CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand and twenty-six.

Writ of amparo (recurso de amparo) processed under case number 26-023470-0007-CO, filed by Nombre01 against THE MINISTRY OF ENVIRONMENT AND ENERGY (MINAE).

Background:

  1. 1By written submission incorporated into the electronic case file on June 30, 2026, the petitioner files this writ of amparo. The petitioner states that for approximately 30 years they have owned a lot on which, 22 years ago, they dug an artisanal well (pozo artesanal) and built a small wooden house where they kept all their belongings. The petitioner notes that the Instituto Costarricense de Electricidad provided them with electrical service. The petitioner alleges that during the morning they received a call from their son, who informed them that MINAE officials had arrived at their home along with Fuerza Pública officers to evict them and destroy their house. The petitioner claims that no administrative file has ever been opened and that they have not been permitted to exercise their right of defense (derecho de defensa). The petitioner alleges that the authorities consider their home to be located on a portion of land designated as a wetland (humedal), of which the petitioner had no knowledge. The petitioner requests that the eviction against them be suspended.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily reject, on the merits or at any time — even from the moment of filing — any petition brought before it that is manifestly inadmissible, or when it considers that there are sufficient elements of judgment to reject it, or that it constitutes a mere reiteration or reproduction of a previously rejected petition that is identical or similar.

Considering:

I. SUBJECT OF THE WRIT

The petitioner states that for approximately 30 years they have owned a lot on which, 22 years ago, they dug an artisanal well and built a small wooden house where they kept all their belongings. The petitioner notes that the Instituto Costarricense de Electricidad provided them with electrical service. The petitioner alleges that during the morning they received a call from their son, who informed them that MINAE officials had arrived at their home along with Fuerza Pública officers to evict them and destroy their house. The petitioner claims that no administrative file has ever been opened and that they have not been permitted to exercise their right of defense. The petitioner alleges that the authorities consider their home to be located on a portion of land designated as a wetland, of which the petitioner had no knowledge. The petitioner requests that the eviction against them be suspended.

II. INADMISSIBILITY OF THE WRIT

In the sub iudice matter, the petitioner states that for approximately 30 years they have owned a lot on which, 22 years ago, they dug an artisanal well and built a small wooden house where they kept all their belongings. The petitioner notes that the Instituto Costarricense de Electricidad provided them with electrical service. The petitioner alleges that during the morning they received a call from their son, who informed them that MINAE officials had arrived at their home along with Fuerza Pública officers to evict them and destroy their house. The petitioner claims that no administrative file has ever been opened and that they have not been permitted to exercise their right of defense. The petitioner alleges that the authorities consider their home to be located on a portion of land designated as a wetland, of which the petitioner had no knowledge. The petitioner requests that the eviction against them be suspended.

In view of the foregoing, the Court finds it appropriate to recall what was set forth in judgment no. 2023017842 of 9:30 hours on July 21, 2023:

"IV.- ON THE REMOVAL OF STRUCTURES FROM MUNICIPAL LAND. From the report submitted by the respondent authorities, given under oath with timely notice of the consequences provided in article 44 of the Ley de la Jurisdicción Constitucional, no violation of any fundamental right against the petitioner is found, for the reasons set forth below.

In this regard, it is established that the petitioner was occupying a park area owned by the Municipalidad de Moravia; that is, a public-domain property (bien demanial). With respect to property of a public nature, legal doctrine has drawn a distinction, designating part of it as public domain (dominio público), demesne, or dominical property, and the other part as the State's own or patrimonial property. The former are understood to be those available for the common use of the administered public or for public use, such as museums, public office buildings, roads, canals, rivers, streams, ports, bridges, riverbanks, beaches, roadsteads, parks, and similar facilities; the latter are those that the State holds as would any other legal person. With respect to public-domain properties, this Constitutional Court defined them as follows:

'The public domain is comprised of assets that manifest, by express will of the legislature, a special purpose of serving the community and the public interest. These are the so-called dominical assets, demesne assets, public things or public assets, which do not belong individually to private persons and are destined for public use and subject to a special regime, outside the commerce of persons... those assets belong to the State... Since they are outside commerce, these assets cannot be the subject of possession, although a right of use may be acquired, but not a right of property' (see, in a similar vein, Sentencia N° 2010-20346 of 9:21 hours of December 3, 2010).

In this context, since the petitioner was occupying public-domain property over which no right may be claimed, the police authorities — whether those of the Municipalidad de Moravia — are not required to initiate any administrative procedure in order to proceed with the removal of structures. In this regard, this Constitutional Chamber, in the same judgment cited above — N° 2010-20346 — stated the following:

'VI... In cases where occupation is sought by means of de facto actions, whether peaceful or through force, the Administration may likewise evict the occupants by those same means, without the need to resort to any administrative file or rules of due process (debido proceso), including the authority to remove property from occupied public places, subject to return to their owners...' In light of the foregoing, any violation of the right to property in the present case is ruled out. In this regard, it is established that, pursuant to report DTO-TOP-07-06-23 of June 02, 2023, the Municipalidad de Moravia's Topography Department, following a review of evidence, technical studies, and a topographic survey, determined that the encroachment on public land attributed to the petitioner occurred in Trinidad de Moravia, Dirección01. Furthermore, officials from the Technical Directorate warned the petitioner that a shade-cloth and wood fence had been constructed that was encroaching on the municipal park.

Because the Municipalidad needed to install a fence in that park to carry out a project known as parque de mascotas, attempts were made to persuade the petitioner to remove the obstacle that was encroaching on the municipal park. However, the petitioner did not cooperate. On June 12, 2023, officials from the Operative Technical Directorate, with the support of the Moravia Municipal Police, Topography Department, Legal Department, and Parks Department, went to the location in question with the purpose of intervening and reclaiming public space; specifically, obstacles — a shade-cloth and wood fence — that were encroaching on the park area located in Trinidad de Moravia, Dirección01, were removed.

It should be noted that we are dealing with public-domain property whose nature entails the impossibility of any person holding a superior right over it, given that it is inalienable, imprescriptible, and unattachable, which is why the petitioner cannot claim the existence of any right protectable through this proceeding.

Consequently, no violation of the petitioner's fundamental rights is found, and the appropriate course of action is to order the dismissal of the writ with respect to this matter, as is hereby so ordered" (emphasis added).

The foregoing precedent is fully applicable to the case under study, since there are no grounds to depart from the criterion expressed therein, nor any reasons to assess the situation presented in a different manner.

It should be recalled that the petitioner claims that MINAE arrived at their home to evict them and destroy it; however, the petitioner themselves acknowledged that this is because the home is located within a wetland — that is, it was built within public-domain property, whose nature entails the impossibility of any person holding a superior right over it and, therefore, with respect to which the guarantees of due process are not enforceable in the terms alleged. In this regard, it is worth recalling that in the judgment cited above, this Chamber held that "since the petitioner was occupying public-domain property over which no right may be claimed, the police authorities — whether those of the Municipalidad de Moravia — are not required to initiate any administrative procedure in order to proceed with the removal of structures." Ergo, the writ is summarily rejected.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the parties that, should they have submitted any paper documents, as well as objects or evidence supported by any additional device, or by electronic, computer, magnetic, optical, telematic, or new-technology media, these must be retrieved from the court's offices within 30 business days after receiving notice of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-023470-0007-CO, interpuesto por Nombre01, contra EL MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).

Resultando:

  1. 1Por escrito incorporado al expediente electrónico el 30 de junio de 2026, la parte recurrente interpone recurso de amparo. Indica que durante alrededor de 30 años ha tenido un lote en el que hace 22 años hizo un pozo artesanal y una pequeña casa de madera donde tenía todos sus bienes. Menciona que el Instituto Costarricense de Electricidad le proporcionó el servicio eléctrico. Acusa que durante la mañana recibió una llamada de su hijo, quien le informó que funcionarios del MINAE se apersonaron a su vivienda junto con oficiales de la Fuerza Pública para desalojarlo y destruir su casa. Reclama que nunca se ha abierto un expediente administrativo ni se le ha permitido ejercer su derecho de defensa. Alega que las autoridades estiman que su vivienda está en una porción de terreno denominada humedal, de lo que nunca ha tenido conocimiento. Solicita que se suspenda el desalojo en su contra.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente indica que durante alrededor de 30 años ha tenido un lote en el que hace 22 años hizo un pozo artesanal y una pequeña casa de madera donde tenía todos sus bienes. Menciona que el Instituto Costarricense de Electricidad le proporcionó el servicio eléctrico. Acusa que durante la mañana recibió una llamada de su hijo, quien le informó que funcionarios del MINAE se apersonaron a su vivienda junto con oficiales de la Fuerza Pública para desalojarlo y destruir su casa. Reclama que nunca se ha abierto un expediente administrativo ni se le ha permitido ejercer su derecho de defensa. Alega que las autoridades estiman que su vivienda está en una porción de terreno denominada humedal, de lo que nunca ha tenido conocimiento. Solicita que se suspenda el desalojo en su contra.

II. INADMISIBILIDAD DEL RECURSO

En el sub iudice, la La parte recurrente indica que durante alrededor de 30 años ha tenido un lote en el que hace 22 años hizo un pozo artesanal y una pequeña casa de madera donde tenía todos sus bienes. Menciona que el Instituto Costarricense de Electricidad le proporcionó el servicio eléctrico. Acusa que durante la mañana recibió una llamada de su hijo, quien le informó que funcionarios del MINAE se apersonaron a su vivienda junto con oficiales de la Fuerza Pública para desalojarlo y destruir su casa. Reclama que nunca se ha abierto un expediente administrativo ni se le ha permitido ejercer su derecho de defensa. Alega que las autoridades estiman que su vivienda está en una porción de terreno denominada humedal, de lo que nunca ha tenido conocimiento. Solicita que se suspenda el desalojo en su contra.

Visto lo anterior, el Tribunal estima oportuno traer a colación lo consignado en la sentencia nro. 2023017842 de las 9:30 horas del 21 de julio de 2023:

“IV.- SOBRE EL RETIRO DE ESTRUCTURAS EN TERRENO MUNICIPAL. Del informe rendido por las autoridades recurridas, el cual es dado bajo la solemnidad del juramento, con oportuno apercibimiento de las consecuencias previstas en el artículo 44, de la Ley de la Jurisdicción Constitucional, se descarta la infracción de algún derecho fundamental en contra de la recurrente, con fundamento en las razones que a continuación se exponen.

Al respecto, se acredita que la recurrente se encontraba ocupando un área de parque propiedad de la Municipalidad de Moravia; es decir, un bien de dominio público. En lo que respecta a los bienes de naturaleza pública, la doctrina ha hecho una diferencia y ha denominado a una parte de ellos como de dominio público, demaniales o dominicales, y a la otra, como propios o patrimoniales del Estado. Los primeros se entiende que son aquellos de aprovechamiento común del administrado o de uso público, como los museos, edificios de oficinas públicas, caminos, canales, ríos, torrentes, puertos, puentes, riberas, playas, radas, parques y otros análogos; los segundos, son los que el Estado posee como cualquier otra persona jurídica. En referencia a los bienes demaniales, este Tribunal Constitucional los definió así:

“El dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público.- Son los llamados bienes dominicales, bienes demaniales, bienes o cosas públicas o bienes públicos, que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera del comercio de los hombres ... esos bienes pertenecen al Estado ... Como están fuera del comercio, estos bienes no pueden ser objeto de posesión, aunque se puede adquirir un derecho al aprovechamiento, aunque no un derecho a la propiedad” (véase en similar sentido la Sentencia N° 2010-20346 de las 9:21 horas de 3 de diciembre de 2010).

En este orden de ideas, al estar la accionante ocupando bienes de dominio público sobre los cuales no se puede alegar ningún derecho, no resulta obligatorio para las autoridades de policía, sean estas del Municipalidad de Moravia, iniciar procedimiento administrativo alguno para poder proceder al retiro de estructuras. En ese sentido, esta Sala Constitucional, en la misma sentencia citada líneas atrás -N° 2010-20346-, se consignó lo siguiente:

"VI... En los casos en que se pretenda ejercer la ocupación por las vías de hecho, ya sea en forma pacífica o mediante hechos de fuerza, bien puede la Administración desalojarlos por la misma vía, sin que sea necesario acudir a expediente alguno, ni a reglas del debido proceso, incluyendo la facultad de retirar los bienes de los sitios públicos ocupados, a reserva de ser devueltos a sus propietarios...”.

En virtud de lo anteriormente expuesto, se descarta que en el presente caso se haya vulnerado el derecho de propiedad. Al respecto, se acredita que por informe DTO-TOP-07-06-23 del 02 de junio de 2023, el Departamento de Topografía de la Municipalidad, luego del estudio de elementos, estudios técnicos y levantamiento topográfico, determinó la invasión de área pública que se le indilgó a la recurrente en Trinidad de Moravia, Dirección01. Además, que funcionarios de la Dirección Técnica advirtieron a la amparada que se había construido una cerca de sarán y madera que estaba invadiendo el parque municipal. Debido a que la Municipalidad necesitaba colocar una malla en ese parque para llevar a cabo un proyecto denominado parque de mascotas, se intentó convencer a la amparada de quitar el obstáculo que estaba invadiendo el parque municipal. Sin embargo, no hubo colaboración por parte de la accionante. Ahora bien, el 12 de junio de 2023, funcionarios de la Dirección Técnica Operativa, con apoyo de la Policía Municipal de Moravia, Departamento de Topografía, Departamento Legal y Departamento de Parques, se apersonaron al lugar de interés, con el objeto de intervenir y recuperar espacio público; en concreto, se removieron obstáculos (una cerca de madera y sarán), que estaban invadiendo área de parque, ubicado en la Trinidad de Moravia, Dirección01.

Nótese, que se está en presencia de un bien demanial cuya naturaleza conlleva la imposibilidad de que persona alguna cuente con mejor derecho sobre él, en virtud de ser inalienable, imprescriptible e inembargable, motivo por el cual la amparada no puede pretender la existencia de algún derecho, tutelable en esta vía.

En consecuencia, no se constata lesión alguna a los derechos fundamentales de la recurrente, por lo que lo procedente es ordenar su desestimación en cuanto a este extremo se refiere, como en efecto se dispone” (el resaltado fue agregado).

El precedente transcrito resulta plenamente aplicable al caso bajo estudio, toda vez que no se encuentran motivos para variar el criterio vertido, ni razones para valorar de manera diferente la situación planteada.

Recuérdese que el accionante reclama que el MINAE se apersonó a su vivienda a fin de desalojarlo y destruirla; sin embargo, el mismo reconoció que ello se debe a que esta se encuentra ubicada en un humedal, es decir, fue construida dentro de un bien demanial, cuya naturaleza conlleva la imposibilidad de que persona alguna cuente con mejor derecho sobre él y, por ende, respecto del cual no resultan exigibles las garantías del debido proceso en los términos acusados. En ese sentido, conviene recordar que en el pronunciamiento supracitado, esta Cámara dispuso que “al estar la accionante ocupando bienes de dominio público sobre los cuales no se puede alegar ningún derecho, no resulta obligatorio para las autoridades de policía, sean estas del Municipalidad de Moravia, iniciar procedimiento administrativo alguno para poder proceder al retiro de estructuras”.

Ergo, se rechaza de plano el recurso.

Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
