Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand and twenty-six.
Writ of amparo (recurso de amparo) filed in case file No. 26-006743-0007-CO, brought by Nombre01, national identity card CED01, against the MINISTERIO DE AMBIENTE Y ENERGÍA AND THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
BACKGROUND:
Opinion written by Justice Hess Herrera; and,
CONSIDERING:
The petitioner alleges that on February 20, 2026, the Directorate of Waters of MINAE served upon him an official notice — bearing no reference number — by which it arbitrarily orders the disconnection of a water intake structure within a period of ten business days. He asserts that he is the owner of the property registered under property registry folio number [number], where a spring is located. He maintains that the water intake infrastructure that is the subject of the disconnection order has operated peacefully, openly, and without interruption for approximately 42 years. He alleges that the system directly supplies 50 families. The water is used for the upkeep of farm animals, domestic animals, and subsistence crops. He states that cutting off the water is equivalent to destroying the families' economic and food patrimony, causing irreparable harm. He adds that the spring is the only source of drinking water for human consumption for the community's families. He accuses that cutting off the water — which MINAE intends to carry out without AyA pipes being in place or an ASADA having been established — would cause irreparable harm to public health.
The following facts are considered duly proven and material to the resolution of this matter:
From the report submitted by the representatives of the respondent authority — which is accepted as having been made under oath with all the consequences, including criminal ones, provided for in article 44 of the law governing this jurisdiction — and from the evidence submitted for the resolution of this matter, it is considered established that on February 20, 2026, officials of the Térraba-Pacífico Sur Hydrological Unit of the Directorate of Waters of MINAE conducted a control inspection at the property associated with file 20781-P in the name of Nombre02, where the following was found: Two water intake structures were identified over two springs of the public domain, which do not have a water-use concession granted by the Ministerio de Ambiente y Energía, as required by Ley 276, Ley de Aguas. The springs being used are located on land owned by Nombre01, the petitioner. On that same February 20 of the current year, Nombre01 was personally served notice informing him that: "if you wish to continue using the water, you must apply for a Water-Use Concession from the Ministerio de Ambiente y Energía within TEN DAYS, pursuant to article 264 of the Ley General de la Administración Pública." Subsequently, during an inspection carried out on March 10 of the current year by the Térraba-Pacífico Sur Hydrological Unit of the Directorate of Waters of MINAE, non-compliance with the aforementioned administrative order was confirmed.
It was also established that on March 15 of the current year, the petitioner filed a request with that institution for an extension of time in order to carry out the necessary steps and comply with what the administrative order required. On April 6 of the current year, by official notice DA-UHTPSOG-0102-2026, the request for an extension was denied because it was submitted outside the established time period under article 258 of the Ley General de la Administración Pública. That on April 6, 2026, the Térraba-Pacífico Sur Hydrological Unit of MINAE filed a criminal complaint against Nombre01 with the Office of the Public Prosecutor to investigate the offense of disobedience to authority.
Based on the foregoing, the Chamber finds no violation of the petitioner's fundamental rights. This is because the petitioner brings a writ of amparo alleging harm arising from the disconnection of water that he has been drawing from a spring he claims is on his property; however, it was established that the spring is of the public domain — it belongs to the State — and, accordingly, the respondent authority notified him of the need to apply for a concession over it, which, as of the date the reports were submitted, he had not done. In view of this situation, this Court cannot hold the respondent authority liable in any way, as the responsibility for filing such an application rests with the petitioner.
Moreover, if what the petitioner seeks is the intervention of this Chamber in order to be relieved of the obligation to comply with the established requirements for the supply of drinking water, it must be noted that it is not for this Court to determine whether or not the requirements for a water connection or service application have been met, as this is a matter of mere legality. If the petitioner believes that such a requirement should not be imposed on him, he must raise the issue through administrative channels or before the ordinary courts, so that his position may be subjected to an adversarial proceeding.
Likewise, it is important to note that as of the date on which the reports were submitted, there is no record of the petitioner having approached Acueductos y Alcantarillados to apply for or inquire about drinking water availability; no proceeding or application in the petitioner's name was found. For the reasons set forth above, the appropriate course of action is to dismiss the writ, as is hereby ordered.
The parties are hereby notified that if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of thirty business days, counted from the date of notification of this judgment. Failing that, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session No. 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session No. 43-12, held on May 3, 2012, article LXXXI.
THEREFORE:
The writ is dismissed. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .
Recurso de amparo que se tramita en el expediente No. 26-006743-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA Y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
RESULTANDO:
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
El recurrente alega que el 20 de febrero de 2026, la Dirección de Aguas del MINAE le notificó un oficio -sin número- mediante el cual se ordena de forma arbitraria la desconexión de una estructura de captación de agua en un plazo de diez días hábiles. Afirma que es propietario del inmueble matrícula de folio real número donde se ubica una naciente. Asegura que la infraestructura de captación de agua objeto de la orden de desconexión ha funcionado de manera pacífica, pública e ininterrumpida por aproximadamente 42 años. Alega que el sistema abastece de forma directa a 50 familias. El agua se utiliza para el mantenimiento de animales de granja, animales domésticos y cultivos de subsistencia. Indica que eliminar el agua equivale a destruir el patrimonio económico y alimentario de las familias, causando un daño irreparable. Agrega que dicha naciente es la única fuente de agua potable para el consumo humano de familias de la comunidad. Acusa que el corte del agua que pretende ejecutar el MINAE sin tener las tuberías del AYA o constituida una ASADA causaría un daño irremediable a la salud pública.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Del informe rendido por los representantes de la autoridad recurrida —que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la ley que rige esta jurisdicción— y la prueba aportada para la resolución del asunto, se tiene por demostrado que el 20 de febrero de 2026, funcionarios de la Unidad Hidrológica Térraba-Pacífico Sur de la Dirección de Agua del MINAE realizaron visita de control a la propiedad que cuenta con expediente 20781-P a nombre de Nombre02, donde se obtuvieron los siguientes hallazgos: Se ubicaron dos infraestructuras de captación sobre dos nacientes de agua del dominio público, las cuales no cuentan con concesión de aprovechamiento de agua, por parte del Ministerio de Ambiente y Energía, conforme lo dispone la Ley 276, Ley de Aguas. Las nacientes aprovechadas se encuentran en terreno propiedad del señor Nombre01, recurrente”.
El mismo 20 de febrero del año en curso, se realizó notificación en forma personal al señor Nombre01, donde se le indicó que: “de mantener el interés en aprovechar el agua, solicite la Concesión de Aprovechamiento de Agua ante el Ministerio de Ambiente y Energía en el plazo de DIEZ DÍAS, según el artículo 264 de la Ley General de la Administración Pública”. Posteriormente, en visita realizada el 10 de marzo del año en curso, por parte de la Unidad Hidrológica Térraba-Pacífico Sur de la Dirección de Agua del MINAE, se corroboró el incumplimiento de la orden administrativa citada. También, que el 15 de marzo del año en curso, el recurrente solicitó ante dicha institución una prórroga para poder realizar lo correspondiente y poder cumplir con lo establecido en la orden administrativa. El 06 de abril del año en curso, mediante oficio DA-UHTPSOG-0102-2026, se rechaza la solicitud de prórroga por estar presentada fuera del plazo establecido según el artículo 258 de la Ley General de la Administración Pública.
Que, el 6 de abril de 2026, la Unidad Hidrológica Térraba-Pacífico Sur del MINAE interpuso denuncia penal en contra del señor Nombre01 ante el Ministerio Público para que se investigue el delito de desobediencia a la autoridad.
De lo expuesto, la Sala descarta la afectación a los derechos fundamentales del recurrente. Esto, porque el interesado acude en amparo alegando sobre la desconexión de agua que ha venido utilizando en una naciente que alega está en su propiedad; sin embargo, se tuvo por acreditado que la misma es de dominio público -le pertenece al Estado-, y por lo anterior, la autoridad accionada le notificó sobre la necesidad de solicitar concesión de esta, lo cual a la fecha de rendidos los informes no ha hecho. Así, ante este panorama, no podría este Tribunal achacarle responsabilidad alguna a la autoridad accionada, pues dicha solicitud es responsabilidad del recurrente.
Ahora bien, si lo que el recurrente pretende es la intervención de esta Sala a fin de que no se le exija cumplir con los requisitos establecidos sobre el suministro de agua potable. Al respecto, es importante señalar que no corresponde a este Tribunal verificar el cumplimiento o no de los requerimientos para la conexión o solicitud del servicio, pues esto es una discusión de mera legalidad. Si el recurrente considera que no se le debe pedir tal requisito, deberá alegarlo en la vía administrativa, o bien, en la jurisdicción ordinaria, a fin de que se someta a contradictorio su posición.
De igual forma, es importante indicar que a la fecha en que se rinden los informes, no consta que el interesado haya acudido a Acueductos y Alcantarillados a fin de solicitar o gestionar sobre la disponibilidad de agua potable; no se ubica ninguna gestión o trámite a nombre del recurrente. Por las consideraciones expuestas, lo procedente es declarar sin lugar el recurso, como en efecto se dispone.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Notifíquese.
