CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the twenty-first of July, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case number 26-024615-0007-CO, brought by Nombre01, national identification number CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
Justice (Magistrado) Castillo Víquez writes the opinion; and,
Considering:
The petitioner claims that the Instituto Costarricense de Acueductos y Alcantarillados ordered the ASADA de Paraíso-Junquillal to divert water resources toward the community of Avellanas without an updated technical, scientific, and hydrological assessment guaranteeing the capacity and sustainability of the aquifer supplying said community, and that, at the same time, works were carried out to effectuate that transfer, while the ASADA maintains a moratorium on the granting of new water connections and water meters in the district of Paraíso and Junquillal. He considers that this infringes upon the fundamental right of access to water and requests that the necessary measures be adopted to prevent the execution of the water transfer under the reported conditions.
Having examined the petitioner's allegations and claims, the Sala notes that it is not an overseer of the legality of acts or decisions adopted by the Instituto Costarricense de Acueductos y Alcantarillados in the exercise of the powers conferred upon it by the legal framework (ordenamiento jurídico) for the administration and management of water resources, nor may it substitute for the active Administration in weighing the technical, scientific, and hydrological criteria underlying its decisions. In that regard, it is not for this Sala to determine whether the order to transfer water resources to another community was issued with adequate technical support, whether the aquifer's capacity guarantees the sustainability of the service, whether the infrastructure built for that purpose conforms to the legal framework, or whether the moratorium on the granting of new water connections and water meters is procedurally sound—these are matters whose resolution requires a legality analysis and a predominantly technical inquiry that falls within the purview of the competent administrative authorities and, where applicable, the ordinary courts (jurisdicción ordinaria).
It should also be noted that the petitioner does not claim to have previously raised his grievances before the respondent authority; instead, he comes directly to this constitutional forum to challenge the legality and technical basis of the acts reported, without this Tribunal being meant to serve as a mere venue for processing complaints or reviewing administrative action. Furthermore, it is important to note that, while the petitioner invokes an infringement of the fundamental right of access to water, that claim rests on a potential harm stemming from the future execution of the transfer of water resources to another community and from the consequences that, in his estimation, this could have on the water supply of the Paraíso-Junquillal water system. However, from the facts alleged, it cannot be inferred that, at the time the petition was filed, there exists a current infringement or a certain and imminent threat to the enjoyment of that fundamental right; rather, what exists is a concern regarding a future and uncertain scenario.
In light of the foregoing, the petitioner must raise his grievances or claims before the respondent authorities or before the competent court, venues in which he may, fully and at length, argue the merits and assert his claims. Accordingly, the writ of amparo is inadmissible.
The petitioner is hereby notified that, if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the Clerk's office within a maximum period of 30 working days counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiuno de julio de dos mil veintiseis .
Recurso de amparo que se tramita en el expediente número 26-024615-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados ordenó a la ASADA de Paraíso-Junquillal desviar recursos hídricos hacia la comunidad de Avellanas sin contar con una evaluación técnica, científica e hidrológica actualizada que garantice la capacidad y sostenibilidad del acuífero que abastece a dicha comunidad y que, paralelamente, se ejecutaron obras para materializar ese traslado, mientras la ASADA mantiene una moratoria para el otorgamiento de nuevas pajas y medidores de agua en el distrito de Paraíso y Junquillal. Considera que lo anterior lesiona el derecho fundamental de acceso al agua y solicita que se adopten las medidas necesarias para evitar la ejecución de la transferencia de agua en las condiciones denunciadas.
Vistos los alegatos y pretensiones del recurrente, se le hace saber que esta Sala no es un contralor de la legalidad de las actuaciones o decisiones adoptadas por el Instituto Costarricense de Acueductos y Alcantarillados en el ejercicio de las competencias que el ordenamiento jurídico le confiere para la administración y gestión del recurso hídrico, ni puede sustituir a la Administración activa en la valoración de los criterios técnicos, científicos e hidrológicos que sustentan sus decisiones. En ese sentido, no le corresponde determinar si la orden de trasladar recursos hídricos hacia otra comunidad fue emitida con el debido respaldo técnico, si la capacidad del acuífero garantiza la sostenibilidad del servicio, si la infraestructura ejecutada para ese fin se ajusta al ordenamiento jurídico o si la moratoria para el otorgamiento de nuevas pajas y medidores resulta procedente, por tratarse de aspectos cuya resolución exige un análisis de legalidad y de carácter eminentemente técnico que corresponde conocer a las autoridades administrativas competentes y, en su caso, a la jurisdicción ordinaria.
Nótese, además, que el recurrente no afirma haber planteado previamente sus inconformidades ante la autoridad recurrida, sino que acude directamente a esta jurisdicción constitucional para cuestionar la legalidad y el fundamento técnico de las actuaciones denunciadas, sin que corresponda a este Tribunal fungir como una mera instancia tramitadora de denuncias o revisora de la actuación administrativa. Aunado a lo anterior, es importante indicar que, si bien el recurrente invoca una lesión al derecho fundamental de acceso al agua, lo cierto es que tal afirmación se sustenta en una afectación eventual derivada de la futura ejecución del traslado de recursos hídricos hacia otra comunidad y de las consecuencias que, según estima, ello podría generar sobre el abastecimiento del acueducto de Paraíso-Junquillal. Sin embargo, de los propios hechos expuestos no se desprende que, al momento de interponerse el recurso, exista una afectación actual o una amenaza cierta e inminente al disfrute de ese derecho fundamental, sino una preocupación respecto de un escenario futuro e incierto.
En virtud de lo expuesto, deberá la parte recurrente plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el amparo resulta inadmisible.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
