CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand and twenty-six.

Amparo petition (recurso de amparo) filed by Nombre01, attorney bar registration number 19107, on behalf of Nombre02, national identity card number (cédula de identidad) CED01, against the CONCEJO MUNICIPAL DE DISTRITO DE LEPANTO.

Background:

  1. 1By written submission incorporated into the digital case file (expediente) on May 4, 2026, the petitioner files an amparo petition and states, as recorded in the case-opening order, the following:

"[The petitioner] states that, since an unspecified date, the protected party has maintained peaceful possession and use of a property located on Isla Venado, in the Playa La Española area, approximately 400 meters west of the house known as Cecilia, where, since 2018, there has existed a stable, consolidated, and habitable structure consisting of 2 bedrooms, a bathroom, a kitchen, and a covered outdoor area, constituting a real and functional building whose eventual demolition would cause serious and irreparable harm. On April 20, 2026, municipal officials appeared at the property and verbally communicated the existence of an alleged period of ten business days, without serving any written resolution, formal administrative act (acto administrativo), properly reasoned order, or delivering any documentation whatsoever. The petitioner alleges that, as of the date the petition was filed, no valid administrative proceeding (procedimiento administrativo) had been served on his client, nor had any prior hearing or real opportunity to be heard been granted, and access to the administrative case file was also denied despite the client's direct and legitimate interest.

The petitioner further states that in the area there are other structures, some even more recently built, against which no similar administrative action has been taken, giving rise to an appearance of unequal treatment and selective exercise of authority. The petitioner contends that, since April 20, an actual and imminent threat of demolition has persisted, directly injuring the protected party's fundamental rights. The petitioner requests that the petition be granted."

  1. 2By resolution issued at 11:27 a.m. on May 12, 2026, the amparo petition was admitted and the district administrator (intendente) of the Concejo Municipal de Distrito de Lepanto was requested to report on the facts alleged by the petitioner.
  2. 3Juan Luis Arce Castro, in his capacity as Municipal District Administrator of the Concejo Municipal de Distrito de Lepanto, reports under oath as follows:

"FIRST: Denial of the facts as presented by the petitioner.

The facts alleged by the petitioner, insofar as they seek to attribute arbitrary conduct or conduct injurious to fundamental rights to this Administration, are rejected as inaccurate, improper, and lacking legal foundation.

The conduct engaged in by this Municipal Council does not stem from a discretionary or arbitrary decision, but rather from the legitimate and mandatory exercise of administrative powers legally conferred for the protection, recovery, and conservation of the maritime-terrestrial public domain (dominio público marítimo terrestre).

SECOND: On the true nature of the structure subject to the proceeding.

It is necessary to clarify to this honorable Chamber that the structure subject to the administrative proceeding does not correspond, under any circumstance, to a consolidated, permanent, or historically inhabited dwelling of the petitioner or his family unit, as the amparo petition attempts to suggest.

From inspections carried out by municipal officials, as well as from on-site physical assessments, it was found that the structure exhibits construction characteristics typical of a building intended for private economic activity, specifically commercial exploitation in the form of a Bar-Restaurant.

Likewise, from the physical assessment on record in the case file, it is evident that the construction is of recent date, and there is no technical, documentary, or registry evidence that would validly support the petitioner's claim of a consolidated existence since two thousand and eighteen.

On the contrary, the evidence gathered reasonably supports the inference that this is a recently built structure erected for commercial purposes within a legally protected public domain area.

Consequently, it is improper to invoke heightened constitutional protection under the right to housing, since, both materially and legally, we are not faced with a residential dwelling but rather with an occupation intended for the private economic exploitation of public space.

THIRD: On the existence of formal administrative actions.

Contrary to the petitioner's claims, the administrative case file contains formal resolutions duly issued by the competent authority, ordering the release of the improperly occupied public zone (zona pública).

The case file also contains proceedings expressly aimed at identifying and locating the person responsible for the works.

As a result of those efforts, a telephone call was made, documented in the administrative case file, during which the person contacted stated that she was neither the owner nor responsible for the construction.

Notwithstanding that denial, the Administration, in observance of the principle of protection of the public interest and protection of the public domain, continued the corresponding proceeding and granted a period of ten business days for the voluntary removal of the structures and the consequent release of the occupied area.

This demonstrates, beyond any doubt, that a formal administrative act, effective communication, and a reasonable opportunity to exercise a defense did indeed exist.

FOURTH: On access to the case file and due process.

The allegation regarding an alleged denial of access to the case file lacks any real basis.

The administrative case file was made available to the interested party and subsequently forwarded to his legal representative.

It should be emphasized that the very fact that the petitioner filed an administrative nullity motion and brought this amparo petition demonstrates sufficient knowledge of the proceedings and full practical access to the information necessary to mount a technical defense.

Constitutional jurisprudence has consistently established that only an actual and effective inability to mount a defense (indefensión) carries constitutional significance.

In the present case, no such inability exists nor has it been established.

FIFTH: On the special protection regime of the Zona Marítimo Terrestre.

The present matter is governed by Ley N° 6043 on the Zona Marítimo Terrestre, a special statute of public order whose observance is mandatory.

Pursuant to its provisions, the maritime-terrestrial public zone constitutes national heritage and is inalienable, not subject to prescription, and not subject to attachment (inembargable), and is dedicated to collective use and enjoyment.

The fifty-meter public strip adjacent to the ordinary high-tide mark (pleamar ordinaria) may not be appropriated, occupied, commercially exploited, or subject to possessory consolidation by private individuals.

The Constitutional Chamber has consistently held that no physical permanence or de facto historical presence generates any vested right over public domain property (bien demanial).

Therefore, any structure erected within that strip constitutes an illegitimate occupation subject to administrative removal.

SIXTH: Non-waivable legal duty to release and recover.

The Municipal Council has no discretion to tolerate illegal occupations.

Ley N° 6043 expressly imposes on local governments the legal obligation to inspect, order vacation, and restore the physical integrity of the public zone when it has been invaded or improperly used.

Administrative inaction in the face of such occupations would constitute a breach of the principle of legality and could eventually give rise to disciplinary liability.

Accordingly, once an irregular occupation has been verified, this Municipal Council is legally bound to order its release.

SEVENTH: Existence of environmental complaints regarding impact on the mangrove (manglar).

This honorable Chamber should be made aware that, in connection with the facts at issue, complaints have been filed with the Ministerio Público and the Fiscalía by SINAC, related to alleged damage to the mangrove ecosystem in the affected area.

These complaints stem from technical actions that revealed reasonable indications of environmental harm associated with recent construction activity.

Mangroves constitute ecosystems given special protection under our legal system and constitutional jurisprudence, given their extremely high ecological importance and essential role in maintaining the stability of the marine-coastal equilibrium.

In light of the precautionary principle (principio precautorio) and the constitutional duty of environmental protection enshrined in Article 50 of the Constitución Política, the immediate administrative action is fully legitimate and legally required.

EIGHTH: Grounds for denying the precautionary measure.

The precautionary measure (medida cautelar) sought by the petitioner is manifestly improper.

To grant it would be equivalent to maintaining an illegal occupation of public domain property, allowing the continuation of irregular commercial exploitation, and obstructing the administrative and environmental protection that the law requires.

There is no appearance of a valid right susceptible to precautionary protection.

PRAYER FOR RELIEF.

For the foregoing reasons, I respectfully request that this honorable Chamber:

1. Deny the present amparo petition.

2. Deny the requested precautionary measure.

3. Find it established that the structure subject to the proceeding constitutes a recently built structure intended for commercial exploitation as a Bar-Restaurant, and that a cabin is likewise under construction, rather than a consolidated family dwelling.

4. Find it established that environmental complaints have been filed by SINAC regarding alleged damage to the mangrove ecosystem.

5. Recognize the full legality of the administrative actions aimed at recovering and releasing the maritime-terrestrial public zone pursuant to Ley N.° 6043.

6. Authorize the continuation of the corresponding administrative proceeding.

CONCLUSION

There is no constitutional injury attributable to this Administration.

The challenged municipal action constitutes the strict fulfillment of a public-order legal mandate aimed at defending the public domain and effectively protecting the environment against a recent, irregular occupation intended for private commercial exploitation within the maritime-terrestrial public zone.

For this reason, the present petition must be denied in all respects.

A certified copy of the administrative case file is also submitted."

  1. 4The legal requirements have been observed in the proceedings followed.

Considering:

I.Subject of the petition. The petitioner alleges that, since an unspecified date, the protected party has maintained peaceful possession and use of a property located on Isla Venado, in the Playa La Española area, approximately 400 meters west of the house known as Nombre03, where, since 2018, there has existed a stable, consolidated, and habitable structure consisting of 2 bedrooms, a bathroom, a kitchen, and a covered outdoor area, constituting a real and functional building whose eventual demolition would cause serious and irreparable harm. The petitioner states that on April 20, 2026, municipal officials appeared at the property and verbally communicated the existence of an alleged period of ten business days, without serving any written resolution, formal administrative act, properly reasoned order, or delivering any documentation whatsoever. The petitioner states that, as of the date the petition was filed, no valid administrative proceeding had been served on his client, nor had any prior hearing or real opportunity to be heard been granted, and access to the administrative case file was also denied despite the client's direct and legitimate interest.

The petitioner further states that in the area there are other structures, some even more recently built, against which no similar administrative action has been taken, giving rise to an appearance of unequal treatment and selective exercise of authority. The petitioner contends that, since April 20, 2026, an actual and imminent threat of demolition has persisted, directly injuring the protected party's fundamental rights. The petitioner requests that the petition be granted.

II. Established facts. The following facts are deemed duly proven as material to the resolution of this matter

  • a)On April 20, 2026, municipal officials appeared at the site referenced by the petitioner and communicated the existence of a ten-business-day period related to the removal of the structures located on the property, in connection with the recovery and conservation of the maritime-terrestrial public domain in the Isla Venado, Playa La Española area (see report of the respondent authority).
  • b)The Concejo Municipal de Distrito de Lepanto processed an administrative case file related to the occupation and construction existing in the indicated area (see report of the respondent authority).
  • c)The structure subject to the administrative proceeding does not correspond to a consolidated, permanent, or historically inhabited family dwelling of the protected party or his family unit. The structure exhibits construction characteristics typical of a building intended for private economic activity in the form of a bar-restaurant (see report of the respondent authority).
  • d)In connection with the facts at issue, complaints have been filed with the Ministerio Público and the Fiscalía by SINAC, related to alleged damage to the mangrove ecosystem in the affected area (see report of the respondent authority).

III.On the specific case. After analyzing the evidentiary elements submitted and the report given under oath by the Municipal District Administrator of the Concejo Municipal de Distrito de Lepanto, with the consequences—including criminal ones—provided for in Article 44 of the Ley de Jurisdicción Constitucional, it is established that the challenged administrative action did not stem from an arbitrary, informal, or unfounded decision, but rather from the exercise of powers aimed at the protection, recovery, and conservation of the maritime-terrestrial public domain.

In effect, the respondent Administration reported that the structure subject to the proceeding does not correspond to a consolidated, permanent, or historically inhabited family dwelling of the protected party or his family unit, but rather to a recently built structure with characteristics typical of a private economic activity in the form of a bar-restaurant, located in a legally protected public domain area. The Administration also stated that the administrative case file contains formal resolutions issued by the competent authority, proceedings aimed at identifying the person responsible for the works, and actions through which a ten-business-day period was granted for the voluntary removal of the structures and the release of the occupied area.

Under these circumstances, the structures to which the petitioner refers are encroaching upon public domain property, in response to which the respondent party is authorized to adopt whatever measures it deems necessary in order to recover the property. Furthermore, since the property is public domain property, no private individual may assert any real right over it, because, by its nature, such property is not lost through the passage of time, given its characteristics of being inalienable, not subject to attachment, and not subject to prescription. It is likewise a consistent ruling of this Chamber that the occupation of public domain property does not generate vested rights in favor of private individuals. Consequently, the competent authorities are not required to initiate a prior administrative proceeding in order to proceed with the removal of structures installed in such areas.

Regarding the allegation of unequal treatment, the petitioner merely points to the existence of other structures in the area that, as claimed, have not been the subject of similar actions. However, the petitioner provides no sufficient benchmarks for comparison, does not demonstrate substantial identity of situations, and does not establish that the Administration acted with arbitrariness or discrimination. The possible existence of other irregular occupations does not prevent the Administration from exercising its powers of inspection and recovery of the public domain with respect to a given occupation, nor does it generate a subjective right to remain in a situation contrary to the legal order.

Finally, it cannot be overlooked that the respondent authority reported the existence of environmental complaints related to alleged damage to the mangrove ecosystem in the affected area. This circumstance reinforces the Administration's duty to act, in light of the precautionary principle and the constitutional mandate of environmental protection provided for in Article 50 of the Constitución Política. In that context, the municipal action aimed at preserving the public domain and preventing or addressing potential environmental harm does not appear, prima facie, to be unlawful or injurious to fundamental rights.

Under these circumstances, the appropriate outcome is the dismissal of the petition, which is hereby so ordered.

IV.Documentation submitted to the case file. The parties are hereby notified that, if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the office within a maximum period of thirty business days, counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at Session No. 27-11, of August 22, 2011, Article XXVI, and published in the Boletín Judicial No. 19, of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at Session No. 43-12, held on May 3, 2012, Article LXXXI.

Recurso de amparo promovido por Nombre01, carné abogado 19107, a favor de Nombre02, cédula de identidad CED01, contra la CONCEJO MUNICIPAL DE DISTRITO DE LEPANTO.

Resultando:

  1. 1Por escrito incorporado al expediente digital el 04 de mayo de 2026, la parte recurrente interpone recurso de amparo y manifiesta, según se consigna en el auto curso, lo siguiente:

“[E]xpone que, desde fecha no indicada, el amparado mantiene posesión y uso pacífico de un inmueble ubicado en Isla Venado, sector Playa La Española, aproximadamente 400 metros al oeste de la casa conocida como Cecilia, en el que, desde el 2018, existe una construcción estable, consolidada y habitable compuesta por 2 habitaciones, sanitario, cocina y área de rancho, tratándose de una edificación real y funcional cuya eventual demolición ocasionaría un daño grave e irreparable. El 20 de abril de 2026, funcionarios municipales se apersonaron en el inmueble y comunicaron de forma verbal la existencia de un supuesto plazo de diez días hábiles, sin notificar resolución escrita, acto administrativo formal, orden debidamente motivada ni entregar documentación alguna. Alega que, a la fecha de la interposición del recurso, a su representado no se le había notificado válidamente procedimiento administrativo alguno, ni otorgado audiencia previa u oportunidad real de defensa, impidiéndose además el acceso al expediente administrativo pese a su interés directo y legítimo.

Agrega que, en el sector existen otras construcciones incluso más recientes sin que contra estas haya existido actuación administrativa similar, generándose una apariencia de trato desigual y ejercicio selectivo de potestades. Aduce que, desde el 20 de abril anterior, persiste una amenaza actual e inminente de demolición con lesión directa a los derechos fundamentales del amparado. Solicita que se declare con lugar el recurso”.

  1. 2En resolución de las 11:27 horas del 12 de mayo de 2026, se da curso al amparo y solicita informe al intendente del Concejo Municipal de Distrito de Lepanto, sobre los hechos alegados por la parte recurrente.
  2. 3Informa bajo juramento Juan Luis Arce Castro, en su condición de intendente Municipal del Concejo Municipal de Distrito de Lepanto, lo siguiente:

“PRIMERO: Negativa de los hechos en los términos expuestos por el recurrente.

Se rechazan por inexactos, improcedentes y carentes de sustento jurídico los hechos alegados por el recurrente en cuanto pretenden atribuir a esta Administración actuaciones arbitrarias o lesivas de derechos fundamentales.

La actuación desplegada por este Concejo Municipal no obedece a una decisión discrecional ni caprichosa, sino al ejercicio legítimo y obligatorio de potestades administrativas legalmente conferidas para la tutela, protección, recuperación y conservación del dominio público marítimo terrestre.

SEGUNDO: Sobre la verdadera naturaleza de la construcción objeto del procedimiento.

Resulta necesario aclarar a esta honorable Sala, que la estructura objeto del procedimiento administrativo no corresponde, en ninguna circunstancia, a una vivienda consolidada, permanente o históricamente habitada por el recurrente o su núcleo familiar, tal y como se pretende hacer ver en el escrito de amparo.

De las inspecciones efectuadas por funcionarios municipales, así como de la valoración material realizada en sitio, se constató que la estructura presenta características constructivas propias de una edificación destinada al desarrollo de actividad económica privada, específicamente de explotación comercial tipo Bar-Restaurante.

Asimismo, de la valoración física realizada que consta en el expediente se desprende que la construcción es de data reciente, no existiendo elemento técnico, documental o registral alguno que permita sostener válidamente la afirmación del recurrente relativa a una supuesta existencia consolidada desde el año dos mil dieciocho.

Por el contrario, la evidencia recabada permite inferir razonablemente que se trata de una construcción reciente ejecutada con fines comerciales dentro de una zona de dominio público legalmente protegida.

En consecuencia, resulta improcedente invocar tutela constitucional reforzada bajo la figura del derecho fundamental a la vivienda, por cuanto material y jurídicamente no estamos frente a una casa de habitación sino frente a una ocupación destinada al aprovechamiento económico privado del espacio público.

TERCERO: Sobre la existencia de actuaciones administrativas formales.

Contrario a lo sostenido por el recurrente, dentro del expediente administrativo constan resoluciones formales debidamente emitidas por la autoridad competente, mediante las cuales se ordenó la liberación de la zona pública indebidamente ocupada.

Asimismo, constan diligencias expresamente dirigidas a identificar y localizar a la persona responsable de las obras.

Producto de dichas gestiones se efectuó llamada telefónica cuya constancia documental obra dentro del expediente administrativo, ocasión en la cual la persona contactada manifestó no ser propietaria ni responsable de la construcción.

No obstante, dicha negativa la Administración, en observancia del principio de tutela del interés público y protección del dominio demanial, continuó el procedimiento correspondiente, otorgando un plazo de diez días hábiles para proceder voluntariamente al retiro de las estructuras y la consecuente liberación del área ocupada.

Lo anterior evidencia, sin margen de duda, que sí existió acto administrativo formal, comunicación efectiva y oportunidad razonable para el ejercicio de defensa.

CUARTO: Sobre el acceso al expediente y el debido proceso.

La alegación relativa a una supuesta denegatoria de acceso al expediente carece de sustento real.

El expediente administrativo fue puesto a disposición del interesado y posteriormente remitido a su representación legal.

Debe resaltarse que el hecho mismo de que el recurrente haya articulado incidente de nulidad administrativa y promovido el presente recurso de amparo demuestra conocimiento suficiente de las actuaciones y pleno acceso material a la información necesaria para estructurar defensa técnica.

La jurisprudencia constitucional ha sido reiterada al establecer que únicamente la indefensión real y efectiva posee relevancia constitucional.

En el caso concreto, dicha indefensión no existe ni ha sido acreditada.

QUINTO: Del régimen especial de protección de la Zona Marítimo Terrestre.

El presente asunto se encuentra regido por la Ley N° 6043 sobre la Zona Marítimo Terrestre, normativa especial de orden público cuya observancia resulta obligatoria.

Conforme sus disposiciones, la zona pública marítimo terrestre constituye patrimonio nacional, siendo inalienable, imprescriptible, inembargable y destinada al uso y disfrute colectivo.

La franja pública de cincuenta metros contigua a la pleamar ordinaria no puede ser objeto de apropiación, ocupación, explotación comercial ni consolidación posesoria por particulares.

La Sala Constitucional ha sostenido reiteradamente que ninguna permanencia material ni antigüedad de hecho genera derecho adquirido alguno sobre bienes demaniales.

Por ende, cualquier construcción erigida dentro de dicha franja constituye ocupación ilegítima susceptible de remoción administrativa.

SEXTO: Deber legal irrenunciable de liberación y recuperación.

El Concejo Municipal no posee discrecionalidad para tolerar ocupaciones ilegales.

La Ley N° 6043 impone a los gobiernos locales la obligación jurídica expresa de fiscalizar, ordenar la desocupación y recuperar la integridad física de la zona pública cuando esta ha sido invadida o utilizada indebidamente.

La inacción administrativa frente a tales ocupaciones constituiría incumplimiento del principio de legalidad y eventualmente generaría responsabilidad funcional.

En virtud de ello, una vez verificada la ocupación irregular, este Concejo Municipal se encuentra comprometida legalmente a ordenar su liberación.

SÉTIMO: Existencia de denuncias ambientales por afectación al manglar.

Debe hacerse del conocimiento de esa honorable Sala que sobre los hechos aquí discutidos existen denuncias presentadas ante el Ministerio Público y Fiscalía por parte del Sistema Nacional de Áreas de Conservación (SINAC), relacionadas con presunta afectación al ecosistema de manglar existente en el sector intervenido.

Dichas denuncias derivan de actuaciones técnicas que evidenciaron indicios razonables de afectación ambiental asociados a movimientos constructivos recientes.

Los manglares constituyen ecosistemas especialmente protegidos por nuestro ordenamiento jurídico y por la jurisprudencia constitucional, dada su altísima relevancia ecológica y función esencial en la estabilidad del equilibrio marino-costero.

En virtud del principio precautorio y del deber constitucional de tutela ambiental consagrado en el artículo 50 de la Constitución Política, la actuación administrativa inmediata resulta plenamente legítima y jurídicamente exigible.

OCTAVO: Improcedencia de la medida cautelar.

La medida cautelar pretendida por el recurrente resulta manifiestamente improcedente.

Acceder a ella equivaldría a mantener una ocupación ilegal del dominio público, permitir la continuidad de explotación económica irregular y obstaculizar la protección administrativa y ambiental que el ordenamiento jurídico exige.

No concurre apariencia de buen derecho alguna susceptible de tutela cautelar.

PETITORIA.

Por lo expuesto, respetuosamente solicito a esa honorable Sala:

1. Declarar sin lugar el presente recurso de amparo.

2. Rechazar la medida cautelar solicitada.

3. Tener por acreditado que la estructura objeto del procedimiento constituye construcción reciente destinada a explotación comercial tipo Bar-Restaurante como también se encuentran realizando la construcción de una cabina y no vivienda familiar consolidada.

4. Tener por acreditada la existencia de denuncias ambientales promovidas por el SINAC por presunta afectación al ecosistema de manglar.

5. Reconocer la plena legalidad de las actuaciones administrativas orientadas a la recuperación y liberación de la zona pública marítimo terrestre conforme la Ley N.° 6043.

6. Autorizar la continuación del procedimiento administrativo correspondiente.

CONCLUSIÓN

No existe lesión constitucional alguna atribuible a esta Administración.

La actuación municipal impugnada constituye el cumplimiento estricto de un mandato legal de orden público orientado a la defensa del dominio demanial y a la protección efectiva del ambiente frente a una ocupación reciente, irregular y destinada a explotación comercial privada dentro de zona pública marítimo terrestre.

En virtud de ello, el presente recurso debe rechazarse en todos sus extremos.

Como también se remite copia certificada del expediente administrativo”.

  1. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. El recurrente alega que, desde fecha no indicada, el amparado mantiene posesión y uso pacífico de un inmueble ubicado en Isla Venado, sector Playa La Española, aproximadamente 400 metros al oeste de la casa conocida como Nombre03, en el que, desde el 2018, existe una construcción estable, consolidada y habitable compuesta por 2 habitaciones, sanitario, cocina y área de rancho, tratándose de una edificación real y funcional cuya eventual demolición ocasionaría un daño grave e irreparable. Señala que el 20 de abril de 2026, funcionarios municipales se presentaron en el inmueble y comunicaron de forma verbal la existencia de un supuesto plazo de diez días hábiles, sin notificar resolución escrita, acto administrativo formal, orden debidamente motivada ni entregar documentación alguna. Indica que, a la fecha de la interposición del recurso, a su representado no se le había notificado válidamente procedimiento administrativo alguno, ni otorgado audiencia previa u oportunidad real de defensa, impidiéndose además el acceso al expediente administrativo pese a su interés directo y legítimo.

Agrega que, en el sector existen otras construcciones incluso más recientes sin que contra estas haya existido actuación administrativa similar, generándose una apariencia de trato desigual y ejercicio selectivo de potestades. Aduce que, desde el 20 de abril de 2026, persiste una amenaza actual e inminente de demolición con lesión directa a los derechos fundamentales del amparado. Solicita que se declare con lugar el recurso.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 20 de abril de 2026, funcionarios municipales se apersonaron al sitio referido por el recurrente y comunicaron la existencia de un plazo de diez días hábiles relacionado con el retiro de las estructuras ubicadas en el inmueble, esto en recuperación y conservación del dominio público marítimo terrestre en el sector de Isla Venado, Playa La Española (véase informe de la autoridad recurrida).
  • b)El Concejo Municipal de Distrito de Lepanto tramitó un expediente administrativo relacionado con la ocupación y construcción existente en la zona indicada (véase informe de la autoridad recurrida).
  • c)La estructura objeto del procedimiento administrativo no corresponde a una vivienda familiar consolidada, permanente o históricamente habitada por el amparado o su núcleo familiar. La estructura presenta características constructivas propias de una edificación destinada al desarrollo de actividad económica privada tipo bar-restaurante (véase informe de la autoridad recurrida).
  • d)Sobre los hechos discutidos existen denuncias presentadas ante el Ministerio Público y Fiscalía por parte del Sistema Nacional de Áreas de Conservación, relacionadas con una presunta afectación al ecosistema de manglar existente en el sector intervenido (véase informe de la autoridad recurrida).

III.Sobre el caso concreto. Después de analizar los elementos probatorios aportados y el informe rendido bajo fe de juramento por el intendente Municipal del Concejo Municipal de Distrito de Lepanto con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de Jurisdicción Constitucional, se tiene acreditado que la actuación administrativa cuestionada no obedeció a una decisión arbitraria, informal o carente de sustento, sino al ejercicio de potestades dirigidas a la tutela, recuperación y conservación del dominio público marítimo terrestre.

En efecto, la Administración recurrida informó que la estructura objeto del procedimiento no corresponde a una vivienda familiar consolidada, permanente o históricamente habitada por el amparado o su núcleo familiar, sino a una edificación de data reciente con características propias de una actividad económica privada tipo bar-restaurante, ubicada en una zona de dominio público legalmente protegida. Asimismo, indicó que dentro del expediente administrativo constan resoluciones formales emitidas por la autoridad competente, diligencias orientadas a identificar a la persona responsable de las obras y actuaciones mediante las cuales se otorgó un plazo de diez días hábiles para el retiro voluntario de las estructuras y la liberación del área ocupada.

Así las cosas, las construcciones a las que hacen referencia el recurrente, se encuentran invadiendo bienes de dominio público, ante lo cual, la parte recurrida se encuentra facultada para adoptar las medidas que estime necesarias a fin recuperar el bien. Además, por tratarse de bien demanial, ninguna persona puede alegar ningún derecho real, ya que, por su naturaleza, el bien no se pierde con el transcurso del tiempo, dada su característica de inembargable, inalienable e imprescriptible. Asimismo, es criterio reiterado de esta Sala que la ocupación de bienes de dominio público no genera derechos adquiridos a favor de particulares. En consecuencia, las autoridades competentes no están obligadas a iniciar procedimiento administrativo previo para proceder al retiro de estructuras instaladas en tales áreas.

En relación con el alegato de trato desigual, el recurrente se limita a señalar la existencia de otras construcciones en el sector que, según afirma, no habrían sido objeto de actuaciones similares. Sin embargo, no aporta parámetros de comparación suficientes, ni demuestra identidad sustancial de situaciones, ni acredita que la Administración haya actuado con arbitrariedad y discriminación. La eventual existencia de otras ocupaciones irregulares no impide a la Administración ejercer sus potestades de fiscalización y recuperación del dominio público respecto de una ocupación determinada, ni genera un derecho subjetivo a permanecer en una situación contraria al ordenamiento jurídico.

Finalmente, no puede obviarse que la autoridad recurrida informó sobre la existencia de denuncias ambientales relacionadas con una presunta afectación al ecosistema de manglar en el sector intervenido. Tal circunstancia refuerza el deber de actuación de la Administración, a la luz del principio precautorio y del mandato constitucional de protección ambiental previsto en el artículo 50 de la Constitución Política. En ese contexto, la actuación municipal orientada a preservar el dominio público y prevenir o atender eventuales daños ambientales no se revela, prima facie, como ilegítima o lesiva de derechos fundamentales.

Bajo tal estado de las cosas, lo procedente es la desestimatoria del recurso como en efecto se dispone.

IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
