Background:

  1. 1By a written submission entered into the digital case file on 26 June 2026, the petitioning party files an amparo application. They state that, on 16 April 2026, the petitioner [Nombre 001] filed an environmental damage complaint against [Nombre 007] Ltda and [Nombre 008] for the alleged development of a large-scale poultry project without the necessary legal and environmental permits. They state that, as has been verified at the site, construction work on the poultry farm that is the subject of the complaint is continuing, which could cause environmental harm that would be difficult or impossible to repair, as set out in the initial written submission. They indicate that the farm is being built without the permits required by law, which would cause harm to the healthy and balanced environment enjoyed by the communities represented by the petitioner associations, and that, given that the precautionary-measure request is intended to prevent potentially irreversible environmental harm, the passage of more than two months without any decision by the competent authority constitutes an unjustified delay, incompatible with the principles of environmental prevention and precaution. They claim that, when the amparo application was filed, the respondent authority had made no decision concerning the complaint or the precautionary-measure request at issue.
  2. 2By a ruling of the President’s Office of the Chamber at 23:10 on 7 July 2026, the amparo application was admitted for processing.
  3. 3Adriana Bejarano Alfaro, in her capacity as president of the Administrative Environmental Tribunal, reports as follows: “FIRST: That on 16 April 2026, this Tribunal received an environmental complaint filed by Mr. [Nombre 001], in his capacity as attorney-in-fact with full general authority of the company [Nombre 002] S.R.L, legal entity identification number [Valor 002], against the company [Nombre 007], legal entity identification number [Valor 010], and against Mr. [Nombre 008], identity card number [Valor 011], for carrying out earthworks (movimientos de tierra), land-use change (cambio de uso de suelo), and tree cutting in a protected area on property [Valor 012], all for a poultry-farm project located in the Province of [...]. THIRD: That on 04 May 2026, a written submission was filed with this Tribunal by the representatives of four Integral Development Associations of Pital de San Carlos, seeking to participate as an assisting party in support of the complainant, the company [Nombre 002] S.R.L.(Folio 41 to 46) FOURTH: That, by memorandum TAA-DT-126-2026 dated 29 May 2026, the Technical Unit of the Administrative Environmental Tribunal provided an analysis of the complaint and verification on official platforms of data compatible with geographic information systems. The complaint is attached. 3.- From Dr. Juan Carlos Jiménez Bonilla, in his capacity as Director of the Huetar Norte Health Area (San Carlos), a report to this Tribunal: a) Whether there is any operating permit for the location, construction, and operation of a poultry farm at the complaint site, located in the Province of [...], property [Valor 012], cadastral plan [Valor 013]. 4.- From Mr. Alfredo Sequeira Ávalos, Regional Director of the Huetar Norte Office of the National Animal Health Service (SENASA), or whoever holds that position, a report to this Tribunal on whether permits or an operating certificate exist for a poultry farm at the complaint site, property [Valor 012], cadastral plan [Valor 013], as well as any other information considered relevant to processing this complaint. 5.- From Mr. José Manuel Alvarado Arguedas, in his capacity as Head of the Pital Subregional Office, Huetar Norte Conservation Area of SINAC, or whoever holds that position: a) To inspect the complaint site and report on the reported facts in accordance with his powers; b) If appropriate, to submit the corresponding economic assessment of the alleged environmental damage in keeping with the reported facts. 6.- From Mr. Ulises Álvarez Acosta, in his capacity as Secretary General of the National Environmental Technical Secretariat (SETENA), or whoever holds that position or is designated, to report whether, according to the powers of the office under his charge, any project has been submitted for environmental impact assessment on property [Valor 012], cadastral plan [Valor 013], whether that office has a case file for it, or whether environmental viability has been granted to develop any project on the property reported…’ As appears in the administrative case file, ruling N° 708-2016-TAA at seven forty on the thirteenth day of July of the year two thousand twenty-six was duly served on 13 July 2026. (Folios 73 to 91) Once the information required by ruling N° 708-2016-TAA is received, this Tribunal will continue the legally appropriate proceeding, within its powers and in accordance with the regulations in force, with the aim of deciding the complaint filed. LEGAL CONSIDERATIONS: By virtue of article 103 of the Organic Law of the Environment (published in La Gaceta N° 215 of 13 November 1995), the Administrative Environmental Tribunal (TAA) is a deconcentrated body of the Ministry of Environment and Energy, with exclusive jurisdiction and functional independence in performing its duties. Under the powers granted to this Tribunal by the Organic Law of the Environment, it acts upon a complaint filed by a party (Art. 108 of LOA) or on its own initiative (Art. 111 of LOA), applying the procedure established in its Regulation N°34136. In this regard, to exercise its function, this Tribunal must first have the technical materials needed to make a decision and establish the real truth of the facts. To that end, as provided by articles 22 and 23 of Regulation N°34136, it is authorized to order the various bodies of the Public Administration to submit any technical or administrative reports it requires and, if it considers it appropriate, may conduct visual inspections or expert inspections. Both upon receipt of a complaint and when summoning the parties to an inspection, the Tribunal has the power to determine whether it is appropriate to notify the respondent that a claim exists or to summon the parties to that proceeding. REGARDING THE AMPARO PROCEEDING: In light of the foregoing, regarding the amparo application filed against this Environmental Tribunal by Mr. [Nombre 001], in his capacity as attorney-in-fact with full general authority of the company [Nombre 002] S.R.L, legal entity identification number [Valor 002], it follows from the background that case file Nº 085-26-01-TAA, assigned to the complaint filed on 16 April 2026, is at the preliminary investigation stage, as provided by the aforementioned regulations. Accordingly, after analyzing the complaint filed by Mr. [Nombre 001] and the request to participate as an assisting party filed on 04 May 2026, the Tribunal decided to consider that request and at the same time request reports from several institutions with relevant subject-matter authority, which it did by ruling N° 708-2016-TAA at seven forty on the thirteenth day of July of the year two thousand twenty-six, duly served. Once all the required technical reports are received, this Tribunal will continue the legally appropriate proceeding, within its powers, in order to address and decide the complaint filed by Mr. [Nombre 001]. It should also be stated that, as established by the Organic Law of the Environment and Regulation N°34136 governing this Tribunal’s procedure, every complaint filed with it must meet a series of requirements and pass through preliminary stages before the Final Act is issued, by which the complaint is definitively decided. One such stage is the preliminary investigation, where case file Nº 085-26-01-TAA currently stands. That stage consists of requesting various bodies of the Public Administration to submit technical reports within each body’s respective area of authority, which this Tribunal must subsequently analyze. If deemed necessary, visual inspections could also be conducted, new reports requested, and so on. Once the investigation stage concludes, the ordinary administrative proceeding will be opened and the parties summoned to a public oral hearing, where all existing evidence will be taken; once that hearing has been held, the case file or matter will be ready for issuance of the final ruling in the proceeding. Finally, it should be noted that although this Tribunal has the power to issue precautionary measures depending on the seriousness of the reported facts, regarding the petitioner’s request for a precautionary measure, it is reported that the request will be assessed once all necessary materials and the reports requested by this Tribunal in ruling N° 708-2016-TAA have been received. However, it is important to note that, according to the documentation submitted by the petitioner with the complaint and appearing at folio 35 of the case file, the Municipality of San Carlos issued a closure order at the complaint site for violation of the Construction Law. Nevertheless, based on the information gathered at the investigation stage in which case file Nº 085-26-01-TAA currently stands, this Tribunal will take the measures deemed legally appropriate, in accordance with the principle of legality and due process (…) REQUEST Accordingly, I ask this Honorable Chamber to consider the requested report submitted, dismiss this amparo application against the Administrative Environmental Tribunal, and consider it timely under Directive-001-MIDEPLAN-MTSS on collective vacations, issued by the Presidency of the Republic, the Ministry of National Planning and Economic Policy, and the Ministry of Labor and Social Security, as well as CIRCULAR-MINAE-DM-006-2026.”
  4. 4The legal requirements have been observed in the proceedings conducted.

Justice Hess Herrera drafts the ruling; and, Reasons:

I. PRELIMINARY ISSUE

Before analyzing the merits of the matter, it must be clarified that, beginning with judgment no. 2008002545 at 8:55 on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with some exceptions—when the dispute concerns whether the Public Administration has complied with the time limits set by the General Law of Public Administration (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to issue a final act resolving an administrative proceeding—instructed on its own initiative or at the request of a party—or to hear the applicable administrative appeals. The present case falls within an exception, since it concerns the alleged delay in deciding an environmental complaint. That clarified, the specific situation raised in this amparo will now be decided.

II. SUBJECT OF THE AMPARO APPLICATION

The petitioning party alleges that, on 16 April 2026, the petitioner [Nombre 001] filed an environmental damage complaint against [Nombre 007] Ltda and [Nombre 008] for the alleged development of a large-scale poultry project without the necessary legal and environmental permits. They state that, as has been verified at the site, construction work on the poultry farm that is the subject of the complaint is continuing, which could cause environmental harm that would be difficult or impossible to repair, as set out in the initial written submission. They indicate that the farm is being built without the permits required by law, which would cause harm to the healthy and balanced environment enjoyed by the communities represented by the petitioner associations, and that, given that the precautionary-measure request is intended to prevent potentially irreversible environmental harm, the passage of more than two months without any decision by the competent authority constitutes an unjustified delay, incompatible with the principles of environmental prevention and precaution. They claim that, when the amparo application was filed, the respondent authority had made no decision concerning the complaint or the precautionary-measure request at issue.

III. FACTS PROVEN

The following facts are deemed duly established as relevant to deciding this matter:

  • a)On 16 April 2026, the petitioner [Nombre 001], in his capacity as manager of [Nombre 002] Sociedad de Responsabilidad Limitada, filed an environmental damage complaint with the Administrative Environmental Tribunal against the company [Nombre 007] Sociedad de Responsabilidad Limitada, specifically concerning the construction of a poultry farm without permits. Case file 085-26-01-TAA was assigned to that complaint (See evidence submitted).
  • b)When this amparo application was filed, the aforementioned complaint had not yet been addressed. (Undisputed fact).
  • c)On 8 July 2026, the respondent authorities were notified that this proceeding had been admitted. (See service records).
  • d)By ruling no. 708-2026-TAA dated 13 July 2026, the Administrative Environmental Tribunal ordered: “THEREFORE, THE ADMINISTRATIVE ENVIRONMENTAL TRIBUNAL, pursuant to articles 50 of the Political Constitution, 103, 106, 107, 109, and 111 of the Organic Law of the Environment, 214, 262, 275, 297, 302, and 308 of the General Law of Public Administration, as well as articles 1 and 22 of Executive Decree number 34136- MINAE, rules as follows: FIRST: Pursuant to articles 276 to 279 of the General Law of Public Administration, the following persons are admitted as ASSISTING PARTIES IN SUPPORT OF THE COMPLAINANT in this administrative proceeding: Mr. [Nombre 003], identity card number [Valor 009], in his capacity as President of [...]; Mr. [Nombre 004], identity card number [Valor 008], in his capacity as President of [...]; Ms. [Nombre 005], identity card number [Valor 006], in her capacity as President of [...]; and Mr. [Nombre 006], identity card number [Valor 007], in his capacity as President of [...]. The complaint is attached. 3 .- From Dr. Juan Carlos Jiménez Bonilla, in his capacity as Director of the Huetar Norte Health Area (San Carlos), a report to this Tribunal: a) Whether there is any operating permit for the location, construction, and operation of a poultry farm at the complaint site, located in the Province of [...], property [Valor 012], cadastral plan [Valor 013]. 4 .- From Mr. Alfredo Sequeira Ávalos, Regional Director of the Huetar Norte Office of the National Animal Health Service (SENASA), or whoever holds that position, a report to this Tribunal on whether permits or an operating certificate exist for a poultry farm at the complaint site, property [Valor 012], cadastral plan A-0006232- 2025, as well as any other information considered relevant to processing this complaint. 5 .- From Mr. José Manuel Alvarado Arguedas, in his capacity as Head of the Pital Subregional Office, Huetar Norte Conservation Area of SINAC, or whoever holds that position: a) To inspect the complaint site and report on the reported facts in accordance with his powers; b) If appropriate, to submit the corresponding economic assessment of the alleged environmental damage in keeping with the reported facts. 6 .- From Mr. Ulises Álvarez Acosta, in his capacity as Secretary General of the National Environmental Technical Secretariat (SETENA), or whoever holds that position or is designated, to report whether, according to the powers of the office under his charge, any project has been submitted for environmental impact assessment on property [Valor 012], cadastral plan [Valor 013], whether that office has a case file for it, or whether environmental viability has been granted to develop any project on the property reported. THIRD: A period of ten calendar days is granted for submission of the requested reports, counted from the business day following service of this ruling.” (See documentary evidence).

IV. THE SPECIFIC CASE

In the present case, the petitioning party alleges that, on 16 April 2026, the petitioner [Nombre 001] filed an environmental damage complaint against [Nombre 007] Ltda and [Nombre 008] for the alleged development of a large-scale poultry project without the necessary legal and environmental permits. They state that, as has been verified at the site, construction work on the poultry farm that is the subject of the complaint is continuing, which could cause environmental harm that would be difficult or impossible to repair, as set out in the initial written submission. They indicate that the farm is being built without the permits required by law, which would cause harm to the healthy and balanced environment enjoyed by the communities represented by the petitioner associations, and that, given that the precautionary-measure request is intended to prevent potentially irreversible environmental harm, the passage of more than two months without any decision by the competent authority constitutes an unjustified delay, incompatible with the principles of environmental prevention and precaution. They claim that, when the amparo application was filed, the respondent authority had made no decision concerning the complaint or the precautionary-measure request at issue.

The case record shows that, on 16 April 2026, the petitioner [Nombre 001], in his capacity as manager of [Nombre 002] Sociedad de Responsabilidad Limitada, filed an environmental damage complaint with the Administrative Environmental Tribunal against the company [Nombre 007] Sociedad de Responsabilidad Limitada, specifically concerning the construction of a poultry farm without permits. Case file 085-26-01-TAA was assigned to that complaint. When this amparo application was filed, the aforementioned complaint had not yet been addressed. On 8 July 2026, the respondent authorities were notified that this proceeding had been admitted.

Finally, by ruling no. 708-2026-TAA dated 13 July 2026, the Administrative Environmental Tribunal ordered: “THEREFORE, THE ADMINISTRATIVE ENVIRONMENTAL TRIBUNAL, pursuant to articles 50 of the Political Constitution, 103, 106, 107, 109, and 111 of the Organic Law of the Environment, 214, 262, 275, 297, 302, and 308 of the General Law of Public Administration, as well as articles 1 and 22 of Executive Decree number 34136- MINAE, rules as follows: FIRST: Pursuant to articles 276 to 279 of the General Law of Public Administration, the following persons are admitted as ASSISTING PARTIES IN SUPPORT OF THE COMPLAINANT in this administrative proceeding: Mr. [Nombre 003], identity card number [Valor 009], in his capacity as President of [...]; Mr. [Nombre 004], identity card number [Valor 008], in his capacity as President of [...]; Ms. [Nombre 005], identity card number [Valor 006], in her capacity as President of [...]; and Mr. [Nombre 006], identity card number [Valor 007], in his capacity as President of [...].

SECOND: To establish the real truth of the facts reported on 16 April 2026 by Mr. [Nombre 001], in his capacity as attorney-in-fact with full general authority of the company [Nombre 002] S.R.L, this Tribunal considers it necessary to request the following information: 1 .- From Mr. Juan Diego González Picado, in his capacity as Mayor of the Municipality of San Carlos, or whoever holds that position, a report to this Tribunal:

  • a)Indicating whether any construction work or project exists at the site of the complaint, located in the Province of [...], property [Valor 012], cadastral plan [Valor 013], and, if so, whether it has the respective permits;
  • b)If any activity is being carried out without the respective permits, indicating what actions that Municipality has taken in this regard;
  • c)Providing any other information considered relevant to processing this complaint. 2 .- From Eng. José Miguel Zeledón Calderón, in his capacity as Director of the Water Directorate, or whoever holds that position, and from Ms. Nancy Quesada Artavia, coordinator of the San Juan Hydrological Unit:
  • a)To inspect the complaint site, in accordance with their powers, in order to determine whether any body of water exists that could be affected by the reported facts;
  • b)If any body of water exists, to issue the relevant technical opinion on its nature and condition;
  • c)If appropriate, to issue the corresponding economic assessment of the damage. The complaint is attached. 3 .- From Dr. Juan Carlos Jiménez Bonilla, in his capacity as Director of the Huetar Norte Health Area (San Carlos), a report to this Tribunal: a) Whether there is any operating permit for the location, construction, and operation of a poultry farm at the complaint site, located in the Province of [...], property [Valor 012], cadastral plan [Valor 013]. 4 .- From Mr. Alfredo Sequeira Ávalos, Regional Director of the Huetar Norte Office of the National Animal Health Service (SENASA), or whoever holds that position, a report to this Tribunal on whether permits or an operating certificate exist for a poultry farm at the complaint site, property [Valor 012], cadastral plan A-0006232- 2025, as well as any other information considered relevant to processing this complaint. 5 .- From Mr. José Manuel Alvarado Arguedas, in his capacity as Head of the Pital Subregional Office, Huetar Norte Conservation Area of SINAC, or whoever holds that position: a) To inspect the complaint site and report on the reported facts in accordance with his powers; b) If appropriate, to submit the corresponding economic assessment of the alleged environmental damage in keeping with the reported facts. 6 .- From Mr. Ulises Álvarez Acosta, in his capacity as Secretary General of the National Environmental Technical Secretariat (SETENA), or whoever holds that position or is designated, to report whether, according to the powers of the office under his charge, any project has been submitted for environmental impact assessment on property [Valor 012], cadastral plan [Valor 013], whether that office has a case file for it, or whether environmental viability has been granted to develop any project on the property reported. THIRD: A period of ten calendar days is granted for submission of the requested reports, counted from the business day following service of this ruling.” In these circumstances, the appropriate course is to grant the amparo application. In this regard, note that it was only in connection with the processing of this application, and after nearly three months had passed, that the respondent administrative tribunal admitted the complaint in question for processing and requested evidence; however, this does not mean that the proceeding has been resolved, which amounts to a flagrant violation of constitutional article 41.

V. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND FULL ADMINISTRATION OF JUSTICE

I have supported this Tribunal’s position that, when a litigant alleges a violation of the right to prompt and full administration of justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Law n.° 9097, Law on the Regulation of the Right of Petition, that right has been made subject to judicial protection through the amparo application established by article 32 of the Constitutional Jurisdiction Law, in relation to article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Tribunal to change its line of precedent, since under article 7 of its Law it is exclusively responsible for defining its own jurisdiction.

Accordingly, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in other cases the competent courts are the Judges of the administrative-litigation jurisdiction, for the reasons given by this Tribunal (judgment N° 2008- 02545 at 8:55 on 22 February 2008). This is all consistent with article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory provisions, based on a logical, systematic, and teleological interpretation of the legal system.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that any documents submitted in paper form, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device must be collected within a maximum period of 30 business days from service of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and article LXXXI of session of the Higher Council of the Judiciary no. 43-12 of 3 May 2012.

Therefore:

The amparo application is granted. Adriana Bejarano Alfaro, in her capacity as president of the Administrative Environmental Tribunal, or whoever holds that position, is ordered to issue the necessary orders and make the necessary arrangements within the scope of her respective powers so that, within a maximum period of TWO MONTHS from service of this judgment, she definitively decides the complaint filed by the petitioning party that is the subject of this amparo application and serves notice of the decision through the channel designated for that purpose. The respondent authorities are warned that, pursuant to article 71 of the Constitutional Jurisdiction Law, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, will be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts on which this declaration is based, which shall be assessed in enforcement of judgment before the administrative-litigation jurisdiction. Justice Castillo Víquez files a note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintitres de julio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente nro. 26-023137- 0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], en su condición de gerente con facultades de apoderado generalísimo sin límite de suma de [Nombre 002], cédula jurídica [Valor 002]; [Nombre 003], cédula de identidad [Valor 003], en su condición de presidente con facultades de apoderado general con representación judicial y extrajudicial de la [...]; [Nombre 004], cédula de identidad [Valor 004], en su condición de apoderado general con representación judicial y extrajudicial de la [...]; [Nombre 005], cédula de identidad [Valor 005], en su condición de apoderada especial judicial y extrajudicial con facultades de apoderada general de la [...]; y [Nombre 006], en representación de la [...], contra el TRIBUNAL AMBIENTAL ADMINISTRATIVO.

Resultando:

  1. 1Por escrito incorporado al expediente digital el 26 de junio de 2026, la parte accionante interpone recurso de amparo. Exponen que, el 16 de abril de 2026, el recurrente [Nombre 001] interpuso una denuncia por daño ambiental contra [Nombre 007] Ltda y [Nombre 008] por el supuesto desarrollo de un proyecto avícola a gran escala, sin contar con los permisos legales y ambientales necesarios. Señalan que, según se ha podido constatar en el sitio, continúan las labores de construcción de la granja avícola objeto de la denuncia, lo que podría ocasionar afectaciones ambientales de difícil o imposible reparación conforme fue expuesto en el escrito inicial. Indican que dicha granja se está construyendo sin los permisos de ley, lo que provocaría un daño al ambiente sano y equilibrado del que gozan las comunidades representadas por las asociaciones recurrentes, y que, tratándose de una solicitud cautelar destinada a prevenir daños ambientales potencialmente irreversibles, el transcurso de más de dos meses sin resolución alguna por parte de la autoridad competente constituye una demora injustificada, incompatible con los principios de prevención y precaución ambiental. Reclaman que, al momento de la interposición del recurso, la autoridad recurrida no se había resuelto nada al respecto de la denuncia y la solicitud de medida cautelar de interés.
  2. 2Mediante resolución de la Presidencia de la Sala de las 23:10 horas del 7 de julio de 2026, se dio curso al amparo.
  3. 3Informa Adriana Bejarano Alfaro, en su condición de presidenta del Tribunal Ambiental Administrativo. Expone: “ PRIMERO: Que el día 16 de abril del 2026, se recibió en este Tribunal denuncia ambiental presentada por el señor [Nombre 001] en su condición de apoderado generalísimo de la sociedad [Nombre 002] S.R.L, cédula jurídica número [Valor 002] contra la sociedad [Nombre 007], cédula jurídica número [Valor 010] y contra el señor [Nombre 008], cédula de identidad número [Valor 011], por realizar en la finca [Valor 012] movimientos de tierra, cambio de uso de suelo, corta de árboles en zona de protección, todo para un proyecto de granja avícola, ubicado en la Provincia de [...]. (Folio 01 al 39) SEGUNDO: Que a la denuncia se asignó el expediente administrativo Nº 085-26-01-TAA. TERCERO: Que el día 04 de mayo del 2026, se presentó ante este Tribunal escrito mediante el cual los representantes de cuatro Asociaciones de Desarrollo Integral de Pital de San Carlos, interpusieron gestión de coadyuvancia a favor de la parte denunciante la sociedad [Nombre 002] S.R.L.(Folio 41 al 46) CUARTO: Que mediante el oficio TAA-DT-126-2026 de fecha 29 de mayo del 2026, la Unidad Técnica del Tribunal Ambiental Administrativo, brinda un análisis de la denuncia y verificación en las plataformas oficiales de datos compatibles con los sistemas de información geográfica. (Folios 47 al 52) QUINTO: Una vez analizado el escrito de denuncia y el caso en general, con el objetivo de determinar la verdad real de los hechos denunciados, mediante resolución N° 708-2016-TAA de las siete horas cuarenta minutos del día trece de julio del año dos mil veintiséis, este tribunal resolvió sobre la Coadyuvancia presentada y a la vez solicitó informes a diferentes instituciones de la siguiente manera: (Folios 68 a 72) “PRIMERO: Con fundamento en lo dispuesto por los artículos 276 a 279 de la Ley General de la Administración Pública, en el presente procedimiento administrativo se tiene como PARTE COADYUVANTE DE LA PARTE DENUNCIANTE, a las siguientes personas: al señor [Nombre 003], cédula de identidad número [Valor 009] en su condición de Presidente de la [...], el señor [Nombre 004], cédula de identidad número [Valor 008] en su condición de Presidente de la [...], la señora [Nombre 005], cédula de identidad número [Valor 006] en su condición de Presidente de la [...], el señor [Nombre 006], cédula de identidad número [Valor 007] en su condición de Presidente de la [...].SEGUNDO: Que a fin de establecer la verdad real de los hechos denunciados el día 16 de abril del 2026 por el señor [Nombre 001] en su condición de apoderado generalísimo de la sociedad [Nombre 002] S.R.L, este Tribunal considera necesario solicitar la siguiente información: 1.- Al señor Juan Diego González Picado, en su condición de Alcalde de la Municipalidad de San Carlos o quien ocupe su cargo, que le informe a este Tribunal: a) Indicar si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de obra constructiva o proyecto y, si este cuenta con los permisos respectivos, b) De existir alguna actividad sin contar con los permisos respectivos, indicar que acciones ha tomado dicha Municipalidad al respecto, c) Brindar cualquier otra información que considere relevante para la tramitación de la presente denuncia. 2.- Al Ing. José Miguel Zeledón Calderón en su condición de Director de la Dirección de Agua o quien ocupe su cargo y a la señora Nancy Quesada Artavia, coordinadora de la Unidad Hidrológica San Juan que: a) realice según sus competencias inspección al sitio de la denuncia, con el fin de determinar la existencia o no de algún cuerpo de agua que se pueda ver afectado por los hechos denunciados b) En caso de existir algún cuerpo de agua emitir el respectivo criterio técnico de la naturaleza y condición del mismo, c) De ser procedente emitir la correspondiente valoración económica del daño.Adjunto escrito de la denuncia. 3.- A la Dr. Juan Carlos Jiménez Bonilla, en su condición de Director del Área Rectora de Salud de Huetar Norte (San Carlos) que informe a este Tribunal: a) Si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de permiso de funcionamiento, para la ubicación, construcción y funcionamiento de una Granja Avícola. 4.- Al señor Alfredo Sequeira Ávalos, Director Regional de la Oficina Huetar Norte del Servicio Nacional de Salud Animal (SENASA) o a quien ocupe su cargo, que informe a este Tribunal informe si en el sitio de la denuncia la propiedad [Valor 012] Plano [Valor 013], existen permisos o certificado de operación para una Granja Avícola, así como cualquier otra información que considere relevante para la tramitación de la presente denuncia. 5.- Al señor José Manuel Alvarado Arguedas, en su condición de Jefe de la Oficina de Subregional de Pital, Área de Conservación Huetar Norte del SINAC, o a quien ocupe su cargo que: a) Realice una inspección al sitio de la denuncia para que informe sobre los hechos denunciados conforme a sus competencias, b) En caso de ser procedente, remitir la correspondiente valoración económica del supuesto daño ambiental, acorde a los hechos denunciados. 6.- Al señor Ulises Álvarez Acosta, en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental (SETENA) o quien ocupe su puesto o a quien designe, si de acuerdo a las competencias de la dependencia a su cargo, en la finca número [Valor 012] Plano [Valor 013] existe algún proyecto presentado para su respectiva evaluación ambiental, si cuenta con expediente en dicha dependencia o si se ha otorgado viabilidad ambiental para desarrollar algún proyecto en la propiedad denunciada…” Tal y como consta en el expediente administrativo, la resolución N° 708-2016-TAA de las siete horas cuarenta minutos del día trece de julio del año dos mil veintiséis, fue debidamente notificada el día 13 de julio del 2026.(Folios 73 a 91) Una vez que se cuente con la información requerida en la resolución N° 708-2016-TAA, este Tribunal con el objetivo de resolver la denuncia interpuesta, continuará con el procedimiento que legalmente proceda, según sus competencias y lo establecido por la normativa vigente. CONSIDERACIONES JURÍDICAS: El Tribunal Ambiental Administrativo (TAA) por disposición del artículo 103 de la Ley Orgánica del Ambiente (publicada en La Gaceta N° 215 del 13 de noviembre de 1995), es un órgano desconcentrado del Ministerio de Ambiente y Energía, con competencia exclusiva e independencia funcional en el desempeño de sus atribuciones. De acuerdo a las potestades dadas a este Tribunal por la Ley Orgánica del Ambiente, este actúa a partir de ser presentada la denuncia a instancia de parte (Art. 108 de LOA) o de oficio (Art. 111 de LOA) aplicando para ello el procedimiento establecido en su Reglamento N°34136.En ese sentido, para ejercer su función, este Tribunal requiere contar de previo con los insumos técnicos necesarios, que le permitan tomar una decisión y determinar la verdad real de los hechos. Para ello, tal y como lo disponen los artículos 22 y 23 del reglamento N°34136, se encuentra facultado para ordenar a los distintos órganos de la Administración Pública la remisión de informes técnicos o administrativos que requiera, así como, de considerarlo oportuno podrá realizar inspecciones oculares o periciales. Tanto de la presentación de la denuncia como de citar a las partes a una inspección, el Tribunal tiene la potestad de determinar si procede o no comunicar al denunciado que existe un reclamo o citar a las partes a dicha diligencia. SOBRE EL RECURSO DE AMPARO: En razón de lo anterior, respecto al Recurso de Amparo interpuesto contra este Tribunal Ambiental por el señor [Nombre 001] en su condición de apoderado generalísimo de la sociedad [Nombre 002] S.R.L, cédula jurídica número [Valor 002], según se desprende de los antecedentes, el expediente Nº 085-26-01-TAA, que fue asignado a la denuncia presentada el día 16 de abril del 2026, se encuentra en la etapa de investigación preliminar, tal y como lo dispone la normativa mencionada.Es así, como una vez analizado el escrito de denuncia presentada por el señor [Nombre 001], así como el escrito de coadyuvancia presentado el día 04 de mayo del 2026, se determinó conocer tanto la solicitud de coadyuvancia presentada como solicitar a la vez, los informes a varias instituciones competentes en la materia de la denuncia, lo cual se realizó mediante la resolución N° 708-2016-TAA de las siete horas cuarenta minutos del día trece de julio del año dos mil veintiséis, la cual ya se encuentra debidamente notificada. Una vez que se cuente con todos los informes técnicos requeridos, este Tribunal continuará con el procedimiento que legalmente proceda, según sus competencias. Todo con el fin de atender y resolver la denuncia interpuesta por el señor [Nombre 001]. No se omite indicar, que tal y como lo establece la Ley Orgánica del Ambiente y el reglamento N°34136 que rige el procedimiento de este Tribunal, toda denuncia interpuesta ante el mismo, debe seguir y cumplir con una serie de requisitos y etapas previas al dictado del Acto Final, mediante el cual se resuelve en forma definitiva la denuncia.Una de las etapas es la investigación preliminar, en la cual se encuentra el expediente Nº 085-26-01-TAA, y que consiste en solicitar a distintos órganos de la Administración Pública la remisión de informes técnicos desde la competencia de cada uno de esos órganos, que posteriormente deberán ser analizados por este Tribunal. También, de considerarse necesario, se podría realizar inspecciones oculares, requerir nuevos informes, etc. Una vez concluida la etapa de investigación, se dictará la apertura del procedimiento ordinario administrativo citando a las partes a una audiencia oral y pública, donde será evacuada toda la prueba existente y celebrada dicha audiencia, el expediente o el caso quedará listo para el dictado de la resolución final del procedimiento. Finalmente, vale señalar que si bien es cierto, este Tribunal tiene la potestad de dictar medidas cautelares según la gravedad de los hechos denunciados, respecto a la solicitud de Medida Cautelar solicitada por el recurrente, se informa que esta será valorada una vez que se cuente con todos los insumos necesarios y con los informes solicitados por este Tribunal en la resolución N° 708-2016-TAA.Sin embargo, es importante señalar que, según documentación aportada por el recurrente con el escrito de denuncia y que consta a folio 35 del expediente, la Municipalidad de San Carlos emitió orden de Clausura en el sitio de la denuncia por infracción a la Ley de Construcciones. No obstante, con la información recabada en esta etapa de investigación en la cual se encuentra el expediente Nº 085-26-01-TAA, este Tribunal tomará las medidas que se estimen legalmente pertinentes, conforme al principio de legalidad y debido proceso (…) PETITORIA Conforme a lo anterior, solicito a esta Honorable Sala, se tenga por rendido el informe solicitado, y se declare sin lugar el presente Recurso de Amparo contra el Tribunal Ambiental Administrativo y se tenga presentado a tiempo según Directriz-001-MIDEPLAN-MTSS sobre vacaciones colectivas, emitida por la Presidencia de la República, Ministerio de Planificación Nacional y Política Económica y el Ministerio de Trabajo y Seguridad Social, así como en la CIRCULAR-MINAE-DM-006-2026”.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. CUESTIÓN PREVIA

Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante la supuesta dilación en resolver una denuncia en materia ambiental. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente acusa que, el 16 de abril de 2026, el recurrente [Nombre 001] interpuso una denuncia por daño ambiental contra [Nombre 007] Ltda y [Nombre 008] por el supuesto desarrollo de un proyecto avícola a gran escala, sin contar con los permisos legales y ambientales necesarios. Señalan que, según se ha podido constatar en el sitio, continúan las labores de construcción de la granja avícola objeto de la denuncia, lo que podría ocasionar afectaciones ambientales de difícil o imposible reparación conforme fue expuesto en el escrito inicial. Indican que dicha granja se está construyendo sin los permisos de ley, lo que provocaría un daño al ambiente sano y equilibrado del que gozan las comunidades representadas por las asociaciones recurrentes, y que, tratándose de una solicitud cautelar destinada a prevenir daños ambientales potencialmente irreversibles, el transcurso de más de dos meses sin resolución alguna por parte de la autoridad competente constituye una demora injustificada, incompatible con los principios de prevención y precaución ambiental. Reclaman que, al momento de la interposición del recurso, la autoridad recurrida no se había resuelto nada al respecto de la denuncia y la solicitud de medida cautelar de interés.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 16 de abril de 2026, el recurrente [Nombre 001], en su condición de gerente del [Nombre 002] Sociedad de Responsabilidad Limitada, planteó una denuncia ante el Tribunal Ambiental Administrativo en contra de la sociedad [Nombre 007] Sociedad de Responsabilidad Limitada por daño ambiental, específicamente por la construcción sin permisos de una granja avícola. A tal denuncia se le asignó el expediente 085-26-01-TAA(Ver prueba aportada).
  • b)Al momento de interposición de este recurso, la denuncia antedicha aún no había sido atendida. (Hecho incontrovertido).
  • c)El 8 de julio de 2026, las autoridades accionadas fueron notificadas del curso de este proceso. (Ver actas de notificación).
  • d)Mediante resolución nro. 708-2026-TAA del 13 de julio de 2026, el Tribunal Ambiental Administrativo dispuso: “POR TANTO EL TRIBUNAL AMBIENTAL ADMINISTRATIVO Con fundamento en los artículos 50 de la Constitución Política, 103, 106, 107, 109 y 111 de la Ley Orgánica del Ambiente, 214, 262, 275, 297, 302 y 308 de la Ley General de la Administración Pública, así como los artículos 1 y 22 del Decreto Ejecutivo número 34136- MINAE, este Tribunal resuelve: PRIMERO: Con fundamento en lo dispuesto por los artículos 276 a 279 de la Ley General de la Administración Pública, en el presente procedimiento administrativo se tiene como PARTE COADYUVANTE DE LA PARTE DENUNCIANTE, a las siguientes personas: al señor [Nombre 003], cédula de identidad número [Valor 009] en su condición de Presidente de la [...], el señor [Nombre 004], cédula de identidad número [Valor 008] en su condición de Presidente de la [...], la señora [Nombre 005], cédula de identidad número [Valor 006] en su condición de Presidente de la [...], el señor [Nombre 006], cedula de identidad número [Valor 007] en su condición de Presidente de la [...]. SEGUNDO: Que a fin de establecer la verdad real de los hechos denunciados el día 16 de abril del 2026 por el señor [Nombre 001] en su condición de apoderado generalísimo de la sociedad [Nombre 002] S.R.L, este Tribunal considera necesario solicitar la siguiente información: 1 .- Al señor Juan Diego González Picado, en su condición de Alcalde de la Municipalidad de San Carlos o quien ocupe su cargo, que le informe a este Tribunal: a) Indicar si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de obra constructiva o proyecto y, si este cuenta con los permisos respectivos, b) De existir alguna actividad sin contar con los permisos respectivos, indicar que acciones ha tomado dicha Municipalidad al respecto, c) Brindar cualquier otra información que considere relevante para la tramitación de la presente denuncia. 2 .- Al Ing. José Miguel Zeledón Calderón en su condición de Director de la Dirección de Agua o quien ocupe su cargo y a la señora Nancy Quesada Artavia, coordinadora de la Unidad Hidrológica San Juan que: a) realice según sus competencias inspección al sitio de la denuncia, con el fin de determinar la existencia o no de algún cuerpo de agua que se pueda ver afectado por los hechos denunciados b) En caso de existir algún cuerpo de agua emitir el respectivo criterio técnico de la naturaleza y condición del mismo, c) De ser procedente emitir la correspondiente valoración económica del daño. Adjunto escrito de la denuncia. 3 .- A la Dr. Juan Carlos Jiménez Bonilla, en su condición de Director del Área Rectora de Salud de Huetar Norte (San Carlos) que informe a este Tribunal: a) Si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de permiso de funcionamiento, para la ubicación, construcción y funcionamiento de una Granja Avícola. 4 .- Al señor Alfredo Sequeira Ávalos, Director Regional de la Oficina Huetar Norte del Servicio Nacional de Salud Animal (SENASA) o a quien ocupe su cargo, que informe a este Tribunal informe si en el sitio de la denuncia la propiedad [Valor 012] Plano A-0006232- 2025, existen permisos o certificado de operación para una Granja Avícola, así como cualquier otra información que considere relevante para la tramitación de la presente denuncia. 5 .- Al señor José Manuel Alvarado Arguedas, en su condición de Jefe de la Oficina de Subregional de Pital, Área de Conservación Huetar Norte del SINAC, o a quien ocupe su cargo que: a) Realice una inspección al sitio de la denuncia para que informe sobre los hechos denunciados conforme a sus competencias, b) En caso de ser procedente, remitir la correspondiente valoración económica del supuesto daño ambiental, acorde a los hechos denunciados. 6 .- Al señor Ulises Álvarez Acosta, en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental (SETENA) o quien ocupe su puesto o a quien designe, si de acuerdo a las competencias de la dependencia a su cargo, en la finca número [Valor 012] Plano [Valor 013] existe algún proyecto presentado para su respectiva evaluación ambiental, si cuenta con expediente en dicha dependencia o si se ha otorgado viabilidad ambiental para desarrollar algún proyecto en la propiedad denunciada. TERCERO: Para la presentación de los informes requeridos, se les concede un plazo de diez días naturales contados a partir del día hábil siguiente a la notificación de la presente resolución”. (Ver prueba documental).

IV. SOBRE EL CASO CONCRETO

En el sub lite, la parte recurrente acusa que, el 16 de abril de 2026, el recurrente [Nombre 001] interpuso una denuncia por daño ambiental contra [Nombre 007] Ltda y [Nombre 008] por el supuesto desarrollo de un proyecto avícola a gran escala, sin contar con los permisos legales y ambientales necesarios. Señalan que, según se ha podido constatar en el sitio, continúan las labores de construcción de la granja avícola objeto de la denuncia, lo que podría ocasionar afectaciones ambientales de difícil o imposible reparación conforme fue expuesto en el escrito inicial. Indican que dicha granja se está construyendo sin los permisos de ley, lo que provocaría un daño al ambiente sano y equilibrado del que gozan las comunidades representadas por las asociaciones recurrentes, y que, tratándose de una solicitud cautelar destinada a prevenir daños ambientales potencialmente irreversibles, el transcurso de más de dos meses sin resolución alguna por parte de la autoridad competente constituye una demora injustificada, incompatible con los principios de prevención y precaución ambiental. Reclaman que, al momento de la interposición del recurso, la autoridad recurrida no se había resuelto nada al respecto de la denuncia y la solicitud de medida cautelar de interés.

De los autos se desprende que, el 16 de abril de 2026, el recurrente [Nombre 001], en su condición de gerente del [Nombre 002] Sociedad de Responsabilidad Limitada, planteó una denuncia ante el Tribunal Ambiental Administrativo en contra de la sociedad [Nombre 007] Sociedad de Responsabilidad Limitada por daño ambiental, específicamente por la construcción sin permisos de una granja avícola. A tal denuncia se le asignó el expediente 085-26-01-TAA. Al momento de interposición de este recurso, la denuncia antedicha aún no había sido atendida. El 8 de julio de 2026, las autoridades accionadas fueron notificadas del curso de este proceso.

Finalmente, mediante resolución nro. 708-2026-TAA del 13 de julio de 2026, el Tribunal Ambiental Administrativo dispuso: “POR TANTO EL TRIBUNAL AMBIENTAL ADMINISTRATIVO Con fundamento en los artículos 50 de la Constitución Política, 103, 106, 107, 109 y 111 de la Ley Orgánica del Ambiente, 214, 262, 275, 297, 302 y 308 de la Ley General de la Administración Pública, así como los artículos 1 y 22 del Decreto Ejecutivo número 34136- MINAE, este Tribunal resuelve: PRIMERO: Con fundamento en lo dispuesto por los artículos 276 a 279 de la Ley General de la Administración Pública, en el presente procedimiento administrativo se tiene como PARTE COADYUVANTE DE LA PARTE DENUNCIANTE, a las siguientes personas: al señor [Nombre 003], cédula de identidad número [Valor 009] en su condición de Presidente de la [...], el señor [Nombre 004], cédula de identidad número [Valor 008] en su condición de Presidente de la [...], la señora [Nombre 005], cédula de identidad número [Valor 006] en su condición de Presidente de la [...], el señor [Nombre 006], cedula de identidad número [Valor 007] en su condición de Presidente de la [...].

SEGUNDO: Que a fin de establecer la verdad real de los hechos denunciados el día 16 de abril del 2026 por el señor [Nombre 001] en su condición de apoderado generalísimo de la sociedad [Nombre 002] S.R.L, este Tribunal considera necesario solicitar la siguiente información: 1 .- Al señor Juan Diego González Picado, en su condición de Alcalde de la Municipalidad de San Carlos o quien ocupe su cargo, que le informe a este Tribunal: a) Indicar si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de obra constructiva o proyecto y, si este cuenta con los permisos respectivos, b) De existir alguna actividad sin contar con los permisos respectivos, indicar que acciones ha tomado dicha Municipalidad al respecto, c) Brindar cualquier otra información que considere relevante para la tramitación de la presente denuncia. 2 .- Al Ing. José Miguel Zeledón Calderón en su condición de Director de la Dirección de Agua o quien ocupe su cargo y a la señora Nancy Quesada Artavia, coordinadora de la Unidad Hidrológica San Juan que: a) realice según sus competencias inspección al sitio de la denuncia, con el fin de determinar la existencia o no de algún cuerpo de agua que se pueda ver afectado por los hechos denunciados b) En caso de existir algún cuerpo de agua emitir el respectivo criterio técnico de la naturaleza y condición del mismo, c) De ser procedente emitir la correspondiente valoración económica del daño.

Adjunto escrito de la denuncia. 3 .- A la Dr. Juan Carlos Jiménez Bonilla, en su condición de Director del Área Rectora de Salud de Huetar Norte (San Carlos) que informe a este Tribunal: a) Si en el sitio de la denuncia, ubicada en la Provincia de [...], finca [Valor 012] Plano [Valor 013], existe algún tipo de permiso de funcionamiento, para la ubicación, construcción y funcionamiento de una Granja Avícola. 4 .- Al señor Alfredo Sequeira Ávalos, Director Regional de la Oficina Huetar Norte del Servicio Nacional de Salud Animal (SENASA) o a quien ocupe su cargo, que informe a este Tribunal informe si en el sitio de la denuncia la propiedad [Valor 012] Plano A-0006232- 2025, existen permisos o certificado de operación para una Granja Avícola, así como cualquier otra información que considere relevante para la tramitación de la presente denuncia. 5 .- Al señor José Manuel Alvarado Arguedas, en su condición de Jefe de la Oficina de Subregional de Pital, Área de Conservación Huetar Norte del SINAC, o a quien ocupe su cargo que: a) Realice una inspección al sitio de la denuncia para que informe sobre los hechos denunciados conforme a sus competencias, b) En caso de ser procedente, remitir la correspondiente valoración económica del supuesto daño ambiental, acorde a los hechos denunciados. 6 .- Al señor Ulises Álvarez Acosta, en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental (SETENA) o quien ocupe su puesto o a quien designe, si de acuerdo a las competencias de la dependencia a su cargo, en la finca número [Valor 012] Plano [Valor 013] existe algún proyecto presentado para su respectiva evaluación ambiental, si cuenta con expediente en dicha dependencia o si se ha otorgado viabilidad ambiental para desarrollar algún proyecto en la propiedad denunciada. TERCERO: Para la presentación de los informes requeridos, se les concede un plazo de diez días naturales contados a partir del día hábil siguiente a la notificación de la presente resolución”.

Desde este panorama, lo correspondiente es acoger el recurso. En este sentido, nótese que no fue sino con ocasión de la tramitación de este recurso y transcurridos casi tres meses, que el tribunal administrativo accionado dio curso a la denuncia en cuestión y solicitó prueba; empero, ello no significa que el procedimiento se encuentre resuelto, lo que se traduce en una flagrante violación al numeral 41 constitucional.

V. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008- 02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara con lugar el recurso. Se le ordena a Adriana Bejarano Alfaro, en su condición de presidenta del Tribunal Ambiental Administrativo, o a quien ocupe ese cargo, que gire las órdenes pertinentes y disponga lo necesario dentro del ámbito de sus competencias respectivas, para que, en el plazo máximo de DOS MESES, contado a partir de la notificación de esta sentencia, resuelva en definitiva la denuncia formulada por la parte recurrente que es objeto de este recurso y le notifique lo correspondiente al medio señalado para ese fin. Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo.
