Writ of amparo (recurso de amparo) processed under file number 25-027587-0007-CO, filed by [Name 001], national identity document [Value 001], against the REGIONAL DIRECTOR OF THE LA AMISTAD CARIBE CONSERVATION AREA.

Recitals:

  1. 1By written submission received at the Chamber's Secretariat at 14:51 hours on September 10, 2025, the petitioner files a writ of amparo against the REGIONAL DIRECTOR OF THE LA AMISTAD CARIBE CONSERVATION AREA, and states that the Playa Negra wetland (humedal), located in Puerto Viejo, Talamanca, forms part of the Río Carbón watershed (cuenca) and borders the Parque Nacional Cahuita. This ecosystem, described in the "Preliminary Assessment of the Eastern Branch of the Hone Creek Afuera Estuary outside the Parque Nacional Cahuita (Wetland Between La Barra and Hotel Perla Negra)" and in official communication SINAC-SE-GASP-165-2005 (July 13, 2005), harbors protected biodiversity, including endangered species such as sea turtles (Baula, Carey, Verde, and Cabezona), monkeys, crocodiles, otters, and migratory birds. It also performs critical hydrological regulation functions and serves as a key nesting site for sea turtles, according to biologist Didiher Chacón of the Asociación ANAI.The petitioner states that since October 28, 2005, the Comité Local Forestal de Talamanca (CLFT), coordinated by Engineer Gustavo Alvarado Salazar, documented illegal activities on the property of Mr. Pool Pavel Jareslav in Playa Negra, including wetland drainage (drenaje de humedales), filling with hundreds of truckloads (vagonetas) of sand and gravel (lastre), unpermitted construction, tree felling, and obstruction of the public coastal zone (zona pública), all carried out with heavy machinery that included equipment belonging to the Municipalidad de Talamanca (official communication SINAC-SE-GASP-165-2005). These activities, ongoing for more than 20 years without effective restoration (restauración), are confirmed by criminal case (causa penal) 24-00377-0597-PE, pending since 2004. The petitioner states that on August 9, 2025, he submitted official communication AEL-0313-2025 to the respondent authority, requesting a follow-up report and a complete copy of report SINAC-ACLAC-DASP-RNVSGM-136-2024 (March 26, 2024), concerning the drainage and filling of the wetland allegedly carried out by the Municipalidad de Talamanca.In response, Licda. Maylin Mora Arias transmitted official communications CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 and CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 (August 26, 2025), which confirm the expansion of the complaint and the additional deposit of gravel, but limit SINAC's action to halting activities and referring the case to the Ministerio Público, without adopting immediate precautionary or corrective measures. He adds that official communication CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 and photographs dated August 26, 2025, evidence the extent of the gravel filling, aggravating the damage to the wetland. Report SINAC-SE-GASP-165-2005 details the presence of wetland indicator plants (yolillo, majagua, araceae), muddy soils, and threatened fauna, as well as human intervention through filling and drainage that has altered the natural conditions of the ecosystem. The absence of an updated characterization and delimitation of the wetland, notwithstanding the documented history from 2004 and 2005, perpetuates the risk of irreversible harm.He indicates that criminal case 24-00377-0597-PE, in process since 2004, has not achieved restoration of the wetland, and SINAC's actions have been limited to reports without effective measures. He emphasizes that the respondent authority has failed to adopt immediate precautionary and corrective measures to protect and restore the Playa Negra wetland in Puerto Viejo, Talamanca — an ecosystem of high ecological value — despite documented evidence and precedents since 2004, including official communication SINAC-SE-GASP-165-2005 and recent SINAC reports. This omission violates fundamental rights guaranteed by Articles 21, 33, 46, and 50 of the Constitución Política, as well as applicable environmental legislation, including the Ley de Biodiversidad (Ley N° 7788), the Ley Orgánica del Ambiente (Ley N° 7554), the Ley Forestal (Ley N° 7575), and Decreto Ejecutivo N° 39838-MINAE on wetland protection.
  2. 2By order of the Chamber Presidency at 07:41 hours on October 9, 2025, the present writ of amparo was admitted for processing and the respondent authority was requested to submit a report (see electronic record).
  3. 3MAYLIN MORA ARIAS, in her capacity as Acting Regional Director (Directora Regional a.i.) of the La Amistad Caribe Conservation Area, reports under oath that: "FIRST: Regarding the case in question, criminal case No. 05-001155-0597-PE exists, filed by the Consejo Local Forestal de Talamanca, belonging to the La Amistad Caribe Conservation Area (ACLAC) of the Sistema Nacional de Áreas de Conservación (SINAC). That complaint was filed in 2005 for alleged environmental damage in wetlands and fragile ecosystems at Playa Negra, Cahuita district, Talamanca canton, documented through official communication SINAC-SE-GASP-165-2005. Since that date, SINAC has acted in accordance with its legal powers established in the Ley Forestal N.° 7575 and the Ley Orgánica del Ambiente N.° 7554, filing complaints, conducting expert assessments, expanding charges, carrying out inspections, and making referrals to the Ministerio Público.ACLAC has maintained continuous follow-up on the situation at the site, submitting new technical reports, expanding complaints, and providing photographic and cartographic evidence in accordance with applicable administrative and judicial procedures. However, any procedural inaction or delay in resolving the criminal case is attributable to the Ministerio Público, by virtue of the principle of functional independence enshrined in the Constitución Política and in the Código Procesal Penal, and therefore no omission may be imputed to this office. SECOND: That even in the face of the persistent harm and the inaction observed in the judicial proceedings, the La Amistad Caribe Conservation Area (ACLAC) once again raised its concerns before the competent authorities. In 2025, this problem was formally presented during a session of the Comisión Regional de Seguridad Ambiental, an interinstitutional forum in which representatives of the Ministerio Público, Organismo de Investigación Judicial, SINAC, and other state entities participate.At that session, the Fiscalía Agrario Ambiental took note of ACLAC's concerns regarding the lack of progress by the Fiscalía de Bribrí in the original case, and agreed to open a new investigation under number 25-131851-0597-PE, pursued against Pavel Jaroslav Hradecky as the alleged person responsible for illegal filling and drainage within the Playa Negra wetland, located in Puerto Viejo de Talamanca. Since that date, SINAC–ACLAC has proceeded to expand existing complaints and file new criminal cases related to the encroachment on, filling of, and alteration of wetlands and public coastal zones formally delimited by the Conservation Area's technical officers. These actions have included field inspections, geographic coordinate surveys, preparation of technical reports, photographic documentation, and submission of expert evidence to the competent judicial authorities. Among the most relevant cases processed in the recent period are the following: • 19-000695-829-PE, for damage to wetland ecosystems in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre). • 21-000574-0597-PE, for encroachment on and filling of wetlands in PNE. • 24-000161-829-PE and 24-000162-829-PE, concerning new encroachments in State Natural Heritage (Patrimonio Natural del Estado) areas. • And 24-00377-0597-PE, which maintains continuity with the original facts reported in 2005.In the same vein, an analysis was presented to the Municipalidad de Talamanca and the Fiscalía Adjunta Agrario-Ambiental in July 2021, in which the specific situation of criminal case No. 05-001155-0597-PE was set out with aerial imagery, to demonstrate the construction carried out at the reported site since 2005, as shown below: THIRD: That since 2017, through the official certification of the State Natural Heritage in the Maritime-Terrestrial Zone of Talamanca canton, under consecutive number SINAC-ACLAC-PNE-C-011-2017 issued on June 30, 2017, the referenced site was formally identified as State Natural Heritage. This technical and legal determination confers upon that land a regime of inalienability (inalienabilidad), imprescriptibility (imprescriptibilidad), and absolute protection, in accordance with Articles 9 and 10 of the Ley sobre la Zona Marítimo Terrestre N.o 6043, which define the 200-meter strip measured from the ordinary high-water mark and establish that the first 50 meters constitute a public zone (zona pública) for common use, where all private occupation or construction is prohibited, as well as Article 75 of the same law, which authorizes the State to exercise permanent control and oversight over these public-domain assets (bienes demaniales).Likewise, Article 13 of the Ley Forestal N.o 7575 provides that lands constituting State Natural Heritage are administered and directly protected by SINAC, so that any unauthorized intervention or alteration constitutes a serious environmental infraction. Accordingly, ACLAC has maintained technical and legal oversight of the site, conducting periodic verifications and administrative actions aimed at preserving the ecological integrity of the wetland and the public zone, in compliance with the principle of state stewardship over public-domain assets and ecosystems of national interest. FOURTH: That subsequent to the State Natural Heritage certification issued in 2017, two official updates have been generated corresponding to certifications SINAC-ACLAC-DRFVS-PNE-C-092-2024 and SINAC-ACLAC-DRFVS-PNE-C-014-2025, the latter being currently in force. Both ratify the legal and environmental status of the site as an integral part of the State Natural Heritage and confirm its ecosystem characterization as a wetland.This delimitation, originally identified in 2017, has remained unchanged through all technical review processes, demonstrating the continuity and consistency of the institutional position regarding the ecological value and the protective regime applicable to the area. FIFTH: That the petitioner has filed multiple formal requests with this Regional Directorate, including communications AEL-027-2023, AEL-044-2023, AEL-0261-2024, AEL-0263-2025, AEL-0281-2025, and AEL-0313-2025, among others, through which he has requested various information related to the case in question. In all instances, this Administration has provided a timely response and access to the requested information, in accordance with the principles of transparency and publicity of administrative acts established in Ley N.o 10554, Ley Marco de Acceso a la Información Pública. An example of this is official communications CARTA-SINAC-ACLAC-DR-0934-2025 and CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025, sent in response to the petitioner's request for a follow-up report and a complete copy of the document issued through official communication SINAC-ACLAC-DASP-RNVSGM-136-2024, dated March 26, 2024, concerning the drainage and filling of the wetland allegedly carried out by the Municipalidad de Talamanca.Likewise, through official communication CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025, also dated August 26, 2025, information was provided regarding the expansion of criminal case N.° 24-000377-0597-PE, in which ACLAC acts as the technical complainant and collaborator of the Ministerio Público. SIXTH: That through official communications CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 and SINAC-ACLAC-DASP-RNVSGM-136-2024, the latter dated March 26, 2024, and duly shared with the petitioner, he was informed of the issuance of precautionary measure (medida cautelar) N.° 0186, issued for the purpose of immediately halting the illegal works and activities detected at the site, as well as ordering the removal of the fill material deposited by the alleged offenders within the wetland area and the public zone of the Maritime-Terrestrial Zone. This measure was adopted pursuant to the powers conferred upon SINAC under Articles 6, subsection g), and 7 of the Ley Forestal N.° 7575, and in application of the precautionary principle (principio precautorio) recognized in Article 2, subsection d), of the Ley Orgánica del Ambiente N.° 7554, aimed at preventing and mitigating irreversible environmental harm in ecologically fragile ecosystems such as coastal wetlands.SEVENTH: That this Regional Directorate of the La Amistad Caribe Conservation Area (ACLAC) has acted in strict compliance with the legal framework, confirming the expansion of the filed complaint, ordering the immediate cessation of the unlawful activities detected, and transmitting the corresponding file to the Ministerio Público for the investigation of the alleged environmental criminal offenses, in accordance with its legally established powers. These actions are grounded in the Ley Forestal N.° 7575, which confers upon SINAC responsibility for preventing, controlling, and reporting all illegal exploitation of or damage to the State Natural Heritage, as well as in Article 50 of the Constitución Política, which imposes upon the State the duty to ensure effective environmental protection. Accordingly, the actions taken by this Regional Directorate fully comply with the principle of legality and the duty of administrative due diligence, ensuring the protection of the public environmental interest.EIGHTH: That this Regional Directorate of the La Amistad Caribe Conservation Area (ACLAC) has maintained continuous and documented follow-up on the complaints related to the harm to wetlands and State Natural Heritage areas in the Cahuita district, Talamanca canton. These include criminal cases 19-000695-829-PE, 21-000574-0597-PE, 24-000161-829-PE, 24-000162-829-PE, and 24-00377-0597-PE, all duly supported by field inspections, technical reports, geospatial referencing, and photographic records conducted by ACLAC officers. Furthermore, given the persistence of the illegal activities in the area, ACLAC promoted the opening of criminal case 25-131851-0597-PE before the Fiscalía Agrario Ambiental in 2025, after presenting the situation to the Comisión Regional de Seguridad Ambiental. These actions reflect the institutional continuity, coherence, and due diligence in addressing the case, in strict compliance with the powers assigned by the Ley Forestal N.° 7575 and Articles 1 and 2 of the Ley Orgánica del Ambiente N.° 7554, which obligate SINAC to ensure the conservation, complaint-filing, and effective protection of the ecosystems under its jurisdiction.NINTH: That the preventive actions undertaken by the La Amistad Caribe Conservation Area (ACLAC) have focused on the effective protection of the State Natural Heritage, through the execution of periodic inspections, posting of signs at vulnerable sites, and application of precautionary measures in the face of any environmental threat or harm. These actions are framed within Articles 8, 49, and 54 of the Ley de Biodiversidad N.° 7788, which establish the State's obligation to guarantee the conservation and restoration of ecosystems, and within the precautionary principle enshrined in Article 11, subsection 2) of the same law, which provides that, when faced with the threat of serious or imminent damage to biodiversity, the absence of scientific certainty may not be invoked as a reason to defer the adoption of effective protective measures. Moreover, while this Regional Directorate acts with full respect for the procedural timelines of the Ministerio Público, it is imperative to recall that in environmental matters — particularly where fragile ecosystems such as wetlands and mangroves are concerned — the administration cannot adopt a permissive stance in the face of judicial proceedings that drag on for decades without a definitive resolution.For this reason, ACLAC has maintained continuous monitoring of the area, generating successive expansions of the complaints and issuing updated technical reports that support the continuity of preventive measures, in accordance with the prevention principle and the principle of in dubio pro natura, cornerstones of public environmental management. TENTH: That, in accordance with the principle of separation of powers between the administrative and judicial authorities, once a matter is under the jurisdiction of a judge or the Ministerio Público, all other authorities — including administrative ones such as SINAC — must refrain from issuing decisions that could interfere with or contradict jurisdictional rulings. At this stage, the role of the La Amistad Caribe Conservation Area (ACLAC) is one of collaboration, technical support, and compliance with judicial orders, within the framework established by Article 290 of the Código Procesal Penal, which authorizes administrative authorities to act as expert witnesses or technical specialists at the request of the courts.Consequently, while the case remains before the courts, ACLAC's powers are limited to: 1. Providing technical reports and specialized expert assessments that serve as input for the judge or prosecutor in evaluating the facts and the environmental damage; 2. Adopting immediate preventive or precautionary administrative measures, such as orders to halt construction or remove fill material, which are provisional and complementary in nature and do not substitute the restorative measures within the competence of the judge; and 3. Strictly complying with judicial orders and mandates, particularly those related to the repair or restoration of environmental harm. In this manner, the judicial process constitutes the appropriate and exclusive channel for determining criminal responsibility and issuing definitive restorative measures, while the administrative authority maintains its technical support role, ensuring the safeguarding of the ecosystem and the continuity of environmental oversight until a final judicial decision is rendered.This coordination ensures respect for due process (debido proceso), the principle of administrative legality, and the constitutional right to a healthy and ecologically balanced environment enshrined in Article 50 of the Constitución Política." The respondent requests that the writ be dismissed.
  4. 4On October 27 and 28, 2025, the petitioner submitted a reply to the reports provided by the respondent authorities, stating that those reports do not refute his complaints but rather, through their omissions, confirm the absence of an effective response to the environmental harm, and that the case must not be limited to verifying whether some inspections or precautionary measures were carried out — that the cumulative impact on the wetland, the absence of a technical delimitation, the alleged institutional permissiveness, and the need to order comprehensive ecosystem restoration must all be analyzed.
  5. 5On November 3, 2025, the petitioner submitted evidence to the case file for consideration. He also requests that this Chamber: 1. Admit the present evidence for the better resolution of the case, incorporating it into the file. 2. Order urgent precautionary measures, such as the halting of works, the elimination of illegal interventions, warnings to institutions (Municipalidad de Talamanca, SETENA, SINAC, ACLAC, RNP), and the proper delimitation of the wetland.
  6. 6On January 12, 2026, the petitioner submitted a written brief to the file stating that on January 8, 2026, in Limón, he formally filed a complaint and technical-scientific demand before Licda. Maylin Mora Arias, director of the La Amistad Caribe Conservation Area, through official communication MLV-009-2026, detailing the facts reported by residents (resumption of truckloads of fill material, extraction of roots and branches, nocturnal transit of machinery). No response has been received.
  7. 7On January 24, 2026, the petitioner submitted a written brief to the file stating: "today I received a new complaint confirming the persistence of these practices: 'They are removing truckloads filled with debris, pieces of vegetation typical of wetlands, such as large pieces of yolillo palm, from the Playa Negra wetland.'" He requests that the Sala Constitucional: "order the competent authorities, including Fiscal Adjunto Ambiental José Pablo González Montero and Licenciada Maylin Mora Arias in her capacity as Director of the La Amistad Caribe Conservation Area, to take the following actions: 1. The immediate delimitation and characterization of the Playa Negra Wetland, culminating in the production of a technical and scientific map defining its exact boundaries, buffer zones (zonas de amortiguamiento), updated ecological, hydrological, and geographical characteristics, and priority intervention areas. 2. The implementation of a strategic ecosystem restoration plan, based on the requested map, including the eviction of illegal occupants, the removal of debris and illegally extracted vegetation, and continuous monitoring measures to prevent future degradation. 3. A stringent formal reproach to the administrative and judicial authorities for their prolonged inaction, ensuring effective compliance with constitutional and international environmental obligations."
  8. 8On March 16, 2026, the petitioner submitted a written brief to the file reiterating his arguments and requesting that the Chamber, in the interest of guaranteeing prompt and effective environmental justice, order the Departamento de Ciencias Forenses of the Organismo de Investigación Judicial to carry out a comprehensive expert assessment of the damage caused to the Playa Negra wetland over recent years.
  9. 9On March 17, 2026, the petitioner submitted to the Chamber a copy of the letter sent to the Fiscal Adjunto Ambiental, indicating that it was submitted for the purpose of calling attention to the seriousness of the situation in the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo and in the southern Caribbean coast of the country.
  10. 10The applicable legal requirements have been observed throughout the proceedings.

The opinion is drafted by Magistrate Cruz Castro; and,

Considering:

I. SUBJECT MATTER OF THE WRIT

The petitioner files a writ of amparo and states that the Playa Negra wetland (Puerto Viejo, Talamanca), part of the Río Carbón watershed and bordering the Parque Nacional Cahuita, harbors protected species (sea turtles, monkeys, crocodiles, otters, migratory birds) and performs key hydrological and nesting functions, according to biologist Didiher Chacón (ANAI) and official communication SINAC-SE-GASP-165-2005 (2005). Since 2005, the CLFT has documented illegal activities on the property of Pool Pavel Jareslav (drainage, filling with gravel and sand, unpermitted construction, logging, obstruction of the public zone), including with municipal machinery, without effective restoration despite criminal case 24-00377-0597-PE (pending since 2004). On August 9, 2025, a follow-up report and copy of report SINAC-ACLAC-DASP-RNVSGM-136-2024 were requested through official communication AEL-0313-2025.

The response from Licda. Maylin Mora Arias (official communications 421-2025 and 416-2025, August 26, 2025) confirmed expansion of the complaint and new gravel deposits, but SINAC limited its action to halting activities and referring the case to the Ministerio Público, without immediate precautionary or corrective measures. The petitioner alleges an omission by the respondent authority in protecting and restoring the wetland despite documented evidence since 2004, in violation of Articles 21, 33, 46, and 50 of the Constitución Política and applicable environmental legislation (Laws N° 7788, 7554, 7575, and Decreto N° 39838-MINAE).

II. PROVEN FACTS

The following facts are deemed duly established as relevant to the resolution of this matter, either because they have been proven on the record or because the respondent authority failed to address them, as required by the initial order:

On October 28, 2005, the Comité Local Forestal de Talamanca (CLFT), coordinated by Engineer Gustavo Alvarado Salazar, documented illegal activities on the property of Mr. Pool Pavel Jareslav in Playa Negra, consisting of wetland drainage, filling with hundreds of truckloads of sand and gravel, unpermitted construction, tree felling, and obstruction of the public zone, carried out with heavy machinery that included equipment belonging to the Municipalidad de Talamanca (see evidence in the record).

During the years 2023 to 2025, the petitioner filed various formal requests with the ACLAC Regional Directorate through official communications AEL-027-2023, AEL-044-2023, AEL-0261-2024, AEL-0263-2025, and AEL-0281-2025, requesting information related to the case, all of which were addressed by that Administration (see report submitted by the respondent authorities).

On March 26, 2024, through official communication SINAC-ACLAC-DASP-RNVSGM-136-2024, ACLAC issued precautionary measure N.° 0186, for the purpose of immediately halting the illegal works and activities detected at the site and ordering the removal of fill material deposited within the wetland area and the public zone of the Maritime-Terrestrial Zone (see report submitted by the respondent authorities).

In 2024, certification SINAC-ACLAC-DRFVS-PNE-C-092-2024 was issued, ratifying the legal and environmental status of the site as part of the State Natural Heritage and its characterization as a wetland (see report submitted by the respondent authorities).

In 2025, certification SINAC-ACLAC-DRFVS-PNE-C-014-2025, currently in force, was issued, once again confirming the legal and ecosystem status of the site as State Natural Heritage and as a wetland (see report submitted by the respondent authorities).

In 2025, at a session of the Comisión Regional de Seguridad Ambiental, the Fiscalía Agrario Ambiental took note of ACLAC's concerns regarding the lack of progress by the Fiscalía de Bribrí in the original case, and agreed to open criminal case N.° 25-131851-0597-PE against Pavel Jaroslav Hradecky, as the alleged person responsible for illegal filling and drainage within the Playa Negra wetland, located in Puerto Viejo de Talamanca (see report submitted by the respondent authorities).

On August 9, 2025, the petitioner filed official communication AEL-0313-2025 with the respondent authority, requesting a follow-up report and a complete copy of report SINAC-ACLAC-DASP-RNVSGM-136-2024, dated March 26, 2024, concerning the drainage and filling of the wetland allegedly carried out by the Municipalidad de Talamanca (see report submitted by the respondent authorities).

On August 26, 2025, through official communications CARTA-SINAC-ACLAC-DR-0934-2025, CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025, and CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025, the ACLAC Regional Directorate responded to the petitioner, confirming the expansion of the original complaint and the additional deposit of gravel material in the wetland, and transmitting the requested information relating to official communication SINAC-ACLAC-DASP-RNVSGM-136-2024 (see report submitted by the respondent authorities).

III.This Tribunal, through decision No. 2024003959 issued at 9:16 hours on February 16, 2024, in file 23-014549-0007-CO at 9:30 hours on February 16, 2024, ordered:

"VI. ON THE PROTECTION OF WETLANDS. In addition to what has been stated above, Costa Rica is a signatory to the 'Convention on Wetlands of International Importance especially as Waterfowl Habitat,' also known as the 'Ramsar Convention' (signed in Ramsar on February 2, 1971). Its Article 4 establishes: 'Each Contracting Party shall promote the conservation of wetlands and waterfowl by establishing nature reserves on wetlands, whether they are included in the List or not, and shall provide adequately for their wardening...' The Convention defines wetlands as: 'areas of marsh, fen, peatland or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish or salt, including areas of marine water the depth of which at low tide does not exceed six metres.' Wetlands are formed by a series of physical, biological, and chemical components, corresponding to soils, water, animal and plant species, and nutrients.

The processes that occur between and within these components enable the wetland to perform certain functions that are beneficial to the area in which it is located, such as flood control and protection against natural phenomena such as storms. Wetlands also generate products that benefit people and society in general, including: maintenance of wildlife, fisheries, and forest resources. The importance of wetlands thus lies in sustaining large numbers and varieties of species, with favorable socio-economic impacts for certain sectors of the population engaged in their rational use, and in the appearance of a unique landscape fully identifiable by its great beauty and diversity of wildlife forming part of the cultural heritage and an important source of tourism for a country or region. This Tribunal has ruled on this matter in the following terms:

V.On the protection of wetlands (humedales). This Court has addressed the relevance of these ecosystems and their protection in judgments 2001-12817 of 10:28 a.m. on December 14, 2001, and 2007-6246 of 7:30 p.m. on May 8, 2007, among others, noting that wetlands are considered the world's most productive ecosystems. In Costa Rica, Article 40 of the Ley Orgánica del Ambiente has defined them as: "Ecosystems that depend on aquatic regimes, whether natural or artificial, permanent or temporary, lentic or lotic, freshwater, brackish, or saline, including marine extensions up to the seaward limit of phanerogams (fanerógamas) or reefs, or, in their absence, up to six meters depth at low tide." Regarding the importance of these ecosystems, in resolution No. 2009-014288 of 3:19 p.m. on September 9, 2009, this Court stated:

"The importance of wetlands is not solely a function of biodiversity and processes that occur at the ecological scale, but also because they provide support functions and essential products for human communities in both the developing and industrialized world.

According to doctrine and scientific studies, the term wetlands encompasses a wide variety of ecosystems with very different characteristics. They can be classified into seven landscape units: estuaries, open coasts, floodplains, freshwater swamps, lakes, peat bogs, and floodplain forests; or into saltwater wetlands, freshwater wetlands, or artificial wetlands. Each is formed by a series of physical, chemical, and biological components, such as soils, water, animal and plant species, and nutrients. The processes among and within these components enable the wetland to perform functions—such as flood control and storm protection—and to generate products such as wildlife, fisheries, and forest resources, to purify water, and to stabilize the coastline. Not all characteristics are present in every wetland, and few perform all of these functions in the same way.

In addition, wetlands possess highly valuable attributes such as biological diversity and the uniqueness of their cultural heritage. It is the combination of these functions, products, and ecosystem attributes that makes wetlands important to society. By storing rainfall and releasing runoff in a uniform manner, wetlands can reduce the destructive force of floods and rivers, so that the conservation of natural water-storage areas can obviate the need to build dams and reservoirs. Their vegetation can stabilize the coastline by reducing the energy of waves, currents, and other erosive forces, while at the same time the plant roots hold bottom sediments in place, which can prevent both the erosion of valuable agricultural or inhabited lands and damage to property. Wetlands that remove nutrients improve water quality and help prevent eutrophication (eutrofización), which can eliminate the need to construct water treatment systems.

Furthermore, many wetlands sustain dense populations of fish, livestock, or wildlife that feed on their nutrient-rich waters or substrate, or graze in their lush grasslands. The hydrological, nutrient, and matter cycles, and the energy flows of wetlands, can stabilize local climatic conditions—particularly precipitation and temperatures—thereby influencing both agricultural activities and those based on natural resources, as well as the stability of natural ecosystems and the wetland itself. They also contribute to recreation, fisheries, agricultural resources, and tourism, as well as to the direct use of the forest resources they generate, yielding a significant number of goods ranging from firewood, construction timber, and bark—among timber products—to resins and medicines, which are non-timber "secondary" forest products. They are even important as genetic reserves for certain plant species—such as rice." Several international instruments, among which the Convention on Wetlands, or Ramsar Convention, stands out—ratified by our country under Ley No. 7224 on April 9, 1991, and published in La Gaceta on May 8 of that same year—address their protection.

In the Ramsar Convention, a wetland is defined as: "Areas of marsh, fen, peatland or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish or salt, including areas of marine water the depth of which at low tide does not exceed six metres." The Convention proclaims the duty of States to protect these ecosystems—not only in their own interests but also in the interest of the international community—and therefore countries are obligated to develop national policies aimed at the conservation of these environments in their land-use policies. Among the obligations undertaken by signatory countries, which are of various kinds, is the designation of at least one wetland of international importance for inclusion in the Ramsar Sites List, the selection of which shall be based on the site's international significance from an ecological, botanical, zoological, limnological, or hydrological standpoint, making this a commitment relating to the protection of specific sites (Article 2).

Additional obligations not related to specific sites include the preparation and implementation of management plans in a manner that promotes the rational use of wetlands in their territory (Article 3). Countries are also obligated to promote the conservation of wetlands and waterfowl by creating nature reserves in wetlands, whether or not they are included in the List (Article 4). Finally, signatory countries must coordinate their policies and regulations concerning the conservation of wetlands and their flora and fauna (Article 5). Thus, the parties establish a system for the protection of wetland areas, first through a list of wetlands of international importance (Ramsar sites), and second, by pursuing the rational use of all wetlands within their territory. Likewise, the "Guidelines for the Application of the Concept of Wise Use of the Convention," adopted under Recommendation 4.10, state that "the provisions on wise use apply to all wetlands and their supporting systems within the territory of a Contracting Party, whether listed or not." According to the Ramsar Convention Secretariat, the National Wetland Policy should set as its objective: "To prevent further loss of wetlands still in existence and to encourage the rehabilitation of the country's wetlands, maintaining their integrity, conserving their genetic diversity, and ensuring that their enjoyment and economic use are sustainable." It should also "cover all types of wetlands." It is therefore clear that, under the Ramsar Convention, every ecosystem that meets the characteristics of a wetland must be used in a rational and sustainable manner within the terms defined by the Convention and the Conference of the Parties." (see judgment No. 2013-7934 of 9:05 a.m. on June 14, 2013).

In our country, wetlands are areas that form part of the State Natural Heritage (Patrimonio Natural del Estado) and belong to the public zone (zona pública). The law on the maritime-terrestrial zone (zona marítimo terrestre), with respect to mangroves (manglares) and tidal channels (esteros), provides:

"Article 11.- The public zone also includes, regardless of its extent, the area occupied by all mangroves along the continental and island coastlines and tidal channels of the national territory." Municipalities administer the maritime-terrestrial zone, which encompasses both the public zone and the restricted zone (zona restringida). However, mangroves are excluded from that administration even when located within those areas, since they fall under the jurisdiction of MINAE pursuant to the Ley Forestal:

"Article 13.- Constitution and administration The State Natural Heritage shall consist of the forests and forestland of national reserves, areas declared inalienable, properties registered in Nombre01's name, and those belonging to municipalities, autonomous institutions, and other bodies of the Public Administration, with the exception of real property pledged as security for credit transactions with the Sistema Bancario Nacional that becomes part of the heritage of that system.

The Ministry of the Environment and Energy shall administer the Heritage. Where appropriate, through the Procuraduría General de la República, it shall register the land in the Registro Público de la Propiedad as individualized properties in the name of the State.

Non-governmental organizations that acquire real property containing forest or with forest vocation, using funds from donations or from public funds obtained in Nombre01's name on behalf of the State, must transfer such property to the name of the State." Article 18.- Authorization of works On the State Natural Heritage, the State may carry out or authorize research, training, and ecotourism activities, once approved by the Minister of the Environment and Energy, who shall determine, where appropriate, whether environmental impact assessments (evaluaciones de impacto ambiental) are required, as established by the regulations of this law." This is set forth in the Regulations of the Law on the Maritime-Terrestrial Zone, in Article 4, and in Article 2, subparagraph 23) of the Regulations to the Wildlife Conservation Law:

"Article 4.- In accordance with Decree Nº 7210-A of July 19, 1977, the mangroves or salt forests existing along the continental and island coastlines and tidal channels of the national territory, which form part of the public zone within the maritime-terrestrial zone, constitute a Forest Reserve and are subject to the Ley Forestal and all the provisions of that decree. Beginning from the vegetation line at the edge of the tidal channels and from the boundary of the mangroves or salt forests where these extend more than 50 meters beyond the ordinary high-tide line (pleamar ordinaria), the restricted zone begins." "23) MANGROVE: An ecosystem dominated by groups of pantropical, typically arboreal and shrub plant species and their associated vegetation, which possess morphological, physiological, and reproductive adaptations enabling them to colonize areas subject to tidal exchange. The general landscape is dominated by the presence of forests of various mangrove species, tidal channels, and waterways. Salinity concentrations vary according to climatic season and the contribution of continental waters, with salt concentration values ranging from very low to very high." In this way, the State Natural Heritage is a legally recognized and individually defined legal asset (bien jurídico) within our legal system.

VII.In this particular case, the acting regional director a. i. of the Área de Conservación La Amistad Caribe informed this Court, in her report, that the document entitled "Characterization and delimitation of wetlands in the maritime-terrestrial zone of the coastline of the canton of Talamanca" has not been approved by the Regional Directorate of the Área de Conservación La Amistad Caribe for use as a document of general application, and that it constitutes an internal technical guide of SINAC, not yet validated or officially adopted by the National Council of Conservation Areas of SINAC. She further indicated that through official communication No. SINAC-ACLAC-DR-PNE-C-011-2017 of June 30, 2017, the delimitation of the State Natural Heritage in the maritime-terrestrial zone of the canton of Talamanca was certified—taking wetlands into account for their protection. On the other hand, despite requests to supplement the report, the only explanation offered is confined to those two specific formal aspects: what was certified as State Natural Heritage in 2017 and the preliminary nature of the 2021 study.

However, it fails to address any technical or material obstacles to updating that aspect of the State Natural Heritage. That is, it does not inform the Court of the current state of the wetlands in the canton of Talamanca, nor does it offer any reason why the studies that justified the 2017 decision are technically superior to the 2021 materials. Or, stated inversely, no grounds are set forth explaining why the 2021 study does not correspond to reality or to the technical criteria for safeguarding the State Natural Heritage. For this reason, this Court considers that, in application of the precautionary principle (principio precautorio), given that this writ of amparo (recurso de amparo) concerns environmentally significant assets constituting the State Natural Heritage—specifically the wetlands in the maritime-terrestrial zone of the coastline of the canton of Talamanca—the writ must be granted, with the consequences set out in the operative part of this judgment.

(…)

Por tanto:

The writ is granted. The following is ordered: i) Maylin Mora Arias, in her capacity as acting regional director a. i. of the Área de Conservación La Amistad Caribe of SINAC, or whoever holds that position in her stead, shall complete, within THREE MONTHS from notification of this judgment, the procedure to supplement the certification of the State Natural Heritage in the maritime-terrestrial zone of the canton of Talamanca with the "Characterization and delimitation of wetlands in the maritime-terrestrial zone of the coastline of the canton of Talamanca" of June 2021; ii) Delio Antonio Robles Loaiza, in his capacity as acting head a. i. of the Urban Planning Department, and Daniel Brenes Arroyo, head of the Technical and Operative Criteria and Territorial Planning Unit, both of INVU, as well as Rugeli Morales Rodríguez, mayor, and Yahaira Mora Blanco, president of the Municipal Council, both of the Municipalidad de Talamanca, shall take the steps necessary to incorporate the above-mentioned update into the Coastal Regulatory Plan (Plan Regulador Costero) of the canton of Talamanca (…)."

IV. ON THE SPECIFIC CASE

After analyzing the evidentiary materials submitted, this Court finds no violation of the fundamental rights of the petitioner. From the reports submitted by the representatives of the respondent authorities—which are treated as made under oath, with the consequences, including criminal ones, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter, it has been duly established that the original complaint concerning the Playa Negra wetland dates from 2005 and gave rise to criminal case N.° 05-001155-0597-PE; that the Área de Conservación La Amistad Caribe has continuously monitored the situation through field inspections, technical reports, geo-referencing, and photographic records; and that, in the face of the persistence of illegal activities, it promoted in 2025, after presenting the case before the Comisión Regional de Seguridad Ambiental, the initiation of a new criminal case, N.° 25-131851-0597-PE, pursued against the alleged perpetrator of the reported filling and drainage works. This demonstrates that the respondent authority has not remained inactive in the face of the reported facts, but rather has exercised its powers.

It was likewise established that through official communication SINAC-ACLAC-DASP-RNVSGM-136-2024 of March 26, 2024, precautionary measure (medida cautelar) N.° 0186 was issued, which was not limited to ordering the suspension of works, but also required the removal of fill material deposited within the wetland area and the public zone of the maritime-terrestrial zone, so that the administrative action included a corrective component, not merely a preventive one, consistent with the precautionary principle set forth in Article 2, subparagraph d) of the Ley Orgánica del Ambiente N.° 7554 and in Article 11, paragraph 2) of the Ley de Biodiversidad N.° 7788. Moreover, the site's status as State Natural Heritage and its characterization as a wetland—originally certified in 2017 through official communication SINAC-ACLAC-PNE-C-011-2017—has been ratified and updated on two subsequent occasions, through certifications SINAC-ACLAC-DRFVS-PNE-C-092-2024 and SINAC-ACLAC-DRFVS-PNE-C-014-2025, the latter being currently in force.

This circumstance distinguishes the present matter from that resolved by this Court in judgment N.° 2024003959 of 9:16 a.m. on February 16, 2024, in which the Court found a complete absence of any update to the delimitation of the State Natural Heritage since 2017, despite the existence of a subsequent 2021 technical study that had not been incorporated. In the present case, by contrast, the respondent authority has kept the certification of the protected area up to date and has explained its ongoing technical monitoring.

Finally, it was also established that the respondent authority responded in a timely manner to the requests for information submitted by the petitioner, including the one contained in official communication AEL-0313-2025, by means of official communications CARTA-SINAC-ACLAC-DR-0934-2025, CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025, and CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025, all dated August 26, 2025, such that no violation of the right of access to information enshrined in Article 30 of the Political Constitution is discernible. With respect to the alleged persistence of new encroachments raised by the petitioner after the filing of the writ, it falls to the respondent authority to assess them and, if warranted, to adopt the corresponding administrative measures and file the appropriate criminal complaints. For the foregoing reasons, the appropriate course of action is to deny the writ, as indicated in the operative part of this judgment.

Notwithstanding the fact that this proceeding has been dismissed on the grounds that no constitutionally reproachable omission has been found in the terms set out above, this Court considers it appropriate to remind the Regional Director of the Área de Conservación La Amistad Caribe that the Playa Negra wetland constitutes a high ecological value ecosystem forming part of the State Natural Heritage and subject to the special protective regime derived from Article 50 of the Political Constitution, the Convention on Wetlands of International Importance (Ramsar Convention), the Ley Orgánica del Ambiente N.° 7554, the Ley Forestal N.° 7575, and the Ley de Biodiversidad N.° 7788. For that reason, the respondent authority must continue to carry out, with the diligence and frequency that these environmental assets demand, the tasks of surveillance, inspection, technical updating of the delimitation and characterization of the wetland, timely adoption of precautionary and corrective measures, and reporting of any illegal activity discovered within its jurisdiction, so as to ensure effective and uninterrupted protection of this ecosystem against new encroachments, in application of the precautionary principle and the duty of environmental stewardship that informs all of its activities.

V. SEPARATE REASONS OF MAGISTRATE SALAZAR ALVARADO

With due respect, I concur with the majority opinion denying the writ; however, I base my concurrence on the following grounds:

The protection of a healthy and ecologically balanced environment in the Costa Rican legal system (Ordenamiento Jurídico Costarricense) is guaranteed not only in Article 50 of the Political Constitution, but also in a series of currently effective laws and executive decrees (regulations), such as the Ley Orgánica del Ambiente, Ley N° 7554 of October 4, 1995; the Ley de Biodiversidad, Ley N° 7788 of April 30, 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 of October 21, 1992; and Decreto Ejecutivo N° 31849 of May 24, 2004, the General Regulations on Environmental Impact Assessment (EIA) Procedures, to cite only a few. This makes it necessary, in environmental matters, to distinguish between constitutional review and legality review. In this regard, it is the opinion of the undersigned that this Court, through the writ of amparo, should only entertain a matter in which a violation of the right to a healthy and ecologically balanced environment is alleged if the Administration has not yet intervened and when the violation of that right is manifest and evident, easily verifiable, of a certain importance or gravity, and directly affecting a specific person or community.

Otherwise, the matter must be raised and resolved through the legality channel. Therefore, mere non-compliance with obligations and duties legally imposed on the various public administrations in environmental matters is properly addressed through the legality channel—administrative or judicial—where, with far greater breadth, alleged failures or omissions can be reviewed. It must be kept in mind that the writ of amparo is a summary, informal, simple, and expeditious proceeding, such that from the moment the Administration intervenes in an environmental matter, in the exercise of its powers, and conducts a procedure resulting in the issuance of administrative acts, the matter falls outside the scope of this specialized jurisdiction. For this reason, review of administrative actions taken in connection with an environmental matter that requires, for its proper evaluation, a full cognizance proceeding is only possible before the ordinary courts, since the design of the amparo proceeding is incompatible with the comparison or review of technical or legal criteria developed under existing statutory or regulatory rules, or with the gathering of further and more extensive elements of conviction needed to compare or review the criteria already contained in the administrative case file (expediente administrativo).

The contrary would transform the writ of amparo into an ordinary full cognizance proceeding, which would distort its nature and render nugatory the purposes for which it was designed, causing it to lose its character as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I consider that when a public entity or body has intervened in various ways, or has issued administrative acts in connection with an environmental matter, its review and oversight belong to the administrative-contentious jurisdiction (jurisdicción contencioso administrativa). It is precisely the verification of the existence of such administrative intervention that determines that the matter falls within the purview of the legality channel. Accordingly, this writ should have been dismissed outright, since its subject matter is a question that is properly to be debated, analyzed, and resolved through the legality channel.

However, since that was not done, the appropriate course is to deny it, without making any pronouncement on the merits of the question raised, as it falls to the ordinary courts—specifically, the administrative-contentious jurisdiction—to determine whether the administrative actions and conduct complained of conform, in substance, to the provisions of the statutory legal system with respect to the protection, guardianship, and conservation of the right to a healthy and ecologically balanced environment.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any documents in paper form, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, these must be retrieved from the Court's office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.

POR TANTO:

The writ is DENIED. The respondent authority is hereby directed to take note of what is stated in the last paragraph of Considerando IV of this judgment. Magistrate Salazar Alvarado records separate reasons, holding that it falls to the ordinary courts—specifically, the administrative-contentious jurisdiction—to determine whether the administrative actions and conduct complained of conform, in substance, to the provisions of the statutory legal system with respect to the protection, guardianship, and conservation of the right to a healthy and ecologically balanced environment.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 25-027587-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la DIRECTORA REGIONAL DEL ÁREA DE CONSERVACIÓN LA AMISTAD CARIBE.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 14:51 horas del 10 de setiembre de 2025, el recurrente presenta recurso de amparo contra la DIRECTORA REGIONAL DEL ÁREA DE CONSERVACIÓN LA AMISTAD CARIBE y manifiesta que el humedal de Playa Negra, ubicado en Puerto Viejo, Talamanca, forma parte de la cuenca del río Carbón, colindante con el Parque Nacional Cahuita. Este ecosistema, descrito en la “Evaluación Preliminar del Brazo Este del Estero de Hone Creek Afuera del Parque Nacional Cahuita (Humedal Entre La Barra y El Hotel Perla Negra)” y el oficio SINAC-SE-GASP-165-2005 (13 de julio de 2005), alberga biodiversidad protegida, incluyendo especies en peligro como tortugas marinas (Baula, Carey, Verde y Cabezona) monos, cocodrilos, nutrias y aves migratorias. Además, cumple funciones críticas de regulación hidrológica y es un sitio de anidación clave para tortugas marinas, según el biólogo Didiher Chacón de la Asociación ANAI.Señala que desde el 28 de octubre de 2005, el Comité Local Forestal de Talamanca (CLFT), coordinado por el Ing. Gustavo Alvarado Salazar, documentó actividades ilegales en la propiedad del señor Pool Pavel Jareslav en Playa Negra, incluyendo drenaje de humedales, rellenos con cientos de vagonetas de arena y lastre, construcciones sin permiso, corta de árboles y obstrucción de la zona pública (oficio SINAC-SE-GASP-165-2005). Estas actividades, realizadas con maquinaria pesada, incluyendo equipos de la Municipalidad de Talamanca, han persistido por más de 20 años sin una restauración efectiva, como lo confirma la causa penal 24-00377- 0597-PE, pendiente desde 2004. Afirma que el 9 de agosto de 2025, presentó ante la autoridad recurrida el oficio AEL-0313-2025, mediante el cual solicitó un informe de seguimiento y copia integral del informe SINAC-ACLAC-DASP-RNVSGM-136-2024 (26 de marzo de 2024), referente al drenaje y relleno del humedal presuntamente por la Municipalidad de Talamanca.En respuesta, la Licda. Maylin Mora Arias trasladó los oficios CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 y CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 (26 de agosto de 2025), que confirman la ampliación de la denuncia y el depósito adicional de lastre, pero limitan la acción del SINAC a la paralización de actividades y la remisión del caso al Ministerio Público, sin adoptar medidas precautorias ni correctivas inmediatas. Agrega que el oficio CARTA-SINACACLAC-DASP-RNVSGM-416-2025 y las imágenes del 26 de agosto de 2025 evidencian la extensión del relleno con lastre, agravando el daño al humedal. El informe SINAC-SE-GASP-165- 2005 detalla la presencia de plantas indicadoras de humedal (yolillo, majagua, araceas), suelos fangosos y fauna amenazada, así como la intervención humana mediante rellenos y drenajes que han alterado las condiciones naturales del ecosistema. La falta de una caracterización y delimitación actualizada del humedal, a pesar de los antecedentes de 2004 y 2005, perpetúa el riesgo de un daño irreversible.Indica que la causa penal 24- 00377-0597-PE, en trámite desde 2004, no ha logrado la restauración del humedal, y las acciones del SINAC se han limitado a informes sin medidas efectivas. Enfatiza que la autoridad recurrida ha omitido adoptar medidas precautorias y correctivas inmediatas para proteger y restaurar el humedal de Playa Negra, Puerto Viejo, Talamanca, un ecosistema de alto valor ecológico, a pesar de contar con indicios, pruebas y antecedentes documentados desde 2004, incluyendo el oficio SINAC-SE-GASP-165-2005 y los informes recientes del SINAC. Esta omisión viola derechos fundamentales garantizados por los artículos 21, 33, 46 y 50 de la Constitución Política, así como la normativa ambiental vigente, incluyendo la Ley de Biodiversidad (Ley N° 7788), la Ley Orgánica del Ambiente (Ley N° 7554), la Ley Forestal (Ley N° 7575) y el Decreto Ejecutivo N° 39838-MINAE sobre protección de humedales.
  2. 2Por resolución de Presidencia de las 07:41 horas del 09 de octubre de 2025, se le dio curso al presente recurso de amparo y se solicitó informe a la recurrida (ver registro electrónico).
  3. 3Informa bajo juramento MAYLIN MORA ARIAS, en condición de Directora Regional a.i, del Área de Conservación la Amistad Caribe, que “PRIMERO: Que sobre el caso en mención existe la causa penal N.o 05-001155-0597-PE, interpuesta por el Consejo Local Forestal de Talamanca, perteneciente al Área de Conservación La Amistad Caribe (ACLAC), del Sistema Nacional de Áreas de Conservación (SINAC). Dicha denuncia se formuló desde el año 2005 por presuntos daños ambientales en humedales y ecosistemas frágiles de Playa Negra, distrito Cahuita, cantón de Talamanca, los cuales fueron documentados mediante el Oficio SINAC-SE-GASP-165-2005. Desde esa fecha, el SINAC ha actuado conforme a sus competencias legales establecidas en la Ley Forestal N.° 7575 y la Ley Orgánica del Ambiente N.° 7554, realizando denuncias, peritajes, ampliaciones, inspecciones y remisiones al Ministerio Público. El ACLAC ha dado seguimiento constante a la situación del sitio, remitiendo nuevos informes técnicos, ampliaciones de las denuncias y aportando evidencia fotográfica y cartográfica conforme a los procedimientos administrativos y judiciales vigentes.No obstante, la inacción procesal o demora en la resolución de la causa penal corresponde al Ministerio Público, en virtud del principio de independencia funcional consagrado en la Constitución Política y en el Código Procesal Penal, por lo que no puede imputarse omisión SEGUNDO: Que incluso ante la persistencia de las afectaciones y la inacción observada en los procesos judiciales, el Área de Conservación La Amistad Caribe (ACLAC) elevó nuevamente su preocupación ante las instancias competentes. En el año 2025, esta problemática fue expuesta formalmente durante una sesión de la Comisión Regional de Seguridad Ambiental, espacio interinstitucional en el que participan representantes del Ministerio Público, Organismo de Investigación Judicial, SINAC y otras entidades estatales. En dicha sesión, la Fiscalía Agrario Ambiental acogió las inquietudes planteadas por el ACLAC respecto a la falta de avance de la Fiscalía de Bribrí en la causa original, acordando la apertura de una nueva investigación bajo el número 25-131851-0597-PE, seguida contra Pavel.Jaroslav Hradecky, como presunto responsable de rellenos y drenajes ilegales dentro del humedal de Playa Negra, ubicado en Puerto Viejo de Talamanca. Desde esa fecha, el SINAC–ACLAC ha procedido a ampliar las denuncias existentes y presentar nuevos casos penales vinculados con la invasión, relleno y alteración de humedales y zonas públicas debidamente delimitadas por funcionarios técnicos del Área de Conservación. Dichas actuaciones han incluido inspecciones de campo, levantamiento de coordenadas geográficas, elaboración de informes técnicos, registro fotográfico y remisión de evidencia pericial a las autoridades judiciales competentes. Entre las causas más relevantes tramitadas en el período reciente pueden citarse las siguientes: • 19-000695-829-PE, por afectación a ecosistemas de humedal en la Zona Marítimo Terrestre. • 21-000574-0597-PE, por invasión y relleno de humedales en PNE. • 24-000161-829-PE y 24-000162-829-PE, relativas a nuevas invasiones en áreas de Patrimonio Natural del Estado.• y 24-00377-0597-PE, que mantiene continuidad con los hechos originales denunciados en 2005.En este mismo sentido, se presentó un análisis ante la Municipalidad de Talamanca y la Fiscalía Adjunta Agrario-Ambiental en julio del 2021, en la cual se expuso la situación concreta de la causa penal N.o 05-001155-0597-PE con imágenes aéreas, para evidenciar las construcciones realizadas en el sitio denunciado desde el año 2005, lo cual se puede evidenciar a continuación: TERCERO: Que desde el año 2017, mediante la certificación oficial del Patrimonio Natural del Estado (PNE) en la Zona Marítimo Terrestre del cantón de Talamanca, bajo el consecutivo SINAC-ACLAC-PNE-C-011-2017 emitido el 30 de junio de 2017, el sitio señalado fue formalmente identificado como Patrimonio Natural del Estado. Esta determinación técnica y jurídica confiere a dicho terreno un régimen de inalienabilidad, imprescriptibilidad y protección absoluta, de conformidad con lo establecido en los artículos 9 y 10 de la Ley sobre la Zona Marítimo Terrestre N.o 6043, que definen la franja de 200 metros desde la pleamar ordinaria y establecen que los primeros 50 metros constituyen zona pública de uso común, donde se prohíbe toda ocupación o construcción privada, así como en el artículo 75 de la misma ley, que faculta al Estado para ejercer control y vigilancia permanente sobre estos bienes demaniales.De igual forma, el artículo 13 de la Ley Forestal N.o 7575 dispone que los terrenos del Patrimonio Natural del Estado se encuentran bajo la administración y protección directa del Sistema Nacional de Áreas de Conservación (SINAC), por lo que toda intervención o alteración en ellos sin autorización constituye una infracción ambiental grave. En ese sentido, el Área de Conservación La Amistad Caribe (ACLAC) ha mantenido el control técnico y jurídico sobre el sitio, efectuando verificaciones periódicas y acciones administrativas orientadas a preservar la integridad ecológica del humedal y la zona pública, en cumplimiento del principio de tutela estatal sobre los bienes demaniales y ecosistemas de interés nacional. CUARTO: Que con posterioridad a la certificación del Patrimonio Natural del Estado emitida en el año 2017, se han generado dos actualizaciones oficiales correspondientes a las certificaciones SINAC-ACLAC-DRFVS-PNE-C-092-2024 y SINAC-ACLAC-DRFVS-PNE-C- 014-2025, siendo esta última la vigente a la fecha.Ambas ratifican la condición jurídica y ambiental del sitio como parte integrante del Patrimonio Natural del Estado, y confirman su caracterización ecosistémica como humedal. Esta delimitación, originalmente identificada desde el año 2017, se ha mantenido invariable en todos los procesos de revisión técnica, lo que demuestra la continuidad y consistencia del criterio institucional respecto al valor ecológico y el régimen de protección que ampara el área. QUINTO: Que el recurrente ha presentado múltiples gestiones formales ante esta Dirección Regional, entre ellas las notas AEL-027-2023, AEL-044-2023, AEL-0261-2024, AEL-0263-2025, AEL-0281-2025 y AEL-0313-2025, entre otras, mediante las cuales ha solicitado diversa información relacionada con el caso en mención. En todos los casos, esta Administración ha brindado respuesta oportuna y acceso a la información solicitada, conforme a los principios de transparencia y publicidad de los actos administrativos establecidos en la Ley N.o 10554, Ley Marco de Acceso a la Información Pública.Ejemplo de ello son los oficios CARTA-SINAC-ACLAC-DR-0934-2025 y CARTA- SINAC-ACLAC-DASP-RNVSGM-421-2025, remitidos en atención a la solicitud del recurrente respecto a un informe de seguimiento y copia integral del documento emitido mediante oficio SINAC-ACLAC-DASP-RNVSGM-136-2024, de fecha 26 de marzo de 2024, referente al drenaje y relleno de humedal presuntamente ejecutado por la Municipalidad de Talamanca. Asimismo, mediante el oficio CARTA-SINAC- ACLAC-DASP-RNVSGM-416-2025, también del 26 de agosto de 2025, se remitió información sobre la ampliación de la causa penal N.° 24-000377-0597-PE, en la cual el ACLAC actúa como denunciante técnico y colaborador del Ministerio Público. SEXTO: Que mediante los oficios CARTA-SINAC-ACLAC-DASP-RNVSGM-421- 2025 y SINAC-ACLAC-DASP-RNVSGM-136-2024, este último de fecha 26 de marzo de 2024 y debidamente compartido con el recurrente, se le informó sobre la emisión de la medida cautelar N.° 0186, dictada con el propósito de paralizar de inmediato las obras y actividades ilegales detectadas en el sitio, así como de ordenar el retiro del material de relleno depositado por los presuntos infractores dentro del área de humedal y zona pública de la Zona Marítimo Terrestre.Dicha medida fue adoptada conforme a las facultades conferidas al Sistema Nacional de Áreas de Conservación (SINAC) en los artículos 6, inciso g), y 7 de la Ley Forestal N.° 7575, y en aplicación del principio precautorio reconocido en el artículo 2, inciso d), de la Ley Orgánica del Ambiente N.° 7554, orientado a prevenir y mitigar daños ambientales irreversibles en ecosistemas de alta fragilidad ecológica, como los humedales costeros. SÉTIMO: Que esta Dirección Regional del Área de Conservación La Amistad Caribe (ACLAC) ha actuado en estricto apego al ordenamiento jurídico, confirmando la ampliación de la denuncia interpuesta, ordenando la paralización inmediata de las actividades ilícitas detectadas y remitiendo el expediente correspondiente al Ministerio Público para la investigación de los presuntos ilícitos penales ambientales, conforme a las competencias legalmente establecidas. Estas actuaciones se fundamentan la Ley Forestal N.° 7575, que confieren al SINAC la responsabilidad de prevenir, controlar y denunciar todo aprovechamiento ilegal o daño al Patrimonio Natural del Estado, así como en el artículo 50 de la Constitución Política, que impone al Estado el deber de velar por la protección efectiva del ambiente.En consecuencia, las acciones adoptadas por esta Dirección Regional se ajustan plenamente al principio de legalidad y al deber de debida diligencia administrativa, garantizando la tutela del interés público ambiental. OCTAVO: Que esta Dirección Regional del Área de Conservación La Amistad Caribe (ACLAC) ha dado seguimiento constante y documentado a las denuncias relacionadas con la afectación de humedales y áreas del Patrimonio Natural del Estado en el distrito de Cahuita, cantón de Talamanca. Entre ellas destacan las causas penales 19-000695-829- PE, 21-000574-0597-PE, 24-000161-829-PE, 24-000162-829-PE y 24-00377-0597-PE, todas debidamente respaldadas con inspecciones de campo, informes técnicos, georreferenciación y registros fotográficos realizados por funcionarios del ACLAC. Asimismo, y ante la persistencia de las actividades ilegales en la zona, el ACLAC promovió en el año 2025 la apertura de la causa penal 25-131851-0597-PE ante la Fiscalía Agrario Ambiental, luego de exponer la situación en la Comisión Regional de Seguridad Ambiental.Dichas actuaciones reflejan la continuidad, coherencia y debida diligencia institucional en la atención del caso, en estricto cumplimiento de las competencias asignadas por los la Ley Forestal N.° 7575 y los artículos 1 y 2 de la Ley Orgánica del Ambiente N.° 7554, que obligan al SINAC a velar por la conservación, denuncia y protección efectiva de los ecosistemas bajo su jurisdicción. NOVENO: Que las acciones preventivas emprendidas por el Área de Conservación La Amistad Caribe (ACLAC) se han enfocado en la protección efectiva del Patrimonio Natural del Estado, mediante la ejecución de inspecciones periódicas, la rotulación de sitios vulnerables y la aplicación de medidas cautelares ante cualquier amenaza o daño ambiental. Estas actuaciones se enmarcan en los artículos 8, 49 y 54 de la Ley de Biodiversidad N.° 7788, que establecen la obligación del Estado de garantizar la conservación y restauración de los ecosistemas, y en el principio precautorio consagrado en el artículo 11 inciso 2) de la misma ley, el cual dispone que, ante la amenaza de daños graves o inminentes a la biodiversidad, la ausencia de certeza científica no podrá invocarse como motivo para postergar la adopción de medidas eficaces de protección.Asimismo, aunque esta Dirección Regional actúa con pleno respeto a los tiempos procesales del Ministerio Público, resulta imperativo recordar que en materia ambiental particularmente tratándose de ecosistemas frágiles como humedales y manglares la administración no puede asumir una posición permisiva frente a procesos judiciales que se prolongan por décadas sin resolución definitiva. Por tal razón, el ACLAC ha mantenido monitoreo constante del área, generando ampliaciones sucesivas de las denuncias y emitiendo informes técnicos actualizados que respaldan la continuidad de las medidas preventivas, conforme al principio de prevención y de indubio pro natura, pilares de la gestión ambiental pública. DÉCIMO: Que, conforme al principio de separación de competencias entre la autoridad administrativa y la judicial, una vez que un asunto se encuentra bajo conocimiento de un juez o del Ministerio Público, las demás autoridades, incluidas las administrativas como el SINAC, deben abstenerse de dictar resoluciones que puedan interferir o contradecir las decisiones jurisdiccionales.En esta fase, el rol del Área de Conservación La Amistad Caribe (ACLAC) es de colaboración, auxilio técnico y cumplimiento de las disposiciones judiciales, en el marco de lo establecido por el artículo 290 del Código Procesal Penal, el cual faculta a las autoridades administrativas para actuar como peritos o expertos técnicos ante requerimiento de los tribunales. En consecuencia, las competencias del ACLAC, mientras el caso se mantiene en sede judicial, se circunscriben a: 1. Aportar informes técnicos y peritajes especializados que sirvan de insumo al juez o fiscal para valorar los hechos y el daño ambiental; 2. Adoptar medidas administrativas preventivas o cautelares inmediatas, tales como órdenes de paralización de obras o retiro de material, que son provisionales y complementarias, sin sustituir las medidas restaurativas que competen al juez; y 3. Cumplir de manera estricta las órdenes y mandatos judiciales, en especial aquellas relacionadas con la reparación o restauración del daño ambiental.De esta forma, el proceso judicial constituye el canal idóneo y exclusivo para determinar responsabilidades penales y dictar medidas restaurativas definitivas, mientras que la autoridad administrativa mantiene su papel técnico de apoyo, garantizando el resguardo del ecosistema y la continuidad del control ambiental hasta que exista una resolución judicial firme. Esta coordinación asegura el respeto al debido proceso, al principio de legalidad administrativa y al derecho constitucional a un ambiente sano y ecológicamente equilibrado consagrado en el artículo 50 de la Constitución Política.” Solicita que se declare sin lugar el recurso.
  4. 4En las fechas 27 y 28 de octubre de 2025, el recurrente hace replica a los informes rendidos por las autoridades recurridas y manifiesta que estos no desvirtúan sus denuncias, sino que por omisión confirma la falta de respuesta efectiva frente al daño ambiental, y que el caso no debe limitarse a verificar si hubo algunas inspecciones o medidas cautelares, que debe analizarse la afectación acumulada del humedal, la ausencia de delimitación técnica, la presunta permisividad institucional y la necesidad de ordenar una restauración integral del ecosistema.
  5. 5El 03 de noviembre de 2025, el recurrente aporta prueba al expediente para que sea analizada. Además, solicita a esta Sala: 1. Admitir la presente prueba para mejor resolver, incorporándola al expediente. 2. Ordenar medidas cautelares urgentes, como paralización de obras, eliminación de intervenciones ilegales, advertencias a instituciones (Municipalidad de Talamanca, SETENA, SINAC, ACLAC, RNP), y delimitación correcta del humedal.
  6. 6El 12 de enero de 2026, el recurrente aporta escrito al expediente y manifiesta que el 8 de enero de 2026, en Limón, presentó formal denuncia y exigencia técnica-científica ante la Licda. Maylin Mora Arias, directora del Área de Conservación La Amistad Caribe, mediante oficio MLV-009-2026, donde se detalla los hechos denunciados por vecinos (reanudación de vagonetas con material de relleno, extracción de raíces y ramas, tránsito nocturno de maquinaria).Sin embargo, no le han dado respuesta.
  7. 7El 24 de enero de 2026, el recurrente aporta escrito al expediente donde señala: “el día de hoy he recibido una nueva denuncia que confirma la persistencia de estas prácticas: “Están sacando vagonetas llenas con escombros, pedazos de vegetación típica de humedales, como grandes pedazos de palma yolillo, del humedal de Playa Negra”. Solicita a la Sala Constitucional: “que ordene a las autoridades competentes, incluyendo al Fiscal Adjunto Ambiental José Pablo González Montero y a la Licenciada Maylin Mora Arias en su calidad de Directora del Área de Conservación Amistad Caribe, las siguientes acciones: 1. La inmediata delimitación y caracterización del Humedal de Playa Negra, culminando en la confección de un mapa técnico y científico que defina sus límites exactos, zonas de amortiguamiento, características ecológicas, hidrológicas y geográficas actualizadas, y áreas prioritarias de intervención. 2.La implementación de un plan estratégico de restauración del ecosistema, basado en el mapa solicitado, que incluya el desalojo de invasores ilegales, la remoción de escombros y vegetación extraída ilegalmente, y medidas de monitoreo continuo para prevenir futuras degradaciones. 3. Un riguroso reproche a las autoridades administrativas y judiciales por su inacción prolongada, asegurando el cumplimiento efectivo de las obligaciones constitucionales e internacionales en materia ambiental.”.
  8. 8El 16 de marzo de 2026, el recurrente aporta escrito al expediente donde reitera los alegatos y solicita a la Sala que, en aras de garantizar una justicia ambiental pronta y cumplida, se ordene al Departamento de Ciencias Forenses del Organismo de Investigación Judicial, realizar una valoración integral y pericial del daño causado en el Humedal de Playa Negra durante los últimos años.
  9. 9El 17 de marzo de 2026, el recurrente aporta a la Sala copia de la carta remitida al Fiscal Adjunto Ambiental, señala que con el propósito de que se tome nota de la gravedad de la situación que se vive en el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y en el Caribe sur de nuestro país.
  10. 10En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente interpone recurso de amparo y expone que, el humedal de Playa Negra (Puerto Viejo, Talamanca), parte de la cuenca del río Carbón y colindante con el Parque Nacional Cahuita, alberga especies protegidas (tortugas marinas, monos, cocodrilos, nutrias, aves migratorias) y cumple funciones hidrológicas y de anidación clave, según el biólogo Didiher Chacón (ANAI) y el oficio SINAC-SE-GASP-165-2005 (2005). Desde 2005 el CLFT documentó actividades ilegales en la propiedad de Pool Pavel Jareslav (drenaje, rellenos con lastre y arena, construcciones sin permiso, tala, obstrucción de zona pública), con maquinaria incluso municipal, sin restauración efectiva pese a la causa penal 24-00377-0597-PE (pendiente desde 2004). El 9 de agosto de 2025 se solicitó vía oficio AEL-0313-2025 un informe de seguimiento y copia del informe SINAC-ACLAC-DASP-RNVSGM-136-2024. La respuesta de la Licda. Maylin Mora Arias (oficios 421-2025 y 416-2025, 26 de agosto de 2025) confirmó ampliación de la denuncia y nuevo depósito de lastre, pero el SINAC se limitó a paralizar actividades y remitir el caso al Ministerio Público, sin medidas precautorias o correctivas inmediatas.

El recurrente alega omisión de la autoridad recurrida en proteger y restaurar el humedal pese a evidencia documentada desde 2004, violando los artículos 21, 33, 46 y 50 de la Constitución Política y la normativa ambiental (Leyes N° 7788, 7554, 7575, y Decreto N° 39838-MINAE).

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

El 28 de octubre de 2005, el Comité Local Forestal de Talamanca (CLFT), coordinado por el Ing. Gustavo Alvarado Salazar, documentó actividades ilegales en la propiedad del señor Pool Pavel Jareslav en Playa Negra, consistentes en drenaje de humedales, rellenos con cientos de vagonetas de arena y lastre, construcciones sin permiso, corta de árboles y obstrucción de la zona pública, ejecutadas con maquinaria pesada que incluyó equipo de la Municipalidad de Talamanca (ver prueba agregada a los autos).

Durante los años 2023 a 2025, el recurrente presentó ante la Dirección Regional del ACLAC diversas gestiones formales mediante los oficios AEL-027-2023, AEL-044-2023, AEL-0261-2024, AEL-0263-2025 y AEL-0281-2025, solicitando información relacionada con el caso, las cuales fueron atendidas por dicha Administración (ver informe rendido por parte de las autoridades accionadas).

El 26 de marzo de 2024, mediante el oficio SINAC-ACLAC-DASP-RNVSGM-136-2024, el ACLAC dictó la medida cautelar N.° 0186, con el propósito de paralizar de inmediato las obras y actividades ilegales detectadas en el sitio y ordenar el retiro del material de relleno depositado dentro del área de humedal y zona pública de la Zona Marítimo Terrestre (ver informe rendido por parte de las autoridades accionadas).

En el año 2024, se emitió la certificación SINAC-ACLAC-DRFVS-PNE-C-092-2024, mediante la cual se ratificó la condición jurídica y ambiental del sitio como parte del Patrimonio Natural del Estado y su caracterización como humedal (ver informe rendido por parte de las autoridades accionadas).

En el año 2025, se emitió la certificación SINAC-ACLAC-DRFVS-PNE-C-014-2025, vigente a la fecha, que confirmó nuevamente la condición jurídica y ecosistémica del sitio como Patrimonio Natural del Estado y humedal (ver informe rendido por parte de las autoridades accionadas).

En el año 2025, en una sesión de la Comisión Regional de Seguridad Ambiental, la Fiscalía Agrario Ambiental acogió las inquietudes planteadas por el ACLAC respecto a la falta de avance de la Fiscalía de Bribrí en la causa original, acordándose la apertura de la causa penal N.° 25-131851-0597-PE contra Pavel Jaroslav Hradecky, como presunto responsable de rellenos y drenajes ilegales dentro del humedal de Playa Negra (ver informe rendido por parte de las autoridades accionadas).

El 09 de agosto de 2025, el recurrente presentó ante la autoridad recurrida el oficio AEL-0313-2025, mediante el cual solicitó un informe de seguimiento y copia integral del informe SINAC-ACLAC-DASP-RNVSGM-136-2024, de fecha 26 de marzo de 2024, referente al drenaje y relleno del humedal presuntamente ejecutado por la Municipalidad de Talamanca (ver informe rendido por parte de las autoridades accionadas).

El 26 de agosto de 2025, mediante los oficios CARTA-SINAC-ACLAC-DR-0934-2025, CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 y CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025, la Dirección Regional del ACLAC dio respuesta al recurrente, confirmando la ampliación de la denuncia original y el depósito adicional de material de lastre en el humedal, remitiendo asimismo la información solicitada relativa al oficio SINAC-ACLAC-DASP-RNVSGM-136-2024 (ver informe rendido por parte de las autoridades accionadas).

III.Este Tribunal, mediante sentencia No. 2024003959 de las 9:16 horas de 16 de febrero de 2024 dictada en el expediente 23-014549-0007-CO de las 9:30 horas de 16 de febrero de 2024, dispuso:

“VI. SOBRE LA PROTECCIÓN DE LOS HUMEDALES. Adicionalmente a lo dicho anteriormente, Costa Rica suscribió la denominada "Convención Relativa a los Humedales de Importancia Internacional, Especialmente como Hábitat de Aves Acuáticas", llamada también "Convención de Ramsar" (firmada en Ramsar el 2 de febrero de 1971). En su artículo 4 se establece:" Cada parte contratante fomentará la conservación de las zonas húmedas y de las aves acuáticas creando reservas naturales en los humedales, estén o no inscritos en la " Lista ", y atenderá de manera adecuada su manejo y cuidado...". La Convención define a los humedales como: "extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros". Los humedales se encuentran formados por una serie de componentes físicos, biológicos, químicos, que corresponden a suelos, agua, especies animales y vegetales y nutrientes.

Los procesos que se producen entre estos componentes y dentro de cada uno de ellos, permite que el humedal realice ciertas funciones, positivas en la zona en que se ubica, tales como el control de inundaciones y la protección contra fenómenos naturales como las tormentas. Genera también productos en beneficio de las personas y de la sociedad en general, tales como: mantenimientos de la vida silvestre, pesquería y recursos forestales. La importancia de los humedales estriba, entonces, en el sostenimiento de gran cantidad y variedad de especies, con impactos socio-económicos favorables para ciertos sectores de la población que se dediquen a una explotación racional y la aparición de un singular paisaje identificable plenamente por su gran belleza y diversidad en cuanto a la vida silvestre que forman parte de su patrimonio cultural, fuente importante para el turismo de un país o región. Al respecto se ha pronunciado este Tribunal, en el siguiente sentido:

“V.- Sobre la protección a los humedales. Esta Sala se ha referido a la relevancia de estos ecosistemas y su protección, en las sentencias 2001-12817 de las 10:28 horas del 14 de diciembre del 2001 y 2007-6246 de las 19:30 horas del 8 de mayo del 2007, entre otras, señalando que los humedales son considerados como los ecosistemas más productivos del mundo. En Costa Rica, el artículo 40 de la Ley Orgánica del Ambiente los ha definido como: “Ecosistemas con dependencia de regímenes acuáticos, naturales o artificiales, permanentes o temporales, lénticos o lóticos, dulces, salobres o salados, incluyendo extensiones marinas hasta el límite posterior de fanerógamas o arrecifes, o en su ausencia, hasta seis metros de profundidad en marea baja”. Sobre la importancia de estos ecosistemas, en la resolución No. 2009-014288 de las 15:19 horas del 09 de setiembre de 2009, este Tribunal señaló:

“La importancia de los humedales no lo es sólo (sic) en función de la biodiversidad y de las que se desarrollan a escala ecológica, sino porque proveen de funciones de apoyo y productos esenciales para las comunidades humanas en el mundo en desarrollo e industrializado.

Según la doctrina y estudios científicos, el término humedales comprende una gran variedad de ecosistemas, con características muy distintas, se pueden clasificar en siete unidades paisajísticas: estuarios, costas abiertas, llanuras de inundación, pantanos de agua dulce, lagos, turberas y bosques de inundación; o en humedales de agua salada, de agua dulce o humedales artificiales. Cada uno está formado por una serie de componentes físicos, químicos y biológicos, tales como suelos, agua, especies de animales, vegetales y nutrimentos. Los procesos entre estos componentes y dentro de cada uno de ellos, permiten que el humedal desempeñe funciones, como el control de inundaciones y la protección contra tormentas, y que se generen productos, como la vida silvestre, pesquería y recursos forestales, purifican el agua y estabilizan la línea de la costa. No todas las características están presentes en cada humedal, pocos desempeñan todas las funciones de la misma manera.

Además, presentan atributos muy valiosos como la diversidad biológica y la singularidad del patrimonio cultural. Es la combinación de estas funciones, productos y atributos de los ecosistemas la que hace que los humedales sean importantes para la sociedad. Mediante el almacenamiento de las precipitaciones y la liberación uniforme de la escorrentía, los humedales pueden disminuir la embestida destructiva de las crecidas y los ríos, por lo que la conservación de los depósitos naturales puede evitar la construcción de presas y embalses. Su vegetación puede estabilizar la línea costera mediante la reducción de la energía de las olas, corrientes u otras fuerzas de erosión, al mismo tiempo que con las raíces de las plantas, sostiene los sedimentos del fondo en su lugar, lo que puede prevenir tanto la erosión de valiosas tierras agrícolas o habitadas, como el daño a la propiedad. Los humedales que remueven nutrientes, mejoran la calidad del agua y ayudan a prevenir la eutrofización, lo que puede evitar la necesidad de construir sistemas de tratamiento del agua.

Por otro lado, muchos sostienen la vida de densas poblaciones de peces, ganado o vida silvestre, que se alimentan de sus aguas ricas en nutrientes o de su sustrato, o bien comen en sus exuberantes pastizales. Los ciclos hidrológicos, de nutrientes y de materia, y los flujos de energía de los humedales, pueden estabilizar las condiciones climáticas locales, en particular, las precipitaciones y las temperaturas, lo que influye tanto en las actividades agrícolas como en aquellas basadas en los recursos naturales, como en la estabilidad de los ecosistemas naturales y en el mismo humedal. Coadyuvan además en la recreación, pesquerías, recurso agrícola y el turismo, así como en el aprovechamiento directo de los recursos forestales que generan en un importante número de bienes, que van desde leña, madera para la construcción y corteza, entre los productos maderables, hasta resinas y medicinas, que son productos forestales “secundarios´ no maderables.

Son incluso importantes como reserva genética de ciertas especies vegetales -como el arroz-.” Varios instrumentos internacionales, entre los que destaca la Convención sobre los Humedales o Convención de Ramsar, suscrita por nuestro país según Ley No. 7224 el 9 de abril de 1991 y publicada en La Gaceta el 8 de mayo de ese mismo año, se ocupan de su protección. En la Convención de Ramsar, el humedal es definido como: “Extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros”. La Convención proclama el deber de los Estados de proteger -en aras no solamente de sus propios intereses, sino de intereses internacionales- estos ecosistemas, por lo que los países tienen la obligación de desarrollar políticas nacionales tendentes a la conservación de estos ambientes en sus políticas del uso de la tierra.

En cuanto a las obligaciones adquiridas por los países signatarios, que son de diversa índole, se encuentra la designación de al menos un humedal de importancia internacional para ser incluido en la Lista de Sitios Ramsar, cuya selección deberá basarse en su interés internacional desde el punto de vista ecológico, botánico, zoológico, limnológico o hidrológico, por lo que es un compromiso referido a la protección de sitios específicos (artículo 2). Además, se adquieren obligaciones no relacionadas con sitios específicos, como elaborar y aplicar sus planes de gestión de forma que favorezcan el uso racional de los humedales de su territorio (artículo 3). También se obliga a fomentar la conservación de las zonas húmedas y de las aves acuáticas creando reservas naturales en los humedales, estén o no inscritos en la Lista” (artículo 4). Por último, los países firmantes deben coordinar sus políticas y regulaciones relativas a la conservación de los humedales, de su flora y de su fauna (artículo 5).

Así, las partes instauran un sistema de protección de las zonas húmedas, en primer lugar a través de una lista de humedales de importancia internacional (sitios Ramsar), y en segundo lugar, procurando el uso racional de todos los humedales en su territorio. Asimismo, en los “Lineamientos para la Aplicación del Concepto de Uso Racional de la Convención”, adoptados por la Recomendación 4.10, se indica que “las disposiciones sobre el uso racional se aplican a todos los humedales y a los sistemas que los sustentan dentro del territorio de una Parte Contratante, tanto los incluidos en la Lista, como todos los demás.” Según la Secretaría de la Convención de Ramsar, la Política Nacional de Humedales debe contemplar como objetivo: “Evitar nuevas pérdidas de los humedales que aún existan y alentar la rehabilitación de los humedales del país manteniendo su integridad, conservando su diversidad genética y velando por que su disfrute y aprovechamiento económico sean sostenibles.” Y debería “abarcar todos los tipos de humedales”.

Es claro entonces que según la Convención de Ramsar, todo ecosistema que reúna las características de humedal, debe ser utilizado de forma racional y sostenible en los términos que la Convención y la Conferencia de las Partes han definido.” (ver sentencia No. 2013-7934 de las 9:05 horas del 14 de junio de 2013).

En nuestro país, son áreas que forman parte del patrimonio natural del Estado y pertenecen a la zona pública. La ley sobre la Zona Marítimo Terrestre, respecto de los manglares y esteros dispone:

“Artículo 11.- Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional”.

Las municipalidades administran la zona marítimo terrestre, que incluye tanto la zona pública como la zona restringida. No obstante, los manglares están excluidos de esa administración aunque se ubiquen en dichas áreas, ya que competen al MINAE, según la Ley Forestal:

“Artículo 13.- Constitución y administración El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su Nombre01 y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.

El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado.

Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a Nombre01 del Estado, deberán traspasarlos a Nombre01 de este.” Artículo 18.- Autorización de labores En el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, una vez aprobadas por el Ministro del Ambiente y Energía, quien definirá, cuando corresponda, la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de esta ley.” Así lo consigna el Reglamento de la Ley sobre la Zona Marítimo Terrestre, en el artículo 4 y el artículo 2, inciso 23) del Reglamento a la Ley de Conservación de Vida Silvestre:

“Artículo 4º.- De acuerdo con el decreto Nº 7210-A de 19 de julio de 1977, los manglares o bosques salados que existen en los litorales continentales o insulares y esteros del territorio nacional, y que forman parte de la zona pública en la zona marítimo terrestre, constituyen Reserva Forestal y están afectos a la Ley Forestal y a todas las disposiciones de ese decreto. Partiendo de la línea de vegetación a la orilla de los esteros y del límite de los manglares o bosques salados cuando éstos se extiendan por más de 50 metros de la pleamar ordinaria, comienza la zona restringida”.

“23) MANGLAR: Ecosistema dominado por grupos de especies vegetales pantropicales y típicamente arbóreas, arbustivas y vegetación asociada, las cuales cuentan con adaptaciones morfológicas, fisiológicas y reproductivas que permiten colonizar áreas sujetas al intercambio de mareas. El paisaje general está dominado por la presencia de bosques de diferentes especies de mangle, esteros y canales. Las concentraciones de salinidad varían según la estación climática y al aporte de aguas continentales encontrándose valores de concentración de sales desde muy bajos hasta muy altos”.

De este modo, el Patrimonio Natural del Estado es un bien jurídico, definido e individualizado en nuestro ordenamiento jurídico.

VII.En este caso en particular, la directora regional a. i. del Área de Conservación La Amistad Caribe indicó a este Tribunal, en su informe, que el documento denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general y que se trata de una guía técnica interna del Sistema Nacional de Áreas de Conservación, aún sin validar ni oficializar por parte del Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación. Asimismo, que mediante oficio No. SINAC-ACLAC-DR-PNE-C-011-2017 del 30 de junio de 2017 se certificó la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del cantón de Talamanca -considerando los humedales para su protección-. Por otra parte, pese a las solicitudes de ampliación de informe la única explicación ofrecida se concentra en esos dos aspectos formales puntuales: lo que se certificó como patrimonio natural del Estado en 2017 y la condición preliminar del estudio de 2021.

Sin embargo, omite referirse a obstáculos de índole técnico o material para actualizar ese aspecto del patrimonio natural del Estado. Es decir, no indica a la Sala cuál es el estado actual de los humedales en el cantón de Talamanca, ni ofrece razón alguna por la cual los estudios que justificaron la decisión de 2017 son técnicamente superiores al material de 2021. O, dicho a la inversa, no se exponen los motivos por los cuales el estudio de 2021 no corresponden a la realidad o a criterios técnicos de tutela del patrimonio natural del Estado. Por lo anterior, considera este Tribunal que en aplicación del principio precautorio, al versar este amparo sobre bienes ambientalmente relevantes, constitutivos del patrimonio natural del Estado, específicamente de los humedales en la zona marítimo terrestre del litoral del cantón de Talamanca, debe declararse con lugar el recurso con las consecuencias expuestas en la parte dispositiva de esta sentencia.

(…)

Por tanto:

Se declara con lugar el recurso. Se ordena: i) a Maylin Mora Arias, en su condición de directora regional a. i. del Área de Conservación La Amistad Caribe del Sistema Nacional del Áreas de Conservación, o a quien en su lugar ejerza ese cargo, concluir, en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, el trámite para complementar la certificación de Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca con la “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” de junio de 2021; ii) a Delio Antonio Robles Loaiza, en su condición de jefe a. i. del Departamento de Urbanismo, y a Daniel Brenes Arroyo, encargado de la Unidad de Criterios Técnicos y Operativos de Ordenamiento Territorial, ambos del Instituto Nacional de Vivienda y Urbanismo, así como a Rugeli Morales Rodríguez, alcalde, y a Yahaira Mora Blanco, presidente del Concejo, ambos de la Municipalidad de Talamanca, disponer lo necesario para incorporar la actualización arriba mencionada en el Plan Regulador Costero del Cantón de Talamanca (…)”.

IV. SOBRE EL CASO CONCRETO

Después de analizar los elementos probatorios aportados, este Tribunal descarta la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, la denuncia original sobre el humedal de Playa Negra data del año 2005 y dio origen a la causa penal N.° 05-001155-0597-PE, se constató que, el Área de Conservación La Amistad Caribe ha dado seguimiento constante a la situación mediante inspecciones de campo, informes técnicos, georreferenciación y registro fotográfico, y que ante la persistencia de las actividades ilegales promovió en el año 2025, luego de exponer el caso ante la Comisión Regional de Seguridad Ambiental, la apertura de una nueva causa penal, la N.° 25-131851-0597-PE, seguida contra el presunto responsable de los rellenos y drenajes denunciados. Lo anterior evidencia que la autoridad recurrida no ha permanecido inactiva frente a los hechos denunciados, sino que ha ejercido las potestades.

Asimismo, se acreditó que mediante el oficio SINAC-ACLAC-DASP-RNVSGM-136-2024 del 26 de marzo de 2024 se dictó la medida cautelar N.° 0186, la cual no se limitó a ordenar la paralización de las obras, sino que dispuso también el retiro del material de relleno depositado dentro del área de humedal y zona pública de la Zona Marítimo Terrestre, de manera que la actuación administrativa contempló un componente correctivo y no meramente preventivo, ajustado al principio precautorio contenido en el artículo 2 inciso d) de la Ley Orgánica del Ambiente N.° 7554 y en el artículo 11 inciso 2) de la Ley de Biodiversidad N.° 7788. A ello se suma que la condición del sitio como Patrimonio Natural del Estado y su caracterización como humedal, certificada originalmente en el año 2017 mediante el oficio SINAC-ACLAC-PNE-C-011-2017, ha sido ratificada y actualizada en dos ocasiones posteriores, a través de las certificaciones SINAC-ACLAC-DRFVS-PNE-C-092-2024 y SINAC-ACLAC-DRFVS-PNE-C-014-2025, esta última vigente a la fecha, circunstancia que diferencia el presente asunto del resuelto por este Tribunal en la sentencia N.° 2024003959 de las 9:16 horas del 16 de febrero de 2024, en la cual se constató la ausencia de toda actualización de la delimitación del patrimonio natural del Estado desde el año 2017 pese a existir un estudio técnico posterior de 2021 sin incorporar. En el caso concreto, por el contrario, la autoridad recurrida sí ha mantenido actualizada la certificación del área protegida y ha explicado su seguimiento técnico continuo.

Finalmente, también se constató que la autoridad recurrida atendió en tiempo las gestiones de información formuladas por el recurrente, entre ellas la contenida en el oficio AEL-0313-2025, mediante los oficios CARTA-SINAC-ACLAC-DR-0934-2025, CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 y CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025, todos del 26 de agosto de 2025, con lo cual no se advierte lesión al derecho de acceso a la información consagrado en el artículo 30 de la Constitución Política. En cuanto a la persistencia de nuevas afectaciones alegadas por el recurrente con posterioridad a la interposición del recurso, corresponde a la autoridad recurrida valorarlas y, de ser procedente, adoptar las medidas administrativas y denuncias penales correspondientes. Por las razones expuestas, lo procedente es declarar sin lugar el recurso, tal como se indica en la parte dispositiva de esta sentencia.

Sin perjuicio de que este proceso fuera desestimado por no constatarse una omisión que resulte constitucionalmente reprochable en los términos expuestos, este Tribunal estima oportuno recordar a la Directora Regional del Área de Conservación La Amistad Caribe, que el humedal de Playa Negra constituye un ecosistema de alto valor ecológico, integrante del Patrimonio Natural del Estado y sujeto al régimen de protección especial que se deriva del artículo 50 de la Constitución Política, de la Convención Relativa a los Humedales de Importancia Internacional (Convención de Ramsar), de la Ley Orgánica del Ambiente N.° 7554, de la Ley Forestal N.° 7575 y de la Ley de Biodiversidad N.° 7788. En razón de ello, debe la autoridad recurrida continuar ejerciendo, con la diligencia y la periodicidad que estos bienes ambientales demandan, las labores de vigilancia, inspección, actualización técnica de la delimitación y caracterización del humedal, adopción oportuna de medidas cautelares y correctivas, y denuncia de cualquier actividad ilegal que constate dentro de su jurisdicción, de manera que se garantice la protección efectiva e ininterrumpida de este ecosistema frente a nuevas afectaciones, en aplicación del principio precautorio y del deber de tutela ambiental que informa toda su actuación.

V. RAZONES DIFERENTES DEL MAGISTRADO SALAZAR ALVARADO

Con el debido respeto, concuerdo con el voto de mayoría que declara sin lugar el recurso; sin embargo, lo fundamento con las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara SIN LUGAR el recurso. Tome nota la autoridad accionada de lo indicado en el último párrafo considerando IV de esta sentencia. El Magistrado Salazar Alvarado consigna razones diferentes, al estimar que corresponde a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
