Amparo proceeding filed by [Nombre 001], identity card [Valor 001], against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO COMUNAL DE UVITA Y BAHÍA DE OSA.
Background:
“1. First, it must be said that the petitioner’s wording is unclear, since apparent questions are followed by answers, without making it very clear what is being requested; we will therefore respond subject to those limitations. 2. We reject each and every one of the statements made by the amparo applicant against the ASADA I represent, and respond to them below. 3. By way of historical context and background, it is important to note that the neighborhood, hamlet, or community known as La Guágara is an area north of Uvita, in Bahía Ballena de Osa, which is not, and has never been, part of the aqueduct administered and operated by our ASADA. For nearly 30 years, it has apparently been supplied through an informal supply system, in an unlawful manner. In other words, it is outside the coverage area of the aqueduct administered and operated by this ASADA. 4. In a telephone inquiry to the Southern Zone Water Directorate Office, located in Pérez Zeledón, we were told that the Sociedad de Usuarios de Agua de La Guágara was established in that community in February 1996 and registered under number 201-S. However, it has never applied for a water concession in its name. 5. It appears that in May 2019, the Water Directorate notified the residents of La Guágara of a communication stating, in essence, that MINAE, pursuant to Articles 17 and 168 of the Water Law, provides that a concession must be granted in order to use water, and that authorization is issued by MINAE following an application to the Water Directorate. Since they do not have a concession, they must, within 10 days and in accordance with Article 264 of the General Law of Public Administration, cease the unlawful use by removing the structures built. In the event of noncompliance, the State may take the corresponding criminal actions. If they fail to comply, the actions taken are deemed notified within 24 hours, under Ley 7637, and a criminal complaint will subsequently be filed for the offenses of disobedience and unlawful appropriation of water. 6. Over the years, residents of La Guágara have thus made attempts to organize and build an aqueduct to hand over to the ASADA of Uvita, especially since they were notified in 2019. 7. In none of the attempts initiated by residents of La Guágara has this ASADA been part of the project. Our participation has always consisted of expressing our willingness to receive an aqueduct project once it has been built and fully accepted by AyA; the ASADA would then receive it and, from that point onward, begin administering it under the same conditions as the neighborhoods and hamlets within the ASADA’s coverage area, all in accordance with the regulations governing this matter, primarily laws and regulations issued by AyA and ARESEP. 8. With regard to this case, first, this Chamber should be informed that neither Lic. [Nombre 001] nor his associate, [Nombre 003], is a member of this Association or a user of the services supplied by the ASADA. 9. The first information request received was from [Nombre 003], who works with Lic. [Nombre 001]. Her first communication was by email, without formalities or a digital signature. Even so, she was answered through the same channel, with emphasis on the fact that the organization of residents of the La Guágara area to build an aqueduct follows arrangements in which the ASADA neither participates nor is responsible for the projects. The only matter in which we are taken into account is to express our willingness to receive the future aqueduct once it is operational and completed to AyA’s satisfaction, since AyA is the entity responsible for reviewing and supervising the project. 10. She later sent another email under similar conditions, and some of the preceding points were reiterated, this time in a digitally signed letter from Lic. Andrés Ríos Ortiz, ASADA Administrator, emphasizing that: ‘Finally, and no less important, upon reviewing your request to the ASADA, you have not established your authority to act before our Association or identified whom you represent. We therefore ask that you send the information and attached documents by email to the address indicated, as digitally signed documents, or in physical form submitted at our public service desk. All of this is in accordance with Article 285 of the General Law of Public Administration: “Article 285.- 1. A party’s petition shall contain: a) Identification of the office to which it is addressed; b) The party’s first and last names, residence, and place for service of notices, and those of the party’s representative; c) The relief sought, specifying any damages claimed and their estimated amount, origin, and nature; d) The grounds in fact; and e) The date and signature. 2. Failure to meet the requirements listed in subsections b) and c) shall require rejection and filing of the petition, unless they can be clearly inferred from the brief or attached documents. 3. Failure to sign shall necessarily result in rejection and filing of the petition.” And likewise, in accordance with Article 4 of Ley 9097, Law Regulating the Right of Petition: “ARTICLE 4.- Formal requirements for exercising the right of petition. a) Petitions shall be made in writing and must include the petitioner’s name, identity card or identity document, the subject matter, and the recipient. Each written petition must be signed by the petitioner or petitioners. As to other requirements or procedures not established in these rules but developed by regulation or by orders, instructions, or circulars, the principle of informality shall prevail in every petition so as to guarantee the free exercise of this right by all citizens. b) In the case of collective petitions, in addition to meeting the foregoing requirements, all petitioners shall sign, and each person’s first and last names shall appear alongside their signature. If all signatures are not included, the petition shall be deemed submitted only by those who signed it, without prejudice to subsequent correction or supplementation. c) The petitioner may indicate that they are exercising their right before another institution or body different from the one to which the petition was addressed, by sending it a copy of the written petition. …” 11. A new request from Lic. [Nombre 001], dated 3 March 2026, was then received as a digitally signed PDF, and on 16 March 2026 he was answered, reiterating the need to establish his public and legitimate interest, as follows: “As indicated in our earlier response to [Nombre 003], with regard to standing, neither you nor the person you represent has established a legitimate interest in your request. It has not been shown that you are a user of the ASADA of Uvita or a resident of the La Guágara area, nor have you shown that anyone meeting either of those conditions has granted you a special power of attorney; for that reason, your public or legitimate interest has not been established. For all of the foregoing reasons, you are urged to demonstrate your legitimate interest as required under the regulations previously sent to you.” 12. Later, on 24 March 2026, a meeting was called to discuss and update information about the La Guágara aqueduct project. Participants included AyA officials from both the UEN Región Brunca and AyA’s central offices in San José. Residents promoting the project, both Costa Rican and from other countries, were also present, as were Lic. [Nombre 001] and his associate [Nombre 003]. Naturally, some representatives of the Uvita ASADA were present as the future recipients of the works, but without any responsibility for developing the project, contracting construction or consulting firms, preparing designs, or providing approvals or supervision, which are the responsibility of AyA professionals. During that meeting, which lasted three hours, from 10:00 a.m. to 1:00 p.m. on 24 March 2026, all the topics were raised, and all attendees’ questions were discussed and answered. For our part, we were certain that Lic. [Nombre 001] had found all the answers he was seeking, since, as I reiterate, the meeting lasted at least three hours; representatives of the residents of La Guágara, who after all intend to finance the project works, were there, as were regional and national AyA authorities, who addressed each of the attendees’ inquiries, and our ASADA administrator. These were all people whom Lic. Pochet could see and hear in front of him, and whom he had the opportunity to question and ask to clarify his doubts. Minutes were taken at this meeting and issued under letter GSDUEN-GAR-2026-01471, signed by Engineer Mario Chavarría Gamboa of AyA’s ASADA Engineering Directorate. The minutes show which points were discussed, and an attendance log prepared by AyA is attached. It shows the signature of Lic. [Nombre 001]’s associate, [Nombre 003], along with her identity card number, cell phone number, and, importantly, the email address [...]. Since the email address identified by Lic. [Nombre 001] for service of notices is [...], we know that both belong to the same company. We do not know why Lic. [Nombre 001] did not sign the attendance log, but at the time he introduced himself to those present as Lic. [Nombre 001]. 13. After the meeting, as stated, Engineer Mario Chavarría of AyA issued minutes of the meeting, indicating, among other matters, the following: ‘Topics discussed • Clarification was provided regarding the technical and legal position of the ASADA and AyA, and that both participate at the design and construction stage solely to ensure compliance with standards, regulations, and laws. • Neither the ASADA nor AyA participates in collecting contributions from each project beneficiary. • Neither the ASADA nor AyA determines how the project is financed. • The ASADA and AyA stated that both are awaiting notification from the Comité de Agua La Guagara that work is commencing, so that both may inspect the works and ensure compliance with all permits required for construction. • From the outset, AyA and the ASADA emphasized the importance of the Project comprehensively covering the communities and roads served by the aqueduct. • AyA and the ASADA asked the Comité de Agua La Guagara to update flow measurements at the aqueduct’s sources of production, in order to validate the functionality and operation of the construction plans and the detailed budget for the works defined in 2025. • AyA and the ASADA are unwilling to receive microsystems for water supply within the coverage area of the La Guágara Project, given its integrated nature and the gravity-fed operation originally designed. • If the requested update to the flow measurements does not meet the expectations of the construction plans defined and approved by AyA in 2025 and their coverage for approximately 180 services, the first step would be to request restoration of the 3 springs that ceased to be part of the system; second, the incorporation of one or more sources of production would be requested in the construction plans, and the Technical Study would have to be updated to include this solution for the system’s production. • If a well is proposed for incorporation into the system to add more water to the La Guagara Drinking Water Supply Project, it must go through the requisite legal process before the Water Directorate. This “well” must be incorporated into the construction plans, and the Technical Study must be duly updated to account for it. In addition, the ASADA requests that if a well is incorporated into the system, it have backup electricity supplied by a diesel generator, due to the poor quality of ICE’s electric service in Uvita. • It is clarified that all pipes originally included to supply drinking water to the various sectors of the La Guagara project’s distribution network are located in municipal public roads or neighborhood roads; therefore, their route will not be changed even if residents and beneficiaries of the same system object based on an environmentalist view of the public right arising from the nature of the road that provides access to their properties.’ As can be seen, these points excerpted from the minutes answer practically all of Lic. [Nombre 001]’s concerns. Moreover, each of these points, and the others in the attached minutes, were discussed in greater detail during the meeting, where Lic. [Nombre 001] and his associate [Nombre 003] had the opportunity to ask questions, make inquiries, and clarify all their doubts directly with those managing the La Guágara aqueduct project and with AyA authorities. Also note that in the fifth point, which is underlined, both AyA and the ASADA maintain their position ‘…that the Project comprehensively cover the communities and roads served by the aqueduct.’ That is, all areas currently served by the existing (illegal and irregular) aqueduct are to be taken into consideration. Of course, I reiterate that our more active participation will begin once the works for the future aqueduct have been accepted to AyA’s full satisfaction and handed over to our Association, including not only the civil works but also all land needed for spring intakes and tanks, as well as all easements necessary for the proper operation and maintenance of the new system. 14. One of the amparo applicant’s questions concerns the future, which is uncertain, since, as already stated, attempts to build an aqueduct in La Guágara go back several years and have not yet materialized. We therefore do not know when or how this project will be built, or whether it will be built at all. However, in the hypothetical event that an aqueduct is built in La Guágara, accepted by AyA, and handed over to the Uvita ASADA, the ASADA would treat potential users in the same way as current users and applicants within the coverage area of our aqueduct, in accordance with the laws and regulations issued mainly by AyA and ARESEP. In the hypothetical event that AyA and the project developers enter into an agreement to apply Article 38 of the Urban Planning Law, which provides that new users who did not contribute to the cost of the aqueduct may, for a period of five years, be required to pay a proportional share of the initial investment, this would apply to future projects and developments, but not to organic growth or single-family homes. All of this is in accordance with Article 38 of Urban Planning Law No. 4240 and Agreement No. JD-2025-045, dated 17 February 2025, of AyA’s Board of Directors, entitled ‘Comprehensive Amendment to the Regulation for Applying Article 38 of the Urban Planning Law, No. 4240, to AyA Water and Sewer Works,’ an agreement published in Alcance No. 26 to La Gaceta No. 38 of 26 February 2025. Other than that, technical factors will affect the decisions issued by the ASADA on new requests, all in accordance with AyA’s Service Provision Regulation and the ‘Technical Regulation for the Provision of Aqueduct, Sanitary Sewer, and Hydrant Services (AR-RTPAAH-2015),’ issued by Resolution RJD-101-2014 of 22 September 2014 and its amendments, in the versions in force in the future. 15. With regard to legitimate public interest, specifically in the case of ASADAS, this Chamber has held (…) And, as indicated, neither Lic. [Nombre 001] nor [Nombre 003] is a member of the ASADA or a user of the services it provides. 16. Finally, it is important to note that most of the communication received from the private developers of the La Guágara project has concerned plans, sketches, and tables prepared by professionals hired by those interested parties. It is understood that these types of documents are protected by Ley 6883, ‘Law on Copyright and Related Rights,’ as established in Articles 1, 90, and 101 (…) SUMMARY This case, the subject of the amparo proceeding under case file No. 26-011911-0007-CO before the Constitutional Chamber, may be summarized as follows: The community of La Guágara is located north of the town of Uvita, in Bahía Ballena de Osa, and has never been part of the aqueduct administered by the ASADA I represent. Initially, it was a group of people, mainly farm owners, who established the Sociedad de Usuarios de Agua de La Guágara a little over 30 years ago, in February 1996, and registered it under number 201-S. They apparently began using water without having applied for a water concession in their name. The population of La Guágara grew in number, and its aqueduct network, apparently without professional designs, also began to grow. In May 2019, the Water Directorate notified residents that they had to cease using the water because they did not have concessions authorizing them to do so, and that otherwise they could be reported for criminal prosecution. Although residents had already tried before that date to build an integrated aqueduct to later transfer it to AyA or an ASADA, these efforts gained new momentum after 2019. Accordingly, the owners and users of the aqueduct or aqueducts built without permits or water-use concessions have organized to launch a new project, using their own funds and hiring private companies, just as hundreds of developments have been built in this country throughout its history, with the aqueduct later handed over to AyA or an ASADA. Since this is a private project managed by individuals or legal entities unaffiliated with the Uvita ASADA, using private funds and contracts with private construction or consulting firms, this ASADA’s only participation has been to give its approval in principle to receiving the aqueduct project once its construction is complete and it has been accepted to AyA’s full satisfaction. As the entity legally and regulatorily authorized to oversee it, AyA would accept the project, after which the ASADA would receive it, together with the land and easements needed for its operation. From that point, it could incorporate the project into the ASADA’s coverage area and administer and operate the system in full compliance with the laws and regulations governing this matter, issued primarily by AyA and ARESEP, and in keeping with all the principles of public service recognized and required by Costa Rican law. On the other hand, the amparo applicant, [Nombre 001], is neither an associate nor in any way affiliated with the Association I represent, and is not a user of the aqueduct administered by the Uvita ASADA. Accordingly, while his requests, made through [Nombre 003] and by him, were addressed within the prescribed time limits, they have not established a public and legitimate interest in their requests; rather, they appear to be based on a private interest. The constitutional case law set out in at least decisions No. 2011-015820, issued at 2:30 p.m. on 22 November 2011, and No. 2023-015629, of 30 June 2023, of this Constitutional Chamber therefore applies. It is also very important in resolving this case to reiterate that both [Nombre 003] and Lic. [Nombre 001] attended the meeting called by the private developers of the project, held on 24 March 2026 in Uvita de Osa, where AyA authorities at both the regional and national levels were also present and addressed and answered attendees’ questions. The inquiries of the aforementioned [Nombre 003] and [Nombre 001] were therefore also addressed by AyA, the developers, and even representatives of our ASADA. The main topics are recorded in the meeting minutes issued under letter GSD-UEN-GAR-2026-01471 and signed by Engineer Mario Chavarría Gamboa. Accordingly, it is unacceptable for Mr. [Nombre 001] now to say that he does not know the details of the project or that his questions were not addressed, despite the fact, I reiterate, that he has not yet established his legitimate interest in requesting information from private entities. Finally, it is important to note that many of the matters requested by the amparo applicant are hypothetical questions about an uncertain future, and it is therefore unclear what rights this amparo proceeding would protect. Even so, it has been stated, and is reiterated, that in the hypothetical event that a new aqueduct is built in the La Guágara area and handed over to this ASADA, residents would be treated on equal terms with the rest of the population supplied, in accordance with the principles governing the public water service and the laws and regulations governing this matter. For all of the foregoing reasons, the amparo proceeding must be dismissed” (sic).
Prepared by Justice Garro Vargas; and, Reasons:
I.The amparo proceeding filed against private-law entities. Given its exceptional nature, before considering amparo proceedings against private-law entities, it must first be examined whether the specific case falls within any of the circumstances that make such a proceeding admissible under the requirements of Article 57 of the Constitutional Jurisdiction Law; only then, if so, can it be determined whether the claim should be granted. The cited provision establishes that an amparo proceeding shall be granted against actions or omissions of private-law entities when they act or are required to act in the exercise of public functions or powers, or when they are in law or in fact in a position of power against which ordinary judicial remedies are clearly insufficient or too slow to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In this case, the proceeding is deemed admissible because ASADAS arose under the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados, Law No. 2726 of 14 April 1961, as amended.
In addition to establishing AyA as an autonomous State institution, that law empowered it to delegate the administration, operation, and maintenance of the aqueduct and sewer systems entrusted to it by the legislature to groups such as ASADAS, duly formed for that purpose, as follows from Article 2(g) of that Law. Accordingly, as associations administering rural aqueducts under an agreement with the Instituto Costarricense de Acueductos y Alcantarillados, they are, by law, in a position of power in relation to users.
II.Subject of the proceeding. The claimant states that since 2020 AyA, Calle Bejuco, La Guágara SRL, and the ASADA of Uvita and Bahía Osa have been coordinating development of the project called Acueducto Comunal La Guágara. The claimant therefore says they made various requests to the respondent ASADA to learn the project’s status; however, they complain that access has been restricted and denied, despite the information being of interest to the community and concerning the right of access to water, a matter of public and not private interest. The claimant requests the Chamber’s intervention.
III.Facts found. The following facts, relevant to the decision in this matter, are deemed duly established:
The claimant is not a member of or user of the ASADA of Uvita and Bahía Osa (see respondent’s answer); On 16 February 2026, [Nombre 003] sent an email to the addresses [...] and [...], requesting:
“Dear Sirs: Eduardo Antonio González, President of the Uvita ASADA; Andrés Ríos, Administrator of the Uvita ASADA: Greetings. At the direction of Lic. [Nombre 001], I am sending this email regarding the project to build an aqueduct known as La Guagara, about which I would like to raise a series of questions. According to communications from the developer, it has been indicated that property owners who do not make the corresponding contribution to the aqueduct in advance may not be included in the project, and that these service connections may eventually be offered to other future landowners or developments. However, homes have already been built in the area and there is a real and current need for water, which is being met through an irregular system; this is what gave rise to the need to carry out this work. In that regard, I ask that you tell us how the ASADA would handle this situation, particularly considering that the planned system includes the connection and needs of existing homes.
We would like to know how the scenario would be handled if the ASADA formally assumes provision of the service and there are people who did not make the initial contribution: would they be offered a connection upon payment of the applicable charge, or would they be excluded even if their properties are within the coverage area? We understand that the purpose of the development should first be to regularize the situation of those already using the water and meet the system’s current needs, prioritizing existing homes, and then to address new availability. No one would be required to connect; however, there should be a real possibility of doing so once the service is operational, upon payment of the cost applicable at that time. Thank you in advance for your attention. I await your response so that we may have clarity about how the ASADA is addressing this situation. The Licenciado has also tried several times to contact Mr.
Andrés by calling the ASADA, but has been unable to reach him. We would therefore like to request a virtual appointment” (see evidence submitted); On 16 February 2026, staff of the ASADA of Uvita and Bahía Osa gave the following reply:
“First, we wish to correct that the president of our ASADA is Mr. Diego Sibaja Monge. The name previously provided is not part of our Board of Directors. We also understand that Engineer Eduardo Antonio González is handling the relevant matters directly with the community’s Neighborhood Committee. We wish to clarify that the development of the project called Acueducto La Guágara is not part of an administrative process of our ASADA. With regard to this project, our participation has been limited exclusively to reviewing the construction designs submitted in the technical study conducted by the Neighborhood Committee, and issuing the necessary comments in strict accordance with AyA regulations. We are not part of the project’s administration and cannot guarantee its ultimate completion. It is imperative to point out that the current water supply is illegal and poses a risk to public health.
The Ministry of Health and the Municipalidad de Osa have already addressed this matter by requesting that users be disconnected; however, the ASADA has no legal authority in that disconnection process. Our official position to date has been to express our willingness to receive the project once its construction phase is complete and it complies with all AyA technical and legal requirements. At this stage, the project remains private, so this ASADA has no connection with its management until AyA formally approves the transfer of administration. 1. On the private nature of the project and responsibility for construction The AyA Service Provision Regulation, as amended, provides that works built by third parties are the developer’s responsibility until formally handed over: ‘Infrastructure works built by developers or subdividers [...] shall be their technical and financial responsibility until final acceptance by AyA or the corresponding ASADA.’ 2.
On ‘Willingness to Accept’ and acceptance of works The Regulation on Delegated Aqueducts and Sewers (ASADA Regulation), in its provisions on infrastructure, states: ‘The ASADA may express its willingness to receive systems built by third parties, provided they comply with the technical design and construction standards in force. Acceptance of the infrastructure does not make the ASADA responsible for the debts or administrative matters previously handled by the committee or private developer.’ 3. On the illegality of the current service The Service Provision Regulation, in its section on Illegal Connections, supports the position that a system without technical approval is illegal: ‘An illegal connection is any connection made without the service provider’s proper authorization or without approval of the required technical designs. Use of water sources unauthorized for human consumption empowers health authorities to order their immediate closure due to the health risk’ (see evidence submitted); On 17 February 2026, [Nombre 003] sent an email to the addresses [...] and [...], requesting:
“On several occasions we have called the ASADA, and a few weeks ago the Licenciado appeared in person. However, we note that the official channel for communicating with you is by email, so we will proceed accordingly going forward. We apologize for the confusion regarding the composition of the Board of Directors and duly note that the president of the ASADA is Mr. Diego Sibaja Monge. With regard to what you explained about the ASADA’s participation, we would be grateful if you could send us copies of the letters, technical opinions, comments, or any documents issued by the ASADA as part of its review of the designs for the Acueducto La Guágara project you mentioned, as well as any other formal communication related to the project in which the ASADA participated. Once you send us the documents and we have reviewed them, we would be grateful if you could arrange a virtual appointment at your convenience” (see evidence submitted); On 20 February 2026, the administrator of the ASADA of Uvita and Bahía Osa sent [Nombre 003] a letter, indicating:
“As stated in our previous response on the same subject, construction of private projects of this nature, when public services do not extend to the areas of interest to the developers, is authorized under Article 38 of the Ley de Planificación Urbana and pursuant to the regulation known as Comprehensive Amendment to the Regulation for the Application of Article 38 of the Ley de Planificación Urbana, Nº4240, for AyA Water and Sewerage Works, published in Alcance Nº 26 to La Gaceta Nº 38 on 26 February 2025. In addition, all infrastructure works must be designed and carried out in accordance with AyA’s directives, such as the ‘Technical Standard for the Design and Construction of Drinking Water Supply, Sanitation, and Stormwater Systems’ (AyA Board of Directors Agreement Nº 2017-281), among others. As a procedural matter, the private development must comply with the regulations, coordinating with the Instituto Costarricense de Acueductos y Alcantarillados, which is the entity that must approve the designs and construction plans, and subsequently conduct a detailed inspection and review of the project’s compliance with legal and technical standards, until it grants its approval and recommends delivery of the system, operating to full satisfaction, to the relevant ASADA, or alternatively under the Institution’s direct administration.
It is also essential that the developers coordinate with AyA the transfer of the land and creation of any necessary easements (servidumbres) in favor of AyA itself or the relevant ASADA, all in accordance with the Regulation on Community Water and Sewerage System Administrators’ Associations, Decreto Ejecutivo Nº 42582-S-MINAE, and the AyA Service Provision Regulation. In addition, AyA must arrange for registration of the springs (nacientes) or other bodies of water whose waters feed the system, either in AyA’s name or in the name of the relevant ASADA. These matters are also regulated by Decreto Ejecutivo Nº 42582-S-MINAE. At the end of this entire process of meeting requirements and carrying out the works, once AyA has duly accepted them, a complete, operational system with all legal, technical, and financial requirements duly fulfilled would be delivered to the ASADA or directly to the Instituto Costarricense de Acueductos y Alcantarillados.
Once the project in question has passed all the prior stages indicated and has been accepted by AyA to its full satisfaction, and if its administration is then transferred to our ASADA, only from that point onward would our Association have full capacity to address requests and issue water-availability determinations, water-capacity certifications, or other documents, treating applicants efficiently and equally in accordance with the rules established in the applicable regulations, whether those of AyA or the Autoridad Reguladora de los Servicios Públicos (ARESEP), and in compliance with the principles governing public services as established by law and regulation. Therefore, it is important that your client contact AyA and/or the developers to request specific information about the project, and the Dirección de Aguas of MINAE, as the governing authority in this area, regarding water use, and because they have been addressing the matter of the informal La Guágara system directly with the neighbors.
Finally, and no less importantly, upon reviewing your submission to the ASADA, no authorization or power to act before our Association has been demonstrated, nor has it been stated whom you represent. We therefore request that you send the relevant information and attached documents by the email address indicated for service of notices, as digitally signed documents, or in physical form submitted to our public-service counter. All of this is in accordance with Article 285 of the General Law of Public Administration:
‘Article 285.—1. A party’s petition must contain:
‘ARTICLE 4.—Formalities for exercising the right of petition. a) Petitions shall be made in writing and must include the name, identity card or identity document, subject matter, and addressee of the petition. Each submission must be signed by the petitioner or petitioners. With regard to other requirements or procedures not established in these regulations but developed by regulation or through orders, instructions, or circulars, the principle of informality shall prevail in all petitions, in order to guarantee all citizens the free exercise of this right. b) In the case of collective petitions, in addition to meeting the foregoing requirements, they shall be signed by all petitioners, and each person’s first and last names shall appear beside that person’s signature. If not all signatures are included, the petition shall be deemed to have been submitted only by the signatories, without prejudice to its subsequent correction or expansion. c) The petitioner may inform another institution or body, other than the one to which the petition was addressed, that the right is being exercised, by sending it a copy of the submission. …’ Signed in Uvita de Bahía Ballena de Osa, on 20 February 2026” (see evidence submitted); On 3 March 2026, an email was sent by [Nombre 003] to the email addresses - [...] and [...]- requesting:
“I, the undersigned, Lic. [Nombre 001], identity card [Valor 002], in my capacity as an attorney, hereby submit this formal request for information pursuant to the provisions conveyed by the ASADA last 20 February and based on the right of access to public information, the right of petition, and the principle of informality, in accordance with Article 27 of the Political Constitution. With regard to your statement concerning the alleged failure to establish authorization or power to act before that Association, we respectfully state the following: the person submitting this request is Lic. [Nombre 001], in his capacity as an attorney, and all communications have been made at the undersigned’s direction. The method for receiving notices is also provided, and this letter is duly digitally signed. As stated in previous communications, you have established: ‘With respect to said project, our participation has been limited exclusively to reviewing the construction designs provided in the technical study prepared by the Neighborhood Committee, and issuing the necessary comments in strict compliance with AyA regulations.’ In light of the foregoing, we formally request that you send us any document or official letter issued by the ASADA in connection with its participation in the La Guagara Waterworks Project.
If there is no such official letter, please expressly state that no such document exists in the institutional records. We have also made inquiries with AyA as the governing authority, and it shared with us the attached official letter No. GSD-UEN-GAR-2026-00758, dated 23 February, which states under the first item in ‘Critical Pending Actions’: ‘Update of the Technical Study: The ASADA must formally amend the study document so that the service limit matches the 170 authorized by AyA, removing any reference to 200 or more services to protect the sustainability of the resource.’ Since this request is being made to the ASADA, we also request that you send us that update, as well as the official letter to be issued by the ASADA in compliance with what was indicated. The following email address is provided for receiving notices: [...]” (see evidence submitted); On 17 March 2026, the administrator of the ASADA of Uvita and Bahía Osa sent a letter to [Nombre 003], stating:
“Sir: Lic. [Nombre 004]. Dear Counsel: As stated in our previous response addressed to [Nombre 003], regarding authorization to act, you or your client have not established a legitimate interest in your request. It has not been shown that you are a user of the ASADA of Uvita or a neighbor in the La Guágara area, nor have you shown that any person meeting either of those conditions has granted you a special power of attorney. For that reason, your public or legitimate interest has not been established. In light of the foregoing, you are urged to establish your legitimate interest as required and in accordance with the regulations previously sent to you. Signed in Uvita de Bahía Ballena de Osa, on 17 March 2026” (see evidence submitted); On 24 March 2026, the appellant met with personnel from the ASADA of Uvita and Bahía Osa and AyA (see respondent’s answer); On 12 May 2026, the ASADA of Uvita and Bahía Osa was notified of the resolution admitting this proceeding (see notice of service); The community of La Guágara is located north of the town of Uvita de Bahía Ballena de Osa and is not part of the waterworks system of the ASADA of Uvita and Bahía Osa (see respondent’s answer).
IV.The specific case. In this case, the appellant states that since 2020, AyA, Calle Bejuco, La Guágara SRL, and the ASADA of Uvita and Bahía Osa have been coordinating development of the project called the La Guágara Community Waterworks. Accordingly, the appellant states that, to learn the status of that project, he sent various requests to the respondent ASADA; however, he claims that access was limited and denied despite the information being of interest to the community and concerning the right of access to water, a matter of public rather than private interest. He requests the Chamber’s intervention.
In this regard, review of the case file establishes that the initial requests sent to the respondent ASADA came from the appellant’s associate, since it was only on 3 March 2026 that the appellant submitted a request for information, through which he sought the items transcribed in proven fact f. However, it is established that the respondent did not answer that request, arguing that the appellant is neither an associate nor a user of the ASADA of Uvita and Bahía Osa.
In these circumstances, the respondent should be advised that the justification given for not addressing the appellant’s request is not acceptable, since it has an obligation to resolve all requests for information related to the administration of the public waterworks and sanitary sewerage service, as provided in Article 5 of the Framework Law on Access to Public Information:
‘ARTICLE 5—Public officials as obligated parties For purposes of this law, the following are obligated parties:
Private-law legal entities, their attorneys-in-fact, administrators, managers, and legal representatives, and natural persons who hold, administer, or operate funds, property, or services of the Public Administration under any title or management arrangement are considered obligated parties. Political parties are included in this category as part of democratic and electoral transparency principles.
Public companies and institutions operating in competitive markets must separate publicly accessible information from sensitive or confidential information covered by industrial, commercial, or economic secrecy where disclosure to third parties is inadvisable for strategic, commercial, or competitive reasons.
Private-law entities that provide a public service are excluded from the application of this law, without prejudice to their obligation to provide users with information about the operating conditions of the public service they provide, or to provide information that the governing or regulatory entities are authorized to require from them, all in accordance with the legal framework and contractual provisions applicable in each case’ (Emphasis not in the original).
In addition to the foregoing, this Chamber has held that ASADAS are private-law legal entities which, although they perform work of public interest by providing an essential service to the community, do not lose their private nature and must be organized under the Law on Associations. It has further reiterated that an associative grassroots organization’s refusal to address an information request from one of its members is not protected by the right of petition enshrined in Article 27 of the Political Constitution, but by the right of association. In this regard, access to information must be analyzed according to the following criteria: a) whether the requester is a member of the organization, which gives that person certain rights of access to information under the Law on Associations; however, such access is not absolute and must be connected to the essential content of the right of association; and b) whether the requested information is related to a legitimate interest connected to the public service provided by the ASADA (see judgment no. 2025006284, issued at 09:20 on 28 February 2025).
In light of the foregoing, although it is established that the appellant is neither an associate nor a user of the respondent ASADA, the evidence submitted in the case file, and even a reading of the request in question, reveal a legitimate interest connected to the service provided by the ASADA in relation to the information sought, since it refers to alleged participation in the La Guagara Waterworks Project. Since the matter is therefore related to the public activity carried out by the entity, the obligation to provide the information arises under Article 5 of the Framework Law on Access to Public Information.
Accordingly, in this Court’s view, the respondent ASADA’s refusal constitutes an illegitimate obstacle to the fundamental right of access to public information, since it deprives the exercise of that right of effect and eliminates the possibility of citizen oversight of the administration of an essential public service such as drinking water, thereby establishing the violation alleged (see judgment no. 2025035691, issued at 09:30 on 31 October 2025). This is aggravated by the fact that it merely limited itself to denying the requested information without examining its content or determining which aspects could be disclosed and which, if any, might be subject to protection.
Consequently, this amparo application is granted, as stated in the operative part of this judgment.
V.Documents submitted to the case file. The appellant is advised that if any paper document, or any objects or evidence contained on an additional electronic, computing, magnetic, optical, telematic, or new-technology device has been submitted, it must be collected from the court office within a maximum period of 30 working days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the ‘Regulation on Electronic Case Files before the Judiciary,’ approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is granted. Luis Diego Sibaja Monge, in his capacity as President of the Administrators’ Association of the Uvita and Bahía Osa Community Waterworks, or whoever holds that position, is ordered to issue the relevant instructions and carry out all actions within the scope of his authority so that, within TEN DAYS from notification of this judgment, the petition submitted by the appellant on 3 March 2026 is answered as required by law and the response is served on him. The respondent, or whoever holds that position, is advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Administrators’ Association of the Uvita and Bahía Osa Community Waterworks is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration, to be assessed in enforcement proceedings in the civil jurisdiction. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintiseis de junio de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO COMUNAL DE UVITA Y BAHÍA DE OSA.
Resultando:
“1. En primera instancia, debe decirse que la redacción del peticionario no es clara, pues aparecen aparentes preguntas seguidas de respuestas, sin que quede muy claro qué es lo que se solicita, por lo cual procederemos a dar respuesta bajo tales limitantes. 2. Rechazamos todas y cada una de las afirmaciones del amparado en contra de la ASADA que represento, y se responden de seguido. 3. Como contexto y antecedentes históricos, es importante señalar que el barrio, caserío, o comunidad conocido como La Guágara, es una zona ubicada al norte de Uvita, en Bahía Ballena de Osa, la cual no forma parte, ni ha formado parte nunca, del acueducto administrado y operado por nuestra ASADA, y se han venido abasteciendo aparentemente en forma ilegal, mediante un sistema de abastecimiento informal, durante cerca de 30 años. Es decir, están fuera de la zona de cobertura del acueducto que esta ASADA administra y opera. 4. En consulta telefónica a la Oficina de la Dirección de Aguas de la Zona Sur, ubicada en Pérez Zeledón, se nos indicó que en esa comunidad se constituyó la Sociedad de Usuarios de Agua de La Guágara, desde febrero de 1996, y quedó registrada bajo el número 201-S. Pero que nunca han gestionado una concesión de aguas a su nombre. 5. Según parece, en fecha mayo de 2019, la Dirección de Aguas notificó a los vecinos de La Guágara, un comunicado que en esencia dice: Que el MINAE de conformidad con artículos 17 y 168 de la Ley de Aguas establece que es necesario contar con la concesión otorgada, para el aprovechamiento de las aguas, autorización que concede el MINAE, previa solicitud ante la Dirección de Aguas. Siendo que no cuentan con la concesión otorgada, deberán en el plazo de 10 días de conformidad con el artículo 264 de la Ley General de la Administración Pública, cesar el aprovechamiento ilegal, eliminando las estructuras construidas. En caso de incumplimiento el Estado puede ejercer las acciones penales correspondientes. En caso omiso se tiene por notificado lo actuado en el transcurso de 24 horas, según la Ley 7637, y se presentará posteriormente la denuncia penal por los delitos de desobediencia y de usurpación de aguas. 6. Es así como a lo largo de los años, los vecinos de La Guágara han realizado intentos por organizarse y construir un acueducto para entregarlo a la ASADA de Uvita, y con mayor razón desde que fueron notificados en el 2019. 7. En ninguno de los intentos iniciados por los vecinos de La Guágara, esta ASADA ha sido parte del proyecto, sino que la participación de nuestra parte lo ha sido siempre en mostrar la anuencia para que, una vez construido algún proyecto de acueducto, y este sea recibido a plena conformidad por el AyA, entonces la ASADA lo recibiría, y a partir de ese momento, empezar a administrarlo bajo las mismas condiciones que lo hacemos con los barrios y caseríos que forman el área de cobertura de la ASADA, todo bajo la normativa que informa esta materia, principalmente leyes y reglamentos provenientes de AyA y de la ARESEP. 8. Con respecto al presente caso, en primera instancia debe informarse a esa Sala que ni el Lic. [Nombre 001], ni su asociada señora [Nombre 003], son afiliados a esta Asociación, ni son usuarios de los servicios suministrados por la ASADA. 9. La primera solicitud de información recibida fue de parte de la señora [Nombre 003], quien trabaja en conjunto con el Lic. [Nombre 001], y su primera comunicación fue mediante correo sin formalidades ni firma digital. Aún así, se le contestó por el mismo medio, haciendo énfasis en que la organización de los vecinos del sector de La Guágara para construir un acueducto, se rige por modalidades donde la ASADA no participa ni es responsable de los proyectos, sino que lo único donde se nos toma en cuenta es para que manifestemos nuestra anuencia a recibir el futuro acueducto, ya operativo y terminado a satisfacción de AyA, que sería el ente responsable de la revisión y supervisión del proyecto. 10. Posteriormente envió otro correo, en condiciones similares al anterior, y se le reafirmó algunos de los conceptos anteriores, esta vez mediante nota firmada digitalmente por el Lic. Andrés Ríos Ortiz, Administrador de la ASADA, enfatizando que: “Finalmente, pero no menos importante, es que, revisando su gestión ante la ASADA, no se ha demostrado la legitimación o poder para actuar ante nuestra Asociación, ni a quién o quiénes se representa, por lo cual solicitamos remitir la información y documentos adjuntos, por medio del correo que se indica, mediante documentos firmados digitalmente, o en formato físico presentados ante nuestra plataforma de atención al público. Todo ello en concordancia con el artículo 285 de la Ley General de la Administración Pública: “Artículo 285.- 1. La petición de la parte deberá contener: a) Indicación de la oficina a que se dirige; b) Nombre y apellidos, residencia y lugar para notificaciones de la parte y de quien la representa; c) La pretensión, con indicación de los daños y perjuicios que se reclamen, y de su estimación, origen y naturaleza; d) Los motivos o fundamentos de hecho; y e) Fecha y firma. 2. La ausencia de los requisitos indicados en los numerales b) y c) obligará al rechazo y archivo de la petición, salvo que se puedan inferir claramente del escrito o de los documentos anexos. 3. La falta de firma producirá necesariamente el rechazo y archivo de la petición.” Y de igual manera, con el numeral 4 de la Ley 9097, Ley de Regulación del Derecho de Petición. “ARTÍCULO 4.- Formalidad en el ejercicio del derecho de petición a) Las peticiones se formularán por escrito, debiendo incluir, necesariamente, el nombre, la cédula o el documento de identidad, el objeto y el destinatario de la petición. Cada escrito deberá ir firmado por el peticionario o los peticionarios. En cuanto a otros requisitos o procedimientos no establecidos en esta normativa y desarrollados reglamentariamente, o mediante órdenes, instrucciones o circulares, prevalecerá en toda petición el principio de informalidad, con el fin de garantizar a todos los ciudadanos su libre ejercicio b) En el caso de peticiones colectivas, además de cumplir los requisitos anteriores, serán firmadas por todos los peticionarios, debiendo figurar, junto a la firma de cada uno de ellos, su nombre y apellidos. De no constar todas las firmas, la petición se tendrá por presentada únicamente por las personas firmantes, sin perjuicio de su posterior subsanación o ampliación. c) El peticionario podrá indicar del ejercicio de su derecho a otra institución u órgano diferente del cual ha dirigido la petición, remitiéndole copia del escrito. …” 11. Es entonces que en documento fechado 3 de marzo de 2026, se recibe nueva solicitud por parte del Lic. [Nombre 001], esta vez en PDF firmado digitalmente, y en fecha 16 de marzo 2026, se le responde reiterando la necesidad de acreditar su interés público y legítimo, de la siguiente manera: “Como se indicó en nuestra anterior respuesta dirigida a la señora [Nombre 003], con respecto al tema de la legitimación, de parte de ustedes o su representada no han acreditado un interés legítimo para su gestión, no se ha evidenciado que usted sea usuario de la ASADA de Uvita, o sea vecino del sector de La Guágara, ni ha constatado que alguna persona en cualquiera de dichas condiciones, haya otorgado un poder especial a su favor, razón por la cual no se evidencia su interés público ni legítimo. Por todo lo anterior, se le insta a demostrar su interés legítimo como corresponde, y según la normativa que le fue remitida anteriormente.” 12. Posteriormente, en fecha 24 de marzo de 2026, fue convocada una reunión para discutir y actualizar información sobre el proyecto de acueducto La Guágara, con participación de funcionarios de AyA, tanto de la UEN Región Brunca, como de las Oficinas Centrales del AyA en San José, también estuvieron presentes los vecinos impulsores del proyecto, tanto costarricenses como de otros países, y en esa reunión estuvieron presentes el Lic. [Nombre 001] y su asociada [Nombre 003]. Obviamente, estuvimos presentes algunos representantes de la ASADA Uvita, como futuros receptores de las obras, pero sin ninguna responsabilidad en el desarrollo del proyecto, ni en la contratación de empresas constructoras o consultoras, ni en los diseños, ni en avales o supervisiones, que les corresponde a los profesionales de AyA. En dicha reunión, que se prolongó por tres horas, entre las 10:00 am y la 1:00 pm del día 24 de marzo de 2026, se ventilaron todos los temas, se discutieron y respondieron todas las dudas de los presentes, y, al menos de nuestra parte, tuvimos por cierto que el Lic. [Nombre 001] había encontrado todas las respuestas que buscaba, pues como reitero, fueron al menos tres horas de reunión, donde estaban los representantes de los vecinos de La Guágara, que son al fin y al cabo los que pretenden financiar las obras del proyecto, estaban las autoridades de AyA, regionales y nacionales, quienes se refirieron puntualmente a todas las consultas de los presentes, y estuvo el administrador de nuestra ASADA, todas personas a quienes el Lic. Pochet tenía al frente y estaba viendo y escuchando, y a quienes tenía la oportunidad de preguntarles y aclarar sus dudas. De esta reunión fue levantada una minuta, emitida mediante oficio GSDUEN-GAR-2026-01471, suscrito por el Ing. Mario Chavarría Gamboa, de la Dirección de Ingeniería de las ASADAS, de AyA, en la cual se observa cuáles fueron los puntos tratados, y se adjunta una Bitácora de Asistencia levantada por AyA, en la cual se observa la firma de la asociada del Lic. [Nombre 001], [Nombre 003]., con su número de cédula, su número de celular, y muy importante, el correo [...], siendo que el correo señalado por el Lic. [Nombre 001] para atender notificaciones es el [...], sabemos que ambos pertenecen a la misma empresa. Ignoramos las razones por las cuales el Lic. [Nombre 001] no firmó la bitácora de la asistencia, pero en su oportunidad él se presentó ante los presentes, identificándose como Lic. [Nombre 001]. 13. Con posterioridad a la reunión, como se dijo, el Ing. Mario Chavarría de AyA emitió una minuta de la reunión, donde se indican, entro otros aspectos, los siguientes: “Puntos tratados • Se hace aclaración de la posición técnica y legal de la ASADA y el AyA, y que la participación de ambas se basa en la etapa de diseño y construcción, meramente en el cumplimiento de normas, reglamentos y leyes. • La ASADA ni el AyA participan en el cobro de los aportes de cada uno de los beneficiarios del proyecto. • La ASADA ni el AyA establecen la forma en que se financie el proyecto. • La ASADA y el AyA definen que ambas partes están a la espera que el Comité de Agua La Guagara, les comunique sobre el inicio de obras, con el fin de que las mismas sean inspeccionadas por ambas partes y en el cumplimiento de todos los permisos necesarios para su construcción. • El AyA y la ASADA desde un inicio resaltan la importancia que el Proyecto abarque de forma integral las comunidades y calles que comprende el acueducto. • El AyA y la ASADA solicitan al Comité de Agua La Guagara, realizar una actualización de los aforos de las fuentes de producción del acueducto, con el fin de validar la funcionalidad y operatividad de los Planos constructivos y el presupuesto detallado de las obras definidas en el año 2025. • El AyA y la ASADA, no están anuentes a recibir microsistemas de abastecimiento, dentro del área de cobertura del Proyecto La Guágara, debido a su integralidad y al funcionamiento por gravedad diseñado inicialmente. • Si la actualización de los aforos solicitada no cumpliera con las expectativas de los planos constructivos definidos y aprobados por el AyA en el año 2025 y su cobertura para aproximadamente 180 servicios, en primera instancia se pediría la recuperación de las 3 nacientes que dejaron de ser parte del sistema, y en segundo lugar, se solicitaría la incorporación de una o varias fuentes de producción, en los planos constructivos y debe realizarse una actualización del Estudio Técnico que incluya esta solución de la producción del sistema. • Si para incorporar más agua al Proyecto de Abastecimiento de Agua potable La Guagara, se propone incluir un pozo al sistema, el mismo deberá contar con el debido proceso de legalidad en la Dirección de Aguas. Este “pozo” deberá incorporarse a los planos constructivos y deberá realizarse la debida actualización del Estudio Técnico que lo contemple. Además, se solicita por parte de la ASADA, si se incorpora un pozo al sistema, el mismo deberá contar con su respaldo de suministro eléctrico por medio de una planta generadora Diesel, debido a la mala calidad del servicio eléctrico dado por el ICE en Uvita. • Se aclara que todas las tuberías contempladas desde un inicio para el abastecimiento de agua potable en los diversos sectores de la red de distribución del proyecto La Guagara, están establecidas en Calles públicas municipales o vecinales, y por ende, este trazado no se variará aunque exista negativa de los vecinos y beneficiarios del mismo sistema, por un pensamiento ambientalista sobre el debido derecho público de la naturaleza de la calle que le da acceso a sus propiedades.” Como se observa, en estos puntos extraídos de la minuta, se responden prácticamente todas las inquietudes del Lic. [Nombre 001], pero aún cada uno de estos puntos, y los demás que constan en la minuta, de la cual se adjunta copia, fueron tratados de manera más amplia durante la reunión mencionada, y donde el Lic. [Nombre 001], y su asociada [Nombre 003], tuvieron la oportunidad de preguntar, consultar, y aclarar todas sus dudas directamente ante los gestores del proyecto de acueducto La Guágara, y frente a las autoridades de AyA. Nótese, además, que en el punto quinto, subrayado, tanto el AyA como la ASADA mantienen la posición “…que el Proyecto abarque de forma integral las comunidades y calles que comprende el acueducto.” Es decir, que se tomen en consideración todos los sectores atendidos actualmente por el acueducto (ilegal e irregular) existente. Y por supuesto, reitero que nuestra participación más activa será cuando ya las obras del futuro acueducto hayan sido recibidas a total satisfacción por el AyA y entregadas a nuestra Asociación, no solo las obras civiles sino también todos los terrenos necesarios para captaciones de nacientes y tanques, así como la totalidad de las servidumbres que sean necesarias para la cabal operación y mantenimiento del nuevo sistema. 14. Una de las preguntas del amparado se refiere al futuro, incierto como lo es, pues como ya se dijo, los intentos de construir un acueducto en La Guágara se remontan a varios años, y aún no se ha materializado, por lo tanto no sabemos cuándo o cómo será construido este proyecto, o si llegará a construirse. Sin embargo, el trato que le daría la ASADA a los potenciales usuarios, en el hipotético caso que sea construido un acueducto en La Guágara, y sea recibido por AyA y entregado a la ASADA de Uvita, sería el mismo trato que se le da a los actuales usuarios y solicitantes dentro del área de cobertura de nuestro acueducto, el cual está sustentado en las leyes y reglamentos emitidos principalmente por el AyA y la ARESEP. Y en el hipotético caso que entre AyA y los desarrolladores del proyecto se firme un convenio para aplicación del artículo 38 de la Ley de Planificación Urbana, el cual establece la posibilidad que nuevos usuarios que no aportaron al monto del costo del acueducto, durante un período de cinco años, deban abonar una parte proporcional al monto inicial invertido, ello aplica para proyectos y desarrollos futuros, no así para el crecimiento vegetativo o viviendas unifamiliares. Todo ello apegado al numeral 38 de la ley de Planificación Urbana número 4240, y el Acuerdo No. JD-2025-045, de fecha 17 de febrero de 2025, de la Junta Directiva del AyA, denominado “Modificación Integral al Reglamento para la Aplicación del Artículo 38 de la Ley de Planificación Urbana, Nº4240 en Obras de Acueductos y Alcantarillados De AyA”, Acuerdo Publicado en el Alcance No.26 a la Gaceta No. 38 del 26 de febrero del 2025. Por lo demás, serán factores técnicos los que van a incidir en las resoluciones que emita la ASADA para las solicitudes nuevas, todo de conformidad con el Reglamento de Prestación de Servicios de AyA, y el “Reglamento Técnico para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes (AR-RTPAAH-2015)”, dictado mediante la Resolución RJD-101-2014 del 22 de septiembre de 2014 y sus reformas, en sus versiones vigentes del futuro. 15. Con respecto al interés público legítimo, y precisamente, para el caso de las ASADAS, ha dicho esa Sala (…) Y como se ha indicado, ni el Lic. [Nombre 001], ni la señora [Nombre 003], son afiliados a la ASADA, y tampoco son usuarios de los servicios prestados. 16. Finalmente, es importante indicar que la mayor comunicación que se he tenido por parte de los desarrolladores privados del proyecto La Guágara, hacia la ASADA, es con respecto a planos, croquis, tablas generados por los profesionales contratados por los interesados. Y es de conocimiento que este tipo de documentos están protegidos por la Ley 6883, “Ley de Derechos de Autor y Derechos Conexos”, donde en sus artículos 1, 90 y 101, así se establece (…) RESUMEN El presente caso, objeto del recurso de amparo bajo expediente N° 26-011911-0007- CO de la Sala Constitucional, se puede resumir de la siguiente manera: La comunidad de La Guágara se ubica al norte de la población de Uvita de Bahía Ballena de Osa, y nunca ha formado parte del acueducto que administra la ASADA que represento. Al principio se trató de un grupo de personas, principalmente finqueros, que constituyeron la Sociedad de Usuarios de Agua de La Guágara, desde hace poco más de 30 años, febrero de 1996, y quedó registrada bajo el número 201-S. Y aparentemente empezaron a hacer aprovechamientos de aguas, sin haber solicitado alguna concesión de aguas a su nombre. Los pobladores de La Guágara empezaron a crecer en número y la red de sus acueductos, aparentemente sin diseños profesionales, también empezó a crecer. En mayo de 2019, la Dirección de Aguas notificó a los vecinos que debían cesar el aprovechamiento de las aguas, al no contar con concesiones que los autorizaran, y en caso contrario podrían ser denunciados penalmente. Si bien es cierto, desde antes de esa fecha ya los vecinos habían intentado construir algún acueducto integral, para luego ser trasladado al AyA o a alguna ASADA, a partir del 2019 estos movimientos tomaron nueva fuerza. De ahí que los propietarios y usuarios del acueducto (o acueductos) construidos sin permisos ni concesiones de aprovechamientos de aguas, se han organizado para echar a andar un nuevo proyecto, con fondos propios y mediante la contratación de empresas privadas, al igual que se han construido cientos de desarrollos en este país a través de la historia, para luego ser entregado el acueducto, al AyA o a alguna ASADA. Al ser un proyecto privado, gestionado por personas físicas o jurídicas ajenas a la ASADA de Uvita, con fondos privados y mediante contrataciones privadas de empresas constructoras o consultoras, la única participación de esta ASADA, ha sido para dar el visto bueno a que, una vez finalizada la ejecución del proyecto de acueducto, y éste sea recibido a total satisfacción por el AyA, como ente rector autorizado legal y reglamentariamente, la ASADA lo recibiría, junto a los terrenos y servidumbres necesarios para el funcionamiento del mismo, para, a partir de ese momento, incorporarlo dentro del área de cobertura de la ASADA, y así poder administrar y operar el sistema en total conformidad con las leyes y reglamentos que rigen esta materia, principalmente emitidos por AyA y la ARESEP, y en respeto de todos los principios del servicio público que el ordenamiento costarricense reconoce y ordena. Por otro lado, el amparado [Nombre 001] no está asociado, ni de ninguna manera afiliado, a la Asociación que represento, ni es usuario del acueducto que administra la ASADA de Uvita, por lo cual, si bien es cierto sus solicitudes, a través de la señora [Nombre 003] y de él mismo han sido atendidas dentro de los plazos establecidos, también es cierto que no han acreditado un interés público y legítimo en sus solicitudes, sino que parece ser más bien un interés privado, por lo cual le es aplicable la jurisprudencia constitucional vertida mediante, al menos, las resoluciones N° 2011-015820 de las 2:30 horas del 22 de noviembre de 2011, y N° 2023-015629, del 30 de junio de 2023, de esa Sala Constitucional. De igual manera, es muy importante para dilucidar el presente caso, reiterar que tanto la señora [Nombre 003], como el propio Lic. [Nombre 001], estuvieron presentes en la reunión convocada por los desarrolladores privados del proyecto, realizada en fecha 24 de marzo de 2026 en Uvita de Osa, en donde también estuvieron presentes las autoridades de AyA, de nivel regional y nacional, quienes estuvieron atendiendo y respondiendo las consultas de los presentes, por cual también las consultas de los mencionados [Nombre 003] y [Nombre 001], fueron atendidas por AyA, por los desarrolladores, e incluso por los representantes de nuestra ASADA, y cuyos temas principales constan en la minuta de la reunión, emitida mediante oficio GSD-UEN-GAR-2026-01471, suscrito por el Ing. Mario Chavarría Gamboa, por lo cual no es de recibo que a estas alturas el señor ([Nombre 001]) venga a decir que desconoce los pormenores del proyecto, o que no hayan sido atendidas sus dudas, a pesar, reitero, de no haber hasta el momento acreditado su interés legítimo para requerir información de entes privados. Finalmente, es importante señalar que mucho de los solicitado por el amparado son preguntas hipotéticas, inciertas hacia el futuro, por lo cual no se observa cuáles derechos estaría tutelando este recurso de amparo, pero aun así se ha indicado y se reitera que en el hipotético caso que un nuevo acueducto fuera construido en el sector de La Guágara y entregado a esta ASADA, el trato a los pobladores sería en igualdad de condiciones del resto de la población abastecida, en respeto de los principios del servicio público del agua, y de las leyes y reglamentos que informan esta materia. Pot todo lo cual su recurso de amparo debe ser desestimado” (sic).
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Sobre el recurso de amparo presentado contra sujetos de derecho privado. Por su naturaleza excepcional, el trámite de los recursos de amparo contra sujetos de derecho privado exige de previo examinar si en el caso concreto se está ante alguno de los supuestos que lo hacen admisible conforme a los presupuestos del artículo 57 de la Ley de la Jurisdicción Constitucional, para posteriormente, en caso afirmativo, dilucidar si es estimable. Así, el numeral citado anteriormente, establece que se concederá el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren en derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2 inciso a) de la misma Ley.
En el caso concreto se estima que el recurso es admisible, por cuanto las ASADAS, surgen a raíz de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Ley No. 2726 de 14 de abril de 1961 y sus reformas, la cual además de constituir al AyA como una institución autónoma del Estado, lo facultó a delegar la administración, operación y mantenimiento de los sistemas de acueductos y alcantarillados -que le fueron encomendados por el legislador-, a agrupaciones como la ASADA, debidamente conformadas para tal efecto, según se desprende del artículo segundo inciso g) de la citada ley. Por lo que las asociaciones administradoras de acueductos rurales, en cuanto administran por convenio con el Instituto Costarricense de Acueductos y Alcantarillados ese servicio público, se encuentran, de derecho, en una posición de poder respecto de los usuarios.
II.Objeto del recurso. El recurrente manifiesta que desde el 2020 se está coordinado entre el AyA, Calle Bejuco, La Guágara SRL y la ASADA de Uvita y de Bahía Osa el desarrollo del proyecto denominado Acueducto Comunal La Guágara. Por lo anterior, señala que a efectos de conocer el estado sobre dicho proyecto remitió distintas gestiones ante la ASADA accionada; sin embargo, reclama que se le ha limitado y denegado el acceso a pesar de que se trata de información de interés de la comunidad y sobre el derecho de acceso al agua, el cual es un tema de interés público y no privado. Solicita la intervención de la Sala.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
El recurrente no está asociado ni es usuario de la ASADA de Uvita y de Bahía Osa (ver contestación de la recurrida); El 16 de febrero de 2026 se envió un correo electrónico por parte de [Nombre 003] a las direcciones electrónicas - [...] y [...]-, por medio del cual solicitó:
“Señores; Eduardo Antonio González Presidente ASADA Uvita Andrés Ríos Administrador ASADA Uvita Reciban un cordial saludo, por indicación del Lic. [Nombre 001] remito el presente correo con relación al proyecto de construcción de un acueducto conocido como La Guagara, en el que quisiera plantear una serie de consultas. De conformidad con las comunicaciones que remite el desarrollador, se ha indicado que aquellas personas propietarias que no realicen el aporte correspondiente de manera previa al acueducto no podrían ser consideradas dentro del proyecto, ofreciéndose eventualmente estas previstas a otros futuros dueños de terrenos o desarrollos. No obstante, en el lugar ya existen viviendas construidas y una necesidad real y actual de agua, la cual está siendo satisfecha mediante un sistema irregular; del cual es que nace la necesidad de realizar esta obra. En ese sentido, solicito se nos indique cómo se estaría manejando esta situación desde la ASADA, particularmente considerando que el sistema proyectado contempla la conexión y necesidad de las viviendas existentes.
Quisiéramos conocer cómo se manejaría el escenario en el que la ASADA asuma formalmente la prestación del servicio y existan personas que no hayan realizado el aporte inicial: ¿se les ofrecería la conexión contra el pago respectivo?, ¿o quedarían excluidas aun cuando sus propiedades se encuentren dentro del área de cobertura? Entendemos que la finalidad del desarrollo debería ser, en primer término, normalizar la situación de quienes ya hacen uso del agua y cubrir las necesidades actuales del sistema, priorizando las casas existentes, para posteriormente atender nuevas disponibilidades. Nadie estaría obligado a conectarse; sin embargo, debería existir la posibilidad real de hacerlo cuando el servicio sea efectivo, asumiendo el costo que corresponda en ese momento. Agradezco de antemano su atención y quedo a la espera de su respuesta, a fin de contar con claridad sobre cómo la ASADA está abordando esta situación.
Asimismo, en diversas ocasiones el Licenciado ha intentado comunicarse con el señor Andrés, llamando a la ASADA; sin embargo, no ha sido posible establecer contacto. Por ello, quisiéramos solicitarle una cita de manera virtual” (ver prueba aportada); El 16 de febrero de 2026, el personal de la ASADA de Uvita y de Bahía Osa brindó la siguiente respuesta:
“En primera instancia, deseamos corregir que el presidente de nuestra ASADA es el señor Diego Sibaja Monge. El nombre indicado anteriormente no forma parte de nuestra Junta Directiva. Asimismo, tenemos entendido que el Ing. Eduardo Antonio González está gestionando lo pertinente de forma directa con el Comité de Vecinos de la comunidad. Queremos aclarar que el desarrollo del proyecto denominado Acueducto La Guágara no forma parte de una gestión administrativa de nuestra ASADA. En relación con dicho proyecto, nuestra participación se ha limitado exclusivamente a revisar los diseños constructivos aportados en el estudio técnico realizado por el Comité de Vecinos, emitiendo las observaciones necesarias en estricto apego a la normativa del AyA. No formamos parte de la gestión administrativa del proyecto ni podemos dar certeza de su ejecución final. Es imperativo señalar que el suministro actual de agua es ilegal y representa un riesgo para la salud pública.
Al respecto, el Ministerio de Salud y la Municipalidad de Osa ya se han pronunciado solicitando la desconexión de los usuarios; no obstante, la ASADA no tiene injerencia legal en ese proceso de desconexión. Nuestra posición oficial ha sido, hasta el momento, manifestar la anuencia para recibir el proyecto una vez que este finalice su etapa de construcción y cumpla con toda la normativa técnica y legal del AyA. En la etapa actual, el proyecto mantiene un carácter privado, por lo que esta ASADA no tiene relación con su gestión hasta que el AyA apruebe formalmente el traslado de la administración. 1. Sobre el carácter privado y la responsabilidad de la construcción El Reglamento para la Prestación de Servicios de AyA (y sus reformas) indica que las obras construidas por terceros son responsabilidad del desarrollador hasta su entrega formal: "Las obras de infraestructura que sean construidas por urbanizadores o fraccionadores [...] serán responsabilidad técnica y financiera de estos hasta tanto no se realice la recepción definitiva por parte del AyA o la ASADA correspondiente." 2.
Sobre la "Anuencia" y la recepción de obras El Reglamento de Acueductos y Alcantarillados Delegados (Reglamento de ASADAS), en su normativa sobre infraestructura, establece: "La ASADA podrá manifestar su anuencia a recibir sistemas construidos por terceros, siempre y cuando estos cumplan con las normas técnicas de diseño y construcción vigentes. La aceptación de la infraestructura no implica responsabilidad de la ASADA por deudas o gestiones administrativas previas del responsabilidad de la ASADA por deudas o gestiones administrativas previas del comité o desarrollador privado." 3. Sobre la ilegalidad del servicio actual El Reglamento de Prestación de Servicios, en su sección de Conexiones Ilícitas, respalda que un sistema sin aprobación técnica es ilegal: "Se considera conexión ilícita toda aquella que se realice sin la debida autorización del prestador o que no cuente con la aprobación de los diseños técnicos requeridos.
El uso de fuentes de agua no autorizadas para consumo humano faculta a las autoridades de salud para proceder con su clausura inmediata por riesgo sanitario” (ver prueba aportada); El 17 de febrero de 2026, se envió un correo electrónico por parte de [Nombre 003] a las direcciones electrónicas - [...] y [...]-, por medio del cual solicitó:
“En diversas ocasiones realizamos llamadas a la Asada y hace unas semanas el Licenciado se presentó de manera presencial; no obstante, tomamos nota de que el canal oficial para la comunicación con ustedes es vía correo electrónico, por lo que en adelante procederemos conforme a lo indicado. Ofrecemos disculpas por la confusión generada respecto a la integración de la Junta Directiva y tomamos debida nota de que el presidente de la ASADA es el señor Diego Sibaja Monge. En relación con lo expuesto sobre la participación de la ASADA, le agradeceríamos, nos pueda remitir copia de los oficios, criterios técnicos, observaciones o cualquier documentación emitida por la ASADA en el marco de la revisión de los diseños del proyecto Acueducto La Guágara del cual nos comenta, así como cualquier otra comunicación formal relacionada con dicho proyecto en donde haya participado la ASADA. Una vez nos remita la documentación y la hayamos revisado, le agradeceríamos que se nos pueda conceder una cita virtual según su disponibilidad” (ver prueba aportada); El 20 de febrero de 2026, el administrador de la ASADA de Uvita y de Bahía Osa le remitió una nota a [Nombre 003], por medio de la cual se le indicó:
“Como se indicó en nuestra anterior respuesta al mismo tema, las construcciones de proyectos privados de esta naturaleza, cuando los servicios públicos no alcanzan a las áreas de interés de los desarrolladores, están amparados mediante el artículo 38 de la Ley de Planificación Urbana, y en aplicación del Reglamento conocido como Modificación Integral al Reglamento para la Aplicación del Artículo 38 de la Ley de Planificación Urbana, Nº4240 en Obras de Acueductos y Alcantarillados de AyA, publicado en el Alcance Nº 26 a la Gaceta Nº 38 del 26 de febrero del 2025. Adicionalmente, todas las obras de infraestructura deben diseñarse y ejecutarse en apego a las directrices de AyA, tales como la “Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial” (Acuerdo de Junta Directiva de AyA Nº 2017-281), y otras. Procedimentalmente, lo que corresponde es llevar el desarrollo privado en apego a la normativa, coordinando con el Instituto Costarricense de Acueductos y Alcantarillados, que es la entidad que debe dar el aval a los diseños, planos constructivos, y posteriormente realizar una inspección detallada y revisión del cumplimiento de las normas legales y técnicas del proyecto, hasta otorgar el visto bueno y recomendar la entrega del sistema, operando a plena satisfacción, a la ASADA que corresponda, o bien bajo la administración directa de la Institución.
Es indispensable, además, que los desarrolladores coordinen con el AyA, el traspaso de los terrenos y la constitución de las servidumbres que sean necesarias, a favor del mismo AyA, o de la ASADA que corresponda, todo ello en apego al Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo Nº 42582-S-MINAE, y al Reglamento de Prestación de los Servicios de AyA. Adicionalmente, el AyA debe gestionar la inscripción de las nacientes, u otros cuerpos de agua, cuyas aguas alimenten el sistema, ya sea a nombre de AyA o de la ASADA correspondiente. Aspectos también regulados mediante el Decreto Ejecutivo Nº 42582-S-MINAE. Y al final de toda esa cadena de cumplimiento de requisitos y ejecución de las obras hasta su debido recibido por el AyA, es que se daría la entrega de un sistema completo, operativo y con todos los requisitos legales, técnicos, y financieros debidamente cumplimentados, a la ASADA, o directamente al mismo Instituto Costarricense de Acueductos y Alcantarillados.
Una vez el proyecto de que se trate, haya superado todas las etapas previas indicadas, y llegue a ser recibido por AyA a entera satisfacción, y caso que la administración del mismo sea entregado a nuestra ASADA, sería a partir de ese momento en que nuestra Asociación tendría plena capacidad para atender solicitudes y emitir las disponibilidades de agua, certificaciones de capacidad hídrica, u otros, dando un trato eficiente y en igualdad, acorde con las reglas establecidas en los reglamentos correspondientes, ya sean de AyA o de la Autoridad Reguladora de los Servicios Públicos (ARESEP), y en cumplimiento de los principios del servicio público, establecidos legal y reglamentariamente. Por lo tanto, es importante que su representada acuda ante el AyA y/o ante los desarrolladores, para solicitar los aspectos puntuales del proyecto, y ante la Dirección de Aguas del MINAE, por ser el ente rector en la materia, para lo relacionado con el aprovechamiento de agua y por ser quienes han estado tratando el tema del sistema informal de La Guágara directamente con los vecinos.
Finalmente, pero no menos importante, es que, revisando su gestión ante la ASADA, no se ha demostrado la legitimación o poder para actuar ante nuestra Asociación, ni a quién o quiénes se representa, por lo cual solicitamos remitir la información y documentos adjuntos, por medio del correo que se indica como medio de notificación, mediante documentos firmados digitalmente, o en formato físico presentados ante nuestra plataforma de atención al público. Todo ello en concordancia con el artículo 285 de la Ley General de la Administración Pública: “Artículo 285.- 1. La petición de la parte deberá contener:
“El suscrito, Lic. [Nombre 001], cédula de identidad [Valor 002], en mi condición de abogado, me permito remitir la presente solicitud formal de información, de conformidad con las disposiciones remitidas por parte de la ASADA el pasado 20 de febrero del presente año, y con fundamento en el derecho de acceso a la información pública, el derecho de petición y el principio de informalidad, conforme al artículo 27 de la Constitución Política. En relación con su manifestación respecto a la supuesta falta de acreditación de legitimación o poder para actuar ante esa Asociación, respetuosamente indicamos lo siguiente: quien suscribe la gestión es el Lic. [Nombre 001], en su condición de abogado, y en todas las comunicaciones se ha actuado por indicación del suscrito. Asimismo, se indica el medio para recibir notificaciones y se remite la presente nota debidamente firmada digitalmente. De conformidad con lo indicado en comunicaciones anteriores ha establecido “En relación con dicho proyecto, nuestra participación se ha limitado exclusivamente a revisar los diseños constructivos aportados en el estudio técnico realizado por el Comité de Vecinos, emitiendo las observaciones necesarias en estricto apego a la normativa del AyA”.
En virtud de lo anterior, solicitamos formalmente se nos remita cualquier documento u oficio que haya sido emitido por parte de la ASADA en función de su participación en el Proyecto del Acueducto La Guagara. En caso de que no conste ningún oficio, favor indicarlo de manera expresa, señalando que no existe documento alguno en los registros institucionales. Asimismo, se han realizado gestiones de consulta ante el AyA como ente rector, que nos compartió el oficio adjunto No. GSD-UEN-GAR-2026-00758, de fecha 23 de febrero, en el cual se dispone, en el punto primero de “Gestiones Críticas Pendientes”: “Actualización del Estudio Técnico: La ASADA debe adaptar formalmente el documento del estudio para que el límite de servicios coincida con los 170 autorizados por el AyA, eliminando cualquier referencia a 200 o más servicios para proteger la sostenibilidad del recurso”. Siendo que la solicitud se realiza ante la ASADA, también solicitamos que se nos remita dicha actualización, así como el oficio que se vaya a emitir por parte de la ASADA en cumplimiento de lo indicado.
Se indica el siguiente correo como medio para recibir notificaciones: [...]” (ver prueba aportada); El 17 de marzo de 2026, el administrador de la ASADA de Uvita y de Bahía Osa le remitió una nota a [Nombre 003], por medio de la cual se le indicó:
“Señor: Lic. [Nombre 004] Estimado Licenciado: Como se indicó en nuestra anterior respuesta dirigida a la señora [Nombre 003], con respecto al tema de la legitimación, de parte de ustedes o su representada no han acreditado un interés legítimo para su gestión, no se ha evidenciado que usted sea usuario de la ASADA de Uvita, o sea vecino del sector de La Guágara, ni ha constatado que alguna persona en cualquiera de dichas condiciones, haya otorgado un poder especial a su favor, razón por la cual no se evidencia su interés público ni legítimo. Por todo lo anterior, se le insta a demostrar su interés legítimo como corresponde, y según la normativa que le fue remitida anteriormente. Firmo en Uvita de Bahía Ballena de Osa, en fecha 17 de marzo de 2026” (ver prueba aportada); El 24 de marzo de 2026 se llevó a cabo una reunión del recurrente junto con el personal de la ASADA de Uvita y de Bahía Osa y del AYA (ver contestación de la recurrida); El 12 de mayo de 2026, la ASADA de Uvita y de Bahía Osa fue notificada de la resolución que dio curso a este proceso (ver acta de notificación); La comunidad de La Guágara se ubica al norte de la población de Uvita de Bahía Ballena de Osa y no forma parte del acueducto de la ASADA de Uvita y de Bahía Osa (ver contestación de la recurrida).
IV.Sobre el caso concreto. En el sub lite, el recurrente manifiesta que desde el 2020 se está coordinado entre el AyA, Calle Bejuco, La Guágara SRL y la ASADA de Uvita y de Bahía Osa el desarrollo del proyecto denominado Acueducto Comunal La Guágara. Por lo anterior, señala que a efectos de conocer el estado sobre dicho proyecto remitió distintas gestiones ante la ASADA accionada; sin embargo, reclama que se le ha limitado y denegado el acceso a pesar de que se trata de información de interés de la comunidad y sobre el derecho de acceso al agua, el cual es un tema de interés público y no privado. Solicita la intervención de la Sala.
Al respecto, del estudio de los autos, se tiene por demostrado que inicialmente las solicitudes remitidas ante la ASADA accionada fueron por parte de la asociada del recurrente, por cuanto fue hasta el 3 de marzo de 2026 que se remitió una gestión de información suscriba por el recurrente a través de la cual requirió lo transcrito en el hecho probado f. Sin embargo, se verifica que dicha solicitud no fue atendida por parte de la recurrido, bajo el argumento de que el recurrente no es asociado ni usuario de la ASADA de Uvita y de Bahía Osa.
Bajo este panorama, conviene advertirle al recurrido que la justificación brindada para no atender la gestión formulada por el recurrente no resulta de recibido, toda vez que tiene la obligación de resolver todas aquellas solicitudes de información relacionadas con la gestión del servicio público de un acueducto y alcantarillado sanitario, tal como lo establece el artículo 5 de la Ley Marco de Acceso a la Información Pública:
“ARTÍCULO 5- Los funcionarios o las funcionarias públicos como sujetos obligados Para efectos de esta ley, son sujetos obligados los funcionarios públicos y públicas de:
Se consideran sujetos obligados, las personas jurídicas de derecho privado, sus apoderados, administradores, gerentes y representantes legales, y las personas físicas que custodien, administren o exploten fondos, bienes o servicios de la Administración Pública, por cualquier título o modalidad de gestión. Se incluyen en esta categoría a los partidos políticos como parte de los principios democráticos y de transparencia en el ámbito electoral.
Las empresas e instituciones públicas en competencia deberán separar la información de acceso público de aquella de carácter sensible o confidencial, enmarcada en el secreto industrial, comercial o económico, cuando por motivos estratégicos, comerciales y de competencia no resulte conveniente su divulgación a terceros.
Los sujetos de derecho privado prestadores de un servicio público se encuentran excluidos de la aplicación de la presente ley, sin perjuicio de la obligación que les corresponde de brindar información a las personas usuarias sobre las condiciones operativas del servicio público que prestan, o de la información que las entidades rectoras o reguladores estén facultadas para requerirles, todo de conformidad con el régimen jurídico y las disposiciones contractuales que les resulten aplicables según el caso” (El destacado no es del original).
En adición a lo anterior, esta Sala ha establecido que las ASADAS son personas jurídicas de derecho privado que, si bien realizan labores de interés público al brindar un servicio esencial a la comunidad, no pierden su naturaleza privada y deben organizarse conforme a la Ley de Asociaciones. Adicionalmente, ha reiterado que la negativa de una organización de base asociativa a atender una solicitud de información de uno de sus miembros no se encuentra amparada en el derecho de petición consagrado en el artículo 27 de la Constitución Política, sino en el derecho de asociación. En este sentido, el acceso a la información debe analizarse bajo los siguientes criterios: a) si el solicitante es agremiado de la organización, lo que le otorga ciertos derechos de acceso a la información en el marco de la Ley de Asociaciones; sin embargo, dicho acceso no es absoluto y debe estar vinculado con el contenido esencial del derecho de asociación, y b) si la información solicitada está relacionada con un interés legítimo vinculado a la prestación del servicio público que brinda la ASADA (ver en ese sentido la sentencia nro. 2025006284 de las 09:20 horas del 28 de febrero de 2025).
En virtud de lo expuesto, si bien se verifica que el recurrente no es asociado ni usuario de la ASADA accionado, lo cierto del caso es que de los elementos que aportados en autos del expediente e incluso de la lectura de la gestión aducida se desprende un interés legítimo asociado a la prestación del servicio que brinda la ASADA sobre la información que se pretende, pues hace referencia a la supuesta participación en el Proyecto del Acueducto La Guagara. De ahí que al guardar relación con la actividad pública que la entidad desarrolla surge la exigibilidad, según lo dispuesto en el artículo 5 de la Ley Marco de Acceso a la Información Pública.
Así las cosas, a criterio de este Tribunal la negativa por parte de la ASADA accionada constituye un obstáculo ilegítimo al derecho fundamental de acceso a la información pública, pues priva de eficacia el ejercicio del derecho y anula la posibilidad de control ciudadano sobre la gestión de un servicio público esencial como el agua potable, lo cual configura la lesión expuesta (ver en ese sentido la sentencia nro. 2025035691 de las 09:30 horas del 31 de octubre de 2025). Con el agravante de que solamente se limitó a denegar la información pretendida sin analizar el contenido de lo pretendido ni determinar qué extremos eran divulgables y cuáles, en su caso, podrían estar sujetos a resguardo.
En consecuencia, se acoge este recurso, conforme se indica en la parte dispositiva de esta sentencia.
V.Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Luis Diego Sibaja Monge, en su condición de presidente de la Asociación Administradora del Acueducto Comunal de Uvita y de Bahía Osa, o a quien ocupe dicho cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo de DIEZ DÍAS, contados a partir de la notificación de esta sentencia, se conteste la petición planteada por el recurrente desde el 3 de marzo de 2026, según en derecho corresponda y se le notifique lo respectivo. Se advierte a la parte recurrida, o a quien ocupe su cargo, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Asociación Administradora del Acueducto Comunal de Uvita y de Bahía Osa al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamentos a esta declaratoria, los que se liquidarán en ejecución de sentencia de la jurisdicción civil. Notifíquese.
