In June 2023 (expediente 23-002188-1027-CA, Voto N° 314-2023), the Tribunal entirely denied a request for an urgent interim measure (medida cautelar provisionalísima) filed by COLEMU S.A. In February 2025, within the present case, only very limited protection was granted (solely an order to refrain from demolishing structures within the concession area). However, in May 2026, the injunctive relief was significantly expanded—including the municipal cooperation order—without any substantial change in the facts or the legal situation that could justify such an expansion. 7. Ruling N° 2026002926 was not appealed by the Municipal Administrator (Intendente Municipal) of Cóbano. II. BACKGROUND AND CONTEXT OF THE PRESENT WRIT OF AMPARO. Additionally, the following factual context is particularly serious and relevant to the admissibility of this writ: The agreement canceling the concession granted to COLEMU S.A. was adopted by the Municipal Council of the District of Cóbano through subsection b) of Article VII of Ordinary Session N° 185-2019, held on November 12, 2019.That administrative agreement was subsequently upheld by the Tribunal Contencioso Administrativo in judgment N. 66-2022 of February 24, 2023, thereby becoming final at the administrative level. Notwithstanding the foregoing, since Mr. Ronny José Montero Orozco assumed the office of Municipal Administrator in May 2024, he has maintained a systematic pattern of obstruction and delay in the execution of said agreement, with the active complicity of the municipality's legal advisor, attorney Aralyn Villegas Ruiz. Despite the repeated and formal requests of the Municipal Council of the District of Cóbano to proceed with the execution of the cancellation agreement, the Municipal Administrator has avoided fulfilling his legal duty. Particularly relevant is what occurred with ruling N° 2026002926 of May 11, 2026. Once notified of said ruling, the Municipal Administrator deliberately chose not to file the appeal that was available under the law.Not only did he fail to do so, but he informed the Municipal Council of the existence of the ruling only two weeks after having been notified of it. When called upon to explain why he did not appeal, he refused to provide any explanation and falsely claimed that "no appeal was available," despite the fact that an appeal was indeed available and that a prior precedent already existed in which a request for precautionary measures on substantially similar grounds had been denied by this very Tribunal in June 2023 (Voto N° 314-2023), with no relevant change in the facts or the legal situation of the case. This deliberate conduct by the Municipal Administrator and the institutional legal advisor resulted in the municipality failing to exercise its right of defense in judicial proceedings, thereby allowing a ruling that imposes unrequested obligations upon the respondent municipal entity—and that directly affects the public interest in the protection of the maritime-terrestrial zone—to become final without appropriate institutional opposition.It is also worth noting that, as is publicly known, the sale of the ZMT concession was negotiated by COLEMU S.A. for the sum of thirty million United States dollars in 2021, but the transaction could not be completed due to the ratification of the concession cancellation agreement; furthermore, notwithstanding the cancellation agreement, the houses constructed within the concession area are rented to tourists for up to ten thousand dollars per night, all without a municipal business license and without COLEMU S.A. paying any sum for its commercial operations to the Municipality or to the Dirección General de Tributación Directa. The Municipal Administrator, despite being aware of the situation, has taken no action to prevent this "off-the-books" vacation rental operation from continuing to function to this day. III. GRIEVANCES AND CONSTITUTIONAL VIOLATIONS. A. Standing of the petitioner.The undersigned, in his capacity as a council member (Concejal) of the Municipal Council of the District of Cóbano, has standing to file the present writ of amparo. The challenged judicial ruling directly affects administrative acts issued by the Council of which he is a member, and the regime protecting the maritime-terrestrial zone, whose administration is the responsibility of the municipality. When the legal representative of the municipality—the Municipal Administrator—deliberately refrains from exercising available ordinary remedies, it falls upon the members of the collegiate body to seek constitutional jurisdiction to protect institutional legality and the public interest, all the more so when such omission has been accompanied by conduct involving the concealment of information and false statements made before the Council itself. B. Violation of the principle of congruence and due process (arts. 39 and 41 of the Constitution).The challenged ruling flagrantly violates the principle of procedural congruence (congruencia procesal) by granting, under the guise of a counter-security, a measure not requested by the plaintiff that imposes upon the respondent Administration an affirmative obligation (to actively cooperate in good faith for the regularization of business permits and licenses) that substantially alters the subject matter of the precautionary proceedings and the procedural balance between the parties. The Tribunal cannot, under the pretext of balancing a precautionary measure, create new and unrequested obligations that materially favor one of the parties. C. Violation of the principle of legality and municipal autonomy (arts. 169, 170, and 172 of the Constitution). By ordering the Municipal Council of the District of Cóbano to "provide its cooperation and act in good faith" so that COLEMU S.A. may regularize its business permits and licenses in connection with a concession that has been canceled and de-registered, the Tribunal compels the municipality to assist in the perpetuation of an activity that never held a municipal operating permit and that is carried out in violation of the serious and persistent breaches of the maritime-terrestrial zone regime.This constitutes an undue judicial intrusion into the sphere of municipal administrative competence. D. Violation of the principle of proportionality and continuing harm to the public interest in the ZMT. The cancellation of the concession in 2019 was issued precisely because serious violations of the construction regulations applicable within the ZMT and encroachment upon protected areas had been established. These infractions have not ceased. To this day, the structures remain standing and the property continues to be commercially exploited without a valid concession title or municipal operating permit, all to the detriment of the public interest that the municipality has a constitutional and legal duty to protect. The cooperation order contained in the May 2026 ruling has the effect of freezing and perpetuating a situation of serious harm to the maritime-terrestrial public domain. Using the counter-security mechanism to compel the Administration to cooperate in the regularization of an activity that never held a municipal permit and that rests upon continuing violations of the ZMT generates a current, serious, and unjustified harm to the public interest.E. Violation of the constitutional right to protection of the environment and natural resources (Article 50 of the Constitution). Article 50 of the Constitution recognizes the right of every person to a healthy and ecologically balanced environment and obliges the State to guarantee the protection, conservation, and sustainable use of natural resources. The maritime-terrestrial zone constitutes a specially protected public domain asset, whose integrity must be preserved for the benefit of present and future generations. The cancellation of the concession in 2019 was issued precisely because of serious construction violations and encroachment upon protected areas within the maritime-terrestrial zone. These infractions persist to this day. By ordering the municipality to actively cooperate in regularizing an activity carried out without a municipal permit and on the basis of continuing environmental violations, ruling N° 2026002926 has the effect of perpetuating and consolidating environmental harm to the detriment of the public interest protected by Article 50 of the Constitution.Precautionary relief cannot be used to maintain or facilitate situations that damage the environment and natural resources. By imposing upon the municipality a duty to cooperate in the regularization of an activity built upon serious and persistent violations of the maritime-terrestrial zone, the Tribunal is violating the constitutional mandate of environmental protection and the principle of in dubio pro natura that governs in this area. F. Violation of the principle of administrative legality and the maritime-terrestrial zone regime arising from the order to maintain Nombre02 in use and enjoyment of the area (subsection I of the ruling). Subsection I of ruling N° 2026002926 orders the Municipal Council of the District of Cóbano "to maintain Nombre02 Nombre03 in the use and enjoyment of the area corresponding to the canceled concession, and not to evict her or demolish the structures built on said land for as long as the granted injunctive relief remains in force." This order is manifestly contrary to the principle of administrative legality and to the legal regime of the maritime-terrestrial zone for the following reasons: First, the concession granted to Nombre02 was canceled by a final agreement of the Municipal Council as of November 12, 2019, an agreement that was subsequently upheld by the Tribunal Contencioso Administrativo in February 2022.Furthermore, the registry inscription of the concession expired on November 3, 2024, and has already been de-registered from the National Registry (Registro Nacional). Therefore, there is currently no valid concession title supporting Nombre02's continued presence in the area. Second, pursuant to Ley N° 6043 (Ley sobre la Zona Marítimo Terrestre) and its regulations, the use and enjoyment of the maritime-terrestrial zone by private individuals may only take place under a valid and duly registered concession. Allowing a private party to remain in possession and use of a public domain asset without a valid concession title constitutes a direct violation of the principle of legality enshrined in Article 11 of the Constitution and in the Ley General de Administración Pública. Third, the judicial order to maintain COLEMU S.A. in the use and enjoyment of the area, despite the final cancellation of the concession, has the effect of preventing the municipality from exercising its powers to recover the public domain and to enforce its final administrative acts, in clear prejudice to the public interest and to the constitutional mandate for the protection of natural resources contained in Article 50 of the Constitution.Fourth, said order exceeds the limits of a legitimate precautionary measure, since instead of provisionally preserving the subject matter of the proceedings, it consolidates and perpetuates a situation of occupation and use of the maritime-terrestrial zone without a valid title, to the detriment of the constitutional and legal rules governing this public domain asset (bien demanial). For the reasons stated, subsection I of ruling N° 2026002926 must be annulled by this Sala Constitucional, as it constitutes a judicial order compelling the municipal Administration to maintain a situation contrary to the principle of legality and the protective regime of the maritime-terrestrial zone. G. Judicial inconsistency and absence of substantial change in the facts. Precautionary measures regarding the same facts had previously been denied in June 2023 on the grounds that the danger in the delay had not been sufficiently established and that the public interest in the protection of the ZMT prevailed.In February 2025, only limited protection was granted. Nevertheless, in May 2026, the precautionary relief was significantly expanded—including a municipal cooperation order that had never been requested—without any substantial change in the facts or the legal situation. This progressive and contradictory expansion of the measure, without new relevant factual grounds, is detrimental to legal certainty and to the municipal interests that the Council has a duty to defend. H. The Municipal Administrator's failure to defend municipal interests. The Municipal Administrator's failure to file available remedies leaves both the Council's administrative acts and the public interest in the proper application of the maritime-terrestrial zone regime without effective defense. His omission is the culmination of a series of irregularities on the part of the Municipal Administrator that have been reported by the Council and that have been aimed at obstructing the execution of the concession cancellation act.The undersigned, as a member of the collegiate body, has standing to seek amparo protection in order to restore the rule of law that has been violated. IV. LEGAL BASIS. Violation of Articles 39, 41, 49, 50, 169, 170, and 172 of the Constitution is invoked; Articles 19, 21, 22, 28, and 29 of the Código Procesal Contencioso Administrativo; the principles of legality, proportionality, congruence, and due process under the Ley General de Administración Pública; Ley N° 6043 (Zona Marítimo Terrestre) and its regulations; and the jurisprudence of this Sala Constitucional on the limited and ancillary nature of precautionary measures and the protection of the maritime-terrestrial public domain. V. REQUEST FOR PRECAUTIONARY MEASURE WITHIN THE PRESENT AMPARO PROCEEDING. In addition to the principal writ of amparo, and on the basis of Articles 27 and 41 of the Constitution, Article 19 of the Ley de la Jurisdicción Constitucional, and Articles 19, 21, and 22 of the Código Procesal Contencioso Administrativo, I subsidiarily and urgently request that the Sala Constitucional, as a precautionary measure within the present amparo proceeding, order: That the Municipal Council of the District of Cóbano immediately suspend any processing, review, decision, or granting of an operating license (patente de operación), commercial license, or any other municipal operating permit in favor of COLEMU S.A., derived from or related to compliance with ruling N° 2026002926 of May 11, 2026, until the present writ of amparo is finally resolved.Grounds for the request for a precautionary measure: 1. Appearance of good law (fumus boni iuris): There is a high probability that the cooperation order contained in ruling N° 2026002926 will be declared contrary to law as ultra petita, as violating the principle of congruence, and as harmful to Article 50 of the Constitution, since it compels the municipality to facilitate the regularization of an activity that never held a municipal permit and that rests upon persistent violations of the maritime-terrestrial zone. 2. Danger in the delay (periculum in mora): The three-month period granted by the Tribunal Contencioso Administrativo for the regularization of permits is running. There is a real and imminent risk that, while the present amparo proceeding is being processed and decided, the municipality—in compliance with the judicial order—will end up granting the operating license to COLEMU S.A., thereby consolidating a legal situation that would then be very difficult or impossible to reverse. 3.Harm that is irreparable or very difficult to repair: The granting of the operating license would generate a subjective right in favor of COLEMU S.A. that would greatly hinder the effectiveness of a possible favorable judgment in the present amparo proceeding. Furthermore, the harm to the environment and to the maritime-terrestrial public domain that this writ seeks to prevent would be perpetuated. 4. Proportionality and public interest: The requested suspension does not cause serious harm to the plaintiff in the underlying proceeding (who never held the license), whereas its granting would harm the public interest in the protection of the environment (Art. 50 of the Constitution) and municipal autonomy. 5. Instrumentality: The requested precautionary measure is necessary to guarantee the effectiveness of a possible judgment declaring the nullity or ineffectiveness of the cooperation order contained in ruling N° 2026002926."
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily reject, on the merits or at any time, even upon filing, any petition brought before it that is manifestly inadmissible, or when the Chamber considers that there are sufficient grounds to reject it, or that it constitutes a mere reiteration or reproduction of a prior identical or similar petition that was rejected.

The opinion is drafted by Magistrate Castillo Víquez; and,

Considering:

I.SUBJECT MATTER OF THE WRIT OF AMPARO.- The petitioner disagrees with ruling N° 2026-002926 of 7:29 hours on May 11, 2026, issued by the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José in expediente N° 23-003998-1027-CA-O, which ordered the Municipal Council of the District of Cóbano to maintain COLEMU S.A. in the use and enjoyment of the area corresponding to the canceled concession, and not to evict it or demolish the structures built on said land for as long as the granted injunctive relief remains in force.

II.ON THE SPECIFIC CASE.- In this regard, it must be clarified that the ruling deemed contrary to constitutional law originates from a body of the Poder Judicial exercising its jurisdictional function. Accordingly, it is not proper for this Chamber to rule on the matters alleged in the writ, since, pursuant to Article 30, subsection b) of the Ley de la Jurisdicción Constitucional, those acts are not subject to constitutional review by way of an amparo proceeding. Consequently, the grievances and claims that form the basis of this writ must be raised through the ordinary legal channels established for such purposes. The writ is therefore inadmissible and is so declared.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby put on notice that if any paper documents, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the office within a maximum period of 30 business days counted from the date of notification of this judgment. Revisión del Documento PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026028443 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiocho de julio de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.

Resultando:

  1. 1Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 17:46 horas del 7 de julio de 2026, la parte recurrente interpone recurso de amparo contra el TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, y manifiesta: “I. HECHOS. 1. Dentro del proceso de conocimiento expediente 23-003998-1027-CA que se tramita ante el Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, Nombre02. solicitó medidas cautelares intraprocesales para suspender los efectos del inciso b) del artículo VII de la Sesión Ordinaria N° 185-2019 del Concejo Municipal del Distrito de Cóbano (12 de noviembre de 2019), que ordenó la demolición de obras y la cancelación de la concesión en zona marítimo terrestre otorgada en 2004 sobre una parcela en Playa Santa Teresa de Cóbano. 2. Las pretensiones cautelares de la actora se limitaron, en lo esencial, a suspender el derribo de construcciones, la cancelación de la concesión, una advertencia administrativa sobre portones y, en ampliación posterior, la desinscripción registral y la contratación de notario en SICOP.En ningún escrito de la parte actora se solicitó que el Concejo Municipal debiera prestar cooperación para regularizar permisos o licencias comerciales. 3. Mediante resolución N° 2026002926 de 11 de mayo de 2026, el Tribunal acogió parcialmente la medida cautelar y, como contracautela, ordenó a Nombre02. regularizar “todos los permisos y licencias” ante el Concejo Municipal de Distrito de Cóbano en un plazo de tres meses, advirtiendo expresamente a la entidad accionada que “deberá prestar su cooperación y actuar de buena fe para dicha regularización”, bajo apercibimiento de levantamiento de la tutela. 4. Nombre02. nunca ha contado con permiso municipal de funcionamiento (patente comercial o licencia de operación turística) para desarrollar el negocio de alquiler de casas de lujo en la parcela objeto de la concesión. La actividad turística se ha realizado históricamente sin el permiso municipal correspondiente, incluso durante la vigencia de la concesión y con mayor razón después de su cancelación administrativa en 2019. 5.La cancelación de la concesión acordada en la Sesión Ordinaria N° 185-2019 tuvo como fundamento la constatación de graves violaciones a las normas constructivas aplicables en la Zona Marítimo Terrestre (ZMT) e invasión de zonas protegidas. Dichas irregularidades fueron detectadas en el procedimiento administrativo N° 002-ODPA-CMDC-IM-2019. Estas violaciones e infracciones continúan al día de hoy, a pesar de la cancelación administrativa firme de la concesión y de la posterior desinscripción registral. 6. Las medidas cautelares sobre los mismos hechos ya habían sido rechazadas con anterioridad. En junio de 2023 (expediente 23-002188-1027-CA, Voto N° 314-2023), el Tribunal denegó completamente una solicitud de medida cautelar provisionalísima interpuesta por COLEMU S.A. En febrero de 2025, dentro del presente expediente, solo se otorgó una protección parcialísima (únicamente se ordenó abstenerse de derribar construcciones dentro de la concesión).Sin embargo, en mayo de 2026 se amplió significativamente la tutela —incluyendo la orden de cooperación municipal— sin que hubieran variado de manera sustancial los hechos ni la situación jurídica que justificara tal expansión. 7. La resolución N° 2026002926 no fue recurrida por la Intendencia de Cóbano. II. ANTECEDENTES Y CONTEXTO DEL PRESENTE RECURSO DE AMPARO. Adicionalmente, resulta particularmente grave y relevante para la procedencia de este recurso el siguiente contexto fáctico: El acuerdo de cancelación de la concesión otorgada a COLEMU S.A. fue adoptado por el Concejo Municipal del Distrito de Cóbano mediante el inciso b) del artículo VII de la Sesión Ordinaria N° 185-2019, celebrada el 12 de noviembre de 2019. Dicho acuerdo administrativo fue posteriormente ratificado por el Tribunal Contencioso Administrativo mediante sentencia N. 66-2022 del 24 de febrero de 2023, adquiriendo así firmeza en la vía administrativa.No obstante lo anterior, desde que el señor Ronny José Montero Orozco asumió el cargo de Intendente Municipal en mayo de 2024, ha mantenido una conducta sistemática de obstaculización y dilación en la ejecución de dicho acuerdo, con la complicidad activa de la asesora legal de la municipalidad, licenciada Aralyn Villegas Ruiz. A pesar de las reiteradas y formales solicitudes del Concejo Municipal del Distrito de Cóbano para que procediera a la ejecución del acuerdo de cancelación, el Intendente ha evitado cumplir con su deber legal. Especialmente relevante es lo ocurrido con la resolución N° 2026002926 de 11 de mayo de 2026. Una vez notificada dicha resolución al Intendente, este deliberadamente omitió interponer el recurso de apelación que procedía en derecho. No solo incurrió en dicha omisión, sino que informó al Concejo Municipal de la existencia de la resolución recién dos semanas después de haber sido notificado.Cuando se le requirieron explicaciones sobre los motivos por los cuales no apeló, se negó a brindarlas y alegó falsamente que “no cabía recurso de apelación”, a pesar de que sí procedía y de que ya existía un precedente en el cual una solicitud de medidas cautelares en términos sustancialmente similares había sido denegada por este mismo Tribunal en junio de 2023 (Voto N° 314-2023), sin que mediara variación relevante en los hechos ni en la situación jurídica del caso. Esta conducta deliberada del Intendente Municipal y de la asesora legal institucional ha tenido como consecuencia que la municipalidad no ejerciera su derecho de defensa en sede judicial, permitiendo que una resolución que impone obligaciones no solicitadas a la corporación municipal —y que afecta directamente el interés público en la protección de la Zona Marítimo Terrestre— quedara firme sin la debida oposición institucional.No está demás indicar que según es de conocimiento público, la venta de la concesión en zona marítimo terrestre fue negociada por Colemu S.A. por la suma de treinta millones de dólares estadounidense en el año 2021, no pudiendo llevarse a cabo la transacción en razón de la ratificación del acuerdo cancelación de la concesión; adicionalmente, no obstante el acuerdo de cancelación las casas construidas en la concesión sin alquiladas a turistas hasta por la suma de diez mil dólares la noche, todo sin patente municipal y sin que Colemu S.A. pagara suma alguna por su operación comercial a la Municipalidad o a la Dirección General de Tributación Directa. El Intendente, no obstante tener conocimiento de la situación, no ha tomado ninguna acción para impedir que esta operación “en negro” del negocio de alquiler vacacional continuara operando hasta la fecha. III. AGRAVIOS Y VIOLACIONES CONSTITUCIONALES.A. Legitimación activa del recurrente El suscrito, en su condición de Concejal del Concejo Municipal del Distrito de Cóbano, tiene legitimación activa para interponer el presente recurso de amparo. La resolución judicial impugnada incide directamente sobre actos administrativos dictados por el Concejo del cual forma parte y sobre el régimen de protección de la Zona Marítimo Terrestre, cuya administración corresponde a la municipalidad. Cuando el representante legal de la municipalidad —el Intendente— omite deliberadamente el ejercicio de los recursos ordinarios de defensa, corresponde a los miembros del órgano colegiado acudir ante la jurisdicción constitucional para proteger la legalidad institucional y el interés público, máxime cuando dicha omisión ha sido acompañada de conductas de ocultamiento de información y de afirmaciones falsas ante el propio Concejo. B. Violación al principio de congruencia y debido proceso (arts. 39 y 41 Constitución Política).La resolución impugnada viola flagrantemente el principio de congruencia procesal al otorgar, bajo la figura de contracautela, una medida no solicitada por la parte actora y que impone a la Administración demandada una obligación de hacer (prestar cooperación activa y de buena fe para regularizar permisos y licencias comerciales) que altera sustancialmente el objeto del debate cautelar y el equilibrio procesal. El Tribunal no puede, so pretexto de equilibrar una medida cautelar, crear obligaciones nuevas y no pedidas que favorecen materialmente a una de las partes. C. Violación al principio de legalidad y autonomía municipal (arts. 169, 170 y 172 Constitución Política) Al ordenar al Concejo Municipal de Distrito de Cóbano que “preste su cooperación y actúe de buena fe” para que COLEMU S.A. regularice sus permisos y licencias comerciales en una concesión cancelada y desinscrita, el Tribunal obliga a la municipalidad a coadyuvar en la perpetuación de una actividad que nunca contó con permiso municipal de funcionamiento y que se desarrolla sobre la base de violaciones graves y persistentes al régimen de la zona marítimo terrestre.Esto constituye una indebida intromisión judicial en la esfera de competencia administrativa municipal. D. Violación al principio de proporcionalidad y daño continuado al interés público en la ZMT La cancelación de la concesión en 2019 se dictó precisamente porque se acreditaron graves violaciones a las normas constructivas en la ZMT e invasión de zonas protegidas. Estas infracciones no han cesado. Al día de hoy, las construcciones permanecen en pie y se continúa explotando comercialmente el inmueble sin título concesional vigente ni permiso municipal de funcionamiento, todo ello en perjuicio del interés público que la municipalidad tiene el deber constitucional y legal de proteger. La orden de cooperación contenida en la resolución de mayo de 2026 tiene el efecto de congelar y perpetuar una situación de grave afectación al dominio público marítimo terrestre. Utilizar la figura de la contracautela para obligar a la Administración a cooperar en la regularización de una actividad que nunca tuvo permiso municipal y que se asienta sobre violaciones continuadas a la ZMT, genera un daño actual, grave e injustificado al interés público.E. Violación al derecho constitucional a la protección del medio ambiente y los recursos naturales (artículo 50 Constitución Política) El artículo 50 de la Constitución Política reconoce el derecho de toda persona a un ambiente sano y ecológicamente equilibrado, y obliga al Estado a garantizar la protección, conservación y uso sostenible de los recursos naturales. La Zona Marítimo Terrestre constituye un bien de dominio público especialmente protegido, cuya integridad debe preservarse en beneficio de las generaciones presentes y futuras. La cancelación de la concesión en 2019 se dictó precisamente por graves violaciones constructivas e invasión de zonas protegidas dentro de la zona marítimo terrestre. Estas infracciones persisten hasta la fecha. Al ordenar a la municipalidad cooperar activamente para regularizar una actividad que se desarrolla sin permiso municipal y sobre la base de violaciones ambientales continuadas, la resolución N° 2026002926 tiene el efecto de perpetuar y consolidar un daño ambiental en perjuicio del interés público protegido por el artículo 50 constitucional.La tutela cautelar no puede utilizarse para mantener o facilitar situaciones que lesionan el medio ambiente y los recursos naturales. Al imponer a la municipalidad el deber de cooperar en la regularización de una actividad erigida sobre violaciones graves y persistentes a la zona marítimo terrestre, el Tribunal está vulnerando el mandato constitucional de protección ambiental y el principio de in dubio pro natura que rige en esta materia. F. Violación al principio de legalidad administrativa y al régimen de la Zona Marítimo Terrestre por la orden de mantener a Nombre02. en uso y disfrute del área (inciso I de la resolución) El inciso I de la resolución N° 2026002926 ordena al Concejo Municipal de Distrito de Cóbano “mantener a Nombre02.Nombre03. en el uso y disfrute del área correspondiente a la concesión cancelada y no desalojarla, ni derribar las construcciones edificadas en dichos terrenos mientras permanezca vigente la tutela acordada”.Esta orden resulta manifiestamente contraria al principio de legalidad administrativa y al régimen jurídico de la Zona Marítimo Terrestre por las siguientes razones: Primero, la concesión otorgada a Nombre02. fue cancelada mediante acuerdo firme del Concejo Municipal desde el 12 de noviembre de 2019, acuerdo que fue posteriormente ratificado por el Tribunal Contencioso Administrativo en febrero de 2022. Además, la inscripción registral de la concesión venció el 3 de noviembre de 2024 y ya fue desinscrita del Registro Nacional. Por tanto, actualmente no existe título concesional vigente que ampare la permanencia de Nombre02. en el área. Segundo, de conformidad con la Ley N° 6043 (Ley sobre la Zona Marítimo Terrestre) y su reglamento, el uso y aprovechamiento de la Zona Marítimo Terrestre por particulares solo puede realizarse mediante concesión vigente debidamente inscrita. Mantener a un particular en posesión y uso de un bien de dominio público sin título concesional vigente constituye una violación directa al principio de legalidad consagrado en el artículo 11 de la Constitución Política y en la Ley General de Administración Pública.Tercero, la orden judicial de mantener a COLEMU S.A. en el uso y disfrute del área, a pesar de la cancelación firme de la concesión, tiene el efecto de impedir a la municipalidad el ejercicio de sus potestades de recuperación del dominio público y de ejecución de sus actos administrativos firmes, en claro perjuicio del interés público y del mandato constitucional de protección de los recursos naturales contenido en el artículo 50 de la Constitución Política. Cuarto, dicha orden excede los límites de una medida cautelar legítima, pues en lugar de preservar provisionalmente el objeto del proceso, consolida y perpetúa una situación de ocupación y uso de la Zona Marítimo Terrestre sin título válido, en detrimento de las normas constitucionales y legales que rigen este bien demanial. Por las razones expuestas, el inciso I de la resolución N° 2026002926 debe ser anulado por esta Sala Constitucional, al constituir una orden judicial que obliga a la Administración municipal a mantener una situación contraria al principio de legalidad y al régimen protector de la Zona Marítimo Terrestre.G. Inconsistencia judicial y falta de variación sustancial en los hechos Las medidas cautelares sobre los mismos hechos ya habían sido rechazadas en junio de 2023 por no acreditarse suficientemente el peligro en la demora y por prevalecer el interés público en la protección de la ZMT. En febrero de 2025 solo se otorgó una protección limitada. Sin embargo, en mayo de 2026 se amplió de forma significativa la tutela cautelar —incluyendo una orden de cooperación municipal que nunca fue solicitada— sin que hubieran variado de manera sustancial los hechos ni la situación jurídica. Esta progresiva y contradictoria ampliación de la medida, sin nuevo sustento fáctico relevante, resulta lesiva para la seguridad jurídica y para los intereses municipales que el Concejo tiene el deber de defender. H. Omisión del Intendente en la defensa de los intereses municipales La falta de interposición de recursos por parte del Intendente deja sin defensa efectiva tanto los actos administrativos del Concejo como el interés público en la correcta aplicación del régimen de la Zona Marítimo Terrestre.Su omisión es la culminación de una serie de irregularidades por parte del Intendente que han sido denunciadas por el Concejo y que han sido dirigidos a obstaculizar la ejecución del acto de cancelación de la concesión. El suscrito, como miembro del órgano colegiado, tiene legitimación para acudir en amparo a fin de restablecer la legalidad conculcada. IV. DERECHO Se invoca la violación de los artículos 39, 41, 49, 50, 169, 170 y 172 de la Constitución Política; los artículos 19, 21, 22, 28 y 29 del Código Procesal Contencioso Administrativo; los principios de legalidad, proporcionalidad, congruencia y debido proceso de la Ley General de Administración Pública; la Ley N° 6043 (Zona Marítimo Terrestre) y su reglamento; y la jurisprudencia de esa Sala Constitucional sobre el carácter limitado y accesorio de las medidas cautelares y la protección del dominio público marítimo-terrestre. V. SOLICITUD DE MEDIDA CAUTELAR DENTRO DEL PRESENTE AMPARO Además del recurso de amparo principal, y con fundamento en los artículos 27 y 41 de la Constitución Política, el artículo 19 de la Ley de la Jurisdicción Constitucional y los artículos 19, 21 y 22 del Código Procesal Contencioso Administrativo, de manera subsidiaria y urgente solicito a la Sala Constitucional que, como medida cautelar dentro del presente amparo, se sirva ordenar: Al Concejo Municipal de Distrito de Cóbano que suspenda de inmediato cualquier trámite, estudio, resolución o otorgamiento de la patente de operación, licencia comercial o cualquier otro permiso municipal de funcionamiento a favor de COLEMU S.A., derivado o relacionado con el cumplimiento de la resolución N° 2026002926 de 11 de mayo de 2026, hasta tanto se resuelva en firme el presente recurso de amparo.Fundamentos de la solicitud de medida cautelar: 1. Apariencia de buen derecho (fumus boni iuris): Existe alta probabilidad de que la orden de cooperación contenida en la resolución N° 2026002926 sea declarada contraria a derecho por ser ultra petita, violatoria del principio de congruencia y lesiva del artículo 50 constitucional, al obligar a la municipalidad a facilitar la regularización de una actividad que nunca contó con permiso municipal y que se asienta sobre violaciones persistentes a la zona marítimo terrestre. 2. Peligro en la demora (periculum in mora): El plazo de tres meses otorgado por el Tribunal Contencioso Administrativo para la regularización de permisos está transcurriendo. Existe riesgo real e inminente de que, mientras se tramita y resuelve el presente amparo, la municipalidad —en cumplimiento de la orden judicial—termine otorgando la patente de operación a COLEMU S.A., consolidando una situación jurídica que luego resultaría de muy difícil o imposible reversión. 3.Daño de imposible o difícil reparación: El otorgamiento de la patente de operación generaría un derecho subjetivo a favor de COLEMU S.A. que dificultaría enormemente la efectividad de una eventual sentencia estimatoria del presente amparo. Además, se perpetuaría la afectación al medio ambiente y al dominio público marítimo-terrestre que se busca evitar. 4. Proporcionalidad e interés público: La suspensión solicitada no causa perjuicio grave a la actora (quien nunca contó con la patente), mientras que su otorgamiento sí lesionaría el interés público en la protección del medio ambiente (art. 50 Constitucional) y la autonomía municipal. 5. Instrumentalidad: La medida cautelar solicitada es necesaria para garantizar la efectividad de una eventual sentencia que declare la nulidad o ineficacia de la orden de cooperación contenida en la resolución N° 2026002926”.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.OBJETO DEL RECURSO.- El recurrente se encuentra disconforme con la resolución No. 2026-002926 de las 7:29 horas del 11 de mayo de 2026, emitida por el Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, en el expediente No. 23-003998-1027-CA-O, mediante la cual ordenó al Concejo Municipal de Distrito de Cóbano, mantener a COLEMU S.A. en el uso y disfrute del área correspondiente a la concesión cancelada y no desalojarla, ni derribar las construcciones edificadas en dichos terrenos mientras permanezca vigente la tutela acordada.

II.SOBRE EL CASO CONCRETO.- Al respecto, se debe aclarar que la resolución que se estima contraria al Derecho de la Constitución proviene de un órgano del Poder Judicial en ejercicio de su función jurisdiccional. Por ello, es improcedente que esta Sala se pronuncie sobre los extremos alegados en el recurso, toda vez que, conforme al artículo 30 inciso b) de la Ley de la Jurisdicción Constitucional, esos actos no están sometidos al control de constitucionalidad por la vía del amparo. Consiguientemente, los agravios y pretensiones que sirven de sustento a este recurso deberán ser planteadas a través de las vías de legalidad ordinaria establecidas para tales efectos. En consecuencia, el recurso es inadmisible y así se declara.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
