PROCEEDING: AMPARO PETITION (RECURSO DE AMPARO) RULING Nº 2026027369 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the seventeenth of July, two thousand and twenty-six.

Amparo petition filed by Nombre01, national identity card (cédula de identidad) CED02, on behalf of ASOCIACION CULTURAL INDIGENA TERIBE, legal entity identification number (cédula jurídica) CED01, against the FONDO NACIONAL DE FINANCIAMIENTO FORESTAL and the ASOCIACION DE DESARROLLO INTEGRAL DEL TERRITORIO INDIGENA DE TERRABA.

Background:

  1. 1By a written submission received by this Court on July 8, 2026, the petitioning party files an amparo petition against the FONDO NACIONAL DE FINANCIAMIENTO FORESTAL and the ASOCIACION DE DESARROLLO INTEGRAL DEL TERRITORIO INDIGENA TERRABA, and states that the protected party is a family association made up of members of the family surnamed Nombre01, indigenous people of the Brörán nation residing in the Territorio Indígena Térraba, in Buenos Aires de Puntarenas. The Asociación de Desarrollo Integral del Territorio Indígena Térraba appears as the holder of registered title (propiedad registral) over a significant portion of the lands within the territory. However, this does not reflect actual physical possession (posesión material) of the lands, which are possessed and worked by individual indigenous families. The petitioner explains that the Nombre01 family exclusively, continuously, and openly possesses and works the 53.1 hectares corresponding to the registered property (finca matrícula) bearing registration number from the Puntarenas registry.This possession predates the execution of the challenged Pago de Servicios Ambientales contract and was known to the Fondo Nacional de Financiamiento Forestal. The petitioner explains that on September 24, 2019, the Fondo Nacional de Financiamiento Forestal executed PSA contract number PN-01-222-0050-2019 with the Asociación de Desarrollo Integral del Territorio Indígena Térraba, covering a total area of 74.9 hectares under the forest protection modality, with a payment of 442,942 colones per hectare and a term of ten years, from September 24, 2019 to September 24, 2029. This area encompasses two registered properties: registration number with 21.8 hectares and registration number with 53.1 hectares, without the petitioner having been convened, consulted, or included as a party to the contract. Upon executing the contract, the Asociación de Desarrollo Integral del Territorio Indígena Térraba warranted to the Fondo Nacional de Financiamiento Forestal, in clause seven, subparagraph h, that it held possession and ownership over the entirety of the contracted area; yet, even though the association holds registered title to the property, actual physical possession does not belong to the association — it belongs to the Nombre01 family — making the warranty provided materially false.The petitioner further states that the Fondo itself prepared, on May 31, 2019 — four months before the contract was signed — the technical study for project number PN-01-222-0050-2019, in which the Asociación Cultural Indígena Teribe was expressly identified as the beneficiary of the environmental service corresponding to registered property number with 53.1 hectares, and Mr. Nombre02 as the beneficiary of registered property number with 21.8 hectares; and that, notwithstanding the Fondo Nacional de Financiamiento Forestal's prior knowledge of this before the contract was signed, the petitioner was excluded from it. Against this backdrop, following prior efforts made in 2024 in which the respondent Fondo was informed of the situation, on May 28, 2025, the petitioner's legal representative sent a formal communication to the Director of Environmental Services Development and Marketing of the Fondo Nacional de Financiamiento Forestal, requesting an in-person meeting to clarify the petitioner's status as a beneficiary under contract number PN-01-222-0050-2019.The petitioner adds that the meeting was confirmed and took place on June 17, 2025, at which the Fondo Nacional de Financiamiento Forestal refused to recognize the petitioner as a beneficiary, invoking the principle of legality and the registered title of the Asociación de Desarrollo Integral del Territorio Indígena Térraba as the basis for its refusal. The petitioner considers these arguments to be constitutionally insufficient to justify the exclusion of the protected party, and states that, as of the date of filing of the present matter, the Fondo Nacional de Financiamiento Forestal continues to execute the contract without recognizing the petitioner's participation, and is directing the PSA payments corresponding to the 53.1 hectares of the registration number exclusively to the Asociación de Desarrollo Integral del Territorio Indígena Térraba. For the foregoing reasons, the petitioner considers this to be injurious to her fundamental rights. The petitioner requests that the petition be granted with all legal consequences.
  2. 2Article 9 of the Law on Constitutional Jurisdiction authorizes this Court to dismiss outright or on the merits, at any time — including from the moment of filing — any matter brought before it that is manifestly inadmissible, or when this Court considers that there are sufficient elements of judgment to reject it, or that it constitutes a mere reiteration or reproduction of a prior identical or similar rejected petition.

The opinion is authored by Justice Castillo Víquez; and,

Considering:

I. SUBJECT MATTER OF THE PETITION

From the instant case, it is clear that the petitioning party's claim is to express its disagreement with its failure to be included as a beneficiary in contract number PN-01-222-0050-2019 entered into between the Asociación de Desarrollo Integral del Territorio Indígena Térraba and the Fondo Nacional de Financiamiento Forestal, in which it was warranted, under clause seven, subparagraph h, that the Fondo Nacional de Financiamiento Forestal held possession and ownership over the entirety of the contracted area; yet, even though the Asociación de Desarrollo Integral del Territorio Indígena Térraba holds registered title to the property, actual physical possession belongs to the Nombre01 family, making the warranty provided materially false. The petitioner requests this Court's intervention.

II. ON THE SPECIFIC CASE

In this regard, it is appropriate to clarify that it is not within the competence of this Court to determine whether the contractual conduct of the respondent authority was lawful, as this is a matter of ordinary legality (mera legalidad) that falls outside this Court's jurisdiction and must therefore be raised and resolved through the ordinary courts (vía ordinaria). Nor can this Court act as a mediator with respect to any particular natural or legal person — whether the latter is governed by public or private law — to intercede on behalf of a third party so that such party may obtain what it seeks. Accordingly, the petitioning party should, if it sees fit, raise its objections or claims before the respondent authorities or before the competent judicial forum, before which it may broadly discuss the merits of the matter and assert its claims. In light of the foregoing, the petition is inadmissible and is so declared.

Furthermore, with respect to the grievances raised by the petitioning party regarding the alleged violation of the principle of equality and non-discrimination, it should be noted that, on repeated occasions, this Court has established that it is not sufficient for the petitioning party to merely assert, without more, that in a given case a different treatment was applied to two subjects, in order for such a violation to be considered established. On the contrary, the party alleging the violation is obligated to provide elements that allow for a full comparison between the subjects treated differently. However, given the eminently summary nature of the amparo proceeding (proceso de amparo), it is evident that the element of comparison must be of such a nature that it does not require prior analysis of the affected party's situation under ordinary law. Nor, however, would it fall within the jurisdiction of this Court to evaluate, determine, or classify each particular case in order to grant what is sought. By virtue of the foregoing, the petitioning party should raise its objections or claims through the appropriate ordinary legal forum. Consequently, the petition is declared inadmissible.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby notified that, should they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office (despacho) within a maximum period of 30 business days counted from the notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, in accordance with the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial número 19 of January 26, 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.

Therefore:

Revisión del Documento PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026027369 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diecisiete de julio de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED02, a favor de ASOCIACION CULTURAL INDIGENA TERIBE, cédula jurídica CED01, contra el FONDO NACIONAL DE FINANCIAMIENTO FORESTAL, la ASOCIACION DE DESARROLLO INTEGRAL DEL TERRITORIO INDIGENA DE TERRABA.

Resultando:

  1. 1Por escrito recibido en esta Sala el 08 de julio de 2026, la parte recurrente interpone recurso de amparo contra el FONDO NACIONAL DE FINANCIAMIENTO FORESTAL y la ASOCIACION DE DESARROLLO INTEGRAL DEL TERRITORIO INDIGENA TERRABA, y manifiesta que la amparada es una asociación de familia integrada por miembros de la familia de apellido Nombre01, indígenas del pueblo Brörán con domicilio en el Territorio Indígena Térraba, en Buenos Aires de Puntarenas. La Asociación de Desarrollo Integral del Territorio Indígena Térraba, figura como propietaria registral de una porción significativa de las tierras del territorio. No obstante, no refleja la posesión material efectiva de las tierras, las cuales son poseídas y trabajadas por familias indígenas de manera individual. Explica que, la familia Nombre01 posee y trabaja de manera exclusiva, continua y pública las 53,1 hectáreas correspondientes a la finca matrícula número del partido de Puntarenas.Posesión que es anterior a la celebración del contrato del pago de servicios ambientales cuestionado y del conocimiento del Fondo Nacional de Financiamiento Forestal. Explica que, el 24 de setiembre de 2019 el Fondo Nacional de Financiamiento Forestal suscribió el contrato de pago de servicios ambientales número PN-01-222-0050-2019 con la Asociación de Desarrollo Integral del Territorio Indígena Térraba, el cual cubre una extensión total de 74,9 hectáreas bajo la modalidad de protección de bosque, con un pago de 442,942 colones por hectárea y con una vigencia de diez años, del 24 de setiembre de 2019 al 24 de setiembre de 2029. Área que comprende dos fincas, la matrícula número con 21,8 hectáreas y la matrícula número de 53,1 hectáreas, sin que la recurrente fuera convocada, consultada ni incluida como parte del contrato. Al suscribir el contrato, la Asociación de Desarrollo Integral del Territorio Indígena Térraba garantizó al Fondo Nacional de Financiamiento Forestal en su cláusula séptima, inciso h, que tenía posesión y propiedad sobre la totalidad del área contratada, pese a que, si bien la asociación ostenta la propiedad registral de la finca, la posesión material no le corresponde a la familia de apellido bre01, s, siendo la garantía ofrecida materialmente falsa.Expone que, el propio fondo elaboró el 31 de mayo de 2019, o sea, cuatro meses antes de la firma del contrato, el estudio técnico del proyecto número PN-01-222-0050-2019, donde se identificó expresamente a la Asociación Cultural Indígena Teribe, como beneficiaria del servicio ambiental correspondiente a la finca número de 53,1 hectáreas y al señor Nombre02 como beneficiario de la finca de matrícula número con 21,8 hectáreas y, pese a que el Fondo Nacional de Financiamiento Forestal tenía conocimiento previo a la firma del contrato, excluyeron al recurrente de este. Así las cosas, en seguimiento a gestiones previas realizadas en 2024, donde se informó al fondo recurrido de la situación, el 28 de mayo de 2025 su representante legal dirigió una comunicación formal a la directora de Desarrollo y Comercialización de Servicios Ambientales del Fondo Nacional de Financiamiento Forestal, solicitando una reunión presencial para aclarar la condición de la aquí recurrente como beneficiaria del contrato número PN-01-222-0050-2019.Agrega que, se le confirmó la reunión, la cual se llevó a cabo el 17 de junio de 2025, donde el Fondo Nacional de Financiamiento Forestal rechazó el reconocimiento de la recurrente como beneficiaria, invocando el principio de legalidad y propiedad registral de la Asociación de Desarrollo Integral del Territorio Indígena Térraba como fundamento de su negativa. Argumentos que considera no justifican constitucionalmente la exclusión de la amparada y a la fecha de interposición del presente asunto, el Fondo Nacional de Financiamiento Forestal continúa ejecutando el contrato sin reconocer la participación de la accionante y dirigiendo los pagos del PSA correspondientes a las 53,1 hectáreas de la matrícula exclusivamente a la Asociación de Desarrollo Integral del Territorio Indígena Térraba. Por lo anterior, lo considera lesivo a sus derechos fundamentales. Solicita se declare con lugar el recurso con sus consecuencias.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

Del sub-lite, se desprende que la pretensión de la parte recurrente es manifestar su disconformidad con la falta de inclusión como beneficiaria en el contrato número PN-01-222-0050-2019 contraído entre la Asociación de Desarrollo Integral del Territorio Indígena Térraba y el Fondo Nacional de Financiamiento Forestal donde se garantizó al en su clausula séptima inciso h que el Fondo Nacional de Financiamiento Forestal tenía posesión y propiedad sobre la totalidad del área contratada, pese a que si bien la Asociación de Desarrollo Integral del Territorio Indígena Térraba ostenta la propiedad registral de la finca la posesión material le corresponde a la familia de apellido Nombre01, siendo la garantía ofrecida materialmente falsa. Solicita la intervención de esta Sala.

II. SOBRE EL CASO CONCRETO

Sobre el particular, conviene aclarar que no compete a este Tribunal determinar si la actuación contractual de la autoridad recurrida, por cuanto se trata de un tema de mera legalidad ajeno al ámbito de competencia de esta Sala, por lo que deberá ser planteado y resuelto en la vía ordinaria. Tampoco, puede este Tribunal fungir como mediador ante una determinada persona física o jurídica -ya sea esta última de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que pretende. Por ello, deberá la parte recurrente, a bien lo tiene, plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En mérito de lo expuesto, el recurso deviene inadmisible y así se declara.

Ahora bien, Respecto a los agravios expuestos por la parte recurrente, en cuanto a la alegada violación al principio de igualdad y no discriminación, cabe destacar que, en reiteradas ocasiones, esta Sala ha establecido que no le basta a la parte recurrente afirmar, sin más, que en un caso dado se ha producido un trato distinto entre dos sujetos, para tener por demostrado ese quebranto. Por el contrario, quien alega la violación, está obligado a aportar elementos que permitan efectuar una comparación plena entre los sujetos tratados en forma diferente. Sin embargo, dado el carácter eminentemente sumario del proceso de amparo, es obvio que el elemento de comparación debe ser de tal naturaleza que no haga necesario entrar a analizar, de previo, cuál es la situación de la parte afectada en el plano de la legalidad ordinaria. No obstante, tampoco le correspondería a esta sede constitucional entrar a valorar, determinar ni calificar, cada caso particular, para otorgar lo que se pretende. En virtud de lo anterior, deberá la parte recurrente plantear sus inconformidades o reclamos en la vía de legalidad correspondiente. En consecuencia, el recurso se declara inadmisible.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI

Por tanto:

Se rechaza de plano el recurso.
