SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand twenty-six.
Contempt motion (gestión de desobediencia) filed by Nombre01, identity card no. CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE HORQUETAS DE SARAPIQUÍ.
Recitals:
The opinion is drafted by Justice Araya García; and,
Considering:
I.Subject Matter. The petitioner alleges contempt of what was ordered in judgment no. 2025013579 of 9:15 hours on May 9, 2025. He states that to date the authorities of the Instituto Costarricense de Acueductos y Alcantarillados and the Asociación Administradora del Acueducto de Horquetas de Sarapiquí have not complied with what was ordered.
The respondent authorities, or those who may hold their respective positions, are warned that, pursuant to the provisions of Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order they must comply with or enforce, issued within an amparo (constitutional writ of protection) proceeding, and who fails to comply with it or to ensure its compliance, provided the offense is not more severely penalized under another provision. The Instituto Costarricense de Acueductos y Alcantarillados and the ASADA de Horquetas de Sarapiquí are ordered to pay costs, damages, and losses caused by the facts underlying this ruling, to be assessed in judgment enforcement proceedings before the contentious-administrative courts. Notify accordingly." (the record).
During this stage, several setbacks arose that required AyA to revise its activity plans and seek financing to cover activities not originally contemplated. Among these, some activities that were initially the ASADA's responsibility but could not be carried out as agreed stand out, such as the installation of pipeline at the Dirección 01 crossings, the construction of five elevated crossings (pasos elevados), thermofusion (termofusión) and polyethylene pipe installation at those crossings, and the planned system interconnections. Likewise, the limited water capacity currently available from the Horquetas aqueduct has made it difficult to carry out pressure tests on the full length of the installed pipeline. Despite the difficulties noted, completion of this stage is in its final phase; however, it is essential to complete Stages II and III in order to bring the new potable water system for the communities of Finca 6, Finca 4, Villa Nueva, and Semillero into operation (…).' Regarding Stage II (the water intake on the Río Santa Clara, the conveyance pipeline, construction of the drinking water treatment plant (PTAP), and the storage tank adjacent to the PTAP) and Stage III (construction of a 1,000 m³ storage tank in the Nazareth sector), the report states: '(…) there was a commitment for these stages to be developed by the ASADA de Horquetas de Sarapiquí, which was managing the technical design of Stage II (intake, conveyance pipeline, land formalization, and treatment plant construction) with its own resources.
However, the technical documentation submitted did not reach the level of development required for approval by AyA. With respect to the intake site, the plan was to use the existing intake known as "La Gata," a structure built by the ASADA without coordination with AyA; however, as stated in official memorandum DA-UHCAROG-0531-2025 of July 17, 2025, the Dirección de Aguas determined that said infrastructure falls within the boundaries of the Reserva Forestal Cordillera Volcánica Central, which, in compliance with the applicable regulations, made it necessary to identify a new intake site. For this reason, this stage incorporates the construction of a new intake. Given this situation, in order to proceed with Stages II and III, AyA and the ASADA reached agreements on their development through an action plan to be executed so as to ultimately deliver a definitive solution to supply potable water to the communities of Villanueva, part of Finca 4, and Dirección 02.'" (see reports of the respondent authorities).
III.On the contempt proceeding. In the present case, the petitioner alleges non-compliance with the order issued in ruling no. 2025013579 of 9:15 a.m. on May 9, 2025. He states that to date the authorities of the Instituto Costarricense de Acueductos y Alcantarillados and the Asociación Administradora del Acueducto de Horquetas de Sarapiquí have not complied with the order.
By ruling no. 2025013579, this Court ordered the following: "(…) so that: a) IMMEDIATELY, a remedial plan be executed to provide potable water service to the Río Frío de Horquetas community, in Sarapiquí de Heredia, while the project 'Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí' is completed; b) within a maximum period of TWELVE MONTHS, counted from the date of notification of this ruling, the project 'Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí' be completed, so as to supply potable water to the Río Frío de Horquetas community, in Sarapiquí de Heredia, in such a way that, once completed, potable water service be provided to the dwellings in the area that meet the requirements in accordance with the sub-constitutional legal framework, in an efficient, effective, and continuous manner." In this regard, the Board of Directors of the ASADA de Horquetas de Sarapiquí reported the following:
"It is important to highlight that the ASADA de Horquetas has maintained a permanent, active, and coordinated involvement with the institutions concerned, carrying out all actions within its technical, administrative, and financial competencies and capabilities, with the aim of promoting the development and execution of the project. It is important to inform this Honorable Court that the current Board of Directors of the ASADA de Horquetas assumed its duties in April of this year. Nevertheless, from the very outset of its administration it adopted, as one of its priorities, the continuity of the actions set out in the Remedial Plan, immediately following up on ongoing proceedings and reaffirming the institutional commitment to comply with the order issued by the Constitutional Chamber. The current Administration and Board of Directors remain fully prepared to continue carrying out all coordination, management, and collaboration actions within their competencies to contribute to achieving the established objectives.
However, it is respectfully requested that the institutional reality of the ASADA de Horquetas be taken into account, as it is a community organization with limited economic and financial capacity, whose ordinary revenues barely suffice to meet the operational, administrative, and maintenance needs required to ensure continuity of service to the users currently registered with the system. In light of the foregoing, while this ASADA has demonstrated a proactive and ongoing attitude in seeking solutions, it must be noted that the full execution of the Potable Water Supply Project for the communities of Río Frío requires investments that far exceed the financial capacity of this organization. It is therefore essential that institutions with the competency and financial capacity to develop this type of infrastructure participate and contribute budget resources — particularly the Instituto Costarricense de Acueductos y Alcantarillados (AyA) — as well as support from other public entities involved.
The ASADA de Horquetas reiterates its absolute willingness to continue managing, coordinating, and collaborating with all competent institutions so that this project may be carried out as quickly as possible, thereby guaranteeing the beneficiary communities permanent and safe access to potable water service — an objective that is of common interest to all parties involved. For the purpose of objectively demonstrating the actions taken and the state of progress of the commitments assumed, the main actions carried out by this ASADA are set forth below, with the corresponding documentary evidence attached. Such documents demonstrate the specific actions taken, the inter-institutional coordination carried out, and the sustained effort to advance the execution of the project 'Mejora y Ampliación del Sistema de Agua potable de la ASADA DE Horquetas hacia las comunidades de Río Frío de Sarapiquí' and to comply with the order issued by this Honorable Court.
Logistical support has been maintained during 2025 and 2026 for the supply of potable water to the communities of Río Frío through tanker trucks operated by AyA, enabling the filling of units and the supply of tanks installed at various points in the beneficiary communities. 4. Financing for the construction of a 1,000-cubic-meter storage tank in the community of Nazaret continues to be sought from the Instituto de Desarrollo Rural (INDER). To date, this process is approximately seventy-five percent (75%) complete. 5. Through official letter AH-175-2025, dated July 17, 2025, the ASADA sent to AyA the Comprehensive Report requested for the project assessment, incorporating the technical, social, environmental, legal, and financial components necessary to support its viability. B) COMPLETE THE DEFINITIVE IMPROVEMENT AND EXPANSION PROJECT WITHIN A MAXIMUM PERIOD OF TWELVE MONTHS. This Asociación Administradora del Sistema de Acueductos y Alcantarillados Comunales de Horquetas (ASADA Horquetas), in response to the hearing granted by this Honorable Constitutional Chamber, respectfully requests that the granting of an extension of thirty-six (36) additional months for the completion of the project entitled 'Mejora y Ampliación del Sistema de Agua Potable de la ASADA de Horquetas hacia las comunidades de Río Frío de Sarapiquí' be considered.
This request is based on objective circumstances beyond the control of this ASADA. As evidenced in this report, this organization has complied with the provisions issued by that Judicial Authority and has diligently carried out all actions within its sphere of competence, including administrative proceedings, inter-institutional coordination, acquisition of land and easements, logistical support to AyA, financing management with INDER, and ongoing collaboration for the temporary supply of potable water to the beneficiary communities. Nevertheless, the physical execution of the main works contemplated within the project cannot be concluded within the originally established timeframe, primarily due to the absence of the financial resources necessary for its development. It must be considered that the investment required for the full execution of the project absolutely exceeds the economic and financial capacity of this ASADA.
It is likewise important to note that this timeframe depends on the procurement of budget resources, the contracting of studies, designs, and infrastructure works, as well as the execution of essential project components — all of which depend on public institutions with competencies and financial capacities different from those of this community organization, particularly the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and other entities participating in the process. Consequently, the completion of the project does not depend exclusively on the actions of this ASADA. For the foregoing reasons, and given that there is a material and financial impossibility to complete the works within the originally established timeframe, this Association respectfully requests that this Honorable Court grant an extension of thirty-six (36) months for the execution and completion of the project — a period considered reasonable for its realization, provided that AyA supplies this ASADA with the budget and the required financing sources to carry out the pending technical and administrative processes and to execute the works necessary to guarantee a definitive potable water supply solution for the communities of Río Frío.
This request is made in good faith, reiterating the absolute commitment of the ASADA de Horquetas to continue promoting all necessary proceedings, coordinating with the competent institutions, and actively collaborating to achieve full compliance with the order of this Constitutional Chamber and to guarantee effective access to potable water for the beneficiary communities. The actions and efforts undertaken by the ASADA de Horquetas to comply with the Court's order are detailed below. The following specific actions have been completed: a) Acquisition of the property designated for the installation of a 1,000 m³ vitrified storage tank in Nazaret de Horquetas, including the relevant registration and cadastral documentation corresponding to registration folio 136063-000, cadastral map H-2290606-2021, for the installation of a 1,000 m³ vitrified tank for the conveyance of potable water from the Río Frío Project. b) Purchase and registration of a water right-of-way easement in Heredia, registration folio 280542, cadastral map number H-0049609-2025, for the installation of a conveyance pipeline. c) Registration of a public road in Heredia, Horquetas, registration folio 281110, cadastral map number H-0055834-2022, along which the conveyance pipeline will be installed. d) Approval of the construction of a 1,000 m³ tank, with financing from INDER, with works projected to begin between 2026 and 2027, approved by the Ministerio de Planificación Nacional y Política Económica MIDEPLAN on March 10, 2026, under code 004365, at a cost of 509.585.184,20 colones. e) Coordination with the Municipalidad de Sarapiquí, the Asociación de Desarrollo Integral de Finca San José y Chirripó, the company DOLE, and the Oficina Regional de Acueductos Comunales del AyA (ORAC Huetar Norte AYA), to analyze the technical and financial requirements for evaluating the use of the wells currently owned by the company DOLE as a supplementary source for the potable water supply. f) Joint participation with AyA in the work to relocate the geographic and topographic reference points of the water intake on the Río Santa Clara, known as 'La Gata.' g) Coordination with Deputy Marta Esquivel Rodríguez to promote inter-institutional actions among the company DOLE, the Municipalidad de Sarapiquí, AyA, and the Asociación de Desarrollo Integral de Finca San José y Chirripó, aimed at using the existing drilled wells to strengthen the future water supply for the project. h) Ongoing maintenance of the physical space made available to AyA for operational and logistical work related to project execution. i) Continued support for the supply of potable water by tanker trucks to the communities of Río Frío. j) Currently coordinating with AyA on defining the terms of reference for the procurement of professional services for the basic studies and designs of the water intake works on the Río Santa Clara and the design of the conveyance pipeline from the intake site to where the drinking water treatment plant will be constructed.
AyA delivered the terms of reference documentation via the email of Engineer Francisco González Fallas on June 8, 2026. ACTIONS CURRENTLY UNDERWAY. The nature and scale of the project require the participation and coordination of various public institutions; accordingly, there are activities whose execution is ongoing and that depend on technical, financial, and administrative processes outside the direct competencies of this ASADA. In this regard, the following actions remain in progress: 1. Construction of the 1,000 m³ storage tank financed by INDER, with execution scheduled for the 2026–2027 period. 2. Coordination and follow-up with Asamblea Legislativa authorities to promote the institutional actions necessary for the project to advance. 3. Continued supply of potable water by AyA tanker trucks to ensure the immediate needs of the communities of Río Frío are met while the permanent works are carried out.
The ASADA de Horquetas has demonstrated diligent, consistent, and committed conduct in complying with the actions set out in the Remedial Plan, carrying out all proceedings within its sphere of competence and actively collaborating with the institutions responsible for executing the various stages of the project. It is likewise relevant to note that, despite its budgetary limitations and its nature as a non-profit community organization, the ASADA de Horquetas has made a significant financial effort in support of the Potable Water Supply Project for Río Frío, allocating resources exceeding five hundred million colones (¢500,000,000) to the acquisition of land, easements, technical proceedings, administrative formalities, and other actions necessary to promote its development. This demonstrates the institutional commitment and unequivocal willingness of this ASADA to actively contribute to the definitive solution to the potable water supply needs of the beneficiary communities, even though the total investment required considerably exceeds its financial capacity.
Similarly, coordination of efforts will continue with the Instituto Costarricense de Acueductos y Alcantarillados (AyA), the Municipalidad de Sarapiquí, the Instituto de Desarrollo Rural (INDER), Asamblea Legislativa authorities, the Asociación de Desarrollo Integral de Finca San José y Chirripó, and the other actors involved, with the aim of achieving the successful completion of the potable water supply project for the communities of Río Frío. It must, however, be respectfully noted that the full implementation of the planned works requires financing, planning, and execution of investments that fall primarily to AyA — the institution responsible for essential components of the project's completion. For the foregoing reasons, this Association reiterates before this Honorable Court its absolute willingness to continue collaborating and carrying out all actions necessary to guarantee the beneficiary communities' access to potable water.
It is likewise important to note that the ASADA de Horquetas has at all times complied with and attended to the provisions contained in the ruling issued by that Judicial Authority, acting in good faith and in strict observance of the principle of legality. In compliance with the order of the Constitutional Chamber, this organization has carried out the actions within its sphere of competence and has maintained a proactive attitude of coordination and collaboration with the institutions involved, demonstrating its firm willingness to fulfill its commitments and to contribute to the effective enforcement of the judgment issued. This ASADA has immediately and continuously complied with the provisions contained in the ruling issued by this Honorable Constitutional Chamber, acting in strict accordance with the court order. In compliance with the mandate to execute a remedial plan to guarantee the potable water supply to the community of Río Frío while the definitive solution is being developed, the actions described in this report have been carried out on an ongoing basis, including inter-institutional coordination, the provision of logistical resources, financing management, and support for the temporary supply of potable water by tanker trucks.
Likewise, all proceedings within this ASADA's sphere of competence have been promoted to contribute to the advancement of the improvement and expansion project for the water supply system. Notwithstanding, it is respectfully submitted to this Court that the full execution and completion of said project necessarily depends on the joint participation of various public institutions and on the allocation of financial resources that significantly exceed the economic capacity of this community organization. The ASADA de Horquetas is a local entity whose ordinary revenues are directed primarily toward the operation, maintenance, and sustainability of the service it currently provides to its subscribers; it therefore lacks the financial capacity to single-handedly assume such a large investment. Despite this, this Association maintains its full willingness to continue managing, coordinating, and collaborating with the Instituto Costarricense de Acueductos y Alcantarillados (AyA), INDER, the Municipalidad de Sarapiquí, and the other institutions involved, with the firm purpose of obtaining the necessary resources and completing the works required to supply potable water to the communities of Río Frío as quickly as possible." On its part, the General Manager of the Instituto Costarricense de Acueductos y Alcantarillados reported to this Court the following:
Regarding the matter ordered under point a) concerning the remedial plan (plan remedial) to provide potable water service to the community of Río Frío de Horquetas, in Sarapiquí de Heredia, this General Management submitted a compliance report in a written brief dated May 21, 2025, along with the corresponding supporting evidence, all of which appears in the case file of the present constitutional protection appeal (recurso de amparo) (see Exhibit 01). It should be noted that the written submission initiating the contempt proceeding (gestión de desacato) makes no reference to any failure to comply in this regard; accordingly, this Institute has ensured compliance with the ruling with respect to the rights of access to potable water, health, and life. Nevertheless, for the information of the Honorable Constitutional Chamber (Sala Constitucional), memorandum GSD-UEN-GAR-2026-02486 dated June 5, 2026, and its annexes are attached (see Exhibit 02), which reports the following: "(…) In accordance with information provided by Licda. Katherine Pérez Fernández of the Equipment and Machinery Directorate, via email dated June 4, 2026 (attached), the following has been established: • The potable water distribution service by water tanker truck (camión cisterna) remains active as a remedial measure to address the water shortage situation. • The communities covered by the service are Río Frío, Semillero, Finca 4 (Industrial), Villanueva, San Luis, and San Isidro. • Said service has been formalized through Service Order No. CIS-ALQ-2026-1230 (attached), valid from April 1 through July 31, 2026, with the possibility of extension while the permanent solution is being implemented. • The supply service is provided continuously seven days a week, thereby guaranteeing regular access to potable water for this population. • The referenced Service Order defines the operational route of the water tanker truck, beginning at 6:00 a.m. at the loading point located at the ASADA de Horquetas de Sarapiquí, and continuing thereafter with water distribution to the affected communities.
Said service responds to an identified condition of water shortage due to lack of infrastructure in the affected communities, which justifies the adoption of this emergency measure. In that regard, the institutional action is aligned with what was ordered by the Constitutional Chamber, by guaranteeing effective access to water resources while the necessary projects for a permanent solution to the problem are being developed." With respect to the project "Improvement and Expansion of the Potable Water System of the ASADA de Horquetas toward the communities of Río Frío de Sarapiquí," report number GSD-UEN-AP-2026-0668 dated June 8, 2026, and its annexes are attached (see Exhibit 03), which explains that this initiative began in 2021 and the current state of progress is set forth below:
Regarding Stage I (installation of transmission lines (líneas de conducción), distribution networks, construction of river crossings, and complementary works), the report states: "(…) As for the execution of Stage I, the works are 100% complete and pressure testing (pruebas de presión) of the distribution pipeline is currently underway as the final activity, with completion scheduled for June of this year; the investment made for this stage amounts to ¢937,036,960.55, of which ¢608,486,537.75 corresponds to investment through works performed through direct administration (obras por administración) and ¢328,550,422.80 for contracted works (obras por contrato). During this stage, certain difficulties arose that required AyA to redesign its activity plan and to seek financing to cover activities not originally contemplated. These include activities that initially constituted a commitment of the ASADA and that could not be carried out as agreed, such as the installation of pipeline at the Dirección01 crossings, the construction of five elevated crossings, the thermofusion (termofusión) and installation of polyethylene pipe at said crossings, and the planned system interconnections.
Likewise, the limited water supply capacity currently presented by the Horquetas aqueduct has made it difficult to carry out pressure testing on the entirety of the installed pipeline. Despite the difficulties noted, the completion of this stage is in its final phase; however, it is essential to complete Stages II and III in order to put the new potable water system into operation for the communities of Finca 6, Finca 4, Villa Nueva, and Semillero (…)." Regarding Stage II (intake at the Santa Clara River, transmission line, construction of the potable water treatment plant (planta de tratamiento de agua potable, PTAP) and storage tank adjacent to the PTAP) and Stage III (construction of the 1,000 m³ storage tank in the Nazareth sector), the report states: "(…) there was a commitment for these stages to be developed by the ASADA de Horquetas de Sarapiquí, which was managing the technical design of Stage II (intake, transmission line, land formalization, and construction of the treatment plant) with its own resources.
However, the technical documentation submitted did not reach the level of development required for approval by AyA. Regarding the intake site, it was originally planned to utilize the existing intake known as 'La Gata,' a structure built by the ASADA without coordination with AyA; however, as stated in official communication DA-UHCAROG-0531-2025 of July 17, 2025, the Water Resources Directorate (Dirección de Aguas) determined that said infrastructure falls within the boundaries of the Reserva Forestal Cordillera Volcánica Central, which, in compliance with applicable regulations, made it necessary to identify a new intake site. For this reason, this stage incorporates the construction of a new intake. Given this situation, in order to proceed with Stages II and III, AyA and the ASADA reached agreements for their development through an action plan to be executed and ultimately provide a permanent solution for supplying potable water to the communities of Villanueva, a portion of Finca 4, and Finca 6." The details of the referenced action plan and the current status of the procurement process for the design of the potable water treatment plant are set out in report number GSD-UEN-AP-2026-0668 dated June 8, 2026, and its annexes (see Exhibit 03), which concludes as follows: "(….) 2.
Stage II, which contemplates the construction of the PTAP, the intake on the Santa Clara River, and the storage tank adjacent to the PTAP, represents the critical path (ruta crítica) of the project and cannot be completed in less than two and a half years (end of 2028), given the technical and financial complexity of its works. 3) The procurement process for the design of the PTAP and storage tank is underway, with documentation uploaded to SICOP and bidding specifications (pliego de condiciones) being prepared, with the start of design projected for October 2026. 4) Stage III has a financing management request before INDER made by the ASADA, as well as the institutional endorsement of AyA, factors that support its viability to reinforce the current system while Stage II is being executed." From the foregoing and the supporting evidence submitted, it is evident that the Improvement and Expansion of the Potable Water System of the ASADA de Horquetas toward the communities of Río Frío de Sarapiquí is a large-scale project not only at the technical level but also at the financial level, and therefore the 12-month deadline initially ordered by the Constitutional Chamber has proven insufficient.
As extracted from report number GSD-UEN-AP-2026-0668 dated June 8, 2026, and its annexes (see Exhibit 03), this Institute has faced a series of difficulties and delays that were beyond its control; however, as the governing body (ente rector) it has continued to advance together with the ASADA de Horquetas and a clear roadmap exists that will enable the supply of potable water to the communities of Finca 6, Finca 4, Villa Nueva, and Semillero. It is reiterated that, since May 2025 and to date, AyA continues to provide the potable water supply service by tanker truck while progress continues toward the permanent solution for said communities.
In light of the foregoing, while it is established that the authorities of the Instituto Costarricense de Acueductos y Alcantarillados (AyA), as well as those of the Asociación Administradora del Acueducto de Horquetas de Sarapiquí, have taken steps with the aim of achieving compliance; the fact of the matter is that the record does not show that, as of this date, full compliance has been achieved with what was ordered by this Chamber in ruling no. 2025013579.
Consequently, the respondent authorities are hereby reiterated to comply with the provisions ordered by this Chamber in sentence no. 2025013579 of 9:15 hours of May 9, 2025.
IV.Regarding the request for an extension of the deadline of sentence no. 2025013579 of 9:15 hours of May 9, 2025. The Board of Directors (Junta Directiva) of the Acueducto de Horquetas de Sarapiquí requests that this Chamber extend the deadline of sentence no. 2025013579 by an additional 36 months for the completion of the project entitled "Improvement and Expansion of the Potable Water System of the ASADA de Horquetas toward the communities of Río Frío de Sarapiquí."
In this regard, this Chamber considers it established that the authorities of the ASADA de Horquetas de Sarapiquí have indeed taken a series of actions aimed at complying with what was ordered in sentence no. 2025013579. In that sense, this constitutional body understands the efforts made as well as the difficulties encountered, but the request submitted to extend the deadline by up to 36 additional months is manifestly disproportionate (it would imply an additional extension of 3 years beyond the deadline granted, which expired on May 13, 2025). It should also be noted that the respondent ASADA presents this request 12 days after the deadline granted by this Tribunal had elapsed.
In light of the foregoing, the extension of the granted deadline is not deemed appropriate.
V.Documentation submitted to the case file. The parties are advised that should they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session No. 27-11 of August 22, 2011, Article XXVI, and published in the Judicial Gazette (Boletín Judicial) No. 19 of January 26, 2012, as well as pursuant to the agreement approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session No. 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The disobedience proceeding (gestión de desobediencia) is granted. Jose Darío Guzmán Álvarez, in his capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, as well as Ana María Palacios Gallado, in her capacity as President of the Board of Directors of the Acueducto de Horquetas de Sarapiquí, or whoever holds said positions, are hereby reiterated to proceed to comply with the provisions ordered by this Chamber in sentence no. 2025013579 of 9:15 hours of May 9, 2025, in the sense that the project "Improvement and Expansion of the Potable Water System of the ASADA de Horquetas toward the communities of Río Frío de Sarapiquí" be completed, so as to provide potable water to the community of Río Frío de Horquetas, in Sarapiquí de Heredia, such that once completed, the potable water service is provided to the dwellings in the area that meet the requirements in accordance with infra-constitutional law (ordenamiento infraconstitucional), in an efficient, effective, and continuous manner.
The foregoing is issued under the warning that, should disobedience be established, it may be ordered that certified copies of portions of the record be referred to the Ministerio Público for the possible commission of the offense of disobedience (Articles 53 and 71 of the Law on Constitutional Jurisdiction). As for the request for an extension of the deadline, the motion is declared without merit. Personal notification is ordered to Jose Darío Guzmán Álvarez, in his capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, as well as to Ana María Palacios Gallado, in her capacity as President of the Board of Directors of the Acueducto de Horquetas de Sarapiquí, or whoever holds said positions.- Fernando Castillo V.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .
Gestión de desobediencia presentada por Nombre01, cédula de identidad no. CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLOS y la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE HORQUETAS DE SARAPIQUÍ.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto. El recurrente acusa la desobediencia de lo ordenado en la sentencia no. 2025013579 de las 9:15 horas del 9 de mayo de 2025. Señala que a la fecha las autoridades del Instituto Costarricense de Acueductos y Alcantarillados y de la Asociación Administradora del Acueducto de Horquetas de Sarapiquí, no han cumplido con lo ordenado.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Se advierte a las recurridas, o a quienes ocupen sus cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados, y a la ASADA de Horquetas de Sarapiquí al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. Notifíquese” (los autos).
Durante esta etapa se presentaron algunos inconvenientes que obligaron a AyA al replanteamiento de actividades y a la búsqueda de financiamiento para cubrir actividades no contempladas originalmente. Entre estos, destacan actividades que inicialmente constituían un compromiso de la ASADA y que no pudieron concretarse según lo acordado, tales como la instalación de tubería en los cruces de la Dirección01, la construcción de cinco pasos elevados, la termofusión e instalación de tubería de polietileno en dichos pasos, y las interconexiones en el sistema y previstas. Asimismo, la limitada capacidad hídrica que presenta actualmente el acueducto de Horquetas ha dificultado llevar a cabo las pruebas de presión en la totalidad de la tubería instalada. Pese a las dificultades señaladas, la conclusión de esta etapa se encuentra en su fase final; no obstante, es indispensable completar las etapas II y III para la puesta en operación del nuevo sistema de agua potable para las comunidades de Finca 6, Finca 4, Villa Nueva y Semillero (…).”.
Con respecto a la Etapa II (captación de la toma sobre el río Santa Clara, línea de conducción, construcción de la planta de tratamiento de agua potable (PTAP) y tanque de almacenamiento junto a la PTAP) y la Etapa III (construcción del tanque de almacenamiento de 1000 m3 en el sector de Nazareth), refiere el informe que: “(…) existía un compromiso para que fueran desarrolladas por la ASADA de Horquetas de Sarapiquí, la cual gestionaba con recursos propios el diseño técnico de la etapa II (captación, línea de conducción, formalización de terrenos y construcción de la planta de tratamiento). Sin embargo, la documentación técnica presentada no alcanzó el nivel de desarrollo requerido para su aprobación por parte de AyA. Respecto al sitio de captación, se contemplaba aprovechar la toma existente conocida como “La Gata”, obra ejecutada por la ASADA sin coordinación con AyA; no obstante, según lo indicado en el oficio DA-UHCAROG-0531-2025 17 de julio del 2025, la Dirección de Aguas determinó que dicha infraestructura se encuentra dentro delos límites de la Reserva Forestal Cordillera Volcánica Central, lo que, en cumplimiento de la normativa aplicable, hizo necesario identificar un nuevo sitio de captación.
Por este motivo, esta etapa incorpora la construcción de una nueva toma. Dada esta situación, para poder continuar con las etapas II y III, el AyA en conjunto con la ASADA llegaron a acuerdos para su desarrollo a través de un plan de acción para ser ejecutado y finalmente dar una solución definitiva para abastecer de agua potable a las comunidades de Villanueva, una parte de Finca 4 y Dirección02” (ver informes de las autoridades recurridas).
III.Sobre la gestión de desobediencia. En el presente asunto, el recurrente acusa la desobediencia de lo ordenado en la sentencia no. 2025013579 de las 9:15 horas del 9 de mayo de 2025. Señala que a la fecha las autoridades del Instituto Costarricense de Acueductos y Alcantarillados y de la Asociación Administradora del Acueducto de Horquetas de Sarapiquí, no han cumplido con lo ordenado.
Esta Sala mediante la sentencia no. 2025013579, dispuso lo siguiente: “(…) para que: a) DE INMEDIATO se ejecute un plan remedial para brindar el servicio de agua potable en la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, en el tanto se finaliza el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”; b) dentro del plazo máximo de DOCE MESES, contado a partir de la notificación de esta sentencia, se finalice el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”, que permita dotar de agua potable a la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, de manera que una vez finalizado este, se brinde el servicio de agua potable a las viviendas de la zona que cumplan los requisitos de conformidad con el ordenamiento infraconstitucional, de forma eficiente, eficaz y continua”.
Al respecto, la Junta Directiva del Acueducto de Horquetas de Sarapiquí, informaron lo siguiente:
“Resulta importante destacar que la ASADA de Horquetas ha mantenido una participacion permanente. activa y coordmada con las instituciones involucradas, realizando todas aquellas gestiones que se encuentran dentro de sus competencias y posibilidades técnicas, admmistrativas y financieras, con el proposito de impulsar el desarrollo y ejecucion del proyecto. Es importante hacer del conocimiento de esa Honorable Sala que la actual Junta Directiva de la ASADA de Horquetas asumio funciones en el mes de abril del presente año. No obstante, desde el inicio de su gestión adoptó como una de sus prioridades la continuidad de las acciones contempladas en el Plan Remedial, dando seguimiento inmediato a las gestiones en curso y reafirmando el compromiso institucional con el cumplimiento de lo ordenado por la Sala Constitucional. La actual Admimstración y Junta Directiva mantienen plena disposición de continuar realizando todas las acciones de coordinacion, gestión y colaboración que se encuentren dentro de sus competencias para contribuir al cumplimiento de los objetivos establecidos.
Sin embargo, respetuosamente se solicita considerar la realidad institucional de la ASADA de Horquetas, la cual corresponde a una organización comunal de limitada capacidad económica y financiera, cuyos ingresos ordinarios apenas permiten atender las necesidades operativas, administrativas y de mantenimiento requeridas para garantizar la continuidad del servicio a los usuarios actualmente adscritos al sistema. En virtud de lo anterior, si bien esta ASADA ha demostrado una actitud proactiva y permanente en la busqueda de soluciones, debe sehalarse que la ejecución integral del Proyecto de Abastecimiento de Agua Potable para las comunidades de Río Frío requiere inversiones que superan ampliamente la capacidad financiera de esta organización. Por ello, resulta indispensable la participación y el aporte presupuestario de instituciones con competencia y capacidad financiera para desarrollar este tipo de infraestructura, particularmente el Instituto Costarricense de Acueductos y Alcantarillados (AyA), así como el apoyo de otras entidades públicas involucradas.
La ASADA de Horquetas reitera su absoluta voluntad de continuar gestionando, coordinando y colaborando con todas las instituciones competentes para que este proyecto pueda concretarse en el menor tiempo posible y así garantizar a las comunidades beneficiarias el acceso permanente y seguro al servicio de agua potable, objetivo que constituye un interes común de todas las partes involucradas. Con el proposito de acreditar objetivamente las gestiones efectuadas y el estado de avance de los compromisos asumidos, se procede a enumerar las principales acciones desarrolladas por esta ASADA, adjuntandose como respaldo las evidencias documentales correspondientes. Tales documentos demuestran las actuaciones concretas realizadas, las coordinaciones interinstitucionales efectuadas y el esfuerzo continue desplegado para avanzar en la ejecucion del proyecto Mejora y Ampliación del sistema de Agua potable de la ASADA DE Horquetas hacia las comunidades de Río Frío de Sarapiquí y en el cumplimiento de lo dispuesto por esa Honorable Sala.
Se ha mantenido el apoyo logístico durante los ahos 2025 y 2026. para el suministro de agua potable a las comunidades de Río Frío mediante los camiones cisterna operados por el AyA, permitiendo la carga de las umdades y el abastecimiento de las tanquetas instaladas en distintos sectores de las comunidades beneficiarias. 4. Se continúa gestionando ante el Instituto de Desarrollo Rural (INDER) el financiamiento requerido para la construcción de un tanque de almacenamiento de 1.000 metros cubicos en la comunidad de Nazaret. A la fecha, dicha gestión presenta un avance aproximado del setenta y cinco por ciento (75%). 5. Mediante oficio AH-175-2025. de fecha 17 de julio de 2025, la ASADA remitib al AyA el Informe Integral solicitado para la valoración del proyecto incorporando los componentes técnicos, sociales, ambientales, legales financieros necesarios para sustentar su viabilidad. B) FINALIZAR EL PROYECTO DEFINITIVO DE MEJORA Y AMPLIACIÓN EN UN PLAZO MÁXIMO DE DOCE MESES.
Respetuosamente, esta Asociación Administradora del Sistema de Acueductos y Alcantarillados Comunales de Horquetas (ASADA Horquetas), en atención a la audiencia conferida por esa Honorable Sala Constitucional, solicita se valore la concesión de una ampliación del plazo por treinta y seis (36) meses adicionales para la conclusion del proyecto denominado “Mejora y Ampliacidn del Sistema de Agua Potable de la ASADA de Horquetas hacia las comunidades de Río Frío de Sarapiquí”. La presente solicitud se fundamenta en circunstancias objetivas y ajenas a la voluntad de esta ASADA. Tal y como se acredita en el presente informe, esta organización ha acatado las disposiciones emitidas por esa Autoridad Judicial y ha ejecutado de manera diligente todas las acciones que se encuentran dentro de su ámbito de competencia, incluyendo gestiones administrativas, coordinaciones interinstitucionales, adquisición de terrenos y servidumbres, apoyo logistico al AyA, gestión de financiamiento ante el INDER y colaboración permanente para el abastecimiento temporal de agua potable a las comunidades beneficiarias.
No obstante, la ejecución material de las obras principales contempladas dentro del proyecto concluirse dentro del plazo originalmente establecido, debido principalmente a la ausencia de los recursos financieros necesarios para su desarrollo. Debe considerarse que la inversión requerida para la ejecución integral del proyecto excede de manera absoluta la capacidad económica y financiera de esta ASADA. Asimismo, resulta importante señalar este plazo depende de la obtencion de los recursos presupuestarios, la contratación de estudios, diseños y obras de infraestructura, así como la ejecución de componentes esenciales del proyecto, dependen de instituciones públicas con competencias y capacidades financieras distintas a las de esta organización comunal, particularmente del Instituto Costarricense de Acueductos y Alcantarillados (AyA) y de otras entidades que participan en el proceso. En consecuencia, la conclusión del proyecto no depende exclusivamente de las actuaciones de esta ASADA.
Por lo anterior, y considerando que existe una imposibilidad material y financiera para finalizar las obras dentro del plazo originalmente dispuesto, se solicita respetuosamente a esa Honorable Sala que se conceda una ampliación de treinta y seis (36) meses para la ejecución y finalización del proyecto, plazo que se estima razonable para concretar siempre y cuando el AYA, brinde el presupuesta a esta ASADA, las fuentes de financiamiento requeridas, para desarrollar los procesos técnicos y admmistrativos pendientes y ejecutar las obras necesanas para garantizar una solución defmitiva de abastecimiento de agua potable para las comumdades de Río Frío. Esta solicitud se formula de buena fe. reiterando el absolute compromise de la ASADA de Horquetas de continuar impulsando todas las gestiones necesarias, coordinando con las instituciones competentes y colaborando activamente para alcanzar el cumplimiento integral de lo ordenado por esa Sala Constitucional y garantizar el acceso efectivo al agua potable de las comunidades beneficiarias.
Se procede a detallar las acciones y esfuerzos realizados por ASADA de Horquetas para cumplir con el ordenamiento de la sala. Se han concretado las siguientes gestiones especificas: a) Adquisición de la propiedad destinada a la mstalacion del tanque vitnficado de almacenamiento de 1.000 m3 en Nazaret de Horquetas, incluyendo la documentacion registral y catastral correspondiente al folio 136063-000, piano H-2290606-2021, para la instalacion de un tanque de 1000M3 vitnficado para envio de agua potable del Proyecto Río Frío. b) Compra e inscripcion de servidumbre de Paso de Agua de Heredia folio 280542, piano numero H-0049609-2025. para la instalacion de tuberia de conducción. c) Inscripción de calle pública de Heredia. Horquetas folio 281110, piano número H-0055834-2022, por donde se instalara tubería de conducción. d) Aprobación de construcción Tanque de 1000M3, con financiamiento del INDER, obras proyectadas para iniciar entre el 2026 y 2027. aprobado por el Ministerio de Planificación Nacional y Política Económica MIDEPLAN el 10 de marzo 2026 con el código 004365, con un costo de 509.585.184,20 colones. e) Coordinación con la Municipalidad de Sarapiquí, la Asociacion de Desarrollo Integral de Finca San José y Chirripó. la empresa DOLE y la Oficina Regional de Acueductos Comunales del AyA (ORAC Huetar Norte AYA), para analizar los requerimientos tecnicos y financieros que permitan valorar el aprovechamiento de los pozos actualmente existentes en propiedad de la empresa DOLE como fuente complementaria para el summistro de agua potable. f) Participación conjunta con el AyA en los trabajos de reubicación de los puntos geográficos y topograficos de la toma ubicada en el rio Santa Clara, conocida como “La Gata”. g) Coordinación con la señora diputada Marta Esquivel Rodríguez para impulsar acciones interinstitucionales entre la empresa DOLE, la Municipalidad de Sarapiquí, el AyA y la Asociacion de Desarrollo Integral de Finca San Jose y Chirripó, orientadas a la utilización de los pozos perforados existentes para fortalecer el abastecimiento futuro del proyecto. h) Mantenimiento permanente del espacio físico facilitado al AyA para labores operativas y logísticas relacionadas con la ejecución del proyecto. i) Continuidad en el apoyo para el abastecimiento de agua potable mediante camiones cisterna a las comunidades de Río Frío. j) Actualmente se coordma con el AYA en la defimcibn para los términos de referenda para la contratación de servicios profesionales para los estudios básicos y diseños de la obra de la Toma en el río Santa Clara y diseño de la línea de conducción desde el sitio de captación hasta donde se construira la planta de tratamiento de agua potable.
El AYA entrega la documentación de los términos de referencia mediante el correo electronico del Ing. Francisco González Fallas el 8/6/2026. ACCIONES QUE SE ENCUENTRAN EN DESARROLLO. La naturaleza y magnitud del proyecto requieren la participación y coordinación de diversas instituciones públicas, por lo que existen actividades cuya ejecución continua en curso y dependen de procesos técnicos, financieros y admistrativos externos a las competencias directas de esta ASADA. En ese sentido, permanecen en proceso las siguientes acciones: 1. Construcción del tanque de almacenamiento de 1.000 m3 financiado por el INDER, cuya ejecución se encuentra programada para el periodo 2026-2027. 2. Coordinación y seguimiento con autoridades de la Asamblea Legislativa para el impulso de las acciones institucionales necesarias que permitan avanzar en la materializacion del proyecto. 3. Continuidad del suministro de agua potable mediante camiones cisterna del AyA para garantizar la atención inmediata de las comunidades de Río Frío mientras se ejecutan las obras definitivas.
La ASADA de Horquetas ha demostrado una actuación diligente, constante y comprometida con el cumplimiento de las acciones contempladas en el Plan Remedial, ejecutando todas aquellas gestiones que se encuentran dentro de su ámbito de competencia y colaborando activamente con las instituciones responsables de la ejecución de las distintas etapas del proyecto. Asimismo, resulta relevante senalar que. pese a sus limitaciones presupuestarias y a su naturaleza de orgamzación comunal sin fines de lucro. la ASADA de Horquetas ha realizado un importante esfuerzo financiero en favor del Proyecto de Abastecimiento de Agua Potable para Río Frío, destinando recursos que superan los quinientos millones de colones (¢ 500.000.000) en la adquisición de terrenos, servidumbres, gestiones técnicas, trámites administrativos y demas acciones necesarias para impulsar su desarrollo. Lo anterior evidencia el compromiso institucional y la voluntad inequivoca de esta ASADA de contribuir activamente a la solución definitiva de las necesidades de abastecimiento de agua potable de las comunidades beneficiarias, aun cuando la magnitud total de la inversión requerida excede considerablemente su capacidad financiera.
Asimismo, se continuará coordinando esfuerzos con el Instituto Costarricense de Acueductos y Alcantarillados (AyA), la Municipalidad de Sarapiquí, el Instituto de Desarrollo Rural (INDER), autoridades de la Asamblea Legislativa, la Asociación de Desarrollo Integral de Finca San José y Chirripó y demás actores involucrados, con el objetivo de alcanzar la conclusion satisfactoria del proyecto de abastecimiento de agua potable para las comumdades de Río Frío. No obstante, debe señalarse respetuosamente que la matenalizacion integral de las obras proyectadas requiere del financiamiento, planificación y ejecución de inversiones que corresponden principalmente al AyA, institución que tiene a su cargo componentes esenciales para la culminación del proyecto. Por lo anterior, esta Asociación reitera ante esa Honorable Sala su absoluta disposición de continuar colaborando y ejecutando todas las acciones que resulten necesarias para garantizar el acceso al agua potable de las comunidades beneficiarias.
Asimismo, resulta importante señalar que la ASADA de Horquetas ha acatado y atendido en todo momento las disposiciones contenidas en la resolución emitida por esa Autoridad Judicial, actuando de buena fe y con estricto respeto al prmcipio de legalidad. En observancia de lo ordenado por la Sala Constitucional, esta organización ha ejecutado las acciones que se encuentran dentro de su ámbito de competencia y ha mantenido una actitud proactiva de coordinación y colaboración con las instituciones involucradas, evidenciando su firme voluntad de cumplir con los compromisos adquiridos y contribuir al cumplimiento efectivo de la sentencia dictada. Esta ASADA ha acatado de manera inmediata y permanente las disposiciones contenidas en la sentencia emitida por esa Honorable Sala Constitucional, actuando en estricto apego a lo ordenado por la autoridad judicial. En cumplimiento del mandato de ejecutar un plan remedial para garantizar el abastecimiento de agua potable a la comunidad de Río Frío mientras se desarrolla la solucion definitiva, se han realizado de forma contínua las acciones descritas en el presente informe, incluyendo la coordinación interinstitucional, la facilitacion de recursos logísticos, la gestion de financiamiento y el apoyo al suministro temporal de agua potable mediante camiones cisterna.
Asimismo, se han impulsado todas las gestiones que se encuentran dentro del ámbito de competencia de esta ASADA para contribuir al avance del proyecto de mejora y ampliación del sistema de abastecimiento. No obstante, respetuosamente se hace ver a esa Sala que la ejecución integral y conclusión de dicho proyecto depende necesariamente de la participación conjunta de diversas instituciones públicas y de la asignación de recursos financieros que exceden significativamente la capacidad económica de esta organización comunal. La ASADA de Horquetas es una entidad de caracter local cuyos ingresos ordinarios se destinan principalmente a la operación. Mantenimiento y sostenibilidad del servicio que actualmente presta a sus abonados, por lo que carece de la capacidad financiera para asumir por si sola una inversión tan grande. Pese a ello, esta Asociación mantiene su total disposición de continuar gestionando, coordmando y colaborando con el Instituto Costarricense de Acueductos y Alcantarillados (AyA), el INDER, la Municipalidad de Sarapiquí y las demás instituciones involucradas, con el firme propósito de que se obtengan los recursos necesarios y se concreten las obras requeridas para dotar de agua potable a las comumdades de Río Frío en el menor plazo posible”.
Por su parte, el Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, informó a esta Sala lo siguiente:
“En relación con lo ordenado en el punto a) referente al plan remedial para brindar el servicio de agua potable en la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, esta Gerencia General rindió informe de cumplimiento en escrito de fecha 21 de mayo de 2025 y sus respectivas pruebas, todo lo cual consta en el expediente del presente recurso de amparo (ver prueba 01). Nótese que, en el escrito de interposición de la gestión de desacato, no se alude ningún tipo de incumplimiento al respecto y por ende, este Instituto ha velado por el cumplimiento de la sentencia respecto de los derechos al acceso al agua potable, a la salud y a la vida. No obstante, para conocimiento de la Honorable Sala Constitucional, se aporta el memorando GSD-UEN-GAR-2026-02486 de fecha 05 de junio de 2026 y sus anexos (ver prueba 02), en el cual se informa que: “(…) De acuerdo con la información suministrada por la Licda. Katherine Pérez Fernández de la Dirección de Equipo y Maquinaria, mediante correo electrónico de fecha 04 de junio del 2026 (adjunto), se tiene acreditado lo siguiente: • Se mantiene activo el servicio de distribución de agua potable mediante camión cisterna, como medida remedial para atender la situación de desabastecimiento. • Las comunidades cubiertas por el servicio son Río Frío, Semillero, Finca 4 (Industrial), Villanueva, San Luis y San Isidro. • Dicho servicio se encuentra formalizado mediante la Orden de Servicio N.º CIS-ALQ-2026-1230 (adjunta), con vigencia del 01 de abril al 31 de julio de 2026 y con la posibilidad de prorrogarse mientras se implementa la solución definitiva. • El abastecimiento se realiza de forma continua los siete días de la semana, lo cual garantiza regularidad en el acceso al agua potable a esta población. • Mediante la citada Orden de Servicio se define la ruta operativa del camión cisterna, iniciando a las 6:00 a.m. en el punto de carga ubicado en ASADA de Horquetas de Sarapiquí, para continuar posteriormente con el reparto de agua en las comunidades afectadas.
Dicho servicio responde propiamente a una condición identificada de desabastecimiento por falta de infraestructura en las comunidades afectadas, lo cual justifica la adopción de esta medida emergente. En ese sentido, la actuación institucional se alinea con lo ordenado por la Sala Constitucional, al garantizar el acceso efectivo al recurso hídrico mientras se desarrollan los proyectos necesarios para dar solución definitiva al problema”. Con respecto al proyecto de “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”, se adjunta el informe número GSD-UEN-AP-2026-0668 de fecha 08 de junio del 2026 y sus anexos (ver prueba
En virtud de lo anterior, si bien consta que las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, como de la Asociación Administradora del Acueducto de Horquetas de Sarapiquí, han realizado gestiones con el fin de dar cumplimiento; lo cierto del caso es que, de los autos no consta que, a la fecha se haya cumplido de forma íntegra con lo ordenado por esta Sala en el voto no. 2025013579.
En consecuencia, se procede a reiterarler a las autoridades recurridas dar cumplimiento de lo dispuesto por esta Sala en la sentencia no. 2025013579 de las 9:15 horas del 9 de mayo de 2025.
IV.Sobre la solicitud de ampliación del plazo de la sentencia no. 2025013579 de las 9:15 horas del 9 de mayo de 2025. La Junta Directiva del Acueducto de Horquetas de Sarapiquí, solicita a esta Sala se amplíe el plazo de la sentencia no. 2025013579 por 36 meses adicionales para la conclusión del proyecto denominado “Mejora y Ampliación del Sistema de Agua Potable de la ASADA de Horquetas hacia las comunidades de Río Frío de Sarapiquí”.
Al respecto, esta Sala tiene por demostrado que las autoridades de la ASADA de Horquetas de Sarapiquí ciertamente han realizado una serie de acciones tendentes a dar cumplimiento a lo ordenado en la sentencia no. 2025013579. En ese sentido, este órgano constitucional comprende los esfuerzos realizados, así como las dificultades que se les ha presentado, pero la solicitud planteada para que se amplíe el plazo hasta por 36 meses adicionales, es a todas luces desproporcionada (implicaría una prórroga adicional de 3 años al plazo otorgado, la cual venció el 13 de mayo de 2025). Nótese además que la ASADA recurrida pantea esta solicitud 12 días después de haberse terminado el plazo otorgado por este Tribunal.
En virtud de lo expuesto, no se estima procedente ampliar el plazo otorgado.
V.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se acoge la gestión de desobediencia. Se reitera a Jose Darío Guzmán Álvarez, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, así como a Ana María Palacios Gallado, en su condición de Presidenta de la Junta Directiva del Acueducto de Horquetas de Sarapiquí, o a quienes ocupen los cargos, que proceda a dar cumplimiento a lo dispuesto por esta Sala en la sentencia no. 2025013579 de las 9:15 horas del 9 de mayo de 2025, en el sentido de que se finalice el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Río Frío de Sarapiquí”, que permita dotar de agua potable a la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, de manera que una vez finalizado este, se brinde el servicio de agua potable a las viviendas de la zona que cumplan los requisitos de conformidad con el ordenamiento infraconstitucional, de forma eficiente, eficaz y continua.
Lo anterior, bajo la advertencia que, de acreditarse la desobediencia, se podrá ordenar testimoniar piezas ante el Ministerio Público por la eventual comisión del delito de desobediencia (artículos 53 y 71 de la ley de la jurisdicción constitucional). En cuanto a la solicitud de ampliación del plazo, se declara no ha lugar a la gestión formulada. Notifíquese en forme personal a Jose Darío Guzmán Álvarez, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, así como a Ana María Palacios Gallado, en su condición de Presidenta de la Junta Directiva del Acueducto de Horquetas de Sarapiquí, o a quienes ocupen los cargos.- Fernando Castillo V.
