CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the seventh of July of two thousand and twenty-six.
Non-execution motion (gestión de inejecución) filed in amparo case N.° 24-024752-0007-CO, brought by Nombre01, national identity card CED01, and Nombre02, national identity card CED02, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
RECITALS:
"(…) Based on technical report N° GSD-UEN-GAR-2026-02855 of June 24, 2026, signed by the UEN Rural Aqueduct Management–AyA, and its annexes attached as evidence forming an integral part of the administrative file, we submit the following: FIRST FACT: It is true that within case file N.° 24-024752-0007-CO, resolution N.° 2025006043 of nine hours and twenty minutes on February twenty-eight, two thousand and twenty-five was issued, by which the appeal was declared partially granted, solely against the Instituto Costarricense de Acueductos y Alcantarillados. It is true that the judgment ordered that all necessary coordination be carried out and that instructions be issued within the scope of institutional authority so that the appropriate studies be conducted, as reported by the respondent authority, in order to determine a viable solution for the supply of potable water to the Bribri indigenous community of Meleruk, known as 'La Pera.' It is documented that AyA has undertaken actions to address the mandate within its competencies.
These actions include the supply of potable water via water tanker, interinstitutional coordination, attendance at meetings with the community, management of the initiative within the institutional portfolio, handling of information requests, and the evaluation of measures to improve temporary distribution while a solution is defined. It is documented that on March 19, 2026, a meeting was held at Dirección01, in the Bribri indigenous territory, with the participation of representatives of AyA, the Municipality, the Talamanca Health Oversight Area, the Nombre03 Committee, and the community. The purpose was to analyze the water supply shortage situation and to coordinate interinstitutional actions aimed at developing a solution. It is documented that on May 11, 2026, a virtual meeting was held with representatives of the community, the Ministry of Health, AyA's Office of Interculturality, the Executive Presidency, the Deputy Management of Delegated Systems, and the Directorate of Machinery and Equipment, at which requirements were discussed and it was agreed to conduct a technical site visit (gira técnica) on May 20, 2026.
It is documented that on May 20, 2026, a technical site visit was conducted in the community to assess on-site the expansion of the supply route via water tanker vehicles and the placement of additional storage tanks, taking into account schools and housing concentrations. For the foregoing reasons, it is true that the judgment exists, but it would be incorrect to interpret this as institutional inaction, given that documented actions have been taken following the judgment. SECOND FACT: It is false that there was no institutional communication regarding this case. It is documented that the inquiry related to the status of the project was addressed through official letter GSD-UEN-GAR-2025-05066 of December 17, 2025, by which Filidencio Cubillo Morales, Marlon Hidalgo Salas, and the community representatives were informed that the potable water supply initiative for Nombre03 had been approved and was undergoing the institutional process of inclusion in the investment portfolio.
It is documented that in said communication it was reported that the initiative was in the assignment stage to begin the corresponding formulation phase, in accordance with the applicable institutional procedure. It was also indicated that service to the community continues to be provided through temporary water tanker supply while the institutional process for the definitive solution advances. It is further documented that the initiative had previously been referred to the Planning Directorate through memorandum GSD-UEN-GAR-2024-00731 of February 22, 2024, that it was approved on March 4, 2025, and that it is ranked at position 116 within the institutional prioritization list, which is why it had not yet advanced to later project formulation stages. For the foregoing reasons, it is false that there was no institutional response or communication. What is documented is that AyA reported the actual status of the initiative, its position within the institutional portfolio, the stage it was at, and the continuity of the temporary water tanker supply measure.
THIRD FACT: Based on the information available in the administrative file, there is no evidence that Mr. Filidencio Cubillo Morales traveled on November 21, 2025, to the capital city to personally deliver documentation to AyA's central offices; likewise, we have no record of the means of transportation used, the duration of the trip, the exact point of departure, or the time of arrival at AyA's central offices. It is false that there was institutional inertia with respect to the requests submitted by community representatives, since it is documented that AyA has provided attention and responses to requests related to the status of the potable water supply project for Meleruk. It is documented that the inquiry related to the status of the project was addressed through official letter GSD-UEN-GAR-2025-05066 of December 17, 2025, by which the community representatives were informed that the potable water supply initiative for Nombre03 had been approved and was undergoing the institutional process of inclusion in the investment portfolio.
It is documented that in said communication it was reported that the initiative was in the assignment stage to begin the corresponding formulation phase, in accordance with the applicable institutional procedure. It was also indicated that service to the community continues to be provided through temporary water tanker supply while the institutional process for the definitive solution advances. It is further documented that during 2026, communications and follow-up actions were maintained. On March 19, 2026, a meeting was held at Dirección01, in the Meleruk community, in the Bribri indigenous territory, with the participation of representatives of AyA, the Municipality, the Talamanca Health Oversight Area, the Nombre03 Committee, and the community, with the purpose of analyzing the water supply shortage situation and coordinating interinstitutional actions aimed at developing a solution.
It is documented that said meeting addressed, among other topics, the current status of the water supply, the amparo appeal and legal support, technical alternatives, community organization for community water management, and the definition of agreements. It is documented that one of the agreements reached at that meeting was to improve communication between AyA and the community so that community members would not need to travel to San José, which demonstrates that AyA responded to the community's concern regarding the need to maintain direct and follow-up communication channels. It is documented that on April 8, 2026, the community sent a note addressed to Natasha Coward Ugalde, raising eleven requests stemming from the March 19, 2026, meeting, related to tanker distribution, adjustments to distribution measures, inclusion of Alto Meleruk, preliminary works, strengthening of communication channels, agreements, hydrogeological studies, a direct liaison, support for the UTN hydrogeological study, a community meeting, and clarity regarding the potential formation of an ASADA.
It is documented that on May 11, 2026, a virtual meeting was held with representatives of the community, the Ministry of Health, and AyA, at which the submitted requirements were addressed and a technical site visit was agreed upon for May 20, 2026. It is documented that on May 20, 2026, a technical site visit was conducted in the community, with an on-site tour to verify requirements, assess the expansion of the water tanker route, the placement of storage tanks, schools, and housing concentrations at specific points. It is documented that on June 2, 2026, the Directorate of Machinery and Equipment prepared a technical site visit report documenting background information, analysis, conclusions, and recommendations related to the water tanker supply measure and tank placement. It is documented that on June 4, 2026, the report prepared by the Machinery Administration team was sent to the community, and that pending information was requested to continue with the implementation of the recommendations.
For the foregoing reasons, although the specific personal trip mentioned by the petitioner is not on record, what is documented is that the inquiries related to the status of the project and community service were addressed through formal communication, meetings, follow-up, a technical site visit, and a technical report during 2026. FOURTH FACT: It is partially true that on January 14, 2026, the Deputy Management of Delegated Systems issued a response to inquiries related to the status of the project. It is false that said response constitutes the only institutional response or that it was limited to forwarding unrelated information. It is documented that after January 14, 2026, an in-person meeting was held on March 19, 2026, at Dirección01, with the participation of AyA, the Municipality, the Talamanca Health Oversight Area, the Nombre03 Committee, and the community. It is documented that that meeting addressed: the current status of the water supply, the amparo appeal, technical alternatives for a definitive solution, community organization for water management, and follow-up agreements.
It is documented that on May 11, 2026, a virtual meeting was held to address the requirements contained in note No. Nombre03 of April 8, 2026. It is documented that on May 20, 2026, a technical site visit was conducted in the community, with an on-site tour to verify requirements, assess the expansion of the water tanker route, the placement of storage tanks, schools, and housing concentrations. It is documented that on June 2, 2026, a technical site visit report was prepared by the Directorate of Machinery and Equipment, documenting background information, analysis, conclusions, and recommendations. For the foregoing reasons, although it is true that a response was issued on January 14, 2026, it is false that institutional attention was exhausted with that communication. FIFTH FACT: It is false that AyA has taken no concrete actions to address the situation in Nombre03. It is documented that on March 19, 2026, a meeting was held in the community to analyze the water shortage situation and coordinate interinstitutional actions aimed at developing a solution.
It is documented that said meeting produced documented follow-up agreements regarding the water tanker service, communication with the community, a sketch for tank placement, documentary support, road maintenance, an existing well, a hydrogeological study, alternatives in the event that no viable sources are found, storage tanks, direct contact with those responsible for supply, and an interinstitutional commission. It is documented that on April 8, 2026, the community sent a note with eleven points for attention. It is documented that on May 11, 2026, a virtual meeting was held to address community requirements and to agree on a technical site visit, demonstrating the continuity of the coordination and requirements-definition process. It is documented that on May 20, 2026, a technical site visit was conducted on-site to assess the expansion of the supply route via water tanker vehicles and the placement of additional storage tanks.
It is documented that the technical site visit report recommended continuing with a remedial supply management plan, providing two storage tanks with their platforms, installing a 2,500-liter tank approximately 300 meters to the southeast of the Nombre03 School in the direction of Suretka, and installing a 1,100-liter tank approximately 800 meters to the southeast of the Nombre03 School in the direction of Suretka Meleruk. It is documented that through Memorandum No. GG-CSA-2026-01563, the Deputy Management of Delegated Systems was formally requested to procure said storage tanks and their platforms, and that the transfer and installation would be handled by the Directorate of Machinery and Equipment, with the procurement and transfer process currently underway. It is documented that on June 4, 2026, the report prepared by the Machinery Administration team was sent to the community, and that pending data was requested to continue the process.
For the foregoing reasons, it is false that nothing concrete exists. The documentation evidences meetings, agreements, a technical site visit, a report, recommendations, and a formal request for storage tanks. SIXTH FACT: It is not known to this office that AyA has formally received conclusive hydrogeological studies establishing the viability of six drilling points to supply the Meleruk community with water. It is documented that the issue of hydrogeological studies was incorporated into the agreements from the March 19, 2026, meeting, where it was included as an action item to obtain a hydrogeological study to expand the scope in collaboration with AyA, the community, and UTN. It is documented that in the note of April 8, 2026, the community requested the expansion of hydrogeological and other required technical studies, as well as the provision of technical, financial, and human support for the hydrogeological study being conducted by the Universidad Técnica Nacional, indicating that they would share the results once available.
It is documented that the Committee would consider requesting from AyA a hydrogeological study for well drilling in the event that the UTN studies do not yield positive results. It is documented that AyA maintains coordination actions on this alternative; however, external studies must be reviewed and incorporated in accordance with the applicable institutional procedure. For the foregoing reasons, it is false that there is a hydrogeological study formally received by AyA with conclusive character; what is documented is that the issue was addressed, incorporated into agreements, and linked to follow-up actions. SEVENTH FACT: It is false that AyA required the community to form an ASADA as the sole condition for addressing the case. It is documented that on March 19, 2026, the issue of community organization needed for community water management was discussed. It is documented that in the note of April 8, 2026, the community itself requested clarity regarding the scope and implications of the potential formation of an ASADA, taking into account the community's indigenous status, in order to ensure respect for current legislation and treaties on indigenous peoples.
It is documented that the issue has been addressed as part of the aspects that must be resolved in order to structure a comprehensive response, since any supply solution requires defining representation, permits, responsibilities, resource management, institutional coordination, and operational sustainability. It is documented that AyA's actions have not been limited to requesting an organizational structure, as there exist meetings, agreements, follow-up, water tanker supply, a technical site visit, recommendations, a tank request, and communications with the community. For the foregoing reasons, it is rejected that AyA conditioned all institutional attention to the formation of an ASADA. What is documented is that the need for community organization has been addressed as part of a solution that requires technical, administrative, and legal support. EIGHTH FACT: It is false that AyA acted without the participation of the indigenous community.
It is documented that on March 19, 2026, a meeting was held in the Bribri indigenous territory, at Dirección01, with the participation of representatives of AyA, the Meleruk Committee, the community, the Municipality, and the Talamanca Health Oversight Area. It is documented that at that meeting the community's presentation was heard and the composition indicated by the Committee was recorded: 102 service connections in Meleruk, 15 additional families in Alto Akberi, 117 service connections including homes and institutions, 296 registered individuals, and 5 community institutions. It is documented that the meeting incorporated community concerns about institutional communication, accompaniment, the remaining time on the amparo appeal, and the perceived inequality in service delivery. It is documented that on April 8, 2026, the community sent a note with eleven points for attention and that said note led to a virtual meeting on May 11, 2026.
It is documented that on May 20, 2026, a technical site visit was conducted with the participation of community and institutional representatives, where requirements were verified on-site and new requirements were addressed. It is documented that on June 4, 2026, the technical site visit report was shared with the community and pending information was requested to continue with the implementation of the recommendations. (…)".
They request that the motion be declared without merit.
The opinion is authored by Justice Hess Herrera; and,
CONSIDERING:
In judgment n.° 2025006043 of 09:20 hours on February 28, 2025, this Chamber ruled as follows: "The appeal is declared partially granted, solely against the Instituto Costarricense de Acueductos y Alcantarillados. Juan Manuel Quesada Espinoza, executive president, Georgina Garro Mora, deputy manager of the Management of Delegated Systems division, and James Phillips Ávila, Planning Director, all of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions, are ordered to carry out all necessary coordination and to issue instructions within the scope of their institutional authority so that: 1) within TWELVE MONTHS, counted from the notification of this judgment, the appropriate studies shall be conducted as reported by the respondent authority, in order to determine a viable solution for the supply of potable water to the Bribri indigenous community of Nombre03, also known as 'La Pera,' and to implement that solution within an additional TWELVE-MONTH period; 2) within FIVE DAYS from the notification of this judgment, the supply of potable water to the Bribri indigenous community of Nombre03, also known as 'La Pera,' shall commence through water tankers, while the studies are conducted and a long-term water supply solution for that community is determined. (…)".
II.The petitioner in the present matter alleges non-execution of the provisions of judgment n.° 2025006043 of 09:20 hours on February 28, 2025, arguing that, despite what was ordered, on October 6, 2025, he requested information on compliance with the judgment without receiving a response, and that on November 21, 2025, he was therefore required to go in person to the central offices of the respondent institution. He states that it was not until January 14, 2026, that the institution responded through official letter n.° SG-GSD-2026-00037, relying on a prior report that, in his view, does not constitute compliance with what was ordered by this Chamber. He adds that, once the deadline for conducting the studies had expired, only three meetings have been held at which projections were presented, without defining a concrete solution for the potable water supply or executing what was ordered in the judgment. He contends that ICAA continues to fail to comply with the constitutional mandate, having neither conducted the ordered studies nor adopted a definitive solution for the community, and therefore requests that contempt be declared in respect of the ruling.
In this regard, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados reported that, in compliance with this Chamber's order, the Instituto Costarricense de Acueductos y Alcantarillados has undertaken various actions aimed at fulfilling this Court's mandate. Nombre04 indicates that temporary potable water supply to the Bribri indigenous community of Nombre03 has been maintained through water tankers; in addition, interinstitutional coordination has been carried out, meetings with the community have been held, information requests have been addressed, and steps have been taken to incorporate the definitive supply initiative into the institutional investment portfolio. They report that on March 19, 2026, a meeting was held at Dirección02, with the participation of representatives of ICAA, the Municipality of Talamanca, the Health Oversight Area, the Nombre03 Committee, and community members, at which the potable water shortage problem, the status of compliance with the constitutional judgment, technical alternatives for a definitive solution, and the community organization needed for the future management of the supply system were discussed.
They add that at that meeting various agreements were reached, including: improving communication channels between ICAA and the community to avoid trips to San José; obtaining a hydrogeological study; evaluating alternatives in the event that no viable water sources are found; defining the placement of storage tanks; maintaining supply via water tankers; establishing direct contact between institutional officers and the community; and forming a follow-up commission. They further report that on April 8, 2026, the community sent a note to the institution presenting eleven requests related to the service, including: expansion of water tanker distribution, inclusion of Alto Nombre03 in the supply route, execution of preliminary works, strengthening of institutional communication, support for the hydrogeological study being conducted by the Universidad Técnica Nacional, the holding of a new meeting in the community, and clarifications regarding the potential formation of an ASADA.
Nombre04 indicates that, to address those requests, on May 11, 2026, a virtual meeting was held with representatives of the community, the Ministry of Health, ICAA's Office of Interculturality, the Executive Presidency, the Deputy Management of Delegated Systems, and the Directorate of Machinery and Equipment, at which it was agreed to conduct a technical site visit to the community. They indicate that the visit took place on May 20, 2026, with the purpose of assessing on-site the expansion of the supply route via water tankers, verifying the points of greatest housing concentration and schools, and defining the placement of additional storage tanks. They add that, as a result of that inspection, on June 2, 2026, the Directorate of Machinery and Equipment issued a technical report documenting the background, the analysis conducted, the conclusions, and the recommendations, including continuing with a remedial supply plan, installing a 2,500-liter tank approximately 300 meters to the southeast of the Nombre03 School, and another 1,100-liter tank approximately 800 meters from that school, in addition to procuring the respective tanks and platforms.
They specify that, through memorandum n.° GG-CSA-2026-01563, the Deputy Management of Delegated Systems was formally requested to procure said equipment, with its transfer and installation to be handled by the Directorate of Machinery and Equipment, and that this process is currently underway. They also indicate that on June 4, 2026, the technical report was sent to the community, requesting the additional information needed to continue with the implementation of the recommendations made. With respect to the information requests submitted by the petitioner, they contend that there was no institutional failure to respond, since through official letter n.° GSD-UEN-GAR-2025-05066 of December 17, 2025, community representatives were informed that the potable water supply initiative had been approved for inclusion in the institutional investment portfolio and was in the assignment stage to begin formulation.
They add that this initiative had previously been referred to the Planning Directorate through memorandum n.° GSD-UEN-GAR-2024-00731 of February 22, 2024, was approved on March 4, 2025, and was ranked at position 116 within the institutional prioritization list. They also maintain that water tanker supply has been continued throughout this period while the administrative procedure for the definitive solution advances. Finally, they state that they have no record of the petitioner having appeared at ICAA's central offices on November 21, 2025; they deny that the institution conditioned its response to the formation of an ASADA, indicating that this issue has only been addressed as part of the organization required for the future management of the supply system; and Nombre04 indicates that they have also not received conclusive hydrogeological studies establishing the viability of the drilling points proposed by the community, which is why they assert that they continue to carry out the technical, administrative, and interinstitutional actions necessary to comply with this Chamber's order.
III.In light of the foregoing, the noncompliance (desobediencia) alleged by the moving party (parte gestionante) is hereby dismissed. Indeed, by ruling (sentencia) n.° 2025-006043, issued at 9:20 a.m. on February 28, 2025, this Court ordered ICAA (Instituto Costarricense de Acueductos y Alcantarillados) to conduct, within a period of twelve months, the studies required to identify a viable solution for the drinking-water supply of the Bribri indigenous community of Meleruk, known as "La Pera," and to implement that solution within an additional twelve-month period, while in the meantime maintaining the temporary supply by means of tanker trucks (camiones cisterna). As the report submitted reveals, the respondent institution has continued the provisional supply of drinking water by cistern truck, held coordination meetings with representatives of the community and of various institutions, carried out a technical field visit (gira técnica) to the site, issued the corresponding technical report containing the recommendations arising from that inspection, promoted the acquisition of complementary infrastructure to strengthen the temporary supply, and, furthermore, incorporated the initiative for the permanent supply of the community into the institution's investment portfolio (portafolio institucional de inversiones), managing its development in accordance with the institution's technical and budgetary planning.
Although the petitioner (recurrente) considers that a definitive solution has not yet been reached and that certain pending technical actions remain, the fact remains that the order issued by this Court must be assessed in light of the nature and complexity of the project entrusted to the institution. In that regard, the actions that have been verified demonstrate that the respondent authorities have engaged in continuous, progressive activity oriented toward compliance with the ruling, without any omissive, recalcitrant, or derelict conduct with respect to the obligations imposed by this Court being apparent. In this regard, the incorporation of the project into the institution's investment portfolio constitutes an objective step forward within the process of formulating and executing the permanent solution ordered, which is consistent with the technical and administrative sequence inherent in the project to be carried out.
That being so, even though the execution process has not concluded, that fact alone does not permit a finding of noncompliance with the ruling, since the elements on the case record (autos) show that the Administration has conducted itself with diligence aimed at giving effect to what was ordered by this Court. Consequently, as no unjustified failure to execute (inejecución) the constitutional ruling has been established, the appropriate course of action is to dismiss the present contempt motion (gestión de desobediencia).
The parties are hereby placed on notice that if any paper document, as well as any objects or evidence contained in an additional electronic, computer, magnetic, optical, telematic, or new-technology device, has been submitted, such materials must be retrieved from the office within a maximum of 30 business days counted from the date of notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12, held on May 3, 2012, Article LXXXI.
Por tanto:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del siete de julio de dos mil veintiseis .
Gestión de inejecución formulada en el recurso de amparo N.° 24-024752-0007-CO, interpuesto por Nombre01, cédula de identidad CED01 Y Nombre02, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
RESULTANDO:
“(…) Con fundamento en el informe técnico N° GSD-UEN-GAR-2026-02855 del 24 de junio del 2026, suscrito por la UEN Gestión de Acueductos Rurales-AyA, y sus anexos agregados como pruebas que forman parte integral del expediente administrativo, nos referimos en los siguientes términos: HECHO PRIMERO: Es cierto que dentro del expediente N.° 24-024752-0007-CO se dictó la resolución N.° 2025006043 de las nueve horas veinte minutos del veintiocho de febrero de dos mil veinticinco, mediante la cual se declaró parcialmente con lugar el recurso, únicamente contra el Instituto Costarricense de Acueductos y Alcantarillados. Es cierto que la sentencia ordenó realizar las coordinaciones necesarias y girar las órdenes dentro del ámbito de competencia institucional para que se realizaran los estudios que correspondan, según lo informado por la autoridad recurrida, a fin de determinar una solución viable para el suministro de agua potable en la comunidad indígena Bribri de Meleruk, conocida como “La Pera”.
Consta que AyA ha desarrollado acciones para atender el mandato dentro de sus competencias. Entre esas actuaciones se encuentran el suministro de agua potable mediante camión cisterna, la coordinación interinstitucional, la atención de reuniones con la comunidad, la gestión de la iniciativa dentro del portafolio institucional, la atención de requerimientos de información y la valoración de medidas para mejorar la distribución temporal mientras se define la solución. Consta que el 19 de marzo de 2026 se realizó reunión en el Dirección01, territorio indígena Bribri, con participación de representantes de AyA, Municipalidad, Área Rectora de Salud Talamanca, Comité Nombre03 y comunidad. El objetivo fue analizar la situación de desabastecimiento de agua y coordinar acciones interinstitucionales orientadas al desarrollo de una solución. Consta que el 11 de mayo de 2026 se realizó reunión virtual con representantes de la comunidad, Ministerio de Salud, Oficina de Interculturalidad AyA, Presidencia Ejecutiva, Subgerencia Gestión de Sistemas Delegados y Dirección Maquinaria y Equipo, donde se abordaron requerimientos y se acordó realizar una gira técnica el 20 de mayo de 2026.
Consta que el 20 de mayo de 2026 se realizó gira técnica en la comunidad para valorar en sitio la ampliación de la ruta de abastecimiento mediante vehículos tipo cisterna y la colocación de tanques de almacenamiento adicionales, considerando centros educativos y concentración de viviendas. Por lo anterior, es cierto el contenido de la sentencia, pero no corresponde interpretar dicho hecho como inactividad institucional, dado que existen actuaciones documentadas posteriores a la sentencia. HECHO SEGUNDO: Es falso que haya existido nula comunicación institucional sobre el caso. Consta que la gestión relacionada con el estado del proyecto fue atendida mediante el oficio GSD-UEN-GAR-2025-05066 del 17 de diciembre de 2025, en el cual se informó a Filidencio Cubillo Morales, Marlon Hidalgo Salas y a los representantes de la comunidad que la iniciativa de abastecimiento de agua potable para Nombre03 fue aprobada y que se encontraba dentro del procedimiento institucional de inclusión en el portafolio de inversiones.
Consta que en dicha comunicación se informó que la iniciativa se encontraba en etapa de asignación para iniciar la formulación correspondiente, conforme al procedimiento institucional aplicable. Asimismo, se indicó que la atención de la comunidad se mantiene mediante abastecimiento temporal con camión cisterna, mientras se avanza en la ruta institucional para la solución definitiva. Consta, además, que la iniciativa había sido remitida previamente a la Dirección de Planificación mediante el memorando GSD-UEN-GAR-2024-00731 del 22 de febrero de 2024, que fue aprobada el 04 de marzo de 2025 y que está ubicada dentro de la priorización institucional en el lugar 116, razón por la cual no había pasado todavía a las etapas posteriores de formulación del proyecto. Por lo anterior, es falso que no haya existido respuesta o comunicación institucional. Lo que consta es que el AyA informó el estado real de avance de la iniciativa, su ubicación dentro del portafolio institucional, la etapa en que se encontraba y la continuidad de la medida temporal de abastecimiento mediante camión cisterna.
HECHO TERCERO: Consultada la información disponible en el expediente administrativo, no hay evidencia que el señor Filidencio Cubillo Morales haya realizado un viaje el día 21 de noviembre de 2025 hasta la ciudad capital para entregar documentación directamente en las oficinas centrales del AyA; de igual forma, no nos consta el medio de traslado utilizado, la duración del viaje, el lugar exacto de salida ni la hora de ingreso a las oficinas centrales de AyA. Es falso que haya existido inercia institucional respecto de las gestiones presentadas por representantes de la comunidad, dado que consta que el AyA ha brindado atención y respuesta a las solicitudes relacionadas con el estado del proyecto de abastecimiento de agua potable para Meleruk. Consta que la gestión relacionada con el estado del proyecto fue atendida mediante el oficio GSD-UEN-GAR-2025-05066 del 17 de diciembre de 2025, en el cual se informó a los representantes de la comunidad que la iniciativa de abastecimiento de agua potable para Nombre03 fue aprobada y que se encontraba dentro del procedimiento institucional de inclusión en el portafolio de inversiones.
Consta que en dicha comunicación se informó que la iniciativa se encontraba en etapa de asignación para iniciar la formulación correspondiente, conforme al procedimiento institucional aplicable. Asimismo, se indicó que la atención de la comunidad se mantiene mediante abastecimiento temporal con camión cisterna, mientras se avanza en la ruta institucional para la solución definitiva Consta, además, que durante el año 2026 se mantuvieron comunicaciones y acciones de seguimiento. El 19 de marzo de 2026 se realizó reunión en el Dirección01, comunidad Meleruk, territorio indígena Bribri, con participación de representantes del AyA, Municipalidad, Área Rectora de Salud Talamanca, Comité Nombre03 y comunidad, con el objetivo de analizar la situación de desabastecimiento de agua y coordinar acciones interinstitucionales orientadas al desarrollo de una solución. Consta que en dicha reunión se trataron, entre otros temas, la situación actual del abastecimiento de agua, el recurso de amparo y respaldo legal, alternativas técnicas, organización comunitaria para la gestión hídrica comunitaria y definición de acuerdos.
Consta que uno de los acuerdos de dicha reunión fue mejorar la comunicación entre AyA y la comunidad para que no tengan que viajar a San José, lo cual demuestra que el AyA atendió el señalamiento comunitario relativo a la necesidad de mantener canales de comunicación directos y de seguimiento. Consta que el 8 de abril de 2026 la comunidad remitió nota dirigida a Natasha Coward Ugalde, mediante la cual planteó once solicitudes derivadas de la reunión del 19 de marzo de 2026, relacionadas con distribución mediante cisternas, ajuste de medidas de distribución, inclusión de Alto Meleruk, obras preliminares, fortalecimiento de canales de comunicación, convenios, estudios hidrogeológicos, enlace directo, apoyo al estudio hidrogeológico de la UTN, reunión en comunidad y claridad sobre la eventual constitución de una ASADA. Consta que el 11 de mayo de 2026 se realizó reunión virtual con representantes de la comunidad, Ministerio de Salud y AyA, en la cual se abordaron los requerimientos planteados y se acordó realizar una gira técnica el 20 de mayo de 2026.
Consta que el 20 de mayo de 2026 se realizó gira técnica en la comunidad para valorar en sitio la ampliación de la ruta de abastecimiento mediante vehículos tipo cisterna, así como la colocación de tanques de almacenamiento adicionales, considerando la ubicación de centros educativos y concentración de viviendas en puntos específicos. Consta que el 2 de junio de 2026 se elaboró el informe de gira técnica por parte de la Dirección Maquinaria y Equipo, en el cual se documentaron antecedentes, análisis, conclusiones y recomendaciones relacionadas con la medida de abastecimiento mediante cisterna y la colocación de tanques. Consta que el 4 de junio de 2026 se remitió a la comunidad el informe elaborado por el equipo de Administración de Maquinaria y se solicitó confirmar información pendiente para continuar con la implementación de las recomendaciones. Por lo anterior, aunque no consta el detalle del desplazamiento personal indicado por el recurrente, sí consta que las gestiones vinculadas con el estado del proyecto y la atención de la comunidad fueron atendidas mediante comunicación formal, reuniones, seguimiento, gira técnica e informe técnico durante el año 2026.
HECHO CUARTO: Es parcialmente cierto que el 14 de enero de 2026, la Subgerencia Gestión de Sistemas Delegados emitió respuesta a gestiones relacionadas con el estado del proyecto. Es falso que esa respuesta constituya la única atención institucional o que se haya limitado a remitir información sin relación con el caso. Consta que después del 14 de enero de 2026, se realizó reunión presencial el 19 de marzo de 2026 en el Dirección01, con participación de AyA, Municipalidad, Área Rectora de Salud Talamanca, Comité Nombre03 y comunidad. Consta que en esa reunión se trataron: la situación actual del abastecimiento de agua, el recurso de amparo, las alternativas técnicas para solución definitiva, la organización comunitaria para la gestión hídrica y los acuerdos de seguimiento. Consta que el 11 de mayo de 2026 se realizó reunión virtual para atender los requerimientos contenidos en la nota No. Nombre03 del 8 de abril de 2026.
Consta que el 20 de mayo de 2026 se realizó gira técnica en la comunidad, con recorrido en sitio para verificar requerimientos, valorar ampliación de ruta de cisterna, ubicación de tanques de almacenamiento, centros educativos y concentración de viviendas. Consta que el 2 de junio de 2026 se elaboró informe de gira técnica por parte de la Dirección Maquinaria y Equipo, en el cual se documentaron antecedentes, análisis, conclusiones y recomendaciones. Por lo anterior, aunque es cierto que existió respuesta el 14 de enero de 2026, es falso que la atención institucional se agotara en esa comunicación. HECHO QUINTO: Es falso que AyA no haya realizado acciones concretas para atender la situación de Nombre03. Consta que el 19 de marzo de 2026 se realizó reunión en la comunidad para analizar la situación de desabastecimiento y coordinar acciones interinstitucionales orientadas al desarrollo de una solución.
Consta que en esa reunión se documentaron acuerdos de seguimiento sobre el servicio de cisterna, comunicación con la comunidad, croquis para ubicación de tanques, respaldo documental, mantenimiento de caminos, pozo existente, estudio hidrogeológico, alternativas en caso de no encontrar fuentes viables, tanques de almacenamiento, contacto directo con responsables del suministro y comisión interinstitucional. Consta que el 8 de abril de 2026 la comunidad remitió nota con once puntos de atención. Consta que el 11 de mayo de 2026 se realizó reunión virtual para abordar los requerimientos de la comunidad y acordar una gira técnica, lo que demuestra continuidad del proceso de coordinación y definición de requerimientos. Consta que el 20 de mayo de 2026 se realizó gira técnica en sitio para valorar la ampliación de la ruta de abastecimiento mediante vehículos tipo cisterna y la colocación de tanques de almacenamiento adicionales.
Consta que el informe de gira técnica recomendó continuar con gestiones para establecer un plan remedial, dotar dos tanques de almacenamiento con sus tarimas, instalar un tanque de 2.500 litros 300 metros al sureste de la Escuela de Nombre03 en dirección hacia Suretka e instalar un tanque de 1.100 litros 800 metros al sureste de la Escuela de Nombre03 en dirección hacia Suretka Meleruk. Consta que mediante Memorando No. GG-CSA-2026-01563 se realizó solicitud de tanques de almacenamiento con sus tarimas a la Subgerencia Gestión de Sistemas Delegados, y que el traslado e instalación estaría a cargo de la Dirección Maquinaria y Equipo, que están en proceso de compra y traslado. Consta que el 4 de junio de 2026 se remitió a la comunidad el informe elaborado por el equipo de Administración de Maquinaria y se solicitaron datos pendientes para continuar con el proceso. Por lo anterior, es falso que no exista nada concreto.
La documentación acredita reuniones, acuerdos, gira técnica, informe, recomendaciones y solicitud de tanques de almacenamiento. HECHO SEXTO: No consta a esta dependencia, que AyA haya recibido formalmente estudios hidrogeológicos concluyentes que acrediten la viabilidad de seis puntos de perforación para abastecer a la comunidad de Meleruk. Consta que el tema de los estudios hidrogeológicos fue incorporado dentro de los acuerdos de la reunión del 19 de marzo de 2026, donde se incluyó gestionar estudio hidrogeológico para ampliación de alcance con AyA, comunidad y UTN. Consta que en la nota del 8 de abril de 2026 la comunidad solicitó ampliar estudios hidrogeológicos y otros estudios técnicos requeridos, así como brindar soporte técnico, financiero y humano al estudio hidrogeológico que desarrolla la Universidad Técnica Nacional, indicando que compartirían los resultados una vez los tuvieran.
Consta que el Comité valoraría solicitar al AyA el estudio hidrogeológico para perforación de pozo en caso de que los estudios de la UTN no brinden resultados positivos. Consta que el AyA mantiene acciones de coordinación sobre esta alternativa; sin embargo, los estudios externos deben ser revisados e incorporados conforme al procedimiento institucional que corresponda. Por lo anterior, es falso que exista un estudio hidrogeológico formalmente recibido por AyA con carácter concluyente; sí consta que el tema fue tratado, incorporado en acuerdos y vinculado con acciones de seguimiento. HECHO SETIMO: Es falso que AyA haya exigido a la comunidad constituirse como ASADA como única condición para atender el caso. Consta que el 19 de marzo de 2026 se trató el tema de la organización comunitaria necesaria para la gestión hídrica comunitaria. Consta que en la nota del 8 de abril de 2026 la propia comunidad solicitó claridad respecto a los alcances e implicaciones de la eventual constitución de una ASADA, considerando la condición de comunidad indígena, con el fin de garantizar el respeto a la legislación vigente y a los tratados sobre pueblos originarios.
Consta que el tema se ha abordado como parte de los aspectos que deben resolverse para estructurar una atención integral, dado que cualquier solución de abastecimiento requiere definir representación, permisos, responsabilidades, administración de recursos, coordinación institucional y sostenibilidad operativa. Consta que las actuaciones del AyA no se han limitado a solicitar una figura organizativa, pues existen reuniones, acuerdos, seguimiento, abastecimiento mediante cisterna, gira técnica, recomendaciones, solicitud de tanques y comunicaciones con la comunidad. Por lo anterior, se rechaza que AyA haya condicionado toda atención a la constitución de una ASADA. Lo que consta es que se ha tratado la necesidad de organización comunitaria dentro de una solución que requiere soporte técnico, administrativo y jurídico. HECHO OCTAVO: Es falso que AyA haya actuado sin participación de la comunidad indígena.
Consta que el 19 de marzo de 2026 se realizó reunión en el territorio indígena Bribri, en el Dirección01, con participación de representantes de AyA, Comité Meleruk, comunidad, Municipalidad y Área Rectora de Salud Talamanca. Consta que en esa reunión se escuchó la exposición de la comunidad y se documentó la conformación indicada por el Comité: 102 servicios en Meleruk, 15 familias adicionales en Alto Akberi, 117 servicios incluyendo casas e instituciones, 296 personas registradas y 5 instituciones comunales. Consta que la reunión incorporó preocupaciones comunales sobre comunicación institucional, acompañamiento, tiempo restante del recurso de amparo y percepción de desigualdad en la atención. Consta que el 8 de abril de 2026 la comunidad remitió una nota con once puntos de atención y que esa nota generó una reunión virtual el 11 de mayo de 2026. Consta que el 20 de mayo de 2026 se realizó gira técnica con participación de representantes comunitarios e institucionales, donde se verificaron requerimientos en sitio y se abordaron nuevos requerimientos. Consta que el 4 de junio de 2026 se compartió el informe de gira técnica y se solicitó información pendiente para continuar con la implementación de recomendaciones. (…)”.
Solicitan se declare no ha lugar la gestión.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
En la sentencia n.° 2025006043 de las 09:20 horas del 28 de febrero de 2025, esta Sala dispuso lo siguiente: “Se declara parcialmente con lugar el recurso, únicamente en contra del Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Juan Manuel Quesada Espinoza, presidente ejecutivo, a Georgina Garro Mora, sub-gerente de Gestión de Sistemas Delegados y a James Phillips Ávila, director de Planificación, todos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen dichos cargos, que realicen las coordinaciones que sean necesarias y giren las órdenes que estén dentro del ámbito de sus competencias para que: 1) dentro del plazo de DOCE MESES, contados a partir de la notificación de esta sentencia se realicen los estudios que correspondan según lo informado por esa autoridad recurrida a fin de determinar una solución viable para el suministro de agua potable en la comunidad indígena Bribri de Nombre03 conocida también como "La Pera” e implementar esa solución en un plazo adicional de DOCE MESES; 2) que en el plazo de CINCO DÍAS contados a partir de la notificación de esta sentencia se inicie con el suministro de agua potable a la comunidad indígena Bribri de Nombre03 conocida también como "La Pera” a través de cisternas, mientras se realizan los estudios y se determine cómo se le va a suministrar el agua a esa comunidad. (…)”.
II.El recurrente en el presente asunto, acusa la inejecución de lo dispuesto en la sentencia n.° 2025006043 de las 09:20 horas del 28 de febrero de 2025, pues aduce que, pese a lo ordenado, el 6 de octubre de 2025 solicitó información sobre el cumplimiento de la sentencia sin obtener respuesta, por lo que el 21 de noviembre de 2025 debió acudir personalmente a las oficinas centrales de la institución accionada. Indica que fue hasta el 14 de enero de 2026 cuando la institución respondió mediante el oficio n.° SG-GSD-2026-00037, sustentándose en un informe previo que, a su criterio, no corresponde al cumplimiento de lo ordenado por esta Sala. Agrega que, una vez vencido el plazo conferido para realizar los estudios, únicamente se han efectuado tres reuniones en las que se han expuesto proyecciones, sin definir una solución concreta para el abastecimiento de agua potable ni ejecutar lo dispuesto en la sentencia. Afirma que el ICAA continúa incumpliendo el mandato constitucional, al no haber realizado los estudios ordenados ni adoptado una solución definitiva para la comunidad, por lo que solicita se declare la desobediencia de lo resuelto.
Al respecto, las autoridades del Instituto Costarricense de Acueductos y Alcantarillados indicaron que en atención a lo ordenado por esta Sala, el Instituto Costarricense de Acueductos y Alcantarillados ha ejecutado diversas actuaciones tendentes al cumplimiento de lo dispuesto este Tribunal. Nombre04 que se ha mantenido el suministro temporal de agua potable a la comunidad indígena Bribri de Nombre03 mediante camiones cisterna; además, se han efectuado coordinaciones interinstitucionales, reuniones con la comunidad, atención de solicitudes de información y gestiones para incorporar la iniciativa de abastecimiento definitivo dentro del portafolio institucional de inversiones. Indican que el 19 de marzo de 2026 se realizó una reunión en el Dirección02, con participación de representantes del ICAA, la Municipalidad de Talamanca, el Área Rectora de Salud, el Comité de Nombre03 y miembros de la comunidad, en la que se analizó la problemática del desabastecimiento de agua potable, el estado de cumplimiento de la sentencia constitucional, las alternativas técnicas para una solución definitiva y la organización comunitaria necesaria para la futura gestión del sistema de abastecimiento.
Añaden que en dicha reunión se adoptaron diversos acuerdos, entre ellos mejorar los canales de comunicación entre el ICAA y la comunidad para evitar desplazamientos a San José; gestionar un estudio hidrogeológico; valorar alternativas en caso de no localizar fuentes viables de agua; definir la ubicación de tanques de almacenamiento; mantener el abastecimiento mediante cisternas; establecer contacto directo entre los responsables institucionales y la comunidad, y conformar una comisión de seguimiento. Agregan que el 8 de abril de 2026 la comunidad remitió una nota a la institución planteando once solicitudes relacionadas con el servicio, entre ellas la ampliación de la distribución mediante cisternas, la inclusión de Alto Nombre03 en la ruta de abastecimiento, la ejecución de obras preliminares, el fortalecimiento de la comunicación institucional, el apoyo al estudio hidrogeológico desarrollado por la Universidad Técnica Nacional, la realización de una nueva reunión en la comunidad y aclaraciones sobre la eventual constitución de una ASADA.
Nombre04 que, para atender esas peticiones, el 11 de mayo de 2026 se efectuó una reunión virtual con representantes de la comunidad, del Ministerio de Salud, de la Oficina de Interculturalidad del ICAA, de la Presidencia Ejecutiva, de la Subgerencia de Gestión de Sistemas Delegados y de la Dirección de Maquinaria y Equipo, en la que se acordó realizar una gira técnica a la comunidad. Indican que dicha gira se llevó a cabo el 20 de mayo de 2026 con el propósito de valorar en sitio la ampliación de la ruta de abastecimiento mediante camiones cisterna, verificar los puntos de mayor concentración de viviendas y centros educativos, así como definir la ubicación de tanques de almacenamiento adicionales. Añaden que, como resultado de esa inspección, el 2 de junio de 2026 la Dirección de Maquinaria y Equipo emitió un informe técnico que documentó los antecedentes, el análisis efectuado, las conclusiones y recomendaciones, entre ellas continuar con un plan remedial de abastecimiento, instalar un tanque de 2.500 litros aproximadamente 300 metros al sureste de la Escuela de Nombre03 y otro de 1.100 litros a unos 800 metros de dicho centro educativo, además de gestionar la adquisición de los respectivos tanques y tarimas.
Precisan que, mediante memorando n.° GG-CSA-2026-01563, se solicitó formalmente a la Subgerencia de Gestión de Sistemas Delegados la adquisición de dichos equipos, cuyo traslado e instalación estaría a cargo de la Dirección de Maquinaria y Equipo, encontrándose ese proceso en trámite. Asimismo, indican que el 4 de junio de 2026 el referido informe técnico fue remitido a la comunidad, solicitándose información adicional necesaria para continuar con la implementación de las recomendaciones formuladas. En cuanto a las gestiones de información realizadas por el promovente, sostienen que no existió falta de respuesta institucional, pues mediante oficio n.° GSD-UEN-GAR-2025-05066 del 17 de diciembre de 2025 se comunicó a los representantes de la comunidad que la iniciativa para el abastecimiento de agua potable había sido aprobada para su incorporación al portafolio institucional de inversiones, encontrándose en etapa de asignación para iniciar su formulación.
Añaden que dicha iniciativa había sido remitida previamente a la Dirección de Planificación mediante memorando n.° GSD-UEN-GAR-2024-00731 del 22 de febrero de 2024, fue aprobada el 4 de marzo de 2025 y se ubicaba en la posición 116 dentro del orden de priorización institucional. Además, sostienen que el abastecimiento mediante camiones cisterna se ha mantenido durante todo ese período mientras avanza el procedimiento administrativo para la solución definitiva. Finalmente, manifiestan que no les consta que el recurrente se hubiera apersonado a las oficinas centrales del ICAA el 21 de noviembre de 2025; niegan que la institución haya condicionado la atención del caso a la constitución de una ASADA, indicando que ese tema únicamente ha sido abordado como parte de la organización requerida para la administración futura del sistema de abastecimiento, y Nombre04 que tampoco han recibido estudios hidrogeológicos concluyentes que acrediten la viabilidad de los puntos de perforación propuestos por la comunidad, razón por la cual afirman que continúan desarrollando las actuaciones técnicas, administrativas e interinstitucionales necesarias para cumplir lo ordenado por esta Sala.
III.En virtud de lo expuesto, se descarta la desobediencia alegada por la parte gestionante. En efecto, mediante la sentencia n.° 2025-006043 de las 09:20 horas del 28 de febrero de 2025 esta Sala ordenó al Instituto Costarricense de Acueductos y Alcantarillados realizar, dentro del plazo de doce meses, los estudios que correspondieran para determinar una solución viable para el abastecimiento de agua potable de la comunidad indígena Bribri de Meleruk, conocida como "La Pera", e implementar dicha solución en un plazo adicional de doce meses, manteniendo entretanto el suministro temporal mediante camiones cisterna. Ahora bien, del informe rendido se desprende que la institución accionada ha dado continuidad al abastecimiento provisional de agua potable mediante cisternas, celebró reuniones de coordinación con representantes de la comunidad y de diversas instituciones, efectuó una gira técnica en el sitio, emitió el correspondiente informe técnico con las recomendaciones derivadas de esa inspección, promovió la adquisición de infraestructura complementaria para fortalecer el abastecimiento temporal y, además, incorporó la iniciativa para el abastecimiento definitivo de la comunidad al portafolio institucional de inversiones, gestionando su desarrollo conforme a la planificación técnica y presupuestaria de la institución.
Si bien, el recurrente estima que aún no se ha alcanzado una solución definitiva y que persisten actuaciones técnicas pendientes, lo cierto es que la orden impartida por esta Sala debe valorarse atendiendo a la naturaleza y complejidad del proyecto encomendado. En ese sentido, las actuaciones acreditadas evidencian que las autoridades recurridas han desplegado una actividad continua, progresiva y orientada al cumplimiento del fallo, sin que se advierta una conducta omisiva, renuente o de abandono de las obligaciones impuestas por este Tribunal. En este sentido, la incorporación del proyecto al portafolio institucional de inversiones constituye un avance objetivo dentro del proceso de formulación y ejecución de la solución definitiva ordenada, el cual resulta compatible con la secuencia técnica y administrativa propia del proyecto ha ejecutar. Así las cosas, aun cuando el proceso de ejecución no haya concluido, ello no permite afirmar, por sí solo, la existencia de un incumplimiento de la sentencia, pues de los elementos que constan en autos se desprende que la Administración ha observado una conducta diligente encaminada a materializar lo ordenado por esta Sala. En consecuencia, al no acreditarse una inejecución injustificada del fallo constitucional, lo procedente es desestimar la presente gestión de desobediencia.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
No ha lugar a la gestión. Notifíquese.
