Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours twenty-five minutes on the twenty-third of July, two thousand twenty-six.

Writ of amparo (recurso de amparo) processed under case number 26-011167-0007-CO, filed by [Nombre 001], national identification number [Valor 001], against the MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) and the ASADA MATAPALO DE SANTA CRUZ.

Background:

  1. 1By means of a brief incorporated into the digital case file at 19:08 hours on March 28, 2026, the petitioning party filed a writ of amparo against MINAE and the ASADA de Matapalo de Santa Cruz. According to the order admitting the case, the following is stated:

"[F]or more than fifty years, the community of Bahía de los Piratas, Playa Real, Cabo Velas, located in Santa Cruz de Guanacaste and comprising approximately 16 resident families—including minors and elderly persons—has had an artisan well (pozo artesanal) located in Playa Real as its sole water supply source, given the absence of potable water service provided by the local ASADA. On March 27, 2026, a MINAE official—Ms. Diana Meza Calderón—appeared without prior notice in the community and notified permanent residents—Mr. Jaime Enrique García Velásquez and Ms. Linsey Elena García Chavarría—of the immediate closure of the well, ordering a total prohibition on its use on the grounds that it lacked administrative authorization, and warning that any access to the water would give rise to criminal proceedings for misappropriation of water and contempt of authority. This occurred despite Ms. García Chavarría's expressed need for water to attend to the basic needs of her household and her children, Sebastián and Camila, who are minors.

On that same occasion, the official permitted a private individual to place a padlock on the access to the well, leaving all resident families—including founding settlers and co-owners of the well—without access to water, directly affecting fundamental rights such as health, human dignity, and life. The petitioner states that, for a number of years prior, the community had engaged in verbal and written efforts before the ASADA de Matapalo and the Ministry of Health to obtain potable water service, without positive results, despite the water pipeline network being located approximately one kilometer away—an omission that the ASADA justified by citing lack of financial resources. Accordingly, MINAE is attributed with having taken an arbitrary and unlawful action without due process or right of defense, and the ASADA is attributed responsibility for the persistent failure to provide the public potable water service. The petitioner considers that the foregoing violates her fundamental rights. She requests that the petition be granted, with all legal consequences."

  1. 2By order issued at 12:35 hours on May 5, 2026, the Presidency of the Chamber admitted this constitutional proceeding and granted a hearing to Efraín Milanés Obando Álvarez, national identification number 0501540464, in his capacity as president and judicial and extrajudicial representative, holding general power of attorney for the ASADA de Matapalo de Santa Cruz, to respond to the facts and omissions attributed to it. Likewise, the Vice-Minister of Environment and the Director of Water Resources, both of MINAE, were requested to report on the facts alleged by the petitioning party.
  2. 3By means of a brief incorporated into the digital case file at 15:33 hours on May 15, 2026, José Miguel Zeledón Calderón, in his capacity as Director of Water Resources of MINAE, reported under oath as follows:

"ON THE MERITS FIRST: It is important to note that, with respect to the situation affecting the wells that are the subject of the amparo petition Exp-26-011167-0007-CO, the Dirección de Agua has conducted on-site inspections and generated relevant technical official communications. In this regard, and as pertinent, through official communication DA-UHTPNOL-514-2026 dated April 22, 2026, the following was stated: '(…) Furthermore, according to what was communicated to the undersigned by Mr. Bustos Caravaca, artisan well No. 02 is used by two of his siblings for domestic human consumption in two dwellings not located on the property where artisan wells Nos. 01 and 02 are situated. Likewise, artisan wells Nos. 01 and 02, as recorded in administrative case file (expediente administrativo) 27324-P, are located on the property registered under property registry folio (folio real matrícula) 62036-000, corresponding to cadastral plan (plano catastro) number G-0034618-2024, which is currently subject to a pending application for a water-use concession (concesión de aprovechamiento de agua) for said artisan wells.

Additionally, less than ten meters from artisan well No. 02 and less than one hundred meters from artisan wells Nos. 01 and 02, a watercourse was observed that was completely dry at the time of the inspection. For this reason, and in order to obtain a better technical assessment, a follow-up visit will be conducted during the rainy season, between the months of May and December of the current year. During the inspection, a Garmin Montana 680 GPS device was used, with a margin of uncertainty of (± 3 meters) and in CRTM05 projection. Finally, upon completion of the inspection, Mr. Bustos Caravaca stated to the undersigned that he had decided to secure the shed of artisan well No. 01 with his own padlock. It is hereby noted that said action was carried out of his own free will, without any intervention on the part of the undersigned in that decision.' (…) 'At the site where artisan well No. 01 is located, a meeting was held with representatives of the institutions mentioned in the preceding paragraph, as well as with Mr.

Juan María Bustos Caravaca (provisional executor (albacea provisional)), Mr. Jaime Enrique García Velásquez (manager of Hotel Bahía de los Piratas), Mr. Sabino Quintanilla Medina (attorney for the provisional executor), Mr. José Andrés García Chavarría (resident of Hotel Bahía de los Piratas), and Ms. Linsey Elena García Chavarría (domestic partner of the hotel manager and resident of Hotel Bahía de los Piratas) and [Nombre 001] (legal representative of the properties comprising Hotel Bahía de los Piratas).' (emphasis not in the original) (…) 'Subsequently, with the authorization of [Nombre 001], entry was made onto the properties forming part of Hotel Bahía de los Piratas (property parcels (fincas) with property registry folios 590-Z-000 and 85208, rights 01, 02, 03, and 04), and the corresponding inspection was carried out. During that visit, it was confirmed that the properties are used for tourism purposes, with a laundry area, villas, swimming pool, restaurant, and mini-market observed, as shown in figures 03, 04, 05, 06, and 07. (…)

It is important to note that, according to [Nombre 001], one of the villas is the residence of her son José Andrés García Chavarría and her daughter Linsey Elena García Chavarría, together with their respective families. Likewise, on an occasional basis, she and her husband René García Arguello (both legal representatives of the properties comprising Hotel Bahía de los Piratas) reside in one of the villas. Similarly, Mr. Richard Arthur Hahn, owner of right 04 of the property parcel with property registry folio 85208, uses one of the villas during certain periods of the year. Finally, having determined that Mr. García Velásquez and Ms. García Chavarría do not hold legal representation of the properties with property registry folios 590-Z-000 and 85208, rights 01, 02, 03, and 04, [Nombre 001] was notified that no water use of any kind from artisan well No. 01 may be carried out, given that they do not hold the corresponding authorization from this Ministry.

Likewise, Mr. Bustos Caravaca was notified that he may not carry out any water use from artisan well No. 02, since that well is located on a property different from those where the water use takes place. The respective notifications are attached to this report. Therefore, the following conclusions are reached: 1. The existence of two artisan wells (Nos. 01 and 02) was verified, both equipped for water extraction, located on the property identified in the application for a water-use concession pending under administrative case file number 27324-P in the name of Fidencio Bustos Bustos; however, the water resource is being used on properties different from the one where said wells are located. 2. Artisan well No. 01 is linked to tourism activities at Hotel Bahía de los Piratas, and water use is carried out on property parcels with property registry folios 590-Z-000 and 85208, rights 01, 02, 03, and 04; however, there is no water-use concession granted in the name of the hotel or any of the legal entities that own said properties. 3.

Artisan well No. 02 is used for domestic human consumption in dwellings not located on the property where it is situated, which constitutes an irregular condition in the use of the resource. 4. A watercourse was identified near the artisan wells, which was dry at the time of the inspection; however, follow-up during the rainy season is considered necessary for an adequate technical assessment. 5. It is hereby noted that the action taken by Mr. Juan María Bustos Caravaca, consisting of placing a padlock on the shed of artisan well No. 01, was carried out of his own free will, without the intervention of the undersigned. 6. Documentation submitted by [Nombre 001] was received, related to the use of artisan well No. 01, including electricity bill receipts, bank transfers for water supply services, and an authorization for the use of artisan well No. 01 issued by a relative of the former provisional executor.

7. Having determined that Mr. Jaime Enrique García Velásquez and Ms. Linsey Elena García Chavarría do not hold legal representation of the properties with property registry folios 590-Z-000 and 85208, rights 01, 02, 03, and 04, [Nombre 001] was notified that no water use of any kind from artisan well No. 01 may be carried out, given that they do not hold the corresponding authorization from this Ministry. 8. Likewise, Mr. Juan María Bustos Caravaca was notified that he may not carry out any water use from artisan well No. 02, since that well is located on a property different from those where the water use takes place. 9. It is recommended that this administrative case file be referred to the Legal Advisory Directorate of this Ministry for the legal handling of the matter.' The foregoing arose in connection with administrative case file number 27324-P in the name of Fidencio Bustos Bustos, under a pending application for a water-use concession for two artisan wells, bringing to light the actual conditions of use that were taking place and that deviate from the regulations governing the operation of artisan wells.

SECOND: The facts alleged by the petitioner have already been claimed before the same Sala Constitucional under case 26-011125-0007-CO, attended to by the Ministerio de Ambiente y Energía, and in that regard, through official communication DA-UHTONOL-0515-2026, the following was stated regarding the allegations: 'In response to the writ of amparo processed under case number 26-011125-0007-CO, filed by René García Arguello on behalf of María Rosa Bustos Duarte, concerning an artisan well located in Playa Real, district of Cabo Velas, canton of Santa Cruz, province of Guanacaste, to which this Directorate assigned correspondence number 1345-2026, I wish to state the following: 1. The artisan well referenced in the writ of amparo corresponds to one of the two artisan wells subject to pending proceedings under administrative case file number 27324-P in the name of Fidencio Bustos Bustos. Said case file is in digital format. 2.

Through official communication DA-UHTPNOL-0514-2026, dated April 22, 2026, the corresponding inspection report on the situation of the two artisan wells subject to pending proceedings under the administrative case file referenced in the preceding point was issued. 3. The writ of amparo states that it is filed on behalf of Ms. María Rosa Bustos Duarte, who does not hold legal representation of the property where the artisan wells are located. 4. During the inspections conducted on March 27, 2026 and April 9, 2026, Ms. Bustos Duarte did not appear at the site to learn about the situation of the well of her interest; furthermore, it is unknown whether she resides permanently at the location.

5. On April 6, 2026, a motion for reconsideration and nullity motion (incidente de nulidad) were filed through this Directorate's correspondence application, to which management number 1084-2026 was assigned. This is pending analysis and resolution. 6. On April 15, 2026, correspondence was admitted through the SIPECO application, corresponding to a motion for reconsideration with alternative appeal, which was assigned on April 16, 2026, to legal advisor Alberto Quirós Sanabria for the corresponding analysis and resolution. 7. The administrative case file referenced in point 01 contains the information detailed in the preceding points.' THIRD: With regard to the processing of the application for use of the wells that are the subject of the writ of amparo, processed under case file 27324-P, technical assessment DA-UHTPNOL-525 dated April 23, 2026, was issued, which states, as relevant: (…) 'The aspects noted above are set forth in official communication DA-UHTPNOL-0514-2026 dated April 22, 2026.

Furthermore, artisan wells Nos. 01 and 02 are located within the Playa Brasilito aquifer (acuífero), which is currently categorized as an area with special water characteristics, subject to regulation for the granting of new drilling permits and/or concessions. Likewise, in agreement 5 of the minutes CTI-007-2023, dated August 31, 2023, the following is stated: "(…) Based on the results of the studies, water availability has been identified in certain areas of the studied aquifers, which will only be sufficient to meet immediate and short-term water demand. Given that these are fragile aquifer systems that respond directly to rainfall variation and are vulnerable to saltwater intrusion (intrusión salina), and in accordance with Article 50 of the Political Constitution, sustainable use and the human right of access to water must be promoted. Accordingly, it is recommended to MINAE that the use of available water and access thereto be channeled through public utility operators to meet the water demand of the area.

In the case of ASADAS, the registration of the required water flow shall be carried out through AyA, in accordance with applicable legal regulations (…)" In connection with the foregoing, it is important to note that through resolution R-0283-2023-MINAE, dated September 18, 2023, in section I of the "Por tanto," the following is established: "(…) TO ACCEPT the recommendation of the Comisión Técnica Interinstitucional para la Gestión del Agua Subterránea pursuant to agreement 5 of the minutes CTI-007-2023 of August 31, 2023, to the effect that the use of available water as identified in the studies and access thereto be channeled through public utility operators to meet the area's water demand (…)" Therefore, it is recommended to deny the application for a water-use concession from artisan wells Nos. 01 and 02, on the following grounds:

  • a)The water use from artisan well No. 01 corresponds to tourism use, which is carried out on a property different from the one where said well is located. b) Artisan well No. 02 is used for domestic human consumption; however, the water resource is used on properties different from the parcel where the well is located. c) Artisan wells Nos. 01 and 02 are located within the Playa Brasilito aquifer, which has restrictions on the granting of new concessions due to its hydrogeological conditions and its categorization as an area with special water characteristics. d) In accordance with resolution R-0283-2023-MINAE, the use of the water resource available in said aquifer must be channeled through the area's public utility operator. FOURTH: In response to the previously filed writ of amparo in case 26-011125-0007-CO, through official communication DA-0903-2026 dated April 23, 2026, the following was set forth regarding the concessions for the artisan wells in light of the facts claimed: 'Pursuant to Article 6 of the Ley de Aguas, any person may lift water within their own property to satisfy their basic needs.

The cited article reads: "Article 6.– Any property owner may freely, without the need for a concession, dig wells to lift water within their properties for domestic use and the ordinary necessities of life, even if the result is a reduction of water available to their neighbors; however, a distance of two meters between wells must be maintained within populated areas, and fifteen meters in rural areas between the new excavation and the neighboring wells, ponds, springs, and permanent irrigation channels of neighbors." In accordance with the foregoing, an artisan well may be dug for domestic use without a permit, by the property owner, to cover their domestic needs. A requirement of this provision is that the well be located on the same property where it will be used, which is not the case here. Now, if the use is domestic, the well does not require a concession; however, if any other use is intended, a concession must be sought by the owner of the property where the well is located and where it is to be used.

In other words, the use being made of well No. 1 by the owners or users of Hotel Bahía de los Piratas is unlawful, and therefore it must be closed; those with an interest in the matter must seek another water source to supply the hotel. The same applies to well No. 2: the individuals using it must seek another source or public utility provider to supply them with potable water.' FIFTH: That being the case and in the interest of truth, what has been stated above makes it abundantly clear that the framing of the facts alleged by the petitioner does not correspond to reality, and that the actions taken by the Dirección de Agua have been in strict compliance with the regulations governing the matter and NOT an arbitrary act, as the petitioner would have it appear; on the contrary, in protection of the water resource and in accordance with the law, the misuse of the artisan wells—which were being put to uses not permitted by law without the corresponding concession—has been brought to a halt.

PRAYER FOR RELIEF For the reasons set forth above, it is requested that the writ of amparo be dismissed in all its aspects insofar as it concerns the Dirección de Agua-MINAE, given that the latter has acted in accordance with the law without any violation of constitutional provisions. Likewise, since the facts and petitioners are the same, it is requested that cases 26-011125-0007-CO and 26-011167-0007-CO be consolidated on grounds of connection."

  1. 4By means of a brief incorporated into the digital case file at 12:22 hours on May 18, 2026, María Navarro del Valle, in her capacity as Minister of Environment and Energy, reported under oath to the same effect as the report submitted by the Director of Water Resources of that Ministry. She requests that the petition be dismissed.
  2. 5By means of a brief incorporated into the digital case file at 14:36 hours on May 21, 2026, the following is reported under oath:

"FIRST: The area of Bahía de los Piratas, Playa Real, Cabo Velas, District of the Canton of Santa Cruz, Province of Guanacaste, does not have water service provided by the corresponding ASADA.

A/ True.

The sector referenced does not have potable water service available. The reason for the absence of service is that the ASADA does not have technical feasibility (factibilidad técnica) in the sector. The technical feasibility is lacking because: 1) there is no hydraulic capacity—that is, there is no distribution pipeline. The last service provided is located approximately one kilometer away. 2) there is no water resource capacity; based on AyA's recommendations in its official communication GSD-UEN-GAR-2020-01426-F (see Annex 1), the ASADA has received a recommendation from the governing authority not to grant additional availabilities, a recommendation that the ASADA, as a delegated utility operator, is required to follow.

SECOND: Given this situation, the resident families—approximately 16 in total—have depended for more than 50 years on an artisan well located in Playa Real as their sole source of water supply, which serves all these families, including schoolchildren and elderly persons.

THIRD: On March 27, 2026, MINAE official Ms. Diana Meza Calderón appeared in Playa Real and WITHOUT PRIOR NOTICE NOTIFIED PERMANENT RESIDENTS MR. JAIME ENRIQUE GARCÍA VELÁSQUEZ AND MS. LINSEY ELENA GARCÍA CHAVARRÍA of the closure of the well, warning them that no type of access to or use of the water would be permitted, as they had not been authorized by MINAE, and that any use of the water would result in criminal proceedings for the offenses of misappropriation of water and contempt of authority—this despite the protests of Ms. García regarding the need to attend to the basic needs of her household and, in particular, her children Sebastián García García, aged 15 and 5, respectively, the first a secondary school student and the second a preschool student. The public official permitted a private individual to place a padlock on the door of the well, which is unlawful.

A/ Not within our knowledge.

FOURTH: The closure of the well left all permanent resident families in Playa Real—and particularly the founding settlers, the FAMILIA BUSTOS DUARTE, OWNERS OF THE WELL IN QUESTION—without access to water, directly affecting their fundamental rights such as health, human dignity, and ultimately life, given that life depends on water as a fundamental balance between health and illness.

A/ Not within our knowledge.

FIFTH: For many years, we residents have engaged in verbal and written efforts, participating in meetings convened by the ASADA de Matapalo and the Ministry of Health, with the aim of providing the community of Playa Real with potable water service, without positive results, despite the pipeline being located approximately one kilometer away; and the officials of the aforementioned ASADA justify the failure to provide the public service on the grounds of lack of financial resources. MINAE, knowing that the community of PLAYA REAL depends on the artisan well, ordered its closure to prevent us from obtaining water, as stated above.

A/ Partially true.

We refer solely to the efforts that the petitioner states she made in connection with the request for potable water service.

As a result of a request for service availability submitted by the petitioning parties, a notice of non-availability was issued, citing as the reason the absence of infrastructure (pipeline) along any boundary of the property to be served. In this regard, the following provision from the Reglamento de Prestación de Servicios is noted:

Article 8.– On services. AyA shall provide water supply services for population use and wastewater sanitation services within the coverage area, provided that the area has technical and legal feasibility.

For a better understanding of the foregoing, the concept of Technical Feasibility as extracted from the same regulation cited above is set forth:

Technical feasibility analysis for the granting of services: The process of verifying the actual and current existence of sufficient water, hydraulic, material, technical, legal, and environmental resources to grant service availability and eventual connection. For such purposes, the following conditions must be observed:

a. That the distribution and collection networks run along the boundaries of the property, or that there is direct access via public road or right-of-way easement (servidumbre de paso) from the property for which a service is requested.

b. That the systems have sufficient water, hydraulic, potabilization, and treatment capacity to grant new services.

c. That the system meets the established quality standards.

d. That it complies with applicable environmental regulations.

Given the foregoing, the non-availability response is grounded in points a) and b). Additionally, as further evidence of non-compliance with point b) of the Technical Feasibility concept, the following is noted from official communication GSD-UEN-GAR-2025-01254 (Annex 3), page 6, point 2, which states verbatim:

The result of the water balance has been negative since 2023, and even through the 20-year projection it remains negative. This is because the balance takes into account only the flow rates granted as concessions by the DA of MINAE; consequently, due to the restriction on water extraction for human consumption issued by the CTI, the flow rates from the sources have not increased—this aimed at preventing contamination of the wells by saltwater intrusion. All of this applies within the area of influence of the Huacas-Tamarindo aquifer.

Given the foregoing, the ASADA's decision to issue a notice of non-availability is supported.

SIXTH: The conduct of the MINAE public official and of the ASADA DE MATAPALO—the former for the unlawful action of appearing without prior notice and impeding the community of PLAYA REAL from using the artisan well, without any due process that would allow the community and those affected to exercise their right of defense, given that the notification of March 27, 2026 grants a period of 10 days to process a water-use concession before MINAE while simultaneously, in the same act, prohibiting the use of the water from the only available well, which constitutes an arbitrary and unlawful act without justification, content, or purpose, and is instead punitive in nature, without the right of defense or the right to survival, since using said well would turn the water-deprived citizen-user into a criminal; and the ASADA, through its inaction in meeting the basic obligations for which it was created—namely, supplying potable water to the families within its jurisdiction—bears responsibility for the community's lack of access to potable water.

A/ False.

While it is true that Article 50 of the Political Constitution establishes that access to water is a human right, this does not mean that it constitutes an unrestricted service. As has been reiterated throughout this document, access to potable water service availability must meet a series of water-related, environmental, legal, and infrastructure conditions. Moreover, there is extensive case law supporting the foregoing.

  1. 6The legal requirements have been observed in the proceedings followed.

Drafted by Justice Garro Vargas; and,

Whereas:

I.Subject of the petition. The petitioning party claims that MINAE officials ordered the immediate closure of the artisan well that, for several decades, has constituted the sole water supply source for the inhabitants of the community of Bahía de los Piratas, Playa Real, Cabo Velas, and prohibited its use on the grounds that it lacked administrative authorization—including by placing a padlock on the access point and under the threat of initiating criminal proceedings against anyone who made use of the water resource. The petitioner contends that this action left the resident families—including minors and elderly persons—without access to water, affecting their fundamental rights. The petitioner likewise alleges that, despite years of efforts before the ASADA de Matapalo and the Ministry of Health to obtain potable water service, the competent authorities have failed to take the necessary measures to guarantee that public service, leaving the community without a regular water supply.

II.Proven facts. Of relevance to the decision of this matter, the following facts are considered duly established, either because they have been corroborated or because the responding party failed to address them as required by the initial order:

  • c)On August 31, 2023, the Comisión Técnica Interinstitucional para la Gestión del Agua Subterránea agreed that the Playa Brasilito aquifer has water availability only sufficient to meet immediate and short-term demand, given that it constitutes a fragile system vulnerable to saltwater intrusion, and accordingly recommended that the use of the available water resource and access to water in that area be channeled through public utility operators (see the report of the responding authority and the evidence submitted to the digital case file).
  • d)On September 18, 2023, through resolution no. R-0283-2023-MINAE, MINAE accepted the recommendation issued by the Interinstitutional Technical Commission for Groundwater Management, to the effect that the use of the available water in the Playa Brasilito aquifer (acuífero) had to be carried out through the corresponding public service operator entity (see the report of the respondent authority and the evidence submitted to the digital file).
  • e)On March 27, 2026, MINAE officials conducted an inspection at Playa Real, Cabo Velas, Santa Cruz, for the purpose of verifying the conditions of two hand-dug wells (pozos artesanales) whose application for a water-use concession (concesión de aprovechamiento de agua) is being processed in administrative file (expediente administrativo) no. 27324-P, establishing that both wells were located on the property parcel (finca) registered within that administrative proceeding and had equipment installed for the capture of the water resource (see the report of the respondent authority and the evidence submitted to the digital file).
  • f)On March 27, 2026, during the inspection referred to above, it was verified that the use of water from hand-dug well no. 1 was destined for the operation of the Hotel Bahía de los Piratas, specifically for tourism-related activities carried out on the property parcels with cadastral registration numbers (folios reales matrículas) 590-Z-000 and 85208, rights 01, 02, 03, and 04, without any water-use concession having been granted in favor of the hotel or the legal entities that own those properties (see the report of the respondent authority and the evidence submitted to the digital file).
  • g)On March 27, 2026, it was also established that the water extracted from hand-dug well no. 2 was being used for domestic human consumption in dwellings located outside the property where that well is situated, even though both wells are part of administrative file no. 27324-P (see the report of the respondent authority and the evidence submitted to the digital file).
  • h)On March 27, 2026, the appellant (recurrente) was notified that she could not make any use of the water from hand-dug well no. 1, as she lacked the corresponding authorization granted by MINAE; likewise, Juan María Bustos Caravaca was notified that he could not use the water from hand-dug well no. 2, because it is located on a property different from the one where the water resource was being used (see the report of the respondent authority and the evidence submitted to the digital file).
  • i)On March 27, 2026, Juan María Bustos Caravaca, acting on his own initiative and without any intervention by MINAE officials, placed a padlock on the pump house of hand-dug well no. 1 (see the report of the respondent authority and the evidence submitted to the digital file).
  • j)On April 9, 2026, MINAE officials conducted a second inspection at the site together with representatives of the Municipality of Santa Cruz, the ASADA de Matapalo, the Ministry of Health, the Flamingo Tourist Police, and the Instituto Costarricense de Acueductos y Alcantarillados. The appellant participated in this proceeding, providing proof of payment for the electric service, bank transfers related to the water supply, and an authorization for the use of hand-dug well no. 1 issued by a relative of the former provisional executor (albacea provisional) (see the report of the respondent authority and the evidence submitted to the digital file).
  • k)On April 9, 2026, during the inspection carried out at the Hotel Bahía de los Piratas with the authorization of the petitioner (promovente), it was verified that the property included, among other facilities, a laundry, villas, a swimming pool, a restaurant, and a convenience store, confirming that the water from hand-dug well no. 1 was being used for tourism-related activities (see the report of the respondent authority and the evidence submitted to the digital file).
  • l)On April 22, 2026, MINAE issued technical official document (oficio técnico) no. DA-UHTPNOL-0514-2026, in which it concluded that the use of hand-dug wells nos. 1 and 2 was being carried out under conditions different from those authorized by current legislation, recommended referring the administrative file to the Legal Advisory Directorate for the corresponding legal action, and decided to continue technical monitoring of the watercourse near the wells during the rainy season (see the report of the respondent authority and the evidence submitted to the digital file).
  • m)On April 23, 2026, MINAE issued technical opinion (criterio técnico) no. DA-UHTPNOL-525-2026, in which it recommended denying the water-use concession application corresponding to hand-dug wells nos. 1 and 2, on the grounds that the first supplied tourism-related uses conducted on a property different from the one where the well is located, the second supplied water to dwellings situated outside the property parcel where it is found, both are located within the Playa Brasilito aquifer, which is subject to restrictions on the granting of new concessions, and resolution no. R-0283-2023-MINAE provides that the use of the water resource in that area must be channeled through the corresponding public service operator entity (see the report of the respondent authority and the evidence submitted to the digital file).
  • n)At the time the report was filed, the community of Bahía de los Piratas, Playa Real, Cabo Velas, did not have access to the potable water supply service provided by the ASADA de Matapalo, due to the absence of distribution infrastructure in the area and the lack of sufficient water capacity to grant new service availabilities, in accordance with the recommendations issued by the Instituto Costarricense de Acueductos y Alcantarillados and the negative water balance of the Huacas-Tamarindo aquifer (see the respondent's reply and the evidence submitted to the digital file).

III.On the specific case. The appellant claims that MINAE officials ordered the closure of a hand-dug well located at Playa Real de Cabo Velas, Santa Cruz, prohibiting the use of water that, she asserts, constitutes the sole source of supply for several families in the community. She alleges that this action was carried out arbitrarily, without observing due process, thereby affecting the residents' access to water.

With regard to the grievance raised against MINAE, this Chamber finds that the present matter must be resolved in the same manner as in judgment no. 2026-021173 of 9:30 a.m. on June 12, 2026, issued in case no. 26-011125-0007-CO. On that occasion, this Tribunal examined an amparo appeal (recurso de amparo) brought in connection with the same administrative action taken by that authority with respect to the use of water from the hand-dug wells located at Playa Real de Cabo Velas, Santa Cruz, and therefore the criterion set forth therein is reiterated here. In that judgment, the following was decided:

"I.- SUBJECT MATTER. The appellant alleged that the protected party (amparada) is an elderly person and is the owner of a hand-dug well located at Playa Real de Cabo Velas de Santa Cruz, Guanacaste. He accuses the respondent authority of having illegally closed that well with padlocks, without guaranteeing due process, leaving the family without water.

(…)

IV.Specific case. In accordance with the sworn reports, with the legal consequences—including criminal ones—provided for in article 44 of the Law governing this Jurisdiction, it is established that the protected party María Rosa Bustos Duarte, national identification number 502320252, does not hold any real estate registered in her name. The well that was closed due to illegal use is not located on any property owned by the protected party. According to the National Concessions Registry maintained by the Water Directorate of MINAE, there is a water-use concession application for two hand-dug wells under file no. 27324-P, in the name of Mr. Fidencio Bustos Bustos. The concession is being processed in order to use the water from the wells for agricultural and livestock use. Prior to resolving the file, on March 27, 2026, an inspection was carried out at the site in order to verify the condition of the wells and to confirm whether they are in fact dug (hand-dug) or drilled wells.

Upon arriving at the site, the official from the Tempisque–Pacífico Norte Hydrological Unit of the Water Directorate confirmed that two hand-dug wells do indeed exist on the property. As indicated in technical official document DA-UHTPNOL-0514-2026 of April 22, 2026, both wells are located in concrete pump houses protected with chains and padlocks. At the property, the official was received by Mr. Juan María Bustos Caravaca, who indicated that he did not have the keys to the pump house of well no. 1, but that the keys were at the Hotel Bahía de Los Piratas, as it is that establishment that uses the water. At the hotel, Mr. Jaime Enrique García Velásquez, who identified himself as the Hotel Administrator, reported that he holds a water-use concession application for both wells. Well no. 1 is managed by the hotel. The condition of the well was verified on site and the corresponding notice was served on Mr.

Jaime García Velásquez in the capacity indicated above. At the time of the inspection of the aforementioned well, Ms. Linsey García Chavarría appeared and stated that she was the owner of the property where the hotel that uses the water from hand-dug well no. 1 is located. The corresponding notification of non-use of the water was served on both Ms. García Chavarría and Mr. García Velásquez, since the use constitutes an illegal appropriation for lack of any concession. Mr. Bustos Caravaca proceeded to place a padlock on well no. 1 to avoid any problems. It was placed on record 'that the action taken by Mr. Juan María Bustos Caravaca with respect to the placement of a padlock on the pump house of hand-dug well no. 1 was carried out of his own volition, without any intervention by the undersigned,' a MINAE official. Subsequently, on April 9, 2026, a second inspection was conducted at the site, jointly with officials from the Municipality of Santa Cruz, the ASADA de Matapalo, and the Ministry of Health, as well as the Flamingo Tourist Police and an official from the AyA Regional Office.

Also present at the meeting were Mr. Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla Medina, José Andrés García Chavarría, Linsey García Chavarría, and [Name 001], the latter allegedly as the legal representative of the properties comprising the Hotel Bahía de los Piratas. Ms. [Name 001] provided documentation of bank transfer payments for water, as well as a letter signed by the appellant authorizing the use of the well. During the inspection of the hotel, conducted with Ms. Chavarría's authorization, it was established that the water use is for tourism purposes. On the property, there is another hand-dug well, no. 2, which is used for domestic human consumption in dwellings not located within the property where it is situated, which constitutes an irregular condition in the use of the resource. Likewise, Mr. Juan María Bustos Caravaca was notified that he cannot make any use of the water from hand-dug well no. 2, because that well is located on a property different from the one where the use is taking place.

From the foregoing, it is concluded that there is no basis for granting the appeal. In the first place, there is no evidentiary element from which it could be established that the closure of well no. 1 left the protected party without access to water. On the contrary, the report is very clear that the use is by a hotel. Furthermore, the report is also very clear as to who received the MINAE official at the inspection and placed a padlock: 'At that point, Mr. Bustos Caravaca proceeded to place a padlock on well no. 1 to avoid any problems,' a fact that was duly recorded. Moreover, the report also explains that there is no concession, even though the water is used on a property (where the hotel is located) different from the property where the well is situated. In sum, for the reasons stated, the appeal must be dismissed." Having conducted a comprehensive examination of the file, this Chamber finds no reason to depart from the criterion set forth in the quoted precedent.

Indeed, the facts underlying the grievance raised against MINAE substantially coincide with those that were analyzed in the cited judgment. Likewise, the sworn reports and the evidence incorporated into the file make it possible to verify the same factual circumstances that supported that decision, including the inspections conducted by MINAE officials, the conditions under which the water resource was being used, the notifications served on the persons involved, the absence of a concession authorizing such use, and the circumstances surrounding the placement of the padlock on the pump house of the hand-dug well.

That being the case, this Tribunal finds no new factual or legal elements that would justify modifying the criterion previously adopted. On the contrary, the evidence incorporated into these proceedings confirms the findings considered in judgment no. 2026-021173, so that the reasons that sustained that decision remain fully applicable to resolving the grievance now raised.

Consequently, for the same reasons set forth in the cited precedent, which are hereby reiterated, no arbitrary action on the part of MINAE nor any violation of fundamental rights attributable to that authority has been established. Therefore, with respect to this claim, the appeal must be dismissed.

IV.Regarding the ASADA de Matapalo, Santa Cruz. With respect to the grievance raised against the ASADA de Matapalo de Santa Cruz, the appellant accuses that entity of having failed to provide the potable water supply service to the community of Bahía de los Piratas, Playa Real de Cabo Velas, despite the efforts that, she asserts, the residents have made over several years to obtain connection to the distribution system. She contends that this omission has forced them to rely on a hand-dug well, whose use was subsequently restricted by MINAE, a situation that, in her view, violates their fundamental rights.

It should be clarified for the petitioning party that, while this Chamber has repeatedly recognized that access to potable water constitutes a fundamental right indispensable for the enjoyment of a dignified life, it has also held that this right is not absolute in nature, so that the entities responsible for providing the service may deny a request or find themselves unable to supply it when there are objective technical, material, or legal reasons that justify such a position. In that regard, this Tribunal has stated the following:

"IV.- On the specific case. In the sub lite, the appellant considers her fundamental right of access to potable water to be violated. She indicates that she is the owner, together with her husband, of the property with cadastral registration [of San José, cadastral plan no. SJ-1843630-2015. She indicates that through a request made by her husband to the Instituto Costarricense de Acueductos y Alcantarillados, water availability was requested for the aforementioned plot; however, through memorandum no. UNDGAM-0583-2018-1803 of February 21, 2018, the respondent institute denied the request, on the grounds that no availability exists (…) In the area indicated by the appellant, the existing potable water infrastructure in front of the property does not have sufficient capacity to supply the property. The potable water production that currently exists and supplies the infrastructure located in front of the property does not have sufficient capacity to supply the property.

The population in the area has been growing and this has generated high demand, which has resulted in the system that supplies the area currently being insufficient. The situation is compounded by the topographic elevation of the area, the limited capture sources in the sector, and the lack of cadastral control in the area by the competent municipality. That being the case, the appropriate course of action is to dismiss the amparo appeal. This Constitutional Tribunal has stated in repeated judgments on the subject that the supply of potable water is considered under Costa Rican law to be a public service, and that as such, every public service provider—whether a public or private entity—is obligated to provide the service on a continuous, efficient, and equal basis and must adapt to technological changes (see Judgment no. 2001-09676 and no. 2004-08161). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public potable water service, is also obligated to provide this service continuously, adaptably, efficiently, and equally to all residents.

Moreover, the jurisprudence of this Tribunal has also indicated that, in the face of a legal impossibility (which is the failure to meet requirements established in the relevant regulations) or a formal impossibility (which is the absence of a water distribution network), it is reasonable to decline service requests or to ask the interested party to bear the installation costs when no potable water distribution network exists and the construction of infrastructure is required. Thus, in these cases it has been made clear that this does not constitute a denial of access to the potable water service, but rather the impossibility of providing it or the need for the interested party's participation in overcoming a technical obstacle, namely the lack of infrastructure. In other words, as long as the failure to provide the potable water service is not capricious, arbitrary, or unsubstantiated, but is instead justified by a legal or material impossibility, there is no violation of fundamental rights.

In the present case, the respondent authority clearly states that the appellant must comply with what is stipulated in the Ley de Planificación Urbana and the Plan Regulador. Furthermore, the protected party was informed that there is no associated availability for the subdivision (fraccionamiento) of the parent property from which the property under analysis was generated, nor is there supply capacity in the sector. Finally, the respondent states that in the area indicated by the appellant, the existing potable water infrastructure in front of the property does not have sufficient capacity to supply the property. Thus, there is both a legal and a formal or technical impossibility, since the subdivision of the land was carried out without the prior acquisition of availability and, furthermore, because in the area where the property is located there is insufficient capacity to provide the public service.

As a corollary to the foregoing, the Chamber considers that the amparo appeal must be dismissed, since in accordance with the jurisprudential line taken by this Tribunal in similar cases, it is possible to deny the supply of potable water when a legal and/or formal technical impossibility is found to exist, as is the case here, so that the fundamental rights of the petitioning party would not be violated. If what the appellant disputes is the denial itself and the grounds on which it rests, that is a matter of legality that cannot be litigated in this forum. Furthermore, the Chamber notes that the protected party was expressly informed of the reasons why the service authorization was not granted, and therefore her fundamental rights were not violated in that respect either." (emphasis not in the original).

Based on that jurisprudential criterion, this Chamber finds no merit in the present appeal with respect to the grievance directed against the ASADA. Indeed, the sworn reports reveal that the community of Bahía de los Piratas does not have access to the potable water supply service due to the absence of distribution infrastructure in the area and the lack of sufficient water capacity to grant new service availabilities. It was likewise stated that the Instituto Costarricense de Acueductos y Alcantarillados has recommended against authorizing new connections, in view of the negative water balance of the Huacas-Tamarindo aquifer—circumstances that, as reported, technically prevent the provision of the service under the conditions sought by the appellant.

That being the case, this Tribunal considers that the situation described in the record reflects technical and material limitations that were duly explained by the respondent authority and do not stem from a capricious, arbitrary, or unsubstantiated course of action. On the contrary, the alleged impossibility is grounded in technical criteria related to the capacity of the supply system, the absence of distribution infrastructure in the area, and the existing water restrictions—circumstances that, pursuant to the constitutional jurisprudence of this Chamber, constitute objective reasons justifying the impossibility of providing the requested service.

Consequently, it has not been established that the ASADA incurred any violation of the appellant's fundamental rights. On the contrary, the refusal to supply the potable water service results from technical circumstances that, according to the evidence incorporated into the file, currently prevent its provision. Therefore, with respect to this claim as well, the appeal must be dismissed.

V.Partial dissenting vote of Justice Cruz Castro. I dissent from the majority opinion. In the present case, the Administration's refusal to provide an essential service is upheld on the basis of technical considerations relating to the insufficiency of water infrastructure; however, it fails to adequately weigh the fact that access to potable water constitutes a fundamental right, indispensable for life, health, and human dignity.

Article 21 of the Political Constitution protects human life, and this Tribunal has recognized that access to water for human consumption is a material prerequisite of that right. Likewise, article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all residents, which necessarily includes effective, sufficient, and continuous access to potable water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights (Comité DESC) in its General Comment No. 15—recognize the human right to water, obligating States to adopt positive measures for its full realization. There is a heightened obligation imposed on the State in a social and democratic rule-of-law state; for this reason, the supply of water is a priority obligation of public authorities.

From this perspective, the invocation of technical limitations cannot serve as an absolute justification for disregarding a basic subsistence need. The Administration cannot limit itself to noting the insufficiency of the system; it has the legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to the water service, especially when human consumption is at stake.

The majority approach normalizes a structural omission: it accepts that the lack of infrastructure exempts the State from its obligation, when that very deficiency evidences a failure to fulfill its duty of foresight. This is not a matter of compelling the impossible, but of requiring the Administration to adopt reasonable, alternative, or progressive measures so as not to leave people unprotected.

Water is not just any service—it is an essential human right; therefore, the respondent authority cannot absolve itself of its duty to guarantee it by shielding itself behind technical limitations without offering effective solutions.

For these reasons, I consider that the appeal should have been granted, at least in order to order the Administration to adopt specific and progressive measures to guarantee, within a reasonable time, the appellant's effective access to potable water. Water is a good and a fundamental right whose effectiveness must be genuinely ensured—it is an inescapable duty.

VI.Documentation submitted to the file. The parties are hereby cautioned that, if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court in Session No. 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judicial Branch in Session No. 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The appeal is dismissed. Justice Cruz Castro dissents with respect to the ASADA de Matapalo, Santa Cruz, and would grant the amparo appeal, ordering the adoption of specific measures and the indication to the protected party of a certain date by which the water supply will be satisfied.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintitres de julio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-011167-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) y la ASADA MATAPALO DE SANTA CRUZ.

Resultando:

  1. 1Mediante escrito incorporado al expediente digital a las 19:08 horas del 28 de marzo de 2026, la parte recurrente interpone recurso de amparo en contra del MINAE y la ASADA de Matapalo de Santa Cruz. Según la resolución de curso, manifiesta lo siguiente:

“[D]esde hacía más de cincuenta años, la comunidad de Bahía de los Piratas, Playa Real, Cabo Velas ubicada en Santa Cruz de Guanacaste y compuesta por aproximadamente 16 familias residentes -con presencia de personas menores de edad y personas adultas mayores-, cuentan con un pozo artesanal ubicado en Playa Real como única fuente de abastecimiento de agua, al carecer del servicio de agua potable brindado por la ASADA local. El 27 de marzo de 2026 una funcionaria del MINAE -señora Diana Meza Calderón-, se apersonó de forma sorpresiva en la comunidad y notificó a los residentes permanentes -señores Jaime Enrique García Velásquez y Linsey Elena García Chavarría- el cierre inmediato del pozo, ordenando la prohibición total de su uso por carecer de autorización administrativa, con la advertencia de que cualquier acceso al agua daría lugar a procesos penales por usurpación de aguas y desobediencia a la autoridad.

Lo anterior, pese a las manifestaciones de necesidad expuestas por la señora García Chavarría para la atención básica de su hogar y de sus hijos, Sebastián y Camila, personas menores de edad. En esa misma ocasión, dicha funcionaria permitió que un particular colocara un candado en el acceso al pozo, dejando a la totalidad de las familias residentes, incluidos pobladores fundadores y copropietarios del pozo, sin acceso al agua, lo que afectó directamente derechos fundamentales como la salud, la dignidad humana y la vida. Indica que, desde años anteriores, la comunidad había realizado gestiones verbales y escritas ante la ASADA de Matapalo y el Ministerio de Salud para obtener el servicio de agua potable, sin resultados positivos, pese a que la red de tuberías se encontraba a aproximadamente un kilómetro, omisión que la ASADA justificó por falta de recursos económicos, atribuyéndose así al MINAE una actuación arbitraria e ilegal sin debido proceso ni derecho de defensa, y a la ASADA la responsabilidad por la persistente carencia del servicio público de agua potable. Considera que lo expuesto viola sus derechos fundamentales. Solicita que se declare con lugar el recurso, con las consecuencias de ley”.

  1. 2Por resolución de las 12:35 horas del 05 de mayo de 2026, la Presidencia de la Sala dio curso a este proceso constitucional y se le confirió audiencia a Efraín Milanés Obando Álvarez, cédula de identidad 0501540464, en su condición de presidente y representante judicial y extra-judicial, con facultades de apoderado general de la ASADA de Matapalo de Santa Cruz, para que se refiera sobre los hechos y omisiones que se le atribuyen. Asimismo, se le solicitó informe al viceministro de Ambiente y al director de Aguas, ambos del MINAE, sobre los hechos alegados por la parte recurrente.
  2. 3Mediante escrito incorporado al expediente digital a las 15:33 horas del 15 de mayo de 2026, informa bajo juramento José Miguel Zeledón Calderón, en su condición de director de Aguas del MINAE, lo siguiente:

“SOBRE EL FONDO PRIMERO: Importante destacar, que sobre la situación que aqueja a los pozos objeto del recurso de amparo EXP-26-011167-0007-CO, en cuanto a la actuación de la Dirección de Agua esta ha realizado inspecciones en el sitio y generado oficios técnicos de relevancia, al respecto en lo conducente mediante oficio DA-UHTPNOL-514-2026 de 22 de abril del 2026 se indicó: “ ( ) “ Por otra parte, según lo manifestado a la suscrita por el señor Bustos Caravaca, el pozo artesanal 02 es aprovechado por dos hermanos de este, para consumo humano doméstico en dos viviendas que no se encuentran dentro de la propiedad donde se ubican los pozos artesanales 01 y 02. Asimismo, los pozos artesanales 01 y 02, según consta en el expediente administrativo 27324-P, se localizan en la propiedad con finca folio real matrícula 62036-000 correspondiente al plano catastro número G-0034618-2024, la cual se encuentra en trámite de solicitud de concesión de aprovechamiento de agua de dichos pozos artesanales.

Por otra parte, a menos de diez metros de distancia del pozo artesanal 02 y a menos de cien metros de los pozos artesanales 01 y 02, se observó un cauce que se encontraba totalmente seco. Por lo anterior, y con el fin de contar con un mejor criterio técnico, se dará seguimiento al mismo en época lluviosa, esto entre los meses comprendidos de mayo a diciembre del presente año. En la inspección realizada se utilizó un GPS marca Garmin serie Montana 680 con un grado de incertidumbre (± 3 metros) y en proyección CRTM05. Finalmente, finalizada la inspección, el señor Bustos Caravaca manifiesta a la suscrita que tomó la decisión de asegurar la caseta del pozo artesanal 01 con su propio candado. Se deja constancia de que dicha acción fue realizada por su propia voluntad, sin intervención alguna por parte de la suscrita en la toma de dicha decisión.” ( ) “En el sitio, propiamente donde se ubica el pozo artesanal 01, se realizó una reunión con representantes de las instituciones mencionadas en el párrafo anterior, así como con los señores Juan María Bustos Caravaca (albacea provisional), Jaime Enrique García Velásquez (administrador del hotel Bahía de los Piratas), Sabino Quintanilla Medina (abogado del albacea provisional), José Andrés García Chavarría (residente del Hotel Bahía de los Piratas) y las señoras Linsey Elena García Chavarría (pareja sentimental del administrador del hotel Bahía de los Piratas y residente del Hotel Bahía de los Piratas) y [Nombre 001] (representante legal de los inmuebles que conforman el Hotel Bahía de los Piratas)”.

(negrita no es del original) ( ) “ Seguidamente, con la autorización de la señora [Nombre 001] se ingresa a los inmuebles que forman parte del Hotel Bahía de los Piratas (fincas con folio real de matrícula 590-Z-000 y 85208, derechos 01, 02, 03 y 04), se procedió a realizar la inspección correspondiente. En dicha visita se constató que el uso de las propiedades es de carácter turístico, observándose área de lavandería, villas, piscina, restaurante, minimercado, tal y como se aprecia en las figuras 03, 04, 05, 06 y 07. (…)

Es importante destacar que, según lo indicado por la señora [Nombre 001], en una de las villas reside su hijo José Andrés García Chavarría y su hija Linsey Elena García Chavarría, junto con su respectiva familia. Asimismo, de forma ocasional ella y su esposo René García Arguello (ambos representantes legales de los inmuebles que conforman el Hotel Bahía de los Piratas), habitan una de las villas. De igual forma, el señor Richard Arthur Hahn, dueño del derecho 04 de la finca folio real matrícula 85208, hace uso de una de las villas en determinadas temporadas del año. Finalmente, al comprobarse que el señor García Velásquez y la señora García Chavarría no ostentan la representación legal de las propiedades con folio real de matrícula 590-Z-000 y 85208, derechos 01, 02, 03 y 04, se procede a notificar a la señora [Nombre 001], que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 01, en virtud de que no cuentan con la autorización correspondiente por parte de este Ministerio.

Igualmente, se notifica al señor Bustos Caravaca ya que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquellas donde se realiza el aprovechamiento. Se adjuntan al presente informe las respectivas notificaciones. Por lo tanto, se concluye lo siguiente: 1. Se verificó la existencia de dos pozos artesanales (01 y 02), ambos con equipo instalado para la captación de agua, ubicados en el inmueble indicado en la solicitud de concesión de aprovechamiento de agua en trámite bajo el expediente administrativo número 27324-P a nombre de Fidencio Bustos Bustos, no obstante, el aprovechamiento del recurso hídrico se realiza en propiedades distintas a aquella donde se localizan dichos pozos. 2. El pozo artesanal 01 se encuentra vinculado al desarrollo de actividades de carácter turístico en el Hotel Bahía de los Piratas, y el aprovechamiento de agua se realiza en las fincas folios real de matrícula 590-Z-000 y 85208, derechos 01, 02, 03 y 04; sin embargo, no se cuenta con concesión de aprovechamiento de agua otorgada a nombre del hotel ni de ninguna de las personas jurídicas propietarias de dichos inmuebles. 3.

El pozo artesanal 02 es utilizado para consumo humano tipo doméstico en viviendas que no se ubican dentro de la propiedad donde este se localiza, lo cual constituye una condición irregular en el uso del recurso. 4. Se identificó un cauce cercano a los pozos artesanales, el cual se encontraba seco al momento de la inspección; no obstante, se considera necesario realizar seguimiento en época lluviosa para su adecuada valoración técnica. 5. Se deja constancia de que la actuación realizada por el señor Juan María Bustos Caravaca, respecto a la colocación de un candado en la caseta del pozo artesanal 01, ha sido efectuado por su propia voluntad, sin intervención de la suscrita. 6. Se recibió documentación aportada por la señora [Nombre 001], relacionada con el uso del pozo artesanal 01, la cual incluye comprobantes de pago de servicio de electricidad, transferencias bancarias por concepto de suministro de agua, así como una autorización para el uso del pozo artesanal 01, emitida por un familiar del anterior albacea provisional 7.

Al haberse determinado que el señor Jaime Enrique García Velásquez y la señora Linsey Elena García Chavarría no ostentan la representación legal de las propiedades con folio real matrícula 590- Z-000 y 85208, derechos 01, 02, 03 y 04, se procedió a notificar a la señora [Nombre 001], que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 01, en virtud de no contar con la autorización correspondiente por parte de este Ministerio. 8. Asimismo, se notificó al señor Juan María Bustos Caravaca que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquella donde se realiza el aprovechamiento. 9. Se recomienda trasladar este expediente administrativo a la Dirección de Asesoría Jurídica de este Ministerio para la atención legal del caso.” Lo antes descrito se generó en atención al expediente administrativo número 27324-P a nombre de Fidencio Bustos Bustos, en trámite de solicitud de concesión de aprovechamiento de agua de dos pozos artesanales, poniéndose en evidencia las condiciones de uso y aprovechamiento que se estaba dando realmente y que se aleja de las disposiciones que regulan el funcionamiento de los pozos artesanales.

SEGUNDO: Que los hechos alegados por la recurrente, ya han sido reclamados ante la misma Sala Constitucional en expediente 26-011125-0007-CO atendido por el Ministerio de Ambiente y Energía y que al respecto mediante el oficio DA-UHTONOL-0515-2026 sobre lo alegado se indicó: “En atención al recurso de amparo, tramitado bajo el expediente número 26-011125-0007-CO, interpuesto por René García Arguello a favor de María Rosa Bustos Duarte, referente a un pozo artesanal ubicado en Playa Real, distrito de Cabo Velas, cantón de Santa Cruz, provincia de Guanacaste, y al cual esta Dirección asignó el número de correspondencia 1345-2026, permito indicar lo siguiente: 1. El pozo artesanal indicado en el Recurso de Amparo corresponde a uno de los dos pozos artesanales que se encuentra en trámite bajo el expediente administrativo número 27324-P a nombre de Fidencio Bustos Bustos. Dicho expediente se encuentra en formato digital. 2.

Mediante el oficio DA-UHTPNOL-0514-2026, de fecha 22/04/2026, se emite el informe de inspección correspondiente sobre la situación de los dos pozos artesanales que se encuentran en trámite bajo el expediente administrativo mencionado en el punto anterior. 3. En el recurso de amparo se indica que el mismo se interpone a favor de la señora María Rosa Bustos Duarte, quien no ostenta la representación legal de la propiedad donde se ubican los pozos artesanales. 4. En las inspecciones realizadas en fechas 27/03/2026 y 09/04/2026, la señora Bustos Duarte no se apersonó al sitio para conocer la situación del pozo de su interés, asimismo, se desconoce si reside de forma permanente en el lugar.

5. En fecha 06/04/2026 se presenta recurso de revocatoria e incidente de nulidad mediante la aplicación de correspondencia de esta Dirección, al cual se le asignó el número de gestión 1084-2026. El mismo se encuentra pendiente de análisis y resolución. 6. En fecha 15/04/2026 se admite correspondencia mediante la aplicación de SIPECO, correspondiente a un recurso de revocatoria con apelación en subsidio, el cual fue asignado en fecha 16/04/2026 al asesor legal Alberto Quirós Sanabria para el respectivo análisis y resolución. 7. En el expediente administrativo indicado en el punto 01 consta la información detallada en los puntos anteriores.” TERCERO: Que respecto al trámite para el aprovechamiento de los pozos objeto del recurso de amparo y que se tramita mediante el expediente 27324-P dentro del mismo, se ha emitido el criterio técnico DA-UHTPNOL-525 de fecha 23 de abril del 2026, que en lo que interesa consignó: ( ) “Los aspectos anteriormente señalados se encuentran consignados en el oficio DA-UHTPNOL-0514- 2026 de fecha 22/04/2026.

Por otra parte, los pozos artesanales 01 y 02, se encuentran ubicados dentro del acuífero Playa Brasilito, el cual actualmente se encuentra categorizado como una zona con características hídricas especiales, sujeta a regulación para el otorgamiento de nuevos permisos de perforación y/o concesión. Asimismo, en el acuerdo 5 de la minuta CTI-007-2023, de fecha 31/08/2023, se indica: “(…) Conforme a los resultados de los estudios, se ha identificado disponibilidad de agua en algunas áreas de los acuíferos estudiados, que solo permitirá atender la demanda de agua inmediata y de corto plazo. Tomando en consideración que son sistemas de acuíferos frágiles, de respuesta directa a la variación de la precipitación y vulnerables a la intrusión salina, en apego al artículo 50 de la Constitución Política, se debe promover el uso sostenible y derecho humano de acceso al agua, por lo que se recomienda al MINAE, que el aprovechamiento del disponible y acceso al agua sea a través de entes operadores de servicio público para atender la demanda de agua de la zona.

En el caso de las ASADAS, la inscripción del caudal requerido será a través el AyA, conforme la normativa legal (…)” En relación con lo anterior, resulta importante señalar que mediante la resolución R-0283-2023- MINAE, de fecha 18/09/2023, en el apartado I del “Por Tanto”, se establece lo siguiente: “(…) ACOGER la recomendación la Comisión Técnica Interinstitucional para la Gestión del Agua Subterráneas según acuerdo 5 minuta CTI-007-2023 del 31 de agosto de 2023, en sentido que el aprovechamiento del agua disponible indicado en los estudios y acceso a ella, sea a través de los entes operadores de servicio público para atender la demanda de la zona (…) “ Por lo tanto, se recomienda denegar la solicitud de aprovechamiento de agua de los pozos artesanales 01 y 02, con fundamento en lo siguiente:

El aprovechamiento de agua del pozo artesanal 01 corresponde a un uso turístico, el cual se realiza en una propiedad distinta a aquella donde se ubica dicho pozo. b) El uso del pozo artesanal 02 es utilizado para consumo humano de tipo doméstico, no obstante, el recurso hídrico es aprovechado en propiedades diferentes a la finca donde se localiza el pozo c) Los pozos artesanales 01 y 02 se encuentran ubicados dentro del acuífero de Playa Brasilito, el cual presenta restricciones para el otorgamiento de nuevas concesiones, debido a sus condiciones hidrogeológicas y su categorización como zona con características hídricas especiales. d) De conformidad con la resolución R-0283-2023-MINAE, el aprovechamiento del recurso hídrico disponible en dicho acuífero debe canalizarse a través del ente operador de servicio público de la zona. CUARTO: En atención al recurso de amparo presentado anteriormente expediente 26-011125-0007- CO mediante oficio DA-0903-2026 de fecha 23 de abril del 2026 se expuso lo referente a las concesiones de los pozos artesanales a la luz de los hechos reclamados en los siguientes términos: “Conforme el artículo 6 de la Ley de Aguas, cualquier persona puede elevar aguas dentro de su propiedad para satisfacer sus necesidades básicas.

Indica el artículo citado: “Artículo 6º.- Todo propietario puede abrir libremente sin necesidad de concesión pozos para elevar aguas dentro de sus fincas para usos domésticos y necesidades ordinarias de la vida, aunque con ello resultaren amenguadas las aguas de sus vecinos; deberá, sin embargo, guardar la distancia de dos metros entre pozo y pozo, dentro de las poblaciones, y de quince metros en el campo entre la nueva excavación y los pozos, estanques, fuentes y acequias permanentes de los vecinos.” De acuerdo con lo transcrito se puede excavar un pozo artesanal para uso doméstico sin permiso, por parte del propietario del inmueble para cubrir sus necesidades domésticas. Requisito de esta norma es que el pozo se ubique en la propiedad donde se va a aprovechar, lo cual no ocurre. Ahora bien, si el uso es doméstico, el pozo no se concesiona, pero si se la va a dar otro uso si debe de tramitarse la concesión por parte del propietario del inmueble donde está el pozo y se vaya a utilizar.

En otras palabras, el uso que los propietarios o usuarios del Hotel Bahía de los Piratas están realizando del pozo N°1 deviene en ilegal, por lo que el mismo debe de ser cerrado, debiendo buscarse los interesados otra fuente de agua para proveer al Hotel. Lo mismo ocurre con el pozo N°2, los señores que lo utilizan deberán de buscar otra fuente o ente prestatario del servicio público que les provea el servicio de agua potable.” QUINTO: Así las cosas y en honor a la verdad, es que de lo indicado se puede colegir con meridiana claridad, que el planteamiento de los hechos reclamados por la recurrente no corresponden a la realidad y que la actuación por parte de la Dirección de Agua ha sido en estricto apego a la normativa que rige la materia y NO a una actuación arbitraria como lo quiere hacer ver la recurrente, por el contrario en protección del recurso hídrico y al amparo de la Ley, se ha detenido el abuso que se estaba realizando de los pozos artesanales dándoles usos no permitidos por ley sin contar con la correspondiente concesión.

PETITORIA Es por las razones expuestas, que se solicita rechazar en todos sus extremos el recurso de amparo en cuanto a la participación de la Dirección de Agua-MINAE, toda vez que la misma ha actuado a derecho sin que medie violación alguna a los preceptos constitucionales, Así mismos por tratarse de los mismos hechos y recurrentes que se acumulen los expedientes por conexidad 26-011125-0007- CO y 26-011167-0007-CO”.

  1. 4Mediante escrito incorporado al expediente digital a las 12:22 horas del 18 de mayo de 2026, informa bajo juramento María Navarro del Valle, en su condición de ministra de Ambiente y Energía, en igual sentido a lo informado por el director de Aguas de este ministerio. Solicita que se declare sin lugar el recurso.
  2. 5Mediante escrito incorporado al expediente digital a las 14:36 horas del 21 de mayo de 2026, informa bajo juramento

“PRIMERO: En la zona de Bahía de los Piratas, Playa Real, Cabo Velas, Distrito del Cantón de Santa Cruz, Provincia de Guanacaste, no cuenta con el servicio de agua brindado por la ASADA correspondiente.

R/Cierto.

En el sector en el que se hace referencia no hay disponibilidad de servicio de agua potable. La razón por la cual no hay servicio es porque la Asada no tiene factibilidad técnica en el sector. La factibilidad técnica se debe a que, 1) no hay capacidad hidráulica, es decir, no hay tubería de distribución. El último servicio que se brinda se ubica a un kilómetro aproximadamente. 2) no hay capacidad hídrica; con base en recomendaciones del AyA en su oficio GSD-UEN-GAR-2020-01426- F (ver anexo 1), la Asada tiene recomendación del ente rector de no dar mas disponibilidades, misma que la Asada como ente operador delegado debe de acatar.

SEGUNDO: Ante esta situación, las familias residentes —aproximadamente 16 en total— dependen de un pozo artesanal ubicado en playa real, desde hace mas de 50 años, siendo la única fuente, que abastece de agua a todas estas familias donde hay niños estudiantes y adultos mayores.

R/ No nos consta.

TERCERO: El 27/03/2026, se apersono en Playa Real la Funcionaria del MINAE, Señora: Diana Meza Calderón, NOTIFICANDO A LOS RESIDENTES PERMANENTES SR. JAIME ENRIQUE GARCÍA VELÁSQUEZ Y LINSEY ELENA GARCÍA CHAVARRÍA, en forma sorpresiva, el cierre del pozo, y advirtiendo de no poder realizar ningún tipo de acceso y uso del agua, por no estar Autorizados por el MINAE, y que en caso de que hagan uso del agua se le iniciara proceso penal por los delitos de Usurpación de Aguas y Desobediencia a la Autoridad, esto a pesar de las protestas de la Sra. García, para atender las necesidades básicas de su hogar y en especial, de sus hijos Sebastián García García, de 15 y 5 años respectivamente, estudiante de Secundaria el primero y de preescolar la segunda. La funcionaria publica permitió que un particular pusiera un candado en la puerta del pozo, lo cual es ilegal.

R/ No nos consta.

CUARTO: El cierre del pozo dejó a todas las familias Residentes Permanentes en Playa Real en especial a los pobladores fundadores FAMILIA BUSTOS DUARTE, DUEÑO DEL POZO EN MENSION, dejándolos, sin acceso al agua, afectando directamente sus derechos fundamentales como la salud, la dignidad humana y por último la vida, en razón de que esta depende del agua, como equilibrio fundamental entre la Salud y la enfermedad R/ No nos consta.

QUINTO: Desde hace muchos años los vecinos hemos hechos gestiones, verbales y escritas participando de reuniones convocadas por la Asada de Matapalo, el Ministerio de Salud, con la finalidad de que se supla a la comunidad de playa Real del servicio de agua potable, sin resultados positivos a pesar de que la tubería está a una distancia aproximada de un kilómetro, y los funcionarios de la Asada referida, justifican la omisión del Servicio Público, por la falta de recursos económicos. El MINAE a sabiendas de que la comunidad de PLAYA REAL dependemos del pozo artesanal, ordeno cerrarlo para impedir que nos supliéramos de agua, tal como se refirió supra.

R/ Parcialmente cierto.

Hacemos referencia únicamente a las gestiones que indica realizar la recurrente en relación a la solicitud de servicio de agua potable.

Producto de solicitud de disponibilidad de personas recurrentes, se emite constancia de no disponibilidad, misma que indica como razón la ausencia de infraestructura (tubería) en alguno de los linderos del terreno por abastecer. Al respecto se señala lo que indica el Reglamento de Prestación de Servicios:

Artículo 8.- De los servicios. AyA prestará los servicios de abastecimiento de agua para uso poblacional y saneamiento de aguas residuales dentro de la zona de cobertura, siempre que el área cuente con factibilidad técnica y legal.

Para mejor entendimiento de lo anterior, se indica sobre el concepto de Factibilidad Técnica extraído del mismo reglamento antes citado:

Análisis de factibilidad técnica para el otorgamiento de los servicios: Proceso de verificación de la existencia real y actual de los recursos hídricos, hidráulicos, materiales, técnicos, legales y ambientales suficientes para otorgar la disponibilidad y eventual conexión del servicio. Para tales efectos se deberán de observar las siguientes condiciones:

a. Que las redes de distribución y de recolección pasan frente a linderos del inmueble o tenga acceso directo por vía pública o servidumbre de paso del inmueble para el cual se solicita un servicio.

b. Que los sistemas cuenten con capacidad hídrica, hidráulica, de potabilización y de tratamiento, suficientes para otorgar nuevos servicios.

c. Que el sistema cumple con los atributos de calidad establecidos.

d. Que cumple con la normativa ambiental correspondiente.

Siendo expuesto lo anterior, la respuesta de no disponibilidad se ampara en los puntos a) y b). Agregando, en evidencia al respaldo en cuando al no cumplimiento del punto b) de concepto de Factibilidad Técnica, se indica lo que señala el oficio GSD-UEN-GAR-2025-01254 (anexo 3), en pág 6, punto 2, que señala textual:

El resultado del balance hídrico es negativo desde el año 2023 incluso, y hasta la proyección a 20 veinte años se mantiene negativo. Esto como resultado de que para dicho balance se toma en cuenta únicamente los caudales concesionados por la DA del MINAE, y por consiguiente, debido a la restricción de explotación de agua para consumo humano emitida por la CTI, los caudales de las fuentes no han aumentado, esto apuntando a evitar la contaminación de los pozos por intrusión salina. Todo esto en el área de influencia del acuífero Huacas-Tamarindo.

SEXTO: La actitud de la funcionaria publica del MINAE y de la ASADA DE MATAPALO, la primera por acción ilegal al actuar sorpresivamente con el impedimento de que la comunidad de PLAYA REAL utilice el pozo artesanal sin ningún debido proceso, que permite el derecho de defensa de la comunidad y de los afectados, pues la notificación del 27 de marzo 2026, da un plazo de 10 días para tramitar, una concesión de aprovechamiento del agua, ante el MINAE, y a la vez impide en el mismo acto que se utilice el agua del único pozo, lo cual es un acto arbitrario e ilegal sin motivo, ni contenido ni fin, más bien sancionatorio, sin derecho a defensa ni a sobrevivencia, pues si se usa dicho pozo, convertirá al usuario administrado, privado del agua en un delincuente; y la ASADA, en responsabilidad en que la comunidad no tenga acceso a agua potable por la inercia en el debido cumplimiento en sus obligaciones básicas, para lo cual fue creada, como es de suplir a las familias de su jurisdicción de agua potable.

R/ Falso.

Si bien es cierto que el artículo 50 de la Constitución Política señala que el acceso a agua es un derecho humano, esto no significa que se trate de un servicio irrestricto. Tal como se ha reiterado a lo largo del presente documento, el acceso a la disponibilidad de servicio de agua potable debe de cumplir con una serie de condiciones hídricas, ambientales, legales y de infraestructura. Incluso, existe múltiple jurisprudencia que respalda lo antes indicado.

  1. 6En los procedimientos seguidos se ha observado las prescripciones legales

. Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. La parte recurrente reclama que funcionarios del MINAE ordenaron el cierre inmediato del pozo artesanal que, desde hace varias décadas, constituye la única fuente de abastecimiento de agua para los habitantes de la comunidad de Bahía de los Piratas, Playa Real, Cabo Velas, y dispusieron impedir su utilización por carecer de autorización administrativa, incluso mediante la colocación de un candado en el acceso y bajo la advertencia de iniciar procesos penales contra quienes hicieran uso del recurso hídrico. Sostiene que esa actuación dejó sin acceso al agua a las familias residentes, entre las que se encuentran personas menores de edad y personas adultas mayores, afectando sus derechos fundamentales. Asimismo, acusa que, pese a las gestiones realizadas durante años ante la ASADA de Matapalo y el Ministerio de Salud para obtener el servicio de agua potable, las autoridades competentes han omitido adoptar las medidas necesarias para garantizar ese servicio público, manteniendo a la comunidad sin una fuente regular de abastecimiento de agua.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • c)El 31 de agosto de 2023, la Comisión Técnica Interinstitucional para la Gestión del Agua Subterránea acordó que el acuífero Playa Brasilito únicamente presenta disponibilidad hídrica para atender la demanda inmediata y de corto plazo, debido a que constituye un sistema frágil, vulnerable a la intrusión salina, por lo que recomendó que el aprovechamiento del recurso hídrico disponible y el acceso al agua en esa zona se canalizaran mediante los entes operadores del servicio público (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • d)El 18 de septiembre de 2023, mediante la resolución nro. R-0283-2023-MINAE, el MINAE acogió la recomendación emitida por la Comisión Técnica Interinstitucional para la Gestión del Agua Subterránea, en el sentido de que el aprovechamiento del agua disponible en el acuífero Playa Brasilito debía realizarse mediante el ente operador del servicio público correspondiente (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • e)El 27 de marzo de 2026, funcionarios del MINAE realizaron una inspección en Playa Real, Cabo Velas, Santa Cruz, con el propósito de verificar las condiciones de dos pozos artesanales cuya solicitud de concesión de aprovechamiento de agua se tramita en el expediente administrativo nro. 27324-P, constatándose que ambos pozos se encontraban ubicados en la finca inscrita dentro de ese procedimiento administrativo y contaban con equipos instalados para la captación del recurso hídrico (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • f)El 27 de marzo de 2026, durante la inspección indicada, se verificó que el aprovechamiento del agua proveniente del pozo artesanal nro. 1 se destinaba al funcionamiento del Hotel Bahía de los Piratas, específicamente para actividades de carácter turístico desarrolladas en las fincas con folios reales matrículas 590-Z-000 y 85208, derechos 01, 02, 03 y 04, sin que existiera concesión de aprovechamiento de agua otorgada a favor del hotel o de las personas jurídicas propietarias de esos inmuebles (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • g)El 27 de marzo de 2026, también se constató que el agua extraída del pozo artesanal nro. 2 era utilizada para consumo humano doméstico en viviendas ubicadas fuera de la propiedad donde se localiza ese pozo, pese a que ambos pozos forman parte del expediente administrativo nro. 27324-P (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • h)El 27 de marzo de 2026, se notificó a la recurrente que no podía realizar ningún tipo de aprovechamiento del agua proveniente del pozo artesanal nro. 1 por carecer de la autorización correspondiente otorgada por el MINAE; asimismo, se notificó a Juan María Bustos Caravaca que no podía aprovechar el agua del pozo artesanal nro. 2, debido a que este se ubica en una propiedad distinta de aquella donde se utilizaba el recurso hídrico (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • i)El 27 de marzo de 2026, Juan María Bustos Caravaca colocó, por decisión propia y sin intervención de funcionarios del MINAE, un candado en la caseta del pozo artesanal nro. 1 (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • j)El 9 de abril de 2026, funcionarios del MINAE realizaron una segunda inspección en el sitio junto con representantes de la Municipalidad de Santa Cruz, la ASADA de Matapalo, el Ministerio de Salud, la Policía Turística de Flamingo y el Instituto Costarricense de Acueductos y Alcantarillados. En esa diligencia participó la recurrente, quien aportó comprobantes de pago del servicio eléctrico, transferencias bancarias relacionadas con el suministro de agua y una autorización para el uso del pozo artesanal nro. 1 emitida por un familiar del anterior albacea provisional (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • k)El 9 de abril de 2026, durante la inspección realizada en el Hotel Bahía de los Piratas con autorización de la promovente, se verificó que el inmueble contaba, entre otras instalaciones, con lavandería, villas, piscina, restaurante y minimercado, confirmándose que el agua proveniente del pozo artesanal nro. 1 era utilizada para actividades de carácter turístico (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • l)El 22 de abril de 2026, el MINAE emitió el oficio técnico nro. DA-UHTPNOL-0514-2026, mediante el cual concluyó que el aprovechamiento de los pozos artesanales nros. 1 y 2 se realizaba en condiciones distintas a las autorizadas por la legislación vigente, recomendó remitir el expediente administrativo a la Dirección de Asesoría Jurídica para la atención legal correspondiente y dispuso continuar el seguimiento técnico del cauce cercano a los pozos durante la época lluviosa (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • m)El 23 de abril de 2026, el MINAE emitió el criterio técnico nro. DA-UHTPNOL-525-2026, mediante el cual recomendó denegar la solicitud de concesión de aprovechamiento de agua correspondiente a los pozos artesanales nros. 1 y 2, por cuanto el primero abastecía un uso turístico desarrollado en una propiedad distinta de aquella donde se ubica el pozo, el segundo suministraba agua a viviendas localizadas fuera de la finca en que se encuentra, ambos se ubican dentro del acuífero Playa Brasilito, sujeto a restricciones para el otorgamiento de nuevas concesiones, y la resolución nro. R-0283-2023-MINAE dispone que el aprovechamiento del recurso hídrico en esa zona debe canalizarse mediante el ente operador del servicio público (véase el informe de la autoridad recurrida y la prueba aportada al expediente digital).
  • n)A la fecha en que se rindió el informe, la comunidad de Bahía de los Piratas, Playa Real, Cabo Velas, no contaba con el servicio de abastecimiento de agua potable brindado por la ASADA de Matapalo, debido a la inexistencia de infraestructura de distribución en el sector y a la ausencia de capacidad hídrica suficiente para otorgar nuevas disponibilidades de servicio, conforme a las recomendaciones emitidas por el Instituto Costarricense de Acueductos y Alcantarillados y al balance hídrico negativo del acuífero Huacas-Tamarindo (véase la contestación y la prueba aportada al expediente digital).

III.Sobre el caso concreto. La recurrente reclama que funcionarios del MINAE ordenaron el cierre de un pozo artesanal ubicado en Playa Real de Cabo Velas, Santa Cruz, prohibiendo el aprovechamiento del agua que, según sostiene, constituye la única fuente de abastecimiento para varias familias de la comunidad. Alega que esa actuación se llevó a cabo de manera arbitraria, sin observar el debido proceso, afectando el acceso al agua de los habitantes del lugar.

En lo concerniente al agravio planteado contra el MINAE, esta Sala estima que el presente asunto debe resolverse en el mismo sentido que lo decidido en la sentencia nro. 2026-021173 de las 9:30 horas del 12 de junio de 2026, dictada dentro del expediente 26-011125-0007-CO. En esa oportunidad, este Tribunal conoció un recurso de amparo promovido con ocasión de la misma actuación administrativa desplegada por esa autoridad respecto del aprovechamiento del agua proveniente de los pozos artesanales ubicados en Playa Real de Cabo Velas, Santa Cruz, por lo que procede reiterar el criterio allí sostenido. En dicha sentencia, se resolvió lo siguiente:

“I.- OBJETO. El recurrente alegó que la amparada es una persona adulta mayor y es dueña de un pozo artesanal ubicado en Playa Real de Cabo Velas de Santa Cruz, Guanacaste. Acusa que la autoridad recurrida cerró ilegalmente ese pozo, con candados, sin garantizar el debido proceso quedando la familia sin agua.

(…)

IV.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias legales, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que, la amparada María Rosa Bustos Duarte, cédula 502320252, no posee bienes inmuebles inscritos a su nombre. El pozo que se clausuró por uso ilegal no se encuentra en algún inmueble propiedad de la amparada. Conforme el Registro Nacional de Concesiones que lleva la Dirección de Agua del MINAE, se tiene solicitud de concesión de aprovechamiento de dos pozos artesanales bajo el expediente 27324-P, a nombre del señor Fidencio Bustos Bustos. La concesión se tramita para aprovechar el agua de los pozos en uso agropecuario. Previo a resolver el expediente, se realizó el día 27 de marzo del 2026 inspección al sitio, a fin de verificar la condición de los pozos y comprobar si efectivamente los mismos son excavados (artesanales) o si se trata de pozos perforados.

Al llegar al sitio, la funcionaria de la Unidad Hidrológica Tempisque- Pacífico Norte de la Dirección de Agua, comprueba que en la propiedad efectivamente existen dos pozos artesanales. Que tal y como se indica en el informe técnico DA-UHTPNOL-0514-2026 del 22 de abril del 2026, ambos pozos se ubican en casetas de concreto protegidas con cadenas y candados. En la propiedad la funcionaria es atendida por el señor Juan María Bustos Caravaca, quien le indica que no cuenta con las llaves de la caseta del pozo N°1, pero que en el hotel Bahía de Los Piratas, se encuentran las llaves pues son ellos quienes utilizan el agua. En el hotel, el señor Jaime Enrique García Velásquez quien se identificó como Administrador del Hotel, informó que posee una solicitud de concesión de aprovechamiento de agua de ambos pozos. El pozo N°1 es administrado por el hotel. Se verifica en el sitio la condición del pozo y se procede a notificar la prevención respectiva al señor Jaime García Velásquez en la condición antes señalada.

Al momento de la inspección del pozo citado supra se presenta la señora Linsey García Chavarría, quien manifiesta ser propietaria del inmueble donde se ubica el hotel que aprovecha el agua del pozo artesanal N°1. Se procede a realizar la notificación correspondiente del no uso del agua tanto a la señora García Chavarría como al señor García Velásquez, por tratarse de un aprovechamiento ilegal al no contar con concesión alguna. El señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas. Se dejó constancia de “que la actuación realizada por el señor Juan María Bustos Caravaca, respecto a la colocación de un candado en la caseta del pozo artesanal 01, ha sido efectuado por su propia voluntad, sin intervención de la suscrita”, funcionaria del MINAE. Posteriormente con fecha 9 de abril del 2026, se realiza una segunda inspección al sitio, conjuntamente con funcionarios de la Municipalidad de Santa Cruz, de la Asada de Matapalo y del Ministerio de Salud así como de la Policía Turística de Flamingo y un funcionario de la Oficina Regional del AyA.

En la reunión estuvo presente además el señor Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla medina, José Andrés García Chavarría, Linsey García Chavarría y [Nombre 001], ésta última supuestamente como representante legal de los inmuebles que conforman el Hotel Bahía de los Piratas. La señora [Nombre 001], aporta documentación de pago de transferencias bancarias por concepto de pago del agua, así como una carta suscrita por la recurrente autorizando el uso del pozo. En inspección al hotel con autorización de la señora Chavarría, se constató que el uso del agua es turístico. En la propiedad se encuentra otro pozo artesanal 02 que es utilizado para consumo humano tipo doméstico en viviendas que no se ubican dentro de la propiedad donde este se localiza, lo cual constituye una condición irregular en el uso del recurso. Asimismo, se notificó al señor Juan María Bustos Caravaca que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquella donde se realiza el aprovechamiento.

Del panorama expuesto se concluye que no hay razón para estimar el recurso. En primer término no hay ningún elemento de juicio conforme al cual se pueda tener por demostrado que el cierre del pozo 1 hubiera dejado a la amparada si acceso al agua. Al contrario, el informe es muy claro en cuanto a que el uso es por parte de un hotel. Por otra parte, el informe es también muy claro en cuanto a que quien atendió a la funcionario del MINAE en la inspección un candado: “En ese acto el señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas”, de lo que se dejó constancia. Por otra parte, en el informe también se explica que no hay ninguna concesión, pese a que el agua se utiliza en una propiedad (donde está el hotel) distinta a la propiedad donde está el pozo. En suma, de conformidad con las razones expuestas, el recurso debe declararse sin lugar”.

Del examen integral del expediente, esta Sala no encuentra motivo alguno para apartarse del criterio sostenido en el precedente transcrito. En efecto, los hechos que sirven de fundamento al agravio formulado contra el MINAE coinciden sustancialmente con aquellos que fueron objeto de análisis en la sentencia citada. Asimismo, los informes rendidos bajo juramento y la prueba incorporada al expediente permiten constatar las mismas circunstancias fácticas que sustentaron aquella decisión, entre ellas, las inspecciones efectuadas por funcionarios del MINAE, las condiciones en que se realizaba el aprovechamiento del recurso hídrico, las notificaciones practicadas a las personas involucradas, la inexistencia de una concesión que autorizara ese aprovechamiento y las circunstancias relacionadas con la colocación del candado en la caseta del pozo artesanal.

Así las cosas, este Tribunal no advierte la existencia de elementos fácticos o jurídicos novedosos que justifiquen modificar el criterio previamente adoptado. Antes bien, la prueba incorporada a este proceso confirma los extremos considerados en la sentencia nro. 2026-021173, de manera que las razones que sustentaron aquella decisión mantienen plena vigencia para resolver el agravio ahora planteado.

En consecuencia, por las mismas razones expuestas en el precedente citado, las cuales se reiteran en esta oportunidad, no se acredita una actuación arbitraria por parte del MINAE ni una lesión a los derechos fundamentales atribuible a esa autoridad. Por ello, en cuanto a este extremo, el recurso debe declararse sin lugar.

IV.Respecto a la ASADA de Matapalo, Santa Cruz. En lo que respecta al agravio formulado contra la ASADA de Matapalo de Santa Cruz, la recurrente acusa que esa entidad ha omitido brindar el servicio de abastecimiento de agua potable a la comunidad de Bahía de los Piratas, Playa Real de Cabo Velas, pese a las gestiones que, según afirma, los vecinos han planteado durante varios años para obtener la conexión al sistema de distribución. Sostiene que esa omisión los ha obligado a abastecerse mediante un pozo artesanal, cuyo aprovechamiento fue posteriormente restringido por el MINAE, situación que, a su juicio, vulnera sus derechos fundamentales.

Ahora bien, se aclara a la parte accionante que, si bien esta Sala ha reconocido de manera reiterada que el acceso al agua potable constituye un derecho fundamental indispensable para el disfrute de una vida digna, también ha sostenido que ese derecho no reviste carácter absoluto, de manera que las entidades encargadas de la prestación del servicio pueden denegar una solicitud o encontrarse imposibilitadas para suministrarlo cuando existan razones técnicas, materiales o jurídicas objetivas que lo justifiquen. En ese sentido, este Tribunal ha señalado lo siguiente:

“ IV.- Sobre el caso concreto. En el sub lite, la recurrente estima lesionado su derecho fundamental de acceso al agua potable. Indica que es propietaria, junto con su esposo, del inmueble matrícula folio real [ de San José, plano catastrado N° SJ-1843630-2015. Señala que mediante gestión realizada por su esposo ante el Instituto Costarricense de Acueductos y Alcantarillados, se solicitó la disponibilidad de agua para el terreno citado; empero, por medio del oficio N° UNDGAM-0583-2018-1803 del 21 de febrero de 2018, el instituto recurrido denegó la petición, bajo el argumento que no existe disponibilidad (…) En el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La producción de agua potable que existe actualmente y abastece la infraestructura que se ubica frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble.

La población en la zona ha ido aumentando y ello ha generado mucha demanda que ha provocado que, en la actualidad, el sistema que abastece el sector sea insuficiente. La situación se ve agravada por la elevación topográfica de la zona, las limitadas fuentes de captación en el sector y la falta de control catastral en la zona por parte de la municipalidad competente. Así las cosas, lo correspondiente es declarar sin lugar el recurso de amparo. Este Tribunal Constitucional ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase Sentencia N° 2001-09676 y N° 2004-08161).

Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura.

En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En la especie, la autoridad recurrida es clara en indicar que la recurrente debe cumplir con lo estipulado en la Ley de Planificación Urbana y Plan Regulador. Además, a la amparada se le explicó que no existe disponibilidad asociada para el fraccionamiento de la propiedad madre de la que se generó la propiedad en análisis ni tampoco existe capacidad de abastecimiento en el sector. Por último, el recurrido señala que en el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. De manera tal, que existe una imposibilidad tanto jurídica como formal o técnica, ya que el fraccionamiento del terreno se realizó sin que previamente se haya obtenido la disponibilidad y, además, porque en el sector donde se encuentra la propiedad no existe capacidad suficiente para brindar el servicio públicos.

Corolario de lo expuesto, la Sala considera que se debe desestimar el recurso de amparo, ya que de conformidad con la línea jurisprudencial esgrimida por este Tribunal en casos similares, es posible denegar el suministro de agua potable cuando se determina la existente de una imposibilidad jurídica y/o formal técnica, como ocurre en la especie, de modo que no se estarían infringiendo los derechos fundamentales de la parte promovente. Si la recurrente lo que se encuentra es disconforme con la negatoria en sí, y con los motivos que la sustentan, ello corresponde a un extremo de legalidad que no puede ser ventilado en esta vía . Además, la Sala constata que a la amparada sí se le indicaron expresamente los motivos por los cuales no procedía la autorización del servicio, de ahí que tampoco en ese aspecto se hayan conculcado sus derechos fundamentales” (el resaltado no es del original).

A partir de ese criterio jurisprudencial, esta Sala no encuentra mérito para estimar el presente recurso en cuanto al agravio dirigido contra la ASADA. En efecto, de los informes rendidos bajo juramento se desprende que la comunidad de Bahía de los Piratas no cuenta con servicio de abastecimiento de agua potable debido a la inexistencia de infraestructura de distribución en el sector y a la ausencia de capacidad hídrica suficiente para otorgar nuevas disponibilidades de servicio. Asimismo, se indicó que el Instituto Costarricense de Acueductos y Alcantarillados ha recomendado no autorizar nuevas conexiones, en atención al balance hídrico negativo que presenta el acuífero Huacas-Tamarindo, circunstancias que, según se informó, impiden técnicamente la prestación del servicio en las condiciones pretendidas por la parte recurrente.

Así las cosas, este Tribunal estima que la situación expuesta en autos responde a limitaciones de carácter técnico y material que fueron debidamente explicadas por la autoridad recurrida y que no obedecen a una actuación antojadiza, arbitraria o carente de fundamento. Por el contrario, la imposibilidad alegada encuentra sustento en criterios técnicos relacionados con la capacidad del sistema de abastecimiento, la inexistencia de infraestructura de distribución en el sector y las restricciones hídricas existentes, circunstancias que, conforme a la jurisprudencia constitucional de esta Sala, constituyen razones objetivas que justifican la imposibilidad de brindar el servicio solicitado.

En consecuencia, no se acredita que la ASADA haya incurrido en una lesión a los derechos fundamentales de la recurrente. Antes bien, la negativa para suministrar el servicio de agua potable responde a circunstancias técnicas que, según la prueba incorporada al expediente, actualmente impiden su prestación. Por ello, en cuanto a este extremo, el recurso también debe declararse sin lugar.

V.Voto salvado parcial del magistrado Cruz Castro. Disiento del criterio de mayoría. En el presente caso, se valida la negativa de la Administración de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.

El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.

Desde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.

El enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.

El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.

Por estas razones, estimo que el recurso debió declararse con lugar, al menos para ordenar a la Administración la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable del recurrente. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.

VI.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso. El magistrado Cruz Castro salva el voto en cuanto a la Asada de Matapalo, Santa Cruz declara con lugar el proceso de amparo, ordenando que se adopten medidas concretas y se le indique a la parte amparada una fecha cierta para satisfacer el abastecimiento de agua.
