UPDATES Given the existence of a pending writ and knowledge that ASADA Higuito was unable to comply with the proposed remedial plan due to the denial of access to the property where Naciente Nombre02 is located in order to install the protective mesh, Ms. Calvo Díaz recommends submitting a formal request by official letter to Mr. Gerardo Asdrubal De La Trinidad Jiménez Navarro, within 5 business days, to inform in writing whether he, in his capacity as representative of Sociedad Yubane Sociedad Anónima, objects to ASADA Higuito performing the protective works at Naciente Nombre02 (protective mesh), Dirección01. If so, he should provide the technical or legal basis justifying his apparent objection. The measure was requested by the Regional Health Authority of El Guarco in response to the risk of contamination of the water source due to exposure to the entry of persons or animals, and in compliance with the Reglamento para la calidad de agua potable No. 38924-S.
The management of ASADA Higuito has not complied with the measure, due to apparent opposition on his part. Said measure is not subject to or conditioned upon the granting of water service connections to the property owner. The request for information is made pursuant to Art. 4-5-6-37-340-341-378 of the Ley General de Salud. CONCLUSIONS This report demonstrates that the Regional Health Authority of El Guarco has carried out all actions within its competence in the most diligent manner possible to address matters related to monitoring the quality of potable water, from the first intervention with the inspection on June 13, 2025, through the follow-up verification actions under sanitary order No. MS-DRRSCE-DARSEG-OS-091-2025, including the verification visit conducted on February 18, 2026 (…) REQUEST In light of the foregoing, we respectfully ask the Honorable Constitutional Chamber to resolve this matter guided at all times by the principle of legality and in application of the relevant decrees, measures, and technical guidelines, seeking to prevent and manage risk in a safe manner (precautionary principle) at the required level of priority, in accordance with the provisions of the Reglamento para la calidad de agua potable No. 38924-S. (…) (sic)".
The opinion is written by Justice Araya García; and,
Considering:
I.Preliminary Matters. Given that this matter is filed against a subject of public law, before examining the merits—regarding the alleged violation of the right to a prompt and complete proceeding—it must be clarified that, based on Ruling No. 2008-2545 issued at 08:55 hours on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those cases in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific statutes for special administrative proceedings, in order to resolve by means of a final act an administrative proceeding—initiated ex officio or at the request of a party—or to hear applicable administrative appeals. Specifically in the sub lite, an exceptional circumstance is presented, as this involves an alleged delay in resolving matters relating to the adequate supply of potable water, due to non-compliance with a sanitary order issued by the Ministerio de Salud.
Likewise, as the writ is also filed against a subject of private law, it must be emphasized that, given its exceptional nature, the ordinary processing of writs of amparo against private-law subjects requires beginning by examining whether, in the specific case, we are or are not faced with one of the circumstances that renders it admissible, and then—subsequently and if so—determining whether it is well-founded or not. In this regard, the Ley de la Jurisdicción Constitucional, in its Article 57, stipulates under what circumstances a writ of amparo against acts or omissions of private-law subjects is admissible—that is, when such subjects act or are required to act in the exercise of public functions or powers, or are, in law or in fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights and freedoms referred to in Article 2°, subsection a), of that same Act.
In view of the foregoing, in the specific case at hand, one of these prerequisites is met, since, even though adequate ordinary judicial proceedings exist to satisfy the protected party's claim, the outcome of such proceedings would be untimely, resulting in harm that would be difficult or impossible to remedy, given that the respondent company is the owner of the property on which the spring that must be protected by the respondent authorities is located, and it has been established that access thereto has been denied. Accordingly, the writ of amparo is also admissible against said entity, and in light of both aspects addressed, the Court proceeds to examine the merits of the case.
II.Subject Matter of the Writ. The petitioner, in his capacity as representative of the ASADA of Higuito de El Guarco, alleges the violation of the fundamental rights of the users of the community's potable water service. He states that the water supply depends, in part, on a duly conceded spring located within a property belonging to the respondent company. He notes that the Regional Health Authority of El Guarco ordered the installation of a protective perimeter mesh around said water source; however, he claims that the respondent company has unjustifiably prevented the execution of those works, thereby jeopardizing compliance with the sanitary order and the continuity of the potable water service for the beneficiary population.
III.Established Facts. For the purpose of this decision, the following facts are considered duly proven, either because they have been established on the record or because the respondent failed to address them as required in the initial order:
From the combined reading of Articles 21 and 50 of the Constitución Política, there arise the right of persons to life, health, and a healthy and ecologically balanced environment, rights that are intimately connected, given that life, as the supreme value of the Constitución Política, entails special protection, since without life, the protection of all other fundamental rights would serve little purpose. Accordingly, life must be protected in all its dimensions—physical, mental, and environmental—and it is precisely here that the importance of protecting the environment and natural resources emerges, in order to promote the well-being of persons. Now, among other things, that well-being is achieved through the protection and conservation of the quality and quantity of water resources, so that water may be fit for human consumption and thereby safeguard the health of persons, since, as a resource essential for hygiene, food, and drink, its contamination can cause serious harm to public health.
In that regard, the protection and conservation referred to must be provided by the State, through the bodies it designates for that purpose, which shall adopt the necessary measures to guarantee access to that resource for all persons, as well as ensure compliance with those measures. Within that framework, the right to water arises, which may be protected by this Constitutional Tribunal through the amparo proceeding (Sentencia No. 2007-005482 of 14:39 hours on April 24, 2007, reiterated in No. 2021-005089 of 09:15 hours on March 12, 2021 and recently in No. 2025-002839 of 09:20 hours on January 31, 2025).
V.On the merits. In the sub lite, the petitioner, in his capacity as representative of the ASADA de Higuito de El Guarco, alleges a violation of the fundamental rights of the users of the drinking water service in that community. He states that the water supply depends, in part, on a spring operating under a duly granted water concession located within a property belonging to the respondent company. He indicates that the Área Rectora de Salud de El Guarco ordered the installation of a protective perimeter fence around said water source; however, he claims that the respondent company has unjustifiably prevented the execution of those works, thereby jeopardizing compliance with the sanitary order and the continuity of the drinking water service for the beneficiary population.
Now, after analyzing the evidentiary elements submitted, this Tribunal finds a violation of the right to prompt and effective justice (justicia pronta y cumplida) in administrative proceedings. This is because the report filed by the representative of the respondent authority—which is deemed to have been given under oath with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter have duly established that the Área Rectora de Salud de El Guarco, in the exercise of its public health oversight powers, conducted the corresponding inspections of the supply system administered by the ASADA de Higuito, identified the need to adopt protective measures at the spring Los Fuentes, issued the corresponding sanitary order, and monitored compliance through subsequent inspections and technical assessments.
It was likewise established that the ASADA addressed that order by submitting the required remedial plan and executed the corrective measures ordered, with the exception of the installation of the perimeter fence at the spring Los Fuentes, the non-compliance with which was due to the material impossibility of accessing the property where the water intake source is located, since, at the time the petition giving rise to this amparo was filed, the installation of the perimeter fence required by the health authority had not been able to be carried out due to the lack of authorization to access the private property where the spring Los Fuentes is located. Indeed, the technical report of May 4, 2026 expressly determined that this was the only measure still pending compliance—a situation capable of compromising the protection of a supply source used by the community and that therefore directly affected the guarantee of the fundamental right of access to drinking water under adequate conditions of quality and healthfulness, a right that this Chamber has repeatedly recognized.
However, it was also established that following notification of this amparo petition, the representative of the company YUBANE S.A. expressly authorized access to the property and stated that he did not object to the execution of the protective works ordered by the Ministerio de Salud. As a result, the ASADA was able to begin the required works and, finally, through an inspection conducted on June 29, 2026, the Ministerio de Salud verified that the perimeter fence had been installed and that no measures remained pending in connection with the sanitary order issued.
This being the case, while the record shows that both the Instituto Costarricense de Acueductos y Alcantarillados and the corresponding Health Governance Area carried out various administrative steps aimed at securing compliance with the protective measures ordered with respect to the spring Nombre02, the fact is that those actions were not sufficient to satisfy the obligations imposed upon them. Indeed, although the representative of YUBANE S.A. allegedly objected on various occasions to the entry of officials onto the property where said spring is located, that circumstance did not exempt the respondent authorities from the duty to exercise, through the appropriate legal means, the powers conferred upon them by the applicable regulations in order to ensure the execution of the sanitary order issued.
From that perspective, the refusal of the property owner or occupant constituted an obstacle that had to be overcome through the legal mechanisms established for that purpose, since the competent administrative authorities have powers to enforce the sanitary provisions issued to safeguard public health and the protection of water supply sources intended for human consumption. Consequently, even though multiple proceedings on the part of AyA and the Ministerio de Salud are noted, the fact is that they did not effectively and timely exercise the powers available to them to ensure the execution of the ordered works within a reasonable period and free of undue delays, allowing the reported situation to persist beyond what was acceptable.
Notwithstanding the foregoing—as indicated above—it has also been established that following notification of the ruling initiating this amparo proceeding, the protective works in question were finally executed and completed. Therefore, while the omissive conduct attributed to the respondent authorities and the improper conduct attributed to the respondent company existed at the time the writ was filed, their effects were remedied thereafter during the processing of this amparo proceeding.
VI.Conclusion: Accordingly, the writ is granted, pursuant to Article 52 of the Ley de la Jurisdicción Constitucional, with respect to the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud, on the grounds that they failed to timely exercise the powers necessary to ensure compliance with the sanitary order issued, without ordering payment of costs, damages, and losses, given that the works that were the subject of the claim were executed and completed during the processing of this writ. Likewise, with respect to the company YUBANE S.A., the writ is granted pursuant to Article 63 of the said Law.
VII.On the award of costs, damages, and losses pursuant to Article 52 of the Ley de la Jurisdicción Constitucional. Upon further consideration, the majority of the Chamber finds that, in the sub examine, in accordance with the provisions of the first paragraph of Article 52 of the Ley de la Jurisdicción Constitucional ("If, while an amparo is pending, an administrative or judicial ruling is issued that revokes, stays, or suspends the challenged act, the writ shall be granted solely for purposes of compensation and costs, if applicable"), the ruling in favor of the petitioner should not include a special award of costs, damages, and losses, based on the following considerations. While there is an express statutory provision requiring that the operative part of the judgment state that the writ is granted whenever the grievance is resolved while the amparo is pending, it is equally true that that same paragraph in fine states that the ruling in favor of the petitioner is issued "solely for purposes of compensation and costs, if applicable." It is noted that the Law states "if applicable," which means that the applicability or inapplicability of compensation and costs depends on an assessment, evaluation, or balancing by the Tribunal.
In cases such as this one, the nature of the relief sought by the protected party and the respondent authority's conduct in recognizing that relief suggest that the harms, injuries, or disruptions alleged are not directly related to a constitutional right of an evident patrimonial nature (as would be the case, for example, with an impact on the right to salary). To dispel any doubt on this point, it is important to highlight the provision of Article 51 of the same Ley de la Jurisdicción Constitucional, which states that: "every ruling granting the writ shall order in the abstract the compensation of damages and losses caused and the payment of the costs of the proceeding, and shall reserve their liquidation for execution of judgment," where no possibility of assessing whether compensation and costs are applicable is contemplated. The principles of Constitutional Law, Public and General Procedural Law, or, as applicable, those of International or Community Law, and, further, in order, the Ley General de la Administración Pública and the Código Procesal Contencioso Administrativo and other procedural codes, constitute supplementary sources for the application and interpretation of the rules of the Ley de la Jurisdicción Constitucional—cf.
Article 14. For the contentious-administrative jurisdiction, the legislature established a provision fully applicable to this case by analogy, in Article 197 of the Código Procesal Contencioso Administrativo, which corresponds to the procedural logic applicable in any area of law. In any event, the affected party in the sub lite retains the option of bringing, if deemed appropriate, a full evidentiary proceeding in order to demonstrate that some type of harm was suffered. Based on the foregoing, it is the majority's view to resolve this writ without a special award of costs, damages, and losses.
It is now necessary to note that through Sentencia N° 2024-12475 of 9:20 hours on May 10, 2024, itself citing Sentencia N° 2023-008973 of 09:20 hours on April 21, 2023, this Constitutional Chamber ruled, in the relevant part, as follows:
"V.- On the specific case.
(…) Now, this Tribunal finds harm to the fundamental rights of the protected party, since it has not been established that the payroll deductions made to the petitioner were carried out by Cooperativa Autogestionadora de Protección Familiar R.L. pursuant to a contract signed by the petitioner or based on authorization expressly given by the protected party. It is noted that this Chamber issued a warning to the legal representative of the respondent cooperative to submit the contract showing that the petitioner was a member, or the contract concerning the multiple assistance plan referenced to justify the deductions; however, the representative merely reported that the petitioner had been excluded by Cooperativa Autogestionaria de Protección Familiar R.L. from all of its internal systems and contribution reactivation management, and that the petitioner's request for a refund of contributions in the amount of ₡47.200,00 was processed.
This demonstrates a violation of the protected party's right to salary and property, as no valid justification was established for the respondent Cooperative to have made the challenged deductions. In light of the foregoing, the Chamber finds it established that the situation violating the fundamental rights of the protected party was corrected while the amparo was pending, and therefore the writ is granted for purposes of compensation." (Emphasis added.)
"VI.- On the award of costs, damages, and losses in the specific case. For the reasons extensively set forth in the corresponding judgments, the majority of this Chamber holds that when the granting of an amparo petition is based on application of the first paragraph of Article 52 of the Ley de la Jurisdicción Constitucional—that is, because the challenged act is revoked, suspended, or stayed after the admissibility ruling in the amparo has been notified—said ruling in favor of the petitioner must be issued without a special award of damages and losses. However, upon further consideration and as an exceptional rule, it must be noted that when the amparo petition specifically concerns a direct patrimonial matter strictly related to the protection of pecuniary rights—such as the failure to pay salary or the benefits to which the interested party is entitled by right—full application of the ruling in favor of the petitioner is appropriate, including the corresponding award of costs, damages, and losses, since such an award serves as a guarantee that the amount owed may be honored by the Administration—on its own motion or upon request—with the appropriate updating or indexation to be determined in the context of ordinary legality, in the corresponding enforcement proceeding of the constitutional judgment in favor of the petitioner. It is for this reason that, in the case under study, the award of costs, damages, and losses is in fact applicable" (sentencia 9298-2018).
As can be observed, the Chamber reiterates that when the relief sought is obtained upon notification of the admissibility ruling, Article 52 of the LJC applies, which provides: Article 52. If, while an amparo is pending, an administrative or judicial ruling is issued that revokes, stays, or suspends the challenged act, the writ shall be granted solely for purposes of compensation and costs, if applicable.
Since that article states "if applicable," the majority of this Tribunal interprets the ruling in favor of the petitioner as being issued without a special award of damages, losses, and costs. However, upon further consideration, the most recently cited judgment indicates that this does not apply in matters involving patrimonial rights, since in such cases there would be grounds for such an award. In the present judgment, this Chamber clarifies that those two lines of precedent remain intact, but with the understanding that they refer to subjects of public law.
In contrast, upon further consideration, as of this ruling, this Tribunal declares that when private law subjects are involved, such an award shall always be made, regardless of whether the matter concerns patrimonial rights, since the basis for this is Article 63 of the LJC itself, as will be explained immediately: Title III of that law establishes the various amparo proceedings: against public law subjects (Chapter I) and against private law subjects (Chapter II), establishing differences in their processing and resolution. Article 52 is in Chapter I and provides, in the relevant part, as follows: "Article 52. If, while an amparo is pending, an administrative or judicial ruling is issued that revokes, stays, or suspends the challenged act, the writ shall be granted solely for purposes of compensation and costs, if applicable." In the sub lite, we are dealing with a private law subject, namely: the Asociación Centro Científico Tropical. Therefore, Articles 62 and 63 apply, and not Article 52, all of the Ley de la Jurisdicción Constitucional, which establish the effects of a successful amparo proceeding against a private law subject in the following terms:
"Article 62. The judgment granting the amparo shall declare the action or omission that gave rise to the writ to be unlawful, and shall order that what the relevant provision requires be complied with, as appropriate in each case, within the period the judgment itself sets, and shall order the responsible person or entity to pay compensation for damages and losses caused and to pay the costs of the proceeding.
(…)
The liquidation of damages and losses and of costs shall be reserved for enforcement proceedings in the civil jurisdiction." "Article 63. If, at the time the amparo is granted, the effects of the challenged act have already ceased, or the act has been consummated in a manner that makes it impossible to restore the injured party to the enjoyment of their right, the judgment shall warn the responsible party not to engage in acts or omissions identical or similar to those that gave grounds for granting the writ, and shall order, in the abstract, payment of compensation for damages and losses caused and payment of costs, with application of the provisions of the preceding article. All of this without prejudice to any other applicable civil or criminal liability" (underlining and emphasis not in original).
While Article 65 of the LJC provides that, in matters not provided for in the chapter on amparo proceedings against private law subjects, the provisions and principles established in the chapter on amparo proceedings against public law subjects shall apply, to the extent compatible, a cross-reference on this point is not appropriate, because the law itself has established, for amparo proceedings against private law subjects, special rules that provide for an award in the abstract of costs, damages, and losses. Accordingly, given that in the sub examine it was established that the situation violating the protected party's fundamental rights was corrected while the amparo was pending, the writ is granted in this proceeding for purposes of compensation pursuant to Article 63 of the Ley de la Jurisdicción Constitucional."
IX.Note by Justice Castillo Víquez, regarding prompt and effective administrative justice. I have supported this Tribunal's position that when a party alleges a violation of the right to prompt and effective justice in administrative proceedings, it is the Administrative Contentious Courts, and not this Chamber, that must hear the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that that right is subject to judicial protection by means of the amparo writ established by Article 32 of the Ley de la Jurisdicción Constitucional, in connection with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the material acts of the Administration, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Tribunal to modify its line of jurisprudence; pursuant to Article 7 of its own Law, it is this Tribunal's exclusive prerogative to define its own jurisdiction.
Therefore, except for those constitutional-legal disputes that this Chamber itself has recognized as exceptional cases that are properly heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons this Tribunal has given (sentencia N° 2008-02545 of 8:55 hours on February 22, 2008), the competent courts are those of the contentious-administrative jurisdiction, all of which is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.
X.Partial dissent of Justice Salazar Alvarado, solely with respect to the non-award of costs, damages, and losses against the respondent public authorities. While I agree with the rest of the Chamber in granting the writ, I dissent from the majority's position insofar as it exempts the respondent party from being ordered to pay the costs, damages, and losses arising from the violation of the protected party's fundamental rights.
The Ley de la Jurisdicción Constitucional, in Article 52, provides that:
"If, while an amparo is pending, an administrative or judicial ruling is issued that revokes, stays, or suspends the challenged act, the writ shall be granted solely for purposes of compensation and costs, if applicable." Furthermore, Article 51 of the same law provides that:
"…every ruling granting the writ shall order in the abstract the compensation of damages and losses caused and the payment of the costs of the proceeding, and shall reserve their liquidation for execution of judgment." This last provision establishes the general system governing compensation and payment of costs, which the majority refers to as the "natural or normal form of termination of the proceeding, where there is a ruling on the merits of the matter and recognition of the facts that have violated fundamental rights…." In the majority's view, the cited Article 51 governs cases in which the Chamber has found the grievance established; as a consequence, the need for an award of costs, damages, and losses arises. However, in my opinion, from a systematic interpretation of both provisions, it follows that both in cases where this Constitutional Tribunal finds a violation of a fundamental right and consequently grants the writ, and in cases where the Administration, on its own initiative, restores the injured party to the enjoyment of their fundamental rights upon learning of the amparo—the scenario contemplated in the cited Article 52—by operation of Articles 50 and 51 of the said law, the necessary and unavoidable consequence is the award against the violator of compensation for damages and losses caused and payment of the costs of the proceeding.
This rule is nothing more than the recognition, for the party who has suffered a violation of their fundamental rights, of the right to effective judicial protection with respect to reparation of the harmful consequences arising from the acts or omissions of the violating authorities; and, as a deterrent, so that the State does not again engage in the conduct that gave grounds for granting the writ, a matter regulated by Article 50 of the law governing this jurisdiction. Therefore, whether the Chamber has found the grievance established and has ruled on the merits, or whether the violation has ceased by the respondent authority's own decision upon learning of the amparo proceeding, with restoration of the enjoyment of fundamental rights in favor of the injured party (Article 52), in either case there always arises the imperative need for an award of costs, damages, and losses against the violator, the foundation for which lies in the principles of protection of the rights of persons and in the principle that the Administration must be held responsible for the damages and losses it causes through its unconstitutional conduct.
Thus, the fact that, at the time the granted amparo is decided, the effects of the challenged act have already ceased, in the terms of Articles 50 and 52 of the cited law, does not negate the applicability of the award of costs, damages, and losses, since that case forms an integral part of the general system of mandatory award in those respects contained in the Ley de la Jurisdicción Constitucional.
Furthermore, it is clear that the cited Article 52 applies only in cases where the Chamber, even though it has not examined or ruled on the merits of the claim, has found the violation suffered by the protected party with respect to their fundamental rights, by virtue of the restoration of the enjoyment of those rights accorded in their favor by the Administration; a situation which, as the majority of the Chamber affirms, constitutes an "abnormal termination of the proceeding." The legislature established and precisely delimited the conditions under which this Chamber may order that form of abnormal conclusion of the amparo proceeding, as well as its scope, namely: 1) that the amparo must be pending, meaning that the Administration must have been duly notified of the ruling initiating the amparo; and, 2) that there must be an administrative or judicial ruling that unambiguously provides for the revocation, stay, or suspension of the challenged act that violates fundamental rights.
Certainly, the provision in question contemplates an exception to the general system of award of costs, damages, and losses, notwithstanding the granting of the writ, by providing that, in the cases it governs, the writ shall be granted "solely for purposes of compensation and costs, if applicable." As an exception, it must be interpreted restrictively; that is, it applies only in the cases strictly contemplated by the provision, not only because of the rule that exceptions in law must be interpreted restrictively, but also because the consequences of applying that exception undoubtedly entail a diminishment of the fundamental right of persons to obtain effective judicial protection against the damages and losses suffered as a result of the violation of their constitutional rights.
In my view, such exception must be interpreted in the sense that, in accordance with the general system of automatic award of costs, damages, and losses (costas, daños y perjuicios) in cases involving a violation of fundamental rights (derechos fundamentales), such an award (condenatoria) is always appropriate, even where the respondent issues an administrative or judicial resolution revoking, halting, or suspending the challenged conduct, unless it is clear and indubitable that in the specific case no compensable harm whatsoever was caused. Only and exclusively in such circumstances could the respondent Administration be exempted from paying those amounts. Since in this case there is no element whatsoever that rebuts the presumption that economic damages and losses arose for the protected party (parte amparada) as a result of the challenged conduct—the precise determination of which does not fall within the jurisdiction of this court—the granting of this writ must necessarily entail an award of costs, damages, and losses, and we so declare.
As an additional reason, it is worth noting that the dynamics and very essence of amparo proceedings are not primarily aimed at analyzing whether or not damages and losses exist, but rather at determining whether or not actions or omissions exist that may generate or produce an infringement of the regime of fundamental rights of individuals. From that standpoint, the analysis carried out by this court focuses on that verification but does not extend to weighing whether such matters have or have not produced harm in the strictly patrimonial sphere of the protected parties. Although the aforementioned Art. 52 of the LJC, in its literal scope, provides that such an award (of damages, losses, and costs) operates where appropriate, the undersigned does not consider that such a review of appropriateness can, a priori, be automatically excluded in this type of proceeding, insofar as it is within another ordinary proceeding (proceso ordinario) that it must be determined whether, within the legal relationship analyzed in the writ of amparo (recurso de amparo), the conduct or omissions attributable to the Administration (or the private-law subject, where applicable) have constituted the proximate cause (causa adecuada) of patrimonial harm that is legally compensable.
By way of reference, Articles 179 through 184 of the Código Procesal Contencioso Administrativo, Ley N° 8508, define a special proceeding whose purpose is to determine the economic effects arising from judgments rendered in these proceedings. In light of Art. 179 ejusdem, that proceeding has the following purpose:
"ARTICLE 179.- The execution of judgments rendered by the Jurisdicción Constitucional in habeas corpus and amparo proceedings against subjects of public law falls within the jurisdiction of the Juzgado de lo Contencioso-Administrativo, solely with respect to the proof, liquidation, and fulfillment of pecuniary indemnifications." It is clear that that proceeding is directed at analyzing the necessary antecedent issued by this Sala Constitucional in the form of an abstract award (condenatoria en abstracto) under those headings, since that type of claim would not be admissible in that type of case when the judgment rendered within the amparo proceeding expressly establishes the inadmissibility of damages, losses, and/or costs, nor when there is no express ruling on this particular matter. That is, the special proceeding before the administrative litigation forum requires, as a sine qua non condition, an express award or ruling by this Sala Constitucional.
In that order of ideas, in my view, pursuant to the aforementioned Art. 52 of the LJC, the exemption from that patrimonial award requires, in each case, proof of circumstances from which it may be reasoned, with adequate justification, that no patrimonial harm exists—not even potential harm—arising from or associated with the facts analyzed. It is therefore an exception that, as such, requires qualified and duly reasoned application on a case-by-case basis. The mere fact that, in the course of the proceedings, the Administration issues a resolution or a judicial judgment is rendered revoking, halting, or suspending the challenged conduct does not, per se, rule out the possibility that, prior to that cessation—whether caused by the respondent itself or by an external factor—the alleged indolence or impugned disturbance may have caused damages and losses. However, such a substantive question, as regards the reality of the harm, its amount, timely claim, etc., involves considerations that fall outside the nature of these proceedings and which, pursuant to the mandate of the aforementioned Art. 52, are proper to an abstract award that subsequently serves as the basis for analysis before the Jurisdicción Contencioso Administrativa.
The protection sought in these constitutional proceedings does not require proof of damages and losses, since, it bears repeating, that is not their purpose or primary ratio. Thus, the protected party is not required to claim or demonstrate damages, as what they seek is the protection of their fundamental rights. Subsequently, whether that administrative conduct has caused them harm is a matter that, as a matter of principle and except in exceptional cases, does not form part of the analytical basis of this type of proceeding. It should be noted that, in the scenario regulated by that mandate, the Sala Constitucional does not conduct a substantive analysis of the situation to be protected, given the termination of the amparo or habeas corpus by the supervening circumstance already mentioned. Ergo, in these cases, by operation of law, no inquiry is made into whether or not there is an infringement, which means that it is even less possible to determine whether, based on what the petitioner has reported, there may or may not be situations of possible civil redress.
Thus, the exemption from award referred to in that provision is exceptional in nature, not a matter of principle. Therefore, in those scenarios, the provision mandates an abstract award so that its merits may be analyzed within another plenary proceeding (proceso plenario). Otherwise, if that exemption from damages, losses, and costs were applied as a rule, the protection of the legal situation of the person who, despite that supervening response from the respondent party, may have suffered harm to their patrimonial sphere would be put at risk, in derogation of the provisions of Art. 45 of the Constitución Política, and disregarding the potential liability of the Administration, as imposed by Art. 9 ejusdem. Furthermore, it must not be overlooked that it was by virtue of an action of that nature that conduct was adopted causing the cessation of the conduct that, in theory, threatens or infringes upon the fundamental rights of the individual.
That is to say, in order to obtain the protection of those rights, the individual opted for judicial protection, and it was by virtue of that action that the impugned disturbance ceased. It bears repeating: whether the continuation of the threat or deterioration of the individual's situation, until it was caused to cease by the reasons referred to in the provision under examination, generated damages and losses is a matter that, absent evidence to the contrary, must be analyzed within an ordinary proceeding, but which, it is reiterated, must in no way be denied, as a precondition, by the mere materialization of the factual scenario regulated under the aforementioned Art. 52 of the LJC. Therefore, with the utmost respect for the majority's position, I express my vote and reiterate that the granting of this writ must necessarily entail an abstract award of costs, damages, and losses.
XI.Dissenting vote of Justice Garro Vargas regarding the operative part of this judgment, on the award of costs, damages, and losses against the respondent public authorities. Art. 52 of the Ley de la Jurisdicción Constitucional (LJC) reads: "If, while an amparo is pending, an administrative or judicial resolution is issued revoking, halting, or suspending the challenged conduct, the writ shall be declared with merit solely for purposes of indemnification and costs, if appropriate."
My interpretation of that provision is as follows: That "resolution" is any valid and effective act by which the competent authority restores the enjoyment of the infringed right. The phrase "if appropriate" refers to costs. Moreover, Art. 197 of the Código Procesal Contencioso-Administrativo, cited by the majority on the basis of Art. 14 of the LJC, specifically refers only to these: to costs.
Certainly, pursuant to Art. 48 of the Constitución Política (CP), the essential content of the right to the writ of amparo is not indemnificatory but restorative; however, Art. 51 of the LJC provides: "Every resolution granting the writ shall order, in the abstract, indemnification for the damages and losses caused and payment of the costs of the writ, and shall reserve their liquidation for the execution of judgment." If the right has been violated and the Sala so finds, even in the event that it has been restored, damages and losses may have arisen. For that reason, an abstract award of such amounts is appropriate. If this were not done—if no such award were made—in the event that damages and losses had in fact arisen, there would be no basis—derived from these proceedings—to claim them, which could violate Art. 41 of the CP. If, despite the abstract award, no damages and losses have in fact occurred, the judge in the ordinary proceedings will so declare, since it is solely within that forum to find proven the real existence and magnitude thereof.
With the thesis defended by the majority, I consider that, contrary to what is sought, the Administration would be incentivized to respect rights only upon the filing of a writ of amparo. It remains to be said that Art. 52 of the LJC provides for the possibility that, if it is deemed just, the Sala may award costs, even when the right has been restored.
For the foregoing reasons, I partially dissent from the vote with respect to the operative part and order the award of damages and losses, but not of costs.
XII.Documentation filed in the case file. The parties are hereby notified that, if they have filed any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device, such materials must be retrieved from the court office within a maximum period of thirty business days counted from the date of notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session No. 43-12 held on May 3, 2012, Article LXXXI.

The writ is declared with merit, pursuant to the provisions of Art. 52 of the Ley de la Jurisdicción Constitucional, with no special award of costs, damages, and losses, with respect to the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud. Likewise, with respect to the company YUBANE S.A., the writ is declared with merit solely for purposes of indemnification. Consequently, YUBANE S.A. is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, which shall be liquidated in civil enforcement proceedings. Justice Salazar Alvarado partially dissents from the vote and orders an award of damages, losses, and costs. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diecisiete de julio de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, a favor de la ASOCIACIÓN DE LA JUNTA ADMINISTRADORA DEL ACUEDUCTO DE HIGUITO EL GUARCO, cédula jurídica CED02, contra la YUBANE SOCIEDAD ANÓNIMA, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y EL MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Cuestiones previas. En vista de que este asunto se recurre contra un sujeto de derecho público, antes de analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la Sentencia N° 2008-2545 de las 08:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante la supuesta demora en resolver sobre el debido abastecimiento del recurso de agua potable, por falta de cumplimiento de una orden sanitaria emitida por el Ministerio de Salud.
Asimismo, como también se recurre a un sujeto de derecho privado, se debe recalcar que por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para —posteriormente y en caso afirmativo—, dilucidar si es estimable o no. En ese particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula bajo qué supuestos es admisible el amparo contra las acciones u omisiones de sujetos de derecho privado, es decir, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2°, inciso a), de la misma Ley.
Visto lo anterior, en el caso concreto, se cumple uno de estos presupuestos, ya que, aun existiendo procedimientos jurisdiccionales comunes adecuados para satisfacer la pretensión del tutelado, el resultado de estos sería tardío produciéndose lesiones de difícil o imposible reparación, al ser la sociedad recurrida propietaria de la finca donde se encuentra la naciente que debe ser resguardada por las autoridades recurridas y constatarse que se ha impedido el acceso de estas. En ese tanto, el recurso de amparo es admisible en contra de esa entidad también, y en vista de ambos aspectos desarrollados, se procede a conocer por el fondo el asunto.
II.Objeto del recurso. El recurrente, en su condición de representante de la ASADA de Higuito de El Guarco, alega la vulneración de los derechos fundamentales de las personas usuarias del servicio de agua potable de esa comunidad. Indica que el abastecimiento depende, en parte, de una naciente debidamente concesionada ubicada dentro de una propiedad perteneciente a la sociedad recurrida. Señala que el Área Rectora de Salud de El Guarco ordenó la instalación de una malla perimetral de protección alrededor de dicha fuente de agua; sin embargo, reclama que la sociedad accionada ha impedido injustificadamente la ejecución de esas obras, lo que pone en riesgo el cumplimiento de la orden sanitaria y la continuidad del servicio de agua potable para la población beneficiaria.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la Constitución Política, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.
En ese sentido, la protección y conservación a la que se hace referencia debe ser brindada por el Estado, a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia No. 2007-005482 de las 14:39 horas de 24 de abril de 2007, reiterada en la No. 2021-005089 de las 09:15 horas de 12 de marzo de 2021 y recientemente en la No. 2025-002839 de las 09:20 horas de 31 de enero de 2025).
V.Sobre el fondo. En el sub lite, se tiene que el recurrente, en su condición de representante de la ASADA de Higuito de El Guarco, alega la vulneración de los derechos fundamentales de las personas usuarias del servicio de agua potable de esa comunidad. Indica que el abastecimiento depende, en parte, de una naciente debidamente concesionada ubicada dentro de una propiedad perteneciente a la sociedad recurrida. Señala que el Área Rectora de Salud de El Guarco ordenó la instalación de una malla perimetral de protección alrededor de dicha fuente de agua; sin embargo, reclama que la sociedad accionada ha impedido injustificadamente la ejecución de esas obras, lo que pone en riesgo el cumplimiento de la orden sanitaria y la continuidad del servicio de agua potable para la población beneficiaria.
Ahora, después de analizar los elementos probatorios aportados, este Tribunal verifica la violación al derecho de justicia pronta y cumplida en sede administrativa. Lo anterior, porque en el informe rendido por el representante de la autoridad recurrida -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el Área Rectora de Salud de El Guarco, en ejercicio de sus competencias de vigilancia sanitaria, realizó las inspecciones correspondientes al sistema de abastecimiento administrado por la ASADA de Higuito, identificó la necesidad de adoptar medidas de protección en la naciente Los Fuentes, emitió la respectiva orden sanitaria y dio seguimiento a su cumplimiento mediante inspecciones y valoraciones técnicas posteriores.
Asimismo, se acreditó que la ASADA atendió dicha orden mediante la presentación del plan remedial requerido y ejecutó las medidas correctivas dispuestas, salvo la colocación de la malla perimetral en la naciente Los Fuentes, cuyo incumplimiento obedeció a la imposibilidad material de ingresar al inmueble donde se ubica la fuente de captación, ya que, al momento en que se planteó la gestión que dio origen a este amparo, la colocación de la malla perimetral exigida por la autoridad sanitaria no había podido ejecutarse debido a la falta de autorización para ingresar a la propiedad privada donde se localiza la naciente Los Fuentes. De hecho, el informe técnico del 4 de mayo de 2026 determinó expresamente que esa era la única medida pendiente de cumplimiento, cuya situación resultaba susceptible de comprometer la protección de una fuente de abastecimiento utilizada por la comunidad y, por ende, incidía directamente en la garantía del derecho fundamental al acceso al agua potable en condiciones adecuadas de calidad y salubridad, derecho que esta Sala ha reconocido reiteradamente.
Sin embargo, también quedó demostrado que con posterioridad a la notificación de este recurso de amparo, el representante de la sociedad YUBANE S.A. autorizó expresamente el ingreso al inmueble y manifestó no oponerse a la ejecución de las obras de protección ordenadas por el Ministerio de Salud. A partir de ello, la ASADA pudo iniciar los trabajos requeridos y, finalmente, mediante inspección realizada el 29 de junio de 2026, el Ministerio de Salud verificó que la malla perimetral había sido instalada y que no existían medidas pendientes de cumplimiento relacionadas con la orden sanitaria emitida.
Así las cosas, si bien de los elementos incorporados al expediente se desprende que tanto el Instituto Costarricense de Acueductos y Alcantarillados como el Área Rectora de Salud correspondiente realizaron diversas gestiones administrativas orientadas a lograr el cumplimiento de las medidas de protección ordenadas respecto de la naciente Nombre02, lo cierto es que tales actuaciones no resultaban suficientes para tener por satisfechas las obligaciones que se les imponía. En efecto, aunque presuntamente el representante de YUBANE S.A. se haya opuesto en distintas oportunidades al ingreso de funcionarios a la propiedad donde se ubica dicha naciente, esa circunstancia no eximía a las autoridades recurridas del deber de ejercer, por los medios legales correspondientes, las potestades que les confiere la normativa aplicable para garantizar la ejecución de la orden sanitaria emitida.
Desde esa perspectiva, la negativa del propietario o poseedor del inmueble constituía un obstáculo que debía ser superado mediante los mecanismos legales previstos para tales efectos, pues las autoridades administrativas competentes cuentan con facultades para hacer cumplir las disposiciones sanitarias dictadas en resguardo de la salud pública y la protección de las fuentes de abastecimiento de agua destinada al consumo humano. En consecuencia, aun cuando se advierte la realización de múltiples diligencias por parte del AyA y del Ministerio de Salud, lo cierto es que estas no ejercieron de manera eficaz y oportuna las potestades que les correspondían para asegurar la ejecución de las obras ordenadas dentro de un plazo razonable y libre de dilaciones indebidas, permitiendo que la situación denunciada se prolongara más allá.
No obstante lo anterior, -como se indicó líneas atrás- también se encuentra acreditado que con posterioridad a la notificación de la resolución que dio curso a este proceso de amparo, las obras de protección reclamadas fueron finalmente ejecutadas y concluidas. Por ende, si bien la conducta omisiva atribuida a las autoridades recurridas y la actuación indebida atribuida a la sociedad accionada existían al momento de interponerse el recurso, sus efectos fueron subsanados con posterioridad durante la tramitación de este proceso de amparo.
VI.Conclusión: En consecuencia, se declara con lugar el recurso, con fundamento en lo dispuesto en el artículo 52 de la Ley de la Jurisdicción Constitucional, en relación con el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud, por cuanto omitieron ejercer oportunamente las potestades necesarias para asegurar el cumplimiento de la orden sanitaria emitida, sin proceder con la condenatoria en costas, daños y perjuicios, toda vez que las obras objeto de reclamo fueron ejecutadas y finalizadas durante la tramitación del presente recurso. Asimismo, respecto de la sociedad YUBANE S.A., se declara con lugar el recurso con fundamento en el artículo 63 de la citada Ley.
VII.Sobre la condenatoria en costas, daños y perjuicios de conformidad con el artículo 52 de la Ley de la Jurisdicción Constitucional. Bajo una mejor ponderación, la mayoría de la Sala considera que, en el sub examine, de conformidad con lo dispuesto en el párrafo 1° del artículo 52 de la Ley de la Jurisdicción Constitucional (“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”), la estimatoria debe serlo sin especial condenatoria en costas, daños y perjuicios, con base en las siguientes consideraciones. Si bien hay un texto expreso en la ley que obliga a que la parte dispositiva del fallo indique que se declara con lugar el recurso, cuando estando en curso del amparo se resuelva el agravio, no menos cierto es que ese mismo párrafo in fine refiere que la estimatoria se dicta “únicamente para efectos de indemnización y de costas, si fueren procedentes”.
Se subraya que la Ley indica “si fueren procedentes”, lo cual significa que la procedencia o improcedencia de la indemnización y costas depende de una valoración, apreciación o ponderación del Tribunal. En casos como este, el contenido de la pretensión de la persona amparada y la conducta de la autoridad recurrida de reconocer aquella, sugieren que los menoscabos, lesiones o alteraciones alegados no están referidos de modo directo a una repercusión en un derecho constitucional de evidente naturaleza patrimonial (como sí ocurriría, por ejemplo, con una afectación al derecho al salario). Para disipar cualquier duda al respecto, es importante destacar lo dispuesto en el artículo 51 de la misma Ley de la Jurisdicción Constitucional, cuando dispone que: “toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”, donde no se prevé la posibilidad de valorar si procede o no lo concerniente a indemnización y costas.
Los principios del Derecho Constitucional, los del Público y Procesal General o, en su caso, los del Derecho Internacional o Comunitario y, además, por su orden, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo y los demás códigos procesales, son fuente supletoria para la aplicación e interpretación de las normas de la Ley de la Jurisdicción Constitucional -cfr. artículo 14-. Para la jurisdicción contencioso-administrativa, el legislador estableció un precepto plenamente aplicable al caso por analogía, en el artículo 197 del Código Procesal Contencioso Administrativo, que responde a la lógica procesal en cualquier materia. En todo caso, la parte afectada del sub lite preserva la posibilidad de acudir, si a bien lo tiene, a un proceso de conocimiento a fin de demostrar que ha sufrido algún tipo de menoscabo. Con base en lo anterior, es criterio de mayoría resolver este recurso sin condenatoria en costas, daños y perjuicios.
Ahora bien, es preciso advertir que mediante Sentencia N° 2024-12475 de las 9:20 horas de 10 de mayo de 2024, citando a su vez, la N° 2023-008973 de las 09:20 horas del 21 de abril de 2023, esta Sala Constitucional resolvió, en lo que interesa:
“V.- Sobre el caso concreto.
(…) Ahora bien, este Tribunal determina la lesión a los derechos fundamentales del tutelado, pues no se tiene por demostrado que los rebajos realizados al amparado los efectuara la Cooperativa Autogestionadora de Protección Familiar R.L., al amparo de un contrato firmado por el recurrente o por autorización expresamente dada por el tutelado. Nótese que esta Sala le realizó una prevención a la representante legal de la cooperativa accionada a fin de que presentará el contrato que demostrará que el recurrente fuese afiliado o bien el contrato sobre el plan de asistencia múltiple al que se hace referencia para justificar los rebajos; sin embargo, únicamente se limitó a informar que el amparado fue excluido por la Cooperativa Autogestionaria de Protección Familiar R.L. de todos sus sistemas internos y gestión de reactivación de aportes y se procedió a atender la solicitud de reintegro de aportes de dinero del recurrente por un monto de ₡47.200,00.
Lo anterior demuestra una vulneración al derecho al salario y la propiedad del tutelado, por no haberse acreditado una justificación válida para que la Cooperativa accionada haya efectuado los rebajos cuestionados. En virtud de lo expuesto, la Sala tiene por acreditado que la situación que vulneraba los derechos fundamentales del amparado fue corregida estando en curso el amparo, por lo que se procede a declarar con lugar el recurso para efectos indemnizatorios”. (El destacado no es del original).
“VI.- Sobre la condenatoria en costas, daños y perjuicios en el caso concreto. Por las razones ampliamente expuestas en las sentencias correspondientes, es criterio de mayoría de esta Sala que cuando la declaratoria con lugar de un recurso de amparo obedezca a la aplicación del primer párrafo del artículo 52, de la Ley de la Jurisdicción Constitucional, sea, porque habiéndose notificado la resolución de curso del amparo se revoque, suspenda o detenga la actuación impugnada, dicha estimatoria lo debe ser sin especial condena en daños y perjuicios. Sin embargo, bajo una mejor ponderación y como tesis de excepción, debe señalarse que cuanto el recurso de amparo verse de forma concreta sobre una situación patrimonial directa y estrictamente relacionada con la protección de derechos pecuniarios –sea la omisión de pago del salario o de las prestaciones que por derecho le corresponda a la persona interesada sí procede la plena aplicación de la estimatoria del recurso de amparo, incluso con la correspondiente condena en costas, daños y perjuicios, por cuanto dicha condenatoria se erige en garantía de que lo adeudado podrá ser honrado por la Administración – de oficio o a gestión de parte- con la debida actualización o indexación que corresponda fijar en el ámbito de la legalidad ordinaria, en el respectivo proceso de ejecución de la sentencia constitucional estimatoria. Es por esta razón, que en el caso bajo estudio sí resulta procedente la condenatoria en costas, daños y perjuicios” (sentencia 9298-2018).
Como se puede observar, la Sala reitera que cuando la pretensión se obtenga con ocasión de la notificación del auto de curso, corresponde aplicar el artículo 52 de la LJC, que establece: Artículo 52. Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes.
Como ese artículo señala “si fueran procedentes”, por mayoría, este Tribunal interpreta que la declaratoria con lugar se dicta sin especial condenatoria en daños, perjuicios y costas. Sin embargo, bajo una mejor ponderación, en la última sentencia citada indica que eso no procede en asuntos que involucren derechos patrimoniales, pues en tales casos sí habría mérito para tal condenatoria. En la presente sentencia esta Sala aclara que esas dos líneas quedan incólumes, pero bajo el entendido de que se refieren a sujetos de derecho público.
En cambio, bajo una mejor ponderación, a partir de la presente resolución, este Tribunal declara que cuando se trata de sujetos de derecho privado, tal condenatoria siempre se dará, con independencia de si se trate de asuntos patrimoniales, pues el fundamento es el mismo artículo 63 de la LJC, tal como de inmediato se explicará: El título III de esa ley establece los diversos procesos de amparo: contra sujetos de derecho público (capítulo I) y contra sujetos de derecho privado (capítulo II), estableciendo diferencias en su trámite y resolución. El artículo 52 está en el capítulo I y señala, en lo que interesa, lo siguiente: “Artículo 52. Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.
En el sub lite, estamos ante un sujeto de derecho privado, a saber: la Asociación Centro Científico Tropical. Por ello corresponde aplicar los numerales 62 y 63 y no el 52, todos de la Ley de la Jurisdicción Constitucional , que establecen los efectos de una estimación de un proceso de amparo contra sujeto de derecho privado en los siguientes términos:
“Artículo 62. La sentencia que conceda el amparo declarará ilegítima la acción u omisión que dio lugar al recurso, y ordenará que se cumpla lo que dispone la respectiva norma, según corresponda en cada caso, dentro del término que el propio fallo señale, y condenará a la persona o entidad responsable a la indemnización de los daños y perjuicios causados y al pago de las costas.
(…)
La liquidación de los daños y perjuicios y de las costas se reservará a la vía civil de ejecución de sentencia”.
“Artículo 63. Si al declararse con lugar el amparo hubieren cesado los efectos del acto reclamado, o éste se hubiere consumado en forma que no sea posible restablecer al perjudicado en el goce de su derecho, la sentencia prevendrá al agraviante que no debe incurrir en actos u omisiones iguales o semejantes a los que dieron mérito para acoger el recurso, y lo condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas, con aplicación de lo dispuesto en el artículo anterior. Todo ello sin perjuicio de las otras responsabilidades civiles o penales que correspondan” (el subrayado y resaltado no es del original).
Si bien el artículo 65 de la LJC establece que, en lo no previsto en el capítulo de amparos contra sujeto de derecho privado, se aplicarán las disposiciones y principios establecidos en el capítulo de los amparos contra sujeto de derecho público, en lo que fueren compatibles, no procede una remisión sobre este aspecto, porque la propia ley estableció para los amparos contra sujeto de derecho privado normas especiales que prevén la condenatoria en abstracto a las costas, daños y perjuicios. Así las cosas, dado que en el sub examine se tuvo por acreditado que la situación que vulneraba los derechos fundamentales de la amparada fue corregida estando en curso el amparo, procede la estimatoria de este proceso para efectos indemnizatorios de conformidad con lo indicado en el artículo 63 de la Ley de la Jurisdicción Constitucional”.
IX.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
X.Voto salvado parcial del magistrado Salazar Alvarado, únicamente en relación con la no condenatoria en costas, daños y perjuicios a las autoridades públicas recurridas. Si bien coincido con el resto de la Sala en declarar con lugar el recurso, me separo del criterio de mayoría en cuanto exime de condenar a la parte recurrida al pago de las costas, daños y perjuicios derivados de la lesión producida a los derechos fundamentales de la parte tutelada.
La Ley de la Jurisdicción Constitucional, en el artículo 52, dispone que:
“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.
Por otra parte, en el artículo 51 ibídem, se establece que:
“...toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.
Esta última norma establece el sistema general que regula lo relativo al tema de la indemnización y el pago de las costas, y que la mayoría denomina “forma natural o normal de terminación del proceso, donde hay pronunciamiento sobre el fondo del asunto y reconocimiento de los hechos que han vulnerado los derechos fundamentales…”.
En criterio de la mayoría, el artículo 51, de cita, regula los supuestos en los que la Sala ha tenido por comprobado el agravio; y, como consecuencia, surge la necesidad de una condenatoria en costas, daños y perjuicios. Sin embargo, a juicio del suscrito, de la interpretación sistemática de ambas normas, se concluye que, tanto en los casos en que este Tribunal Constitucional constate una lesión a algún derecho fundamental; y, por ende, declare con lugar el recurso, como en aquellos en los que la Administración, por decisión propia, restituya a la persona agraviada en el goce de sus derechos fundamentales, una vez que tenga conocimiento del amparo -supuesto contemplado en el artículo 52, referido-, por imperio de los artículos 50 y 51, de la ley citada, la consecuencia necesaria e ineludible es la condenatoria al infractor a la indemnización de los daños y perjuicios causados y del pago de las costas del recurso.
Esta regla no es más que el reconocimiento, a la parte que ha sufrido una vulneración en sus derechos fundamentales, del derecho a una tutela judicial efectiva en torno a la reparación de las consecuencias dañosas derivadas de las actuaciones u omisiones de las autoridades infractoras; y, como medio disuasivo, a fin de que el Estado no incurra nuevamente en las acciones que dieron base a la estimatoria del recurso, tema regulado en el artículo 50, de la ley que rige esta jurisdicción. De modo, que ya sea que la Sala haya tenido por comprobado el agravio y haya entrado a conocer el fondo del asunto, o que la violación haya cesado por decisión de la propia autoridad recurrida, una vez que tuvo conocimiento de la tramitación del amparo, con restitución en el goce de los derechos fundamentales a favor del agraviado (artículo 52), siempre, en cualesquiera de esos supuestos, surge la imperiosa necesidad de una condenatoria en costas, daños y perjuicios al infractor, cuyo fundamento se encuentra en los principios de tutela de los derechos de las personas y en el de que la Administración debe hacerse responsable por los daños y perjuicios que ocasione con su actuar inconstitucional.
Así, el hecho de que al momento de conocerse y resolverse con lugar el amparo, los efectos del acto impugnado ya hubieren cesado, en los términos de lo dispuesto en los artículos 50 y 52, de la ley de cita, no enerva la procedencia de la condenatoria en costas, daños y perjuicios, pues tal caso forma parte integral del sistema general de condenatoria necesaria en esos extremos, que contiene la Ley de la Jurisdicción Constitucional.
Por otra parte, es claro que el artículo 52, mencionado, se aplica únicamente en los casos en que la Sala, aun cuando no ha conocido, ni se ha pronunciado sobre el fondo del reclamo, ha constatado la vulneración que en sus derechos fundamentales ha sufrido la parte amparada, en virtud de la restitución, que, en el goce de esos derechos, ha acordado a su favor la Administración; situación que, tal y como la afirma la mayoría de la Sala, implica una “terminación anormal del proceso”.
El legislador estableció y delimitó, de forma precisa, las condiciones en las cuales esta Sala puede decretar esa forma de conclusión anormal del proceso de amparo, así como sus alcances, a saber: 1) que el amparo esté en curso, es decir, que la Administración haya sido debidamente notificada de la resolución que dio curso al amparo; y, 2) que exista una resolución administrativa o judicial que disponga, de forma indubitable, la revocación, detención o suspensión de la actuación impugnada violatoria de derechos fundamentales. Ciertamente, la norma en cuestión contempla una excepción al sistema general de condenatoria en costas, daños y perjuicios, no obstante la estimatoria del recurso, al disponer que, en los casos allí regulados, se declarará con lugar el recurso “únicamente para efectos de indemnización y de costas, si fueren procedentes”. Como excepción que es, debe ser interpretada restrictivamente; es decir, que solo procede en los supuestos estrictamente contemplados en la norma, no solo por la regla de que las excepciones en derecho deben interpretarse de forma restrictiva, sino también porque las consecuencias de aplicar tal excepción implican, sin lugar a dudas, un menoscabo en el derecho fundamental de las personas a obtener una efectiva tutela judicial frente a los daños y perjuicios sufridos con la lesión a sus derechos constitucionales.
En mi criterio, tal excepción se debe interpretar en el sentido de que, de conformidad con el sistema general de condenatoria automática en costas, daños y perjuicios ante una violación a derechos fundamentales, esa condenatoria es siempre procedente, aún en el caso de que la parte recurrida dicte una resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, a menos que conste de manera indubitable y clara que en el caso concreto no se causó perjuicio alguno capaz de ser indemnizado. Solo y únicamente en tales supuestos podría eximirse a la Administración recurrida del pago de dichos extremos. Como en este caso, no existe elemento alguno que desvirtúe la presunción del surgimiento, para la parte amparada, de daños y perjuicios económicos derivados de las actuaciones impugnadas -cuya determinación concreta no le corresponde a esta jurisdicción-, la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en costas, daños y perjuicios, y así lo declaramos.
Como razón adicional, cabe destacar que la dinámica y esencia misma de los procesos de amparo, no tiene por objeto primario el análisis de la existencia o no de daños y perjuicios, sino, de la existencia o no de acciones u omisiones que puedan generar o producir un quebranto al régimen de los derechos fundamentales de las personas. Desde esa arista, el análisis que realiza esta sede, se concentra en dicha verificación, empero, no ingresa a la ponderación de si esas cuestiones han generado o no lesiones en el ámbito eminentemente patrimonial de las personas amparadas. Si bien el precitado precepto 52, de la LJC, en su ámbito gramatical, estatuye que dicha condena (en daños, perjuicios y costas) opera, de ser procedente, no estima el suscrito que dicho examen de pertinencia pueda, a priori, excluirse de manera automática en este tipo de procesos, en la medida en que, es dentro de otro proceso ordinario, que se ha de definir si dentro de la relación jurídica analizada en el recurso de amparo, las conductas u omisiones imputables a la Administración (o sujeto de derecho privado, cuando corresponda), se han constituido como causa adecuada de lesiones de orden patrimonial, que sean jurídicamente indemnizables.
A modo de referencia, los numerales 179 al 184, del Código Procesal Contencioso Administrativo, Ley N° 8508, define un proceso especial que tiene por objeto la definición de los efectos económicos derivados de condenas dictadas en estos procesos. A la luz del canon 179 ejusdem, ese proceso tiene por objeto lo siguiente:
“ARTÍCULO 179.- Corresponde al Juzgado de lo Contencioso-Administrativo, la ejecución de las sentencias dictadas por la Jurisdicción Constitucional, en procesos de hábeas corpus y de amparo contra sujetos de Derecho público, únicamente en lo relativo a la demostración, la liquidación y el cumplimiento de indemnizaciones pecuniarias”.
Es claro que ese proceso se direcciona al análisis del antecedente necesario emitido por esta Sala en cuanto a una condena en abstracto en esos rubros, pues no procedería ese tipo de pretensiones dentro de ese tipo de causas, cuando la sentencia dictada dentro del proceso de amparo, estableciere, de manera expresa, la improcedencia de daños, perjuicios y/o costas, así como cuando no exista pronunciamiento expreso en cuanto a este particular. Es decir, el proceso especial en sede contencioso administrativa, requiere, a modo de requisito sine qua non, de condena o pronunciamiento expreso por parte de esta Sala Constitucional. En ese orden, a mi juicio, al tenor del mencionado ordinal 52, de la LJC, la dispensa en esa condena patrimonial precisa de la acreditación, en cada caso, de situaciones a partir de las cuales, es estime, motivadamente, la inexistencia de lesiones patrimoniales, aún potenciales, derivadas o asociadas a los hechos analizados.
Por ende, se trata de una excepción, que, como tal, requiere de aplicación calificada y debidamente fundamentada de manera casuística. La sola circunstancia que, en el curso del trámite, la Administración dicte resolución o se emita sentencia judicial que revoque, detenga o suspenda la actuación impugnada, no descarta, per se, que, de previo a esa cesación por causa propia o ajena al ente accionado, la indolencia acusada o perturbación reprochada, haya llegado a ocasionar daños y perjuicios. Sin embargo, tal cuestión de fondo, en lo relativo a la efectividad de las lesiones, su cuantía, reclamo oportuno, etc., son ponderaciones que escapan a la naturaleza de estos procesos y respecto de la cual, en orden a lo regulado por el mandato 52 aludido, son propias de una condena en abstracto que luego constituye base de análisis en la Jurisdicción Contencioso Administrativa. La tutela que se pretende en estos procesos de orden constitucional no precisa de la demostración de daños y perjuicios, pues, se insiste, no es su objeto o ratio primaria.
Así, no corresponde a la persona amparada el reclamo o demostración de daños, siendo que lo que busca es el resguardo de sus derechos fundamentales. Luego, si esas conductas administrativas le han producido lesiones, es un extremo que, por tesis de principio y salvo casos excepcionales, no forman parte de la base de análisis de este tipo de causas. Nótese que, en el supuesto regulado en ese mandato, la Sala Constitucional no hace un análisis de fondo de la situación a tutelar, dada la terminación del amparo o habeas corpus por la circunstancia sobrevenida ya citada. Ergo, en estos casos, por imperativo legal, no se ingresa a valorar si hay o no infracción, con lo cual, mucho menos puede definirse si a partir de lo denunciado por el requirente, puede haber o no situaciones de posible reparación civil. De esa manera, la dispensa de condena a que alude esa norma, es de orden excepcional, no de principio.
Por tanto, en esos supuestos, la norma impone la condena en abstracto, para que sea dentro de otro proceso plenario, que se analice su procedencia. De otro modo, de aplicarse como regla esa liberación de daños, perjuicios y costas, se estaría poniendo en riesgo la tutela de la situación jurídica de la persona que, pese a esa respuesta sobrevenida de la parte reclamada, pudo haber sufrido lesiones en su esfera patrimonial, en detrimento de lo estatuido por el precepto 45, de la Constitución Política, y desconociendo la potencial responsabilidad de la Administración, tal y como lo impone el artículo 9 ejusdem. Además, no debe dejarse de lado que fue en virtud de una acción de esa índole, que se adoptó una conducta que hace cesar las conductas que, en teoría, amenazan o conculcan los derechos fundamentales de la persona. Es decir, a efectos de obtener el resguardo de esos derechos, la persona optó por la tutela judicial, y fue por esa virtud, que se produce el cese de la perturbación reprochada.
Se insiste, si la permanencia de la amenaza o deterioro de su situación en tanto se hizo cesar por las causas aludidas en la norma bajo examen, generó daños y perjuicios, es un tema que, salvo prueba en contrario, debe ser analizado dentro de un proceso ordinario, pero que, se reitera, en modo alguno, debe negarse, como presupuesto, por la sola concreción del supuesto de hecho regulado en el mencionado ordinal 52, de la LJC. Por ende, con el respeto de siempre en cuanto a la postura de mayoría, externo mi voto y reitero que la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en abstracto en costas, daños y perjuicios.
XI.Voto salvado de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia, sobre la condenatoria en costas, daños y perjuicios de las autoridades públicas recurridas. Dice el artículo 52 de la Ley de la Jurisdicción Constitucional (LJC): “Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.
Mi interpretación sobre esa norma es la siguiente: Esa “resolución” es todo acto válido y eficaz por el cual la autoridad competente restituye en el goce del derecho conculcado. La frase “si fueren procedentes” se refiere a las costas. Es más, el artículo 197 del Código Procesal Contencioso-Administrativo, citado por la mayoría, sobre la base del artículo 14 de la LJC, justamente se refiere sólo a estas: a las costas.
Ciertamente, a tenor del artículo 48 de la Constitución Política (CP), el contenido esencial del derecho al recurso de amparo no es indemnizatorio sino restitutorio; sin embargo, el artículo 51 de la LJC señala: “Toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.
Si el derecho ha sido violado y la Sala así lo constata, aún en caso de que haya sido restituido, podrían haber surgido daños y perjuicios. Por tal motivo, cabe la condenatoria en abstracto de éstos. Si no se hiciera así, si no se diera tal condenatoria, en el caso de que sí se hubieren dado, no habría título –derivado de este proceso– para reclamarlos, con lo que se podría violar el artículo 41 de la CP. Si a pesar de que se haya condenatoria en abstracto, no se han dado los daños y perjuicios, el juez en la vía ordinaria así lo declarará, pues sólo a él corresponde tener por probado la existencia real y la magnitud de los mismos.
Con la tesis defendida por la mayoría estimo que, contrario a lo que se busca, se estaría incentivando que la Administración respete los derechos sólo ante la existencia de un recurso de amparo. Resta decir que el artículo 52 de la LJC prevé la posibilidad de que, si se estima que es lo justo, la Sala condene en costas, aun cuando el derecho haya sido restituido.
En razón de lo anterior, salvo parcialmente el voto respecto de la parte dispositiva y ordeno la condenatoria en daños y perjuicios, pero no en costas.
XII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso, con fundamento en lo dispuesto en el artículo 52 de la Ley de la Jurisdicción Constitucional, sin especial condenatoria en costas, daños y perjuicios, en relación con el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud. Asimismo, respecto de la sociedad YUBANE S.A., se declara con lugar el recurso únicamente para efectos indemnizatorios. En consecuencia, se condena a YUBANE S.A. al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil. El magistrado Salazar Alvarado salva parcialmente el voto y dispone la condenatoria en daños, perjuicios y costas. La magistrada Garro Vargas salva parcialmente el voto y ordena la condenatoria en daños y perjuicios, pero no en costas. Notifíquese. - Fernando Castillo V.
