Motion for non-compliance (gestión de inejecución) filed in constitutional protection proceeding (recurso de amparo) No. 24-003134-0007-CO, brought by Nombre01, national identity document CED01, against the MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) and the MUNICIPALIDAD DE NICOYA.
BACKGROUND:
"(…) II. REGARDING THE REQUESTED REPORT. This report is submitted in response to the facts attributed to SINAC, in which contempt is alleged with respect to the orders contained in Decision No. 2024015681 issued at 09 hours 30 minutes on June 7, 2024, pursuant to which the following was ordered: Regarding the facts alleged by the petitioner, in summary: "The writ is granted, solely against the Sistema Nacional de Áreas de Conservación. David Chavarría Morales, acting executive director, and Nelson Marín Mora, regional director of the Área de Conservación Tempisque (ACT), both of SINAC, are ordered, within the scope of their respective competencies, to: a) adopt and issue the necessary measures so that, within ONE MONTH from notification of this decision, a proper response is provided to the complaint filed by the petitioner on April 8, 2022, and the petitioner is notified of the resolution; b) likewise, carry out the pertinent actions and coordination so that, within TWELVE MONTHS from notification of this decision, the necessary and applicable studies are conducted to determine the true nature of the problem reported and to provide a definitive solution.
(...)" III. PRELIMINARY CLARIFICATION REGARDING THE SCOPE OF MINAE AND SINAC COMPETENCIES. In accordance with Article 50 of the Political Constitution, every person has the right to a healthy and ecologically balanced environment, and it is the State's duty to guarantee, defend, and preserve that right. Likewise, Article 11 of the Political Constitution requires public officials to act within the framework of legally assigned competencies, without arrogating powers not granted by the legal order. Articles 21 and 50 of the Constitution further impose positive duties to protect life, health, and the environment. Pursuant to Article 11 of the Political Constitution, public officials are mere custodians of authority and may not arrogate powers not granted by law; and Article 50 recognizes the right to a healthy and ecologically balanced environment, the protection of which must be exercised within the jurisdictional framework established by the legal order.
SINAC, created by the Ley de Biodiversidad No. 7788, integrates competencies in the areas of forestry, wildlife, and protected areas. Within that framework, it is empowered to intervene in matters related to environmental protection associated with natural resources. IV. REGARDING THE CONTEMPT ALLEGATION. With respect to the contempt allegation, the petitioner is incorrect, given that the institution has continuously responded to the orders issued by the Court in Decision No. 2024015681 issued at 09 hours 30 minutes on June 7, 2024; however, it does acknowledge that the case is complex and requires additional time to comply with the orders. The twelve-month period established by this Court is not sufficient to resolve the situation. In this regard, it is important to report that SINAC has been continuously carrying out actions toward compliance with the order, as detailed below: 1. CREATION OF A TECHNICAL-LEGAL COMMISSION.
As a first step, it was necessary to establish a Technical-Legal Commission to develop a "Proposal for the recovery and rehabilitation of the mangrove (manglar) of Estero Lagarto, Playa Sámara, Nicoya," which, after analyzing the information obtained, sets out recommendations and a general activity schedule for mangrove rehabilitation over a longer time frame, with the least possible intervention and minimal environmental impact, along with an estimated budget per activity. The proposal's general objective is to determine a strategy for restoring the mangrove of Estero Lagarto, Playa Sámara, Nicoya, based on an analysis of the potential environmental impacts, constraints, and conditions required for its restoration. The proposal identifies the following specific objectives: to characterize the condition of the mangrove of Estero Lagarto based on field reports and aerial photographs of the site; and to analyze different proposals for the recovery and rehabilitation of the mangrove of Estero Lagarto, with community participation and the application of site-appropriate regeneration techniques. 2.
RECOVERY PROPOSALS. Additionally, three recovery proposals for the mangrove of Estero Lagarto, Playa Sámara were developed, identified as follows: Recovery 01. Recovery of the State Natural Heritage (Patrimonio Natural del Estado, PNE) as natural forest, with 3 required actions: 1. Demarcate the site with barbed wire fencing (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments. 2. Promote the establishment of forest in the mangrove area so as to recover the PNE, through community-based actions such as reforestation campaigns and the creation of ecotourism trails. 3. Foster biological connectivity of the forest toward the southwest sector, ensuring that species remain away from the urban area, thereby preventing the risk of electrocution of arboreal fauna. Advantages and disadvantages are also noted. Recovery 02. Mangrove rehabilitation over a longer time frame, with the least possible intervention and minimal environmental impact, with 7 required actions: 1.
Demarcate the site with barbed wire fencing (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments; 2. Restore the public-domain watercourse (cauce de dominio público) located to the northwest of the mangrove, following the proposed coordinates. This involves establishing the appropriate grade so that water flows from the diverted stream to the estuary (estero), preferably reaching the original substrate beneath the fill (relleno). It must be considered that, when opening a new channel, the width deemed appropriate by the Dirección de Aguas of MINAE or another technical criterion must be provided. Additionally, the material extracted must be removed from the site and disposed of outside the mangrove area. It should be clarified that the proposed route requires field verification and may therefore be modified, while retaining the proposed concept; 3. Based on the outcome of the public-domain watercourse restoration, the advisability of carrying out smaller-scale interventions to widen the water inlet of the estuary over the stream may be assessed, thereby accelerating the removal of fill material and fostering mangrove recovery; 4.
Reforest the outer area with native species characteristic of local forests to accelerate the creation of a natural forest perimeter; while in the core area, reforestation will use mangrove species: R. mangle, L. racemosa, and A. germinans in zones where the original substrate is recovered; 5. Progressively remove fill from the mangrove on a smaller scale, beginning from the interior and moving toward the edge. This will allow sediment reaching the sea to be absorbed by the ecosystem with a lower likelihood of damage to the coral reef; 6. Foster biological connectivity of the forest toward the southwest sector, ensuring that species remain away from the urban area, thereby preventing the risk of electrocution of arboreal fauna; 7. Remove the stone paving over a stretch of at least 85 m, so as to facilitate coastal erosion eliminating, over the long term, the fill present along the edge of the estuary, with advantages and disadvantages analyzed.
Recovery 03. Mangrove rehabilitation over a shorter time frame, with a high level of intervention and greater environmental impact, with 7 required actions: 1. Demarcate the site with barbed wire fencing (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments; 2. Remove the fill covering the mangrove area, estimated at 22,000 truckloads of 14 m³ each; 3. Restore the public-domain watercourse in the approximately 30 m section between the public road and the edge of the mangrove. From that point onward, the watercourse will flow through the mangrove, gradually establishing a new channel as water is channeled naturally; 4. Remove the stone paving over a stretch of at least 180 m, so as to facilitate coastal erosion eliminating, over the long term, the fill present on the dune and the edge of the estuary; and 5. Reforest with core mangrove species: R. mangle, L. racemosa, and A. germinans.
The introduction of Rhizophora racemosa could be evaluated at a later stage. These actions also include an analysis of advantages and disadvantages. All of the foregoing, together with additional information, is contained in the "PROPOSAL FOR THE RECOVERY AND REHABILITATION OF THE MANGROVE OF ESTERO LAGARTO, PLAYA SÁMARA, NICOYA," which is attached as evidence of the work performed, and whose general activity schedule for implementation has been estimated at 10 years to achieve mangrove recovery. 3. REPORT ON TECHNICAL-LEGAL PROCEEDINGS. By official communication SINAC-ACTOR-DT-1075-202 dated June 22, 2026, Mr. Mauricio Méndez Venegas, Technical Director of the Área de Conservación Tempisque, issued a report on actions taken in the case of Estero Río Lagarto, Playa Sámara, in accordance with the requirements of Decision No. 2024015681 in judicial case file No. 24-0013134-0007-CO. The report contains a series of follow-up actions and an updated account of proceedings dating back to 2019, when the cartographic and photointerpretive study was requested, through official communication CARTA-SINAC-ACT-DR-1064-2026 dated June 19, 2026, in which the Concejo Municipal de Nicoya is requested to provide municipal support for the removal of stone paving at the mouth of Estero Lagarto and for conducting the soil study necessary to carry out the boundary demarcation (amojonamiento) of the mangrove of Estero Lagarto.
A link to the case file is attached for verification of actions and other proceedings in progress: EXPEDIENTE ACTOR-DR-390-2024 ESTERIO RIO LAGARTO, and the actions taken in compliance with the orders. This Administration has been carrying out multiple technical, legal, and administrative steps aimed at fulfilling the Court's orders, as documented in the submitted report, the recovery plan, and the documented proceedings. Notwithstanding the foregoing, it is necessary to note that the twelve-month period granted is neither materially nor technically sufficient to achieve full implementation of the required actions, given the high complexity of the case, which is set out below: 1. Technical and environmental complexity. The affected ecosystem is a mangrove, which has been significantly altered by fill material, entailing highly complex interventions from a technical and logistical standpoint.
Furthermore, the removal of fill material cannot be carried out immediately or on a large scale, as this would generate severe negative impacts, particularly on the nearby coral reef, as duly documented in the technical studies. 2. Legal complexity. The area overlaps with private properties and concessions, which requires the parallel development of legal proceedings for the recovery of the public domain, proceedings that operate on timelines that do not depend exclusively on the Administration. 3. Existence of a formal technical proposal. An official proposal exists titled "Mangrove rehabilitation over a longer time frame, with the least possible intervention and minimal environmental impact," which establishes a ten-year implementation schedule encompassing: a. Gradual interventions. b. Progressive restoration. c. Continuous monitoring. d. Environmental impact control. 4. Material impossibility of complying within 12 months.
The required actions include: a. Legal recovery of land. b. Hydrological works. c. Progressive removal of fill. d. Ecological restoration of the mangrove. By their nature, these actions cannot be carried out within a 12-month period without compromising the effectiveness of the process or causing additional environmental damage. 5. Principle of reasonableness and environmental protection. It must be considered that hasty implementation could run contrary to the constitutional purpose of environmental protection, given that incorrect or accelerated interventions could worsen the damage rather than repair it. (…)" They request that the motion be denied.
"(…) FIRST: The respondents submit a report that is very vague in scientific and technical data, which only generates further uncertainty, as they inform you that it will take 10 years to achieve recovery, thereby merely expanding the generic information that the damage will remain unaddressed for years to come. SECOND: As can be seen from the report, to date SINAC has not completed the definitive and unequivocal studies, within the realm of science and technology, necessary to resolve the problem, nor has it identified or sought the financial resources required to provide a definitive solution to the problem of the elimination of the wetland (humedal), and it therefore remains in contempt of the ruling—a situation that has not changed in several years. It should be noted that the respondents do not explain to you why no concrete decisions are being made and merely state that the problem is complex.
In fact, they have provided three broad restoration and recovery options, but these lack budgetary content and there is no schedule for each step to be taken, which only demonstrates that giving effect to the ruling is riddled with a glaring information vacuum resulting from willful State inaction. In accordance with the principle of scientific oversight, they should be entirely clear and specify the pathway and what actions they will take and how, but what you see are merely proposals devoid of content, and on that basis the contempt motion is maintained. To date, without an activity schedule and without clarity as to the manner in which the eliminated mangrove will be restored, it is as if we were at square one, and that is how the situation is asked to be declared—rejecting the 10-year timeline, since it is unclear where that figure comes from; why not 5 or 15 years? All of this indicates that they do not even know the optimal and essential pathway.
That is to say, for any serious planner, time, an activity schedule, and a budget are fundamental, yet the report says NOTHING—so where did that decade come from? I wish to insist that, according to science and technology, there is NO serious proposal that holds up, and proof of this is that, as I said, you will not see in the report even a tentative schedule. As a result, as civil society, the undersigned and the community are in clear violation of the right to information and transparency. THIRD: Of vital importance is the fact that you will also not see any actions aimed at removing the rocks placed in front of the beach that prevent seawater from entering and connecting with the river; they merely state that removing that material will cause damage but provide NO scientific or technical justification for that claim. In other words, if the rocks are not removed from in front of the coastline, what credibility does the assertion that something will be done in 10 years have?
FOURTH: Nor is there any mention of the mass events held each year on the site formerly occupied by the wetland, which is very serious, as it indicates inaction and passivity with respect to land that would be STATE NATURAL HERITAGE both within and outside the maritime-terrestrial zone (zona marítimo terrestre). They point to complexity regarding private property, but what more do they contribute in the report: NOTHING. And this is because they are not doing anything. FIFTH: In fact, I am even submitting photographs from today showing a work crew apparently conducting drilling operations—based on information obtained from neighbors and the workers on site—for a soil study for the purpose of building houses or condominiums, and this should not be permitted by SINAC, as it is evidence that a real estate development project could begin on the site at any moment, which would thwart the ecosystem recovery sought to be restored, due to that willful and bad-faith State inertia.
(…) In other words, while the contempt matter is being debated before the Court, developers are already conducting studies to build on the wetland site, and SINAC is not taking the appropriate action and is merely requesting 10 years. (…)" He requests that the motion be granted.
"(…) SECOND: To date, more than TWENTY-FOUR months have elapsed since the decision was issued, without the respondents having carried out the actions necessary to provide the definitive solution ordered by this Court, manifestly failing to comply with the constitutional mandate within a period that far exceeds the maximum twelve months granted by this Court for full compliance with the orders. THIRD: The non-compliance is objective and fully verifiable. Far from demonstrating compliance with the decision within the established period, the respondents themselves, through official communication CARTA-MINAE-DAJ-1527-2026 dated June 22, 2026, acknowledge their intention to carry out the ordered actions over an approximate period of ten years, without having provided any technical basis to justify that need, thereby disregarding the judicial deadline of twelve months set by this Court. FOURTH: It must be recalled that the State is the first party obligated to comply with the law.
The Public Administration may only act in accordance with the principle of legality; it is therefore inadmissible that the Administration itself should defy a decision of this Court, disregarding the legal order it has a duty to protect and uphold. The Administration cannot unilaterally modify a final judicial order. Its conduct constitutes a manifest failure to comply with the decision and contempt of the authority of this Court. It should also be noted that the subject matter of the constitutional protection proceeding concerns the protection of public-domain assets and the State Natural Heritage, a circumstance that renders the persistence of non-compliance even more serious, given the nature of the public interests protected. (…)" He requests that the motion be granted.
The opinion is drafted by Magistrate Hess Herrera; and,
CONSIDERING:
In Decision Nombre02°. 2024-015681 issued at 09:30 hours on June 7, 2024, this Court ordered the following: "The writ is granted, solely against the Sistema Nacional de Áreas de Conservación. David Chavarría Morales, acting executive director, and Nelson Marín Mora, regional director of the Área de Conservación Tempisque (ACT), both of SINAC, are ordered, within the scope of their respective competencies, to: a) adopt and issue the necessary measures so that, within ONE MONTH from notification of this decision, a proper response is provided to the complaint filed by the petitioner on April 8, 2022, and the petitioner is notified of the resolution; b) likewise, carry out the pertinent actions and coordination so that, within TWELVE MONTHS from notification of this decision, the necessary and applicable studies are conducted to determine the true nature of the problem reported and to provide a definitive solution. (…)"
II.The petitioner and the intervenor in this matter allege non-compliance with the orders contained in Decision No. 2024-015681 issued at 09:30 hours on June 7, 2024, arguing that SINAC has not completed the studies necessary to fulfill the order issued by this Court, has not secured the required budgetary resources, and has not taken concrete coordinating action with the Municipalidad to remove the dikes (diques) and fill material that prevent the recovery of the wetland and mangrove, with the result that conditions at the site remain unchanged since the constitutional protection proceeding was filed. They add that there is no implementation plan or schedule, and denounce the continued authorization of activities in the area that obstruct its restoration, concluding that the orders of this Court remain unfulfilled.
In this regard, the respondent authorities (autoridades recurridas) stated the following:
"(…) II. ON THE REQUESTED REPORT. This report is submitted with respect to the facts attributed to SINAC, in which contempt (desobediencia) of the order issued by the Chamber in ruling No. 2024015681 of 09:30 hours on June 7, 2024, is alleged, given that said ruling provided the following: Regarding the facts alleged by the petitioner (recurrente), summarized as follows: 'The writ (recurso) is granted, solely against SINAC. David Chavarría Morales, acting executive director, and Nelson Marín Mora, regional director of the Área de Conservación Tempisque (ACT), both of SINAC, are ordered to act within the scope of their respective powers: a) to adopt and issue the necessary actions so that, within ONE MONTH from notification of this judgment, a proper response is provided to the complaint filed by the petitioner on April 8, 2022, and the outcome is communicated to the petitioner; b) likewise, to carry out the relevant actions and coordination so that, within TWELVE MONTHS from notification of this judgment, the necessary studies are conducted to determine the actual state of the reported problem and to provide a definitive solution. (…)'
In accordance with Article 50 of the Political Constitution, every person has the right to a healthy and ecologically balanced environment, and it is the duty of the State to guarantee, defend, and preserve that right. Likewise, Article 11 of the Constitution obliges public officials to act within the framework of legally assigned powers, without assuming authority not granted to them by the legal order. Articles 21 and 50 of the Constitution further impose positive duties to protect life, health, and the environment. Pursuant to Article 11 of the Political Constitution, public officials are mere custodians of authority and may not assume powers that the law does not grant them; and Article 50 recognizes the right to a healthy and ecologically balanced environment, the protection of which must be exercised within the jurisdictional framework established by the legal order. SINAC, created by the Ley de Biodiversidad №7788, integrates powers relating to forestry, wildlife, and protected areas. Within that framework, it is responsible for intervening in matters of environmental protection associated with natural resources.
With respect to the contempt allegation, the petitioner is incorrect, given that the institution has consistently responded to what was ordered by the Chamber in ruling No. 2024015681 of 09:30 hours on June 7, 2024; it does, however, acknowledge that the case is complex and requires more time to comply with the order. The twelve-month period established by Your Authority is insufficient to resolve the situation. In this regard, it is important to report that SINAC has been continuously carrying out actions in furtherance of compliance with the order, and reports the following:
1. ESTABLISHMENT OF A TECHNICAL-LEGAL COMMITTEE. The first action taken was to establish a Technical-Legal Committee for the creation of a "Proposal for the Recovery and Rehabilitation of the Mangrove (manglar) of Estero Lagarto, Playa Sámara, Nicoya," which, after analyzing the inputs obtained, sets out recommendations and a general activity schedule for mangrove rehabilitation over a longer timeframe, with the least possible intervention and the least environmental impact, along with an estimated budget per activity of the proposal. The general objective of the proposal is to determine a strategy for the restoration of the mangrove of Estero Lagarto, Playa Sámara, Nicoya, based on an analysis of the potential environmental impacts, constraints, and conditions required for its restoration. The proposal identifies the following specific objectives: to characterize the condition of the mangrove of Estero Lagarto based on field reports and information from aerial photographs of the site; and to analyze different proposals for the recovery and rehabilitation of the mangrove of Estero Lagarto, with community participation and the application of site-appropriate regeneration techniques.
2. RECOVERY PROPOSALS. Three recovery proposals for the mangrove of Estero Lagarto, Playa Sámara, are also developed, identified as follows:
Recovery 01. Recovery of the State Natural Heritage (patrimonio natural del Estado, PNE) as natural forest, with 3 required actions: 1. Demarcate the site with a barbed-wire fence (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments. 2. Promote the establishment of a forest in the mangrove area so as to recover the State Natural Heritage, through community-based actions such as reforestation campaigns and the creation of ecotourism trails. 3. Foster biological connectivity (conectividad biológica) of the forest toward the southwest sector, ensuring that species remain away from the urban area, thereby preventing the risk of electrocution of arboreal wildlife (fauna arborícola). The proposal also notes the advantages and disadvantages.
Recovery 02. Mangrove rehabilitation over a longer timeframe, with the least possible intervention and the least environmental impact, with 7 required actions: 1. Demarcate the site with a barbed-wire fence (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments; 2. Re-establish the public-domain watercourse (cauce de dominio público) located to the northwest of the mangrove, following the proposed coordinates. This involves bringing the level to an appropriate point so that water flows from the stream (quebrada) that was diverted all the way to the estuary, preferably reaching the original material beneath the fill material (rellenos). It must be considered that, when opening a new channel, the width deemed appropriate according to the criteria of the Water Directorate of MINAE or other technical criteria must be provided. Furthermore, the extracted material must be removed from the site and disposed of at a location outside the mangrove area.
It should be noted that the proposed route requires field verification and may therefore be modified, while preserving the proposed concept; 3. Based on the outcome of the rehabilitation of the public-domain watercourse, the advisability of carrying out smaller-scale interventions to widen the water inlet of the estuary over the stream — and thereby accelerate the elimination of fill material and foster the recovery of the mangrove — may be assessed; 4. Reforest the outer area with native species characteristic of the forests of the zone to accelerate the creation of a natural forest around it; while the core area will be reforested with mangrove species: R. mangle, L. racemosa, and A. germinans in the zones where the original substrate is recovered; 5. Fill material must be progressively removed from the mangrove on a smaller scale, beginning from the inner area and moving toward the edge.
This will allow the sediment reaching the sea to be absorbed by the ecosystem with a lower likelihood of damage to the coral reef (arrecife coralino); 6. Foster biological connectivity of the forest toward the southwest sector, ensuring that species remain away from the urban area, thereby preventing the risk of electrocution of arboreal wildlife; 7. Remove the stone paving (empedrado) over a stretch of at least 85 m so as to facilitate the long-term elimination by coastal erosion of the fill material along the edge of the estuary, with the analyzed advantages and disadvantages.
Recovery 03. Mangrove rehabilitation over a shorter timeframe, with a high level of intervention and greater environmental impact, with 7 required actions: 1. Demarcate the site with a barbed-wire fence (950 m) to keep domestic animals out of the recovery area and to prevent new encroachments; 2. Remove the fill material located over the mangrove area, that is, the estimated 22,000 truckloads (vagonetadas) of 14 m³; 3. Re-establish the public-domain watercourse over approximately 30 m between the public road and the edge of the mangrove. From that point onward, the watercourse will run through the mangrove, gradually establishing a new channel as the water is channeled naturally; 4. Remove the stone paving over a stretch of at least 180 m so as to facilitate the long-term elimination by coastal erosion of the fill material on the dune and the edge of the estuary; and 5. Reforest with core mangrove species, R. mangle, L. racemosa, and A. germinans. The introduction of Rhizophora racemosa may be evaluated at a later stage. These actions also include an analysis of advantages and disadvantages.
All of the foregoing, and further information, is contained in the "PROPOSAL FOR THE RECOVERY AND REHABILITATION OF THE MANGROVE OF ESTERO LAGARTO, PLAYA SÁMARA, NICOYA," which is attached as evidence of the work carried out. The general activity schedule for implementation has been estimated at 10 years to achieve mangrove recovery.
3. REPORT ON TECHNICAL-LEGAL PROCEEDINGS. By official memorandum SINAC-ACTOR-DT-1075-202 dated June 22, 2026, Mr. Mauricio Méndez Venegas, Technical Director of the Área de Conservación Tempisque, issued a report on the actions carried out in the case of Estero Río Lagarto, Playa Sámara, in accordance with the requirements of ruling No. 2024015681, in judicial case file No. 24-0013134-0007-CO. The report contains a series of follow-up actions and an updated account from 2019 — when the cartographic and photo-interpretive study was requested — through official memorandum CARTA-SINAC-ACT-DR-1064-2026 dated June 19, 2026, in which the Municipal Council of Nicoya is requested to provide municipal support to remove the stone paving at the mouth of Estero Lagarto and to carry out the necessary soil study for the boundary demarcation (amojonamiento) of the mangrove of Estero Lagarto. A link to the case file, accessible for verification of actions and other proceedings in progress, is attached: EXPEDIENTE ACTOR-DR-390-2024 ESTERIO RIO LAGARTO, along with the actions carried out in compliance with the order.
That this Administration has been conducting multiple technical, legal, and administrative proceedings aimed at complying with the Chamber's order, as reflected in the submitted report, recovery plan, and documented actions. Notwithstanding the foregoing, it is necessary to note that the twelve-month period granted is not materially or technically sufficient to achieve the full implementation of the required actions, given the high complexity of the case, which is set out below:
1. Technical and Environmental Complexity. The affected ecosystem is a mangrove, which has been significantly altered by fill material, requiring interventions that are highly complex from a technical and logistical standpoint. Moreover, the removal of fill material cannot be carried out immediately or on a massive scale, as this would generate severe negative impacts, particularly on the nearby coral reef, which has been duly documented in the technical studies.
2. Legal Complexity. The area overlaps with private properties and concessions, which makes it necessary to develop parallel legal proceedings for the recovery of the public domain, proceedings that have timelines which do not depend exclusively on the Administration.
3. Existence of a Formal Technical Proposal. An official proposal exists entitled "Mangrove Rehabilitation over a Longer Timeframe, with the Least Possible Intervention and the Least Environmental Impact," which establishes a ten-year implementation schedule, considering: a. Gradual interventions. b. Progressive restoration. c. Continuous monitoring. d. Control of environmental impacts.
4. Material Impossibility of Compliance within 12 Months. The required actions include: a. Legal recovery of land. b. Hydrological works. c. Progressive removal of fill material. d. Ecological restoration of the mangrove. These actions, by their very nature, cannot be carried out within a period of 12 months without compromising the effectiveness of the process or generating additional environmental damage.
5. Principle of Reasonableness and Environmental Protection. It must be considered that hasty implementation could run contrary to the constitutional objective of environmental protection, given that incorrect or accelerated interventions could aggravate the damage rather than repair it. (…)."
III.In light of the foregoing, the alleged contempt is not established. Indeed, while by judgment No. 2024-015681 of 09:30 hours on June 7, 2024, this Chamber ordered SINAC to carry out the relevant actions and coordination so that, within twelve months, the necessary studies would be conducted to determine the actual state of the reported problem and to provide a definitive solution — and that period has now expired — the evidence on record (autos) shows that the respondent authorities have maintained actions directed toward compliance with the order. In that regard, they established the formation of a technical-legal committee, the preparation of a proposal for the recovery and rehabilitation of the mangrove of Estero Lagarto, the conduct of specialized studies, the definition of technical intervention alternatives, and the execution of various interinstitutional coordination measures aimed at restoring the ecosystem.
While the authorities acknowledge that it has not been possible to complete the full implementation of the planned measures within the period set by this Tribunal, they also explain, with technical support, that the environmental, legal, and material complexity of the case requires the progressive implementation of actions related to the delimitation of the State Natural Heritage, the recovery of land, the removal of fill material, the execution of hydrological works, and the ecological rehabilitation of the mangrove — all of which require planning, specialized studies, and coordinated intervention by various public institutions. Under that understanding, the order issued by this Chamber must be interpreted reasonably and in accordance with the nature of the mandate imposed, such that the obligation of the authorities consisted in deploying, within the time period granted, the technical and administrative actions necessary to advance the resolution of the reported environmental problem — and not necessarily in achieving, within that same period, the material and definitive restoration of the ecosystem, a result that, by its very nature, depends on technical, environmental, and temporal variables that exceed the sphere of the Administration's immediate control.
That being said, although the moving party (gestionante) expresses dissatisfaction with the progress of the process and with the absence of certain recovery works, such allegations do not support the conclusion that there exists an attitude of defiance or contempt toward the order issued by this Chamber, as the case record shows that the Administration has continued to carry out concrete actions aimed at compliance with the ruling. Consequently, since unjustified inactivity or deliberate non-compliance with the judgment has not been established, the appropriate course of action is to dismiss the present contempt motion, without prejudice to the duty of the respondent authorities to continue to execute, with the greatest diligence and within a reasonable period, the actions necessary to achieve the objective pursued by the judgment.
The parties are hereby notified that if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the court office (despacho) within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del treinta de junio de dos mil veintiseis .
Gestión de inejecución formulada en el recurso de amparo N.° 24-003134- 0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) y la MUNICIPALIDAD DE NICOYA.
RESULTANDO:
“(…) II. SOBRE EL INFORME SOLICITADO. El presente informe se rinde respecto a los hechos atribuidos al Sistema Nacional de Áreas de Conservación, en el que se acusa desobediencia a lo ordenado por la Sala en la resolución No. 2024015681 de las 09 horas con 30 minutos del día 07 de junio del 2024, toda vez que en esa resolución se dispuso lo siguiente: Sobre los hechos alegados por el recurrente, en resumen, señala lo siguiente: “Se declara con lugar el recurso, únicamente en contra del Sistema Nacional de Áreas de Conservación. Se ordena a David Chavarría Morales, director ejecutivo a.i. y a Nelson Marín Mora, director regional del Área de Conservación Tempisque (ACT), ambos del Sistema Nacional de Áreas de Conservación (SINAC) para que dentro del ámbito de sus competencias: a) adopten y giren las acciones necesarias, para que en el plazo de UN MES a partir de la notificación de esta sentencia, se brinde respuesta como corresponda a la denuncia planteada por el recurrente en fecha 08 de abril de 2022 y se le comunique lo resuelto; b) Asimismo, realizar las acciones y coordinaciones pertinentes, para que en el plazo de DOCE MESES contados a partir de la notificación de esta sentencia, se efectúen los estudios necesarios y que correspondan a fin de determinar la situación real de la problemática denunciada y brindar una solución definitiva.
(...)" III. ACLARACION PRELIMINAR SOBRE EL ALCANCE SEGÚN COMPETENCIA DEL MINAE Y SINAC. De conformidad con el artículo 50 de la Constitución Política, toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado, correspondiendo al Estado garantizar, defender y preservar ese derecho. Asimismo, el artículo 11 constitucional obliga a los funcionarios públicos a actuar dentro del marco de competencias legalmente atribuidas, sin arrogarse facultades que el ordenamiento no les concede. Los artículos 21 y 50 constitucionales imponen, además, deberes positivos de tutela de la vida, la salud y el ambiente. Conforme al artículo 11 de la Constitución Política, los funcionarios públicos son simples depositarios de la autoridad y no pueden arrogarse facultades que la ley no les concede; y el artículo 50 reconoce el derecho a un ambiente sano y ecológicamente equilibrado, cuyo resguardo debe ejercerse dentro del marco competencial previsto por el ordenamiento.
El SINAC, creado por la Ley de Biodiversidad №7788, integra las competencias en materia forestal, vida silvestre y áreas protegidas. Dentro de ese marco, le corresponde intervenir en lo relativo a la tutela ambiental asociada a recursos naturales. IV. SOBRE LA ACUSACION POR DESOBEDIENCIA. En relación con la acusación por desobediencia, no lleva razón el recurrente, en virtud que la institución ha dado respuesta constante a lo ordenado por la Sala en resolución número 2024015681 de las 09 horas con 30 minutos del día 07 de junio del 2024, pero sí acepta que el caso es complejo y requiere de más tiempo para cumplir con lo ordenado. El plazo de doce meses según lo estableció su Autoridad no es suficiente para resolver la situación. Al respecto es importante informar que el SINAC ha permanecido de forma constante realizando acciones en pro del cumplimiento de lo ordenado, al respecto se informa lo siguiente: 1.
CREACION DE COMISION TECNICA-LEGAL. Como primera acción fue necesario establecer una Comisión Técnica-Legal para la creación de una “Propuesta para la recuperación y rehabilitación del manglar del Estero Lagarto, Playa Sámara, Nicoya”, la cual después de analizar los insumos obtenidos, determina la recomendación y cronograma de actividades generales para la rehabilitación del manglar en una escala a tiempo mayor, con la menor intervención posible y menor impacto ambiental, un presupuesto estimado por actividad de la propuesta, cuyo objetivo general, determina una estrategia para la restauración del manglar del Estero Lagarto, Playa Sámara, Nicoya, a partir del análisis de los potenciales impactos ambientales, limitantes y condiciones requeridas para su restauración. En la propuesta se determinan los siguientes objetivos específicos: caracterizar la condición del manglar del Estero Lagarto, con base en los informes de campo e información de las fotografías aéreas del sitio; y analizar diferentes propuestas para la recuperación y rehabilitación del manglar del Estero Lagarto, con participación comunal y la aplicación de técnicas de regeneración acordes al sitio. 2.
PROPUESTAS DE RECUPERACIÓN. Asimismo, se crean tres propuestas de recuperación del manglar del Estero Lagarto, Playa Sámara, que se identifican como: Recuperación 01. Recuperación del patrimonio natural del Estado (PNE) como bosque natural, con 3 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con una cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones. 2. Promover el establecimiento de un bosque en el área del manglar, de manera que se recupere el PNE, a través de la promoción de acciones con la comunidad como campañas de reforestación y creación de senderos para el ecoturismo. 3. Fomentar la conectividad biológica del bosque hacia el sector suroeste, procurando que las especies se mantengan lejos de la zona urbana, previniendo el riesgo de electrocución de fauna arborícola. También señala las ventajas y desventajas Recuperación 02.
Rehabilitación del manglar en una escala de tiempo mayor, con la menor intervención posible y menor impacto ambiental, con 7 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con una cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones; 2. Reestablecer cauce de dominio público que se encuentra al noroeste del manglar, siguiente las coordenadas propuesta. Esto implica llevar el nivel adecuado para que el agua fluya desde la quebrada que fue desviada y hasta el estero, preferiblemente llegando al material original bajo el relleno. Se debe considerar que, al abrir un nuevo cauce, se deberá brindar el ancho que considere conveniente según criterio de la Dirección de Aguas del MINAE u otro criterio técnico. Además, se deberá retirar del sitio el material que se extraiga y disponerlo en un sitio fuera del área de manglar.
Se debe aclarar que la ruta propuesta requiere comprobación de campo, por lo que podría ser modificada, manteniendo la idea propuesta; 3. A partir del resultado de la rehabilitación del cauce de dominio público, se podrá valorar la conveniencia de realizar intervenciones de menor escala para ensanchar la entrada de agua del estero sobre la quebrada y con ello, acelerar la eliminación de material de relleno y fomentar la recuperación del manglar; 4. Reforestar en la parte externa con especies nativas características de los bosques de la zona para acelerar la creación de un bosque natural alrededor; mientras que en la parte nuclear se reforestará con especies de mangle: R. mangle, L. racemosa y A. germinans en las zonas en que se recupere el sustrato original; 5. Paulatinamente se deberá retirar relleno del manglar, en escala menor, iniciando desde la parte interna, y hacia el borde. Esto permitirá que el sedimento que llegue al mar sea asimilado por el ecosistema con menores posibilidades de daño en el arrecife de coral; 6.
Fomentar la conectividad biológica del bosque hacia el sector suroeste, procurando que las especies se mantengan lejos de la zona urbana, previniendo el riesgo de electrocución de fauna arborícola; 7. Retirar el empedrado en un tramo de al menos 85 m, de manera que se facilite que la erosión costera elimine en el largo plazo el relleno que hay sobre el borde del estero, con sus ventajas y desventajas analizadas. Recuperación 03. Rehabilitación de manglar en una escala de tiempo menor, con un nivel de intervención alto y mayor impacto ambiental, con 7 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones; 2. Retirar el relleno que se encuentra sobre el área de manglar, es decir, el estimado de 22.000 vagonetadas de 14 m³; 3. Reestablecer el cauce de dominio público en la sección de aproximadamente 30 m entre la calle pública y el borde del manglar.
De ese punto en adelante el cauce escurrirá por el manglar, de manera que irá establecimiento un nuevo cauce a medida que el agua se canalice de forma natural; 4. Retirar el empedrado en un tramo de al menos 180 m, de manera que se facilite que la erosión costera elimine en el largo plazo el relleno que hay sobre la duna y el borde del estero; y 5. Reforestar con especies nucleares del manglar, R. mangle, L. racemosa y A. germinans. La introducción de Rhizophora racemosa podría valorar en una etapa posterior. Estas acciones, también contienen el análisis de ventajas y desventajas. Todo lo manifestado y mayor información, se encuentra en la “PROPUESTA PARA LA RECUPERACIÓN Y REHABILITACION DEL MANGLAR DEL ESTERO LAGARTO, PLAYA SAMARA, NICOYA” el cual se adjunta como prueba del trabajo realizado, cuyo cronograma de actividades generales para su cumplimiento, se ha estimado a 10 años para lograr la recuperación del manglar. 3.
INFORME DE GESTIONES TECNICO-LEGALES. Mediante oficio SINAC-ACTOR-DT-1075-202 con fecha 22 de junio del 2026, el Sr. Mauricio Méndez Venegas, Director Técnico del Área de Conservación Tempisque, emite informe de actuaciones realizadas en el caso del Estero Río Lagarto, Playa Sámara acordes a lo solicitado mediante resolución No. 2024015681, del expediente judicial No. 24-0013134-0007-CO, el cual contiene una serie de acciones de seguimiento de lo actuado y que contiene un informe actualizado desde el año 2019 que solicitó el estudio cartográfico y foto interpretativo, hasta el oficio CARTA-SINAC-ACT-DR-1064-2026 con fecha 19 de junio del 2026, en el que se solicita al Concejo Municipal de Nicoya, apoyo municipal para retirar empedrado en desembocadura Estero Lagarto y efectuar el estudio de suelo necesario para realizar el amojonamiento del manglar del Estero Lagarto. Se adjunta vínculo del expediente que puede acceder para verificación de acciones y otras gestiones en proceso EXPEDIENTE ACTOR-DR-390-2024 ESTERIO RIO LAGARTO y actuaciones realizadas en el cumplimiento de la ordenado.
Que esta Administración, ha venido realizando múltiples gestiones técnicas, legales y administrativas, orientadas al cumplimiento de lo ordenado por la Sala, lo cual consta en el informe rendido, plan de recuperación y actuaciones documentadas. No obstante, lo anterior, resulta necesario indicar que el plazo otorgado de doce meses no es material, ni técnicamente suficiente para lograr la ejecución integral de las acciones requeridas, en virtud de la alta complejidad del caso, la cual se expone a continuación: 1. Complejidad técnica y ambiental. El ecosistema afectado corresponde a un manglar, el cual presenta una alteración significativa producto de rellenos, que implica intervenciones altamente complejas desde el punto de vista técnico y logístico. Asimismo, la remoción del material relleno no puede realizarse de forma inmediata, ni masiva, dado que generaría impactos negativos severos, particularmente sobre el arrecife coralino cercano, lo cual ha sido debidamente documentado en los estudios técnicos. 2.
Complejidad jurídica. El área presenta traslapes con propiedades privadas y concesiones, lo cual obliga a desarrollar procesos legales paralelos para la recuperación del dominio público, los cuales tienen plazos que no dependen exclusivamente de la Administración. 3. Existencia de propuesta técnica formal. Se cuenta con una propuesta oficial denominada “Rehabilitación del manglar en una escala de tiempo mayor, con la menor intervención posible y menor impacto ambiental”, la cual establece un cronograma de ejecución de diez años, considerando: a. Intervenciones graduales. b. Restauración progresiva. c. Monitoreo continuo. d. Control de impactos ambientales. 4. Imposibilidad material de cumplir en 12 meses. Las acciones requeridas incluyen: a. Recuperación legal de terrenos. b. Obras hidrológicas. c. Eliminación progresiva de relleno. d. Restauración ecológica del manglar. Estas actuaciones, por su naturaleza, no pueden ser ejecutadas en un período de 12 meses, sin comprometer la efectividad del proceso, ni generar daños ambientales adicionales. 5.
Principio de razonabilidad y protección ambiental. Debe considerarse que una ejecución apresurada podría resultar contraria al fin constitucional de protección del ambiente, dado que las intervenciones incorrectas o aceleradas podrían agravar el daño en lugar de repararlo. (…)”.
Solicitan se declare no ha lugar la gestión.
“(…) PRIMERO: Desde los recurridos presentan un informe muy vago de datos científicos o técnicos, que solo genera más incertidumbre, pues les informan a ustedes que tardarán 10 años en lograr la recuperación y con ello solo amplían la información genérica de que daño se mantendrá incólume a través de los años. SEGUNDO: Como se puede apreciar en el informe, a la fecha, el SINAC no ha terminado de elaborar los estudios determinantes, así como inequívocos, dentro de la ciencia y la técnica, necesarios para resolver el problema y menos ha encontrado, o buscado el presupuesto económico para brindar una solución definitiva a la problemática de la eliminación del humedal, por lo que se encuentran en desobediencia del voto y eso sigue manteniéndose igual que hace varios años. Nótese que los recurridos no les aclaran a ustedes el por qué no se toman decisiones concretas y solo señalan que el problema es complejo.
De hecho, les aportaron 3 opciones amplísimas de restauración y recuperación, pero las mismas están carentes de contenido presupuestario, ni tampoco existe un cronograma de cada paso que darán y ello solo evidencia que darle efectividad al voto, es algo plagado de un gran vacío de información por la dolosa inacción estatal. Conforme al principio de tutela científica deberían ser totalmente claros y señalar cuál es la ruta y el qué y cómo harán lo oportuno, pero ustedes solo ven unas propuestas carentes de contenido y por ello se sostiene la desobediencia pedida. A la fecha, sin un cronograma de actividades y sin tener claridad de la forma en que se restaurará el manglar eliminado, es como si estuviéramos en cero y así se pide declarar y no aceptar los 10 años, que no se sabe de dónde salen, por qué no 5 o 15 años sería lo necesario y es todo ello denota que, si ni siquiera saben la ruta óptima y vital.
Es decir, para cualquier planificador serio, el tiempo, el cronograma de actividades y el presupuesto son básicos, pero el informe NO DICE NADA, entonces de ¿dónde salió ese decenio? Deseo insistir que NO existe, de acuerdo a la ciencia y la técnica, una propuesta seria que se mantenga y prueba de ello es que ustedes no verán como dije, en el informe un cronograma ni tentativo, por lo que, como sociedad civil, el suscrito y la comunidad estamos en franca violación al derecho de información y de transparencia. TERCERO: De vital importancia es considerar, que ustedes no verán tampoco las acciones tendientes a la eliminación de las rocas puestas al frente de la playa que impiden el ingreso del mar y la conexión con el río y solo dicen, que eliminar ese material causará un daño, pero NO justifican nada dentro de la ciencia y la técnica. Es decir, sino sacan las rocas del frente a la costa ¿qué credibilidad tiene la petición de que en 10 años algo harán?
CUARTO: Tampoco se señala nada sobre los eventos masivos que se realizan cada año en el sitio que antes ocupaba el humedal y esto es muy serio, pues denota inacción y pasividad en un terreno que sería PATRIMONIO NATURAL DEL ESTADO tanto dentro como fuera de la zona marítimo terrestre. Ellos señalan que hay complejidad con la propiedad privada, pero qué más aportan en el informe: NADA. Y ello se debe a que no están haciendo nada. QUINTO: De hecho, les aporto incluso fotografías del día de hoy, donde un equipo de trabajo está realizando perforaciones aparentemente (por los datos obtenidos por los vecinos, con los muchachos de la obra,) para hacer un estudio de suelos para edificar casas o condominios y esto no debería estar siendo permitido por el SINAC, pues es una prueba de que se puede iniciar el desarrollo un proyecto urbanístico en el sitio en cualquier momento, lo cual truncaría la recomposición del ecosistema que se busca restaurar debido a esa inercia dolosa y de mala fe estatal.
(…) Dicho de otra forma, mientras se discute la desobediencia ante la Sala, empresarios ya comienzan a hacer estudios para hacer construcciones en el sitio del humedal y SINAC no hace lo oportuno y solo pide 10 años. (…)” Solicita declarar con lugar la gestión.
“(…) SEGUNDO: A la fecha han transcurrido más de VEINTICUATRO meses desde el dictado de la sentencia, sin que los recurridos hayan ejecutado las actuaciones necesarias para brindar la solución definitiva ordenada por este Tribunal, incumpliendo de manera evidente el mandato constitucional y plazo que supera ampliamente el término máximo de doce meses otorgado por esta Sala para el cumplimiento integral de lo ordenado. TERCERO: El incumplimiento resulta objetivo y plenamente verificable. Lejos de acreditar el cumplimiento de la sentencia dentro del plazo fijado, los propios recurridos, mediante oficio CARTA-MINAE-DAJ-1527-2026, de fecha 22 de junio de 2026, reconocen que pretenden ejecutar las acciones ordenadas en un plazo aproximado de diez años, sin que hayan aportado criterio técnico alguno que justifique su necesidad, desconociendo el plazo judicial de doce meses fijado por esta Sala.
CAURTO: Debe recordarse que el Estado es el primer obligado a cumplir la ley. La Administración Pública solo puede actuar conforme al principio de legalidad; por ello, resulta inadmisible que sea la propia Administración la que desacate una sentencia de esta Sala, desconociendo el orden jurídico que tiene el deber de proteger y hacer respetar. La Administración no puede modificar unilateralmente una orden judicial firme. Su conducta constituye un incumplimiento manifiesto de la sentencia y una desobediencia a la autoridad de esta Sala. Debe destacarse, además, que el objeto del recurso de amparo consiste en la protección de bienes de dominio público y del patrimonio natural del Estado, circunstancia que torna aún más grave la persistencia del incumplimiento, dada la naturaleza de los intereses públicos tutelados. (…)” Solicita declarar con lugar la gestión.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
En la sentencia Nombre02°. 2024-015681 de las 09:30 horas del 7 de junio de 2024, esta Sala dispuso lo siguiente: “Se declara con lugar el recurso, únicamente en contra del Sistema Nacional de Áreas de Conservación. Se ordena a David Chavarría Morales, director ejecutivo a.i y a Nelson Marín Mora, director regional del Área de Conservación Tempisque (ACT), ambos del del Sistema Nacional de Áreas de Conservación (SINAC), para que dentro del ámbito de sus competencias: a) adopten y giren las acciones necesarias, para que en el plazo de UN MES a partir de la notificación de esta sentencia, se brinde respuesta como corresponda a la denuncia planteada por el recurrente en fecha 08 de abril de 2022 y se le comunique lo resuelto; b) Asimismo, realizar las acciones y coordinaciones pertinentes, para que en el plazo de DOCE MESES contados a partir de la notificación de esta sentencia, se efectúen los estudios necesarios y que correspondan a fin de determinar la situación real de la problemática denunciada y brindar una solución definitiva. (…)”.
II.El recurrente y el coadyuvante en el presente asunto, acusaron la inejecución de lo dispuesto en la sentencia N°. 2024-015681 de las 09:30 horas del 7 de junio de 2024, pues aducen que el SINAC no ha concluido los estudios necesarios para dar cumplimiento a la orden girada por esta Sala, no ha gestionado los recursos presupuestarios requeridos ni ha ejecutado acciones concretas de coordinación con la Municipalidad para eliminar los diques y rellenos que impiden la recuperación del humedal y manglar, por lo que las condiciones del sitio permanecen inalteradas desde la interposición del amparo. Añade que no existe un plan o cronograma de ejecución y denuncia que continúan autorizándose actividades en la zona que obstaculizan su restauración, por lo que considera que persiste el incumplimiento de lo ordenado por este Tribunal.
Al respecto, las autoridades recurridas indicaron lo siguiente: “(…) II. SOBRE EL INFORME SOLICITADO. El presente informe se rinde respecto a los hechos atribuidos al Sistema Nacional de Áreas de Conservación, en el que se acusa desobediencia a lo ordenado por la Sala en la resolución No. 2024015681 de las 09 horas con 30 minutos del día 07 de junio del 2024, toda vez que en esa resolución se dispuso lo siguiente: Sobre los hechos alegados por el recurrente, en resumen, señala lo siguiente: “Se declara con lugar el recurso, únicamente en contra del Sistema Nacional de Áreas de Conservación. Se ordena a David Chavarría Morales, director ejecutivo a.i. y a Nelson Marín Mora, director regional del Área de Conservación Tempisque (ACT), ambos del Sistema Nacional de Áreas de Conservación (SINAC) para que dentro del ámbito de sus competencias: a) adopten y giren las acciones necesarias, para que en el plazo de UN MES a partir de la notificación de esta sentencia, se brinde respuesta como corresponda a la denuncia planteada por el recurrente en fecha 08 de abril de 2022 y se le comunique lo resuelto; b) Asimismo, realizar las acciones y coordinaciones pertinentes, para que en el plazo de DOCE MESES contados a partir de la notificación de esta sentencia, se efectúen los estudios necesarios y que correspondan a fin de determinar la situación real de la problemática denunciada y brindar una solución definitiva.
(...)" III. ACLARACION PRELIMINAR SOBRE EL ALCANCE SEGÚN COMPETENCIA DEL MINAE Y SINAC. De conformidad con el artículo 50 de la Constitución Política, toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado, correspondiendo al Estado garantizar, defender y preservar ese derecho. Asimismo, el artículo 11 constitucional obliga a los funcionarios públicos a actuar dentro del marco de competencias legalmente atribuidas, sin arrogarse facultades que el ordenamiento no les concede. Los artículos 21 y 50 constitucionales imponen, además, deberes positivos de tutela de la vida, la salud y el ambiente. Conforme al artículo 11 de la Constitución Política, los funcionarios públicos son simples depositarios de la autoridad y no pueden arrogarse facultades que la ley no les concede; y el artículo 50 reconoce el derecho a un ambiente sano y ecológicamente equilibrado, cuyo resguardo debe ejercerse dentro del marco competencial previsto por el ordenamiento.
El SINAC, creado por la Ley de Biodiversidad №7788, integra las competencias en materia forestal, vida silvestre y áreas protegidas. Dentro de ese marco, le corresponde intervenir en lo relativo a la tutela ambiental asociada a recursos naturales. IV. SOBRE LA ACUSACION POR DESOBEDIENCIA. En relación con la acusación por desobediencia, no lleva razón el recurrente, en virtud que la institución ha dado respuesta constante a lo ordenado por la Sala en resolución número 2024015681 de las 09 horas con 30 minutos del día 07 de junio del 2024, pero sí acepta que el caso es complejo y requiere de más tiempo para cumplir con lo ordenado. El plazo de doce meses según lo estableció su Autoridad no es suficiente para resolver la situación. Al respecto es importante informar que el SINAC ha permanecido de forma constante realizando acciones en pro del cumplimiento de lo ordenado, al respecto se informa lo siguiente: 1.
CREACION DE COMISION TECNICA-LEGAL. Como primera acción fue necesario establecer una Comisión Técnica-Legal para la creación de una “Propuesta para la recuperación y rehabilitación del manglar del Estero Lagarto, Playa Sámara, Nicoya”, la cual después de analizar los insumos obtenidos, determina la recomendación y cronograma de actividades generales para la rehabilitación del manglar en una escala a tiempo mayor, con la menor intervención posible y menor impacto ambiental, un presupuesto estimado por actividad de la propuesta, cuyo objetivo general, determina una estrategia para la restauración del manglar del Estero Lagarto, Playa Sámara, Nicoya, a partir del análisis de los potenciales impactos ambientales, limitantes y condiciones requeridas para su restauración. En la propuesta se determinan los siguientes objetivos específicos: caracterizar la condición del manglar del Estero Lagarto, con base en los informes de campo e información de las fotografías aéreas del sitio; y analizar diferentes propuestas para la recuperación y rehabilitación del manglar del Estero Lagarto, con participación comunal y la aplicación de técnicas de regeneración acordes al sitio. 2.
PROPUESTAS DE RECUPERACIÓN. Asimismo, se crean tres propuestas de recuperación del manglar del Estero Lagarto, Playa Sámara, que se identifican como: Recuperación 01. Recuperación del patrimonio natural del Estado (PNE) como bosque natural, con 3 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con una cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones. 2. Promover el establecimiento de un bosque en el área del manglar, de manera que se recupere el PNE, a través de la promoción de acciones con la comunidad como campañas de reforestación y creación de senderos para el ecoturismo. 3. Fomentar la conectividad biológica del bosque hacia el sector suroeste, procurando que las especies se mantengan lejos de la zona urbana, previniendo el riesgo de electrocución de fauna arborícola. También señala las ventajas y desventajas Recuperación 02.
Rehabilitación del manglar en una escala de tiempo mayor, con la menor intervención posible y menor impacto ambiental, con 7 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con una cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones; 2. Reestablecer cauce de dominio público que se encuentra al noroeste del manglar, siguiente las coordenadas propuesta. Esto implica llevar el nivel adecuado para que el agua fluya desde la quebrada que fue desviada y hasta el estero, preferiblemente llegando al material original bajo el relleno. Se debe considerar que, al abrir un nuevo cauce, se deberá brindar el ancho que considere conveniente según criterio de la Dirección de Aguas del MINAE u otro criterio técnico. Además, se deberá retirar del sitio el material que se extraiga y disponerlo en un sitio fuera del área de manglar.
Se debe aclarar que la ruta propuesta requiere comprobación de campo, por lo que podría ser modificada, manteniendo la idea propuesta; 3. A partir del resultado de la rehabilitación del cauce de dominio público, se podrá valorar la conveniencia de realizar intervenciones de menor escala para ensanchar la entrada de agua del estero sobre la quebrada y con ello, acelerar la eliminación de material de relleno y fomentar la recuperación del manglar; 4. Reforestar en la parte externa con especies nativas características de los bosques de la zona para acelerar la creación de un bosque natural alrededor; mientras que en la parte nuclear se reforestará con especies de mangle: R. mangle, L. racemosa y A. germinans en las zonas en que se recupere el sustrato original; 5. Paulatinamente se deberá retirar relleno del manglar, en escala menor, iniciando desde la parte interna, y hacia el borde. Esto permitirá que el sedimento que llegue al mar sea asimilado por el ecosistema con menores posibilidades de daño en el arrecife de coral; 6.
Fomentar la conectividad biológica del bosque hacia el sector suroeste, procurando que las especies se mantengan lejos de la zona urbana, previniendo el riesgo de electrocución de fauna arborícola; 7. Retirar el empedrado en un tramo de al menos 85 m, de manera que se facilite que la erosión costera elimine en el largo plazo el relleno que hay sobre el borde del estero, con sus ventajas y desventajas analizadas. Recuperación 03. Rehabilitación de manglar en una escala de tiempo menor, con un nivel de intervención alto y mayor impacto ambiental, con 7 acciones requeridas en las que se encuentran: 1. Delimitar el sitio con cerca de alambre de púas (950 m) para mantener animales domésticos fuera del área de recuperación, así como para prevenir nuevas invasiones; 2. Retirar el relleno que se encuentra sobre el área de manglar, es decir, el estimado de 22.000 vagonetadas de 14 m³; 3. Reestablecer el cauce de dominio público en la sección de aproximadamente 30 m entre la calle pública y el borde del manglar.
De ese punto en adelante el cauce escurrirá por el manglar, de manera que irá establecimiento un nuevo cauce a medida que el agua se canalice de forma natural; 4. Retirar el empedrado en un tramo de al menos 180 m, de manera que se facilite que la erosión costera elimine en el largo plazo el relleno que hay sobre la duna y el borde del estero; y 5. Reforestar con especies nucleares del manglar, R. mangle, L. racemosa y A. germinans. La introducción de Rhizophora racemosa podría valorar en una etapa posterior. Estas acciones, también contienen el análisis de ventajas y desventajas. Todo lo manifestado y mayor información, se encuentra en la “PROPUESTA PARA LA RECUPERACIÓN Y REHABILITACION DEL MANGLAR DEL ESTERO LAGARTO, PLAYA SAMARA, NICOYA” el cual se adjunta como prueba del trabajo realizado, cuyo cronograma de actividades generales para su cumplimiento, se ha estimado a 10 años para lograr la recuperación del manglar. 3.
INFORME DE GESTIONES TECNICO-LEGALES. Mediante oficio SINAC-ACTOR-DT-1075-202 con fecha 22 de junio del 2026, el Sr. Mauricio Méndez Venegas, Director Técnico del Área de Conservación Tempisque, emite informe de actuaciones realizadas en el caso del Estero Río Lagarto, Playa Sámara acordes a lo solicitado mediante resolución No. 2024015681, del expediente judicial No. 24-0013134-0007-CO, el cual contiene una serie de acciones de seguimiento de lo actuado y que contiene un informe actualizado desde el año 2019 que solicitó el estudio cartográfico y foto interpretativo, hasta el oficio CARTA-SINAC-ACT-DR-1064-2026 con fecha 19 de junio del 2026, en el que se solicita al Concejo Municipal de Nicoya, apoyo municipal para retirar empedrado en desembocadura Estero Lagarto y efectuar el estudio de suelo necesario para realizar el amojonamiento del manglar del Estero Lagarto. Se adjunta vínculo del expediente que puede acceder para verificación de acciones y otras gestiones en proceso EXPEDIENTE ACTOR-DR-390-2024 ESTERIO RIO LAGARTO y actuaciones realizadas en el cumplimiento de la ordenado.
Que esta Administración, ha venido realizando múltiples gestiones técnicas, legales y administrativas, orientadas al cumplimiento de lo ordenado por la Sala, lo cual consta en el informe rendido, plan de recuperación y actuaciones documentadas. No obstante, lo anterior, resulta necesario indicar que el plazo otorgado de doce meses no es material, ni técnicamente suficiente para lograr la ejecución integral de las acciones requeridas, en virtud de la alta complejidad del caso, la cual se expone a continuación: 1. Complejidad técnica y ambiental. El ecosistema afectado corresponde a un manglar, el cual presenta una alteración significativa producto de rellenos, que implica intervenciones altamente complejas desde el punto de vista técnico y logístico. Asimismo, la remoción del material relleno no puede realizarse de forma inmediata, ni masiva, dado que generaría impactos negativos severos, particularmente sobre el arrecife coralino cercano, lo cual ha sido debidamente documentado en los estudios técnicos. 2.
Complejidad jurídica. El área presenta traslapes con propiedades privadas y concesiones, lo cual obliga a desarrollar procesos legales paralelos para la recuperación del dominio público, los cuales tienen plazos que no dependen exclusivamente de la Administración. 3. Existencia de propuesta técnica formal. Se cuenta con una propuesta oficial denominada “Rehabilitación del manglar en una escala de tiempo mayor, con la menor intervención posible y menor impacto ambiental”, la cual establece un cronograma de ejecución de diez años, considerando: a. Intervenciones graduales. b. Restauración progresiva. c. Monitoreo continuo. d. Control de impactos ambientales. 4. Imposibilidad material de cumplir en 12 meses. Las acciones requeridas incluyen: a. Recuperación legal de terrenos. b. Obras hidrológicas. c. Eliminación progresiva de relleno. d. Restauración ecológica del manglar. Estas actuaciones, por su naturaleza, no pueden ser ejecutadas en un período de 12 meses, sin comprometer la efectividad del proceso, ni generar daños ambientales adicionales. 5.
Principio de razonabilidad y protección ambiental. Debe considerarse que una ejecución apresurada podría resultar contraria al fin constitucional de protección del ambiente, dado que las intervenciones incorrectas o aceleradas podrían agravar el daño en lugar de repararlo. (…)”.
III.En virtud de lo expuesto, no se acredita la desobediencia alegada. En efecto, si bien mediante la sentencia n.° 2024-015681 de las 09:30 horas del 7 de junio de 2024 esta Sala ordenó al Sistema Nacional de Áreas de Conservación realizar las acciones y coordinaciones pertinentes para que, dentro del plazo de doce meses, se efectuaran los estudios necesarios a fin de determinar la situación real de la problemática denunciada y brindar una solución definitiva, y dicho plazo se encuentra vencido, de la prueba que consta en autos se desprende que las autoridades recurridas han mantenido actuaciones dirigidas al cumplimiento de lo ordenado. En ese sentido, acreditaron la conformación de una comisión técnico-legal, la elaboración de una propuesta para la recuperación y rehabilitación del manglar del Estero Lagarto, la realización de estudios especializados, la definición de alternativas técnicas de intervención y la ejecución de diversas coordinaciones interinstitucionales orientadas a la restauración del ecosistema.
Si bien las autoridades reconocen que no ha sido posible culminar la ejecución integral de las medidas previstas dentro del plazo fijado por este Tribunal, también explican, con sustento técnico, que la complejidad ambiental, jurídica y material del caso exige la ejecución progresiva de actuaciones relacionadas con la delimitación del patrimonio natural del Estado, la recuperación de terrenos, la remoción de rellenos, la ejecución de obras hidrológicas y la rehabilitación ecológica del manglar, las cuales requieren planificación, estudios especializados y la intervención coordinada de distintas instituciones públicas. Bajo ese entendido, la orden emitida por esta Sala debe interpretarse de manera razonable y conforme a la naturaleza del mandato impuesto, de forma que la obligación de las autoridades consistía en desplegar, dentro del plazo conferido, las actuaciones técnicas y administrativas necesarias para encaminar la solución de la problemática ambiental denunciada y no en alcanzar, necesariamente dentro de ese mismo término, la restauración material y definitiva del ecosistema, resultado que, por su propia naturaleza, depende de variables técnicas, ambientales y temporales que exceden el ámbito de control inmediato de la Administración.
Así las cosas, aunque el gestionante manifiesta su inconformidad con el avance del proceso y con la ausencia de determinadas obras de recuperación, tales alegatos no permiten concluir que exista una actitud de renuencia o desacato frente a lo ordenado por esta Sala, pues del expediente se desprende que la Administración ha continuado ejecutando actuaciones concretas encaminadas al cumplimiento del fallo. En consecuencia, al no acreditarse una inactividad injustificada ni un incumplimiento deliberado de la sentencia, lo procedente es desestimar la presente gestión de desobediencia, sin perjuicio del deber que mantienen las autoridades recurridas de continuar ejecutando, con la mayor diligencia y dentro de un plazo razonable, las actuaciones necesarias para alcanzar la finalidad perseguida por en la sentencia.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
No ha lugar a la gestión. Notifíquese.
